attorney Nan Meer here wonderful thank you all right little business from our meeting we have anybody have a chance to go over the minutes and there any discussion or questions regarding those minutes don't have any but you want to address this comments from the general public somebody you have a section your next section [Music] you come to the general public we have so interested you never know someone may want to jump up and start talking wonderful so for the record I would like to take any comments from the general public if Tim is wonderful there you go can I Del you okay if there's not then I will go ahead and close that okay any comments regarding from the chair myself there's no comments or from the members regarding else Perfect all right we' like to discuss the appointment of Mr Michael FZ as the alternate to the member of the Planning and Zoning Board all right Mr fres if you would step forward and address the board and your desire to join hi Michael FZ uh 5045 Waterside Drive I have an interest in joining the board because I work with a lot of municipalities in my construction field um Statewide to work on flood mitigation and changing codes and working on codes to make insurance work better for citizens to make construction easier for Citizens flood mitigation all of those pieces work better across the board um I'm working with fdm working with FEMA um Statewide on that all over the place and why not want to work in our in our backyard I'm already working with the building official already working with the city manager a little bit on some of the projects that I have going on in town but we're constantly having to make very very small changes to code or get variances for things that should be part of the code um I can't be on the land plan know I'm on land planning Council as a consultant for lots and lots and lots of municipalities around the State of Florida um but here I as a citizen I can actually be part of the board that's going to make those changes I would love to be involved um kind of as a subject matter expert on flood and mitigation when it comes to construction any questions m b question that was city of Port Richie correct city of Port Richie okay because here it didn't really say that you were from here so oh sorry yes I live yeah I live right over on Miller B um most actually every home that's been elevated in the city of Port Richie the ones that have been elevation projects where we've picked up single stories and made them two stories have all been my my construction projects some of them personal my in-laws live in one that I lifted um but the rest of them have either been FEMA or private um and we have quite a few coming up um we work very very closely with Pasco County um Emergency Management um Nolan over there and all of his team to try to get uh to get folks through the grant program quite often um and we've been very successful with that Pasco County has now pretty sure at the end of this year will have received more more Grant uh more grant money for home elevations than any other county in the state we were right behind pelis now we're gonna we're going to overtake them I think and are youed by any of the contractors around this area so I own unified construction uh unified foundations and unified construction anyone else uh no I'm not I'm not employed by anybody else I I'm me okay yeah I used to I used to own a company here called Coastal Life um and we were a consulting firm to help homeowners get through flood mitigation Grant requests through FEMA um helping them write their grants helping them get through all of those hassles um and then helping them find their contractors and that was just proving to be difficult on homeowners because contractors it was hard to get all the contractors in the same box to do it right um so we decided we would just form a company last year that would do all of it from start to finish okay obviously if there's vote of any kind or anything that would directly correlate to something that I'm doing I'm I know I have to rec recuse myself from anything like that but the goal here is to try to shed light on what will make what you can do to the code that will allow mitigation to run more smoothly um there's no reason to tear any of these houses down um all of these houses could be saved I mean I've only ever seen one that I told the homeowner it just wasn't cost effective to elevate it and put it back to together um every other one I've ever been to it's a third of the price to elevate a house than it is to tear it down and start over not to mention three months to be out of it instead of three years to be out of it so okay I'm good okay I'm gonna go the record I will be recusing myself as a real estate broker own snap realy hold the license for Mr frz as well as his wife and so um as such I will be recusing myself for voting um uh but I will make a comment as far as a subject matter expert is concerned I do call Mike on a regular basis to answer questions regarding mitigation in particular especially for my real estate clients who have that question I don't know the answers most of the time so that's why Mike is a a better resource for that St so but I will entertain any motions I move that we make an approval okay do I have a second second all in favor Ione so now the process will be that you will go before the um city council and the board has made the recommendation that you will be added as an alternate and as such city council will make the final determination whether or not that's is what they want to do cool so Ashley will of course give you in contact and tell you when that will happen and then uh we'll see you sitting here or you'll be sitting out there one of the two So yeah thank you all right moving right along okay our next item at hand we're g to come back to it this dancing okay you've seen this before this is a little different this time um I thought would be some little easy fix but nothing's easy and I need to stop thinking it's going to be but anyway so this we're coming back to talk about seaw walls um and the ordinance you have in today's packet um instead of just adding the word seaw walls um add some um parameters so the building official has those um objective um standards to look for when he's evaluating seaw walls like he has already done within this this code like for docs it has some specific things that are supposed to be done this this adds that to the seaw walls and not only the building official will understand that but the citizens will and that's the goal is for anyone reading this to understand and my SE well supposed to look like this or do this or be built this way um and not just say it's not supposed to be dilapitated what is that me um so I worked with the building official to come up with a language you see um that's underlined in red um that adds again add seaw wall to a lot of things but then add some more specific um criteria um towards the end um it starts on page 14 okay and um I will also point out that when we worked when I worked with a building official um to to draft this on page 14 on subsection 10- 278b he asked that to change from 75% to 50% to be consistent with other parts of the code that have 50% as that threshold for um non-conforming structures change some of the time frames that we previously allowed for people to respond um and work on um structures that need working on you can see those new new time frames um within the code um but obviously the biggest change is at the end where we added um division for seaw walls um I do not have a seaw wall I've never built a seaw w to inspect seaw wall so I'll will tell you that much much of this means nothing to me that is why the building official was involved so if any of you have any Sewall knowledge we are I'm happy to listen to that if you think some of this needs to be tweaked or if anyone out there has Sewall knowledge um so I mean I definitely want it to be something that that again and the citizens the city can read this and understand what we're asking of [Music] them thank you all right we'll do the same thing we'll go round robing Miss Lisa you have any questions regarding this or concerns comments nothing at okay Randy yeah a couple of questions to page 14 bottom Bo boat shelters and boat slips uh I know we spoke briefly about Le entertaining the idea of allowing Bo canopies or temporary things over the boat box and over Boat Lifts and things so does that need to be addressed now or this written to where that could be amended in the future or we can we can always amend in the future um if you want that and I I remember we briefly spoke spoke about it um things kind of got derailed from those those prior conversations so we never did pick it back up um if that is something that there's still an interest in we can um I would recommend that we discuss it on a different agenda so people know we're going to discuss it because people might want to come out and comment on that sure um Pro or for or against um and I hate to take an ordinance multiple times and take it to council and go through that process but um this is this has been around a while and we'd like to move that forward obviously if that topic is still something we want to discuss let's U Market to bring it back and we can always Adit this again not shutting down that possibility no no this is that section hasn't changed from what the code already um has so right now it's just saying that there's um boat houses and boat yeah that's not that's nothing new and then it talks about um the size of boat slips so this doesn't allow what you're saying but it doesn't give parameters of how to do it should you want to do it so if that's something that you're interested in having we do need to have that conversation we can do that next month if you just a general question I guess the whole thing I think it mentions W one time but I don't really see where this if you go to the very end on page 18 hope this answer here's your question all the red is the new information about seaw walls word about title flood barrier [Music] structure definition does [Music] not so that so that would be something I don't know that would usually rocks cre rocks toss on the other side of a seaw wall or firm or Bank design to to alleviate a ro when I put in my do it's the preferred wave the they friendly to the war let's say but I just feel like it needs to be addressed some well right now like you just read this is saying that you're not to use that yeah that modification code is actually asking them to take that out so if that's something that you all don't agree with we can discuss rip WP defition is not meant to include rip wrap so it means there would be no rip left that's moving forward yeah I saying red and white it definitely means that do you agree with that no okay and I was hoping our building official would be here um he's I think at a seminar this week so he was unable to attend so he could address these concerns like that as I said I don't have the expertise to say that that this is the the new better way is to not allow the rip wrap maybe that is yeah I agree with Randy I'd like to know why that's out there I agree with you 100% even my SE wall I put a brand new seaw wall in and then they put rip behind it so what is gray green gray infrastructure that a gr area there or something I again I don't this is language that I'm not familiar the meanings behind them I do not know because I do not know how to how to erect a seaw wall um what we what we can do um since Mike could not be here and you do have very specific questions is we probably should table it for him to come to the next meeting absolutely um because we want to get these questions answered so we have the right language in there to make or understand why he's asking for it to be different than what you would expect it to be because all this in red is being added that's new right everything underlined in red is new anything that's read and strike struck through is being removed and and then just I'm still on page 16 on property owners must maintain a title flood barrier and good repair what does that mean if if you go on it tells you what disrepair means so kind what's what that that's the number two defines what that means the title flood barrier means a structure or Shoreline the the one you just were in that has the green Ray and the rip wrap that defines title flood barrier is saying you have to that means you have to have a sea you have to have something requ on the BMS Canal Banks something that to control it and the key the key there is the is D so section D is the key um title flood barriers below a minimum of 5 feet below design constructed to prevent that may be an issue okay and the reason I say that um I have personally owned three properties on Miller byou and all three of them have been below the 5 foot neter so including the one I live in currently Mike knows he came over and helped me vacuum my house out when when was was flooded so um that's gonna cause some serious you are not compliant to that due to the fact that a lot of the seaw walls when people put a new seaw wall in with your neighbors a good neighbor get with your neighbors and say all right I'm gonna remodel my Seawall into my seaw wall and I'm gonna raise my cap you TR Contra so your neighbors are the same height as well because you don't want to put on a 5 foot five seaw wall and all the water rushes around to that right so just kind of that's a good neighborly way of things I'm kind of curious to see in particular the uh where that statement five feet came from and and how the city plans on approaching that because if that's the case there'll be a lot of non-compliant seaw walls or quite a few I would imagine well remember this would be going forward once it's it's in good repair that may not meet this criteria as as it stays in good repair moving forward love that word grandfather um moving forward or it becomes a legal non-conforming use I'll take that one yeah okay um but moving forward the expectation would be would meet these this criteria chosen or by chance that existing seaw wall becomes damaged um it needs to be repaired depending on how the these requirements which will require the contractor when they pull the permit to replace or repair a seaw wall to make sure that there's a current elevation certificate on file as well okay yeah the last part in E it kind of says to consider approaches that enhance the biological value and of traditional flat surface seaw wall so I thought flat surface sea wols were the antithesis of biological values always been my understanding I think and I'm I'm just learning this I think the new I don't trend is the proper works I don't want to discount it but it's a living Shoreline and it's at no seaw wall and it's kind of a different different thought but I think the the thought process was to try that's that New Concept on you know a city might be more extreme than anyone's ready for maybe we had somebody so we're just asking nicely mitigation expert yeah we need a little little expertise here and and a building offish should be wonderful too I guess at that point so yeah let me ask you this by chance do any of you know a seaw wall expert that would be willing to come in about flood medication I know it's but I don't know if seaw walls I don't know if those go together I would think so in some aspect but yeah kind of sort of well there's there are seall uh Professionals in the area quite a few of them actually so I'm sure we can speak it will directly affect their business so maybe we have some in just says that the sea wall will be Construction in in uh conforms to the state be or something that because you have to get a permit anyways from them and they're going to override anything that we say I would think most likely yes all right so what we can do is um we'll table this until Mike can be at either the next meeting I'm hoping the next one so we can bring it back and continue the discussion and I will get with the city manager who and ask if we can try to locate a seaw wall guy or gal to come in and and maybe help with some of the details we all including myself can get educated and and get this done the right way especially if we're trying to train change by being you know Forward Thinking to modify the way we do things currently and the way that the city is used to seeing things if concrete seaw walls have been the things for as long as I've lived here and a hundred years before that and now we're going to switch to a green gray hybrid material I'd love to that what that is agreed so understood okay and what that entails if then that's that's the consensus then we're done with this topic for today can we in in addition to that can we address the issue of um awnings awnings the same the same meeting we K two birds one yes perfect Mr Mueller Dave meller 5439 bluepoint drive on the point that Randy was making I believe that rip wrap is not included in the definition which in case would be a scenario that would allow rip WP to be in effect some kind of barrier there the way I interpret that yeah yeah I just wasn't sure real clear sub subsection two's title title flood barrier definition towards the second line says second line from the bottom this definition is not meant to include rip wrap right so it's taking it out it's taking it out right but by the same token a collapsed seaw wall is in effect rip wrap and somehow you need to make a distinction there because I've got that going on now and it's the whole purpose of getting this thing done so we really need to address what we mean and mean what we say so it's effectively easy for the code enforcement to address it because that's the whole point here right we want clarification and simplification so that any person reasonable prudent person can look at this and say yeah I understand that and fix it right or it's wrong and let's get it fixed and that's the point
