hearing under the massachusett Wetland protection act GLC 131 section 40 in the Southwood Conservation Commission regulation and B chapter 182 and chapter 450 for request of determination project location is 54 Brookshire AV the proposed project for the construction of the staircase and decking all work is within the 100 foot puffer zone of Lake C so we'll open up the public hearing to the petitioner who is online yes yes that is me Russell vanney um so tried to put everything in that um document that I could I think all the details there but um just looking for the deck as stated um we can look at yep I was gonna let him finish talking because it well the document yeah we I'm gonna put the document up while you're talking if you don't mind have a photo of Lake going on upstairs what I'm picture picture you know those new neighbors you're just so py always tough having a downstairs apartment I noticed in here that everything is an X feet from something else are we going to get photo so on the left side of the deck and then on the house side of the deck um that's that's its primary positioning points how far from how far from the lake is it please um so I would estimate there's about eight feet left from the front of the deck to the Waterfront so this actually says you just put a six in for one of the X's that says six feet from Waterfront I think you need to retype this says 8 feet from the neighbor's Beach but not from the neighbor's side property line and six feet from the Waterfront yeah the description is not correct he just said eight right so it's six that's six8 and six feet from side prop property line and then how many feet from the water line but this says it's 6 feet from waterf flow which I would no six feet is from neighbor's property oh yeah it says six feet from Waterfront in the neighbor's Beach and there is there a flood plan on the map no I don't know there is I can definitely let me use my oh there was an email think I already asked yes and I I would say that it's possible that the front corner so I estimated looking at the flood line that the it looks like the flood line is about 20 feet from the house and I would say based on the dimensions the front corner so furthest Corner closest is about 21 ft from the house so I would say there's possible foot overlap in that front corner sure let me get that layer and St data right so we've got blue so so that's where the flood zone is right here on the map and then if we look got a [Music] plan right there oh yeah this is 1 in is 35 ft scale is it on this one just towards the water right that's that's on the high end and then the low end is 10 ft out of the and then they're connecting with a step down right 16 ft from the 10 ft so there's only like a tiny little spot of actual Beach if you want to call it that well they'll be it'll be 8 ft here and then you'll have 14 ft here here in theory right you get 8 ft there right right yeah if it helps for a visual if you go back to that photo of the house um it cuts there was a um there's a stone fire place sort of thing um fire pit and it cuts that in about half so if you're looking at that it will not go beyond that it cuts that uh in half yeah so that right there that the chairs are around halfway to the pit is that what you saying halfway through the pit through the pit between those two blue chairs in the middle yeah yeah so the 16 foot part of the deck kind of cuts that in half um so if you're trying to think of like how much is left there's still all that space between essentially the the fire pit all those rocks and there's a little beach there kind of equipment are you going to need to get down there to do the work um so I'd have to defer my cont tractor um the the majority of the the only like true bigger equipment that's needed is the equipment needed for the helical piles um and I don't know the answer offand on that I know that access isn't very easy um and he knows that stairway access only for this house so I've already talked to my neighbor about it and if we need access just for the helical piles he's okay with that and the neighbor of budding so if you're look at this photo on the left he's the the last house on that road that's White Street is I mean I've seen hels done with just a handheld machine that goes on top but then I've seen it done where a a bobcat comes in and does it so like that would make a difference you know it's a I don't know how you get a bobcat down there honestly but yeah I would say that he's going to go with the handheld then because yeah the Bobcat might be I could get a bobcat to the lawn but um not down to what about what about erosion control I'm looking for to see where that is on the on the plan um I wouldn't So based on that what's the concern um or how how would that be best be addressed I guess based on the concern that you're outlining need to have uh hay bales and silk fence on the plan to make sure Ure nothing goes into the resource area people have to limit of work area oh okay during the construction you're working Lake you need to have some kind of barrier sultation barrier up there sence hay bals most likely both yeah okay I will talk to my contractor about but I'm not going to I'm not going to act like I I already have talked to him about it a question of the committee uh about setbacks right I was going to mention that he probably would want it well set back for talk to put a building on you got a 10 foot of the neighbor's property line is that qu does a deck qualify as a building because it's 6 to8 feet away from the property that's up to the building department I guess yeah right so I would def talk with Kyle the building yeah in the building department Kyle Scott see the problem here is this there's no order conditions going on here there are conditions you can write on there but really hard to enforce them if he had it has it on the plan showing Sil fence and hay bals and doesn't have them up there then we've got to you know say okay you're in violation but it's not on the plan and we write on there right I mean you could you could put it you could put it in there so depends you guys I don't want to be stickler but I think I think when he has everything done right exactly come back everybody feels right so so just update we feel good in theory B where go um because this plan doesn't really indicate any of that here okay um so it becomes a real gray area as far as where we want them where they ought to be all of that I think it should be redone and then come back back yeah that be my call on and in the meantime a call to Kyle Scott to make sure right you can put it 8 ft or six feet from your neighbor without a variance there might be a required 10 foot setback which is not our department no yeah we don't have any jurisdiction over there we could approve this and then the next guy's gonna say no you can't do it yesly yeah let's have everything be cleaner to do it that way right have everything yeah so for 54 I agree with you guys you know so close to the water and everything and then not sure about what kind of equipment equipment and erosion control yeah yeah erion control equipment normally these things would require a notice of intent but if you can convince the commission that you're going to do it in proper manner there's not going to be any impact whatsoever to a resource area is possible that they could that you do under a request for determination the dimensions all make sense okay um so would the applicant request a continuance for this yeah technically you don't do continuances for requests but we do anyway okay okay if you can get it in for December 2nd let not far away for yeah yeah our let me just get my ducks in a roll right here I did speak to Val about that he's going to put a sign in signs in at the 25 okay yeah all right and then he was going to mow the on there in between after you got the signs in remember right yeah so you have the 50 Foot buffer and then the and the inner 50 foot buffer limit and then the 25 foot and right there it's it's Mo annual and then the 25 foot to the Wetland that's a Nomo area but in the order of conditions it wasn't really specified as to how to designate it so they came up with a solution to put a sign um and yeah so there were some areas where the grass has not been establish it's you know there's a drought so um there is grass seed it's been spread out um I do have pictures if you want me to I would leave it up to your judg at this point if I haven't seen it you have if you want for the most part interesting cave out on the grass it's illegal to water the grass on drought but you need to have grass to get your order um I think right now with the drought it's not it's not banned to establish new um new grass I think that's unless they made it more strict um because I know you can like you can water your vegetable garden any any like planting that you were trying to you know establish um I'm pretty sure you can plant that as well or water that as wellable signs of any erosion anywhere happening going into the wetlands or towards no not into the wetlands I think my my something the thing that really like poked out was the down spouts they're like I so you got the down spouts they go into the ground but then you've got the the U I don't know the PBC plastic piping or whatever it comes out of the ground and then it goes into the 50 Foot okay so what did it call for in the order conditions it didn't mention anything didn't mention anything nothing it was a septic plan that we approved so I guess we got no say so in no say it didn't should be clean water right coming the roof yes and I feel the the way that he does have it set up it's it's at the 50 Foot perimeter yeah and it's going to go into a well vegetated area that is the only concern would be that it's not sheet spread then it could that's the thing is if we get all these big rainstorms and then you've got this one point source coming in is it going to start to erad that area in the 50 Foot it's nice vegetated now but I don't know if project at that time has since been conveyed um to depal who will be constructing the project he started meeting uh with our office on comp uh preconstruction compliance issues uh as well as uh you know uh coordinating stake out for silt fence and uh in preparation for a pre-construction meeting so uh we are here to respectfully request a an extension of the order of conditions this is a rather large condo project so this will will take a number of years to complete so we would be uh expect to be before you with periodic updates uh as well as potentially an exist uh I'm sorry a future request for extension um which would likely be uh in three years time there are a number of condo units so it will likely take multiple phases to complete the project be happy to answer any questions you may have or depal again is here to answer any questions you may have as well thank you have any questions um was the original order of conditions ever reported at the registry of deeds it was so I uh you will see in your email that we forwarded you the original book and Page um along well I'm sorry the the original recorded document with the book and page so you do have that that was sent uh this afternoon but it was it was originally recorded by by the uh the first first proponent all right and then the $50,000 Bond um was never posted for this and uh don't believe this project was has started uh the project uh is just uh just started recently uh Deal's been coordinating with the building department with regard to the project as far as land disturbance though no that is correct the project has not started yet and Miss po chime in to that uh we we I reached out to our bond company that regularly post bonds for us uh they need um I sent out an email to on Friday we need a they need a um a Town's bond form which is specific to Southwick if you could send that then we can probably get Bond posted as early in next couple of days or a week I will will pour that off to Jess Our Town Treasurer she's the one that deals with the bonds and I'll make sure that you're C on that thank you I don't have if I remember correctly there's going to be an extensive amount of Earth removal in this project correct uh that there is definitely a significant amount of earth work that is correct yes and when do you plan on starting with the earth work um sorry go ahead sure sure Rob in so right now uh we plan to start artw work sometime in the winter time uh We've approached um the township uh Mr Scott's office very helpful we're getting uh the demo permit issued pretty much in next week or so uh there's a couple of conditions that are being met right now for aesta survey and everything so that'll be done and um we should begin very shortly so we'll remove the the the houses and the sheds and then the tree clearing and then the earthwork will begin right after that so our plan is to get um uh first few houses or first platform in uh the foundation in by hopefully before summer so you are going to be able to actually start the project before this order of conditions expires this order of conditions I think will expire three days I think yeah get out there pretty quick let me double check thatch project has never started technically we're not allowed to issue an extension on project that has not started expires on the 21st of December has no constuction site visit no bond posted no technically this project is not started and it won't start until bond is posted in preconstruction sit as it's done yep so by December 21st if if they if they've got some Sil fencing in is that considered the project is started so just to clarify for the commission I'm not aware of that requirement regarding the project starting certainly we they would be required to get an extension before the uh expiration of the order but the project um many cases we get extensions for projects that have not started um there is a requirement um in the the planning board their decision as a requirement for it to start but an order of conditions typically does not have U other than the expiration does not have a required start date that answer that then know why I thought that but for it's probably you're honestly you're probably thinking of the there is a planning board condition to that effect essentially says that if the project is not started within a certain number of years it's you know it's arguably not in effect um zba filings have that similar um and um yeah but yeah so um either way they they they should and need to start and want to start um and all of the prerequisites that you mentioned that is accurate right so the the bond has not been um uh posted but again you that's pre- construction requirement um so we're making sure that depal is aware of those items he certainly wants to start out on the right foot again he is not the original proponent but he is you know trying to start out on the right foot so those preconstruction requirements definitely we want to make sure happen in the right order make sure sure Sabrina has everything commission has everything that they need and then you know be prepared to start construction once those South B Street request to reduce the bond amount I need to scretch that up um I think they actually just sold that property this past Friday we take any action yes update on 55 Sunnyside Road 56 Sunnyside Road um Mark Stinson had called me up and asked me what updates they were on that because he was originally the one who got the call from somebody I told him I have not had time to do any enforcement and then he said he would take it over I can I can only do so much good so he's doing that and I think he's also doing the um disturbance across the street as well okay de Tree on North Bond conservation property any update there yeah I I spoke briefly with um Nicole on this um so the state said that it was up to the neighbor to pay for the tree to come down however um that's what they say on property that they own state owned property they they say that this is not state-owned property they own the CR the town owns the CR so uh Nicole kind of needs to figure out the legality of who should be the one to pay for that tree work um so she's working on that so she's working on that yes I think she is all right 13 booksh have land donation any update there I was paid for um I submitted and um he supposed to be F next Frid okay so the bill has been submitted and hopefully they will get paid for the first portion of okay R amendments for the local permitting program with the state I have no update there to you okay on the Suffield lppp contract with to bring his help I got a uh some information back from Jason oh he responded no oh I responded you responded with information yes he does not have evidence that we can legally not have an outside resident really on that commission so other than that that's the only update I have I don't have his phone number maybe you can give me his phone number I don't think I have Jason's number either he doesn't answer my unil um um so part of this hold up is also because what the town had voted for in regards to members of the Conservation Commission being elected members a part of that record well being an elected member would mean that you are a resident of town so if that goes through then a portion of the membership would absolutely have to be a resident of town so that's partly why this is kind of like held in LM because we're waiting for I think the legislator to give us an answer on if we can change that to be conservation members elected or I don't know if it's three or four I can't remember I think it's three um but that's that's kind of what is being what the holdup is is State and their to the property at 31 Sam West Road Southwick after receiving a notice from the Conservation Commission of Southwick that we entered a Vernal pool I called surveyor Rob LEC and he confirmed that there was no vernal pools in that location however he did say that some sand and still had left our property and entered a wood line he suggested a burm along the top of the area we constructed one uh the length of the area he also suggested that we remove the sand and dirt that entered the wood line we we both thought heavy we both thought heavy equipment would be too much because we did not want to disturb the area anymore so we removed it with five gallon pales this was done earlier this year I've checked it several times since then and I've not seen any leaking of sand into that area thank you for your patience James alac Jr are they still going to build a burn though that that's where you and I walked that BM was up there yeah BM was up there but he he said we constructed one the length of the area fond right that's it I don't that's on his property or not that's a oral pool I know so it was I think this is a little misleading because there was a delineated Wetland out there that was disturbed by this I kept calling it a Vernal pool because I have some experience with pools and I very much believe that to be a Vernal pool but at the time it's just it's a wetland but it's still protected it you knower it's the same not certified it's the same protection the same protection anyway it's the same prote matter yeah so but anyway he said they put the BM up and they cleaned it out it's a done deal so we can just scratch it off to the weed it yeah yeah we did looked fine it sounded like what you said yeah so at least we have this to put in the file and then we have yeah and then we can scratch it off right yep something we can take off right died under other matters I have two from LMC number one they asked if conservation would consider using Code Red in catfield or in Southwick and whatever the it is in subfield they send out a message reminding water fund owners to remove their docs by December 1st don't we ask that every year or I don't believe via code red I don't I don't think we done by C read before there's no to charge for that or anything so why not that from the police department is that what is the code R explain that uh well it doesn't have to be the police department it come from the conservation department somebody has to record a message and get sent out via telephone or email or text for all three well you're not signed up if you signed up the date you guys voted right so I put uh November 4th on the and that was when you guys signed it and I didn't send it out until last week and so there is and then when I sent it out he got it and that's the official date of issue is it the day you send a registered mail because how do you know when he gets it right well I you can't anticipate that order conditions I send it via email I just scan the document and send it off because I'm not I don't like the e- permitting thing I because the way the it's formatted it I don't like it so how long they have to appeal that he said I think 10 days 10 business days from the day he got it all right so that's expired by now right no no with 14 15 you said right so no it wouldn't I think he's got because you know we took a legitimate vote on a information that we had and then for them to send us a email saying it doesn't count anymore that doesn't sound fair legitimate or even legal to me the vote stands we're not resending it you know so yeah he thought so he was trying to contact me for a few days so according to them the date of receipt of the document in their office the date yeah the date not the day that we vote have to officially appeal that themselves right but that was a different decision that wasn't the order of conditions that was another decision that was made another Vault that was taken well the delineation delineation it's it's the order of conditions is basically based off of contingent on that being an intermittent stream right yeah because otherwise that was voted on it was approved and as far as I'm concerned it it stands don't deal for deal and I was like he can absolutely appeal I've never gone through an appeal so it's something to learn because we've done it like this forever and it is an
