Pastor sour um Madame manager any addition deletion or Amendment to the agenda no mayor I thought there was one item we we were trying to move to consent no we good I believe we are good good on the agenda um I I have a question Madam manager I asked for an item to be added on for the fdot um is concern that about because my understanding if it wasn't added on today that we would lose funding so I did speak with um freebie and their managing partner and they did say that it was already in the works for November 26th so it was on November it's on the November 26th and I did confirm with them we would lose absolutely no funding by proceeding on November 26th I wish I would have known but thank you okay the next one so you you good vice mayor I'm good awesome thank you so much um Mr attorney are we all set yes mayor the agenda is set you may proceed thank you so much um we have a couple of presentation um in of course we have the U major presentation where we're going to administer the oath of office by our elected city clerk but we'll do that last so we'll go down and we'll do the presentation by vice mayor Mary EST Irvings followed by a special presentation by our police chief I'm Sharice G and then we'll go into the special presentation of black girls who math presented by city clerk and then we'll do the um oath of office and then we'll do City Event and then that's basically it thank you let's go good evening everyone thank you so much for being here um I am Mary SM Irvin your vice mayor and it's an honor to stand before you tonight to present this Proclamation recognizing no November as epilepsy Awareness Month epil epilepsy is a condition that affects countless lives including families right here in our North miime Community but beyond a medical condition epilepsy represents a journey marked by courage resilience and often a silent struggle against stigma and misunderstanding as we present this Proclamation we renew our commitment to raise awareness deepen understanding and support the lives of those affected by epilepsy education and advocacy are crucial in fostering and supporting and supportive of compassionate communities where the individual with epilepsy feel empowered understood and fully accepted I want to thank the organizations family and Advocate who work tirelessly to support those living with epilepsy your dedication ensures the resources knowledge and empathy are continual extended to those in need so let us come together now not just in November but every day to break down barriers built awareness and ensure our community is is a place where everyone feels seen supported and value thank you all for your commitment and passion and so where's the proclamation thank you so um National epilepsy Awareness Month e in strength change and impacting promoting a supportive inclusive and empowered Community where no one faces epilepsy alone and whereas raising awareness about epilepsy and displacing myth about seizure is essential to reducing the stigma and improving outcomes for individuals living with epilepsy therefore I Mary Esme Irvin vice mayor of the city of North Miami along with mayor Alex zum councilman Scott Galvin councilwoman Cassandra Tim Y and councilman Pier F Charles do whereby Proclaim November 2024 as the national epilepsy Awareness Month in the city of North Miami and urges all residents to join in raising awareness and supporting the epilepsy Community um so the national epilepsy awareness month and and and it's signed by all of us so thank you have some words excuse me um just want to say thank you to to the mayor vice mayor and everybody here um that is making this happen uh this is on the behalf of half a million of Floridians that are impacted by epilepsy uh and when you hear that number I want you to think about that number maybe double triple because it's just not the individual uh that has epilepsies or seizures but we're talking about their caregivers their mom their dad a husband wives kids um so thank you for doing this as you can see some of us are popping out in purple uh I'm loving that that the shiny purple jacket like I'm like jealous I'm like I wanted that you know but I just want to say thank you uh uh it's very important uh this is epilepsy or awareness month and unfortunately there's a spectrum when it comes to epilepsy a lot of people are not aware of the services we have here at epilepsy Alliance Florida uh and I just want to say thank you to this beautiful city of North Miami uh and and and their City officials and everyone that's being part of this uh uh because we're impacting millions of lives here in Florida when it comes to epilepsy awareness month so I just again one can we give them a round of applause these are the type of people that we need an office these are the type of people we need an office that are interested in helping the community especially when it comes to epilepsy so thank you once again all of you guys thank you so much [Applause] [Applause] good evening everyone Sharice SC Chief of Police I'd like to take this opportunity to ask all of the North Miami Police Department Department Personnel to come [Applause] forward give them another hand because they are really looking sharp they have their Sunday Best on yeah you can stand there that's fine you all some of you can come on this side so so as everyone may be aware on October 9th the West Coast was hit with a catastrophic hurricane Category 3 hurricane Milton within days the Florida police Chiefs Association as well as the Miami Dade County Association of chiefs of police asked for several officers throughout Mii Dade County to go and assist with relief efforts these North Miami officers that you see standing before you stood up volunteered and answered the call the call to help those that were in need there were several deaths that were experienced by this hurricane they left their families and so I want to publicly publicly say thank you thank you thank you to each of you we got nothing but R reviews from the support that you all provided them while you were there and I commend you for your dedication professionalism and I want to say to you all not only are you making a positive impact here in North Miami but you're making a POS positive impact Beyond North Miami so thank have to say for the entire meeting by the way [Music] all right so at this time uh hi everyone Vanessa Joseph city clerk I want to welcome Shava s uh we're doing this new thing at our Council meetings where we're allowing organizations to give a brief introduction about their organization and what they do so please welcome shinava from black girls whth good evening everyone uh thank you all for having me tonight um I just want to introduce myself my name is shaba St toan I'm the founder and the executive director of black girls who math I founded black girls who math a little over a year ago um to create a community for black women and girls who are either already currently in the stem field or interested in pursuing a career in stem um my background is in math education and um we just started with our first cohort this past summer doing SAT prep uh teaching them how to code build out websites um and also preparing them for college and their college application so I'm excited about the work that we're doing in the community and hope to have you all support on my journey thank you so much all right so I'm actually really excited to partner with the Miami Foundation this year to make a contribution to special organizations in the city of North Miami just ahead of give Miami day and for those of you who aren't aware give Miami day is the nation one of the nation's largest online filling philanthropic uh giving days and and annual events where anybody can essentially become a philanthropist no matter how much you have to give and no matter where you are in the United States you're able to make donations for organizations across Miami Dave County and so every single year I make a personal contribution and I also fundraise on give Miami dayve for certain organizations but this year I made sure that the chosen organizations that we selected are actually reflective of the values of my office and so it's truly an honor to be able uh to do our part in contributing to amazing organizations that share the same values that we hold and we espouse within the office of the city clerk and much like the founder of black girls who math shinava s who you just heard from we believe in the power of Education mentorship leadership Sisterhood and Innovation so we are so pleased to contribute to your organization as a small token of gratitude and appreciation for your work and again this program is an invaluable tool for girls and women who are not only in math as she said but engaging in stem Fields so engineering computer science information technology and the and the name is actually really special because math actually stands for well black girls who math stands for black girls who move around trials and hurdles and so at this time I'd like to welcome the Miami Foundation because they actually have a matching gift to what we're going to give you [Applause] today so this came as a surprise to [Music] her it's so wonderful to with go ahead and you guys want to make [Laughter] and so for those of you who are here and who also believe in the mission of black girls who math I highly encourage you to support them on November 21st forgive Miami day [Applause] first of all it's really inspiring to see how engaged your community is coming out filling this room for your meetings it's really a testament to the Civic engagement that you all have uh created so last year on give Miami day the people who live in our community in Miami donated 96,000 donations 96,000 donations totaling 34 million dollar in one day for our community is one of the biggest giving days around the world and it happens here which makes me incredibly proud of how generous our community is this is a community built of choice people want to be here they want to live here they're in ired to give back to the causes they care about the day is coming back up again it's always the week before Thanksgiving so it's November 21st there are over a thousand nonprofits in Greater Miami who address every issue area that we all care about for our Quality of Life Education housing Health the environment and they stand up for Miami every day and this is the one day a year where we stand up for them and so I encourage you you can go online to give Miami day.org you can see the profiles of all thousand non profits you can pick the cause you care about and we have a match somebody donated an anonymous match so that every $25 gift they match it with another $25 on that day uh and so I encourage you get online November 21st support the causes you care about we're very inspired by your work I know there are other organizations you'll be supporting this year and on behalf of the Miami Foundation I just want to thank you I'm so proud I'm so proud of Des uh Council City staff and of course the entire Community neighbors and friends I have to say I have to start by saying how truly truly grateful I am uh to stand with you all today as I'm reelected without opposition to serve to serve as a as the city clerk I think that this opportunity really reflects the trust that you all have placed in me and for that I'm truly truly deeply grateful uh I'm not going to go into the entire set of remarks that I could provide because there's going to be a ceremonial inauguration uh but I do want to first thank mayor desay uh for seeing something in me for inspiring leadership in me uh for believing in me enough to think that I could do this and for always of course supporting the office even when he's mad at me about something just regular but I also really want to take this time to thank my team who entirely supports the mission of this office uh the the mission and the vision of the city of North Miami they take to heart and it's really their Dedication that that is the the engine that powers this office and enables this office our Collective office to deliver responsive and effective services everyone who calls North Miami home and so my face is on the wall and I had to write remarks because y'all know I get sentimental and I start getting preachy so I I'm trying to keep it brief and I'm going to read my little remarks but uh you know my face is on the wall but it's really Dr Stephanie it's Janai it is Roberto Taisha Kai and Leila who come together every single day to form the collective backbone of this office and it's their Collective commitment to Excellence that makes them such a reliable resource to this community so I'm honored to be the face that represents the office but I'm even more honored to be able to work with such great civil servants yeah give it up for yourselves amen and I think a lot of you know that uh the role of the city clerk is a is a role that I take seriously a lot of you don't may not know that I'm also an attorney and I actually practice Deborah if I didn't have you at work a lot of the stuff that I do in this office I wouldn't have been able to do Deborah St Ville is an attorney is a colleague of mine who's made it possible for me to leave work early step out on an Outreach early just to be able to make it to City Council meetings on time and to all the other events so um thank you so much and the president of HLA um as I've done for the past five years and five or six months um I I I will continue to remain committed to upholding the standards of integrity and accountability transparency and and dignity of this office and in everything that we do and I look forward to continuing the important work that we do and ensuring that this office always remains a resource and support system for our residents our businesses and everyone who relies on our services because what a lot of people don't realize is often times people come to our office first for a lot of the needs that they have and sometimes they're not able to access that in another department or something and come to us for help even after so I just I thank you all and of course I I mean it it's it's my deepest honor to watch how some of you who work here come to the office relying on The Sisterhood the fellowship that is apparently a n of nature in my office and it's just really I'm honored to be able to provide a safe space for a lot of people throughout the community and that's something that's really important to me so I'm really excited for what's ahead and I want to thank you all again for this opportunity I I'll I'll be sharing more with you and I'll try not to get emotional I don't know what's wrong with me y know I'm I'm sof a little bit but you know at the ceremonial inauguration I will share more um and I'll be able to really fully reflect on the journey and talk to you all about what I see as the vision moving forward but I just didn't want to let this moment going to have our outgoing councilman Scott Galvin as our Grand Marshall for this year okay congrats yes yes sir all right good evening mayor council staff and residents uh Sergeant Jee Baptist I'm the current emergency manager like you said I we did have a late hurricane previously and one thing that's interesting when you're looking at hurricanes it's actually on a curve yes the peak time is between June and November 30th however it could happen afterwards it doesn't necessarily go down to zero uh just want to touch on deployment really quick what was important about that uh I can compare it to the idea when John F Kennedy 1962 right he gave a rousing televised speech called the moon speech and not to go into too many details but the idea was that he said it was necessary for us to go to the Moon because we had to measure our ourselves and challenge ourselves and that's why I feel like it was important to do the deployment because we did have to measure ourselves see what skills we have what we might lack where we're strong and challenge ourselves because there's certain challenges you cannot look away from because there's a chance we could have something right we're still hanging in there till November 30th so that's why we continue to encourage everybody make sure you have a plan make sure that you're taking pictures for your insurance and make sure you have have all the resources and items you need together uh so far this year we've had 17 name storms the average is actually 14 we've had 11 hurricanes right the average is7 and we've had five major hurricanes two of them were Category 5 I remember when uh Milton was in the gulf and it turned into a category five we were on the edge of our seat for a little bit but we were ready and that's what counts moving forward um the only other time that we've had six hurricanes making landfall at this time of year is in 2020 1985 and 1886 that's the only other time so Milton broke a couple of Records because it was the strongest recorded hurricane since 2005 which was wlmart um the thing that it puts you in awe is the power of Mother Nature so most of the time was spent on a key called called Long Boat Key and what it looks like is hands right reach into the ocean grabs a bunch of sand and water and everything and just dumps it on the land that's what it looks like am I correct and it's it's it's an A A inducing sight to see but also reminds us and keeps us Vigilant that we have to make sure that we are prepared um and that's all I have any questions no thank you so very much um appreciated um and from this portion of the agenda tabs a through J con constitute the consent agenda these resolutions and items are self-explanatory and are not expected to require additional review or discussion a proposed first ordinance of the mayor and City Council of the city of North Miami Florida amending chapter 2 of the code of Court ordinances of the city of North Miami entitled Administration article three entitled boards committees commissions division 2 entitled Board of Trustees of the north Miami Museum of Contemporary Art mocha specifically at section 2- 63 entitled meetings attendance to change the number of required meetings providing for conflict severability codification and an effective St tab K thank you so very much um is there presentation for from MOA what is this um this is an adjustment to the uh ordinance just to require a minimum of four meetings per year okay I see shaa hey how are you good evening good evening mayor and Council on behalf of the manager shaa Sheldon executive director of mocha uh just a change in the ordinance which currently states that the Board of Trustees now 19 individuals strong um is reduced from a minimum of nine times a year to four meetings a year uh this is largely uh with the work that the board is now doing in subcommittee to raise money to prepare for our gallon February um and uh the various other work that the board does to serve the museum efficiently thank you so very much can I get a motion so move second uh are we doing public hearing uh oh I'm so I'm so sorry public hearing is on the item the city of Council of the city of North Miami repealing section 19- 98 Water and Sewer capacity fees in chapter 19 of the city of North Miami code of ordinances entitled utilities amending chapter 29 entitled Land Development regulations articles three entitled development review specifically spe specifically at division 14 new development impact fees repealing Transportation impact fees adopting new storm water impact fees combining parks and libraries impact fees combining General government and general and excuse me police impact fees amending land use categories within the Parks and Recreation and general government impact fees schedules assessing Water and Sewer impact fees on the basis of water meter capacity rather than land use type adopting and up updated impact fee providing for purposes and intent providing definitions providing rules of constructions providing findings providing for conflict severability providing for repealer providing for codification and providing effective date this item was tabled from the October 22nd council meeting that's tab L thank you so very much um Miss love good evening mayor and Council for the record Demi love development services director as you recall at our last meeting um Mr Clancy Mullen who has joined us again this evening uh presented the impact fees um study results and the extraordinary circumstances analysis that was done um tonight we're asking I think kelman galin asked for a very clear ask what are you actually asking us to do it's four parts the ordinance before you does four things one it repeals the transportation fees which is going to be replaced by the mobility fees that you adopted in first reading um the second is to adopt the actual study uh the third would be repealing the capacity fees that are in our current code and the fourth is to adopt the actual ordinance which includes the fee schedule the extraordinary circumstances analysis um is um part of the impact fee study that analysis uh allows you as a councel because as you may have recall Florida statute limits how much we can increase the fees by certain percentages and in some cases it would take us 14 years to actually reach 100% of the cost cost the actual cost of construction for new development to pay their proportionate fair share of what it takes to build new infrastructure to handle new development that's what Florida statute says so the extraordinary circumstances analysis that Mr Mullen went over with you last time allow would allow you to have a great deal of flexibility when you could adopt all the fees at 100% or you could decide to phase it in over a certain period of time and staff has looked at that option for you if that is the direction you wish to go but with that um Mr Mullen is on the line and would you like for us to give a refresher for those who were not not uh a part of it well last time I don't know the the the council's um inter but I I unless anyone up here would like to re rehash again um it's up to you guys no I I have yeah we already heard it I know there was um there was an item I know the the truly is here from the um from the um Latin Builders Association with some recommendation so I I don't know I think you did pretty well in terms of what you always do trying to keep it short right but Mr Mullen is here just in have questions okay thank you um public hearing is open on the item Mr thank you Mr Mayor and um city council uh members my name is truly Burton I represent the Builders Association of South Florida the Latin Builders is a good friend of ours but I don't work for them I work for the regular Builders a it's okay it's easy to get mixed up um and um thank you for letting us uh um offer our comments again this evening uh you heard a little bit about that at the last council meeting it is a big increase okay and while uh Miss Love is correct it might take a while for the city to catch up um I think that prior city councils um didn't want to touch this hot potato and now it landed on your desk okay right wrong or otherwise it's on your desk in the meantime this sudden jump okay will have a big impact on the affordability of housing in the city okay nobody likes prices going up I mean you know no nobody does it's construction costs it's how much land costs paying our employees better which means costs go up higher prices for concrete and steel and the rest um so if the council considers any increase at all it should be very gradual and predictable so that project managers at the city and project managers at you know fill in the blank at your CRA at uh wherever they're going to build in the city have a very specific they know it's going to go up X every year that's how you plan that's how it's I think it's fair it's an equitable solution um I could say no fees because I mean that might be you know one party line but that's not fair okay and that's not right um and also I know that the city's taxable property values are going to be gradually going up as well they've gone up from three I think billion to about 5.2 billion which I pointed out my letter last time so this is the kind of thing that will add to the city's revenues okay so that you can build a new community services uh Community Development Services building which you need a new uh City Hall if you all choose to a new police department or add on to the police department so that's uh that's the request and that's that's our recommendation thank you very much Mr Mayor awesome thank you so much um anyone else um I see mayor Burns and I would like to acknowledge um mayor cin burn Burns which I was going to do but you just got up to speak so good good evening mayor and Council Kevin Burns 2065 alaman to drive um Trudy is a expert on this kind of stuff throughout Miami day County um and uh she's very uh wise however when we implemented this in n in 2005 2006 we did it at 50% expecting future councils to raise it every year a little by little by little they did not because nobody likes to raise fees and now you have an opportunity one more time unfortunately I would have to say and suggest that you bite the bullet it's going to hurt it's like ripping off a Band-Aid go to 100% right now it's it's a a tough thing to do but the neglect that the city has had over the last 15 years as far as increasing fees we see it with the water plant we see it with infrastructure it's catch-up time and we we can't go backwards we got to go forward and uh people will accommodate to it but uh it's if you think future councils are going to you do it at 50% now and then they're going to raise it up next year another 20% and so forth I think you're going to kid yourself on that it's unfortunate that that's been the record of the of the city so um you have the opportunity we cannot afford 14 years to play catchup to today's prices of what it costs to today and so it's unfortunate that you're in this predicament but if you're going to do it you might as well do it this one time and get it done with thank you thank you so much mayor Burns anyone else um Coming see none the item is closed um basically um if I may you know mayor Burns I I actually met with with truly after the the last meeting and and and I I'm just thinking out loud and and in The Proposal that they made um they understand and I think you clearly stated we made some mistakes we didn't raise the fees um in terms of the council so I think what they are proposing to to us at least the proposal that's that's on the floor is very very much um it's it's a little bit fair to to both of us so they understand that we do have to collect and they're not saying that we don't collect so their proposal is if we could phase it out in terms of whatever that we need to collect instead of getting it in in in two two to three years we could get it in in four to five years whatever the case is just to you know we'll ease off on on developers because we don't want the the next headline you know North Miami affordable housing cannot raise up and then we just raise up our fees and so we we we understand the the dynamic um where we would like to raise out 100 but obviously I don't I don't think it would be you know too prudent for us to do but I I do like the proposal in terms of us passing it with now we would the as a council would I guess agreed or negotiate how many West a term um you know and you know and staff could guide us in terms of what we want to do how we would would want to do this and we just have to make sure future Council we keep doing what we got to do to make sure that we are increasing these rates either if it's the infrastructure or anything um on time so miss love yes sir um um we staff would recommend that you that we agree now on a phasing approach our Capital program is in five-year increments so to to increase it and to give certainty to both the development Community as well as our budgeting yes we would we would recommend that you phase it in over a 4-year window so that when the new the next 5-year Capital program you've you've got this this money on this funding so at this at this cost construction cost uh we're looking and Mr Mullen are you there sir he may not may may not because we would been having a little bit of a problem but we do have a proposal uh if you're interested and we would recommend that if you're going to phase it in that you make the determination as part of of this plan that was the and we would start the first year at 50% next year it would go to 70% the third year it be 85 and then by the fourth year it would be at 100% And then your Capital program changes again for the next round of projects because we have a 5-year and a 10-year Capital Improvement plan so if you're interested in doing that um now your storm water fees are new um so it doesn't require by Florida statute phasing and it is about 78 cents a square foot so for a new home or a a home that's being built bigger um they wouldn't pay any impact fee but they would pay the additional storm water fee for the increase in impervious surface that they would be building as you know um most existing homes that are being replaced would not pay any impact fee unless the meter has to be larger than it currently is and the additional uh lot coverage so um the fees are applicable to any new development but again it's not applicable to any existing development nor um if you're just replacing like for like okay thank you um members of the council yes ma'am oh yeah I did have just two questions um first one is what what administrative control um what mechanism would Administration put in place to ensure that you guys are collecting these fees I know there was one fee that was you know minimum that wasn't being collected but is there a plan to ensure that these fees are now collected it wasn't that it wasn't being collected it was because it could only be utilized for New Roads when you're when you're in creating new capacity so it's very small so the dollar amount was just negligible um that's why it's being replaced with the mobility fee which allows us to do witer sidewalks and a lot of other things that we need here in the city so the mechanism is simply that we set this ordinance up our procedures we actually have a book of how this is administered you're giving us direction that you want it phased in at whatever these percentages are that you all tell us and then we as staff will make sure that not only does it get inputed into our new permit system system when that becomes so that it will automatically then at this date it changes that date it changes that date it changes and it's it will be published so at SEC after second reading the thing that we have to do is provide a notice of adoption of the fees and in that piece of it uh I'll work with the city attorney's office to determine the proper language to talk about the phasing so that everyone knows and it will be on our website so our staff will have that process proc and and it's automatically done we don't have to come back and worry about coming back to you we need to look at it again at in the four years to see is this are are we still pretty good on the construction cost are we still right where we need to be but you wouldn't have we wouldn't have to come back every year to ask you for the increase my followup question I know I asked it to the city Administration today in my briefing um for developments that may have not come before us but they submitted their applications will they be grandfathered in or let's say after the 90-day notice would they be will the new fees apply to them the fee doesn't apply until you apply for your building permit Florida statute says that it's paid you submit your building permit we give you your permit not the application but once the permit is ready to be issued we grant you your permit you give us the money that's how it would work so it's once they go over to the building department and then is through the building permit so through throughout this time period they're good until they have to go over to the building department and then there's no grandfathering in beyond that but permits that are in place now and that are being that are under review yeah they should be fine but they're expired in there I know there was at one point solo Miami was renewing their permits like every year because they weren't ready to start but a project like that like you said one their permit okay M that was it for me mayor thank you vice mayor no so what I was going to ask and thank you so much for providing the information you provided the the increments for the four years um do you have an estimated Revenue that you think will happen that first I know it's kind of difficult to estimate but based on what you think is coming up or you know how it be but not without doing that work to delve into that to try to see what would be coming up you know through the system because we just really don't have an idea at this point and I know that you're dealing with developers are you have you had conversations with them is that does that seem fair especially coming from ually if I can get that point of privilege Mr Mayor no go ahead did you hear the increments that was recommended by staff yeah she because I think she was text me um yes yes please I think that probably 20% a year might might do it because remember it's not just the fees that the department is collecting but it's also the increase you're going to have property values increasing over time so more monies and revenues are going to be coming to the city little by little it'll get it'll catch up because like I said this is a hot potato that none of you're doing we understand it's sitting on your desk yeah right wrong or otherwise sitting on Debbie's desk right wrong or otherwise and you know um our folks are now seeing um a an affordably price excuse me an affordably pric city that has got strong solid workingclass families um that want to live in a home that they can afford or rent an apartment that they can afford okay and the only way to do that is to come to that balance so yeah that's that's and I think that's where yeah and I think that's where I'm a little bit um concerned B you know to Echo what vice mayor is saying and and what truly is saying we got to be careful um at the r and do know Debbie with the 50% and where so we we we need the money but we got to be careful especially where we know we need affordable housing and and folks you know we don't want to put it out where it's too much um folks cannot afford it or we got to do what where to balance everybody benefit the city get get what it needs to get but we also don't put um you know the marketing in terms Mr Mayor I you know I and I hear the balance I share but my concern is that let's just say we do the % either way there's going to be a dramatic increase further down I feel that and it's not fun that if we just do that hard that hard 50% and then after that no no it's it's it's decreased after that it's then it's the 20% the second year it seems like you know it goes down so so miss love yes sir So what at the 50% if if somebody's trying to build an affordable uh uh lot what would be just a single family like what would that mayor if I may only because after attending the affordable housing conference I learned that it's very difficult to do affordable housing here in Miami day County because we're the only County throughout the whole entire Florida that doesn't allow a a developer preference when going after those local tax credits that um what is it uh what's the affordable rux park has been waiting for so you know they're waiting for those tax credits to come out in the state and you would get 20 or 30% once you're select if if the city can select a local preference um for the developer but because Miami day county is the only county in the state which I found very interesting that does not allow that it makes it hard for us to do affordable housing so when we're looking for projects that are doing 40 to 60 or 80 Ami they can't do it because they're looking for that tax credit to come from the state and it's a pool that comes out every year but they can't select it cuz we can't give them those extra credit for it so when I found that out I was just like oh God makes it very challenging but if we um looking at it from the other side for the most part of the units that are coming out in the cities of North Miami they are not affordable so we have to uh look at this um also I think looking at it uh the way we have it phased I think it is more than fair because also we have to look at the interest of the city as at heart everything that we we do cuz we also need uh money to uh you know um improve our side work and then everything in the city will need money so this is I think looking at it it is more than fair if we take um such an an approach so with the starting with the 50% and then we move on um gradually so I think it is a very good break and uh if I may just a point of clarity if it is is a if it is a truly an affordable housing project which is up to Workforce housing which is up to 120% you get a waiver you can apply for a waiver of the impact fees so for the first owner of the project they get a waiver of paying impact fees and that keeps that from going onto like Ru park for example um they would qualify for a waiver of uh the impact fees that's the that's the one that you were mentioning okay so all right move for approval second what are we approving the with the am with the amendment or thank you thank you for clarifying I move that we approve this amendment with the recommendation of the increments of you know 50% for the first year 70% 85 and on the fourth year 100 she it would not hurt that um the in the four years so we'll bring this the record Debbie Love development services department before you is a conditional use permit request for uh an apartment complex um they call it Palm Gardens this is part of the former Johnson and Welles property and these were dormitories that um are now being converted into Apartments the um as you as as The Madam Deputy city clerk read the mouthful of the locations as you can see in the picture on the screen you'll see that it consists of multiple buildings uh the lot itself is a little under 3 acres the total Lots um their Community facility because again these were University dormitories for Johnson and Wells uh they are this is within the north Miami transit station overlay District so in order to convert the dormitories to provide um density back to it it requires a conditional use permit what they have is they have aund their providing 138 surface parking spaces for these units and they're upgrading the site uh because a lot of it is simply Paving so they're upgrading the site to improve the storm water and uh some of the landscaping and um the the economic impact really isn't going to change and remember I told you existing development would not pay for it they're not increasing so the impact fees they pay no permit impact fees um when they were on the off the with when they were with Johnson and Wells there were no adorm taxes collected um this conversion now would be would be You' obtain Ador taxes from the city they are not changing the externality of the buildings they have gone in and and uh redid the inside of the building to change them from dormitories to uh ments so it did go through um it it will have to go through DRC review they're going to have to improve the sidewalk have a um I'm sorry that's a type over there it's actually a six foot wide sidewalk on 17th and the 124th frontages uh they the minimum size of the units have to be 500 square ft because in the north Miami transit station overlay we allow Apartments to be as small as 500 square feet they will have to obtain a certificate of use in BTR and they do have to do some things on the storm water for their and provide some sustainable commitments uh The good evening Chris Collins Urban Design 666 Northeast 120 F North Miami um thank you to staff for working with us on the application and the presentation um I think that the application is pretty straightforward um for there's a total of five buildings here four of them were multifam buildings built prior to the school so the school came in purchased those buildings changed the use to dormatory effectively though those four out of five are a typical multif family building the average one building one-bedroom unit is 750 ft the average two-bedroom is 1,50 Ft there is a fifth building that the school did build as as a dormatory and our client has already gone in and converted those dormatory units to apartment units essentially combining two dorm units into one um but but again all the square footages are well above what the code minimum is with this application we're not seeking to change anything physically the buildings would remain the same the units would remain the same we're just trying from an entitlement perspective to change the use to be in compliance with what is actually there um once this is completed we we are seeking to make some site improvements they're allowing in the area that's all I had to say did you call the police I I saw it I saw it and I'm like you know what I'm not going to take a picture cuz I'm like I want to show you that this is real and she's right out there in the air when they're in I'm like this is crazy and these guys are just behaving illegally oh she was just oh she's in in that same area she's right there a tenant of the you're sure she's a positive she's right in the area she's right in the Aira where where they built that complex and I'm like okay aren't we talking about the the complex that's on bisc Boulevard and like 123rd Street where Johnson Wes to be at where the dormor are at where they're at that's where they're at they're just ring out the units Johnson Wales had 28 Acres before they started to sell off so I want to make sure we're talking about the same location you see you know when the students would go and they were dormatory in like when they would Le Johnson and Wells and they would just go into this particular area that's where she was at cuz you have a common area so let's say you're hanging out and you're not in class Scott Center yeah the wild Center the where they used to is it the wild used to be called the wild cat Center I'm not sure I never went to Johnson and Wells I just I noticed where the students were were there that's where they were so here's what I'm trying to Zone in on Mr Mayor how do you know this wasn't a homeless person and you believe it was a tenant of the property that you believe is renting out she right you have you ask a good question she was just too casual uncomfortable she was inside I'm like okay she she's living here I don't know but I'm not surprised because I know this is what they were doing they were just rting out the units so can we ask Collins I believe he's still here I can't is that what's his name are you renting the if we can ask Mr Collins to come forward to a microphone um stay there please miss love would you SI yours to Mr Collins I'm trying to figure out if you're renting the property um even the buildings are occupied yes yeah okay yeah are they allowed to be occupied right now I guess I'm at that's my question for staff do you want to take that or yeah somebody answer the question please if they're not if they're not we need to deal with that and you need to not have naked people run around your proper technically no because they never received the certificate they never received this conditional use permit to provide the density so that they can convert those dormitories to housing uh they needed a BTR they need to see you but in order to legalize it this is the step that needs to be taken so that now they can get their CU and BTR and come into full compliance compliance okay how many people would be displaced if we were to turn this down tonight turnning Shing his head I don't I don't often right okay I don't often defend uh this sort of thing um but I can tell you that this this discussions I've never spoken this gentleman here but I know my office these this this question's been coming up for at least a year maybe two years where where we were trying to figure out what to do because the issue was this was a dorm Johnson and Wales went away I remember and then we had to figure out what to do and there were all sorts of I I know I I don't remember the exact issues but I know there were number of issues before we came and said hey the best way to resolve this is for them to come into for a cup so it's not entirely their fault I can tell you that much that this has been we heard spoke about this yearo building if I could out a little context there there was some back history here when the property owner initially bought the properties the zoning is PU public use which it still is today actually the property owner attempted to pursue a rezoning application for these subject properties at the same time they were doing physical Renovations and they did get a building permit to make those improvements of light light improvements flooring cabinets windows Etc we were directed the property owner was directed to withdraw that application and was told that the city was rezoning the entire campus and it didn't make sense to do peac M rezoning of an assortment of different properties so our client withdrew the resoning application um I'm not sure what happened with the city's pursuit of resoning the entire campus remember that happen however upon however upon discussion another route to changing the use of these is this conditional use application which is why we are here MH think I mean to my knowledge the the owners put a lot of investment into these buildings there's security there um I can't speak for one particular potential tenant that this gentleman here saw but to my knowledge they're very well operated managed um okay thank you my initial thought was like you said um Scott if it's not a homeless person is this somebody that's taking a tan I'm not I don't know but I didn't really you have anything no no no um quickly I just want some um clarification on um that aspect because um when we asked um Debby if um this place should be occupied the answer was tech tech technically no but now we have uh an explanation from uh our um city attorney and everything so now I think there's something that doesn't um sit well with me is like is it the process or what is what is going on because if technically the building is not supposed to be occupied now we have people in there um are they up to code and all those kind of questions um do you understand so that we have to take this U aspect into um consideration when looking at uh this whole um they are up to Cod they have received building permits they have received um uh they're good to go the they're in the train station overlay District which allows the residential use which is why um they needed to come before you for a conditional use permit so staff is recommending approv approval yes to legalize these uh Apartments um and their Inc then make sure that they're in compliance with everything so they do meet building code they do meet the minimum size unit size so staff is recommending approval no now legally speaking at this moment uh is the the question again do they have a permit to you know have of um people window by the Florida building code yes but they would need this conditional use permit to actually allow people to live in the units because they technically don't have density so you're going to give them the density that is necessary for them to be occupied so they do meet Florida building code for occupancy they just need this last step to legalize the apartments and uh and staff is recommending approval thank you so very much councilman you have more questions I I I do if God forbid something happens tonight at that building if if something happens tonight where are we like is the city at fault have we allowed anything that again this is a very unusual situation get it yeah it's and it's and I and I have to tell you it's not completely their fault I mean I don't remember all the details but they they I'm just asking on the record I'm not I'm not faulting anybody I'm tring I mean this is probably two or three uh city managers ago when when this issue first came up so I I would tell you this step tonight will make them legal it'll allow these dorms to become apartment buildings and then we're completely fine but we have to do that if not then you're sitting there with building cuz part of the issue that we had was that this isn't someone coming to ask for new units in order to build a building these are buildings that are here already they were already apartment buildings it was because Johnson Wells purchased them and it became became a pu now that he's reminding me all that that we changed his Zing but they were always apartment building so it was it's been a really weird situation with those apartments but if it's passed tonight then they're they're completely fine and I I I actually recommend that pass I'm okay with everything that you said but we also agreed that they did not go to the pop process right the Occupy first and then come back that's what I'm telling you there is there was no process you know what the gentleman said is correct I remember this happening they were they and I think that was that back when Tanya was here because I think it was it t yeah it was when Tanya was here originally when Johnson Wales left the city had made it well the city staff had made the decision we were just going to change the entire zoning of the property so it made no sense for individual Property Owners to come in and try to change the zoning somehow or another that Chang and all of the the staff changes so that again I'm I don't like being their attorney I'm not trying to be their attorney but I'm telling you that they did what they were supposed to do a lot of it was was is record Debbie Love development services before you is a uh site plan approval request for this project it is um eight an 8 story 31 unit apartment building has an amenity deck uh a little over 1,700 square fet of ground level retail space six ground level parking spaces and an integrated parking G uh Carousel with 48 spaces integrated means it's within the envelope of the actual building uh the parcel is a little more than a third of an acre and uh it's located at the 14440 Northeast 6 Avenue you can see the location up on your screen it's a currently it's a a vacant high density R six parcel it is also located within the um Northeast 6th Avenue PCD uh and which allows up to 100 dwelling units per acre through a conditional use permit you all approved the conditional use permit um about actually almost a year ago and uh through and so you've seen this before you've issued the allocation for the additional dwelling units now the site plan is back before you uh as you can see the uh the DRC has already reviewed this because they did they did site plan review concurrently um with the cup and but they had to do some tweaks to the site plan um and come before you for the cup all as as you can see on the screen uh we have some recommendations uh for the site plan that comes out of DRC and also aligns with the conditional use permit uh such as installing all the utilities Underground um enhanced storm water uh and um obtaining the BTR and CU with that that is the end of my presentation the applicants representative is here they do have a very brief presentation for you grown up in this area and uh we've done work and we're excited to be here uh to present this project to you again through this this interesting process that the the city has this great process um our clients are very excited to have this project in front of you um it's a it's a very it's a prominent Corner that's been vacant for a long time on the corner of 145th in Northeast 6th Avenue and um with the requirements of the city we're giving a a Civic space in the front um the building is going to be green it has some art incorporated into it we have a very interesting Corner uh and a very nice mix of one-bedroom two-bedroom and three-bedroom units with retail on the ground floor and um our client uh has agreed to uh provide all the items required from within the code and the requirements of this process would you like to come and run your own presentation sure if I can see it there thank you you're welcome sir I just push shift so this is the this is the view that that you'd see from the corner of 145th and Northeast 6 you can see on on the bottom um how um we wrap the corner and we have balconies turning from side to side to make the corner very interesting and exciting for the neighborhood and for the residents this is a view coming um from Northeast 6 uh from west to east there every unit has balconies you can see down below some of the retail space and the trees and that we've required to we've been required and included along with green space for drainage and active space for people to enjoy the um walking into the building and there's uh enlarged sidewalks along 145th and uh Northeast 6th and you can see on the top there that we have an amenity Deck with a pool for the residents to enjoy um that's then there's floor plans and you can see in this floor plan all the green surrounding the corner and how the building is set back from the streets giving uh The Pedestrian area back to the pedestrians um so I if you have any questions I'm I'm happy to address thank you so I'm sorry thank you so much um before we let the council member for the district um speak let's open it up for public hearing on the item um I didn't see any card so with that being said that is done Vice yes thank you so much for your presentation um first of all when will when when will you commence and when do you anticipate ending so it will probably take us four to six months to make the construction drawings and then another four to 6 months to get a permit so probably 9 months to a year you get out of the ground and then about another year to 15 months to build so about two years um and and is this um is is there um affordable housing or Workforce housing yes set aside 20% I believe it's 20% set aside yes um do you know what those those rooms will be the would it how many twos and ones have you decided so we yeah the the the building has um 12 one bedrooms 13 two bedrooms and six three bedrooms so it's a good mix a variety and 20% will be for yes and we discussed um the project and uh the affordable housing and things like that yes but at least four months ago if I anyone any recent I don't think I've met with an applicant but you said affordable housing at what Ami are you doing your affordable housing I the maximum I believe is 120% oh W but that would be the maximum they they they're they want to fill the building up so they're going to work with the the community to provide the best possible rate this is this is great vice mayor move for approval no just one quick question about um I think um last time there was a lot of questions about entrance and um exit from the building M oh next near Elementary um and we'll talk Talking um not to have uh that on Northeast 6 Avenue which that still the plane with uh no the the driveway is on 145th Northeast 6 is there's no access all the access is from the from 14 away from the main yes okay yes we made sure to do that yeah very good okay it's a good question thank you move development consisting of a 17 story 348 unit residential building with approximately 40,000 square ft of ground level commercial space and 636 parking spaces on five Parcels of real property located at 1175 noreast 125th Street 1195 noreast 125th Street 1174 Northeast 126 Street and 1140 noreast 126 Street and three adjacent vacant Lots set Parcels are specifically identified with Miami dat County folio number 06- 2229 D 0344 06- 2229 034 068 06- 2229 D 034 d001 0 06229 I'm sorry 06- 2229 d0 34-2 06- 2229 d0 34-30 06- 22 29-0 34- 0570 06- 2229 d34 d80 and 06- 2229 9- 034 0580 and total approximately 2.32 Acres which is approximately 10,300 ft in accordance with article 3 division 4 section 3-42 division 3 section 4-31 0 of the city of North Miami code of ordinances chapter 29 entitled Land Development regulations providing for effective date and all other purposes this item was tabled from the October 22nd council meeting tab o thank you so very very much um a quick you councilman Miss love hopefully this is the last time you'll see me my smiling face tonight it's : again Debbie Love development services department the item before you as uh read by the title is the request for a conditional use permit uh to allocate 348 floating bonus units from our uh bonus pool um and all of those locations again that that um the U was read into the record it's a little under 2 and 1/2 acre site alog together uh currently it has a multitude of uses including some Office Buildings parking lots and some vacant Lots uh it's Zone C3 commercial and it's in the Central Business uh commercial District as well which is our essentially our downtown it's in three overlay districts the PCD the the Arts and overlay district and the north Miami train station overlay District so it is envisioned as part of our to master plan um as far as building a Transit oriented higher density development in this area uh in the to it is at 200 allows 200 ft in height and 150 dwelling units per acre under the current zoning under the underlying zoning there is no residential allowed the proposal is for 17 story mixed juice residential buildings um with a 348 unit again about 30 a little over 39,000 Square ft of ground level commercial space uh an integrated parking garage with 638 spaces uh 100% in forer Native public Arts once again enhanced storm water requirements it was approved by Planning Commission um they recommended approval as 60 uh and their at their October 17th meeting the economic impact for this is at 4 14 a little over 1,400 short-term direct and indirect jobs um with about $44 million in wages during the construction period a collection of uh $1.2 million annually in adorm taxes with a partial capture by the CRA and under the current impact fees it would collect $5.4 million and once again um when they do submit for a building application assuming it's after the 90-day window they would be subject to the change in Impact fees uh we do have conditions that came out of the uh DRC review that are recommended it's a 10ft wide sidewalk along Northeast 125th Frontage 6ft wide sidewalk along the northeast 12th Avenue and 126 frontages again we're getting all these utilities undergrounded which are make it the city more storm hardened um they do have some sustainability commitments and public art so the next steps assuming you prove it the the cup this evening is they would come back to us for DRC review uh for the site plan and come back to you ultimately for the site plan just as the other projects I've done with that that is the end of my presentation we do have the develop ERS team here that they do have a brief presentation and they are here to answer any questions you have and let me pull that up for them and then you can come over here and run your PowerPoint okay Miss love um while you are setting that up there's several people who sign up to speak on the item um but Mr okay go go ahead go ahead you you Arthur Sor Sor Solutions it's been my privilege to serve as the consultant for T take Capital um in the mixed use development 1195 Northeast 125th Street 11 75 Northeast 125th Street throughout this entire conditional use Pro process we've worked diligently with the staff uh with Debbie staff uh to ensure this project meets the city's goals and objectives and vision we're excited to present this Innovative development which promises to enhance the area both with the residential commercial as well as the recreational spaces that are in place we believe the project will not only boost the local economy but it will know continue to make this downtown area very vibrant in you know with the train station and everything coming in the future so um couple things that I do want to point out prior to us moving forward with our present ation um we did go the highest point at this building will be 15 Stories the stuff the top makes at 16.7 um 167 ft um we did have the 200 ft um designation that we could have went to we made sure we were under that um also we were afforded through our development um the 15% reduction in parking um letting you know that we've only took advantage of .7% of reduction in parking so we have approximately 68 additional spaces that we do need uh and required to have by the city um two things that you'll see in Mr Bear's presentation is that we did on 126 Street take into account the commercial space which will be um we consider uh some type of grocery store Farmers Market something there there's a entry and a ramp for that entrance there's a completely separate ramp and entry for the residential parking um and they you know can't be comingled and then there's only entrance on 125th street for the commercial vehicles to come in everybody will exit outside the dumpsters and everything are inside enclosed within the property um so those are some things that I did want to put on again um as the Director did point out we are in our conditional use permit process right now um we do have to come back before this board for site plan review and other stuff at this current moment we haven't asked for any CRA funding or anything at this current moment um not sure if that'll happen in the future but everything right now we've developed um is going to just be as of right um building um and we look forward to your support right now pass out to Mr Robert bear with bear good evening Mr mayor council member for the record Robert bear be fun partner 4533 Pon thank you for the opportunity to be here I'd like to start by commanding staff Debby Derek Derek as for being outstanding working with us in this project I I'd like to make before we go into the project a couple little Corrections here um it it's not a 17 story building it's a 15 and 16 story building total height is 167 feet 4 Ines we 200 feet allowed the parking we got a little change from what we had a meeting last week with the community and what we done now is we comply 100% we have a total of 683 parking spaces we're not taking any any deduction reductions whatsoever we have 522 spaces 1.5 * the 348 522 plus the 5% 27 that gives us 5 49 spaces for the residential our commercial component is approximately 40,000 ft and we have 134 parking spaces dedicated for the commercial again a total of 683 spaces we're not seeking any reduction whatsoever that's something that we did in the last couple days after listening to the uh to the uh neighborhood um if we start the project it is a mixed use project uh 348 I think it's going to be a very exciting because we are bringing a commercial component not a very big re uh uh grocery store as approximately in total between the two retail comp areas that we have about 40,000 square ft what we've done is trying to do something that is really activate 125th street because what we've done is put the um you can start we don't have the enter enter okay this is the location of the site you're very familiar with it right you know right in front of the gardens project which is right to IM midle to the north that that project as you know it's almost completed it's between 8 and N story building doing very very well and this project is is fronting 125th which's nice about this is that we're really activating 125th with with habital and Commercial spaces fronting the the street you can see the on the on the corner on the Eastern portion of the side is where we're going to have the uh re uh the grocery store again not a very big all the service are going to be down the middle internalized seal not visible from the outside you have a one way in one way out on the back on the left side you have a small uh retail space and then you have one of the entrances to the lobby on 125th on the back side you're going to have two dedicated uh entrance for the garage the one on the right towards the east that's dedicated for the uh commercial component and then the one further to the left is dedicated for the residential so at no point you're going to have a commingle between the ramps they're going to be dedicated uh throughout as you go and then all the internal spaces inside when you the the the second floor which I was calling it mezanine but it's really you know if we call it the the second floor where we added the additional spaces that we were short before now we're in full compliance you're going to have come in and that's going to be dedicated this this this level for the residential on the on the on the right hand side you can see it's open because the the the grocery store will be much taller than than the residential you keep going up the at that point the you're going to have parking for the residential on the left side parking for the commercial on the right side that happen for floor 34 and up to keep on the fifth floor then above the parking pedestal you're going to have on level six you're going to have the first level residential and the amenity floor what's really really nice about this is going to have a really large residential floor uh area which is going to be a lot of the amenities it's going to be a really really ample space that goes through floor from 7 to 16 on both sides here is what I'm showing on the right hand side where is it's really 15 stories on the left side is 16 stories and you start seeing some of the of of the rendering where you got the grocery store on the right hand side which some of the walls will be dedicated for artwork on the left side you got residential unit and what we've done is we have lined the parking garage with residential units so we could activate and bring more life to the street so it's not just a blank garage fronting uh 12 125th on the side that's that's a that's a view on on on uh 12th Avenue um um and then what we done is we accept the condition of the of the uh uh requirement for the sidewalks the 10t and the 6ot sidewalks and you can see as we go along where we trying to incorporate some of our work throughout uh this is just some maral view of the site but again I mean I think this is a very exciting project the we bring a a grocery store not a big grocery store and we bring the residential uh units to the to the site that concludes my presentation if you have any question I'm here to answer thank you very much thank you so much um there are um several residents Nicole yes right here no no those were I you spoke these are the new good evening Nicole Savage Jo 1503 Northeast 127th Street um I'm also I had a business in the building next to the tape building and the gardens and when all these new aqu um there's not going to be any office space for businesses in this proposed um space so there'll be a a 400 no 40,000 square foot um Store where the employees can't afford to live in the building um 134 you know parking spots uh for the for the customers but where are the the people working they're going to park there's no other um space spaces allotted for um other businesses so where are all these businesses are currently in the tape building um going to end up and and um the traffic is horrendous on 125th it's next to a school there's a school zone which they have issues already um there's the trains when they slow down then there's going to be a 20 story building potentially um across the tracks and like at what point um you know all all the traffic analysis says you know oh no this fits our equation but I don't like Common Sense would you know say otherwise and so how what benefits are there for the community is there a Park oh there's going to be a nice little piece of artwork you know I mean there's not and this you know do we need really another grocery store I mean I didn't WR I I don't know but between there's you know what is it offering the community uh the business owners that might you know be displaced um the people that work there can't afford to work there I mean is everyone going to be on bicycles again because of that what what was discussed on the building um that's behind this on 126 so I don't know it just it's like at what point is are we oversaturated thank you so very much Miss Davey and Mr Davies 36 by two minutes okay hi Deborah Davies 1165 Northeast 127th Street this project has been rushed through the Planning Commission and now a cup hearing before our election is even over we all know that the critical time to make changes to these plans is before the cup is granted we need it included in the cup that there will be Community benefits agreement with the community that will meet our needs not the asks of the mayor and the council people this plan includes a supermarket on Northeast 12 right across from the school pickup and drop off area from WJ Bryan the delivery trucks will exit and block Northeast 126 Street a small neighborhood street where children walk to and from school and cars already get backed up waiting to drop up drop off and pick up their kids this neighborhood cannot handle another huge development before you addressing our Antiquated water plant and other infrastructure these new developments are being built with their ground floors High higher than our existing homes and we are already experiencing worse flooding caused by the gardens residents I have heard that the I have heard that the Miami Dade fire department will not allow full occupancy of the gardens until the city fixes the low water pressure and now you are considering a 17-story commercial and residential housing building for this block what right across the street this is a public safety issue the developer claims that the surrounding area is just Northeast 125th Street the school and the gardens residences but it is only one block away from single family homes as you can see in one of the slides that maybe they showed just now where North miamians have lived for many years we are part of this neighborhood too and we are concerned about traffic parking and flooding in our small neighborhood streets I agree wholeheartedly that we need new housing but this plan is too big for this location please remember that this is not New York which has a working Citywide public transit system and a real urban planning process New York does not leave it to private developers to randomly redesign the whole city each block at a time thank you very much I hope you really think about this thank you so very much Mr David yes well um my presentation was will actually not be what I thought it was name and address for the record please this even Nicholas Davies 1165 Northeast 127th Street um what I have to say first of all is thank you to uh Mr Tate and uh and his team for actually giving up what the city wanted to give them a reduction in from the 1.5 per unit minimum required parking spaces um as we all know this was first the first development to receive such a reduction was the gardens residences but that building is not even fully occupied yet and yet since really beginning this experiment with uh a reduction in the minimum parking spaces you have granted that reduction to many other new developments now we are going to see very shortly now when the gardens residences is finally fully occupied uh what the real world impact of that parking reduction really is and as each of these other buildings things that have got the parking reduction is completed one by one you are going to see what the impact is and uh if in fact we end up as we have we and our neighbors have feared all along with these buildings all around the city with not enough onsite parking then I hope that you will rethink that entire policy and I've asked Miss love to conduct a thorough review of that policy but I just thank the Tates for having the wisdom to provide enough parking for their tenants thank you thank you so very much sir God bless you um I think that's it for all the speakers um if we have any we'll have some time for rebuttal um in terms of up here with the council I know um councilwoman this is in your District but from my understanding um Mr attorney that's why I had to ask you this this is just a CU application right this is a conditional use per conditional use appliation and I yeah no okay because I'm hearing other you know cuz I was a little bit confused in terms of um some of the stuff that was mentioned by Miss um Davey um in in in this stuff so councilwoman you want to sure thank you mayor um I just want to thank the applicant for hosting the community meeting I know it was late I wish we could have done more to engage the residents so that they were aware of this magnitude of this project um but my question is to staff um especially since Miss Davey brought up the water pressure my question was going to be in terms of making sure that the infrastructure is in place um for this project um I know I'm reading what Public Works St but is this something that is going to affect um their project in terms of like the water pressure and so forth I don't know if M manager someone can chime in De love or public work we look at um we look we request from Public Works whether or not there's adequate capacity and um as far as the details that would be more the public works okay if I may come I may answer that actually your water pressure for for this building comes from Miami day County doesn't come from the city of North Miami say that again please the the water on this particular site comes from Miami day County it does not come from the city of North Miami so the the the pressure that is there is for this project adequate more than sufficient again it comes from the county doesn't come from City of North Miami okay and I know there was talks about a grocer and I know you guys stated that um you don't know what um you don't know what what grocery will be part of the building but an issue did Arise at the meeting about where um where the delivery trucks will be coming in and making sure that it's not coinciding with you know affecting the traffic for schools and so forth what mechanism do you guys you know plan to put into place to ensure that there's delivery at what 4: or 6 a.m. is what you guys stated at the meeting and and all that will be coordinated and especially with the drop off and pick up from the school but everything is is is is done internalized if you see that this exhibit which I am trying to put on there the the the drop off the you know the loading is right in the center of the building so the the truck will come in from 125th and the idea is really is to go towards the West make a left turn and go out 126 in front of the and then go back to 125th um but it's internalized and everything will be coordinated we we are not at Liberty to to to give any names at this point you know so I but there's idea not going to be a big grocery store it's not a not a supermarket it's going to be something more you know compatible with the neighborhood the convenience and I use my where my office across the street there's a tra is jokes well you know what I could see not only all the rest myself walking across the street to to the to the trader JS which is convenient and this is something that's going to do the same for this community you're going to see a lot of people in this area walking to the grocery store or the residents coming straight down to the groceries yeah M Mr beart go ahead I'm sorry my last Point um time I know there's a point that says that it should be compatible with the nature condition and development of adjacent uses building and structures and when not adversely affect the adjacent uses buildings or structure um I do feel like this building is a bit out of scale with what is planned um in the area and will kind of create an aers effect um there are plan development there were developers who did come before me who wanted to build 20 stories but after speaking with their neighbor they brought it down to 12 or they brought it down to 11 I think this one is one that is you know pretty huge in size and um I think it will have an adverse effect so tonight I'm not in support of the project that which we would have discussed it a little bit more maybe had some concessions I know you guys are asking for bonus units um just to see like where we could have met in the middle so for as as for me I would not be in support of the project tonight thank you okay thank you so much um councilwoman I'm looking at Miss um deie um um Deborah dy's um you know message so a lot of the stuff was what um the council woman was mentioning in terms of the TR the the traffic the delivery of the truck and I think you you had to um address address that so they won't be if they you you saying they would be leaving going West on 126th Street so how would they get back on 125th would it be on 10th back on 10th half or would it be going through Mr Tate's um other building to get Mr Tate's property will be you know all part of this site the 2.3 Acres so if if anything they will go oh okay so it will not go through the you know Mr taste proper it will go west and I think we have the traffic engineer here that could maybe address that more my question is if it's going West on 126 Street to get back on 125th so it would be going back on 10th right that is that' be correct that's correct and just for the record Cory Dorman with Kinley horn offices at 2 alhamra Plaza sweet 500 Coral Gables Florida 33134 that's exactly right because there's a traffic signal at Northeast uh 10th Avenue in 12 hist stre that would facilitate the trucks to return either East or westbound along 12 125th okay all right the other question was about the swer which I think was mentioned um the ERS getting coming from Miami day County um okay what else okay the the scale so councilwoman um I think you you said you you did talk to the um the folks um you you had requested the meeting yeah I requested them to have a community meeting okay mhm okay awesome so thank you so much um I it's so far that's basically I'm Council woman um councilman any question no um quickly that would be for stff on um staff analysis uh page 9 of 10 uh the on the first point said uh density uh bonus I see that we have uh 195 but in terms of numbers 348 was that be a a mistake just take a look at page 10 you said page um n N9 of 10 number one first line the city will allocate yeah that's the that m is a typo there it's 348 yeah because as I was looking at it um like everywhere uh on the one that you guys have online you just keep on repeating so me for floating units I always want to know what are we doing about affordable and Workforce housing can we commit to you know 20% um U sorry um Vice right so I just want to make sure that you know right now with how we designed how the building was designed and everything that we've had we haven't you know said that we're doing anything besides putting this building together as we sit and go through and possibly seek you know CRA funding or other benefits from the city then I mean I think that's when we enter into that conversation work so I I hear you um but I want to know that that is on the table oh it's definitely it's definitely a possibility and on the table without a doubt most I'm looking to have 20% because again like I always say if we're think getting things if you're asking me if you're asking me for support then I need to give back to the community and and as you know housing is an issue and so I you know so this is this is my well this is my ask is my community benefit that I would like to ask I want to be supportive of this project but I just want to know that we can set aside some dollars especially if you're talking about revisiting the C which is another thing but I'm I just want that on and and definitely uh Mr Tate did you know say that that's on the table his part and he wants to talk about that you know after we get through this proc process how do we move forward with talking to the city about possibly C8 or something again all of that comes during the site plan and do we do have to come back to you for the site plan but it is definitely the table but you can rest assure that that is on the table and that will come up and and and and Mr T will be committed to to work with the city on on making something good to happen to the community and that is also the point once we get to the site plan is and with that what we bring I did hear Miss David mention the community benefits all of that stuff does happen once we get to site plan approval so that's um when we'll be looking and locking down and meeting with everyone to determine what the community benefits will be from this project to have them for by the time we get to site plan thank
