the town there's not many restaurants at that time and there's a lot of people who order a night and people order through the online orders so so this is you want to stay open just for takeout is that just for takeouts that's correct so you're not going to have customers coming in custom no after 11:00 p.m. it won't be customers same premises so 11 oh no so 7:00 a.m. to 11: with customers and then 11 to 2 any particular reason why you're limiting yourself to just takeout only at that time it's going to be complicated to have people around inside the store so that means it implicates having more people working in the store because we someone has to control who's coming in and who's coming out at that point there's a lot of people who are really tips on the street so we try to limitate ourselves from that and just do take outs I mean if we if we I mean we don't we don't get into whether they can let people in or not I mean that's not our no I mean you know it it would be a whether or not it's a public nuisance or what do you think is going to it's going to attract something that is going to be derogatory toward the the area residence or the area itself I mean that would be the considerations I think that we would have to but it's highly commercial area it's right on Broadway it is and there aren't I mean there is a couple Residential Properties behind one of the buildings going to have uh outside seating some beautiful tables some different high tops we've had it all covered with some really nice Shrubbery uh as an outline as a barrier and we're going to rope in between that and put some more Shrubbery so it's really closed in nice and tight so people know that's uh that's a patio we've got some clear uh exits and entrances on both sides and eventually we're going to hang some lights uh from the side of the building down so s to light up at night uh but it's almost like the Edison lights it's nothing too bright so it uh won't interfere I don't think with the neighborhood uh certainly some big street lights in that area also thought that are pretty bright and we want to uh create a nice uh beautiful food and beverage atmosphere for for the folks of the town and we think it's going to add something very nice to be able to sit outside on a beautiful patio right in the middle of the city especially at the Gateway where people are driving right in are going to see this beautiful patio and we're going to continue with the same menu you know same same alcohol service out there and uh there'll be constant you know management presence on that outside patio because we know it's outside and uh but with the reputation we we're built there we run a pretty tight uh clean operation down there at M's Tavern No Nonsense um and we we want to be a good neighbor no I've I've been to a place a few times it's a it is a well run operation I'll give you that thank you food's good thank you food's good too now now will you be having any entertainment outside or how's that going to work we will we'll have just small like we do inside we have uh usually one person will sit right in front the side door in the front door uh there'll be one or two people Max there's no bands there's no loud drums outside it's acoustic background just you know just just like a good uh like a music festival um nothing too loud you know one speaker uh no amplifiers cuz we know there's people that live there's a few houses that are right around the corner we want to be cognizant of that too and we we keep it uh we have speakers outside too but we keep it down low so it's manageable so it's just background music more than you know there's a big block party type thing yeah that that would be my only concern is that there are neighbors right you know you are in a residential area there yeah there's three three there's three or four houses just on the side of us and there's one on the back near the back p uh patio little driveway so we'll keep that music down you know as we get close to 11:30 12:00 that music will be down uh pretty low if if you know not at all after 12 we did 12:30 only because 1:00 because we found even lately um people just like to sit outside late we have the 80° weather and it's just it's it's nice to be able to sit outside finally uh when it's not 97 too which is nice I think the again I share I share the concern of the commissioner that um the 1: a.m um proposal or request um is concerning given where you are M um and um I understand based on some correspondence you sent over to the commission that um you would have uh someone singing and possibly playing guitar um you know so the 1: a.m. the 1:00 a.m. entertainment does concern me especially on a Monday Tuesday Wednesday Thursday that you're requesting we could we could end that a little little sooner certainly like I said it's would make sense you know maybe what you think if you end it a little sooner midnight midnight Midnight's probably an acceptable right I think that's probably a good time we get it's for the Neighbors certainly we got a late late push we got a lot of late customers that come in to Mar to 10 10:30 11:00 at night 12 12 a.m. very good do you have any uh questions for the gentlemen I think I'm in the same page as you guys are I've been there love it too um it's just a 1:00 a.m that I'm also a little bit concerned Avenue in R thank you thank you very much uh gentlemen um so the reason why we're here is that we have had a series of complaints over several months um some of them we have Tred to address with you on previous occasions I think you have received at least two letters from us regarding this and one other one than this this is the only one I I don't we sent one in March so this is the second letter I'm sorry I didn't get you didn't get that letter can you just try to speak into the mic cuz we are recording get a chance thank you so what I have here is I have several police reports and several complaints from Neighbors and City officials complaining about the way the place is being run that there are intoxicated individuals after hours that there are people hanging around there causing disturbances the music uh just a series of events that have created a situation that the neighborhood is finding intolerable so I I guess at this point you you want to um you want to discuss this as far as uh I would like to hear um from I uh if the board I have uh Sergeant Matthews from review Police Department would like to uh give some Tes be right to M Sor to hear you my name is Sean Matthews by s 76 representing the Patrol Division of the r Police Department I've worked for the r since about 2011 12 and I've worked the east side of the city that essentially that entire length of the time uh that length of time I've never known a bar to caus as much problems as the pet is uh this person says he's the manager I've never seen him before in my life I'm on there four or five nights a week dealing with complaints and every time I'm on there I'm speaking to different person who claims are the manager he's never been there so maybe he's the daytime manager or the owner but he's never there at night as which is when we deal with the complaints uh a lot of the problems aren't their fault you know what I mean like if people are making noise outside leas that's not really Lea's fault uh the main problem with the Peters is the noise of the music it's it's it's licensed as a bar and restaurant in my opinion it's not a restaurant it's a bar and Nightclub so you have a nightclub in a heavily residential area uh it's not it's not soundproof like a nightclub for example if you go to the ocean front ballrooms the square or any the other nightclubs in the in the city they have soundproofing the Peters doesn't have that so the noise is simply incredible so when I turn up there as a patrol supervisor I have to deal with intoxicated patrons angry staff and Furious residents and it's Thursday Friday Saturday and Sunday the residents don't understand why I can't shut them down the bar staff don't understand why I'm harassing them the patrons don't understand where they can't stand outside and scream and shout and play music in their cars so it's every week now some of that's not the P's fault but some of it is no I've asked them a couple of different occasions to turn the music down they won't turn the music down and legally they don't have to do that legally they have an entertainment license the entertainment license is not linked at the S level so if they don't want to turn it down there's nothing I can do however when it's 1:30 in the morning and you're in a a heavily residential area surrounded by multifamilies in the spirit of cooperation I think it would be nice if you turned down your music well I want to ask you about that Sergeant because your interaction I'm just reading your report how would you say is the level of cooperation because as a lensee they have an obligation to cooperate with City officials do you feel like they're cooperating with you when you interact with the head of security or the manager so the head of security is awesome he's a very nice person and the security staff there work very very hard very hard and anytime I've asked them to do something they've definitely done it however they're not in charge of the bar they're in charge of security like this gentleman says I've never seen him before in my life so when is is he the manager okay so excuse me sir so I wasn't working Sunday so I'm not sure how he he he saiding me on Sunday I wasn't working so right would you say that over service of the patrons is a problem I mean it's a bar it's it's it's very difficult for a bar like that they you know if you're intoxicated but someone who sober go up and buys you drink it's very difficult but the I don't think it's a problem that any bar in the like in the city has you know it's just some people come out a we but drunk and some people don't I don't think they really over serve we have also reports here that says that um City officials have seen individuals um exiting the bar who appear intoxicated with drinks in their hands that's definitely I've seen that trying to hide it um yep I've seen that but that's more a door staff thing a security thing yeah that's that's a security thing the security should be stopping them coming out and I've said that to the security staff you're telling me that's water and a glass there's no there's no bages allowed outside the threshold well uh sergeant in your opinion what what do you think would be some of the things that the bar can do to remedy some of this stuff I think like the music should have a 1 p.m threshold uh do that whole area from like Costa Park all the way down in the H should have quiet ERS starting at midnight where you can't congregate outside bars and play music and and you know generally cause a disturbance cuz we can move them along but then they come back then we move them along so it's a never ending process and again that's not Lea's fault it's a very successful bar but it's very frustrating for the residents they have people continually outside the Peters trying to get on screaming shouting we move them along we leave they come back and it's just a never end of circle you've been out there when they've let everyone out is the music Still blar glaring after 1:00 a.m. after after 1:30 a.m. their music goes right until 2 do would you think that increased security would help the the patrons out front if they had no really I think the I think the music needs to be ruled back they won't okay so in your opinion uh additional security wouldn't wouldn't help at all no cuz the security sta are there work right in front of the bar okay I lived there for 11 years it was quiet straight for a while until this place opened and I have the license here is saying the music should stop at 1 not 1:30 and they never stop the music at 1:00 and they called the police many times at 1 10 1 to call them said they are break breaking the law the music still on and the police came okay usually come in 5 10 minutes and the music stop at 1:30 2:00 and then the customer come out and they start partying and shout and screaming outside in the street out in front of our house and many times me and these neighbors we saw people excuse me peeing outside our garden and we can't talk to them they are totally drunk we scared if we talk to them they might throw something at us or some so just called the police and this gentleman usually come and I saw him with my eyes was asking them to leave go home and one guy was shouting at him about last month don't what gentleman the no the officer the offic the officer the offic yeah he was tell him go home go home it's too late go home after 2:00 and one guy said don't talk to me like this and he was shouting at him and he was totally drunk and my neighbor has a chemotherapy every day he missed his chemotherapy because we don't sleep this girl go to school late every day that boy also go to university late every day we have a Spanish lady her kids she she couldn't do it her kids don't go to school because they are late every every night because of this have you spoken to the owners of the this no we don't know who's the owner and we scared to talk the owner the owner will be powerful man and he has power so we SP we spoke to our representative and he understand and he listened to our story but uh as I said the license said music stop at one and they never do it they have one single door so every time customer in and out the noise in the street so as the officer said it's not built to be a nightclub it is bar a local bar we fine with that it's I mean every area has a local bar but this is not local bar it's a discoe it's night club it should have like the different building like the the double door and some Ro and so and so and because of this mess in the street we cannot find a parking to park our car because from 7 p.m. until 2 there is no space in the street they Park everywhere my neighbor uh Cambodian store they open the gate and they go park inside their parking and she told me I'm scared to talk to them because they're drunk and they might do something um so we two times my car was hit Scratch by the by the drunk people and I'm scared to go and talk to them one time I reported um um on June 9 we have a big bottle fight outside and I guess the officer was there or maybe your colleague women throwing bottle of of beer outside in the street so they can hide the beer and come out in the street and two ladies were fighting in Spanish I couldn't understand but it was reported by the police on June 9 I tried to get the police report I went to the riv and they said no but the the city hall have access to it we took many times video of them I send it to uh Mrs Maggie and uh about 2:30 about 1:30 the music loud and fight and people and the police every time we call them they come sometime we feel guilty to call the 9108 every night every night call 911 I feel embarrassed to call them but they come and like six seven officers they cannot control the people because there are too many people dancing and shouting outside and again I I I agree with the officer the the the security they're good but the guy cannot push them to go home say come on go home go home but they don't go home again I just remember the license said music stop at one it never stop at one never never even last night never stop at 1 the music never stop at 1 and when they stop at 2 and the customer come out they stay in the street for at least 30 45 minutes before they decide to go home and we we are really suffering we it's it's not safe we don't feel safe in the area it's it's like downtown like Chinatown the the discotic area or the nightclub area it shouldn't be like this you know that yeah that's my uh thank you thank you almost it's every night we call the police 911 sometimes they tell us it's not our fault you have to see the licenses until two you have to call City Hall we called the city hall many times the city hall said call the police and we were just to wik to to police and sometimes to the city hall and we don't know what to do okay I heard my neighbor said that they have until one even until one it's not fair for us we have kids we have miners that have to see things that you cannot believe and it's not fair to us I'm someone who has health issues I have lung disease I have to take medicine I have to sleep I cannot sleep our medicine sometimes they are at n and we have kids that have to go to school and mostly every day they are late and we kep calling and we see that we that we have no help and my husband has cancer he he has to do radiotherapy and I understand right yeah it's it's too much we feel like we are left out that nobody cares about us and thank you thank you hello your name and address please um hello my name is El Buu I live at 11 12 Shirley Avenue apartment 3 I'm her daughter um and I live directly across from Lupo's restaurant bar nightclub whatever you want to call it um I think to start off I want to say that growing up on Charley Avenue I'm very familiar with you know bars there's a bunch on our street I think I counted six on my walk home the other day um and I know what you know like having drunk people on the street is like and noise complaints but at the end of the day I will say lupas by far has been the worst been the most people the loudest and overall I've just felt very unsafe I work as a nursing assistant um at a hospital my night shift ends or my evening shift ends at 11:30 I get back home at 1:00 and there's days where my parents will call me and say go to your uncle's house it's safer for you instead of walking the train home um and there's other days where I do have the video every time I'm walking back home I record myself in case I get a insulted or someone bothers me or something and um I'm aware that our neighbors and our community has been speaking to era and I think like as he said earlier everything is kind of goes back to the complaints of the neighbors and the residents um so far ever since I've come back from college and I do go to a city school so I know what nightlife is like lupas is scary it's the worst thing I've kind of experienced um first and foremost I think it's important to know note that the music that they keep is very late it stays until sometimes 3:00 in the morning and I'll check their website it'll say they close at 1:00 or 2:00 depending on the day of the week and they'll still bring in guests after one or two and I do have videos so um I do have like the proof of that and you know more than the music they do let the people stay outside sometimes I'll see the men that are sitting behind me over there um they'll stay outside and hang out with the patrons and if they're not drinking they're still being loud um lupas is kind of causing a very very unsafe place for us the residents of Shirley Avenue are veterans it's old people it's sick people it's young children my brother and my neighbors are telling me they've seen stuff I would have never imagined they would see we have people that are relieving themselves in our backyard we have drunk people that are trying to leave before the police come and they leave drunk and they drive drunk and now not only is this a question of the safety and the places of Shirley Avenue I think it's become a Citywide issue if you have drunk people that are driving and if you have people that are causing our police forces to spend all of their time and their energy and resources at lupas it's the middle of the night I don't know what's going on in the rest of the city and if we have to continuously call the police because we feel unsafe what does that make a space for everywhere else in the city who's going to be able to go there and on time we ALS also had the situation on June 9th where the police had to come because of a bar fight where they were throwing like the beer bottles at each other and ever since then I think I saw the security guard starting to wear a bulletproof vest which kind of only increased our feeling of not feeling safe because now we're like anything can happen here sometimes I'll watch them Pat people down before they come in and other times they don't and I do also have a video of that um so it's just been kind of something that's been going on for a very long time we don't have space for parking we're getting tickets for not being able to park in our residential area because their cars will take our spot and then by the time they do leave it's 3: 4 in the morning and then no one's going to be like feeling safe enough to go and remove the car and then we have things to do in the day so every single night I've been getting maybe 2 3 hours of sleep I work at a hospital like I have to be awake I have to be present my dad goes to his radiation therapy my mom is sick we have people that are going to school and I think even without anyone being sick or having things to do in the day at the end of the day we're people we feel really ignored and we have been for a very long time because we just feel so unsafe pushed aside and ignored just because we feel like I understand that lupas might have like a monetary benefit but what is that at the cost of our safety our health and what does that reflect upon the city and how we're treating our citizens because we've been here much longer than they have I grew up on Shirley Avenue I think it's like one of the best places in Rivier it's diverse and you know there's so many programs for children in the day so I don't understand how there would be something at night so unsafe for our kids too we expect to have kids at the playground and then we're going to have drunk people there at the same time and they're they use the bathroom there they relieve themselves it's just become very unsafe very chaotic and very messy um so yeah that's kind of what I have to say thank you thank you very much anybody else that would like to uh speak at this hearing yes sir name and address please hi my name is uh Nar zri and I live on 110 Shirley AV Apartment 2 um so my me and myself I work at a restaurant and we we usually finish around 12:30 and then obviously the drive home B from Boston is about 30 minutes I get home around 1:00 a.m. and now with the with me coming back I drive there so for me just to find parking I cannot I spend time going up and down Shirley AV Road where where we supposed to park at um we have this little area where it's for the residents cannot find any type of parking there's people parking in like um the entrances the exits like you literally cannot come in and out um I even go down the street a little bit near um Marshalls um absolutely no parking so I'm just spinning around in the car for at least 30 minutes until everything starts clearing up are you attributing that to lupas only or is it because there's there's other there's other restaurants and bars open on that street yes it's um I say it's mostly lupas or like at least from um my road at least the once in the shley AV road we we'd like to find parking and um not only that I've uh I've sat outside in the balcony just also with my first floor neighbors we've seen uh multiple encounters of people just like the like we said previously peeing um on our yard y peeing on other people's uh cars I've seen it I've witnessed it on Saturday a guy just walked up to a this red uh pickup truck and just literally just did it right there in front of us um I've also like witnessed like the um just over the time winess people um just always arguing fighting um just causing a disturbance and there's really no peace within like what we uh with the res um let's see um we have veterans right on the right side of lupas they've recently built it maybe around two years ago now residents from over there also complain and they are US veterans I mean that's just something on its own we have uh people like me the residents on Shirley AB we live right in front of it we always uh see a disturbance um I've lived there myself since 2013 my parents have been there for a little bit longer um and honestly this is like it's just gone too far um like a nightclubs in Boston they usually shut down everything around 1:30 a.m. and they then they start kicking people out and it's way more respectful in Boston and then you have lupas in a residential area causing way more disturbance than I've seen um and honestly I I don't think that's acceptable especially for the residents you know like uh my father has uh is diabetic my mother she's also getting a little bit older now I have to take care of them my grandma also lives with us and she's always in and out of the hospital she needs her rest and none of them can go to sleep and we have they usually sleep around 2 2:30 like a.m. to around 3:00 a.m. and then they wake up uh my parents wake up early in the morning my dad has to go to work early my mom taking care of my siblings my grandma or if my grandma has an appointment around in the morning it's just uh stressful espe and then there comes to me like I said I come around 1: 2 a.m. and um just trying to find parking yeah exactly and it's I find it very unacceptable of uh of that and well thank you very much sir we appreciate no problem appreciate it thank you so much thank you yes sir your Saturday whatever the officer was there and he' been telling him shut down shut down the music he still the same I think the when he was the games for the soccer mhm Sunday yeah the officer was there he was he's doing good job but we don't need to be calling him every minute because there is something more important to calling about a bar a nightclub a lot of noise at the night plus we didn't pay back the the building for the veterinary sacrifice for life for our country we distribute this is no respect for him because that noise he never stop he never stop the solution we need to find out how he's going to shut off the music whatever at 11:00 no more music we can't take it 11: but he go until 2:00 2:30 the Saturday was almost like Sunday with the games almost over 2:30 in the morning and the officer was there said till 2:30 in the morning almost 2:30 and he was there well he wasn't there Sunday cuz he just said he wasn't there Sunday no he was there I don't know know the day because he was kicking the people out I see yeah because the people he coming back from the parking he was doing good job and the back theas this is a parking and he been stopping the the line to to let those people in the parking to go but I don't remember it was Saturday or Sunday there was the games but the problem for Litas is the noise he never stopped it's a lot it's a lot it's over 50 Mega cuz I check it online he supposed to be like less than 50 he go over 70 okay cuz I check it online and I find out the music for the nightclub that that's the music is be loud like 11 if it's going to close by 11:00 he shut off the music by 10:30 no more no music people can sit down drink no problem and thank you okay thank you thank you very much thank you is there anybody else that would like to say anything here yes counselor good afternoon commissioner zra Nova salski 53d H Street W 2 city council um I know my name's been mentioned a couple times they have called me uh more than just late and and the people at 110 112 surely have but I've gotten calls from the HEV 50 Walnut AV which is the highrise across the street around the further up in Walnut AV around the corner from them and to me the only complaint that I've had is the music okay all this other other things that they're talking about I had no clue all that was going on if that's in the police reports I've always told them you know if you have a problem you should be calling the police department to document everything and U so a couple of the people that did complain couldn't get up today you know up here today they had other appointments uh but they didn't want me to mention that they you know they were upset more about the music than anything else um as far as the people coming out of the building again a lot of this stuff that was mentioned tonight are not lupa's issues you know they're after the fact I know people may be drunk and I know a lot of the one of the issues is people believe it or not are waiting for Uber and have to wait a half hour to 45 minutes for the Uber to pick them up CU there aren't that many Uber drivers that late at night so uh they're hanging around and they get noisy you know I don't know what the answer is um but uh the main thing is with the music that you know that my complaint is you know that I've gotten from the folks you know I I live you know like maybe uh 600 feet from from lupas on toone Street it's right around the corner I personally have not heard them uh but the immediate people around the vicinity within 100 ft are the ones that are getting the complaints okay thank you very much do what you you know think is necessary thank you thank you thank you is there anybody else that would like to speak okay you have to press the mic just press the button on the microphone yes thank you thank you I have just a question the place where we live in my opinion doesn't have to have an uh uh uh a night club but if you go online it said it's a nightclub we used to go to restaurant that has bars we can eat people are quiet nice they eat and they drink and we say hi to each other but here it's another story if you go online it's said night club that's my question what is your question exactly can we have a nightclub in a place like in place like that that there is redent I know nightclubs there is a lot there is one near Wonderland but there is no Lo there is no people there is just the the train and they can go and this and have fun it's their right but in a place like our place we don't don't we don't supposed to have a nightclub and and I think after 11: in a place that has uh residents and kids and elderly we music is not I think anyone of you or any person in here they want to go at night to sleep not okay I know that people are paying to come and dance it's their right but it's our right to to sleep and rest thank you thank thank you very much can I add something hello sorry is it okay if I add something I was sure just because of what um council member AA was kind of talking about about his um what he's been hearing about the complaints um I think it's important to note that prior to June 9th there was no written complaint about what was happening at lupas because June 9th of 2023 of 2024 when we I mean at least for when we've been calling about the complaints for the noises and stuff when we spoke to an officer after the big bar fight happened um we were told verbatim that there was never a any kind of report filed prior to that night and that this night they were going to start because now things are getting like serious so what so what's your question for us um I guess I just wanted to kind of clarify again on our end cuz he was saying that our main complaint or the one that he was hearing was noise and for us we're witnessing a bunch of other stuff that aren't just the noise like yes the noise is a big thing but there's so many other things that we mentioned before so I just kind of wanted to reate that well just just so you know we do have complaints dating back to April and um so there have been complaints prior to we have over complaints so they go back of 2024 I mean yes okay just in 2024 yeah but I mean I think he was saying that they haven't been doing them like consistently every single night that we've been calling which I guess plays a role in like not being able to hear all the complaints that we had if they weren't always being filed that's all I wanted to say okay thank you I think we got the message thank you thank you yes counselor Mr chairman just uh two two things um I did speak to U the manager who is actually the owner of the place you know several last week actually and um he know he tells me there is parking in the back for people if they want to use it and he I told him about the noise that was my main thing and he tells me that he is in the process of soundproofing the whole front of the building I said well right now it's not soundproof you know so the noise is still happening so you know they do plan on doing decel levels when they open the doors and all that kind of stuff so excuse me one second but Council refresh my memory when when they first came here wasn't it a restaurant yes and there was never any mention of it becoming a nightclub bit that I can remember no see you know what what happened in in your opinion has the usage of that property change since uh it's it's increased you know and one of one of the things is when he C when they came in for the additional music and karaoke and bands and life and you know you folks approve those things that's when things started to you know increase okay thank you very much thank you you have heard from the neighborhood and so I guess the got to turn on the what what is your position here U thank you first of all uh we appreciate and respect the Neighbors come in and they made some very valid complaints uh about the the neighborhood about parking and about noise and bars and as the sergeant had mentioned we're only one bar in that area okay we're not to blame for all the parking issues and problems that the city rever and the Commonwealth of Massachusetts has right and I'm sure they understand that and there are other bars and restaurants in the area and there are people there no disrespect to the the homeowners and and the neighbors because they're trying to live their lives and we understand and appreciate that one of the issues I've been on this case for two weeks one of the issues that I've been speaking with Mr Gua about is number one full compliance with any regulations regarding the music is shut off at 1:30 two lowering the decb I talked to the sergeant about that he said that's one of the major issues lowering the decibel three my client went out and got an estimate okay from a MSC Corp regarding insulating his restaurant okay where they'll be able to insulate it and absorb almost like massport absorb the sound coming out to be a good neighbor and again what's under our control is the uh security which the sergeant said is good uh continuing not to allow intoxicated patrons into the bar continuing to uh make sure that everyone's out and I think the police officer mentioned clearing the uh bar and establishment you know before 2 a.m. okay we live in a Multicultural Society and we allow liquor to be served we allowed to have restaurants and entertainment okay we have to coexist we have to be good neighbors and we understand that this gentleman uh is owned uh Lupita's restaurant for about a year and a half he also owns the family owns Lupita Bakery for about 15 16 years on shirle AV and they were in shirle AV okay during the transformation okay and I as a resident of the area I've known the transformation and it continues to improve and become a wonderful area to live and work and we want to continue that can I show the board the estimate regarding the installation sure sure can I approach yeah thank you a lot well councelor you would you would have to agree that when when lupas first opened it was a restaurant and everybody was fine with it being a restaurant now it seems as if it is a nightclub and I have to say I think the residents make a valid point that you know had he come in here initially and said I want to open up a nightclub on Shirley Avenue at that location I'm not so sure that we would have all been in agreement with that and so it's almost feels somewhat disingenuous that he came in for a restaurant license got a restaurant license and now has changed the usage to a nightclub much to the Chagrin of the neighbors and to the detriment of the neighborhood so I don't know you know what we can do about that but uh you know a a roll back of ours a roll back of the entertainment license but clearly the neighborhood is is in distress and a lot of the distress seems to be coming from lupas and and again we're here to communicate and cooperate which I've done in the past and with other uh individuals and license holders I've reached out to uh uh Miss Haney regarding um the police reports I been talking to my client about that I think we have a plan going forward okay in order to insulate lower the uh decb okay uh communicate cooperate the sergeant I've all introduce myself I know councelor nitki I'll I'll speak with the Neighbors at any time and again trying to be a good neighbor again this is a uh a small business uh run by him and his family uh they come here in good faith they want to do the right thing they they don't want to become an issue or a problem and again what's under our control I know the frustration about parking and other people in bars and restaurants but again our little corner our little slice of Rivier which is Lupita's restaurant will be uh conducted in full compliance with the ordinance and regulations of the city of Rivier and the Kwal of Massachusetts that's what I can promise and maybe come back here in in 30 days and show the Improvement Council I want to ask you um has your client made any attempts to speak to any of his neighbors in the past eight months since all of these complaints have arosed you know I we can't control what happened in the past all I can say is that once this uh hearing is concluded I would like to speak with the neighbors outside and talk and discuss issues and have sort of like a you know a good neighborship partnership um and again outmost respect for these individuals they taken time off to come here and uh it's their home and we have to coexist well I I'll be honest with you I mean you know just for from my vantage point sitting here listening to the neighbors um and you know respectfully to you counsel I I certainly credit your argument and I certainly um can appreciate um what you're doing here um but from my advantage point I'll be honest with you your client doesn't seem very um sympathetic to the complaints he's hearing today I'm watching his mannerisms doesn't sound like he looks like he doesn't really give a f excuse my language um and I'm very concerned you know just over the past 7 to 8 months um this restaurant um has um goned um over 13 uh complaints at least that's recorded from my understanding from the young ladies representation they essentially call every night that it's open I'm not getting the sense again I credit your representation I'm not getting the sense from your client at all that this is something that he's terribly um concerned about um and for me um I know that usually when people when folks come in with entertainment license we actually just dealt with this at the last meeting I I tend to take the position that look we we're all about businesses thriving and making the most amount of money and you know I rather you let's let's let them stay open till 2 and take the approach like if something happens then we'll address it then as opposed to saying you know let's take this pres preventative measure and uh restrict this business's ability to you know make the most money they can and and be a good uh uh business in the community and provide a service to the community and you know so but it seems to me that that approach with this restaurant was was wrong I think that um you know it should have been uh a situation where let's see how they operate for the first year or whatever 6 months and see if there's and then if they want an extension of hours from there then change it but um I'm not I'm not not uh terribly impressed with uh what I've hear I've heard uh from from uh your side here um and I'm very concerned and I think I have to credit the neighborhood from the seven uh individuals that that live in this community that's been experiencing this issue including uh Sergeant Matthews who deals with this nightly um that something needs to change and needs to change today so that's my position very good do you have any um any questions that or concerns that you want to have addressed well I think that lupas is a successful business congratulations on that right but I don't think that uh that it's following all the rules that it should and that's where the problem is you know um as a community um I do here I feel for the residents I'm a mother I'm a neighbor um and I just just feel that you could absolutely you know run your business but it's not being done properly so we absolutely need to make some changes today I yes we're left what that that's what that was no so um here's here's what I think I I'd like to propose a motion to roll back the hours of this restaurant if it you know it the the intended purpose here the license was given to this restaurant to operate as a restaurant and from what I'm hearing it seems to be um encroaching on an area that um would would put them in a class of a nightclub so I think uh to allow them to continue to do conduct their business as a restaurant I would propose rolling their hours back to 12:00 the restaurant closes at 12:00 I would also propose rolling back the entertainment to 11:30 that all the entertainment needs to be shut off by 11:30 um um and then um of course uh this is not uh something that needs to happen indefinitely Or into perpetuity they can certainly come back and request a change provided that we don't get multiple calls nightly and and and patrons come in here complaining that's my proposal proposal um you know I'm very concerned about it and frankly um based on what I seen from the management from lupas here at the uh you know I'm not I'm not I'm not prepared to do anything else so that's my position I'm one of three and that's what I put that in the form of emotion that's my motion I'd move to roll it back to 12:00 p.m. uh 12:00 a.m. um restaurant closes and uh I would also uh ask for the entertainment license to be uh rolled back to 11:30 and I'm going to second that very good it seems to be unanimous of the board that what we're going to do here is roll the hours back um and if a time goes by and it appears that you know you're you're being compliant with with this set of circumstances maybe we can take steps to to start restoring stuff but the way it stands now um we're going to roll back your hours of operation uh on on your license uh to midnight and then we want the music stopped at 11:30 well I would just I'd like to you know ask the commission um again this is a gentleman that owns a business and establishment and uh this is his livelihood so um I would suggest maybe uh uh that uh one of the conditions be that maybe this is for like a 90 or 100 20-day period where we can schedule something now and then you want us to show you not tell us show us what we're doing to ameliorate and and and rectify these issues I think I think I think the so it seems like our motion Carriage so that's what it's going to be going forward I would like if you if you wanted to come back to request an extension of hours or to change the entertainment license in the hours um you know you apply for it and the first thing that we're going to do on our end is is talk to Lieutenant uh uh Randall here and and pull the the logs and see if we got any complaints over however long it takes for you to do that and and and it it's something that can easily be put right back to where it is provided there's no disturbances in the community provided that there's no complaints um and I also want to remind um your client uh councelor I would ask that you would remind your client that it's it's imperative that when city of officials whe Al be it the police officers uh whether it's Mike Wells from the Department of Health or myself as a commissioner or any of the Commissioners if we show up at your business I think it's so important that we get a level of cooperation not necessarily just from the uh the the uh the security but also from the management and um as the gentleman said here he said he's never seen the owner there and again he's not required to necessarily be on site as long as he has an on-site manager but that on-site manager needs to be known needs to be disclosed we need to know who that person is and and if there is a problem that arise that you know especially uh Sergeant Matthews who is seems to be one of the ones frequen there that he knows exactly who he needs to talk to it's nice that he has a great report of security I think that that's important especially when you're dealing with the police but he needs to say I need Mr whoever on-site manager or Mrs whoever on-site manager is come out here so I can have a conversation with that person and I think that's important that your client understands that as part of um him holding his license that he has an obligation to go up with City officials absolutely yes sir say please okay let me just say best thank you and everything you know but at the end of the day we all have personal issues in life I'm a single dad of two girls I wake up at 5:30 every day every day I get home late I had a heart attack four four years ago I suffered from diabetes I got have blood uh high blood pressure you know I got a kidney surgery last November everybody body who is blaming me for this there's four other places there there's four establishment including one establishment that says nightclub uh I feel like it's unfair for me you know for you guys to cut the hours and everything we can work this thing together I'm willing to collaborate I actually talked to the owner of Las Vegas and he agreed with me that we wanted to talk to um what's his name Conan uh the guys who's in charge of the um um t that's his name right so we wanted to come and accomplish this with the owner of Las Vegas who his name is Raul uh to we split the F so we can have an office there on the weekends and he agreed to do that with me so I'm collaborating as much as I can and about the neighbors I'm sorry about what happening and everything but no neighbor has come to my restaurant and look for me or talk to me or my bakery or everything else so I don't know when they say that I'm a powerful man I'm a scary man no like I said I have a basic life myself I'm a single dad of two girls who has full custody of them I talk to Maggie about this Maggie knows my story since we started open it CU you know like I I talk to her she listens to me and like like I said I'm willing to collaborate with every circumstances that we have and I feel like it's unfair for you guys to cut the hours of my establishment I mean if you guys do you guys do is the law I comply with that too at the end of the day but like I said we are working as much as we can we already have an statment for the sound fruit and everything and about the volum we can work on that like he said give us another 30 days 90 days we'll be back here see what happens if you guys have any more complaints and you know we go from that there's no way of you cutting me the hours right away I I'm not the issue maybe everybody else is blaming on me but it's five other establishments have license I understand that but however you know the there have been complaints about your music I I understand and it's been brought to your attention and you have not done anything about it and so this is the end result of that you if if you have a situation and people is saying hey please turn down the music Turn down the music the officer was here he asked you turn down the music it never happened they said they don't have to so this is this is the end result of that and I'm sorry no one wants to hurt you or hurt your business or hurt your family but there are bigger consideration ations in the neighborhood is a major consideration if someone brings something to your attention as a manager it's incumbent on you to deal with that and if you don't deal with that someone's going to deal with it and it may not be dealt with with the way you like and that's what's happened here so if you want to go over a period of time let a month go by another month go by and if you want to come back before the commission and see if we can address some of this stuff you know I'm all for it but this this is what happened because and I'm going to be perfectly Frank you failed to address this situation before it got here and once it got here you left it to us to address we have to deal with the neighborhood and this is the way we decided to address it and I'm sorry that it didn't work out the way you wanted it to but I want to say councel and I certainly want to point to you because I I feel I there is a sense of solid here knowing that you're going to be involved absolutely the plan that you just proposed I would love for you to send that to Maggie and writing um again knowing that you you're going to be involved and I think that the efforts that you're going to put forward going forward um is going to help his business tremendously um so again it gives me uh the Peace of Mind knowing that you're going to take uh whatever necessary steps to get your client where he needs to be whether it's in the next 60 days or 90 days put this put this back in front of us when you feel like it's ready to go with the plan laasa Yes uh myself address please uh Alo house 24 Chelsea Street heast Boston Mass very good and your name sir I'm the on-site manager Walter P 133 School Street River thank you very much um you received a letter from from uh the commission correct correct so you understand the issues that are U that are being discussed yes can you tell us briefly what uh what your position is on that um so we did receive the letter and um we have been informed in the last couple of months about uh parking uh noise complaints and as well as uh patreon staying outside uh staying after in the parking lot mhm um we've uh gone and done a couple of things to you know improve the situation and hopefully it shows in the next couple of months that uh that it's it's progressing um one of the things we did was let see can I over and show sure sure runss it out of and then the windows we' that's how it is from the outside okay um and then that's from one of the other on we have Windows on the side and then inside of them is that there's oh see soundof trying to soundproof it yes that process itself took like about four months to try to get in because they're specialized Windows okay um but yeah and it's entertainment for we only have it for not like every day and this is is there is there any windows on the side like where the like where typically you guys have like a mariach that's one of that's is that one of the windows the side of the Mariachi that's what I'm looking do you guys have the mar again every night no just Thursdays we have uh they switch th every other Thursday it's not typic play 8 to 11 8 to 11 mhm amazing East Boston location I sat and eight the Marchi band is loud inside I mean you know and again it's a cultural thing so I'm it's no knock on the culture you know the folks that enjoy that enjoy it obviously me for one it's not my necessar couple tea and it didn't stop me from coming in several times you know tacos are great I love the food mariachi band is really loud um you know um and I know that there's been several complaints about that noise obviously protruding outside of the restaurant in addition to the other things that you guys got going on which I'm going to get into in a second um so again the Mari band only comes in on Thursdays every other every other Thursday yeah and when did you have those windows put in uh June 22nd Saturday okay so just so you just it order it was like a 4mon process to get them customized and so and then so you stay open till 2: a.m. yes and so you have some form of entertainment like that goes into we have a DJ that comes in at 11: and ends at 11:15 11:5 and what time do people typically start exiting so we we turn the lights on at 1:15 music it lowered down while we're 1:15 is last call by 1:30 everybody starts getting pushed what do he do for security uh he's actually here we actually do have our security okay had of our security is it one is it one individual and he obviously it started off with one uhhuh it's been a learning process you know the restaurant started off slow and then it just kept picking up picking up and then now that Summer's around uh we we realized we need a second security guard outside in the parking lot moving people along making sure that they're uh you know not staying after they're not playing their music loud and when did you start doing that putting a second security guard out uh beginning of July cuz I know that you have a parking attend that usually sits across the street yes young kid yeah doesn't really do much just kind of stand it's not him it's just him it's just to move the traffic along so I see we don't have people parking in front of the store so we're trying to take up but you have actual security this is Alex and he'll tell you a little bit about what he does my name is Alex Dum um 73 Mount Outer Road Boston Mass um so when me and my colleages we spoke about this security um I know how we were getting that type of crowd and coming in U we make sure we double up um taking care of the parking lot situation um of course the noise complaint um uh making sure the crowd control so we limit the capacity and all that we have a seating charge so we took care of everything do you let people walk out with beers or beer bottles or anything like that that's one of the complaints that there's a lot of cans and beers no none of that issue that's why we have security at the door present at all time um checking IDs at 12:30 um like you said um we turn on the lights music are is off so we're just trying to make sure we we get everybody cleared out the building by before 2: a.m. so now did you say you have a DJ that comes in at 11:00 yes you understand you don't have a license for a DJ it's not on your entertainment license we we do have a karaoke machine but uh we have a DJ that just automatically uh plays just let it play so I'm not 100% sure about that uh entertainment but we are present and we just you're going to have a DJ you need to have a an entertainment license that specifies DJ okay but um that was an oversight on my on my behalf my apologies we'll deal with that um all right gentlemen thank you very much we' like to hear from from some of the other folks about what some of the issues are is there anybody that would like to speak hi um Nicole Toto I live at 310 r street directly across the street so um got a letter sent it in um so I'm kind of going to read it cuz it's in I do want to preface this by every single change that they said they had made has literally been what two weeks these complaints have been coming in since October we as neighbors have tried to respect who they were tried to work with them directly we've spoken to Walter very nice man they they they've never been rude um they've tried they're little fixes they the DJ is there a lot I live on the third floor directly across and my bed shakes when I tell you the base is so ins intense the mariachi band to me is not as big of an issue because it's till 10: 11:00 people need to have a good time we need this is a restaurant and a with the bar in it it's not a nightclub two nights ago they were if I was as far as I'm concerned if I was an inspector walking out front they were overc capacity there was several people they have this little room when you first as you've been in there there this little room off to the right when you first right where the right where the bar is there was the whole room was full full full of people and they're dancing in the in the they're dancing and they're they're they're playing so it's a nightclub they're they're saying it's a restaurant it's a nightclub um my neighbor downstairs who lives downstairs she can hear it and she's on the other side of my building there's reviews online for the same problem we just couldn't my neighbor across the street who's 86 years old and I'll I'll preface this in my letter with the alcohol that's another problem so with the DJ I'm going to so I'm going to read this just so I can kind of go over it um they have a big parking lot across the street for their patrons their patrons employees Park almost the entire Street of of Beach Street I sit on my porch I don't like to be inside I sit on my porch I watch the employees parking on the resident parking I see the employees I also have pictures and videos of them illegally parking um they are parking in their loading zone which they were told by the city that they had 15 minutes to unload and leave they're parking less than 20 ft from the intersection of the it's every night um there the um landlord has been forced we've been forced to put cones on our side of the street because they're they're moving our cones um because they're parking up on the sidewalk I got several pictures of they're they're they're loading people they can't their loading people can't load stuff because they're blocking their loading zone so at the end of the day they we've we've tried to address that they said they would work on it that hasn't happened just the other day I have pictures of them I had a gentleman the other day now my father put a who's the landlord of my building has put myself I have a garage so I'm fortunate enough to have the garage for myself however there are a lot of times I have to park out front because I have someone using my garage guy Parks now again this is not their personal fault but he comes out says I'm going inside I'll be out after I said excuse me but you can't park there can there's a parking spot right there like I par like right there well I have to go urinate and I go okay fine move the car and he did screamed a couple profanities I've been yelled and screamed at a few times from asking them to to be removed um so they have a parking lot across the street I know for a fact they've been asked there's so many other parking lots that they can work with in a valet this is a heavily densed residential area there are no bars the closest is Billy teas down the street they're quiet they are in a spot where you've got a building here a young boy behind them I've got an 86y old man who's they're defecating in his his yard um the fights I have videos of fist fights in their parking lot now this is new with the with the um guard and he has done a decent job of doing that so I'm not going to I'm not going to discredit you know that part it's Friday night I get it but their license is Monday through Sunday till 2: a.m. there is no need for a 2: a.m. and no they do not leave at 1 I know my share of Al what an alcoholic is so I know what they're doing I see them they're coming in intoxicated they come in they're serving they're either overpour or they're serving already drunk people coming into the into this establishment um I'm hoping to see R change sort of just like you just did with this last one in this area there's no need to have a nightclub and obviously they don't have an entertainment license and they violated this since October um which um I'm not convinced that they didn't know um theyve spoken several times to the city um I have a child I got people across and a baby um I'm really hoping and in a parking 6:30 at night should the resident parking really and I know this is not the issue I've been dealing with parking resident parking ends at 12:30 in the morning which means people in my building are parking two to three streets down because we can't find our own parking in front of our own homes and 12:30 is insane they have a huge Park parking lot and they need to maintain that the little the the the the young man I should say he is in the parking lot I have to watch him the other about maybe a month ago not even a month ago break up a fight there was a U-turn come again across the their street another incident with the police with an accident uh drunk driving accidents uh the music uh typically they're playing till 10:30 11 11:00 at night which they did state which is the mariachi band they're not the issue um and I state that it's the DJ the DJ and they they moved they were asked by neighbors and by our counselor nicely trying to work with them to move the DJ to the other side of the building which we would probably never have a problem with the music if it was over there they moved it for one week and it got returned back and it's outside that window this window's right here my building's right there and again for me to hear it sound does travel I don't think they understand that the sound travels um so it's it's really difficult I work 69 hours a week okay I'm 50 years old I'm a single I work at a bank and I and I work at a convenience store at type of thing at night um till midnight so I basically am up at 6:00 a.m. and I come home at 1:30 in the morning so I witness the night and obviously there's nothing going on in the morning it's a beautiful morning cuz it's peaceful um so I mean they arrest all that traffic on that street I've been in I've been living in I grew up in Riv 49 years old so I'm third generation R so I've I've seen this restaurant transform from maos to the next one to the next one this is the only time we've actually witness something like this um they have a night life that's intense that's okay that's your life but this is not the place for that you know they have other places I get it where they're located they're around business location There's No Business besides a convenience store legitimately across the street um so I I do want to mention that the DJ is in the front window I did say that um the alcohol use um that's huge um I I mean I've had to call the cops I hear smash every night smash uh I think three weeks ago and I have a video someone pulling a U-turn out from probably doing a takeout order smash um outside the in the rest the the when they come out I've watched someone actually be held coming out of the establishment two people holding her up like this as she's like this and she can't walk falls in the MD she fell in the middle of R V street she had to be picked up and placed in a vehicle um there they across the street and when I tell you you'll have we had mobs maybe 3 months ago not even 3 months ago a mob of people in the parcking lot the police police had to come they came they they broke it up it was huge they they have these After parties what they're doing is they're coming in intoxicated and I'm I'm convinced of it um because they told me that they stopped serving I believe walta said at 12:30 well from 12:30 to 2: two to three glasses of water anyone knows will so be you up to a point where you could at least walk out the door but they're not they're they're coming out even more they they're just coming out drunk they they're driving they come in now that they recently put a speed bump which I guess is is a good idea because they they have these low riding cars and I watch them from my window one car and they line up I'm not even kidding like you a child would put their Legos their their cars in a line like this and they fly out the pocket just like that every night so no they are coming out the for the couple nights that uh he's there he h i have watched him you know remove people which has been appreciated so I see them working which is nice I mean Friday Saturday well we're talking Monday through Sunday this this liquid license does not they they need to curb that the that the alcohol is huge the music is huge they've done these temporary fixes and they're only doing them now because we've brought this up and it's been a complaint since October that we've had problem with tra the other day that trash guy was there dropped bottles of glass picked up most of it but they left it out for 3 days that stuff was fermenting on the ground before they actually even wiped it up um so they have a dogs outside going after the dogs are destructive too but whose dogs yeah The Neighbor Next Door has these dogs and there's a hole in the thing and there's B there's bags of trash I watched outside um of that hole and the dogs are at the hole like this the well the trash doesn't belong on the ground it belongs and thing they're so busy sometimes that their trash is over and that they can't even close the thing we got to rat crawl them down the street cuz we have a marsh I mean so the the point is they've recently done this the parking the alcohol and the music we should be able to go to bed I should be able to come home at 12:15 in the morning and settle in my my bed and have be up in 4 hours and not have to be up till 1 2 in the morning listening to loud cars alcohol uh you know infused individuals screaming and swearing and partying out front in the parking lot so I mean it really just has to stop it's we've we've tried to work with them peacefully but the parking just the couple of at two days ago 3 days ago there's three or four women in the parking lot screaming at each other this and this was I believe today's Wednesday so it was Monday Monday night 2: a.m. is too long um you know I it really needs to be this is not an area for a 2 a.m. Club it's it's a restaurant so I mean they should have their people in they come in they eat they can listen to light music that's great um but you know 1 1 2 in the morning nothing good happens at those times in this area so I mean for the sake of the residents and my neighbors next door it's it's it's too much appreciate it thank you you does anybody else like to speak on this issue name and address for the record please my name is Dennis Toto I own the property at 310 312 Riv street that abuts the restaurant at the onset I'd like to say that I like the manager and the owner I have a good rapport with them I have communication with them I've had a few minor issues they've worked with it I want the business to stay open I do not want this business to fail it's to my benefit to have a successful restaurant there and anything I can do to make that business successful I would try to do however they D it's always been a restaurant I know the history of that restaurant going back probably to the 40s um the original serrento owners are good friends of mine they live behind my building I've got a a good rapport with them I knew all the owners when Tony Mario bought the building Tony was one of my best friends Bob Sasso who was another owner was another close friend of mine I've always had a good relationship and a good professional working relationship as a neighbor in that neighborhood we've always been able to talk which we still do we can talk and work out any issues the problem now is it's not a restaurant it's not just a local bar or a restaurant where you can have a cocktail with your dinner then you're going to go home it's a nightclub it's a nightclub so from your from your perspective is the issue the DJ at 11:00 till the DJ's a big problem yeah cuz he pumps up the base he's blasting base out it goes right through the walls um now the mariachi band I'm not that I haven't gotten a lot of complaints on them they do stop earlier so I'm kind of okay with that as long as they and I know Alo will if I talk to him he long as I make an attempt to keep it down and maybe put them on the other side now addressing the soundproofing of the window yes they did I know that building very well because I've worked in it I'm an electrician I've worked in that building in the past the walls are paper thin it's not just the window the walls on that side of the building of paper then I mean they didn't have I don't even know if they have insulation maybe during the construction they put it in but years ago that place was built so cheap that you know sound will reverberate through the roof through the walls in it maybe in addition to the sound proofing of the windows maybe something they can put on the soundproofing they can put on the walls that'll stop a lot of the base that'll stop a lot of the sound bouncing out and try to put the people on the other side for the mariachi band okay the DJ that's another whole problem that's potty Central that's everybody's going to get drunk as they can get they going on a party they're going to have a good time Pump Up the Volume and I just lost a tenant on the first floor she just gave her now it's costing me money so I had a tenant move out she said Dennis I can't take it anymore she said the noise is just too much I got another apartment I'm going to move out I got a woman on the second floor who takes melatonin every night to try and get to sleep she works late she gets she's a widower she's a senior citizen she gets home late at night she can't find a parking space she takes melatonin puts ear things in to go to sleep um so that side of the building and then my daughter's up in the top floor and she gets blasted with everything on r street we can put up with a lot of abuse we've seen everything down there but a nightclub in a purely res residential neighborhood that's that's going too far there's two there's families there's elderly I've got behind me there's a elderly senior citizen couple and his wife just her cancer came back I just was informed this week that her cancer came back so obviously that's a problem and they're within 50 ft of the restaurant so I would like to keep a good relationship with Aldo in walta I haven't met his new security but I will and I'm sure he'll do a good job but having a nightclub in the middle of a res purely residential neighborhood seems like a mistake and you know somehow we need to try to fix that mistake so the quality of life doesn't diminish in in that neighborhood so that's all I would like to say whatever we can do um you know and maybe it's a meeting maybe it's getting everybody together on the same page I've got other issues I'll take them with other departments with the Board of Health and traffic and park and I'm not going to bore you with that uh but if you do drive by the building you will see that I have to put cones on my sidewalk cuz my building is literally 6 feet from the curb so a bedroom the bedrooms are 6 fet from the curb so delivery trucks were pulling up on the sidewalk with the refrigerators running the guys getting out slam indoors somebody's bedroom and living room is right there um and it's really affecting the quality of life of the people that are living in there and it's affecting my business also in a in a negative way especially now I'm I get tenants moving out I can't have that I've never had it and I've enjoyed and I've been thankful to enjoy for 40 years in that neighborhood of great relationship with everybody dilio Joe dilio and I had a great working relationship I never had a problem never had an issue he closed at a reasonable hour kept the noise down he was kind of if you knew him he was kind of a tough guy he policed his area and did a good job there no drugs in the neighborhood no problems the Sasso same thing the family they police their area I never had a problem what I suspect is happening is and I don't mean it in a negative sense but I think they've lost control of their customer base okay and how they get it you know they don't want to alienate their customers because they make a money but they've lost control of it and this Board needs to take control of it the police need to take control of it somebody needs to take we're not far off we're close we'll I'll personally work with them with just about anything but we've got to get to a better spot than we're at now thank you thank you thank you very much very well said Thank You does anybody else like to speak yes Mike good afternoon Commissioners Michael Wells director of inspectional services city of Rivier um as a former restaurant tour for 30 25 years this is all preventable stuff um it it and what it entails is Hands-On ownership right we just had a hearing before for lza we have uh laas Enda here and you know when we do a pre-opening inspection for the health inspection you know and a lot of stuff gets thrown into inspectional Services lab um and then we send it off to the respective departments that needs to address it however we build a relationship with business owners and they come to us for a lot of a lot of different things one of the things I try to explain to restaurant owners especially restaurant owners that are but residential neighborhoods right for this to never happen because it's again it's all preventable and it's only preventable if the ownership is doing the right thing and respecting the neighbors because if you don't have the respect of the neighbors this is where we end up right you end up losing two hours of your license and I guarantee you in those two hours those are his two busiest hours right but that's the price to pay when we don't do the right thing so it's important I I I I tell them go when when you're opening go introduce yourself to the neighbors get a stack of gift cards give all your neighbors a $50 gift card invite them into your restaurant get to know them so they have a contact with you so we don't end up in this forum right where you have to make the decision and put their business in Jeopardy right so we've had conversations um councelor Gino and I went down there we with with with Mr Toto we sat there with Aldo we we had conversations um I've had you know Facebook Messenger um um notes from Nicole at midnight okay um regarding trash issues trash issues I think have pretty much been resolved might be a couple incidents here and there but not like they were to me an overflowing dumpster is a good thing that means you're busy right but you need to get an additional pickup so those things can all be resolved um when we don't do that that's when fines are issued for overflowing dumpsters so again I think an overflowing dumpster is a good thing but it needs to be resolved for for an extra pickup right um we we we try to work with them to not get here right um but sometimes they don't they just keep doing what they always did um and things don't change so um you know listen Lupita good people same thing lahasenda good good people but at the end of the day um they businesses have turned into something that they were not intended thank you thank you councelor good evening Council Angela Gino yf5 bitman have I hate that we got to this point um this started off as the neighborhood completely complaining every single night with parking issues um going all the way to to uh from baates all the way down the street to shirtliff and people parking there and leaving 2:00 2:30 in the morning but still partying outside in front of the homes where people are trying to sleep I've actually had many conversations with Aldo and as well as Walter they have complied with a lot of the stuff that I have asked to be honest with you so I complained about the music being on the side they did put it to the other side for about a week and then they pushed it back again since then they put in soundproof windows but I think the neighbors are still hearing the music um they complied with the parking issue that I had with with people parking all over the place they did get a speed bump because people were flying out of the parking lots drunk so that was a serious issue that we were having going up and down Rivia street car accidents happening um fist fights outside uh but they are working with us so I do have to hand it to them they're not like lupas who just seem to be defiant Aldo is not that same type of person he will work with us and do what we ask but as far as now the music is concerned they don't have a problem the neighbors do not have a problem with the Mariachi because it does end at 11:00 but the DJ is now a different story because it is Extremely Loud they do have to scale back the time of when the alcohol is being consumed within that restaurant and I understand where the neighbors are concerned as far as them thinking that it's more like a nightclub because once the restaurant closes it does somewhat become of a bar/ nightclub there's dancing there's singing you know um so what I would propose as the counselor I don't know if if I'm allowed to do something like this but what I would propose is we scale back the time for 60 days to see if they can come to terms and do the right thing by The Neighborhood because it they're great people they really are and I don't think any of the neighbors are complaining about any of that stuff they do have to curb the drinking and at the time that they do drink I want to give them the opportunity to come back and say okay we've done this can we have our license back but I want to give them 60 days of of a scale back time so they can Cal their um their clients all all the the the restaurantes that come in there um everybody who who who drinks everybody who who comes to their restaurant I just want to be able to say okay no this is our time now it's going to stop so maybe the clientele can change as time goes on and they can um do better with the neighborhood but I have to look at the neighborhood first so that that's about it I I I I do feel for the restaurant I do absolutely think they're amazing people they would they are great neighbors but they do have to comply with what the neighborhood wants thank you thank you very much counselor is anybody else that would like to speak uh at this hearing I don't see your hear any gentlemen would you like to come yes Mr Toto I agree with the councelor if we could just amend the hours a little bit for a little while I think they've always been Cooperative they're not uncooperative people I just I believe that they lost control of their clientele lost control of the people but I think if they see it serious and and I from what I understand now they have security they didn't have that before so I'm hoping uh that that will go a long way to maybe getting and they got people outside maybe maybe they can curb some of the problems but I think if we cut it back cut back those hours and let's see how it goes I don't want to hurt the business cuz as I said before there I want when the businesses are closed there I find drug paraphernalia on the street I've picked up hypodermic needles out there when there's nobody there and there's a vacuum in there the bad guys come in and I got all sorts of I got bigger problems this is a problem we can fix this is a problem if everybody's cooperative and works together here we can fix this and and hopefully it's good for the whole neighborhood we agre with you thank we certainly fix thank you fellas well gentlemen you heard from from the neighbors and the councelor um you've heard their suggestions you know that the DJ has got to go because you don't have a license for the DJ number one and it seems as if the DJ is the Crux of your problem seems like that's the thing that is causing the most noise and it's probably keeping patrons in there drinking and dancing longer than they would otherwise so I mean you you tell me what what you think is a reasonable solution and what your your uh what your plan would be um I just want to apologize to Dennis and his family and um you know going forward um definitely we will get rid of the DJ my as a oversight on my part that will never happen again um and for counselor Angela um her suggestion we would be more than open for like 60 days 1:00 a.m. our kitchen closes at 12:30 a.m. give our patrons at least time to take their food to go um if that that works with the with the board we'd be more than open to uh a probation period of two months and uh if obviously off you hear complaints from uh from the police or from from anybody we can uh definitely uh hopefully it works so and also too um go ahead counselor I'm okay with 1: a.m. just I just want the board to know just as long as the dinner is served till 12:30 and then there's no DJ after that we shouldn't find any issue whatsoever so I I want to say um so just so you know with the entertainment license like when you come in to apply for it if you decide to change it sometime in the future which I you know I'm sure you will um you have to be very specific about what you're asking for even dancing by patrons should be on your application because that's not even on there and DJ's not on there so you're you're you're operating well beyond um the limits of your your license right Your Entertainment license so um you know obviously I think the community from what I've heard is it's a lot different than the uh other hearing that we had I think they're all really in support of your business you know I know the family history I've read about it you guys have a great history good reputation in the community in East Boston and in rever too I think um so I I you know my personal opinion and I I can certainly propose this I don't know if it'll be in the form of emotion I want to see how my fellow Commissioners feel about it I don't see a problem with you staying open till 2:00 a.m. um I was actually going to propose that you close at 12:00 a.m. on Monday Monday through Thursday close at 12: um Friday and Saturday stay open till 2 um with some obviously with understanding that you have to stop serving alcohol at a certain time and you have to you know certainly um and then the Sunday I would say you know shut down at 11:00 p.m. cuz it's Sunday night people a lot of folks are getting ready for work that's what I was going to propose um because your entertainment license only says that you're allowed to have cable TV karaoke vocal and instrument music so there shouldn't be a DJ there and there shouldn't be people you know dancing now granted I think that's pretty strict you know couple people moving about their chair right in front of I mean it's not really a big deal but if it's from what I described or the the the the resident here described that you know you have a a area of your your your restaurant that's literally completely full of folks just like partying and dancing then you're kind of in a nightclub area right so when you decide sometime down in the future to amend your license then you need to be very specific about what you're asking for even patrons dancing on the floor it has to be requested um as well as requesting a DJ so I I certainly would not propose changing your entertainment license as part of this order I the way it is now should be the way it should be operating you guys are clearly operating beyond the limits of your license so um it's it again I'm not necessarily prepared to make a motion I want to hear what my fellow Commissioners have to say about it but I'm of the position that Friday and Saturday stay open till two serve make as much money as you can and obviously within the parameters of the the laws that govern the liquor licensing as well as understanding exactly what your Your Entertainment license says that you can do um and also I think that I would propose rolling back your hours um till uh 11:00 p.m. on Sunday and um Monday through Friday 12 12:00 a.m. so that's that's Essen my position and what were you proposing Monday through Thursday what time 11 1200 a.m. 12 Friday Saturday till two what do you gentlemen think about that um our I mean with our kitchen being open I mean 1:00 for me personally and him makes sense with 7 days a week 1 a.m. 1: a.m. and then our kitchen closes at 12:30 and we do get a lot of Uber Eats and a lot of stuff that benefits us from it and that he said too if somebody comes in 12:25 12:29 to get their last meal I think and that gives him 30 minutes and we got to get people out well I think if you if you don't have any music um just just the Juke Box pardon me I didn't say if you don't have any music um I I don't see why you can't stay your K leave your kitchen open till 12:30 um and have everybody out of the place at 1:00 right uh when you do have the Mariachi ban it doesn't seem as if that's a problem right because they di shutting down at what 10:00 11 11 11:00 and it seems like that is reasonable with everyone yeah so I think what what I would propose is that we you we would let you stay open till 1:00 okay and you know across the board Saturday Sunday Monday any night yes because it doesn't appear as if without the DJ you're going to have a noise issue and you do have uh people coming in and eating and you do have take out late at night um so I mean we want to see you business succeed but at the same time we have to take into account the neighborhood absolutely and so what I would propose is that we roll them back till 1:00 um across the board what what are your feelings on that so um one thing I got to say is that I feel that you guys are are willing to work and your neighbors know you guys I see that they all know you by name so that's a different story from what we had in the other situations so that makes me feel comfortable with with laasa um I think I also agree with you guys I mean without the DJ I think you know it's going to be a different situation for the neighbors and you know you still be able to stay a little bit later till 1:00 a.m. it it really helps us out a lot because a lot of our uh customers are in the restaurant industry hospitality and our days off are Sunday and Monday which is why 11:00 would affect us a lot people get out late from work it's mostly servers bartenders and people that are getting out of restaurants from work at 11:00 and we're there to provide their last meal of the night okay so uh what is your feeling on that commissioner that we roll them back to 1:00 and uh allow them to keep the kitchen open till 12:30 day deep six to DJ and see how that goes for Iain I I mean if if my sister wants to uh support it and second your motion I think that the a 12:00 during the week is more than sufficient it's a highly residential area um I'll just stay out the second and you know but again that doesn't mean that I don't fully support this restaurant I think that they're doing great things I think 12:00 Monday through through Thursday um is appropriate for the community based on what I heard um and again and this is this is my opinion Alone um because obviously they said they're okay with 1:00 um but um but my what you think about trying it for a month or so with with uh letting them letting them go until 1:00 and we'll come back here at our next meeting and see how it's going and uh that would let us know if something goes wrong yes ma'am I I I want I do want to say because I know I said a lot but I I'm okay with what you said give them a chance I mean I I think that if we have to come back up here again cuz I will hear it and I will see it and I I'm not quiet um by any means but I think the 1:00 is is fine as long as they're they stop their serving at a certain time with the alcohol and if they're not dancing and they're not partying and they're not out doing their thing they and they can this their servers can just be servers and and drink and then they can shut they can see who's drunk drunk and they as long as they're paying attention to their people as to who's actually had too many too much to drink and let's let's shut them off and do more water I think I would be okay with um giving them chance to to do what they're doing and even maybe soundproofing the wall versus just the window or just moving you know I don't know but whatever I I do they are receptive they're very receptive so I'm okay with that they they want want to work with you so I would think that we would let them give them a little bit more room to fix it themselves so as long as they fix it I mean otherwise if if it doesn't get fixed and we have to come back here in 60 days from now then I think that we're going to go to plan B and I think he laid out a pretty good plan B okay um so I that's where I'm at all right well um so gentlemen I guess this is what uh I'm going to propose and you've already second it so uh we're going to roll you back till 1:00 uh your kitchen will stop serving at 12:30 um and we'll come back here in 60 days okay and we'll see how it's working out if there are problems before that um I'm sure these folks will let us know and then we'll we'll deal with it then so if we have problems we may call you back in here before that but as it is um I think you guys have been you know receptive to the neighbors and I think that you you have a plan in place with the security and the parking and all to to kind of get this thing under control and I think by eliminating the DJ you will now eliminate that element of people who are coming dancing partying and turning it into a nightclub which wasn't really what it thank you very much Andre Gomez 1559 norshore Road thank you um you you understand why we called you here right um well what what do we what do you have to say for about that he can explain to you yeah I'll explain for you guys uh just for comprehension sake um from what I was told and understood uh the uh restaurant stayed open till later than when it shut off uh uh stayed open till 2 um there's still music playing but I also say the music was played still at the normal um volume as it normally is uh so and it's rarely heard from outside um also the paper says that alcohol was served at two uh which wasn't true uh the liquor was last serves either at most at 1:00 a.m. or right before 1:00 a.m. um which we understand uh that the license only allowed last call to be like 12:30 um so that's a mistake on our end were you the Bender that was working that night Matthews came in I wasn't uh but my mom was working that yeah well so you the person speaking on your behalf said that that this report isn't true you spoke with the sergeant directly right and you said he he told you it was 2:30 in the morning and you is it fair to say that you said oh you didn't realize the time was that late yes so and I don't think the report that came back to us said that um there were people were being served he said that when he walked in the bartender was in the process of making a drink he was shaking something but he did note that he counted about nine or 10 drinks on the bar that people had in front of them um consuming at 2:30 in the morning that was the concern um so yeah uh it was correct where people still had glasses in front of them but those were glasses that were left there from 1:00 a.m. from when they were served uh no more drinks were served after that fact and uh from what I'm told of the drink shaking apparently that could have been just misunderstood as just him already cleaning the bar uh there are instances where to clean the cups you'll just dump water into the cups close it and then shake it it's a more efficient way of doing that now you do understand for the 2 a.m. license last call is what time 1:30 rob their license is 1:00 a.m. it's a 1 a.m. license they were hour and a half 1 a. so you guys are hour and a half past your you know so for 1:00 a.m. license last call is 12:30 yeah and 12:30 okay uh and we understand we made a mistake and we're very sorry about it um we weren't letting more people in either at that time after that um the people that were in were more so uh friends um and also but beside that no more people were let in the doors were closed uh lights were on I'm just trying to understand to to that day and what happened this is not something that normally happens was this an event that happened that day like a birthday party or something and everybody just stayed late yeah people just stayed late um um also uh we had people already before that we had so the kitchen was also closing way later than it usually does so we still had um the chefs there um but no this is I mean this is the first time that it's happened for us we've been compliant um for the most part or for how long uh just over a year we opened uh end of March last year and this is your first complaint yeah okay thank you very much council did you want to uh speak on on this subject thank you commissioner members uh iron noas salski 53d H Street W two counselor uh I live 100 feet from the place and I was shocked when I heard that there was an issue uh they've only been open about a year and uh they run a nice business like I said I couldn't believe what I read uh I felt bad uh hopefully they learned a lesson and where it's their first I haven't heard anything since then since you know a month month and a half ago um where it's our first time you know if you want to do something that's up to you but you know I think it's uh it's not three strikes R have you received any complaints from constituents about not a one not a one you know the next door neighbors one one side and across the street and uh over uh the new Riv Business Place there nine Apartments over there haven't gotten one complaint okay thank you very much C you know I would I would ask to be ask you to be lenient on this one and give him a shot thank you thank you I I would just like to say that um on behal of the Rev Police Department that serving an hour and a half past your license is beyond disturbing I mean they have a 1:00 license at 2:30 the cops told me they were operating like it was 10:00 at night yeah there were people dancing the bartender was serving drinks and the there were 19 drinks on the bar I find this extremely hard to believe this is the first time that they went beyond their their hours if if they went this far beyond just my opinion I I think I think that um you know I think I think your business has a really reputation especially based on what the counselor is um saying um I think that you should consider looking at your operation hours I mean you know if if if you know if you need to amend or make some changes there in terms of the time you should consider that um but I don't think at least my position is I don't think it's something that we need to act on at at this time I think you're on notice that um what what you need to op what you need to do under your license and um you know I certainly would propose just keeping it on file and or filing it excuse me um and you know you take heed to what we what we're we're telling you that you can't you can't serve that late clearly and obviously your licens until 1:00 a.m. um just operate within your parameters and we'll just put this I I would propose putting it on file um and and taking no further action from there uh sir did you have something that you wanted to uh I just came to see not I understand not good purp enough I just wanted to make sure that you you were you were recognized I'm very thankful of that okay well you've heard from Lieutenant rall he's disturbed by it I mean have your right so it's not as if it's a few minutes over or it's a close call or anything like that and it appears that your bartender was not really all that um Cooperative Cooperative or uh didn't seem to to show the officer much respect sorry sorry uh didn't mean to interrupt uh I just want to add to that that what I'm told is that the officer came in with more so of a lack of respect where he was already screaming at U my mom and the other employee uh that were working there and continue to do so throughout the rest of the night even when he was asked to lower his voice so because they were being compliant and even when he was asked to not be yelled at well for them to not be yelled at that you know this is understandable he continued to um scream or yell or just be rude about it we understand that the restaurant was not supposed to be open at that time and it won't happen again uh like the was mentioned this our first time of this happening and we're very sorry about it but also to say that our employees weren't showing respect to the officer I don't think would be a correct way to put it okay um commissioner osen has um made a motion to put this on file what do you feel about that I think I I agree with you I mean it's it's been a while since you know a year and it's your first complaint um you know I think it's a lesson not to happen again and um I do hear what you said about uh uh Sergeant Matthews but you know our notes are clear to and what happened and um you know hopefully that doesn't happen again uh so I'm going to second that okay so I think that that probably makes the most sense is we will put this on file however if there is another issue this is going to be considered when we discuss the next issue as well so it's not going away we're just going to keep it on file and hope hopefully we won't have this situation again so just so you're clear you have a 1:00 license 12:30 last call all by by 12:45 all the drinks should be off the bar there shouldn't be any empties or any drinks at all and by 1:00 everybody needs to be out yes sir okay okay all right good luckk
