received from vanle July 23rd 2024 um my understanding is we have submitted Pro of taxes already so that's that's complied with we don't need a a waiver there on item two of minor site PL submission checklist uh we we request a temporary waiv we will we will put that onto the plot plan for the for the next meeting um and then item three um I can only say my applicant will have to testify and I can I can provide proof but I was told today that the leaders the drainage does not go into the sewer actually go into the yard a couple different um gutters coming down off the off the off the house um can provide proof of that so if you need that information for for complete his purposes I'd ask for a temporary waiver and I'll provide that evidence support at the next meeting you have any questions uh just for clarification for the drainage items it's we're just uh looking to make sure that the new roof leaders would be directed away from the adjacent property okay as a potential condition condition of approval there will be a need to verify that the sanitary sewer is connected to the sanitary sewer connected to the storm they I did confirm with client that the is connected was worked on by sartini BRX 20 years ago and it's working now so I can get what type of proof would you want for that other than going a video typically the um the town sewer Engineers either taking if the proposed amendments are consistent with the town ordinances and and the the master plan and typically when it's trans uh submitted to the board then the board asks our board planner to good evening chairman Duffy this evening you all will have received or will receive signed letters from the residents and businesses in fisberg who believe the town of fisberg is violating the master plan and violating their trust in the town government by allowing the grone Howard property to be zoned industrial there are 93 letters for each uh voting member of the land use board and a total of 1,23 letters being presented in total 30 of the 93 letters are from the residents of Mercer Street additional letters are residents who live along South Main Street where truck traffic is going to be pushed to with the new truck R you will also see letters from the residents of Center Street where residents already are experiencing heavy truck traffic in spite of signage that indicates no trucks over 4 tons should be used on Center Street and it is fully expected by the residents that the trucks from the perone Howard Street Warehouse will also disregard the signage now you will be asked to consider whether the zoning on the perone Howard Street property from Riverside residential to Industrials consistent with the master plan we urge you to rely on what's actually on the latest version of Master Plan the 2013 master plan revision report it is our opinion that the February 21st 2021 and the December 20th 2021 consistency review reports by Angela noes and the September 22nd 2022 consistency review letter by Timothy O'Brien represented neither the spirit nor the letter of the master plan none of the previous consistency reports mentioned Pages 28 and 29 in the latest master plan of which you have been presented copies for the land use board the emission is baffling since it is the Howard Street area you are considering and since it is the Howard Street area you are considering would it not make sense to note and present in the consistency report the section of the master plan specifically labeled Howard Street in addition to ignoring reference to the Howard Street section in the 2013 master plan previous consistency consistency reports have cherry-picked statements from various other Master plans to reach the conclusion that zoning the her own Howard Street property to Industrial is consistent with the master plan having to reach back as far as the 1988 master plan also don't allow folks to try and justify a small strip of light industrial that the 2013 master plan says the town should be rezoning to Riverside Heritage don't allow that to justify the zoning to Industrial that that area should be only zoned Riverside Heritage Riverside commercial and Riverside res residential to uh on that 32 acres of land now I have the highest respect for attorney willhelm you know there is going to be contention when a discussion starts out like that but I strongly believe attorney wilhelm's instruction to the land use board was an air in previous previous consistency hearings attorney wihelm said that you are not the take into account negative effects to the community and the air uh and the area when considering to recommend rezoning from Riverside residential to Industrial on the perone Howard Street property we believe the 2013 master plan demands that you take into take the negative consequences of resoning the property to Industrial into account when making your decision as to whether you recommend the property be rezoned from Riverside residential to industrial the 2013 master plan says the area should be rezoned to encourage or accommodate uses that would complement the surrounding neighborhoods new and old the riverfront Heritage trail system and the overall Riverfront revitalization uh effort the statement in the master plan demands that if it can be shown by example of effects that will degrade and be detrimental and not complement the surrounding neighborhoods then that must be presented and considered by members of the land use board when making their determination as to whether changing the perone Howard Street property from Riverside residential to Industrial is consistent with the master plan thank you for your attention I I just want to address first of all thank you for the kind words uh initially uh on the second half that I have commented uh to the board on how to consider a consistency is completely inaccurate I would be curious to to where you got that just so everyone understands my job is simply to provide guidance to the board I don't have anything to do with the study which is conducted by the planner and I have nothing to do with the consideration of the study by the board members there to review it and decide what they're going to do and quite frankly I think my conduct at last month's meeting demonstrated that I pumped the brakes on this because uh this was referred by the Town Council the day of the meeting and uh I did not uh we did not have it referred uh to Mr O'Brien at the last meeting so I think I did my job in pumping the brakes on it uh and pushing it off till this month so uh I'm just curious as to where you came up with I said that the board is not to consider negative impacts I've never commented on what the board is to consider so uh again I have the highest respect for you I remember you pushing back back on December 20 in 2021 when they were running a consistency report without proper notice try to get it done at the end of 2021 and slam it through and you protested that again highest respect now thank after saying that um in the last uh consistency report hearing we had I I it was on Zoom U I said well what about like trucks traffic fumes and basically the comment was that's irrelevant that's not part of what that that's not part of what we're talking about and that type of stuff would be discussed during the site plan here we'd have to we have to cut you off thank you thank you yeah true thing thank you good evening uh Michael BR 2351 Washington l uh spent most of my life in Philipsburg however um Mr Marset um I'm sure is well intentioned but it's totally misguided um but when I spoke to Mr Mars said about why he is so against this project he said well when I kayak down the Delaware River I don't want to look up and see the roof of a warehouse or cold storage and I said to Mr Mar said well if you turn right you'll you see the eastn score clamp on the other side of the property okay so for 20 years I tried to develop this property as a residential property I was the one that asked this board and the council back then to change it from industrial to residential and for 20 years I spent millions of dollars trying to develop it as residential it just did not work I got no buyers so a year ago we had a great contract with an Atlanta company that was going to build a cold storage facility there with 250 jobs paying an average of $50,000 we work with Norwest cap to train Philipsburg people to have those jobs think about it 250 jobs at $50,000 for people in Philipsburg and their lawsuits kind us up the Atlanta company went elsewhere okay so I don't know what the game plan is here then we took and we bought the property on mcken Street on South Main Street so if Howard Street Extension doesn't go through we can knock that house down so all the trucks turn right on mcken street and they go 1,400 ft in Philipsburg until they leave our town property our boundary lines and all the signs say you can't turn left and the Town Council made Center Street non-restrictive for trucks so if there's trucks going up there Mr Mar said that's a police issue that's a police issue that's not our issue that could be stopped with one police officer in a car giving everyone a ticket and I promise the gentleman that lived on Center Street that we would make sure that the state approved non- trucks going left on South Main Street and going up Center Street they get to mcken Street the worst scenario is they turn right 1,400 ft if we get Howard Street committed which I think that the state is going to do they pay 250,000 to your engineers to design it none of the trucks will not not just our trucks but Atlantic State I forget what it's called now but all the trucks in that industrial Zone will be out of your town and you will create tax revenues jobs and incentives I've developed in a lot of towns this is my hometown which I love and I just don't get why 11 people are controlling the narrative in this town and they get you know what they get signatures they get signatures hey you want trucks down your street of course I don't want trucks down my street so they sign a letter they're misguiding and misrepresenting the factual pattern of this project and you know it's about time that people start to understand the facts you can have your own opinion but you can't have your own facts the facts are the facts and so um I understand tonight it's just a referral um to your engineering consistent consistency report I just don't understand why normal people average people with intellect can't sit down and say let's just make this the best project we can let's get people jobs I mean America's about building things and getting people jobs bringing people up into the middle class and what have you and I just don't understand the opposition to the thank you thank sorry s moris Sat by Fairview Heights in Phillipsburg you see I chose to live in Philipsburg sadly Mr peruchi chose to move out of Philipsburg we chose to live in Philipsburg almost 29 years ago when we returned to New Jersey from Georgia we love this town with its distinct neighborhoods deep historical roots and we love the idea of this town as a Riverside destination each of you now have to decide if our Town's 2013 master plan which de deemed the Delaware River area of the flats to be either Riverside residential Riverside commercial or Riverside Heritage is your vision of this town also a Riverside destination or do you see the town as a home for a gigantic Warehouse built by the New Jersey Department of Environmental Protection designated as an overburdened Community two years ago this would be the sit Greaves South Maine and marer Street Corridor this Warehouse would diminish air quality dangerously increased summer temperatures from the industrial activity reduce Traffic Safety from tractor trailer traffic increase runoff due to humongous impermeable areas as well as increased light pollution how is any of that compatible with the vision of Philipsburg as a Riverside destination and in compliance with the town's 2013 master plan that says all zoning is to complement the existing residential area given our historic ties to Canal and train use these beautiful 32 Acres of undeveloped land could absolutely be used as Riverside historic given the residential nature of the flats it could also be further developed as Riverside residential or Riverside commercial all three of these designations would increased hold values in the overburdened area of the flows you and the use board have a decision to make not just for us at the present day but for your children and grandchildren life is precious and so too are those 32 acres of land a warehouse will absolutely not value future Generations that live in Philipsburg you were just given Warehouse statistics from a well-respected industry resource sections of it have been highlighted in italics and underlined some think a warehouse will bring much needed jobs to Philipsburg like Mr peruchi I was shocked to learn that robots will replace 40% of warehouse jobs by 2030 robotic automation is already affecting employment with consistent decline since 2022 according to this resource full-time employees in the warehousing and storage industry work an average of 42.3 hours per week with an average annual salary of 37,5 192 what perhaps Mr peruchi has brought into his sum for an annual wage is the incredible amount of money that the higher Executives in a warehouse earn it should be noted that graders and S only earn $15,600 machine feeders and off bearers earn $ 4,976 those are more of the majority of jobs within a warehouse thank you very much for your time and consideration is there anyone else who wishes to address hi uh p petol a hill seat heberg uh I just drove the route that the trucks would be driving you got five stop lights you go past the police station you go past the firehouse there are no turnouts trucks break down on that road you're going to it's going to interfere with Emergency Services not to mention the traffic now he mentioned Warehouse shards there are millions of square feet at the old INR site of warehouses they're going to build a warehouse at the fburg mall all this merges upward 22 turns into 78 his trucks will be going up Brunswick Avenue I drive the work there every day it's already a bottleneck it'll be a nightmare there's no need for more warehouse jobs in this area I applied to three warehouses UPS Amazon and GS all three offered me a job within a week I have no Warehouse experience and I'm not that young somebody wants to work at a warehouse they can start tomorrow we do not need another warehouse thank you uh yes I'm from pacan Township Richard Stevens 1417 South Main Street uh a lot of this trucks will obviously be going right past my house um two weeks ago parking was prohibited on street parking was prohibited on South Main Street in that area um it's um obviously in certain houses along there uh this will affect their value valuation parking is not so much a privilege as a necessity in today's work environment and the fact that so many people have to drive distances to get to their employer because there's not adequate housing in the area where they're planning on on working um so it's uh a lot of these trucks will be affecting your neighbors in Poon Township um and uh uh there's on my understanding uh you can be with a microphone on South Main Street and uh you can hear the volume of traffic uh with the exhaust systems uh the variety but increasing the volume of trucks with their shifting uh will obviously increase emissions and and uh will uh I think kind of be a lowering of the standard of living in this area of Warren County uh I I know recently they had a story that one in three New Jersey ites live within 3 miles of a warehouse or Distribution Center uh this was not something that you would necessarily put on a sales brochure or a realtor uh uh uh sales uh card uh as an encouragement uh when you go down South Main Street now you see pedestrians of all ages and uh they seem to be able to actually use the sidewalks on South Main Street without inviting harm to themselves that might not be the future of South Main Street uh bicycle Riders children unattended children uh children leaving school buses looking at their phones stepping off the curb so it's uh this is you know the street was not designed I think for the type of traffic that you're will be you know necess necessary to support you know the the the building of the the warehouse as it stated so it's uh there there are things to weigh in your decision thank you [Music] anyone else Sarah hair from Hope um I'm regretting now that I don't have a written statement so I apologize for my nervousness I sat in on planning board meetings for five years in White Township so I've heard the jobs jobs jobs uh comment and I sympathize with M Mr peruchi and his efforts over the years but I have to say um I do hope this land use board looks at the state Planning Commission Warehouse guidelines looks at the Highlands council's Warehouse guidelines which were just um they just passed a resolution on those um it really does recommend to townships to look at and you're not Reed to do this but in all good ethical Consciousness we should be looking at how this will affect us regionally patcom how will that truck traffic affect them I agree with the gentleman who says do we need another Warehouse in Warren County in the state of New Jersey we're inundated with that it's an eyesore polluted diesel runoff and other uted storm water into the Delaware River which is drinking water for 17 million new jerseyans diesel air pollution which Le High Valley in this area we now have one of the most polluted air qualities in the country lots of asthma we need to be thinking about the costs and not just in dollar amounts of jobs I just implore you to really educate yourselves about all the costs and benefits you know weigh them what will the benefits for people be with more truck traffic in Philipsburg Ando hatom what will the benefits be environmentally the the wildlife on the along the Delaware River nobody's talking about that very much much we have hundreds of threatened endangered species on that River and everything you build on the Delaware River will affect every Community every Wildlife uh species all the way down the river I just I could go on all day I just implore you to think deeply about this for the future of Philipsburg and Warren County and K haton thank you anyone else Rogers Elder Elder Avenue I don't have any statistics of anything I'm just speaking as a resident and from what I've been seeing lately just around town for one thing down by 78 rout Exit 3 from Walmart all the way up to um where the Honda is in the evening time that is jam packed with trucks and eventime dur in the middle of the day and they're not just in one lane they're in all three lanes of that highway and it's hard to get around there and between the trucks and the little mopeds it's becoming a very dangerous area area and I've seen where during through out the city because our streets are narrow it's unfortunate and the trucks are big they cannot make a good turn with into the street so if cars are already sitting at the corner they're coming down and they're trying to turn they're turning into the car so if the streets aren't going to be be widened then there's going to be some other use where they have to become oneway streets or something but something have to be done because they're not it's not going to work with all the trucks and lastly I agree with what what she had said about the admissions I was going down to Walmart last night this truck was so pungent that's all I can say is I smelled it through my car through the air conditioning and I could hardly breathe so we really need to think about all this truck traffic thank [Music] you co Donaldson 44 har Road itself um I have a business here in Philipsburg um I had a building on South Main Street um I know there is going to be an effort I know we already got it passed that there's not supposed to be any trucks and we we're waiting for signage but um as a business it is really difficult for customers to negotiate South Street I'm really grateful that I'm on sck street now now that I've had to move but um the truck traffic no matter what is going to be horrendous uh and I think that that's a huge deterrent for people to come um you have businesses and the business plan is all about increasing residential and it's all about being a Riverfront destination and it's all about stores and people coming there all we're doing by adding more truck traffic is deterring people from coming and fburg has had a reputation that has been very difficult on the business end of it to change the perception of people even in the town to talk positively about the town um so for that reason I've always been opposed to the warehouse um but I did get a chance to peruse through you know the um older uh Master plans every single one of them I I always say we have no plan I always say that all my meetings I'm like this town has no plan it's it's we have no vision to pull the plan off there is a plan just we never do we never follow through on the plan we are always at a stand this plan the plan been in place since 1999 I came here in 1989 um I was very excited for this plan there was going to be a lot of residential we're going to use our Riverfront which is huge Waterfront is huge to to I don't think there's anywhere going all the way down the river unless you're in maybe Trenton or whatever else is down in Canon uh that there's anything industrial on the river you know it's it's residential people pay a lot of money to look at at water you know and what goes with that we're getting um The Rails to Trails we're doing all these recreational things to bring people here and I just feel like sometimes we're just you know picking ourselves by putting something where it doesn't belong um and and I do feel bad for you Mike because you did I mean you have a big investment in there I get it from business people but um I just always thought it was a bad idea I think 55 plus development is what belongs in there that's what I have to say I agre pretty much everything everybody said here so I can't answer that thank you CR filbur is my hometown I love filbur we're all here tonight over our warehouse nobody was complaining about Atlantic states nobody's complaining about Avatar that has truck traffic that's in a residential and business area nobody was complaining about the trucks running 24/7 all of a sudden we're worried about a warehouse going in on Howard Street the man's got money he wants it's his land I don't see none of them people offering the man any money for his property when he's offering to do something with the land that sat there for all these years because they don't live down there they want to do something with it none of you are offering the man any money none of them but they all want to bring a lawsuit against the man and the town so until they bring up money I think you ladies and gentlemen should do what you feel is best for the town of Philipsburg if it's going to bring jobs here go for it because there's a lot of people in this town that need jobs and if it's going to bring revenue and what not to our town hoay hooray the land has sat there and has done nothing the man's willing to do something with his property then people are just barking up the wrong trait we're not doing anything we keep bringing it up bringing it up let's please do something tonight with the property thank you [Music] uh what I've been hearing tonight is uh a lot about fburg being a Riverfront uh from what I'm getting I mean I know that area pretty well okay I mean from Mercer Street you go back towards the river you have a railroad embankment okay you have a rail bed that's where the Rails to Trails is going through now on the other side you have some light industrial then you're going across Howard Street then it steps down and it goes down a little bit more the project that Mr PRI is presenting I don't even think you're going to see that from Mercer Street from the river you're going to if somebody likes to go kaying that's okay it still can be a Riverfront destination that whole stretch of land belongs to belongs to the state of New Jersey so he can go kayaking all he wants um this town a few some years back we had the option to enter the highlands as a planning area why because Philipsburg was always that way we were industrial uh we had jobs we had commercial and also we also have residential but we can't we can't treat an area like that as Pres ation we're planning some you know you've got we're not po haong we're not green wi we're not Harmony we're Philipsburg it's a planning area it's an old industrial town I believe I believe that we can actually make whatever you know the rails we can make open space and we can also have this project move forward I don't see any pollution coming out of this and quite frankly me living around the corner from there I've said this before it's I don't want to see open space back there only because I know the town of fsb's track record when it comes to taking care of things it's all brand new for maybe the first year or two but they don't take care of it and I don't want to see crime drugs and you've also got a lot of homelessness camps back there is that what you want back there because that's exactly what you're going to get and it's just going to be a bigger problem and I don't like to see a few people try to impose their will on on a large group of people but I have a feeling that's what's going on here so that's all I got thank you thank you thank you hi everybody think you can hear me my name is audre Frank I live in Stewartsville New Jersey but my town is Philipsburg there is no town for Stewartsville and I actually had the pleasure of talking to Mr peruchi of actually seeing his property I also know that he wanted to uh help somebody that was upset about kaying which I think it's a great deal um he was going to have me do a bureau on the on the building he was willing to do that I've been here since this plan started and I have not seen anything which is starting now for things that were happening on that master plan that have not been done my my suggestion is to talk to Mr kuchi you don't want a warehouse is that get give him ask him what you would like to have or tell him what you would like to have on that River because I've seen stuff that he has built and it's fantastic thank you hi Center Street um I'm going to read this first and then I'll just make a few comments um so um here this evening to let you know I do not want to see a warehouse built at 170 Howard Street otherwise known as The paron Howard Street property furthermore I believe resoning this property from Riverside residential to Industrial is not consistent with the latest master plan uh recort of 2013 that 2013 master plan says Zoning for the Howard Street area should be Riverside residential Riverside Heritage or Riverside commercial no industrial the master plan also states that whichever of those three types of zoning is used the zoning should complement the surrounding residential neighborhoods and new the riverfront Heritage trail system and the overall River frontalization effort the proposed Heron Howard Street Warehouse is directly opposite to what is uh to what is written in the master plan the consequences of resoning this property to Industrial and opening the way for a warehouse that will hurt the surrounding Community are the truck noise in the neighborhood if a warehouse is built on this property the truck fumes in the neighborhood if a warehouse is built on the property the large amount of concrete and uh macin from the warehouse will heat up the area if a warehouse is built on this property then you will sandwich us between two industrial sites to the West there is the existing M buile plant that pumps Mercury arsenic lead chromium and many other toxic chemicals into the atmosphere so there's your toxicity um and uh so the others are um the prevailing well actually I want to miss this sentence if the parin Howard Street Warehouse was built along the Delware River we will have toxic truck fumes from the East the prevailing winds blow from the west across the Delaware River to the East and this me the toxic truck fumes will blow right into the flats of billsburg I believe Warehouse associated problems from the trucks will lower my property value for sure because I live on Center Street at the four-way stop where you know they blow the stop sign all the time anyway um and I believe that resoning the paron Howard Street property uh to Industrial not against other options is not consistent with the town's uh Master PL in 2013 so I urge you to vote that resoning with property does not agree with the thank you for that um but I there's already too much truck traffic on that road there is tiny little children that go to school behind my house they are absolutely adorable walking on you know a little tow rope from Norwest cap they crossed that street and with that Hill those trucks are loaded they can't stop those kids will not survive um there's already too much of it um and I heard somebody ask um do we need another Warehouse in Philipsburg I mean without knowing as much as half the people in this room about all that um I can tell you I don't see why because the warehouses that are up the street from me are empty there's no cars there there's no trucks there there's no merchandise inside when I see those garage doors open so that's no um and um when you do the math for how many trucks will end up on Center Street I believe it will be jam packed with trucks all day which I mean it's a residential area so um the last thing I'll say is looking up residential I wish I had my big fat dictionary but couldn't um but designated for people to live in private residential and nursing homes as an example um occupied by private houses and then in in quotes it says quieter traffic in residential areas it's not quiet because when I sit outside at 11:00 at night to listen listen to the sounds of the night it's loud it's very loud for a residential area so to add trucks to driving through that whole area on a regular basis 247 to go to the warehouse it's not nice so thank [Music] you anyone else Mr chairman if there's nobody else that wants to comment if I I just would like to make a statement to help the board understand their role and so the public well before you say that yes I'm closing public comment thank [Music] you decision I thought so I'm not encouraging or discouraging the opponents or the proponents of the project I simply want to educate everybody the Town Council has a proposed amendment to the Riverside Redevelopment plan by law they are required to send it to the land use board for the land use board to undertake a study to determine if the proposed amendment is consistent or inconsist or inconsistent with the master plan as the members of the board here to my knowledge are not experts but Mr O'Brien is he's a professional planner and a professional engineer and he is hired by the board to provide Guidance just as I am we're the board is referring matter to Mr O'Brien so that Mr O'Brien can give his opinion Mr O'Brien's going to give his opinion in a consistency report which will be available to the public at least 10 days before the August 22nd meeting at which time this board will in public contemplate and comment and debate and deliberate on his plan so anybody who wishes to come to August 22nd meeting to comment they will have that opportunity for the members of the board I would encourage you to look at the master plan and I would encourage you to individually not as a group reach out to Mr O Brien if you have any questions and the board will then have the opportunity to either accept Mr O'Brien's plan and report in full request that he make modifications to it or flat out rejected but regardless whatever is voted upon by the board will then be reported to the Town Council and it is the Town Council as the the Redevelopment Authority which will make a decision as to whether the uh uh the uh proposed amendment in fact will be adopted So for anybody who has comments you're welcome to come next month and comment and uh so the board can hear it and you'll also have an opportunity in front of the Redevelopment Authority down the road so I just want everybody to understand what role this board plays in the process thank you Mr chairman okay does anyone have anything for the good I have a stupid
