right it might be different prescription maybe it's Blended a little B better but these were just you know I wear prescription glasses I could he's doing anyway um you know no my ey don't oh I have to if I'm repeating myself but are there any public comments okay um seeing none then um go into the first item on the agenda is to review select board minutes um meeting minutes from February 27 I think it's actually 12 isn't it yeah it is why did I have March the um it's the 26 today that's the meeting for tomorrow no but it says online oh we have a meeting on March 12 I mean March 27 but the last meeting was March 12 we do not have meeting no I think that's the right agenda I went back and I found minutes from February 27th from Geneva had we already approved those 27 yes I think these last on she took them right okay okay I'm yeah anyway this was confusing yeah no I printed this out from something and I had February 2 I think it's wrong on the yeah maybe it was it was wrong on the the agenda yeah okay um so it's March 12 I did take a look at those too is there a motion to approve those minutes of March 12 mov second um any discussion okay I I moved it so I I moved the motion and Eric second and Melissa Melissa I'm sorry andita they are it says the February 27 on the agenda that's my mistake okay that's all right I thought I was going nuts you are going nuts I thought you said and farell I and um since we have a minute I just want to back up and I want to um for those of you who haven't um already met Janette Kylie um Janette is now our new assistant Town Clerk and this even she is filling in taking minutes because Geneva Bickford who was our administrative secretary um unfortunately um left the employee of the town of shry to take a full-time job with the town of monu Board of Health so um she didn't want us to make a big deal about it we had a little celebration for her at the Town Hall um and we were sorry to lose Geneva and we really appreciate Janette here um stepping in this evening to help us out and um the job her administrative secretary is posted on the town website as well as the um job to the land use cler so um there are two jobs up there so again thank you Janette and um thanks to to Geneva for um her work with the town uh so the next item on the agenda is to review the second draft of the annual town meeting Warren and Becky I'm going to turn this over to you we've been through this once and there are some changes some additions yeah okay I have it up on M I can or have been going through all the kind of standard um articles that we've already done Becky if you would um this this will be available as part of the minutes from this me right this graph so people wanted to read it but if you could highlight um what the changes are that would be great okay so um the bulk of the warrant was first reviewed two weeks ago um we're moving down to the first edition to the warant is article six a request by the energy climate action committee um to put on a warn article for the specialized energy code um they the energy committee did a presentation about on this about two weeks ago um they do have that presentation available for people the specialized energy code has um significant change es over the stretch code the regular stretch code that the town had adopted into around 12 um 2012 and um we hope to have another information session but it's only in the planning stages we don't know if there'll be time to do it um any questions on that could be directed to the energy climate action committee and I assume is that presentation is there a link to that presentation on their website or do people have to go to I believe it's on their website I'll double check yeah we should just make sure it's it's there um article seven was requested by the Athletic Club on to the select board they had one consideration um to open for brunch at 10: a.m. on Saturday Saturdays and Sundays and have the ability to serve about the at those times which they currently do not have and requires the town to adopt chapter 138 section 33 Okay article 11 is um being requested by the chair of the cemetery commission Walter tibits he um on the encouragement of his other members they have come to realize that Walter does significant amounts of repair and maintenance um to equipment that the cemetery commission uses as well as he often jumps in and does a regular grounds keeping work all the work that um the other members of the cemetery commission have pointed out are contained in the cemer grounds Keepers job description um and so there a request similar to cat I'm sorry Katherine Hilton of the Board of Health that the town um allow payment to Walter Tibbits for his work while being an elected member of the cemetery commission article 12 is um a request from the cemetery commission to add a to our revolving fund the S um $2,000 fund so that fees that come in from our cations can be put in there and when we pay whoever we pay whether it be Walter or someone else to do the cations like Clark um Clark could be paid out of the revolving fund want with them them yes not to do this Clark brings his heavy equipment and digs um which are used in the VAR Becky can you just go back was that um was the money for the pest remediation was that in at last time yeah it was okay I just don't remember yeah I still have to we still yeah I have to get through to have to meet with Jeffrey fer with the Clean Water trust believe we had a couple more in the meting this still needs to get the 25 24 is a placeholder we don't have the final budget from the finance committee their recommendations no no they're going to be working through they added an extra meeting for wed this tomorrow night at 6:30 um warant article 26 is a a bill of two prior years one is for McNichol an invoice for $967 125 for title insurance for the Cent land purchase that happened last year um I got a call from um Tina rocker who works at um donam M's office that inadvertently they had failed to send over the title um the title insurance bill to us last year when went through the cro process so we need to um pay that invoice the second invoice is from Associated elevator for an annual safy check back in October 2022 article 27 is a a bill of high years the first one for two automar ballots and media invoices I'm sorry yes and that one needs the amount oh I see yeah sorry okay um the and the last final bill from prior years was a cartell Ford invoice for $384 189 for mil in of a 2008 police cruiser that had not been paid and Becky is there a reason why they weren't where the these invoices were in paid for the elevator and the the Val later that there was um the bill was lost and came up when we did um when we were reconciling the account um but it had not it had not got in process we don't know if we received it or not um this the one for the Automark ballots is the town clerk's office and she found when she went back through to reconcile she found that he had not paid um those two retire found me brought those to my attention and the final um was an FY 23 invoice from the police department that was omitted okay and those are the changes that we have I did the final change is I added um another petition from citizens regarding nonresident voting as you can see there's some NY petitions in here we have our Landing board here's the citizen petition for the cours allies and then the final citizen petition um was from a resident non-citizen permanent residents to give them the ability to vote or take any action there too those are the final changes that I have and um the only other bill of Prior year was around the tree Warden has that been um resolved um I'm still working okay but that so we'll go through this warrant we will do a final one after we get the budget I think it to meetings on the 2th we another dat okay and 23 is our normal round meetings yeah so it has to be on the nth we have a speci meeting and that would be in coordination with finance committee if they need us but we really need it on the n9th because we wanted well the 16th we can still mail out I mean we can get things up online since we no longer mail out the budget we just put it up online we can still manage it well we send out a uh had announces the link in the email to it and have the school budget well we have the elementary school budget the regional school budget is in dramatic FL they have reached out and asked for towns to share an increase of 97,000 um the school committee made up of almost no one has much experience over one or two years and they voted a budget almost a million dollars higher than they had than what was reviewed by the four towns and school Comm the school committee voted almost a million dollars more and asked um Doug water to make up numbers and send them to the town which has been received and for susberry it means about 129 $136,000 so is that part of what the the finance committee is raling yes um the conversation at the last finance committee meeting was a two hour discussion with the regional rep um about the budget the conclusion of that was um a memo to the superintendent saying that we were not we were that the finance committee did not feel that amount of money was feasible for the town of HB um and they did ask for another fourtown meeting they indicated they would appreciate disc discuss of coming up with a lower number that would help address some of the concerns um today I had a phone call from Le that was my next question and um the Town Administrator asked me what subery was thinking I gave her that information he told me he was going into a budget hearing tonight with two budgets one with the new number and one with the old number for the regional assessment and that no committee had yet had a conversation in her town about the new request from the region when a fair town meeting same day as our oh is and have you heard anything from fum George reported talking to John tricky that fum had was a no vote yeah because there theirs would be even higher than we were the lowest 200,000 yeah wow that's a huge huge increase and Le is about almost identic with the sh faes what they did and this is another point of intention that the finance committee addressed was that the regional assessment formula appears to have been dropped in the calculation I think yes the the statutory fiveyear rolling average does not appear to be how they did the calculation right and then the language that they voted with it causes more problems so that was one of the things the finance committee asked Doug to review the assess the assessment paragraph and vote that they were sending out to communities because it was in Conflict it appears to be reflecting there's two different total in in their calculation and the assessment formula that they used which was a flat 88.2% for all towns um was came up with a $23 million figure but in the other column where they list statutory it's a $24 million figure but then they the vote refers to using the $23 million fig so there's conflict and I think it's one of those things that they have to go back and look at so hopefully that'll be enough time for them to riew all the e issues so the finance committee is meeting tomorrow night and then do they have another they have their regular scheduled meeting the following Tuesday on second of okay all right great thank you for that I I knew that there were issues but I didn't know that level of detail so appreciate that um okay anything else on the on the warrant we'll get it finished the next meeting it will get Town announce will go out with a link to it and hopefully the school budgets at the same time they're done yeah they and I'll send it I'll send it to Donna do they have to be done they have to be done for the warrant right done so anything any changes those figures have to be amendments on town meeting floors by multiple oh my God okay that are in no way in agreement right wow okay sound good okay sounds like fun um okay um so the next item on the agenda is the appointment of Frank mcin um as the towns uh appointee to the Franklin County Commission inspection program Frank are you with us I see your picture up there y find away so Frank is a a member of the Town building committee and Frank I understand that you have volunteered to be the the town's representative yep okay and the next meeting is in April in three weeks okay meet ply so it' be fun to do all right good um good more information okay great um all right Becky we are ready for 10 administrator updates okay um so the school had a safety meeting this week on Monday um unfortunately um I all our town representatives were not available so but I got an update from Jackie their main discussion was about the a that they are working on getting funding for the one that they have in the gym currently has is no longer functioning at all they can't get replacement parts similar to what ly experienced this is a defibrillator is that c yes um so they are searching through their fund to try to solve that problem immediately let me help them Source the the one that he's getting to his Grant um they I believe they're G to try for a grand H for a second one but at this point it will be good to have one in the gym and hopefully Lenny's recommending they PO on in the nurses office as well um the other problem that was discuss is the generator um did not automatically turn on again so um we have calls into Tim pure who's scheduling an appointment for him to get out and solve the problem on the switching over um it switched over manually without any problem but it didn't do it automatically this is during the most recent power out yeah what's the plan right now if we lose our Liv for the switching is is there a person assigned to go down there and switch it like well not just we're not just where Matt can do it if he comes in but the fire department had also checked on it and we'll have them go down immediately L's GNA make sure one of his guys goes down to check it right away um this weekend's power outage um I believe we had a very strong response from our fire department and our Highway Department um yes it was it was um luckily we had word by the morning that they they thought they would have all power back on by midafternoon I know a number of yeah Melissa was 8:30 pm and mine was 4M some were but um all power was restored um Christen was uh in charge of National Grid and found in them mercilessly like for um and Lenny was out unfortunately the result of all his activity is he's again pulled his back out um and you working through that again can I before we move on I I want to say that remember the meeting we had with National Grid was here when they were doing that phase down wend Road yep those lights stayed on mostly Le oh they did okay yeah we only Ling line fire exting exciting we got quick attention um so we had a incy about um not having set up the emergency station um we couldn't get a pH the phones didn't work the landlines if your internet goes out and you don't have the backup battery your phone right you have to have the backup battery to run the phone right um although the land line at my grandmother's house the land line with a copper line we haven't done the Wi-Fi and it was on it was on really yeah okay um but um it's that was the tough one I'm usually the one who opens the Waring station was a bit of surprise the Lea man did not sa her having a nice and did not allude to it either I also have a tree down on the far side of my car between the road and the car which is you know we got so and I came here at 10:30 because Ryan had set off the alarm arm part of the his code had vanished from the system so he was but maryan um got here before I did because she was out hiding eggs in the snow for the Easter egg hunt um but it it and I I had plans and I had I was I had an appointment that morning and with friends and I did not think about getting you know keeping it open we we try to find a way to make sure that happens I think we should get the emergency management team together we haven't met since and that certainly been I think we need to yeah kind of just review procedures yeah just you know maybe it's or whatever comes out of it but need and that the hour has been checking on everything I you know I checked through this building I met it I had phone call with kisten I went down to the fire department and made and made sure that they were atck on the school and made sure that we were in good condition and that Highway was finishing up but I didn't how many households were out there were about 250 ACR 274 kind of bounced around I I watched the M out yeah a lot of people have have it if you go to National Grid you can get all the updates that are coming to us yeah Michael gets he gets yeah and they're the same cheex that I get and police fire pretty much the same so that's a a place that people can go if they're concerned we also have to keep in mind too that there's people when the lights go out there's no cell phone or right because that's in the situation when I'm personally in like well my back battery goes down after because I have nothing I have no self sign right so you know update via electronic method or not going now I know drive up to the top of the hill one of the problems yeah yes so we have to keep that in mind we should just and we should talk about that I think your suggestion is great that let's get money on that and the way we used to do it is to select word would pit and turn well they yeah I mean the uh the power company actually finally came they cut the tree but then they were there for a long time because because the line said they're going to fire so then they I don't and they were L wires down yeah well I'm Ling through these um Union negotiations are in full Wing um I've got a meeting at the school on the 8th of April they've met twice I've got got a police union meeting on the 28th which I think it's Thursday um so those are happening neither will be complete before the budget has to clows um so that might have its own challenges moving forward um the library well was um drilled began last week um and completed yesterday at 69 feet um the good news is they didn't if they if they hadn't hit at that point they would have had to do some prce so that's good that they got two gallons and a quar at 609 ft um the bid for the Sho fa exterior trim and painting will be due in on April 2nd um we had we held um a pre bid meeting on the 20th of March and we had three vendors show up um we only had two vendors show up for the um rout but we got eight bids so I think three vendors hopefully will get the annual Town report which has been um a question mark this year um our editor of the newsletter Janice gray has done this for the last number of years and declined to do it this year um today I got confirmation from Greg tton that he will step in and do the work that's great I believe there is there is a small stien that have been initiated that with Greg um until it returns to if it ever does it might return to the admin secretary position that's who used to be responsible for it um and the last thing is um I worked with Jeffrey art and Sam Evans and P and Bon um to submit um an IRA on the gasoline on Friday and we had a second one that was due yesterday on Monday and both were submitted can you just um spell out what the IRA is um incident response action and that was submitted to D um e um so how is well we can talk about it when we okay think that brings up barely close anything else Becky all right I see um is Jeffrey are here yet he will be in second okay well maybe you can answer the questions then or we can I can save it for him but we had that um February 20th letter to DP so what is the what is the relationship that that was submitted that was a periodic review opinion and then the IRA gets submitted as a result that is that well the the he can answer the question okay February 22nd was that it was February 20th 2024 it was a periodic review opinion for a temporary I think that was our draft that was the basis of the report submitted okay all right so I'll check okay sorry that all right um so is there I um licens site professional and a VP at tyan Bond who has been um the lead person in working with the town on the um gasoline and pest issues at the pittsb fire station so um what we wanted to do this evening um is uh just you know hear from you I know we have some of the the background information but to give us a kind of status update on where things stand with both with regard to both uh the p and with the the gasoline station and give the um the board an opportunity if um they have questions about um what's next how we how we go from go from sure okay um it's all right with you I'll share my screen and it be easier if we can look at Maps hang on one second we need to make this you should be okay to here now can you see your site plan yes okay all right so this is the aerial view of the fire station um this was actually the uh in that submitt that we just made uh in response to deeps notice of non-compliance for the periodic review opinion um so as part of that work we sampled mw8 9 12 53 um we were going to sample mw11 but that well was dry and we sampled these two vw1 and vw2 that are inside the fire station um these two Inside the Fire Station were non- detect um MWR and mw5 were both pretty hot uh we had two constituents that were above the standard um mw9 had a little bit in it mw12 was almost completely clean so I MW3 also had some had some in it so this these are the groundwater Contours and this Arrow indicates what these Contours show um this doesn't necessarily agree with what we're seeing for contaminant distribution uh like I said we seems to be more of a Northerly component which might be indicated by this little blurb in the line here um but that's that agrees with the previous Consultants they had also suggested a Northerly or northwesterly flow Direction so that makes sense what we're seeing at 9 and what we're seeing at three um we were going to sample MW4 also that well could not be located in the field I don't think that's been sampled since the 90s so it's very well overgrown and all of that um so what we ended up doing I submitted um this periodic review opinion stating that I believe that the temporary solution that had been in place previously by Otto um was still effective um we had measured like the dissolved oxygen and the oxidation reduction potential and some other geochemical things in the groundwater um that indicate you know there is oxygen so in these Wells here between 8 and five um there was very little dissolved oxygen and the oxidation reduction potential is negative or very low um so that typically indicates you don't have aerobic bacteria and aerobic bacteria are the ones that degrade um gasoline so um you know having Doo dissolved oxygen in orp that's positive outside the plume tells us that there is oxygen here um but it's depleted in this contaminated area because the bacteria are using it so um based on that we said that you know what Otto did before is still effective we do there is aerobic biodegradation happening um the issue here is that we only have these two Wells eight and five and five was pretty hot and you know we don't have any Wells down here so we don't technically D could say we don't have the plume defined um that our monitoring is not adequate because we don't have wells down here um so what I said in the in the opinion was that we would put a well down here somewhere and then uh we'll have to sample that for for gasoline and and hopefully you know what's here is below standards um the concentrations between eight and five are almost identical so you know it's it's a bit of a crapshoot on what we're going to find down here um but I think going down gradient as far as we can you know something along the edge of the property oh not sure what the property line is but somewhere in this area you know we can get a drao rig in here to put a well in and we'll sample it and see what we get you know fingers crossed that it that we find the end of it and that we can tell D we found the end of it um you know our plume is confined to you know this area here um as part of that work we also sampled the sump in the basement of 50 lever road that sample was also non-detect so again that speaks to you know this Arrow not necessarily being true this is what the elevation show but the contaminant distribution shows something else which is not terribly uncommon um so we did check the indoor air in the basement and we also checked the sump um there were some gasoline constituents in the air in the basement but we attributed that to the fact that there's cars parked in the garage with just a door separating them so it's not uncommon to have you know something like a gasoline you know communicate with an adjacent space so um so I I guess I need to get together a proposal to install a monitoring well here and to sample this new well and we're going to do a little more effort see if we can find MW4 May with Becky's help and some other Town Personnel that might remember where that well was uh that was put in all those years ago um so you know we don't know what D's current opinion is um I I don't think they're going to make the town you know terminate the temporary solution you know re-enter phase two finish the delineation of the plume and then re-enter that just seemed like a giant waste of money um considering all the remediation that was done here this this can't be all that bad so uh hopefully we can get this well in get it sampled and and find out that we're okay so that's the gasoline any questions on that no I don't think so I think yeah just keep going ahead more well so I guess the question I have the the new well that you're contemplating on that Northern property by 50 leverage so that's on private property right correct so so so permission would have to be gotten from the granted from the the homeowner and um when you said the some the wells like are hot so that was eight and five eight and five yeah and does that mean that doesn't mean any additional remediation has to be done they're at a level at which it's the the the current solution is okay well not here let me let me show you the data table yeah um so this is mw5 you see the C5 to C8 aliphatic hydrocarbons at the C9 to C10 aromatic hydrocarbons um we had 2800 parts per billion and 1100 parts per billion the standards are 300 and 200 so we're we're well above those standards um but we do have the cushion of I mean this these standards are protective of drinking water and as I think you know you know these houses all have treatment systems on them and the the carbon systems that are on them to treat pasas will also treat um will also treat gasoline so you know we have that bit of a cushion there and that was that was part of my pitch to D too was that you know there is um there is treatment on these Wells so that if they are contaminated if they are impacted by the gas Vine release um you know we have treatment in place so people aren't going to be exposed but is that a is that a long-term solution I mean so are we looking at a at a open ended um commitment to these poet systems the filtration systems and all the houses and and testing continue testing that they will be there for the P yes and they serve dual purpose and that they will treat gasoline too if the gasoline gets there okay let me just see if I had any other yes Jeff if you look back on the chart um I think the other point you made to me um to answer Rita's question if you see the levels in the early years were in the 9 12 14,000 range so there has been significant degration it is you know it's not what we want we want to get farther but I just wanted to so there's is there some explanation for why I think in your um letter it mentioned that the levels are where they are where they were in 2018 for some reason why that is yeah we call that rebound so um you know when they closed the site in 2017 um you know this level was here this is the 3100 and 3400 that's what it was in 2017 and then we sampled in June of 23 you can see it's they jumped to 8700 5700 which is commensurate with you know kind of what we had back here in 2013 2014 um we resampled in August and it was elevated again and uh we sampled in November um there was a problem with the lab with this with this result so this result was considered no good we resampled in January and um got this 2000 and the 1100 so the 1100 is exactly the same as what's in mw5 and the uh C5 to C8 aliphatics are actually a little bit higher at five than they are at at at 8 but 2800 2,000 those numbers aren't all that much different so why why it rebounded I don't know um you know I reviewed everything that OT had done and I mean they dug up all of the contaminated soil that was there um they had a little bit of rebound they came back and did some injection work um you know we didn't see rebound under the fire station that vw1 vw2 are still non detect which which makes sense um but I'm I'm at a loss to explain why these concentrations would jump up like this and um and then the IR the IRA that was submitted to um to De was that was that a followup to the um periodic review opinion is that no the periodic review opinion just deals with the gasoline issue oh the the IRA is for the people F oh okay all right I thank you sure all right so I'm I guess I'll get a proposal to Becky for the installation of this additional monitoring well and some sampling um we did say too that we would check the influent of the houses that are nearest here because we have to sample those for pasas anyway um so we'll sample those for vph as well just to show that they're um not impa Ed I don't you know we're dealing with so all the drinking water wells are deep Bedrock Wells and these Wells that have the gasoline are shallow uh they're above the Bedrock so I it doesn't seem like there's any mixing going on there um the well that serves the fire station that's closest to the to the gasoline contamination we sampled that one it was non- detect um but it's it's UPG gradient so you know it's questionable whether or not that would reach there but um you know there's definitely some communication between the overb bird and the Bedrock aqua um obviously the p is is in both and it was a surficial release of pasas that that got into the Bedrock too so um you know gasoline's not as soluble as past so I I still like don't expect we're going to see it in the Bedrock aquafer but you know we need the data to to show that all right moving right along moving right along um so this is our current past distribution map um the purples mean that the past six recall there are six compounds that M EP regulates six past compounds we add those up the standard for the sum of those six is 20 parts per trillion so the color coding on here the purple ones are above 90 they consider that to be an imminent Hazard um these two are red just meaning they're above 20 but below 90 um but remember that these two home these two properties are served by drinking water well at the fire station so um you know this isn't representative geographically of what is on this side of lever Road um it's you know it's indicative of what's at the fire station in in that in that other Supply well um so the the greens are good greens are non- detect uh yellows mean that there was a detection but it's below the 20 parts per trillion so you know overall we're we're looking pretty good um I think let's see there was one over here that was really high last time that that came down um so you know what we're really dealing with from an elevated concentration perspective is really like these four properties and the rest of these are you know singled digigit you know low teens kind of sums um the good news from the sampling we did the samples the houses that were clean are still clean uh so the plume is not migrating rapidly um you know the groundwater does move so we will expect to see some some movement so some of these greens may turn yellow at some point in the future um but you know this this plume is not expanding rapidly which you know would be a from a financial standpoint would be would be devastating um you know these black and white lines around this radius you know those are all the 500 foot radi that we've had to do so if we have a detection we have to do a 500t radius from that detection sample any of those properties and you know I mean there's other projects we work on where it's like hot there's another 500 another 500 another 500 so you're not that um you know this does seem to be fairly stagnant um you know all of the wells are pumping so they're pumping ground excuse me they're pumping ground water that's contaminated out of the aquafer for pumping it through the carbon um you know that is accomplishing some Mass removal it it's not a lot it's not significant um you know remember these concentrations are parts per trillion so what we're pulling out is you know it takes millions and millions of gallons to get even a gram of pasas but the good news is that it's not that it's not migrating so the um Ira that was submitted um what what was that basically that just reporting it just presents the results of our sampling yeah um you know and and putting the the carbon treatment where it needs to be put on um and there's a couple there's a couple locations internally within the existing radius that that didn't have a system before that needs a system a single vessel system so um Becky's working with the plumber to get those installed and once we do that it's really just babysitting the systems um like I think I told you before the carbon systems will last you know we've got other sites where they've lasted over three years and still going some of them so um you know we're not expecting to have a lot of carbon changes and you know that that expense but you know the systems do need to be put in they do need to be monitored and um so that's you know that's going to be an ongoing cost what are other communities doing um Beyond I mean should SHP be looking at some sort of a a public water system or are we not I'm just trying to gauge where where we stand on the Continuum here in terms of contamination yeah if if if one of your neighboring communities had a water lock line you know right at the Town Line extending that line into into shutesbury would be an option um I think I'm correct that shy has no water right there's no water department there's no public water correct and there's mind we have we have Clavin at the bottom of the hill so we just got something from the MW which says they're hiring San bonds to do a um a watered feasibility study which I gathered they've done in other regions of the state to look at whether or not um we could get you know I think it's like five or six communities Becky could get access to uh to quava of course it's only a study and when I looked at the numbers for the other um the other regions that they looked at like metro web you know they were a billion billion dollars oh yeah but um you know I know that there has there has our legislators anyway um have really pushed to say we should be getting we're providing all this water to the eastern part of the state and not getting any of the benefits and can we get you know some change for um for payment and lose so uh it' be a long a Long Hill to pump water up but there is water right there great water yeah I'm fortunately it's the it's the pumping and piping part that gets really expensive right right well talking about facilitating the full infrastructure for the project yeah but it's a feasibility stud but yeah it's a long way off what if anything do you know about uh of a related question what if anything do you know about the loss class action loss season for P mitigation against 3M and people like that do you know anything about that yeah our um a couple of our clients are are are party to that um the mdl the multi-district litigation um I I would suggest that you try to get into it um you know I guess the the feeling is that you know nobody's going to be made whole but you know the attorneys are going to make out well um and the communities hopefully get something back you know hopefully get enough to you know at least get you know a few years of these costs back you know but I mean this is a this is a Statewide problem you know it's not just you guys there's there's towns all across the Commonwealth that are similarly impacted and you know what we're doing putting these treatment systems on and sampling them monitoring them reporting to D is is good you know to prevent people from being exposed to it but but it's not a long-term solution and you know like shutesbury doesn't want to have a line item in its budget forever you know for for this money to keep to keep going and keep sampling and you know like I said we are going to see you know depending what way the groundwater moves here we are going to see some you know some expansion of this plume and adding more systems and eventually the carbon will have to be changed you know and this is just an ongoing cost with you know no end in sight short of someone coming up with a miracle solution to clean the stuff up so who do we who do we contact regarding oh you have the information okay um there was there was talk of um of the state establishing a a past remediation fund that would be you know distributed I assume based on you know need um you know to help mitigate some of these costs you know some like I something's going to have to be done I mean we can't just keep going the way that we're going it's not going to be you know it's not sustainable in the long term and you know it's not your fault you know you didn't put pfest in the firefighting foam and you know whatever releases that that occurred um you know at the time nobody knew any better so you know there's a lot of people in the same boat and something's going to have to give but if you guys want to get into the mdl I mean I'd suggest doing it you don't it's not a big cost for you up front and you know you may get you know at least get reimbursed for a few years of of costs on the back end at some point bringing a water line in would be awesome but you know to establish a drinking water supply and staff a water department and put all the lines in mean it's millions and millions and millions of dollarss yeah she just along those lines because that's where what I was ask you next I mean if if you if we contemplated that um you know having some sort of water supply we'd probably run into the same problem if we we were digging a well right we were digging a well in the center of town just to supply the center of town with water you're saying to p is in the in the the Bedrock and in the the groundwater so regardless of how deep we we went we were probably gonna find p is that the conventional yeah unfortunately yeah that is that is the reality um which would mean you know putting the well somewhere not downtown which means you know more more length of water line and but you know I mean there are you know we can do a study for you to to try and find a location to put the well and they would do some exploration and you know find a spot that's P fast free or put the well you know put the well here and just treat it you know you just but then you're just treating it once you know you just have one treatment system at at the well head versus you know versus 40 systems in all the houses and and we're having to test all of those quarterly right at a what $250 300 $300 per and now we have we've been required to put in additional dual system F systems require three test so they're closer to $800 $900 for an individual house and for for what it's worth I we're just doing quarterly for the first first year and then once we demonstrate that you know the concentration the influent concentrations are steady the systems are effective um at that point we can propose something less frequent um you know based on based on how the systems are working and the concentrations that we're seeing you know we can go at least to semiannual if not if annual is probably too much to hope for but semiannual I think would be approvable by De they would they would have to approve a corate yeah we have to request a modification to the IRA to to change the monitoring schedule okay we also have to T um all the non detects annually or semi um right now we're doing them semiannually and again you know once we generate more data if we have enough data that we you know we can be comfortable that you know this plume is really not moving and you know these concentrations down here are I'd have to look back but if they're you know single digit kind of numbers and we have you know three semiannual rounds and they're all non-detect we could push to maybe go annual on those um you know if there was an impact you know just if there was an impact to come to come you know it would be at a you know something well below 20 so that would give you know D the comfort that you know yeah somebody might be drinking peas for a brief period until we detect it and then we'll put a treatment system in and they'll be covered but that's yeah that's that's kind of the you know that's the hard part telling people like well you know you may have to drink P fast for a little bit but just a little bit for a little while but there's really no you know I mean quarterly testing is is very expensive so we have to kind of balance the real risk versus the cost okay any lessons learned from any of your other clients that would benefit us or no we're all kind of in the same boat you know it was this mad scramble as the radii expand and getting the treatment systems in and you know now that they're all in we're just kind of babysitting it and you know unfortunately there's just no good remedial options you know everything is is super expensive I mean to dig up the fire station and send it for incineration would be you know hundreds of thousands if not if not a million or two dollars um and that does nothing for what's already in the ground so these systems would still have to be here but you would take the source out are are there new towns that are or cities or municipalities that are uh discovering this now I mean is we have seen everything right all the municipalities have not been discovered yet that they have they don't even know they have from is that true yeah yeah the ones um the cities that have you know that have big water systems they were required to sample but I think some of the you know the smaller towns are not you know where all the houses are on private Wells they're not required to sample um so that's one of the things you know the UMass program where they went out and how uh towns that had I think it was I forget what the number was but there was you know if some percentage of the town was served by private Wells D and UMass would fund or DP would fund UMass would collect the samples um just to check so that's what they did and a lot of towns got pulled into the system because of that you know a lot of them found these you know one two three four parts for trillion levels um with no Apparent Source you know so it's assumed that it's just septic systems and you know pasas in household products that have been discharged septic systems over the years some of them did really elevated concentrations and they turned out to be you know by a fire station or a fire training area or a plane crash or something like that okay well um this has been very informative and um we'll have you back quarterly just as we as we do our testing not quite as often but no sure I think it's really important for um I mean this is on record now people in town W to um hear this hear hear your presentation um hear the answers to the questions and yeah I think it would be good to get updates some sort of regular things um so I think that's it we have a executive session we going to so thank you very much Jeff um really three which is to discuss strategy with respect to litigation if an open meeting may have a detrimental effect on the government's litigating position litigation is specific to a complaint received from Cole regarding the shb solar bylaw with special Council Town Council and planning board representative um we need to do a roll call vote to go into executive session and um we will not be reconvening and open session we have nothing else on the um on the agenda and and all votes taken in exe executive session will be recorded roll call votes um so do I hear a motion to go into evening and of course you know Becky so um you are here to give us an update on the litigation correct uh I am and I just got a an education on past like I've never gotten before I've sat through a couple of shorter presentations but that was quite enlightening scary huh it is it is um so uh so thank you for adding me to your agenda tonight I I want to say at the outset and I don't think this will be problematic I I actually thought I was on the agenda at 5:30 not realizing that that was actually your your meeting start time so that's fine um except I have a hard stop at about quarter past 7 because I have backtack meetings tonight um but that gives us about a half an hour 25 minutes I really only have about 10 minutes worth of an update and then it's really any questions that board members might want to ask there there really hasn't been a whole lot that has occurred in the litigation over the course of the past uh maybe eight to 10 weeks since we last uh convened and and had conversations maybe just after the holidays about this lawsuit and about filing a further lawsuit challenging the the AG's determination on the bylaw so um my focus today and what I really wanted to discuss with the board is the litigation that was uh filed or commenced by Kohl's and and by the the four separate uh limited liability companies that are offshoots of Amp energy that are proposing these these solar solar projects um that you recall that litigation was was filed last spring or summer uh
