for notice of intent D file number 06108 one8 for 21216 tratt Street 418 winr Avenue new residential development of 250 units is Sir uh representative here thank you uh Mr chairman members of the commission for the record re Salvo engineering Alliance I hear this evening on behalf of Parkway holes LLC who's the owner and applicant um of this project so this is our uh third meeting we had a site visit um at the last meeting um the friends of B Marsh asked that we consider a continuation so they could have a chance to better evaluate the site uh we had a pretty productive um site walk um with the representatives that were here um at that last meeting um and a few other people from the organization so they got to really see and understand the project um on site sent them some Supple supplemental information it's my understanding that they sent some correspondence to the commission um indicating their support um for for this particular project um so there have been no plan changes um since the last meeting so I guess um at this point in the game i' turn it back to the commission for any questions or comments Mr chair if I can make a comment thank you for hearing out the friends of the Bell Marsh we appreciate just the time it took to hear their conc concerns and to address them as stakeholders yeah no problem it it worked out really well for I think everybody involved so thanks any other questions from any of the Commissioners how soon do you plan on beginning once approval uh Caleb Manchester 501 East fth Street Boston um the beginning is we have some design work to do we have to get through uh a construction drawing set um which going to take give or take four or five months um and so the plan would be to get going sometime after that within a couple months after that and how soon into it would you start with trying to clean up some of that back area would that be later in the development or earlier on the clean up would be early early on in the process okay thank you thanks uh I do want to just say for the record we did receive an email today from the friends of B Marsh and we'll include this in the submitt uh to the D I'll just excert one paragraph out of here we appreciate the time they spent with us and the work they're doing to not only improve the property for future tenants owners but to enhance the property with Native plantings that will encourage a more resilient environment for developments like this along the river and Marsh so we'll make sure this is included in the application great um is there anyone from the audience that would like to make any additional comments either for against the project so a couple of the conditions we probably will will add will be removal of the concrete in the back and um making sure we don't get any type of erosion and runoff from that back property to the um and I think you adjusted the drawings to show a second row of of erosion control barriers yes and then uh we'll probably add to your storm water management plan on an annual basis to uh Walk That Back Creek area and clean up any solid debris or anything that's on the bank there um no I don't think we have an issue with that okay say um from what it was to where it is and to where it's going to be I think will be a big Improvement for the the area and I think for the environment of that back area that's been a Dumping Ground this is a property that has a large wide open Marsh space and then all of a sudden there's a building that pops up it's surrounded by several tall buildings a lot of tall trees and then at the front of the site the hillside on the other side of the parkway climbs U pretty quickly so I I don't think that that while that has a lot of validity in certain situations I don't think it really fit into again this month for you guys didn't have a a doc number to give us in order to continue and I'm back here tonight okay so yeah we're waiting on the D number right no I remember like um um when we got here on the last meeting um we were talking about how we were going to stop right in front of the mic my name is John Harrison I'm the contractor working with these folks it seemed like um at the S sidewalk it was really noticed that the leeching was working great just with the water coming off of the gutters and down into the yard and um after further review and uh talking with the clients it seems like they they feel that really doesn't need ctech Chambers just because of the way it leeches into the ground as of right now and it's a massive expense for them that they weren't expecting so so to that I think the drawings we saw that were marked up showed two ctech Chambers being added uh I probably think you don't need two but we would like to see at least one added because you are putting an addition on and taking up permeable space so another words you you're saying you you don't feel the leeching that's exists with the current ground would work that you'd like to at least see one yes okay well I kind of I kind of disagree with this the reason is because I've been there for 50 years I've never had a problem with any flooding or any water getting into the basement anywhere in in on our neighbors so putting one of those in in there it's going to take up space I'm going to have gravel underneath there no dirt one of those break it's going to be a very expense for me to call someone in and to dig it up and to replace it that is one of the reason I kind of don't agree with putting one of those in there and it's I'm not building a big house I'm building a small addition the rain is going to come down based on what I have now and what I even have that small addition it's not going to make a difference and it's rain it's going to go right into the ground and putting it in a tank it's going to freeze during the winter if it rains eventually they it's going to crack then I'll have a bigger problem to repair that is the reason why I'm here and I kind of thought about it and kind of did not agree with this so you're you're the one that proposed if you want me to honestly put one in I will put one in but once that tank cracks and breaks I won't replace it and then all that water is going to come up and it's going to cause problems maybe to my neighbors where right now my neighbors don't have any problems with any water it comes it rains it goes through the gutter it goes into the ground like every other Home in the city of Riv any comments from any of the Commissioners I mean I want I want to grow I want to grow a tree a peach tree an apple tree I want to use the the ground to plant tomatoes peppers whatever I normally do I won't be able to do that no more so I would ask the chair is is this something that's the regulation that she has to have it as far as for doing this or is this more of a recommendation they proposed two CeX in their application actually I'm sorry it was one we proposed but then we kind of thought about it and said yeah maybe we could put a few more in there but then I thought again and say I don't have there's no room in the back even put them in the drawings we have in the application show two those are from you does it show two I thought it was one showed one and then we noted that uh we noted to we were asked for someone to regulate the look at the numbers from the roof and that's when we had uh added the second one I could but the original form was just one and but but I think the biggest reason why is cu um when we were at the last meeting and at the sidewalk it just seemed like everybody understood that the water was disappearing we we we did added all that but we have to go based off of the drawings of what you guys submit so um yes so I would just to try to you know ask a question to the chair if they redid the drawings would this then need a new DP number would this be a whole new filing if they no they can amend the drawings just delay it another month so I mean your your options seem to be and twofold now of you know delay it a month redo the drawings and then you'd have to come forward for us to re-approve without having them you you guys already have other drawings just take away that drawing that he stretched out and go it is what it is you know I mean month just of drawing to you to just I've been going through this for about a year now and it's been costing me money on top of money and I'm here again today and and and by putting those chambers in it's going to cost me even more on top of the money I'm already spending which probably would deny me because I'm going to go over my budget so I I think we're trying to come up with a solution we're we're trying to come up with a solution for you thank you so I I understand your hesitation you're upset of the cost um but we we do everything based off of the drawings is submitted with a DP number all of that is done it's basically like Hey we're approving this and this is what you gave us so now you're coming and saying you want to do something different we're not saying no to that we're just saying it just has to be done a certain way I understand so my recommendation if you know and I would put this to the chair as well if they came forward with a new drawing without them would we would that be something that could be approved someone makes a motion and the commission votes on it so that seems to be the option on the table so it seems that you have two options option one is to go forward with the drawings as is and you could get started immediately or option two is it's delayed but at the same time you bring forward a different drawing we approve that and then it's amended okay um I think that's you know I think we have in our possession a drawing that without it without it okay so would we be able to amend that tonight without that or is that did you do the walkdown I was there for for the walkdown so if you as a commissioner feel that the addition um in the Lost space under that addition where water could permeate is fine then you can make a motion to approve it and the other Commissioners agree they'll vote in favor and if they don't then they won't vote in favor then I I think what would make sense for see how many members were at the Joe I know you were there were there we have do you mind if I ask a question real quick before you consider a motion um I don't have written down my notes but how much um impermeable surface were you adding to the site that would then have to be made up by the colberts because I written down it was like we needed three call texts from the last meeting and now there's none okay it was two we're adding 20 by 25 okay no that makes sense thank you yeah I I personally still think there should be one um but it's not my call um any any other questions for then before we turn it over to the audience we're not we're not ready to do voting yet we got to close the hearing no no further questions for the applicant from the expense all right any other discussion if so with it not having flooded for as long as she's lived there for 50 years and seeing what the addition was that it wasn't going to be a massive thing that took over the whole entire property um would you say that it's probably minimal that without having 500 square ft yeah I'm just trying in my head of of trying to think of Pros cons for everyone involved for it um but I do think it makes sense for have it to go to to a vote so I'll entertain a motion um I'll make a motion to uh have the board vote for it as is of to to to amend it to uh to no CeX so your motion is for the commission to vote on approving the noi with no CeX I mean with um sorry with with one sorry with one one yes one okay so you make that motion I make a motion to uh approve the noi with one calltech right is there a second second right we have a motion all in favor I I I I all right it's unanimous so we pass the uni requirement will be one ctech if you don't agree with this when you receive your order of conditions you can appeal that to the D okay uh you'll have uh 10 business days to do that if you decide not to appeal it the order will not become effective for at least 10 business days anyway because the D has to have a chance to intervene if if they want to okay once that time is passed the speakers go out all right once that time is passed then uh you'll have to record the order and then you can start construction okay so those those will be your options we'll go with one that's what they we're going to go with that one that oh it's Transportation Authority this is to renew the Wetland delineation along the mbta's rideway and rev is part of the new vegetated management plan good evening good evening if you want to state your name and address for the record sure thing uh Alicia Toms for the MBTA at ten Park Plaza in Boston need to make sure you're really into that mic and did you want me to do an overview of the BMP or are you all up to speed on that um so so I think we can start off with questions from the Commissioners um you guys have any questions on the full disclosure our hired subject matter expert had his first grandchild and is not able to attend so I'll do my best to substitute if I cannot answer your questions I'll certainly find the answers to them all right well I'll start off while they're looking um so one of the concerns I had was how to how does what processes the NBTA have in place to make sure they're not clearing areas that's not on their property uh because we had that just happen recently within the last 3 months um it was in the last three months I I made inquiries based on your email this afternoon and uh uh the individual who is the Maintenance of Way is in charge of those projects He had no knowledge of it so I still would like to get specific so I can explore that further okay um but okay so something's going on something's going on with the microphone um I just can't hear okay if you want to you can come around and get in front Okay um by way of assurances um the VMP plan itself has parameters that we must operate within uh it's actionable if we do not MD AR who approves of the plan on the state level can visit us at any site and ensure that we are working within the parameters of the plan and that includes industry approved best management practices and whatnot um but important elements are that there are license applicators that are specifically licensed by the state in order to be educated and trained on the identification of w LS and then the application of any herbicide or any action within those Wetlands um and so they're required to uh be knowledgeable about it and then adhere to it as it's their license at stake in addition too there's a a certified uh um vegetation management planner that has to be with the team of people and that's an added measure um so they only applying it within the wetlands they don't apply it within 10 feed of any water um so there's built-in rules and and and subsets we've discussed uh in order to ensure compliance that if they do have to do anything that's outside of those parameters meaning if they are doing something that requires a um uh either interpretation and or cutting of something a branch or something that is visibly in the way of the right of way uh that is a hazard that we need to maintain to ensure safety on the tracks um we're having them do the like a photo log if you will right so we can take a picture of what it looked like and then take a picture afterwards to ensure that it meets the Integrity of the intent of the plan for the safety of the rideway but then doesn't take any Liberties that create concerns for the commission Andor any nearby constituents yes Mr chair I I'm I can I assume that this also includes areas of the MBTA uh right away where there's no tracks at the present time so it's meant to ensure the Integrity of the tracks so it does the track bed itself any vegetation uh and add a measure is it's it's it's a Target application the applicators will have backpacks and they um it's low pressure system on a backpack so they're they're literally pointing it to the vegetation on the rail bed it it will then kill the vegetation in the track without um compromising the Integrity of the track uh they'll do that similarly to the to the railway area to ensure that nothing grows into it as the trains go uh back and forth so that I'm also referring to isn't there other areas in the city that the MBTA has the right of way or and but there's no track there yet I'm I'm referring specifically to the if you go from the end of the Wonderland Station uh North okay uh right up to Rivier Street and and and actually further I thought I might be mistaken so that's commuter real this ve vegetation management plan is for the subway system so it would no I'm referring to the subway system okay so it what ends it ends at Wonderland it doesn't go Beyond Wonderland do do you have does the MBTA also own property on the other side of that that there's no track at this present time I I I always thought that was so no I'm talking about like a right of we okay that allegedly was going to extend all the way to the um the general Edwood bridge at one point you know all the way down to the point of Pines I had always gone under that assumption that you that the NBTA has a right of way back there am I mistaken it's not active is what I'm comfortable saying I'm just a few months with the te so I apologize that I'm not knowing it specifically um we do have the commuter rail but this is not about the commuter rail so that's kis is the operator for the commuter rail I just want to make sure that you're not referring to that right of way um otherwise if you want to show where on the maps that you're talking about I can get that confirmed to say that there's either activity within the vegetation management plan or if it's outside of it and the only reason I bring it up Mr chair is that we've had problems in some of that area back there going up to Rivier Street uh and and I always there were times in the past where I was told that that MBTA property are they have the right away in that area if they have a right to that area I don't know if they also have a responsibility well I think this RDA is deline ated in their application I don't know if it includes that or not which we did not get a chance to walk this down okay um MH so we're probably going to ask for your concurrence that we can delay this and if I can get one of two of the Commissioners to volunteer to schedule a walkdown uh and look at these different areas because as I read the application it looks like the identification of the wetlands was a tabletop exercise and then they sent people out to flag it it was field review but it's delineated by way of tabletop yeah so we can definitely add GPS coordinates I think I put that in in my response the limitation with the field review is we cannot have you be on the right of way I believe you can uh obtain access outside of the right of way looking into the right of way so we would probably need someone from the MBTA or consultant to escort us what we've done in another town we exactly did that the the gentleman who did the field to do the delineations accompanied them and escorted them but we did need to keep it off of the right away we were able to see enough from outside looking in it's a safety measure trains go by and we can't have anyone on the track so um so we can absolutely arrange that okay who from the commission would like to volunteer to do now it might be a good time because it trains aren running I'm not mistaken is the Blue Line oh the search yeah I apolog I have nothing to do all right I need a couple volunteers from the Commissioners Bernardo Wilson Joe all right I will forward the contact information you guys coordinate a day that you can do this um and then report back at the next meeting and then we'll vote on it then that's okay and there any other questions so you you mentioned you done this in another town and if you rem me ask what was the resolution how how were you able to solve it or so we did have uh the flagging ready for the field review to facilitate um based on the GPS coordinates and that was validated um and then I think they asked for a couple more nuances that we we updated and and completed so but the gentleman who did do the initial delineation was the one that we could arrange to be in the field so it was actually pretty efficient and very effective in order to do that what city was that in it was Milton Milton okay thank you okay so you will provide that information we'll figure out a date coordinate it with the consultant hopefully we'll be the very same person and then take it from there yeah and and just for the Commissioners it'll probably be during the work week so you'll need to be aware of that if it need be after hours we can we did it on a Saturday with Milton can you do it on a Saturday yeah okay all right I'll let them I was going to say I don't know what they want to but we can we'll do week before the festival was due and I was faced with having to cancel it um then it turned out the permit was still effective because of tolling during covid uh and I told the person then that I was working with they needed to submit a new application months prior so they don't risk not being able to have the festival so yeah this will be I think the third time thank you any other questions any concerns I love the festival it's awesome yeah thank you it's right uh I know this sometimes to come in front of these things can be like tents of like it's happens in my front yard so my front yard is where this happens so I love it everything to do with it however we can help we're happy to help we uh support Rivier and the sand festival and all that and the uh the actual pier where you guys do the fireworks a lot of years is done right in front of my home which is on pier of Viv so it's uh actually kind of cool to have like my own little fireworks festival right there so um just you know however we can help things like this it's awesome that you have John help tell you months before to be able to do this but um I don't think going to have too much opposition here perfect thank you so representing 1166 Washington Street LLC uh of 63 Elliott Road uh yeah last time we left off I don't think the commission had any problem with it but uh we were waiting for an acceptable site plan uh it did take me a couple months uh to be honest with you site plans notice of intent that's uh it's like rocket science for me but uh I was able to figure out a lot with the help of M Mr commissioner and his office and uh it was a learning curve but I'm glad I went through it glad glad I was able to uh learn something new so thank you questions any questions from any of the commissioners just want to say thank you for taking the time to do it and to to learn that new education of how to do it but uh if there's anyone you can learn from John is the the right person definitely all right um since blocked off the the the beach is blocked off and the state police take charge of it but there's a person there who collects money from all the vendors to help pay for the event right so we don't have anything to do with that we're only concerned with the activities on the beach on the sand any license or permitting they need to have the festival through the city and through the department of conservation and Recreation that's all separate well we have nothing to do with that the event does cost the city money having having the does cost a this is the Conservation Commission so we we're just focused on I don't know how their business model works and the congestion of automobiles at the event is horrible and that also cost the city money for traffic uh I would definitely recommend talking to the DC they would be the ones who I talk to DCR I talked to the city council I talk to your representative but that is not us us being rier is new to me although I lived in rier over 70 years yeah this this is not the right meeting for that and uh the these committees and so forth I only started attend them uh this past year because of certain things that I don't particularly care right if you well you're you're in the wrong place for your current concerns well I'm a street vendor I know the business so but you're not hearing me you're in the wrong place for your current concerns there is a person here who's looking for a permit to have an event in R we are the Conservation Commission this is not licensing permitting any of that you're at the wrong we don't we don't permit any of the vendors we don't permit parking we're only allowing them permission to have activities on the sand let me say this the health department does permit the vendor for a one day permit Health Department we're the Conservation Commission you're in the wrong spot you're in the wrong place you're in the wrong place get the get the thank you for your comments get the event and make some money on it because you have to pay for it can you turn off the mic please thank you oh I'm all alone yeah shocking all right can can you kill that mic all right um we'll finish this up pretty quickly sent out an email with my observation notes when I did the site inspection they were halfway done with the work at the time however the homeowner has confirmed that the work has been completed she's provided clear photographs of the final the final um and the concrete on the front side of the foundation got removed um so I'm not sure if I need like a final walk through before I respectfully request a recommendation from the Conservation Commission to approve writing a letter to the homeowner um stating that she's back in good standing with the wetlands protection act and the city's environmental ordinance so I I'm okay with approving that right now as long as you lay eyes on it to to close that out before the June meeting yeah I'm I'm satisfied um and how quickly she's able to move and get this work done yeah so so we need a motion to approve Lena writing a letter to 100 Arcadia Street that she's met our requirements and she's back in good standing with the WPA can I just say I approve everything you just said you yes okay let's do that need a second I'll second all right all in favor I okay I I uh and just give you a further update on the three businesses we visited over a month ago furong so these are businesses on the other side of the creek from the Pratt Street development 12 furong 14 furong 16 furong 12 furong they clean that site up they've got it organized uh it's it's very good uh so my plan is to write a letter to them saying that they met our requirements uh and they're currently in good standing but we reserved the right to do follow-up inspections in the future and so I'd like to get a vote on being able to do that I motion to being able to send a message to 12 Furlong and letting them know that in the future they have to keep up what they've already done so that will kind of close out 12 furong so I need a second second all in favor I I all right so I'll write that letter that will close out 12 furong but we will follow up uh 14 furong another story uh they have made progress they've got a lot more to do I walked around today and pointed to a whole bunch of things that they need to remove so and I don't need permission to do this but I'm going to write them another letter saying we have seen progress but you need to continue to do this and we're going to come back out in a month to follow up um and then 16 furong there's there's really nothing there that was Sullivan attire their site was anything that had happened on that site was a result of the other two sites so so that's the update on that enforcement um so other than that um we have a site walkdown scheduled for Monday at 900 a.m. it's going to be an all day event uh we'll also be meeting with nich for about an hour to go over their report and uh ask them some questions ahead of time our peer reviewer will be there uh walking down some of the Wetland delineations We'll be asking questions so if you do come it's supposed to be a nice day uh bring boots bring bug spray and keep the ticks off you bring some sunscreen bring water um it's it's we're going to be tramping around it's it's a big it's a big site and there's a lot of delineation and things going on there um so just kind of a warning on that for those that can't make it on Monday uh this is going to come up on the agenda for our June 5th meeting right now I have it on the schedule for June 1st it's the Saturday before I will take you guys out we can't deliberate but I will take you guys out and walk you through everything take us about an hour hour and a half uh if you want to wait to then and see the site for yourself so that feel more comfortable reading the report um if you have any questions or concerns that would generated at that time so that is already on the schedule let me know if you want to do that or not this Monday coming on so this Monday is the walkdown with representatives from LEC uh from Niche me Lorena uh our peer reviewer it's an all day so when you stay all day obious probably 9 to 4 okay if I was able to stay for a good of it is that that's fine you can come as long as you want um I'm just letting people know it's um these things take time if you're going to do it this this project has a lot of eyes on it and we need to be as transparent as possible and make sure we do a really good uh due diligence uh on this um it's just approving the nrad and turning it into an orad uh but they're asking us to approve bordering land subject to flooding to approve some of the wetlands that possibly wouldn't be protected under the wetlands protection act because they're isolated things like that um so it gets a little that's way we brought the peer reviewer in but if you can't make it on Monday but you still want to walk the site down I'm more than willing to do it again on that Saturday June 1st or a different day if you're choosing it's fine I would like to do it on the Saturday I won't be able to do the whole day on Monday so thank you in advance yeah yeah I know people work it's um I I'd like to attend I plan to on Monday I just won't be able to stay the entire time but I do plan to at least come down for as long as I can all right so um and then we'll Jour adjourn here so our next meeting is June 5th uh the July meeting is not July 3rd the first Wednesday it if you look on our schedule that's on the website it's actually scheduled for July 10th I'm just reminding you it's July 10th so don't show up July 3rd um that's great news I couldn't make that there so but you can make the 10 yes I did that
