event manager this is an application for two one-day common vular and entertainment licenses those licenses will be exercised Outdoors at 10 suffk Downs Boulevard on Saturday November 30th 2024 and Sunday December 8th 2024 from 12:00 p.m. to 300 p.m. these licenses will be events uh holiday FS with a Christmas tree popup live music non alcoholic beverages kids crafts and food trucks the expected attendance is 500 to a th000 your name and address for the record please Rachel Atley uh mclen Highway One Beacon Street Boston thank you and can you tell me what you'd like to do uh with these licenses yep so we have two one-day events for the public open um Christmas tree popup shop with wreaths and such we have uh three local food trucks on both dates um music uh on both events as well as is this the first time you're doing this event yeah we just completed uh the temporary this this is a parcel that will F have a future vertical building but it is a just temporary activation parcel your diagram here where you plan to be ating things um where will the food trucks be located so on the if you're looking at the map windr should be at the top of the page so basically it will be a buffer from windr so you'll have the Windthrop uh sidewalk and the food trucks will be right along they're facing into the plaza essentially so all the activations um and folks eating will be on that event for small businesses the expected attendance is 30 to 40 name and address for the record please sir Don Martelli 39 Dale Street uh yes sir can you tell us briefly what you'd like to do with this license yes sir uh I'm I am on the board of the Riv Public Library trustees I'm also on the board of the directors um for the Rivier Chamber of Commerce and we're trying to create some collaborations between the two entities uh to expose uh resources for small business owners um such as the library of things at the library which allows folks to understand how to create an LLC or to launch their business or find a tax accountant and the the chamber is always typically done events either at night with our Gala or in the morning and coffee and tea so my suggestion was let's let's do something after after work at the library to showcase the library things promote the things we're doing at the library which they're doing a phenomenal job but make some collaboration between the two entities because they kind of work in tandem with each other um so the idea was to get you know 30 40 people together uh talk about and have a small panel discussion uh featuring John Murray at M's Tavern and some other local business owners about what it what it takes to operate a business in the city the resources you have as a proprietor such as the library or the chamber or the administration to be able to run a successful business and um typically to to bring people in you have you know beer L and it's more of a cal um casual environment but it's more of a business networking event at the library featuring The Chamber very good uh thank you very much you're welcome do any of my fellow Commissioners have any questions who'll be serving the beer uh uh John Murray and the folks in Murray's Tavern y it's it's one cooler uh no kegs it's all either canned or U beer wine and um stuff that's bottled no liquor that's all right do you have any questions no no questions very good um I take it he's going to set up a kind of a bar situation in the main floor it'll be a single so in the main library as you walk in to the right hand side with that kind of big circular location is there'll be a single table uh with just one probably one or two coolers with uh John Murray his staff and then to the left of that will be a kind of a table this size where I'll be hosting the panel discussion with John and other business owners as the audience is in front of us so there'll be about a half hour networking before the event then the event goes on for about 40ish minutes and then item number three Rockwell realy trust 1380 Nao Road Walter Gary is the manager this is an application for a change of number of spaces for commercial parking lot license the application of rock wall realy trust to change the allowed number of parking spaces for a commercial parking lot license the current number of parking spaces is 45 the proposed number of parking spaces is to be reduced to 32 hello name and address for the record please it's Jean Gary uh 138 M Road Salem M thank you very much can you explain what the what this change is about I um okay I we we've never owned the entire lot um National Grid we've always had a lease with National Grid even way back in the 50s when my dad started it and um when um I took over and the church leased the building we we revised the lease with National Grid I had two Representatives that I dealt with and then all of a sudden in June I got an email from um their new senior representative and they said she said uh you cannot park commuters on that on our portion of the laot and I she says it's stated in your lease and you know I finally like I went over the lease for the fine tooth comb at that point and realized it was I was always under the impression I pay you monthly for the land does it matter what's the difference between a church Parker or a commuter um and I said to my previous reps you know I have a license with the city everything's above board you know it's all good and they've they never came back and said well you're going against your lease so all of a sudden now I'm hearing it and uh I fought it all summer I um offered to buy the land knowing that I could not build on that land because it's why is underneath they never parked trucks or anything there they've never in my 32 years there they have never come to dig up anything I mean nothing never had a problem and if there was some sort of an issue in the lot with a car or if somebody hit a car or whatever you know that's the responsibility of the cars like their insurance is covered for that so I've never had a problem I've had theft um whether it was at night when I owned the nightclub or um whatever with a with a car and I've never gone back to National Grid and said hey you owe me you know for whatever reason and so I was taken aback and um I I'd like to believe her when she said that she went to the all the powers that b and asked if I could buy the link but I don't necessarily do but anyway she said that that was a no-go and I tried to get them to revise the lease and that was a no-go so I had nothing my lease expires August 31st I require the lease because the church needs an occupancy rate so I need that parking that's what my dad had it for that's what we had it for as the nightclub and now that's we have it for the church and um she said no they said no so I got a custom stencil made marked off every spot that is the um church church parking only she came down she sent somebody down with National Grid down with um signs that said um you're going to be towed unless it's authorized parking I put stuff in in the packet that I sent to you with that did you ask me a question I said yeah I see it okay good yeah and so um and then for it was really like the month of September I had to literally police it so that my Parkers would not my regulars knew knew once I put a note on their car explaining the situation they Park just in the lines that are mine um occasionally I get a random person that will park I say to Ira yesterday some people amaze me if you go into a parking lot and the entire back row is empty but there's cars in certain other areas why would you park in the back so occasionally I have to put a note on and say listen don't park here National Grid could tow you and so I have to kind of police it that way now the none of the parking garages park there I mean it's a whole thing so instead of me paying the 40 for 45 spaces I'd like to reduce it because I don't have that income coming in anymore so so the 32 spaces um still able to yeah okay so you still can get they're mind yeah I mean my dad when he bought the property I guess I mean he's dece so I'm not asking him but like when he bought the property there were a certain amount of spaces but um I think that whole strip has people lease from National Grid reality um not just me in my land but like further down I did some investigating here um to see like how much the land was worth and how big the land was not just my land you know I did I mean I did my due diligence and um yeah so we just have that lease she wanted to go I pay um a certain amount of month they wanted to go up they wanted to go up to like 12,000 a year but they they were kind enough to not increase my my thing so I was like you're taking away my my way of living you know and then you're want to charge me more so I was able to get that xade so for the most part now I'm just it's a very small parking lot to park commuters but I have regulars I don't even have signs out front parking anymore like I used to always have signs to encourage people to come in don't even need it anymore I have a handful of regulars that park there now and still Monday through Friday not the weekends the and the church can park anywhere they can either Park on mine or on their on National Grid property because remember they're open at night and on the weekends and I don't park commuters nights at weekends so it's all good no no conflict of interest did National grd ever explain to you why the commute is and not the Church of Vice Versa and I nope and I I tried to get past this woman and there was no getting past her like and I've done like research trying without me going and knocking on the the door in um wherever it is in in wayth or no whatever knocking on their door and literally trying to hunt someone else down she she don't like me you can tell that I called her I was like I'll meet you in person can I come to your office she's like no I can talk to you on the phone and that's it and so I said my plea I've never had a problem and this is the best IRA knows this I said to her she wanted me so not only did I have to do all that but I had to increase my insurance so I had the normal traditional million dooll policy whatever all the policy that I needed right that was all set she wanted me and I had to get a $4 million umbrella on top of that and then she wanted me to get auto insurance I don't drive any commuter's car I don't drive a church person's car I don't drive a a commuter and my two of my insurance people finally the head guy called her with me on the phone and said the underwriters will not provide her auto insurance because she does not have it like it's something I don't have like I don't need it and so she finally waved that so that's how that's how tough she's just not wavering at all but if you could tell me the difference between a commuter and a church Parker great but I that's that's above my pay grade right so that's my problem now okay all right well uh thank you very much for the explanation yeah we'll close this section of the hearing uh are there any proponents or anybody up to haunt people and this is what happened they will not they were very insistent uh they will not give her the right time of day you know and this new person said this is what it says it's black and white and that's what I'm holding to so the National Grid is known for this they're they're uh they're not customer service they're not user friendly and um they're not the this isn't the only thing that I have a problem with with them cuz they are not but City friendly you know as as everybody knows when you see the city council between double polls and the things that they pull you know digging up streets without notifying us very very not friendly at all so uh I'm here to support Gina and U you know let her reduce it and do what she has to do and get what she can out of it appreciate it thank you thank you very much counselor uh are there any other proponents if anybody else that would like to speak on behalf of the reduction of these uh parking spaces we don't see or I had said to the original count representative back back like 29 2009 20 what maybe I had said to him how do I know that this this is cuz my dad had a 99-year lease and he goes it's just going to roll over and I was like okay thank you so I'm going to second in that very good the um application is approved the application for a change of number of spaces for a commercial parking lot license is the manager this is an application to add bottle service for an all alcohol restaurant license the application of 21 R Beach Boulevard to add bottle service to be exercised at 21 rev Beach Boulevard is there anyone here from 21 Rivier Beach Boulevard LLC Michael Aldi owner 21 Rivier Beach Boulevard okay thank you very much sir can you explain how this bottle service is going to work yeah it's just tableside service so a party of four more could they could elect to order a bottle of alcohol served by a tip certified server and it's more of exclusive experience at the table where we'll be pouring off the alcohol at the table it's more of a nightlight thing like right after dinner they want to stay and enjoy with four more people and enjoy some music and get served by us very good do you have any questions on this I do um Maggie uh did you send us something about the bottle service recently I did I actually brought it up to Maggie I sent in a bunch of information a while back asking if we even offered this license in the city cuz I didn't see any byla on you know online or anything like that we've done it in Boston before so that's why we were inquiring and rever we didn't know if we needed it or not cuz we have full entertainment and we have full alcohol till 2 a.m. already yeah I so um the yeah so I I I did inquire about the bottle service um and I did see your request um we were looking for some guidance on this because obviously just the city the so they have something on file for it right um but you know and this is what the VVS right yeah it used to be cut1 yeah it's a New Concept so it's a more night friendly concept well it seems like turning into more of a Night Lounge club type well it's dinner dinner until 10:00 and then we move the furniture around and then it's there's a DJ after 9: 9 to one one right did you did you so okay I mean I I know that before cuz I I I freed your restaurant several times right um it was obviously primarily restaurant based I noticed that you guys are doing brunch parties now and right and um and bringing in DJ and it's a lack of Revenue in that space it's been totally difficult so we're trying to this you know I'm strictly restaurant focused you know even I've done 10 different restaurant right I have done this stuff in the past younger me but you know this is the only thing working in that in this demographic in that space I mean we've hit the wall twice I you know change a concept twice and this is actually bringing in Revenue obviously we don't want issues with it we don't want you know problems with it so we're testing the waters now we've done it we've done DJs for the last two months no issues and now we're doing our Sunday events it's a brunch event and then we do a night event we close down we clean and then we do dinner and then we do the night event right I understand that so I guess you know you know bringing in bottle service um you know again it it kind of feel like it brings you into a space where you you're somewhat moving away from the the the idea of why you open right because I I get the revenue aspect I totally understand I'm not challenging that um but I think it it raises some other questions and concerns um that you know are we truly restaurant base or are you going into it's kind of both it's kind of a mixed base of like a lounge yeah it's kind of a mix we're still trying to keep the viv's identity like be a restaurant Prime restaurant until a certain time and then we're trying to have a little fun after you know because that's what's bringing these you know the 25 to 45y Old demographic who actually spend money in a restaurant from that time frame from 9:00 on in all my spaces as you can see and all of them they're not that busy you know so if I can't generate any income from 5 to 10 you know what are we going to do at this point let me ask a question when you did your brunch party and I I I noticed over the the past at least weekend we yeah two weeks now two weeks now yep um have you received any complaints from your neighbors no noise complaints there was one the other night and it wasn't because of the space it was people outside across the street so the state troopers came I know you know I know all of them obviously what about security we have uh we have a security company insured they're there two three guys at all times okay and what time do they come in they're there before we start and they're there until we lock the doors and everyone's gone what do you mean before you start they're there at 9:00 until the end of the event the brunch parties they're there before we even open brunch is 12:00 to 7:00 yeah we serve food until 6:00 get stay until 7:00 then it's a hard shutdown then we restart at 10:00 we reset up they're they're already there and then we reset up the restaurant and then that last call is at 1:30 so I have a couple of questions well I know a lot of people currently are doing similar things around here cuz you know I own a lot of businesses in the city and you know I see what's going on I'm trying to be a nice version of a lounge restaurant combination that's kind of what I'm trying to do do without without getting any issues without bringing a crowd that I don't want to have you know that's really what I'm trying to do I was there on Sunday I mean it was a decent crowd it wasn't you know I I don't that certainly wasn't my concern and in fact when I went to your brunch party um I I sent Magie an email to inquire about the entertainment license I was a little confused obviously I've known your place to be a restaurant and I was bit surprised well so whenever whenever I would go apply for full liquor I always go for full entertainment so I have the ability to do DJ I have the ability to do uh band music all the good stuff it just with drift and the other entities I don't really need to do anything like that it's busy enough you know we we have we have the crowd all day all night at drift as you can see we have the outdoor bar which I don't really need to do any other live music other than Elon and the Sachs and some other live stuff we've done DJ a drift a few times but you can't because the outdoor speakers you know the residents above it's been difficult I live in the building yeah the good yeah and then a lot of the guys from the brunch party have Liv in the building and stuff like that they've been asking me to do stuff like that at drift for you know years and I've always said no we don't need it here you know but we needed it down there so we're trying other things I'm venturing into Waters I've never you know dealt once the summer goes it's it's kind of dead on that side of the beach It's just tough because you know we have the conservation landan ahead you know no one could sit on the beach ahead of us there's no parking lots over there so we're kind of restricted with what we have down there I okay sorry to interrupt okay so um um bottle service is going to be at happy hour time no only no no no no no this excludes happy we will not discount alcohol as a it's happy hour this you're paying full price for the bottle we're just pouring it off at your table for you at any time but it's just these night events bottle be left at the table nope it's always in possession of our staff No guest could actually physically touch a bottle it's like as if you were sitting at the bar but you're at your table you have your own dedicated server it's like in Boston what they do everywhere you know like I used to go in Miami like you know sexy fish it's like they bring it out and they also have you know it's different from wine and champagne is different this is more like tequila Vodka it's just more of an experience you have six people you can sit at your table you have your own personal bartender and who's your onsite manager currently it's demic who's sitting over here I that yeah and then we also have Jay Rios and the best one you got yeah and then we have Victor Lopez as well no not to Victor so we still have all the same people that have been managing these restaurants from Cut 21 ER are still with us currently well except for one which one Barrett anyway uh I'll talk to you about that one but um but that's all I have do you have any other uh questions so you're going to be basically following the guidelines that you follow in Boston for their bottle service yeah absolutely okay all right well I will uh we'll close this section of the hearing thank you are there any proponents or anybody that Thursday 6:00 a.m. to 12 a.m. Friday 6: a.m. to 1: a.m. the alcohol service would commence no earlier than 10: a.m. on Sundays and 8:00 a.m. on weekdays gentlemen your name and address for the record license yep so K has been open for I think two years now uh I'm not connected to the business I'm just assisting them with the paperwork and translating but um they have a lot of customers that do come in speak into the M what speak into the microphone they have a lot of customers that come in asking for an expansion of the menu mostly with beer and wine so uh they still want to focus on food but they do want to have that option for people to come in enjoy drink draw a glass of wine with the uh diverse Cuisine they offer from Columbia thank you very much um as the gentleman had any experience uh dispensing and serving beer and wine in the past yes he does it was listed on the application he was a night manager at Bruno's Bar located here on uh Western AV Lin and then mam Mia's restaurant at 301 Elm Street in ett and I do see he is tip certified he is tip certified yeah uh thank you very much uh do any of my fellow Commissioners have any other questions do you have an entertainment license no not at the moment do you have plans to bring in entertainment or do any forms of entertainment now that you're adding beer and wine at the most it'll probably be a radio it's a very small space it's not it's not going to be like a full drinking establishment it's mostly just food so it's really just to compliment the food yeah okay the radio will probably be really really quiet you know under conversational L I haven't had a chance to pop into your restaurant but I certainly would love to try do you have any questions good very good uh we'll close the section of the and that license is approved Good Luck Good Luck uh the next item on the agenda uh is a board discussion relative to extending the opening hours to for food service and KN non-alcoholic Refreshments on New Year's Eve uh in the past we have uh voted to allow establish to remain open until 3:00 a.m. on uh New Year's Eve and although they businesses May remain open until 3:00 a.m. they're still required to give last call at 1:30 and all alcoholic beverages that will be taken from patrons and discarded by 2 a.m. now patrons can remain on the premises for for uh Food Service um and entertainment until 2:30 a.m. at which everything shuts down and everybody must be off to premises by 3 a.m. that's what we've done in the past I don't know if you my fellow Commissioners would like to continue that or would you like to make some adjustments to that no I I think we should adopt what we've done in the past and uh we from what I understand there's relatively haven't been any issues and I don't see why we would change it at this point so if it's done in the past oh yeah yeah this is what we've done pretty much um every year for the last many years okay so would you want to continue it would you think that that's what you want to do that's fine with me okay so I would make a motion that we we adopt the um outline guidelines that we have established in the past which would be New Year's Eve open until 3:00 a.m. uh the liquor service will stop for last call at 1:30 all alcohol taken from patrons by 2: a.m. uh and entertainment and food service has to stop by 2:30 and all patrons must be off the premises by 3:00 a.m. I don't so that would be my motion i' second that motion very good that motion uh is approved the next items uh well we have another board discussion about Oceanside and I'm not sure what we would like to do with this uh we do have some reports of incidents that have occurred there and I know they have asked us to consider reducing the police def um so I guess what uh what we would do here is perhaps discuss whether we want to have them come in to explain what what their plan is or I I would like I would like to propose that we we bring in the um Oceanside for a uh a conversation on the record regarding some of the incidents that took place and regarding their inquiry to reduce the presence of Rivier police um I do have some concerns about security at some of their larger events and um I think a uh a formal inquiry on the record is needed here so I do agree with you i' uh look at looked at the reports and it seemed like it's happening very often at least you know in the last few weeks so I would also agree to have them come in very good uh Lieutenant Randle is there a particular officer that generally does the details there or is that kind of on a rotating basis or uh yeah there are some regulars but um I have a couple of reports so I'll try to get the officers who wrote the reports to come here and you can You' be able to question them on specific instances great thank you very much so I guess what we do is uh make a motion to have have them appear at our next meeting and so I would make that motion I'd second that motion very good that motion is approved uh the next items are communication an advisory from the Massachusetts Alcoholic Beverage Control Commission concerning non-consensual drugging occurring at licensed premises and uh the next communication is an annual holiday compliance reminder uh regarding happy hour regulations and that's also from the Alcoholic Beverage Control Commission the next items would be license renewals and there are a a lot of them and I would suggest that anyone interested to see where the license or when the license is renewed would go to the website and uh
