so we could have a quorum we have Paul FAL Mark garold and myself Paul demon here Dan L Valley and Steven Johnson are unavailable so our first order of business tonight is a anr for Robert coocher for 266 County Road and the plan is uh before us on our desks and to present is Robert olac from Heritage Engineering and surveys [Music] thank you Paul all right uh pretty simple here um as you can see on the plan in front of you um parel parcel 7 is proposed to be conveyed by the coocher revocable trust to Aaron J Bower Incorporated with the adjoining land to form one contiguous parcel it looks very straightforward to me there's no uh fee for creating a a new lot so um any questions from the board no I think so do I have a motion um I make a motion that we approve the anr or endorse the anr problem all right moving along right along so we can get our friend here back to Sick Bay all right we have a u Kyle finel is here from pioner Valley Planning Association and we were awarded a DTA grant for some work to be done on water supply protection zoning bylaws that need revisions and Kyle's here tonight in your packets is a uh brief overview of the contract of what will be taking place and what the commitment is and he will explain it going forward in the work that we will be pursuing with the help also of Richard Harris good evening members of the board thank you for having me so I take it you have a copy of uh the drinking water supply protection initiative scope of services in your packet along with the copy of the affirmation of community commitment so as Paul said um town of Southampton was awarded dlta Grant funds call after you read it I've only got the one copy oh you got okay oh thank you thanks so uh this project um is funded through a DTA Grant um awarded to the town uh that funding source is on the calendar year so this project is officially starting and will wrap and conclude by the end of December this year uh this scope of work that you see before you is based on um The Proposal that was sent forth to the Pioneer Valley Planning Commission uh and outlines generally the the intention of the project and identifies six primary tasks in a bulleted form and then also talks to how we would measure a successful project uh enumerates deliverables and talks through the time frame um I'm the project uh manager and Lead I'm a senior planner with the land use and environment section at pioner Valley Planning Commission uh joining on this project will be uh another planner um and also our chief environmental planner Patty gamberini who will be coming in to support the second task uh that I'll get to so over the course of the next eight months or so um Pioneer Valley Planning Commission will be working with Mr Harris and the planning board uh reviewing the existing water supply protection uh District bylaw um we'll be also reviewing existing town plans like the uh Southampton master plan from 2013 uh also be reviewing Mass D model bylaws that were produced in 2011 regarding water supply protection and also recent recommendations and work that Pioneer Valley Planning Commission has conducted with other member communities in the region uh we will bring all that information together drafting a technical memo on best practices for water supply protection districts that'll be the first real deliverable that this pro project will produce um from there we will um start to draft up revisions to the existing water supply Protection District uh also looking at any necessary revisions to the map um delineating uh zones one two and and hopefully three that's something that we we're kind of we're trying to figure that one out um that fifth bullet uh we do have uh the in intent to engage with the public community members uh specifically um that format can be determined uh moving forward it could very much just be a regular regularly scheduled planning board meeting uh where we have a presentation of the technical memo and solicit feedback uh from the public we could also explore uh a standalone event uh or we could even consider an online or um a physical survey for the uh Town residents uh the intention of the public engagement particularly with the town um be trying to get input as to what residents would like water protection to um look like uh it's doesn't really look like much on paper but you know it does it is extremely relevant uh to the health and uh sustainability of the residents in the town that last bullet where it says to hold one or two Roundtable meetings with the bayac municipalities that's the Barnes aquafer protection advisory committee uh a now disbanded Advisory Group uh of municipalities including South and neighboring communities um Southampton and some of the neighbors have expressed interest in various forms to uh reconstitute that Advisory Group so in the summer months actually following the conclusion of this fiscal year so starting in July um my colleague Patty gambarini will take over and really Spearhead that conversation and that part of the project uh We've allocated about uh 20% of the project budget just for that single task um my hope uh is to get through the bylaw part of it as efficiently and quickly as possible EXC so that we have more funding if the bay pack conversations prove fruitful and we want to continue that um right now we're think think that um we'll start with an internal conversation with Southampton to talk about what U participating in a a more Regional water protection Advisory Group would look like and then we'll likely host the first meeting um and try to convene as many stakeholders as possible and then see you know what fruits emerge from that effort so as a measure of success of course we would like to to by the end of the project uh have an updated water supply Protection District bylaw and map based on community priorities and best practices ensuring continued water quality for Southampton and protection of the Barnes Great Brook off aquafer uh deliverable um in addition to ongoing Communications and meeting notes throughout the project there will be a draft uh a technical memo of best practices for water supply protection we'll also provide new water supply Protection District map uh along with proposed water supply Protection District bylaw um for planning Board review and uh endorsement which will then go on to select board and eventually on to town meeting um that would likely be annual town meeting 25 um we'll also share any uh materials and conclusions from the engagement with our bayac communities uh again this is a project funded through the 2024 calendar year and final deliverables will be prepared and shared with the planning board and select board uh in late fall likely November December months I'm happy to field any questions at this point put in their packet the U the commitment letter and the 5% um in kind match could you just speak to that briefly uh speak to that uh yeah so uh this is uh a formal letter that we send out to all um recipients of DTA funding uh it's the uh commitment um for the uh Grant awardees to ackn acknowledge that you all have received our scope of work you understand that um what is schedu to be performed and delivered uh also there is a requirement of an in-kind match equivalent to 5% of the total budget um I've put those values into the community commitment there which is $375 $375 total uh this is uh can include community staff time or volunteer board members time so any time spent on the project can be um recorded pretty simply uh for the sake of reporting um and then the second point is just to affirm that um whatever work we conduct um um you're committing as a community to to take that up and and Carry It Forward um that would mean in this case whatever revised bylaw we have for the water supply Protection District the planning board will endorse and take forward to the community for annual town meeting vote any questions from the board members um couple quick questions on the delineation Zone one two and three and and the uh aqu for protection overd district is that going to be provided digitally as well it's like be on mass mapper as a layer D layer uh so zones one and two are typically informed by mass D data um whenever we deliver a product we typically provide it as a PDF final static image um if we are successful in any Zone 3 delineation um I will advocate for sharing that as as freely as [Music] possible just touching on that um we had discussion about that last week cuz I asked them where did you get the Zone 3 data from because Zone 3 is not on mass ja right and so that's what they're exploring how where that is dered from so how does Zone 3 exist without mass GIS that's what they're foring yeah yeah um so right so there is no zone three or zone three that you have on your map I think already and it U uh I think dve from years ago in Mass DP did produced a report that had the contributing areas but for some reason that's not shown on mass GIS right interesting and I've asked Master D about the Zone 3 and they have not responded to me because I've got another community that we have the same question M Paul any questions from you the last part about the commitment um it it says you mentioned that whatever is determined has to be so the town is responsible to carry that through to what point um well I think uh with the case of this specific project of course at the end of December my our intention is to have for you um byla an a bylaw that would be easily endorsed and supported by the planning board uh we recognize that's a lot of time between January 1st and annual town meeting I think um you know if if the bylaw gets an extra set of uh eyes looked at it over those months and gets kind of the typical revisions that happen approaching town meeting that that's understood to be kind of standard um I think it's more of the intent of the board to say you know the work has been conducted and in a productive way and we're committed to carry it forward if I can touch well my experience has been my previous job work on this is the commitment is that we will take a proposed bylaw amendment to town meeting for consideration there's no commitment for the town to adopt just that be considered right that was a part that needed a clarification OB this board can't commit town meeting to vote right so it's just a commitment to have it taking town meeting for consideration anything else no that was that was it that was that was have one question go ahead how do you value the volunteer time uh that's a good question my time is easy to calculate right right um there is a hourly breakdown of that I don't have it in front of me but I can I'll share that and we'll make sure to report record it appropriately and my guess is my time will end up being the match but want to be sure we have that calculation right yeah to use I'll follow up with that all right all that being said I need a motion to um approve the uh Community agreement for this uh Grant so I entertain a motion um for the work to be done and up to a 5% match of $375 from from our budget well it's not cash match it's volunteer time and contribut staff time yes they can't afford US okay are we before we vote can I can I before we motion anything can [Music] I granted this is addressed to us and this is our action that we're going to be voting on we don't have anything that needs to be vetted by the board of Selectmen the select board excuse me so zoning revision my in my past experience the um we just handled it without s board because not committing Town ERS we committing time okay no I don't that's fine my my question was answered thank you do I have a motion uh I'd like to make a motion to approve these um conditions Community what we call them Community commitment letter yeah Community agreement letter uh from the Pioneer Valley Planning Commission have a way forward good thank you very much nice nice to meet you have a nice evening very nice meeting you all right next is a public hearing that we've had advertised and um I will read the uh public hearing that was published in the daily Hampshire isaz that 14 days and S days prior to this meeting uh that in essence reads the uh zoning ask the uh town to when we send forward to town meeting to approve a zoning code bylaw table one use regulations um uses permitted by special permit from the zoning board of appeals signified by ZB and the zoning bylaws by changing the L language and table one said references to use permitted by special permit from planning board designated by PB on said table one um in your packet is the uh list of the regulations that are going to be uh amended and just for your own edification for some reason or other when we went and U along with ecode and put our revisions in at last town meeting in 2023 this got overlooked for some reason or other you know with all the work we did uh this this part of it was eliminated we we it went to public hearing and was heard and all and approved it just it just didn't make it into the language so now we're uh bringing this back forward so we can put everything in line for all the work we had done uh the last five six years on zoning to uh get up to speed on the uh use regulations Richard you could probably weigh in some more information that pretty much covers of them um you have I believe you have this yes this document that identifies the uses and the districts that they apply in I I looked through the use table that Paul gave me and they made some changes but they didn't make these changes so I think there's just some miscommunication with Eco the Jun Co and mind standing The Zone board appeals is is supportive of this being done they this was work done with when Larry Smith was your planning board consultant and um um some would call this a clerical correction but it has some substantive implications so is this a clerical what's the let's say this gets approved by us tonight what what are the what are the steps it goes town meeting town meeting has to approve it and once Tom approves it then has go State that's what I'm getting at attorney general attorney general will there review and approval and so then we wait another 6 months hope hopefully not with this because this is pretty straightforward but once Tom me approves it an applicant can cement application pursuant to this at their risk U I'm working with another Community where they made a change and uh there's a developer that want to do a Community Drive Common Drive differently and he' like the new bylaw and he was prepared to submit at risk the risk is if you spend application Force approved by the Attorney General by Amendment approved by attorne General and then the Attorney General rejects the amendment you've wasted your time and you have no recourse against the town because it was at your risk but afcan could do that they're confident that there's no reason for uh Amendment not being approved so usually usually AG would only rejected if there was a uh procedural error and I've since found out there is a method by which certain procedural errors can be corrected or remedied um all this information that we had previously worked on and incorporated into the the new bylaw M so if it's stated in the bylaws itself but not in the use regulations where's the legality there you need to correct the use table so you could not apply because of it's here but it's not here right it has to be it needs to be consistent consistent okay and everything that's current is grandfathered and until this gets approved by correct yes so I see our public um is not here to comment but I assuming it's very straightforward because it is um any other comments from the board St forward so hearing I will accept a motion to forward uh this um need close the hearing sorry thank you very much need a motion to close the public hearing any motion that we close with public hearing second motions made in seconded any other further discussion all in favor Bye by by all right now I will ask for a uh recommendation to um forward this on we had already sent it to the uh select board and the cop to the town um administrator to put on a warrant pending this hearing so uh now to make it official I favor I I okay nothing else I just a just a heads up but at the May 1st meeting there's a solar ground Mount hearing coming up at 97 strong Road it's nothing uh I I gave you a copy of the uh plan it's uh but anyway it's it's it's pretty uh straightforward the uh ground Mount Sol but nevertheless we have to have a hearing on that um other than that I just have uh a warrants that I need approval on
