coaches and the families that all support them and their goals so I offer my congratulations I don't I don't want to be redundant but I want to congratulate everyone uh four championships and an inter league championship I mean uh these These are these are milestones and goals that you've achieved that I don't know if that anyone expects it so you're to all the players are to be congratulated all begin to describe the hardships many senior tenants endure there are mounting challenges upon reaching a senior age never widely discussed but is is this on anything on our agenda tonight no so there'll be public there'll be a public comment portion L I thought so I thought I was hearing it wrong so I'll sit down I'll say it later yep absolutely okay thank you anyone wishing wishing to be heard I'm uh agenda items only this evening seeing none uh Board of commissioner announcements uh commissioner Evans nothing for me mayor yes mayor I do have several while it is summertime and everyone's on vacation I'm happy to report that my parks department is absolutely not on vacation all right and we've evidenced that uh by taking uh taking under our wings many projects one being a lighting project where we replaced all of the lights at the Owens football Feld field the softball field the soccer rink the tennis courts the pickle balls and this week we'll be replacing all of the lights at the glotzbach soccer field uh we will be doing the DPW and several other uh spots in town where we pay the electric bill uh with LED lights which not only reduces our carbon footprint it Le it it adds to our sustainability and it it reduces our energy cost and it reduces the the drain on the grid so that's that's one thing that we've accomplished so far and we're continuing um there was a report that was just out uh from the GIF which is a joint Insurance Fund which Nutley has been a member of for the past uh 32 years and I'm happy to report that all of our members and we have 11 members 11 different entities uh in this shf mostly municipalities uh some school boards um some uh some health departments joint health departments and over the 32 years that we've been in the joint Insurance Fund we've saved approximately 11.13 million dollar over the years again reducing the cost of government and how we do our business this last weekend we also sponsored uh and supported uh a pickle ball contest at our new pickle ball courts actually wasn't at the new courts it was at the old courts because the new courts are too crowded uh because that's how much use they're getting at the mural Park and that was held by Cheshire homes and this is a group that supports those folks who are suffering from spinal cord and brain injuries and last but not least uh when we get to our the agenda item uh concerning our our Township dental program we have negotiated a three-year deal Which is 1.48% less than our last three-year deal that's all I have mayor nothing but good news excellent commissioner scar Pelly I have nothing mayor commission PCO yes I I just like to um say tonight also please keep locking your doors at night all of a sudden there has been a tick up with these um with these um car robberies again last night unfortunately we had a chase at a norc um to to um people nor chased them through not through bille bubble got involved notle got involved with finally a crash by um Target down Washington Avenue so cops are out there working hard they have tough jobs um today they I believe that they were involved in a shooting because we're really not even allowed to um Chase cars anymore so you know things are changing in the world hopefully they change this B reform and you know cops can um do their jobs again so with that being said just keep locking your doors also I would like to thank everybody that called me yesterday um text me did on went on Facebook and wished me a happy birthday was very nice of them and I really really appreciate it even though it was my son's birthday not mine that's what happens when you name your son after yourself but thank you for all my son's birthday wishes 29 years old whatever do be 29 again L but happy birthday with through the Township's online portal due to a system error she inadvertently submitted her credit card payment uh information multiple times resulting in an over payment of $30 and and postage of $128 now therefore be resolved by the board of commissioner Township of nly County of V that the treasur of the and is hereby authorized to refund her a refund in amount of $31 and 28 cents uh for the additional payment so move second commissioner Kelly uh I commissioner Evans hi commissioner PCO hi commissioner Tui hi mayor Kell supposed to go last that's fine it was a little wrong mayor Kelly hi again and then commission did I get everybody did I get everybody okay sorry about that there you go my next resolution 21424 whereas on November 21st 2023 the township nly authorized resolution number 29623 to enter into a contract with the law firm of UL scrio 14 Village Park Road Cedar Grove uh New Jersey uh and uh whereas a change order has been authorized for the original contract increasing the amount by $25,000 uh whereas the funds are available in account 301012 205 for 17,700 and 401 12205 for 7,300 and have been certified by the chief financial off set certification being attached to this resolution that therefore be resolved by the board of commissioner of the township of NY County of ESS state of New Jersey at the change order number one attached is a change uh from the contract previously made by the township with the law firm of tul scrio and is hereby authorized and approv so move second commissioner Evans hi commissioner Tui I commissioner scarelli I commissioner Petco I mayor Kelly I whereas on February 7th 2023 the township authorized resolution number 5123 to enter into a contract with the banker group uh 113 Orton Road West Coldwell for services uh related to uh Financial impacts of various free development projects within the township whereas change order number one has been authorized for the additional contract amount to be increased by uh $4,100 whereas funds are available in account 401 22625 and have been certified by the Chief Financial Officer said certification being attached to this resolution therefore be resolved by the Board of Commissioners in the township not the county of es state of New Jersey the change order one as attached is a change from the contract previously made by the township with the statute 54 col 4-3 do30 provides that War veterans who were honorably discharged from active service in the time of war in any branch of armed services of the United States who have been or shall be declared by the United States Veteran Administration to be 100% totally and permanently disabled and connection with their wartime service are entitled to a full tax exemption of their dwelling and the lot on which it is situated and whereas the following taxpayer has filed an application for allowance of full exemption with proper supporting documents ation thus making the taxpayer eligible now therefore be resolved by the Board of Commissioners of the township of nly County of Essex state of New Jersey that Omar uh Ruda be granted full exemption from payment of property taxes from July 22nd 2024 and all subsequent years thereafter on the property identified as block 5800 lot 18 known as 51 Manhattan Court need further resolve that the treasurer is hereby authorized to refund $2,944 2024 Commissioners of the township of nly in the county of ess6 state of New Jersey the treasur is hereby authorized to refund overpayment of tax charges in the amount of $1,661 for all of of the accounts of N and County of essic State New Jersey that the treasurer is hereby authorized to refund overpayments of water charges in the amount of $53 uh for the account listed in the resolution so move the Township Commissioners uh of the township of Nutley authorizing a contract with the banker group for services related to the review and preparation of the fiscal and financial impacts of various Redevelopment projects within the uh Township of of Nutley now therefore be resolved by the Board of Commissioners of the township of nelia in accordance with the local public contract law the board is hereby authorized and approves a contract with the banker group for professional Ser professional Financial impact analysis and related Consulting Services uh relating to various Redevelopment projects in the township at a cost and amount not to exceed $35,000 being further resolved that to Chief Financial Officer has executed a certification of funds for the contract and that sufficient funds are available from account 401 22625 for set contract be further resolve that the contract term shall be from February 7 2024 through February 6 2025 May further resolve that the mayor and clerk are hereby authorized and directed to execute seal and deliver said contract for Professional Services on behalf of and in the same in the name of the township we further resolve that the business disclosure entity certification and business entity disclosure disclosure of campaign contributions shall be placed on file with this resolution finally be further resol that a copy of this resolution commissioner Tui yes thank you mayor uh before I get into my resolutions when I gave the report on the lighting I left out one very important fact the lights were 100% G provided by public service through the vendor that we used to install it whereas the Suburban essic joint Insurance Fund here and after called the fund is duly chartered uh it's a duly chartered Municipal Insurance Fund is authorized by njsa 48 colon 10-36 and whereas the township of Nutley is currently a member of the fund and whereas effective December 31st 2024 said membership will expire unless early renewed and whereas the governing body of the township of Nutley has resolved to renew said membership now therefore is agreed upon as follows one the township Nutley hereby renews its membership in the Suburban Metro joint Insurance Fund for a three-year period beginning January 1 2025 and ending January 1 2028 two the township Nutley hereby ratifies and reaffirms the indemnity and Trust agreement bylaws and other organization and operational documents of the Suburban essics joint Insurance Fund Suburban Metro that is as from time to time amended and altered by the Department of Insurance in accordance with the applicable stat statutes and administrative regulations as if each and every one of said documents were re-executed contempor contemporaneously herewith three the township Nutley agrees to be a participating member of the fund for the period heing provided and to comply with all the rules and regulations and obligations associated with said membership and four in consideration of the continuing membership the town mle and the Suburban Metro joint Insurance Fund agrees subject to the continuing approval of the Commissioner of Insurance to accept the renewal application of the Surplus equipment no longer in use by the township on August 7 2024 and whereas Jersey 1 Auto Sales 495491 Auto Sales bid an amount of $412 now therefore be it resolved by the Board of Commissioners of Township of Nutley County of US state of New Jersey that the Surplus item be sold to the highest bitter Jersey one I move the resolution second commissioner Evans hi commissioner Tui hi commissioner scarelli hi commissioner PCO I mayor Kelly I whereas Township Nutley has a need to acquire dental plan services on behalf of the township and whereas such Services may be acquired as a non-fair and open contract pursuant to the provisions of njsa 19 colon 44 a 20.5 is appropriate and whereas iMac Insurance uh and Consulting shopped rates but none of the quotes were comparable to the benefits the township currently has with Delta Dental and whereas the township has negotiated with Delta Dental of New Jersey and has retained the three-year renewal rate with a 0% increase and a 1.48% decrease and a three-year reduction in a total amount of $ 4,735 and whereas the anticipated cost for the service will not exceed $375 ,000 per year and whereas funds will be available from accounts 51526 243 and 5577 243 and will be certified by the Chief Financial Officer subject to the adoption of the 2025 Municipal budget and whereas Delta Dental New Jersey has completed and submitted a business entity disclosure certification which certifies that Delta Dental has not made any reportable contributions to a political or candidate Committee in the township of Notting the previous one year and that the contract will prohibit Delta Dental from making any reportable contribution through the term of the contract now therefore be it resolved that the Board of Commissioners of Township Nutley County of ESS state of New Jersey authoriz the commissioner of parks and public property Andor the mayor to enter into a contract with Delta Dental of New Jersey for a term insertion of a special item of Revenue in the municipal budget when such items have been made available after the adoption of the budget whereas said director may also approve the insertion of an item of appropriation for an equal amount and now therefore be resolved by the Board of Commissioners Township andell hereby request the director division of local government services to approve the insertion of the following items into the revenue into the 2024 B Municipal budget um this grant is the track driving Crackdown Grant 2024 from 0 to 8750 National opioid settlement Grant from 0 to whereas the applications have been reviewed and approved by the municipal clerk and the police department now therefore be resolved by the Board of Commissioners of Township of Nutley County vess state of New New Jersey that the app for mentioned licenses are hereby approved and the municipal clerk is authorized to issue said licenses I move the resolution second commissioner Evans hi commissioner Tui hi commissioner scell commissioner PCO hi mayor Kelly uh the next one I have on for this evening is resolution number 28-24 this is to recognize September as National blood cancer month whereas the main types of blood and bone marrow cancer are leukemia NJ hodkin and hodkin Lymphoma and multiple Myoma whereas some of the common blood and bone marrow cancer symptoms include fever chills persistent fatigue weakness loss of appetite nausea unexplained weight loss night sweats bone joint pain AB abdominal discomfort headaches shortness of breath frequent infections itsy skin and swollen lymph nodes and whereas blood cancers are caused by mutations in the DNA of the blood cells and risk factors for the most common form of leukemia and adults is advancing age being of the male gender exposure to Industrial chemicals smoking exposure to high doses of radiation and history of other blood cancers whereas a blood cancer diagnosis often starts with a physical examination or view of a patient's health history examination of the lymp nodes and signs of infections or BR bruising biopsies Imaging scans and a complete blood count can also be used to diagnose blood cancer whereas treatment for blood cancer diagnosis depends on the type of cancer the patient's age how fast the cancer is progressing and where the cancer has spread some of these treatments include stem cell transplantation chemotherapy and radiation therapy whereas according to the National Cancer Institute surveillance epidemiology and end results see your program the PE percentage of people who are still alive 5 years after diagnosis is 66.7% for leukemia a number dramatically improved in the past 50 years and therefore beat resolved that the Board of Commissioners of Township of Nutley County of Essex state of New Jersey recognizes September as National blood cancer month so moved second commissioner Evans I just a couple comments uh be I vote Yes but just I want to add um being a cancer survivor of a blood B blood-based cancer um so I'm beyond the 5 years which is a good thing uh so I would add though uh that you may not necessarily have symptoms that you would notice right because they sometimes come on very gradually uh which was in my case uh I went to the doctor because I had a cold and wound up I had a lousy blood test uh so what I would say is so important to don't be afraid to go get a physical go get one go get one annually get a comprehensive blood test because a simple blood-based biopsy not the traditional tissue biopsy but a simple blood-based biopsy can detect uh the onset of one of these blood-based cancers um and if it's detective early it's very very uh treatable uh so uh and I would also add is that um stem cell transplants work had three of them uh and uh well well chemotherapy and radiation are a part of the process uh what is advancing rapidly is the whole field of immunotherapy and what that can do to create dramatic change in in patient uh uh patient outcomes so I I just wanted to stress that while I say yes please don't be afraid to go get a physical and go get a comprehensive blood test commissioner Tui hi commissioner scarelli hi commissioner p hi mayor Kelly and I would just like to add that this is special importance to my family my my Uncle Frank dejo passed away about a month ago from uh complications related to leukemia I vote I the next one I have on for this evening is resolution number 29-24 and this is to recognize September 2024 as National preparedness month whereas every year communities across our country face emergencies from unforeseen natural disasters to Del deliberate acts whereas during the month of September we encourage residents to rededicate themselves to important tasks of being prepared in the face of any crisis whereas by discussing with our families friends and neighbors how we will protect ourselves and our communities we can contribute to and share in a stronger more resilient Society whereas the best time to prepare prepare for an emergency is before it happens residents should take the time to review their own emergency plans and update their emergency kits and whereas federal state and local agencies have resources to share with the community as how to put together personal emergency kits and plans such as www.re .gv and www.epa.gov nural disasters and www.fema.gov may therefore be resolved at the Board of Commissioners of the township of Nutley County of Essex state of New Jersey recognized September 2024 as National preparedness month encourage all Nutley residents to recognize the importance of preparedness and work together to enhance our resilience and Readiness so moved second commissioner Evans hi commissioner Tui hi commissioner scarelli hi commissioner PCO hi mayor Kelly uh and September is also National prostate cancer awareness month and so I have resolution number 22024 whereas in 2024 an estimated 299,00 new cases prostate cancer will be diagnosed in the United States whereas 32250 men will die from the disease with a 7% higher incidents in black men than white men whereas the only wellestablished risk factors for prostate cancer are increasing age African anry family history and the disease family history of the disease and certain inherited gen genetic conditions smoking and excess body weight may also increase your risk whereas the American Cancer Society also recommends that men beginning AE at age 50 have a conversation with your healthc care provider about benefits and harms of a PSA testing so that shared decision- making can occur through communication and education whereas the American Cancer Society States due to early detection through PSA testing and advances in treatment the death rate from prostate cancer declined by half from its peak of 39.3 per 100,000 men in 1993 to 18 8 per 100,000 men in 2017 whereas early stage prostate cancer usually causes no symptoms but some benign prostate conditions can include weak or interrupted urine flow difficulty starting and stopping urination frequent urination especially at night and blood pain blood and blood pain or burning with 108th birthday of the United States Marine Corps Reserve whereas us involvement in World War I appeared more likely the increased demand for war Fighters warranted the formal creation of an operational reserve for and on August 29th 1916 president Woodson signed the naval Appropriations Act of 1916 which established the Marine Corps Reserve whereas the Marine Corps rapidly demobilized following World War I by 1922 the entire Marine Marine reserve had been demobilized into inactive status with 90% of Reserve Marines discharged leaving less than 600 Marines in the reserve Force to maintain Readiness during these lean years then Coman of the Marine Corps Major General John leun determined that a healthy Reserve component was a strategic necessity to compensate for diminished Act of force and rebuilding Reserve component was emerged as one of his top priorities Le jun's opinion in the event of War it is absolutely necessary that there be a Marine Corps prior to the emergency and adequate well-trained Reserve whereas Congress agreed with General leun on February 28th 1925 passed an act that superseded The Act of 1916 for the creation organization Administration and maintenance of the Marine Corps Reserve it was organized into 18 battalions and established an aviation squadrons which conducted drills in weekly 2-hour drill sessions Reserve Administration was concentrated in a single Staff Agency discharged veterans of World War I were encouraged to return to the ranks whereas a reserve group through the 1920s until it exceeded 10,000 Marines by 1930 the growth was noteworthy for the fact that reserves received no drill pay outside of annual twoe summer camp training had no purchase and had many had to purchase their own uniform items th it was F loyalty on the part of the Marines and their sacrifices which kept the reserves alive during lean years of the Great Depression whereas today United States Marine Corps Reserve stands ready to continue in the proud tradition of those before them who valant he fought and died combining a long proud and Heritage of faithful service to the nation with resolve to face tomorrow's challenge now of the New Jersey tenants organization he's the founding board member for 51 years his many contributions he has helped negotiate the senior ordinance and has drafted legislation and is a director of organizing New Jersey tenant rights he's also aligned with New Jersey citizens action he said he would be glad to work with all of you other senior tenants will be attending these meetings in the fall as they have expressed a need that is only fair and truly helpful those that are physically unable to attend have suggested a petition I'd like for you mayor Kelly to please arrange a meeting or phone consultation with Mr Hannon and me and here's the basic it takes a minute to insert the one sentence ordinance to help senior tenants it takes under five minutes for the five Commissioners to vote it in and I pray that the majority Will Rule and we'll do just that I have a hard copy of the ordinance uh that I'd like you each to have so Mr Bruno if you'd like to take it thank you thank you uh so we we don't arrange uh meetings with with our attorneys uh with to the general public of the town that that that would violate the attorney climent privilege uh but I did have a conversation W with Mr Hannan and Mr Bruno a couple weeks ago and Mr Hannon is is doing research and will be providing us with a memo related to this this issue uh uh it's summer uh i' I've been I I've been on National Guard Duty for the last two weeks so I haven't been able to follow up with him uh but I will be following up with him in the in the coming weeks anyone else wish to be heard uh seeing none I believe we have a need for an executive session you do mayor we have to discuss contract negotiations litigation thank you uh do I have a motion move it second thank you uh whereas Section 8 of the open public meeting act chapter 231 Public Law 1975 permits the exclusion of the public per meeting in certain circumstances and whereas the public body is of the opinion that such circumstances exist and where is the Board of Commissioners of the township of nut and the county of Essex and state of New Jersey desires to proceed to close executive session and now therefore be resolved that the Board of Commissioners of the township of Nutley move into Clos executive session to discuss contract negotiations and litigation be a further resolve that at the time when such discussions may be disclosed to the public shall be when and such disclosures may be made without adversely affecting the township of Nutley pending Andor anticipated legal Personnel contractual matters and other matters within the
