e thank you um the meeting will come to order uh before we begin we'd like to do the Pledge of Allegiance led by Lieutenant Randall pledge of aliance to the flag United States of America to the rep stands one na God indivisible and thank you very much the uh following matters will come before the License Commission today this is our regularly scheduled meeting the meeting previously filed with the city clerk uh the first item on the agenda is the approval of the minutes from March 20th 2024 would you like to discuss those or you want to make a motion uh no discussion I move to approve the minutes I very good the uh motion is approved and the minutes are approved the next items on the agenda is are um actually we're going to be taking a couple things out of order because there are people who have some prior commitments and um as a courtesy we've agreed to take a few people out of order so the first item on the agenda will be a a uh hearing it will involve Emerald business Enterprises Inc DBA roadway in 309 American Legion Highway Danielle Santos is the manager this is a hearing into violations of fire safety regulations and conditions of the commercial parking lot license are there folks here from roadway good afternoon commissioners Attorney Jerry dambrosio 14 Proctor Avenue uh Riv Massachusetts thank you for taking us out of order this afternoon uh along with me is Miss Santos my client uh she's the manager on the license uh the matter that's before you is uh has been adequately stated uh we have had an opportunity to conference this matter with the lieutenant from the fire department who's also here I believe um uh with regard to potential red let me take get step back and say this is a MIAA uh what had happened here at this particular facility is that the parking was regulated through a a computer RSVP system um the manager of this facility uh who is different than Miss Santos who regulates all of uh Mr Philbin's facilities uh did not properly regulate the computer uh reservations um this took place at the end of February during school vacation week as a result the hotel and the spots were overbooked so the spots that were there were the cars that were there was a result of overbooking uh during that week because of the school vacation week uh there was difficulty uh in communication with River fire department uh we were uh the the owner and the general manager were very upset about that the individual for that hotel has been put on a pip personal Improvement uh plan uh to remediate uh some of the issues isues that we identified as going wrong with his regulation of the computer reservations uh in in talking to the uh Riv fire department we've also agreed to supplement their uh communication list for this facility so that they not only have the local manager but they'll have the regional as well as Mr Philbin's number as well so that they can call Direct uh so the the defense on this is a mopa it was school vacation week uh this it shouldn't have happened but it did happen and it happened as a result of overbooking uh these cars did not come from other sites uh these were these were cars that were uh properly booked unfortunately to that hotel and it was simply overbooked uh because of administrative error thank you councelor uh Lieutenant would you like to come up and and address the situation from the fire department's perspective Lieutenant Larry uh fire prevention um I spoke to them and we are in agreement um my main issue was just how long it took to be able to get somebody to help us resolve those issues um so they're going to provide us with all the information we've went by many times they've been complying so I have no complaints there um but one other thing I did want to bring up as a whole is is I think that if if you guys could maybe make um the license holders provide at least even you with contact information so when an emergency does arise that we're not running around we can we can come to the board and say hey do you have contact for you know any of the license holders in the future I think that would make our life a lot easier um okay well thank you if you could just hang for one second do any of my fellow Commissioners have any questions for lieutenant no I don't I don't So you're satisfied with what has been decided between you and the license holder yes okay thank you very much Council would you like to speak on this matter yes and and I'm glad it's um being rectified but I just wanted to um please take your name oh I'm sorry j McKenna wwin counselor um I just wanted to um on behalf of Matt just talk about a little bit about his character um I he probably didn't do this on purpose and I think this is the first incident that he has had but um when I had fires in my uh wad he stepped up and he gave uh the fire victims Free Housing uh free hotel rooms uh at roadway in he also uh helped me build um he donated a fence that was $122,000 for the community of Beachmont uh for the Corey Abrams Memorial Park so he's really a good neighbor and he does a lot of things uh you know as Goodwill so I really think that um if you decide this that you should give them a break thank you thank you very much Council Council I do want to know for the record this isn't the first time they've had this parking issue but um you know I'm glad to hear that they're working with um the fire department to to continuously address the uh the issue okay thank you for let me know is there anybody else that has anything to say regarding this hearing I don't see or hear anybody do we want to discuss this any further forther discuss do you have anything that you want to ask or discuss about this uh just want to make sure that you that Maggie has a member for capella singers and DJ pending approval of required fire safety equipment from the r fire department is there someone here from valari I am sir and your name and address Cecilia Maya very good can you tell us what you'd like to do with this license I would like to bring in um Mother's Day is coming I wanted to try and bring in either someone to play the violin or to play music there's a gentleman um he's a a constant customer at the restaurant and had asked if we were going to provide some type of entertainment for Mother's Day um so I we were thinking of something on that idea I wanted to come up with maybe WI a wine tasting night um have I don't know maybe a group or a DJ something to give us atmosphere at the restaurant I'm trying to attract new clients try to do something different in the community add more you know I don't know more Ambiance to the place slowly but surely we've we've tried to um you know change our furniture change our customer our food we're trying every day to improve on what we currently have or do and so that's that's very good now don't any of my fellow commissioner have any questions um I I'll defer to you uh Rob to address the issue you have any questions there to as well um the one question I have is that when this when you applied for a license in the past I believe the r fire department um informed you that you needed to have a kill switch for your entertainment system so if there was an emergency one switch kills everything has that been done yes sir it has okay very good I don't have any other questions um and the hours will be the establishment uh several times and I'm impress the way it's run so I'm here to speak in favor of it and uh I hope you look favorably on it thank you very much councelor is there anybody else that would like to speak on behalf of this motion hello again J McKenna wwin counselor um I'd like to advocate for Chris too because um uh this year uh when I uh during the election uh he I did a food drive and he gave us everything for nothing um he's he's just a really good soul and the other um thing is he did start the co um drive that was started years ago he started that he had it for a couple of years and then it moved to uh the drift and it's an annual thing so he's he's willing he he's he gives a lot to the community he's willing to do uh Charities and I just think this is a great thing for him to get especially when you have establishments on Broadway that have music and entertainment thank you thank you very much councelor we appreciate that are there any other proponents Angela Gino sa W five counselor I'm also in favor of giving them their license um the license that we're discussing right now is not the one that needs the kill switch the one with the kill switch is Swit last year last year so I think that's that's that's part of the issue here I think you know I I'm not um we're we're not inclined to amend anything on the am entertainment portion of your your license until we get that uh stamp of approval from the fire department um and I know that this is um separate from what you're standing before us today but I I think it's all part parcel to your license I'm not sure how my fellow Commissioners feel but that's the information I received well I mean we have issued license in the past uh with a contingency that um the license doesn't actually take effect until the inspections are done so I mean I wouldn't have a problem um issuing the license in lie of the inspection or which means which would mean that contingent upon the conent on correct so that what that would mean was that the license you would we would approve it but you wouldn't be able to exercise the license until you got the inspection sign off from the fire department understood yes okay all right so I mean I would uh I would make a motion that we approve it based on a contingency that the fire department inspects it and it passes inspection and I would second that we had an architect draw up the plans with the increase proposed increase uh it's been submitted and uh approved by the building Ting very good and the seating is is cleared through the building um department for 22 so I think that is uh that was a sticking point initially okay so you're going to just run a hot dog place out of there and uh 22 22 seats very good thanks so you have any other fundraiser with food DJ and raffle for a service animal nonprofit the inspected attendance is 50 to 100 your name and address for the record please Nicole Tower I'm the owner of the brand letter rip and the representative for Boston harleydavidson very good can you tell us what you'd like to do with this license yes um I'd like to host a bike show for all ages all different types of motorcycles um my nephew is autistic and is receiving a service animal from the organization that we want to donate funds to um the funding will come from raffle tickets sold and from the entries of the bike show um aside from the show we'll have some vendors set up um we previously submitted the application with a food vendor um they have unfortunately since backed out but the dealership location shares um a uh parking lot with Easy Pie it's a pizza place and so we've reached out to them and asked if they would just coordinate the food so that we can alleviate any food issues the only thing we would need is the license for the one day entertainment and to have the DJ so ultimate concessions is not a part of this operation right now correct Y and has Easy Pie agreed to yes provide the food for your operation they'll keep their doors open and so all the food will still be served out of Easy Pie um they'll keep their doors open and we'll just feed you know her people over their way very good have you done this event before I have not no this will be my first time so this isn't what usually goes on in the parking lot no they the by the dealership themselves have different events throughout the year but this will be my first time hosting an event at their dealership how do you plan to well I guess your license only says you're only anticipating 100 to 100 50 to 100 people but usually when there's events down there um tends a lot of people tend to show up especially when it's something to do with bikes m um we have that was just estimated based off of what our Facebook group has done and the Outreach that we've given to the show um we're expecting about that most likely hopefully more than 50 um closer to that 100 range but do you plan to um have a detail off there um yep the and the by the dealership will handle the coordination of that um they're aware and have gone through this process multiple times um with what they need to be in accordance of as well as um making sure the drawing that I've submitted with the parking lot layout does have the fire lanes blocked off um so we've made sure that everything will be cleared for them I know EAS pie um sells liquor will will liquor be S sold outside this um not at the dealership their license their insurance does not cover that so we're not advertising any alcohol at the event um if they if somebody does go to Easy Pie and consume they're not allowed outside of their doors and that has been also discussed with the dealership they're fully aware of that as well very good do you have any questions okay um thank you the microphone please just press that button thank you hi my name is Kirby Diamond codo and we're expecting to have this even at the Ry March thank you very much can you explain briefly what um Franco Fest 2024 is and what you plan to do with the license yes um so frankco Fest is basically in African Caribbean um event if you will a community event that we've done in the past um at Ramy March and is to basically celebrate African Caribbean culture uh specifically french-speaking um African Caribbean culture very good and so I have reviewed the material and as as of the other uh Commissioners and I see that you have um it set up in the field that is where the soccer that's correct field is MH is this where you've had in the past yes and it indicates on here that station two is where a lot of these things will be happening these events uh on on this I don't see where station two is marked is that in the center of the field yes and what exactly would what station two is station two is usually the stage so we're trying to like um position the stage in different location I'm working with rever Parks and Recreation um and that's where we setting up the stage so that people if they're performing they're speaking Etc that's where they would go now you've had this event in the past is that right mhm um and I'm looking at some um incident reports from past events particularly relative to noise complaints were you aware of those uh complains yes um and how do you plan on addressing those this time so in the past when there was noise complaint I would work with the officers that were getting the complaints and we would try to lower the um the volume of the music but that's mostly what we've done so far and I I note that you're not looking for any alcohol or uh beer or wine but how do you plan to keep that from coming on to the premises people bringing them yeah we do have officers at the front door and we also have security so everything is checked um before going into the field when you say offices at the front door what how how is that going to work in the past we had Riv police in front before the gates so okay um Romy March has a gate so before you enter you get checked and then the officer is also there and security also checks you before you enter the field very good and um I see the food is going to be provided by Yolanda Mori and how is how is that going to be uh so it's U basically like a polog this year we're trying to do like a polock version and she's from our community and she would be cooking it would be food African food Caribbean food we're also inviting different restaurants at the moment we haven't gotten a reply so I couldn't put it on the uh on the form so if they do if they do want to provide food then we would add them on is the event free no okay will you be providing or will there be cooking equipment on the premises no so the food is excuse me the food will be prepared off site and brought on site correct very good do you have any other questions so in regards to last year and the complaints that were received um what is it done this year that's going to be different from last year um as I mentioned with the noise complain we would try to put the the music lower but also we're working with the riv Parks and Recreation and we've tried to seeing if we could use um the beach mall location if possible that's something we're still in conversation with because um it's kind of like isolated away from like homes and houses so we're trying different location and we're working on that so it's possible that it might be moved from Romney March as of right now it is at the Romney March that I would say but if it works with the logistics of everything that we're doing then yes you also received reports about um because I see in your license you're not applying for a u any type of alcohol service license or anything like that so but um you had an officer there last year correct multiple officers multiple they were still I guess Sports of a lot of drinking and um um debris left behind on the field and stuff like that so I guess you know you have to just really take uh consideration uh to make sure those things are kind of tailored and and addressed because we want want leave the field exactly the way you found it obviously and and the parking lots surrounding the field um but I'm I'm actually surpris I just this is the first time I'm hearing about I think it's a great great idea is great right we haveing culture here and I do know yoland and her catering I'm very familiar with her as well um so that's good food would be good at least um but the main concern for our um the the commission is the um is the the crowd control and the music so um you know some real effort has to be uh put into it I would I do have a question in terms of the music um is there a particular volume level that we're supposed to keep it within Etc because it's like a it is a bigger event on the field so if there's like any regulation that would help a lot too end R um as we're planning well the city or city ordinance noise ordinance as you can't annoy or cost you know any neighbors with with it so if it's allowed enough that people complain then it's too loud it's too loud yeah so that's kind of yeah let not really a lot of guidance yeah lot guidance I think positioning your speakers a certain kind of way too I know there's uh houses along Harrison Avenue there or Harris Avenue um and like you know and I see that your stage would be like in the middle of the field it might be best to keep the keep it kind of everything going towards the highway yes if you stay at Ry last year we had the the speakers I don't know how I can describe it but the speakers were kind of like facing towards the parking lot of the school so I guess it was going into the houses this way which is why we're trying to do it in the middle so they could face the school and the noise will go this way and maybe that would help yeah I think that would help yeah all right um well very good thank you very much we'll close this section of the hearing are there any proponents is there anybody that would like to speak on behalf of the issuing of this license I don't see or hear anybody we'll close that section is there anybody opposed um I do have some correspondence from the Ward counselor for that area mhm um Anthony cogliandro has uh sent in a letter and I'll read the letter briefly it said last year the festival was playing music well beyond the volume it should have been residents called my phone numerous times that day took videos Etc the music was so loud people's homes were shaking because of the base the police were also called several times and asked the event promoters to lower the volume they did not comply once with that request also there were people drinking in the parking lot and leaving the cups bottles nips Etc all over the place lastly there were people having sex in the parking lot this type of behavior at an event is unacceptable and should not be allowed a license on the field or in the parking lot that our children use so the award counselor has basically come out against your in opposition of your license do you have anything that you want to address on that or um with to my knowledge I those complaints were not the only complaints was about the noise and we did the police officer that was at the door every time the DAT get a report they would communicate directly with me and we would try to put the music down so I'm not sure about that um in terms of the alcohol and also the the activities going on in the park the parking lot I was not aware of so I guess it's mostly will try to put bring people in the parking lot to I guess secure that area as well and watch over that area I would say you could monitor the parking a little bit that would that would probably be helpful what I think would really be helpful if you move it to Beachmont I think you know that's cuz like you said it's more isolated there um you might have um a little bit more discretion when it comes to the music because it's not because you're literally surrounded by yeah people houses and residential the high school you know so on and so from the mar all right well are there any anybody else opposed um I don't see her anybody will close that section um do you need to discuss this further or what what uh type of action would you like I'm not sure about this one yeah I'm not sure I think my only hesitation with just issuing that license is is um the the the counselors and as he put it strong opposition um this is an event that's taking place in June and we're in April um I think that it still affords us enough time to to possibly have The Counselor come in or even afford the um the prospective neighbors um an opportunity to be heard in person at our next hearing I'm not sure if you guys agree to that but again I I I would I would approve the license um based on what I think it offers to the community I'm I'm a strong proponent of that I think there's a strong Caribbean Community here that um sometimes gets underserved and having such event would be great um however um you know the the counselor's um emailed to us earlier is concerning and I'm not sure if if um we I'm not sure if just issuing it out right without giving him an opportunity to either come in or give you know prospective Neighbors come in to come in and let them be heard on record um wouldn't necessarily be a bad idea so that's my my position so I think it's a nice activity you know and uh if you're planning on having it yearly maybe just you know obviously we need to have the counselor you know maybe here and say you know his point of view but um now that you know like what the concerns are in the parking lot what happened last year um just a better idea so we can get a better idea what the plan is are you going to have more people like more are you having police officers there or you know us for us to know based on the issues in the past what are you going to do sure to to avoid that it seems that one of the issues was that at the conclusion of the festival people were hanging around in the parking lot and at least that's one of the complaints that we have here is that the police were called because uh loud music was still going on um after the festival um I would say that's incorrect because um exactly at 9:45 15 or 10 minutes before the event the music was shut off because rier Parks and Recreation make sure because they had to go home and had to get all of their um their items off the field so that music was completely shut off anybody else that would be left in the parking lot would have been people that are helping cleaning out and bringing things out what would you think about cutting back the the time from 10:00 10:00 is I would say that so usually the 3: to 10:00 p.m. usually last year people did not start showing up until 7 p.m. so the three to just give them time to eat Etc but they usually come out pretty late which is why we extend the time earlier so that we give them time to come well I mean from our perspective I mean the counselor coming in I think we know what uh I'm sorry I think we know what he is going to say he's pretty much said it in his letter um I don't know what else he could add to it um there have been three complaints for noise from the last time um the license holder has indicated that she's going to address that I don't know what else you know would it be possible to speak with the counselor you certainly could do that yeah sure you could speak with counselor go Leandro do you do you want us to you want us to table this until you could come into our May meeting because you're your license isn't until June 22 so we do have a meeting in May and we will be able to address any of the issues that um you feel need to be addressed and it would give everybody an opportunity it would also give you an opportunity to perhaps see if you could move the move it to beach m which is more conducive to you know your your situation I mean moving into Beachmont is not a problem it's the field is available so if that's more convenient for everybody then I that's something that could be done well I mean it it would be more convenient although if you point the speakers at the houses in Beach you're going to have the same issue so but you know it's going to require a little bit of forethought as far as how you set this thing up so that you know inconveniencing the neighbors yes because that seems to be the primary problem is the noise from the from uh the speakers the other things I think you can address with just some monitoring you know having people walk through the parking lot uh and and making sure people are ushered out when the event's over so uh what would you like to do would you like do you want us to take a vote on this now or do you want to perhaps wait until the next meeting when you're able to address some of these questions yeah I think I could wait till May very good okay so that's what we'll do we will we'll table this for now all right and we'll bring it up getting here after the start my apologies for that um second there was a clerical era on the application It should read um not beer and uh malt but all alcoholic beverages as consistent with prior years yes no H okay that settles that thank you ma'am um so yes we've um been here at deluso Stadium proudly uh since 2018 um riding a fiveyear national championship streak into the season uh happy to be back again yeah great great program you guys are running over thank you thank you well we've got great support great folks and a great place um so no substantial changes um the schedule is similar to previous years where we play three regular season games those are the first three noted on the application the last two are playoff dates that if we continue to do what we've been doing you know we'll be hosting those games as well but we put them on the application just to You Know cover our bases um the procedure for bringing the beverages in is the same they'll be brought in day of stored in the refrigeration um facilities inside the concession stand served uh only two people of age that'll be checked and then all of the anything left over we brought off premises uh when the event concludes um consumption is relegated to the Grand stands and then The Concourse areas either side of the grand stands extending to the restrooms on either side and um other than that you know we do shut off uh sale of alcoholic beverages at the start of the fourth quarter so thank you very much what's the what's the attendance like uh it's um about 500 give or take uh it varies depending on opponent and weather and other factors sometimes there are other things going on in the city uh which might draw folks away sometimes you know if it's 37 and pouring that's that's going to hurt us too yeah um but yeah I'd say if there's an average number it's probably about 500 have now have you seen the the um the attendance pick up as the years have gone on um so we were on a good streak until the virus hit you know Co we didn't have a season in 2020 as you recall no one was playing any sports at that point 2021 was slow because people were still you know getting back out there and I do not want to jinx things so let me knock on some wood here um we're kind of a victim of our own success we've been doing very well and the games aren't typically competitive and I think that hurts attendance somewhat because people just assume we're going to go out there and win by 40 or 50 points so um again I'm just watching for falling safe in here right now uh but that's to answer your question directly uh we have not seen the increase that we'd like but we're working on it I'm trying to get it better very good thank you very much yes uh do any of my fellow Commissioners have any is the location of the uh longstanding almost iconic restaurant of companions here in the city of river uh the petition is for a transfer of that entity twin Corp Incorporated which has done business in the city as uh companions for decades uh to transfer their existing uh 7-Day all alcohol 1:00 a.m. section 12 restaurant liquor license to uh my clients entity Prato Brothers LLC uh that that is a Massachusetts LLC form in 2022 its uh members are here with me today and they are uh Mr Diego Prato and Mr Juan preiato each owning 50% of that LLC so they control the uh 100% of the ownership interest in that entity uh they're the prospective purchasers of the business from the current owner they're under contract to uh um conclude that trans transaction subject to some contingencies one of them of course being a successful transfer and approval of the license both at the uh commission level here in the city and at the state level at abcc if those if the board is so inclined to approve an abcc signs off they're looking to close very quickly after that uh the subject space is a single story street level establishment at the corner of Broadway and Mountain Avenue uh they will occupy that space pursuant to a lease with the building owner uh copy of that of course is included in the uh application for transfer as a 10-year lease uh and in addition it contains uh an option to purchase and a right of first refusal in the event the building owner uh uh is inclin to sell at any point during the lease term over the next 10 years these are gentlemen who if uh possible would very much like to establish a more permanent Presence by actually owning The Establishment but for the moment and and what's before the commission is they're they they'll be leasehold tenants for 10 years at this point uh they these gentlemen own and operate there they're established and uh I would I would suggest to the commission uh very good restaurant tours they own a couple of a couple of other establishments uh in Lynn uh Mr Juan Prato owns a restaurant called Juan paria uh and in that's over on Western Avenue in Lynn and uh on Broadway in Chelsea they own a restaurant uh which is called Pond quano uh both uh in with respect to the Chelsea establishment the two brothers one and Diego uh both own and operate that um Juan perie has been in business for a number of years as a liced uh by the way those are both licensed establishments uh ju per has had a license for a number of years I represented these gentlemen uh in December of this year before the Chelsea licensing board where they were granted uh a liquor license for the Chelsea establishment uh by all accounts they run uh nice clean familyfriendly restaurants they have no record of problems at any of their uh establishments I can suggest to the commission uh that the expectation would be that if if uh the commission acts favorably and ultimately this transaction concludes and they become the owners and operators of the new restaurant at that location I think the commission would be pleased with the fact that they are are not people who end up end up in front of the boorder Commission because of issues with the way they're running the restaurant um the proposed man yes I just had one question the the other restaurants that they operate do they have alcohol um licenses at those restaurants oh yes both both are all all alcohol section 12 all alcohol restaurant licenses at both locations thank you uh the proposed manager is also with us today he's also a family member but not a brother his name is Omar pre he is a cousin of Diego and one and he presents with a wealth of experience as a liquor license manager he currently is the manager at the Lynn establishment ju peria he'll migrate over to the riv establishment if the transaction does go forward he's been there for a number of years and he was a liquor license manager at yet another licensed establishment for four or five years before that so for the last nine years Mr Omar Prato has been uh the manager at two license establishments again none of which had any issues complaints uh uh or any action by any local boards or the abcc again they run good clean familyfriendly compliant licensed establishments um with respect to their entertainment license uh it's laid out in some detail on the application but they're looking to have kind of conventional television uh and uh background music uh but they'd also like to have the ability to have a DJ uh DJ Sunday I'm sorry th Thursday through Sunday and uh something perhaps uh not currently available in the city mariachi band uh Monday through Wednesday the mariachi band uh would not be electrified or Amplified they would be a traditional Mexican Mariachi Band acoustic guitars who sing they go to the tables they they make the patrons happy and and have a good time they play a little music for them uh I don't know the instruments one is certainly a guitar um trumpet did they have horns horns can can do you know you don't think so all guitar he thinks all guitar okay um but again not not Amplified not electrified so we we don't expect noise to be an issue and the whole point is to uh play a little bit for individual diners at a table so you're not you're not shaking the walls in that kind of a kind of a performance for diners basically it's just something that do you utilize uh Amari am Mari band either of the other two establishments oh so but is it is it currently do you currently have the mariachi band or you're planning to ask for the mar mariachi band at L they're planning at asking Lyn so this is something new for them okay uh but they think it would uh create Ambiance atmosphere and be a um overall Plus for the dining experience at the establishment oh lastly uh We've provided a specimen menu at the time that was generated uh that is not the final menu so to speak it it doesn't you you may note that it doesn't say lantina 2024 but as you may um expect from the name uh or the proposed name of the establishment in Spanish that the fair will be uh principally Latin American uh which would be a change from what was there uh I'll say in conclusion that uh again companions was uh certainly an iconic establishment here in the city it can't be replaced only succeeded but I respectfully suggest that uh these gentlemen are worthy successors uh to a fine family restaurant located right in the center of town on on the main strip on Broadway uh we think it will be a good fit for the city and all all parties are available and address any questions uh commission members may have the one question I would have is for the DJ situation will there be do you guys have a a kill switch for the DJ I heard that in in the previous hearing uh it appears to be something that the commission wants and and fire department or or local I think that's really the fire department's uh as far as that goes we certainly would represent if that were to be a condition of a grant of the license that's not a problem for for these petitioners okay very good um do any of my fellow Commissioners have any questions for these gentlemen no I just want to say that I have been atas and ly and it's fabulous I love it I'm uh excited to have you guys here in Rivier um and yeah good luck I just think that uh I have a question in regards to the Mariachis uh do you have like a particular hour it's going to be open till 1 right yeah the current license is is a 1: a.m. license there they're asking that if it's to be transferred that it stay a 1: a.m. license uh but perhaps my clients could could address the hours of DJ music uh for the commission what's your plan for how late that music would play if it's granted yeah hold the F CL yeah I know miai are awesome they're nice but I think that you know try to avoid them like at late hours CU we have like people on Mountain NAB they understand they're they're in a resident despite the fact that they're on Broadway they're also in a residential area with with a Butters literally next door so uh they're they're cognizant of uh and and they have a heightened uh awareness of that at this point in time and as I said they uh and as commissioner you know they they run family friendly establishments they're not looking to shake walls at at 2:00 in the morning that's not their not their understand the current owner is in a rear um it's in general it's his issue to address but but I uh I'm I've never spoken to the current owner I've spoken to his attorney um I believe I've been told they're in the process of working that out but I can't offer the commission any details about what working that out means except that um Mr St genene understands he's the principal of twin Corp he understands that if he doesn't address his tax issues this can't go through and if this can't go through he can't sell his business and I I think he needs to sell his business for one reason to address his tax issues out to the city but I apologize for not having uh he's not my client and I'm not acting puts us in kind of a a situation as far as we'd like to give these gentlemen every opportunity to be successful but we can't really allow everything to go forward until the past stuff is addressed I understand uh if if I may uh I would I believe it's within the uh commissions perview to Grant Subject to conditions of of uh many Natures uh this one certainly could be another condition if the board's inclined to Grant Subject to uh the current property owner resolving any and all property tax issues with the city prior to is actual issuance of the license yes I think that's uh would have to be something that we would definitely discuss but uh thank you very much for they they've never opened up um the property was a mess uh we have so many photos we've had an attorney involved um we had three property surveys done to try to work it all out with them they hired two survey companies that they never paid they wouldn't give the surveys uh they've had four different attorneys that got involved with this that never stayed with it uh we we've asked them to clean up the property we went over and ended up cleaning it up because people come in it's not fenced in and they pull into our property and there was fences and dumpsters and it was a mess and I mean we have everything photoed our attorney has it um we just can't we've we've tried to work with them then they put a door coming into our yard we have a contract with the state police nobody can enter our facility that's not authorized we had to put a fence up the door comes out and right into our fence so it's not no means of Eis in the building they did a lot of work on the building uh change Windows uh there was no permits we the there was just so much has been gone on but they never opened very hard to work with uh the police has been down there I think four or five times that he called them because we had trucks that were parked he's saying on his property they weren't um it just been you know a real problem and we looked into these people before when we originally came up with they went for the license we had an attorney come up and we complained then that the place was vacant with no license they do not have any other car lots they do not have another body shop facility there we we checked into the background very well in them they don't operate any other facility anywhere and what we were told from a couple of auctions that they're using the license and they're going in they're buying cars and but they're not selling them there and they're selling them out of parking lots and uh and so on so I mean it's it's we've we've had constables come down looking for uh 1087 rare Broadway to serve them and they come into our office because obviously we're 1087 Broadway and it's just been it's been over I I don't know about a year and a half now it's just been a constant problem can't reach them I have voicemails we've tried to talk to them and emails and we've paid the attorneys to communicate with again four different attorneys they'll hire an attorney or they'll get one and then they just then he'll fall off the face of the Earth and and our attorneys have just left holding even the attorneys are falling off the face of the Earth their attorneys yeah and our attorney attorney gold is you know she's away this week but uh she's she's communicated every time you know back and forth with letters like I said we had the property surveys done tried to do a fence uh We've cleaned currently now if you look at the surveillance cameras so today at around 1:00 they brought a 2006 Expedition and they put up for sale sign on the dashboard you can see it on our cameras right now so we thought they knew about the hering because they put this car there and there's been no cars on the property there's a smashed boat on there a broken down car a bunch of debris piled against their building which is a budding our property which we have I mean we have a part of our facility the front part looks like a fire station obviously the back is a towing facility and it's as neat as could be and then you have that and we're concerned about a fire with all the debris in there but I mean we have the surveillance cameras on right now that you can see how it the deplorable condition of it very good well thank you very much for that synopsis um I would think that um I mean you can't hold a license uh according to uh the Massachusetts regulation class two licenses are required to be open to the public for at least 30 hours per week during business days and obviously this business is not complying with that um regulation I would make a uh a motion that we suspend this class two license until such time that the owner comes before the commission to explain what it is they plan on doing with the license I would certainly support and second that motion um I I I I vividly remember um this coming before us it was met with a lot of contention um there was a lot of representations made about what they plan to do and it doesn't seem like any of that was being done I think that uh they need to come before us before we um or give them an opportunity before so I would I would second uh suspending the license immediately I believe this is the gentleman who came before us and tried to say he was going to fit 50 cars 50 cars remember yeah then we were're like well how are we going to do that where you going to put them okay um so um are you all right with I'll second that very good so at this point what we'll do is we're going to suspend his license and we are going to suspended pending um until the next meeting when you can come here um and address this situation so that matter will be closed the license is suspended and that concludes the items on the agenda the next items are Communications notification from the Massachusetts Alcoholic Liberto pastry Inc Liberto pastry shop 28208 Broadway so those licenses the those businesses are currently operating unlik licensed gold silver jewelry precious metal dealers Larry bagnera DBA lva
