chair present okay let's get right to it in the interest of time um so the last time we closed the hearing and we made some uh modifications to the uh draft order of conditions uh Chuck uh went off to make those changes we have all received them via email has everybody had a chance to review those comments so uh before we get ahead uh a little bit uh Tony and Martha sent me comments and I'm prepared to just go through them quickly there's not many um so I can I can bring them up on the screen and we can review these let me see what I have have to do to do make that happen but while you're doing that so everybody's had a chance to review these okay no yes but you haven't seen Tony's right correct I haven't seen Tony's changes but I did get to review the the document you sent out a few days ago okay so which was my question so yeah okay yeah I thought you meant Tony's no okay okay there you go all right so um this document includes uh Tony's changes and um mamor changes so I'll just scroll through it it's all the same except for where we have um these changes I'm just going to move that so I can see and here's the first one here about uh Ceda swamp with sightings of four or more endangered species so that seems appropriate um I don't see anyone raising their hand or speaking out about that um there is uh four that we got from the list of natural heritage so that was was a good correction this is uh we might miss a few of Math's um corrections but this is one of them just uh spell appropriate word correction here again um Derek Rick was changed to drill rig Derek okay we have Tony's comment about do we want to re inquire uh require a spill equipment and I added the appun must have spill containment kit on site at all times The Spill containment kit will be located within the reading work area during all operations so that's what this Chang is about this is I wouldn't even have to tell you this is Tony's comment true natives he wants in this section yeah that sounds familiar Marthur I missed all yours I can get the email out and go through yours if you need if you need me but I did go through each one and make those you got the important ones um and I noticed that the page numbers are now correct that was a big one for me so I think we're good and this one here uh Walt sent me some information and I did make some changes this um somehow I would have thought that would that would have highlighted a change but I don't see it here I don't think you have his changes only because in a one of the changes he made was to say the Commonwealth as opposed to the state so this is still uh your original version and yeah hold on a sec I'm looking for uh what oh that's put this here I should have been while Chuck is looking my other two changes were number 12 and number 26 they were just minor grammar Corrections yeah the uh that a part is not what I wrote or I should say yeah MH and then I having read your comment again should it be a civil engineer for Part B or does it matter I think professional is sufficient it's broad but certainly captured civil engineering because an electrical or mechanical will not be touching this but part A I think should be amended still looking uh wait a minute uh the best thing to do at this point let me I just probably have just too many these open I can copy them over in the chat is that all right is what I wrote a written and signed statement from a wetland scientist clarifying the Project's compliance to the state Wetlands protection act and the town's wetlands protection bylaw to this order of condition and its approved reference plan and setting forth what deviations if any exist that was a hybrid version of what Walt wrote and how I tried to um uh blend it in with what I thought was um appropriate oil oh Tony's here by the way under projects compliance um that should be possessive a long words smithing I think the difference is the state and Commonwealth I think that's the main differen I see is any I mean Walt I don't know what you're thinking I so waltter when you wrote it I I was trying to read to understand you know how you were writing it um but also get the correct language in there and some of it's not what I've seen before so I left that out but tried to use most of what you put in well I was also concerned about grammar and I was putting parentheses there to break out the fact that we want the scientist to clarify all these things so you need to put par commas between the different items that we want clarification on Jessica wall is coming in what's the where where do you want these lands protection act comma the towns Wetlands comma Protection Law par me Town's protection bylaw comma this order of conditions and its approved reference plans otherwise it becomes a runon sentence all right and that what's what's being clarified what needs to be clarified in the statement hey Tony at this particular moment it's um it's grammar discussion and you use of commas just to make it clearer right but my my question is it says a written and signed statement clarifying the project compliance is there is there a particular issue that's that that needs resolution well if you just said that the compliance this is uh when a request for a certificate of compliance we would also like a letter from and this is the issue that the applicant doesn't have um they don't usually uh have an engineer available to I mean does anyone remember what was said but anyways they wanted um the Wetland scientists to do the statement and uh clarify that everything is complied with the order of conditions and the commission pushed back and said well that we wouldn't we wouldn't like to see that uh on the engineering portions of this so we decided that an affidavit by a licensed professional engineer would be sufficient so we have the Wetland scientists doing um or letting us know that they see the project in compliance with the order of conditions and same with the uh engineer so it wouldn't be clarifying that the project complies it's stating that the project complies and then maybe identifying any any deviations from the proposed plan and how it still meets the conditions and requirements of the ACT I interpreted part A from an environmental perspective meaning here's the different uh regulations that it should obey the second part for professional engineer means did it did they do it analytically correctly yeah I I I think I think you're on the same page what Tony was saying if I can take a whack at it is an a where it says a wetland scientist clarifying the project they're not really clarifying there um asserting that in fact it was done according to the WPA so clarifying is probably the wrong verb it should be something like certifying or stating is probably affirming yeah yeah yeah that's where I was getting hung up Ryan thank you well I think what they're saying is and the way I worried was they needed to certify the compliance not complying but to certify the compliance not the complying right then then it should say certify instead of clarify thank you okay anything else in that section or can we move on um what Walter was saying at the end of the big long crossed out part where it says two he was suggesting that that be a comma so that they're complying with the WPA the wetlands protection bylaw and the Order of conditions and the plans so that's a whole list and they should all be commed between right so Chuck can you stick some comments in there yeah I'm GNA have to take notes because I have that PD f up there and it's not working for me okay so I will do that right so B basically is just to put commas in the list to be grammatically correct is there anything else in this section and the other thing was you were talking about clarifying and that word was to be changed to certifying certifying okay and the last comma is instead of the word two okay remove two yeah and um when we're done here the two other things that were tiny grammar issues were in numbers 26 and 12 yeah yeah by that one got rid of an extra shall in that sentence it had shall twice in the same sentence and this one got rid of the shell oops you're right this was the extra shell and the other one was missing the body and you added the Buy in sorry my mistake so these are corrected the way I think makes grammatical sense now all right and I did send so Chuck um before this you were going over Tony's comments and did yeah I think we got down to the end um drop this down a bit Yeah so this is the response for the spill kit we added a section I sent that to Andrew Cole he was fine with it um this is pretty standard so that's what I expected actually I expected some fantastic new uh condition that we could add to all the rest of them but you just let me go with what we wrote um prioritize native species that was Tony's comment we just talked about this and that's the end of it there were just several changes can can we go back to 51 again please yep 51 okay 51 51 54a we don't we don't want them to clarify the compliance we want them to say that it does comply yeah it didn't I didn't change that
