and members of the board uh my name is Nancy O'Neal I an attorney located at 14 Proctor Avenue and I represent the applicant to Podge Development LLC uh we are requesting a continuance of this matter tonight um as legal advertisement uh was omitted from the Rivera Journal edition of May 8th uh 24 2024 uh so we are requesting continuance uh of this matter to uh uh a meeting of the zba uh in June to allow for uh proper legal advertisement to occur thank you are there any proponents anyone in favor hearing and see close that side of the hearing it's because we're continuing is there any opponents calendar to number and if he doesn't show up then then we'll deal with it next application is a 2406 Al EST 79 Devon Street Boston requesting multiple variances to enable the appellant to construct a 122 by 242 foot addition at the Northeast side of the existing single family home at 25 wnv good evening yes if you could take press the button state your name and address for the record uh yes hi my name is Al Estes address of the property your company address 79 79 dev Street bus and mass okay okay do you want to add anything to it or the application speaks for itself uh I believe the application speaks for itself so I'm the architect on the project I'm helping Kyle uh Sheriff he's the homeowner and the current resident of the property and he's just looking to uh do a small addition uh like it was just said 12 and 1/2 by 24 ft on one side of the property uh that is uh adjacent to uh a a driveway on uh the neighbors uh theuts okay thank you um seeing that this a public hearing proponent it I'd ask for the ward counselor to step up to the mic please hi thank you uh Angela Gino sa W five city councelor um I think Kyle has done his due diligence and has spoken to everybody that's lives around him and none of the neighbors have a problem with him doing um the addition so I will support this thank you are there anyone else as a proponent seeing and hearing the L close that side of the hearing any opponents anyone opposed sing and hearing not I'll close that side of the hearing any members wish to speak yes I think my biggest concern is your parket spaces parket spaces you you got total of 15 ft for two vehicles I mean is there any Reon reason why he's not putting that in the back I mean hit the addition uh yes there's a couple of reasons so there's an entrance to the basement on the back of the house uh there's a deck there's a couple of uh site improvements in the rear of the property that would make it challenging to do the in addition to the interior layout of the house um it would make it challenging to do the addition on the back that was the first option that we looked at um we would also uh we also have the rear setback which is a bit larger that we would um have to work with I mean I don't oppose the addition what the pcking is just really asking we're going to ask the wad Council because they did have a meeting at the area and I believe that the abas assumed that it was street parking and they weren't doing the lot so so in the point of Pines we have 24/7 parking so it it's resident only parking for 24/7 like you couldn't come over there and park without getting a ticket so we assumed that they would be parking in the street like they do now so we have no problem with them building that addition to their home okay so he can he could do one car in that lot and the other car will be in the street exactly that would be fine yeah yeah yeah thank you any other speakers would we be able to make that recommendation along with the site plan review our regular restrictions yeah okay then would be asking for a different variance because you need two you need twoes for a single family so he' be asking for a one VAR and could we allow that could we do that tonight and not have to advertise it again I mean I would have to device m okay so there's a motion to approve with the condition of having the plan resubmitted with one parking space and the board would be granting the variances for one parking space Ong with the other variants that are requested is there's a second okay could you just clarify that with the hour the S sure so the variance variance is being requested at this time would be a variance of section 17241 with respect to the minimum sidey setback requirement and a variance of section 17 28020 the minimum parking requirements for a single family home shall the zoning board of appeals Grant the relief requested subject to the following conditions the plan shall be updated to reflect one parking space 9 by8 in the driveway second condition if the rights authorized by this variance are not exercised within one year of the date of the granted this variance the right shall lapse this variance shall not be valid until appellant has recorded this variance in plan in the SE County registry of deeds and submits document recording numbers and dates to the city clerk and the building inspector of the city of rier the appellant must receive site plan review approval prior to applying for a building permit shall the zoning board of appeals Grant this relief Mr lemina yes yes Mr loes yes Mr O'Brien yes yes Mr Pelton yes yes and chairman Tucker yes the Baran have been granted subject to those conditions uh yeah and I got most of that so um I we have to go to site plan I know we have to update the plans to show a single parking space that makes a minimum requirements so that's you know totally fine um and then the part that I was confused is that registry of deeds so does something need to be once you re after you get site plan review approval then yeah once you once the decision is recorded written up and recorded with my office there's a 20-day appeal period at the end of that appeal period if no one appeals the decision of the board you can then report you'll have to record this decision in the plan add the reg of Deeds on the deed and then once that happens
