Al to the flag United States of America indivisible andice thank you if you could join me for a moment of silence thank you like to call this meeting the order it is Monday August 5th 2024 at 6:30 all members of council are present uh first up we have our ceremonial item uh the opening of the art in the chamber program so how do we want [Music] to deputy mayor uh we have some folks to introduce to you tonight and Dr CRA is going to do the introduction great fantastic so would you like to come to sure the floor so mayor deputy mayor council members we are very excited today to be opening the um program art in the chambers and we are even more excited to be open opening with the exhibition we are opening with which is really a Hidden Gem for me here in the city um and I would like to invite the public art board members to come to join me because this program is sponsored by the public art board and then we have also um the daughter of the artist Mr James um kenck the daughter is here with her husband I would like to invite them to come as well to join us here and um um as you can see these are amazing watercolors that show a city that is not here anymore right but it's beautiful um paintings and uh and the idea was brought to the public art board by Mrs Helen Clark so I would like her to give us the the history okay thank thank you well I have a few notes here to help me along if you don't mind I I want to thank um the mayor the deputy mayor the council members because you're supporting this Venture the public Arts board and um we appreciate that oh and we appreciate that sorry about that but I also um I've lived here quite a while and have worked and with the city and done things with the city for many years but I want to say officially that the um um staff that helps us Dalia Teresa and our attorney Juliana none of this could happen without them we had the idea but they put it together that that should be noted so we want to thank you for that um so when we decided to have this um what arts in the chamber um it didn't take us long at all to realize that we wanted to start with um Jim cavik he moved here in 1969 and to work as a biology professor at Florida Tech and um he moved first I think to me Manor and then to Garden Grove in the part of Ovito that was Agricultural and these pictures I just found out from Kim today he intentionally wanted to document the Farm Workers The Groves the people the buildings of Ovito because he knew that it was going to be passing and sure sure enough it did I met Jim in um 1988 so he was a wellestablished citizen here and his warmth and intellect and his kindness you can see in his work the color um the light and especially the people so um I hope you all can see that in the back there's a biography of Jim there's posters that we're going to sell and mostly I want to thank Kim because Kim sharing these with us for months now we can have these up and people can come and see I'm coming Wednesday with my grandsons and um just to see something that just isn't here anymore so thank you all for listening and here's Kim all right well thank you guys for having me and I wanted to thank you so much Helen for um and you guys Helen is our neighbor in Ovito so I've known her and her husband for quite a long time but she's really the instigator of uh getting this started and uh inviting us to participate in the exhibit I also wanted to thank Teresa and Dalia and really the whole team of people I know there are many people behind this that that really put this together yes you know the lawyer team and even the facility Ops Team that you know hung all the painting So carefully so uh really appreciate that and um I just uh I know my father would be just so pleased uh to have his watercolors shared in the community again um he's with us here in spirit um his ashes are actually in my little necklace today so he could so he could be here and um there a little side note there but um as Helen said um we move moved here in December of 1969 from Kansas and you can imagine my uh what a treat it was to moved to Florida from living you know Colorado Kansas New Jersey a lot of northern states before uh my father found his uh work home at UCF which back in the day was Florida techn Technological University and um so my dad you know lived here 45 years he passed away in 2015 he was very very well known uh as a UCF Professor he um was awarded the UCF teacher of the year three times and you know that was quite an amazing and even in the other universities where he taught he won many teaching Awards but even as a little kid his passion was Art my grandfather was very artistic and uh so my dad kind of grew up with that and uh he originally did not think he was going to be a professor he thought he was going to be a medical illustrator until he got in the O and and then he's like I can't I can't be in the O and you know draw paintings and stuff from that so he got out of that and he decided that the watercolors were going to be his his hobby so to speak but really was like a second profession and he developed his skills gosh for for decades and um he was nationally known he was a president of the Florida watercolor Society he was inducted into the national watercolor Society um he was a judge for many art shows besides winning and participating in many art shows when you go in his Studio there's still lots of ribbons all over and um uh and he was a teacher uh of art as well he did workshops and um you know he loved sharing and teaching but what was unique about him is he really loved integrating his Science Background his degree was in biology but also botany so he loved plants and um and then he loved integrating that into art so he meshed both of them um I can remember when we moved here um back in the day Lake charm Drive dead ended and turned into a dirt road that headed back towards the Black Hammock and back there there were no houses it was all fields and I can just remember going with him and he loved to you know look at the folks that were you know picking cabbage and celery you know a lot of you may not have known you know was like the celery capital of the world and uh he just really enjoyed um do documenting all the the people that you know were behind us getting food and um so I think you know for me just to have those uh images as a little kid just really remembering him you know trying to honor that and now as we've seen Ovito really grow a lot um I mean I always joke and say back in the day I was teased in high school as being a hick from the sticks that's how was you know known and um but now gosh you know UCF is you know one of the largest universities in the country and everything is really grown but a lot of the land where the agriculture took place and even a lot of the nature my Dad loved to go um you know to the waterways and uh like St John's and stuff and and take pictures of that and he would always paint off of his pictures so we have tons of slides so I'm in the Historical Society someday I gotta donate tons of slides of old oito and probably some of the paintings too so uh anyhow um but I just want you to know you know he he was a very um skilled and respected artist and and educator a professor um he loved Ovito and you know this this is the town where he passed you know he made Ovito I was only 10 and I'm 64 now so you know all these years this was the his place that he really found that he loved because we moved around a lot when we were little so um you know I know that he really um would think that this is very special you know to have have this honor and it was so funny because I was going through some of the art magazines he's been featured in many art magazines he's been interviewed a lot and uh what Helen was saying I was telling her uh today I found what his quote was and it says my work is recreating history and reflecting a Vanishing lifestyle and um and that is so so true so he certainly painted many other things other than just oito so they traveled he and uh my mom and then my stepmom after my mom passed they traveled many places around the country in the world and so there's certainly much other artwork that we have that represents other areas of the United States in the world but it's so special to start this out with uh with oido so all right so thank you so much thank you there other paintings only oh my house is full of paintings it's like an art yeah so in this exhibition we'll be here until December 19th let me grab some of my other stuff sorry I had others [Music] that's good stuff all right next up we have the approval of the minutes for June 17th 202 before regular session June 24th 2024 work session what is the favor of council I'll make a motion to approve the minutes of June 17th 2024 regular session and June 24th 2024 work session second all right I have a motion a second any discussion okay we'll take a vote all those in favor say I I I the minutes are approved next up we have public comment I have two written requests uh first up uh sine L Saron did I say it right be the first one you you are the first one sir yes so if you would state your name and your address for the record my name is Sim alaran address is 73 East High Street uh uh so good evening council members and the city staff thank you for providing me the opportunity to be heard my public comment is about the impact of the construction of OVA square town home Community to my property project also known as chelonian I group the current impact under three headings and I have communicated with Miss Korea about them she's great in following up I provided some documentation to you in case in your spare time you want to find out or if you're asking questions it's not for here and uh so I think that they were distributed to you and um after mentioning these I would like to request for consideration a modified approach in involving adjacent residents when engaging in a major construction next to their property so there are marked up photos over there again now or in the future I can be uh you know just uh ask any question if you are interested so uh the current impact is in terms of a fence that was being located at a location that that is not matching the drawings I happen to have the drawings that I had obtained them and then I have iner Miss Korea and she's addressing it now this fence is uh is related to some drainage issues there in my opinion but I do not know and so as much as I analyzed I addressed and like I said she's great in addressing them and there is a retaining wall and this retaining wall may be related again the rage issues I would like to remind that I do not have a mount in my property I have septic tank and so the high the Alafaya Trail is sitting at a high location there used to be a nature balance there now that balance has been intervened and so if the water flow is going to end up in a such a way that it saturates my property then my drain field will not work I did have a soil study report done when I moved into the house and I know where the water table is M request would be that post construction they should be monitoring in the rainy season following rain events where the water table is going to be now another comment for current situation is one day when I was home there was high vibration cylinders that were being utilized next to my property not only me even a turtle that I had not seen in two and a half years had come out because it's probably barrows were were collapsing so who am I again I am not the person who is is going to judge whether it's going to be the the impact is minimal or less and I find something about Florida Department of Transportation when they are saying hey compacting is going to be affecting the properties you need to do this and that so miss Korea and I we are working on these things my three minutes is up now I would like to make my recommendation if you please allow me as suggestion for consideration very quickly uh it is that uh when they are involving in a major construction like this is it possible for the Constructor to budget independent counil that actually works for the interest of the residents that are in ad adjacent properties I would like to give you the example if they do their own quality control it would be like me going to University Writing my own exam passing the exam grading the exam and graduating myself and so in this case that they could have distributed the mail the the drawings to us and this independent council could be talking to us I don't know if this is legally possible but it could have been great because I am on my own trying to monitor if there would be impact to me during construction I think that this is enough so you get the point thank you very much for for this time great thank you okay next up I have Mr Allen a thank you Council uh for giving me the opportunity to speak my name is Alan a I live at 1000 Lake Roger Circle in Ovito uh I was here for the special session last week and I'd like to thank the city staff uh particularly Jerry Bop uh for his great prot uh presentation about the difficulty that the city faces uh in budgeting and Taxation a lot of people were in attendance and I think there was an expectation that a lot of people were going to be angry but by the end I looked around at the body language of the people who had stayed and I got the feeling that everyone understood the difficulties of the issues and for that I credit the presentation given during the first 90 minutes of the meeting so uh thank you to uh Mr Cobb and uh Mr Boop I don't know if who's here there he is uh the second issue I wish to speak about is uh the meeting before the special session on uh July 15th where the council uh conducted a public hearing regarding the police station Bond referendum during this hearing there was a second a second presentation made by Mr Cobb about an alternative way to fund the police station using the one cent sales tax unfortunately this presentation was not in the packet and it was given after public comment had clo had been closed public comment was not reopened afterwards and so there was no way for the council to get input from the public on the alternate proposal now I want to be clear that I'm not throwing rocks at anyone here and in particular I'm not throwing the rocks at the one who is holding the gavl I recognize and respect that we have regular order in this chamber and perhaps our regular order did not allow public comment after the presentation however if the regular order during a public hearing does not allow the council to hear from the public then perhaps the regular order should be amended or Revisited and and that's all I have thank you great thank you I do not have any other written requests to speak is there anybody in the audience that wish to speak on any subject explain to everybody why I'm wearing this shirt so uh Omari Jones is fighting uh he's a boxer uh whose family hails from Ovito and before he went off for his final training he stopped through Ido to visit with his family and so all of us could give him a fond farewell and and cheer him on uh so he has won his first two matches and he is down to the top four in the world for the welterweight class so he fights again tomorrow I'm not sure exactly what time but I'll do my best to find out and post in social media so we can cheer 3 o'cl 3:30 in the afternoon or is it in the morning because it's Paris all right 3:30 in the afternoon thank you very much okay very good okay we are on to the consent agenda what is the favor of council I'll make a motion to approve the consent agenda as presented have ordinance number 1747 annexation of 0.56 56 Acres of simal County to the city of Ido Mr Hall can you read the ordinance by title only absolute Mr Mayor ordinance number 1747 an ordinance of the city of Ido Florida annexing by voluntary petition that certain real property approximately 0.56 acres in size generally located on the south side of Geneva Drive and the west side of Reed Avenue and located contiguous to the city of Ido in accordance with the voluntary annexation provisions of section 17144 Florida statutes redefining the boundaries of the city of Ido to include said property directing the city clerk to record the ordinance with the clerk of the circuit court with the chief administrative officer of Simo County and with the Department of State providing for a legal description and a map providing for a savings provision ratification of Acts and acknowledgement of inclusion in lands within City municipal boundaries providing for conflicts providing for separability providing for non- codification the taking administrative actions providing for scrier errors and providing for an effective date great thank you sir Mr Cobb can you give us a brief introduction uh yes thank you Deputy Mayor Annie if could we pull that map up uh for the annexation uh section 17144 of the Florida Statutes allows a property owner to petition a a local government to uh Annex his property into the municipality and there's three things that the statute requires the property must be contiguous to the corporate boundary of the municipality it must be reasonably Compact and it cannot create an enclave uh this is a voluntary annexation the property owner did submit a petition to Annex into the city uh the site is contiguous to the city's corporate boundary it is reasonably packed it's only uh one parcel it's less than an acre uh it's half an acre and actually in this case the prop this annexation will reduce the size of an existing Enclave uh the city staff in doing their analysis of this realized that there's a portion of of Reed Avenue that is still unincorporated that just happens to be adjacent to the property so we're recommending that we include that portion of breed Avenue in the annexation ordinance as well and you can see up there uh the the cross hatch you can see there's a little piece that reaches out to the right there uh of the cross-hatching and that's the part of the rideway that staff's recommending that we include in the in the ordinance but U so C uh Deputy Mayor this um this annexation qualifies for annexation the city under Florida statute it's recommended that city council conduct a public hearing and adopt ordinance number 1747 great thank you I know the applicant is present would you like to say a few words if you could just state your name and your address for the record uh hello my name is uh Malachi Middlebrook I am the owner of the property at 1088 Geneva Drive I am here today to request a land use change for 108a Geneva Drive from simal County low density residential to the city of OVO medium density residential in 2021 we purchased the property to house my elderly father-in-law while allowing him to maintain independent my family which consists of myself my wife BNA and our three young kids currently reside in the carolon community of Ido although close enough to care for my father-in-law it has become increasingly evident that more full-time care will be needed in the near future the purpose of this request is to seek approval of the change mentioned with the ultimate goal of splitting the current property from a single 56 acre parcel to two quarter acre Parcels allowing my family to build a new home that can accommodate us without needing to remove the existing home which has been a long-standing home in Ovito for over 80 years and potentially dis displacing an elderly family member for an extended period of time uh thank you for your time great thank you okay I do have one written request to speak on this subject Mr Allen a hi thank you I'm Alan a uh 1000 Lake Rogers Circle uh regarding this ordinance annexation into to the city looks good and does reduce the size of the existing Enclave but the zoning in this case goes from A1 agricultural to R2 medium density residential um this seems to be a significant upgrade the R2 in the OVO Court of ordinances reads uh the following the r1b and the R2 districts are designed for medium density single family detached single attached town home and two family residential development generally located in areas with complete Urban Services while the south of the while the zoning to the south of the property is currently R2 the property to the West adjacent to what would be the remaining Enclave uh is R1 uh the Zoning for this property could be made R1 by the council and does not need to be made R2 much like every rezoning it's not about what the current applicant plans to do or what he says he plans to do the resoning is what a future owner could do with this property namely building town homes this ordinance gives a significant upgrade in zoning where an upgrade in zoning does not have to be given I ask Council to consider our one zoning since the applicant has stated that um that he wants to do something other than developing Town Homes thank you great thank you the only written request I have is there anybody in the audience that wish to speak on this subject okay seeing none we will close public comment what is the pleasure of council make a motion to approve ordinance number 1747 second have a motion to Second any discussion well this this motion is just to Annex the property and this is not a zoning question right now okay I've got a question and I'm not sure if it's for the applicant or for staff um I I'm wondering if the intended use is possible in the county and what benefit there is to the applicant to come in because my understanding is you already have utilities and all this does is create additional tax taxes for you so I feel like I'm missing something here oop sorry uh yeah so to answer that question I started this process back in December of last year um I just I started because this is a property of of seminal County unincorporated uh the county did a pre-application which you know I paid a fee to do a pre-application for them to basically tell me what I could and could not do um in that process uh they determined that this was an enclave surrounded on all sides by the city of Vito and they requested that we get a pre-annexation agreement from the city of Ido uh before they would allow me to proceed any further and so uh when I discussed uh back in February the um with the city staff um they made the recommendation that they would like to move forward with the possible annexation and so we are here in August and that's what I'm doing all right thank you and uh I I believe that what you have said is accurate but I have a question for staff and that is have you cross checked with Cal County because I spoke with some people at Cal County today and they said that they that they do not require people to Annex even if there is an enclave so I'm I feel like we're missing a piece of information somewhere and I don't want to create a scenario where somebody feels like they must Annex if it is a choice not to and you can still accomplish your goal so I don't want anybody to be tricked into annexing or us to do it in such a way that ultimately we create a higher density than maybe anybody is intending to uh to Mr 's point though I do like the idea of more taxes I mean that's that that is nice so good evening um mayor deputy mayor council members um we did not check with with the with the uh County we received today the DRC package for the pre-application meeting um that's that Mr Middlebrook had with the the county and they did not require the property owner to um to Annex into the city but because it's an enclave an enclave it's an urban issue for both entities right for the city and the county because it's it's really a little island of a jurisdiction within another jurisdiction so it it's something that both sides would like to resolve um this is not sprawling this is just resolving an piece of seminal counting within the city so it would be an infill right the agricultural use and and right now we just talking about annexation right but the agricultural use is an artificial um uh zoning because this is not an agricultural um area actually there is a house on the lot already um so because it complies with the require requirements of the statutes and our comprehensive plan talks about resolving enclaves there is no reason for us not to recommend okay okay okay any other questions okay say none we will take a vote all those in favor say I I I opposed it is approved welcome to the city okay on to our next one this is ordinance number 1746 Mr Hall can can you read it by title only absolutely Mr ordinance number 1746 an ordinance of the city of Vito Florida amending the future land use map of approximately 0.56 acres of land generally located on the south side of Geneva Drive and on the west side of Reed Avenue from Simo County low density residential ldr to City of Vito media adity residential MDR providing for legislative intent implementing administrative action a savings provision scrier errors conflicts and separability and providing for an effective date great thank you Mr Hall Mr cob can you provise a beef a brief uh introduction uh yes thank you deputy mayor uh any if we could pull those mths up as well uh one of the things about when you Annex property into a city the first thing you have to do is make it part of your comprehensive plan uh no development activity can occur on the property until it is made part of that Comer plan the applicant has requested uh has requested a uh a change change to the comprehensive plan to incorporate it as uh City medium density residential and uh that's what this does it is a change of jurisdiction from County to city as you can see from the map on map on the left it shows the existing with uh the county uh low density residential future land use you can see there City uh medium density residential to to the north and to the East and southeast of the property then there City low density residential to the west and to the uh to the northwest of the property the um The Enclave that surrounds it is County ldr County liny residential as well uh the uh when we look at these we look at we look at compatibility we look at uh is there sufficient infrastructure to serve the property uh what are the impact on natural resources those types of things all covered within the comprehensive plan the staff did their analysis and they found that the proposed medium density residential land use uh is consistent with the city's comprehensive plan uh the the uh local planning agency uh conducted a public hearing on July the 2nd 2024 and recommended adoption of the ordinance it's recommended that the city council conduct a public hearing and adopt ordinance number 1746 great thank you and I know thein is here do you have anything to comment on this um so malikai Middlebrook my U 1088 Geneva Drive uh just one additional comment from my previous my previous comments are the same but um I know there's been some talk about ldr MDR and A1 Agricultural and the reason simal County would not allow me to stay A1 agricultural even if I were to go to the through the simal county um dur jurisdiction um that's because it's a non-conforming property which means uh A1 agriculture has to have at least one acre and so even if I were to go that route I would have to tear down the existing structure to keep an A1 status and even that would there would be some loopholes involved and so part of the request for this from from agriculture ldr A1 to MDR is obviously to to Future proof um any sort of plans that we might have again the existing home is over 80 80 years old and while we do our best to maintain that structure um it might come a day where it it just can't stand anymore and so I do have a young family with three young kids that hopefully will stay local and go to University of Central Florida or somewhere else that you know we could potentially have another uh piece of of uh home that we could build for them so um that is the reason why we've sort of requested this long term um I think anyone in my position would do the same but that's the only comments I have great thank you I have no written requests to speak on the subject is anybody in the audience that wish just to speak on the subject okay seeing none we will close public comment what is the pleasure of council make a motion to approve ordinance number 1746 second all right I have a motion a second any discussion you know the the difference I mean right now we're just doing the future land use but the the you know looking at the map up there um you know it's right between ldr and MDR and as we saw when we were going through our comprehensive Plan update um we're trying to get away from less dense places because they cost the city a lot more money to maintain the the dense the the Le less density so as we're moving forward we're moving more to an urban environment en um you know medium medium density residential Mak sense and you know and you know whatever they want to do with it um you know as long as they're within their rights with that land use um I'm I'm all for it Council woman to sure um you guys have dealt with a lot of government to get here um but as far as what's matching up here I mean we're surrounded by MDR I agree with that it's also gone through our LPA board and our citizens have said go for it and I haven't heard anybody say anything against it as far as the purpose it seems to fit the area so makes sense to me council member bruttin I'm good thank you madam mayor while I see how eliminating The Enclave by annexing solves some problems especially for law enforcement uh to have continuity across that area it there there is a a block that's ldr and I I get that it's contiguous but once we start going across the way um yeah I I just have some reservations about that and about the long-term use uh and using annexation to as as a mechanism to increase density uh because that is something that I think residents are not aiming for and best I can understand from our code ldr will allow the exact same outcome as MDR so there's no need to do the MDR for this particular use and this family and I do want to make sure that since you have gotten through all of this government stuff that you get to the end result that will let you do your vision and I do believe ldr will let you do that so I guess my question would be you want them to be ldr he borders up the MDR so when did when he wants to go to MDR what are you asking him to do to come back again come back again but I don't think he doesn't need to cuz he can slice it in half and still be ldr is that not correct and I guess that's a question for staff I think there's enough land there to have two quarter acre lots and have plenty of setbacks to have two complete ldrs or to keep it big and you can have the main house and and an Adu which from a tax perspective maybe even more advantageous I I don't know so the diff difference is that MDR would allow a little more density right the double of density absolutely and would allow duplexes and and another policy of our comp plan and we discussed that in the comprehensive plan um rewrite was to um tackle the missing middle and missile middle will happen with those infield um Lots so this is an opportunity since it is a buing MDR to the north and to the east to U provide the same level of of density that you have um to the north and to the East do we have sewer nearby um I I'm not sure re sewer if it was multi family cuz that that's my concern I'm looking at this thinking we're not going to expect anybody to pull sewer there if you're saying I'm just want not multi family duplex I'm talking about duplex R2 would allow duplex duplex is two units and a lot um I'll have to check I think we we um I'll have to check we we are not there yet okay and and right now he's not asking you know for duplex but that is that would be the difference then it would be that would be consistent with the comp plan if you did come back and say you know really I'd like to have two duplexes here and not maintain the 80y old home and build another single family home but instead I want to shift it up in here which I'm kind of open to that but I think it is it should be done a little bit less peac meal and more consistent with like it looks like we had a plan and that the plan did not involve uh MDR in that area you're like if if we had considered it in at the same time as the rest of the the city it probably would have ended up ldr and not MDR in that area so that's my thoughts but thank you for for the info of no info on where sewer is okay all right so we will take a vote all those in favor say I I I opposed n okay 4 to one all right we have no first reading orces resolutions none uh discussion item City website redesign update I assume since Mr Kelly's jumping up that will be him good evening uh deputy mayor uh mayor city council members uh back on March 25th um we brought an item for you uh at your work session to discuss a website redesign and uh hosting focus groups to to do so thank you Mt or Annie um so um uh we advertised uh for focus groups uh from March 29th to April 22nd uh then met on uh May 2nd uh we had two groups come in uh at uh 10:30 and 6:00 p.m. uh so we are able to accommodate folks uh with day jobs uh in the evening and uh uh you know other folks in the morning so so had a had a good group come through how many did you have um we had uh right there um okay so really we had two groups of of four and four um that's a familiar name and lots of very very talented folks uh one one was a a TP web design at full sale uh few web developers on some some bigname uh websites that you would know uh several that are advertised nationally uh one uh just did a redesign project on Disney's website one did Wells Fargo a popular sports book as well um and then we also had a couple of other folks uh one uh was a realtor who had just moved to town and only been here for a month so that that was some interesting perspective of someone that uh did not uh know a whole lot about oo and really relied on our website to to find information or in some cases lack thereof um and we had a couple of folks that were not able to attend either work session U either focus group that offered some written uh help in lie of being there so uh next side uh please any uh they first uh gave some uh wonderful uh websites to emulate uh City Durango Colorado was the one that was brought up most we we sent a a a large list out for folks to look at uh that was one uh city of apaka next uh and then uh this is actually city of San Jose uh out in California which was another good one and you'll notice sort of a a trend here that they're uh um a lot more mobile friendly um than our website and that was uh something that was very interesting they were uh they were all fairly adamant every single one of them about not uh relying on a mobile application but rather a just a web responsive uh a mobile responsive website uh so that was some uh very helpful information next slide and like I said this is uh uh city of apaka was was one another one emulate so two of them were Civic plus yeah I was going to say a papa looks like ours yes very similar but it's got more of the tile uh tile look to it uh and so Durango Colorado was was Civic plus as well but San Jose was was a independent U it being Silicon Valley I guess that was a good place to to to look uh next slide please um so they got together uh like I said we met for uh two 2our uh work sessions keep going there we go uh it boiled it down to to several recommend I'd like to go over with um and uh you can go to next slide please uh there was about 15 or so keep going no you're fine you're good um they're all individually listed here but we'll go through them one by one really really quickly uh next slide so uh first thing was just condense the the information um there's a lot of steps to get to information you're looking for um and uh that that kind of makes it more difficult the rule of THB when we first started out was was sort of three three clicks to get what you're looking for and and many of our uh you know subject matter has to be found uh uh several more than three clicks so that's one thing we have to work on next slide please um they also gave us what was a good page with and that was garbage in recycling uh that's just sort of a look at it there um that had all the information you need on one one page uh that where you could would quickly and readily find information next slide also the the count calendar was was a big big deal uh some discussion on what how important it was to have it on the front page um we're going to look at maybe a a modification of where where it's one button click uh kind of pop out on a sidebar um but the the look of it was was something that uh was difficult this this one is from Durango Colorado you'll see and it was it's a little more lot cleaner a lot more uh a lot lot nicer to look at than what we we we typically have right now did theirs was theirs on the front page uh it was yes uh and then next slide fine so uh and better present Event Event information this is actually something that Miss McDonald uh did a great job uh you'll notice we changed uh on our website right now um she um uh changed how we do it and it looks a lot cleaner where it just basic this is happening on this date at this time and then click through for more details um and that's on a sliding uh uh rotating carousel there and that's uh I think much better and that's something we're gonna we're going to continue through on our next uh after we do our update next slide so the newsfeed is something else that uh it's kind of it's It's stale it's just text it doesn't really grab the reader attention very much and that that was something that uh Durango did very well so you'll see you know an image people like pictures and uh then a sort of a by line uh a headline sorry and then the the text under underneath it so that's that was a uh suggestion of the group as well next slide please Annie uh and then a more prominent search bar ours is up in the very top U most people are used to seeing a search engine such as Google or or something like that and search bars in the right right in the middle this was a great example of of what that looked like uh so uh we can utilize that um on our uh redesign next slide please uh and this came from our our our realtor our new Resident promote ovido so we went and looked at the about OVO website and web page and this is about all we got on that page um so while there's a lot of information uh about Ovito it's kind of scattered throughout the website uh so as as we do uh complete our redesign we thought we'd uh uh do a better job of of using all that great content that Miss McDonald uh has been promote uh producing for us and uh really try to do a little bit better job selling oito and what a great Community is next slide and then organize uh the resident tab at the top of the website and there's three tabs You government residents businesses how do why that those main uh main uh menus it's called the mega menus um the residence tab just sort of become a catchall and and that was uh uh something that was brought to our attention by one of our web developers it just it did not you know it just it was confusing stuff was kind of everywhere so it's something we could do a better job of uh working on next slide please and then update the graphical menus um kind of had a couple of different uh schools of thought on this one uh everyone uh got analytics from our website so everybody sees what pages are most uh most viewed um as a public entity you know we want to uh balance uh what we need to have sort of the Public Notices and the meeting minutes and uh agendas and things like that and then the the most um the most looked at website uh most web pages what is the most looked at well at the time we did the the focus groups it was right as summer camps were signing up so everybody was going to summer camps looking for information on summer camps so um what we're going to try to work on is sort of a balance between the two the analytics and the what we should have as a public public entity um and maybe some rotating uh items up there that would would be based on analytics and then you know our our standard you know jobs and Public Notices and uh meeting information so that's something we're going to address with Civic plus as we go forward next slide and then this one uh I really didn't want to put it up there uh but it was a recommendation of the group um it was consider a logo update uh they all thought very highly of the logo in the history of the community but uh there's a lot of young people being a more Tech Savvy and web developer type group um so not knowing a lot about that oido they suggested maybe uh considering a Lo logo update and that's about where I'll leave that um next slide please and then more vibrant color scheme um I I I kind of agree with it I I like the color scheme it was uh made to be simplistic but it's a lot of kind of a muted green on Gray on white and it's not it doesn't catch the eye uh really well which I completely understand and uh that'll be something we work with Civic Plus on a on on when we update and then uh so this was a very interesting uh that's my screenshot when my children but um uh utilizing uh a mobile web page icon there's a way that I learned about which I should have known to link any web page to your homepage on iPhone or an Android so it's just an icon that you're able to put on your uh phone so what we'll do is when we do download or do update the website we'll we'll put uh do some instructional promotion on how to do that so uh you're not downloading an app we're not paying for an app as a city but all that information will be on a mobile friendly website so how much would an app cost just so a curiosity um essentially links you back to this information and that that was what we found uh we met with several um several uh app developers and uh anywhere from what 5 to 7,000 five to N5 to $9,000 um and that's annual subscription based and well that's 5 to n every year yes uh and that's and most of the software people are greedy but this would if it it would just reformat into a mobile friendly format so we don't need that is that what I'm understanding that's what that that was the recommendation of the group and that was one thing I wanted to ask your opinion on when we were uh um it's just a favorite button yeah that's great but to have a button where because a lot of people who may not be TCH Savvy if there's some way you can like download to your home screen a button that will open to the right page like that's a huge deal yeah yeah that is possible to do and and and we'll work on some uh public information like a campaign to to do that uh and and really most of the website sorry mobile application developers we met with 80% of the content is just a link to our website so I I couldn't uh really recommend an expenditure and I agree with the group um on that on that recommendation so next slide so this was an interesting one from our web developers organize uh the homepage into an F pattern so I superimposed the F over the that's not a grade I hope um but uh uh over over our website so this is the pattern your eyes follow when you first look at a website again this was uh brought forth by web developer and so you read the top and then you move down and then you read the second line so I mean we kind of meet that but um that's something when we go to Civic plus to to do um to to do the redesign we're going to show this to them and and ask them how we can we can uh kind of meet that requirement so next slide please and then uh improve improve the business resources this was again our our new Resident realtor um it's just kind of a static list um there's nothing really great there I mean we have comp plan signature requirements mapping Services you know there's no one thing I noticed right off the bat was uh I don't see you know renew your business tax receipt it's not even on there so um I think that's something we certainly should should address in this uh business resource page and I've kind of got a running list of of what we need to to look at when we do do the redesign and then uh lastly uh streamline the recreation parks this is another one that was uh like like the other Pages uh there's just a lot of information there and and it's difficult when we have so many great programs out there uh to to Really condense it and it's something we are we are working on mapping out right now to to uh to bring that um bring that into more of a a streamline form so next slide so then um lastly uh we did receive a lot of written information that's in your uh agenda packet which was great um a lot of analysis on our current website and this very professionally done um by a lot of the folks and so we're going to as we work through the website redesign with Civic plus we're going to share this information with them and how they they uh they can make our site better U utilizing the talents of the folks in the in the groups next slide so timeline um we have a date right now kickoff of August 26th um so it's about an eighth month process to to go through um uh that redesign so then we'll do analyze it you said eight months yes uh and we are going to uh be sending the information back out to the groups uh as you requested at your uh work session uh to have them kind of be our uh our beta testers so to speak and uh next slide and what was going to cost us to do this uh it's included in our subscription right now okay so but if we if we ask for a lot of bells and whistles that there may an increase in cost but right now um we're working with them um to try to we're going to try our best to get it at the current rate how much was our subscription right now um 12 12,000 something I'll get that information for you but it's it's not exorbitant as far as I'm concerned when when the when the mobile application that did hardly anything 5,000 to 7 9,000 got um this is certainly a better uh is there any and the other thing I want to ask one you did you want us to continue to look at doing a mobile application um I personally we talk about this a lot right and I think the thing we landed on is what you're doing right make our website mobile friendly because that's essentially what we would pay for the app to be anyways so right now if you go on the app it's not mobile friendly if we go on our website I think what you had the kind of work around to put link directly on your phone desktop um that's perfect I mean they're going to navigate the same way we could pay six grand and it's going to look the same so no I'm I'm align with that too you found a good solution there yeah okay um is there any other recommendations that Council might have for us to uh to look at before how are you going to test it out and what I mean by that uh go through every link and make sure it goes to the proper link they are going to run a a an audit of all the links on there to make sure there's no we do it from time to time but there's so many it's hard to keep track and and and when it's it'll come in on us to to link to other websites that often change their web pages um you know we do have to stay on top of it and I think we do a a fairly decent job well we we need to get it right the first time but yeah it's very frustrating if you go to click on something and it takes you to the wrong place and you you think you're in the right place but you're not so that's that's a frustrating thing with these websites yes sir the one thing that bugs me about the website is the lists um and the incompleteness of them and lack of yeah if somebody if a resident wants to in the middle of the night figure out how to make application for a comp plan change or zoning change or or apply for offense or whatever it is it is really really difficult to find it um and even I know that I have to look for list and when I start going through and this may be resolved uh but adding enough detail for people to know what the forms are and what they're used for would be helpful so there's an element that Civic plus can probably just kind of automated Shuffle things around and make it in the F format and the tiles and all the other stuff but I think there's also an element where uh each department is probably going to need to just set aside a day and go look at the pages that they use uh because most of the time I end up having to call or residents will call and get walked through click this button now click this button now click this button which you know the three-click thing Civics plus can't fix that we have to tell them how to fix it um so I'm hoping we can set enough set aside enough staff time to hopefully save them a whole lot of time if we nail this I I know for for each application on in the Building Services Department there is there's a a a PDF with a checklist that folks have to go through and then applications as well for like a yeah but it's hard to find it and to know if are like you're looking for zoning you're looking for development services I don't know if there's a way to for people who don't know the difference between you know comp plan change and Zoning change or going to the Building Services you like you're just doing you need a building permit like they're all different in our brains but to a regular person they're not and people can't people can't find them so maybe I don't know if one big list okay somehow I don't know something we can we can discuss yes yes mayor thank you anything else I think that's good all right we'll get started and um once as we progress through the process we'll bring you some regular updates and as uh the first thing we will see after we start to work through the process is a is a JPEG version of some of the pages and how they'll look uh and then once those are approved then we will proceed to the HTML and then we'll start to get uh you know links and then we'll we'll work on the back side of the website with with the current website up and then we'll have a go live and certainly keep you all update and I just wanted to say like I think you've done an absolutely awesome job with this um you know I threw my husband in there um he came back and said the talent that you got it wasn't a big group but sometimes that's better yeah but everybody who walked in there was extremely talented so I know sometimes we do this focus groups and we don't always get exactly what we're looking for but we got some really top-notch talent and I went through and read and they really gave awesome feedback I agree 100% I just good job and looking forward to see where we end up thank you great thank you okay we're on to the city manager's report I have no report Deputy Mayor we are on to the city attorney's report uh just quickly very good to be back with you guys um I wanted to make the council where a case that came out of Tampa it affected City councils and and it was a kind of a strange decision the judge handed down it was a c case a rezoning case um zoning joning Amendment case uh and the judge issued it's a Circuit Judge in hbur County issued a 33-page opinion which is unusual in itself or Circuit Judge that's more of a supreme court but the judge ruled that she did not have have jurisdiction to hear a such matter because of s our Constitution and she also ruled that city council doesn't have any quasi judicial Authority so her take was that appealing um a zoning decision Supreme to the city council was a nullity because city council doesn't have quide judicial Authority granted to it by the Florida Constitution which makes no sense whatsoever but uh um um it I've looked into it uh I've read about half the case like I said 33 pages and it just goes on and on and on it runs a foul of the floor rules of Bel procedure which which clearly says that the search circuit court has original jurisdiction for and what it says a petition review quu actions of a agency boards and commissions local government so it runs the foul the Florida rules of Appel procedure uh my guess is if it goes any further the Florida bar will get involved the uh I mean the Supreme Court is the one who who sets the rule P procedure so I don't see it going anywhere but I just want to make you a whereare you may hear from it a cous what are you going to do if you can't do it but I don't see it going anywhere and it's probably not be appealed because the developer what's he going to do the judge say I don't have jurisdiction to hear the case Tampa's not Tampa's not going to peel because the judge turned it down so it may may not go anywhere but just in case uh Mr Hall just to clarify because I don't know that I get all the legal speak but are you saying that it said we don't have quaity judicial like Authority as a that's what she that's what the judge in this case said okay that's what I thought you said she doesn't appear to be an activist judge she's been with the court since 2019 my theory is it may have been a law clerk that wrote wrote an opinion because I said it like a 33 Pages that's usually a Supreme Court decision um but but it runs the fal fact just had a search AR case last year and I went back and read the opinion and she held just the opposite she said I have authority I have original jurisdiction from the fora rules Court Appel procedure and she cited a case she said yeah and I went back and reviewed our Charter and our Charter does say that city council does he appeal does hear appeals from any other commission agencies within the city and so Jud guys came down down on separation of the the branches of the government executive legislative and judicial and she says they don't have right to oversee each other and all which which it's just a strange ruling and and I I I don't think it's going to go anywhere I don't think anybody cite it but there could be a law of firm glom on to it and try to try to enlist cities to help fight it or whatever but I just want to make you aware if you see that um and I will look into it further I don't see it going anywhere it's a circuit court in Tampa so there's no jurisdiction for us and so forth but it it it's it's just kind of a strange willing the judge said I don't have sear jurisdiction even though P procedure rules said you do but U anyway I want to make you aware that but that's all wow okay thanks for coming back with all the good news okay next up uh council member Britain uh real quick just want to I know someone else will ask it so I'll just ask it for Brian are we going to address the gentleman's concerns and uh I think there might be a legal we need to get a legal opinion on the Mr Hall on this oh we will I know he's working with Dr kareah and obviously our public work staff is out doing inspections and so we we will we'll address them okay uh I just have one other thing is uh send out the prayers to the families that were impacted in uh usus this weekend it's sad situation we also have one one of our own officers who's going through a family uh situation that we uh keep them in your thoughts and prayers that's it okay Council tuer yeah and I did want to clarify one thing that was brought up on the toting project um the projects we have going on in the city they don't grade themselves we have City and independent inspectors go out and and check the work so I just want to make sure everybody understands that um developers are not finishing a job and then self-checking their own work we do have City inspectors go out and they will definitely get you to fix things so um I wanted to clarify that uh let's see so as far as things coming up um OA does have their annual Bulet on that's coming up August 31st so that's a good fundraiser I know the police foundation has one October October so those are some good ones to go to and then this next week we have League of cities so I think most of us are going and then I just want to say have a good first week of school next week that's right it's all right here Madame mayor hope helps did a great uh back to school bash this last Saturday and um a lot of people don't realize that there are 3,500 kids who are classified as homeless in simal County I just want to throw that number out there because I I think it's a little bit mindblowing and I am so glad that an organization here in oo is stepping up to try to you know lighten the load at least a little bit for some of these families who are couch surfing or hanging in their cars or whatever so if you have an opportunity to help out any of these groups that are are trying to help people meet other needs so they can have housing and they can cover their food and other Essentials hope you will uh and then one other thing and I'm not sure if my notes are correct but I had a little calendar reminder that popped up and it says remind City to create RFP for Garbage Contract which ends September 30th 2025 and the reason it's there and I I do remember feeling like we were a little bit rushed in our last garbage negotiations um so that's I think the reason it's there so we can be sure that we have that completed in plenty of time to you know not have it extend past when the contract does end so just throw it out there that I hope we will be thoughtful and think ahead on some of these things um and that's it great thank you council member poock no report wow don't want to go out in a bang I mean you want I am with report go all right so first off welcome back Mr Hall it's uh good to have you back and have you back in the fold uh I also do want to say uh our condolences obviously with the situation that happened in Lake County we have a personal friend who is a uh Lake County deputy and definitely feel for that and I think it ties back to again what we had talked about our session last week and in in my mind it does and when we looked at the millage um I actually had somebody that emailed me and said that they were outraged about the uh the increase of the millage and what it was going to do for them and public overreach and government overreach I'm sorry and I got to be honest I mean you look at a situation like that and I look at fire and I look at police and you guys just never know what the what the moment's going to be and I think we did the right thing to to try to obviously help you guys out with the with the pay situation for recruiting retention try to get you know good people in here and involved I appreciate you know everybody that does everything like that and you know you all you got to do is just it just happens random random senses acts like that that just you just can't make sense of and it's not just police it's fire I mean it's either way it just again thank you guys and I think we did the right thing and I understand that some people may not agree with it um the ladies note said to me that um that you know if I voted for it that she would vote vote me out uh it turns out she doesn't live in the city um so that might be a little hard for her at this point but um yeah I just again when you get something like that I think we did the right thing uh for everybody there I want to again thank public works for the standbag operation uh way to get on that fortunately thank God we didn't have anything actually happen to us uh this time around so that was uh definitely a good thing but nice to see that they get out there and got a get ahead of it uh so people do have sandbags if something else comes up uh down the road I did want to ask parks and wreck um when are we actually going to start selecting this Advisory Board next meeting next meeting yes sir all right you have uh 20 applicants all right good for for a seven member board for a seven member board yes I just reviewed it today that's great it's nice to see that turnout people involvement I guess we're seven yeah and I did want to address the uh the comment about where uh we talked about the bond referendum and um and that particular situation I would tell you the challenge I had with that particular meeting was that it was a last minute thing that came up uh to us uh about this proposal of a 1-cent uh taken up from a 1-cent uh sales generation tax and the fact that you we know that we use that to fix our roads fix our sidewalks and a lot of the infrastructure and I'm I mean I don't know how anybody else would in the audience could have been privy to that because we got it literally that night and we hadn't even seen it before so at that point at that night I just made a decision that you know we were going to move forward so I I apologize if that offended and you know offended you but I mean this it was a last minute thing we we knew what we used the sales tax for I understand the proposal came out at least we could have got some heads up of it to know ahead of time so before going in there and I got to be honest that's the stuff that kind of frustrates me is just getting blindsided you know and then you sitting there going all right I'm being told this is the first time so so I do apologize if you know again I'll obviously try to be more you know cognizant of the situation there so and that
