Proclamation um we are sponsoring a constitution week kick out kickoff this Sunday at the First Presbyterian Church on the riverfront um the public is invited to that our keynote speaker is Dr Roger Smith who is um a professor and author lecturer and a renowned um expert on Southern American revolution history and he'll be talking about Florida the 14th colony and the Forgotten role that it played in the American Revolution so if everybody um could join us that would be great it starts at 2:30 with a patriotic concert by the community band and then the program is at 3 o'clock if the weather holds out there'll be a flyover at four o'clock than stand thank you next we have a presentation by Robert natson for the occupation of Palaca 2024 event thank you madam mayor and members of the commission this is kind of my annual update on on the occupation what we did last year ah thank you and uh and what we've got going this year um Sunny can you advance the slides for me so the next one um we are uh recreating an actual historical event that occurred in Paca putam County in 1864 after the battle of usty uh a uh Brigade of Union Army troops was sent here to reinforce an occupy patka and those are shown on the on the bottom of the slide there next slide so we're on the actual historic site where it occurred uh Colonel Barton the commander of that uh Union Army unit um he and his staff build it in the Bronson house the uh unit was camped around the house some of them actually commandeered the sanctuary of St Mark's church and they are a part of of this event uh this the uh reenactment our living history was H begun in 2011 and it's now in its 14th year next slide there was the um Union Military well the both Union and and a little bit of Confederate military units that that we have at the event they will all be here this year and I'll mention why in just a sec and then the next Slide the civilian element is very important because this isn't about a battle or a battlefield this is about the town and and what happened in uh in 1864 so we have a number of Civilian groups as I mentioned St Mark's Episcopal Church is uh is part of this the next slide uh Friday is school day uh mainly we host the uh putam County Schools fourth graders we also have we welcome um homeschool Charter School type type groups we had little over 300 students last year and in some years we've had as many as 700 students um back up just one and then Saturday and Sunday we're just kind of open to the public uh all all most of the day last slide almost last log so the event this year will be September 27th through 29th 9 till 2 p.m. all 3 days this is the 160th anniversary of the event which occurred in 1864 and again it's the 14th year of our our living history event and this next one should be the last slide just thanking you all for your staff's help with this as well as some of the other groups that uh that put this on be happy to answer any questions anybody have you and the commission for allowing me the opportunity to stand in front of you and congratulate you on your educational Endeavors it means a lot to us as staff that you're able to set the standard for us for educational Excellence I'd like to read to you a letter by Greg Ross president of the Florida Le of cities and mayor of Cooper City dear Commissioners and mayor congratulations on achieving your University certificates for elected Municipal officials this year we know the hard work and dedication required to achieve this certificate and the league greatly appreciates your participation we've had a strong response since the program launched and look forward to even more officials participating in the coming years your points were tabulated from July to July of 2023 to 2024 the fire and close with your pocket is information about each tier how to accumulate points and when the FLC University will give you a midyear status update we hope you're already planning next year's activities to move up or maintain your status it gives additional contact information and says again congratulations and thank you for supporting FC University's educational programs may I approach to provide the certificates thank you thank you you want to stand you want us to come down there or stand here oh wait a minute okay children do better than I do thank you on to city manager administrative reports update on the American Rescue plan act Finance Miss mayor sorry go ahead that's okay um as the commission had requested that uh this is a standing item that we've added to the agenda uh which is the update on the American Rescue plan um so that uh it's clear what uh is allocated and what is still unencumbered and so miss cardi if you would mind good evening Commissioners Mayors everyone in attendance um the oper update is showing that um currently we do have uh 1, 242,000 of approved allocations and we've made budget Amendments of 37,000 so we're currently at 1.2 and uh we have spent 1,1 19,000 so mainly we're just giving an update uh actually is there a second page that's the problem second page I'm sorry so on that second page is more this is what I was looking for so the balance for uh that's going to be reflected in next year's budget is 1, 546,000 $461 that that column there so that is the amount that we will be carrying forward into the new budget and that's the remaining amount of the original amount of 5,234 th000 so we're just um adhering to the request made uh that we give you an update of offer does anybody have any questions this thank you update publication of Staff staff updates for the month Mr Bell yes ma'am and per the request that we received from uh the commission we have included the monthly uh updates in the package and so that item is there for your uh consideration if there are any questions on it um staff is here to respond to any questions or requests basically this is a compilation of uh the weekly updates that we have been providing um or every week in the previous month who did and and how how was it all authored um did each department summarize their own yes yes they did it was uh a summarize from each department highlights from each department submitted to myself and to the public information officer we um peruse them and then condense them into the monthly format that you have here any questions Mr B I will note one thing um in requesting in the updates that we provide every week uh we asked each of the Departments to provide highlights and if there wasn't something specific that was going on in that department then they wouldn't have provided a highlight for that week so thank you commission B were you going to ask something no well yes but also the challenges as well if uh you know a lot of departments are doing great work but then a lot of times they have issues or challenges and we we would don't like to see those come at the last minute when they're having issues uh and we get hit with a number of different departments coming all at once so as things happening we need to kind of know those as they're happening so we can stay on top of things and try to help the city continue to run run smoothly absolutely anybody else have any comments questions for Mr B thank you next is cyber security training so uh I'm happy to report that we're at just at about 100% uh um compliance with the cyber security training uh we have an onboarding process that now uh requires any new employees that come on board within 60 days they have to complete uh a number of pieces of training which cyber security is one of those items and um the only thing that we currently need is um the cyber security training for the commission um and I think we're at 100% compliance at that point and at what point are we going to do the training um that that is at your discretion I'd like to see it done sooner rather than later we can shoot out the uh links to the commission be great please get it to us yeah so we can get it done excellent thank you any other questions than there's one other thing that I would like to add if I may Madam chair um and that is uh the the we are applying for a grant for um uh Splash bad for our Parks and Recreation and in order for us to meet the terms and requirements of the grant requirement um I need to at least share with the commission that we're applying for this Grant and to give you kind of an overview of what that uh that Grant looks like and so if uh Madam Clerk we have a quick overview of that okay and there's no action required I just wanted to give you uh um some insight into what the Grant application looks like uh the proposal is an Improvement to the Riverfront Park area that may include um any of the number of spaces that are that are there that is not required that we identify specifically where but this is the area that we're uh talking about go ahead so all of you have seen what our Riverfront looks like but um this is a an example of a potential site location ideally uh the way the grant Works they want to see it in somehow or some way connected to your downtown Main Street area if possible the objective is to try to identify a space that you can make as a destination um with the idea that people would come visit enjoy the the amenities associate with splash pad and as a result uh stay and shop and um provide foot traffic to the downtown area go ahead another location potential go ahead and this is what uh a possible Splash Pad could look like um so we have some examples to to share that we would include in the Grant application go ahead so we can page through that to give you kind of a sense of what it might look like in one of those locations um they can come with her without lights without um get back to that right um jets that you could use at night or um uh during the day go ahead that's the last one okay beautiful so that's an overview the maximum amount of that Grant application is $200,000 um so that is something that we are hopeful that we can score fairly High highly on um and inclusive with that Grant it's not just a Splash Pad but a refresh of the uh play ground area uh We've also identified possible improvements to the uh band shelter area so all those are part of the package that uh will help us to score highly on that does anybody have any questions you said the grand amount 200,000 and the total cost is 375,000 we're looking for the splash pad you said um the splash pad can range anywhere from 200,000 to 800,000 depending on uh what structures you include how many jets Etc so um if and when we get to that point then that we we'll come back to the commission to ask for some direction on what you would like to see as as well as public in but but the concept that you showed was that a 375,000 why am I seeing that just do know the concept that I showed um would be Grant was 200,000 and then I saw 375,000 I think I did so together that would be 575,000 the grant plus the 375 say that again the grant plus the 375 would be 575 because I because I thought you say the max was 800,000,000 no no you say the max of the grant the Grant Max was 200,000 right right and um it can go anywhere from 200 to 800,000 for the splash pad yes but we seen the 370 what you saw there was about 575,000 okay I would like to see what we what we will be getting because well we're not at that point now but we'll wait till the grant gets here and then we can deter from there you got it okay you something that Miss Carter city manager I wanted to remind you that 375 is included in next year's budget so hopefully with that 200,000 then we have 575 right right yeah because that's um about almost six almost seven times what we originally were um dealing with just five six years five years ago that's correct uh we were at 83,000 so we're that's a lot that's a big number right and even though we're applying for that uh that grant that has a maximum amount of 200,000 there's several opportunities of additional grants that we can pursue and we will pursue to offset the cost of that there's also the maintenance Factor afterwards and the cost M I think we need to try to go ahead and be vigilant in trying to go ahead and go after those other grants why not okay right commission C has there been any communication with the county with regards to the splash pad that is out at Triangle Park and the maintenance and the cost of what they um paid or was paid whoever paid it in the ongoing maintenance of that Splash Pad yes I I haven't seen the exact numbers of how much they spent to um to put in that Splash Pad but we are in conversations with them about what their ongoing maintenance cost are so I don't have a number that I can quote for you right now but I can get back to you as soon as they give me that information what did you get out the conversation like idea that that it was a positive factor that uh that that they would strongly encourage us to pursue that that it helps to create that sense of destination don't they have kind of is some issues with it it's not always running that's what I'm wor about maintenance and the cost associated with it so definitely it's per and especially in the location and which is going to be on the riverfront uh I would definitely hate to see that it's not operable um when it needs to be and again I know I've made visits out to with my family and it's been shut down several times and it was actually a big talk of um Facebook at one point with regards to it being shut down so again when we uh move forward with that we want to make sure that not only we take in consider the consideration the maintenance but we want make sure that we have staff who's who has the capabilities of maintaining it very well I would like to know has it any uh public private Partnerships that uh maybe some social action clubs around town that may be interested in participating have we uh did any ask or surveying folk that may be interested in partnering with us uh because as you mentioned the county excuse me I think I don't know if it's rotary or kow's actually helped build that Park out there and they may be interested in partnering for uh the purpose of this Splash Pad uh we know that that splash pad out there at the county built some time ago and Technology have improved so we let's not shoot it down before before we go and check it all out I'm a opponent for it I think that'd be a great addition somewhere down in the riverfront I know uh south end or the north end but uh thank you for bringing this up and I I would request you ask for uh the taste of the community see if they would like to support that excuse me excuse me yes and also make make sure you check in with um wnter I think it's Winter Garden Winter Park I know uh they have splash pads as well so just check in them with some of the other municipalities who have um to kind of get an understand of the gist of what what we're looking at and what we'll be doing and I'm I'm a major proponent for having it as well but we also need to be um cost conscious as well so okay that's all I have okay thank you anybody else thank you we're moving on to public comments public comments offer any items are not on the agenda rather just general items of concern or interest a speaker time is limited to three minutes please give your think that you're missing a bulk of people that generally Works around that time so I'm not sure how well attended it would be because it's not to complement those that work 9 to5 at least um which is the bulk of people so again I wanted to take in consideration and make sure that that's known that that time frame is not necessarily the best with regards to the working class well we will absolutely do additional input sessions so we won't stop there so I I do appreciate that um that that time is not the best time for everybody and we'll make sure that we do expand that sorry go ahead Mr Vickers they said that they don't do private property I like to know the definition of private property and I for his ID he covered his badge so I couldn't see his name there's no numbers on the car so you can't relate him to who's driving the car and I ask uh for a a supervisor to come he said he would not call him I call for a supervisor as of yet that's been three weeks ago he's not showed up yet I don't know what the definition of private property is but they've been Tor away cars from State Farm and the partn shop and there's no signs posted toway they say they can do that because the business is closed and they can pull anything away there not occupied by the owner if they close up you not legally parked there I don't have no Clarity and understanding about this issue here I have some more issues but I'm not going to get there I want to do one thing at a time I would be here every time these doors are open until I die to make some sure that you understand what I'm talking about in my be brief um I know that things have come to a light um publicly in the last three weeks regarding bluecraft Festival um my experience um for bluecraft festival um was not good um it went through um City attorney city manager um clarification and communication was not done properly I followed the letter of the law my restaurant followed the letter of the law um things did happen on behalf um in regards to my restaurant um receiving some restrictions some I really want to go into it um I would see if you would want to discuss it further you can see me about it but my whole agenda I mean my whole conversation is that if a organization um has a contract to put on an event for the city those businesses that operate on a daily basis and sell chips juice soda alcohol whatever they do it should not be infringed on because somebody got a permit and applied for um if so then that event organizer Bears the responsibility of communicating that towards the city residents and City business I was not afforded that that did not happen towards me um I did work and there was a transition time so I'm GNA I'm going to give I'm going to give the city some leniency and the city has been very good everybody that I've talked to all the city commission members I'm City attorney city manager but in the in the the flex of transition of Old City management New City management some things was Lost in Translation um also according to the city um city planner but I I kind of feel that I got lost in a I would say a political storm and that that was not right um things happened to me in my organ in my business and you know to be frank right now I'm G to speak Frank on behalf of heart and Soulful eer we have three way St John's Avenue you know we're struggling as as as a business it is tough to make ends me everybody can see the economy it is really really really tough right now in that we struggled to to make it towards opening last year and making it a part of um being a part of um the Blue Crab Festival and and we were not treated right it did not go the way that we expected to happen shout out to the city manager um well not the city manager at the time because he wasn't there but the um events department for really picking up the pace so I I'm going to wrap it up real quick is that communication needs to be effectively better I have no problem I want to stay on a record I have no issue with the private organizations coming in to do events because it brings economy it brings everything butun communication has to be key and what happened to us as a as a business should not happen it was not right like my business is on on the verge of closing down right now it was not right at all just minute please finish up so I would like to say on behalf of har for eery you have to have some type of some type of of of character when people come into into the your town and do something we're on the verge of clothing all right we're closing because of what happened in Corruption under y watch I got the documents to show where the city committed fraud and corruption in this matter October the 12 I brought it to the city I was on the city agenda your lawyer right here miss West she said it was a scrimmage area but when they sign me the public records they show where they ask for the sell documents of what and then the new owners say they were going to bring them in the next day I don't lost everything because y'all transferred my business illegal and I'm been trespassed from the city hall two times I'm the only person since the city of Paca being him has been trespassed from the city hall with no legal reasons whatsoever y'all violated my constitutional rights y'all took my business away from me West next I come to you I ask you me you and assistant chief Matt Nukem we sat down matt Nukem told you this bu that business is never clo but I'm facing five years in prison for what y'all did do you think that's fair in any kind of way that y'all could committing fraud and Corruption and y'all hiding with this BTR it been changed five times and this this the response I get when I try to talk to anybody from the city I don't get no call back I don't got numerous of email I'm s to everybody no answer so it's my rights as a citizen what is my rights y'all say y'all want to keep moving P for but you moving back to the gim Crow South and right now I'll place my hands behind my back I go do them five years if you sit here and tell me that you ain't that you knowingly know that the city is committing fraud and Corruption and you hid it so we can take my freedom I give it away if I can show you I got the documents to show where the city committed fraud if I can show the city committed fraud will you resign that's how long this problem been going on for a year every time I come in him it's all we get why nobody talk to me nobody was say nothing but y'all committed fraud I'm F to go to prison what your city officials did not me can y'all is a moment where staff and Commissioners will have the ability and the opportunity to answer or address some of the concerns that he has brought forth um we can do that and that is the case shortly after public comment that but however that's been answered several times and I'm not sure how to answer together go ahead commission yes we did we finalized on that uh numerous times uh in terms of where we were with your whole um issue and concern and where we were at the last moment our our City attorney city manager said that that was a legal thing if you think that the city has done anything illegal you have a legal right to obtain an attorney to fight that battle that's where the city was finished with the whole deal and we' we've gone through that a number of times and you came back with your public comments but you keep you you coming back with the same thing over and over so you're not going to be stopped from making public comments but you're you're making accusations against the city that's not true I can I can show you the EV not going to go back and forth where the uh your major statements it's at a legal point at this time I want us to stay true to what we have said and this is not the appropriate time for us to make the response so his coming is up so I understand it but my comment was to let it be known that Mr Clark at this time your comment is up but there is an opportunity for Commissioners and staff to make the proper response it's just after public comment so I didn't want you to walk away from the podium thinking that you would not hear from us so respond to that if that's something that he can do to address or not just I want that response so he can have that answer there has to be an emergency and the city manager can guide you through that process I I will mention um that there is uh the possibility of incarceration for Mr Clark but that is due to Grand eff of fund from an internet cafe here in town has nothing to do with the city we have ped this out multiple times if there was any fraud that was on the part of the city we have invited Mr Clark on numerous occasions to hire Council uh to make a cause of action against the city that we could defend against and that has not happened um I I I have gone over this issue at nauseum with Mr Clark chief Shaw assistant chief newom the former intern city manager the current city manager I believe we have exhausted all options at this point Thank you any other comments responses well I just want to make sure that Mr Clark are you understanding that these are two separate occurrences and know the current the the concept of the time has nothing to do with the errors that was made on behalf of the city you so everybody the three minutes was up well I'm asking a question directly to him and that is the opportunity that I do have there wasn't any era um Cath you I asked a question you said was the city said was discri there that they Mis checked the wrong check boox it was how how can you say subscrip there is a misspelled word or typo of a document that major this certain major I don't lost everything behind this and she even ask the new owners y your Miss West for the sell documents and the new owner say they will provide them the next day so it ain't no scriage there this BTR been changed five times it's not a scri ER the city committed fraud if the city ain't commit fraud just like I told you I put my hands behind my back I go lay down for the five years want to make sure that again the from just clarification from what Miss West has stated that the charges are Grand Theft yeah the charges those are not any that's not anything that we have done so that's where the charges and that's where the potential jail time is coming in from that particular instance and not so much no no commissioner come um I come in here July the 6 the day I got arrested I asked Miss Lisa was and Renee Brown she got the paper where I say I tried to pull my beat and closed the business when I did that they already transferred the ownership of my business to them so when I came in asked them about closing it they should have told me what they did and we could have handled this I don't reached out to everybody to try to sit down and handle this the right way and the city committed fraud how can they transfer ownership of my business they don't have jurisdiction to do that it got to be done through sun MCO so are you saying as a result of a city committing fraud you're going to prison yes ma'am but I thought the charges were Grand Theft it's Grand Theft I went inside the business I still I still have ownership of the business they switched the ownership of the business to somebody else without my knowledge without my consent without anything how can a BTR that I for how can y'all justune it and don't let me know nothing I think those are are good questions again I think those are two isolated incidents you have the grand beft charge that you have that you're going to prison for and then you have a concern about what you alleged the city has done and based on that am I right counsel you have directed him to seek counsel to address that issue am I right so that's where we are that's are you understanding us now no ma'am okay I'm sorry maybe you see councel and they'll be able to help you that's where we are right now you need to seek your own attorney and have them help you and explain this to you and how to proceed so so how about the trespass y trespass me two times illegally with no ground I'm I'm the only person ever we're suggesting you hire your own legal counsel to resolve these issues if you think they're valid so you know please feel free but y'all got sworn in to uphold my constitutional right I'm sorry go ahead so I do have a question to the trespassing you're here right we're allowing you to come here what impact did the trespassing have on you if you're still allowed to come in and address the commission is he only allowed to come in at a certain time or or what how has the trespass impacted you how TR it would let me U voice my opinion you voicing your opinion right now and you are in this building am I correct so I just want to make sure that's on the record that you are allowed to come in here yeah cuz they remov the trespass Miss Miss MC okay so you're good with that now you trespass I ain't good with it I still want the I still want the trespass the allegations what they say I did I still wanted in black and white and that so with that being said can I ask S the chief if he can get with the chief and get some consult with him to get to see how that resolve that issue is that good direction to give if you can make an appointment with a chief and resolve that that's something that we we don't deal with here that would be something that if you were trespass we didn't that would be the chief in those that you would talk to to talk about the processes of going about addressing that and resolving those issues understood I guess so I okay thank you thank you Mr PL I do have a additional commentary if I may please so there's a question about the amount of the BTR and that's something that uh my staff is currently looking into so I wanted to make sure that you're aware and that was brought to my attention are you looking in the when you looking when you're saying you're looking into the BTR what are you looking into be detailed rically the cost that was charged for the acquisition of the BTR versus what uh similar locations have been charged whether it was an appro appropriate amount or not thank you okay moving on to the consent agenda Mr Vic has had some concerns as well okay but we weren't doing this um Chief sh can you come up to address Mr vicker's concerns please we not be suppos to be doing this good afternoon mayor and Commissioners as the concerns with Mr Vickers I'll be happy to meet with him in schedule of time these are uh issues or accusations I haven't heard of this is the first time I've heard of them U Mr Vicor has come in uh previously and made uh statements in regards to um responses to his club and we've had conversations and come up with different ways that we can address those issues and he also has been given um the opportunity to come speak with us let us know if the concerns had had Arisen again we haven't heard from Mr Vickers in regards to any of the response times or the issues of any of the towing uh so I haven't had an opportunity to look in it nor have I received any conversations or calls from Mr Vickers and regards to this issue um I'll be happy to speak with him and schedule a meeting and look to address him and give you a response thank you moving on to the consent agenda are there any items to be pulled from the consent item um I'm sorry there was a question I had a question about whether or not the items that were pulled from the consent agenda would go into the regular business as opposed to going directly into them so I think this is one of the first times that we've had public hearings in front of regular business on the schedule usually uh public hearings are after regular business what does it have to do with the item pool I was confused on what the order was that's why so moving into discussion of uh the item so Madam W so before you you have um the resolution for the RFP for the disposition of property within the community redevelopment area if you recall there was a statute that was brought to City's attention and then abundance of caution we opted given that this property of the River Center uh was within the CRA District to go ahead and notice that for request for proposals uh to dispose of the River Center property we received exactly one response to that RFP um that response was opened last Thursday morning there was an evaluation committee consisting of various uh City staff members the city staff members ranked The Proposal Mr CR I don't know if you have the ranking um P available for your review and now you uh then proceed with either awarding um this RFP to the one entity that made bid that's the blue CB development or pursue other options as usual does anybody have any questions discussion about this item well you you move to discussion once there's a vot you going to discuss before there's a motion in a second or how we're going to do that right I mean there's no sense does anybody want to make motion motion we have a motion to approve we need a second second for discussion purposes for discussion discussion Madame mayor if I may I do believe that you may have public common on this matter as well I don't know if they've turned in their speak other speaker cards but I just wanted you to be aware as much as I'm aware how many um public comment I have a keeping our best and brightest here at home empowering Our Youth and creating a community where folks want to live work and play our Collective Vision truly has become a work of faith and a labor of love we are grateful for the opportunity to have collaborated and built consensus on this project attended and spoke at public hearings participated in one-on-one meetings and submitted a detailed plan through our 94 page proposal so I will not rehash all of that tonight and I will keep my remarks very brief simply to overview our commitment is to awaken the River Center to where it is hustling and bustling morning noon and night we will bring music programs people and events we'll showcase the best of our community from art food coffee TV radio and podcasts we'll Foster a positive sense of place for family and fellowship and we'll do all this in a way that continues to honor our natural resources and Rich vibrant history we will continue to welcome and celebrate the bartum trail Society for their namesake centuries long influence in our region we will activate the Waterfront with tours and kayaks jet skis sailboats and sea planes we will support and promote the businesses and Merchants downtown so that the River Center is not just a destination unto itself but it is a launching pad and a springboard for visitors to discover and to explore all of what our city has to offer most of all we want to activate the hearts and minds of our young people to show them both in word and In Deed that they can stay right here and succeed so tonight our community turns to you citizens uh I have had the unique opportunity to see and learn all roles of event production as City staff as a volunteer and Through The Eyes of private organizations when in an organizing role I've experience the time demands to plan coordinate execute and break down events and programs of all sizes from behind the scenes I've seen the challenge to obtain sponsors vendors performers and Staffing events while keeping to the bottom line I've managed to struggle I've managed the struggles of budgeting needing resources and managing overtime to meet day-to-day roles on top of event operations should the commission move forward with this opportunity my role at the River Center will be to provide programs events and rentals this position is something that allows me to serve my hometown alongside a team of very knowledgeable people I stand before you today to ask that you support this land swap as it would be an honor to utilize this opportunity to continue working with the community members Civic organizations and businesses to activate the full potential of the St John's River Center thank you thank youly Applause please Shan Puritan oh there it is my name is Shan puron I Live Now in Atlantic Beach Florida um but my home was in patka for a lot of years in fact for over 60 years and I'm only 52 just kidding anyway one of the many high points when I did live here was my association with the St John's River Center I was asked to serve on the community advisory committee and was part of the initial planning phases after the Center opened in 2015 I coordinated the volunteers who helped the city to staff it for several years and I think Rob Matson does that today I have in fact on my River Center shirt because I'm really proud of it and um every once in a while I wear it just to have those memories um before I moved to Atlantic Beach um the Paca Community Affairs department and the city commission honored me with a plaque and a proclamation and appreciation for my years of volunteer work at the River Center and Waterworks that plaque now hangs above my desk in Atlantic Beach so I am very excited about the possibility of an expanded future for the River Center my understanding as Charlie has said and as Aaron has said is that the River Center will maintain its emphasis on the awareness of the importance of our local natural resources especially our River it will upgrade the facility and opportunities for the River Center it will Elevate the experience of our visitors and guests and we often when I was there we would have hundreds of visitors coming through that is a very strategic location for our city the bartrum trail society as char mentioned has a rich history here and it is currently headquartered at the River Center so I hope that that will continue Charlie has demonstrated in many ways that he cares for the city of Pat and its people his positive efforts are quite visible in the 100 block and other Investments he has made for the betterment of the patka my observations of Charlie over the years has shown that he can be trusted and more importantly he follows through so I am hopeful that this proposal will be approved thank thank you thank you shy shy Shan please you want me to tell him again not to clap good evening my name is Shelley Shanker I reside in East Palaca and my place of business is in Paca thank you mayor Korea and Commissioners for taking public comment I want to address the Das on behalf of the blue crab Development Group and their plans for the 100 block on St John's Avenue this group is is associated with arguably the most wellth thought out and executed Redevelopment in our historic district by placing your faith in these developers to create the gem of our city you're agreeing to a project that activates the very first block of our main drag and can set the stage and positive standard for fun and engaging businesses down the road both figur figuratively and geographically thank you thank you Tim Smith thank you mayor and Commissioners friends good to see you tonight um uh I had an opportunity to review some of the development plans uh for the River Center in the area uh downtown but I wanted to offer a historical perspective of how we kind of got to where we are today uh so when I served as mayor from 1987 to 2000 early in my terms as mayor uh we had the 100 block and if you weren't around then uh you probably don't know what terrible shape that whole block was in it was really uh an eyesore uh buildings were dilapidated they were falling down and uh we always thought you know the first thing you see when you come over the bridge into patka is that block um and so um at that time the the block was owned by seven different individuals and uh to be honest with you they didn't really care for each other so there wasn't a lot of conver ation about how we could work together to do something so the city uh after much discussion here at the same uh chamber uh decided that the only way to probably resolve this over uh some period of time was to begin to acquire those pieces own them the city own them and so we had discussions and so one by one over six or seven years we uh would work with the owner and uh finally came to agreements on the properties and were able bble to purchase them and buy them but it was never our intent then that that block should remain in uh ownership of the city so it was always something back then when this began was to say that let us do the work to consolidate it to get it available to remedy some of the um slightl issues and then to try to Market it and it took us a number of years on the backside to do that and so what we see today is the beginning of that time and so I think about uh how long that's taken and these projects take a while and um and I think all the time about how uh I have dreams sometimes uh and commissioner Bor I know has these same dreams in that uh when you used to dream that you missed your last class at school or and at college and you're not going to graduate uh I had those kind of dreams but my dream that I always remember was I dreamed all the time of what a lovely uh view Reed Street was it had freshly painted buildings it had nice landscape it had all these things and so here we are today and we look at in this audience this is not new people that come to town and want you to do something this is Paca that's asking you to do something and I want to encourage you uh to support uh the acquisition of that property uh by the blue crab Development Group and I thank you so much for allowing me to be be here tonight thank you thank you Jeff seagler Jeff Ziggler uh Pittsburgh Pennsylvania uh good evening mayor good evening Commissioners um as by way of background uh I got my masters in urban planning from Virginia Commonwealth University I was a Main Street manager for two years I ran the Ohio Main Street program for 10 years and I've worked full-time as a consultant in urban planning since 2017 under the um company name revitalizer uh I'm here today to express my full oh and I'm a commissioner in Mount Lebanon Pennsylvania so I appreciate the work that you all do especially on an evening like tonight I'm here to express my full support for the real estate development project proposed by Mr Charles Douglas based on my professional assessment this project presents a transformative opportunity for the city of patka promising substantial benefits both in terms of economic growth and Community enhancement one of the most significant aspects of this project is its potential to considerably increase the city's tax base by activating currently underutilized spaces this development will generate new revenue streams that can be reinvested into the community this is a crucial step toward ensuring a long-term Financial Health and sustainability of the city moreover the location of the development at a key downtown intersection is strategically advantageous as the primary entry point for visitors crossing the bridge into patka the site plays a critical role in shaping first impressions of your city the proposed development will create a visually appealing and active Gateway setting a positive tone for those entering downtown enhancing the aesthetic and functional appeal of this intersection is likely to stimulate further economic activity attracting business visitors and potential investors into patka I would also like to commend Mr Douglas for the thoroughness and care with which he has approached this project it is clear that he has taken into account the diverse needs of the community ensuring that the development will bring maximum benefits to the residents of a Palaca his willingness to explore and Implement measures that align with the city's long-term goals is a testament to his commitment to fostering sustainable Urban growth the proposed real estate swap is particularly prudent move offering a mutually beneficial Arrangement that positions the city for future success the Strategic advantage of the swap combined with the broad Community benefits um uh of the development make this an opportunity that the city should eagerly Embrace in conclusion I strongly recommend that the city commission support and improve Mr Douglas's proposal this project is well aligned with the city's strategic planning objectives and represents a critical step towards Pat's ongoing development the positive impact on the community economy and overall Urban environment makes this a project that should be prioritized thank you very much for considering my professional opinion on this matter thank you Sandra gilia speak then you called me protocol has already been established but good evening to all of you uh very quickly I just want to say that I just come to stand in support of a young man that I had the opportunity of meeting some years ago uh as teachers when you get your class that first day you kind of look over the classro you look over the students and you can kind of pinpoint those that have that wow fact that Charlie has it not only that he was one that was thorough in any and everything that he started out to do or attempted to do and so that's why I stand tonight because I believe in him and the effort that he has put into this project and I believe in the fact that it is not a selfish Endeavor it is for the good of the uh constituents the stakeholders our community one final story and I'm going to get out of here because uh it's you I'm late for Bible study but that's okay one quick story uh when I went to ANM many years ago uh one of the uh coaches found out that I was from Paca well really San mat but you tell people Pac because you you figure they knowwhere uh county seat is and he they had recruited Paca red David Daniels from East pakka anyway he had come to Paca uh through Paca at night and he said wow he thought this was something he said and then they were caught here the next day and the lights come on and he wonder where the city went I dare him to come back now because we're improving thanks to Visionaries like Charlie thank you and God bless you thank you Sharon Harris good evening Commissioners Madam mayor thank you so much for allowing me to speak tonight um before I'm actually here on behalf of Dr Rick Cy the superintendent of putam County Schools but before I read his letter um because he could not be here tonight because of the homecoming pray that going on um he asked me to come and read his letter but I would like to just um say um I'm along F first of all Sharon Harris Francis area of Paca um I have watched this young man grow up and he is everything everybody's been saying about him uh from what the time that he was a toddler all the way and I was at Paca high school for over 33 years and watched him as a student there and the impact he made even in high school was amazing so I am here to jump up and down to support this but I also came to support uh Dr ceny with his letter so I'm going to go ahead and read that now thank you dear members of the pla City commission I'm writing to express my strong support for the land swap proposal put forth by Blue Crab Development Group this initiative represent present a significant opportunity for economic development within our community and aligns with our shared goals of fostering sustainable growth and en enhancing local Prosperity the proposed land swap is POS po poised to bring substantial benefits actually five five areas that Dr ceny wants to U point out economic growth is the first one by facilitating the development of underutilized property this proposal will stimulate economic activity attract new businesses and create job opportunities for local residents infrastructure Improvement the project promises enhancements to to the infrastructure and will support not only the proposed development but also the broader Community by improving access and amenities Community Development the plan development will include features that will benefit res residents directly such as new retail spaces recreational facilities and improved public spaces environmental sustainability blue crab Development Group has demonstrated a commitment to incorporating environmentally sustainable practices into their development plans which will contribute to the long-term health of our community and last number five increase property prop values the proposed developments are expected to have a positive impact on local values sorry on local property values which will benefit current homeowners and contribute to a more vibrant neighborhood the land swap proposal is a strategic move that aligns with our vision for Progressive and thoughtful Economic Development the rigorous planning and thoughtful approach demonstrated by Blue Crab development assures me that this project will bring about meaningful and Lasting improvements to our area I urge you to support this proposal and help facilitate its successful implementation should you have require any further information or wish to discuss this matter further please feel free today is much better than where we were seven months ago started this process so thank you commission thank you city manager thank you City staff we appreciate you thank you so that's it and everybody else is you're all good thank you before you proceed I do need to note that the RFP if you choose to go with it the contract is already included in the big package which would mean that paragraph number two under your now their clause in the resolution would be a strike through because you would be accepting the terms of the RFP would already included the contract so if you have questions on that let me know and finance can also walk you through what exactly that entails but I just want to be clear that that portion needs to be a Str through on paragraph two the resolution okay Dr Dr fivan still wants to speak thank you Madame mayor thank you Commissioners city manager thank you very much I'm Richard fiban um my address is 110 L Shore Terrace inlock in Florida um my wife and I are co-owners of bop's uh Corner uh in in the one 105 building I'd like to to just bring up a couple points um I've been U really kind of a resident of black since 1984 when my wife and I got married in beautiful Ravine Gardens um all these years um we've watched our city struggle um and we've tried to overcome so many negative connotations and um the the just the basic sense that nothing can be done in Blanka uh that um is something that has been on my mind uh particularly since Mr Douglas and blue crab development um started this process I know it's been arduous I know we spent a lot of time you guys Douglas um a lot of money in this process um tonight I think that we have a chance to turn the page on our community to really offer something that hasn't been seen in this community for probably 25 or more years the enthusiasm the the Positive Growth that would come with this and so tonight I think U with all respect I think the Commissioners mayor have a chance to make this your legacy that this will be a time when we really rejuvenate the catalyst for our city and allow the city on this wonderful River become the signing City that it should be so thank you for your time and your consideration thank you kit I didn't close my fault alra kitchens 1027 South 12th Street Pac Flor I just wanted to say that I uh I know Charlie Douglas I've known him since he was a kid and he does do what he says he's going to do if he tells you he's going to do it you can take it to the bank and Bank on it he will do it he's very trustworthy he's not only putting his Blood Sweat and Tears into this he's putting his money where his mouth is and better yet he's putting his heart where his mouth is uh he is taking this building hopefully he'll get it it needs a lot of repair the city has not been able to keep it up it probably needs hundreds of thousands of dollars to repair right now and Mr Douglas is willing to take that and put all that money into it and make it for as a a Cornerstone and a beacon for downtown patka and I think you very well would be well advised to uh give him the RFP and sell him the building swap It Whatever the RFP says thank you thank you um we're going to close public comment public comment closed discussion any discussion at this time ID like to hear from the city manager uh with with any input into this matter as you have talked with staff for countless hours on this you've met with the proposing group and I would like to have your inut this time so you have the option as the commission to accept the r RFP response as proposed uh you also have uh if you choose not to accept it um if your interest is in the idea of being able to purchase the riverfront property I'm sorry to sell the River Center uh versus purchase the uh consolidated oil building then you would have to reject this RFB and then propose that or go into negotiations around that idea but just understand that with the RFP as proposed uh and it was reviewed by the Review Committee that uh recommended it that you would accept it with the contract included and the contract that is included does address some of the negotiation terms that I had previously mentioned not all of them but the majority of them so you have to make that decision whether or not you want to go with it what was proposed or not if you want to do something different that would require you to reject the RFP proposal as it stands now and negotiate something different any additional questions I just like to hear What U I would like for him to share with the community because not everybody read the agenda can you uh give them uh somewhat of a synopsis as to how much of benefit it would be to the city or to the Douglas law firm uh the the crap blue crab um Development Group uh how everything kind of shakes out and the benefit on both s Rosen C well uh one of the long-standing issues that uh we've had members of the community bring up was uh whether or not there would be an opportunity for continued access to the River Center um a role and responsibility of local government is to ensure that uh when you have green spaces or recreational spaces that those spaces continue to be open and available to the entire Community how those spaces are used is a function of whether or not the community votes for a commissioner or not for a commissioner and ultimately the Commissioners that are elected have an opportunity to decide how that space is used but a basic tenant of that is always this idea of continued access for the entire population that participates in the vote so when this property becomes private that question comes into play because it's no longer a government entity that's subject to the social contract of Elections it is a private entity and that private entity has the opportunity to choose whether or not they want to give access now fortunately Mr Douglas has indicated that he would continue to be provide Open Access but the question that you have to decide as a commission is whether or not you want to put your Lock Stock and Barrel in that promise that's something that I can't decide for the commission but that is one of the pros and one of the cons associated with a public piece of property becoming privately owned now on the other side a public piece of property becoming privately owned offers the opportunity for um private investment and so if there are needs that are associated with the structure of the building private investment can address those needs programming often in private hands can occur at a much more rapid Pace than government government is not always equipped to work rapidly quickly uh um or quick to the market and that's one of the cons associated with it now when you look at the cost uh uh uh and the dollar cense you have to consider the um environmental issues the social assciated with the Port Consolidated uh facility it is currently under environmental remediation uh there is a commitment to make sure that that remediation is completed but at this point in time it is not and so you have to consider that whether or not that is valuable the other thing that the commission needs to consider is whether or not there is a vision for the property that you would receive as part of this swap proposal what is that Vision what is the intent for it is there a need for it or is there a desire to raise that property and uh simply have the space to be able to do something else in the future um some of the proposals that were made for how that property could be used uh which could be a um uh a Center for Meetings a meeting Center possibly uh a Chambers instead of this facility here using that as a Chambers there the costs associated with that uh looking at what the school district did for their property and how much money they spent that's on the order of 300 to $400,000 so you can assume that that's at minimum what you would probably need to spend in order to bring that property into being a meeting Center so that's just a a brief overview of some of the questions that need to be addressed yes I'm ready to make a motion I but I have we already made the motion I mean I'm ready to vote com I'll make a comment before okay again the motion is in but I want to just clarify that you said that it has to uh include strike out of paragraph two if we if we decide to accept this am I right legal that is part of the now Clause under the resolution to strien you're accepting the RFP as it was F okay commissioner Bor did you have something you want to say against I was gonna do the V if otherwise I'm sorry what question voted in a second already it's been yes it's been a motion in a second already so it's ready to come to vote unless you have something else to on my question I just I here's here's my later L uh you know I hold Mr Douglas and everything he does that um his profession is high regard a lot of respect I wanted um to provide some a little bit of feedback and and my support for all of your everything you you've ever done your business uh even when we had uh the look for attorney I I sought you out um at that time when we had um um Mr Holmes here as our city manager and so we were in the process of looking for a replacement attorney because we were going to be losing our last attorney Miss uh Valeria Thomas so I was i s your um business out in that time uh the other thing we had I'm under President of the northeast Florida League of City ities and also we just roll our Charter so I sought Mr Douglas um out again myself and the executive director to help continue to uh support your business uh however in this endeavor what I'm looking at right now and how the landscape is as it relates to um doing a swap a even swap uh I I don't see it there's no value in it for the city um the the project and everything else I I wholeheartly support it I think it still can go on even if with the purchase I I remember the city approaching the owner of Jenkins uh Middle School um the property was I think for 4 million and they wouldn't accept nothing less than 10% less than what that property number was so they put us down to 3 almost 3.6 million uh in order so today we still just only have the administration billing and and the U in the gymnasium and the rest of everything else in the package was not part of what we did we and we and we we sold it we we sold a good we we went with with a excellent presentation as to what we could do with with those properties and it didn't go through so the owner of though that facility was was good stewards of that because they didn't see any value in that and I see the same thing with this in terms of uh 240,000 uh gallons of petroleum waste that's toxic petroleum waste we're in phase one and I don't see the city accepting this property as equal to what we currently have with the River Center I mean I'm that's just this is me I'm talking only for for myself it's not being good stewards of of our taxpayer dollar if we're going to do that the building can be sold I wouldn't mind doing that at all we got to put a number on something if you don't you we we have every every other entity have value in their assets that's an asset we'll be accepting a liability we could if we took over this this building as it sit we could not make a loan on it you will have to put your own collateral up to make a make a loan so the asset that we have we can leverage that this is just my opinion so again I I wholeheartly support this project but I can't see doing an even Swap and not putting a number on it so that's just my my point of view anybody else have anything and we're still in the phase one we're in Phase One of an environmental cleanup and it can go for months years or whatever and it and it determines what you can do with that property and you know I just hate when people impose certain things on uh uh commission or whoever else to say okay giving you a direction as to what you can do with the building I don't know if anybody on this dice ask for a new we got buildings all over the city we got a building across the street that is not even at capacity we got we got um other people in the public works area that need places to building a new facility for them so we got we got things that we need to do we're not underutilizing our current assets so that's where I'm at with it and we can I support the project but I can't do it with this current Construction contract right here anybody else have anything they want to say otherwise I'm going to call May m please amend a motion to do the strike through on okay oh okay I do want to just say um before that I just want to kind of comment on what you said that I mean I understand what you're saying I understand where you're going but I think all that would have been great to have um charged our city manager whoever we needed to charge with to have a value or a number prior to tonight and then that you know to have it available however with that being said I would like to amend or modify amend my um my um motion to uh strike through paragraph paragraph two and accept it second and And to clarify there were appraisals done on both properties so values were established for both properties previously not in the recent past can I can I ask a question just a general question for information for the general public yeah turn right now and and that and that question is um have we this don't have anything to do with Charlie um in the organization because I have to commend you you have done a excellent job through your staff your team um and it's back to commissioner borm statement and concern what we're going to end up with the proposal is the building in the back and we don't know the cost of renovating that building doing everything we have to do with the brownsfield it hasn't come up that's again it's not on Mrs Douglas's side it's actually on the city's side as we said do due diligence I think we fell short but I don't want to hold up this process or progress um it's just a matter of it's almost like throwing good money at the bad again s du you're going to win and I want you to win I want the community to win but I know you got to understand our concerns on that piece of property in the back this is an ask and I don't want to I don't want to be that guy but I feel that I um I have to say it when a negotiation happen it should be a proposal and it's a account you guys have purchased homes cars everybody in this audience have and I haven't seen that happen in this setting again I don't want to point fingers but if I don't mention this I'm guilty of it all I want to say would you or can we reconsider just consider not reconsider consider a sale a purchase no swap are we are we pass that point city manager City attorney no we're not not past that point if you were to choose not to accept uh the RFP results then you have the option of at that point uh selling the River Center by itself or purchasing the Consolidated oil building by itself those don't necessarily have to be connected to each other in this proposal they are connected in this proposal it is a proposal for a swap and whatever the net difference is between that swap if you don't accept it let me re reiterate it if you don't accept this RFP you go back to the drawing board essentially and you can negotiate one or the other or both the way it is we stand to get the building behind us in $275,000 so the only thing I'm going to add to the city manager's comments is because this followed the procedure of disposition of CR property there was a requirement um when we put this out to bid for the RSP that there be a community engagement um assessment and so if you looked at the response to the RFP the applicant here has basically gone to our entire C plan and has accomplished or met goals of identifying Community stakeholders and work with them prioritizing marketing efforts to work with the city um like blue crab festivals and other events none of that is going to be part of any black and white real estate transaction where you simply dispose of the property um from this point forward I just want to add that because it was part of the that statutory requirement that's why the RFP looks the way that it does also for clarification as I recall during several previous presentations we heard about the brownfields information um Mr Shar in particular gave us that presentation and my understanding is yes I know it's not complete but that the tanks are they still there no that's what I thought I'm just putting that out there so the public hears that the tanks have been removed correct and this was an extensive part of our due diligence period um I can go we get the due diligence package but um my understanding is of all the boring samples that were conducted that are required to be conducted through the Department of Environmental Protection there was only one that was still testing at a minimum level it would not prevent the property from being encumbered thank you um any go ahead commissioner B I just I just want want to be clear because um I also uh subscribe to the uh Department of uh Environmental Protection and I get uh alerts or what have you so again the property is in a um phase one it's 240,000 gallons of petroleum contaminated control petroleum move removed from the property 55 gallon you know and there was other f about 15 15 55 gallon uh other uh partic removed they could not put it in the in the regular waist stream it's in the report they could not put it in the regular wayist stream so there there are some Still Still issues so I don't I don't want the city to be a part of that piece of it I don't want that that property again the River Center if they want the River Center it we could just put a number on it we're not stopping anything I'm not I'm not I don't want to be a part of a legacy that's accepting a property that has contamination fiscal year 20242 for the Florida Department of Transportation median and decorative lighting project along Reed Street and providing for scrier SS thank you do we have a motion motion to approve second second discussion IID like them to present to us please and for the purpose of lightting is this is this the median the second median up here uh on re street from the bridge includes that second medium hey how's everybody doing David Shear with Whitman recart and Associates consultant for fdot working on this project um we've got an exhibit um and there were some handouts for you all do you have a copy of those in front of you okay so did you have a specific question or do you want me to give you an overview of what's going on well the question are you just going to address the lighting only so the lighting is it's decorative lighting if you want to go to keep going through there that's the fourth fourth line item okay so basically there's lighting out in the roadway Corridor now it goes all the way from read from the Memorial Bridge all the way up to State Road 100 um so this project is going to replace the existing lighting from the Memorial Bridge to 11th Street where the railroad tracks are um and it's going to replace it with some decorative lighting right now it's just standard you know FPL lighting do lighting um so you know the first request by the city was to try and mimic what is at the railroad station and that's a picture of what's there now um you know that's a parking area we're looking at trying to do Corridor roadway lighting so there's other standards that we have to meet for that and so we need taller poles a different kind of light so we tried to to match that as best we could if you go to the next one um so the the the light that we're proposing is this teardrop light um keep going keep going okay it'll be mounted on that that pole on the pendant coming off of the pole is that four pole number four only uh the one in the middle there and then it'll be mounted on the pole on the next sheet um in the pole the lights will be mounted at about a height of 37 feet um and there's a conceptual layout um if you keep going on the basically your last last several sheets it kind of shows the conceptual layout of where these poles are going to go um they're spaced approximately 100 feet or so um depending upon existing conditions so these po these light poles will be on the sidewalk at the sidewalk area exactly it'll be in a similar we're trying to put them as close to the back of the sidewalk as possible right now most of them are kind of up front near the roadway um but to try and provide you know safer situation we're trying to move them back but yeah it'll be in a kind of similar layout as existing polls okay I wasn't sure if we were putting those in the middle of the medians that was proposing we actually um stated we didn't want a second Median on Second Street and Dot decided it's not what we want it's what you guys were going to do right and since we have you here could you elaborate on the reason why do you feel that you may didn't decide this but you guys uh feel that we need that second median after we had a discussion about we feel that it it really would impede traffic coming across that bridge and coming across that bridge uh they have uh log trucks semi come through there and trying to turn on Second Street and get it get backed up right there and I don't know if you guys did a traffic study or what but the traffic has really picked up in Pak around about 5 o'clock 5:30 and that just concerns me and so I wanted to make certain that we address it while you guys were here you guys know what we're talking about and how we feel about the safety right okay so I can give a little bit of of history and and some input on the safety side of it and then maybe Wes from the Department can add um but I guess if you go back to to the beginning and if you look at the first couple sheets that show show the medium um so one of the concerns that the department has um you know part of of adding the median in it it reduces conflict points um it reduces accidents um it prevents turning movements that cause accidents so um so what we're concerned about with if you have um what direction if you got what westbound traffic coming from over the bridge and if you just you you just build up to about the end of that sheet because I think that's what y'all were originally wanting right and then in the median kind of at the end of the right side of the sheet and not continue it so if we do that the issue that we see is that truck or that cars that come that direction now and turn into Memorial Parkway you're not supposed to to be able to do that but I'm sure people do that and it creates a safety issue so if we in the median where you guys want to do it it's going to potentially cause some U-turn movements there yeah so you're pointing but I don't think everybody else is getting it but here I can point over here do you have this is the bridge bridge right here you talking exing this no no no so that's going to stay the same so so the the median area one that you guys were wanting to use and and you said median two you didn't want it was ending right there at the end right yeah so that Medium was going to end like right there so let let me tell you what I see pictures so what happens is a video when you coming off this bridge right about here Second Street is here right about here you get the turn linee right here right and cars actually back up to almost here and so you're getting cars coming off the bridge and trucks where you usually have two lanes going through you only have one MH and it's I mean the chief is ready that we've had we've sign up in WatchON so for you guys not to take our input and we're actually living this every day that was a little disheartening and you guys go well you know we're going to do it anyway then you come back and ask us to contribute to it so I know you DT give us a lot of money but um if you're not if you're not thinking about kind of what we want uhuh that's that's that's a little disheartening so I just want to let you guys know that's why I pull it off the agenda okay so but I want the rest of the commission time if they feel the same or if they don't so so you you're in support of ending the median right there near the end of the sheet then to the right just do the area one but you're not in support of doing area two because that is going to impede wor and make that backup it's backing up without a median so if you put that median there the cars can't really what they actually do is go almost in the middle of the world to make that term so then I mean if you're saying it back way up here I mean are you not are you not wanting any of that left turn then don't we want the left turn we don't want the median in there to impede the left turn you can you go to the next so we can see it the second SL believe is better yeah yes so what I'm talking about right you're wanting the median to end and and go back to what's there now leave what's there now yes okay okay so go back go back to the first slide so you would have to build it up too close to the end of that sheet though point to what you're talking about I'm I'm conf yeah you Ling so you would if you're wanting you're wanting this medium yes we separator yes okay so we would it would have to end right about there and so if you're saying you know so that turn lane would then start right here so you still may have an issue it'll be safer to have a turn lanane that goes back there didn't impede the okay I'll just try and understand exactly what you guys are wanting you get me yes do you think a traffic study would help you understand the concept A little bit better and us being able to talk on the same use the same language so I I do yes yeah I think we're all I think I completely understand traffic counts and stuff like that and seeing that the uh that the traffic counts would actually meet uh the median requirement for that median link for what's all coming off there there may be some instances where it's overflowing like if you see if you're seeing videos but for the traffic counts that they've they have uh studied with that uh they're showing that it supports the length that we have and that it would be good uh but but having the reason why we needed to extend that is because of the safety reasons we're wanting to prevent people making u-turns into Memorial Park from the bridge as well as people coming uh uh this way on Reed Street and trying to take lefts here we only want the lefts going into uh the First Street there so it's kind of like once we do one part of the median the the other part of the Medan is absolutely necessary it's like we have to do one or we have to do both or none is almost kind of the way it would work because otherwise people will take if there's only one take advantage of that as they tend to do and pull a UI or whatever yeah yeah it's all about the safety as to why we were doing it that way down further yeah I think the chief of police be a great expert subject matter expert if you're having those issues now because I I have see I haven't seen that there been such a problem um we do see people tur in there but it's not the problem that it's going to create it's going to create a bigger problem than we have now is what I'm saying I think commissioner B that based on his study as he went out and actually did video so I just want to be heard by dot because if it does increase we kind of try to tell you guys commissioner boram yes um actually you know all of these are valid concerns but if you you do you doing the count but are you doing anything as it relates to queuing yes that is what and I specifically asked that of the safety when they were reviewing it traffic Ops traffic operations so they I said do we have enough because I was very concerned about the the bridge and everybody coming off there I said are we gonna cause a problem with that and he said that uh the traffic supported the queuing that it would would do right there I don't know how much yeah that's one section according to the traffic that's one section but then you move up to the next street and then all the way up to Ninth Street um yeah so it gets bad right I saw both ways all the way to the railroad track uh coming going east and then West you have it you have it both ways you uh I would like for you know somebody from your staff to come and just spend a little time just spend a little time a few hours here during during those times and then Not only would you see it based on your stats or your data but you are actually eyes because a lot of time a picture don't tell the story you have to actually be there to see it and and just not to prolong it and just to reiterate what he said if you all would come out and do the trapet study and and spend some time and then come back I think that we can all have a better conversation better conversation as well as a better understanding are we in agreement so with that being said do we want to okay so we we have Motion in a second do you um I mean if that I'm willing to move forth of of course we have to take in consideration oftentimes we do ask for the experts to come in and give them their expertise while we may take in consideration that we live here but again often we often ask for the expertise of those who do it for a living and we don't um I'm in position to move forward but of course if it's at the pleasure of the thank the commission to do whatever it is that they desire I'll be on board but again these are subject uh area experts so I do want to take that into consideration as well you did bring up a very very valid point but I would like but them to be able to come and see I mean that's y'all's area of expertise and I think you can make even better um some recommendations and come up with better conclusions if you come see it because we do live here we see it but I think you all well can do an even better job if you come see what we're talking about what's the time frame on this though I mean again you about pushing time and so we actually needed it approved last month and we got it extended to this month told us that yeah no no we we were told was told to us well when you bought it to us it was it was an emergency at that point so it wasn't that we lingered because when we got information we had questions we weren't planning on building medians or the lighting so who we were we were we the city came to us and asked us to put to install meetings for landscaping okay and well and then yes and then the lighting so we were told we weren't we didn't we didn't approach I mean we maybe staff may have right staff staff did exactly so so that we don't look so this combobulated up here tell us uh how that happens um Mr manager because I mean how did that happen and how did that how did those conversations commence and we and we were presented that we need to make a decision but we so it did I mean talk started like early early year probably prior to Mr B being here so and there were a couple of openhouse workshops where you explained to the public that came um I came to those and will you explain this whole concept that I I do want to pose one question with the design that you currently have is there a way that you can extend the length of the turn lane with that current design technically yes we could it would probably get rid of some of the that the open space SP is available for future Landscaping which was purpose that you guys came to us and so we were trying to maximize that but still have the queuing space that was needed so both were taken into consideration that's the design that you see but if you wanted to eliminate some of that landscaping area you could extend the turn lane even more that might be a compromise you could eliminate the majority of the island if you did not care about any future landscaping and it would be mostly concrete separator it would be nice to have that option for future landscaping though too I mean you know Read Street is pretty Barren for lack of a better word it's not very attractive aesthetically so we need to have it safe but it would also be nice to have but way safety and a I don't think that's this is waying I I don't think they would have given us this design if it was taking looking at aesthetic SOA safety I think that their primary is safety first thank you so I think they've done yes so that's what we need to however you all just say it's going to take away future po you opportunities for that and we're not really concerned about that we're our priority is safety here so that's what we need to consider and it was and it was was reviewed by the Safety Office the traffic operations and they fully reviewed it and blessed off on it with the way it was thank you any further discussion we do have a motion in a second I just need clarification so are we going to consider extending the turning lane am I missing something here that's what this resolution exing the turning lane where it is are you good commissioner Jones this says about lighting this doesn't say anything this is lighting lighting medians and lighting median and says landscape Medan at the foot of the bridge and decorative lighting improvements of the re street car so with that are we considering extending the turning lane because I thought that question just came up from the it did but it's not in what so is that all inclusive is that what you tell because that's not what it says it just said lighting it says Med says Med so again we were told we in our meeting in our meeting we said said that we wanted only we agreed to the first median only M and we we said let's scrap the second one and we were told that we got a notice that you guys said forget about it you guys going to put it up anyway disregard what our wishes was no no I don't know how it was presented to you but the what the deal is if you put in one it becomes unsafe to do it that way so therefore you have to have another thing so we didn't it wasn't totally communicated to us that you guys what the reason was you didn't want it you know for for all we knew it was a cost thing well who did you talk to Jonathan it was Jonathan G yeah and we did have we did originally design what five medians all the way down right and and so definitely didn't want the five at that time the majority of the group I should say is the me still going on at at 8th Street no no only this section here yeah this is the only median at this point and the second part is at their expense it's not they're not seeking exactly right right but the commission did approve phase one of it and then I guess you guys say scrap it no that is Phase One this is the phase no our phase one our phase one it was area one but the area one from what I'm understanding and I just want to make sure that there's complete understanding on my have if it's the safety component that if we do the phase one even though that's our desire it's not as safe as if going through with the second part as well they yeah they they cleared that up so that being said I mean we'll just have to work and trust and believe that in the area of safety because that's what what the original concern was the safety piece of it and then also take away turning lanes for people for building up queue which could you know ultimately cause rear ends C people when they back up in the queue it offsets and go into the fast lane so that was just my conern and and you know the design we're not the Design's not final at this point so there's still time to look at those links and tweak it knowing you know what your concern okay I mean that's I mean that's my own I request shorter link well and you and we're willing to listen to whatever you guys want because we only are putting them in because we you guys requested it said we request well it came from the city manager I don't actually I don't know how it came residential and to reson the Lots from General commercial C1 to single family District R1 the application meets the requirements of the comprehensive plan for lus Amendment and the standard for resoning as it's lay out in the staff report which is part of your package therefore staff recommends adoption ordinance number 20247 and ordinance 20248 representative from the applicant is present here to make a presentation or to answer any question you may have thank you for the applicants representative does anybody have any question specific to the representative we have something on this think uh the understanding was that we we understood that this was postponed to this meeting as opposed to being postponed until the resolution of the inquiry so I think we want go ahead I think we were G to wait until that matter is clear so that we would have all the information from beginning to end uh so we don't want to make another decision and we were are not clear on all the information available and right now it hasn't been presented to us and what are the legal ramifications of of not making a decision that up but right now we have an applicant that has just stated to you that there is no ownership in by the previous um assistant city manager they are seeking a future land use map change and resoning so essentially if we do not have confident substantial evidence to the application here there are significant legal ramifications I you need me to print out the memo I don't but I don't know if anybody else does well we could vote we could we could vote on it you want to do I think to to clarify that to to vote an opposition of approving this is the issue that we creates the legal ramifications that is correct so there's two ways we could do it are there legal ramifications to uh postponing this until the inquir is resolved I think that's the question frustration is coming from because we're asking a question that I specifically asked at the beginning and had this not had we not had stopped and had this conversation we wouldn't have known that the entities are no longer involved so again we have due diligence we ask you question for you to provide us the answers and the frustration that I'm seeing displayed and the unpleasantry that I'm seeing displayed is very disheartening because again we are asking questions based on moving forward to cover our behind so again when I posed the question the question was only cled because I inquired when this first came to us so again if there was information that should have been received it should have been received prior to to that the gentleman being standing up and me having to POS a question with regards to those who had an injury no longer a part of being having that injury with this whole situation there has been several things that have been told to us that was not necessarily correct hence the reason why I had apprehensive I was apprehensive to move forward and I caused to say that we did not want to move forth with this project until we knew all of what was inclusive with regards to this so that's the only reason again that I brought it up tonight because this should not have been before us because it has made been made clear the two times that it has come before us before our displey with moving forward with reasons of why we did not want to move forward Madam mayor if I May yes may I submitted information last week to Lorenzo and to the city manager regarding the removal of those individuals from the ownership structure including copies of the filings I don't believe they're yet posted on the state's website but we did provide copies of the uh change to the ownership structure thank you commissioner Bor well again going back to what U commissioner Campbell originally said the request was to wait until the final resolution of the in investigation that's currently in play however we're receiving uh this on the agenda again uh against what the commission had decided upon so um nothing towards you but the thing with that is that's what our our Direction was and that's um where we at commissioner mcal I want to go back to the question I think commissioner Campbell ask are there any legal ramifications if we were to postpone this potentially yes um given the it depends on how long this investigation takes if there is an undue delay that could potentially be considered a taking of private property rights um that would potentially uh prompt a ver J Harris private property rights taking claim against the city depending on the length I mean but you also have to be considerate of what was before associated with what was brought before us so again we would ask for that courtesy to be given and the reason why we even got to this point so that's the reason why we are all hesitant well at least I'm hesitant or was and iant and the information that you provided was not provided to us and again had I not stopped to ask this question on tonight we would not have known that those parties have a vest no longer have a vested interest in that property again that information was provided to the city well before this meeting was provided last week so I the the the position of of the applicant would be that the application's complete we have not heard anything from the planner that additional information is required the staff report lays out that we've met all the requirements for the the land use change in the rezoning and so we're requesting that the the city take action on this matter any further discussion commissioner B where you going commissioner I'm just gonna wait whenever the city manager has something to Sayad commission I did want to share that the preliminary um uh report has been shared with the commission as of today so in terms of the timeliness of it and the length of time so what's your recommendation man so given the fact that when the commission gave Direction and where we are now and then potential legal ramification what's your what's your recommendation if the consensus of the commission was to uh postpone this until the inquiry was resolved then that's what we should do um there are potential legal ramifications either either way um the City attorney said it all depends on how long and what I'm saying is I I don't think it's going to be that long and we're not in control of Investigation so I mean they can grow along or not so what what is your estimated timeline of completion of this investigation two weeks at the max at the max based on the pre preliminary report I make a motion that I make a motion that we we bring this back we table it and bring it back uh date certain After we receive the completed investigative report and we'll review that and make a providing for scers SS Miss West sure um so basically this internet cafe ban ordinance stems from a 2013 law that Governor Rick Scot signed into uh law which basically banned gaming centers however when he signed that into law he left it at the discretion of local officials to basically Implement that law and so while many counties and cities throughout the state have adopted internet cafe bands Paca has allowed the businesses to continue to operate unregulated um the internet cafes in Paca have been posing an increased threat to Public Safety and have become localized areas of crime um and pretty much universally all of them continue to operate basically as gambling operations um the cafes create an unsafe environment for surrounding businesses because of the criminal activity and frequently serve as a front for the illegal gambling operations and chief Shaw can speak uh to some of the issues that the internet cafe CA have been having sure thank you again good evening Commissioners and mayor uh as uh you all know we've dealt with n a number of different issues with the internet cafes as far as Major Crimes and violent crimes uh throughout the recent years our number one issue is we repeatedly upon investigations uh into the internet cafes of find that they're consistently violating the state law and giving cash um and that is our biggest uh issue U when we go in there's always a criminal assessment although it be a misdemeanor on the employees but it's a criminal assessment to it there things that we addressed and not noticed to the uh city manager as well as as the attorney and our reasoning for pushing forward there's also other issues which as you know uh the code enforcement uh issues that follow behind them especially with the tenant windows that provides an unsafe environment both for inside and outside um we've uh brought the issue to uh staff and they have helped us in drafting the ordinance and hope to uh correct the situation thank you are there any other issues they have like locking doors and different things of that nature as well so yes we have been in I can speak on a couple different we have been uh in the process of trying to address both us and the fire department one of the internet cafes that we've received information that is locking doors and buzzing people in I can tell you anytime that our uh staff or officers are in the par parking lot as well as the fire department that business either closes down completely or they eliminate that factor um they also uh shut down completely when we begin doing inspections whether it be on another internet cafe so if we arrive at an internet cafe they shut down for the day so it's been extremely hard to catch them in that process but we've received a number of different um calls and notices that it is happening per the far have there been shootings so we have in recent years just not long ago um had a number of different shootings in a couple different locations as well as U whether it be involved in a robbery or or whether it be involved in a dispute um we haven't had them as of this recent but we've had them in the past yes ma'am and robberies and association with cash being on hand at those sites that is correct okay thank you any additional questions if you sure I'm going to open the FL public comment is there anybody here for public comment okay Mr Clark how you doing Tor CL the reason you bringing these internet cafes up is because of what me and the city going through the other two internet cafes I don't think they got nothing to do with this the one at one4 104 North 19 Street You' been running that illegally since I told you it ain't registered with the state it ain't got no BTR on and or nothing I been let you know that when you transfer the ownership of my business to him you it was not registered with the state but the other two CAF yeah it ain't got nothing to do with this matter y'all shutting them down because of what me and the city going through thank you Mr clar miss miss kitens no you're gonna do it again Mr clock you got one too he gave he did give a second one he all set and you've got mine already algal kitchens 1027 South 12th Street Paca Florida I'm very glad to see you're addressing this issue uh I had a private citizen call me two weeks ago and give me confidential information on illegal gambling uh at specifically at the one at Midtown shopping center that Mr Clark is referring to and I thank him for bringing that to the Forefront um and also I what I'd like to know will this also address the businesses that aren't actually internet cafes but there's at least one business in Paca maybe more than one that has two or three gambling machines in the business well let's address that good because I've also heard that there was illegal there's proof that there's illegal gambling going on there what the chief referred to about getting cash and all that kind of stuff so this is a very dangerous situation we've had robberies we've had all kinds of stuff uh where years ago I I think before you all were elected uh but I wasn't on the commission at that time I don't think uh they asked one of the people that ran a cafe said why did you come to to Florida to Paca and they said because where we came from and I think it was South Carolina it said the law cut shut down on us in Florida there was no law stopping us so they were using Pac to do their illegal activity in Florida so I strongly support this it's very important for you all to pass this thank you thank you are there any additional public comments saying n oh sorry I'm sorry come on up I would like to speak my name is Sean Harris and I would listen to some of the comments that was being made for one um y'all might have had problems in the past but right now like Chief at um they asked us to do clean the area up such just saying dark tenant windows okay we did all that there and then now it give the community somewhere to go and play we're not you know like lot of people that's in there they're not committing no crime it's they just come in there enjoying their s having a good time some of them actually come in there they enjoy environment like I play we play music we we have good times in there and then you don't have no bad stuff about it but I just hate that they're trying to ban these places because actually there's nothing wrong with them and whatever that happened in the past it's 2024 now you ain't getting no criminal activity done with them now as I can see but that's just my opinion municipal code regarding vacant structures it's a strikethrough of the vacant structure registration because vacant structures are already mentioned in the another part of the code section 3215 and so it was dective in nature um this came to our attention after we secured orange Data Systems or the property registrations were abandoned lighted forclosed and vacant structures um and there was some confusion because you had these two different Provisions in the code so this does some clean up the stke through making it clear to the residents of fla which property they are required to register the city of Paca convenes the public hearing on the city of Paka fiscal year 2024 2025 proposed millage rates intentive budget as required by Florida Statutes chapter 129 and 200 and as advertised in the truth and millage trim notices if anyone in our ordinance is here for the purpose of contesting their assessment a petition for adjustment with the putam county value adjustment board should have been filed on or before 5:00 pm September 10 2024 as was stated in the trim notice is sent via first class mail by the County's property appraiser to every taxpayer on the property value assessment role for those in attendance this evening wishing to address the commission citizen comments will be taken following the overview of the tentative budget by the finance director the finance director Marcia cardi will now present an explanation of the proposed enroll back millage rats thank you um following the script mayor and Commissioners this evening we will take a few actions related to the adoption of the proposed millit rate and budget for the fiscal year ending September 30th 2025 tonight's hearing is the 1 of two public hearings required to be held per Florida Statutes prior to the adoption of the final millit rate and budget by a tax and Authority as such this is not the final budget hearing and final adoption of the millage rates and budgets will not be considered tonight at the conclusion of this hearing a specific date time and place of the second public hearing for for adoption of the final milit TR and budget will be established Florida Statutes require the name of the taxing Authority the milit rate to be Lev the roll back rate and percentage change over roll back rate be publicly announced in addition one of the requirements of the truth and millage legislation is to provide information about why proposed millage rates differ from the rollback millage rates rback millage rate is defined as the millage rate which exclusive of new constructions addition destructions deletions and property added due to Geographic boundary changes will provide the same avalor tax revenue for each taxing Authority as was Lev during the prior year the trim process requires that a notice of tax increase be advertised when the current year proposed aggregate millage rate exceeds the calculated aggregated rollback millit rate so the aggregated rollback millit rate is calculated by dividing the prior year adjusted property tax revenue by the current year taxable property value multiplied by 1,000 the current year taxable value does not include new construction and tax increment that would be CRA values for the fiscal year 2025 budget the aggregate proposed operating millage rate for the city of Paca is 6.4 Ms which is 4.45% greater than the roll back rate of 61271 Mills the increase in property tax revenue is essential to fund the Appropriations needed to operate the general Citywide budget this is inclusive of personnel costs operating costs Capital costs and as well as Grant revenues and expenses so at this point um mayor and Commissioners the total City tentative budget for fiscal year 20242 is 75 million 98556 I am happy to of the par of vision plan Northeast Florida Regional Cil Mr [Music] Shan Mr yes is gonna do the introduction for that that's correct uh Commissioners the the following presentation by the noreast Regional Council is foru of the contract that we have at the city of palaka with the council for the preparation of the palaka vision plan the contract requires the presentation of the draft document to the planning board and two presentations to the city commission the draft report was presented to the planning board at their meeting on August 6 and the planning board they have no comment ments or changes to to the draft today presentation is to obtain any comments or changes that you may recommend uh to to the council the final report Incorporated any changes will be presented back to the commission on September 26 I just want to point out that the palaka vision plan will serve as the basis for the update the upcoming update of the comprehensive plan and with that will turn over to Jack shat from the council for the presentation uh good evening I'm Jack Shad with the northeast Florida Regional Council uh I do have some paper copies of the vision document uh which I could pass down youall would like uh can you go to the next slide um so I think uh y'all have gotten used to seeing some of us around um and so here's our our project team that worked on this uh if you'll go to the next slide okay uh just a reminder about the northeast Florida Regional Council uh we are a um an organization that uh works with the Seven Counties and the different municipalities in Northeast Florida um one of the big things that we do is work with the smaller cities and towns and counties uh in the region to do specialized work like this uh as always we cannot tell anybody what to do but we're we're happy to come in and help people figure out what they want to do next slide uh and so uh as Lorenzo mentioned um it is time for the City to update its comprehensive plan I believe the current version dates back to 2008 uh and a lot has happened in that time um we were asked to help the city develop um a vision plan that that helps kind of figure out what direction uh that those revisions to the comprehensive plan would go in and uh the comprehensive plan is a more of a legal document that has very specific State requirements uh it doesn't always do a good job sort of putting out a clear and and uh concise Vision so that was the idea that roadmap should guide your staff as they work to update the sort of more legal version that's embod in the the comprehensive plan so next slide um uh so we're going to uh talk about the results from our public engagement we've got the draft Vision uh and then mostly we want to hear from y'all uh we're happy to make changes before the next meeting um if they're minor you know it may want to go on the consent agenda or we're happy to um you know come back and sort of present the changes so next slide uh we have worked in Paca enough to have learned that this is a city that loves to come out and offer input and actually it's it's a it's a great thing about this city uh people love to come to meetings they love to offer their uh their input and so um at the request of elected officials and your staff we built a lot of public engagement into this project we started off um back in January with a kickoff meeting at Jenkins Center we met at Ravine Gardens we met at the uh State College uh as a sort of a first for us uh we did a popup event where we had staff at the Blue Crab Festival uh we sort of presented the survey results back at Jenkins middle school and then we went to uh the planning board last month uh in addition to those we did an online survey that was open for 13 weeks and that got over 400 responses and at that first meeting at the Jenkins Center we were specifically asked by a number of folks you know to try and reach out to young people in Palaca and get their View and if you go to the next slide actually the next slide uh I'm honestly this is the best engagement I've ever seen in a project from folks uh who are you know young people uh almost half of our survey responses came from folks 17 and under we did send this out to the high school uh and they they pushed it out to every student's uh excuse me email account and like I said I've never you know I've never seen anything like that that age breakdown for the rest of the survey responses honestly is pretty typical for what we get as far as you know it does tend to sometimes be older folks who maybe have more time available little more experience who are participating more uh the first of the survey questions was a wordcloud asking folks to describe uh what word or phrase kind of sums up their vision for pant I'm sorry I skipped the slide uh if you go to the next slide uh so we did a map of where folks um uh were responding from and I will say people were putting these survey responses in many cases on a mobile phone you know with their finger and so I don't know that each individual dot is super accurate but I do think you you get a sense that um Pac is important to a lot of folks who live uh in the county as obviously you know a lot more than half uh of folks who respond to Residents but this is an important place there's a lot of stakeholders who don't necessarily live in the town next slide uh so we asked folks to describe uh what word or phrase kind of sums up their vision and we did a word cloud with those responses next slide uh and you can see if you look closely that we did have a number of teenagers uh responding to this um but I mean most of these responses really show uh folks see the town as growing they love the small town feel everybody sees the potential um you know I I I gotta say I do see boring in there and I think that probably comes from young people and I know I know y'all are always asking how do we involve young people how are we gonna um you know how are we G to keep our young people in this town and so I I think it starts by asking and so we're we're proud to have been able to do that uh I'm going to go through the um the kind of results portion if you go next slide before you go yeah as U boring stuck out po stuck out to me yeah what was your feedback on um I mean if you look at it statistically this is this is not a town with you know in the higher levels of income in Florida and it has the challenges that are associated with that um I I think you know young people are smart they they see that um I do think um you know there there are there are ways to improve that situation you got to be smart as a city government and figure out how to how to do a lot with a little I just I just want to get your feedback on yeah um all right any other questions on on the word cloud no okay thank you all right um so on these next slides uh these are summarizing both the survey results and also the comments that we got from folks uh the online survey had a space where people could write in sort of long form comments we had easel and and flickboards uh at the public meetings and people you know would make comments there overall we got over 1500 comments with regard to this project um and you know not surprisingly um there's a strong preference for maintaining the historic character uh of Palanka uh and you know even for historic design on new buildings to kind of maintain that feel this is an area that really stuck out to us though is when the young people did the survey they actually preferred modern design and they were less focused on preserving uh historic structures and so I think that's an area uh maybe to try to understand you know what results or you know why there's that difference um and and think about you know I I know that's an important value for this city and so it's worth thinking about what the implications of that are uh next slide uh a lot of focus uh on a for housing um really in the comments uh it was very uh it was mentioned a lot uh we did survey questions that ask people what types of affordable housing they wanted to see uh and the most popular were tiny homes garage apartments in-law suits uh these kind of things uh with uh big apartment buildings uh not particularly popular U manufactured houses not particularly popular um residents preferred that the city uh try to get private developers to build affordable housing instead of having it be done you know by a governmental entity um and at the same time as we're looking at you know adding more housing units to keep housing affordable or make it more affordable people do like the low density look and feel of the city the next slide uh Parks uh were also something that the the city uh that residents wanted to see uh more of um they want high quality public spaces of all kinds um and including community centers and active Waterfront active Parks passive Parks were the most popular of the sort of Community features that people mention them next uh next slide uh additional river access was very popular uh this was another uh another area where the youth sort of separated out from the majority of residents where youth were more uh interested in motorized river access which would be you know boat ramps small boats that kind of thing whereas older residents were more interested in non-motorized canoes and that sort of thing next slide um people want to see uh more diverse commercial opportunities both in terms of jobs and in terms of shopping opportunities um we asked whether uh folks thought the city should incentivize commercial activity to promote that variety uh and they said yes I will point out uh there's a lot of ways to incentivize things without necessarily you know Doan out cash can be incentives in terms of what you let people build um you know parking requirements there's a lot of ways to make it easier uh to open a business uh and then we didn't have this as a survey question but we did get a lot of comments about um uh reactivating the mall uh adding major retailers and we got a lot of comments uh folks would like to see things like movie theater um and those kind of big entertainment options uh next slide um people want more public art and cultural events there's a slight preference I think right now um a lot of those events uh and institutions are focused downtown there was a very slight preference uh to keep those downtown um but there was also lot of support for for increasing cultural activities within the neighborhoods uh next slide uh and finally um uh pedestrian friendly infrastructure and uh lighting lighting was the single most popular um survey question that we asked if the city needed to improve Street lighting and almost everybody said yes um we asked about some different forms of bicycle and pedestrian friendly infrastructure and and there was um a lot of support for some of those next slide and finally uh folks want to see you know the natural environment uh preserved uh in particular we asked about Wetlands we also asked about um what are sometimes called uh green infrastructure features uh like bio swes and these are features that um that handle storm water in some different ways oftentimes uh you know they don't look as manicured or or neat as green grass but they do a better job at um dealing with storm water next slide so that's the public input that we got uh from folks in the city and the second part of our job was to try to turn that into a vision and a set of uh you know statements that would be useful to the city and useful to your staff as you go onto the next step of of updating the comp plan so next slide uh and so we sort of broke that down into just a couple of big themes uh and I'll say uh on each of these slides we have some direct quotes from comments that we got either on the flip boards or uh on the uh uh online survey uh and the the first kind of big theme is really to focus on infill development uh the 2008 comp plan um is honestly it's very similar to a lot of comprehensive plans from from cities all over Florida um it has a lot to say about new development but it does not have as much to say about how to get things redeveloped uh and and you know this is a unique place and and uh our sort of read of what we've heard is that the city really needs to focus on how to Spur infield development how to make it easier how to make it better um in particular if you want to see more businesses uh and jobs you got to add residents and if you're adding residents you got to add a lot of housing units um to keep housing affordable uh and and there's not necessarily a lot of undeveloped land to grow into and so you you really got to focus on uh increasing infield development the next slide um supporting historic land uses and if you want to add residents they're they're kind of two ways to do it you can either have kind of larger developments Apartments those kind of things you know big apartment complexes uh that can really change the character of a community and so a different way to do it is to allow things like duplexes and quads garage apartments you can add density to neighborhoods without changing the character as much next slide um you know you you do have this great downtown in these great historic districts uh one of the things that makes them so Charming is the mixed uses uh but you your city does not allow mixed use projects outside of the downtown there's no mixed use uh land use category outside of downtown um next slide so the another big theme uh for the vision that we saw was there's just a just a real desire to see high quality public spaces and that's not just Parks it's it's making uh you know the street environment making um the the area the that the city controls uh really be of high quality and so that's everything from Street trees um you know seeing buildings get renovated um seeing sidewalks all those things than next slide um we did have a specific recommendation here um this map shows uh with the sort of teal dots you can see and the blue um are the properties in the city that have been evaluated as to whether they have historic significance and the properties in kind of the yellow or the kind of beigy uh are older than 50 years old and so what we see is that there is potentially a lot of history in this city outside of the downtown if you look at the map I mean you see downtown and the historic districts have been very well surveyed but there is a lot of history in the city outside of those areas and we'd love to see the City uh start by just let's let's do historic surveys on the other neighborhoods and that will give um City staff and residents uh a sense of you know what are the significant buildings what's the significant history those things build neighborhood Pride they they help kind of provide the anchors for these other neighborhoods um and there are State Grant programs available uh to help do that next slide um if you are going to focus on infield development you've got to focus on uh improving uh bicycle and pedestrian uh travel it's got to be easy to walk and bike places if you're trying to get you know more people into a town um and you know based on on our result survey results we feel like there's a lot of support for that next slide uh finally um we had a lot of folks who wanted to see uh Transit want more you know ways to get around without driving uh in in the city and that is a long-term that's probably a decade long project but you can lay the groundwork for that now by making it easier to get around on foot or by bike and then down the road um you know you you get to where you can support uh Transit next slide um another part of this project uh is we went through your existing comp plan and some of the other documents and we kind of pointed out where it did or didn't match up with uh what we heard from residents about what they want and that is a pretty long and honestly pretty dry document your staff has that we can send that out uh and that will provide sort of a lot of the more specific uh recommendations as to you know specific things to change um let's see uh next slide so that's the sort of thumbnail view you'll have the full document um what did we [Music] miss man you covered everything never I mean you your Northeast Florida Regional Council you guys just done a phenomenal job I mean this is the road map for Pac future and um we just want to at least commend you guys for all the hard work and dedication you put in it apprciate represent what um the city of Paca and the putam county U look forward to trying to implement as as best we can so we commend you guys I thank you so much I I'm I'm glad to hear that can we get this of the restroom that we're proposing the build um and if you can imagine four feet all the way around it will be a concrete footer to have access the doors are on the side of not the front of the building which a inaccurate picture or representation of it which is poor um we couldn't find anything actual picture of it so so the picture that you sent us is not a picture on it it is not accurate No Sir because it look like out house no not accurate sir the door the entry door is on the side it changes the whole way that it sits and everything we tried to get as close as we could no right understood that's exactly why I wanted to put the tape down so that you could get a sense of um and and I know we requested to see what we're getting for our money and if that's not what we're getting well right I have a problem with it well we we did send a one line drawing the prints as well with it right there right there this so the we were able to save a lot of money on the design this actually putting the design together that was a collaboration with the county so what you see is a a representation of the architecture but the actual view is something that we had to pull pretty much out of the air based on the materials that are used okay that yeah on anything little disappointing to me yes so it must be open honest with you because if you put something out that looks like what you just showed us we're going to be upset um so I like I like the design Flor yeah floor plan but I don't like we did try very hard to try to find a more accurate reputation of this but we just could not that was the closest we can get from the designers in every place else unfortunately that's what the the difference is that the front instead of coming off the front and looking like a dog house we'll have a side to it which will come off to the side so it's basically the same only it comes off the side you know you can almost build the one bedro house tiny house for 73,000 understood sir um the additional quotes we got for this project that exact same building were um 217,000 166,000 215,000 and the 73,000 for the building that you showed us ma'am you did you where did you get your where did you get your quote from no that's an RFP process this is the RFP sir okay yes so it came from all different Builders yes sir five different people this was the lowest bit this yes sir for that size yeah that's the actual interior size of the building carved the door marble floors I wish it will be quaint uh the original bid um when we put out we did it as a design build was 195,000 okay so when we actually got to the county designed it for us at free of charge of course and put it back out and that's how we came up with a much better price and this just one one of the is it for very welcome it's unisex is it unex it's unisex yes sir it's one like it's just one yeah it's easy to one bathroom yeah I think I don't think that's sufficient it would be cozy if it were two I think I'm just saying you could get two at least two why we need that that storage in there we don't need storage yeah huh well it if I could I want ahead and did some estimated costs on the project above and beyond this building what what are the actual costs going to be um we have a 200-gallon pump station that we have to have with a um half horsepower grinder that's about $6,000 the water and sewer run just to get out to the road is additional $33,000 uh the directional Bo under the road with the water and the sewer is another $3,500 the electric service $2500 the slab $3,800 so you're looking at $220,000 prior us even starting to build yeah so there is there's so much cost Associated total yeah total cost Associated totally correct but you can get two out of that I me two like for just not one one individual at the same time what we say yeah sir I mean that's what that's I'm asking yeah no for the original design we'd have to put the whole thing back out to to bid again it would be a whole different process change if they alter it they have to put it back out to bid yeah any I can you yeah can you can you make it so we can get to uh we can certainly design whatever that's luxury right there that's a lot of space then I'm thinking about Aesthetics now how it looks as well yeah because we're going into the neighborhood or dog yeah it need to it does need to we did look at U pre-cast Solutions too to see if we could come up with a lower price and 200,000 for single bathroom to 300,000 the prebuilds they bring in Dr stropman in place we'd still have to do the infrastructure underground as well on top of that so there it's costly quite costly for to build something that's sustainable [Music] I understand appreciate the County's input on that yeah but if yeah if we could pay2 200 something thousand do for a lift we certainly could pay a little more for restrooms at our Parks so I think the investment we may just have to pay a little more but I think uh okay we're not talking about 200,000 not worth but of course but I think this the storage area is it strictly for mechanics or is there additional storage there be an electrical panel in there and it'll be stored for cleaning uh materials and whatnot and stuff for in the Park it's a fairly small area anyway there's not a lot of room in there the way it looked right there yeah you could put another stall over there or something um I think that's a waste of space and try to steal the stuff I mean w I don't even know storing that stuff that they can bring it that why think think that's waste of space just 148 which is the whole length here so it's probably a 4 foot mechanical room which gives you 10 feet so there' be a 4 foot mechanical room on the side then about 10 feet left for the actual bathroom so what about clean you know the you just pressure wash like pressure wash pressure wash it down yeah it'll be a building structure yes sir we can clean it that way with pressure washers that we on hand with the city sir yep so we s it back out so we have a resolution do we want to how do you want to proceed with that this current resolution well it sounds like name if we're going to send it back out if that's the if we're going to if we ask them to entertain a motion and accept the resolution if they want to resend it back out is that a a it's a a for me so do we want to go to the protocol mad may do do we have to want make a motion to table yeah I mean if you're going to go out for another RFP you're going to have to make a motion to do that yes secondly yes we deny public uh Parks or have to have Unice unisex restrooms no okay perect okay all right thank you on to D thank you so much resolution 2024 a resolution of the city of Pac authorizing a second contract renewal with RQ music LLC for the promotion and production of the 2025 Blue Crab Festival and providing for scrier m hi um I sent um an email today um sort of just um an addendum line item email for a few things that need clarification on my behalf um to everyone everyone was copied on it Finance legal and Mr B that can you go over those chance to read oh [Music] I so for the purposes of my um legal understanding of this document um I have a few things line item um and I copied and scanned it actually in um the largest and most Nuance subject of this um production seems to be naming the owner of the blue crab for liability sake um I was under the impression with you all sponsoring that I was applying for a permit not so much a contract that negotiated production elements production elements increase our cost um if the production elements are up to the promoter then I'm working with the funds that I'm able to raise not um under the Litany of production ideas of other people um also as far as um my company is a holding company um originally in the first RFP um that I responded to we um this the city was receiving the invoices we were on a uh joint bank account that was subject to audit um since the uh City had switched into being a sponsor they were cutting a sponsorship check I wasn't submitting um my production company's bank account for public record so um my legal I have other clients besides you guys I don't I don't just do the Blue Crab Festival some of those clients I have contracts with ndas all kinds of things that I can't can't make um private vendors public as my intellectual property as a promoter um specific programming obligations um don't typically fall under event sponsor Discretions so with increasing the budget um for four days that includes an additional headliner act but increasing the firework show from also the the numbers of minutes are kind of interesting to me with the fireworks it's like 14 minutes to 22 minutes it's not like 15 to 20 but with increasing the fireworks show the length that it is um it goes up $14,000 so when I have an event sponsor um who wants to negotiate additional scope of services on me as a producer that means we're co-producers that doesn't mean they're a sponsor anymore they're adding to my scope of services um and that costs more money and I'm not necessarily um of the capability to fund raise longer this year lastly um and most importantly and I really want to stress this it's very imperative to me that I'm able to work under good conditions and with transparent communication office to office within the city of patka and if I don't think that that is a possibility there will be a cancellation Clause enforced to excuse us from performance um I that's imperative um that's all on my side everything else um essentially we separated the Crab Pot idea for to go from three event days to six event days as we originally discussed we took that idea off the mix um we added an additional event day to move the event to four days to include Monday um that's pretty much everything on my end anybody have any questions I'm you have any questions I'm confus figure out what the modifications and changes are as it relate to what we had because I didn't I didn't read what if you sent something to me today I didn't send it you actually it was sent to me um additional things that were requested to be added to the Blue Crab Festival it was sent to you the additional thing that you asked yes I I received a draft agreement um a couple weeks ago I think Mr Bell and um can I ask one question you have a concern about transparency yes ma'am so so do I what where are we how did all this happen like what's going on who did you receive an email from the negotiation and all so I have um to be perfectly transparent about my experience I have attended several meetings a good amount of meetings within Paca um I have spoken um in meetings with Mr Bell and Mr cutright um Miss cardi Miss West Mr Bell and miss Mr cutright um I was under the impression the last time we I met with you and presented um I don't believe you were here miss mccal but I think you guys were here um I was under the impression that the meeting I believe on the 29th was when this was recommended within my purview and um I came to PKA um I had a negotiation with an agent um regarding I buy all my talent at once um we I had discussed it sort of that at that prior presentation that I buy it before Labor Day um at that time I signed a few documents and picked up a check and that was the most I had heard about it until I read about it sign that document was there anybody else no it was just uh it was just me it was a a pickup like a so we did not approve the funding officially and in the contract document was signed so and you've received funding already I received the portion of funding which was the renewal of the existing contract and then I was under the impression that you were ratifying to increase or not increase the sponsorship at this meeting and move forward as a straight- ahead sponsor so I heard the mayor say we did not approve so are you speaking on behalf of who because so nobody up here approved the 50,000 am I right is that what you're saying did not approve it okay and how did you get under the impression that you were just renewing how did you get to this point based on what we had a contract renewal meeting um where we discussed some things and I was sent a draft and um that was who you had that meeting with Mr cutright Mr Bell Miss West and Miss CI so orig yes sir go ahead Mr B originally um there was a presentation that was made to the CRA uh where the request Wars uh an agreement of $150,000 and a cost share associate with that over a multiple year Peri period um it was clear from that presentation that that wasn't uh the way that the commission wanted to go also it appeared if we went in that direction it would require a new RFP process so uh we were given the direction to go back and negotiate with um Miss helier uh about the Blue Crab Festival as a result of that conversation as U Miss J said uh we got rid of the six days we went down from six down to four days and $75,000 as opposed to $150,000 and so with that um uh decision to go to 75,000 we added some items that she talked about that's in your package now and that's we came up with an agreement for 75,000 which she received a copy of that agreement and um indicated that she was in agreement with in spirit with that uh approach um she had expressed some concerns with uh the cost of uh the staff doing uh work at the festival I think it comes out to somewhere in the neighborhood of 23 $225,000 and U there was a desire not to include that um so that she wouldn't have to pay for that that that would be an amount that we would um take care of ourselves and so we tossed that around and came to an agreement though it is included in the contract you are going to have to pay for and we're willing to go for four days at 75,000 so that was the first step in the process I know I missed a couple of meetings is this something that we were all involved in and then the check C and the commission are two different bodies even though some of the same bodies sit on both right um so it came before this the the presentation for 150,000 for three years came before the CRA which was not a funding source and it would have had to come back here to this commission um but I don't think we agreed upon that and of a bigger concern to me is that we didn't and there is no resolution of agreement of an amount or contract but yet money was released and so if I can speak to that as well so miss s indicated that she needed to um if she was going to move forward that we need to have a decision by September 1st and uh our next meeting was until September 12th so a $775,000 agreement would have required us to come back to the commission because it was something different so we weren't able to um to meet her uh need to get this addressed before September 1st with a $75,000 contract so when I brought this before our um staff meeting um and said this is our dilemma if Miss aler um if we can't cut an agreement before September 1st we don't have her doing the the Blue Crab Festival that was what the situation was but you also can't um the 50,000 couldn't be released as well 25,000 is the cap the city manager has to spending anything above that has to come to the commission so what I was uh what I asked staff was do I have the authority as the city manager to renew an existing contract and so that was uh what I posed and what I was told was that as the city manager I could renew an existing contract for um the Blue Crab Festival which one did the city which one did the Commissioners told you to that this was at my staff meeting so so I asked so a commissioner didn't tell you that you asked one of your subordinates I asked the the City attorney what is the spending Authority based on the policy so my the idea that I posed to the staff was how can we position this so that we keep an opportunity to to work with uh the bluecrab uh promoter and bring this to the commission I wanted to position the commiss commission so that the commission I didn't want to usurp that Authority I wanted to position it so that we wouldn't lose her and the commission would have an opportunity to decide M West can you tell us exactly what you informed Mr Bell of that he could or could not do please sure so after the budget meeting which I believe was on Thursday no it was a staff meeting on Thursday let her speak yes let her finish please a budget meeting I I don't recall the exact date of it but I was told um that he was looking for a path forward uh to work with Miss Janetta and he asked me to draft an option for a renewal of a contract and I said okay when do you need this buy and he said 8 o' tomorrow morning like okay I and this was already Clos of business I'll get that to you and so I sent that over to him uh at 6:20 the next morning I did not know that he was going to go ahead and have that executed by Miss Janetta without approval furthermore I need to point out that this is not within my sole discretion or the city manager's sole discretion we don't function in silos like that that's why you have a checks and balance system our purchasing policy leaves the discretion here with the finance director of whether or not a matter like this should go to the commission the finance director did advise and I did not know about it until the next morning did advise the city manager not to execute the agreement that's not correct she's here can she come yes could you pleas please miss C okay so basically um after the budget meeting well no that's wrong at the department staff meeting that whole discuss question came up and I knew that uh the city manager needed guidance for what he's actually saying I met with my staff and I said look I want us to do the research pull the purchasing policy so the next moment I get I will meet with him so we finished budgeting early by 4:39 we were done I called my staff in I said I want us to go meet with the city manager and she did come with me we met with him we went over the policy to make sure he understood that his uh authority to contract is limited to 25,000 and he did question us and said something about you know if it goes to 25,000 one and said and I think Jill said um 25,000 one you got to go to the commissioner so that was the gist of Thursday even evening but he did request that he have a check that he needed that check by 8:00 a.m. we told him we couldn't do it then but we could possibly have it by noon and again I did say hey make sure and get with your Commissioners and that's when he did say you know uh the City attorney has uh said that I don't you know need the well I may not be saying it correct but he basically said that the City attorney advised him that uh he could move forward with the renewal or something to that effect up to you know that 50,000 but the point was very simple for me I just kept saying no 25,000 that's all you can do so uh he he did say an exchange and we I I said I make sure and put it in writing and so before we had that 9:00 meeting you know uh Miss Joel I think came to me or something I made certain that I did put it in writing but he was um we were all running and so we got to the 9:00 meeting I saw him outside I said I got have a concern I gotta go and I ran outside and I met him and I went over my writing with him and I I I had said something that uh in his opinion wasn't really answering what he had asked me to do because what he asked me to do was what is my my limit for Contracting and what I said was I caution you to not execute this agreement and he wanted to understand that and I said look what I'm really saying is I know you say the City attorney said whatever I'm saying go back to her make her review this stuff that's all I'm saying and that was it and Miss West did you ever say he could so no as a matter of fact it was the opposite um Mr B put the proposal in writing Friday at 1255 and concluded the email with saying let me know if you have if you have any concerns please let me know I replied yes I have a concern at what time this was 26 Miss cardi stated this morning that she was advising against course of action the purchasing policy defers to the finance director on services that were not approved in the budget when you requested that I draft an option to renew I was not aware of Miss card's position I'm not sure she had reached that conclusion yet I suggest we have a brief internal meeting upon Eddie's return he was out to address Miss card's concerns and I have copies of this email correspondence if you would like may we have copies of that please um the initial meetings around this just so you know um my advice had been to send this out for another RFP because the scope that was being contemplated by Miss Janetta was significantly different from what we had done the previous year and if you're going to change the scope that much not only the financial scope but also the days of the festival and the Aly of other items you have to send it out to bit and I put that in writing that I believe this needs to go out for an RFP but I'm willing to listen to other options um and we did have multiple meetings to try and Hammer that out and I'll distribute us and so the than with here to be addressed but I think more specifically with regards to yes perplex and how we got here I'm a tet for because we have an innocent person who only came to pick up a check because that's what yeah I would have done if I had St but again I think the conversation needs to be if we're going out for another RFP if we're going to renew with what we have or we going to negotiate with M Janetta but then again we still have to come back but I think at this moment addressing what the person who is driven from St Augustine um she has nothing to do with the administrative side mhm so I think that's where we need to put our focus on so that she can get to where she needs to be and we can take care of home whenever we got to take care of home but as of now in order to be fair to miss Janetta who has set through this meeting who has set through countless meetings um who has driven to show her dedication to City of Paca that's what we need to address right now very valid point and that leads to my question my question would be I was under the impression that if you did not receive the $50,000 by September first you would walk and would not want to work with us and I was wondering was there an issue with you waiting 11 more days or until the 12th to for us to talk about this can you share share that yes ma'am so as it was originally discussed I believe in two or three separate meetings um I had a Labor Day weekend after Labor Day weekend Talent purchasing goes up by about 20% that was part of my presentation at the CRA um I don't just buy the celebrity talent for blue crab at one time I buy it for all of my events at one time so I receive a discounted rate working with an agency um at which point I was under the impression given the C and I believe there was a meeting the night before I I actually picked up that check that that was the unilateral decision of everyone to move forward so with that being said it's really you say negotiating and working with her she had to have had that byy if I mean we had you get where I'm going so I have a better question thank you was and this is not to you this is to Mr Bale well know this is to my commission yes sir were you all at any point contacted by Mr Bale given the state of where we were the plan to move forward and how we were going to move forward Mr Bale contacted me I think after the it was after the fact of the check being written and are you shaking your head now I think I reached out to you before the check had been written no you reached out to me after the check had been written and you also said that uh she wanted an additional day of uh and it would have been $75,000 so let me ask you this if you reached out to me before did I would I give you permission to write $50,000 we didn't have a convers until after thank you Mr B I appreciate you I would prefer the question to be answered because I'm trying to get he reached out to me after the $50,000 check had been written I asked what's that best practice that that should have been brought before the commission so that's my answer wait on I was not contact I was not contacted till after the fact either that's not correct either that that is correct you contacted me on the Tuesday for pre- agenda meeting I I've reached out to you mayor on several occasions and you have not responded you with you well I the reason I asked the question was because I did receive communication prior to and the communication that I received I asked the question was it best practice I asked the question did they get did he get a legal opinion from the attorney attorney West and the answer was yes and when I got that I felt a little bit better because again that came from saff but then as things began to progress or unfold that began to change and so when I received the phone call from Miss Janetta stating that the city was wanting to get a check back that was issued that's where I became aware of the situation that the check had been cut I wasn't under the impression that it had already been cut or that there was an extension of then that's where I believe that there was a attempt to make an special call meeting yes where it was stated that Commissioners had been con contacted and there was a certain commissioner who was willing to sign on for that meeting and what I'll be willing to sign on of course trying to do business let's get it done but so I'd like to just also um for transparency sake um I received the check I went to uh it was Labor Day weekend holiday weekend deposited the check I received a call that I missed um because it was from a unknown number and and then I saw it call again and I called it back it was Miss cardi she said do you have the check and I said I deposited the check and you said you and she said you already deposited the check and I said yes ma'am I didn't want to walk around on a holiday weekend with a paper check that large and she said all right well that's all I'm going to say and I was like well all right then that's I I didn't really know at that time that there was an issue but then the following week I was sort of appr prised that there was I'm going to ask a really crazy question y'all help me it may be very dumb so you have a checkbook that you write or somebody had to print check it was a printed check so who printed the check I have no idea it wasn't signed by me unlike what the the who printed the check Paka daily news said it was the you Paka Daily News no I said unlike the pla daily news said yes sir it was uh our finance department my signature is not on there it was it was created by the finance department so that I could provide the check to miss saler um yes sir prior to the September 1 so the finance department would that be you you printed the check nor that would be my finance department yes okay you them directives to print the sh after no I if you may yes ma'am if I may so like I mentioned on Thursday evening the city manager said he had to have the check by 8:00 a.m. we could not do it uh we would get it done by noon we did ask him to make sure he met with his Commissioners said it wasn't necessary and blah blah so of course we work for the city manager he asked us to do the check and my finance department complied and matter of fact my staff got it done by 10:00 a.m. which I didn't know because I was also in a police benefit union meeting so the check was then released to the city manager you said you didn't know the check was had been printed did you give directives for the check to be printed I'm sure I would because who did you give the directives to just I didn't actually give it the city manager did that night so I didn't like say behind him please go do the check you're saying follow what your I mean I work for him so you gave directives to who to print check I did not give directives to anyone the only thing we did was follow Direction and my staff do the check there's multiple people involved with issuing a check so that would be wait wait let me say it since you asked so it would be the accounts payable person processing requisition it would then be the financial services supervisor it would also be myself so you know so all there three different persons or entities involved in getting one check made so can I ask you this Mr bail approached you ask you about the $50,000 check from there who were who printed the check and who gave who okay so I believe financial services supervisor or either accounts payable printed the check the financial services who approached them and told him do it you yeah that's what I'm asking right made by the city manager right right went to them and told them to exact you weren't aware because you said you were not aware that it had been already printed well I was aware that the check was going to be made that I was aware uh I was just not aware that he had already gotten it gotta and then I also was not aware that it had been given out and once I found out I want to void it so that's what I wanted to do is stop payment it was done before 2 o'cl the transaction occurred before 2 o' and let me point out that um there is in the purchasing policy an exception that allows for uh for the city manager to take the action that I took under emergency conditions was this constitute an emergency I'm sorry I don't see well we had we had a blue craft promoter who said that she would not be able to continue if we did not renew the contract before September 1st you're you're you're a you you are a phenomenal producer you have brought the blue crab back I tell you however if she was going to walk and you called that an emergency we could have went out and got somebody else she could walk well she had other folks you said I attended several several meetings and had discussions and was and was pretty transparent um I will say and this is totally unbiased this is my experience producing this Festival within the city of patka there has been staff turnover since I've been here for 3 years between city manager and legal and change and elected officials and and there is a lot of re-explaining of some some things that year to year I do as part of my job as the ins and outs of my job so all all in effect to say if we needed to send it out for RFP I wouldn't have the time to to take it on this year this coming year and that's not to say I wouldn't take it on in the future I really enjoy working in patka but I'm but at some point to drive to pakka for four hours once a week I'm spinning my wheels a little bit so that was that was said and that you know is yes so realizing that uh she indicated that she could refund the check if in fact um the commission did not want to move forward on September 12th with the $75,000 contract that to me allow allowed me to position this situation so that the commission could make the final decision without again make sense it doesn't make sense to me either I also I'm probably one of the most understanding people when it comes because I was under the ass again I was under the assumption told by you that you communicated had conversations with all of my fellow colleagues which with the exception of commissioner borm Mr borad before there is a response because now I feel like you're listening to respond and not listening to understand I'm sorry go ahead and that's why I have a problem I was under the assumption that communication had been made with the Commissioners excluding commissioner Bourne I was under the assumption that the fellow Commissioners were in agreement and in position with what was presented to me that legal again reviewed legal and I and I specifically asked did Miss West attorney West get say that it was okay because I did have a question I said how does the city clerk have the ability to extend a contract along with the mayor and not our city manager so I did pose that question that was before and then we get to the point of a special call meeting where again I was informed that one of our fellow Commissioners stated that they wanted to do a special call meeting and would I be willing to sign can you please give that fellow commissioner's name I surely can commissioner mccal and that is not true go ahead and finish and then we're going to get to that point so when commissioner I was informed that commissioner mccal stated that she would um like to have a meeting and would I be willing to sign on the meeting so that we would be able to discuss the matters of bluecrab regarding the execution of the contract I then agreed I was made contact by sunny sunny advised me that um she had made contact with the commissions she also stated that she was unable to to speak to um two of the fellow Commissioners for whatever reason and then I was also informed that one of the Commissioners stated that they would not be attending a special call meeting so operating in complete transparency that's what I received and ultimately that we got here today and again I feel that you are brought into something that is affecting you that could have easily been avoided had there been an honest conversation some honest dialogue um because again based on what I was provided by the person that we hired now is completely untrue and I again I received several calls it wasn't just that time Mr Bell has called me several times with regards to Blue Crab and again in operating in complete transparency I was operating under what I was informed by legal everyone knows that I sit on this diet I always reference legal to make sure that my thought press is correct and that's the only reason I said I was in agreement with moving forth because of what was presented to me that it was a extension of a contract I didn't know anything about coming back to the table to renegotiate for 75,000 I was informed that the event was taken from the six days or however many days down back to the originals what what it has been that's what I received Mr Bell I'm going to ask you a simple question and I want a yes or a no answer was what I just stated incorrect or correct I'm I'm sorry well yes or no yay what I just read what I just put out to the public was that not an accurate account of what happened with regards to your conversation and dialogue with me yes it's correct so if I can respond if I may and then Mr Mr Bale consulted with me about the $50,000 check and I I asked questions I said is that something that you could can do like are you allowed to cut a shake without bringing it before the commission it would be best practices we had an initial conversation he called me on Thursday September 5th I was in the middle of a meeting I said I'll talk to you later I'm in the meeting I received a text subsequent of that and said that you and commissioner Campbell are signing off for a special call meeting to approve Janetta contract for bluecraft Fest on Friday evening the earliest you can be available I said wait and one I said I'm going to call you this meeting number one I knew that I would have issues with attending a special call meeting because of the position I was in in my primary role my administrator was out of town and I had to run the school so I knew it and that was a that was a a concern so I wouldn't have agreed to a special call meeting and then I said okay just just want to talk about the time I may have to do do Zoom he said okay you said yes okay and oh and he even when he called and said he wanted called about a special call meeting I said what is this meeting for I had no idea so I didn't agree to a meeting for this so that and and you told what you just said is what I said true is that our what we collaborate about about so can I clarify that please so my initial conversation with you uh explaining the situation you mentioned it sounds like we need to do a special called meeting and that's if if I could sounds like we need to do that and I said well let me reach out to the other Commissioners that's when I had the conversation with commissioner uh Campbell and then when I came back that's when you said that you were not sure whether or not you could make it because of your primary commit if I told you to call a special call meeting why would I ask you what it was for and here's the thing I'm I we I have a problem with these Special call meetings due to the last special call meeting that was called and it appeared that I called it and I did it so that's why I'm reluctant to special call meetings because I want transparency and I don't want it to be looking like it's on me and here's the second time it's being done so so at the end of the day commissioner mccal did not recommend a special call meeting commissioner MCO wouldn't ever recommend writing a check because I wanted to know why was the check written how did it get written is that best practices and I recommended that you should have brought it before the commission and you said you really didn't have to but I said just best practices due to what we're dealing with now for complete transparency so I'm not going back and for if I said it I would have told you hey let's call a special call meeting nobody can reprimand me for wanting to call a special call meeting but I did not so I'm operating in transparency and I'm not going back and forth and that's my answer and then I agree I said later I couldn't because I would not be able to attend I would not have been able to attend then I texted to you and told you that I would not I let suay know I would not be available that's correct you did but by that time commissioner Campbell had already said that he didn't want to do it because uh the other commissioner was not available well we wouldn't been in this position the chck W no sir no no no no no no Sunny what did I say well you you wanted all of the Commissioners to participate my response was I'm not willing to move forward without knowing the pulse of the rest of my commission that's what I said I did not say I did not want to do it because had my commission been available I would have availed myself but I specifically said and it's in I said I am I am going to reserve my right because I don't have the pulse of the rest of my commission I didn't say I would and I didn't say I would okay so this as far as my my input again I was on vacation and uh there was no way that I could uh make these meeting and uh Su did reach out uh by email I mean by text I'm Sorry by text on uh AUST I sent uh a a communication on August I think 27 to let her know that I would be out of the loop until uh September 8th is when my vacation and I think they were trying to call a meeting on um was it the 6th the 5th or the 6th whichever or Friday or what have you so uh I wouldn't have been able to make it anyways because I was out of the country in my conversation with Miss Grant I thought from our conversation that she was saying that commissioner Campbell would not be available because the other Commissioners were not Mr Bale I talked to you yes I know so what are you talking about in your conversation with sunny when I talked to you and I told you exactly what I told you would not want to move forward without the pulse of the what are your what I'm I'm I'm confused and you're confusing me and that's what I don't like because I now feel like you're playing in my face not because I had a conversation with you and the conversation that you and I had was after the conversation I had with Miss France which then I it wasn't yeah because when I reach out to you never mind I want I heard he spoke with me he said he already spoken with missioner him I I have a concern tell I have and you tell me this you said commissioner Campbell said that commissioner Jones would not attend and he wanted everyone in attend that's what you told me and again I had I know I didn't want to call special call meeting because the last special call meeting again put on the record that we had it appear that I called for it and I did it and I don't want to I didn't want to get into practice of calling special call meetings and I know for sure that I've been missing some me due to priorities that I have and I didn't want to miss this meeting Mee and I was Campell want to do the I was going to try zo I said after that I so at the end of the day we couldn't do we couldn't uh do a special called meeting in order to get the contract signed so we have to decide in inde defference to miss saler whether or not we want to move forward with this the negotiated contract or and then I still further have questions and I well I receiv received the cheat we know that and I negotiated with the agent and I've been working as if I'm working on the blue crab right now but we did not approve the 75,000 now I now I know that but I've been under the assumption that you did so but you did say you were willing to refund yeah but what do we do with the talent that she's already booked though well that's I mean we that's a whole differentation at that point that that's I mean we at some point I we do have to take in consideration the position that she has been put in that was not at her own not transparent with her as well we have to take that in consideration and I think we have we have two separate things here going I think commission Campbell said that we have to resolve this situation with Miss seero and then we have the other issue that we have to resolve separately and will and able to but again at what amount well hold on she has been presented something that she feel is true and correct which is a contract right but that contract had draft on it right the document there's not a contract it was a draft doc I signed when I received the check Madam if I may would you like me to everybody sure so you you received a check we know that correct is the check symbolizing you had a deal I mean yeah that's that was my understand right now you're doing a bluecraft for $50,000 correct unless unless you want to add anything on to it that's correct sign contract with an additional intention I think that she was going to get another 25,000 because it was goingon to be that's what was presented to me when I was received the check he didn't negotiate it absolutely absolutely not I was I was presented with the city manager's capability to extend my contract for the existing amount of $50,000 and at September 12th we would negotiate the additional $25,000 and the additional event day that's what I wasc that's absolutely what was told to me step one and it's not your we're not but again I don't know the purchasing I I I didn't don't know the city's purchasing policy yeah yeah um and I have another question Miss cotti yes at this point does AR M you whichever company you used last year I don't know which company was used last year is there any outstanding balance owed to the city well uh Mr Eddie cutright did inform me you know uh he sent me evidence that there is an amount due from last year from this uh wait wait let me see uh and the amount that's due that I have a copy of today or this evening is 23,000 maybe 385 something and the custom oh here it is here it is I have it finish for please right okay so I have it now all right so it says uh Ace Alliance okay and the amount that's due uh to the city of Paca from last uh from this past blue crap is 23385 and it's mainly for the Community Affairs Public Works fire department and also uh the police department and 60 trash cans and also the permites yeah so these are services that we provide it um to our promoter Miss Alia said she had the check to pay for and the custom is that when we initiate the agreement for the next year that's when she provides the check except that we except that she was given another check before that agreement happened before she paid the debt and the only thing that we're waiting on was to decide whether or not you wanted to move forward with the 75,000 or not and if for with how do you move forward with 75,000 when you have not gotten credited the 23,000 plus dollars we've never done that in the past so that Happ never happened in the past because all we did in the past we paid we paid we we paid the 50,000 and we actually start dropping the money down from 150 to to 75 to 50 it was and we were looking to go zero it was originally 25 it was originally 165 then it was 75 then it was 50 um and if we're looking to go to zero then that would be a great discussion to have because the reason I said the reason I said zero because the fact of the matter is you you have built this thing up over the last three to four years you have unlimited access to make make make make money and no restrictions no no shares with I don't so I mean that's that's why I was saying that and I think it was it's a it's a positive thing as opposed to a negative thing so please don't take that as negative I don't I don't take it as a negative thing I I was just saying what the value that our community was receiving having in the past spending 15075 or 150 75 and 50 right and when we did spend the 150 we end up spending 300,000 so that was my problem I don't I didn't when when we do events events where where people are making uh um unlimited Mony you're priv you're private organization I didn't make Unlimited money so you had a limited cap potential so we don't look at your books and we don't share so when when you double permit a vendor to sell alcohol at an event that I'm permitted at and then they sell alcohol and I have a substantial decrease in my sales and then I still owe you $23,000 at the end of the day that's a loss that's a l you can't get to a million without a couple L's so I understand that I'm a business person but what I am going to tell you is it's not unlimited capabilities I have followed the policy and checked the boxes I have your check and was informed that this was the process that's the process I'm following if you want to eventually move it to zero then I'm going to have to have somebody else own the blue crb part of my addendum for legal is to establish is blue crab the cities or is it a private entity because that changes the way I do business so that's please don't take it as I a negative I'm a realist I don't take it nothing's negative or positive I love all of you I love Paca if I don't do the blue crab I still love you and I love you too in the past in the past in the past in the past we have had this as a um a nonprofit group used to run this understood yes so the city we the city saved this event shortly after Co we had a number of other people who um uh nonprofits tried to do it a couple of years and the city said this will never happen again because they were threatened that they would no longer have the event so three years ago we saved this and we said we made a commitment to put the money in put the money up and this is where we are today we have saved this event the commission that you see right now with uh I did a little May was also well so you you really helped put us in a better position so that's what I'm where I'm at right now my whole thing is we have gotten a lot of value out of this and my whole thing is we don't need to continue to put a whole lot of money in especially when you're the promoter you're putting this event together most promoters I don't know if they get uh funding from cities for a lot funding well we help seed it so so what my proposal that I brought to the CRA the presentation had a seed mechanism to grow this you guys asked me to go back to the drawing board on that so there was a mechanism presented this year for sustainability's sake I've explained Rising production cost to you I've explained adding scope of services I've explained I pay private security on top of the police I don't know why I'm paying your staff 23,000 I'm paying my staff 28 ,000 so there isn't unlimited profitable capabilities or what whatever we believe there that doesn't make it so you're not paying our staff our staff is uh is aligned to work those where you you got the sanitation you got police you got fire that's every no you're you're yeah you have to pay that every event every event holder does pay that so that's just where we are sure um in your code it says that City sponsored events provide city services it's not a city sponsored event you you you're you're putting this on and we gave you seed money that's not the definition of language in the contct we sponsor that's what she's saying the language in the contract is that you're sponsoring the event that's that's no it's a public private partnership that's that is that that's what I'm saying that is a different thing a private entity a public private partnership or a public entity those those are different things there's different accounting methods there's different things that I rules that I have to follow so what I'm trying to do for transparency sake is Define what that means to you guys and then I can perform the best capabilities that I have that's it that's it at point we have this resolution that we need to make a call on whether to approve it table It Whatever the commission wants to do and then we have to deal with other things but we need to this for her sake for the 50,000 it's either the 50,000 or the 75 which which would you it would either be 50 days 58 for the original three days or adding the day into 75 that's Point let's just keep it what it is let's move forward we don't need the extra day right now that's we can take in consideration I humbly ask you the fire assessment attorney Mark Lawson is on the line available for questions um but this is 2024 r171 a resolution of the city of Paca amending and approving the fiscal year 20242 not have theum assessment role for the Fire Protection Services facilities and programs directing certification of assessment role and collection pursuant to the uniform assessment collection act and confirming the imposition and Levy of the fire service assess providing directions providing an effective date providing for scer SS there anybody who's here to speak on this West my understanding was Miss cardi was taking the would she go she just to get some and then Mark uh Mr Lawson's gonna be available to I'm still here you're a good man hanging in there good for you Mr you want me to explain it to y'all Miss C is here she just walked into the good good good good she got some money um just to close that the check is here thank you okay yes why am I here go ahead please we're on we're on resolution 2024 R71 fire fire assessment [Music] you already write it okay so uh as a result of the uh budget meetings and uh comments from Commissioners to look at the possibility of reducing the firei assessment uh we did we prepared analysis looking at different options um a variety of options $2.35 $2 25 $211 we also looked at options of reducing or increasing the fixed so the fire assessment have two components the fixed tier and the variable tier variable tier is $2.35 for the value for the parcel and the fix is $ 125 so uh we involved the consultant uh Mark I did send him the analysis that that were're prepared Mark also prepared analysis as well and with the guidance of city manager uh it was decided to reduce the variable rate from $246 to $2.35 the impact of doing that is that it reduces the revenue of the fire assessment by 73,000 so the you know and I'm just going to say it real plain the 11 cents reduction means that revenues for the city is decreased by 73,000 so the existing budget that we have reflects a reduction in the fire assessment from the amount that the consultant uh calculated to show that the city is enti to to A reduced number and it's been reduced by that 73,000 commission as we requested I'm glad to hear that reduction because this commission requested that what would have happened or I think we asked Mr Lawson before on the fixed amount that's that's a 100 what you say $125 per paral um is it all possible to reduce that rate at all without it being detrimental I mean severely detrimental so the reality is that you know we need our money in order to pay our operating expenses if we are really committed to reducing uh the fire assessment in particular then I would say okay at the same time then we should look at some of the capital uh budgeted items because I would not touch operating I would not touch Personnel you cannot touch Grant so the only discretionary component of our entire budget that we can reduce would be Capital so therefore if we're strongly committed if the commissioner are strongly committed to reducing the fire assessment revenues then you should also consider a corresponding reduction in your Capital outlay may I address you all there's one thing that I wanted to just see Mr commissioner Jones was finished sure okay go ahead Mr Lawson I I only would tell you that it's September uh 12 and and the law requires that we certify the role to the tax collector on the 15th because that's a Sunday we have till the 16th and the ability to you know Bob and we even change is limited because only so many hours left until certification is required um happy to look that in ensuing years but I will just caution you with this every dollar you change here I would assume doesn't really affect your fire budget like she said Capital but again when you begin to reduce Capital no matter what you do with the fire department budget your Chief will tell you you begin to affect the lives of the firemen who respond and so traditionally and generally whenever you reduce the fire assessment you typically fully fund your fire department budget and what you end up doing is going to the bottom of your budget and finding something at the very low priority that you find this money from now having said that I will do whatever you ask be done and I think that the way it was presented to me was this was a a smart thing to do at this point in time your uh finance department identified that the net cost would be about $773,000 to your budget um uh uh uh uh your your Finance director has accounted for that and that the document that we prepared focused on what we were told to do was to lower that we can talk about the permutations but we're we're we're just dog on close to the Midnight Hour of having to certify the role and that I've got Miss uh Aaron paloy who does certify the role ready to to to turn this role around tomorrow at that rate but it's difficult to to to make lots of changes at this point I will have however do whatever I can for you all and like I've told you before I enjoy you I respect you I respect that you're a small City and we'll do whatever we can but the document tonight would allow you to make that flight reduction and then we can begin to revisit in ensuing um budget periods but again I stand ready to try to do the best I can for you all um and I thank you for that opportunity I I can appreciate that feedback Mr Lawson and U I know you've been with us for a while tonight and on that survey I mentioned about the word poor and the word poor uh the young man said that yeah we have to mention that city of Paca is a poor City and that fire I know I I disagree that you are a rich city you don't have a lot of money yeah right you are a rich place I want to tell you that I respect you you are a rich place but you just don't have all the funds that some other places do okay yeah yeah so that's why I want to task you tonight with finding a way to uh reduce that and we could still fund be comfortable funding our fire department with the fire assessment fee because overwhelmingly people complain about that fee and I remember when we uh initiated that fire assessment fee there was promise to the people that we were going to try to lure get it lowed and so um that that's just that's what I'm working hard to and I know this entire commission is uh right concerned about passing that cost on and so uh that's that's that's my concern so that's why I had to ask okay sure and and I've told you before you're a water balloon you're not the you're not the federal government you get a print money you're a zero budget operation so every dollar you cut one place falls out of your budget somewhere else and I've learned that because it's a public safety issue that the fire department tends to get funded something else does not I will do whatever you ask we do okay we can move on okay good so tonight tonight all I would ask you do is you adopt this resolution as it's written we'll get the role certified to your honorable tax collector timely and you will have $73,000 less which Finance the finance officer has accounted for and we will pick up where we left off looking at this again uh as already directed in your resolution to look out how we can reduce it just with the understanding that for every dollar you reduce that fire assessment however whichever tier it is you'll have an impact likely elsewhere in your budget or it will begin to impact the efficacy of your fire department and that's just those that's the long and the short who's going to do the opening for that Miss Jones Is Gonna start with the introduction mayor and Commissioners I um just with um what's been going on through this process of the grievance that Miss cardi just some steps that have already been taken um from an HR standpoint to just let you guys understand that the grievance process was flowing as per our grievance policy and the step that we've already attempted to resolve to a resolution um back and I think it was in March um when Miss U Miss Kaiser actually brought the concern to um Miss cardi her supervisor as outlined and they could not reach a resolution through all of their analysis and different options that were offered so they did not reach one and so miss um Kaiser took it to the city manager which is the next step to try to get a resolved um so we looked at different things we had three different meetings one on 1410 426 and 51 in regarding to trying to come up with a resolution we looked at several things within that to try to come up but at the end of the day um what there was a contract that was in place in 2018 signed by Miss Kaiser for the new position of the accepting that pay rate for the new job um things with a 90-day review stipulation in there to go back to the finance director at that time Miss Becker to try to get an understanding if you know how that played out was it enough being compensated for the duties she was being additional duties and none of that was taking place um so that was what the finance director Logan beg um Becker which left in 21 and then lawence shank came in in 21 and left in 22 from the meetings through HR Miss Kaiser the city manager and Miss cardi um a resolution was provided to Miss Kaiser by the city manager um a pay increase and a retro payment which was implemented on 510 24 um her hourly rage was raised from $ 3426 to $42 an hour which equates to from 71260 annually to 87360 a retro payment in the amount of the city manager felt comfortable with going back only from the time that he was hired on to the current of April and that was a $39 and $3,910 which was also given to Miss Kaiser on the um that pay date so that was the resolution that was um offered to Miss Kaiser and was implemented on the check but didn't she recommend a different amount Miss cardi yes what was the amount she recommended it was 9,000 I don't have that one here um she wanted to go back to 10 to the beginning of the fiscal year um the city manager didn't feel comfortable authorizing that because he came in in February instead of 10123 so the amount that Miss cardi going back from 10123 would have been $9,800 and something dollar and I do have that number um in there go ahead commission is it okay if I ask and first of all you you the city manager agreed that she should have been compensated compensated right and he recommended a certain amount you recommended a different amount Miss cardi can you explain to us why can you give us justification as to why you recommended that 9,000 I I don't mind walking up there yes may okay good exercise okay so I I I guess I looked at everything and all the work that you'll have been doing and um once it came to our understanding and we all began to understand it better I just said look the wisest thing to do we're not going to go back all the way to when you signed this agreement because that was way back in October 2018 the most and and then I didn't get here until May 2023 so the most that I've would feel comfortable with you did not bring it to my attention until March 2024 so therefore it's in the middle of the fiscal year I'll feel comfortable going as far back as October 1 first 2023 to give you remedy and that was the best that I was comfortable with and then I respect the city manager he said look I wasn't here I came February 9th so I'm going to started from February 9th and the difference between my Approach and the city manager's approach was about $6,500 something to that effect so so you know given the fact that you had the chronology with the various um previous Finance directors right not addressing this issue previous interm city manager city managers not addressing this issue I want to commend you guys for what you've done to this point and um you know just I just lay mine out there and I you know what you recommended think I mean I think we should you know go based on your recommendation yeah I was gonna say that next come up right because Miss Kaiser has not had an opportunity to present herself so Miss Jones was just trying to make sure you understood the background okay I didn't I didn't know how one minute right okay and the only reason it is at this level is because they already presumably gone through the gance committee I don't know have agre and that's a delegated Advisory Board to this commission and that is governed by state law okay um it's supposed to comprise of three to five members ADV have been brought by okay well why we didn't hear from them prior to it come we don't have one we Jones is going to read the uh gance policy the proxy to them you look before you speak M please I just want to speak to the attorney and city manager uh there are some timelines in this policy and it appears that it wasn't followed at that point so even with your recommendation how do you guys get to a recommendation and it supersedes what's in the policy we got to we cannot start with a practice that isn't policy and and we you know we can't say well yeah we think we think that this person and this have nothing to do with you jail directly we can't go well I think she should get this because when we went over the salary survey we actually adopted it for everybody guess who else wasn't in that salary survey the commission commission wasn't okay so are you because I'm gonna tell you right now if that's what we're doing you got five more people to start considering thank you so don't open the can of worms unless we're ready to actually defend what we're about to do right now to set pres okay so I I want to air on the side of caution caution with legal advice not what we feel that we should do there you go that apprciate good evening um thank you for allowing me to discuss this with you um yes I did start this grievance policy back in March early March um I have been as I say feeling that I wasn't properly compensated and I believe D from 2018 to that it would be corrected during the salary study because the salary study was supposed to go out and compare your job description that you made specifically for that job for that salary study because every employee was asked to review their um their job description make sure it was accurate make sure everything was in it and give it to your supervisor who then provid ided it to the uh HR Director or the HR at that point um I did that um I was very surprised when it came back at 2% above my current rate given that the few cities that were allowed into the salary study um I doubted that there was any person to compare to what I do for this city because I am the pension administrator for three local plans as well as the financial services supervisor when it didn't get corrected then I had no evidence no proof to um substantiate my belief that proof didn't come until March because in March I had ready IND ated I was retiring in October and I had been directed by m cardi my supervisor to revise my job description to remove the the duties that were going to be now um handled by an outside company um the three pension boards in the past every year had been paying 21,00 000 to the city so that they could have a pension administrator so the pension could have a pension administrator not the city the pensions they paid out of their money toward to the city when in March I deleted all those pension responsibilities at least most of them the bulk of them um HR put the uh new job description out at the same identical rate grade because the salary study is based on grades my position was put out there for the same grade as the new position with what we all agreed was about a third of my duties removed when that happened I put my grievance in because this was the first first proof I had to say my job per the salary study done in 2021 was not correctly evaluated when we had our first meetings probably by the third meeting um first of all our fir my first meeting was M was with Miss cardi and she invited in HR if you review the policy HR is not involved at all in the grievance Pro process but she was invited in and through all the meetings HR was involved when it came time no resolution was was offered I moved my grievance up per the policy to Mr Bell City Manager Bell we had several meetings and one of the meetings he directed the HR to go out and find the company who did the salary study and have them take the new job description with the third of those duties removed have it placed in the grade range that company um HR found out that that company no longer existed and Mr Bell directed her to then or she took it upon herself to find other local um job descriptions that matched the job description that she put out on the website and the her analysis came back that the new job description is at the correct rate that is why I believe my job description the original one presented to HR which when we when I did an ask on my own personnel file the job description that I that my supervisor um approved of and brought to the salary study was not in my personnel file which indicated to me a second reason why I was not put at the correct range grade range so um at that meeting Mr Bell um decided that he would move me up a grade range and that he did not feel comfortable doing retro back any further than his when he was hired so I was retroed back for April for March and for February and my request here in this grievance says that I've been improperly uh compensated for my job duties I've performed since October 2021 I in no way am grieving back to 2018 I add something um certainly so as a result this okay uh as a result today I did request that human resources uh give us a value uh for what is the amount you know like if um The Adjustment that we figured out at all these meetings where Miss uh Jill should be and where she is currently right um if that had been reflected back in the salary survey when it started which was October 1st 2021 I wanted to know what was the value of that dollar amount you know and so uh Miss Jones have that information yes okay so what I did for Miss cardi when I went back doing the calculation based on where Miss Kaiser was actually her rate of hourly pay at the beginning of the salary study implementation and the fact that they moved her from one grade to another grade I calculated her pay based on the new grade same step so where she would have been in that position and the total I came up with and as she got um years of experience increase 4% Cola 5% I facted all of that in as I moved the grade down the total cost I came up with that would have be done to due to miss kaer if there was a will of the commission was 18770 26s the 39 um 10 that she's already received you calculate what was again 8,770 126 that's from going back to what October um October October 15 2021 when the salary survey um was implemented I feel if she's do that I'm in agreement with it I don't know where you all say think we need let Miss West okayy because it appears that there are some uh limitations and there's some expirations they uh the guses have a time period that they need to be fil and I don't know if we Within that that's three years ago have you reviewed that Miss Miss Council W sir so the the grievance procedure is in your packet I've already mentioned the fact that this need been sent to a grievance committee in order to comply with the the procedure but there are commissioner Jones is correct there are time frames um regarding when the grievance is brought the time frame to address the grievance by the department supervis and consistent with that on March 20th I met with chill after she brought it to me and I met again on March 22nd and Miss Jill did make me aware of the 72 hours that I had to make certain that I met with her because uh we went over the grievance policy so that's that's okay of What year no see the grievance policy doesn't say what year it just says 72 hours right within it says see here's what it says all supervisors and department heads shall arrange to discuss a grievance within 72 hours after the grievance request has been brought to that supervisor so I made sure and adhered to that but I have three days if I heard it correctly the complaint was prior to you getting it you no no so you didn't tell them when you you said when the salary survey maybe so you you fil I filed my agre in early March she filed the 2024 of 2024 for because I had no evidence to support my grievance until I found out that the job was advertised at the same grade as I am currently occupying this different that's the replacement job to replace your position without any of the pension responsibilities because the pension had already decided in February of 24 to hire an outside company for 70,000 plus dollars a year to do my pension job okay I understand that right so just before we make this decision we have had employees hired in doing position and then Mr Bill is example then we hire new people same job with a hire R so when I say set president now think about what think about what's being said what we're saying we're g to do we're g to go back in retro folks it's not the same job though it's not the same job absolutely not um I spend and I documented that in in your packet because before Mrs Miss cardi was hired I asked my staff and myself we kept track of our hours of what we were doing and that's how I can document how much time I spend on a regular basis on pension um which we all agreed in the meeting was about a third of my time and I required them to do that yeah I required all the staff that I took over to document their time okay well you you do remember that when you Commissioners found out that you were paid in correctly for a year you retroed back to when the mistake was made and that has happened for multiple employees back multiple years it's not a new precedent it's the norm okay so with that said we have to make a decision I'll give direction on how to move forward with M ka's so so we didn't ask this question the grievance went to the city manager first no it went to it went to me and then went to me then and then it went to the city manager and then y didn't agree then he s it well he then made a he then said uh make sure and meet with human resources and so that's when I brought her I involved her in at that point yeah we agreed on the reclassification what what we uh had a question about was how far back we go and if I may my hesitation was that there was an agreement that was made with um Miss Kaiser uh when she took on the new wage range uh that said that uh there was 90 days for for an opportunity to come back and revisit what the uh wage rage was so was the N9 days is this within the 9 days no that was right and in her defense though let me mention that she uh pointed out that um between the 90 days and when I came on board there were several Finance directors that came through and several city managers that came through and so she felt it difficult to bring that issue to their attention because it was a I think to use her words a revolving door and she didn't have a basis by which to assess the difference in until recently until March and so balancing those two factors the fact that there was a document that was signed and agreed to there was a 90-day period that wasn't adhered to with the fact that um there were uh it was a revolving door so to speak and didn't have an assessment value to balance that out I felt it was appropriate to at least make her whole back to when I started as a manager let me address the revolve door um issue um Don Holmes stabilized the revolving door CU City manag we yeah we we stabilizing with Don Holmes and he was here up until 2022 I have been I have been this is my seventh city manager and my fourth Finance director and I agree Don holess was here for three years however it could have been I didn't I didn't have any basis for my grievance until the job description was put out there and um I also direct your attention to the packet showing that Don Holmes actually signed off on an employee to move three grades up with no documentation behind it well I just want to at least so this is not aess president this has been done I just want to clear the revolving door up because it's been stable since uh don Holmes had been put in place and it's been stable since that time because he he left on his own he retired thank you so how do we want go what direction do we want to drive um I'm also in agreement with commissioner mcal I think she needs to be made whole she did the job she worked for those for that position and I think she deserves to be compensated for that I mean I'm I'm I'm in full agreement with that but also do we have anybody else out there that's lingering that could potentially bring this uh same type of situation up and if we again when we when we talking about policy we can't do it for one if we don't do it for everybody so where does that put us as it relates to anybody else bringing things in about their job and their role the additional responsibilities and if they're tracking their hours as well I'm just want to put the whole thing out here so that we're fair to everybody exactly and that is a very good question that's why we've tried to be very careful and making sure that when we uh took a look at these things that we were very methodical in our approach to make sure that every everything uh was dat databased now one of the risk factors that we have though is that as Miss Kaiser said the individual that did the salary study before that company no longer exists so our ability to go back and re-calibrate which should be done on a five to 10 year basis is not there so at some point in time we will need to go back to an RFP to bring in another company to allow us part of what we base everything on is we take a job description and we say based on this job job description which describes everything that the person is doing what is the appropriate stepping grade for that position right irrespective of where they are what is the appropriate today for that job description and based on that uh feedback we methodically look at what the uh data says in terms of the cost impacts right I app I appreciate that and again I'm I'm all for making sure that people get paid for what they're worth and um she certainly deserves that now the other piece of it is in order to be fair to everybody um you know I guess we can just kind of make a recommendation to give a time period for people to come forth if they have anything so that we can cure this whole thing and make sure that we're fair to everybody a Time certain that people bring their documentation if they feel that they have not been paid fairly so that the policy need no I'm just saying if we gonna pay B is and I'm if I may Madam mayor I want to stay on commissioner boram's trail that we need to make our employees aware that they have the opportunity to do so it's important that they know we got to get it out there and then make it time certain but we got to do it by all means of communication make these employees aware do an ident identification I'm sorry and get that get the word out so those employees can have their opportunity to come forward okay um with that said is the direction I've heard three is that direction of everybody at this point we move along Do you have a me a suggestion on frame I'm good with it but I just don't like the the policy piece but again she she has done her due diligence um uh again and then to be fair with everybody else I think we need to make sure that we um cure this process so we need a time frame of making sure that we get it out there and then a time frame for those folks to respond does that make sense what do you think would be a reasonable time frame for for those people for us to advertise and get the word out and then for them to respond for them to respond yeah M Jones do you have ideas yeah well I was just asking yeah the communication piece will be simple to um just send it out to all employees um but the how far are we looking are we going back to the beginning of the salary study for people yes that were not compensated so we're going back three years to be fair we would have to if if they're basing it on the salar that 2021 I got to say something I think we have listen to ourselves what we saying those people who made those decisions are not here we voted on let's do it but we wasn't in nuts and boats and and actually into the salary like the then Finance director or then at that time City management um this is a situation where Jill was doing two jobs two actually two jobs okay so I don't think or HR would know if we have anyone else that's doing two titled jobs I said identify okay right so I don't think it should go to someone who got a yeah they got a promotion and then bu it they should be retr paid because they did a C Level of job so that so it's very different her yeah her situation is exactly identify those folks so let's still go back to let's let HR kind of like deep dive into this because I'm telling you there we already got a policy we we just talked about some policy violations let us let them go back and reassess with this policy before we say yeah go ahead and do it we take career Bring yes that's what I'm saying let's finish let's finish that for this one too you want say go ahead we're gonna take care of Miss question we can also uh as far as the timelines Miss West uh on the legality of it are we in line because I'm a little lary what the policy say and what we just said we're going to do it don't seem like it's lining up to me what you're discussing I first I suggest that you table this discussion to another meeting because their decisions AR why you Ain tell us that what um and I can make recomendations at that time but what you're talking about doing is opening the door for potential complaints pursue this this new policy idea what what you have now is each grievance is different it's a caseby casee situation got facts are different and you're going to apply it differently so I I think what you have in place works just fine I don't think you should have an open time period for retroactive by case basis it is working um but if you want to take that up I would suggest you do that that's exactly what I okay thank you question answer your question long as I POS it so you guys know I say let's refer to Legal okay all right thank you thank you are we all set then with Miss Kaiser we have one more item on the agenda but we also have something else to we're not finished do we want a table let's go let's go tell us what the okay so I reached back out to um sniffing and spelling who we agreed that we would go to um she sent she sent a letter did y'all receive it the first letter indicated that when I asked when the scope of it the investigation was um the alleged conduct of Mr Bale which had been the uh sub subject of certain complaints submitted by former and S current employees and it gave the nature you all have that it gave an hourly rate um the estimated fee was not to exceed 30,000 in the original letter um and we I gave a date that we wanted the investigate complete investigation completed it was prior to his probationary period ending I went back out to them and they sent another letter out which indicated this is this was a follow-up to the conversation that I had with them that they still um said that their investigation would they would stick to the original amount not to exceed 30,000 but that does not mean that it will be 30,000 they were going to charge by that the hour however they would give us let us know if it got to 5,000 um they would let us know where we are if it got to 7,000 if it reached 10,000 a lot of the work has been done because in the original letter they were um they included um the investigation um things such as travel time but we talked about doing it in a manner in which it was very uh kept the employees um you know confidential so maybe doing it by Zoom they didn't we didn't have to pay lodging fees cuz that included in that they wouldn't have to come here for lodging fees to meet with employees they can do it via Zoom they had limited information at that time now they do have um more information to go off of it wouldn't take as it shouldn't take as much time to um interview the employees or the complaint the complaintants um so it's 375 an hour that's what they uh agreed to the first time is still 375 an hour they want to do take on a team concept however it would be one that's the lead on the lead attorney and that lead attorney will interview everyone but she has all the statements now so she'll kind of be just substantiating what's in the statement so that kind of cuts down on the time so it's up to you all if you still want to go at snipping and Spellman they're willing to do so however they're willing to let us know when they reach a certain amount out may not even get that for you know it definitely won't exceed 30,000 they'll let us know way before it gets to 10,000 because that's what we agreed to but we just need to know they need to know if we want to still proceed with that company with their burm up to us I heard I heard 30 but I thought the max would be 10 because you had you weren't using this the number of and if you see in the original letter that they sent that's what I told them at first however they went back to their team and they decided that they would stick with the 30 it would not exceed however they will let us know uh in increments if it got to five when it gets to five if it gets to 10 where they are in the process and a lot of the work has been cut down from the original scope it's up to you all to decide you have both letters in front of you so it's up to you all whether or not you want to proceed with sniffing and Spellman also with the mediation process I with the time I get off from my primary job trying to reach out to companies I went back and I came to HR what I would like for her to do because we do not want we agreed that we did not want to use the same company that did the the um team building with us her to give me a list of the folks that the the pool of folks that we chose from and then we as a team can decide if we want to go with another firm so we can have a mediator come mediator to come in once the investigation starts are there any questions I'm going fast but all of this is before us we can decide what we want to do I thought the last meeting we said 10 but that that's I and I said I went back to 10 they went back to their team and their team decided they were going to stick the last me we said 30 because of the time frame when I went back to them they said that they're still they want to use a team concept and it will not exceed 30 it may not even go to that they go by an hourly rate which is 375 per hour it may not reach 5 10 however they will let us know when it reaches five whatever we want to tell them let us know when we get to this point a lot of the work has been cut down because they've received statements at the end of the day the information is before you all you all make a decision and we need to know just we need to make a decision whether you all do it tonight or table it the information is here before us and then we can move from there we've been tbling this item for a while I me this investig I'll be I'm okay with the knowing and increments and if we get to the point to where I think that's fair it I think us I think we yes we need to get it going to start it and get it we agree to this in investigation and has yet to begin because if they get to the 10,000 and they haven't gotten what they need and they already have statements it's up to then to the last item that we really have to discuss that's very important is this whole incident of not following policy and the check issue in regards to Mr B and um we have to add it as an emergency item correct um I would like to add that is this administrative um situation as an emergency item it could be new business or emergency new business new business I would like to add it as okay because this is the norm that our city managers right $50,000 checks or go over 25,000 or is it something that we're going to get into the practice of is it policy yes these are just questions that I'm posing as talking points to facilitate this discussion the policy is a maximum of 25,000 that the city manager has the authority so with that being said are we saying that he violated the policy yes with that being said what are we going to do as a team as a commission what's our decision what does the policy say or what do we do and Council can you give us some guidance in this no she can okay all right so we have identified that our city manager has violated a policy what are we going to do as a commission um I'm passing the gab I'm making a motion but yet again to terminate Mr Bell immediately his position immediately grounds of violating City policy and um releasing funds without Authority second motion is second all in favor the other one supposed to call roll call I have a motion in a second on the floor to terminate call question okay yeah go no you go ahead to terminate this bail the city manager's employment due to uh violation of policy um and release of City have a question yes question um just I just want to just make sure that from a um policy standpoint and individuals uh making uh certain decisions outside of the commission is there a pathway not to potentially um firm but maybe give give him time off time off without pay uh to send the message uh to not continue to have this um open you know this the the the discontinuance of Lea if you if if if if we terminate a city manager right now without give I would say give him time off without pay that is almost equivalent that's the message the next one could be if that occurs again terminate but the commission can do what what it what it wishes Ian it's a it's a violation yes but again uh whatever the commission would like to do I just I just made a uh I just made a an alter for what happened to keep have at least some continuity in that leadership role uh but if the commission decides to move forward let it be what it is not I'm not I just made a I just want to say that at some point we have to really take into consideration the potential Jeopardy that we were put in um I believe personally that there was so much that could have resulted out of that one little instance and if we allow this to be swept under the rug for lack of better terminology um and slapped on the risk that there's a potential that additional things can be done um that will F further compromise the integrity and jeopardize the Integrity of this city and sometimes we just have to really accept that there's a character flaw and being that what it is I mean it we just have to make a decision because again there are a lot of things not just the issuing of the check but the disclosing of other Commissioners positions with regards to their stance on certain things with regards that falls upon the sunshine and there shouldn't been him connecting saying oh I'm talked to commissioner Campbell commissioner Campbell said this to another commissioner am I correct you you didn't hear the whole conversation earlier the earlier conversation yeah so and I mean I I don't I don't and I think that I mean that goes against Sunshine with regards to um and that's I mean that's not a good practice and those are just my thoughts okay uh could we have a roll call for vote can I say something I think it's problem go ahead so the situation that occurred with blue crab um I only did that because I thought that that was the authority that I had I went to staff and I asked that question I wouldn't have done it otherwise and I only did it because of the purpose of uh making sure that we with regards to what you did how you did it and I asked you a simple yes or no and you agreed I didn't agree that I lied I asked you if there was anything for you to correct you had the opportunity too and so that's why I said I didn't understand what you were saying because I never agreed that I lied I asked you did you not tell me that the appropriate I asked you the steps that you taken with regards to going to Staffing you said yes you told me that you made contact with the additional Commissioners and you told me that commissioner mcal said that she was willing to sign on to a meeting which is the only reason why I said I would sign on to a meeting one that you shouldn't have said who what when where or how if that was not the case Mr Bell you have and I the list can go on with regards to this whole situation and I asked my asked my fellow Commissioners had they been contacted by you with regards to that and half of them stated no but you told me that you made contact which each one each one of the Commissioners and that's the direction in which they were wanting to go in did you not I did reach out to each of the Commissioners yes okay but I I I don't think that I lied I mean that's I I disagree with your position on that if I just ask you for clarification and you didn't give clarification but again you just agreed that what I just stated my statements were correct what do you call it so Ian we can go over the details of what you said and what I said but there's no there was never any intent to to um to deceive you on that what do you mean that was blatantly I I to well of course I retract that if we are continuing the investigation into Mr Griffith I think we have to continue this investigation no we don't how are you going to investigate a hosle working environment the person is not documents but yeah okay that's fine but it's up to the team okay was what's the consensus consensus for the investigation to either the investigation to Mr Bell that we
