threshold for the project is for the program is up to 150,000 and the applicant is requesting a guideline waiver for um is this coming from this is a Northwest 7th the business is located on Northwest 7th at at uh 133000 Northwest 7th Avenue I I would defer to the district council person where are we what are we doing that's can oh can you can you um just go ahead and finish so what is the what is the ask uh the ask is 400,000 and um staff is recommending 250 with 150 um allocated for the exterior Improvement um only okay so 250 total is what you're 250 total uh looking at um all the work that they going to do all the improvement with the parking and uh um sidew work and everything so um can we um raise it up to um 300 um I don't we did review the work that they needed to do I mean 250 uh Miami Florida 33167 in the form of an infrastructure Grant not to exceed $6 million and a tax increment recapture incentive of 50% of projected City Ador tax revenues from the time the project appears on the property tax roles until the north Miami CRA sunsets approximately 20 years authorizing the executive director at North Miami CRA attorney to negotiate and finalize a tax increment recapture incentive and infrastructure Grant agreement with Nomi Miami Ventures LLC to provide funding for the development of a multif family residential project authorizing the executive director to execute the tax increment recapture incentive and infrastructure Grant agreement authorizing the executive director to take all action necessary to implement the terms of the tax increment recapture incentive and infrastructure Grant agreement and providing for an effective date agenda item 11 awesome thank you so much Madame secretary in terms of this item this is based on the distribution of the um CRA Grant um C loan that we have received and this is some of the dispersement um do we do is there a presentation in term of not not not from the applicant but from staff um so we can just go through yeah like just a quick overview a quick overview of this project is that it is um to be known as Nomi Square located at 1385 no no no no not necessarily of the like the process like what we received how much like the 10 yeah the overall yeah before yeah that so the total project is 34 two housing um apartments and the CRA will be getting 34 affordable units at 60% 70% and 80% of Ami eight of the units are going to be at 60% six one-bedroom units and two two-bedroom units nine units are going to be at 70% six one-bedroom units and three two-bedroom units and 177% are going to be at 17 units are going to be at 80% which will be 11 one-bedroom units and six two-bedroom units additionally there will be four live work units and then there will be other amenities that um come with the project but as far as affordable housing those are the that's the breakdown of what the CRA will be receiving awesome Vice so is this 100% Workforce it's no no it is not okay no live live live local so in all um Canada the live local is going to be done for administrative purposes only I was able to clarify with the applicant this is not for the tax exemption purpose but is for the administrative portion for them to be able to move through um our zoning process and that has been um verified with the applicant pardon and it will be included in the grant agreement as well um just as has been discussed with every applicant that if live local is being sought for tax exemption purposes that would be a violation of their Grant agreements so if they are using it for the administrative process that is okay however um for tax exemption purposes it is not and they are aware and they have assured us that the administrative process is the only portion of Li local that they are going to be that's going to be in writing that that is going to be in our agreement is the only absolutely it is in our agreements already yes oh well we haven't executed but yes okay um Madam public heing yeah any other question vice mayor um councilman since I know we've been working with this for a while any question no I'm just um kind of happy to see um these uh projects finally moving because since I um came in I've been like dragging but my my question um again will be for the um affordable units so uh my name um director you said it's um for the affordable units you said on the record is about so of the 342 housing units there will be 34 affordable units at the following breakdown eight units will be at 60% of Ami with six one-bedroom units two two-bedroom units nine units will be available at 70% of Ami with six one-bedroom units and three two-bedroom units 17 units will be available at 80% of Ami with 11 one-bedroom units and six two-bedroom units okay first one I saw was 60 thank you that's a big step have it at 60% Ami so kudos to Integra yes um and just for clarity again the initial ask was for 8 million plus 50% Tiff staff is recommended 6 million plus 50% Tiff move for approval second okay um before we do I just want to add this will be coming from the loan and uh funds have to be dispersed uh within two years so we are not in violation so that means it'll be automatically resend infrastructure Grant agreement and providing an effective date agenda item 12 thank you um sir good evening um Mr Mayor honorable board Robert Holland with offices at 3250 Northeast Miami Avenue uh Suite 334 I stand Here Again on behalf of Redwood development and the uh the remake of The Claw Pepper Park as most of you all aware we've been working on this project now for a couple of years we've been before you a few time for zoning site plan approval and uh many other issues um this will be transformative to the west side of the city of North Miami similar to what solar Mia is on the east side uh so we're very very proud to be here before you this evening uh in support of staff's recommendation but asking for some leeway for an improvement to that recommendation if possible uh as you know this is an approval site plan right now has been approved for over 2,000 units of housing 120,000 ft of retail space structural parking a revitalization of claw Pepper Park with new facilities a pool bowling alley movie theater uh the comprehensive project is roughly about uh 3/4 of a billion dollars it's a major uh Improvement to the area and major money your staff is recommending um $8 million in the uh from the loan we initially requested 15 uh then we modified that request to 10 million because it becomes very important from an infrastructural standpoint that this thing get done right in a way that makes it an improvement to the community long term uh we honestly believe that once this site is developed it will be adding to your uh CRA just as solar Mia is adding to it now this isn't just a one shot project this is something that becomes an oasis over time and generates major income going forward for the community uh so we're asking instead of the 8 million we asking for the 10 million that we requested uh when you look at the size of this project compared to anything else uh the 10 million is really a drop in the bucket from the loan compared to 3/4 of a billion dollars uh that the project would run us uh we also supportive of the uh of your staff's tax increment uh position we accept that the only other request that is not on there we have requested a tenant based assistance of 1 million for 11year period starting in 2026 and what that does just for those who don't understand there is a major concern in the community with the cost of housing and it is very real what this does it is not money to US what it does is it buys Downs the debt so that you can put the affordable rentals out for the seniors so as opposed to seniors paying $2,000 a month in rent they'll be at about $1,200 a month so it's a $800 savings if that money is added in here to be able to buy that down it's no different than if you were buying a home the more you put down the less your monthly mortgage is and the only way you bring about affordability because if you're doing everything at market rate at market value the note is what the note is but if you're able to bring in government subsidy to buy down that note to be able to pass that on to the community that's the best way of doing that and that kind of cuts back on the gentrification that typically takes place in neighborhoods where people feel like they can't afford to live in those neighborhoods anymore uh so we willing to work with the city on that I know the city of Miami has done that on what they call block 55 which is right now is the largest most most successful affordable housing development in the nation uh that CRA did the same thing with rental assistance by adding from their uh pool of funds to kind of again buy down the debt so we're asking that staff re-evaluate that and look at that as a way of making sure that we can get those numbers down to a level that will be very very workable for the community and we'll continue to work with the city on how that is pre-market within those adjoining neighborhoods and zip codes to make sure that people those seniors who are now maybe uh their home is too much for them they'll have a way of transitioning in to this development on the seniors so this is bring the senior cost down on the housing okay Mr Mr I'm I'm I'm that's why I didn't go with the whole presentation mayor but I wanted you to understand that that's not in the recommendation now so we're asking that modifications of the recommendation be from 8 million to 10 million and then the ti I mean the rental assistance yes 1 million at for 11e period so what we'll do um before we we open it up for this well let's open it up for public hearing and then we'll close it and then we'll have our discussion on on the item item is open on for public hearing this is tab 12 um I item is open is yeah this is top 12 okay so none item is closed so you are proposing you you saying revision based on the 8 million that we are suggesting you are asking 10 million and you are agreeing with the tax increment and then also requesting rental assistance how much is the rental assistance you are asking for is hold on how how what's the amount how long is is the amount and then I'm going to go to staff to to get some answers it's technically 11 million 1 million for 11 years but as you can tell on the previous application you had 34 units of affordability this one you have in excess of 300 units of affordability so that's why we're just we asking for the justification for the extra 2 million out of out of instead of the 8 million because you're getting a 10 times as many affordable units being put into the marketplace with your money so you're reallying your money beyond what most can do with the money and the other is to bring the senior cost down to roughly 60% Emi uh Ami across the board across the across the board than sir now my question to staff in terms of what he he had said and I know where we are financially and and I know what you guys have been saying to us in doing our briefing um well number one so let's just take it the tax increment we good with yes 50% that's good so the two big questions are this 8 million the the 10 million in in the in the in in the the rental request for the 10 million the the we are are we we comfortable where we are right now we're comfortable with the 8 million okay and we don't have no money in in nowhere in in terms of supporting their 10 million no to be very Frank we have given our very best recommendations at the highest levels that we can financially support got it okay perfect so now how do we work on the the the rental how does because this the first I heard about the rental assistant either last week or yeah either last week or the week be um of the week before um and I think I I asked you about it yesterday um how does that even work so you said um Robert Mr holl you say the city of Miami CRA does it yes and what they do is it goes to it does doesn't go to the renter and it doesn't come to Redwood what it does it goes to the bank and it buys down so it's for brick and mortar and so you reduce the cost of your construction overall which reduces the Ami so which is a good plan but do we have the the 11 million no um we do not have it right now with everything that we have in our budget uh when it comes to refunds to the taxing authorities um and other allocations it's it represents 63% of our revenues without um adding any other programs or um admin expenditures so we cannot afford another extra million um for 11 years okay can Mr Mayor can I ask yes maybe some wiggle room maybe if there was a way of getting the other 2 million within a three-year period that would give us the leverage of the 10 in order to make because this is a 3/4 of a billion dollar project this is a big project and it's transformative for the community other that have rents that might be too high on on the record I just want to be clear every project that we' presented tonight thus far we are very supportive of we understand the transformative nature of all of these projects and what they are offering to the north Miami Community our budget doesn't change our budget doesn't change because of it and we honestly have been very clear with everyone we have given our highest our best financial offers tonight that will not put us in the red everything that we have offered tonight tonight is what we are able to financially support got it okay unless you resend somebody else unless you take somebody unless money comes from somewhere else we got you um at the September meeting we did approve um for 10 million out of the loan that would go towards um large scale projects we are over we are over that 10 million which means another prog is going because the 10 million that was already how how we just approved 6 million now we have another request for 8 million we're already at 14 we've had to defund other programs to be able to support the ask tonight the multif family um project that we have been um working on for the past 4 years we had allocated one 10 million for the existing structures that we have we've already lost 6 million out of the 10 million now we have 4 million if we increase another 2 million we won't even be able to kick off the program with $2 million and cuz there's no project currently in the pipeline that's where they um Mr Mayor we might be able to make this easy for you yes sir we'll accept your staff's recommendation because we anticipate being long-term partners with the city and as we see other pools come available on different phases of it we'll come back hopefully and apply a different time for some of those other phases as we move forward because we want to get the brick of shoves in the ground but you you know that this could have all resolved at the beginning of my suggestion if we had just trying to take the the the Su of that line that word that we would not even be here cuz we would have way enough system come out of the Northwest but this is what I'm saying no but no no no no but this is what I'm saying is if if there's a pot of money that is there for for a corridor that is sitting there for that Corridor right now you have a pot of money that's just sitting there for that only street but you needed to develop the whole corridor but you don't have money to develop the C but you have money to sit there for bis it's just like this bouevard you have money for but you Mr Mayor I hear you Mr Mayor but I don't know about you but after that meeting when that suggestion was made I got a call from the county saying what are you doing with the agreement remember this is an agreement that we made and it was very specified no wanted to have the agreement with them so that they could because I think if they understood because if the goal is because if they understand that we trying to uplift the community you have money in one pot that's sitting there and then you trying to and didn't why why would he just leave it there Mr I think that's quickly quickly if I me yes go ahead uh Mr harand was about to say that I started a statement we accept your staff recommendation and then all of a sudden we jump and CAU him short I would like to hear that part because um I will tell you this is like the first big big project that we have in District 4 that will give us a chance to hold our District 4 Resident in District 4 and we know this is such an important topic people cannot afford to leave in the city of North Miami so now let's give them some time to explain exactly it's everywhere let's give them some time I know it's everywhere Mr Mayor but I'm not responsible for everywhere uh talking about North Miami now now let's give them some time and listen exactly and then we'll move together but if we just keep on jumping and then everybody's talking at the same times we're not going to move anywhere so uh Mr Holland um you are about to say that you will accept the staff recommendation I just want you to finish that statement so that I can have a full have no problem we have no problem accepting the staff's recommendation so we can move forth on on the first two phases of the development including the park uh we just asked that as those funds grow if you will consider us again for those other dollars uh when we come back to try to make a play for those because of the size and volume of this development and what it would do for the community and it will ultimately become the donor to your CRA because it's so big and it will be the thing that other developments will be able to uh receive money from going down the uh down the line so we think it is the right one to really put the investment into so so um if I understand we if we approv um if you just approve the resolution as it is tonight with the 8 million so now and um and uh long term if you got more money coming you suggest that you can uh come back and you know try I just want to be clear we will definitely be coming back because there's so much to be done uh to make this year work so so tonight we let's say um we approved the 8 million yes then we'll move from there okay yeah okay and the okay um vice mayor and then we're going to um call it to um to V vice mayor go ahead so I have a question when do you plan to start construction they have to start in two years the contamination is going to start being cleaned in the next 30 to 60 days and we should have uh shovels in the ground within the next six months to go vertical next six months to go we're going to have we're going to we have to meet with the city manager to take possession um let's say within the next 30 days because there's been some issues with that but we expect within the next 30 days we'll start cleaning the contamination um because it's you know with the Brownfield credits and then we expect to go vertical within let's say quarter two of 2025 2025 okay so in this 8 million can you not include the rental assistant what is that dollar figure that so with so with the no if we're it's an infrastructured gr it's a different yeah so the $8 million is infrastructure Grant so right so basically the eight the additional million dollar per year would have allowed us to get two buildings in the ground rather than one uh we do have some other options with the county but with the $8 million of assistance that you're granting and we we appreciate it uh we will be able to move forward on the affordable elderly housing which we also just signed a 22,000 foot binding ler of intent with Miami Jewish Health to benefit the seniors good also the money this infrastructure money will not go into the renovation of the park that will be our our contribution David once we have money like you said if we do um you know you guys will come back this is a great project for our city we we we understand it open for discussion um for public hearing on the item move for I just wanted I apologize just so this is on the record the name of the developers Redwood CP Dev LLC uh should be on the agreement uh financing the 8 million could be all within the first bill building and um the because it talks about in the uh recommendation that you have to have full uh financing uh approved we're talking about on a per project basis so I just want to put that on the record okay per building basis okay Mr bur that's your an Administration no problem thank you for your consideration you got it thank you I mov Grant agreement with solo Miami Development LLC to provide funding for the development of a multif family residential project authorizing the executive director to execute the infrastructure Grant agreement authorizing the executive director to take all action necessary to implement the terms of the infrastructure Grant agreement and providing an effective date agenda item 13 thank you so very much Madam Secretary with that being said I don't think we have a presentation because I know this item been for a while um any quick quick summary Madame executive director so as a quick refresher this is a project that has come before you before and was awarded Tiff um and the applicants are now coming back to be able to receive 1.63 million in infrastructure um funding to be able to complete their project I do believe that they are here tonight are they here yes come on come on all right yay okay um councilwoman it's your District yes we've been meeting with this one for a while I know they've been waiting patiently in the pipeline we we I think not when you were mayor but the previous mayor um told them to come back when we got the loan and they've been waiting and waiting and waiting and you know finally right but um but thank you for your patient and you know hope to see you get the approval tonight thank you yes um any other members any anything else um what is Staff recommending I know they want 1.6 is it the initi that is their request um where are we where are we tonight why as you know funding is oh there's one more let me very very slim I don't believe that 1.6 is something that we're able to support um what do we have what is Staff recommending so which part of money is this is this the 1 million the the it's also coming from the loan oh no this is coming from from the loan so the loan does balance after we we just gave um eight 8 + 6 is 14 14 every project we approve the multif family Pro U program is going to suffer from it it's supposed to be okay yeah okay is that making a recommendation what was what is it 750 I This was um so again their request is 1.6 I um I think uh $850,000 is okay with that hurt the c or would would because they've been waiting a long time can we do a million with that that because they've been it's been back and forth for a while I know in terms on on a to be clear this project is almost complete and so I even if we do make an award tonight in order for them to be able to take advantage of that award they're going to have to show reimbursable expenses and so with a project that is almost complete MH that may be difficult and so again um that's okay I think going towards the 1 million Mark is a lot okay so I think under $1 million would be recommended or safer we have not touched the infrastructure part part of the the project we did only the verticals any you know underground utility lines has not been done as well as the outside perimeter the sidewalk the concrete sidewalk the the asphalt to make this short and sweet we love that uh this is a request for a conditional use permit to allow the bonus Tite that uh came under the amendment that you all had approved uh this is at 12,000 North Bayshore as the title said it's a little bit uh Less Than 3 acres of Upland buildable land and it's currently U multif family there it is owned bz and the future land use is bore Zone uh under that it's 115 ft in height 100 dwelling units per acre and with that cup that uh you all had approved that process uh it would allow up to 238 ft 10 in in height Planning Commission recommended approval on 11424 when they met uh the proposal is a 267 unit residential building with 422 structured parking spaces uh there is uh uh an enhanced pedestrian activity area um as you can see along the right hand side of the picture and I'm sure the applicant is going to provide you a little bit more information on that uh there's other uh sustainable Design Elements uh that they will have to do including enhanced storm water management they are going to be providing that public Waterfront access on that north side as you can see on the right side of the picture shown there and there is a public benefits program that they will be presenting to you this evening the economic impact is a little uh little less than 3,300 short-term jobs during the construction period uh with about $124 million in wages uh resulting in 15 to 20 full-time permanent jobs and they anticipate paying $1.57 million in permit and impact fees under the current impact fees schedule and they are looking at paying some um adalum at 3.81 million annually and uh let's see what else I need to point out that I can cut short and uh it does require DRC review uh and uh there are some other things that you can see up here that's really critical uh including uh something you don't see here and you see all the time on our projects is undergrounding and hardening all the utilities so they will have to deal with um Miami day County uh transportation and Public Works amends for the traffic impact analysis with that the next steps as currently proposed would be to go through that DRC and then come back to you for final site plan approval and that's the end of my presentation the applicant is here both with a brief presentation and to answer any further questions you may have good evening patrian ofay night with offices at 701 brick Avenue I am joined this evening by my colleague alandria San Romain M and I'm also joined by representatives of 12,000 property owner and the Continuum company Ian Bruce ikner and William Wallace the 4th although I do have a pretty long presentation prepared I will be brief uh I I can see what's going on on this evening and I can I think I can read a room uh so let's see how this goes the the the short of it is I think that this project creates substantial benefits to the city not just to this neighborhood but to the city this is the culmination of about a years worth of work in order to be here before you before I talk about the community benefits package before I talk about any of the things that we're volunteering Prof offering as part of this evening presentation you should know that this project this one project over a span of 5 years will provide $20 million to the city over 10 years $45 million to the city and over a 20-year time span over $104 million which is an unrestricted dollars that the city can use in public goods next slide please now as part of this project we were fortunate enough to receive the unanimous recommendation of approval from your Planning Commission and we are not seeking the maximum height we are not seeking the height of 238 ft 10 in we are only seeking the height of 2117 ft as part of this project and as part of our commitments tonight and what we're seeking to do is address an area that has been substantially impacted by the lack of improvement with respect to infrastructure because the area in which we're impacting and developing is an area that was developed back in the 1950s 60s and 70s where they were allowed to drain their water into the public rideway next slide please and one of the core issues that you have in the city as demonstrated by Hud is that over 83% of your housing stock was built between between 1950 and 1979 and that creates a scenario where your infrastructure is not sufficient to address the drainage that's there and a variety of other issues with respect to the sites and what this project will do is both address drainage resiliency Park Improvement and provide for hardening for the development of this property next slide please as you all know I know I'm preaching to the choir on this item you know that insurance is going up you know that sea level rise is is causing uh prices to go up construction materials are going up so we have to have the type of development that's going to support the type of infrastructure that we need in order to improve this area this neighborhood and this community next slide and the specific Vision that this Council had was specifically south of Northeast 123rd Street East of Base Road Drive which is an area where you have the older buildings next slide please and this is the area you you'll see that you have all these buildings that were built between the 50s 60s and 7s in the area that this Council will allow for the pursuit of the higher height next slide please and what we're doing as part of this development is providing for a tropical Lux architecture that's going to provide for a fenestrated and movement movement articulation and it's going to provide for the core development standards that you would anticipate within a luxury development at the site next slide we're going to be enhancing the street street skate we're going to be planting over 139 trees and over 1,390 shrubs as part of our development and providing for a iconic entry feature as part of our project we're also going to be substantially enhancing the Eastern View Corridor on the site so if you're on bis game Bay and you're looking to the West towards the city of North Miami what you're going to see is a substantially enhanced area where we're going to provide for Condominiums and town homes which are on the Eastern side of the property they're going to range between $1.5 million and $4 million as part of this project the annual spend from these residents will be about $32 million annually within the city of North Miami according to our ecence next slide please in addition to that we're going to have media lounges kids playroom media rooms fitness centers infinity pools and all the types of luxury stuff that people who can afford to pay $ 1.5 and $4 million will be entitled to as part of this project and we anticipate that those dollars would not just benefit this neighborhood and this community but will substantially benefit the city as a whole next slide please now one of the things that was was talked about by Debbie in her presentation was uh and I want to talk about this in a two-fold scenario the first thing is if you look on the right side of the screen you'll see that we're providing for pedestrian path that that pedestrian path is about 50 ft by 135 ft that's about 6,500 ft that we're providing as part of our property where the public can come on to our site and be able to view the bay and we're we're not just creating a green space we're going to substantially enhance it so that the public can utilize it but in addition to that we're going to be enhancing the seaw wall by 2 ft it's currently at 6 feet we're going to enhance it by 2T raise it up to 8 ft which is about a $11.25 million uh cost and that's going to help protect our residents and the residents west of us by providing for more resiliency as part of this project next slide please and this is the area of the specific site of our project on the Northern portion of our site that immediately abuts Leman Park whereby we're providing for the enhancement of this area to ensure that the general public from sunrise to sunset will have an opportunity to utilize and view the Bay from the portion of our property next slide please in addition to the fact that we are addressing the resiliency that we are providing a public space on our property we're also uh providing for contributions for the Improvement of Leman Park that Improvement is taking into account enhancing lighting infrastructure we're going to be providing for enhanced uh picnic areas we're going to be providing for um outdoor equipment and uh playr equipment on the site where we're going to be improving all of those items on this property as part of the community benefits package that we're proposing to you this evening now we recognize that that has to be approved by your Parks director and by the Parks Commission and we're willing to work with them to ensure that the improvements that we're providing is something that they see as a benefit to the city as a whole next slide please in addition to that we're going to be providing for an affordable housing and Workforce housing contribution whereby we'll be supporting down payment assistance as part of our contribution and Community benefits program and that program is going to not just help folks with down payment assistance but we also assist with um rental assistance with respect to affordable housing and Workforce housing on the site next slide please we're also going to be providing for freeb uh Community trans Transportation uh contribution as part of this program whereby we'll ensure that the vulnerable populations that aren't necessarily able to afford uh the Uber rise will be able to receive free Transportation within the city to get to the places that they need to get to next slide please but in addition to all of that we're going to be providing for community and youth de development programs as part of our community benefits package we're providing for a scholarship for post-secondary education so if it's not just for college it's also going to be for vocational schools that we want to provide as part of our development to ensure that the community receives uh a tangible benefits from this uh project we're also going to be teaming up with FIU uh at Miami day College in order to provide for Workforce training we're going to provide for some of Youth U activities along with uh senior activities next slide please and one of the things that we're focused on is that this city has two amazing they have more but they have two amazing centers that provide for core opportunities for us to utilize these centers to enhance the communities the Scott Galvin Center and the Joseph Lon Center serve as an opportunity for us to address both the seniors and the youth during the summer to ensure that they have um active participation during the summer and can be engaged during the summer as part of our programs next slide please we're also going to be providing for Green Building certification to ensure that we can provide for more resiliency as part of this project next slide but one of the things that exist today is that the current infrastructure has drainage issues and as part of our project we're going to not just addess address the 25y year storm event but staff has made a requirement that we also address 10% above that in addition to that we are going to go into basore drive which is offsite and we're going to improve the pipes because one of the reasons why it floods in that area today is because that property was those three properties were built in the 60s and70s and were allowed to drain into the road and as a result we have to en enhance and substantially improve that infrastructure we're going to do that at our cost to ensure that we can address these storm water management issues but in addition to that we'll also be providing for $1.32 million directly to the city in building uh impact fees as part of our project before we ever even open up this building the moment we seek those building permits we have to give those funds to the city in order to address uh our impact as part of this project next slide please and again as Debbie noted earlier we'll be providing over 3200 jobs it's anticipated that 3200 jobs are going to be uh developed as part of this project it is a development that's going to have substantial uh impact and benefits within the community next slide and as I know earlier over $20 million for one project this is all just money to the city over $20 million in5 years $43 million over 10 years and over4 million over a 20-year time frame from one project directly to the city next slide please but when you look into what we're actually providing to Miami day County as a whole it's $1 million plus every single year and that goes up each year so when you look at it as a whole in the totality we're providing a quarter of a billion dollars over a 20-year time frame from one project within the city those dollars can have a massive impact within the city to really address the needs so that this gifted Council can address some of the issues within the city and to ensure that the the population benefits from it next slide please and as I noted earlier the annual spend that's anticipated from these residen is about $36.4 million annually within the city so we anticipate when you look at what we're doing not just from the fact that from our tax benefits from our community benefits and from the fact that this development will substantially enhance the estat of of the area we think that this is a project that we respectfully believe should be approved I thank you for your time I'm here to answer any questions and would like to reserve some time for autle thank you so much oh one one more thing because this is actually something I I need to talk to on the record there's two items that we're requesting for from the council we are seeking giving the um the time frame that we have for administrative site plan approval for this board to uh allow us and authorize us to receive administrative site plan approval for this project and as part of that uh one of the things that we wanted to do as part of our community benefits package is address a concern from the Sans Susi Community um and what I wanted to read into the record is our uh Amendment to the community benefits package that we would provide at section nine which is that prior to final administrative site plan approval the owner will negotiate with the sun Susi and I I have their official name I think it's the voluntary guardhouse Association Inc I will tell you in a second with the sunsi voluntary gated homeowners organization Inc for the design relocation and reconstruction of the Guard house currently serving the association the design reconstruction and relocation of the guardhouse shall be acceptable to the association whose consent shall not be un unreasonably withheld the commencement of construction of the guardhouse shall occur within 6 to 9 months of the issuance of the temporary uh certificate of occupancy for the site and so with those items we think that we have really engaged in a robust Community meetings we've been in this process for about a year we're looking forward to hearing from this Council and from the neighbors thank you for your time that the applicant would please consider um installing um some high defition security camera systems at the entrance uh of our Gate House to ensure effective guest screening requiring the windows down for police recognition or the opportunity for them to do so as well as Implement a system similar to the security standards in eastern Shores uh golden ales and Golden Beach to enhance our overall all Community safety thank you thank you Robert doson Mariners Bay unit 209 I've been on this long journey with this whole process it's been well over a year and I know that everybody's aware of the changes that are about in our communities now after surf sides collapse and Mariners Bay is probably giving you a half a million dollars a year in taxes versus the numbers that we've talked about tonight not only that we don't have the money we cannot not survive as we are as a building we've been given a lifeline and one of the challenges with lifelines is not everybody can get on board and we've gotten on board which tells a message that this is real and it needs to happen and Continuum is a very prominent Builder has built some beautiful properties in Florida I think you'll be astonished by the product when it's over and I think this community will be better for it thank you thank thank you sir thank you thank you next we're going to have Stefan I'm Shel and Then followed she tell your honor 12,000 North Bay Shore 302 too your honor I've written the you and the council several times over the course of these year the Year on and supported this project I want to give you a different perspective of why this city needs this project as is proposed you need residents like me this is my second home um I've been here for 18 years I love it in North Miami the the second home buyer is the greatest is a great opportunity for the city in addition to the fact that I pay my taxes and don't have uh students in the school I don't drive during rush hour I don't need the water 247 uh seven days a week we don't use trash police sewer uh police everything or fire to the extent that a full-time resident does in addition to what I've written larger units means larger taxes for the city the building as proposed with Twin Towers gives two times the number of nuns which means higher sales prices which again equates to higher sales taxes excuse me uh real estate taxes this is a luxury building which will attract people like myself who will spend money in the city they'll buy services from local Merchants I donate money to local charities I've been volunteering in the schools here with my daughter I have attended Services of Beth Moshi and donate money to the synagogue and much more you need this project you need people like me who are second home buyers to live in the city who will not use city services but we will pay for the benefit of being able to enjoy this fine City and the and the property thank you thank you sir good evening Veronica gusang 540 Northwest 127 Street I am opposed um with approving the height variance there's already a congestion problem in the city although the project is beautiful it's amazing but I feel like um certain elements uh this specifically should not be approved because they will be getting bonus units just by being able to to build higher um when you look at downtown Miami and the issues that they have with a regular afternoon thunderstorm they're completely underwater um and I although I appreciate the things that they are offering for the community I think that building at what it is now can still offer some of those Community benefits um being that you know in 2008 the market did collapse a lot of second homeowners walked away didn't pay their their um maintenance fees for the condo associations and this has created the the situation that we're in now throughout South Florida so I would really appreciate the council considering um taking those things into consideration thank you thank you um we going to have Miss Allison satalino Adam Cohen followed by Max Carney Tracy abowitz um hi I'm Alison sadino Cohen I live at 12,000 North Bayshore Drive uh unit 408 I am here in support of the project I think it will bring some real positives to the city um and not only is it a beautiful project but also will bring some needed tax renov to revenue to the city um I plan on living here and starting a family here after um this whole thing is over so um I vote in support of the project and not only for the residents of mariners Bay but also because it will bring a lot of positives to the city thank you thank you thank you yes good evening Adam Cohen 12,000 North Bayshore Drive I'm here in support of this project as you're all aware the situation at Mariners Bay is dire 46 families have been living the past 3 years without knowing what their Futures hold I can't tell you the stress that we've all been under it's it's been crushing Not only would you be alleviating us from this disastrous situation but you also be replacing Mariners with an outstanding project this will be the new face of North Miami from the East something that our city should be proud of I also want to acknowledge the impressive Community benefits package uh that Continuum presented I think it's going to bring a lot of good to our city a city that I hope to start a family in and remain living in for years to come if all that wasn't enough for uh to support this project then surely the immense increase in tax revenue would be I'm at these meetings all the time and we talk about our budget shortfalls and the need to tighten up because we don't have enough money this is an opportunity to bring in millions to our city the project is a true win-win and I hope that we can approve it tonight thank you thank you sir Hi how are you Max Carney 12000 North bashore unit 306 um there's a lot of folks that are going to say things that are pretty similar so um I would just say that I I look at this project is is such a tremendous benefit offering both for the immediate neighborhood uh but also for the city as a whole given again the economic benefits that people have outlined so I don't need to belabor it but wanted to express my support thank you okay uh hi I'm Tracy abowitz 2040 Northeast 12th rad in Sans suusi I'm in favor of this project provided we get our robust Community benefits project um an opportunity to speak with them it's been a little bit difficult to actually get in front of them I feel confident that moving forward we will have our time my ask is more I think we've already had our guardhouse established the cameras established um the green space but with all this tax revenue I wanted to be recorded that our side the East Side gets a lot more attention more police presence more landscaping and a lot more carap moving forward since there's a ton of taxes going to be generated on this side thank you okay we have Laura Gideon followed by Claudia pimo Jacob rinsky Frank know we want to get out here tonight um I just want to bring up the point that has been made but you know the mayor said earlier um in the uh CR c um meeting that your goal is to uplift the community um and then there were two projects that were presented one that had um a I think one or two million shortfall within the city to be able to give them fully what they wanted and then the next one um was about $250,000 difference um those are transformative projects we all know about the affordable housing issues the work Force housing issues um and the needed um injection of money as Pedro pointed out 2 million in 5 years 45 million in 10 years 100 million 104 million in 20 years would really really help the city the other point that I want to make is that we have a lot of elderly residents on fixed incomes in Mariners Bay and we're facing a real real real hardship um we have been in this flux for three years I can't tell you how much stress it's put all of us under and it's a scary proposition if this doesn't get um passed tonight um one last thing because I know that not everyone's going to speak tonight I ask that everybody in favor of this project please stand thank you Claudia Paso 13504 noreast 23rd Place I oppose this project I'm a longtime resident since my family's been here since 1997 I don't like that people who are going to live here are considered a second home because those of us who are full-time residents we love the city as you know we come here we're considered Advocates troublemakers because we love the city I have a coworker who doesn't live in North Miami former coworker I no longer work there she has food delivered from her from broadw so just because they're going to live here doesn't mean that they're going to um contribute to the economy doesn't mean that they're going to shop at our stores or get food delivered from the restaurants here all that Glitter Is Not Gold those of us that moved here in our full-time residence we wanted we like the sun I move from New York a lot of people here move from North the north here because they wanted the sun they did not want to live you know being overlooked by a shadow of a tall building so again second home people I'm sorry but I don't like that like full-time residents we care about the city we're involved in the community we go we Vol unteer I'm part of the I've been at the library for several years now volunteering I have not seen some of you there some of you don't even know the library exists so again I ask you to please consider the full-time residence and remember all that Glitters Is Not Gold and then what's going to happen to the dog park did did not mention a dog park so please consider the full-time residents that want North Miami to be the way it is an All American City not a City full of tall buildings and flooding brickles flooding beautiful buildings it's flooding thank you could you pass them up to the council good evening mayor counsel I'm Frank wand 12865 west6 Highway tonight you have a window of opportunity it's only going to come by one time you can support something great something that will really Mark our city as a great City if you look at the plan in front of you the Baywalk is on the right side on the large plans it's labeled private pedestrian prominade it's 25 ft long I'm sorry 25 ft wide and 600 ft long the public with the present plan is excluded the public has the two benches and the 20 ft on the right side of the drawing tonight is different from any other night because if you have the vision for our city you can make that a public but pedestrian prominade not a private pedestrian prominade you can tie it in to our Park North Bayshore Park which would give the public access to two times as much as our park has hopefully when the property to the South is developed there will be a Baywalk in front of it as well I think that EX in exchange for doubling the height of the project this is a fair quid pro quo it is a real Community benefit that will last our entire lifetimes Miami has a river walk Miami Beach has a boardwalk all of the people of North Miami deserve a chance to walk along the bay in staff April 11 report it says it page three let's have a walkable pedestrian fr residential community that invites the public to access and joy thank you may thank you so much mayor mayor Rand I I really really do love the idea but I I I honestly thought that that was already incorporated as part of um of the deal even from the first initial discussion it was supposed to be because we had had this discussion month months prior but the the the boardwalk in terms of from you know from basal drive and and we that's when we were talking about um the possibility of the the taxi the the the the taxi thing that Mi day county is um thinking about um using so I always thought that the the boardwalk was part of the proposal I didn't know it was a condition or part of the community benefit so it's it's private now it it is on the on their plan it is private the public access that they providing is on the right side there it's a walkway from the street there are two benches and about 20 ft so the public could look at the bay I think that as a community benefit that falls for for far short of what the people of North Miami need and what we should have when I represented the developer of the White House in I insisted and you all agreed that there would be public access to the water around the White House in that's the plan that was approved I'd like you to carry the idea of having a bay walk so that the bay is except we have so little accessible land for the public on the bay and the bay is such a huge part of our city and our people deserve it and I don't think it's too much to think that um forward from from here which I think is a great sentence for all of us um we can say that we have a meeting of the minds and that with the language adding a timeline and adding the Sans sui homeowners association's um approval that we now have um meat on the bone as opposed to we're going to do something sometime somewhere so I am changing my statement and I'm in favorite and I Mariners Bay my wife and I have been about 50 years PL combined in the luxury real estate space when I was approached or I should say our building was approached by the Continuum building after three previous developers I was really surprised because I myself and my wife have been involved with selling their type of products in namely in South Beach there are two products down there uh very surprised and very happy because what this is going to do this is going to put us on the map literally put us on the map in terms of a Gateway for those that are coming back over the over the beach as well as those going over the benefits package I'm really surprised most developers would never offer that so in closing I'm in support of the project obviously very happy with the results uh that I've seen so far and looking forward to another let's say 35 years in North Miami God willing thank you thank you thank you so very much sir thank you um oh Hal is here Hal Mauricio kiski you already Bay I I wouldn't want to be in their situation but I don't want to be in my situation either we're going to be left in the community they're going to cash out and what happens to us and I do understand their situation by the way the White House property is 11 stories right across the street they're not they're not complaining they're making money this developer is making plenty of money they're building all over the place so I don't feel that bad for them but I understand they want to make money um the traffic is unbearable if you drive around and and all of you know if you drive around you know what's going on 16th Avenue 125 indry solia they're coming up everywhere the the traffic is going to be unbearable and we don't have the infrastructure I'm not against development but I think they're overdoing it they're pushing it to the Limit also I have an issue with councilwoman Timothy uh this is called voter suppression they were not able the attorneys were not able to get rid of the super majority somehow out of a miracle they hire someone in her family to do community outreach I beg the council woman to ask her why she recused herself I'm not going to disclose it here but basically from what I understand to the best of my knowledge she did not have to recuse herself her vote killed the the whole situation it it would possibly in a lower height her vote was made the difference that continued this project if she had not recused herself this we would be in a different place today it would have been rejected I mentioned this to the board of adjustment and all they cared about with a clapping their hands is about the community benefits I live in that Community what am I going to get I live in majorka all right the dog I don't have a dog but I'm glad for the dog people and glad that the dogs will smell good and it smells delicious but are they going to is that it 30 seconds yes okay okay so are they going to build are they going to build the sewers on the other side of the street we're getting killed where the bagel place and the cleaners is we're getting killed over there so they're going to fix one side that's good for them what about the other side convey my gratitude for the after mentioned change in language um at section nine of the uh public benefits plan um so long as that the timeline is agreed to and there is an agreement as to the um location and uh appearance of the um guard housee I would be happy to change my stance flip supportive although um just as a um one um concern I had um that wouldn't overall make it difference as to my stance on this um benefits plan but just as something I had a concern with section three I find it difficult to understand how the um plan listed in section three would help increase the supply of affordable and Workforce housing versus subsidizing existing demand um but overall I'm encouraged by the plan regardless of that and I would be happy to change my stance in supportive provided that the languages agreed to and that there is an agreement with Sans sui um homeowners association on that thank you thank you thank you thank you next person next next next we we got to go good evening getting what they want um I don't think that's a very uh nice way to think about this project like it's not about Community it's about oh I'm getting my guard house okay I'm supporting oh I'm being saved because unfortunately you know the what Mariners Bay is going through that they cannot afford the assessment and all this so everybody's kind of like getting what they want and jumping off the boat but I don't know how many people that are supporting here uh from Mariners Bay are going to be able to afford a $2 million or $3 million uh apartment in the building I don't know about that also many things about the community package really we already have a park there's a lot of uh Bay View in the park uh I live in mayorca for almost 10 years and I do go to the park and sit by the water and I love it and there's many many places where people can sit and look at the water so they're not really adding anything to the community by putting two benches to look at the water um also they talked about the that they're going to do the sewage and all this this is all beneficial for them because they cannot sell Apartments for2 or3 million when everything is flooded so it's not really for the community or for people that live in the community also about the trees and all the improvements they're going to do to the sidewalks we already have trees um and again they're embellishing their entrance to their building not really for the community so even though it looks like a nice project um I will oppose to the increase on the heights thank you so much thank you anyways hope we're near the end also my name is Jeff Tomlinson local real estate broker been living here all my life selling real estate here for 37 years I basically sold almost everything Keystone and sansie not bragging but it's a it's a very tall order what they're doing so I came in as cancelled but I'm not for I'll be an incumbrance in between as we say I see contracts fall apart all the time people say one thing do another I would be before if you know it seems like we were bypassed through a lot of this it's hard for us to organize we're not as big as Keystone Point they have, 1500 homes we are they have 1,200 we have 300 so we uh are here now to try and get our guard gate built which we think is very fair they have three we need ours redone Sans Suzi Boulevard we were told by Cassandra our homeowners association representative when she comes for district 2 that they were going to go down San suie Boulevard widen it put a bike trail down there and I haven't seen any evidence of that unless again the developer is going to be picking that up it's got to be beautified sanc Boulevard is the main entrance in there but but first and foremost uh we need a guard gate terribly and that was my main complaint we're all in talks now illustrious attorney friend made a suggestion they're supposedly going to put something in writing I would not be opposed to it if we in fact get written up in writing that we're going to get our guard gate they're going to beautify Sans Susie Boulevard I don't know what you're going to do about the flooding when you pull up from the orthopedic center there in the end of 12 third every king tide in September October November it's underwater it goes right through the drains I don't know how you're going to correct that I would think you'd have to go from a twoot seaw wall to 4 feet higher above that and go around the whole you know it's like Venice but anyways in short that's basically it I'd like to see it take place and the guard gate would include removal of the cheesy Gates on each end of Canal Drive and get something substantial up that cannot be climbed only open an emergency thank you Jeff thank you so much um thank you Michael Michael spoke right Law Group offices at 100 Southeast 2nd Street I here again on behalf of mariners Bay Condominium Association first and foremost I do have to thank your staff Debbie and her team and the Continuum company for doing everything in their power to move this forward efficiently I can't stress this enough time is the enemy for the 46 unit owners at Mariners Bay it's a pretty unique situation where Almost 100% of the unit owners support this project not just because it's well thought out with a fantastic Community benefits package but because it's a real solution to uh pretty serious financial situation that the residents are facing you all know like other aging condominium buildings there are uh significant costs to repair deteriorating Concrete in the case of mariners the price tag is significantly High because you can only spread those cost out over 46 unit owners we're talking about over $100,000 in assessments and that's before you factor in the rising HOA fees which are about 3,000 per unit bottom line the numbers do not pencil out out as you might imagine and it's something that is keeping the unit owners up at night they cannot sell their unit right now because of the limbo that the building is in and they have no certainty in terms of where they're going to be living moving forward so we're asking for an approval tonight so that there is peace of mind for these unit owners and certainty moving into the new year thank you thank you and I think that was the last speaker did any did everyone who signed up and received the card came up and speak okay Mr Gant my only thing that I would say to you um to you we're in a good thing so please there's not much to rebuttal I think let us do what we do you you had a good for no no we got no we got to discuss um the thing but give us um you have anything you want to say so I'm going to be very brief and I'm sure we're going to engage in some dialogue the first thing is that there was a reference to what we're doing to the dog part that's specifically identified in uh paragraph 8D of the community benefits package that we're going to enhance the dog park uh with respect to the seaw wall we can only increase the seaw wall That's along the uh that's called tness with our boundary line so that's on the Eastern portion of our site so we are enhancing the seaw wall for our site from 6 feet to 8 ft which is what we can only do for our property we can we can only improve it for for our site uh and I'm sure we're going to have a discussion regarding the uh Baywalk I think that there are some uh substantial differences between this site uh and the White House site one is that it's immediately ad joining and adjacent to a park uh and that park has peers that go into the water uh secondly when you look at the Eastern portion of our property we have town homes that are immediately on the Eastern portion of our site so if you allow people to walk along the perimeter of our site people will literally be walking around their backyards in addition we've already set aside a northern portion of our property in order to provide for the access for the public to utilize in addition to uh Leman Park uh and then finally one of the last things that I'll talk about respect to the drainage one of the improvements that we're making is along Bas Ro drive under Bas Drive there's a pipe uh that pipe is being upsized to address the drainage one of the reasons why you have issues on Base Road Drive is because that pipe uh has not been improved in some time and will be improving it so with that I'm looking forward to discussion uh and looking forward to the robust dialogue uh that we're going to have all right thank you so much Miss love you have something want Ahad yes sir Mr Mayor one of the things that they are asking for and you caught it right at the tail end is they are asking you to allow them for us to administrate administratively approve the site plan uh instead of bringing the site plan back before you no no no no yeah I'm not surpr so we wanted to make sure that that was clear that that's one of their asks yes and um so I let me say this I to to begin the discussion I was and and I have started this discussion with the developer in in in the unfortunate situation for months and and I really I think we have gotten you know over the past few months and I inserted myself in there because I understand what was happening at Marin Bay as well as Myas Tower um took the time out went and spoke with with the residents it's been back and forth and a lot of time residents I think they they they see us and they make all these things about us whatever the case is not even giving us the opportunity to even talk to us or even see how we feel about certain things and we are really here to to listen and hear um the developer and you know when I when the disclosure was they didn't even reach out to me because they already KN know that I was a no vote in in terms of the project um coming in cuz I was in the um in coming in and I'm not happy with the height and I and I said it from the from the go in I think that conversation we we left that I think last meeting it it it left when they did that that hype whatever the the cases but tonight when when when I came in and the the people started coming and I don't know whatever that she said you did to kind of flip folks I'm here as a representative of the people and I've always said this and one thing about me you are and I am going to have votes up here that you're not going to agree with you know that's that's normal you know my mother and I whatever you and your wife your spouse you're not going to agree with everything that somebody do but we have a city to run that we got to do it together and and and you may disagree or agree but there's a there's a level of respect at least giving us up here who come up here and and and do this because the type of names and the type of things that we up here trying to do and we get called and some of it may be true and but in in in in the instance for some of us who trying to come up here and do the best that we can as public servant um and after listening to the to the folks and and and listen it's all about compromise and I've always said to the folks I will listen just like with the White House in we did tremendous progress working with the homeowners group with Keystone and still I have residents who assume that I said things I didn't say and and the folks who work with me you know hand inand knows the the truth and and what we were able to do and I went in and I did the same thing and and it's hard and it was hard at times when I went home and cry when after I went and set with with myON his Bay folks listened to them they went on in the roof and and then I went next door the type of stuff and we getting emails from one side there are groups of people on every issue in this city and councilman G who's been here for 25 years will tell you you have a group of people who will email you and who will tell you I am afraid to come out and speak because my neighbor is for this item and I don't want to have that conversation because they are the most loud person and that I have to take into consideration because that's also a res president but sometime people just say okay it's my idea because I want this and I want that but at the end of the day this is something I don't like the height and we know but the residents came out we spoke there's a negotiation we're going but I am going to vote in support of it but I'll tell you one thing I am going to and and and I think the past 10 years I've been on this Council one thing people could say about me you could like me or you don't I don't lie that's number one and number two if I say one thing I'm G do it I'm GNA make sure and hold y'all to whatever that's in that agreement whatever that we are doing that we are getting every guard gate we getting whatever infrastructure whatever things that we need to do together um to get it and and we're going to make sure that's all I could you know go cuz I am one vote um and I am very pleased what I saw tonight because that's all we've been asking people to do work with the developer we're not going to all be in you know it's a compromise it's a one one with the White House some people didn't want nothing on that property but as a city person uh a representative who looked at the city we said okay we know the people don't want nothing there but what is it that we could get that's a compliment that the developers okay they not overreach but at the same time that's a balance that's fair responsible and we knew that Lowa taba building was nine um story so 11 story they were compromising and folks were but we were okay and what we are getting over there and that was real smart development so with that I uh you you did great job tonight sir um I don't know if any of my colleague vice mayor um Mr councilman and and councilman yes please so I want to talk about the uh Boardwalk yes explain again because I've got the handout that you probably don't have that Mr Wen gave us tonight I don't know if you've seen it or not so so so we oh sorry sorry C so I'm I if I understand Mr wen's desire he'd love to see it be contiguous from North Bayshore along the Waterfront um you said there's some tow houses that would impede that but as I look at the drawing that I was given I don't have any frame of reference here will the public be able to access the bay how does it work I know what he wants what do you want what do you envision so so our our vision for the program and I'm not sure um if you guys can see it Debbie if you mind can I can I come over there and just see showing give me one second all right so this is a depiction of particularly the town homes that are on the Eastern portion of the property and immediately adjoining their site right behind them is essentially what I I believe Mr Wen is referring to in his depiction and what you'll see there is that when you look at the the walkway it's immediately adjacent to the private boat docks that are immediately east of the site so one of the core concerns that we've had is how do we address the security issues of the public being able to have access to these uh private boats that are on the property and being able to provide it for a compromise so that there wouldn't be any uh confliction of issues with respect to access to those boats people being able to walk around between sunrise and sunset with respect to those boats so what we thought about doing was enhancing essentially a portion of our property to provide for the Public's access to be able to enjoy the bay and so if we go back well see if it's here so here if you look at the right side of the screen you'll see an area that's essentially outlined in green uh and I'll show you what the depiction is can you point to it because it's really small and where the green the arrow going okay okay and so that area is 50 ft by 135 ft it's about 6,500 ft and so it's not a small area that's we're providing as part of the public on our property to be able to utilize and this is what the depiction looks like in actuality this is not just Green Space that we're leaving we're actually substantially enhancing this area to ensure that the public can have access to something that they can be proud of and to be able to utilize the bay but in addition to that councilman one of the things that we're doing is of course enhancing Le Leman Park and one of the benefits of Leman park today is that it has peers that goes out into into the water and so from our vantage point it didn't make sense to create a scenario where you can have a potential conflict between the traveling public and private boats when you already have an opportunity to utilize and enjoy the baay from a part that's immediately on the baay and so that that was a perspective that we had and that was the Compromise that we provided because it could have been that we provided contribution just to Li in part because that's a public part but we also said you know what we'll give a portion of our site that the public can utilize to be able to enjoy but once you start having the public going along the perimeter of your site where you have residents and where you have private votes you're inviting conflict and that's that's the issue that you end up have having with respect to this uh property with respect to the what do you mean conflict you're inviting conflict because if you go on South Beach um along um is that the boardwalk um I mean they don't have nowhere to park I mean when you're saying you are having conflict I'm assuming what Mr Roland was talking about which you help us out with starting at the North bash show Drive um Boardwalk kind of continue it up to whatever portion of where where your your development would be so that would at least that would be the access of us having access to the to to the water rats um is that my understanding Mr Roland continuing our so I don't think we have I don't think the city has an existing Boardwalk um that not really like it's not really I mean a is a that's right it's a um the what I would do is I would extend their Boardwalk right to the property and then the city or as part of their benefits package they could just continue it it doesn't have to be 25 ft high and as far as the uh docks go there can be Gates um like they have at quider Coconut Grover anywhere else you know you you put up a little gate they put up a signed private dock it's not a not really a concern we we we think it's different because you not only have private Docks but you have town homes that are right there you're literally behind people homes growth I mean raise I'm I'm not familiar with with those but I understand because access the public access to that so I mean I I get it if my backyard are butts against the water and people are walking back and forth I'm going to have to put up some sort of gate to keep that people from just walking up to my back patio if that's and it's hard to Envision how you're designing the property so I get where you're coming from there is something in sonal that where they have there's a and I don't know which bill I think it's 188 where in the back of it I guess it's far far enough but the adjacent to the building so the separation from and it's a it's a residential building it looks like a hotel but it's beautiful gorgeous um and I guess they have their own so here's the thing from my standpoint I'm out of here I'm out of here is there time for y all to carry on this convers I mean there's going to be multiple hearings on this proper going forward I don't think anybody up here wants to just have staff administratively sign off on things no um so if you're going to be bringing site plans and things back is there not a way to have conversation to you know he's he's speaking of I I wish I ever got to South Beach you know what I mean I don't hang out anywhere where there's docks and but you know what so I don't have any point of reference to say what works what doesn't work etc um but if you're open to the conversation um and you know there there's a time to still have conversation let me ask Debbie this Miss love what happened tonight once this H if this passed tonight what happened without their condition forget the administrative yes yes they would submit a DRC application and based upon the conceptual design that you are approving tonight uh we would assure that they come into compliance with to the greatest extent practical of what you are are saying conceptually so if you approve it like this um like that then when it goes to DRC we're going to look at it from the same perspective unless they submit something different um a different design a different concept at DRC and then unfortunately that would require them to modify their cup and come back for cup review again so you're saying there's no time to have any conversation let's hash it out everybody roll up your sleeves we're go and be here till midnight not to a great extent they can't really modify what you approve tonight conceptually because the site plan has to be in compliance with what the cup designed that you provided so they'll have a final site plan based upon the conceptual design that you approve this even tonight and all right here to and if I might Mr Wen mayor Wen a lot of people in this room have flipped tonight don't want to be the one to stand in the way of that flip and then throw this all back to the drawing board over Public Access I'm trying to find you follow where I'm coming from in other words I know what you want I know what you want I get would you be would that be okay for for you to have people going you know up and down that doesn't make any sense so to for my for me in looking at it um it is not a question on that folks will be able to access the bay but it is where but not they want to give access they working with the park and on their side access to the Bay but not directly from the back of this um resident um Town Hall so that is something I you know we can spend the rest of the night discussing that part but I don't it doesn't make like a very big difference and again you have to look at the other side the safety the safety issue I think that's what uh Mr uh Mr um G was and the other um side of it I'll say this is I was waiting to hear so many people scream no I think they did a very good job if you look at the building that will be the gateway to our beautiful city and to uh to the residents who are suffering it need a break they will see it on another line and you have them tonight so with that um it to you privately and I told you that I would say it publicly the Baywalk and that's something that you can see that I I in my the first time it came up I said I talked about the Baywalk and I and I and I understand the the the what you're offering and it's pretty but whenever whenever you're talking about Waterfront people want to be able to I would want to be able to now you're talking about this is going to be a luxury building I I don't see security being an issue someone that's buying a house or buying um Condos for 1.3 million 4 million that's going to be baked in so there's going to be security so now let's work it out so I understand your point of not being so close to the town homes okay fine let's probably scale it back I don't know but but ju but but that linear view is important I I think it's important to have access again I always say this I say this every time if you're coming to ask us for something we have to give back to our residents I say this every time so if you're and that's why whenever people asking for floating units I says how what what is the amount of Workforce housing or affordable that you're going to set aside because the people have given us the authority to vote in the the their best interest I have to be able they can't someone can't come here and buy a $1.3 million home and up and then the people that allowed me to vote for it can't have access to it because of you know that that you know I you know I I I thought about it I revisit it so let's in the spirit of what Scott galin is saying let's see if how can we come you know Frank help him or let how can we come to happy medium where you know we're not intruding on or there's not a fear for the town home owners but then we still have a linear view of the water wouldn't the town client's Direction um personally I might feel otherwise but I've communicated that to you and I thank you very much for your consideration have a nice evening I'll second councilman's appr uh motion to approve before we do that I still have more discussions I didn't talk about the community benefit yeah but you also yeah but now it's it's it's a it's a problem but okay I still want to discuss if there's something about the community benefit though that you don't like or want to see improved is there not time to talk about that at a future meeting cuz that's not a design item that has to go before the DRC no it is a condition of your approval it is a requirement by the code that they have a community benefits agreement that meets with your now staff um that doesn't go to DRC right that doesn't go the community benefits does not go to DRC it's just part of the package so technically you could have a further discussion but before they would go to DRC they'd have to have a final we have to have Community benefits agree not necessarily this evening beforeit for DRC I I have to say vice mayor I think what they've put forward thus far is way more than what we normally see for anybody theirs was on a lot of levels in a lot of places so I mean if You' got a tweak let's I think that's cool but I'm Miss love if well maybe miss Warren this question um um this is a quasi does have a client I mean the clients my clients are the people right so where where can we meet yes so I think Vice May one of the things that I'm trying to um access and address are both of the concerns from the council and from the client with respect to the potential tenants on the site and so I think and I would need to talk to um Bruce and William about this we we have a an exension of the northern um property we have where the building ends we can we can extend potentially extend the access point for the residents to make the area potentially wider and potentially and I would need to make sure that the um give me one second so I can talk to my client to make sure that he's uh that they are should we take a 10-minute recess no um two minutes two minutes two two minutes yeah if if I may vice mayor yes please just to to satisfy some of your concerns yes Miami D Shoreline committee this project was required to go before the Miami D County Shoreline committee staff always encourages and so does the shoreline committee proper linear access to the Shoreline they actually um presented this modification and and they have an approval from the Miami day County Shoreline committee for this particular modification due to uh justifications that were provided by the applicant so just so you know normally that would be a requirement of the shoreline committee but they explained their rationale size width of the lot things like that that that made that linear access um more challenging to to um deliver and so they had received approval from the shoreline committee for this so whatever modifications they would like to profer additionally to expand that it would certainly be appr uh appreciated by staff because we like those boardwalks to be like that along there as well um but when the shoreline committee approved it staff certainly goes along with their approv their final approval so I just wanted to put that clarification out for you that it did go before the approval no I have some questions I have some questions questions yes um it's hey how are you it's a great great program it's costing us a little bit of money um the question that I have is the advertisement on the freebie um it's it's we get some complaint with residents and and we pay this amount of money and when I explain it to the manager which I thought it would make sense if they do advertise on the vehicle We There is a discount that I'm I'm assuming that we getting from it but at this amount this is the discount that we getting um so that that was my my yes uh Mr Mayor so uh the current agreement that we have uh they provide a discount of $7,500 per vehicle it's a longsome amount uh that's provided and that is what the current agreement provides for uh if uh the council wishes to go on a different direction then certainly uh we can take up the conversation and negotiations with and the representative I love it it's a good program but I I don't think it's fair if if I may also provide a little bit further clarification so when we uh quoted the city for the services uh we went ahead and gave an upfront discount of 7500 normally how we work with cities is we do a 50/50 Revenue share with the city so whatever we sell in advertising we return 50 cents back to the city in this case we went ahead and gave you the $7,500 per vehicle upfront which was a total of $30,000 with the new agreement it would be a total of $455,000 uh if we go to the regular way that we normally work with cities which is the 50/50 split your cost would actually go up because we would not be giving you that $7,500 discount no but I'm saying why do we need the advertisement on the car do if because iur not all of their cars that's the problem because it reduces your so if we do the advertising that helps reduce the city's cost so so whenever we sell advertising it brings in Revenue and that Revenue we share at a 50/50 with the cities but in this case we went ahead and took the risk up front meaning we may not sell the advertising but either way we're giving you the $7,500 upfront in a discount per vehicle um in addition to what we're we're looking at today with the addition of the two vehicles is because the city was able to apply for and be awarded the F do Grant which is a 50% matching Grant so last year you were paying for four vehicles this year you're going to have six vehicles but only be paying for three so there's a a savings in that as well um now my question is that the $750,000 that um coming from the general fund M manager I believe it's coming from Transportation taxes along with the grant so this year there is a grant for 325,000 and then there's another portion of the city's handling and um that freebie contract so for how long we uh so it's like for how many years we just going to keep on carrying well there's two more years to the contract uh councilman uh so again as uh as the interim city manager mentioned uh this grant will help us to offset 50% of the cost uh of the the annual cost of this uh of this contract um not my my other question is on the service um I haven't had a very good experience with uh the service um two times I um order a vehicle just sitting and this thing just walking around never get to see one um that is something that we need to uh take into consideration and then the second time I was at uh Enterprise met car on Northeast uh 14 and then I ordered a vehicle to go back home and we was like waiting it was 45 minutes and then I saw one coming I was like jumping and then said damn and then all of a sudden the guy got out and then do did whatever he had to do and then got back in the car and drive and then this thing was still waffling so um I haven't had a very good experience with uh that so my concern is that we just want to have the service and everything but um in uh terms of uh the amount of money that is going to cause the city we have to um look at um you know what we getting uh for the money so is there any way that um standing in here can uh tell us that you the service will be improved um since you're adding too much more vehicle to to that Fleet exactly um councilman so by adding the two more Vehicles that's going to help with reducing the weight times I do want to say that there is a large majority of folks who are Transit dependent that are using um the freebie just to get to like regular grocery stores and such so we do have a high usage I will also say that the average weit time across our cities what's considered standard is 20 to 25 minutes um I'm happy to offer a couple of things number one I'm happy to offer a presentation to come back to you and go over all of your numbers show you what your ridership has looked like month over month since a service has been in place so that you could see how the ridership has grown and the popularity of course of the program has grown thereby necessitating more vehicles um also I'm happy to do a town hall and help educate the residents on how to best use the freebie knowing that they should call it you know 20 to 30 minutes in advance so that they can take the most advantage of it and and kind of help them manage their expectations you know unlike ride share companies where you have thousands of vehicles out there you know we we're only working with four for the entire city so your peak times are between 2: p.m. and 600 p.m. you're going to have during those times higher uh than normal than your standard 20 25 minute weit time um with the service but um again I'm happy to come back here and go over all your numbers from you know from when the service started to where we are now um perhaps you want to wait a couple of months when the two the two vehicles are in there so that we can see what the impact of those two vehicles um will be in the city thank you very much um um Mr um Alberto to the manager how many more years do we have in that contract two more years Council was like for a total of four years no it's actually a total of three years so it'll be this year it's only one year we've only had one year right so this will be the second year and then there's one more year coming up after okay and um do you guys Pere any um increase uh next year because it's like getting heavy and increase in the cost or yeah well no the cost is what we have under contract so the cost is not going to increase you know again I I think uh you have the the vendors here and they're hearing your concerns and they're hearing the council's concerns and obviously performance is important right and service and performance is important in a contract like this because the contract will run out in in a year or two so so I think they're hearing your concerns and hopefully they'll be receptive to those concerns right uh because uh you know poor performance may lead to the council not uh extending their contract right thank you if I may we also have identified a new grant that we'd like to bring to to the city's attention through the department of energy that's another 50% matching Grant Federal grant that would also help with um the city's portion of the costs oh good thank you I'd like to thank you so much for your presentation um um and again I just want to and I hear the concerned and I hope that you hear the concern I'd like to implore my colleagues to really support this this is I think one of the dollars that is well spent on our taxpayers where anyone in the city of North Mi any Resident of the city of North Miami can use this anywhere within the city of North Miami and not only that you know they can and and and it helps our model of work live and play so you can go if you work in North Miami you take freebie from work and if you you know go to the supermarket Etc you know I've literally had residents come to my home um and said to me you know what we need more because the weight time is is is you know it's it's high and so that's why I'm so happy for the grants that we're able to get so that we can get more cars but this is the one benefit that I think that our residents really fully um get a benefit from so with that I'd like to motion for oh you still question Mr yes um vice mayor how was this money is coming from our transportation all is an Enterprise fund it is a transportation s tax fund okay so this is Enterprise um money okay but but the CRA had a um a 50% match in the other one um is that happening this year or is just only the city portion so the CRA for the first year made a $100,000 contribution but it was only one year so tab X right so the part that I would like to speak about is a community benefits for the um Workforce housing and affordability um portion uh I just wanted to know if you'd be able be supportive of setting a $1 million for for that for housing yes we would be willing to set aside $1 million for uh affordable and Workforce housing pursuant to that section of the community benefits package okay so now I just want to make sure because that last time we had a community benefit and then it changed hands and then it didn't appear so how do we get those funding before or right when you're pulling permits so the timing of it I I think even with the other project was going to be based at the time of the uh construction loan um I would have to talk to my client to see the timing of it because I haven't uh obtained the time con at the time of construction loan it's typically not done at the time of building permit it's at the time of construction loan because we know we're mobilizing the materials and the construction of the site so we would tie and tether that amount to the time at which we received the construction loan to move forward with the project um but with that I would I would ask uh for this Council Indulgence on one specific issue um and it's a narrow issue with respect to the fact that uh I know that there has been uh some discussion on the unwillingness to be willing to approve or authorize the approval of this administratively uh our request would be to allow for it to be approved administratively because I I hear you mayor I think wait a second mayor I know you have the votes but listen I was on board to move on with that tonight but if we going to do if we want to go down that rabbit hole tonight and we we're going to be here I have 110 reason as to why this community I think people left here with the understanding that we were okay and we were um because we you know most of the folks that was leaving that that was something that we were okay with in terms of doing um and and I was okay with that I'm already getting um text messages from from residents you know that's already upsetting with me in terms of what what we are talking about doing but um this is really troubling wait wait a second so I want to make sure I address this issue because in the negotiations that I had with the neighbors it was specifically we specifically talk about you're negotiating with us so I I understand with them but this is the council I I understand mayor but you were talking about the neighbors and their concerns so I want to make I want to make sure that I address the concerns that they raise with me and what we raised with them so what we what we told them was that prior to administrative site plan approval we would have the issue respect to the relocation the redesign the Reconstruction wait wait a second man I know you're shaking your head I just want to want to get it out and then and then we can have the conversation if if if you guys will indulge me that we will have those issues addressed prior to site plan approval and the re the reason why let me say this sir please somebody has to look out for the rest of the residents and I'm going be very clear coming into this meeting you guys already knew as as as as far as public disclose nobody had met with me or discuss or anything like that cuz my vote was not needed which I get I get that however I I I am still on this Council and I am still the mayor I had received many calls from Keystone and S Susi on on the issue on this particular issue and I have been dealing with this issue and working with you in the developer from the get-go so I did not appreciate the fact that I have not seen the no Community um package benefit I have not seen none of these things which I'm okay with in terms of that but this one big ticket item you are asking the council members and and and if you have council member that's okay with that to give our right and and have staff do and that was the biggest thing I had four calls today from from residents of s sus and Keystone and and like I said I'm okay with the project and this and that and they really really it's a fundamental question that they have so which has nothing to do with you because you are making a request but if if that's the rabbit hole that we are trying to go down here the day the night before Thanksgiving um after whatever that's we we are opening up this thing up for so so so mayor look I I I'm just trying to address and zealously advocate for on the client's behalf with respect to the administrative site plan approval because we're seeking to get the construction loan to close on the property you need to close on the property as soon as possible to address the issues for Mariners Bay having a discretionary approval out there through the site plan approval process has an impact on our ability to obtain that and so I have an obligation as give give me one second M I have an obligation to be able to at least make the request of the council to seek to have the authorization for the administrative site plan approval and the attempt to see if we can close on the property as soon as possible which has been the timeline issue and so I wanted to make the respect the the request respectfully understanding the mayor OB I'll say this sir and and I'll say publicly and and if it's 12:00 midnight if it's anything that you would need us to make a decision up on something that you need that we vote um if we needed to call a special meeting I would give you that guarantee to call that but instead of us giving it to staff the resident I'm I I am telling you this it's it's not a good thing and and a lot of them left here and and we okay it's that that's that's just what I'm just putting it out there in terms of um that process Council I just have to I had to make the request I've made the request I've laid it before the council I hope that the council will indulge Us in the request so what I needed to clarify mayor was whether when the motion was made by councilman Charles it was with the intent of the two things that Mr gassant had put on the record which was the uh request for the administrator of site plan approval and then the second one was related to the section n of the community benefits package so and and one one more item um Madam clerk I want to make sure that it also includes the uh reference addressing the vice mayor's concern regarding the uh $1 million contribution in section three of the community benefits package can we vote on all three of those separately I I have to say I'm not comfortable with the administrative site review or approval I'm not comfortable with that and and look I I think I'm not gifted at a lot at a lot of things but I can count and so um I think for for me I I see where that is Council I wanted to make sure that um I got to that point and and sof for it I'll take the the mayor at his good word that to the extent that we need to folio number 06229 00- 1772 and totaling approximately 60 Acres in accordance with article 3 division 4 sections 3-42 through 3-47 Article 4 division 2 sections 4-22 section 4-23 parentheses capital A and section 4205 in article 4 division 3 section 4- 305 of the city of North Miami codee of ordinances chapter 29 entitled Land Development regulations providing for an effective date and all other allocate 17 floating units um to develop this particular project it's located at 450 Northeast 136 Street it's a little uh over a half of an acre uh it's a vacant parcel now it's zoned R5 and it would allow 75 ft in height um and 16.2 three dwelling units per acre but which would allow them eight dwelling units per right but through the conditional use permit which they're coming before you uh you they can request up to 25 additional drawing units per acre through this conditional use permit they're not requesting that maximum uh of 25 they are requesting only 17 to develop the uh uh this particular project the Planning Commission recommended approval with the condition the applicant of to consider doing a rooftop garden on this particular project uh again it's a four-story 25 unit apartment building and with 41 ground level parking spaces uh they have a seating area amenities on the first floor of the property it's going to be uh Green certified it'll have those enhanced storm water requirements at 10% over as Mr cassant mentioned earlier uh it will during construction at 250 direct because it's a small project 255 direct indirect jobs during the construction period with 4.1 million in wages uh they anticipate providing the city with 21,000 almost $22,000 annually in ADV valorum the current impact and permit fees as um with the old impact fees would be $84,950 um for their onetime fee the we do have those typical conditions that we always provide expansion of the sidewalks in this case it would be a 6ot wide sidewalk along the Northeast 135th Street Frontage and again lead certified uh they have some low impact commitments sustainability commitments they must keep the next steps would be DRC review and then come back to you for city council site plan approval with with this project um and we have complied obviously with every DRC review comment that we we went through right so as you can see in the interest of time I this is in my district and and and I'm getting a point of privilege to speak to you real quick so you're asking for 17 units I'm asking for uh well this building is a four-story building 25 units uh okay appr so it has um parking it has electrical vehicle parking we are prospering if you would like because I heard you mention it and in in a few occasions here tonight we're offering uh a percentage of uh Workforce housing SL affordable housing if if that's what how many would you be offering uh at least a 10% and what and 10% is five five of the 25 is that is that what's good at math I don't know something so well I want to hear the numbers is it no so so so can you allocate five five units five units and then we can work out the Ami yeah the interest of my clients have been to include Workforce housing in every project that they have done so in most of the their the other cases we have gone way beyond that that percentage anyway so you you will get you will get five and then the roof time they're recommending the the roof top Garden um is did you accept that offer that the Planning Commission is doing okay and let me see is that the building no vice mayor when you done sure um and so those are impact fee he's taking my fellow alumni from nor Mii high is taking place yes oh you okay Miss truy I'm here yes Miss Burton is out of town and asked for a substitute I'm not quite as pleasant as she is I'm sure but I I appreciate your uh your Indulgence um so as as you know from Miss Burton's letter uh the Builders Association has requested that the uh the fee rather than the proposed a very significant increase that instead be phased in a 20% increase over five years or 20% for each year of five years um and I just want to amplify the points that uh she made in her letter which is this is going to be a massive increase in the cost of housing and as the council is well aware the cost of housing is one of the things that this community struggles with I also want to point out that uh the Florida Statutes do require um that impact fees not be increased more than 50% and even if it is a 50% increase that that be phased in over the course of four years unless there's some extraordinary circumstance your report does not lay out in appropriate extraordinary circumstance uh and so for that reason alone you should either defer this to retool it um or accept the proposal for the 20% increase I would also like to specifically address the general government fee just to put on the record that the methodology that's at least laid out in the report there's no the law requires that there be a Nexus and a rough proportionality for the impacts of new development there is um no Nexus stated um and no rough proportionality in terms of how you've set the fee which you're now proposing to increase by up to 600% um on at least one of the categories uh which would be a violation of state law so on top of not having an extraordinary circumstance um It is Well out of proportion to what uh the statute requires and so with that we would ask that you either defer this indefinitely for further review or that you um accept the phased in 20% increase um and then revisit this at a later date thank you very much oh thank thank you so much we've been having problem with our mics um thank thank you so much Miss love um thank you thank you thank you in in in my meeting with the manager um earlier today we mentioned we talked about it because I did received the letter from Miss truly and I spoke to some members of the organization and and some stuff and and I think we all are in especially with vice mayor and um I think Council woman Timothy with affordable affordable housing all of us it's an issue that touched all of us um in terms of what's happening and it's not only in North Miami it is it's a national um Nationwide issue but we do understand whatever that we need to do we we we do take you know notice that we have made some mistakes in terms of this was supposed to be done 14 years ago it wasn't been done in terms of what we we are doing um I I am in favor of the the recommend the recommend that amount because I I I don't think the recommended amount based on it's not really taking any anything away from us it's just like we won't be getting the amount of money at such a you know one one one lump sum in a short period of time which I think you guys are saying okay we understand that you guys have made this this um mistake but we we agreed to work with you guys if you guys are able to you know fade fade it out into 5 year and in 20% um annually edit edit up until you get to your 100% whatever Miss love I see you shaking your head because there's a there's a there's a challenge with that well let me tell you my challenges as a as as a as an elected official I have to be careful because I don't want to sit here and vote on something tonight and then 10 years or 5 years from now um something did not happen in North Miami and it's because okay you it's because of your vote that while affordable housing is a problem I voted something to cause developers not come into to you know to build so that that that's the argument and and I don't think we want to be in the herald or anything like we got to be careful with where we are so tell us what's the challenge and we will'll figure out how to we definitely do that and I I'll also profer something slightly different you up on the screen you should see what the phasing schedule looks like okay right you'll see what what that dollar amount is as you phase it in for the first year this timeline that you see here first let's start with that this timeline at four years is actually follows Florida statute because you're supposed to look at your fees every four years right so going out five years takes us to a different level um this actually is the recommended fee phasing that you all approved at first reading right so going out to 5 years with this as as recommended by um the Builders Association we have concerns about it going out Beyond five years the fouryear because you can only do them every four years so as far as the extraordinary circumstances analysis Flor statute doesn't outline what what determines whether it's a extraordinary circumstances or not you do and and our extraordinary circumstances is outlined in your package so what happens when I compare them side by side you'll see that at the first year is the largest bump at the first year we know and they start to even out though it it we don't start to get close to what the actual fees should be the proportionate share should be until the third year using their methodology however what could happen and stay within that four years is to do it 25 25 25 25 okay right so that's why I was saying to you let me show you the slides okay so it comes closer because right now if you look at this and I have some notes if you don't mind I'd like to look at my notes here real quick all right so in this particular calculation we think it's a better balance to talk to them you know to to share their concerns yeah um but we also have to remember that proportionate fair share we don't start catching up until the third year and then we start balancing at the 50758 but I think your proposal if if I'm mist again you could correct me would basically just because if she's going it was 50% and and your your truly proposal your the the organization proposal was 20% each year so if it's only 5% more each year so added up I I think that it's it's a no-brain to me unless there's there's another in in her methodology that I did not um yet consider am I thinking it the right way well you're getting to the 100% we're talking about doing it over an extra year I just want to point out under under the statutes the the cap is 50% and you're more than doubling your fee so under the statute you could only do a 50% increase over four years absent extraordinary circumstances which quite frankly I don't think that the council's your predecessor's failure to increase the fee over the years counts as in circumstan so what the what we're asking for is an organization is rather than do it over the four years you're already over the amount that you're supposed to be able to do you do five years 20% and then we can live with that as an organization that's the request so we can't go over so we four years you H you cannot you have to do it every four years you have to revisit your fees every four years and the the the he he the with uh this I think it is a good um option MH to go 25 25 25 25 because even with this we're not evening out until the third year oh right yeah is that is that because based on on and that would make that would make sense to staff and it would also follow the um but again it's not evening us out until the third year but that also help you guys in terms if it's 25 this year versus taking it out an extra year I'm I'm not I'm not in a position tonight to say that we're okay with the 25% over four years all I can tell you is that the statute doesn't allow you to even out past failures to increase the fee the statute says is whatever your fee is today you can't go more than 50% over four years but we we would not no you're more than doubling it in one in a couple of the instances it's 600% in right but that is because we have extraordinary circumstances and it's not based because we didn't do that it is based upon the need today and the inre construction cost what it actually costs to do the work that needs to be involved it has the the 17-year time period is a notation we're not using that it's just the cost of construction for today and if it goes beyond four years we're not allowed to we'd have to come back and revisit that at the fifth year yeah the issue that we as as policy maker and we got to be careful just on because I'm hearing what you're saying but it's not as simple just hearing it and and sir thank you as an expert cuz he's just here giving us just some guideline in terms of that we got to balance it out the we we're in a crisis it it's the market it's really bad we we all kind of get that but how do we I don't want to be able to vote on something on a policy that actually does not help people coming into North Miami to help us resolve the problem a affordable housing because we put a policy that you know the the developers are saying or whoever's coming in or somebody wants to build the house say I cannot afford here because it's too much um in terms of um of that that's that's my only issue how do we of course sir yeah how do we work that if it is affordable housing there's a we offer waivers for the impact fee for the first owner now if it gets flipped yeah the previous owner has to yeah has but that first round MH it is a waiver that is available for affordable Workforce housing okay so that and then as you all know it doesn't apply to existing housing as they replace their housing the only thing that is they would be paying for is if they have to upssize their water meter or they have to or they're ex uh extending uh more per surface on the site and then that's 78 cents a square foot and that's new so that's not phased in um so the recommendation of the 25% you have the waiver for affordable housing I agree with the 25% because I'm looking at it and I don't know unless there's something wrong with with my formula thinking if they propose 20% each year so let's just say we starting out this year you're proposing 25 so next year if you put it up on under that plane it'll be 40% but under your plane it's 50% % am I am I correct so the 30 will be 75% correct so we start evening out right then by the third year so that at the end of the fourth year by doing that compromise of the 25 25 25 25 uh we become whole on construction costs and the actual proportionate fair share cost unrelated to how long it took us is today's cost of construction so that get this is a compromise for us as the city we would like to get all the money up front but unfortunate unfortunately the circumstances we just have to be so we hope these are good policies and and and sir you will you will continue to work with us to you know you know cuz we want to be right we not this is not about us we just want to make sure that we could do this that'll be good for the residents and the folks um in North Miami yeah of course the association will continue to work with the coun thank you so much sir we look forward to that sir thank you so why do we go from there yeah it's been got to shake it yeah so um the phasing schedule that's currently in your ordinance will be replaced with a 25% phasing schedule and um we will work with staff to make sure that final piece of legislation is all queued up with those um new 25% phasing schedules for your execution awesome thank you now um Now quickly the the the schedule that we have in here now um and um Mr um try spoke about um a violation of uh the state s so where do we where do we stand from there so um according to Florida statute 163 31801 Florida's impact fee Act it does allow a local government to exceed these maximum caps that were described by um by the attorney for the Builders Association however the the Florida Statutes do allow for the impact Fe rate to be increased Beyond those limitations if three requirements are met one is that you have an extraordin extraordinary circumstances need study which is part of the Council agenda packet which is also posted on the city's website and that the local government jurisdiction have no less than two publicly noticed workshops which has occurred those workshops have occurred and that this Council adopt this ordinance by a 2third vote of the governing body so as long as you're meeting those three requirements and staff has taken for care of the first two requirements you do have your study analysis it is part of your Council agenda packet tonight and we have already taken care of your two publicly noticed workshops so the last item is on you we'll need a super majority vote um for approval of this ordinance
