Case number 2 0 2 3 dash 0 3 6 1 3. Address, 2 7 0 3 Plum Ave Coley, Florida on November 11th, 2023. Upon arriving at said address, I noticed installation of brick pavers with no permit posted. I then called building department to verify if there was a permit for such installation and no permit was issued on 11 21 23 and notice of code violation was posted on property at 2 7 0 3 Berry Avenue Accord, Florida homeowner, Courtney Barclay as identified by Orange County records of violation of ordinance 51 51 dash 13 regarding work without a permit they were given until 1 16 24 to obtain a permit. Permit was applied for on 12 4 23 and was rejected by a building department on 4 14 24. Notice of hearing was sent to sent out certified service for hearing on this date. Signed on four 16 for proof of service and as of today it is not in compliance with the city. It is the city recommendation of 30 days to come into compliance thereafter be assessed $50 per day, if not in compliance. Alright, any discussion questions for the officer? I have a question. Do we know why the permit was denied by the building department? No sir. By any chance? No, sir. Um, that's something that I don't, um, dig into. Once we, um, do our part then the building department goes to inspect and then they will get with the homeowner as far as what needs to be adjusted in order to get the permit. Okay. Thank you. Were you able to, So are they required to resubmit another permit? Is the homeowner required to submit another permit, another application for permit? Well I don't think they have to re submit another permit, but they have to adjust whatever the issue is in order to get this permit issued. The one that they, that they originally applied for? Correct. There's just been rejected a few times and they need to uh, do what the building department wants them to do to get approved and get final approval. Which could be rip some of it out. I'm not quite sure. Could be too close to the property line next door, but um, that's for the building department. It's been going on since November. Right, Exactly. Yes. I personally, I don't think that $50 a day is a fair amount. I think it needs to be less than that. This is not a hazard or anything, it's just a building department and the homeowner have to come to an agreement penalizing 'em for not following the rules. Yes. But I think $50 is probably a little too much. Remember Brendan if you'd like to make a motion Sure. If I can Do that, we'd love to hear it. Okay. So that would be the, That one. Okay Mr. Chairman, I'd like to make a motion Yes, That in case number 2 0 2 3 0 3 6 1 3, that the respondent be found in violation of the code as cited in a compliance state of January 16th, 2024 and be given 30 days till May 23rd, 2024 to come into compliance. So we fined $25 per day per violation, which is only one until found, until it comes into compliance. I second it. Okay.
