meeting was provided by resolution of the municipal Council adopted on June 13th 2023 setting forth the schedule of meetings for the year 2023 2024 set notice was published and posted on the city hall Bulletin board by the office of the city clerk please be further advised this meeting will be conducted in person the zoom stream provided is for viewing only and is offered to the public as a convenience on May 8th 2024 public notice and zoom instructions for this meeting were published in The Herald news and posted on the city of Pake website at www.city of.com Council agendas us in the decisions that will take place this evening in your beloved name we pray amen United States of America to the for it stands one nation God indivisible with the council's permission Mr Mayor what a pleasure to see you um may we impose on you uh for an update yes president today they held the blue mass in Patterson New Jersey at St John's Cathedral to honor the lives of all the officers that have passed away in our County from County Sheriff to Municipal officers I was uh specifically touched as they also acknowledge the passing of our own officer Brian Laura and his recent passing uh my nephew and chief Guzman was there with the police department and the sheriff's was there as they are recognizing the loss of pay County Sheriff Richard Bernie I take this opportunity once again to thank everyone who has reached out to my family during this most difficult time but the mass was a beautiful Mass with the bishop and the priest there and all those who came there was lieutenant governor tahisha attorney general placton Congressman pasc elected officials from all over came to uh honor those who have lost their lives council president here in the city of Pake members of the city council I Shar that starting June 1st we begin an initiative with our police our code enforcements and our health department to address the unregulated and unlawful selling of food on sidewalks in the city many municipalities took a very strict approach immediately after the pandemic in 2022 in our city we we have tried to work with those who were struggling and have given a grace period of two years however last year we began informing those who were selling without permits on the street that they had to cease and desist and we created working together a permit program here in the city that any one of them can come and apply for a permit it has been over a year that we've done this initiative and there are still some that are selling food on the streets illegally and they're selling seafood and fruit and meats and the challenge with that is because it is unregulated and the health department doesn't inspect it if people get sick there's no one to hold accountable our first concern is obviously the public health concern if individuals are buying food that is supposed to be refrigerated or kept or prepared in a certain way and individuals are taking advantage of not having to go through the law circumventing the law they may be putting children seniors those with compromised immune systems and the regular public at risk council president members of the city council the other concerns and we will share is uh unfortunately this is unfair regards to the market in Justice to those who are doing everything right if a business takes their permit out and gets inspected if they don't prepare appropriately our health department closes them down if something is wrong and the food goes bad they're held accountable business owners are saying we can't compete with those who don't have to pay for permits and don't have to worry about inspection or refrigerating or making sure the food is all right so they get to lower the prices some of these individuals have become so Brazen that selling the same product in front of the store that has that product selling it right in front of them at lesser prices as again we've tried to work with them we've designated two areas where they are allowed to sell they've been consistently going in areas of main have Market Street Monroe Street and Lexington our chief our code officials have been going out to inform them beforehand as we always take the approach of trying to educate and inform first and letting them know that there will be Zero Tolerance beginning uh January 1st by zero tolerance means your product your produce the foods can be disposed of on the spot any truck or any vendor that's out there your vehicles can be told we've had reports of individuals now coming from other cities and even from New York and setting up their unpermitted food trucks again without any health inspections and just selling the food the other challenge I'll share is more of a concern of quality of life and cleanliness when individuals don't have permits and they're out in the street with these food trucks or these uh hand trucks they're dumping their grease right into our storm drains right into our inlets right on the street this results in sometimes Vermin coming up from under the streets seeking out food sources and we've seen an increase and then of course there's littering because they're setting up anywhere in the city so though we are considerate and concerned collectively as Government I often speak with my colleagues on the council about trying to do everything we can and give the benefit of the doubt some people have come back if you indulge May bit and said well some of these individuals are just trying to pay their bills some of them are single parents they've had losses but I will respond and I'll say it publicly how about this single mother who's a waitress at the restaurant and that restaurant is going to close because they can't compete with those who are perit what about the struggling single parent that just opened up a business and did their inspections got their permits invested their money and someone is selling right in front of their business the same product at half the price because they don't have to do it right that if we're going to be compassionate we have to be compassionate across the board we understand that there are times like holidays when people go out let's say Mother's Day or Valentine's and you see these buckets out in the community of people selling roses but I've had businesses come and say mayor my I'm a florist I did it right I got my permit I I don't even put all my flowers on holidays because there's 10 people on my block selling flowers for a dollar and I invested my money for my business so we want to take a balance approach we're not trying to stop these individuals from being able to do business we're telling them go to the clerk's office get your permit and we have a location for you to go I share for those online who need the information and need to understand where to go it's 3:30 Pake Street at our city clerk's office you can come in and apply for these permits I also wanted to share with the public as is every year in the winter our roads we take a toll because of the snow the dropping temperatures sometimes when it doesn't snow freezing rain and there's a need for salting of the roads and that deteriorates a lot of the roads and then in the spring we we have to pave them fill potholes we do it every year and this year again we're beginning in the spring to do the roads U Mark Watkins from our Department of Public Works is here and we've been filling potholes throughout the city but I'll go through them quickly starting in April and all the way through August we will be doing Third Street Summer Street Park View orth a Donald a ball a reand a over a a street murle Pin Street Third Street Exchange Street Chestnut High Street Myrle a all the way up to Oak how AB from MAV to prospect to Grove Street Henry Street from MAV to mle a Market Street from South Street to marro Street PAB acre gab intersection including a traffic signal installation PAB Prospect Street intersection uh additional Ada ramps or uh Americans disability acts that's the uh Cur cut in order to make access for wheelchairs rectangular flashing Beacon installations Pennington Na and AC ab acri ab and an installation of a traffic signal hope ab and R Street intersection rectangular flashing Beacon installation main a acre AB sidewalk improvements and American with Disability Act compliant ramp construction the same for main a Westerville Westerville Park Park a sidewalk Park and a this is millions of dollars of improvements through grants that we apply we uh schedule these every year but I want to give context every year after the winter we have to address but we've been doing Pooles throughout the city and we're going to continue to do so upcoming events our Memorial Day Parade ceremony will be Monday May 27th our Memorial Day Parade will be Monday May 2 7th it will begin on Lexington beginning at Highland and at Armory Park I share that we put up our Avenue of flags again this is our second year we've received so many calls and comments of individuals that are appreciative as we honor the men and women who have died sacrificing for the Liberties and freedoms that we enjoy each day in this great nation that affords people the opportunity to speak freely to share their thoughts thoughts and their minds where in other nations some people cannot do so freely so we thank those who have died and given their lives we have the Avenue of flags at Armory Park on MAV and on Pake Avenue in front of Third Ward Memorial Park the grand opening of the VFW also will be this weekend and then Sunday June 9th we will have our tire recycling collections often around the city we have seen where individuals leave their tires out on the sidewalk we have partnered with the county where we have a collection anyone who needs to dispose of their tires can come by by city hall and drop them off and the county will collect them and take them out we will send out emails post them up and send them to the council members to ensure that we can get them out to their Community recently we were awarded the NJ doot 2023 local Aid Safe Streets to Transit and local Aid infrastructure Improvement for our project it will be awarded for the upgraded traffic signals on acri AB Pake ab and the ADA compliance sidewalks at Prospect Street Gregory Avenue and Pake Avenue just to give a little bit of context on there we don't arbitrarily decide where to put traffic lights we don't decide in silos let's do a a ramp here or we can we do traffic studies when we receive information whether from a council member or directly to the office we speak to our police chief and they put out what we refer to as a speed study it's a machine that monitors the velocity of vehicles going down we have our engineer come and do a study then we take that data in that report and we determine the best approach in order to reduce the speed or make the area safe and then we submit this and apply it the state recognized our efforts our most responsible and pragmatic effort to improving pedestrian safety and traffic safety and awarded us a recognition for this work so I want to thank the business administrator the police the engineer council members who call and identify areas in the city for improvement because together the city continues to be recognized on the state level ongoing City projects are cdbg storm and sanitary improvements we have added three manholes on Central AB from Burgess place to Harrison AB to be replaced this week with brand new ones our Columbia ab and Jefferson Street parking lot PSG installed new service poles and contracted planted trees Landscaping and the final electrical service connection is pending that is the last item on Gregory Avenue we have a sanitary sewer between Krueger place and B's Place being replaced and then if I may conclude with this and I think it's important because council members have expressed their concerns so have residents me and the business administrator took it upon ourselves to have a direct meeting with the representative from PSG they had requested for our Corporation to put up all those new polls around the city and to do work the sidewalks were opened up and neighborhoods obviously were inconvenience for parking unfortunately as we have been traveling around the city we've noticed that the sidewalks that were there were replaced with dirt patches they have not come back we had a very Stern meeting with them this week and they have assured us that they will replace and return every area uh to what it looked like beforehand obviously in residential areas where people pay to take care of their sidewalks and where the city has worked so hard to try to maintain our sidewalks the other concern is some of these polls seem to encroach a little bit more than the previous polls we have addressed them and asked them to give us a detailed explanation by encroach means the there the original PSN poles were closer to the street on the sidewalk some of these are closer to the pathway of those who are walking now they're much taller they're much higher they tell us ster but we have asked for a full report so it could be presented to the council for the next council meeting council president members of the city council city of Pake and those in attendance that is the extent of my report for today thank you sir thank you very very much I was listening Street after Street after street that you mentioned I is there anything that we're not repaving we trying to cover everything but I think it is important for the public to understand because they're not always as privy to information as us the life of the street when it's paved and cleared is 10 years so usually we do a street and for 10 years we're good we pick the streets that are in the greatest need and then we submit them to the engineers in order to have them confirm and address issues and then we try to line it up with any additional work from utility companies so for example if we're going to pave let's say right here a William Street on May 25th but we hear that on August 1st PSN is going to open up that road then we go we can't do it right now because it's going to be a waste of City resources or grant funding but this year we're doing a lot of Roads because through great relationships in the state through our assemblymen relationships with our governor with our legislators we've been able to receive more and more grants that assist our city in terms of infrastructure repairs and development so we're extremely excited and then today we've started to work on the bridge right on um I believe it is on Benson right on Benson yes there's a lot of work being done tremendous amount there it goingon to be anywhere to park when all this stuff is going on there hopefully hopefully I think it's Benson and Tennison they were doing the work yes this is just amazing I think it's brings a new face to the city on something that is so very important um in terms of convenience of residents and convenience of business tremendous ACC um members of the council any questions for the may this time yes I I I have a question um sorry so um May thank you for your report you were mentioning about um how we're going to have um those unregulated sellers um you mentioned food will that also be for anyone selling Goods great question councilwoman yes it is both food and goods and for the same concerns um not so much in terms of dumping grease but some of the items that are sold sold sometimes the quality of the items they can also have an effect you put on a specific chain and it's false and it leaves a mark you get a good that isn't regulated and it backfires or may cause a fire in your home because of the way it's created and also it's unfair you're standing in front of a store that has gotten its permits invested in doing things right and you're selling merchandise right in front of them again we've opened up locations our our approach is not to stop individuals we appreciate your entrepreneurship your ambition you want to progress but there is a process and we've made it so much easier for anyone to get a permit if you come to the clerk's office if you follow rules you're going to get a permit they'll identify the location I use this as an example for some who say there are not a lot of people there for the merchandise councilwoman when we decided to make Madison Street food truck roll we started with one food truck and people said no one's going there now we have 10 Madam cler we have 10 applications that have been approved now right yeah we have 10 trucks and everyone around goes after work in the area because they know that the food is there so we take almost the uh Field of Dreams approach we build it and they'll come so we're encouraging the individuals if you if you follow the process we've done our due diligence we studied people will go there and they'll be able to purchase items from you ma'am this is we don't shout out during Council meetings I'm sorry there so yes councilwoman it includes merchandise goods and materials for many of the same concerns as well as Public Safety when it's unregulated sometimes the things that they sell can be items that can harm people can be weapons or can again malfunction and cause an issue in the home electronics or things of this nature and then you can't hold someone accountable if you go back next week and you can't find them because they're not there anymore thank you thank you ma'am any for and they sacrificed their lives so that the constitution could be born 1787 the first three words of the Constitution is what we the people yet it still feels like we are not the people community members come here and explain to you guys that there's a struggle that there's an issue and you are either dismiss it change the narrative or just do what they say is an issue to make yourself look better undergrad in college I learned people first people first above all things we are all human beings no matter what we've done that was a mistake or something that we've done that was wrong yet I feel like people don't at least you guys because you guys are in a different seat here where you understand how to treat people how you should be carrying yourselves in this community you have an ethical conduct that you should be following however I don't I don't feel like you guys are following that conduct you when you were sworn into these seats I'm not like you much smaller than you however in order to get anything done in this city it's a fight it's okay I'll accept the fight my ancestors fought I will fight however when you say that people don't care you sat you said as far as doing it right for the license and I'm going off topic on my what I literally wanted to say but literally there was a member of the community that came here and told you about the people selling things on the streets like that and you skewered him you skewered him dismissed him and acted like he was delirious in what he was saying but all he did was come here and express a concern you have community members coming down here expressing that we need mental health resources for community members you know people don't walk around and be crazy just to be crazy it's got to be something creating that crazy I learned the people first method from my forensic psychology like my forensic psychology professor and it's just like you know when it comes to mental health is very important but as far as like Laura I feel like you do too much you do a lot of good yes sorry for your lost too I was supposed to say that before I started to get into it but sorry for your loss but you do too much you do a lot of good yes on the other hand I feel like you do things that are not ethical you put your hand in places where it shouldn't be I I go to the Carney brag Park the same park where you publish an article you have one minute man to publish the article to demean these people and and degrade them you're literally judging people and that's fine judge them but you're not God you don't tell people how to live last week 13 people were arrested we have videos many videos of the police coming down to that area literally criminalizing Community the whole entire Community though so I guess if one then all but that's not fair the people going have at the park Carney P brag park where you want to put your concession stand so that you can fund the BFW I literally gave you a new spot BM Street in Main Avenue it's a desolate spot there where you don't have to take the community members out the park and keep criminalizing them having cops RAC profile them thank you for your comments man G time is up right anyone else like to address the council please you don't have anything to say regards to my comments no ma'am we do not not when you say things like ethical conduct is flawed and you're not following after some of the comments that you made I don't think that any of my colleagues uh nor I would want to respond to you they are unfounded they are with misinformation they are and one which I know personally I applaud the administration for is there anyone who would like to address the Council on this item there's a motion to close public hearing and there is a second roll understanding that a bond ordinance requires five affirmative votes yes very good and we are uh we have a full Council here including councilman Garcia who is uh getting all the sun waves in Puerto Rico I believe uh we have had public hearing is there motion to accept there a light yes I'm sorry there is a light on yeah thank thank you just regarding this ordinance I know we we spoke about this at the last meeting um in terms of getting some type of the bulk of this this bond is for the parking stack right the whole B okay so just understand financially um how the city is repaying for this Bond um and to understand better also what the projections are in terms of the fund uh the the income right the the uh uh from you know the parking spaces you know based on I don't know what it's based on terms of certain percentage of occupancy and rates and so and so forth oh no yeah I'm just Mr Fernandez okay um yes councilman so this ordinance is also attached to resolution 34 which is the lease agreement between the city of Pake and the parking authority in the lease agreement it states that the parking authority would manage and maintain the facility and would pay the city uh rough $250,000 to be used to repay the debt um additionally we did the math right now I'd like to say that Fernandez if I may interrupt you forgive me that's $250,000 initially per year per month it is so the Way It Was Written because it's directly tied to this bond is the payments begin the moment the bond is issued and the payments end the moment the bond is paid off so every year every single year and every time there's a payment from the city of pay to for the bond it is accompanied by a payment to the city from the parking authority to pay that Bond so the city does not have to take it out of the city coffers thank additionally financing was obviously very important not just to the city but to the parking authority as well um as the city council may be aware the parking authority paid off their 3 million doll Bond and can pay off this lease payment with its current Revenue which means if this parking deck made zero dollars the parking authority can still pay the city for the deck now obviously we want to know well why would I build a deck and not give us any money so we did a projection if you excuse me because I can't see anymore based on the current hours of operation that the city has for metered parking it is between 8:00 am and 6 PM leaving the fee exactly the way it is without the city charging any more for any meter and anywhere in the city of Pake it averages out to $7.50 a day that's our daily rate the parking deck is going to have 310 parking spaces okay so if this was 100% occupied during those hours it would generate $669,500 um for 48 weeks right so what we did is we did a very conservative approach as the mayor discussed he wanted a very conservative approach so that there's no confusion that we're not going to hit this we did a vacancy rate of 50% that means half of this building would be empty during the day and that would the anticipated Revenue based on that uh vacancy is 33 $334,800 now additionally um the mayor had proposed in this Council approved overnight parking for residents right because as the council knows or the public might know um not know our public parking spaces were not allowed to be permitted to park overnight now with this permit you're allowed to do that in this main Central business district area um the fee is roughly um $300 annually right so taking again the same vacancy rate and number of spots which is the 310 spots with a 50 % vacancy rate that leaves us with 155 spaces roughly that would be rented overnight which that yielded an anticipated annual uh revenue for permits of 46,500 that leaves us with a total annual anticipated revenue from the deck with a 50% vacancy rate all day from 8 am all the way overnight to 8 am the next day of $381,500 at a 50% vacancy rate under our current agreement with the parking authority that would yield an additional $190,600 to the city of Pake above the $250,000 if the these numbers happen as they occur which as you can see it's a 50% vacancy rate um as they occur the city share would of just the deck not counting the share in the rest of the city just for the deck would be an additional $1650 um that this parking would yield additionally for the city of P under the current arrangements and the maintenance and operation of it is the responsibility of the parking authority and the city maintains ownership of the deck so contrary to the last Arrangement the parking lots were owned by the parking authority that's why this is a lease because the city of Pake continues to the and can count that as an asset hopefully that answered all the questions and it answered hopefully 34 as well when I look to do my next investment Mr I'm bringing you with me especially one having anything to do with numbers or Atlantic cting oh I am telling you no you know better than tell me about numbers with you so I appreciate that what president councilman monk the number of 50% I mean it's a nice number is that do we look at other municipalities that have parking decks what their actual occupancy is I mean it's a nice 50 sounds good sounds conservative maybe the number is 30% 7% I don't know what it is I have no clue what it is I would highly doubt again I see where you going with these numbers I highly doubt again I hope I'm wrong that 150 people gonna Park to every single take these month hours again it's possible I have zero experience in this I zero knowledge of it but what are we basing it on from other realities other people that have built these type of things and this is the type of setting this type of community that's I think the challenge when you ju toose one municipality to another is to ensure that all the factors match up we're not comparing apples to oranges so considering the location of this parking deck and as stats have shown to our census track it's right by our more densely populated area in the city obviously that's why we did a conservative projection parking is at a limit in the city and especially in this area it was one of the determining factors in the application to receive the award to create the parking deck so we know that there is a great need but as you've mentioned it's a projection we're we're hoping to see it full we cannot guarantee that it will be full but again that's why we went with 50% we feel that that's an extremely conservative estimate because of the need for parking in this area I mean we have seen look just to give some perspective individuals are parking in our city Lots without our permission overnight because they have nowhere to park they've come and offered money to the city in order to use the Lots so we know there's a need but again we won't know until it's built there's there's no one in the administration or any professional that's going to tell you they can guarantee you 50% of the people or 50% of the lot will be full but we do feel considering the other lots and this is a big lot 310 spaces every lot that we built has been full we haven't had an issue where someone has come back and say this is a waste of a development in the city so we know that there's a need in our city we also want to point to something that perhaps people don't always realize though our census didn't show a drastic increase in population we went 2010 from about 70,000 to 2020 70,500 but a couple years ago the state of New Jersey chose to allow everyone to have access to driver licenses good thing whether documented or undocumented so though we may have not seen a boom in population we saw a rise in the number of vehicles on the streets individuals who in the past may have not had access to insurance and vehicles now did we saw many more vehicles in the streets and considering that perspective in context we know that there are many vehicles in the city so we do believe that there will be a benefit the use in the day because of its proximity to some of our schools to the commercial area and we constantly get requests from our businesses can we pay for parking during the day we believe again that this conservative estimate may have been very conservative we expect it to be over 50% but council president council members there's no one who's going to guarantee it but we do believe because of past development because of conditions that have changed because of around in numbers of vehicles and access and its proximity to our schools our main commercial area as well as our most densely populated area in the city we are confident that this Revenue will come into the city the lots that are full you know that the city has built are they metered or is it free parking these lots that are full no they're they're metered per met permitted so if they're not metered they're definitely permitted and I was just going to just add on to the mayor's did an analysis of our current loss and uh most of the day they're at 100% And roughly when we do the math of the whole day we're in the very high 90 percentile of occupied in addition I think it's important to note with the new bus terminal that's we're going to lose the island right here next to this parking deck so the amount of spaces which I believe that's the biggest island that we have or one of the biggest how many spaces in that island so that Island has a roughly 55 spaces so that's 55 spaces that is always full which is going to be gone with the bus terminal where their best option will be that parking there and that brings a new clientele that is the commuter so again that and just so we're clear that didn't include any permits or ordinances that we may pass for commuters or the daily passes for you know School teachers that's why we feel that this is an ex extremely conservative Approach at the 50% and when you're looking at all our current Lots in a vacancy rate of sometimes less than 3% in some of lots you know we feel that the 50% is uh significantly conserv so the goal would be I guess being you want to be a community lot right with the bus station to offer day not only night passes but to offer day passes as well those are conversations we would want to have with the Council depending on the need if we see that there's a an increased need for commuters wishing to have parking because one of the issues in the islands was that many communs were going in and then taking the bus or taking the train and leaving that that might be of a benefit to consider for the council moving forward right because right now all the meters are two hour limits right so if we simply say for the parking deck it's not a two hour limit I mean a computer is only paying $750 for the day so that would probably probably break the record for one of the cheapest commuter parking lots if we left that at 750 but that's what I'm saying like this 190 is also conservative because we also didn't include other passes and things you would do for a Deb teachers passes business pass which already exist today that's already been passed by the coun if I may forgive me uh councilman colon Monas um definitely is better than a ticket the price and and I truly believe that you will have it pack during the day when you come to the Board of Education in the morning the middle to8 not even oh if you're not there by quarter to8 you're not gonna find a parking so I've gotten to the point where I have my husband drop me off because you'll spend at least an hour looking and we have a deck and that's full and it stays full all the way into I'll attest to that also that it usually takes me 15 to 20 minutes to find a parking space I've debated walking it's step out and also for the econ IC viability of the stores when everybody's when you have the extended parking in the deck now that allows more of a turn around which I know the man brought it up to me that he's getting a lot of questions from businesses about their their consumers being able to find parking but even with almost the most dire awful scenario we still walk out okay councilman monk yeah so I did Le through the the topic whatever was available in in the uh resolution 34 so so the city's going to own this deck the city is going to bond for it but the revenue is going to the parking authority the parking authority is going to pay the city a fee a yearly fee $250,000 a year but you're you're missing the existing shared service agreement so we tried to keep this as simple as humanly possible for the process we're not changing any of the process that was done originally with the parking deck with the exception that the city is keeping the deck and bonding for it right uh other than that all the payments and the shared service agreement is all the same so what's happening now is that $250,000 that we're we have that we were paying into the the other Debt Service was going into trust accounts to buy more meters and things like that and then what we're doing is budgetarily instead of putting it there we just put it into another Debt Service so the city isn't wasn't getting that 250 because I know where you were getting at with the with the shared uh Revenue no that's 250 was already part of the parking authority they're just transferring where they're putting it to pay that Bond the shared service agreement which currently exists which we don't need to touch would Grant the city the same share they always got and because you're getting more revenue for this deck we're estimating on a very conservative approach that the city's going to make on top of everything they're making now and keeping a deck as an asset you're G to make an additional 00,000 I'm not following I'm missing is what is that shared agreement every for every $10 that comes in that comes into a meter right right now what is that shared agreement with the parking authority $10 comes in how does that $10 get split up so the way that the agreement works right now is that after expenses right so if you recall when the parking authority was first created all the parking enforcement officers some of the traffic police is kind of a shared service where the parking authority pays the city for those individuals so that the city doesn't have to pay for it so that doesn't come as part of the shared service agreement uh the revenue share agreement it it's part of the agreement and then after those expenses and buying the meters you get 50% of that Revenue split so that the parget authority can continue to operate and the city gets back their revenue okay so and that's original from when the parking authority was created and we're not we in this case it it just worked out so perfectly the Stars aligned right Mary when I was like well wait a minute that's what the parking authority already had bonded the last time they could make the payments without any additional Revenue so this is very rarely when you see a project of this magnitude that you can have a shared service agreement where it's only more money right because of the great work on the grants that were provided mayor with the $10 million and I'd like to mention that in this Bond I don't know if you noticed $475,000 of dollars of that is coming from the payment in L of parking for all the developments that are now paying into providing parking for the area but so I don't want think oh I'm sorry I I can get off I'm excited about this so I I can get off a little so so again so we the bond is what a $14 million Bond No 10 mil was it no 3 million s was three million the rest is funded through this everything is funded through grants or trust accounts that we've already built up through payment of other sources not taxpayers okay so we have the bond what what benefit does the parking authority give us those of if we we're we're building it we're bonding for it if the city itself kept it let's say right and we just took all the revenue right what what do we benefit by giving the Parking Authority 50% and I understand there's a plan here we're having a parking authority and they're having more money giv them the ability to do more more parking within the city right but they've done they've been doing a great job until now with x amount of dollars right with this parking with this park parking garage let's say we're going to throw them another $300,000 a year okay $200,000 a year right who needs that More Money More is the parking authority need more or the city needed to cover our expenses the increases of salaries and insurance and so on and so forth I I get the plan but if we are building decks and creating more Revenue right who needs that money more this the S of parking authority has been doing a great job they've been covering they paid it back all their bonding they paid down right do they need that extra $300,000 or do we need it to keep our taxes in check that's so you're missing the expense yeah that's right you're missing the expense of maintaining and operating the deck the new deck but but they're paying for that regardless you're not paying for the bond so you said the city is bonding yes but that debt payment is made by the parking authority not the city so the the parking authority is paying you that you don't have to pay for it so that 300 000 that you would have made in debt service payments you're putting it back into the budget to reduce the taxes where otherwise you would have had to pay that as part of the budget in our Debt Service as part of expenses councilman and and I believe the question is specific if if we receive the full portion that the full portion would be the benefit I'm sorry I just want to be clear on the question because I think the business administrator answered it clearly I just wanted to make sure that no details missed if we take on the expense would we still be receiving 360,000 if we have to pay the expenses for maintaining the deck no because remember the the the individuals who have the staff and is paying for the staff is the parking authority so the city doesn't have to pay so it would be our stff so we wouldn't receive $300,000 if we're using round numbers if we're splitting 50% the 150,000 doesn't go to the parking just to keep it they use it to maintain the parking deck if we eliminated the parking authority then we take on the cost to take care of it we're not receiving 300,000 to pay off insurance we would be paying a portion cover the way it was laid out earlier we're covering that cost regardless because the the 50% that we split with the Parking Authorities after the expenses of paying all the employees so after the employees are paid out then there's a split of 50% Parking Authority 50% the city now I get I understand why we created that parking authority initially but now as the city has been growing and and under the mayor's initiatives we have doubled Tri whatever the amount of parking spots it comes a certain point where the parking authority doesn't need so much money it's been a profitable Venture it's great to the point that we even pay down all the bonds but also gets a certain point where there's additional Revenue we need it to keep taxes in check there's a limit how much money we need them parking and I think that's a good thing that we own it so I think it's a good thing that we own it because if in the future and the wisdom of this Council and they choose to Simply break the relationship obviously things are paid we own it it's not like the islands where where we don't own them go to the parking authority in this agreement it's leas agreement for the parking authority but the city still owns it I don't know if we would agree I think it is a good perspective that state whether right now we feel that without the parking authority it would be the most pragmatic approach to to pay this off ourselves and not there there has to be a benefit to the parking authority if you read the resolution 34 all right it says the city desires to lease the property and project to the city of faake parking authority with the exclusive right to operate manage maintain the project in exchange for an annual rent payment of $250,000 so like sounds like it's a win-win like you're giving us $250,000 and you're going operate it for us I mean great give us you know keep doing this all day off right you take care of it you pay us to take care of it right they get money and they get money so there's obviously there is a benefit that's the 50% of the sharing right the agreement question again if if we will be 90% full right then we're talking about a revenue of $750,000 instead of $390,000 that's an additional $3 $400,000 maybe we need it to keep our taxes in check and the parking authority needs it that's where I'm going with this we would be able to assess that at the end of a couple of years at it right but this is the resolution 34 is a 20y year yeah L of the bond so so maybe we need to amend this 20 years saying or put leave it 20 years but we have a right to break this with you know after two years after pay of the bond before the P the bond with our bond it's not their bond then then you're then and with all du respect then president you can't break a bom not the bond No break this agreement with the parking AG let's break the bond I would think I would think that that would have considerable effects on on the city's rating and would require an agency the city has a great rating the city could is our credit not if you're abrogating what you've not if you're abating tomorrow that what you've established today no this the the city has no problem bonding the cities our bond is very the amount the Mone we have we borrow is very low compared to other municipalities we're good there question and we're bonding this regardless question is are we sign a 20-year agreement with the parking authority 20 years to give them the right to the revenue of this parking before before we go on to answer that councilman love please your Li is sorry okay I'm terribly sorry the council I thought was on I wanted my point here is that if this thing becomes a cash cow as you know as councilwoman mentioned that be 90% full 95% full they could be additional Revenue 3 400,000 a year I think the city needs that money to cover our increases more than that parking authority needs cash that's I understand that perspective I would say that the the services that come from the parking authority do directly benefit the city so it isn't that the money is necessarily not going to the city it's going to an agency that serves the city so we would be glad if we had 90% 100% full but I think it becomes um I don't want to say subjective but whether or not more Revenue to the parking authority is somehow less Revenue to the city it depends on where you want to allocate the funds I I can make the argument that any Revenue that's going to a different service could go off to pay off debt to Insurance whatever obligations we have but then we have to consider whether we're going to lose additional Services I think the parking authority whether it's parking enforcement whether it's maintaining of the meters whether it's considering the impact of 310 vehicles that might fill the parking deck or potential uh Innovative approaches whether this Council comes up with a new idea for parking and the parking authority is now in a better position to bond for more money because they have revenue or to employ more parking authority enforcement or whatever issues it may come up but if if we don't meet the obligation in terms of the 20-year contract and I think it's a good lease it's my opinion because we're still owners it puts it in the hands of perhaps legislators and administrators after us I would hope we're all still here 20 years from now it' be great but it does give the opportunity for that to be considered but right now I genuinely believe that this would be the best approach going back to my point is is that the parking authority definitely benefits the city of Pake and the residents yes by the funds coming to the city as opposed to this to the parking the city could do whatever else with the money you could do the same thing that the parking authority was always doing he could buy more meters they could buy more you always do the same you're not taking away any Services that's why we created the parking author so they could do it correct there was a the main reason why it was created so there could be additional bonding and so on and so forth that was really the the the initi why initially it was done that benefit but now I'm saying is we're getting into serious parking decks and serious potential dollars right there's a limit what we need for parking decks and we could if all this money came to the city we could always push the money back to the parking authority by what's what's the likelihood that that would happen Council well based on what I'm hearing that the reason the Reas the reason I ask is I can cite you without naming names for obvious reasons but the conclusion of this meeting I'd be happy to site with you municipalities which established Parking Authorities diverted the funds from the authority to other causes the bottom line is the authority one particular one which rings in my mind which is very close to this city went bust right because of because of that I think that there's nothing which would preclude the Housing Authority paying for items that the city would have that would normally PID be paid for by the city they could be paid for by the authority but it does give another basis of control um and does welcome the input of still yet another public body to weigh in on the the efficacy and the desirability it would seem I if I may I I think that's an excellent point I one that I think it's something that was in the back of our minds that we wouldn't have considered that way council president you correct and I think the word we use it provides checks and balances I mean we could reinvest into parking authority just say that we guarantee that the legislative body here would if if it becomes funds that we can determine to use what if we use it for things that we don't necessarily need what if we have a council that says use that money for any program parking authority Revenue should go to help additional parking initiatives and for maintaining parking and we are receiving 50% but I I would ask also if they didn't have a contract or at least what's what's the reason why the parking authority would partner with us it seems like we're just using the parking authority if they're going to pay off the bond if they're not going to receive any revenue and they're not going to get at least for 20 years then it looks like the parking authority gets nothing then that's cool the parking authority is the city just a different different then make the rich argument is a city they're getting point but but it locks the money up in a certain thing and if we're concerned about down the road that we're better off locking money to the parking authority because we don't know who's going to be sitting here we have a bigger problem because whoever sits here controls $80 million not 300 not $300,000 hyp as you giving hypothetical we have bigger problems you know what I'm saying no but it's it's a hypothetical and a factor to consider as you stated what what if we could use the money for other areas that we might need but the checks and balances I think is a good argument to have a different agency where the money is specific for parking authority maintenance so that that goes back to how much money does a parking authority need okay in other words if the parking authority has has flushed with money okay you might see people for the parking authority driving these brand new cars it's great while the city needs a cars for police police cars I'm just giving an example glad you brought that up all the cars that traffic and the um the parking enforcement uses the city doesn't pay for them it's paid through the parking author the parking authority pays for all those Vehicles which then you would have to pay for so and I'm sure the parking authority could pay for things like maintenance of parks because they're close by commercial area just maintaining the Lots themselves right that the mayor just said the pavement is every 10 years that imagine a parking lot that's used all that time and right now we're lucky this is a brand new deck but the expense to maintain a deck after a handful of years is significant right mon if I may forgive me you and I I don't believe councilman Garcia or councilman Schwarz I'm not sure but you and I are the longest serving members of this Council and we have indeed seen things which would be Indescribable right to our history to things to misspending and to difficult things that the city had so I'm not so sure that I trust the future anymore than I trust the Pres I want to rest my case here okay and move on but just just to close okay is that if if the issue here is to lock money to a parking authority because we don't trust what's going to be in the future we have a bigger problem because that's not the issue okay that was just a response to one of the concerns because the council president's point of checks and balance where the parking authority may be limited and what the revenue could be used for the city may not so that's just one yeah you know the last 100 years the parking authority all the parking was done through the through the administration and the city council Okay the reason why you was separated out as a separate entity was to be able to do so so forth it wasn't because we need checks and balances do check it's the same people is wearing different different different so all my point was is that now as we're getting serious into parking and there's serious dollars potential dollars here not to have the money locked into a parking but have more access to it if we need it to do other things in the city that's it believe that 10 years from now I will be watching television and you will be on it making the case for it and I believe that your colleagues at that time will gleefully vote in your favor um item 33 resolution 33 um it's actually a proposal to reject um Consulting Services just curious what this consult Services is for so the reason we're rejecting The Proposal is that we only received one bid response and it was not done correctly so they failed to be responsive under the local procurement laws and we have to put it out again okay thank you um item 35 resolution authorizing the execution of a lease agreement between the city of p and New Jersey Transit Corporation for the P train station property okay so our lease expired with them and as you know the has been a big proponent of trying to get it you know redone to give it some kind of better character so this lease agreement is going to allow us uh to enter into an agreement with New Jersey Transit and then put out a bid for a vendor as was done in the boat house and in D the island and palaski park and uh not far from um the train station to be a another amenity for the residents I think in this case we're trying to do something that's more dessert based right mayor because we have food you don't decided to do something that is exclusive and does not compete with anything that is already exist right so that's our goal so after this happens uh don't be surprised if you see a another resolution for bidding out for the vendors of this location so we we had at least with transit for yes we actually used the space for recreation so so we pay the same rent base rent yeah we don't pay rent well it says here it's a dollar a month I just I don't ever see on the bill list ever a dollar payment to we'll have to go back through the records to find the dollar a month and pay we assure you that we are meeting our obligations if if not we'll have the have the bonding Authority couches maybe the park maybe the parking authority will take this one out also take but if you would like to bond the dollar per year cman I serious no like I I get the great I get idea of having you know you can pick up an ice cream get onto the train you know all great but or iced coffee that's iced coffee even even better but here's the butt why would we want just for the benefit of having an ice cream P right why would we want the liability of leasing all that land there someone slips that that we become the land still belongs to the transportation they're aware of it but in this the land but if you read this this lease agreement which is like 20 pages long it says in here that because the Le C if we if we put out to bid must have insurance they take on liability of the use of the area property and then the surrounding property still be loans to page nine under Insurance Le see that's the city of P shall purchase and maintain an entire term of lease insurance coverage for the folling K which is you like $5 million per occurrence personal injury $5 million person injury I mean what's what's that that's we don't that so as the middle man the ba would share that's if we didn't bid it out remember just as there's a contract for them the city makes a contract with whoever is going to lease it we'll have the same requirement for their insurance to meet those same expectations so we don't take on the liability for if we don't bid it out and say we're going to keep it we're going to use it ourselves then of course we're responsible solely but if we put out a bid for response whoever wins that bid and the council approves they take on the responsibility because we write it out they're insur they're required to have insurance they can't just lease and say well we'll use the city's Insurance we're just transferring the liability the same way they're transferring it to us where where is this lease does it allow us to suas it to someone else uh so there's a section where um it talks about the uses yeah uses has uses in 2.01 it says the uses there doesn't mean that we could we that we could suas it to someone else yeah so that the conversations and the review from all the attorneys was directly with that in mind and this is what both our attorneys came and their attorneys came back with with the understanding that they're helping us in the goal to R out so they are with us they we met yeah we met with them specifically and told them the goal was to rent it out so this agreement lined up with allowing us so and apparently this is how they do it and they being the New Jersey Transit where they've done it in many many other locations so they newk they've done it in nework they've also done it in Bergen County this was the exact same contract that they used in order to allow the municipality to Le in fact mayor you remind me that I think the attorney had I'm sorry Section 8 um allows us to um section eight section page excuse me 13 Going On to 14 okay got it okay we can it can be um assigned um or transferred with consent which shall not be unreasonably withheld this is that totally totally free up the city for covering for carrying insurance this allows us to bring in a third party does this totally free us up that so the bid is what and I'm sorry s so this provision doesn't totally free us up but when if we bid it out to we bought Smith and Company in to do the servicing then there would be an agreement with Smith Servicing Company which would totally free us from liability because we would require them to assume it has a condition of them providing the service okay okay and on on on another note with this I don't mean to be C with the parking but many municipalities Alone by the train station they have permanent parking you buy by the month you buy a perm by the month right so serious seriously why I mean it probably with angle parking you know was famili very good with this G more parking with angles and everything else if we angle Park Park up over there right yes we could probably get and the parking author have a lot of money to do all this work we could and couldn't stop yourself on that one but what gets even what gets even better is if you read this agreement with the New Jersey trans including the part that the attorney pointed out that you hadn't read what happen is that was page 13 I fell councilman I keep on telling you end the pages that really but uh but but anyway the um in in this agreement it says that any Revenue that is earned you have to split 50% with the news a Transit right so if we have the parking authority picks up the parking so the parking authority splits 50% with the transit and other 50% they split with us so we get 25% if we did that in this hypothetical hypothetical that is maybe the only thing I would share is that we we we have in the past attempted to uh bring up the idea of permit parking by the train station so it isn't something that we we brought it before the council and we don't know if if if that's something we want to do we do think that um the would be a benefit and it didn't just come about from us looking at the city we actually looked at other municipalities that had leases or lease agreements right by their train stations and they've been enormously successful some have been coffee out coffee some have been very quick grabb and go right by the train station but again we specifically made sure that our approach would be nothing that would be competitive to anything in the area right something that would be unique and I think that that would be an added amenity that would uh that would really increase and expand on all that we're investing in in our third ward but the train station and considering the new bus station that will now connect to the train station right off of Pake Avenue we believe that it's going to be a great addition to those who are commuting those who are using the train station and those who go to the park you know we utilize the baseball field more and more the family festivals more and more communities are leasing it for or not leasing it but utilizing it for their little leagues for their groups and I think it's going to be a real benefit there much like the concession stand in palaski park was a big game changer for individuals who you know having to leave the park and walk all the way down Market Street to grab something just didn't make sense at dun the island the concession stand made a huge difference here we feel it would be the same right are the um um yeah the by the the um the Perman parking at train State really to is to is to discourage people from other communities right using up taking up all those spots yes um but that's why we painted the lines all the way down by the train station and the park we had painted the parking but I think we we chose to stop short of doing permits or limiting the parking where or putting meters okay thank you are there any other questions on the proposed thank you for assisting with the family bike ride at Third Ward uh Memorial Park so many children and families went and it's a fourth annual one and it was extremely successful thank you that's the about maybe getting this this third party company from Pennsylvania here counc me the Home fund remember those those councilman and all seriousness I could not understand what you said we had um we spoke a few meetings back about getting this fellow that handles the the consultant that handle like the home funds these funds for um a certain federal program to build you know affordable housing right if you remember there was we awarded I don't know million2 million dollars to one person right and we wanted we could bring that person here in front of us so we can understand better how those funds could be used Mr was a request I I think we may have um if there there may have been a gap in the communication or something that was missing we we were going to have the individual who was um responsible for determining and that and I believe that's Miss Joyce hunt was going to come in and answer but if we we need to ask the corporation we will make a request of the corporation to come those are two different individuals there was a company that actually admin they administered or they consult yes we were going to bring the person who makes the determination determining where those
