incorporation of recitals providing for an effective date this is sponsored by city manager and it would be included on the agenda again as 141 all right Mr manager can you state the emergency nature of this item yes um we just had a workshop on the um on the workshop on the HVAC system uh as many of of you all know um our HVAC system is uh old and dilapidated here within City Hall uh and we're looking for the funds to secure it uh in addition to that we have some several other very pending issues such as the uh maturation of a bond that will require $3.2 million pre uh uh balloon payment in June 2025 as well as a deficiency in entrance payments from our current bacon vendors so all of these things uh severely impact and hamper uh the city in a financial uh in a financial way uh we want to uh move forward with these items and hopefully um be able to replace our hbac system uh the RFP uh is already out for the hbac system so we should have a vendor vendor soon uh putting this forward will give us some means to actually actually make those payments uh this is a dire need as we did have uh about two months of reprieve there in in November and of 2023 and January of 2024 uh where our uh HVAC system really was underutilized uh starting in February as it was in November we started seeing breakdowns again uh to the point we just recently had uh a breakdown of uh AC coverage in our server rooms our server rooms uh house all of our data uh and at the risk of losing all the city's data we actually opened up the doors turned on the fans and the hallway was extremely hot uh we were able to get some emergency vendors in there uh but we really really really uh want to move forward with this item so that we can uh mitigate this issue thank you Mr manager can I get a motion to add virtual public comments okay so for those of you that in the chamber citizens form is open Brian Dennis address 2140 York Street it is amazing how a park plan came about all of a sudden now I'm the chairman of the community relations and Park and Recreation and activities board and I remember at the last c c c meeting somebody was saying that we were trying to control something one trying to control nothing but you have to see things for what it really is now here Ingram Park from last year to n would have been flipped and done everybody know it 16 year old boy from the city of opaka works for a world famous athlete who was going to flip that Park and do all the work to it for nothing it ain't concerned about no interest in or out of it or anything like that so now all of a sudden something that was so minimal now get ready to cause a problem now we went from supposedly where y'all stayed on the corner a water park T now we talking about homes or tow houses or apartment buildings now we know sheet rock need to be done on every last one of these parts especially where the old King Hospital used to be at I mean l Rock got to be dug into all the way to the ground to the te but we have a a thing of creating Illusions like we are doing so much and we ain't doing nothing and the words of Biggy Smalls it was all a dream so we see this and it's been going on for a whole year now I'm the chairman so guess what we we would had the Arabian Nights done this year we already had the deals on the table we already had the sponsors willing to come in from last year to now but guess what we got nothing now isn't it amazing that the very same weekend that you had the Arabian Nights that K City and Central had something I'm just saying it looks strange when you trying to do Jan Avenue um I have two things that I'd like to say this evening first um on a positive note just a sincere heartfelt thank you I extend my gratitude um to each one of you as the commission uh the city man manager Miss Lawson Miss Brown we had an absolutely fantastic turnout with manifest an inaugural event that celebrates our community's identity and our heritage um for those of you that were not aware it's something that took place at our historic fire station up the street and we welcome several hundred opal Ain and the region to enjoy our city with a handful of performances so needless to say I just wanted to publicly thank each one of you um for believing it the manager's office for supporting it um it was a very tasteful event that turned out quite well that I'm very proud of to have been a part of um on a second note um uh working here in opaka for the nonprofit 10 North group formerly opaka Community Development Corporation we have a very exciting update for opaka for Miami data in South Florida um and that is an initiative that started back in December that got Revisited in Jan January and has subsequently been coming up at the state level with the state legislator and that is for the proposed location of a future Florida museum of black history um this is legislation that the governor and the legislator had proferred back early last year 13 locations were presented back in December 10 North was involved in essentially preliminarily pitching opaka and the state Regional complex just in front of this building um um and it turns out as of last week we have now been uh made a finalist of three locations to potentially welcome a worldclass um institution cultural facility exhibition space Performing Art Center there's a number of different um levels that are required per the legislation that would be funded by the state um mayor Danielle LaVine Cava commissioner Gilbert Ashley Gan our representative Senator Jones have all put their backing to it um and we are in preparation of the May 21st meeting up in Tallahassee which the mayor is aware of and the city manager office has also been supportive as well um we are nearing the finish line and I just want to express this and make it aware as a resident and adopted opal lockin to the rest of the community just how important exciting and positive this is for our community um that we even have a seat at the table and a very serious discussion about an important Institution um being implanted not just in opaka but representative of all of South Florida and the black community for the entire State of Florida um this could very well become the home for it and um needless to say I just wanted to share that with the public and thank each one of you thank you thank you Alex citizens form Mr Cooper thank you again Mark Cooper I want to bring Mr Cooper let's start over it your name and Mark Cooper 6801 Southwest 75 Terrace Miami Florida how are you good evening everyone I just want to bring something to your attention this is not related to litigation something else yesterday there was a code enforcement hearing I I gave you guys what I presented at the hearing I received a citation for a property that I purchased but it was made out in the prior owner's name so it was an easy citation I went to the hearing I provided in writing thinking was an easy case to win and it became a struggle with the magistrate she took about five minutes to try to contort Every Which way to figure out how she could make me guilty finally she dismissed the case so as I was going home I was wondering why why is this is the second time I've complained about this judge why is this judge doing this and I've come to the conclusion that what happens is there's no City attorney president at those hearings and I thought we already addressed this and you guys were going to have a City attorney there so what it ends up happening is that the magistrate who's supposed to be a neutral party ends up taking the place of the advocate for the city and it kind of blows up it blows up the Justice of the hearing you're you're there arguing a case there's no way I could lose this case it's it's like I'm I'm driving a car drunk my passenger we get stopped he gets the ticket I'm driving it's here there's no way he can lose and I'm about to lose and I'm wondering not everyone has the time and the energy to come here or go to a hearing or write up a motion or all of that and if I can't do it not that I'm the greatest if I can't get it done there's a problem and so the idea behind a magistrate hearing is is the cities and municipalities are allowed to have their own judicial process it's quasi judicial to help tickets get resolved and you know compliance get done but if the city attorney's office is not there and the judge is acting like an advocate for the city we have a problem I was a member commissioner Kelly chose me a long long time ago to vet the attorneys who were going for the City attorney position when we had the former City attorney that was a mess and I remember we were offered gold frankincense and myrr to the services we were going to receive and we're paying a lot of money but at these hearings where it's due process and property rights and money rights and it puts the onus on the property owners to then go appeal to the Circuit Court and spend the time and the money not everyone has it I've done it it's not easy the city has the responsibility to present a product a magistrate hearing and a magistrate Who's acting on behalf of fairness and not as the advocate of the city because the City attorney is not present please resolve this thank you thank you Mr Cooper citizens form is still open all right hearing none seeing none citizens form is now close um so going back Mr Dennis Parks plan we're currently discussing it you were at the meeting today um Mr Cooper we will get an answer for you um we'll get an answer for you um Al Al we're going to discuss that later on in the meeting and thank you for the hard work for manifest it was a great event all right so we're going to move on if we have no concerns from the commission citizens form all right going into our consent agenda item 121 a resolution of the city Commission of the city of opaka Florida authorizing the city manager to conduct a feasibility study to explore the advantages and disadvantages of the city transitioning from a fay work week to a 4-day work week starting fiscal year 2025 2026 providing for incorporation of crital providing for an effective date this is sponsored by mayor tayor okay can I get a motion move for discussion move by commissioner Kelly second second by vice mayor this is my item um this is something that I profer a couple Maybe couple years ago of taking our city to a 4-day work week one that would extend the business hours here in City Hall allowing people that get off at 5 o' uh access to our government building however I wanted to see what it actually would look like in the city of opaka which is why I asked for a feasibility study which the manager would bring back to the commission present it and then the commission at that time with the manager will make a decision on whether or not we want to move forward with it and it was it was was pulled by vice mayor and seconded for discussion so vice mayor you want to yeah I just even before the feasibility study I mean I'm thinking a 4 day like we struggle now with keeping the city clean and stuff like that sometimes they're working six days a week opposed to 5 days a week and now they cut it down to four days a week I I I hear what you're saying about the um us being there after five but I'll say this it it wouldn't this wouldn't go for everyone so certain departments would not qualify but again that's why we were doing a feasibility study so the manager can see okay maybe obviously we know police will work 24 hours a day Public Works will probably be working around the clock but there it he has to break it back okay I I read everything I didn't see where it specified certain departments or which departments so bring it back during the study okay thank you Mr Mayor commissioner Kelly thank you um yeah it's part of the study because um every city is different a lot of cities do have the 4- day work week um but every city is unique so I would look forward to it coming back uh from the manager on um the recommendation and I I'd like to um co-sponsor it too think it's a good something to look at yes sir I will accept all right um any other question on this item not a question Mr Mayor my concern well for me I need to see the study first before I make a decision all right okay again we're only voting on the manager doing a feasibility city of opaka support for allocating a Florida museum of black history within the city of opaka allocating $50,000 for the hiring of a consultant promotion of the opaka regional service center as the proposed site and provide for communication support providing for incorporation of recitals providing for an effective date this is sponsored by vice mayor Irvin all right can I get a motion move it move by um commissioner bass second second by Vice May Madam Vice May is your item you can go and present yes I thought it's a something that we need to look into further since we um started out there was 12 loc uh cities that were were interested and we were a part of that 12 and now we're down we actually made it to the final three and I think that it will be something very nice to have in our city uh black Museum right here in our city and uh that's where we are okay so this item was pulled for discussion commissioner Kelly thank you Mr Mayor and let me just uh say up front I'm not opposed to history black history being in opaka the center being in opaka um I would love to see it but I also have some questions so let me just um direct my questions and see how this transitions um from just hearing and reading this process has been ongoing since December and the resident just said that but also from doing some some research uh I never saw it come before the Commission in any form um about a co-sponsorship a co- supporter ship an endorsement or anything um so let me ask the first question was that ever done would that ever brought forward for the commission to even support this item back when it started that's to the sponsor well I'll say no it was never brought towards the commission okay it wasn't brought to the commission so let me just start there and again I appreciate what uh vice mayor is saying um but I'm always looking at the details I always have a challenge when folks go out advocating um and it's nothing against the 10 North group any other uh entity that wants to bring things to the city but I don't like as an elected official being brought in secondarily after things have start moving to me this should have been brought to the commission when it was first come up in the legislature passed it and proposals could be accepted it should have been proper then um for the commission to be involved I'm quite sure we probably would have supported it in some form uh that's number one number two we're talking $50,000 uh dollars to support the application I'm not sure exactly what that means supporting the application since it's already there we're in the top three um and then it says to hire a consultant to promote the service center as the site how would we as a city given that they're going to meet again next month uh middle of the month hire a consultant that quickly um through our process that would know and be able to do whatever it is we would want them to do as a consultant and promoting how would that take place that quick because usually for um anything or anyone to be hired normally takes at least three unless an emergency basis and I think you can knock it down to seven days for something being out and come back in So H how would that work in terms of even hiring a consultant Who would know um what to do that quick because we're at April you know the end of the month the meeting is going to be in May so how would that how would that work and then the final question that really is the one I want to get answered to and again I'm taking this information from the Miami uh Times article so if I'm incorrect because that's all I can go by because it wasn't a lot of documentation in the um backup it says that the city would um reload loate the um vendors or the businesses that are in the regional service center to the City municipal complex so the space there would be for the uh black Museum again have no problem museums so don't you know leave us Sam commission Kelly's anti the museum but I need to know is that an accurate statement that we are agreeing or would be agreeing to relocating the folks that are in there the agencies that are in there into our Municipal complex because that's what I read via the article and again I don't have anything else to go by so I got ask that question here is that part of how this process would be um driven in terms of our proposal I don't know Mr um I'm going to defer to the manager oh uh thank you uh vice mayor uh so we have not uh Administration has not had a meeting with tin norf on this uh proposal so there we there's been no discussion with my office uh regarding this item okay um again for the third time I'm not against the blackish Museum coming here and showcasing South Florida and all of Florida but that gave me a concern I could even probably get past the consultant because you probably could get someone you know that could really help that's the problem or the challenge I have with this legislation because we're saying giving up space in this building to accommodate the museum Museum that would be put there so I mean it's manager to see that being doable because we need to I guess vote on it tonight to move it forward to show our support um for making it happen but that that's my concerning Point that's really my because we already having challenges here now with parking and whatever whatever and and just space so yeah let me just hear your thoughts yes we would in order to be able to answer that question appropriately uh we' need to get an identification of who those vendors are how much space do they need can they be accommodated here uh so we just need a lot more information regarding the perspect and the time frame what would be the time frame that we would want to uh they would want to be moved in how long would we preserve the space uh so I need a little bit more additional information to be able to answer that and affirmatively Sir so now hear commissioner Kelly sitting in the middle of opposing the Black History Museum not that I would mind because I'm always sometime by myself but I like the idea I really do but that concerns me like I said the consultant spending money to promoted because it does cost but that is the real red flag for me um because I don't even know how many entities are in there that would be possibly coming over that we would have to accommodate and do we have the space to do it commissioner Kelly MH um if you don't mind let me weigh in a little bit because I was able to attend that meeting um to answer your question the moving of the tenants in the State Building does not it's not the end all Beall for that property so that was just an idea that was proferred by the sponsor at the time that if need be the city can and which will come back before the commission so but it has nothing one has nothing to do with the other one has nothing to do with the other one has nothing to do with that it's not predicated upon that when you say it's not one has nothing to do with the other Mr Mayor we're saying we're going to allocate $50,000 to go promote this um to come here but you're also telling me that the location or relocation of the entities in there is not predicated on making this possible I'm trying to see how to separate because the land the I'm not 10 North so I'm just the land they offered that land so they said this is the idea of where we can do it so in every city that that that presented it wasn't state land it was just regular land but the unique thing about opaka is because we already have land we were the only city that actually has land that's already owned by the state of Florida so it again I I understand that it has I got the statement my problem is if the manager could say to me or somebody say to me we got to relocate four tenants and there are 10 people and so we can put them on the third floor with no issues and I would have a problem what I don't want to spend is money knowing that we not even sure we can accommodate and again I'm only going by the article so you're telling me that the article is not no I'm just saying one has nothing to do with the other but what I'm going to suggest because 10 North is here if our commiss the commission doesn't mind to let them speak on this item because they prepared it if the commission does not mind so say North because I don't want to say something that's wrong now I will say this and I brought this up in my agenda briefing with well Madam manager cuz she was there I did not understand the $50,000 and the whole Consulting thing and the reason where it's going who it's going to and why we're actually doing it now I understand putting skin in the game because most cities that presented were putting skin in the game but I didn't agree with the whole consultant versus US putting $50,000 maybe towards the project but I didn't see what the consultant and the promotion behind it and I think I expressed this to you and our one on ons that the meeting is less than a month away and How We Do procurement like we're not gonna have time to even hire a consultant so I didn't even know what but I yeah but I understand that we do need to put skin in the game but the allocation with the consultant that CH gave me pause and and I'm use commissioner Williams word so you are here to answer commissioner Kelly's question yes sir hi uh James nson with tin North group uh Alex M with ttin North group as well so uh par to answer the question regarding a consultant um is to your point Sir Mr Mayor it's truly to show that there is skin in the game as Alex mentioned earlier there's been a lot more concerted effort uh with the county mayor's office the county chair and um at large to be to be able to show a concerted effort of uh opaka B selected the site um so the intent of that resolution was to be able to show formally that there is um a commitment from the city of opaka to um participate in the the site selection to particularly answer the question regarding the relocation um and preparing the media alert um as mentioned it was proposed that that is the site for the location um it was an intent to not create alarm to say if I work in that building where do I go and I think it it may have could have been worded differently to say that the the services in that building would be relocated but you know one of the things is to say hey we're uh or or the site will become a new building but um people not particularly know where they would be working or creating even more concern doesn't mean that I have no job or whatever the case there so um that could that sir uh could is a A misn or we can further uh answer that question okay let let me thank you for those answers let me go back to the beginning because you went from the counting to the when did opaka get involved when was it brought to the city to say we are looking at proposing this because the manager said he's not he has not had any meetings or discussion with anyone even about it so when did we get involved or noticed or brought to the table or whatever so in December there was a a application submitted help me clarify Alex uh submitted um when the state was uh soliciting for potential sites um I believe it was at that time from the Main Street Association correct um that that presented um and then um others like our AR uh learned of the initiative so of course um being able to be a potential site for uh uh a real Museum U for the state we uh we started participating and learning more information and began to have rallying efforts a lot of it was um like in some some of the communities they formed formal committees amongst uh conventions and visitors bureaus cities counties school boards um opaka in our community didn't formally uh put together a committee but we ended up taking the lead we as in North ended up taking the lead to aggregating um participants um so we've had unofficial conversations or conversations through rout um since that time but um as a formal um stamp of the city of opaka we hadn't had that conversation okay I I appreciate you honestly we weren't we weren't really invited the tape we just got here yesterday really because the manager's not really aware he's already said it because I'm quite sure he' to wait in or brought it to the to the commission's attention I happen to hear about it not from here but from other uh folks that I know now you're saying the relocation you didn't want to bring you know a lot of attention as to where those folks might be going Etc so I'm going to still ask the same question since you have proposed since you have made the presentation and the idea is for that site because it is a state site to become the museum where would those vendors departments whatever's in there where would they go would it been the state facility that would be up to the state and how they reappropriate or reallocate their usage of uh Department space so we we're not offering or we have not offered um to relocate them in the city facilities uh we as North don't have that Authority I mean this is I didn't say that Authority I'm just going by what I read from the article so um and it it seems to me it was inferred if nothing more that that was coming from from tenor in the article that that be part of the The Proposal presentation that those uh vendors or those agencies in there would be coming to the city because I just read it to make sure of it so you're saying you all didn't have you mean you all didn't profit that that's that's what I'm saying in the the media alert that was a u um something that we put in there to say that the the the tenants would be relocated um it probably went too more too much in DET because that's obviously an option but not a defend um there's still feasibility studies being done for the particular site um including the state Architects and partnership with fam you and all so um that's more of a a formal plan that the state would have to decide where um they locate uh departments oh okay um all right so you put on record I'm going to go back thank for the aners I'm going to go back again um in terms of $50,000 I thought was really high given the short time frame I do agree need to have some skin in the game but I also think the city should have been more involved in the early part of this process and I would just say that and um you know I know the boss real well and I'll convey that to him as well if you're going to embark on these kinds of uh joint ventures we can be great for the city we need to be brought in you know the manager's office obviously the commission of need be uh brought in I I got a a screen shot of my mayor standing next to uh your president giving a presentation and I'm like what is this so when I start looking I'm like oh okay it's a nice idea but I didn't know anything about it so then when I get my agenda and see this item on here I'm trying to figure out how can it happen that fast so is it of your opinion that if we do not put some skin in the game to use the terminology it would not look good on the proposal that you're trying to do absolutely okay then do you uh think the $50,000 I mean is that the amount that gets the attention or just the idea of making sure we have someone speaking on our behalf as a consultant yes sir the $50 $50,000 is uh appropriate um so it basically gives additional seed monies uh to be able to help with marketing um we're joining uh we've been working with Tallahassee and collabor Le so the $50,000 was uh a a strategically decided amount amount to to show enough initiative to to continue to get us out the gates and be able to close with it now um in the e in the sense of having the risk of um it being Council if that that number needs to be changed of course but ultimately the goal is to and the need is to show that the city has uh a commitment into looking forward into the site okay uh thank you again for your your answer Mr Mayor um since I I pulled this item let me ask the manager question because if we approve this um what we're saying is to hire a consultant to do whatever needs to be done number one that means you'd have to craft something of what has to be done um do you know all of that at this moment and number two uh to you and I guess the attorney how could we get this done that quick because it actually um you know go out probably got to come back because You' have to do this to some kind of RFP proposal something um would it be allowable for us to come back that quick um Madam attorney I guess mayed to the attorney or some way because of the urgency to allow the manager to do that put it out in the 7-Day form versus the normal how long what's the normal process Mr manager 21 days sir no 21 days 21 days takes us actually almost to the the presentation which would not be a good fit so uh Madame attorney could I mean is that even possible or doable I I think that's really a management um question um respectfully I don't you know I I think they can put together in the process that you all direct but um that's really um no no I'm I'm saying I know you can put together but in terms of the the amount of time required to go out come back in not the proposal itself I'm not aware of any requirement that says that you can only have a certain number of days I think if it's if you deem it to be an emergency and you think you can get a provider to do the services that are outlined by the manager and his um Agenda Report then that's something that you can consider okay back to the manager so so we did um uh begin to look at this anticipating that if it pass how would we respond uh so we have begun to put together some ideas of packages and uh rfps and marketing and proposals to bring the to the commission uh we would have to have a a quick meeting turnaround time with the 10 North group to find out uh where the needs are uh as this moves forward uh with consultants and what would be the services of the consultant and how would the consultant be deployed and utilized and things like that um at best uh one of the things that uh I put to the team is could this be something that would be broken down and perhaps uh service in two different services so uh maybe one uh service would be $10,000 one service would be five one service would be a different one and maybe not the same vendor for every single one uh that way uh we could do uh uh the procurement that is less than $25,000 which allows us just to get three proposals as you know and move forward so once we did receive this uh we did begin uh looking at how we could implement it and that was just one of the ideas at least the idea that I put forward to the team uh also uh listening to what the City attorney said uh we if we're just looking at one vendor we'd be more than willing to um we and we have to do this in the city of buaka quite frequently uh we not only publicize our rsps but companies that do the services that are uh um that we're looking to provide for the city we call them and ask them please uh submit a proposal uh we we'd be interested in seeing what you could do for the city vaka maybe that's something that we could possibly do here so that when we put it out we can have maybe a a shorter time period because we know we're going to have at least two or three companies that are going to uh uh um offer their services yes Mr Mayor I just want to um one second Madam attorney you finished Mr no not finished but I I'll you because she's talking about the same um yes I just wanted to State for the record if you're headed in the direction of what the manager is suggesting now that's a different issue and we would have to revise this um resolution that wouldn't be an RFP so just putting it out there okay see I I understand fully the 25,000 under your threshold and if it was that then it' be a whole different discussion but because this is 50,000 that's why it takes on a different connotation and that's why actually did you have to have 50,000 to make this work because and I know you want to make it seem we got skin in the game to use the M's word to show we're we're committed but to get it done and get it to you or whoever to make the presentate proposals it's going to be very challenging um to just do 50,000 because that requires a whole different uh process even if he is able to go out and find some folks interested you all talk later the night meet in the morning and get out it's going very challenging to get it by the commission pass get it to you all make presentation seem very unprofessional or un whatever um if we're going to do this and this just my opinion if you're saying the 50,000 you got to have as the proposal to present I think that's more challenging I think the 25 or 24,999 which allows the manager more flexibility for consulting or whatever uh I don't mean do it twice Mr manager 24 you know but um I think that's more doable I'm just sending to the sponsor I think we want to support um having the item pass and have Museum here since you're indicating that the whole moving of the folks piece is not on the table that's something they would have to to deal with so I can support that but I would say to the sponsor um 50,000 way our process works is going to be very challenging to get done get back and make it efficient so I'll just put it out there's your item so I'll let you decide how you w to how you want to do it thank you Mr Mayor okay Madam sponsor if the manager feels that we drop the price will be the I mean the the cost to be the easiest way to get it out then I'm okay with it yes if it's below the 25,000 threshold yes so I'm assuming that we're pulling the item or um amending it to 25,000 50,000 yeah um um so that it doesn't hold up the process um if it's going to be 24999 that we don't even have to vote on there because but I think we M ma'am sorry I think we're voting because if I'm hearing correctly they need to show that the city is officially behind it because right now even though he made a presentation and we're saying we're going to do it I think the offices in an amount not to exceed $ 77,6 in a form acceptable to the City attorney providing for incorporation recital providing for an effective date this is sponsored by the city manager um can I get a motion move by commissioner bass second second by vice mayor m i mean Mr manager your item thank you Mr Mayor uh so as you all aware sometimes we uh encounter circumstances that we didn't expect uh in the development or building or even here as a demolition uh this was a project to demolition the old uh old uh site for the police station which as you know was uh uh RI with asbestos uh we also found at that time that the grounds uh contained fuel tanks uh fuel tanks that were not uh registered with the county that were not registered with the state uh and we believed uh there were to be two fuel tanks there uh once we started the demolation and the uh developer was mobilized uh we determined that there we were found that there were actually three tanks three fuel tanks that were there uh none of these were uh as again as required by law uh registered with the county or registered with the state I think number seven for the Command Staff gon let you just keep talking I was I was trying to we're here on the wrong okay set up well these there are a couple ratifications here so I do want to address the things of ratification this came up in commissioner Kelly's commission meeting and um what we have done to address ratification is uh we're uh putting forth a policy to determine when the triggering factor is for ratification so that an email will go out to the commission to say hey we're going to whether it's a month from now two months from now three months from now a ratification will be coming because we found a a change in the circumstances uh of development uh so here this particular one was the uh uh my apologies here this one was the particular one was for the Command Staff uh the original scope of services did not include the Command Staff because the Command Staff was going to remain where it is uh in perhaps the future mayor's Chambers so we absolutely had to uh Abend this scope of services so that we can move forward with moving the Command Staff downstairs and as you all know uh to stop a developer and then restart them or even re-engage them or restart the RFP process could cost you know tens of thousands of dollars so that was what occurred with this ratification here but again the overarching statement that I want the commission to be aware is that we're putting policies and procedures in place uh to tr immediate notification when a ratification may be coming all right commission Kelly you pull this item yes thank you Miss Lawson gave you the whole speech didn't she yes sir she did I know she did um thank you I like I look forward to whatever that trigger is because when I saw and I didn't pull all of them all of these ratification I always give me concern or some of them now the tank you Mission I know that's could be health and safety so that's a different type but with some of the other especially we're going to be paying for it or doing it out of budget amendments that are going to be coming forward um that always is something I don't really like to see where we're already knowing we going to spend these dollars out of a future budget amendment I don't think that's good practice especially as we get out of financial emergency that's why I said that so um whatever you determine or whatever that trigger or whatever that is going to be that process I look forward to um seeing that and that's why I pulled it so good job Miss l you got you got him on point thank you all right any other discussion on this item all right the only question that I had do have Mr Mar I did ask Mar in the briefing will there be more monies for the police department um because we do a lot I want I want I want to look at the chief of police if he's in the room when I answer this question and because the answer sir is absolutely not all right because it's a lot of it's a lot money going and I I love the police no nothing against the police but then we don't have the playground and we say we can't find money for a playground so um I'm a little ah so that's that's my only concern and I'm not against I just want to make sure because it's like every other meeting it's it's ratification and adding and no it's not Grand and Mr Mar to add to it because I brought up the same thing but I think one of the reasons why I didn't have such a challenge with this one was because the space down on the first floor was um career source and of course they were there when we first started this process and of course they moved out which freed up that corner area so it makes sense to have Command Staff and everybody in the same place I shared the same concern about how much more we got to put into it but I certainly understood and understand having your Command Staff in the same place uh and I wouldn't have liked that so I'm kind of glad in essence that Career Source did move out because have your commander one place and the other folks would not be a good fit so I'm hoping to um and we love the police but um yeah no more no more unless it's just you know and I ask this question because of the HVAC system and that you're putting in that is totally separate from the other part that we're going to be doing so as it stands now the police in good shape so something happen you go to the police department cuz they they'll be hurricane proof bulletproof they got the best seat in the house they got the best seat in the house so we call it the Taj ball that's why Mahal but yeah I I had that same concern so thank you Mr Mayor all right so um that's my concern and we we can move on we can call the question commissioner bass yes Mayor um I know the process has to come through and be approved because our laws say 12 Etc so forth I got that I I have challenges um going to 3:00 am. number one and the second to have alcohol going to 3 a.m. and I know that's a considered a um industrial commercial no people but um when I think of that many people alcohol and I know they ain't gonna be in that building they gonna be all over the place you know when my neighbors down the street have a party with three cars I hear to whatever so I can just imagine um going to 3:00 a.m. um I'm not I'm not in support of going to 3:00 a.m. um I understand people like to have a a good time and all of that and I know to get approval for the alcohol they got to come to the commission but I'm not in favor of going to three 3:00 a.m. for anything um like that and I see where they've been other places other places they've had this so I'm intrigued as to why they would come here as opposed not go back where they where they went before and come into the city but I can't support 3:00 a.m. um no I just can't support 3:00 a.m. and and selling alcohol and having something outside is just too challenging and I know they going to say they going to have police or or security whatever but I think 3 A.M um I would not be in favor of of that Gerald Lee planning and Community Development Department you any other concern I'm just gonna say that I support the item um I I support the item I don't have a problem with the 3:00 a.m. based upon where they're located and clubs we I mean we have a 24-hour club and you go to a lot of these places that are open they're there till late they're they're there late nobody really stops a party or function at 12:00 um most times so I do support the item um even being at 3:00 3:00 a.m. okay um any other concerns on this item you want to hear from Mr Lee I will say this I'm I I support it as is I just want to make sure there is a a public safety component to this because it is 3:00 am so that part the only thing I want to make sure like yes uh there is a public safety component not only through our regular process but definitely through our special event that's 50 50 50 people or more that's for the regular process for special events they actually have to confer with the police department and I will uh do and has that already been proferred in the package of Mr Lee I believe it is okay yes so yes that is part of the pro process sir and we will enforce it I just want to make sure that there is a public safety component added to this because like commissioner Kelly said 3:00 a.m is a long of the city Commission of the city of opaka Florida authorizing the issuance of request for proposals RFP for qualified financial institutions providing for incorporation of recital providing for an effective date all right can I get a motion move by commissioner baz second by vice mayor all right Mr manager thank you uh very very excited to bring this uh item forward and thank you to the commission for allowing us to bring this forward and and the City attorney uh on the uh on an emergency basis giv uh what occurred with the HVAC system but for particularly for the opportunity to speak again as I have in the past regarding the current C City's uh banking Service uh our Uh current Bond agreement ties us to the bank that issues the bond agreement for all of our financial services and I from my perspective as your city manager I believe that the city uh and also I'm in agreement with uh uh the finance director uh the city has uh has had to endure several abuses as to being tied to that agreement uh one of uh the least of not of which is the lack of receiving uh interest uh interest payments on in um on our um checking accounts there are several solid accounts on any given day that may have $18 to $33 million in them and for those uh since I've been your city manager we've been managing those funds and then moving them and consolidating them in into singular accounts they were laid out and across 86 accounts uh which makes it very difficult to have a significant uh uh um presentation of funds uh once we started consolidating those accounts and you have account with $33 million in it and you're not getting any interest uh we're looking at a loss of anywhere between uh 200,000 to a quarter of a million dollars annually um we've addressed that issue uh with the our current vendor we' made some progress they still continue to charge us fees but at least they're paying us some interest payments but we're contining to to feel and experience challenges uh and we just know having had some of the conversations that we could do so much better for the city uh there are banks out there willing to uh do workshops for our residents assist them with buying homes uh and provide free services to our employees every payroll period and we just want to see uh what's out there and that's what this RFP does to see what kind of better Services we can provide commissioner bz Mr manager uh thank you again Mr Mayor uh so this is a companion item as I said before with the previous item uh we can select a different bank if we want to but so long as the curent vendor holds this Bond uh holds our bond uh we're stuck to them through that Bond agreement so uh we want an opportunity and this is an opportune time uh we could utilize these funds as we've discussed uh to perhaps do some parks improvements if we get us enough funds but also the very much needed uh to replace our um uh to replace our current HVAC system uh in addition uh it's a timely time to uh look at our bond refinancing as this Bond uh we've paid out down all of our bonds except for this one and this Bond comes due June 20 uh June of 2025 and that would be a payment of $3.2 million uh we currently haven't budget for that such a payment so we'd like to uh uh refinance uh that Bond uh there's a u a bond Council has already been approved uh and this RFP is contingent upon uh them weighing in on that so I think we're now prepared to move forward on uh with this agreement and we look forward to hearing uh consensus from the commission okay um any questions for the manager on this item Mr Mayor commissioner Kelly I don't have a question but I'm um want to thank the manager's office because we I say we should have done this a long time ago considering that most banks that deal with um cities offer them a variety of services and we weren't really getting anything uh from them other than putting our money the bank so I'm glad to see us um going this route thank you all right no problem um Mr manager the only thing I requested to see a side by side um but we my apologies sir I thought that that was already uhuh but we can do that I didn't see it because we just got it so okay we can do that before we bring it back because you got you put for RP in yes um it's been emailed to you but I also have paper copies I'll get it to you and then I'll set up a needing to discuss got it all right um Madame clerk commissioner Kelly yes commissioner baz yes vice mayor Irvin yes mayor Taylor yes motion passes 4 Z all right um next item is an ordinance 16 A1 an ordinance of the city Commission of the city of opaka Florida amending chapter 2 entitled Administration Article 1 of the city of opaka code of ordinances to add section new section 2- 8.6 entitled outside employment by the city employees providing for separability providing for conflict and repealer and providing for an effective date this is sponsored by mayor Taylor can I get a motion move move by Vice May second by commissioner baz um simply put the city doesn't have a policy for outside employment this came up during the man while we was negotiating the manager contract we right now have adopted the we go by the County's ordinance for outside employment so what this ordinance does is it simply adopts what the county has already set in place to be put as one of the city's ordinances that's all it is nothing has changed it's a public hearing but I do have a question oh this is a public hearing item public hearing is open public hearing is closed all right and I will take questions I do have a question I support it I like it I just have one concern be because there was a time that I was employed by somebody what I don't I don't agree with the amount of income expected reporting how much money I'm expected to make um on my second job or my outside job what what what what does that I know you didn't write it but I don't think that that should be a part of of this didn't mention down here again oh okay um she's referring to this the amount of income expect to be earned application shall be updated with any change in annual expected income at the earliest possible time which may require reconsideration for application that's part you don't think the person should report the income that they're receiving from another job correct okay and again this is the County's ordinances I would tell the county the same thing because I mean in my situation there was a situation where I was making more money self-employed as I was making on my job and I was okay with that but the problems that came uh for me with my seniors became an issue and we have to realize that people do have it it it brings about an issue got it but let me ask this question Madame attorney or to the clerk because you're more familiar with this process um certain positions in the city of Paka are swarm positions and they do have to file a um I don't know what that form is that talks about income Financial disclos disclosure thank you so how would that work would this need to be amended to say those positions or okay so so Mr Mayor right now as it stands Miami day County Court um ordinance with regards to outside employment um applies to all full-time Municipal employ employes and not only for opaka but in Miami day County okay so this stand straight across the board yes all right and let me correct myself all County and Municipal fulltime employees yes well Vice man I I I because it's what it's what's already in place so yeah well I won't support that all right commissioner Kelly yes thank you um yeah I never like that either but it's in there somewhere um the question I really have is the application or when you um fill out the form as you call it um for notifying got outside employment it has to be approved by the City by or not is it just the requirement that you fill out the form notifying the city or does the city have a process we can would be approving it or not approving it there's two processes here the first process is it would be if it's a city employee because the commission has no jurisdiction right the city manager which is what it stands today will have to approve it through I guess through the department chair or however they work it but if they are Charter officer than the commission because we hired them we have to approve it no I'm not talking about Charter officer I'm talking about other employees the same process because and I'm I'm saying that because one of the challenges to happen back years ago was depending upon the the manager some folks could get outside employment some folks wouldn't get approved and then it wind up becoming an issue to the Personnel Board at that time used to actually hear those things of outside employment that you had to file with HR and then HR notifi the board and you go before and say I got outside job it ain't going to interfere blah blah blah and they would approve it because there was some man and or supervis you know whoever's in charge employee did not want them to have outside employment because they just felt like whatever reason that not fair but they would say you know uh you can't have it because of whatever the reason so the way this is worded um the manager has to approve it or is it just a sign off since it's going since is the county Zone the way it has the county has it the manager have to prove it that's the way that's what it is today and the of opaka it would be the same because we just adopted what the county as are because we have no policy on our books so if I'm an employee and I as the vice mayor just said I can make more my second job than I do here but the manager forever reason decide they don't want to prove it I'm just stuck the way it stands today yes sir and I mean the way this would be you know the way the county has it now yes sir I believe um there's some language in there that that allows some difference I I you know this is I'm amable to change no no no I don't say this is only um first reading I'm I I'll support on first reading but I I think um and I like the attorney to to look into that as well I think that it's not there there's some difference because there have been cases um and I'm going back historical now where folks have sued cities and the government because they wouldn't let them work and you know they felt like they're being unduly whatever you want to call it but I'll support on first reading and then just so I know what to research through the mayor are you suggesting commissioner Kelly that it be some process like for instance if there was an appeal the appeal would be to the city commission well yeah back then it was to the board I mean just the appeal or or whatever the reason for it um yeah there's some kind of process if that exists some kind of I me it has to be triggered by something can't be just I don't like the fact that the manager said I you know didn't approve it has some kind of but what I'm suggesting is we we lifted this from the county so are you suggesting that you'd like to see a process because I don't think that would be problematic if we were to have a process that like an appeals type process and so but the only appeal you can make of the manager would be to the city Commission because nobody's higher than in the administration than the manager right so if you're suggesting that it be an appeal the only place would be the city commission so is that what you'd like to see I'd like to if you're saying the county didn't have any kind of difference I'd like to see something um to see how that would look not saying that we would do that but I just I I just you know would have a comfort level that it were to occur and it's not that the manager somebody wanted to work but not want folks to make money if it doesn't interfere but I just want would would feel comfortable if we did have something in place to address it if it were to cup up with that would it need to be an amendment for this well I'm gon I'm gonna do my own research so I'm gonna support on first reading as is and then I'll you know go ahead Mr I'm sorry no no the only concern that I have with the appeal process being that they're not our employees if we don't create the board that handles that if they do bring it to the commission we're now stepping in Uncharted territories territories that we're not supposed to be in so I'm a little that's what I said I'm a support on first reading and I I I'll um do my own Defence because although you're saying if that's you I can't make money on my second job they making more and I need to Fe my family that uh becomes a big issue so but I'll support on first reading do M all right St May no problem um Madam clerk one one quick one quick question I'm sorry so we have employees right now that have second jobs already would they be grandfathered in this has nothing to do with already taking in place because the manager has already approved and remember now we're just adopting County's policy as a city of opaka policy right now we fall up under what the county is already doing okay you know everybody got a second job not because everybody has that's what she said she everybody got a second job but to answer her question it it would need to because yearly you have to come back and have this reviewed so after this is passed and it's approved by the state it would need to start a process and there would have to be a form that you know has all of these things in it that are referenced in the but doesn't like you said come up yearly so they have to do it anyway correct right but what I'm saying is in order to be compliant with all of these things that going to be in place it starts then it starts after it's passed so whoever's doing outside employment they would be filling out the application the manager would just approve them again I guess and you start your process from after this has passed so it no there's no grandfather I just want to make sure that it's you know it's clear for the record okay and I still don't like that people you have to tell people how much money you make and so this clarifies what the policy is for the city so this has to do with outside employment this is basically you know the County's policy and this is intended to clarify so it's not an issue of you disagree with the County's policy it's you know it was just making it clear so I disagree with the but I'm saying I'm saying it's making it clear that this is that that's my point you disagree with it but it's still policy so I don't want employees who may have outside employment to think that because we don't pass it they don't you know the manager sends them whatever form or sends them on a yearly basis um probably about um so the outside employment is due in July of every year the form um heard the county code all employees receive an email from me two months prior to that due date forms applications on file yes we do okay not your not mine no I'm not you're not a fulltime Municipal I leave here thinking that we're kind of separate from what the county the policy is a policy so Department uh this is uh person has to go through be presented to the PAB board uh for their recommendation and their advisory to you it's a land use Amendment changing the land use uh so that uh a facility could be additional facility type can be put on the site at Cayuga uh PAB had recommended that the commission deny this application but we're still required to present it to you uh for a vote outright denying but I want to make sure that that that's the case um we're fully aware so we don't find ourselves in any challenges later but sorry been an ass so move on um just due to the circumstances surrounding this item and um letters that have been presented and the history of this item I would recommend that you all hear the item and make your decision after hearing the item so I would recommend um that you that let somebody give a second for the item so that you can hear the item because that could be an issue I'll second it okay um it was motioned by commissioner Kelly and second by commissioner baz and it's a public hearing item public hearing is open mo your lapt so she can have a room thank good evening Audrey Dominguez Jan Avenue I am a member of the Planning and Zoning Board um this item was presented to us and it was denied um due to several factors um they want to build a warehouse furniture headquarters or quarters um it's a beautiful project I'm not going to lie it's beautiful but they're trying to change it from a residential to Commercial and um there's a lot of things that came about that we did not agree on um for instance the proposed change will create an excessive increase in traffic uh congestion otherwise after affect the it would affect the public um this will create a drainage problem um and the proposed use will result in more more concrete asphalt than what the current uh zoning permits this will result in a a greater runoff of uh rainwater into the Waterway system built to serve the residential um population um there's a lot of other reasons why we didn't agree on it um I think that the although we we just recommend is up to the commission to vote on it and I know that they've brought it um to us however it did not go through but I noticed that in the workshop there's a property that I guess partial belongs to the city and it seems similar to their property so I'm kind of confused is if that property belongs to them or to the city if I could get clarity from the manager um so that's basically it we did not approve it because of those factors how are you good evening Mar Cooper 6801 Southwest 75 terce I don't live in opaka I know the property when they owner bought it they knew was contaminated it's been contaminated for a long time it used to be a landfill uh it was owned by another company they were going to develop it they desisted during the financial crisis the new owners bought it uh I think o blocka needs more uh residential space number one number two a lot of the time what property owners do is they buy a property that's deri you get the zoning changed and then you sell it as a development site and so the value of the hearing today is once they change the zoning of it the owner sells it out I know madani they buy it they're a new company they develop it and what happens at these hearings is once you guys start on the change of zoning train right now you control the process but when later the zoning is changed and they bring you a project and you say no there's a threat of a lawsuit I was at a similar hearing for another property note blaka you ask legal what's our position and legal's answer at that hearing was well in America you can get Suited for anything and it kind of left you guys in the air you didn't know which way to go and you had to approve it so today you have control if you approve the little bit of change you lose control so I suggest you don't lose control you make it residential you make grow the base of families in opaka get people in the Parks and people involved in the government and not bring another Industrial Area another property too Obaka thank you thank you okay and we're closing public hearing I'm sorry we're reopening public hearing I don't know if the technical division okay uh first of all uh Robert Holland on behalf of U madani I think there's a lot of Confusion And I think it's being generated for some reasons that could put everybody in some trouble i' be very honest with you I've always come before you I'm always very honest to you when I come here uh as most of you all can tell from the application if we can go to uh slide number uh two they have a mouse for me to work it or they can work it back all right as most of you where this land is located this is over 40 years if not 50 years of stockpiling contaminated things the contamination on this site is so deep and pervasive that you can't do Residential on here and sometimes it is diff difficult to sit down with folk who don't understand the science of development people tend to just make these knee-jerk reaction oh we think this should be this so first of all this site is extremely contaminated uh the next uh slide please we're asking for a small scale comprehensive plan amendment to change from town houses to industri uh reone the property from townhouse to uh light industrial a development agreement all that stuff should follow Norm all these things come at one time for some reason in this process only the land use was bifurcated out even though all of these things were filed back in October we were scheduled for a hearing in November it never took place we were scheduled for a hearing in December never took place January never took place February never took place despite a state law that gives you 180 days to bring these things a hearing so we recognized it was an effort to run the clock out so you see what the requests are slide number the next slide please this is what the site looked like the unregulated site with all the history of the construction debris and demolition debris and so significant contamination next slide please next slide please so as a result of that there was environmental phase uh assessments done on on this property environmental phase was prepared by Teran Consultants uh in conjunction with the city of opaka through a Federal grant there was over a thousand page report it took nine months to complete tens of thousand thousand of dollar next slide please here's what the scope of work was on this site ground penetration radar test and observation soil excavation pits 19 of them Advanced so boring um 20 so boring installation of vapor points nine of those and groundwater monitoring Wells 20 next slide please and so what happens when they do these tests they break them up into two different categories resid IAL thresholds and Commercial thresholds which determines what you can build on these properties based on the toxins that are in this ground the toxins just don't disappear next slide please when you look at the soil test on the excavation pits of the 19 pits 22 contaminants are above the residential direct exposure level level of the five pits only five commercial pits were above that level when you look at the soil soil borings 20 of those borings 15 are above the residential capacity and only three with the commercial which means next slide after that which means this site here will never be used for residentials and I'll tell you why it's virtually impossible for a developer uh for a non-developer to understand this sometimes often time lay people misunderstand the science and feasibility of development your staff is recommending denial merely on the idea that they think mixed use would be the best fit the problem with their idea is this it defies development Logic for mix use to work on this or or even residential on this site with the extremely high concentration of residential or or or toxins your building would have to be so high your density so I heard the manager mention I was a little shocked that this application which is an illegal process before you would be considered as part of a workshop when you have paid for a legal process to proceed zoning and land use it is tinkering on torous interference with a contract and I'm going to get into some of that stuff because it's going to put the city in a world of trouble unfortunately and I didn't want to go there I always try to be a friend and figure this out but in order for this site to be developed residential and I heard the statement made in your Workshop that other sites with toxins have been developed for residential he never told you what the level of those toxins were on those sites and I want you to look at Midtown and I want you to look at solar Mia and look at the thousands of units that are developed on that land and how high those buildings are in order to offset the price of remediation to get those properties where you could do Residential loing you don't have that capacity on this land this land would not be allowed anything over three stories requires you to put pilings into the ground which means you now stir up more of those toxins when you go deep down with the pilins in order to to do this mixed use because mixed use requires some commercial on the bottom and residential on the top and the volume of residential you would need to eradicate the toxins to make this where people could actually live on it that you would be appr proven you don't want to take that chance because a part of that lawsuit will be this city because you now have direct knowledge of what those scientific levels of toxins are that residential will not go there unless you can eradicate them and even if the city gets another Grant it wouldn't be enough to take away the toxins to the level that would be about bringing this property to residential use for the volume that will be required whatever the land cost are and the remediation all that stuff that goes into your overall total project so they the city tells you well we think residential can go there they didn't tell you that it's already been at least 10 residential companies go to the next slide please new rock has had property under contract twice uh Richmond has terminated their contract on it H Holmes terminated their contract on it Lenard DR Horton related Ryan Holmes Cornerstone Landmark all of these major housing developers have had contracts or looked at this land and when they found out the toxins that are on here they recognized not suitable for development when we went before the planning board as fate would have it there was two items there ran across a client there they're not on this list they had a contract to develop this for residential say the toxins are too high he asked me what was I there on I told him oh I hope you're doing industrial and I say it's funny you mention that why and he we had a contract it won't work I got a call from Willie Logan what is this project you working on so I called him I talk to him he said oh shoot I had a contract for residential own too won't work this is not me making this up this is not me guessing kind of guessing oh I think this would be a great place for an ice cream par that's not how development is done if you put residential on this property with these toxins you run the risk of the Su the city being sued and anybody else that absorbs those toxins in this end the reason you can do commercial and Industrial because there's an easier cap you can put for those uses to allow those to be developed and you're not building so many stories so they don't impact the ground as much and so when people tell you they think and they've never developed anything they've never built a building they've never sought fin you can't even get financing for residential on this site and so when I see that as part of your Parks program when you talking about some the think maybe we can do a joint venture with them you're on the legal process right now you have violated that legal process already you violated with all the delays in the process as well so there's so many things in fact the manager mentioned that the city has an interest in buying the land well that was mentioned some time ago the client gave them a letter of intent you know you serious let's let's go ahead and do a letter of intent never happened never happened but it's in your V it's before you today as a possible joint venture which means you're saying you're willing to kill this in order for it to become a city development or a residential development since residential won't happen it has to be something that the city has a desire to do and so that's a big problem we go to the next uh slide please in addition to the residential uses my client sat down with your city staff over a year or so ago because there was the idea of a hotel he open to a hotel you got somebody want to velop it with Hotel despite the toxins and they willing to get the approval we're fine guess where that went nowhere the people they bought to the table say no the toxins are too high because it too requires verticality with people and it opens those toxins open up the that verticality will open up the ground even more and it runs a risk so the hotel said no then I was asked can you see if Costco will come here public any number look at this list Ali public wind Dixie Dollar Tree Dollar uh Family Dollar Bravo Supermarket all these folk were reached out to all said no they tell you what what sizes they're looking for but the main thing a lot of them some of the smaller ones like the Dollar Tree and the Family Dollars some of them pointed to the crime stats of the city next slide please so what do we propose I listen to some of the things this Council has said since we know we can get industrial built and we didn't want this to be something speculative this isn't where madani comes in and gets this reone and sell it I understand how somebody might have that concept the gentleman that was up here earlier this is where madani seeking to move their headquarters to to the city of opaka so they're talking about a retail component kind of like you had leit furniture and Modern Age and all those folk a retail Furniture spot with storage and and and and the ability to also do Logistics that's what you're talking about bringing here to this site you're talking about bringing some jobs here and this is not your low-end furniture this is not your lowend this they talking about making their headquarters here in the city of opaka not creating another dollar store or a pond shop or a service station this is by bringing real Economic Development to a city that you can be proud of next slide please madani is in seven states they ranked in the top 100 firms they have several places here one in Midtown and one in aventur they talking about consolidating those things and making their headquarters in your city this is the site plan next next slide please so this is what we're proposing the front facility would be the madani facility where they have the retail the warehousing the logistics stuff op op up the back they've already worked with the state of Florida Department of Transportation to create Ingress EG off off of State Road n so so it does not go through the residential neighborhood that was a concern it didn't go through the residential neighborhood I heard a comment from the planning board member who said that they rejected it based on certain things first of all it was a 3-2 vote and it stayed kind of dormant for a while the questions that were raised about pavement and and storm water drainage and all that stuff we addressed those there we have to meet storm water retention D requires us to maintain water on site so it wasn't like that wasn't known the boogeyman was put out there to say oh this is bad we don't know what all this is going to happen your development staff knows durm is g to require that from a Brownsville site you have to go above and beyond to secure that anything that happens on that site remains on that site so that was Bull when you talk about traffic you talking a water par in some possible water that might be contaminated out there and all these kids running around in a water park on a contaminated site and you think that's what the best use is that opaka will approve and run the risk of being liable for that approval when you knew about the toxins but even if you do a water park you imagine the volume of traffic for water park if you do uh buildings that in the style of of Midtown and and aventur or solar Mia imagine the volume of traffic that is there ver versus an industrial site that typically Clos at 5 6 to 7:00 in the evening but that was again trying to bring City kept saying they wanted a retail component even to their warehousing components because they wanted to be able to come shop and and do things wanted something that they gave you some some presence in the city and this is one of the first buildings you will see as you come into the city next slide please again a front picture of what we're proposing on the front part of the facility next slide please now this is the rear the second building in the back that's not for industrial use you've been telling me for the longest you wanted other kind of recreational uses in your city so you talking about an indoor soccer park you're talking about pickle pickle ball you're talking about um paddle ball possible bowling alleys all those things bring uses into your community that you Community now has access to to come in and enjoy themselves so again thinking outside of the box this is not just your regular Warehouse I understand the the fog that people have with the old warehouseing and opal Locker you look at the features of how the place is designed beautiful designers next slide please this is what the place proposed to look like in the evening so you don't walk into a dark you don't drive down the street with just a dark Road you see when you come in opal Locka you see something Majestic when you come into opal Locka next slide please we also talked about hoping to work along with the city because it is the entry point coming into the city this is just a sign that says welcome to the city of Obaka but trying to create some sort of monumental sign that you know when youve just enter the city of opaka you don't have that anywhere in your city right now so this being one of the gateways coming into your city they would have that along with all of the signage of what will be on that site next sign please this shows you the uh the new dedicated State Road accessing uh the neighborhood I mean uh there a avoid Pro uh accessing neighborhood come right into the site next slide please again we talked about a prospect of new jobs and Retail activation they're willing to participate in opal Locker's job fairs obviously consistent whatever your development agreement says they're willing to offer the opal Locker residents a discount on all of their Furniture so if you have a op Locker ID you get a discount on your furniture the second building as I mentioned with Target Recreation and family oriented uses such as powle ball indoor soccer field Kido kid playgrounds next slide please this gives you kind of an example of what we're talking about when you look at these pictures here uh of going there next slide please and again as I talked about the the the welcome to opaka sign so I heard you talking about the parts though my client has already put $100,000 in a scholarship fund for opaka residents he offered two years ago to put $100,000 in Ingram par to help out there this was even before this application was filed I had another client has already been approved on Industrial over at the um offer leune who and I didn't say this as part of an an item when it appeared because it wasn't meant to be a part of it they offered $100,000 to go to your Parks program and I have still been waiting for those two years for a plan that allows them to put that $100,000 in because I want to make sure opaka gets developed right and not the service stations not the the dollar store things that bring real jobs into this community that people can build a life around and you get fought over some speculation of we think we can put tall residential buildings on this contaminated land despite all of the experts in housing from Willie Logan to related to the laundry list of folk that I mention telling you won't wor but you have folk on your staff who've never developed housing telling you we think it will work not the experts it would give you no expert opinion as to how they can develop this land with residential and then the big box I've reached out to Costco reached out to Publics you all those grocery stores all saying no this isn't just somebody saying I would just want to do this here this has been years of going back and forth with this staff trying to find a way to make this happen and then you come in today and you see a presentation before you prior to this that says well we looking at we're also looking at this other land that we don't own as a possible joint venture don't go down that legal Road and put yourself In Harm's Way when you've seen here on the record the tox the toxicity at this site the levels that are still there the housing folk that have rejected it the commercial folk that have rejected it and you're talking about doing things that are contrary to all of those experts because it sounds good it may sound good but it's undoable and you'll end up in court and I'm not saying I just to me I never want to say that kind of stuff but and I was I came in for a very mild presentation today until I came into the work shop and notice that like you cannot do that it is legally impermissible it violates all of your codes to say this city that currently has an application pining for it is saying we're looking at doing something with this private property in a joint venture with ourselves you can't do that those are the things that have gotten this city in the trouble in the past and I'm trying to caution you on it because the best way of developing it based on all the other folk the industry and I'm not talking about industry where you're manufacturing and you're creating more toxin we talking a high-end furniture store with things that kids can come to in the rear buildings and do things that activate this community so it's not a water part it's not going up several levels where you're creating all this impact on the land it's something that is single story in a half it can accommodate the toxins that are on that land because you can cap that if you're not paying attention to the science and you go by the the lipstick on a pig I think you put yourself In Harm's Way of not getting this property on the tax RADS the other thing that is beneficial to this site is because it's industrial it does not erode your tax base in the standpoint of what it takes they don't you don't have to pay Solid Waste to go there you don't have to pay a fire to go there all the money that they pay back in your property taxes help to go into the other services within your community because industrial sites are donor sites they're donor sites and you've heard me say that before they add to your tax base versus taken from your tax base which it allows you to not have to always raise your tax rates I heard residents me bring that up early when you talking about some of your Park stuff what does that mean our taxes gonna go up when we pay for this stuff here because you're not gonna get it all in Grants you're not going to get all this money for your Park stuff that you want to do in Grants you got to tighten the belt somewhere and the best way to tighten it is by bringing in uses that don't bear on your expenses and this is again one of those so it is truly the city's prerogative on how they proceed on this but I can tell you it's been so many issues that have been placed on the record and I want to make sure that we incorporate the planning and zoning boards record into this as well as the part um Workshop record minutes into this hearing as well because it is extremely important what has been happening to kind of backo this development from taking place on for developments that can't even be begin to be built on this site so with that I'm open to any questions the council may have any questions Madam vice mayor um couple of questions and and everybody knows I've been trying to figure something with that kyogo site for for uh years I'm not in favor obviously of trucks going down Rutland or Wilmington or service um but I do know that there have been a lot of uh folks who come and gone and have not stuck around I know money's been spent on brownsfield um for brownsfield one and two and phases that have not really produced anything more than what we already know that is a challenge site I I really just want to go to one of your slides here I I I see madani I you know know the company I just want to go to one slide which is the one that dealt with the access to the um State Road I'm trying to see what number is not numbered um accessing to come in and out or whatever um the best view of it would be if you look look at the first pictorial show you this one here right no I saw that I'm I'm really I saw the I'm talking about really going out to State Road nine right okay that that's what I'm saying I'm asking the question um you've already had discussion I'm assuming with the state on coming in and out Etc from State Road n and to make that the main way of coming in and out okay um I will say this to my colleague because I when I saw this um kind of separated out I was wondering why it was all bifurcated as well because normally we get these things almost in a three or four lump package um so when I saw it separate out I was kind of concerned about that but um I do know at this point there a lot of folks com and G on in terms of businesses um that have not chosen to stay there and develop this particular site for whatever reason um it's almost like choosing the the worst of the best nothing against madani but it's just choosing something that can be done because right now it's an eyesore and residents complain all the time about it just being an eyesa um I've heard your your statement um management takes a different view I heard what the um wording from the planning Council um why they rejected it my biggest concern and really to my colleagues is if we're not going to allow um industrial on there and and really that's not my first choice then what are we going to wind up doing because I think even it was indicated earlier that to remediate it um with some Brownsville grants or dollars would be in the mill ions of dollars if you can um even access them so yeah I'm kind of torn between the fact of just how much longer do we wait to see what kind of development we can get that would be residential and I know over the years and I've been here 20 years a lot of folks come and gone talked about residential but have never done any residential own it because when they run up against that Browns field and and the contamination has always been a um majoring sticking point my point is really the traffic for the residential trucks Etc and to me um having the in and out from State Road nine um and you also if I'm not mistaken maybe I need to staff that or the manag office because I've seen in other areas where at certain hours or times you could restrict um trucks from coming in um certain area Mr Madam vice mayor can I ask the manager to uh have staff way in on that yes uh we actually do have a a presentation required to provide to you uh by staff uh regarding this item so that you will be making an informed decision uh not based on conjecture uh prepared by the Community Development Department okay yes sir y'all should have came first well public hearing has to come first I I'll um I'll wait and hear their presentation before I move any for can you pull the other U presentation up Gerald Lee um planning Community Development Department do we have that we have that we have that presentation I didn't didn't bring okay um I'd like to thank Mr Holland for his wonderful presentation and he provided a lot of information uh about the site um staff is aware of what has been proposed this is a land use change that they were asking to do on this on this site next slide next Slide the owner has has has gone painstakingly to remediate the site and they have done that to the level of what's required for uh commercial or industrial next line of course we all know where it is next line as the as the applicant is concerned about developing the site their development is not based on what is available for the site what's available for the site based on the zoning is for residential development and mixed use of course they've already explained the level of contaminants and and and so on and so forth what that requires and staff has to go along with what has been adopted by the commission for the comp plan and for the zoning with that being the case this would be a change in direction from what our plan has said and what the zoning allows they're saying that it's impossible to get there and we're saying it may not be immediate but we can get there if the commission decides that they'd like to go in a different direction this would be an opportunity for that change to occur next slide please next slide this just shows uh the location of the uses that are nearby not uses uh from zoning but uses from the comprehensive plan next slide as has been stated by Mr Holland um this site this site can be developed and they would like to develop it for industrial but the city wants or desires to bring about uses that are going to be compatible with the neighborhood and with the area with that being the case without a change of of land use or zoning this development can't happen the staff's recommendation based on that is that we continue with what we have and that we look forward to obtaining the monies through grants and Partnerships to do what we need to do we don't want to encumber litigation concerning this so with that being said our recommendation has not changed and we still look forward to developing the site for residential and mixtures that's the city stance that's the department stance not the commission wants to take it in a different direction then you'd go contrary to our recommendation and do something different based on your desire to move the city in a different direction based on this property that's all I have Vice May thank you yes I I need the first I need the presentation that you just gave yes sir that's number one number two you're saying that the city had other ideas that going to for this site my challenge is that site has been there so long and the city not the manager but the city y'all in that department been there for a long time I have not seen where we comeing with this commission to apply for 20 million in Grants for brownsfield for kyoga or some other agreement or or partnership or something for that particular site that's been sitting there so to say to me and to my colleagues even I'm GNA say for me I can't speak for them to say to me tonight we're thinking about doing this so we prefer do that with residential to me is I'm really challenged with it I'm past paus I'm challenged with it because all of us have been around for a while the folks live in that area and nothing has changed now Community Development had went out somewhere and got someone five years ago or three or four folks and came to this commission and said you know we're going to be a residential and then backed out fine that has not taken place hadn't got that far hadn't got that far so now you're here telling us now we've got potential plans residential when we all know it's going to take and I'm going to ask you because you're the professional how much you think Brownfield money will take to remediate that because you've been around I I'll ask your expert opinion since you're the billing official it'll be in the millions how many t 10 million dollar so and and I'm I'm not in the legislature I've been to tallas a few times I don't see anywhere where there's $10 million sitting and one pot for opaka now they Browns fi money out there there there's billions of dollars but opaka accessing 10 million at one time is probably really challenging and if we were going to do that we should have been doing it already regardless of who wants to develop regardless of these folks coming for a land change so I'm challenged with that but to hear you say now we possibly got some residential something that we could do without saying to this Commission because I tried to follow your presentation all I'm hearing is we probably got something else we might can do what are we going to say in the meantime if nobody else wants to even come and develop it or look at it um we've had residential folks to come look at it before haven't we and they backed out because they've said what no don't do your hands like that I I public can't see your hand I see you doing that but the public can't see your hand cuz money economics people don't mind building but they want to make money and that's the American dream so it was not economically feasible for them to move forward based on the cost okay um commission I won't hold you up any long I'll look at this while we're my colleagues are speaking or what have you because I wanted to look at your presentation that you gave thank you Madame vice mayor thank you vice mayor I I wanted to clarify uh a statement that uh Mr Lee made uh he stated that uh from the city's perspective and and and perhaps he was piggybacking some of Mr Holland's thoughts that we that uh the city wants to do Residential and the statement was also made that uh uh I want to do uh residential there uh a lot of statements have been made tonight uh so I want to clarify the record first on my position not in opposition at all to this project um the process and some the claims made as a city manager of course puts me in a defensive posture uh but the notion that uh as you all know I'm always constantly trying to push development to you all for the growing of our city uh our population has been stagnant for some time and that is a death nail uh to a city uh we need to move projects we need to have shovels and shovels and lands and if this is a a uh a a mode uh for the city to do that then Administration absolutely will do that uh so the notion that there's some uh nefarious means of foot uh regarding this process this application uh that is just simply uh not the case uh both as assistant city manager and as your current city manager uh I'm quite familiar with this project uh and have always tried to work with them to do whatever it was uh when I was assistanc manager we were trying to do a hotel uh and then we tried to do uh uh we put uh before we had the uh the little flying structures we got one of the flying structures to do a video for this project to try to sell it and and the city actually uh for the mitigation for some of the mitigations there was done with the First Brownsville Brownsville Grand the see opaka got a Browns Bill Grant at that time and we put about a couple million dollars on it so um if it be the will of the commission absolutely we will follow uh the will of commission on this so I just want to uh you know clarify uh the position that has been taking that the that the city of opaka or the administration of are against this project somehow now uh there are reasons why there's a recommendation for denial both from the PAB board and thankfully we've had a member come and detail those reasons but I also want to clarify uh from uh Mr Lee he's speaking as the zoning official uh so when he says what the zone is and that is his recommendation uh that can absolutely be overruled by you uh and absolutely in some SES can be overruled by me so he's not speaking uh for the city uh that is not uh my position nor the position of administration that uh that residential was feasible there so just want to clarify that for the record thank you Mr vice mayor yes okay just I and just one thing I want to put on the record whichever way you all decide to go um I need to for litigation purposes potential litigation purposes just let it be known for the record that um Mr Holland did refer to a workshop that took place prior to this meeting any statements that were made by the city manager those statements were being made by the city manager they had not uh resulted in any action of the city commission there was no vote that took place um and in fact one of the Commissioners even stated that he had he just saw the information for the first time so that um whatever statements were made by the city manager they were simply made by the city manager and had no impact on um a vote of the city commission and I just want to make sure that the record is clear thank you thank you madam attorney I'm sitting here and I'm listening to all of this information um and truth be told Mr Hollis I felt a little bit bullied by some words that you said but I'm going to say I will support it for the first reading and I would pray about it going forth because I really felt a little bull sitting here tonight hearing you present and I don't like feeling that way I don't want to be pressured to do anything but I will give you that much I will support it tonight but I can't tell you that I'm going to support it going forward but I will give you a chance if if I may I have um spoken to many residents in that area over the last week my last visit over there was Sunday even today coming into this building I had residents have a conversation with me about the property I'm going to do the opposite of commissioner bass I won't support this tonight I don't know about the second reading I will go back out again and talk to my residents um and show them the very pamplet that was given to me tonight and we'll see what happened on the next reading I must say that public hearing is still open we never closed it you the G we never we never closed it um two minutes well first of all I Vice mad Vice may we if you got resident can we hear them before Mr Holland because that way he'll be last because the resid been sitting here a long time let them weigh in if they want to speak again my name is Bridget stalworth I live at 142 55 Northwest 21st Court I agree with commissioner bass I also felt bullied I felt that the tone was do this or else I did not like that and I want you to um think about this while you're talking about the egress that comes off State Road 9 I have to go to two schools in the morning to drop off my grandkids when I come out of that area to try and get on to 22nd Avenue they're not coming from State Road 9 they're coming from up 22nd Avenue from down south Liberty City from other areas I can't even get out of my streets sometimes because of the traffic you want to add more traffic in the back that's can also come out and then want to make it worse on the weekends pickle ball soccer land there's a soccer land on 135th we already have one you want to make another one in the same area with it less than less than 20 feet away I mean it's right there on the corner we don't need another soccer land also I don't see them going going up 20 oh your through your eag rest I see them coming up turning the corner like they do every afternoon and I have to fight I back into my driveway I don't pull into my driveway I back into it I get cursed out I get fingers pointing at me I get all kinds of languages just to get into my own driveway because they think my street can get them for some reason across state road N I don't know why they think they can get across state road N9 and you that's adding more traffic if those people can think that they can come and weave around and cuz over there it's my street you turn you turn talk to the mic come back to the mic you turn several ways just to get back over there into that water they're not GNA come up State Road n they're gonna come up 22nd weaving in and out of traffic you have kids mik Street all day long on their bicycles on those little scooter things and they're always hopefully not getting hit because we have those two um the humps in the road they goodness but people don't see that on at 5:00 in the afternoon they flying down my street they go over the hump like it's like they're flying in the spaceship you're bringing more traffic to a place that does not need it you have the 20 on 27th Avenue Jackson has that old tury Ward why didn't you that's that's a nice area you're right on 27th Avenue it's a big open space you have all that traffic people are stopping and say oh wow let me turn in here instead of in a back with a bunch to people's houses you have like you said where Modern Age was where where all those warehouses are places in the back back there that will probably well fitted back there they can drive down that long Street under the arch oh this is nice they can go over there why where we live thank you public hearing is still open right Brian Dennis 21 address 2140 York Street I think what we not paying attention to is the business the the business of the city and from what was shown on the presentation the majority of that traffic comes through State Road n it doesn't go through the backside of the through the residencies my concern and this is my concern because every time a project comes in the city nobody from opaka ever works there's never an agreement I don't care what they say in Community Development about it's always in agreement the agreement is never forced it is never in forc according to 956 of the city chart any entity coming within the city of opaka must hire the residents so now we looking at whole construction looking at the whole construction they talk about the job fail so now let's go back to the old overlocker overlocker Swap Shop they had a whole construction project had a job wasn't hardly nobody there I came to it and nobody worked on the project let's go to the new builders on 22nd Avenue Department building they just been no residents there nobody from the city worked on that project nobody had the opportunity to make anything now we don't know when these developments come in who's the property managers on those devel developments so who's going to control who gets in and out of the city who's going to occupy those domains those apartments see the business of the city has to be taken half taken taken into an account and you have to look at it for what it is my proposal and I understand what what what the lady just said Miss starart just said if you're going to use that interest where K hog was everybody wall it off wall It Off separated from the residential and then you have all that commercial but there has to be an agreement that when construction starts that the residents of this city have to benefit it we got everything in the in the city Charter but we won't enforce it we do everything we violate the city Charter on just a simple get a job and then it's on that east side and I said to somebody night do you know where the majority of my boot campers come from that I'm dealing with the miam day County First and life sentences that come from opaka they come from the East side don't have a par we see everything going wrong over there so I'm in support of it if it got teeth in it if it got some teeth that it could be enforced that people are going to that going to make some money some real serious money doing the doing the construction project and having an opportunity to work there but they got to separate the that residential area has to be walled off from the commercial thank you uh just two minutes first of all uh commissioner bass I do want to apologize I just it's been a little frustrating with the process so I apologize if I did come off as a bullying that I would never want to do that and if I offish you I'm really sincerely apologetic about that as it relates to the wall on the west side of the property there will be a wall in fact commercial developments require that so there would be no access from those residential streets into the site it would have to come along State Road n and we can do work on something with with the manager as it relates to the egress and Ingress hours to kind of divert traffic going towards uh the golden glaze exchange uh at certain hours to children to be more than willing to do that um and as relates to compatibility because it sits out there it is compatible with the community because it will not be interfering with the residential roads inside commissioner Urban where the residences are there's no traffic on those roads there and as you relates to the type of uses in the back building that's for us to kind of work with the city and who we can find tennis it doesn't have to be soccer we were just saying it would be recreational kind of uses so that potentially you know gymnasiums or whatever could come in with the gymnast or whatever and create a function where by which kids can now come in and have a safe place that they can come and do their thing so we were trying to come up with a way that was compatible with the community the retail with recreational Services the uses that could be built versus not be built and ultimately get this property off the Record as an eyes saw was not producing Revenue back to the city that was whole on 10 with the application thank you okay public hearing is now closed Madame vice mayor yes um thank you I think since this is um obviously um first uh reading and has one more to go I think the applicant has heard the concerns that that raised but I also think we have to figure out a way to make sure folks in the community understand exactly what is taking place in the real options because I too here you know don't want trucks coming on the street don't want to hear there want to see housing I think you know we would love to but I think the misnomer is thinking what can be there and doable economically and feasible as opposed to what can't be there and I appreciate the other the the citizens coming up some of the traffic because we need to deal with that whether um madani comes here not because I've been talking about that forever the traffic that comes off a 202 trying to get around so that needs to be addressed irregardless of of this um application I I would just kind of urge my colleagues to support this on first reading and um yeah I I really would hope the whole commission be here for the next one because I think is that magnitude and also allows any questions as we go back out into the community that they may have because I know many of them watching what can be on this site of property versus what can and you heard the manager himself say that he's not really a Pros to the project it's actually a commission decision um because trust me if we could have put residential or housing on this uh location I I would have been pushing it for the last 20 years it's just not been economically feasible that folks want to invest that kind of money and trying to get the Brownfield grants to do it so um we need to be able to do something but it's commission decision and Madam vice mayor you got the G so it's in your hands thank you madam uh any more Madam clerk commissioner bass yes commissioner Kelly yes Vice May Irvin no motion fails no fail the motion passes there's a there's a um there's a quorum here okay so it's my understanding there's a Code section and I'll look for it that says that the majority is required whether a quorum is present or not okay and I'll look for it if you give me a minute do something I haven't heard anything so only way I know to get us to come up with something or do something is to have it in legislative form um I don't prefer I wouldn't hope or think that it needs to be in resolution form but I don't know any other way to do it vice mayor by May commissioner count um I'm thinking that we should pull the commission for a workshop to incorporate that as well as the opening of our old city hall building so we can discuss everything at once I don't I don't problem I mean I don't know okay I mean I'm open to it that's more of a workshop um right so we at once and kind of be done with it okay so we're do that then I don't really need to put it in legislative form I just put it on my report the next time but in the meantime I guess commissioner bass is suggesting holding the commission for a workshop to discuss that and reopening of um yeah c i just hopefully it can happen within the next couple of weeks the the workshop so when you poll us you know thank you okay well I don't need to do the thank you I think we're finished with uh future agenda items and next we have the mayor uh commission reports okay so oh it's on you it's on me yes oh we um I didn't ask the manager about it because I thought he was gonna give us the update on the glory of the gardens whatever because I know that's been a big issue but I'll do my report he can do that after uh under my report we did restart our um feeding South Florida um program at Seagull Park on um last Friday I know the autism uh program was going on we did restart that we are taking the the data name addresses so we can get an idea of how many opaco residents are utilizing it we are going to do some signage to um make folks more aware um and also um bomb shares next Wednesday at um The Pavilion here at 10:00 a.m. um we've been having a tremendous amount of people coming uh running out of food really by 12:00 so encourage residents to get there early for that and um I will leave the nation prayer to to commissioner Bay he said go ahead with it um the national pray of course uh next Thursday uh we're going to have two opportunities to celebrate and to pray and come together as a community just like the nation will be doing 11:45 a.m. at the Helen Miller Center we're going to have an indoor um service with um couple of sermon Nets we're going to have Fellowship praying for our community praying for our state and Nation with some refreshments um and then also so couple of our local pastors will be speaking English and Spanish and also um at 6: p.m. uh right in the same area uh where we had the Manifest we're going to have an outdoor um Fellowship service for the nation Day prayer because we do realize some people are working and can't get to the one middle of the day so we're going to have one at 6 PM we invite the entire Community we' reached out to all of the local churches to be involved uh and we look forward to everyone coming and being a part of the National Day of Prayer and y'all know my pastor so anybody is saying uh we all need prayer and there's power in prayer and so as we move our city forward we make sure that we don't leave that component out of course I'm co-hosting with commissioner bass but I know the entire commission is supportive and a part of it so we welcome and invite the community and uh Mr manager if possible I don't know um any employees maybe want to come over on the lunch break they can um you know we'll be there we're going to have some refreshments as well uh but we don't anticipate it being long anyway it's about an hour and length but we invite the community out to come for the National Day of Prayer um I think that's about it on my report uh thank you man thank you I'll be really really quick because yes it's been a while I just want to say thank thank you to everybody that um had anything to do with manifest it was an amazing event um I missed the first half but I caught the second half it was great um Alex you did an amazing job I know you didn't do it alone but we've had several conversations while he was planning he was a nervous wreck it was a beautiful event also the car show on Saturday I'm so sorry that the resident had issue with the noise but I loved it I love the noise because noise means alive you know it it was alive we actually had great time fellowshipping with uh with the folk and it was said that it was done annually and I agree with the resident that I spoke to that it shouldn't be annually and shouldn't take that long to do another one so hopefully it will come back before a year is over not that's too long um and uh that's going to be about it for tonight is is time so thanks to the police department thanks to everybody that had anything to do with all the events that we had this month thank you so much and I think that's it right all vice mayor yes I as Kelly uh commissioner Kelly had recommended I do want to provide uh the reports that I do give normally under the mayor's report uh which is financial oversight update and Gloria the gardens update okay uh so very very quickly uh Gloria glor at the gardens update uh as I stated our last commission meeting the uh HUD has taken the position of abatement uh that is at this time moving forward a date uh with a date uncertain um upon mobilizing their contractors to support the residents in in in that e in that effort uh a new general partner uh for Gloria Gardens Apartments ownership has stepped forward uh they've met with all the Community Partners uh including the city of opaka um uh HUD uh and also some other community departments Partners um they have um braford uh how to rehabilitate the property and demonstrate they have the capital to do so um so far all of our requests unlike the previous partner have been answered in the affirmative uh if HUD provid them with a chance then uh there is there looks like there may be a path forward uh to uh provide the residents with what is required from my position which is minimum housing standards um that consist of the update with glor the gardens will'll continue to meet with this new partner meet with the uh meet with HUD uh to facilitate the best interest of our residents um in addition with financial oversight uh we are contining to mobilize to complete complete our 2023 uh Financial audit reports so we are still within Striking Distance of submitting a Tim report uh very very excited to do that uh we are looking at I'm we're requesting a January deadline and we're going to be meeting with HUD to facilitate that I've requested uh a meeting with HUD excuse me not HUD I've requested a meeting with jayg uh through our uh uh financial department director um we will provide you an update as soon as we have that uh if possible we certainly will submit it in uh e even faster uh we still are on record as the only city uh in the history of the State of Florida to submit uh Three Financial audits reports in 18 months uh we continue to want to uh remain on that very very winning Stellar uh path and believe that we can do so Mr um just one thing for the manager yes sir I've been very nice trying to be bo tonight um when you all are doing these workshops or or presentations or want could could you all make sure y'all check with the clerk via US because a lot of times y'all put it out the fly out and we don't know about it until you know I think you got something I just saw it today for next two next Thursday th during the National Day of Prayer and that's a tough fit because it's I think it's 4:00 I forgot the time frame but I know we got the 11 45 got 6 p.m. and then whatever it is it's right in the middle um that makes it very difficult and a lot of times we want to be supportive just like the bus that you had on Monday but you know I don't know about my colleagues but had things planned I couldn't change and I'm trying to figure out how do we come up with the these dates and times without us really knowing because it will it gives a bad appearance we don't show up or not supportive when I think we are but um we got to do a better job of that um so how whoever does those scheduling or reaching out they could do that and secondly um you said they got new partners and I wasn't here last week so maybe this is already you know old news to me uh I mean to you all but the agreement that was signed or whatever that they supposed to be paying the money that's what I'm getting at um that's still in effect even though they switch Partners they've S I mean we've signed and they're paying the money or the whatever they're painting even though they're not the face or Vocal Point no more that's what I'm asking yeah yes um yes and I will confirm that the wire transfer was received okay because yeah a lot of time with these llc's once they switch over the money is not um you know get long the money okay yes sir thank you okay just one followup for the manager do you know if they signed the have they signed the agreement um the they want to request if they uh and um they have it to their Council it has Kenneth we name and they want to strike that they want to know can they nation under God indivisible with liy and justice for all we've come to the part where we will um hear public comments and public comments have to remain to the park itself because it's a workshop thank you um uh vice mayor yes uh can we move public comments to the end of the presentation sure okay okay so it's all on you Mr the manager good afternoon uh Commissioners uh and the public thank you so much for coming out uh my name is Darin Williams your city manager and I'm here to lead a workshop discussing the development of our Parks right next slide now just as a kind of a background we have uh three parks that we're going to decide but there's another Park that that we're going to be discussing tonight and some of the surrounding City properties that uh supports these Parks or joining to these parks and what those plans are in addition uh we have a break at uh we have a break at 6:45 uh we have Refreshments outside we have some food some edibles and some things um for a session that we have for a shade meeting for those of you that are also planning to attend uh the commission meeting okay so if you see here uh city vak is 4.25 square miles uh we have within that area three major Parks uh to the West we have shundi Park uh in the center we have seagull Park and on the east side as they say we have Ingram Park all right our first discussion is going to next slide and for those of you in the audience we also have these presentations on the table so make sure that you have one and you can follow along uh right here with your own paper copy uh I'm going to be moving really really fast uh but um because we only have a very very AB time but we do have a Q&A session we also have our consultant te Miller Le here uh that is assisting us with the with the development of the parks and getting your feedback they also have surveys for you uh so you're also able to fill out a survey so that your voice can be heard regarding how we want to situate these Parks one of the questions that was faced to us the really overarching question was between shundi Park and Ingram Park we can't put everything on both parks so how do we Implement providing services for the community providing services for our kids and so what we looked at doing if you take this slide for shabi Park the major thing that you'll see is that we returned baseball to shundi park along with that we're also looking in that bleachers area potentially with the if we're able to raise enough funding to outlay an Amphitheater there we've been discussing that as well you'll have a office kiosk a restroom and then uh to the left you'll see right by bomman Avenue we have basketball courts new basketball courts a water splash pad for those that have been interested in discussing and wanting to see a water splash pad and also a new playground set okay next slide so these cost of improvements comes to about $2.7 million uh the bulk of that being the baseball field uh for the drainage and soil and the field preparation that comes to about $1.2 million uh the rest of those costs are somewhat dimin di Minimus comparatively speaking you have the uh bleachers that are 175,000 uh the lighting we're going to put new lighting all around uh shundi field that's about $350,000 the splash bag comes to $120,000 uh we want to make all of our playgrounds uh ADA Compliant uh for those of you that come to our Parks over at Ingram Park shundi Park seagull Park you know that all of our playground systems are very very old and dilapidated so we're looking at ways to replace those uh the replacement of our of our playground sets will be will be about $375,000 uh kiosk and restrooms $425,000 so uh these costs are not actually current uh covered in our current budget uh we would be looking at ways to raise funding to actually Implement these uh you'll see later for the other two parks uh we have some funding that has been raised for Ingram Park uh we actually have uh seagull Park is fully budgeted okay now as we also talked about the parks we also talked about how we support the parks so for each one of these Parks the city of vaka actually owns city property adjoining the adjoining those parks and we want to look at how we're going to develop that next slide so for those of you that are familiar with shundi Park you know that that large Green Field that sits just south of shundi park that is actually city-owned property so we have determined that we could fit approximately 80 to 90 parking spaces there uh but we want to maximize the use of that property so what we're looking to do is put out a RFP to find out a developer that wants to partner with the city of opaka in order to bring a Housing Development there a market rate Housing Development there that will set aside 90 parking spaces for us and also provide some very much needed housing that we need here in the city of opaka so this is just a kind of brief rendering of what that might look like uh that would have the housing up top and then the parking would be on the bottom okay next slide okay so that parcel is about a Le just less than an acre uh the development need would be market rate so that's a a high demand right now which is in compliance to uh with our with our affordable housing rates uh and the site is proposed as a parking lot and have some mixed use development to it okay right next slide right uh this next slide covers seagull Park as I shared with you uh with uh seagull park at earlier the the presentation and workshop we've already funded uh all of the improvements with seagull Parks earlier uh excuse me not 2023 but in 2022 uh the residents came out and voted to support seagull Park and Ingram Park with some of the arpa funds so we've already begin to spend some of those funds some of the things that we want to do here uh as we know that our seniors use utilize this park a lot uh and they're all of our senior program is lo located at Seagull Park if you look on the slide or look in your presentation you'll see a new walk trail there's a brand new completely constructed walk trail uh for our seniors uh with drainage stations all throughout that will be implemented and placed into the ground to mitigate flooding in addition one of the requests uh from our commission was to look at additional parking uh additional parking for Seagull Park as that has also come into question so we have a new layout here that you can see that adds an additional 50 parking spaces to seagull Park uh and still maximizes the land used for all of its intended purposes now you what's what's missing you'll notice that some of that equipment and you know I'm in my 50s so I grew up with some of the old school uh equipment that's metal and you almost died when you slide down it so for the kids of this generation that are not using that equipment and it's somewhat unsafe we will be removing we will be removing that equipment as well so those are some of the uh modifications that we're looking to do at Seagull Park all of these have been um budgeted for some of these expenses have already made uh we've already uh did the fence um part of the parking part of the parking lot uh we're getting ready to the commission's already given approval to move forward with the drainage system and the and the new walkways and we'll be bringing if approved we'll be bringing the additional parking spaces forward okay next slide so the cost of improvements at seal park come to a m just over a million dollar uh the drainage system is about $475,000 the walking trail $125,000 the additional parking lot that we want to create for the additional 50 spaces that'll be about $325,000 uh we've already installed the picket fence that would be about $125,000 and again uh we want to put some new age appropriate fitness equipment out there particularly since a lot of adults uh go to seagull Park and walk and I we have our seniors there so that we're going to spend about $50,000 on that and we do have a grant for that so that won't be coming out of the taxpayer dollars okay next slide now this is one of the projects that if approved by the commission is one of the ones that excites me the most again as I as I've shared with you all at the beginning of this uh conversation uh we have a lot of land that is City owned land that adjoins all three of our parks and so we have to have a a a discussion around and that's why you all are here to give us your feedback to give us your thoughts about what does that look like how can we best utilize city land to support our residents now I will tell you opaka has a residential population of 16880 residents and out of that number we have approximately 2,500 citizens that are over the age of 65 and those citizens are desperately in need of housing so what we like to do here is put a housing a senior housing complex put a RFP out uh for a developer to come and be selected and work with the city to put a senior housing complex we think that would be ideal to support seagull Park uh since we already have our senior programs are based there uh our w walking trails are based there our adult uh fitness equipment is based there we could do a dog path or and be creative about how seniors get from their senior building to uh our senior programs and to the parks facility so we're really excited about this project I'm particularly excited about this project about the opportunities it can provide for the city of opaka and for our seniors okay next slide just a couple points about why we're looking to provide some housing for our seniors uh for those of you all know that we have the Town Center elderly housing complex we have the Archbishop McCarthy and if you are are a person over the age of 62 for uh over the age of 62 which is the requirement and it's income based housing and you make an application there the weight list right now is two and a half years uh so we hope yes it's two and a half year weight list so we hope that providing some additional housing helps bring some of the strain off of uh housing for our our our senior citizens right next slide this was a rendering now we've gotten actually a lot of excitement around this project as I've said this is just one rendering uh this one was selected by Our Community Development Department not my favorite uh but it's still very very nice uh they just kind of give you an idea of what we could look what it could look like um as far as a structure that we could place there okay next slide and the one that we're so excited about and the one that we're out here the one that we get to the most conversation around Ingram Park uh very very excited to open Ingram Park up to uh up to the community uh this has been a park that had been closed for some time since uh around 2017 after a hurricane and as your uh city manager I tell anyone that I give a tour of the city that this is one of the most beautiful parks in Miami day County and it really really is if you go there you have waterfront properties you have lush green grass you have lots of space and so we've put out a plan uh to discuss with you today to discuss with bring before our commission uh ideas of how we can situate that Park and we've really really kind of done it up so uh if you see on the outside we first have a uh running track so the running track here now that's other thing too I want to bring to your attention as we develop in the past we have not developed uh to competitive standards so although we have one of the best football team teams here all of our games have to be away games although we have some of the best uh uh running teams here and cheer teams all of them and basketball teams all of them have to be a away games because in the city of opaka we don't have any facilities that meet competitive standards to have for us to have home games so that's one of the things that we really want to correct and change so what we're looking at what we're looking at doing as we Implement our baseball park as we Implement our uh football field as we Implement our soccer park as we Implement these running tracks even running tracks have to be for a certain length and a certain width in order to have competitive races on them so as we're it costs a little extra money but we're going to make all of these facilities to competitive standards so for the first time when these parks open or reopen we will be able to have home games here in the city of opaka so yeah you can appla to that [Laughter] so so um track um we have a very very strong uh track program and we want to uh continue to support that so you'll see the additional eight Lanes there that we can have some competitive uh not only training but some competitive games there uh the bleachers look small but in real life they're going to be a lot larger we're going to have uh two sets of large bleachers that can accommodate home games with restrooms adjoining and a concession stand and office kiosk um additional parking lot uh pole ball courts um a playground a new playground um now out of all the parks Ingram Parks has the newest playground but that being said I think that playground was installed like like in the late 80s so we're looking to do some uptic somebody said okay we're looky thank you for the audience participation so we are looking to do some upgrades the beautiful thing about the plan for Ingram Park is we have uh h a plan to put not only football there but for soccer uh now both of those sports are highly highly highly in demand in our community uh we've got FIFA coming to Miami day County next year uh and we've have very very strong football teams that go to the Super Bowl every single year so we're you know going all out as you can see to give them facilities that are appropriate to the type of service that they are providing and the type of recognition that they're bringing to the city Baka now as you can see we've got a whole building sitting out there at Ingram Park so we will have to do this in phases um because that's going to be a very very expensive undertaking as well next slide so here's how we break down the cost um phase one which will include the football the soccer and the track field the pickle ball courts and the and the powle ball courts the water splash pad uh the new playground and the large capacity bleachers that phase is going to cost about $2.5 million now here is the good news as I shared with you earlier seagull Park is completely uh budgeted for and we are closing in on having um the cost for phase one for Ingram Park uh almost completely funded uh we are part partnering with a vendor here in the city that's bringing about a million dollars uh to the city of opaka uh the Administration has requested from Miami day County an additional $500,000 uh which is pending pending approval that brings us to about 1.5 million and the city's looking to chip in another $500,000 to seagull Park that would leave out of a $2.5 million cost for phase one that will leave us short just half a million dollars so we're very very that's if everything goes correctly as planned as we're pushing forward uh that would leave us uh with just short of a half a million dollars uh we can continue to raise and work for that we can continue to raise and work work towards that and that's going to provide all of the things that the resident has been coming to uh the commission coming to the elected officials coming to Administration say this is what we'd like to see for for Ingram Park uh phase two would be the gymnasium which is going to be that uh the building structure that include an indoor basketball court and that's going to come to about 5.4 million okay next slide now if no one has been out to Wilmington you're missing out and you have not yet seen the city of opaka that property that is alongside that Waterfront that that is city-owned property and we want to develop that for our residents it's right across the street from single family homes it's across it's across the Waterway from CBO Cove and it's just uh south of the uh of of the town homes that that are connected to the bus station excuse me the uh uh the train station uh right off of State Road State Road 9 this is some of the most beautiful property in Miami day County and certainly some of the most beautiful property in the city of opaka and we have plans on we can partner with developers to bring out that beauty all right next slide so here you see just one example some beautiful Waterfront town homes that we could place there for our residents to own to buy to lease to utilize to live and enjoy Ingram Park even better this is a great way we've had some issues there as those of you all know with uh people coming from other communities that launch and to the waterways that's actually illegal and we try to prevent that we have police officers that Patrol that area to actually prevent that because uh we're liable for that that's our land if something happens to someone and we're not uh uh we're not appropriately policing that area we're responsible for that uh even the commiss even commissioner Kelly has profit legislation that has has us putting out signage additional signage out there to kind of protect the city's interest there uh administration's also put up a burm to build up some of that Waterway and so that the backyards of these new Property Owners would be uh nice and lovely okay next slide as you can see here this is just another rendering of the potentiality of what this property could look like for our citizens for our residents for our uh new homeowners in the city of opaka and one thing that excites me about the prospect of this opportunity uh for the city of opalak is that right now there's a strong push for housing and the quickest way to address housing is generally Apartments um but there's something to be said about the American dream there's something to be said about home ownership and what I love about this opportunity is that the city of opaka can put together programs to make home ownership affordable for new residents or existing residents here in the city of balaka there are great programs that the county has to assist with funding and financing cras are getting involved with this so that cities can expand on home ownership so this is an opportunity because this out of all of the projects in the city right now this is the only one that would be conducive and suitable to home ownership we're really want we're really excited about it really want to move forward on it uh really want to get feedback from the commission and the Comm and the community to discuss what that potential could look like okay next slide uh and at the request of the commission the commission has requested that we discuss uh possibilities for adjoining land uh to our land City own property and what the city had discussed in the past there is a property uh um adjoining the city property called kayuga development it's approximately 7. Acres it's what is called a Brownsville site a Brownsville site means that uh it's been determined that there's been so many contaminants in the ground uh that sometimes for private sector the cost is prohibitive in order for it to be developed uh so if the opportunity arises the city would be more than happy uh to partner with a potential owner uh to ex to extend itself to a Brownsville Grant uh so that we could do some development there what does that development look like next slide as you can see here uh we've been reaching we well uh we've reached out administration's reached out uh to a public vendor for the potentiality of putting up a a grocery store there uh this is would be some years in the making so it's just at the discussion phase and again this is private property so this would be have to be the willingness of all parties and also a water park uh this was something that residents have been talking to Administration about for some time and as a city manager knowing that some area cities um uh such as the city of Mi Gardens has been looking for a place to put a water park why not opaka why not opaka first uh and I actually have my uh Community um excuse me Capital Improvements project manager Miss Adelina gross she goes over to a Mia air heart for lunch every day uh and I said well why don't you stay in opaka why don't we build you a water park right here so you can have lunch in opaka so uh that concludes my presentation I will now open the floor up to uh commission for question then subsequently to residents for their feedback yeah we're listen to the residents first since time is of the essence for us today thank you good evening everyone my name is Dorothy J Morrison and I am here to represent the opalak old school group could you please stand these are people who came to Ingram Park way back in the 60s this was my first full-time job I was 19 years old that was 55 years ago we have baned together to try to keep the memory and the legacy of Ingram Park alive my sister and I Betty morrs and King have come up with 24 items that I'm going to give to somebody uh who is in charge of this so that you could know what we are thinking because it's too much to go through right now my main thing though if I could engage you we need a sign on 22nd Avenue that say Ingram Park with an arrow pointing East people live right here in the city I cannot believe it Trayvon Martin's grandmother did not even know that part was over there they don't know it's there so anyway um I wish you all luck I really like what I have heard it sounds good sounds like it's already done thank you so much for your time thank you even good evening thank you for intruction I don't have to do much uh uh I thank you guys for all the h work that you doing and it's it really looks nice my number one concern well one of my concerns will be with the housing that you're talking about the apartments the apartments that we have in opaka now we have a parking issue and so I want you to really really think about it I see one plan where you say one parking spot per place and that didn't sound good and one and a half parking spot I think you're going to need more than that I want you to hit set of parking and the question I would like to ask if the soccer field and the football field at England Park are that one is that one field that's going to be utilized or is it two different fields do soccer and football run together will we be able to you know in football season use the football field and then soccer time use the soccer field or do we need two Fields I don't know I'm asking uh that's pretty much and then with the uh ta yoga you say the water part and we talk about the land is cool for that right I mean you know the the no you know I mean environmentally safe that's that so that would require uh that would require what is called a Brownsville Grant uh that's private that's private property and so the the owner would have to say we we'll work with the city to secure Brownsville Grant to clean up all of the contaminants there uh those contaminants uh cost estimates for cleaning up those contaminants have reached about 12 million do so we're talking about a heavy duty cleanup but uh what we want people to know is that there are a lot of Brownsville sites that are now developed Midtown uh where those railroad tracks that was once a Brownsville site uh downtown dado for those that have been to downtown dado those were once Brownsville sites so this is a possibility for us but it's not something that's going to happen overnight okay okay thank you that's all I thank you microphone please my name is Bridget stalworth I live directly behind the park where you go into the entrance I don't see where this you GNA first of all you're gonna block my view I can't go in my backyard I'm I gonna to see the back of people homes when you if you build this development sure where you live ma'am direct I can I can look at my watch my back my back porch and see the entire park but if you do that now with these apartments what am I going to see oh the apartments the back of their of their apartments with their garbage cans and everything what will I see but my house is already flushed against the Gate of the park no ma'am the there is city-owned property that is adjacent to the park that is extended is actually uh part of the parks that's waterfront property so those homes further down by the water yeah yes so then you're G to block The View that I cannot I can no longer sleep from the park if you're the only way that that could block your view is if you are on I'm on the park all the time my grandkids ride their bikes on that Park these homes will be placed on waterfront property so there's no way that your home could be between the land that's what I'm asking you where I'm trying to answer give me a where because I see the homes on this side of the park all right I see the the Spence with the warehouses I'm in the Middle where are they going to be so I'll get with you uh doing we have a break at 6:45 I'll get with you during the break to show you exactly where they're going to be why can't we just improve the park and leave it as it is I provide all those services to the to to the community and to the children re renovate the tennis court my grandkids are on the basketball court I would love you to renovate the the ground upgrade the trail so I can keep walking around while they're riding their bikes that sounds like a renovation no no no Apartments though those again again I'll give with you 101 those apartments are not where you think they are how about don't don't fix what's what's not broken how about that yes ma'am yes ma'am that's what I'm asking don't what's not broken yes ma'am Nancy I'm shy up here I'm one one person sorry about that I gotta talk in here yes ma'am NC if you could just give your name and your address I'm on York Street behind the park yes ma'am um one comment is if you improved the park made some type of rules for the resident the people in the park for the residents because last weekend the police had a um car show car show there and it was what 8:30 when the music Started bang bang bang bang bang bang and it went all the way to six o'clock my walls were shaking in the house so was my neighbor's house too and her she lives right behind the park I think you should you're going to have have a fence right between the park and the residential I don't know if you guys understand what I'm saying the houses are right behind Ingram Park right you're going to have a large fence to block their backyards yeah right by your house right yeah okay okay um let me um I'm nervous now um when you come came to the development from the little town houses that you showed by the park is it going to be um financially good for the residence for people to buy because lenar built a little far around the area they're charging like 400,000 for their houses and their little tow houses yes so I'm just wondering what kind of yes so that's one of the things that we're really excited about because this is city-owned property we can get really creative about how we help our residents to own these homes uh there's County programs that can actually provide uh Mortgage Assistance uh programs and also down payments and also we have a CRA and our cras are also permitted to assist and create their own programs to facilitate home ownership so we're looking at creative ways to keep the cost down and make it affordable for the residents you have this new um apartment building on 141st and 22nd Avenue that um was Coastland developers built that it's not open yet it's not affordable so unfortunately we're only can discuss the projects that are have to do with their Parks there's not enough parking under there yes ma'am so you could maybe use that empty lot right there before the park and make that parking additional parking for the building thank you I'm going to go sit down my name is Eddie Carwell my address 14245 Northwest 22nd Court uh I have several concerns first my first concern is uh will any of this cost come back to the residents on their property tax that's my first concern will the resident have to uh in incur any of the cost for these projects around the city no sir there would be no additional cost uh that would be added as additional tax to properties okay now the second one is do you have Engineers to go look to survey this land because the land that you're talking about especially at Ingram Park where you talking about building that gym they done build several buildings in in a tennis court and and it sinks so you would have to go where the uh senior citizen building is and where that parking space is in order for it to be stabilized and then when you're talking about with seagull Park they got a sinkhole in the back okay so uh whatever you think about building but my my thing is why wouldn't you instead of building uh apartment building why wouldn't you put like a clinic there for the senior citizens you know or for the residents um so they their health is more important than than um you know uh a place to stay because every part you done showed us you talking about bringing in developers now when you bring in these developers and these Builders they build will the money go back to the city or where the developers come in build get the money and leave the [Music] city I need an answer well this is something that was contemplated we don't have uh contracts there's not even the bidding process in place so it's a little premature for me to be able to know what you're thinking about and know what that would look like uh I can only speak to the presentation that we've given today and can we get two more Pavilions at Ingram Park because that one Pavilion ain't gonna work yes sir good afternoon everyone my name is Rodney Tillman I grew up on service road okay I want to know why are y'all taking the baseball field away from England par I played on all four teams as me coming up that was a s Day part for us when I was coming up we was always there it's basic B Teams out there want areas to rent parks in park would be a good idea I see the marins went and did shundi park that's ridiculous the way that field looked out and I'm a high school coach at Miami North West I'm always round kids just like I said uh Honduras league right here on 54 Street in 22nd Avenue I deal with those peop they need places to rent to play their games at I think engg Park would be a good place and I have talked with commissioner Kelly we was talking about it a while back but uh I'm here to give help to the community any way I can so anybody can tell me why is the baseball field being taken away Mr manager yes sir he wants to know why the baseball field is being taken um these are prospects and plans uh that are presented to the community for discussion we want you to give your feedback um baseball is not being taken away uh this is uh a plan um so if the commission supports the plan baseball would be present on shundi uh be a brand new multi-million dollar uh uh baseball field as I showed uh so that we could also have have uh soccer and football uh which we don't have enough space at sherbundy for soccer and football uh so we want to have soccer football and baseball so we would put a multi-million doll baseball field I think it cost about $1.2 million at shundi uh and put a a a nice facility for football and soccer and also track at Ingram okay but what about the kids at ingland Park they got to travel all the way to shundi that's one point three miles sir we could walk that together they might need to exercise like I say when I was coming up shundi had uh shaby had they Eng par had well if it be the if if it be the will of of the of the people and it be the will of the commission that we no longer have football and we no longer have track and we no longer have soccer then we might be able to accommodate that right now we do not have enough parks to put everything at every Park we just don't so this is just a proposal okay shabany field is too short yes sir you can play t- ball 11 12 13 and 14 maybe but for adults that's what I'm telling you you can make money on the outside with the adults like I say the Rocka leag they looking for places to play uh in Liberty City they only play on 54 they gotta play about six games on Saturday GW Cherry closed down that's money opaka can bring in well that's certainly something we'll look at okay thank you yes sir Chris Roberts 640 dunad Avenue I do not agree agree with the situation of baseball on Ingram Park and I'm GNA tell you why I don't agree with baseball being on Ingram Park first of all we have bigger issues with England Park we have to first Zone it so that we'll have a double entry so it be listed as a park first that's what the people do not know the other issue is the feed for the children and the participation on the east side you get on your feet the people don't even participate we have only time you're getting issues is when it affects them directly right now because they said they got to put a um a building on that part I'm all for it everybody knows I grew up on that side too 40 years but if you do something you do it the right way Ingram paron have never been open never been open it's a straight liability right now it's a liability part and you have to go out there and you will understand why I say it's a liability I can show y everything that I've complained about or whatever the situation is I'm here and I've been fighting for a long time where everybody was sitting home I was here still fighting for it I'm all for Ingram Park being open but the right way good afternoon uh I it's a little bit outside of the Parks and Recreation but I would like to talk about the safety issue right Sandra my name is Sandra 403 fisherman Street um I want to address uh the lighting outside of uh Amazon it's pitch black outside of there outside of Miami Garden like it's Miami Gardens like when you coming from St Thomas University and you 32nd Avenue swe sweetheart if you could just wait for commission meeting that's a commission meeting issue opposed to the workshop we're in a workshop right now all right so for Parks and Recreation what about the homeless issues same thing same thing thank you quick question my name is Brandon Lawrence I live on 1980 wimington Street I'm right next to the lake behind England par I think I spoke with you before I just got here what were your you guys plans to build next to our house because when you guys say Waterfront we're on the water so if you're building buildings is it going to be as big as the ones off 22nd because that impacts all of the current residents that are there that you're now going to take away their rights to the water if you're now building a building right next door to us because we're the blue house before the land so we're on the water so we would be impacted and our residents here no one wants to be looking at an apartment building in a residential zone so it's like us that have been five years a little longer us that have been there you're taking that away from us and the whole Community it's all houses so why is there a building of Apartments where everyone else's house there it's not even it's a dead end so where's the where's the In-N-Out for all that traffic that you're going to put on the end of the street so if I may respond um I actually met with you sir if you recall uh and I asked you what's your pref preference was since you are these are going to be your your neighbors and I told you then that we were looking at single family homes or town homes and we're looking at single family homes and town homes now so there's no buildings that are going to be beside that property as would I and we you and I had that discussion as would I so what about extend the park around to our side extending the park uh there's no plans to extend the park would there be an entrance made from our end so people who have access ABS uh uh what the previous resident stated is absolutely true uh Ingram Park is not recognized by Miami day County at this stage uh in order to a park to be recognized by the county for official uses and purposes it must have what is called a in a egress and an Ingress right now you only have an entrance to Ingram Park so it is Our intention to build another entrance from State Road 9 then it can be recognized we can put signage out uh and it would be an official park it come from State Road n up wiling yes yes sir my yes yes sir Ro yes as I shared with you on the map that that was a road already there that that city property that there's and I can show that to you again and I can share that to you again like what I was telling before I I'm only 38 M right this was my grandparents home they brought that home they passed it down to my dad my dad passed it down to me okay for long as I know and I talk to my older siblings there was never a Road next to my house I'm the last house on the right well you know I talked to you before yes right next to the W yes I've never seen a road there so I don't know what anybody else is talking about I've talked to some of the older neighbors that are there but I've never seen a road there okay but if you put a road there now I'm sorry this is my neighbor from two houses down okay it's never been a road there okay I'm 38 my older sister is 606 well again if it be the will of the community that we not have an official Park as I stated the only way that that can be official Park is if it has an entrance and an exit if it does not have an entrance and an exit we will not be able to get funding for that park it will not be recognized by the state it will not be recognized by the county that as you and I share that is city property uh we must must put a road there in order for people to have Ingress and egress to that Park okay but that that amount of traffic coming in and out are you don't think that's going to affect the residents on that street well we'll certainly have a traffic study done uh but at the end of the day we're putting for proposals right so these are proposals for discussion uh that we can continue to engage the community in continue to engage the commission and have the community and the commission make the decisions that are in the best interest we're just putting forth proposals okay um I'm sorry ma' no you'll be our last presenter and then we're going to adjourn this meeting those of you that have public comments you're welcome to come back during our commission meeting we have two other meetings um one with attorney client session and then the commission meeting right after that so you'll be our last presenter then we'll let the manager close out this portion of the meeting and then we'll go into our second meeting and those of you that have comments you can come back to the regular commission meeting at 7 and voice them at that time so we'll let you go ahead you let save it for that one all right so Mr manager if there's nothing else okay so yes so um thank you Mr Mayor so we're going to close out here again we had a discussion on three of our Parks we appreciate all of you that came out to discuss uh we have uh for during the break we have uh refreshments and foods and other items uh for you uh and then uh at 7 o'cl we'll be taking public comments for any other items that you have right Mr Mayor you Mr Mayor commission Kelly I know we're leaving here but y'all you know I'm G set it hour I believe it we just got this ourselves so I want the community to know we just got this so we're digesting this just like you are and ain't nobody out there and some of y'all older than me yeah y'all know my mom y'all know a group New York Street nobody loves Z Park and the park system more than me I got some real concerns about what I'm looking at everybody want to see the park develop and yes the county may not recognize it in its current state we'll deal with that and move forward thank
