Good evening For the case of 20 24 0 0 9 7 5 10 10 Shady Maple Circle in O coi. This is a case that we have since March of this year, and we continue it, um, for October to the, we gave them to continue until October the 22nd. This was the person that came here and she spoke about buying the house and they paved the back without a permit and that she couldn't go into the back because they paved even the neighbor back to back on her property. Okay. She has not contacted me, um, not called me. She has not done anything with building department. So this is where we are right now. Okay. Recommendations. Well, what we did on the recommendation of the city, I gave her the 20 days, if not go into 50 days, $50 a day. Um, she had to come into compliance. Uh, they were given up to April 22nd, 2024. Then the case was continuing on May, and then we had, um, July, and now we are now in October. They have not contacted anyone since they came to the first hearing. Not at all. And I gave her my phone number before she left. Are they still at that residence? Mm-Hmm. And what's the timeframe that the, uh, city is asking for? Well, uh, I'm just gonna give 15 days. Okay. Edward Leffler, city of Ocoee, code Enforcement case number 0 1 3 1 7 re As regarding 1561 Dusty Pine Drive and the owners are present today as well. Okay, On April 22nd, 2024, while in the area responding to complaints of, uh, surface additions without permits, this officer did observe new cement framed paver block sidewalks on both sides of the house leading to the rear, while subsequently checking Orange County's website for an indication of when they were installed. A area of surface was also observed in the backyard on the same date, April 22nd, a violation notice was sent out, certified service by the clerk to the owners, Monica Freeman and Edward Freeman, Jr. Of the same address as identified by Orange County Records for violation of Ordinance 51 dash 13. Regarding permits required the owners were given until May 9th to obtain a reviewed, approved, issued and in possession permit from the billing department or to remove the unpermitted construction and return the property to original condition. On April 28th, the owners did submit a permit application and on May 14th and 15th, the permit was rejected by both the building and zoning departments and it was for six legal and lengthy reasons. Also, on May 15th, the building staff entered into the system and sent out a letter conveying to please address the comments from the zoning department and resubmit for approval on October 8th, 2024. Following a very reasonable timeframe, a statement and notice to this hearing was posted in the city hall, how a lobby and sent out certified service by the clerk. As of the state, the property remains non-compliant. The city was originally going to request a 15 day compliance timeframe and a fine amount of $25 per day for every day, not in compliance with any issued orders. However, since talking to the property owners, there seems to be a lot of confusion. Infusion on what zoning is finding and what building is finding with their pavers. I think they've been told they can get the back part permitted, but they have to remove the side part. So the city I'd direct to correct that to 90 days and $25 per day for any day, not in compliance with any orders you issue. So just to refresh, uh, 90 day compliance period? Correct. And, and, uh, what was the fine that? $25 25 per day. Alright. Do we have a date with respects to what? The 90 days? Uh, probably January Of. I was not prepared for that. January. January 20th. I went on the website, I called, um, you know, the building people, and they told me I needed to do an after the fact permit. Mm-Hmm. Due to the fact that obviously the work was completed. Mm-Hmm. Which is what I did. Um, then I got the rejection in May and I didn't understand why I, it was rejected. I did everything that we were supposed to do, submitted everything. And then the following day after receiving the rejection, me and my husband physically came here and we met with the zoning manager with, um, Ms. Woodfield. And we showed her everything. We asked her specific questions. And in that meeting, she did say that she would approve everything with the exception of the sidewalk walkways. She is claiming that, um, the way that our homes in this subdivision are, is built. There's a five foot easements on the sides of the home, and that you cannot put anything there. So, um, after doing some research, um, I'm a paralegal, so I work with lawyers and I used to do, um, land use development, um, years ago. Um, I went and I pulled my plat and I think there's a discrepancy in how she reads the plat and how we read the plat. Um, we read it that there's no clause or prohibition allowing us to build anything or put anything, any kind of improvement on the sides of our home. And I explained that again to her in an email or in my letter. I had sent a letter on May 6th explaining all of that to her. Um, I also pointed out that the materials that we used on the side were permeable materials. She said that the materials are not permeable, even though the website says that they're permeable. Um, I also pointed out to her that there's 22 homes in my same subdivision that have the same exact thing on the sides of their home. My neighbor to the right of me has the same thing on the sides of their home. We act, we have a picture of, oh, you can see in the picture that my neighbor has the same walkway. In fact, theirs is wider and it doesn't look at the aesthetically pleasing when you're walking. And that neighbor didn't receive a code violation. And a couple of my other neighbors that I'm friends with that have the same thing didn't receive code violations. So, um, we don't understand why we got one and we need to pull it up. Um, in addition, she also said that the front part that you see there, that's in the front window, that she would approve that. And then the aerial view of what she showed in the back, she said she would approve it, but she will not approve it until I remove the side, um, paved area. So that's where we're at now. I don't know if my husband, I just gotta interjected. There's, there's a several houses in the neighborhood that also got cited. Mm-Hmm. Some of them removed and some of them got actual permits. It might not have been as big of, I don't know. Do you know if any of those places were, were given a variance by zoning to, uh, to, to allow for that Inc. Egress and into that five foot ea? You're asking me? Yeah. Do you know anything about e egress? No, I do not know. Okay. Anything variances are, we have require a hearing In between. If you look carefully in between, there is grass in the middle and ours is not the, the whole width of our property. Okay. It's three and a half feet. Yeah. Which the other side, they took the whole thing, but we took three and a half feet. So we don't have, and then before we had the pavers, we had grass which damaged the side of the house that you Could see it on The, so now with the pavers, we fixed it, and now there's no damage, no erosion, no, no anything. So the grass actually was ruining the house compared to the pavers. Right. So the city's position is hoping that 90 days is enough time for the city and the property owners to figure out what to do with that side piece. And what did the city say again? I actually did bring, uh, as an exhibit Her, her, Their comments. Yeah. Their position is that you cannot put anything on the sides of your home on the side part of your home. So then I went in further, you could see I, it's documented Mm-Hmm. In pointing out to her that the AC units on the sides of the home are on the easement. So I'm like, how did the city allow that? But I, you are saying that nothing can be placed there. Did they say Why? Because the, the builder made a mistake And there's nothing that they can do about it. Now, I even took it a step further to point out, it's not just the AC units. The, there's people who get, um, the gener generators. Yeah. They put 'em on the easement and they have a concrete slab. And my neighbor to the left of me even has a water softener that's placed on a concrete, concrete slab. So where are, where, my question is, where are you supposed to put any of these things when you make improvements to your home, if you're not allowed to put 'em on the size of the home, if you're claiming their easement, there's Easement that would, that would be a reason you would want to discuss that with the zoning department and ask about variances and things like that. And today, you can't fight the battle for your neighbor today, you're here to, for you. Yeah. Yes. Which I to understand That. So, you know, and I, and I appreciate you saying how your neighbor did bigger and you did smaller. So according to, uh, Sergeant Beck, you were just speeding a little. Okay. So did I call that right? Okay. Obviously that's what the 90 days is for. Yeah. Oh yeah. Yeah. And The main goal is since the violation is no permit, yes, they can, they have a back patio and the little front one that still remains without a permit. And the only way they're gonna get that is to work it out somehow. With that side piece, You're gonna have to really work that out with zoning. And so Do you suggest we come back here to speak With them personally? Well, we're gonna, we're gonna make a ruling, um, at this meeting and hopefully by us setting, uh, a timeframe as like set by this, uh, the city here, or recommended, but set by this board, maybe that'll light a little bit of a fire and you can go to zoning and say, Hey, I only have 90 days to get this done. I know there's holidays and Thanksgiving and Christmas and New Year's and all that stuff, but we gotta get this done. Okay. Okay. If not, I'm gonna be before this board again or paying a fine. Yeah. You, you Need to go before zoning though. Yeah. Okay. Zoning. That's Which is the same person we went to before. Yep. Okay. Yeah. You're gonna have to do some battle with them and, and request a variance if you, if you can, I don't know if they'll give it to you, but, you know, you gotta state your case, plead your case, and, and Go from there. And we explained to her, we don't have a problem with, with paying whatever the zoning Yeah. Whatever has to be paid for sure. Because everything came out to a pretty penny. Yeah. Yeah. And in fact too, on the back of the home, um, she also addressed some stuff with the back of the home there behind our wall. Our property backs up to a brick wall. Um, and then on the other side of that is a trailer park. A trailer park. It's West Orange Park, I think it's called. In between there, there's a track, track O that's owned by RHOA according to the plat. That's where the easements are On comment number two, they described track O as not within your property, which belongs to the HOA, But that's where the easements Right are. But she's saying they're within my property. No, no. That's, she's, he officer's saying they did, they're saying it's, Excuse Me, officer's saying that, they're saying it's not. That's what they're denial. She said that. Oh, well then that's in our favor though. Then if it's behind in track O and it's not owned by me, then These are the same comments that are online. Officer Rodriguez for the City of Ocoee Code Enforcement for the address of nine one Ridgefield Drive. On June 13th, 2024, the Ocoee, um, the City of Ocoee received a web form complaint in regards to a garage totally enclosed or converted into a room without a permit. Let me get the pictures here. Here you can see from Orange County the picture that they, uh, the garage was not enclosed on June the 13. On the same day I did, uh, see that the garage was enclosed without required permit from the city of Ocoee. Uh, let's go down. On June 13, the same day the notice of co violation was mailed to VAR E at 9 0 1 Richfield Drive naco Florida is identified by the Orange County property appraiser for the violation of the ordinance number chapter 51, building code section 51 dash 13 permits required they were given until June 28th, 2024. I did verify with the USPC delivery attempt and verify that they didn't receive the notice of violation certified mail. So on July the first of 2024, I posted the revised NOV notice of violation give, giving them until July 16th, 2024. On July 11, I received a phone call from Mr. Navarro, the owner of the property, indicating that he is taking care of it with the permit with the building department. On July 16th, 2024, I called Mr. Navarro for an update and he requested a two week extension, which I did granted until July the 30th of 2024, on August the sixth. Once again, I called Mr. Navarro and he indicated that he hired a contractor and they are dealing with the building department. On August the sixth of 2024, I received a call from the contractor, Hector from Sunshine Contract LLC, indicated that he was waiting for the architect drawings in order to submit with the permit application and will keep me updated. On August the 20th of 2024, I called the contractor, I left him a message to call me back and never did. On October the seventh of 2024, the notice of hearing was posted at the property on November 11th, 2024. An application was submitted by the contractor, sunshine Con Construction, LLC, which was rejected from building department due to needed documentation. And as of today, the property remains still not in compliance with the city. So this is a city issue. Officer Rodriguez, this is not the count. Is this this our city or the county? Uh, no. Orange County or co? No, it's us. Okay. Yes. Okay. And the city's recommendations, The city recommendation. On July 23rd, 2024, the city received a phone call complaint in regards of this property having a junk car parked in the front of the yard. On August, on August the fifth of 2024, I observed the inoperable vehicle parked in the front yard of the property. The same day a notice of co violation was mailed to Barang brothers property, LLC 1 1 0 East Broad Street, Groveland, Florida 3 4 7 6 3 6 dash 4 0 0 2. And also posted on the property 1409 Snowden Street in Koi, Florida, as identified by the Orange County property appraisal for the violin sheet of the ordinance. Chapter 1 6 5 vehicles abandoned and junk section 1 65 dash four presumption of evidence of a abandonment they were given until August 21st, 2024. And on August 22nd, 2024, I reinspected a property finding a night in compliance with the city. Let me take the pictures here. These pictures were taken today when I, uh, October the seventh when I post posted the property. They're huge. Yeah, they have flat tires. It came out huge. Um, on October the seventh of 2024, the property was posted with the notice of hearing board meeting. And as up to date, the property remains not in compliance with the city. Uh, it's the city recommendation of 15 days to come into compliance thereafter to be assessed $50 per day, if not in compliance. Okay, let me show these pictures. On August the eighth of 2024, I receive a phone call complaint for this property with the overgrown grass and weeds and an abandoned awe untagged vehicle that was the grass. Mm-Hmm. On, on the same date and on August the eighth, a notice of co violation was mailed and, and posted to Clark Sharon and Casanova Orrin at 1324 Vicar Lake Drive in Ocoee, Florida as identified by the Orange County property appraiser for the violation of the ordinance. Chapter 1 1 15 nuisance section 1 1 5 dash three, declaration of nuisance and menace b ex excessive weeds or grass growth. Also for the vehicle, it was a chapter 1, 6 5 vehicles abandoned and junk section 1 6 5 dash four presump of the evidence of an abandoned vehicle AB one A, they were given up to September 23rd, 2020 fourth. On September 24th, I re I reinspected the property finding not in compliance with the city. On October the seventh of 2024, the property was posted with the notice of hearing board meeting. And as of today is in compliance with the city. Um, the case is being presented for future repeat violation If the board wishes to rule, um, as the city recommended, that would be page two, uh, of your motion sheet, the second one there with the red, uh, next to the name. Okay. Uh, what is your recommendation, officer Rodriguez? Well, my recommendation because, um, they gave me a very hard time to come into compliance. I was dealing with the president of the HOA, so that's why I wanted, uh, even though they didn't come into compliance for the date they were supposed to, and they did. Now, as of today, um, I just want to have it presented just in case for the future. So is you said it was the HOA that you were having an issue with? No, the HOA was the one that complained. Complained. Oh, the HOA was the one that complained? Yes. And the but it was the property owner that was giving you a difficult time. That's correct. Uh, I just brought it to, uh, just wanted to bring it to the board's attention that, uh, this resident has been in violation of HOA, uh, uh, requirements as well. And the HOA has sent this, this particular instance to the lawyer. And I have notified Mr. Loeffler on four different occasions regarding this resident. And he totally disrespects any authority. Um, I have gone over to his house and tried to speak to him when the con contractors were on, on site working. His garage doors were open, he was obviously home. He refused to answer the door even acknowledged me. But, uh, his, the, uh, I had reported to the HOA on the day that the hurricane was coming on October 9th, that he had, uh, quite a bit of debris out back of the house for the construction. And no one was around. I'd gone over there to see if they would pick it up. I have pictures of the debris. The HOA, uh, one of the board members on our HOA was out and about and the officer, I'm sorry, you can display pictures. Officer Vincenti had come by and she said one of the board members had notified her that the debris was out. So she created an incident report, didn't run it, just run it up the chain, but not, uh, uh, uh, actual report just in case something did happen that we'd have a number, a reference number to come back to. I have her card and I also have pictures with date stamps of the contractors continuously working on this, uh, residence. And I don't know if they've had a work stop order or not, but I just know that the HOA has told 'em that they're not in compliance. So, um, these, these are from, this is from the 21st. I know you don't wanna see all the pictures, but I have pictures from the 18th, 19th, 2020 first. And this is just some of the debris that was laying out, which way is up on the right. It's kind of, there you go. There we go. There you go. During the hurricane that the neighbor on the other side of their residence had gone over with me to pick this stuff up Just so that it wouldn't blow into our houses. So he did not, he was not even in the area to secure anything. Um, I have arc re copies of ARC requests, um, that he had submitted to our HOA to install a fence. And on those arc requests, we can make comments. And I requested that the board, the ARC board, uh, deny his request until he fixed my sprinklers that the contractors had run over with the, uh, equipment, equipment that they were using. And also, as you can see, I could go through here, but the, the neighbor on the other side did the same thing. They, they, uh, had ruined his sprinklers and some of his grass that they requested that he, he resaw. They had acknowledged that and agreed to do that and apologized. And then again, uh, there's their apology. But then again, uh, I believe it was on October 11th or somewhere near there, I had requested again that they've run over 'em again and it's still, it's just a mess. It, it, it remains a mess to this day. The runoff from the back, I don't know what they've got for, you know, to make the runoff go wherever it's supposed to, but it's degrading our embankment. Matter of fact, there's the property line right there and the flags right here are my sprinklers. But he's, I don't care if he's over the property and I don't care if he ruins the sprinklers or the sod if he would just fix it when he's done. But he refuses to acknowledge or even say boo to me when he is there. Uh, uh, I don't know. He, they, but they only visit every other weekend. They come on a Friday and leave Sunday. So I don't know if it's their primary residence or, or what the, how they, uh, use that residence. But I just wanted to, uh, bring to the board's attention tonight that he, uh, continuously, um, disrespects authority in, in not just the zoning or code enforcement, but Understood. I know it's a small consolation, but at least we can impose a fine lien tonight. Thank you for allowing me.
