behalf of the Haitian Heritage Month committee we present this these scholarships what but I want to give you just a little bit of background around the scholarships and what was done we decided that this month we wanted to do something that not only celebrated and uplifted Haitian Heritage but also brought the community together to learn a little bit more about Haitian history especially locally and so what we decided to do was an 18.04 mile bike ride anyone who knows me knows that that was not my idea it was the idea of John lfus our intrum Deputy City manager and John had us convinced that we could all do it and I want to say that I completed an 18.04 ride thank you thank you Claudia it could have been on a bike it might have been in a freebie but it that doesn't matter it's not the point and the point for us was let's not just have this bike R let's not just learn about something but let's also make concerted efforts to invest in our children and so what we did was took this bike ride as an opportunity to provide Scholarships in the amount of $184 to children who are actually graduating seniors and so it's with great pleasure that I first off welcome the uh Haitian Heritage Month committee to come up please and join us for these presentations yeah because without them that none of this would be possible and what was especially significant is that we reached out to folks that we never reached out to before for support on this and the way that they supported us was tremendous and so our T our presenting our Platinum sponsor actually was the children's trust who made it possible for us to give out four donations after that y go ahead Give It Up [Applause] after that we had the EC Management Group and so whenever I introduce them as such they're like it's our financial quarterly update followed by um City announcements and I don't think I see any appointments so we'll just right after that we'll just get right into um the agenda yes ma'am good evening mayor and Council my name my name is Angela Reyes I'm the Chief Financial Officer and tonight we're going to present our first and second quarter un audited Financial reports to do the budget presentation Roy Brown the manager of our budget unit will come and present all right good evening honorable mayor council and residents I'm Roy Brown budget manager for the city of North Miami and tonight we'll review the city's fiscal year 2324 first and second quarter report uh this report covers the periods from October 1st 2023 through December 31st 2023 and January 1st 2024 through March 31st 2024 respectively at the beginning of the year the budget was adopted at $28,988 47 throughout the first quarter of the Year October 1st through December 31st the budget was amended by $24.9 million bringing the total to 233 mil4 5,498 this increase in spending Authority can be primarily attributed to purchase orders uh in the amount of 16.2 million and reappropriations totally 8.1 million po rollovers help facilitate the continuous procurement operations by allowing unspent funds from a purchase order to be rolled over to the next budget cycle while reappropriations are funds from unspent projects that may span multiple years uh the reappropriation process provides a little budget flexibility to accommodate delays unforeseen expenses or changes in scope of work in the second quarter of the fiscal year January 1st through March 31st the budget was amended Again by an additional $1.9 million the total amended budget after the second quarter is $235,900 1868 from a city standpoint from a Citywide standpoint my apologies in the first quarter the city collected 24% of budgeted revenue or 55.9 million of planned Revenue by first quarter standards of 25% we are on target the city's expenses for the first quarter are at 16% or $37.4 million which is $18.4 million less than revenues which is always a good sign in the second quarter Citywide the city collected 41% or 97.3 million of planned Revenue while while spending 35% or 81.8 million of expenses revenues exceed expenditures by 15.4 million as of March 31st 2024 there's a few things that I do want to highlight first the general fund revenue and expenditures are on target relative to the 50% threshold for the second quarter Enterprise funds are at 177% primarily due to the 35.6 million in the prior Surplus account despite that 177% Revenue collected the revenues for the sale of the city's water and sanitary sewer Services remain healthy and timely lastly uh special revenue is at 63% through half the year and this is primarily due to money received for impact fees and the building fund exceeding Revenue expectations building fund has already collected 6.9 million through two quarters of the expected 5.6 million good job building next impact fees are fees imposed on new development projects to help pay for additional public services and infrastructures uh required by that development if you navigate to the uh impact fees line You'll see that we've collected 1.5 million of the expected 880,000 this snapshot is uh a snapshot of the categories for both revenues and expenditures uh in total for the first first quarter 36% of general fund Revenue was collected property taxes are at 70% as you can see um at this time last year we were at 76% charges for services and other taxes such as local options gas tax franchise fees communication Services tax and waste collection tax are normally received one to two months late uh and you will see an improvement on the next slide in the second quarter to shift gears a little bit uh Personnel Services salaries French benefits are all slightly above the threshold of 25% for the first quarter and this is primarily due to the large pension payment made at the beginning of the year in the general fund for 5.8 million operating expenses are on target 27% internal services are on target at 25% Capital was below the 25% threshold and this is primarily due to some projects being in the prelimin stages or just haven't started yet last year at this time the general fund has spent 30% of the budget so we're comparable to last year this slide shows the same bit of information but for the second quarter as you will see property taxes are at 93% which is the same as last year at this time other taxes are at 42% which is comparable to last year and still on target licenses and permits are above the 50% % threshold and this is primarily due to revenue collected For Occupational licenses exceeding expectations intergovernmental revenues and charges for services are on target overall the city revenue is at 54% and is on target expense categories for the journal fund are also on target at 45% close to the 50% Mark here's a breakdown of the depart Department spending for the first quarter um as you can see uh for the we are at 26% for the first quarter that's 1% over and we're on target for the second quarter there are three depart two departments that I would like to highlight um that are slightly above the 50% threshold and that is Personnel they are slightly above the 50% Mark and this is primarily due to Citywide training efforts next we have police at 50 7% and this is primarily due to the largest pension payment made in the general fund for 5.1 million all other departments are on target thank you for your time and your attention and I'd like to pass it over to our CFO Angela thank you Roy now we will start to look at our cash balances on the screen you will see that on our first quarter we had a balance of $ 63.2 million which is where we get our largest deposit for our property taxes and you'll see a decrease of $4 million in our second quarter leaving us with a balance of $ 48.3 million this is due to our payments um out to the C and our encumbered POS from prior year so we take a big dip in January we get the money in and then big dip in January goes out this is a trend analysis of how we've performed since 2015 this is the from the second quarter of fiscal year 2015 through our second quarter fiscal year of 2024 the increase or the peak increases you'll start to see is due to the arpa funds and right after we get the arper funds in in September of 2022 you see another increase in December of 2022 which is when we get our property taxes and then we go back down to September 23 where we're um we've already earmarked our arpa funds and we have our projects going out and then we go back up as regular Trends in December of 2023 when we receive our uh property taxes for the year our operating account inflows and outflows for the first quarter are an overall of 8.5 million net and inflows and our average inflow and outflow from January to March which which is our second quarter is um an outflow of 4.9 million so on average every month it was 4.9 millions that outflowed for expenditures that will conclude our financial report presentation um I will take questions thank you so much um Angela and and Roy I I have a few minor questions but I'm going to go ahead and let my col colag councilman gin no questions right now vice mayor yes thank you thank you so much for both of your presentation um well detailed um I have a question for the reappropriation of um 8.1 million is that on the second quarter or first quarter um actually it's the same number for first and second so could you tell me what has been reappropriated we can get a detailed report on what's been reappropriated but 8.1 million you have that you can give it to Y Roy has that for you it's a combination of things that that com you what the bulk is or it's okay fact you make a copy thank you okay can have that um you also mentioned about the pension so this year there was a pension payment could you explain that it was more or yes uh every year at the beginning of October uh the beginning of the fiscal year um for those employees that are not in the F FRS Pension Plan there's a pension payment made at the beginning of the year um to cover to cover our Personnel um this year the total amount was uh for all Citywide was in the $6 million Mark have to go through my notes to find the exact number I know specific specifically for PD it was 5.1 million M Jesus is that abnormal is that that's normal yes that's completely normal also I I don't know if personnel has to answer this but there there's been some extra training for personnel which I'm very happy about just wanted to know in details or overall what were the training do we know she's not in our personal director is out for a family emergency so she was not able to attend tonight okay nobody so I have to nobody okay thank you that's all my questions for now thank you vice mayor councilman uh yes um thank you very much mayor um thank you for the presentation and um I like the numbers now um before I um go and have a party so would you please tell me um at this point now what is the you know Financial Health of the city so we in good standing so right now we are uh financially healthy um we are financially healthy right now uh you know we're at at the beginning stages of being financially healthy as we you know continue and arpa funds are no longer available we're starting to do a lot of projects so we just want to keep that rhythm going beginning stages of uh being healthy meaning that we need more medication right we need to yeah um so in term of that medication so what do we need to do at this point not only to uh stay on course but you know to even um do better moving forward so we need to monitor our expenditures and um we also need to diversify our revenues just look at other avenues of increasing that okay uh expenditure so we know we have to uh uh spend anyway but when you said uh we need to uh modify our expenditure so can you please um elaborate on that things that we need to do so because we don't want um a quarter from now and then we have a um report that look totally different correct so at this moment we're on target with our expenditures that we budgeted for we just need to remain On Target and not go over that Mark so we are still within the range by in within our second quarter of expenditures there are some departments as Roy highlighted that we will look at but overall we are still on target with our expenditures according to our budget report thank you very much mayor I I you know I just want to State for the record are there any any concerns or any any any advice or anything that you want to State on the record in terms I know that you're saying that we're in a good position right now but are there any uh concerns that you want to highlight or state on record so we're in the beginning of a good Financial Health right so for the record it's the beginning of moving forward um uh for honestly just the conservative conservative ISM right is that it that's right of um just being mindful of of staying on track with the budget and not going honores to the citizens Hall of Fame providing for an effective date and all other purposes tab B thank you so much um since I'm the maker of this item couple months ago we I was talking about doing the um annual event that we do with the Hall of Fame and when I asked about the guideline it was pretty much it's it's an old um guideline for many many years so they needed to revise some stuff um so staff work with the I think with with your office Mr um attorney to draft some of the things that would make sense um I think Kia I don't know if there's I don't know if there's any presentation in terms of what was changed from it um I know it was minor I don't know all of the details but I don't think it was it was things that to clean it out to make it make make more sense for my understanding I can go through the changes May um so the the actual guidelines are exhibit a to the uh resolution um originally on section three it uh required that uh nominations should be sub submitted in writing that was removed um in section four it was required that uh after the vote the nominee would be um inducted at the following at the next regular council meeting um and we just Chang that to a regular city council meeting uh number five uh there was a there was language that said that all efforts should be made to uh have induction ceremonies coincide with other major event City events we took that out um number six oh I'm sorry number seven going to number seven um and this is pretty much the the M the major change in this uh in this resol in this uh ordinance it's um so originally uh number seven read that elected officials shall not be eligible for induction during the time of their term of office um and the way it was stated it meant that no elected officials could be um uh inducted into the Hall of Fame uh there was question of whether that was the intent at all in the beginning so we've changed that to city of North Miami elected officials shall not be eligible for induction during the time of their terms of services um and remove the requirement there's a a Prohibition uh for three years thereafter so originally you would you would you could not be um uh inducted into the Hall of Fame uh for period of three years after you've been elected official so that was removed those are the changes mayor okay thank you so much um any discussion on on was being done and why it was being done could have you know the historian on this you could go ahead and let us know yeah no I I I think that and actually this is one of those things that dates back to the 80s like so I wasn't on the council but I think I don't think that when when was this I'm sorry Mr attorney when was this the change done I don't have that those were doing I mean the the board itself goes back to the 80s I don't know when any addendums were made I apolog I don't remember that well actually I'm sorry it's it's actually in the resolution it was uh it was resolution 2 2013 2013 2013- 97 I don't remember there being any I don't know why that happened I don't remember any that probably was on a consent agenda at that point yeah yeah yeah it wasn't nothing really major in terms of that and we only having it because it was told that you know this might be a good time to look at the agenda and make whatever changes that we want if you want to have it or don't want to looking at um uh for the um qualifications for uh number three for example so said Nom nomination shall be submitted and writing so by striking that out so how is that um we are going to make that um the the next regular um city council meeting so yeah um miss philipo you want to come I know you worked on there was a um there was an explanation when they mentioned it good evening Chiefs of Staff Kat fipo from the discussion it was in case there wasn't a council meeting the very next council meeting um it would be at a reg reg council meeting because in order for them to actually be presented as in this evening there's a bio that's needed to present to the city attorney's office so they can formulate the resolution in the event it won't say they had the in writing or sent to the manager's office yesterday today wouldn't be possible to have it presented so it was going to be at the next available reg regular so meaning meaning that um your number four number four would would still be good with uh into the next um the next uh meeting so just to give you to give um staff time and everything to revie so I I don't see the reason why um taking that out so meaning like say it wouldn't be at the very next regular account well the next meeting but a like it could be two meetings after that it depended on the time that they were able to gather the information to formulate the resolution CU I just want to make sure that we have uh precisions so if we're going to put two meetings so let's put it in writing so that at least we know we have it that we just don't I mean you could you could keep it that that just means that staff just have to work extra hard I mean I think that was the the intent of it um and I go would that be part of it meaning that staff would want would be uh terminated because if if she was terminated she just goes back to CRA um and then the only other thing was the Sal uh matches um the the current salary of the city manager so that's the those are really the only changes other than that the it's the same agreement okay so and this so this will be the the the the temporary agreement whatever that we have um um in terms of so for the interum position this only addresses the interim okay okay think we go ahead question then how do we how are we planning on handling a permanent that that's a discussion that the council needs to have that's later to come all right so on this I guess okay and I guess it should probably wait till after June 4th plays itself out okay okay no I mean no I think we we I was going to ask to put it do you remember what that take it's minimal it's about I want to say we around $60 maybe 75 for the VIP um I'm sorry no no oh sorry $60 for regular and then the VIP is about 70 75 um and with that you get everything food and um the tastings of all the things that are there and there's normally a North Miami discount right for residents yes there are there is a North Miami um employee and a resident discount that they provide uh that we get sent and we you know give out allow people and they don't check for that it's just open to whoever it is for that time frame and um and this contract is for two two years three years three years yes so I'll move to continue this to the next agenda so we can have Fu here too I'll make sure they're here and then if and a report on the north Miami businesses that they use for vendors for sure yeah I know they utilize they definitely do yes they're using the red garden now aren't they and also if I'm if I may add we need also to um take a look at um how much they charging us when we um the city having even over at their facility because they they just going keep on going up and up and up and uh we have to oh we actually I had staff run that number and it was about a million dollars that we give to FIU we do have that report and I'll provide that to the administration that's why I don't think it's fair for us to be paying them to do this so if necessary we would also work with the emergency Operation Center if we had a catastrophic event to you know fulfill our needs for pumps um but I mean we have you know 46 lift stations in the city we're you know we're not um we don't feel the need so so let me let me let me go to my district for example I think you just saw that um the Bree sweat pump um needs some attention right so yeah that's a that's a planned upgrade that's it wasn't there wasn't anything dire wrong with the station it's one of um four pumps that we're looking at right now to do um planned upgrades on those so we're just going through the pro procurement processes and um design and and then future construction for those upgrades but if we had an issue with that we could bring in a bypass pump and operate the station without issues okay is May Mr yes okay thank you mayor mine has more to do with um safety uh Mr G who's responsible to uh uh for those pums to keep the um the area when it come to because um there is one I'll tell you exactly on 126 in Northwest 11th Avenue I see pieces of equipment all over the floor and then is not being kept you know looks terribly bad so there there were um two pumps that that three pumps at that location um we've U brought it back to one um we do have extra hoses that are there but it should be fully barricaded if it's not we'll get it addressed tomorrow $170,000 providing for an effective date and all other purposes T I thank you so much um Mr okay so the the item that you have before you is staff's requests uh for your approval and authority to issue a contract to acre engineering and Construction Inc and this contract is for the award of a utility relocation project located along Northwest 6 Court from Northwest 135th Street to 143rd Street for a not to exceed amount of $170,000 so this project uh as reflected in my Council report is the result of a an agreement which the city and the council approved with the Florida Department of Transportation for a grant of easement along this relocation uh area and to relocate the utility infrastructure uh in in order to accommodate their I95 project for the Golden Glades interchange and enhancement project uh the city has agreed to relocate the impacted utility lines along Northwest 6 Court from Northwest 135th Street to 143rd quarter as I said and in return fot has agreed to reimburse the city for all of the expenses incurred related to this work in order to expedite this award uh staff worked in conjunction with the Consulting engineer uh Ross engineering uh to ensure that we would accommodate fdot's construction schedule for their golden glazes interchange enhancement project uh here with me in support the item is not only the interim Public Works director but also representative from Ross engineering young lady back here as well as a representative from acre engineering construction if you have any questions I'll be glad to take thank you sir um public hearing is you don't have any presentation yet um public hearing is now open on the item okay see none coming it's closed members of the council question yes thank you Mr Mayor um you mentioned that fot will reimburse the entire cost of the project and so so we're the one who we're the one who submitted the bid stating that it would cost 170 did we take into account any you know Miss cellaneous cost that may come if there's any damages and so forth is that included as well good evening again Jeff gimr Public Works um the 170 is the contractor's bid this was the lowest responsive responsible bidder um if there are the need for change orders if they get into the project this isn't the final amount that fdot's going to reimburse this is fdot's going to reimburse the cost of the project so if there are issues that arise and we need to address it and there is a change order if that would help um would cover the cost for that as well okay thank you is that it so I question you said this was the most responsible bit lowest they were the lowest and and they were responsive and so why are we doing a bid waiver we didn't well U again so in order to expedite this process uh we essentially worked in conjunction with the engineering uh consulting firm with Ross engineering uh to seek bids from it was I believe from six different contractors that do this kind of work um it we had to sort of kind of shortcut what would be the formal bidding process again in order to be able to accommodate EP Do's construction schedule so uh this was all fully bid it was again done in conjunction with our Consulting engineer uh there are plans and specifications ations Etc uh in fact you have on the second page the two bids that were submitted there were two bids that were submitted uh the other contractors did not submit a bid but I can give you the names of all the contractors that were sort of solicited to submit P right no I I I just want to understand you know there are times where this is the only um the only provider you know I'm like if we you know when was this put out to bid well again it wasn't a formal process it was actually issued through the cons uh through the engineers the Consulting Engineers and as you so stated Madame Vice uh mayor that sometimes you have to sort of FastTrack and expedite the process to be able to um you know award a contract that again is in line with what fot has requested us to do and have they worked with fot before and well remember we're going to be managing the project the city is responsible to do the work because it's our utility infrastructure so we want to be responsible to relocate the infrastructure uh what F wants us to do is to do that relocation right because that's an area that's already been approved by Council it's a grant of in easement of that area for f that for their project Madam vice mayor this the city has worked with this contractor and the other contractor that did submit bids um and we were able to um reduce our purchasing uh timeline by about 90 days uh by going through this method and we're already at basically the deadline for fot and this Golden Glades project it's like a$ 1.7 billion do project and we had to expedite in order to stay on the fot schedule any other question yes maam no quickly um when you said um utility relocation so we're talking about um what it's it's essentially relocation of underground utilities that's basically you know in an Essence that's what the project entails um and and it's that's exactly what it is is it be able to free up that area which is an area that Dan have thought is going to use for their project so so uh underground utility that include um just um power lines water and sewer water and sewer and everything oh okay so and power Lin totaling a little bit less than 6 Acres they're currently zoned Bay Shore I mean designated Bay Shore Zone on our future land use map which allows a height Max of 115 ft and 100 dwelling units per acre the applicant is profer some certain conditions that um for this uh uh particular Amendment and and you can see them listed here um specifically the parcels located south of Northeast 123rd Street and East of Bayshore Drive the applicant May seek a height bonus of up to 238 ft 10 in including parking levels through the conditional use permit uh for following certain policies in the that would be part of the actual conditional use permit uh this request tonight is to amend the comprehensive plan the text of the comprehensive plan to allow someone to come in one of the owners of this property to come in and apply for a conditional use permit if they say so desire to go above the maximum 115 ft height limit that's currently established this would be set for second reading as soon as we could uh as soon as it comes back from the state it has to get transmitted to the state for certificate of completion and then after about 31 days after they say it's fine uh then it will be take effect the second part of this is amending the ldrs now ldrs actually have about that same very similar language into that um with the added as you read before through the conditional use permit up to a maximum of 238 ft 10 in through the conditional use permit um they will be the I believe that they wanted to say it is a I wanted to say they were like gold I believe the applicant has that clarified um they have a setback of 75 ft from the nearest single family zone property line again the community benefits package and then just as a reminder this would not be applicable to the former White House in sight and when this comes back through the comprehensive plan we have to wait for the ldr change for the comprehensive plan to come back we bring that back to you for second reading uh assuming you passed that you would then pass the text Amendment and that will move this particular application forward the applicant is here tonight uh with their representative to make a brief presentation and I'm available of course for any questions you may have good evening Patrick Assan of Holland tonight with officers at 701 Brickle Avenue I am joined this evening by my colleague Alexandria San Romain as well as my colleague Misha I'm also joined by representatives of 12,000 property owner the Continuum company Alexandra enner David Fishman and William Wallace IV this evening I want to be very clear as to what we're asking you with respect to these text amendments we're not asking you to approve a height tonight I'm not asking you to approve a project Tonight Tonight essentially all that we are asking you to do is to transmit this text Amendment to the state reviewing agencies next slide please your vote tonight will not approve a height for a building it will not say that a project is approved it will not say that anything can be built on this site at any particular height all you would be doing tonight is saying that the state reviewing agencies have an opportunity to provide comments on this application next slide please and what happens essentially what this Council would be seeking to do is to act ask various state agencies to provide comments on the text amendments that we have presented so that they can provide any comments that may or may not impact important state resources so the state land planning agency the state Regional planning Council the south Florida waters Management District the Florida Department of Environmental Protection the Florida Department of State and the Florida Department of Transportation would all be aining on these text amendments so again in context all we're asking you tonight is to seek more information so that we can have time to receive that information from the state agencies and to make make sure that we're in a position to provide all the information with respect to the potential impact and benefits with respect to this text Amendment next slide but to the actual text itself what we wanted to do was to address and remedy what this Council had asked us to do this Council had previously as you may recall told us that it did not want the height or any particular height in this area to be approved via Avance and so what we've done now is create a process whereby it would have to come back before this Council because it would have to pursuant to our text Amendment go through a conditional use permit process which requires recommendation by the Planning Commission and approval by the City Council next slide and the comprehensive planed text Amendment all it does is provide specific language in the text that says that there is a maximum height that could be sought of up to 238 ft and 10 in on the property this Council has no obligation to approve an actual height of that magnitude but we would simply be in a position to say if you meet the variety of criteria that we put in place the the requirements that we've established that you could pursue this height next slide please and what are those items that we've created so there are essentially five different things that we're requiring as part of this text Amendment the first is that any hype bonus would have to go through a conditional use permit which essentially require the city council to approve it second you would have to provide either a contribution to the local park which would be Bill Leman park or a portion of your land so that people can see the baay from the property third that you receive a Green Building certification fourth that there's a distance of at least 75 ft between your building and a residentially single family residentially Zone lot and fifth that there's a community benefits package that receives recommendation from the Planning Commission and that is accepted and approved by the city council so what we've done is create a set of criteria that is Tethered to the specific height and if we create a sense of addressing each of these items providing for a community benefits package that increases and enhances the community provides for a contribution to parks that increases and enhances the community provides for a Green Building certification and provides for the different aspects that would allow us to be to obtain approval of a conditional use permit under those circumstances the city council May approve a height of 238 ft and 10 in but at no point is this going to require you to approve a height at that instance and at this moment all we we would be asking you to do is to go directly to the state and where is this going to apply the entirety of our text amendment is narrowly tailored to the area south of Northeast 23rd Street and East of North bore Drive in the area that is already zoned bz and has a bore Zone designation this specific area was curated by this Council to have more density to have an area that can serve as a platform for the city because this is one of the unique areas in this city that has access to the bay and that since the 1960s and70s has had multif Family Properties immediately along the bay this creates a unique opportunity for in the future for there to be a project that that is an iconic project that focus on the East portion of the county and east of the city can see that is emblematic of the magnitude and the beauty of the city but tonight you're not approving any such project all you would be approving is an opportunity for this to go to the state for us to receive more information next slide please again this text amendment is limited to the area south of Northeast 123rd Street in east of Bas drive next slide it specifically provides that the Declaration that was applied for the White House will apply so that there is no equivocation that there's no confusion that nothing that is being done here tonight will impact the White House Insight at all next slide as you all may remember there was a declaration of restrictions that was entered into for the White House in next slide that specific Declaration of restrictions specifically limited that site to 110 ft next slide and you may recall that there was a requirement that to modify any term of that declaration of restrictions there was a requirement for a super majority vote and so what we wanted to be clear about with respect to this application and with respect to the text amendments for this application is that nothing is being done to circumvent what has happened with the White House in everything that occurred for that site is not going to be impacted At All by what we would be doing today in fact the only thing that we would be doing today is sending up this application to the state to receive comments from them so that they can come back to this Council to make a determination next slide and that's the point you are not going to be and I know I'm going to sound like a broken record here tonight but you are not approving a height you are going to Simply Be approving an opportunity for this item to be transmitted to the state as noted earlier these are sets of criteria that we would uh ESS essentially recommend be part of the text Amendment for the site which would essentially require that they go through the conditional use permit process that we provide contribution to Parks or provide our portion as Park land that we provide a Green Building certification that we meet the 75 ft distance requirement and that we have a community benefits package that is accepted and approved by the city council this process is going to be there's a variety of different steps that would come even after today this would have to go to the state the state would have to receive it within 10 days of this hearing the state agencies would have 30 days to review it to provide any com comments send it back when it comes back to this Council we would have to come back before this Council to make a presentation about it again subse went to that we would have to come back with another conditional use permit process that conditional use permit process would have to demonstrate that we're providing contribution to parks that we're meeting all of this criteria that we're providing a community benefits package that's being accepted by the city council and then only after all of that when we come back before you is there a potential for the city council to approve a height of 238 ft 10 in next slide again it's specifically tailored to ensure that we are enhanced the public spaces next slide that that we are providing for a Green Building certification next slide and that we are providing a community benefits package the entirety of the text amendments tonight that we are presenting before you is merely at the end of the day seeking to obtain more information from the states today and even if it was approved we would have to go through your conditional use permit process we would have to go through your site plan approval process we would have to provide you with a Comm Community benefits package that would be negotiated with community members and be approved by the city council so all that we're asking tonight is that you give us an opportunity to receive more information from the state and we thank you for your time we think that there would be an opportunity for us to rebutt anything that comes before you I know that I've I've said this at nauseum but this is the point we still have a lot more to go with respect to this process we're only at the current status which is the yellow it has to go to the state it has to come back and then potentially uh be a part adopted by the city council we thank you for your time I'm here to answer any questions and would like to reserve some time for a bule thank you so much thank you so much um just Mr Mayor thank you so much sir um give me one second no no for just for full disclosure I had a meeting with uh I met with the applicant that yeah in in a few minutes um we'll do our disclosure um but in terms of I have a couple of folks who do want to speak on the item um I I assume that these folks already been sworn in um but just disclosure any disclosure I have heard from so many people on this project I don't even remember who they all are but yes I've talked to people on this all right so I'd like to report that I have expar communication even though wasn't in this detail but I did speak with um the um the applicant okay you sp to the applicant councilman the applicant Mr prevel um the audience who I don't think they count right the residents don't count um Jeff do they talking to the residents does that count yeah oh okay anybody yeah she should disclose any conversations about okay um councilman Charles yes I did okay councilwoman I met with pedri Assan I think Mr Wallace Linda Julian um and I think that's about it and then with me I I I met with the residents okay so we good all righty so this is where we are going um herend Bartell will be first followed by William parvel L and I and I apologize if I'm um mispronouncing your name Zara or Lisa a zustin or Austine but I what zustin okay I'm sorry Adam Cohen can can we do them in shorter Snippets cuz I'm sure that people will forget what number they were in so these four the first four and we have two mices thank you Mr Mayor uh erando VTO 11930 nor vure Drive uh North Miami um council members um our community support new buildings up to 11 floor stall um 115 ft adding 21 luxury units in Mariners Bay and 78 in ALA Bay alongside with this 54 units in White House allowed under current ldrs building up to 11 floors financially viable as shown by the warehouse project developers have tried to buy as rules and non Miami residents concerns to exceed current ldr specifications here is the context in 2022 during the comprehensive plan discussion they tried to Rite the city maximum Building height City in solia they failed in that attempt in 2023 they added the White House to be SE Zone allowing aund uh 110 foot 10 floor development in 2024 they attempted to bypass the ldr by via variance which was rejected an appeal now they are using a text Amendment which is right however the proposed changes to the comprehensive plan and soning code in the ldr are excessive for the BC area developers also want to change the soning code boing requirements from a super majority to a simple majority is aous for developers to seek change our comprehensive plan and Democrat Democratic voting process also there is a slight risk that White House Developers might include their parcel in the next in the text Amendment pushing for height to 38 City staff assured us this is unlikely but it's still possible developers plan to push the changes in our plan and ldrs assuming they can dictate our lifestyle and disregard nor Miami resident if this text amendment pass it will encourage developers to maximize projects using txt amendment in order to get bonuses also of 100% more High BC and anomi residents might compromise a developer geniously balance citizen well-being with Equitable development for the BC area and the city thank you so much sir pil two minutes good evening everyone William privatel uh 11930 North Bay Shore Drive uh evening friends uh fellow neighbors Council and uh mayor Dr now com Des which you know I love that outfit um I'd like to speak completely in favor of of this item uh there is little or no downside to it and um if we haven't caught on yet when we increase the height when we have a higher allowable height what that means is no extra units but it means each of the units become larger if the units become larger wonderful things happen we make more in development fees we have more jobs or longer lasting jobs we have bigger product to sell there's more in fees there when people buy in they're buying a better bigger product in addition to that the city gets Revenue that is increased greatly increased over time that'll help for our infrastructure in addition to that what I tried to explain last time when I was talking about refrigerators and filling them up when you have a large apartment 4,000 square ft or whatever that isn't complement the houses in the neighborhood it doesn't mitigate those homes it does not compromise those homes it enhances those homes and their values so therefore you have something that is enhancing the overall value of the neighborhood not H holding it down finally if we have homes that are very large apartments that are very large that will be people's thirdd fourth and fifth home people had have that kind of money four and5 million to put into Apartments they are not using it around the clock small apartments yes they're there 247 s days a week you have their traffic you have their sanitation have all their problems large Apartments they'll never be there it's a bonus it's a blessing to our city thank you very much I appreciate it wow your consideration under two minutes amazing bill that's good hello good evening uh I'm Lisa Austin um I'm Homeowner of mariners Bay uh since 2015 and I support uh the project of Continuum I loved Mariners Bay condo but buying into an old building uh has serious consequences as you may know residents uh at Mariners are en encountering serious financial situation a huge financial hardship with regards to our HOA uh and potential special assessments and ultimately a potential bankruptcy of the association I would need more than three or two minutes or three minutes to go into the details but what is important is for you to understand that your position has an important impact on the Mariner Bay uh residence as well as any future old building that can find himself in the same situation which is not unique to us I ask that the city please provide what the developers need in order for them to be enthusiastic in investing in the city of North Miami we at Mariners Bay have been stuck in the middle and have been have lost past uh deals because because the de developers don't obtain what they need in order for them to be enthusiastics to invest meanwhile the financial situation at Mariners Bay is going worse as time goes we are now at a stage we cannot go through multiple rounds with potential other developers without potential bankruptcy of the association I appreciate the city is listening to the residents and I uh and seeks to compromise ultimately the city needs to progress with new opportunities which allows for additional Revenue thank you good thank you Adam uh good evening council members my name is Adam Cohen I live at Mariners Bay I'm also the vice president of the board uh the association I'm not going to be a dead horse regarding the critical situation at Mariners Bay I'm hopeful that tonight um we can take a positive step forward um and have an outcome that would relieve the uh looming financial crisis for 46 unit owners and families um I think everybody in the room can agree that Mariners Bay is going to get redeveloped uh there's just no other outcome that uh makes any sense um it also seems over the past few months uh the sentiment has been trending towards uh the majority of the neighborhood being okay and comfortable with some sort of height increase the town hall that the mayor held uh was evident of that even the most vocal opposition seemed to be somewhat comfortable with some sort of height increase this text Amendment would allow for some sort of height increase it doesn't guarantee a height increase um that would be up to you all and the developer to decide what's most beneficial for the neighborhood what's most beneficial for North Miami as a whole uh not everybody's going to be satisfied you all know that more than anybody in this room room uh the decision is difficult and the work's going to be hard to get to a final outcome but we appreciate your leadership and uh and uh we know you guys love this community you love North Miami you wouldn't be up there if if you didn't so thank you all for your consideration we hope that you can uh vote Yes on this text Amendment so Mariners Bay residents and the community can move forward in progress thank you right after and then Carlos CIA good evening mayor council members lyanna kazlowski with shuin Law Group offices at 100 Southeast 2nd Street I'm here tonight on behalf of mariners Bay Condominium Association as you know by now the 46 unit owners are in a tough spot like many other unit owners in South Florida who have bought in to aging condom miniums they are facing a financial situation that is really difficult to absorb by such a small building a lot of these buildings in South Florida Mariners Bay is no exception require immediate repairs to address things like deteriorating concrete and and those items are creating real life safety issues the repairs are definitely feasible but the cost especially for a building like Mariners Bay is enormous 46 unit owners on just the recertification work would have to absorb over $100,000 on that special assessment the hardship is compounded by the fact that the condo building is also going to have to move forward with assessing what their cost would be to fund Capital Improvements which the state now requires them to look at every 10 years things like repairs to elevators uh the roof AC when you add in all those costs what these folks are looking at is closer to $200,000 in a special assessment that's enormous and you'll hear from the condominium president and others that you've heard so far that this is just not something they can bear I won't get into those details what I do want to impress upon the council is these folks aren't here at the last minute saying bail us out I think they've worked really diligently and they found a solution that we think not only works for the site but could be a good example for the city and we ask that you move us forward in this process thank Youk you so much Laura gallano 12,000 North Basher Drive president of mariners Bay the approval of transmitting this text to the state which I would like to reiterate is not an approval for the height it's crucial for moving the sale of the bill Building forward this and future approval specific to Mariners impact has a huge impact on the city we're at a crucial juncture in Florida's condo crisis to it North Miami was the focal point of this month's Wall Street Journal article North Miami was the focal point of the Wall Street Journal article highlighting issues faced by the Cricut Club under the State's new condom uh mandates Cricket Club faces 29 million repairs as one resident stated in the article people are losing their sleep their health and potentially their homes due to these Financial burdens the entire nation is watching as this crisis unravels in our hometown just on the road in alport Hall Palm Bay Yacht Club faces $49 million in repair with the 2025 mandates Mariners is now looking at $10 million in repair among 46 units many condo unit owners in Florida are facing harsh reality they cannot afford these costs and would be buyers don't want to take on the liability some condos like ours have been incredibly proactive we started looking into this issue the moment the legislation came out and sought a buyer willing to redevelop the property council members I implore you to approve the text Amendment this is not just about Mariners it's about setting a precedent for smart government governance and showing that our community can lead the state and the country in addressing this issue if this sale does not proceed our condo will go into foreclosure unit owners face bankruptcy property values go down we are a are at a precipice your decisions will have far-reaching consequences I ask everyone in support to please stand please make the responsible choice and help us navigate through this crisis thank you thank you so much Laura and I'm sorry Laura for messing up your name I know La thank you so much um yes my name is Andres baretto resident of 2177 Northeast 122nd Street part of the colonade Town town home associations I support the progress that this city needs to make in developing that site and I think we can get to the benefits that that any project even though we're not approving a project but any development there can bring us the tax all the benefits that have been given to us shared to us however sending this text Amendment to the state sets the precedent of an overreach which is setting a really high maximum limit to open up to negotiations with a high anchor and this is because incentives Drive Behavior we have the incentives of the real estate developer which is to increase shareholder value we have the incentives of the mar Marin Bay residents who are in a very precarious situation and they need to get out of it I think there is a way to reach a compromise but it's not by approving this Tex Amendment as it is and I think you'll know that you've been successful at reaching a compromise when everybody is unhappy and the compromise that I'm willing to be begrudgingly happy about is the one that allows development to reach the height of Creek East but I go to that dog park every day well my mom goes there every day I'm for the residents who are against it because Nobody Knows the area better than the residents and I do not agree with changing the city to have these apartment buildings so high I understand it's going to bring money to the city but at what cost like the majority of the people that moved to North Miami was because they like the way North Miami was or is and I do not like that it's changing I used to be a nice cute City now it's just a tall apartment buildings a TP you know it's looking like I don't know it's reminded me of New York one of the reasons that so many people left New York yes it is all these tall buildings I'm telling you it's going to get there soon when you look out your window all you're going to see is another tall building you're not going to see The Greenery like it like North Miami was so I'm asking you to go to please vote against this take consideration of the residents I was at the hall town hall meeting you had and there was residents saying why can't we be more like what is it bricko why can't we why can't we be a city where we listen to the majority of the residents why can't we be a city that we ignore the 1% cuz honestly it's just going to favor those on the east east side are going to get money what about the rest rest of the city think about the rest so all these people are saying why can't we be this why can we be that because we're North Miami like we got to be our own we can't like copy somebody else so I ask you to vote against this and consider the entire city of North Miami thank you thank you Claudia Max and then Frank Wallen good evening uh Max Carney 12,000 North bashore Drive Unit 306 um I'm here in support of the proposed Tex amend being sent to the state um with a particular focus on safety in the neighborhood and a couple of things I just want to point out um I've twice been the victim of property theft on the 12,000 bore property um I think eight minutes be after or I'm sorry before my wife and I got home one night um my neighbors in the audience were robbed at gunpoint in the parking lot um we had a shooting at the parking store so I'm candid as a is as a member of the community I want to see a project of scale right that has the presence and candidly can afford the staff right that may work to deter crime whether that's full-time valet people outside full-time security that a building like Mariners or a commodity building built to 115 ft just cannot afford anything that this property could potentially do to Aid law enforcement and detering crime in the area is something I'm heavily in favor for thank you thank you thank you sir Mr Roland and he would be the last speaker and Mr kasan if you have any reut that'll be f after yes sir good evening staff uh mayor counsel Frank Wen I represent DMB LLC I want to encourage you to increase the height limitations for these properties frankly not just to 236 ft but I would like you to think about maybe going higher I don't understand why solomia can have buildings that are 400 ft High that's okay you're later this evening you're going to consider Pepper Park 18 story buildings they're pretty high those are not 115t buildings I don't understand why these properties should be treated differently in fact by my way of thinking this is the best property in the city of North Miami it is by far the most valuable property per square foot no one's going to argue with me no one's going to disagree it's a fact so if you have the most valuable property where you can build Condominiums which will be selling for two and three and $4 million and you can increase the tax base by millions of dollars so you're talking about money for police officers and parks and the library why why would you say no it it baffles my understanding because really when somebody says think of the rest of the city the speaker two speakers ago said that think of the rest of the city please you you should really make make this as high and as good as the city deserves thank you thank you Mr Mayor thank you so much um with that being said any rebuttal sir yes mayor I will be very brief I want to touch on two main points uh I believe Andreas Rose brought up the point respect to compromise and in order to have compromise you need information you need as much information as you can obtain to be able to get to a point where there's an opportunity to compromise and all we're asking is for the opportunity to receive more information from the state reviewing agencies with respect to the site because that gives us an opportunity to see what would the compromise potentially be but then in addition this text amendment when it comes to this site provides for a variety of benefits that can benefit to Claudia's point the entire city with a potential project that can come before you with a robust Community benefits package that can enhance this community enhance parks and enhance the way that this community looks enhance the way that this community thrives and enhance the Comm Community nearby so those are really the two main points that I wanted to come back to and address is that in order to have a sufficient opportunity to compromise you need more information and we would ask that we be given the opportunity to have a trans to the state so we can see whether those State reviewing agencies have any relevant and pertinent comments with respect to this application we thank you for your time we are here to answer any questions okay thank you so much Medina from 20110 Northeast 122 Road I live right down the street from the potenti project I can say that I know that there's been I've been to all the hearings up till today and um I see a tower sitting right next to the proposed property that already exceeds the height variance I don't have any opposition to the new building I see that I could bring additional resources to our neighborhood that are much needed we have a lot of necessities and as a resident I think I would be mostly impacted and I think that seeing this building would help our community would help our neighborhood and would help the city thank you thank you so much sir thank you um with that being said let's begin with um commissioner Timothy since it's in your District um and we'll go no problem thank you mayor um and thank you to everyone who spoke and also again thank you mayor for your leadership I know you had several Town Hall meetings um regarding the bz of course couldn't attend because we're two of us are gathered um Sunshine yeah sunshine and we can't um discuss the matter but I did have um a town hall well I did have earlier this year last year we had a meeting with residents in the area about the proposed development and I'm surprised you know not that many are here tonight but I've watched the Planning Commission I've watched the boa um meeting where this was heavily discussed and I know there were some issues um you know this is the time for us to talk about it up here I don't know was proferred at your meetings Mr Mayor um I know that the residents were um very much in uproar about you know buildings you know going up that high so close to their to their homes um and you know this Council has a approved building 20 stories um like the one on the agenda tonight Bart and some others bis Kang Bay um and this is just kind of one of those little touch touchy situation where you're directly impacting residents and residents in my district I know I've spoke to m Mr Wallace and Mr Pedro and I gave you guys my um sentiments about the project and where there where you guys could meet in the middle um I know someone said about majorica towers that was discussed as well um but before us we have an application for 238 feed um I won't be supporting the project tonight um not to say moving forward when you bring site plan we'll see what happens there but tonight as it stands um just from speaking for my residents I won't be voting for the matter thank you okay thank you so much um we'll move to councilman Galvin which next door thank you Mr Mayor Mr City attorney or city management several of the uh people who spoke in favor of the project tonight referenced that they are residents at Mariners Bay now it I I understand or or do I understand correctly that Mariners Bay is or has been sold not yet can anybody sh I'm super confused because if you're in favor of something that's on the site where you live are they is everybody getting like a free condo in the new building or no no no I'm not trying to be funny but to me it's absolutely pertinent for instance if we if we were to approve this an up Zone I think that greatly appreciates increases the value of the homes everybody has there so the question I have is is everybody selling and then second if they're selling and they're getting a lot more than they would have are you staying um so that can anybody sure I can shed some light on that Lanna kazlowski representing the association so there is a contract and 45 of the 46 unit owners are in support of moving forward with this development but whether it happens is contingent on what kind of approvals we see here today so I think a lot of the unit owners that I've spoken with um enjoy living in the city I haven't heard anything about people looking elsewhere but I think those are premature discussions because we're just trying to get through this process totally knowing that it's not binding can I ask for a show of hands of those who would sell their unit now and still stay in the city of North Miami okay thank you that's the only question I had right now Mr okay thank you sir vice mayor thank you for everyone's presentation Mr attorney can you so we're discussing a just so we could clear ordinance tab K correct Len K yeah well my first question is she's are we are we doing are we doing is this is this for so the K&L are companion items so we had public discussion on both K&L and then once we're you're done with your discussion you'll vote on individually so if K doesn't pass then L doesn't continue is that yeah okay so I just want to make sure that and just for clarity what would I so voting for k for tab K what does that state what would that be Jo that's the complain tab K is the uh Amendment to the um comprehensive plan so that so with the process let me pull the process so the process is once um once you make this approval it goes to the state we get comments it comes back I think miss miss love explained all of that um but that's the comprehensive plan once the comprehensive plan is approved then you can go on to the text Amendment on the ldrs that's tab l um Mr garon I have a question why up to 230 feet why can it be why why that I know that it based on your presentation that if we approve it would come back to us and we would still decide up until then but why that 238 so one of the things that we wanted to do was be able to present the absolute best project that we think would be beneficial to the city and we wanted to have a pro project that would be luxurious that would create a type of seasonal um owner that would be on the site and that would present a variety of opportunities for us to have an enhanced Community benefit package we wanted to have a robust scenario whereby we could address the entire city with respect to this project on the east side and so when we looked at it and when the team looked at the analysis for the site they did a robust analysis to determine what would be the height that would have that perfect project and so that's why we've come before this Council that's why we went before the boa with the specific height uh and that's why we didn't seek for a rounding up we we wanted to be very specific as to what we were seeking because we had done that analysis and we believe that at this height we can bring the best specific project before the city now in understanding that we recognized that we wanted to provide for benefits to the community as a whole and we think that at this height given the luxuriousness that we will be able to offer the the owners and the residents of these buildings that we can provide a community benefits package that will be trailblazing and we and we think that that will be a scenario that the city council will have to take under advisement when we come back uh during that process so mayur Towers what is the height now so Mya Towers is 169 ft and I I want to I want to create a a jua position here because mayorca Towers when it was approved didn't provide a community benefits package and so the reason why we're coming at it from this Paradigm is because we want to be able to provide a community benefits package and so it wouldn't be comparing Apples to Apples by saying hey mayorca is there you're here because we're going to be doing much more than what mayorca has done and our position would be that we want to have a development that will still be subject to the city's approval to come back and say this is the best possible project that could be put on the site this is the best possible Community benefits that could be put on the site this is the type of development that can help to move it forward but tonight all we're talking about is seeking more comments from the state so that we can continue that dialogue with the council and to continue that dialogue so that we can fully explain why we think it it's appropriate to have this height on the property so Mr attorney I just want to ask again if approved this will go to the state we'll wait we'll wait for comment and this is the first reading right so on second reading we could always so the ordinance does not get adopted until the uh second reading okay in invit mayor if I may I want to call up the uh president of the Continuum company to come up and and speak okay one one minute please if you may yes this mic is fine is do they un limited time Jeff because they the applicant or how does that go I'm just answering the question if you would like me to no sure sure yeah just um Alexandra anner I'm president of Continuum company just wanted to as the developer give a little bit of color when we come up with a height um we are taking into consideration many factors construction costs HOA fees how we can provide like someone said if there's the ability to provide security there's a certain number of units certain sizes there is a very very uh robust uh process that we go through to determine you know Above This height it's too expensive below this height it's too expensive for residents so I just want to under to really help you guys understand that when we come before you we will we will present to you and you will have an opportunity to decide and our community benefits program will be in line with whatever the height is that you all deem that we can do um and I just wanted to offer that as additional color questions um no I think I've asked all of my question just to reiterate this is will go to the state it doesn't mean that the council if ever approved have to agree to 238 Heights um and so those are the questions that um I had that I just wanted to underline but thank you okay councilman no no quickly I know it's just going to be a same line of questions and just to be clear so tonight all we doing is um not we're not approving any 238 ft right that that is correct you are not approving 238 ft we're transmitting it to the state so that we can receive the comments back and so that when it comes back for second reading for these items you'll be able to make a final determination um you know information is key for the sake of knowledge for um us to go out there and uh know exactly what because I I know coming back from the state we get we got more information and then from there we can have a better analysis of where we at and compared to um other um neighboring cities and everything and all that will come back so we can sit down and have a better understanding of what we're talking about is that right that is correct councilman thank you sir no further questions okay thank you so much councilman um okay um councilwoman Timothy um from early on you you mentioned I did have several meetings and and I'm glad to share with my colleagues um the findings and why I what I've learned about the project um ever since I met with the developer I think um couple months couple weeks ago it must have been um and you know they told me the case um and I listened and I told them I the the way I do stuff is really dealing with the residents um talking to the residents I told them I if it was for me it could be 800 ft you know I would be so happy like we have in um sunal and all these other places however very important I am a representative of the people and I live on the west side so we don't even have those so the people who this is going to impact um directly good or bad um I wanted to listen to them and for me to to be able to work with with with with them in terms of coming with something good now I say all that at the beginning because there were some lines I I laid out from from the get-go in terms of having this real honest conversation with the community and folks that are um this impact very very much very much so last week we had a meeting in here several members came out and spoke I felt like it was a little bit we needed a little bit more personal personable type of setting meetings where residents could come out um so today I did have two um Town Hall listen session with um with Maya Tower and with Marin Bay um thank you again Laura and I'm so sorry Laura and um also Mr um mayor's um Kirk from marinus Bay uh I'm sorry from Myas Tower and in herberto all of the residents this has been again Mr ped like you like to put me in these situations we dealt with the white house a couple months ago now we were almost in identical situation um with this um particular applicant so in talking with the residents and listening to both side I was able to almost come up with something and I could put it out there and see perhaps the council woman um you know might you know feel a little bit different but and this is just my my my my my take and I told them before I left this afternoon that we all were in agreeing what I was going to say I was going to be there stward to come out and and pretty much um you know State what was um talked about in in with the meetings that I had with the residents and I do want to thank all of them it was the middle of the day afternoon and you know we had folks who came out if it wasn't on Zoom you know to to to show their support or their opposition not to mention all of the emails that we've been getting um for in against um this particular um project and again I started the compy conversation with we do want something there you know and I've said it to you I I I love your project I think it's a a great project but again I don't live there so um I I am listening to what the residence wants to say and that's how I um I did my listening tour with marinus Bay and then Myas Tower um there is something if we if that's something that the developer since she's here that I I think it a lot of the residents um I I'll put it out out there I think that could be something that could cut through a lot of these um things there were some con consensus and Concession that was made but it let me tell you it's not easy because I understand and and I and I and I know what um former mayor Woolen stated that it would be 500 feet that that's fine we we we we get it but we're not there and the reality is we know our community and you know our community by now um so I urge them to kind of work out something that would be acceptable not necessarily um where all sides will win something and I and I felt like they did they did and I and I pushed them a little bit more and they they they they did to their limit and I and I think that's something what what I think staff did in terms of providing that um I guess that little big window in terms of the the height um because at the end of the day we all know what we here for the complaint and we understand how the comp work we send it to Tallahasse Blas Blas but at the end of the day is the height and and I don't like to life is too short if we could cut it and and all this stuff going around we get it it's the height and that's what I went in and I talked to the residents I said you know what put everything on side let's come up with what what is it that you could afford here what is it that and let's give it out to the develop if they like it they do if they don't hey we did the best that we can but this is something of us looking at the entire city not only that particular um area and I am so sorry about about about that and with that being said I believe your son mentioned it um and some of the owners so with with that councilwoman talking to to the residents um and a lot of the opposition are is from you know Mayas Tower and some of the others around but are willing to okay if with the height of um and and I guess there will be two parts to it because I I did not like the the blanket up to I think a lot of the residents and I'm with um councilwoman Timothy if that's the case I'm going to be with her right along um it's an overreach um in terms of the of the height and and you have to listen to the residents to kind of get it they they and and they do get that something they want something nice there but they don't want it to be way over um the the the the maximum limit and I think when we met um and I said that I said you know what guys um I love the project I you know as far as me I know this I know the the audience I think this is a little bit too too high what can we do so that was my focal my focal point and my focus in terms of going and and talking to the residents so the the the consensus I I think not like everybody's happy but I think people would might be able to live off and I think that's a very good um thing for you guys is to cap it at um the same thing as myoka Tower at the 169 and and and that would be and that's a big increase for North Miami and you know what we had to go through with um in terms of you know the White House and all this and all that that's a huge huge and and trust me there are people there and I told folks if somebody walked into me as much and you could ask the interim manager and all everybody's in administration we need money and say to me I have $10 billion to give to North Miami I would love to take that money but if half of the residents are for whatever reason because you're going to get that I mean $10 billion you think about it who go no you're going to get some people who's goingon to find something if that cost keep on continuing continue so we kind of get it so in terms of of that I do know that the height the the whatever that that number is there but I think the 169 is something that's um that I think we I could swallow and that's that's a progress that's a big progress for North Miami and for for that area and for the residents there so it's that's my what I would say um Miss Love is in in in the in the thing that that's going it's a little bit overreached when we talk to the residents the way we we kept it and I do understand and um the the methodology how we got to up to the 234 we we we we we know we well at least I was told something different that I hear tonight but I I get it um but I think the 230 the the the 234 it's it's a little bit too much for the the the residents again not for me but if you listen to all of them the opposition and there are opposition I'm we're not going to sit here and and like but again we made a big progress in in in terms of the the the 169 um and keep in mind there are people who don't want that and you know so yes sir so so may if I may look we we do and I know you know the process well I know that the city council understands the process well it's going to take we have to submit the city has to submit it to the state reviewing agency within 10 days yes the state reviewing agencies then have 30 days to review it and send the comments back during that time frame we will have the opportunity to to to really explain where we are I just explained it did I I I thought I made myself clear so if I need to be a little bit slower let me know no no you don't you you don't need to be slow I'm saying with all due respect and I want be respectful here uh to to ensure that we're in a perspect in a position to be able to have that conversation we think that we would be in a position to have that dialogue during that time frame now I think what you're saying right now is that you don't want it to go to the state but with respect with respect to the 238 no no no no exactly what I said we have to send it to the state y I said what I was told and and I need to kind of get this I was told that the number came because I asked where did this number come from if they had said you know the developer came up with it whatever I would understand it's about making whatever money whatever I I get I was told that it was from discussion in staff suggested that that number just to be it did not well at least that's you know the thing that I got so if if you telling me the developer had that was the initial ask the 238 um if that if that's it we just I'm just saying listening to the residents they don't want nothing I mean honest to God I'm William please please not not not please they they they I I listen to them I get the emails you are and and we not I don't want to direct so in terms of that that's what talking to them and and that's the overreach going from 115 to 238 so that if you look at 115 is is you at right right now and then we are asking for 138 we understand that the mayoka tower which was grandfathered in which we not which is 169 so what we are saying what they are saying is you know what we we we kind of get it but we want to work with the developer and the these were their words they do want the the community um benefit package they want to be able to work and they are able to work if you know whatever that could come out out of that um number and that and that was it and what I said to staff um Miss love that n that whatever that we have the language in the um comp plan that's what really scaring the residents because although they would not be proposing something that's 200 but they are they they feel like this Council need to we need to have a number where they are comfortable with where they don't feel like developers could come in and and just say Okay I want to building 20 um 210 ft because we have it at 238 so we said maybe if it's to approve it yes we will still have to approve it but that's what they saying the um the E the the the easy way if we do it and I said maybe if it's 180 I I I do I do not really care that number but that's that's the that was the little hookup that they were having is that number the potential of going up to the height and when talking to them they like okay we at 115 like I said we got a good majority okay with the 115 we got a good majority saying okay we might if we coming over to make this compromise we understand our neighbors need help we we we get it we're willing to do that and honestly I thought that was the the um the best thing that which I had nothing to do with with with the thing that they were able to you know talk and and again and trying to do something yes Miss love if you uh the applicant profer the 23810 okay if you all wish to change it you should change it now before it's transmitted to the state because if you change it at second reading you have to transmit it back to the state again it will be taking long correct Miss love if I'm sorry mayor um what when you transmitted to the state what exactly is the state looking at I know you mentioned it but can you certainly they look at the impact on state resources um they're very specific uh and what they look for South Florida Water Management District does the same FTE does the same uh Mr gassant explained it perfectly that's exactly what they look at is primarily the impact on state resources so quite honestly I don't anticipate getting a big analysis back from them yeah it's whether they object to it or not okay but it also has to go to the county and so the county has the opportunity to bu uh comment on the height change as well and have we seen what have we seen what the state has said about other projects similar to their size like have they we haven't transmitted a height change like this no not from us but like maybe from like a neighboring City no no ma'am okay thank Mr Mayor if you would mind I'd like to make a motion that we approve um tab K with an amendment of 180 yes a um a height of 100 up to still keeping it up to 180 second that is no so look the the and with all due respect we're in a position right now where we we don't believe that we can accept the uh Amendment we we would prefer to have it at the 238 we can come down to 220 um and continue you just lost me continue process you had them you don't know what I did to get there I know I'm sorry no project sorry sorry please um thank you but honestly in in P respectfully I got into this with the residents trying to help the best way I can I have no thing in in in this game they don't want it I'm just I'm just being honest and I'm and I did my best but for me to get that from that that was not you know it's it's right so I and and I have to say Mr garant um you understand I do have a lot of emails that are for this project I want to state that under record as well but I we do have opposition um let's just say even if it was 238 we don't have to approve it 2 180 so so I I I think that this Council appears to be wanting to work we understand um we understand what has to be done I understand what needs to be done but I be honest with you um I don't know to 20 is not that number based on what I'm hearing my Arcus higher right now it's 169 I thought it was fair to you know to go 180 um but um you know if we can't get there then I I I'll I'll gladly pull my motion I'm with you I'm 100% with you so we what we can do is if it's to the council's will we would ask because the the person who makes the dispositive decision we're uh communicating with um to see if if we can agree to the 180 because that person is not here I haven't been authorized to accept anything below the 238 and that's why I had to say that we couldn't we would ask that the um item be table to see if we can talk to the person uh and see if there's an opportunity for us to to obtain the authorization as the attorney I can only represent and and agree to what my client allows me to represent and agree to move to continue to the same providing for an effective date and all other purposes tab n good evening Mr Mayor again for the record Debbie Love development services department the item you have before you is an abandonment of a portion of 12 123rd Terrace as you can see here the location um is between two properties that are owned by the same applicant and they are requesting the abandonment of the tail end of Northeast 123rd Terrace that dead ends at biscane Boulevard it is currently um used for parking primarily um and uh sometimes the gas station uh leaves the cars parked in that Alleyway there or that Street there but it is about 14 almost 15,000 square feet of roadway um it's a 45 uh foot wide uh piece of our roadway uh the adjacent properties are owned by the same property owner biscane apartments LLC who are requesting the abandonment uh Planning Commission recommended approval and back in their April meeting um the applicant said that what they want to do with that piece of property the the the roadway is to combine it help it to combine the two Parcels the properties on either side of it into one mixed use development with 450 residential units and about 30,000 square feet of commercial and retail space uh as required by the ldrs we did U seek two independent appraisals um and to determine the fair market value uh and then the charter requires that you sell city property with for no less than 90% of the appraised value that does not mean that you have to sell it for 90% it just means that you could sell it for the full value if that's what you so so choose to do tonight um but no less than 90% which based upon the appraisals would be $1,593 th000 there are a couple of conditions that go along with any type of Abandonment particularly uh such like this is after they pay us in full whatever you decide this evening whether it's full value 95 90% whatever it is you choose uh we will work with the city attorney's office and they will issue we will issue a city deed that uh we will also require uh easements because believe that one of the utilities comp utility companies require an easement so we'll make sure that that easement is is provided and within 45 days of adoption of the resolution if you so choose to approve it this evening the applicant will have to unify those properties either through a uh Unity of title or what is called a covenant in lie of unity of title uh the next steps assuming you approve it tonight would be to collect the payment issue the city deed and the applicant records the deed and moves forward the next steps in that project again this is not approving any particular project this is uh approving the sale of the uh and abandonment of a portion of Northeast 123rd Terrace for any development approvals they will have to come back uh before you with a conditional use permit um they will have to do a site plan so you'll actually get to see the development a little bit further down the road and that is the end of my presentation I think the departments Development LLC I think staff cre a great presentation it's a very simple roadway dedication the road has very little public benefit at this time it's essentially a another road to access the existing gas station on bisc 123rd I'm happy to answer any questions or comments you may have awesome thank you so much um we're going to ask former mayor Burns to come up and speak um that's the only applicant did you did we SW oh okay good evening Mr mayor council members Kevin Burns 25 Alamanda Drive um real quick history lesson and uh a historical how we got here and how you're able to do what you're you're going to do tonight before you used to be able to abandon property or sell it city- owned property you had to take it to the voters not too many years ago less than 20 years ago myself and a couple other people in this room we put it on had made a charter Amendment took it to the voters and said we want the city council be to be able to abandon property sell it conduct City business and do what they think was necessary because the voters did not trust the city councils of the future we put a caveat in there that said no way can the city council sell the properties for less than 90% because back in the day in the 50s 60s 7s there's some Shenanigans going on with city-owned property that's sold for $10 that was worth a lot more so what has been happening recently is Staff or somebody has the mindset that you take 90% and that's it what we put in there was two appraisals and you can take the lowest appraisal but you start out at 100% of what that is and if the applicant comes before the city council and ask you to reduce it from 100% of the praise value that you settle on then they can ask you it's not predetermined by by staff I support the two projects uh this project is going to be fantastic the little Alleyway that's been pulled it makes so sense they need these properties sense my issue is we're giving away city- owned assets City owned money and as our financial advisor said earlier today we're on our way to do a little bit better health but why would you give away 10% of City owned assets and cash and money they're going to build the project we want them to do great things and again it has nothing to do what the community benefits and so forth but if I get a house appraised go to buy a house and that's a million bucks they're not going to take 900 90% of the pra thank you thank you so much um mayor Burns um Point well taken um so you're telling us you support the project but at 100% we need to sell it gotcha thank you thank you sir I'm member of the council vice mayor oh yeah I have a couple of questions um when I noticed this was in my district I wasn't aware of the project so we tried to reach out to the applicant and couldn't get in touch to kind of just get a better understanding of what exactly project was um so I would say if we could defer one more time so I can have an opportunity to meet with the applicant and to kind of discuss this project as it is in my district the second issue that I had was that the appraisals was done in November and December of last year I think if we're going to sell City old land that we should have a an up upto-date appraisal especially with land prices right now um and I know there was a pre previous a previous um applicant similar to this and I know mayor you took an approach of not selling any City onl so definitely wanted to hear what the council thought there as well but tonight I just wanted to kind of table to get further information because we did try to reach out and we didn't get in touch with anyone can we do that can you arrange a meeting um May I think I can answer that well I think she said let's defer it so that we could meet up with each of the um Commissioners and kind of get their input into it yes sir respectfully we don't have a project yet until the road is vacated so Our intention was is to seek the vacation of this road which has no public benefit and at that that point then the property owner once he retains the property can then develop a design and and plans to actually share with you what that project is without this road there isn't there isn't a project no no I hear you it was just a kind of I know there's a letter of intent that has to be submitted with the application and it was but in terms of just understanding what's going to be taking place I think we kind of owe that to the residents to know for sure like what are we planning here before we vacate some land project once the road is vacated we would actually the applicant would then spend the money and effort and the the time to design that at this point there wouldn't be anything to show without the road in place I I'll second the motion to continue this there's an opportunity for you to answer questions kind of reach out and just meet with with with with with the council members and and you know just kind of let them know there's this is what you want to do there's nothing now once we do and then you'll come back correct okay I have a motion made by councilwoman Timothy to continue the item to the next regular meeting the motion County folio numbers 06212 3- 0000-18 and 0621 1 23-- 0050 in accordance with article 3 division 4 sections 3-42 through 3-47 Article 4 division 3 sections 4-34 and section 4306 parentheses capital D parentheses 6 of the city of North Miami code of ordinances chapter 29 entitled Land Development regulations providing for an effective date and all other purposes tap o go ahead M good evening again for the record Debbie Love development services department the item before you is a conditional use permit for the Claude Pepper Park renovation and um development project as it as it stated in the as Madam clerk read it's to allocate 2,193 floating bonus units from the unit pool and 12,500 Square fet a floor area from our commercial pool uh the location is 1255 Northwest 135th Street and 1525 Northwest 135th Street it's about 28 acres in total and of course the uses are the J celesine Center the park and a vacant site it's all Zone pu and it's Community facility on the future land use map back in December we EST established the Joe celesine planned Global planed cor Corridor development District that allowed up to 200 ft in height and 150 units dwelling units per acre and that was in order to uh implement the RFP that you all had had previously approved so the project consists of eight 18 story mixed use residential buildings with uh about 2200 dwelling units and the Redevelopment of Claude Pepper Park it also includes the expansion of the Joe celesine Center as per the RFP that you all had approved uh we'll have about uh 3900 parking spaces and in inside of various garages that will be uh developed on the site and 227 service parking spaces it does have some new park amenities including the amphithe theer community pool with a splash area multi-purpose Field Banquet Hall and of course as I said earlier the Joe Celestine expansion I it'll have uh it will be required to be uh at a minimum lead silver but I believe that they were going for a higher uh development standard uh they have public art and it will have enhanced storm water requirements the Planning Commission heard this on May 7th and came up with a number of conditions that they would like for you all uh to consider um lowering the height uh from 18 stories to 16 a study that adding uh rooftop gardens be conducted by the applicant that a stud to add residential units on top of the garage be considered that a study on the feasibility of a pedestrian bridge over Northwest 135th Street is conducted that a study on moving the bus stop located on the south side of Northeast 135th Street to the parks side is conducted and finally that a study for the police substation on the park site is conducted the economic impact would be about 7,800 full-time jobs uh during the construction period um including 4724 short-term Construction jobs with $49 million in wages uh the anticipated adorm is $4.59 million annually a partial capture will occur because it is part of the uh North Miami CRA and with approximately one-time collection of $ 9.62 million in Impact fees we do have some standard and some unique conditional use permit um conditions for this of course they'll have to go um to DRC for final site plan and come back to you all with a final site plan approval they will have to install a 10ft wide sidewalk along Northwest 135th Street Frontage and six foot wide sidewalk along the Northwest 17th Avenue and the Northwest 12th Avenue frontages all the utilities must be underground um again I believe that they had proposed lead because right now Joe Celestine is lead silver I believe and I think they are going to increase the uh lead certification for the buildings in there and the architect and the applicant will be speaking a little bit more in detail um and public art as well so after tonight assuming you all approve their conditional use permit they will be submitting a DRC application and it will go to DRC Rie and then the final site plan will come back to you all at some point in time with that that is the end of my presentation and the applicant is here with a lot of great um pictures and boards for you all to talk about with that you have any questions for me I'll be right here thank you Miss love um who's representing the okay guys good evening Mr Mayor members of the council uh Mickey morera here from the law firm burky Rell for and as Larin and tapinis with me today several folks in our development team um David Burston Robert Holland Kobe karp Joe Benton and many many others um with that what I'd like to do is just kind of go over a summary of where we how what got us here um and then I'll pass it on to kobby and Mr Holland to to go over some additional items uh so as as you know and and Debbie went went over a little bit this all started with an RFP that the council requested proposals for um in November 2022 you all awarded the RFP to the Redwood group and we're here tonight on that in 2023 there were two significant approvals that the council considered again every time reviewing this project in in substantially the form you see it today uh there was a lease agreement that you all approved um long-term lease with redwood and legislation that Debbie mentioned that legislation created the Joe Celestine Global Innovation district and allowed Heights of up to 200 ft 2 20 stories and the development incentives and everything else and requirement associated with this project that were really based on the RFP that was approved subsequent to that and we've been working on designing and perfecting the project with all of our team we put together a great team that includes kimley horn includes Kobe karp and includes a whole host of Consultants with really the top level to make this project an absolute huge success um in 2024 in the last several months we've had multiple Community meetings most significantly two meetings were held at the centin center one meeting focused on the park improvements we took a lot of those comments and concerns to heart and made changes that you see today the second of those meetings focused on the private side of the development the towers the commercial and the residential again we there was a lot of comments some of the folks that were there are here today as well um while there was widespread you know some some concerns we addressed as much as we could and we feel that it's made the project better uh just a couple weeks ago we were in this room at the Planning Commission and there was a very very Lively discussion a lot of residents spoke we answered a lot of questions we were probably discussing the project for something like two hours and at the end of that the Planning Commission voted 60 in support of the project and they recommended that we address some issues that that Debbie mentioned I'd like to go over those in a brief detail because although we've had a very short time since that meeting we have taken the time to try and address those concerns they're in your staff report but what's not in your staff report is how we've uh addressed some of them so I'd like to just quickly go over that with you first it was uh requested that we consider study we study a possible reduction in height from 18 to 16 on the south side of the buildings we are looking at that we can't commit to do that today for example one of the one of the buildings is going to house uh it's going to house the Jewish Health and their PACE program that take one to two stories and there's other considerations that we're working on to make sure everything that we need to fit in these projects is there um we were asked to look at the possibility of rooftop gardens um and we have actually implemented some of that pools and Gardens are going to be on the on the rooftop of some of those buildings um they asked us to look at possibly putting residential units on top of the garage on that one we really just because of the way the columns are set up and the garages it's just not going to work we did look at it and it just complicates things way too much and it's very important that we have the necessary parking we're asked to look at the feasibility of a pedestrian bridge connecting the project over 130 fth Street we we're not we haven't given up on that yet but it will require uh sign ific modification of power lines and the dedication of private property that we don't control so we while we continue to look at that we think it's a great idea we can't commit to that because there are certain interests outside of our control um but again some of these are long-term items that we're looking at they can't be solved in a couple weeks um we're also looking at a bus stop on the south side of 135th but that requires cooperation with the county and those discussions are going to take a while um we may be able to report something more significant to you but we can't at this time and finally we were asked to consider placing a police substation within the property that is something we've met with the police chief and there's definitely interest there we think we're going to be able to make that happen uh and get that staffed uh to provide more security to that area and to the park and everything around us so we are continuing to make progress on all those items um as Debbie mentioned uh the project will bring in almost $5 million in avalor taxes annually um and at at permitting almost 10 million in Impact fees in in addition to all the other benefits of employment and activation of this area um so with that I there's a lot of other folks that want to speak and I know I know it's getting late in the evening um so I'd like to first introduce Kobe karp who's going to go over these wonderful photos that you see these wonderful designs that you see and following him we're going to have Mr Robert Holland speak about the community benefits that we're working to employ with the project thank you remember what remember what I said about 11 o'clock vice mayor see real quick go ahead sir yes got to go in the mic I'll get behind here since we do not have a traveling mic so my name is Kobe carp and number one I have to tell you it's been a real honor to work with your staff that your whole staff has been very helpful um some of the items that were just mentioned um were able to make them possible because of your staff um the images that you have there on the upper right hand side is the community pool that we're proposing the rooftop pools that we are proposing the passage p with the Green Landscaping kimley horn has done a phenomenal job on the Landscaping of course Vanna come here I got Vana right here she come here hold up the first quickly quickly DW we got to go time is of the essence you're skinny you can run first one on oper right hand side no no no that one right there hold it up to the crowd please that is the image of the community pool oh it's on the screen thank you ah thank you very much much better yes go to the next image huh well I think staff is able to point to them yeah yeah there she go staff is doing you probably have to do just point to each one yeah yeah just tell got you he's like I'm on TV show them the rooftop pools Please Mr D okay here we go that's good the image on the left is the um pools on the roof that we're implementing if the camera goes to the next image um what we have is we also have the Amun areas very larly uh landscaped lead sustainable um project with um Amun areas that include the green rooftop here we go and then if you can also go that's it thank you that's the Green Landscaping with the canopy with the shade canopy trees for the community to sit outside be able to eat and drink for and obviously for the local community if you go on to if you pan to the next image if you can I love it that's great that's that's the path which is um open to the public all the way around the whole site the whole 26 plus acres has a public accessibility in landscaping lit at night you can walk there with your family with your friends with your boyfriend with your girlfriend with your dog you can exercise and run meet people therefore for coffee next image please if you keep on panning around more no not me that's it go down a little bit that's it so that shows the path in The Pedestrian the improvements of the site that we're able to do here in perpetuity are phenomenal and that really has been implemented um to the Quality that we have done in Winwood Design District uh Midtown Miami next image please if you keep on panning and so we provided these images as part of the public record with the side PL so it shows exactly where it's located below um ground level uh next image please and we have an ability to have we're asked to have the theater for have the bowling alley um we've implemented all of those into our program um I'll be brief thank you so much much appreciated it's an honor and pleasure to be here thank you good evening uh Mr Mayor honorable Council Robert Holland officers at 3250 Northeast 1 Avenue I want to thank the council and the staff for all of the years of work on this uh project which should be a very transfer AAL project for the west side of North Miami which has gone underserved as far as transformational projects uh for many many years uh this development has received unanimous recommendations at every phase of its uh uh discussion so far and even with your Planning Commission recently for years North Miami has been NE neglected when it comes down to affordable housing allocations from the county in fact it is the one city that has received very little uh compared to others uh well we're here to tell you that as of uh a few weeks ago uh the county has allocated at least what they call the uh inducement $200 million for this development uh to bring about the affordability of housing in North Miami and that's transformational for an area because it would now be able to bring down the cost of living for many many residents uh in this community when you hear uh housing and rent prices skyrocketing all over the place uh and much of that was because of the whole aspect of this live work and play concept but how also Al brings the whole Community together as well people even outside of the development and while I know there's been a lot of discussion about the number of units and the height uh I want to talk about the community benefits as it relates to this here uh roughly you talking about 120 well $12 million worth of Park imp Park improvements that becomes a state-of-the-art park facility over at claw Pepper Park and that includes new bleachers baseball basketball soccer tennis uh accommodations community pool has been uh introduced to this since we last spoke uh multi-purpose Fields an Amphitheater you have the Joe celestin facility that gets expanded with additional classrooms um uh uh banquet facilities and so a number of things now get to take place on this Northern uh oh I'm sorry the western side of of of North Miami and when you think about the synergies that's created here it help support the retail that we're talking about bringing here which is unheard of when when you think think about what's happening so on the retail you have 120,000 sare ft of retail that's restaurants retail medical facilities bowling police uh substation possibly a grocery store those things work what you mean possibly well I'm just saying until you get until you get your site plan together and the approvals then that's the only time you can really go to folk and get them to commit Aldi is very close to committing but they need to see we've had others talking as well uh about possibly being here on this site so let me ask David something did so in reference to he's not talking about the pantry um okay grocery okay got it no this is a grocery store got it got it okay thank you uh and what helps the yeah or in the movie theater I forgot about in the movie theater what helps those things is the fact that and and the restaurants is the fact that you have the built-in density on site so those restaurants and businesses know that they have that built-in customer base plus you have the surrounding community so that makes it more viable and people more trusting of investing their dollars into retail and some of the other stuff when they're talking about building those spaces out um as your staff mention also uh there's a million dollars uh that's being given to the city of North Miami in various phases uh at the permitting phase I think the 00,000 comes to the city uh upon the uh issuance of the uh certificate uh that we here on tonight uh as well as the first permit and then the um additional $100,000 comes after that and there's a series of of payments that come on the permit pulling uh there's a creation of an independent Foundation to support the park uh that'll be worked in conjunction with the city and we'll be funding that Foundation $50,000 a year for 10 years that's an additional half a million dollar uh your staff spoke of the 7,780 uh jobs in the community 530 will be permanent on site and that becomes important because you're talking about $49 million in salaries in the area uh and this will include a program that we will work in conjunction with the city to do local Outreach for local vendors local contractors and local employment so we're hoping to also engage a PR firm that will be able to make sure that we reach out within the city of North Miami if you guys have access on your website we'll post that stuff on your website but we'll were trying to make sure that people around this uh well in the city of North Miami and the surrounding zip codes are aware of all the jobs and Rental opportunities first before this goes out to the dominant Market um additionally talking 8 uh 8.4 million in North Miami permit fees that goes into support your department as they're moving the fees forward and the project forward 15.6 million to Miami day County for roads and Parks now what becomes important about that 15.6 they go into what they call a park fund and the road fund that doesn't mean that the city can't apply for those from the county for those parks and Road improvements within the city so now that you know that money goes in it gives you the advantage to go in first hey we're going to be adding additional money to the confers we'd like you to add some money to some of the other parts in our area and roads in our area as well um 2.3 million to the Miami day Public School System um and then you have the recurring fees these are annual contributions that will never go down they only go up because typically the property values go up or your avalor uh millage rate goes up but right now it's $4.6 million of new money to the the city of off Miami each year the county gets roughly about 4.6 the School Board gets about 4.2 million uh each year going forward and that's just based on today's market value and today's milit rate this development will will enhance the property values in the area because all of the amenities now become available to the surrounding community so now when people look at homes and look at rental properties they now know that they have restaurants across the street they have an upgraded Park that their kids can play on they have programmed in the park that now has a funding stream they a number of things that are taking place within the community now that makes people want to be in a community and it creates a better sense of community lastly based on the comments received from the uh planning board uh as was mentioned by um a co-counsel we've agreed to the north Miami police substation on site we don't have a problem with that uh we'll employ it becomes difficult to do the bridge over the street because as you know those bridges when you do them in that shallow distance it requires the zigzag on one side and then the whole zigzag on the opposite side of the street we'll continue to work with the Department of Transportation in the county to see how that can happen but typically on the other side of the street is private property and that mean those homeowners would have to agree to abandon front yards and everything else to accommodate but what we do know we can do in in the instance is we create those um uh those crosswalks where you hit the buttons and it starts flashing yellow and it can go red for a moment to give people time to cross so that can be worked out to make sure the people have access both uh across the street uh so we can accommodate that um the upgrade of the pump station as relates to the Sewer SE um sewer uh we have to obviously upgrade the pump station at the park and we don't have a problem doing that it'll be above the capacity that is needed for uh what is currently there now plus what we're bringing there and we'll have no impact on the north Miami water infrastructure because the water that becomes to this site will be from North Miami Beach so I think we've addressed many of the things that was at the plan board we've talked about the community benefits uh we're here to kind of work to make sure this is a stellar uh project and a transformative uh project for the community and as we told you once before we came in here with the banker uh before we're ready to go it's just a matter of getting through these process we're ready to get this developed so this isn't speculation thank you so much Mr Holland um we got we have a couple of speakers um signed up for sorry 1630 Northwest 135th Street M I've been living in no Miami for over 25 years this um project is being um um constructed uncontaminated land over for 25 years where I see that dumping on the truck which I got pictures of which I disagree we're going to have another Surf Side here with the with the 18 a minute mayor you said that you're going to listen to the residents I have I haven't received no notification on the CH Celestine Center of of of this project being um um talked about I spoke with my neighbors they haven't heard anything I was talking to them today my back my next door neighbors were not even aware of it that's one thing number two um with the project is we don't have a problem with North Miami being constructed or being um um being next thing but 18 stories that's preposterous and it go it's a albatross for that I'll go live in New York because to see a building right in front of my face and let's be real this is a a residential I've been living for 25 years we got middle income and lower income and we border AP alaka so what kind of has a an analysis been conducted with on me what is the traffic because we have an accident every day on one 35th every day every day every day I hear it where boom between 135th and the one by the cemetery that's two we got all the traffic there's no traffic analysis where is the EP analysis I want to see it I go D we're going to have another Surf Side but we do 18 stories and they all going to come tumbling down and I go let's be real and I go third thing and I go what is it thank you Claud did I oh I didn't call call you yet okay go ahead Miss Brown Rebecca is you or Judy my name is Rebecca Brown Thomas I live on 1110 Northwest 128 Street and I've used to walking on Peppa Park but when I I haven't been to meetings regularly because from January 31st I've been back and forth in the hospital but thank God I'm here and um certain things I heard coming around a lot of things coming we going to have a theater we going to have a this we're going to have that but there's two important things that I heard that that didn't hear that we should have that we need at least an urgent care what happen when you sen this get sick and somebody can't take him to the doctor whatever have you an urgent care and a grocery store we don't have that in North Miami we don't have those two things that's very important another thing even while the building is being built if it's being built the children still have to go to school they still have to walk and go to school you know the seniors imagine them in 18 story building what happen if that elevator missed and dropped from one floor to the next by the time you open the elevator half of them might be dead we we have to think about all these things you know I mean I'm I'm old now I'm no spring chicken but I don't mind getting on the elevator but some people scared to even put their foot in the elevator so I think those are some of the most important things in the pool and the theater and the this and that I don't think the the the the Peppa Park is big enough for all those things and and be honest with you I saw one area of the park a few years back when it was a hurricane they were taking trash from another area and parking it down in Pepper Park I remember when there was water a POR in that Park so so what happen if there's a whole heap of rain what what going to happen water going to meet the water and things sink like that thank you Rebecca thank you Miss Brown Judy Judy Brown 1100 Northwest 128 terrce um my concerns is this 18 stories the first town is going to be senior citizens and usually in City of Miami or my uh Metro day they have the seniors in a to by themselves I think this is going to be disingenuous because you're going to bring the seniors in first and they going to get very comfortable because it's going to only be them on site and then you're going to bring in all the other other developments and I think that's going to be very stressful for the mayor and his seniors because he loves his seniors he loves them not only that um then you have a lot of seniors there with their homes and like the last meeting at the planning meeting these people have pay for their homes and that's that's it for them they you know they're going to die and they go you know goes on to next the the uh heirs but this 18 stories I've talked to and I understand that what we going you know what we need all the good all the good things that's being promised and I know we need we are always promised things and it's never come to fruition never there so many things and I'm not going to stand here and be label the point what we haven't gotten uh I'm I know it's coming I know it's going to be a five to zero vote um the only thing that I'm going to ask is that you will consider lowering if at all possible to lower the towers so they will not be so high and please consider the building where the seniors are going to be I really don't feel like it needs to be 18 stories I really don't that's all I have to say thank you m brown thank you appreciate that um Mr go ahead sir Fields Troy fields on 1415 opaka Boulevard it is a privilege to be standing here today to purchase a duplex in July of 2000 for $90,000 that's worth almost $700,000 now that is a privilege however there's an issue a major concern with eight 18 story buildings going inside of Pepper Park I've seen the development of this park with the Joe Celestine Center I'm a retired police officer from City City boaka from 1987 to 2013 I drove around this park every single day there's no one here more qualified than me to speaker on this in my opinion we had one Gentleman on the board for the planning Council in the second seat from the left he was saying move the bus stop from the right side to the left side the door and the bus is on the right side so how you can you do that that that's I mean that shows how out of touch that he really was okay when you have a funeral it is against the law to imped the procession of a funeral there's a funeral over there every Saturday there's one cemetery on opaka Boulevard and there's two cemeteries the average funeral length is over 150 cars so whoever is living inside those 18 story buildings they will be on lockdown and will not be able to leave until that procession is fully fully proceeded and make the left turn on 12th Avenue to go into the cemetery and opaka Boulevard they will not be able to leave it be be almost like they're in prison that's two and three times every Saturday not once a week not once of two and three soon on a Saturday alone you can't interfere with a a funeral procession that's the part they leaving out so whoever's inside of those 18 story buildings will not be able to depart those premises until their funeral is over do y'all understand what I'm saying I'm sorry yeah just with us please but it's a very important uh factor to consider I wouldn't want to live there at at that height thank you so much sir Mr Phil thank you we got Claudia um pimo and then Sarah mcdevit and then Alina Medina will stay there Claudia Pino Claudia pasino 13504 Northeast 23rd Place so again I'll say when people moved to North Miami they moved cuz they love the neighborhood didn't have all these tall buildings they found it cute I've sat here for the past years and heard so many people move down from New York I think on 1253 what a Bank of America's was people were upset that they were going to build something there and I heard so many people say I moved down from New York because I wanted to see trees and the son I didn't want a building blocking me so again consider the people that live here and I always say I vote for the PE for the residents and I didn't think about that's true urgent care where I live across the street is a build building called Vino Zar 15 floor constantly you see the rescue there because the elevator is breaking down and so that is true if you have senior citizens like my mom I live in a townhouse when she goes downstairs she doesn't go up her legs are swollen they hurt so that is true God forbid there's a hurricane there's no electricity how these people are going to come downstairs so you got to think about the people in the area they know what's best for them they know what's best for the neighborhood like the gentlemen say about the bus that's something I didn't know like what side the door of the bus is open so I ask you to please consider again be a city that can considers a residents not a city that looks like Brickle Windwood or whatever no we teach our kids be unique be yourself don't copy anybody else so let's be the same and one more thing dog park such a lovely space no dog park that's it Sarah Sarah mcdevit 14490 Northeast 10th Avenue um so for a while I was on the Parks Board and had the pleasure of touring all of our Parks regularly and you know I've Al spent a lot of time in many of our city parks interestingly enough pepper is one of the parks I've spent a lot of time in the softball fields over there I've taken my kids there I've worked on um volunteer activities over there we don't have enough field space in our city for all the different kinds of activities a typical city of our size would be offering and little by little we're chipping away at the opportunities for kids in our community to engage in sport at Young ages develop M programs that help kids learn how to play a variety of sports so that by the time they hit high school they can engage in all the different sports high schools have to offer when this project was originally presented the improvements to the park included maintaining all of the different activities that are currently offered at the park but the most recent Renditions as I look through the plans appear to be leaving out some of the fields that we currently have including softball which would be something that's geared towards girls um I just would like to say that while a a splash pad or other things that had originally been promised at pepper on the west side of pepper now no longer seem to have space with the aggressive building that we have planned on that side I would encourage us to just make sure that we are maintaining land for amenities that should be on the west side of the park things like pool or splash pads that could easily be incorporated into the plans and then improving what we already have at pepper I.E not changing it to be something else but maintaining what we currently have and making it better thank you thank you good evening um Alina Medina 127 Northeast 124 street I'm I like the I mean the beautiful pictur do we have of what can become um I feel for the loss of having a pu losing our our green areas this could have been like our Central Park in North Miami and we we're not going to have that anymore so we have to work with the development that's coming I understand that um I still think that we there's too many 2,193 units it's too many units too many units so the comparison between that tall building and the people that live around it's too much of a difference so it's still going to come but maybe work with the residents to make it a little bit more uh in tune to what they want um and also my concern again about the our infrastructure if if anybody is coming to develop do development nor Miami we could have them put a part of the money towards our infrastructure or care our parks that would be very helpful that's all thank you field spaces being removed no yeah no I I thought that if we touch the park it have to be ref no construction going on the park okay the only construction is on the west side which is an empty field my name is Dana coven I'm General Council and chief business strategist for Miami Jewish Health located at 5200 Northeast 2 Avenue in Miami Miami Jewish Health is a not for-profit corporation that has been proudly serving the senior community in and around Miami for over 80 years our services include skilled nursing residential living affordable housing the MIND Institute which serves patients with a variety of neurocognitive disorders Home Health Care outpatient rehab and our unique Florida PACE program serving close to 12 thou uh 1,200 individuals in the community as a leading provider of senior Healthcare Services with various touch points throughout South Florida and Beyond we have gained a specialized and unique understanding of their health and Community needs one aspect we have grasped throughout the years and no surprise to anyone living in South Florida is the importance of safe and accessible housing for this population and their well-being we are in advanced discussions with the Redwood development team about their project at Claude Pepper Park in North Miami we arly believe the project provides a much needed affordable housing option to seniors living in your community it is irrefutable that a safe nurturing and accessible senior residents with the opportunity for connection and daily activity has proven to have positive results on physical and mental health we see this firsthand on a regular basis the added inclusion of adjacent Health Resources which we would partner in providing in the area in the form of urgent care or something very close to that allows for proactive clinical care and is a welcome and necessary aspect of the proposed development project which will provide for longer healthier living regardless may I finish quickly how long you have just two more sentences regardless of whether we ultimately partner with redwood development in this Venture which we hope to do we believe in the type of project they along with the city of North Miami has invisioned to include affordable housing and the wraparound healthc care services thank you for your attention to this important project thank you Mr Sims good evening how you doing Council my name is Reginal Sims 1420 Northwest 137th Street I've resided in the Pepper Park neighborhood for over 40 years our neighborhood consists of mostly single family homes with a few duplexes we are a bedroom community since becoming aware of the project I have traversed the neighborhood and unequivocally everyone that I have talked to is adamantly opposed to this project eight come on eight 18 story buildings that's ridiculous grocery stores bowling alleys come on man get real okay it's not Sunny aisles it's not Windwood or bricko we don't want that massive project in our community so I'm ask you listen to the homeowners we are a bedroom community we'd like to remain that way okay he's going to put everything there it will you you done yes thank you sir yes good afternoon mayor council staff of North Miami uh my name is Steve hes I reside at 5200 Northeast 2 Avenue in Miami and I'm the uh president of the Flor to PACE program uh in with Miami Jewish I want to talk about service to seniors you know this is a very underserved population within s miles of the center of Claud Pepper Park there are over 5,000 individuals that meet the criteria for uh being in a PACE program PACE program requires you to be nursing home eligible living in the community uh and being able to be safe in the community with our services so there's an extremely large population that's underserved currently in in the neighborhood we uh outside of this project we have identified North Miami as a center for us to expand into this is a great opportunity for us to provide additional services to the senior population when we're talking about individuals our average individual is 76 years of age uh they have six plus chronic conditions they're on 12 plus medications and they need assistance with three plus uh activities of daily living a very fra population that we serve our participants pay nothing for those Services if they're Medicaid or Medicaid and Medicare eligible they don't pay anything for hospitalization for uh they don't pay anything for medication we do home renovations we do all Home Care Services all all transportation to and from uh doctor's appointments this when when the the acronym Pace stands for a program of all-inclusive care for the elderly it truly is all-inclusive we could do things with our with our uh Revenue that other programs don't do just as a quick example uh in a program we had an individual lived in an elderly highrise that in the summer her air condition without she had COPD uh she came in and told us like my air conditioner went out by noon that day we had replaced her air conditioner and she had been able to stay out of the hospital with that service thank you so much sir I think you are the last speaker on the item yes sir you may you have the the mic thank you just a couple minutes to address some of the concerns that were raised appreciate it Mr Mayor uh just I'm going to go through an order that they were made there was a concern about the land is contaminated we are very much aware of that we've talked to you all about that multiple times uh Redwood is committed to address and remediate that land we've already have brownfields consultants and have done exhaustive research and have a plan ready to make sure that this is safe and developable and we were taking on that cost and that's been discussed multiple times um there was mentioned that the neighbors weren't aware of of any of the meetings I can tell you that I attended those meetings there were standing room only we provided food there were Flyers there was public notice I mean we can't reach everyone but we certainly made a valant effort to get as many people there and and again Celestine Center was packed sing room only so a lot of people were there um as I mentioned as no traffic analysis was made uh an exhaustive traffic analysis was made by Kim Ley horn it was reviewed by your staff discussed at length at the Planning Commission meeting um should you have questions our traffic engineer is here but again very significant traffic analysis was done and and reviewed and that's what CAU us here uh it was mentioned that grocery store Urgent Care are the type of things that we should include well they are included grocery stores well we can't say we finalized a deal with with a grocery store provider that is certainly in our plans and we're hoping to deliver that and we will absolutely have an Urgent Care on the site that is something that we propos from day one in addition to the Urgent Care you've heard from from Jewish Health and the PACE program that's 30,000 s 30,000 square feet being dedicated hopefully to those uses um mentioned that the senior building shouldn't be first that was something we were asked to commit to because it was a des a significant need for that so we committed to do that first at the request of the city and we want to continue to do that we think it addresses a significant need um there's a few times that height was mentioned I will tell you that the project as it was presented through the RFP was 20 stories we have reduced it to 18 that was in response to the comments we heard at the neighborhood meeting but I will tell you this is unpr precedented public private partnership the amount of investment being made on the park and on all these things for the community is really you know I got to say unprecedented and what makes that possible is the private development you know it's what makes all these things possible um finally comments were made about the parks that were taking away park space that's absolutely not true taking away an inch of park space would require a charter Amendment that's not happening we're only developing the private portion the undeveloped portion um specifically why aren't we including in a splash pad we are it's been in the plans from day one why aren't we including a pool in the park we are it's it wasn't originally in the plans but at the request of you all it's been put in um this park is going to be really an absolute state-of-the-art facility that hopefully you all can be proud of and we all as a community can be proud of and and this this project is making that possible I try to go quickly but I think a lot of the stuff that was raised are things that we've addressed we have a long night and we're trying to get home so we're here to answer question so much absolutely indeed um well well well well well where do we go from here um we we we've heard the presentation we heard um councilman Charles and then we'll go um in that order thank you very much uh mayor thank you uh for the presentation and um to uh some of the point that um were made we can attest to that there were like several meetings um this project was voted on before I came here so and I was here in the wom when um this project was already on so uh this is not something we just we just thought the only um concern that I have is um uh added on the community pool where is that going to be placed in um and refence to the project it'll be um located closer to 17 um sorry 12 Avenue all the way right here on 12 and 1350 it'll be located in the Southeast Corner um yeah um with all du respect for for that portion um we have a lot of complaint okay um this is not something that we can um I out would um myself support the reason being is like first uh when it comes to like adding po we taking out um some U field space so that is um that is like uh one of the the um complaints that I have um from uh many many residents and um also uh you know what what's the complaint I wanted to you said um the pool is the complaint they don't want the pool yes that's um that's s because I'm hearing otherwise exact on U that um on that side of the with the park because they were complaining about um fail space that we are losing so I I will study that uh commissioner number one number two we do have the softball fields yes in existence right here and we're keeping those and where the splash area we're putting right here a small community uh pool area um with the bathrooms and with concessions yeah yeah and so it is not taken away from any Fields this is the soccer the baseball diamond and um the practice fields now the other concern that I heard about the pool is that who is going to maintain the pool we we are maintaining the spaces in the park was that part of the agreement is it um no sorry let the boss talk go ahead da right we're going to assist with programming but the city is is responsible thank absolutely okay we will maintain our the pools on our on the West Side yes on your side in total there's three pools one in the park side at the request um and uh two on the west side correct okay ah and also we're keeping uh commissioner the buildings towards 17th Avenue because the cemetery is up by 12 so our development is more on 17th Avenue and 16 Avenue away from 12 Avenue so um you know just a little background on that mayor uh for the for the pool like in that far in corner of uh uh Northwest 12th Avenue but that being part of the um original plan or is that an I believe SOC because one of the things that we were talking about we said there would be two olympic size pool in the city CU we didn't have any well it would only be one the one that we are having at the um Kagney Park so over there we have one pool which is the one that um I know that the the um what's the what's the name of it in 125th in um sassel yes ma' and that's a old old old old pulled in in terms of of of what's happening but the arguments is I I can't think for 10 years been on this Council and and I work at that Park when I was 16 um and I was Park attendance with with a deputy um an interim city manager Arthur sorry those two little fi on in the front I guess those are the baseball field is it Christine the the co yeah they have never they just been there for I I would welcome anybody to come in the last 10 years there have never even been one person on on any of those fields except on maybe on some occasions you'll have a little things you know they they usually be on on the big fields so right now it's really not it's under use so there's three fields and it's going there's three Fields well no it's they keeping the big one which going to be the multi-purpose field and then the the other two they keeping one and then one of them they're making a splash pad for kids in a pool I'm like correct so is it with your permission it's four does that require referendum or no you've got the giant one in the middle and then on the furthest East part you've got a uh larger softball field that faces directly north into the cemetery correct and then on the South Side you've got two smaller little t-ball Fields is it is it not two is it just one one I thought it was one one okay memories plan trick yes those we don't bring it up here cuz we it's not on the TV it's not on the TV so we have to stay on the record with everything Parks and Recreation director Christine Carney hello how are you um So currently there are three Fields there is a softball field I'm sorry The Big Field is the baseball field the field to the north closest to opaka Boulevard is the field and the field closest microphone I'm sorry hi apologize so the field y'all be patient with her we still have an hour to go anyway the fields to opaka Boulevard is the t-ball field and the field to 135th is the softball field so the softball field has been used the t-ball field doesn't get used as much but it will but The Big Field is the baseball field that um now that's something Marlin's just renovated and so as it stands the project just enhances the field it doesn't remove any fields are Fields being removed because that's my question because if we're touching the field does it require the prohibition is on building on Parkland okay building on Parkland it doesn't talk about improving Parkland it's still going to be a park weather absolutely the the the initial conversation um councilwoman was the idea was well maybe we could Flip Flip the the development and and move the park to the other side that's vacant and then do the other one so we end up um this was maybe two or three years ago that it would need a a you know a referendum so we that so what we needed is exactly what we put out is what they came a state-of-the-art park to redo all of the park um at Peppa Park and then to enhance the Joe cestine Center the way it's supposed to be and then put all of these different amenities and stuff that that that go I'm sorry Christine I'm here to answer questions oh thank you that was my question yeah I'm good May good mayor council G no okay does this so we vote on this tonight does this not come back before us ever again yes yes this is it absolutely does this is a cup you you will see this as a site plan approval after the RC is resolved and we'll hopefully be back soon we will be back yeah yeah no this was just far more detailed than I'm used to at this moment and so you might have you might have done yourself a disservice by giving out too much information cuz now everybody's texting me going how deep is the pool well listen we we're we're proud of this detail and this has been a unique process because it started a year and a half ago with an RFP so rarely has there been this much discussion if I I'm sorry we 2 ,000 floating bonus units how many do we have left I know we normally I know there's normally a count are they asking for bonus unit all of guys okay they'll need bonus units okay um right now we have about 400 but when our comp plan takes effect it will be 80 another 8,300 okay 8300 that's coming yeah okay and and and go ahead go ahead and no just cuz I know some of the residents were talking about the process I know this started with you Mr Mayor who championed this actually brought the air the draft RFP to us I it was something when he was the councilman he brought before the the board to say that this was something that he was you know he wanted our feedback we're like hey this is your project and then we had the phase where all we had to select a developer after they answered the RFP there were SE was it four developers that answered and we discussed it at length um so that was another opportunity and I know there was recently they came before us again so I don't know how the Outreach is going and why neighbors are just finding out about this project but this was something that I like I said the mayor champion and something that he brought before us and um and we all supported him and and Mary F May yes sir yeah I have to um again um you know give it to the to the to our mayor uh for all the work that he has put into um this um project um I've been here in those meeting and then the mayor has been fighting to see if we can bring something of uh something nice to uh district for and um I was here in this room um in the audience at the time when we we have that project and also to the developers they've been doing such a great job keeping us informed and we have several meetings over at Joseph list senters and um you know every kind of question that you ask them they here to answer and this is a group that just want to work and basically change the Outlook of uh of um District 4 we've been complaining that not much is happening in District Four I think this project will start a whole movement and uh I couldn't be proud with the idea of putting those um senior centers because we need a place where our seniors can afford to leave and stay in our city and this is one thing that I applaud um with this project so again the other uh components we can always talk and then they are very reasonable they are listening to you they are work with you but at um this um juncture juncture I would say um you know up to now I like the progression of the project this is a very nice project that will change the conversation about District 4 just want to say thank you and then with that I'll uh move uh the item for approval thank you um thank you so much Council okay we got to vote in a second um if if if I made just a few comments before we go on and vote um I want to say I purposely well not really purposely because it just didn't um folks who who knows me and this is this is really really true I it took me almost nine years to figure out what we wanted to do there um we talked to the residents and Miss Brown you know 10 or 12 years ago when I said I was going to run for for Council one of the things that the residents we I promised them that they said they would do is to make sure that we have a park where people could walk and do what needed to be done in the process of those t um eight years that I was in the council we wrestle with the idea what can we do there that could represent North Miami because all of the growth is happening on one side of the city and we we like what can we get out of it that we could do what we needed to do um it was it was a um a hard thing because we we had asked um our previous economic um director um Bert Waters couple years ago to do yeah an an analysis for us on that property because at one point I was really into this thing of a water park of having just you know beautiful water park in South Florida s to talk to some residents about it and then something happened um and and and when people it it's hard for us for us to be here in this space to do what we do and and I'm going to say this um and I and I'll give you an example why I say that and it's late tonight but we get up we do what we do every day we cannot people like to think you know we we all of this figure it out this and this and that but it is something when you are over a a a district or over a city in in our case when we have residents coming to us crying that they don't have a place to live they don't have a um um uh you know they sleeping in their cars guys this is where we are this is what's happening in our city it may not be you guys but we get those people and I have to call my staff there some of them they dropped them here with their family and on weekends we got to do what we got to do with my staff to put them up and do what we do and there are some we may have to call the shelter and do what we do to help them out um when I first moved here as you all know I was 12 years old well maybe um seven 7eventh seventh SE seventh grade when I decided to stay here for college my first apartment was right there by presid on 125th Street one bedroom was for $388 and I thought that I needed more space and when they got two bedroom and if Frank Wallen is in this building because he was the attorney for um for that apartment that's still there I got two bedroom for 500 and something and I didn't really need it now you cannot even get a studio for $1,000 so I do want to thank the county mayor and also our County Commissioner who work with these developers who went and they got vouchers for almost 200 units where people who could at least be able to live there and Miss Brown you're right I went and I sat and I talked to the developers and I felt their heart I said we need something that we could we could be proud of we don't want us to we don't want you to come in and say what you can it's a hard time are you able to get the financing they looked at me in the in the eyes and say yes you got our commitment we will do something that everybody will be proud I said if it's something that I cannot walk out from Aventura or anywhere from this city do not bring it to me and they did not and they have not so for those who talked about the units they are able to go 20 story because we made sure that happened a couple years ago when we did the um you know the well when we did the comping a couple years ago to make sure that 17th Avenue and different properties in the corridor kind of match not even Solaria but match you know higher than the other city so when they say about that in the senior um Center I want to ask one question um I think it's maybe to you David or um to Robert Holland is the senior center going to have residential other people in there or how is that structure because I think Miss Brown was saying something I didn't know too much about it so the way the way the affordability um Capital stack structure works is when you have a affordable building for senior citizens it would have to be 100% senior citizen okay because they also require certain services and that's why we're in discussions with Miami Jewish Health and so the ALF that we knew that that was an a component that we we we badly needed here because the problem is we not at that age yet we're not thinking about that but when we get there if you look around here there isn't any Al even near here I think the Villa Maria that's a nursing home I don't know if they have an LF there um so we don't have one you have the Miami Jewish Home and all of them is are in Aventura every single one of them I had to put put my mom in um Alf and the best place is in Aventura because there's nowhere either that or I go to Little Haiti with the Miami Jewish Home that's where we are at this is where we are so we we did say to them we said this is what we need please come back and get give us something that we could be proud of we could be you know wherever get restaurant get things that people would when do they think about the Northwest 7th Avenue when they think about that Corridor they like wow this is there and this is what these folks I've done and if you guys know one thing about me for the last 10 years you know if I stick my mind into something it's going to get done and they know that and we've been able to work good with them as partners if something we need to do that's fine and I apologize for the folks who did not know about the um the all of the meetings I wasn't present at all of them so I can't tell you who was there but I knew some of my neighbors they were excited they came back and it's not everyone but developers you guys have Community people get with the homeowners with Miss Brown and these folks who have concern I think there's a um a young lady that was here miss um Diaz um talk to them in terms of what's happening because we want to make this something for the entire community and so far I have seen that and we are very very pleased with the with the development of it thank you so much and Madam clerk I have a motion made by councilman Charles to approve the item at tab o you can imagine H had a uh a long huddle um because we're trying to be in a position to provide for Community benefits package what the best that we can do for the site is 195 ft and so we would ask that the uh city council would be supportive of it at 195 ft um so they can go to the State because we think that at that number we can still meet the community benefits package the robustness of what we want to provide to the community and being position to uh have a development that's going to be appropriate now mayor now let let me say no no no no no no no no no no no no no this that thing is done and I appreciate and respect respect that um in terms of that um but I'm I'm like I I think I mentioned before it could have been um 500 feet I would um that's not my concern my concern is the resident I made a thing with them they would that was just in terms of that we could do that and send the comp plan down and I and I would still back the vice mayor plan of the 180 because the overreach is the issue that they are having us because you got to remember what you are asking us to do in terms of of of of of doing this we are at 15 now and you are asking from 115 minus 195 that's what you are asking us go ahead sir so so the the only thing I want to say mayor is that the the difference is that 115 is permitted as a right 195 would be what we would we would have to show so many things to even get to it and so that's why we think that it would be appropriate to have a higher height while being in a position to provide for a robust Community benefits package and so when we looked at it when we looked at the numbers we think that it's not to Apples to compare this to mayorca we understand uh Council position we understand where you are on this but we we also understand what it's going to take for us to be able to provide a robust package that can address the benefits of the city that can address parks and that can Pro be a general benefit uh Citywide and that's why we think that the 195 would be appropriate here because of that because of the extra steps that we still would have to provide in order to get up to 195 ft on the site okay um vice mayor Mr Mayor yes would you be amable to or I should ask about you're you're saying 195 yes my um what about 185 okay people don't want so 19 too is was where that's yeah yeah I my only thing is I met with these people today and I've gotten the emails they don't want nothing I'm G be real honest with you it was hard in a struggle I'm sorry it was hard in a struggle that and some of them were here that you know separate meetings and it has been conversation ever since I think we've been getting the emils too for me it could be 500 but I promised them and I they I told them I would that would be my fight for um with them although a lot of them didn't want that um but they they they think that it's I'm getting text right now say please just keep it at the 169 um and we'll we'll live with that that's what literally what when somebody tell me the 169 they it's it's a process and I think we we have to be respectful and and and understand the folks who doesn't want you know for whatever reasons you know they don't you know they they they they they and and they did what they had to do is to help out their neighbors is to work out all this and all that and we said we we we we kind of um get that but it that was a big push that's that's all I'm saying and and M just like that just in the same to and what you're saying is a big push I think it's been a big push on our end to be able to go from 238 come down to 192 and to be to be in a position because we recognize that separate and apart from what myca is today what we would have to do to even get the opportunity to get to that height would be to provide a variety of different things and so again we could do all of this go through the process go through the cup and the council may say no we don't think that the height you're look exactly and and so that's the point that we we we are saying if if you saying all that but you opposed to what then obviously you are saying that so it's either it's either or I mean if if you may do all that in Council come back that I'm just trying to make it work because I knew how this thing work with the residents and all this and all that I personally I I don't have no taste to go back and and and to do what that's on you guys you could do however you want I'm being as honest as I can be um I I think I told you where I'm going to be but you got four mother four people here right so Mr right and you know Mr garant with all due respect um just just trying to really negotiate you see that you're actually just Baseline possibly working with fork I think because I've not necessarily well the that that's progress but 5 years before that building was built a 30 story less than 30 foot building was built in 1964 and 5 years later they built over 150 ft 169 ft more than five times as much in the hot dogs she was pleasant she was surprised she moved us out of the shade so I just want to give props to the city employees for this weekend and for the month for having Smiles being Pleasant and one more thing for the Mother's Day thing I went with my mom I made a big deal about it on the social media I know it was a little U what's it called um overseen that it wasn't publicized but I went at first my mom didn't want to go she went she felt good and the flowers so the flowers a nice touch but when we got home she spent like half an hour playing with those flowers trying to arrange them you know so she's getting older she's a senior so I try to take her out fight with her come on let's go you know you got to be social she's like but then when she on the way home she was like oh what beautiful flowers when we got home she was playing with them cutting them so that little touch whoever thought of it was worth it so that's what I it's all about making people feel good so again
