##VIDEO ID:kF_c9hGOG7I## good evening everyone welcome to the South Conservation Commission meeting today is Monday September 16th 7M our meeting is in Southwick Town Hall land use meeting room we are in hybrid in attendance tonight we have Dennis Clark Norm CH Chris FR and cin Sol all right we have anyone for public comment in the audience here anyone online all right hearing none um sorry Cliff cluck is requesting to record yes you may Cliff approve of course all right I guess we had a little bit of time we can look over our minutes from August 18th are one thing in page2 on the connect Shoreline survey should that be middle pound instead of South pond it's middle pond that's correct it's aome I didn't it didn't change it right I'll take a motion when anybody's ready make a motion to approve the minutes a second as amended y as amended Al ton I I I hi that's unanimous have a nice weekend minut was almost had a really good oh that would have been really they did pull it off for a little bit I gotot something from Mr C Bishop today he sent me a photo of some down trees at the Granville Gorge okay someone has been chopping away and knocking our trees down one one trees is I can show you the pictures yes okay there's the evidence of the chopping a a ax two trees right here or beavers no beavers a beaver I think this is the big boulder that's near the parking area this is the tree that's covering our Trail right now going down to the gorge and where yeah this is a chopping so it's definitely like hand a g g why I don't know they just wanted to chop something down yeah box for everyone didn't so we probably need somebody to go chainsaw and open up that t right there right wow the tree that fell one of the trees that fell yeah biges I haven't been over there see I also saw something on Facebook I think yesterday that someone was messing the trees over there yeah but Melle told me about it oh okay there you go 705 okay 705 we have an noi 55 Foster Road this is continued proposed construction of a single family home within the riverfront and buffer of border V what so in the last meeting you guys wanted um Mark Stinson from DP to look at the application again we said everything was fine and it's up to the commission and I've been working on getting an account opened and um finding someone to do peer review Jeff Smith with svenia Associates said that um they are interested in doing the peer review so they're going to get a quote for me tomorrow and then once I get the quote can let Anatoli know so he can deposit the money into the special account and then we'll get the peer revie going okay so that will be continued I assume he's request a continuation um make a motion to accept the continuation second all in favor Den I Norm I Chris I Jerry I I keevin I okay all right right move on to new business 24 and 26 Nicholson Hill Road possible changes to 44127 do you want to come up I guess you have to oh sorry no you have to stand okay so um uh Jeff Smith for svenia associates so we're representing Lis berelli he bought this piece of land it's two Parcels but he's working on only the uphill one which is 24 asked us to look at it doing delineation um a previous one was done I think in 2020 I went I looked at it um I red delineated at the back of the field along the forest there's there is an isolated Wetland that is fed by groundwater coming down out of the woods and along the edge of the field previous delineation showed a wetland out in the field I didn't find that to be an actual Wetland you sorry I have this is the approved plan yes so so both of them um so we have an approved notice of intent order of conditions four local 44127 and it was local because these are um isolated Wetlands we have one down downg gradient and up gradient to where the proposed house is um so which one you want me to maybe just go up and point on that screen there because I don't there's no right now st's on vacation so okay so let me just hold let me just try to share this for a second I'm gonna follow your hand with my mouse this even okay Soh previously they were going to put the house here on the slope there's a lot of cut and fill involved move the house up to here septic system will stay right where it is um this is the area where I not find this to be a wetland the Wetland is right along here it goes back into the woods it make come out a little bit like this and go across here but this is it's open field with a broad variety of both Upland and facultative vegetation there's one area that does have a lot of soft rush but there's no Hydra um connected to that Wetland or even to make it a wetland this W down here I pr looked at it but then when I found out we weren't working on this part I just y it looks like a wetland we're not anywhere near we 300 feet from so like I said the house isn't going to be here there' be a single family house now right in here a lot less cut and fill um 2 200 ft of of impact in the outer 54 of the zone no impact to the resource no direct or should not be any indirect impacts is this the same noi that they came in and asked to move the house back further Le came in with this yeah and and they wanted to move it back further they did and didn't you have problems with them putting up Sil fencers and down below um the person who he hired to put up his soap funds to do it correctly and eventually it got done correct he was I think he was down in Florida at the time so just the communication was off um so this this order conditions was approved I think it was last year so my question is if it was approved does that does that mean that this Del is good for three years yeah that's so two more years well two more years right Jeff Jeff wants to amend it amend the delineation is that's that's what we'd like to do yeah and um I'm feeling that it's by what I learned that the delineation was done about three or four years ago maybe they held off in the permitting and just did it last year I don't have a lot of the background really familiar with the plan myself so is that amended did they amend they didn't up amending they never got the amendment no they just asked the question out yeah I had said that I didn't really like the idea because it the house or the I think it was the house the way he drew it up was going to be about 10 feet away from the isolated W over in there that's the one he said not really w and that yeah what say now they hav hasn't yet really this but the house would be actually no so maybe this is how it works so there's one of the plant that um previous project had and then this is the one that we have that is the same as that one so sorry I don't have all this to which one and this one although it's further from a wetland is significantly more impact just based on all the cut and that's going to be going on um yeah a single family house would be placed similar to this but like I said when I delineated this and I did soil BS in here and there are isolated spots of soft rush but for the most part it's a pretty broad mix of backup vegetation um some of the top soil has been skimmed off that may have to do with it there's some isolated depressions that may have allowed the soft brush to dominate but it does not it doesn't meet the criteria for wetland either on like primary it doesn't AB but a resource so it's not a BBW and it doesn't have any of the other indicators that would make the soil hydric So based just on vegetation you would have just some isolated little clumps of and you looked at the soils I did matter and I sent you my bu I brought last week I sent you some drafts and I updated this just to have the correct square footage for the the impact area was from I didn't have that yet so this is for the Wetland and this is done at the back of the field and then this is for the Upland and this is done up in adjacent to turn right yeah up in this area here that's my one remember correctly after we approved the plan he realized how expensive the retain wall was going to be and he said therefore the project is now no longer valid to him that was a two family home and now it's a one family so it's going to be an M Mar yeah and that retaining wall is going to be awful tall like an 8ot wall or something crazy very steep slope there less of the impact considerably yes as far as the retaining FL goes right yeah it's the amount of ground work to Earth yeah that's at the back where it is wetland this is oh where it is not okay it says this is under local bylaw because of wetlands are isolated it's an isolated well so it's not a BBW and it doesn't meet the threshold for isolated land subject to flooding it doesn't it doesn't me the volume volume quarter foot qu acre foot so um so that is that's why it's not a state regulated and I think you agreed with that before that's what the other delineator found it was isolated that's why it went to a local y filing so I guess um the question is what is the path forward for the applicant I was going to ask you that's why he I like come in and ask the commission what they think can we amend amend that at a meeting because it's local bylaw I think you probably could would we need to go back out and look at the survey look at the markers do like a site visit on that I'm I'm sure Jeff wouldn't mind doing that I yeah I said the email I'm available um well time we can make it work within the next two weeks so it's it's done before your next meeting okay so you guys want to take a time now while you're all here that would be a good idea yeah please to if you want weekday afternoons are the best okay yeah that makes me happy y anybody else makes what what's your best day F what's your time what's your good for you I'm retired congratulations good for you time in the world all right there we go nice okay very weird yeah Monday comes and you're like you'll figure something need to do something so Jeff what work for you anything except Friday is good he so what about uh maybe Thursday this week sure after 4 4:30 yeah 4 430 good 4:30 on Thursday okay I got to check you know it'll be that one day next Thursday or this Thursday this Thursday let's get this done then we should be able to have a plan for you yeah I can do that next week Steve will be back on Monday and all these technical kind of it's not that we don't trust you yeah I just I'm not really familiar with the plant so I'd like to get some eyes on it myself pry right show off is skills anyway so I've been je many times wear your bug spray I didn't get a t there it is good tick habitat yes yeah and now they are prolific they're really like getting their last yeah dig yeah okay okay and then did you want to update for the noble Steve yeah if I could so this based on the the meeting we had with the water pollution estate water quality not the wetlands but the water quality people so uh the gentleman that came out from the state felt that the crossing met the criteria as a stream different criteria than under the wetlands protection act but so I flagged the Bank on it we don't have it on a plan yet it's the engineers working we have it on our plan like a survey plan but the engineers working on that so I don't have impacts yet for the stream portion or the Wetland I red delineated I can just show you my field not I expanded the Wetland out in two areas um where you guys were there when we did it when we looked at right and um and then I delineated a bank through there where it clearly is channelized and where they dug a channel where they dug a channel exactly he made himself a stream so now he has a stream so uh so we'll take care of the stream and the Wetland and so as soon as I get impact counts for that I can do the Army Corps self-verification we'll find out if we need an Army Corps permit we shouldn't we're under 5,000 square feet of impact I believe I'm pretty certain of that um get that squared away then I can proceed with the 401 Water Quality permit but I need numbers and and then as far as the storm water updates that Jesse was supposed to be working on they have to be realigned now because of the change in the crossing profile because the for crossing profile was so high up um the alignment on the invert you know on the brain has to be changed so that's oh this is being re-engineered yeah and right that's that's where that stands also yes he is yeah good on that gra Ste was gonna just ask a question about that so sure we oh yeah yeah we so we thought that we had everything was squared away the only thing he didn't do was put his his ramps in because he didn't want people walking up the ramps going into the gazebos um so he felt that he was in compliance because we did the Cal and prove that the because the gazebos were built at a higher elevation it reduced the displacement and the Bing land subject to flooding so that was reduced and he was I believe in compliance with everything else but then it got held up because he needs to put the ramps in to get the occupation permit is that is that a planning or zoning thing it's a that's a planning thing they got held out going to keep it open because my dis don't work to happen out there but if so I'm a little up in the air on how to move move it forward for him um um yeah so I thought that he still had time to do an extension on his noi that's why we're talking about this right now and I I talked to Art last week I'm like get your extension request in now because you don't want to go through the process again and then today when I actually looked at the date it was flipped in my head it already expired back in May so that's why we're like um what do we do now and then and and I asked like what what else is left for work right and only the handicap ramps is left um I mean it's it's receded it's it's grown back in vegetations stable so if you applied for a certificate of compliance on the work done and then when you got the handicap RIT to come in get a RDA for that or well I guess we we could maybe do that if that's how if that's the most streamlined way to do it probably do the cleanest way of doing it okay I I'll recommend that then RDA or ramps and compliance certificate compliance come in with all the information to show it is in compliance okay it's always been if the volume in the flood plane yeah okay that's really mostly what we I think that's a pretty good way to do that and get this anything else I think those are the overall comfortable with the bait and switch on that and what's that like you said like gazebo because they're not gazebos he came in and sold you and I know it's not in our purview but I'm not overall comfortable with the B switch and it's GNA get over it because it's not your CH we we op we've been talking a lot about yeah right they're trying to be accountable now so let's work even if you did say he's coming in to build these big Huts he would have approved chicken coops doesn't matter doesn't matter what he built there you could build chicken coops in the Stream yeah what his idea of gazebo is what we picture is you know we picture a tag thing lattice work and right open flower boxes airing anyway so don't cleaned I don't think he meant any harm by it but he certainly did build pretty lavish gazebos still call them gazebos all right Jee okay thanks very much thank you very much for coming in appreciate it y to try to get things moving forward and try to really yeah I'd like to get this Noble Ste thing kind of accelerated if we can because it's just um yeah the same page when I thank you Jeff okay request for certificate of compliance 29234 D and 115 Fred Jackson Road 0374 0374 thank you should we just table this yes Kevin so oh land owner yeah uh Rob I think came out today and GPS some stuff we weren't really aware that we're gonna have to do like a full ass built survey so he GPS but he didn't have time probably to plot it on a plan okay so yeah I think it was Rob when we were talking after I talked to you he looked through the order conditions didn't really he didn't think that it needed a engineered as built but then into the storm water uh regul I I actually found I read to the whole order of convictions and it's in the storm management aspect of it so good catch EXC good catch I didn't know was in there Rob Rob when he was looking at it and we were in his office he was like I don't even know why this is really on here but like cuz he thought he didn't think that it would be but like in in that order but it is it's there now so we have to do it they already went out today plotted everything I you get the approve plans from Ryan today the ones that I was missing oh okay okay we can table that table that we'll move on a 19 f Road well it's not a hearing so uh 19 f Road on approved f trees in concom jurisdiction so I think you guys are familiar with 19 Foster Road um Anatoli had built a single family home in an area that was um there's already a pre-existing structure like house there um and Alex is the new owner uh he came in and asked about um taking down some trees a tree had fallen during one of our windstorms last month but since then more trees have gotten missing and so I sent him a naughty letter and he's come in being compliant um yeah I can update you with some photos yes photos would be nice yes um so I'll just show you some images from earlier this year when the tree this is when anat still owned the property so this is a Sil fence Wetland is over to the left you see some trees over in this area again wetlands are over here MH these are trees along the property line there's the existing shed then that's a violation right there having the D sign on a tree is it yeah oh there something new every day um so here's the backyard um um I guess I should show you where the jurisdiction is huh I have it in there let me just show your jurisdiction if I have a no I don't have it on here do you happen to have the letter Alex there we go so when I buy the house nobody give me the those paper the previous owner excuse me this is this is a current owner um can you just state your name and your address Alexander the dive 19 fer Road Sal have any pictures of the trees that came down yeah so here's some stumps oh yeah right here um I see three three one two three there like five maybe six I'm not sure so these were accidentally marked is what Alex said they're not going to come down and then we have I think these are what aritis the ones that were all in the line that had the D sign on they're gone now and I'm not sure if that small tree in the back was gone so were those ones behind that where the sign was that's in jurisdiction there this whole thing is jurisdiction well up until maybe right where my hand is mouse is so is it the whole Y how does the house look like how does it how does it work though I can show you Alex also had found some trash in the Wetland and um had removed it removed some trash he said there is still some trash out there that he would like to remove and I said you would need approval the commission to do that is that the neighbor throwing that trash in there no I think it's a previous owner you see a many there is just a it's like a pool or something kind of P plastic MH it's just we take it from um there is kind of small lake or some River from there but um when I walk to the almost to the end there is a lot of stuff trash so it needs to be clean out also last time we told somebody they could area yeah we appreciate cleaning Whitland areas but there needs to be a plan to say how it's going to be done what methods going to be taking place precautions exactly what to be taken out no organic materials only plastic we learned our lesson the driveway right got any suggestion Sabrina what the a how to resolve this um yeah I I would say plantings for sure um maybe if you wanted to clean out the Wetland come back with an RDA that showed where the plantings would be and what trash would be removed um and he also said that he wanted to put a fence up out back no because it's not enough space to make a fence then I I'm not going to have any backyard there's no no no room and I just speak with anatol today and say why it doesn't say me when you sell the property say of the make a business MH he supposed to be with you today right no maybe or 55 off the road but it was Contin so do you want to specify what we need he needs a plant and put that in a enforcement order or letter good idea so you'll get a letter enforcement order what planting we would like to you to put back in and then you can come back in with a reest determination applicability to remove some trash from the Wetland which has to tell how it's going to happen as well what methods I can help you with that yeah you see supr should be very helpful' be nice if anally told you this yeah that should be recorded in the D I believe anyway right the is n that um it was reported I don't know if they remove it completely after the certificate of compliance has been issued I don't know how that works if they do what record it in the deed analy in the deed that's how you certificate PL gets recorded to supersede the order conditions were there any ongoing conditions in the order or they were I think there was just like The Monuments that were there and those are those rocks that we saw yep okay all right that makes sense to me do you have any questions no okay thank you for coming in Alex so um can I come back tomorrow to fill out the application or you say you help me with yes yes I'll be at nine I'm thanks for coming thank you very much foring totally to my job in okay sure thank you thank you okay 241 Holiday Drive Connecticut response to water rights for dock and vessels blocking access to the chestnut Inlet we one it's okay sunny side so I'll give you the yeah I'll give you I'll give you the background at Sunnyside um so I did get uh an email from Mark stent with D um someone had said that there was some trees being taken down and Wetland resource was possibly altered because of this let me just am I sharing I'm so bad at that um that bring um are you guys familiar where 52 56 Sunny Side road is by Turtle Co that one no no this is over by the ranch is that with the pond the yard they kind yeah they kind of have a pond right along the street it's got construction equipment in the yard people call because they see that constru equipment yep so um I kind of just scribbled some words here's the Wetland right here there's a new mode area which I don't really remember seeing but I don't it may have been there before and then we can see that there's some some damage being done over here um let me just skip through so again here's the Wetland across the street this is the ranch over in this area I think this is a culvert under here and then this is that Wetland y yep right there and then this is the cloudiness in the wetlands something's happening right here that pond is always cloudy I drove by that pond every single day twice day for a year and that pond never clears up I don't know if there's like a turtle in the bottom or something Turtle it never clears up never ever we so I wonder if the clearing has nothing to do with that because there it looks like there's a good amount of vegetation around it's not yeah I've never seen anything actually in that area the Wetland area any disturbance I've been called a bunch of times because they just have a little bench right here made out of their snowboards so this com across the street the water back cover I'm not 100% sure from the the ranch yeah it might so the the cloudy water might be coming from the ran more to the left you can see how the vegetation flows it's definitely a flow in there yes so over here can up you know the vegetation but I didn't really see anything around this area that would cause it where does all that is that all from uh like what's behind those trees is that one of the old golf courses where like the that subdivision is is that that's on the other side of the road it's further down the old golf I'm talking greens yeah the old is that that's the woods that way though right the direction you're looking I want you just asking yeah where's the water coming from is there across the street from the rch it flows from the ranch this way or is it flows from the ranchan under the street my and heads towards the development you're talking about it comes Kellog Brook maybe or that General vicinity so here's 56 right here and the little Wetland area I guess is right in here that we saw and then and then here's the pond where' It Go evaporated I guess there's just see that's probably discharging into that pond what I'm saying is is if you go further north where's that stream coming from that's maybe where you're getting the cloudy water I think that stops on Larry's Bish's property well now you're get too far now you're to Westfield that whole piece right there is the the Old South Country Club this one right here little the other green part down the bottom this here across the street it's ones that subdivided used to be the golf course 17 18 19 that's the old sou Country Club over oh oh that's and that one you got highlighted we had a problem with that guy for quite a while that he was working the post of the wetlands what number is it 19 though 19 is the one we're looking at right now yeah um let me see if I can get in Ni space go that'll give us any contacts um well there is clearing I did try sending a letter to the owners because they don't live at this house uh and I got it bounced back and I just got the return today so they haven't even been contacted yet um what would you guys want to do try to figure out what's going on because it's been going on for many years that Brook if you follow it in Westfield dumps into the river it's definitely going away from the ranch so from the ranch from the ranch from south to North goes under the bridge and North Stanley Park okay here it's very vegetated right there across the street what the thinking is well maybe Andy's right it's turtle in there kicking it upas so um yeah I'll try contacting them again and see if they can come to the next they have to have a contact number somewhere right yeah but my first first attemp fail okay all right now we'll move on at 241 Holiday Drive response the water rights of dock and vessel blocking access the chestnut Inlet is what's that share I'll put the map on yeah be good you see on line both go participants can share um yeah so I did contact UM piters am I pronouncing that right yep and and they got right back to me they've been very good with communicating um and again this is for docs actually nor can you fill us in y okay I get this back up okay this is two 41 Holiday Drive we we saw these before and the issue here is um ask the owner to please give us a part or give a copy of their deed to determine if they had rights to the lake and over over in this area here my cursor is is where the docks are there's one dock two boats and two pwc's and two lifts for the pwc's I believe okay now according to what we got back from the owner which was a part of the deed not totally the deed it does not the parts that we got does not show that he owns any of this property out to the lake it's confined to this area which is his property now is Fred here I thought he was going to be here tonight thanks I'm here on his beh oh okay okay hopefully sh on up and say your name and address welcome my name is Vincent kanteti I that 215 Holiday Drive West up 215 215 okay two houses down from them okay so you have one boat and two pwcs there correct I've lived there for 20 years or so and uh I live along the canal which is the inlet or Outlet whatever you choose I think it's an inlet and uh it's a quite messy Inlet so I Mo probably here here a little bit and here they come out like this so there's another dock here that comes out and this is U Brit's and Don property so Fred had put a dock out there this I really can't call a water range more can't navigate through it's really you know I actually took pictures today it's uh almost getting to the point where water doesn't even flow so the end just gets filled up and basically we'll dig it out or bury fish you no everything's getting really overgrown nobody really takes care of it and we try to keep the water flowing because so we don't it's going to turn into a mosquito mess and it's it's getting to the point now where it's it's um it's pretty low especially now SL trickles yeah it's uh trickles into the lake trickles into the lake you know this this year when there was a lot of rain it would it would flow out but as of now it's basically so I own the boat on the other side there's the two boats and the dock in between and to the left of this is two PWC zzrs with the yep and you can see where the dock is so those I had probably had those about 15 years so those are kept on Brenton D's property maybe they vegged over a little because they just shrinking but um they gave me permission to do that as for the boat you know I probably got that two years ago after Co and said hey can I put my dock on there nobody really seemed to bother it nobody really bothered with it but now it's question we did a whole study of of Massachusetts Bard two years years ago and then this year we did Connecticut border so we found several potential violations that we're following up on and that's this is one of them okay okay you have permission from the property owner to Edward dock there Bron Don yeah Coulson yeah the dockwise and for them they're okay with it it's not my dock so I just now where the dock is nobody owns nobody owns so going the accessor way way nobody owns it no man's land so it's kind of this question of these rights that people in the neighborhood can go down to which I never know anything about waterways of people you know they say there's five I don't know I never pay attention to them but do other people use that access that area I mean you have a boat there and somebody else has a boat on that doc as well from that's Fred's FR next door yeah yeah now the boat on the other side of the inlet he owns the land yeah okay he he owns this slot number 199 in in the house next to it or I don't think he's filled out an lpp form yet but he's got a dock in the boat there yep he needs to right yes I don't know if he if he responded to Jean slutter or not out of the 50 plus that you took pictures of and that we sent to second request here's a picture you know yeah just fill out the application we got three or four there that was it he's not blocking anybody's access because there is no access up that stream correct well put a Cano in there or anything whatever flooded it probably used to be used to be like all natural water bodies they atrii the water level goes high but I don't think it's gonna because it's pretty much preset it's been closing up for a years yeah well I according to other LMC members the neighbors for years put their leaves into that that probably doesn't help well it's spok lined you know and it leaves just falling it every year and it just gets pretty soon you be able to walk across it so yeah we will mosquitoes are kind of a question of mine but so they just really need to fill out and well I I I think we might want to treat these one of two ways we could we could treat it as um you have them join the association of ABC and decco and they could move their boats over to those areas is one option two option is move everything to the left or to the north and put it on the property of your other neighbor that has L front property and have him fill out the proper lpp forms and then You' both be legal what about the town of subfield though I mean could they petition the town of subfield to allow them to use the boat put a dock on Town property there as an association of their own I not sure how that would work well they'd have to ask the town but yeah the well it's like I don't see anything in his deed that says he's got right away access no I agree with you no I agree with you that's why I'm saying you would have to get the r away from the town yeah to access that yeah I suppose that could be a so that would be another option if you don't want to move or put it on Fred's property that might be a more permanent solution if Fred moves right you know how long have these stocks been there for I think 15 years or so so it's not before 198 I think they had a permit you know for each year not sure this year they have had some medical issues so yeah don't know what's what that is but so I guess you got three options it's the T Suffield or get it right away number two move everything over to your neighbor's doc with his approval and have him fill out the lpp applications or three contact Jerry crane who's I believe organizing reorganizing the association of ABC and Decor okay and and try to get it on their on their docks okay there's no there's no docks on it on a court right now there's only one boat on B Court C Court's got two boats and D Court courts got there a little crowded right now so those are different rways that are right on holiday on the water right M okay and how many there at three ABC and D courts okay and Jerry crane lives at 308 holiday yeah I believe he's the person for you to contact if you want if you want to go that option and see which one works best for you yeah I mean this didn't happen overnight it's not going to get resolved overnight know spring to next year I have a question um would that Association that they're trying to reestablish would that be for all four courts or just SE they could they could do it either way I believe it would be smart for them to do it all four okay so that could be done for all four courts because they that Encompass yeah the rest of the folks down there I'm just curious about that okay okay thank you for your time appreciate it move on to North Pond Conservation Area possible Boy Scout project Andy Reen to present one of our Scouts lives across the street and he suggested that he'd like to go in and do Cleanup in there but they'd like to morph it into an overnight camp out weekend kind of thing like we did years ago I said the likelihood of being able to Camp up top near the pond is probably zero correct but further back I would ask and then I also mentioned for them about the fences and the trail clearing and everything else that was on the too to-do list yeah they seem I'm pretty sure do that camping is not in the conservation restriction precluded right and I'm sure that would be also on the state official game area well right but mean could write a letter and ask there certainly is enough stuff in there yeah oh yeah they helped last time like crazy a lot of stuff out of there last time yeah we didn't have had any problems some of it's half buried right you would have to yeah ER ground Fish game did take a lot stuff out those dumps that were way out back by the field I think they took a lot of the car seats and car parts trash girls the bigger stuff check with the state yeah got to check with everybody anyway now everything's had it taken out of our hands so yeah this is something they wanted to do believe in October so like four weeks I was the state that quick to respond I know they might be might be a quick now right yeah it's a no would be quick right is there any place else over there that they could camp if they wanted to stay the weekend and work in the property is there have a spot that is outside the conservation restriction the area is that's outside of the a little triangle where you come down in that path yeah right inside that triangle is the Wellhead area Reserve that's cut out there' be plenty of room there to count right but you have to make sure police know and everything else right yeah you talk to the task force yeah t the task force task force the North Pond task force yeah find the Wellhead area on a map yeah it's defined it's it's there and you can access right from the parking area because that's outside conservation restriction can they do a campfire in the Weller area campire I don't know have to check have to check with the authorties something you have to consider have Aire right yeah if we did have a fire it wouldn't be on the ground we would bring a barrel or something of that sort if we were allowed yeah so you have to check with the passort maybe write down what you what you want to do verify how about how about on APR land is that camping prohibitor from APR land C I don't think so it's still a walk but they have festivals on APR land sometimes so yeah because uh our property the the 40 acres 40 acres it's a little bit of a hike but you wouldn't have to ask for like ghost on your Hoops either if if they yeah go to their RS yeah if it sry yeah everything's so yeah it's definitely walking distance is that from the south longyard looking in so where the fishing game parking lot is just through the like Woods there we used to actually access the green part right here right yeah right here so the parking area for the Wildlife man your own dirt road that goes in and out of that I think there's actually a road that comes in in between it's 141 South longard so it's more no more uh West goes on the west side of the property oh right here yeah yeah correct right there yeah okay yeah yeah I've seen the road yeah I never no actually that hole number one is the the field yeah and then then the other one the wood par it's two separate 777 correct so I was thinking go a little more like this no the other way the other way other way okay see that little dotted rectangle yeah that's just um why they area like that's still Wildlife Management this is yeah Wildlife Management here and the other side of that road this one this here there yeah Wildlife Management yeah so that's could be if you can arrange it with them summer parking and then have a trail go to the north from there and you cancel out the other entrance completely I don't know if they do camping H I don't know if they Camp there they can or don't think you can camp on the W oh camping yeah I don't know we'll we'll check with the uh we got two options there check and see which ones corn Field's not that far no no it's not be comfortable s corn stubs not even that's that side of that line Kevin you said 77s in the same yeah that's our right even that whole fielders you can't go in there that's not part of wild management no correct that's Kevin's yeah that's right that's what he's saying that's have to worry about it yeah asking go to the state people watch Birds go in there and they just yeah there they go just see T go as far as the laundry list of things to do where are yall with that I know you want you were talking about snow fence and mhm that tree cutting Pi up and they to do that while they were there that was something ready to it's down the agenda I did send them requests of things that we wanted to do good place and they haven't responded yet so we can talk about that in a couple to go in and just clean up yeah everything else isn't ready to go yeah and maybe a second time um like kind of like dump branches and certain areas once the leaves fall down it'll be easier to get those and the sticks and stuff I would definitely need some to get the parking area open for taking the trash out you know the yeah refu I have if we pull it out onto the state land we can go out through Kevin's Road or through through the state plan can't we well you can't drive out there okay so they won't let you drive in that area but yeah I'm sure just way easier to get it out of the park lot yeah just take it off the park right we will plan on it okay moving around ins side of Mountain Road 29238 7 discussion on St project and po uh possible amendments all right we have somebody here with us tonight give us your name and address hav seen you in a couple years my name is Dan D finishing up a house there uh to my surprise I received a letter that my noi expired I had no idea I have no idea when it was back send you that letter or was that so you didn't the person that you hired to do the project didn't let you know that it expired they didn't give me a heads up no but it's been three but it's been three years that's in you know it's a long time yeah well that's how long was good for three years right right I mean how how much has it expired by so I got a letter that expired on August 19th and I got a letter that day and that day wellow well whatever f close to it yeah I would have appreciated a heads up like a little your consultant should have done just going through my Excel spreadsheet and I noticed that yours and Kevin's was expiring like in a week and I was like oh but by that time it's too late to ask for an extension you need to do a month prior right so it was just now you can ask Mark Stinson but he's granted us permission previously if something like this happens to do it after the fact you're supposed to do it a month before but right it has been done and sendest has actually said you know it was a mistake you know I did send some corresponden you know to Sabrina and whoever especially see he had a consultant that didn't this isn't the first time this happened this happened to other people too but and I can't expect them to keep track but then you kind of do cuz you're to do all the paperwork for you so what do you have left on the project are about wrapping up your thing I'm like 60 days away the house is built the set's done the Well's done the driveway's in the adjusted driveway that's let's talk about that in a minute was a lot of work wasn't it it was a lot of work I was here whenever too long with you guys for like nine months and uh I wish through all the Hoops everyone yeah and I wish I hadn't but anyway I did and we're here and I'm almost done so and I i' I I'm very careful about what I do and how I do it and you know so um if you ever want to you know come out there and check it you're welcome to and uh whatever I think I've corresponded with you i' like just go look at it because I was there before you started doing anything yeah and then I was off for a while so I don't remember anything you know that's right now I'm back so I would love to just go just give it a look you're welcome to remember what used to be was like but you'll be applying for a certificate of compliance in the near future anyway so within 30 to 60 days yeah I will so we'll do what we can Mr Stinson hopefully it might take us 30 to 60 days to figure out what to do so okay um so there was a letter from our L you guys have a copy of it um and there were some amendments you guys you wanted to do some changes emitting the thing um I want to do less wants to do less um back let me just actually bring this up and share ahead of time there less impact yeah far less so I don't want to build that bridge and put that driveway in which my call my consultant suggested yeah there's existing Crossing there and there forever since the road was there I honestly didn't think it was the best approach to the property it sort of comes in like sideways yeah but we used it as construction entrance to get concrete trucks and everything in there and my wife likes it so you know what I and no there's a 30in covert there it's big and strong all the concrete trucks and the field trucks have gone over it um it's in the town right away I'll probably have to maintain it for uh the director of Public Works Randy Randy U which I'm glad to do but by not building the bridge I don't have to impact the wetlands I don't have to fill them I'm going to move the limit of work 25 feet uphill in that area so which which hasn't been touched to begin with um so what we've done before situation instead of having to you know vote on the making the changes and stuff is do it and when you come in the certificate of compliance red line that changes okay and that way there we can look see this less impact and approve that certificate think that's what we're looking at the S exist now right here the new silk fence this will remain but there'll be another one limit of work up here so nothing will happen even better the rain Garden isn't necessary the driveway comes in here comes in high just traverses sa systems here traverses and ends up in the same spot at the house I don't need to go into the wetlands and plant or replant it's full it's vibrant it's all golden rod right now nice well allerg yeah if you're not allergic no some okay um the hill this is all this is all stabilized side of the house is now stabilized so I have to stabilize the septic area back of the house and then the downhill side of the driveway that's it all right so I sorry that it happened this way and it's sbr's job to not to keep up with you know who's expiring but to let them know that it's expired yeah she's just doing her job and we worked it sounds like everything's okay though I mean it's not not a problem looking better than it was right guys it was a you know bit of a shock when I had the letter no no no no come on right at the end you know didn't doing yeah um so I'll okay I'll wrap it up and come back to you for certificate compliance and whatever else I'll consult with Serina or what else be whatever else to go for this re come on visit yet yeah sure okay or anytime PA sa has my phone number to come out well thank you very much for coming in you're welcome have a good night cancellation of s n star party no I have some health issues that I need to work out so I won't be able to do anything um so I had to cancel we have another stock party huh have another one next year yeah yeah they did say they want to you eclips tomorrow night martial lunar eclips really for free to tell kids to school hey old business request for certificate of compliance three South Lumis um I so I did just get an email from Ryan but he's not online so I think they're still wanting to move forward with the certificate of compliance I'm a bit confused because I didn't see any Wetland soils in the Wetland restoration area I just saw planting so I don't on okay any vote doc discussions Norm no I think we closed it tonight with 241 I think we can take that one off the list okay super duper okay for liary report well we already did that you want me you have anything else on that Norm well we're still trying to get one more presentation and select board and it'll be our final attempt so all right they're going to buy it or they're not temporary cling of North Pine Conservation Area parking lot discussion and approve Land Management plan I think we've done that a few times um no anything yes something you got a little bit a little packet so um last meeting I did give you guys a draft of the management plan and you were to review it and let me know if you approve it want to change it or you don't want it you need to know what you guys want so it's just the the the management plan is just the first page um and I had norm and Chris sort of rate their priorities for things to do and I just start the are the same right you guys I don't you know which numbers are mine which are yours so I can't tell yeah I think the lighter colors are yours okay but you can't really see I know which twos or mine so as far as the ATV use in creating a bylaw that actually needs to be scratched out um because there is a state law that covers this issue um no one is allowed to use their ATVs and someone else's property with that permission prior permission okay just kind of wondering that because we already had ATVs eradicated from down once why would we need something special funny signage we we book five is least important but on the task force visit they were really big on all about signs yeah yeah and I just don't believe people even read signs right they they tear fire chief was really big yeah on the signs well you can put a sign up then they can take it back down that's the problem SS it's happened a few times so is the town I only see what I read in the paper I know you can't always believe it but are they not approving an idea to have a special Land Management Open Space committee to manage the conservation Properties or are they going to make the Conservation Commission take care of all that on top of the I don't know I don't know what you read I did just get an email from um Nicole Parker asking me to write up why we want the subcommittee well to manage the open space when is when is the open space plan doe again because it's got to be due again soon do this year so there you go one one of the bigger one of the big reasons but this time let's keep the open space committee to manage the stuff that we put in the plan which is what one of the things in the plan was to keep buil with space committee and from what I read in the paper they don't want the luck board dog Doug mogin in particular didn't like Chris's idea and came up with different reasons why he loved my idea he loved your idea he loved my idea he said so at the meeting so I guess what I read the paper was misconstrued well this is a different meeting where he said maybe he didn't like it out could have changed his mind but anyway that tell Nicole that you got to have an open space committee to have an open space plan to start with and need committee to manage the put that's what they've always done is manage is absolutely no good nobody follows through with it well that Lake L yeah State L need to manage that stuff me these meetings they're big old long enough we have legal stuff to cover that we be nice to have a subcommittee speci Land Management Personnel you're being proactive instead of reactive you're not going out putting out the fires after they already happened you have people out there on the ground noticing things and they take care of it they come back to the Conservation Commission with their ideas they don't Implement that they come back correct as an advisory committee like the Lake management committee I like retive why is it not why are they opposing well because you have to have a quorum at a meeting you have to take notes you have to have minutes but there's not even a budget for it they didn't have to pay for it there was no budget even SC yeah he tried to compare it to the agricultural commission which is totally different the same thing the other thing I wanted was a way to get people who are interested in being on conservation they could maybe go to take some of those courses that we do out at Ho Cross and things like that and become familiar with Wetland right you know before they say yeah I do want to do that you know like some people oh they don't know anything about it but they want to be on conservation right you know what I mean yeah I hear that right like we have people a little bit trained before they say yeah I want to be there you know so I thought that' be an Avenue for them you know somebody leaves somebody's there you know stepping into the slot well it seemed to work pretty well in when it existed yeah yeah and they did do a lot of the volunteering work was going to say for but basically that's what it is you know groups of them going out triming things and doing stuff under our and supervision it it's just more hands on the job yeah it's a little more fun than conservation because you get to do stuff and don't have to sit there Monday right they come up with ideas about what they want to do to improve things and then come up here and tell us and said go ahead and it's done you know seems like a no-brainer right service would be like a a regular I say regular sub commmittee but they would meet in one of our meeting rooms they would have a secretary they would keep minutes there's still all those open open space committee files right there there and they've been really helpful soine was there in open space committee 15 years yeah there's a lot of good information in there um so I feel like there should be a secretary and there should be meeting minutes and there should be you know J not smiling great open space secetary I ready to go just these people you know the guidelines are there what to do is there how to do is there everything is right there you know right it's been done before so if you want to get grants you're going to have to get the open space plan approv that's how that that's how it works that's why we got together in the first place so we couldn't get grants right um so do do you guys like this um draft proposed Land Management plan year anything oh yeah destabilize the soils that's we're going to place tree material on those areas help prevent further foot traffic regrow vegetation and those areas mon the plant growth and many species according to suggestions Button Bush Silky Dogwood sweet Gill cat Brier cat Brier I think is the way to go on some of those silver maple red maple but you know you definitely want to have something with some good root structure to hold the bank as well destruction of vegetation same that's kind of the same thing then ATV use we don't need to worry about cing beneficial debris along Shoreline detrimental to fish and wildlife put some signs up for that that's not that big of a deal um I think there I don't see that as that big of a problem that's why I don't see it as that big of a deal yeah I don't see that I'd like the concept to I think it'd be good to have it like be a document so it can be changed when it needs to be right A lot of times you across things that you don't anticipate can add or delete there's already somewhere basic rules right no open fires stay on the trails yeah it's all there yeah right yeah yeah so got to implement it that's the problem all looks good on paper but if nobody's there to implement it then yeah only work the paper written on the task force Le booking to do more signage to make it even more clear what's allowed and what's not allowed property right yeah that's absolutely good idea property all properties five open fires aren't allowed on any public property exactly so hazards D keep the signs there after people tear them down and right shoot them so in there you know shoot the people there yeah okay remember guy trying to rip it down I was like can I help you you trying to do that but yeah um I going to put them high and Out Of Reach you need to vote on this or anything I mean I would like that so I know you guys have aov Land Management thing got my vote of confidence take a motion on the Land Management plan for North Pond who move I'll second all in favor I I Andy I Norm Chris ey Jerry I Kevin I okay thanks everybody thank you the next page in the this um little booklet I guess we call it is my request to the state for temporar shut temporarily shutting down the Scenic Trail area um and yeah I just want you guys to read it and know where we're where we're at I haven't gotten a response yet um I mean as far as the trails go I don't think they here because we're maintaining yeah and we have permission to do that already maintenance is already allowed in the you have it outlined exactly as we talked about it you want sow fencing and everything how else could you do it that's don't never really have any options so I mean I think it's nice to put in there let them know what we're doing as far as asking permission I'm not really sure that we need to um but doesn't hurt yeah just in case yeah there's going to be signage too so they do ask for permission for signage I guess I don't know I just I want get in trouble trouble plan on doing if there's any problems let us know where was so that's that's out in in their land right now okay um there I did give you guys a copy of the walkth through that happened on the 3D of September with myself G Spanish St now spits The Spits um Diane G Norm came Randy Brown is there um so so if you want you can look through that it's just like FYI keep you guys in the loop and then I did want to give you a little update on the task force so the task force I believe we're dismantled n tce um we got a whole bunch of suggestions that are going to go to the select board um and they're going to do I guess what they want with the suggestions um but as like a recap of the main things that at least I got out of it was they want to reduce the parking spaces at the um parking lot to four one of those spaces being handicapped um configuration we kind of played with some ideas but um from eight to four yeah why is that what's the reason behind that just to limit the amount of people utilizing the property by flip I mean yeah I mean you can't limit them from not going on the property but you can close the parking yeah you think Eight's bases I would think eight is fine I think Eight's fine I can see one handicapped so you know maybe if it takes a little bit more to do to one maybe seven there you go yeah makes sense as a compromise compromise so and then they like I we had talked about um they wanted more signage throughout the property um they did mention putting buoys up along like I think they said 75 ft away from the shoreline to prevent boats from beaching on the shoreline that' be a good idea um they wanted to do bylaw was clarifying um what's allowed what's not allowed on both conservation properties and park and wreck properties so they're reviewing those um they didn't mention the plantings and the habitat Rehabilitation um in the Scenic Trail but Dian was also concerned with the old Kings Beach area having that possibly be a habitat Rehabilitation area um there was talk about fixing the fence in the areas where the ATVs um are coming in we're still having issues with with the ATVs um and they talked about doing parking parking bands I guess you call it along the South Long yard and um other roads where people have been parking yeah they posted that yeah um but more more permanent parking bins okay but they're playing with ideas as season um maybe on certain roads maybe not on other roads so these are all suggestions that um are going to be brought forward to select wood so is the idea with the 75 foot buoys no beach no beaching of boats anymore yeah that they they want to do away with that that on the conservation property okay well that's in the water though you're talking about yeah you can't do that I did mention I don't think it's legally temperatur water right but uh I think they're kind of like correlating it with like how buoys are out for designated swim areas tell them to look at what the rules and regulations are before they start deciding what to do right yeah I think that one would be good ide problem that's problematic that You' have to go through the state get getting the ATVs stopped from coming to that should be a priority number one you know that's destroying yeah the area I did mention that the commission is more concerned with what's going with what's going on over at the Scenic Trail area with the foot traffic there um rather than the boats beaching but I didn't mention that did anybody bring up having a porta body up at the Wellhead area or no I think that brought and we brought up the fact that we didn't want it would be a good idea yeah that was a bad choice but that's my opinion I did get an email today from Diane Gil is part of the north time pass Force we are proposing a comprehensive Parks beaches conservation and preservation area bylaw you're wondering if the park can you advise if hunting is permitted on any other town-owned or managed properties so I think that hunting is allowed on the Pinsky because that was also in conjunction with fishing game but I'm not sure about pskowski is it allowed made made us put it in there that only nuisance hunting would be allowed okay because somebody in her family got hurt in a hunting accident so that was specific just to that one property I'm not sure I think any I think Rick cross was the only one that ever was doing nuis nuisance hunting out there would be nuisance and something out coyotes I guess I don't know okay I mean it's that's dangerous I think it's permitted on every open SP property away fromell I mean it's just like any public land I believe you can hunt down well I mean the properties that we have we got the Granda Geor which I don't think that's it you'd have to be far enough from the street for the houses but not sure how much of it we own back there that to the gorge it's just up to the water I think I mean if it's restricted there it's already restricted I don't know I mean yeah if it's 500 feet is that what it is from I think it's eight but specific on any sign I mean it's definitely allowed for through the state determined that there will be hunting on North Pond on Linsky but I think all other down areas I think you you were able to hunt on um you don't even have don't even have to ask the property owner's permission unless it's posted right that was that a whole meeting they had yeah the whole meeting they had they got shot down never made it to tell and it basically boiled down to that if you property is not posted you go in and H yeah that's Statewide law I guess oh yeah that was that was an eye opener for a lot of private property owners who own land they did not know that they just figured that you know some a random Post-it sign every hundred yards or so no they were like do it intense put a lot of them up there have to be sign if there's a window you look 100 One Way 100 the other and there's no signage no post people go in and they can go in we tried posting our property for a while and the signs got knocked shot down that's what oh there you go right sh down but um yeah I mean it's it's the state but I mean the only place I suppose that it's not allowed already is sanowski just for that because that's what it went into um when we got the Grant and purchased the property through and that probably could be changed I don't know where that's written into the deed or was that like a condition that they there the slack for you but no hunting on was a condition of sale at the time but the put a sign on it hunting on this property yeah I think to have something that says where can you hunt in southw can have them right and our open like our open space plan yeah people being Hunters I you know it's nice to know where you can go yeah well some of the conflicts were also around retrieving wounded animals and such and things of that sort like right we hit a deer here and the deer dies over there and in somebody's front yard like it's like something out of chasing tail you know yeah I don't know if you guys know that show but do you know that no yes to by a different name huh no no no that was the ver Hunters that hunted in Connecticut on golf courses and such and what else we got Chris there's an update a little update on 13 brickshire they are working on the survey it's hard for them just because of the whole area is kind of ambiguous when you look back so they're they're working on it it's harder than I went to see if they put any markers up I haven't seen any markers I hope they Mark where it is we said we got to ask them to do that because if you don't they they'll survey it and not put any pins around right we had to do that with you please check house yeah all Sur they might have nice map but there are no pins in the ground like they charge it to come back and put $1500 more you can put pins in the ground yeah well I can put some flags up so of course was pinned make sure was was pinned yeah do we have any updates for the proposed amendments that Diane Gil is going to be working only that the state sent a letter saying that they're still working on them okay yeah I got that least you got a letter from them anyway that was I assume that was both the select board's request and our request MH okay presentation Alp follow on contracts hopefully we're going to give that soon okay S field concom went to the last Mee was nothing concerning the light okay Noble speed we had the noble speed we had the update from Jeff y possible Wetland violation 31 Sam West Road go out there and check because I haven't had time check what uh is 31 Sam West Road it was a uh Wetland it's right off of the rail trail get there from the rail trail yeah you get there from the ra and you can pretty brickers and smooshy what are we looking for so there was Phil in the Wetland um and they were supposed to have restored it in June and I haven't gotten anything from the land owner oh yeah NE has vi from other de anybody want to meet earlier at San West then go to nichelson be easier if we just could get the riot or somebody to say an hour me I can meet somebody I just don't believe it's tough to get done supposed to go out alone that's one of our rules yeah got to be two people a tough area to get to so if somebody wants to meet me at Sam W that for then we could tell you if you're going to be there at 4:30 or let you know why email do Alexa still own that property yeah that's the back of the that was the one where mulch yeah that's the back of yeah because he was the guy cleaning it up wasn't he let see if I can talk to the luck see what he knows okay yeah that was jumping on making his own Crossing and stuff right is that so I thought this wasn't just like a friendly enforcement it was a friendly enforcement yeah he Wasing to do it on his own I think it was right in this area just right off of the trail something about like they were clearing for a solar farm or something in there something that fell through there was Jesse solar F I'm laughing because I you know probably got a lot of mulch know where to put it how how do we get there so we parked our cars right here on San West Road we get yelled at by one of the neighbors to move our car it wasn't parking but we are official Town people so you got to walk walk the bike trail in yeah just walk the bike trail in and it'll be on your right what are you gonna be looking for to see if that Wetland was restored or not because it was like full of sediment before was there water in there that you could see if they've got cloudy or just a wetland yeah the was it looked like a Vernal pool okay wasn't a lot salamander shoot that time Dennis was that you did tiger salamander shoot out there one time or that that was was that it further up the road no that was over by that was my kids were like two and four then so a while ago TJ's property yeah and somebody got upset because you parked at the mouth of the yeah like is that it's not parking for the rail trail like we're not parking for the rail trail we're parking because we're with the Conservation Commission we need to have as I visit yeah all right okay anybody have anything else they want to bring up well I do okay tonight is Jean's last conservation meeting is that true oh no what she's say retiring for now she'll come back right Sabrina needs a lot of help I can't give it to her and me just attending meetings and you know trying to get here for a half hour and you know throw something together and you know try to do some of it at home it's I can't help her I don't and it's just the bus garage is just qu that bus garage thing I don't want that let me see this is this okay I'd like to retire someday and gonna do it Joel do that for take care that Joel actually officially retired Friday wow so you know I can't help you guys I can't help Sabrina so you're going to need somebody that can dedicate some more time and it's you know as much as I would love to keep it because of all the years that I put into it yeah can you help with a transition for the new person say you know where everything is 30th yeah so I haven't talked to anybody yet in time you know we we'll mud through something MH but I'm going to the cape Satur be nice weather I don't care but you know working working 11 12 hours a day at the bus garage is just it's that you are yeah Straight Out Sabrina needs help and agreed okay okay will we appreciate all that you've done abut for so many years definitely it's only been seven well seems like seems like a lot longer but we definitely appreciate what you've done for us no problem thank you 840 who wants to make a motion I'll make a motion normalin hi hi hi hi hi very good
