has been here for most of 60 years that I know all right we are live it being 1:30 we're going to commence the proceedings before the special magistrate for code enforcement for the city of Paca Florida it's April 16 2024 by way of introduction my name is Ron Brown I am an attorney licensed in the State of Florida and pursuant to city code and state statute I have been appointed by the city Commission of the city Paca to preside over today's proceedings this is not a formal court of law we are not required by Statute or ordinance to follow the strict rules of evidence or the strict rules of civil procedure as you might have to fall if you went down the street to the county courthouse we are however required by law to conduct a hearing with fair play and due process which means everybody get a chance to speak everybody get a chance to be notified of the um allegations that have been brought have a chance to uh see and examine evidence ask questions and present any testimony and evidence that they may have one of the requirements of law however is that all testimony must be substantial incompetent and to do that it must be sworn substantial incompetent evidences lawyers speak for evidence that would cause a reasonable person to reach a reasonable conclusion given the facts at hand the substantial confident evidence saring is going what we're going to do next and I'm going to ask all those persons who will be testifying today to please stand you if you're going to testify GNA complain okay are you yeah okay so what we have are the three code enforcement officers have Miss low we have Mr Green we have Mr cutright who will be testifying today and they have raised their right hand do you saw me swear or affirm the testimony should give today should be the truth the whole truth and nothing but the truth yes let record show that all three have answered in the affirmative we take the cases in the order in which they appear on the agenda unless we have a respond in present it's my understanding that we do and so therefore we're going to take that case first this will be case 2024 -23 property located at 400 North 4th Street in PKA uh owner of record is Kenneth Gonzalez and Greg Gonzalez is that correct uh it's case number 2023 068501 I'm sorry I'm sorry that is not the first one we will take it as it is my mistake 2023 68 501 Kirby Street correct yes sir not a problem and this is U um again 2023 68 yes sir and that is still owned by Kenneth Gonzalez and Greg Gonzalez that's correct sir right and are either of those here are you Mr Gonzalez one or the other no sir you are the complainant no it's not on this case okay he's in the hospital sir okay so we don't have a respondent we have a representative but she can't speak because we didn't get the paper she didn't get the paper uh paperwork notorized I can't I can't get T okay well it's not a public hearer and if you're not a representa not the respondent or a representative of the respondent I his caregiver well still that's a legal question and the way that the statute work like I said it's not a public hearing we don't have public comment we have testimony and evidence from people have personal knowledge of either the violation or defenses to the violation I'm just here to listen Okay what was she going to say this is the profer it's not being accepted correct she your interest in this case and why what what do you want to say today I want to speak for Kenny or for Michael he is in the hospital it's not just physical is mental also uh the family has reached out to me the sons and the mother and the brother to try to get his house back in order up to code lights turned on plumbing fixed get it ready for him to come home as an invalid so that is what I'm doing the the only thing that we can do at this hearing is to make a determination as to whether there is a violation of city code that's all we do yes well and the if there is a violation we haven't found one yet because I haven't heard the testimony or evidence yet then it's up to the city to make a recommendation and I'll look at that recommendation and see if it's appropriate is to how much time there will be for compliance that's but I don't have a the ability to make any rulings or any judgments of any type really uh all I can do is find out whether there's a violation and see whether it's reasonable for the amount of time that the city wants to give for compliance and what kind of f they want to impose that's the only thing I can do there are lots of issues that homeowners suffer it's very difficult sometimes well he he it it did it not feel battle we'll we'll get it done we we're I've got the wood for the uh wood I've got the glass for the glass it's just a matter of getting people in there to do it well this goes to whether or not have you had this conversation with um right we're here for a second hearing a second hearing on this case sir we've already had the first hearing on June 13th all right yeah he represented himself but he he was coming down at that time in other words he was well let me ask this we're going to hear it again but what's the city seeking on this one this is the imposition of a lean correct sir well if they're entitled to their lean if there's been no change and like I said I haven't heard that yet with regard to the situation if there's been no change in the property and there's been no improvement they're entitled to their lean it doesn't mean they can foreclose it yet um but it is something that it creates a legal issue because it's a cloud on the title it's it's there and it still needs to be done I realize that I just wanting to let you know that somebody is trying to help out and work with them we've already got one violation taken care of we're working on the other two and I'm working on the plumbing right now all right well tell you what thank you very much if you just have a seat thank you very much sir thank second hearing on this case the first hearing was held on June 13 2023 and you had what due process have you yes said you used we didn't get the green card back but we um posted in the newspaper we did a complex posting and a site posting on this property all right I would like to ask uh your name again was Maron come on up please how did you know about this hearing I live around the corner and I got his I'm I'm doing his house and this is on there and plus I already knew it was coming right so you got the notice the posting right yeah and did you consult with um Mr Gonzalez yes so you have talk with him about yes and I told him what I'm doing and he agrees with because he's paying for all what was that all right thank you very much okay Miss Lo so you sent the notice to the address of record is that correct that's correct sir and that address was the address of the residents at 501 Kirby Street 501 Kirby Street and that's the official address of record on the property appraiser and Tax Collector's roles correct sir okay and you did not get the green card back showing thice no sir I we do have someone here who picked up the um well this is on his front porch so I got it to come up here I'll put it back up there y want that one M Mr Gonzalez needs to get it well I got a file ready all of his mail everything he hasn't opened his mail up in over a year all right please proceed yes sir um this was first observed in April 4th 2023 pictures if we can go to picture 1A please all right and let's for the record set the um legal position there were two or ordinance violations originally cited of one of section 30- 171 um regarding broken crack or missing Windows and with there being a missing window in the property is that correct yes uh yes sir and then also section 30-1 169 of the city's code building fronts and sides of buding Street in public areas rotten and weakened wood painted U or stained wood is that correct that's correct new painted and so that'll be the limit of what we're looking at yes sir all right please proceed yes sir this photograph in 1A was originally taken in 44 of 2023 and then one B from the first hearing yeah and let me do my due diligence here also did you take the photographs you're showing us today as demonstrative evidence I did Sir and do they accurately represent the condition of the property on the date in which you took from they do so yeah please proceed yes sir so this is going to be one B it was taken on 612 2023 from the first hearing there was no change and if you go to 1 C please for the second hearing this was taken on April 9th 2024 you still have the update is the rotten and weaken wood is still there and is visible from Kirby and Kirkland very good and if you go to two AES oh that went out of order so 2A is going to be the rotten and weaken wood there's a banner up there and up underneath the banner is all still rotten and weaken um this photo was taken on April 4th 2023 from the first hearing the followup from the first hearing on 2B it just shows the rotten and weakened wood at a closer and then on my followup for the second hearing on April 9th 2C it is still in the it's in actually worse condition um and this is visible from Kirby Street I got a lot of work to do so there's not GNA be any um photos for 3A 3B or 3C because the mold and mildew did come into compliance so we're going to go to 4 a 4 a this is going to be broken or missing Windows where is that oh that's on the back got the floor and you could have a seat for me please ma'am could you have a seat for me thank you so this is going to be the original window from 4 a it was taken on um April 4th 2023 and then if you go back to 612 which was from the second hearing it's going to be 4B um yes sir 4B so this here shows the missing window it's going to be on the top floor all right and then for C shows you the last two windows that haven't been replaced they have garbage bags in them and the windows are the violation of 30- 16 1771 yes sir so these are the only two windows that I can see that are still missing the other ones now have screens in them and I can't officially see on the back side if there's glass but these two have um trash bags no glass Sur screens and this is visible from uh Kirby and Kirkland and that's going to be all my evidence sir basically we're still at a situation where we have violation of 30171 due to at least two missing Windows is that correct that's correct sir and that's just for the record more or less than Ur there was a total of four but I can't see on the backside because the um the trees grown up and I can't see I can see that there's screens in there but I can't officially raise my right hand and say that there's no window and then the rotten and weakened wood it remains unchanged that was the 30-1 169 the hearing on this was a year ago um yes sir actually it was almost where has the city been for a year on this uh it just it it's hit a fine total fines of 13,800 I understand that I'm just curious as to why it took a year to come back you can come back after three months and seek a lean on that right now that threshold we had put a 10,000 threshold or everything before we came back at the original Mr B Thomas uh what is that about we it was just a opperer number that we came up to give us a gug so we have well you don't want to put yourself in a position where you're arbitrarily increasing the amount of fines you have and giving people notice do it that was the gauge we had at that time since then we have adopted a three month but at that time we said anything over 10,000 will come back to us for the hear it so how much is he 15 but we're going to get more it's not public com so the city had a position that you were going to wait until $10,000 you would bring it back to that was our gauge on when we brought things back was about $10,000 left and what was the basis of that you don't you don't want to get yourself in a position you have an excessive fine that's what this is going to well I mean that conversation we have between the city manager at the time and the City attorney and that was the the number we came and gave us a gat or anything met that threshold will come in for the third lean process well you're entitled under the code to do it under the statute to do it um just want you to be aware but you now have a policy you can follow the state statute and you three months three months so special magistrate this is um Jane West Wayne in just on this this issue the the $10,000 threshold is um those leans throughout the city where the the city is going to go ahead and move forward with either abatement or foreclosure this is really kind of a a resource management issue because there are so many leans that the code enforcement department needed to uh figure out a way to prioritize which ones to move forward with so I I think that's why you're seeing a little bit of a delay here it it wasn't intentional to try and rack up the the fines make that certain of that I think you appreciate my concern about just sure sure letting the number letting the number move up let me ask you this I did I hear at some point that there was a partial compliance um some of the tenants there have been um working on the property wide the um property owners in the hospital so they were able to get some of the mold and mildew off and that was the other um violation sir all right so that one's gone I did take that off sir so the the fine that you're blaming has now approved does not include any fines for the it did up until a weeko missing the now satisfied I Clos it as soon as they told me the mity was off I went over there so the $133,000 is now just for the two that's correct all right and the amount of the third one that approved before compliance that's correct sir how much time is the city asking for you know the digit want the lean place now is that correct UH 60 days sir oh no well you want the lean place now that's correct right I would like to ask you if you can come back I know you're not under oath but is if you talk with Mr Gonzalez about what his time frame is and what he can do Mr Gonzalez is just now getting to where he can eat and he can walk he is a zombie when he came back from being Baker Act he's got congested heart failure I do not expect him home I know that he keeps saying he's coming home but I do not expect him for three months because he's going to go into rehab when he gets here so I do not know what it is he hell he could die in there for all I know for the congested heart failure I didn't know he had that all right thank you very much I'm sorry it's fine but I do have the word to do that now because it came off of a the proper wood just just for everybody's understanding it's it's an unfortunate issue that he has yes it's doesn't change whether there's violation whether we realize that I just want to get it done so that when he comes out he can deal with what he wants to deal with but before then I'm going to get it done because he can't he can't even walk back in April he could hardly walk he had a jug attached to him I mean you know all right thank you very much he Miss l no sir the city is just seeking an official lean on this property of 501 Kirby Street okay right it's you know even with the understanding that the owner has some great difficulties in trying to address any of these issues uh nonetheless the city's entitled uh to their lean based on the evidence and testimony since the two violations one of 30171 and 30 169 um 171 being the two missing Windows that remain that can be observed as well as69 the building fronts and sides of budding the streets and public areas um having rotted wood also Remain unabated the city is entitled under the law for their uh lean and so we are going to impose a lean and in an order allowing that a lean be placed on the property and reported in the public recordss in accordance with section 162 for statutes as of today's date the total fines total $13,800 fines will continue to acrew at the rate of how much per day Miss L it is $50 a day sir $50 per day $25 per day per violation into satisfaction opment ma'am thank you very much for coming today no sir I'm sorry can I comment on this no that's not a public comment that's not a hearing how long have I got then now we're going to close I'm going to close the hearing on this one okay now you want say something fine but it's not a part of the hearing well there's a the two brothers on this property honey I've got it covered guys guys that's not for me decide well I'm just making you aware of it that's fine and that's something that the owners have to sort out in terms of how they want to handle the situation again this this is a very limited venue in terms of what you can decide I can't get into the equity situation why it's not being done and if there are issues between the two of that's just not unfortunately something that we can deal with here is how long I got that's up to the city what what's happened now is that the a lean will be recording the property and the city will have to come back and ask for I think they come back and ask for authority to foreclose the lean just something they can do he's Homestead yeah so if that's a homestead he can't foreclose the lean yeah we we won't be pursuing uh foreclosure on this it is homesteaded property and we won't be taking any action as as you know special magistrate for a period of three months pursuant to for statute three months it won't be you can't you can't foreclose okay you cannot foreclose on Homestead Property if that's what it is yes right how long have I got to fix things that's the here's what's going to happen the lean is going to stay on the property yes at some point if that property is sold or well just tell me how long I got so I can get him up to date and the leans can stop and then when he comes out he can deal with the leans it's the fines are going to the lean can last 20 years well I meant you know all of it I'm just wanting to know what it is so I can get it done so he doesn't have to deal with it he can't well again you're going to have this issue of the authority you have to act on his behalf and that's something you're going to have to get your own legal advice on because I can't give you that fix it just tell me how long I got to fix it that you have until the property is sold or he passes or something happens where somebody's trying to get control of that property this lean is going to be there and it's going to have to be paid before the property is sold transferred or otherwise disposed of I realize that but right now we're talking about the lean I mean the uh stuff the things that the violations how long have I got to fix the violation you have as long as you want but you have to remember and the lean is there yeah I realize and it's going to continue to rack up 50 bucks a day in fines okay so in other words it's $50 a day in fine until I can get it fixed yes ma'am that's until and you're going to have to get some legal advice on this I am not your attorney there are things that can happen where this property could change hands well if it does is won't be my problem anymore then will it and and before the city well I'll give you you need to perhaps get your own how it reads it puts the complaintant up there okay the complainant compl record so the owner of record is her Herbert Delaney and Tracy leadford is that correct that's correct sir property located 400 North 4th Street Paca Florida 32177 all right are Herbert Delaney or Tracy leadford or anyone representing either of them present seeing and hearing no one all right Miss L you may proceed yes sir this is going to be um case number 2024 023 property is located at 400 north4 Street Paca Florida 32177 this is going to be the first case on this violation and it was first what are what statute or ordinance are you claiming a violation section 30 32A it's roof and disrepair and that provides it and that is included in the record yes sir and it's subsection 10 is that correct that's correct sir fure to replace repair with similar improved material in a reasonable period not seed 60 days broken or missing components including limy two doors windows roofing materials siding drives walks outside R away which attract the Aesthetics of the neighborhood or blocked by the connector in the service District okay so basically we're looking at missing building components correct that's correct sir yes sir this was first what's the due process on this um yes sir um this was uh the Green Card actually came uh was not came back the whole letter came back um it was posted in the newspaper complex posting and site posting on the property and actually yesterday I was able to locate a different address and a telephone number and the telephone number the actually the property owner did answer and he gave me a different uh homeowner's address for him so I so the green card from the postal service was not signed that's correct the envelope from the Postal Service um the notation on the return envelope indicated that return to senders insufficient address unable to forward the address was uh 13432 Providence Road Weddington North Carolina 28104 correct that is correct sir that's the official address of record the property in Tax Collector's roles that's correct sir okay and you've had any contact with either of these individuals I did Sir I actually um was able to locate a telephone number um from him yesterday um and I did speak with him um and then I explained to him that he's got other cases and that we needed a good address and um he was able to provide he said he did change it with property appraisers um we pulled it up and it still shows his old address so I've notated his new address so I have had contact contact with him right so he knows about the hearing that's correct did he indicate he said he could not make it he's out of state um but he will try to get down to Flack as soon as he can did he indicate any interest in trying to repair something he is he's going up he yes sir all right well show me what violation the city's alleging that's correct sir um this violation for Section 3032 a roof and disrepair was first oberved on February 15 2024 and this is the site posting and if you go to 1 18 please and you can see here where the um 10 roof is starting to peel off a h of the house this was taken on February 22nd 2024 1A and it's visible from Madison Street okay and the underlayment is is it rotten what is it it's it's wood up underneath and um and it's going into well when it rains what needs to be done to repair them he needs to um right now just replace the 10 for the roof and disrepair can he put the 10 over that wood that's where it was Prior um I just pass that's okay correct correct it's all right next and yes sir this is going to be 1B and it was taken on um I'm sorry that should not that's it it was actually taken on 49 2024 that was a typo on my part 400 North four Street you can actually see where is actually coming off the roof Ro and one other panel of 10 is down and this is visible from Madison Street and that is it sir on this case so basically that's the violation is just that one just the RO and dis repair in that section yes sir does this require a permit um I I advise the property owner it may need more work once he gets here but this is what I can visibly see from the road is that the tent is coming off he doesn't need to go through a permit what I did is I'm asking for 120 days just in case he does need to go through a permitting process um and then that would give him time to get that done and get to Paca he said he's going to have somebody come and actually try to put a tarp over it for now and he's going to try to be here within 30 days I think I ask you did you take these voot I did Sir and do they actually represent the conditions par they do sir anything else no sir based on the evidence and testimony um and I'll give a final call for Herbert Delaney or Tracy leford representing either of them see in hearing I want and find out that the due process requirements have been satisfied the city has been in contact with I guess Mr Delaney is that correct that's correct um and has a correct address for him property has been posted in accordance with State Statute and finding that substantial incompetent evidence exist to find that um they prohibited conditions and public uses of the roof and disrepair are present and U constitute a violation of section 30-32 A of the city's code we're going to find that the violation exists based on the staff recommendation um we'll enter an order giving 120 days from today's date that would be through the end of business on August 14th 2024 in order to bring the property into compliance in the event of non-compliance of final $25 per day uh shall acre beginning on August 15 2024 all right green are you next case 20 2242 correct yes sir all right this is a property located at 2119 Oak Street in patka we try to contact him yes sir um first and the 15 they um volunteer compliance letter excuse me and um that green card didn't come back then I sent the um not of hearing and nothing came back and I posted the address and I post it on the complex okay and the address of 10854 Natalie Drive Jacksonville Florida 32218 that was the address to which you sent the notice is that correct yes sir and is that the official address of record on the property pris tax rols yes sir had any contact with Mr Ash at all no sir all right City looks like it's alleging three violations one of 30-1 169 building fronts inside subing streets or public areas mold and mildew and deteriorating paint is that correct yes sir and 30- 32 A1 prohibited conditions and public nuisances I guess man debris in the yard is white covering for the S that's missing yes sir all right it's not rotted it's just missing missing yes sir okay got you and it's sitting on the top of the 10 roof yes sir all right and this fct is um 28 and this pict was taking 35 22 and 4 this is the right side of the house that bu faing and this is from Oak Street right and again it's just the S has fallen out of yes sir track for it yes sir okay and this picture is 2b this was taken 42 202 and4 it's right side of the house that's the same elevation the front elevation yes sir that's the Oak Street elevation yes sir very good in this picture is 3A it's mold mil do the debris was there as I said but the pi was taking 35 2024 so we looking at the at the yellow orange coloration yes sir greenish yellow orange coloration yes sir so that's the only part that's the violation is the discoloration that's only part you see in that picture this sir what's what's the cure for that violation is shown in picture 3A sir what he what do you need to do to cure that what do he need to do to cure that that's a wood how could pressure wash it so the object is to get rid of the discoloration yes sir all right next that's a this is picture 3B this picture was taking 4 24 you can see them Ming me do more than now is that the same elevation yes sir it's just green there yes the debris is gone and these pictures were taken on the same day no sir when one back up when was the other one taking on 35224 so did that wall turn green in the month no so I think that's a shade other than dat so is 35 you were there is 35 a more accurate representing Isaiah Ash Jr hearing and seeing no one we're going to find it appropriate to find a violation um with regard to section 30-1 169 building fronts and Sid of budding streets of public areas is due to mold milde on the front porch lattice work and support columns and the side of the of the porch and also on the U right side of the house as seen from Oak Street we will find a violation of 30-32 A10 prohibitive conditions and public nuisances due to the roofing s and disrepair and that s need to be replaced um we make a finding there has been um new process and that city has satisfi the requirements of chapter 162 regarding notice and posting of notice in the event of non- delivery of the certified letters we will enter an order finding violations and you wanted how much time 90 days 90 days uh we'll give the respondent until the end of business on July 15 2024 in order to remedy the violations in the event of non-compliance fine of 7 be $50 a day yes sir $50 a day or $25 per violation will acre uh each day until the par is brought into compliance I've got two dates here I got J July 15th and July 17th which one is ju 17th 17th yes this is wrong yes sir all over the porch is that total mildew am I looking at dark mil or Shadow I think that's actually wood but it is mildew on the wood is that mold on the wood yes sir and what about the columns support column yes sir and the um looks like there's a concrete um support column holding up the wood is that correct yes is all that black or is that shadow that's U molding mil so mold and M on the steps the support columns U the was like the side supports and stairs for the porch all that no so the steps are brown okay so that's okay tway this is the side of the house you can see this from Oak Street also this was taken 35 224 there a pained me do and the deteriorating paint on the chimley right can that all be pressure washed or is there pain involed um they need to remove the deteriorating paint and replace it with a on Fresh even coated paint so that side needs to be painted but not the front the chimney chimney yes sir can the wood can be press yes sir that's vinyl same for the sofit yes sir okay next three two be this is picture was taking 41 224 let they try to get they got most of the mold and me do off the side except right there right behind the chimney and then the chimney still the pain is still deteriorating so can that be pressure washed or the side behind the um chimy yes but the paint on the chimy needs to be the theer paint need to be removed and given a fresh even coat so the city saying you have to prep and paint the chimne but you may pressure wash the wood elevation seen from Oak Street yes sir okay I'm just looking at that dark extended area that's yes that's satisfied and that the owner has received the appropriate notice uh under the section 162 of Flor statutes and finding that there is substantial evidence to demonstrate violation of section 30-1 169 of the municipal code due to building fronts and sides of butting stre in public areas uh the street named is Oak Street at the front and right side elevations that are seen from Oak Street have significant molds in mildew um on the siding of the house which do require pressure washing and that there's deteriorating paint on the uh Stone war on the chimney on the right side of the house as seen from Oak Street which paint needs to be um repaired and repaint it we're going to issue an order finding a violation with regard to that ordinance in the order um city is wanting 60 days is that correct yes sir um which is now June 15th or 17th so about the same numbers yes June 17 okay on to the end of business on June 15 2024 in order to bring the property into compliance with the violation as to section 30-1 169 uh in the event of noncompliance a daily fine of $25 a day now yes sir will be imposed on the property until compliance is achieved thank you next case is the property located at 411 Laurel Street pacco Florida case number 20 [Music] 2349 owner of record appears to be Tony vetto is that correct that's correct sir and this is a case of second impression is that correct that's correct sir all right and the record is Tony Vestal present or anyone representing Tony vest seeing and hearing no one was was the owner present at the first hearing yes sir he was yes sir have you heard from him since then um I have not personally heard from him I did make contact with um I want to give you the correct name sir uh Brandy Hoffman who is at this current address um I've made contact with her several times she lives at this property she said that she is is that correct she lives here I don't know if she lives there she said she's currently the property manager for that property um she was able to give me um she didn't give me a telephone number for Mr Vestal but she did give me um an address so it's an address different than the 411 it is it is different yes but he was here at the first year he was here and you sent the notice of this hearing to the same address as you sent to the first hearing that's correct sir and youve got um no green no sign green card no sir the letter came back returned and the address of record is the same as the property location 411 r street I'm sorry that's correct now his address is his address um is legally well the green card shows you address was 411 River Street his address that is listed on property appraisers is 414 River Street PAC of Florida and that's where we've been sending all the information um well the envelope didn't look like it went there the envelope show the address of 411 River Street it's not a public hearing thank you there um I have the one that I sent I have one that says 414 I made copies um I sent several um to the property owner well the Trap the the property tax collectors record sales 414 River Street as the address that's correct sir and we sent the notice to 411 River Street that is um the the the copies that I have that I sent I sent to um the 10day compliance went to 414 River Street and I made copies of that and I believe the copy that you have may have been one that I had to resend and then I also resent one to um his address that I have currently on file um this one here shows for the hearing letter was sent for 414 River Street Okay the reason I asked the question River Street's only got one side of property on it the other side's the river right the actual there should there should be all even numbers or all odd numbers yes sir um the actual home that he that we're in we're questioning of is 411 Laurel Street Laural Street that's correct sir this he owns se he owns different properties but where did we try to get give you notice uh 414 River Street that is what's on the proper that's address that's correct sir that's say address a record well just and what I trying to get at is that we had kind of a transposition on the envelope at four it's a I try to send it to everywhere um just to try to get in contact with him I do have a correct address now and I did resend everything to the we I'm just asking did we try to mail him something at 414 River here doesn't show that okay let me put those in official record so let let the record show that this is presenting me the actual Green Card which was returned addressed to 443 River Street P Florida 32177 um and a second one also showing that in a certified M receipt from the Postal Service also showing the letter was addressed to 414 River Street which is the official address of record for the property at 411 W Street which is a subject got you all right and in the absence of getting a response did you post the property in accordance with chapter 162 I did Sir and your Affidavit of posting is included in the record correct yes sir it is okay and again you've had no contact with Mr vest not him personally no sir okay all right s go through all that I was just making sure all the records were there yes sir all right uh the allegation is a violation of two provisions of the code one of section [Music] 30171 um due to a missing window the code requires that every broken cracked or missing window should be repaired or [Music] replaced with glass it actually says in the code that's what it does say yes sir and violation section 30-1 169 building fronts and sides are budding streets and public areas rotten and weakened wood and painted or stained wood and this is all visible from Laurel Street correct uh Laurel and imit Street yes sir it's a dual Frontage property great show what you have yes sir this is going to be case number 2023 049 this is going to be a second hearing on property 411 Laurel Street uh this property was first observed on March 9th 2023 and for the second hearing the notice was sent on 48 2024 complex posting and also site posting wasone on April 9th 2024 and and you're about to show us some photographs yes sir so did you did you take the photographs person I did Sir and do the photographs accurately represent the condition of depart date in which you took them yes sir and you're going to do kind of a yes sir then and now comparison I'm going to do a then and an now yes sir please proce so this is going to be 1A it was originally taken from the first case 3 2123 um and it's going to show the broken and missing Windows there was a total of nine on the house and if you'll go to 1B please this was taken prior to going to the first hearing this was taken on May 15 2023 and uh the property owner had started to do the work and uh at this time we had five Windows left when we actually when we made it to the first hearing and if you go to 1C please the 1C this was taking on April 9th 2024 at this time um eight Windows have been repaired or replaced um and we still have one broken or missing window which can be seen from um Laurel Street do you know why the one was not repaired so there's only one left that's not repaired there's one left um from our last hearing that we had um Miss Walsh asked for a stop work order until proper permits were pulled um and work was continued to be done um and at this point we have the one window um when I did a followup so the owner was repairing the windows without a proper permit that's correct sir and the city's top Bo yes sir so there's one left to be done and that's the one with the blue arrow in picture 28 a this is 2A yes this was taken on March 21st 2023 okay and the next slide which was 2B was taken on the uh first hearing on April 26 it was showing the windows that we still missing and then if you go to 2C which is our current for our second hearing right now the top Windows um were continue to be replaced and we have one left which is on the bottom left and it faces Laurel Street and um so we have next we have 3A from our original case this was taken on March 21st from the first hearing and then we have 3B which was taken April 26 of the rotten weakened wood where they had started to replace the wood this also um had a stop work order um until he got the proper permits when I went back to do the followup for the second hearing the rotten if you go to 3C please the rotten weaken wood has been all replaced um I did check there still has been no no permits on at this time on that date or the COA at this point we don't have rotten and weaken wood but we still have part of the um 30-1 169 where it needed to be painted or stained this is a historic home and this can be visible from image street so where we are is that end of the demonstrative evidence that's that's correct this is the end of my evence we are is that of the original violations of the two ordinances with regard to the missing window there's only one of the original eight that remains to be replaced that's correct sir and as regard to the rot and weakens wood the W wood has been replaced it has not been painted satisfact that's correct sir that's all that's left has there ever been a permit for for this um as of after speaking with Miss Hoffman she may contact Mr vessel they went Friday and they started the the permits with the county I have a copy of that um Mr vessel still has to go sign in person I spoke with the county they said it won't be um active until he comes sign in person uh they did come down and speak to building and Zoning Monday yesterday so the co COA after the fact is pending okay did the city for some reason believe you needed an extra motivation in order to complete this problem with the recordation of the lean I mean do you think he's going to get it done in the next week or two well the I haven't the the the problem is I haven't made contact with the actual homeowner who he has working there is not someone that has showed me any legal and and and she's been in contact she's telling me what she's doing um she's still waiting on the property owner to come sign like she's the one doing the work and the and the permits but he has to come physically sign the the prop the stuff itself and after the last hearing he never made contact um okay with with my office I just and what I'm looking at is it's at the point when we put the lean on this this fine is is substantial since it's been acing for a year now and it's going to take some undoing if once the leans are recorded it's something that Nei you nor I can do you're okay last call for Tony vest or anyone representing Tony vest right having found the due process has been satisfied with regard to notification of the owner uh that proper posting has been made of the property um that there actually has been some work that has been accomplished on the property although no permit for any of that work has been obtained is that correct and that there is still however a violation of 3171 due to the remaining missing window which is still going to require refer to replace that's correct correct and 30-1 169 building fronts inside the budding streets and public areas rotten in weened wood the wood had been replaced but needs to be painted but that work still requires a permit after the fact permit after the fact and then um the colors um they can choose here which that was explained to the property manager right it and it's been more than three months since the order finding the initial violation back in April of excuse me oh the first case I'm sorry May 16 2023 of last year so therefore it's based on the evidence of testimony um city is entitled to its lean therefore we're going to enter an order um allowing the city to place a lean on the property at 411 Laurel Street in accordance with the provisions of section 162 for the statutes fines will continue to ACR at the rate of $50 per day per violation till satisfaction completion did the owner understand the gravity of these fines I mean at speculation on your part perhaps in terms of what's going on you're you're correct um I'm not really sure sir okay very good thank [Music] you all right final case appears to be James Marvin Mullis Jr property is located at 611 Olive Street in patka case number 202200 one um this is a case the Case Case also yes sir is that correct and this Mr Green this is your case yes sir all right is um James Marvin Mullis Junior president or anyone representing him he seeing and hearing one could you tell me about your due process yes I on this thing in case I sent a not of hear and the Green Card did come back sign and I posted the prop and also prop on posted the complex all right the green card was sent I mean the certified letter was sent to James Marvin Mullis Jr at PBX 7757 Columbia South Carolina 29202 correct yes sir and I got one here that was signed on 4124 by someone yes sir Robert okay Robert Mullis is that correct like more like a jang I think I'm sorry like more like Jane to me I think a woman s a woman's name but is someone named mullus at that address yes sir it's yet the printed name looks different than the yes sir but the Postal Service put that in there so they apparently didn't F the person as a molus yes right did you post the property yes sir and did you put your Affidavit of service in the record yes sir all right other on that side of the house is in the yard and it's facing that way so you where were you standing when you took this phot on Olive Street okay so where's the front face the last picture I'm sorry the last picture Okay so that's the all Street elevation yes sir it's got molden Builder which hasn't been addressed yes sir all right next this is picture 3C it's picture 410 2024 still has the m in Middle same elevation yes sir seene from Olive Street yes sir more more than M do this is this 1410 2024 is when the picture was taken and the violation there is 30-1 169 yes sir and this is taken from all of Street yes sir this is the overgrown brush this picture was taking 119 2022 the house is actually under all that overgrown grass and brush so what what needed to be done was what get remove the um grass and the overgrown brush off the house yes sir um what along the side of the house with the fence at anything that's over 18 inches need to be cut down and removed okay next this is a recent picture the pictures 5c taking 410 224 and the house is still covered we overo grass and brush it shows it cool on the side of the house yes all right next that's that should be it so has there been any work at all done in this house since in the last two years no sir and you've had no contact with anyone regarding the house in the last two years no sir all right last call for James Marvin Mullis Jr seeing and hearing to one and finding that due process has been satisfied in compliance with requirements of chapter 162 and that notice was given uh to the property owner both by certified mail with a green card returned by the Postal Service showing um the certified letter was received at the official address of record um by someone named Mullis and that the property was also posted in compliance with chapter 1624 statutes and that the violations the three violations originally alleged of 30-1 169 building fronts and sides AB buding streets or public areas due to mold and M they visible from Olive Street 30-32 A10 prohibited conditions and public nuisances Roofing this repair showing that the roof is in a substantial state of disrepair with sizable portions of the roof having um caved in and section 30-32 A2 prohibited conditions and public nuisances overgrown grass and brush vegetation grown up on the sides of the house uh and and fills the yard up above the fence line and needs to be removed from the house and maintained at a level not to exceed 18 inches none of which has been done based on the evidence and testimony we find it appropriate to uh enter in order gring authority of the city to a lean on the public records with regard to the unpaid fines fines will continue to acrew at the rate of $75 a day is that correct yes until satisfaction of
