Two junk inoperable vehicles, tall weeds and grass, and miscellaneous junk, trash and debris. On February 27th, 2024, this officer observed portions of the property with tall weeds and grass at the fence line and underneath the junk cars and around them, the backyard. No address numbers visible from the street on the building. Two junk inoperable untagged vehicles next to the home and the side yard and miscellaneous junk, trash and debris and old furniture littering the front yard. February 27th, a violation notice was sent out to the owner as identified by official records, the Betty Prick Estate in Lake Mary and was posted at the location for violation of ordinances 115 dash three B regarding a tall weeds and grass, 54 dash three A1C and D regarding the display of address numbers required, 1 65 dash three A regarding the two junk vehicles and 1 0 8 24 D regarding the junk and debris littering the property the owner was given until March 10 to comply with the codes. Decided on March 11th, re-inspection revealed non-compliance On May 16th. A hearing notice to this meeting was sent out, certified service by the clerk and posted at the location and in the city hall lobby. As of the date, the property remains non-compliant with the codes as cited. The city is recommending a compliance timeframe of 15 days and a fine amount of $25 per day per violation for every day, not in compliance with any ordered issue, any orders issued. Does anybody have any questions for the officer? No questions for the officer. Just discussion. Um, so the recommendation was $25 per day per violation. So there's four violations here. Um, I'm, I'm inclined to, you know, maybe 50 per day. Uh, I mean that's a hundred dollars a day. Um, I don't know what the other members, um, think of that, but my, my, um, recommendation would be $50. And if nobody else has anything else, would you like to make a motion? Uh, I guess I will. Good evening. Diaz Case number 2024 dash 0 1 0 4 1. Address of the property is 1 3 5 Lyle Street in Ocoee, Florida on March 29th, 2024. I received a complaint about the above-mentioned property. I inspected the property and I observed junk and debris throughout the property. Beer cans, bottles everywhere, and mattresses bottle jugs filled with urine and outside in and outside of the property, plumbing throughout the house, not working. Discharge pipe is not connected to the sewer of the septic property, has multiple broken windows. According to the complaint, the, uh, occupants are using outdoor for urine. And number two, nasty and, and uninhabitable property is a public nuisance and it's not being maintained and in a safe and sanitary condition. On April 1st, and let me show you some of the pictures, that's what the bathroom looked like when I went in it, it was not working at all. The le the ju the guys let me in bottle of urine inside the house. That's the kitchen sink under the sink, bottle of urine outside the house, the discharge pipe for the plumbing mattresses and the broken windows on the property. And the beer cans. Uh, I'm sorry, officer Diaz, can you go back to the kitchen for a second to the kitchen? Can you go Backwards? You wanna see that? Yeah. Yeah. Okay. If you can just start right there. Okay. On April 1st, 2024, a notice of code violation was mailed to Galvin Joaquin at 6 0 9 Spring Lake Circle, Ocoee, Florida 3 4 7 6 1, as identified by Orange County Property Appraisal for the violation of ordinance number 51 dash thirteens permit required for the plumbing. 1 0 8 dash 35 public nuisance. 1 1 5 dash three, declaration of nuisance and menace for the junk and the debris on the property. 1 0 8 dash 23 for minimum standards codes for every floor and every toilet. Number one and 2 1 0 8 dash 19 minimum standards for basic equipment and facilities for sanitary facilities and the location of it. Okay. This paper, paper, paper. Okay, one moment please. They were given until April 24th, 2024. On April 25th, 2024. I reinspected the property, finding it not in compliance with the city. On May 1st, 2024, the property city hall was posted with a notice of hearing to this board meeting. As of today, the property is not in compliance with the city. City recommends 15 days to come into compliance or a hundred dollars per day per violation. And for the property owner to repair or to demolish the structure. City also requests the right to board and secure the property if vacant it. Officer Diaz, I have a question, Mr. Chairman, go ahead. Stand corrected. Um, do you know if that's, um, the HOA No, it's a, it's not HOA. No. And, uh, is it a realty company that No, sir. It's a private owner. It's a private owner. It's one person owner, yes. And you said that there were guys, Um, the tenants in the property is rented out to a bunch of, um, single men. Mm-Hmm. Um, and, uh, according to the neighbor that is here and a lot of the complaints that came in, they're drinking out there. They're just, there's no plumbing working. So they're using it somewhere. Can I, can I, Mr. Chairman, may I say ask the, um, respondent to come up to the podium in a, in a minute? Yes, sir. We want to finish hearing from the officer and if anybody else in the court has any other questions. Okay. I just wanted to know if that was okay. Yeah. And, and so, uh, officer Diaz, I, I'm trying to put this as, um, civil as possible from what Do you, Do you think that's being used as some type of drug? Um, that is their, that is their fear as well. I don't know. I cannot. Right. I, I, I, That's why. But their fear can be, yeah, bunch of, we just did see the drinking, but that's all that I observed when I was there. Structure, yeah, I, I was just trying to make an assessment of what's going on. Um, you know why I said that Mr. Gaines, if there were other people coming in. 'cause if it's like a crack house or addend, then there's other people that can be squatting there. That's why I said that. That is, that's all. Yeah. Officer Diaz, um, your recommendation, just to refresh my memory, was a hundred dollars per violation per day. That is correct. And that's, uh, and for those six violations, correct? That is correct, sir. Yes. Six. Alright. Does any of the other board members have any other questions for the Officer? Mr. Chairman? Um, has there been any contact with the property owner? Not at all. No contact whatsoever. Okay. And just for my, um, understanding and, and for probably planning for the future, um, so if a property like this, I, I don't know if this is toward to you, Mr. Uh, Mr. Counsel, but, um, is, is this something that the city has the ability to take ownership of and foreclose and um, demolish? Uh, this seems pretty bad for the conditions. I'm just trying to get our options for the future. There Are procedures that would permit that. This is clearly a nuisance, I think. Agreed. Mm-Hmm. What has been recommended is a violation a hundred dollars a day and was it 6, 6, 6 violations, violations, violation, $600 a day. And, uh, that means the, uh, the bill is gonna run up pretty quickly and if they don't fix it, then the city can foreclose on it, tear it down, sell the dirt. So there are, there are ways, and this is just the way that's more typical than not the other, having a court hearing to find a nuisance is a little bit more tease. Thank you. Alright. I have a question. You also mentioned, um, giving permission to the city to board up the facility. Yes. We would like to board it up and safe, safe it up. Um, When, when would that be done? After, Um, after, if we do not hear from, if the board decides Mm-Hmm. Uh, for the 15 days, then after the 15 days you can allow the city to, um, secure the property and we would board it vacant. Yeah. If it, if It's vacant, it has To be vacant. Yeah. Oh, Oh, oh. So does that fall within any of the violations? The code violations set forth? That would be a separate, No. 1 0 8 dash 35 is public nuisance. And it does state 1 0 8 dash 35 does. State public nuisances are defined, um, when nuisances conditions or hazards to generate or cumulative impact on structures, dwellings, or other dwell buildings regulated by the minimum standard codes. To the extent that repair, removal, securing, or demolition is necessary for the public health, the enforcement board is authorized to order the property owner or city agents to repair, to remove, to secure, to vacate, even demolish such structure according to the procedures outlined herein. So these powers you do have, So my question is, how do you verify that the property is vacant at the time, at sometime after the 15th day? So, Um, one of my, um, recommendations was, uh, to have the owner make sure he vacates it. Um, how would I make sure I would, um, have to go out there, look at it, knock on the door, make sure there's nobody there. According to, um, the lady that is here to speak that lives across the street, which is being affected by all of this, is, uh, she mentioned to me that they did have, um, the guys did seem to leave three or four days ago. Um, but she's not sure because the property is still open. Right. So they can come and go and if they wanna somewhere to drink, they could go there. So. Understood. Um, that's why we're requesting to board. Okay. So just the last question. So what's the definition of a resident then? If it, if it is, um, say that again. Sometimes empty, sometimes with someone there once our threshold for being a resident or it being inhabited. What's the threshold for being vacant? How, how often do they have to be there for you? That I'm hoping that the owner will contact me and I can relay the message. Um, I have to go out there and take a look. That's up to the board to, yeah. I, yeah. I wish I can give you a better number. And the last one is, does it have to be 15 days or can you make It the board has the board makes the decision. Yes. Right. I think they dump it in business dumpsters and vacant properties in the area and a old trailer always on the side yard. Same thing, always full of limbs and junk On May 17th, this officer did observe an older red truck with no license plate, any large flatbed trailer parked on the side front yard. So there's the truck with no tag and exhibit B, that is the trailer on the side front yard visible from the street. Both of them On the same date. A violation notice was posted and sent out certified service to the property owner Leonard Williams, same address as identified via official records for violation of ordinances six dash four H six B regarding the prohibited trailer location and 1 65 dash three A. Regarding the vehicle without a license tag, the property owner was given until April 28th to remove the trailer and relocate it to a location and manner allowed by code and to remove the pickup truck or relocate within an enclosed garage or make operable with the attached display of a valid license tag. So he was given the option to remove the vehicle, remove the trailer, or given the option of ways to maintain and keep the truck and maintain and keep the trailer. I've had no contact with the owner when I'm there doing the postings. I did notice that the truck has since been relocated and backed up to the garage door. So you can't see the tag. On April 29th, the location was reinspected and found non-compliant, but the truck turned around and backed up to the garage door. The trailer remains in the same prohibited front yard location on April 16th. A notice to this hearing was posted and sent out. Certified service. As of the state, the violation remains compliant. The city's recommending a compliance timeframe of 15 days and a fine amount of $25 per day per violation for every day not in compliance with any issued orders. And of course with code enforcement the burden of proof on that license plate is upon the property owner to contact us. So with the truck backed up, we can only assume it still Does not have a take tag. Mr. Chairman, I'd like to make a motion. The respondent be found in violation of the code as cited as of April 28th, 2024 and be given until June the 12th, 2024 to come into compliance or be fined $25 per day per violation until found in compliance.
