get this ired out let's do that get take the same amount of time anyway and jump over to uh superintendent updates um we've been informed by the town manager that uh the entire town is going through uh budget cuts right now basically we had submitted all of our budgets um they had reviewed everyone's budget um they going through each line hour that was supplied um made recommendations for either amount or certain line items that they expected each of us to uh remove um whether it be um you know cutting you know utilities um you know different expenses steeve still can't get in thinket on our anything we can do for them there um basically John and I worked um probably three times this this time around um pulling down the numbers on our side and um trimmed as much fat as we could um we did increase uh a couple of the items that were there one of them was the mfn budget um that number continues to rise you know they see the same cost that we do for you know electrical chemical um Staffing Plus they also have the same um uh debts that we do for infrastructure improvements and stuff so their borrowings and their paybacks are very similar to what we have and we pay a portion of that by being part of that that Tri community so that's something that we don't have the option of taking away from um our number to taunting for the sewer that we um pay them to remove also has steadily been increasing um we have a line item there for about 20,000 and we're slowly getting to that number we're coming in around 177,000 right now so that will slowly increase as time progresses we haven't changed that number in a while is something we with as it get closer explain that to fincom to Capital committee and to the town manager um we did cut back a little bit on our overtime budget um that's an unknown you know we we pull that number you know out of the Hat based on previous years um hoping that we don't have any major catastrophes anything like that or any um required hand operations of any of our facilities you know it's it's really an unknown it's a guess um if something happens and we have to you know go to pull a special town meeting to appropriate new funds we will have to do that um so it's something that we don't plan on and if it happens we have to find the monies for it um you know after that uh there was also talk and it was implemented that there's actually a spending for put on because of the cuts that it also come from the federal level um so basically um any unauthorized or unnecessary uh purchases you are on hold until further notice so um again we've we've put put everything on hold for spending you know unnecessaries um thankfully we actually got our Capital requests in prior to all this coming down there is still the possibility that uh those could be cut um at town meeting but they were all approved for fy2 you know the vehicles and things like that that we had uh we had asked for um Capital committee supported that finance committee and town manager when it goes to the town meeting floor there is the opportunity that the residents do have the chance to pick those um line items apart and you know that's that's their right to do that if they feel you know that they want to tighten the budget up even more um then we'll jump over real quick so the spending freezes next spending freezes on the budget cuts is for next year no budget cuts are are active as well um we had uh I think we had a a 3% budget that we had presented and we had it was taken back down to a 1% budget is Mr Steve fin in hey Steve how you doing the uh the name up there um for the record um I'm an attorney my office is in carpet Massachusetts I represent the landowner Mr Paul Freeman as manager of the LLC that owns the subject patent Road lcks um it's my understanding uh and I may need some clarification that an issue has arisen or issues have Arisen as to whether or not those properties or the owner has a right to connect to the common sewer system uh in the roadway number one uh and number two whether a betterman assessment uh can be charged relative to the use of that property um it's my position on his behalf that uh uh has an absolute right to connect to the sewer system the common sewer system by State Law chapter 83 Section 3 unless there is insufficient capacity in the system uh and unless it's a a a pressurized name um my understanding is there is no issue with capacity and it's a gravity uh it's a gravity pipe um so I just want to get that that aaish um and as far as a vment assessment goes um of course the town has the right to charge vment assessments it's entirely optional uh but in this case um I don't know if one was ever charged and if it was uh it was extinguished when when the town acquired the properties through the tax title forclosure prop the town acquires properties from tax out the forclosure um that extinguishes all leans on the property and certainly any leans count had because the town can't have a lean on its own so those are the two issues that I understand are up in the air and need to be addressed um and if um the answer is my client has a right to connect um because this capacity in the system and a betterment assessment at this stage of the game can't be charged I don't think we have uh we have anything further to discuss um of course he understands that you know at some point um if he applies to Connected the system um you know he has toh pay some sort of connection fee I'm not you know familiar with exact how much that is but that that's a matter for another day I also have been made aware that there was an issue about whether the property is buildable well that is an issue but that's for the Building Commissioner the zoning enforcement officer that's not an issue for the Civil commission sh commission as you know reacts to Applications after there's been uh and constructed or a B has been issued so those those are the issues as I see it and uh um I'm waiting to answer any questions have we seen this before I think I remember hearing so I can actually uh answer all of the the questions and uh it's pretty straightforward these Lots were non-buildable lots they were acquired by the town back in 1976 1983 and 1991 they were never assessed sewer betterments because they were non-buildable lots the sewer was installed in the Grove area back in 1996 they were never assessed betterments because as I said they were never buildable Lots they were sold off by the town auctioned as non-buildable Lots so there were no betterments attached to the property so there were no bents to be waved they are still non-buildable Lots until they were adjoined or are adjoined to adjacent Lots which still needs to be done with the building commission and approved until they are buil Lots they cannot apply for or be granted sewer or water connections to have a house attached to them therefore you know we cannot give them a permit to build and bring a sewer or water line to them which I know we Paul and I had already spoken about um so the question that was raised is could these sewer betterments be waved well there were never any sewer betterments attached to them so there is no better to wave the properties if they can be made buildable by attaching more than one rot together is perfectly fine the sewer cost to connect will be a connection fee based on the amount of bedrooms that are going to be built on the property uh if he wants a three-bedroom four bedroom five bedroom that's completely up to what can fit on that lot and completely up to either Paul or whoever he sells the lots to same thing with the water service down there water water is available and it's based on the size of the service that's connected to the property there are no stubs for water or sewer to either property based on what we see in plans there could be a possible y connection that's left at one or two of the lots that are down there but there were never any provisions to bring anything to any of the properties because even back then in the early '90s it didn't appear as anybody had any intentions of building on the smaller Lots so until these lotss are deemed buildable Lots until they're made buildable either by conjoining one two three or four however it takes to bring it up to code we cannot to give them a a sewer service that that's where they sit right now but it is available if it becomes they're they're fronted by Active water and sewer it's completely available if they do whatever is necessary to make them a buildable lot but they need to do that first before correct coming here basically does that uh make sense uh Mr ler does I mean we had of course we weren't asking for a permit um to connect to a building that's for which a permit building permit has never even been sought um and uh I think the issue was more is the right does the right exist in can the town after the fact charge of su if hearing is that you agree that the right exists and it can be exercised at some point in the future future uh when a building permit or determination of buildability is Sly knows P or S connection permit without a build it makes no sense because it's it's a costly process um and as I understand it there's no issue about capacity in the system um and um sounds like you're agreeing with uh what we're proposing yeah the the right exist it is there for both both utilities um there are fees that are involved with connecting to both utilities uh you know the uh there is no betterment to be waved or no connection fees to be waved um I know Mr Freeman has had good luck with some of the other properties that uh he has purchased over the years where betterments have been waved uh it just doesn't fall in line with uh the age of these properties and how these properties were taken by the town again we're just trying to establish the rights and connect uh when that when the building permit is issued um and we apply forit Bally um and that there will be no better assessment at that point in time if if the answerers are both for those is yes then I have nothing for there is no betterment but there is a connection Fe the answers are yes but there will be a connection Fe yeah no I didn't I didn't suggest or propose that is not a connection you tell everything water sewer let you name it okay there's a there's a connection we're kind of all on the same page okay so we we'll we'll see you again then after you make these Lots buildable officially they they are buildable I'm not going to get into that now I don't mean physically buildable I mean as far as the town is concerned whether they're buildable or not yes that again that's not an issue for the SE commission that's an issue for uh the building commission Zing enforcement officer yeah exactly was obviously we're going to resolve that with him before applying for any connection per it sounds like if you resolve that with him then they'll come back and visit us and everything will be cut and dry and everybody's happy yes what about the fact that the town own them it doesn't what about the fact at the time the time they went by the there was no what year did they acquire those properties wer wer build lot 76 they acquired them they acquired one of them in the 80s and one in the early 90 went by 96 well as far as I am aware as far as I'm aware the town can't assess a betterment to itself correct therefore I'm entitled to the therefore I'm entitled I should be entitled to the use of the better because having the town owner them that basically wipes it out so therefore I should get the use of the V and be entitled to the vaman which is therefore I wouldn't have to pay a current fee I should be grandfathered into the old system the old fees like everybody else in the neighborhood that's what I'm aru and a a betterment was never assessed to the property so you can't have a betterment at the old rate yeah a betterment because because the town can say a betterment to themselves that correct that is correct and I don't think there's any dispute about that so this yeah but he's also not going to get assessed to betterment later either no not going to be a betterman ever at all it's just simply going to be a connection fee the connection fee is what it would be for a house on any other road to tie in yeah uh it's C I don't know what the actual number would be for the connection fee but like Frank said it's depend on what they're going to build so there's no way to know that until I get to that water discussion we have uh Daniel Campbell with us I thought someone all right well let's honestly I don't think we end end up getting anything from no okay I never saw any new PLS so all right well we'll move over here to 0 and 231 2318 Bay Street we have uh anybody here for that yeah that's me oh okay abely so my name is Bob orbes from Zenith Consulting Engineers um I know Foria has been going back and forth of jun just and that but we had five meetings with people uh you guys luck out you get me um so what this is is this is a project it's a two um 2318 Bay Street in Taunton and it's l literally at the corner of Bay Street in Route 495 um in 2018 and 2019 this went through the permitting process with uh city of Taunton it got approved by the city of Taunton in uh I guess September of 2019 19 um this in Taunton this is in taunt okay um now back at at that time somewhere around the end of 2019 and before Co hit in 2020 uh I know that uh Jamie and um the one of the attorneys for the project met with this board I don't know if anybody has any recollection of that I don't know anything about that other than that they came and presented the project to the board uh Mr for a better recollection of that um what this is is so this is a um gas station this is a proposed gas station here it has a convenience store in it just like pretty much every gas station nowadays and a drive-thru here uh and the gas pumps are out front um right now um this project went on hold when Co hit and um the applicant at that time has sold the project to uh another entity and that's TK Taunton LLC who now wishes to build uh the gas station um so what they're looking for now is um so discussions that just started um to the The Proposal was obviously tie in with the under the intermunicipal agreement with uh between Taunton and Norton uh tie in for both Water and Sewer um and I believe the sewer ties in goes down to the uh pumping station and gets pumped back up Bay Street and into Taunton um there is an existing water main out front that we're proposing to tie the um the project into at this time you'll notice that there's a commercial building over here there were no plans to build that at this time there's also a Car Wash shown here that is also not on the table at this time so all the all the current owner is looking to do is to build the gas station portion of the project and get a the ti in for the water and the sewer and I know when um Jamie started discussing this with Mr for here he asked us to come in and discuss it with this board so we're kind of at the initial phases of it and um of discussing with you guys and getting the U permission and whatever we need to do so we're here to I guess we're here to get any feedback the board has and um I just ask you if you uh what we need to do to move forward with this s the biggest hurle that we really want you to come in is this IMA yes so I was in term when this had started and I remember hearing discussions with the previous superintendent about it liation that were placed on it and the as I mentioned the IMA there's limitations in this that taon had placed on Norton when we installed the water main extension there and the sewer line we actually in uh installed it from wiet all the way over 495 down into taunt and down to the wear um the IMA limits the sewer connections to the existing structures that are there along the way no other commercial properties or anything are allowed to be constructed and attached to it it also limits to seven Residential Water Services to be constructed and attached to that Waring and this is good to 2026 okay so I don't know if it's Ironclad I don't know if you guys or the previous people had talked about it with taunting or not that's is that something that's new because no no this has been in there since 2001 ail yeah so this is I'm not an attorney I'm an engineer neither this is this is way beyond my P SC um now so while this whole thing was going through the permitting process um the of course um the applicants were obviously if Without Water and Sewer they don't there not developable project um Taunton assured them um through many requests from the attorneys for this project that this is allowed in the interal agreement and I'm not talk I don't know right but if that's the inter I have a different document than that like I have a copy of it and it specifically says I mean I'm happy to give it to I don't it we can exchange conf again I don't know it's probably something that um the Project's attorney is going to have to go through because again I don't understand that I mean that's actually why we wrot uh Diane in tonight Diane was on the board at the time oh great and is well versed in this and what went on with those discussions Steve uh sleeping or not Steve is our board chair he was here at the time he wasn't in the capacity that he is now um so he does remember some of this um but most of the board has changed since then so it uh there's just a lot of moving parts that obviously need to be straightened out before we can start no problem just goes where it needs to go this is perfect this is exactly what we open we have no problems with giving you guys water and or sewer you know but uh we need to make sure that everything's done correctly make sure that you know the safety precautions are in place because it is in a Zone 2 I believe it's actually in taon zone 2 it not in N but it's so close to to make sure we had to jump through hoops for that believe me so that was just a lot of lot of concerns with this most of the pering was was focused around that F that was in his own too so this is what again this is what they supplied um to us at the time and this is a document from October 3rd 203 and it's signed by town of Norton and city of Taun I mean it's very possible that other may have been made and outside of the fact but yeah the date of that one was 200 this signed in01 and then it was stamped by Dwayne in 2002 yeah and I'm just trying to find Frank I just give me a second I'll try to find the and again I so uh essentially right here it just says U and again I'm not trying to I just want to point this out the delivery of water uh service slw waterer quality delivery of water service shall include adequate volume of pressure for any purpose purpose allowed under the zoning ordinance in the city of Taunton in the designated area under the State Building Code and for any authorized any use authorized by a special permit by the appropriate special permit granting Authority for the city of ton Bo and pre Shelby adate blah blah blah so I think that closes in here but I believe it's also limited yeah and again in previous language yes you can have it actually so what's the dat the DAT of that one this one is 2003 so it is post this one but I'm not this one's 2001 right right so my guess is that this is what they sent the project applicant at the time city of Taunton sent this document to them saying yeah you have no problem this is um not clad basically and again that's something that this here yeah W agrees to allow up to seven properties Bay Street North identified on plan so they had they actually had an appendix which I don't have a copy of yeah that's interesting CU I saw some um questions about I don't know if anybody has that exactly identifying seven specific properties that were existing at the time you know so only seven Residential Properties and um as far as sewer connections only the future public safety building which the Bay Road fire station exting rests and exting resal properties ding exist at the time of this agreement to the that's super interesting Cuts I see exactly where you're coming from I remember this was discussed when they were trying to build a property across the street from this right and it put a swash to it and then this came in and this kind of steamrolled through and that just kind of got the wheels going and you know that was I said you know before Co it's been been quite a while and yeah you know so it's interesting to see that this is still progressing and if there is a documentation that you has progressed and moved through taunted you know it's could be possible it's lost somewhere here it files or we just never a saw and again so I will number one number one a in a through z is going to be have the attorney's check this and figure out what's going on so basically have a conflicting IMA or or it's the addendum to this or that's what it seems like like that that came this is part of the refer of understanding to establish the the IM this is the the actual original this one here was I think intended to just read it right I'm not with it but it looks like it's intended to clarify uh some of the terms that are in the that in the IMA and um the portion of it as you pointed out is that no matter how it's Z for any purpose um is interesting because it's physically not possible um the sewer line that goes across the highway is um as big as it could be made and um short of running the pump station more frequently you know provide like some some extra some extra capacity um but I mean the whole project would have to be looked at because at the time it was specifically the seven houses and Norton had the same cap that no additional construction it would be the existing all 65 houses or whatever it was plus the two um the two restaurants that were that were place at time that was the exact the exact design for that function yeah limited to that it's limited to that and in the land or that pump station is is um again rather rather small um there's not there's not expansion my understanding is that um and again I'm I I actually did this site design um but um I I'm not a sewer guy either I'm not a septic guy sewer guy so um I talked to the person who did uh who looked at this um um for the SE connection and said it's essentially um without the um C wash which they're not doing it's not much more maybe not any more than than a regular regular residential house which there's a residential house here that's coming down so I don't know and again we'll address that we'll address that issue and if it's kind of replacing what's already going in there then it should it should be designed for the capacity of this gas station typically have uses I don't know what I don't know how that they're proposing is I would assume I thought the same thing they have public restrooms it's going to be a lot I mean I I don't know what you guys but I don't have like charers coming into my house relieving themselves all day long it's typically a high high use area yeah so that's what I don't know so that's what I was told by the SE designer again that's another thing that we'll address sorry I I was just curious it's um just a gas station but you said a convenience store time there were also other um you know like a donut shop or other other there is a drive-thru so I'm assuming they're going to have the ability to to pass copies through the window or whatever so uh again I can get you more information on what they're proposing the exact things that they're proposing on doing I don't have that myself but I'd be happy to do that well it just ties into absolutely absolutely and you'll notice that this is titled grease trp so obviously this food this food being prepared and bu yeah which makes a whole different thing especially with the Su exactly what is waterline is proposed the same th this is so or what the original um applicant had proposed was we show an 8 in water I me coming across so at the time that you I heard you mention earlier it's based on the line so that was an astronomical fee but um it made sense to the applicant at the time because they were proposing they needed water for the car wash and again this wasn't using a lot and this is an unknown um the the city of Taunton and when we permitted this thing they wanted us to essentially put a placeholder design here because the it was so um the the drainage design was so complicated they wanted us to essentially Max it out so um we the I know that the former uh proponents owners of the site that looked at doing the storage self storage facility there uh I don't know what's going in there I know these owners have looked at it as a self storage facility and they don't think that that's going to be a viable option so um we don't know we we don't know what's going on here we would be crazy to bring an 8 in across to just service the here limitations are going to be what you're going to get out of your flow at the end of it's a dead end line yes so you're fed you have 12 you know down you know Bay Road in King Philip area there but you're still going uphill to a dead end so you have to do a fire flow test there to see if you can get out of it at the end of the line they might limit you for fire suppression there but the IMA also limits you to Residential Services that's why I was asking what size line is proposed there if you're going for a 1 in or an inch and a half it's kind of a stretch but you can call it a residential service but if the language of that IMA still holds true then 8 in isn't a residential service yeah a b really big res in language of the IMA they considering whether it's residential they're just looking at the size and service they don't care what the actual structure is well the IMA know specifically said the seven residential the exist seven existing residential buildings yeah and it really limits what CL or couldn't be built right um the IMA wouldn't allow this to to go in or it wouldn't allow a sewer connection to this because it wasn't existed at the time okay so that's where you if that was worked out when this had started in its proposed stage and we just don't have copies of it or we haven't found any more paperwork on it I don't know but we've looked everywhere and haven't found anything other than that and you know record keeping is something of that importance is usually so what's the next step want to he you to do with I would if you can email me over everything you have I'll make copies of what I have and and send it back to you be happy yeah we can send it off to the attorneys I can send it off to ours and see if uh yeah you guys who remembers what you can keep that I'll send you a PDF of that so shouldn't he give us water flows and SE flows and what the proposed SE connection if they don't know what that extra building's going to be I really it really doesn't matter no I mean just what they're looking for I i' wait to see what this IMA is going to come out first yeah that's probably the big issue if that IMA is going to be the hold up all that extra work is done for nothing absolutely yeah right why do it and that that we're happy to provide that of course so as soon as we you know get that information from you but would be the ultimate the user was proposing I mean the names that are on that paperwork that you have from Taunton do you know if those people are still in in Taunton still working or I mean our boards change for 20 21 years ago I'm sure they do as well and I didn't I at it just wondering if if it's still somebody that's there unun unfortunately Dwayne has passed away so possible AC so we got two we got Mr nap and I can't BR something there was a Don Brown many years ago yes he was on the board many many years ago predecessor of to7 the football coach you do Master that was all right so yes so I get it I have uh I have my matching orders I'll get you the stuff that I have let's let's get the attorney attorne on this thing so so we should have an answer for you in three or four years so you're going to talk to your attorney and provide that I I'll bring it up to KP law see if they remember anything um again there's a lot of fresh faces over there as well but maybe there still somebody hanging out there remembers it and that makes sense to I through that and then we'll attack the the issues right so did you leave us a copy of that oh did I take it back you're happy to have again will something where they can just I think they'd be in the same boat as us I think all of the turnovers something where they can petition them for a waiver for it or is it something where and what's the Restriction is SE me well it's both it's both it's both oh oh for going over the bridge no what's the limitation of why they was limited um okay so what's set the seven residential Home Connection only because that's what they decided do just because it generates sewer there yeah there was a reason for all of this um the origin of this project was the wiut area was considered an area of critical environmental concern uh at that time uh it was similar to The Grove right it's a lot of summer cottages that were being converted to year round use um and the soil there is very perable it's graveling sand uh people had SES pools and it is going right into the lake so as part of the effort to restore the lake to uh recreational use um this project was proposed in early early 90s um right around the same time as the gold project started as well uh and it took almost 10 years to figure out what to what to do with it apparently it was impossible to get to the um Regular Wastewater right think the time mansfields was Water Treatment Plant um just because of the there's a lot of ledge to blast through and it was uh this is what I recall anyway so as part of the deal so there was a uh and still is obviously a a Wastewater Treatment Facility in Taun that at the time was under capacity and uh so the discussion started with Taunton to um bring in this corner of Norton it's kind of cut off just like the seven houses in Taunton are cut off from the highway right so it's like a little forgotten Corner that's isolated uh because of 395 Taunton wasn't really hot to bring in you Norton users so as part of this project Norton agreed to to you know provide gravity you know to to pump it basically sewage over the bridge and then to have like a gravity line extended I think you said down to beer street it's quite it's quite a distance down though into into Tom to enable um those homes who also drain into the I don't know what the name of the AER is but they all drain into uh like the Watson Pond and then down into the top River eventually um so in exchange for a allowing Norton's problem to be taking care of the negotiations said to said well we've got some of our own problems to take care of so if you pay for the infrastructure we'll do this and by the way those seven houses who are kind of cut off by the highway if you could take care of them by providing them access to PO water um you know as opposed to a well because at the time things were very dry uh and there wasn't uh a lot of confidence that um people wouldn't want to be on City water at the time so that's how the deal was faked um and that's why we had the restrictions on no development on the Norton side nobody else is tying in but you people here who are begging for help and um you know in exchange it was just the seven houses and I don't know what the zoning was back in 2000 1999 1997 whenever this was again cooked but I do know that area is surrounded by conservation land and I think the idea was to just have those seven houses grandfathered and to be left alone for you no further on that corner on the to side good explanation of thater is so ta would be getting the taxes and so it to me Taunton would want if if they're even so this has been presented to Taunton before right this building they approved it in 2019 to me to me I I think it would be something worth exploring with the city it's on I mean I don't see if they're willing to wave a fee on their own restrictions might be something instead of like you said waiting three years for lawyers to get back to you I mean that's just just a I mean a consideration though for the board right is um from a policy perspective there I believe the original landowner owns another of the seven Parcels that is there there's the one nursing home it's across the street acoss street the uh I don't know what it was is a nursing home or a retirement of some sort you know some kind of uh assistant facil um that is an undeveloped parcel um and then there are um there's one other landowner who owns quite a large parel so part of the things to consider you know as a board is can you can you treat them all equally right can you bring them all in is that possible I me you know is that part of our capacity is that part of isn't in line with the you know land use objectives for for that particular area especially given the reason why SE came to it in the first place so I mean it's hairy we can't you know I'm saying we not not me if you allow something for one and you open it and you definitely are and um and so the the planning aspect effect of this you know shouldn't be um taken too lightly um the agreement was put in place for for a reason I'm sure there was a lot of thought that were behind it and a lot of people that that stood up and fought for it I guess what it was it took a long time I remember I remember hearing the stories so this was one of the seven houses this this is one of those yeah is the old old houses somewhere yeah right around here it was are the other six just all along Bay Street somewhere they're on right next St I believe there's four on this side three on side four and three I can't remember which side Street the read property okay so it's just it's just Elm Street all the way from Reservoir to Main Street okay um how many gallons would that is 195 that like known to the NF like I know they're in and PID their fees no one's in there that's not being used that's going to be a substantial a while I think taken forever that's the apartment there's like 100 apartment behind McDonald's McDonald's I've seen that it's been it's like it's literally like that building's been up at least two years yeah went quit too we've been waiting to call and have the pre-treatment coordinator go over and expect it every time we talk to them they're not ready they're building the building they're finishing the insides they haven't got one yet and they haven't finished doing the the Su manual inspections it's like I don't know how um there was a there was a number some were one bedrooms some were two bedrooms some of it's affordable housing there was a c there might have actually been a couple of three minutes in there it was we'll have to get just think so yeah that was it's been a while and El street so still being voted it still has to be voted on we have a couple informational meetings that are going to be coming up to see if the Public's even going to support it with everything being as tight as it is right now it's going to be a tough one to push through well we have a bond 3.8 million we a grant a grant oh that was awarded you still have to put up a pretty hefty portion of it and then there the unknown portion that ta so that's that's kind of hard to unless W Samson does a magic and make it the extra disappear well they did the borings right they're working on the borings hit that water dead on we know where the water is yeah we're locating utilities it's about 45,000 g a day aage day thank you it's not going to hit for a while yeah it doesn't sound like you one of these aning um so and the apartment I don't think it's going to really be that bad I don't think it's going to be that huge of an impact okay no they just have to kind of ramp up their um yeah so depends on how fast people move in that's what I'm thinking it might be a slow process to fill you he is housing shortage housing shortage and for sure there's nothing cor so was that 40b that one it is Affordable depends what you classif so in the process for us approving projects in the past did we just pass that information on to Diana or is that not how it happened typically well in the past it was easy because I was also on the board she was always here we no she's not here so the question is moving forward is that something that if it was a substantial project yeah okay um the other thing is ball Farm which is now something else but that's going to be a long drout process um the building 44 million homes down off of Pine Street they're tiing directly into the mfn Interceptor okay on both sides that again going to be real slow I think the first house is supposed to be built within 3 or 4 months and then it's going to be built to suit after that okay I'm sorry that won't that won't make a Major Impact at all so okay yeah um but I mean if you want to I can give you my contact information if you want to do those give him a card he loves he exchanging cards with people true yeah no and and it's it's fine it's just so uh so there is like kind of a heads up n isn't even close to its capacity at this point um you know we do have the option to buy into more capacity start to get close but we're not close can we sell some we need money and what is capacity um oh off the top of my head what do we have one it's 3.4 million GPD I used to not be able to recite this in my sleep and um we had we kept reducing it we had started off at 700,000 and went down I don't know 5 thought was 550 it's around 500 but we're not we're not close people are it's a good thing we a tight system I think that's still true the finom talking about not wanting people to have to pay for sewer I don't think we'll ever come close on it so they don't uh they want sewer but they don't want to pay but I just got a water bill from taunt and it's just shot way up because they in the you know the you have to go out to the ocean the MWR and wow Chang anyway okay thank you thank thank you Diane um all right Frank you want to jump back in talking budget cuts and spending freezes and all that that fun stuff spending freeze C flooding in case anybody hadn't noticed so Norton's on track to set a a new record for for rainfall from uh January to April we're just under 30 in switch from last year huh right night and day so yeah we uh we're at 2443 as of April 4th that didn't include the 2 and 1/2 in of rain that we got on April 4th it isn't going to include the inch and a half that we got planned for this week so we're going to we going to blow the record out of the water so uh unfortunately with uh you know 30 something inches of rain and in a few few months you know measuring water in feets never a good thing and uh we've been noticing that uh at the water treatment facility you know I mentioned uh I think to to see if he's still on and uh you know I think i' sent a message out to to you too as well um we've been noticing changes at the water treatment facility with uh filter loading you we actually uh we been on the phone quite a bit with uh with tar and Ben from Wesley and Samson and uh We've uh had numerous hours of time spent at the the filter PL at uh you know double and triple checking you know our batch uh operations with the T magate you know all the chemical injectors and stuff just trying to get our heads wrapped around why the filter loading was was changing as much as it was and uh why you know we weren't seeing the the removal the same as we were before the rain and what we've come up with is that you know the the water quality and the aquifer itself has actually changed you more more than likely from you know the heavy impact act flows from seeing to be able to feed a frame and there is obviously other minerals in the aquifer that our plant isn't designed to remove so without getting too scientific and getting too involved basically you know other minerals can also be removed by the Green Sand Filtration plant not just the iron and minerals uh iron magnes that is designed to be removed so what we're coming up with and we haven't scientifically proved it yet with samples we still have samples out that we're waiting for results on on but uh we're thinking that other minerals and contaminants are being removed by the filters that's causing the filter loading that we're seing causing the increased backwashing that we're having to do and obviously taking away from the removal that we're wanting to see of the iron and magines um you know add to that we actually have a filter that's down that needs to be repaired reeded or whatever we got have broken under drain so now we're down to five filters so that's also increasing the amount of time that we're back washing limiting the amount of water that we can pull back to the head of the plant and adding the amount of runtime we have at well one which is our unfiltered PL so you know everything's adding to you know an unfortunate turn of events and we are actually seeing you know a few blips of color out in the distribution system that we've gone out we've had to do some life flushing and stuff um we had any calls we've had a few calls we've gone out and KN on wood we've flushed and you know we've seen a little bit of color in the system it clear up right away thankfully um you know nuisance calls stuff that nobody wants to deal with unfortunately it's it's time to flush and we can't with the filter down um and uh we can't without well three back online which we're still waiting for approval for our uh template for Boston D we sent that off that's got to be got to be two and a half weeks now John they sent that off yeah at least yep so we sent out um a copy of the public notice that we want to send out to the residents um D Boston has to approve that it's basically our PS information um our change of operations to tell the residents that we intend on putting well3 back online um showing all of the P sample results that we've taken while it's been Offline that they are below the 20 parts per trillion sample MCL but what could happen if we exceed you know obviously more Public Notices would have to go out and that way looking to um you know use it you know only as necessary so we could perform our flushing program cuz we need the water volume in order to do that but we can't do anything until they give us a nod to go ahead and then we still would have to put it out to print distribute it before we could even start so um we're looking to set up a meeting with d possibly this week if not early next week to discuss um all of the water quality issues that are going on you know why there a delay in the template approval and some of the other public notice um template approvals that we have to get out um you know we had started um planning to do the flushing um actually started um planning to flush last month and obviously it just didn't happen so um until we hear back from Boston we're on a holding pattern and possibility we may not get into you know flushing at all if we don't hear anything you know within a week or two we end up going doing a modified flush like we've done in years past um we just don't know what the water is going to do and what the weather's going to do if you know if the you know the flip goes and we all of a sudden go into a drought situation which I think is very possible you know we don't want to get stuck in a situation where uh you know we're in a worst situation than we are now um we are talking with Weston and Samson about uh what needs to be done with a filter 5 in the under drain it's more than likely the same scenario that we had with Filter 3 um we would have the company come in I don't remember the name of the company it was Andrew but I don't remember the name of his company um it was a recommended company that Tara had used before uh they were able to come in basically vacuum out the existing media in the filter reuse it put it back in and it actually saved a ton of money instead of basically sucking it all out you know hauling it off to waste um but I think it was still it was still in the 20 or $222,000 range to to redo that filter um but cost to do a business it has to be done we need that filter back online so that's uh that's that's coming so with your budget free that's not a problem it's a necessity okay no I understand there a rhetorical question but I I'll sign it it whether they like it or not it's got to get done what's the worst they can do business know give you contract spr way is that's the worst thing dad you're probably about right um so we will even with our limitations with the the filter down and you know other disturbances going on by the flushing that we do with the the fire pump test the Hy flow test and all that uh we are still going to continue to do our dead end flushing um you know respond to calls and all that just like we have in the past um we have been out um I don't know if you guys have gotten any of the um uh the note and alerts that John's put out we had to respond to a few emergency leaks that we've come across and we actually had to shut down some Mains in order to do the repairs um there were uh some that were very odd we had a a stainless steel wraparound that a hole actually bored through the side of it never seen anything like it um it was put around a repair where a water service was actually pulled out of a main and it literally the the pressure of the water actually shot through the side of that stainless steel never seen it it it looked like a bullet went through I don't know who made that rap on that day but I'll never use that it was compromised to begin with there was a weak spot I'll show you a picture later it's insane never would have guessed that could have happened not different I not different metals or anything looked like the same one we took off the shelf very strange we actually I mean those wraps have a what is that rubber on the inside yeah yeah gasket on the inside it's not even like it was corros calv corrosion or anything like that like you said it was literally like someone put a bullet through it so that that one took a little while to do um had to call in National Grid to have them hold the pole and so that that was a little involved and uh then we had that other one that was down off of uh off of Garrett that was uh that was rather involved we had the Colac truck in for that one all direct every wires and everything in the way so been pretty active couple few weeks um each time had to shut the mains down which obviously changes flow causes disturbances so we can chasing over we had uh two Public Notices that have or are going to be going out shortly the first one is for uh tthm and oddly enough this is for a what's called an LR AA exceedence which is a locational running annual average exceedence you know St Steve loves that one um this actually goes and covers from May 2023 to February 2024 the last sample did not exceed but the combination of the samples that were taken that include the last sample and go back to May the average of them exceeds and that requires a public notice fantastic yeah how much is the general public I don't even understand it so I'm not how anybody else so the because it's a second round of a public notice they are now allowing it to go out in the form of a postcard and it'll have a QR code on it okay which if you scan it it will bring you directly to the copy of the public notice online okay so a little a little different than what you've seen in the past um and the other is actually a public notice for an exceedence of the Action level for magines this is for well one I know we mentioned probably a couple meetings ago that well one was doing really well it was cleaned and the levels were extremely low with again the changes in the aquifer and the fact that we're using a lot more we sto started to see that increase again um so now it is above the Action level which triggers the public notice requirement um the biggest thing with that is it's it's a raw water sample it's the sample taken directly at the well it's not indicative of what you see in the distribution system because it Blends but it's a requirement to send it out so that everybody is aware of what's entering the distribution system so so that will be going out I believe uh actually that was in the paper that one already in the okay so that's all I got you got anything joh um filed our ASR yes statistical report um and uh we didn't get a c i can I can print you one if you want you don't mind you know lifting some weights in Sp time um and that's pretty much it yeah so we had Redmill Village was U we had sprinkler testing um was a very well coordinated I believe and I believe everything worked up really well we had rustic did they work and the water department was there and couldn't have been went off hch I believe and I don't I don't know if they had any follow up on water quality issues I don't think there were any complaints I know you know I I didn't hear anything they usually first one everybody complains to just tell really great I remember that when they call from no one all right thanks guys Weston Samson okay I'll let you guys decide which one short or long how about ladies first um so uh we were we've been obviously helping out with the water quality concerns over the treatment plant and um Frank gave a pretty good summary I'm not going to go even further into the the reach out if you have any questions on that um so the southwester street we chatted uh this we're emailing back and forth about a week and a half ago or so gave authorization to move forward with the bidding for that um while the arpa funds are all being worked out in the meantime but we're planning to advertise in the central register um posted uh next Wednesday and then we just need kind of decide on a bid opening date which I've got some items here just run them by you if you're around or somebody's at least here and we can run it for you but um so the intent would be to have southwester on on the street for about a month have a bit opening miday and then hopefully have the contract award within uh two months or so after that and start construction hopefully end of summer early fall and move into 2025 with that project so that's a decent stretch on southwester and then East hod street so um be good good water made upgrades for that uh the pasos grant uh my team just met uh today we're going to need some signatures for Town Hall but hoping to get that draft overview for review uh we're applying for um funding for design for wealth 3 to provide some initial Alternatives analysis and then a FAL design will be the next uh Grant round and then linking that with our EPA funding uh we had a meeting today with uh with our EPA rep for the special E mark for the aen Clause funding which um need probably want to set up a meeting with Town Hall just to confirm uh yeah I missed that me yeah no worries uh it was it was exciting so uh Mark gave us some good information we have a draft of our application but the costs are what we need to really discuss and I think best thing to do would just be to have a meeting with uh with James and just talk through that again about you know reimbursement and how that'll go um want to make sure we have the right numbers in there before we we submit that application so he's he's ready to go looking forward to looking at the draft but um want to make sure we have the numbers right for that but that that's going to link in with uh potential balance of the funding that'll cover um 80% of the construction cost for well four replacement and then the balance of the 1.47 million will go towards uh the posos construction side of things when we get to that point and that is okay with co- mangling no no concerns with uh with using srf funds for that which is the intent for the balance if we do a treatment system either at well three set something up over around the the treatment plant um you know that's what the Alternatives analysis we presented before we'll go through so um that's kind of more or less where we're at overall uh we're continuing to help out a little bit here and there um you know as water quality comes in um with the situation over at the trm plant but it is kind of more more of the it's unforeseen conditions it's a very uh it's not what we saw during piloting it's not what we saw you know what we've seen historically just never really had a groundwater table this high for this long um so you're you're seeing a little bit more you know other minerals that are normal coming through which you know no concerns right now but long term um you know we we'll take a look at it if there is anything but um climate change we'll see if anything changes but um overall I think the intent is to you know wait the out a little bit and then um you know modify pumping a little bit you know we're working with some other folks to try to see what we can do as far as optimizing and then obviously working with the the the fit filter there with uh some concerns it does sound identical to what we had uh last year too and and uh and go through that the other three it sounds like so we've gotten one repaired six had a core no concerns five was the one that did had concerns but so far it doesn't look that there's any media loss of the other three and uh not we'll see but we'll work with them on either using the company that we had last time come in and do an assessment or um you know see if we can get Tonka you know the actual filter manufactured it yeah D Dereck and I were talk we were hoping to see if we get the media results back before having somebody come out but I just don't think we can wait that long I think we're going to have to have somebody out and Reed that filter just to get it back online so we can cut down on the back washes just because of how frequently we're doing it now and by having an odd number of filters it makes it even more difficult to run the facility I think it's just naturally Beast yeah and your your media is there shouldn't be any issues with it you you've not even pumped what your freedom plant capacity is and the media should last 15 years or so anyway so I think same as you know the rest of the filters you have two separate issues going on right now you have a little bit more you know to and you've got um some color in your water but then on top of it you have uh one of the filters has a little bit of an issue so kind of separate but of course it is Norton so I wouldn't have at the same time exactly 100% so um what the air Rus for the tanks what's just happening with those that's in design so we're uh so we have the irration project as well as the water storage study for the entire town and the likely replacement of the cot Street elevated tank as part of that there's kind of two separate line items and two separate contracts for that but they're in they're in the works um we're at the point with our modeling we've updated the gis and and are looking to start to import all the shape files into the model and upgrade that to um get get ready on the storage T so that so the storage study was really to figure out what size elevated tank we want to go to but also take a holistic look at your entire system because you do have a lot of storage and a lot of it tends to be unused so so now the trend is to have less is better water AG is concerned thms you know so then B days is the other way around bu the biggest you can right right so yep but now there's new uh restrictions on water quality so you need to now very confusing yeah yeah it's no I'm seriously it's kind of like it's a whole flip-flop with the whole thing and and the water study it is still ongoing we're still providing them with information so the question is on the P Water studies will look at other cities and towns what they have for water they will compare with other towns yeah we provided because the bill just went out and everybody in Redmill Villard that's what everybody is complained to me about I'm just saying you got to fix that yeah we're going to raise them we really fix them fix them all right yeah last round we compared to neighboring communities and also similar sizes so and I I mean well we helped with the last one with the firm that you hired so and then the other thing is water me where we with the that oh yeah that's that's still going in the background it's just one of the bottom way it's just been dragging along we've we've had discussions with another company we haven't even had a minute to really even think about bringing them in and looking at it um we are upgrading our meter reading software because we have no support um and it will cost us twice if we don't do it now and we have to upgrade the town software basically we'd have to convert it twice so that just the software is not is out of date now is that you're going to say it is it is it's been out of date so we for some reason our system crashed we have a tech that would work with us but if for some reason he moved on we're out of lock it's just too much of a risk to rely on that you know good natured human yeah at this point it's knowing we we don't want to you know keep our fingers crossed it's time to move on y get the software upgrade and deal with that and we'll look at meters a little bit down the road what we have now works it's always worked well for us is the concern going to be the new software is going to have to cause meters to be replaced or no no it'll work with our existing meters and it we we're told it would actually work with a few other meters as well um they don't like to let you know that because they want you to stay with their right of main meter but most of the end points are kind of interchangeable jumping back to the South Worcester going basically at the end of the year is there enough time if we put Priority on East hoder Street to be done would there be enough time to try and get that done before the winter I we could put it in the schedule to make an attempt to get that done it is a smaller stretch um The Hope is that you do have ductal out there which we thought originally we're going to have to do do the whole length but now it does seem to you get a several hundred feet l so if that's the case and there's not pieace meal kind of in that stretch and it's not um it's few th000 ft and there's not houses are space pretty far apart the only concern I'd have is you know depending on what contractor we get and whether or not they have different you know priorities and or issues with u material but that's it seems to be getting a lot better the time and that's less of a excuse I guess I mean I know the Dean Street insection is kind of involved that'll take some time um but it's got to get done one in another and I know um there's any way to kind of it's a large enough intersection that we could with a lot of cones and some traffic uh readjustments we can you know get it come just just thinking instead of you know having them basically come in in stage and then yeah to have it sit over the winter yeah I think we might just need to get an extension for the railroad crossing but that's I don't think well yeah that's I I think it's only one or two year I believe we changed that CU they had already set the wrong date CU I think they thought it was still 20 23 no I mean if that's going to be hold up obviously we we focus on that and get past that for but just trying to think if we could get one road out of the way and there was a but there was a development potential on Southwest or that's probably not we haven't heard any more about okay great all right then that's not a priority for them either that'll happen after the M goes in the way it works um unless there's any other questions I'm all set all right thank you sure see excellent all right the sewer let's start with the the big project so Elm Street um sewer extension water made improvements is an update so we um the borings are complete or at least the the first round the majority of the borings are done um out there we have a good profile of the ledge and the groundwater is where we expected it um so basically up you know in front of Reen Barton and up in the the hill on that side of Elm Street um there's refusals up there um so we'll get a good uh profile of that and then you come out of it as you come down to the lower elevations as you approach Miller Terrace and then as you go past Miller Terrace there more ledge basically as you get in front of the alongside of the library and head out onto Main Street the ledge starts up again uh and into Main Street um we did uh some environmental sampling near Reen Barton didn't really have any hits on the sniffer we sent it out to the lab um it is coming back with um Trace Amounts of contamination in the soil in the street in front of re bar having more testing done to determine how it will impact what if anything needs to be planned for with regard to the Sewer Trench s out there so we just got our initial results back so we're still getting more information on that it is limited to a small section based on the testing that we did you know as far as our trench goes but there will be some impacts um potentially so we're figuring that out um the one so we haven't done a boring at the pump station site yet because we haven't finalized The Pump Station site so in terms of we've talked a couple of times or been talking at meetings about the site analysis so ideally the low point is near the intersection of Miller terce our Top Choice was um land preservation Society land um we made some progress with that and then we finally hit a brick wall and and it's not going to go there which is fine we're just looking to get final letter that you know we did our due diligence that would be the best site from elevation standpoint there are wetlands um but we were working with the concom um they were amendable to we weren't in Wetlands but we were within you know the buffer zone of wetlands and then there's also wheat and land across the street still in the low area actually figure is up there but we want to go into detail but I think I've gone into detail several times right and you know based on the discussions with Wheaten they're not interested we're getting the documentation back back from them that um they're really not amenable to it so that brings us to the um site the library um Library Park um it'll be a little deeper it's very doable it'll be a little deeper we're in the ledge now that's where so at Miller teris we weren't quite in the ledge so you know we get to that low point and now the sewer continues to go down and the road starts coming up so the the sewer in the street will be you know seven seven or eight feet deeper than it was going to be at the low point which means our wet well will be deeper y um probably similar to the West Main actually West Main wasn't that deep the Town Center was a little deep but anyway um so that's fine we're going to start uh we just have to account for that you know the the uh the cost of the site and again with the ledge in there it's it's not as big a deal because it's a very confined it's more of a big deal like what happened to us on West Main Street I don't know why I just brought that up CU I hate talking about it what happened to us out there where on a linear nature where you're just continually dealing with it here it's just you know you go down 8 ft and you hit ledge you got to get the rest of it out so anyway we could deal with that I think one thing we're going to need to figure out is who who do we work with on the site layout like who's going to want to have input into that we can our first goal we'll walk over the I just need some guidance on who will ultimately be inv obiously I'll we run it by this commission but ideally we would tuck it right in the corner here every you know 10 ft we go this way we get another foot higher with the road and deeper with the sewer so it just keeps know the more we go this way it gets deeper if you tuck it right up in the corner there's a lot of trees and this driveway to this which is a significantly sized property you know good size house swimming pool their driveway is basically right up against this road so we would be right up against it into that corner to land is just it immediately adjacent so we probably should have a site visit with Frank with you but then I don't know who else you know from the town want to be there and think about where ideally the W well would make sense you know CU if being a town property we don't have to tuck it right it's nice to you know leave as much land usable you know so if we come so you've got this entrance down here already this little you know turnaround area it's already open with no trees we just need to figure that out I'm not going to figure that out tonight but I I'm going to need some help with who's going to want to have input in that decision go out there St around yeah well Library Park is a town park it's yep it is yep we have a town planner now yes next week the Old Town planner come back yes I would include him absolutely I mean you agree oh definitely definely I would think Paul and Frank make a decision okay our decision I would think yeah and we can you know I the first go added or natural instinct would be to have the pump station driveway right on that side and the the wet well there and the building um just based on how we would want to tuck it into that corner but when look at what's out there I think we're going to have to move things a little bit away from that line and try and you know see if we can find an area is already not as many trees you know so we'll work it out we don't have a tree Wen right is up the highways that is the highway superintendent's job and we don't have a treat wood correct cut trees down and replacing them I don't some towns do you cut down one you have to seven that like that there used to be um and this might be state level not Town level but if it's a long like if you can't chop a tree down on Bay Road for example Scenic Road or road or something that's a different so that might be state level yeah we'll follow up on that side um the Force main routing we do want to go the The Pine Street route um we do have to figure out continue to work with how we're going to cross East Main Street I sent you a late email I was try to read that in my car yeah there's always concerns there always one you know that rout get around yeah so the issue out there which was also confusing is so the state is just finishing up their repaving and redesign of the stuff in that area we didn't know that this when that project was going forward we didn't know that this one was coming um so they've showed us they they're almost done in the state highway so East ban is not a state highway West Main is but now they're showing on their plan Mass do is saying that the state layout continues from where 140 comes through all the way to the basically the middle of our intersection that we're talking about going through and it's this Jagged one I should have brought a figure but I didn't printed out it's this Jagged line in 3/4 of the intersection and they say once they're done with their work it's the jurisdiction of the town which would fall to Jared as the highway superintendent as to whether we can open cut and dig through there next year when we want to do this you know and do a nice tight trench through there which is ideally what we' want to be able to do so we have to make sure we can make it fit we you know we would considered directional drilling or some kind of trenchless Technology but and the ledge is an issue based on the borings we've done we would be drilling through Rock and the price a it's I don't even know for sure we can do it and if we can do it it won't be cheap so just another little thing that we need to figure out but we will all these things along the way on the design um so the biggest thing I want to talk about is the public Outreach and where we're at with that um because we need to make some decisions and kind of move quickly um we've been before the select board which was right after this um commission met last time and you guys were both there um we went to the fincom a week and a half later Frank was on the agenda for budget issues and kind of forced our way in saying might as well talk about it we I've been trying to get on their agenda it went well um and then he went off the rails a little bit at the end I wouldn't say off the rails but there's definitely the biggest concerns that came up at the end are more related to the veterans and okay have you told people there was just a lot of and this is what's going to continue to be an issue when we have our public meetings is the people fronted by the sewer that are assessed to betterman some of them will be thrilled to have sewer but the ones that aren't are not happy at all because then they get assessed a betterment they can a portion it over their taxes but they don't want to hear that we can run the numbers and explain to them that by assessing you this betterment you um you don't have to pay anything right now you can pay it over 20 years at a low interest rate um but then when you do and then you have now the seven years to connect when never moving Target of of what the policy is and when they do go to connect they do have to hire somebody to connect so there's another cost Y and it's a you know it's a tough balance all the time like why do we build sewers at all there's there's definitely a benefit to it the word betterment isn't just random their property is bettered yep by having a sewer when they go to sell their property if they're on a sewer or have the ability to tie into a sewer versus being on a septic it has value no no one can ever come out and tell you what that number is until you go to until you do it um so I think that's one of the you know we have to um get support along those lines that that it makes sense so I mean you guys saw the presentation as far as how the numbers play out it's you know it would be a shame to lose the three and5 million Grant you know it'll never be cheaper to build this um we have um Mike units is working to get a meeting with the devco people who have been looking into buying the reeden BART property for some time now um because that came up to where are they at how much are we charging them there's that whole issue of you know they've got to whoever buys the property has got a ton of work to do in terms of remediating it there's going to be costs associated with that the sewer and water you know they can't do what they want to do without you know better water you know improved water and a sewer connection um but if you throw their assessment onto the cost of the property I they going to run away and hide you know is that going to put it over the top that it's no longer you know worth it for them you know so those are the discussions that we've had is the presentation at fincom was basically the same one yeah the exact same one you giving that same one a town meeting so I haven't so the town not at town meeting so we're going to have public meetings which is what I want to talk about next I ideally at town meeting we shouldn't be doing anything significant okay people should know what it is and you can answer questions but there shouldn't be a major presentation that's the goal okay um so and the point I try you know there's a lot of push back on oh why you Tred embedments why you doing it this way why you doing it that way I've been pushing Mike so in addition to the reading Barton meeting I wanted we should have like a work session we shouldn't make this you know we can run the numbers and say this is the range of what it's going to cost here's your Grant here's you know the water rates can pay for the water work here's what's left if you assess betterments like we did on West Main Street that takes this much of it and here's still what's left um but others should help with the input on you know a lot one of the guys at fin comps and the town should just pay for it and my answer that was be great it's okay but we've been that's not how it's worked the town doesn't do it that way and everybody that ultimately gets fronted by the sewer you know they do have to buy into the club they do whether it's we can we can adjust the betterments and not have have them be lower based on the grant monies and you know based on this specific project the betterments could be less than what the previous project was if that's more palatable but there will be assessments and if you don't assess betterments it'll be connection fees and nobody likes those either right and that was that whole discussion earlier I think the the gentleman wanted me to say that because vs were assessed on that job and we didn't get one we don't get a connection fee even that's not what the lawyer was trying to get to that's what the owner the property was trying to get to yeah the lawyer to because if you don't assess a betterment then you can assess a connection fee so that's great we don't do you know we take the bents out which we're not going to do but if we take them out then nobody has to pay anything until that 7year time when they have to tie in then they have then they have to pay the same fee CU they would have paid for a betterman and they can't abortion it over they're on their own they can take out a loan they can do whatever they want they got to pay the full thing up front and they got to pay a contractor to build this so the better route is is more pable and just makes sense so all that being said I I asked Mike to try and set something up with like the treasurer the accountant the assessor someone from the select board someone from the fincom we shouldn't make this decision in a vacuum we shouldn't go in front of town meeting with we're the bad guys if the town meeting votes it down they vote it down you know we don't build it that's fine right but the whole reason we're even this far is because the town wants it the town went and got these grants and they have this money so we need to have more people on board that that are going to stand up for if this goes away then the town's vision of the reeden Barton property pretty much goes away too potentially yeah this is a big step in that process I think everybody gets that up to that point yeah and then all it takes is a couple people to to complain about the cost of this and that why are we doing it this way why are we doing it that way so we just need more people to have a stake in how we're putting it forward we go so all that being said public meetings we're waiting on the the reen Barton meeting hopefully next week we'll get something scheduled and hopefully mik can help me set something up with all these other with the finance Comm but we need for the public meetings our plan here is to so the thought is to hold two just to give people two chances to go to go and hear about the information also you I mean they'd be basically the same meeting but obviously the second one could build a little bit on what you what questions are asked at the first one and can add a little information or whatever so we're targeting and you know what made up CS of these you don't have to read the thing that you can see in the block what we're talking about doing are you planning on board attendance or so that's what I want to talk about so I would think so that's up to you and that's why we need to know because then you would have to post right all that means is you would have to post it as as a meeting and have minutes um make okay so these are the dates we came up with we worked with looking at when the other board meetings are and we tried to find venues so we're were able to get the library so we have the library reserved for 6:30 p.m. Wednesday April 24th and then we also the library wasn't available two weeks later so we're doing 6:30 on May 8th 2 weeks later and right before town meeting basically yep at the Woodland meows Community road so that's the plan on when we want to do them I go one on May 8th and I can't come on April 24th okay on 24th and I can't go on so work out uh Steve you still with us are we yes sir so those so the two dates uh 6:30 p.m. on Wednesday April 24th and 6:30 on May 8 are the two dates we're planning for public meetings I guess first off are you available on those dates because if and I think I'm available on both dates Steve and so it should work for me okay so that means we'll have two Commissioners at each meeting y we can do that that's fine and then we should therefore it is a meeting so it needs to be Clos yeah so Jim will be at one and um Steve Bernstein will be at the other Steve and then okay and then if you can be at both that's great bring your coffee and donuts yeah yeah um I'll assign Ryan to do that this will be like last time that's who expecting mostly to show up and we also should Target any people that we know that are ining for the sewer which you know the apartment complex R Barton should be there not death Co company if they are have these States been cleared with a community K they have so that's that's what we looked at yeah Franken suggested that yeah I don't know what else is happening in the world high school or I mean we might run into something else I mean I know there are no other Town committee meetings you know select board fincom or no other meetings that night and venues are available Focus mainly on other board meetings that be hinder okay that's fine the question is valid yeah we we did you know we looked at the calendar on the website we looked at the I guess it's the community calendar on on the town's website and pick it because we were going to do a Wednesday and a Thursday Thursday the the 9th and then Thursday didn't work it conflicted with okay we made sure we skipped Steve's date night as well that's very important Wednesday we nailed it you can bring her yeah she L that okay so that's what I got on Elm Street so the biggest you know we're plugging away on the design we'll we'll wrap that up you know again all covered by the grant monies which is great um the bigger push is going to be getting support and and how hard we're going to push and might have to make a decision if it's clear that it just need support for if the town doesn't have the appetite for it they don't have the appetite that's the case it revisit again down Road some some point hopefully if Paul can attend this public hearing he can speak about the master plan and the importance of the project would be nice and really where it all came from yeah I this whole idea came from yeah yeah which is what I try and present in the presentation that would be better hopefully there'll be clarity about Dev CO's commitment to the project Y and you know Christian the health agent has um in emails said this would be great for this area there some of these systems are struggling he hasn't really been able to provide I don't have any data on systems that are failing but the soils in the area aren't great so there is it is you know all these properties are at risk when they go to sell right that they might fail Title 5 any property is right but and if they do then they got to replace their system it's um we got some prices from the local contract most of them and it's more than the vet system price to replace the system um okay enough about that so Holly Road nolwood so Frank um grid changing the game again they keep changing the game so now I sent that email out so basically we're trying to get the last meter installed at Holly Road so they can make the final connection and grid is now ask a contractor to go out and do some more things before they'll do they want all the work done I don't understand it's not what they want to before so anyway we're at least they're communicating with us I have not heard back from Ardent on the email that I forwarded I'm sure they just roll in their eyes I'm sure I mean but I mean how hard is it really I they're pretty reasonable I mean I just they haven't responded yet so so we'll keep that moving and the startup is pending getting that work done uh cob Street phase one um so the emails that I see in and you know will Chandler who's been working on all these Pump Station projects with me is out this week so I didn't get a chance to catch up with him but the last email on phase one Bruno they they replaced the block heater and Bruno reported that he has not seen leaking right so it looks like it's been fixed I would I know the the contract has sent us a pay application to release their retainage but you guys still didn't I want to approve the previous one if you're willing to do that so they had so we had invoice that you guys didn't approve yeah there was one there was one and they've been asking about when are they going to get paid okay for that one so let's revisit that one now that the issue has been solved something see this was back in February um so they had a pay request in for $3,765 180 I think that was the balance cuz they were done and there's still here so there'll still be $88,000 in retainage after you approve this one so I would recommend now that that this be approved you don't want to entertain that that's the cover letter I make a motion to approve um pay estimate number four for the cop Street pum station improvements contract 20211 for $3,765 180 I will second that motion um all in favor I I'm an I also I right Steve I don't know if we sign that's for Frank to sign um and I think so let's talk so they've asked for release of retainage and I don't think we have any reason not to release it now they are 100% done so I think for the next meeting we will be processing their final payre and then everything would just be under warranty anything else that goes wrong they still have a a warranty where they would have to come out and take care of it how long is that for one year one year so we'll we'll tell them to process that and we'll get it on the next meeting okay so cob Street phase two we met out on site last Tuesday actually came up with I feel like a good plan a good compromise for the bypass pumping which is semi semi-permanent option for you guys to be able to bypass again in the future um and I think you know Frank and John you guys worked well with the contractor to bring down their CA by doing some of the work the town's going to do some of the work um the change order was was more significant than we expected but when we reviewed it you know everything made sense most of it was in the materials and whatnot so by the town um basically they're going to run a sleeve into the manhole um so that we can have the the suction line underground they're going to going to run a sleeve from the manhole onto the property underground and then they'll Slide the suction line through that and into the manhole the problem with the plan that we were going to do is the pipe was going to be the suction line was going to be on the road and they were going to have to leave the road closed and it might have been it'll be multiple days that the road would you 24 hours would have any close so anyway the issue now for discussion um that came up Frank is concerns about owners and what that means um so what do we think so when you do so you mean odors while the bypass pumping is in place is one thing right cuz once that's once they're not doing the bypass pumping that will all be sealed and we back to what we have now um so I guess when they do the bypass pumping doing the suction from that manhole they'll plug the line that goes into the wet well obviously because they don't want to be cleaning out the wet well and I the most of the odors I mean the odors should be coming from the wet well that's where they get generated right where the the waste water gets basically the you're going to have essentially the manhole is going to be open so you're going to that sleeve's going to be into the manhole you're going to have the tubes from the pump going into the sleeve but the gaps around the suction tubes are going to be basically open to the atmosphere so that's what kind of needs to be plugged while that pump is in use yep agreed you know agreed me it's going to be may maybe June you know by the time all that work's taking place and you know there's already been some neighbors questioning you know what's going on because they've seen us out there doing a lot more work than normal so no absolutely then I think we can put some that condition you know tell the contractor that he just needs to do that while the suction line is in place and in the sleeve I would I mean I understand the concerns of odors obviously even if it's only temporary I think I don't know for sure but I think once you plug the the wet well I mean if the odors are coming down the line that's a bigger issue if they're actually in the the sewer and not coming from the the wet well cuz I don't know if you're getting corrosion out there so I I'm not sure how bad the OAS will be in the manhole itself cuz it's just going to be a continual they're going to come into the manhole and get pumped out they're not going to sit there in the wet well you have the retention time when things go septic you'll definitely have some gases yeah no I I know I know I yeah I'm not saying that there won't be odors and that's the nature of the work we're doing no exactly I mean it's just you know anything that could be done to try limit that it's going to be impacte it's really thickly settled over there as well yeah no so you're right while the bypass is in place sealing that having them do some kind of you know sealing that up with with carbon or with some kind of you know a control mechanism shouldn't be a big deal yeah the carbon socks was just kind of an idea I threw and might threw together maybe it'll work maybe it won't yeah we'll talk to I'll talk more with Will chin when he get back and we'll make sure the contractor is aware that you know he is responsible for not having accessib something right and as far as so the other issue is when the when they actually clean the wetwall so they're going to pump it out so the seage Halls are going to come out they're going to open the wet well up there's going to be some odors escaping into the air obviously when you clean that crud um out of there um the trucks that you know most of the Oda from that I would think would be so the trucks come in empty and when they start bringing the waste waterer in and they vent out it's whatever's coming out of a truck so you I don't know if trucks if they all have control mechanism probably all how big is have control on couple thousand yeah I mean it's going to be that's nothing it's going to be a few hours of of work out there I think it's going to dissipate into the air fairly quickly once they leave I mean when you get when I get my septic system pumped out it it smells for a couple of hours pretty bad and then it it dissipates they close it up and it goes so we can do whatever to just make sure that they're not being willing yeah I think bigger issue of the bypass there are going to be odors when they physically clean you know suck out and back out and hose down the wet well and clean it it's going to generate folders and it's going to be you know the middle of the day just want to make sure something's being done and not nothing understood enough for minimum 10 mph wind that's the issue yeah yeah you just get a get without a breeze going be 90 90 and a fog right don't postone right I think that's all of our meeting be the 14th then right 14th for our meeting Wednesday so we wait so is the 14th a Tuesday yeah do we want to schedule for the 15th they told us that the meeting would most likely be on Wednesday not Tuesday the 15th written down that was the first Monday and Wednesday will be the what I hear it could be one night I don't know but I think they're planning for the possibility that's a good thing to say they put in a rule years ago it's got to end by like 10:00 or like that'll be whatever article was proposed at 10:00 right and if that goes till 1: in the morning but they're not starting anything new and then they give you a break for a day and then it comes so we keep our meeting your town meeting us to last like six days six nights wow Rand oh my gosh yeah it was awful they they change their form of government so that was the end of that but back in the day it was really tough and Water Commission was always they did everything alphabetical by the time they got the W there was no money left and we never got anything should have changed to the aqua Department all right okay I I had a question about um the Taun and project um so I don't know how fast this is going to evolve um but is there time to because there were a lot of different like I was just thinking about like the size of the little um pumps in the on the everybody has l pressure E1 type pumps and that system's almost at its limit so I'm just thinking about things like how would it fight with whatever that project comes in with and other things of of that nature so I don't know if there's any interest in doing a study committee or or something to get ahead of this before we just say let's have the lawyers toci what they want to do the only fair way for them to be allow to tying to into that gravity and have it gravity back to win a con then pump out cuz I know the was talks originally about they wanted to tie directly into that for R it looks like has sent yeah and that that was never going to be allowed I know that was the argument that we had back in 2019 with the other owners with the original seller right the longterm property own okay and um yeah I mean and then there you know like I said other things what's going to happen at one time time when you were talking so the water agreements makes act sense it's just water was it was just was just sewer um but it was a very contentious uh Taun and hearings when this thing was finally improved and and uh so I don't know there's a lot of politics involved involved on that um but not anymore to not anymore I mean when I mean so many years ago it was right before Co so it wasn't really that long I see yeah I me to for where this because the area isn't really Z for this like a special permit was um you know but they got it approved but but they did get it approved but then since then for residential though right it was it's it's some kind of special residential it's it's it's in the zone too Taunton I can't imagine that they're going to allow a gas station in there there yeah and some of the history I don't know how much general interest this is is that um on the other side of the highway um another the same applicant actually had wanted to put in gas station um and they were uh zoning said notes to environmentally sensitive the neighbors said too close to housing uh we don't want it here and so they um shot down that project and then Toton changed the authority of the zoning board of appeals and moved it to planning or vice versa and then the hearing for this project which is in a even worse environmental location was pushed through is kind of an ex and I don't know I'm speculating right but I think the idea was to make um to make a form um since then however the original gas station location now is being built it's being constructed so just on the other side of the highway um it's going up you can you can see it so it's been pered it's been approved it's being constructed uh so the viability of this project and again we're not in position to judge the profitability particular R's decision um is you know it's even less of the case but I think that this was done to project um their water SE um we got a different structure we do so I I don't know I don't think he was your superintendent but uh he pointed out the their well protection area that uh they said that this is kind of an environmentally degraded area as it is and therefore uh he wasn't going to draw a line in sand against Construction yeah and and again there some you know additional things going on that we we're not aware of um but we we've got to think about it ourselves because we have that's where three of our five wells in the town right right to Z right next to the zone two and again this town has made substantial commitment to improving this whole little kinded area and it was it was I mean today does sound very expensive that our talk about Elm Street and people not wanting betterments and improving and the uh in this area of town it was a very costly Endeavor for the for the folks who lived there and they were doing it because of the commitment to the environmental um situation and as you mentioned there's no real tax uh you know the the upside for nor is limited for this um in an area that's a couple hundred fet from the lake and drains into you look at the um the topological yeah it goes It goes right in there and but it's complex just from an engineering standpoint to make sure that got all the information but don't um don't miss something something big so it's wonderful if there to theity a major change from what it was originally distressing things that they wanted to do so anyway yeah if there's any further interest in uh you know putting together some kind of study
