chair which be me uh so notify and we have a guest Judy's new iPhone can you please identify yourself on on mute and identify J J's new iPhone can you can you unmute and uh just just let us know who you are okay good you may she may have stepped away for a moment yeah and we have a guest here physically yes oh can you hear me yes we can hear you my name is Judy Harris I live on I live in Forest Road in Westfield okay all right thanks yep okay and all right so let's take attendance Norm Cher here uh Mike kums is not here tonight Malcolm debay is not here Mike debay here dick Gran's here Scotty Graves here Deb harth here Eric Muller here Paul Murphy is not here today so we got this and that's it so we're ready to go do we have a quorum we have a quorum and has everybody had a chance to read the minutes I have and I sent out the updated one which is just number 11 was updated so if everybody's read them do we have any comments changes make a motion we accept them as written unless somebody's got comments I'll second it all in favor oppos abstain unanimous I got Norm Cher hi um Mike debay hi Dick Gran's ey Scotty Graves hi Deb Harris hi Eric Muller hi affirm okay public comments anybody uh Judy do you do you wish to make public comment you're on mute okay okay hearing none seeing none let's move on you don't have any comments so we're just entertaining oh we just lost Judy wrong you're right concom update Norm yes uh several things since we haven't had a meeting in a while um we doc VI vent of violations that I brought up last time and we devoted on how gave them a recommendation gave conation a recommendation uh they settled on two of the three AB b c and d courts the recommendation is that they reactivate their their uh Association then they'll be okay for next year they can decide who who has docks and Vats they can submit the forms yeah okay Sunset Drive which was the private private property issue same solution the Sunset Drive was there three men there and they nor can you speak a little louder I'm sorry so I could hear you a little better okay Sunset Drive they're going to form a an association for there's six or seven homes on the other side of the street on the far side yeah far side and uh that will solve that problem great nice oh that's terrific the remaining open issue is the one at the chestnut entrance of the brook which was private private property but he didn't have have doesn't have U rights to the lake to Waterfront to Waterfront uh we we sent him a letter and asked for a copy of his deed and they're sending that they've sent that in but I haven't analyzed it yet we'll be discussing that Monday night okay okay so that's that one no I mean that that's that's a lot of what I thought were going to be extremely thorny issues was and breath right well depending on how the lppp agreement with seld comes out which I'm gonna give you some highlights of that right now and if you could either uh share share so how do I do this last time you B me a co-host right so how do I do that here share uh no I want to make him a co-host hang on okay uh make a co-host yeah there he is y yes there we go going you're a cohost you deemed so refresh that one more time just so I understand the ABC D what did we come up with the solution is they're going to reactivate the association that used to be there a couple decades ago and they became dunion and um the recommendation was that they do that I sent Jerry crane a email but I didn't get a response on on his reaction would it be one Association for ABCD or one each it could be either either way okay but I believe that they were one Association way back yeah I believe they were yeah only because my wife grew up there too yeah is there any other examples that we have other issues other than this next one which you're talk going to talk about on the for the canal thing over on middle Pond do we have any left over handing hanging out there that are ones where the town recognizes them but because they're not owners of the property lpp doesn't recognize them I don't believe there are any others okay I think okay okay beat them down Norm yes you may want to send Jerry resend that to him he's been having trouble with his computer okay thank you yeah now we can see it nor you want to go to um U Jackson mode or presentation mode yeah okay uh we still have not finalized the contract the lpp contract was suff okay we're GNA make one more presentation and I'm G to cut through some of that for you right now there are two Still Still issues one is the they wanted a independent audit of the L m c inventory for 2024 go right ahead okay and the second one is they feel they don't have any lpp representation on the Conservation Commission okay so those are the two issues on their on their side on their side on their side but we don't have it on their on the subfield side right did you yes well no he he's he's a leon he's not a member well they want on they can have a leaon right you want a leon on their side you're saying he's liaison right for Connecticut right right huh but they want a full he's liaison for conom for Connecticut they want to have a liaison from Southfield on no they don't want leaon they want vo they want I'm aware of the fact that you're the liaison from South Lake to Southfield we don't want we don't have one yet to come this way I got you okay but they want one that's voting right which I'm not even sure you're allowed to do well and because conservation is a is a state right um it's not um right it's not like we're we're appointed by the town you know we're created by the by the select board yeah that is a a position mandated things is a different animal different animal right yeah and I can tell you select board our select board will not allow that to happen I'm not even sure they could they're not sure of that either yeah obviously he can't be both no he can't represent Suffield and represent sou no they want somebody that lives in Suffield that's on their concom to be they want to have a full member of oh of concom already of Southwick concom yeah they want vo M they want to put a person from the Suffield concom right onto the Southwick concom as a full voting member in Southwick he's our he's a liaison from concom Southwick to kcom sopia but not voting he can't vote that right gotta uh so we're GNA look at uh the first one is proofing the inventory okay here's the summary of uh the two 2023 LMC inventory which we use to develop with the shortfall was in finances last year yeah and then we have the LMC inventory for this year and then we have the photo shoot information that what I'm saying is would trust it's going to verify the 2024 LMC inventory and you can see uh overall the the photo shoot and LMC inventory only varied by one oh really okay it fluctuated a little depending upon different categories like docs was was uh we had four more on the LMC inventory that we did on the photo shoot uh but in total as you go across it was only a difference of one right it's right it's not a hell beam yeah yeah not a hell beam now I I I I have a little bit of an issue with the difference between the LMC 220 2023 and 2024 inventory I'm with you you look at those numbers they're they're significantly different uh swim platforms went from 23 to 32 and and and I have a feeling some of that is a misunderstanding of what's supposed to count I think I believe that's what how they were cized went from lifts went from 29 to 46 didn't happen now now some of that could be remember we got the new kind of lift for pwc's we probably didn't count last year right we didn't we didn't talk about that out of time right right but now we're counted them this time so I'm hoping that's the the big difference and again it doesn't you know it's it's noise um right it's not if we're off by one or two here and there it's noise well and and with regard to the discussion with Connecticut it it's not relevant because it doesn't affect the cost right that's correct because we there there's no charge for lifts we just count them right it's vessels you know it's you know it's all all the stuff all the stuff that we charge for is the stuff where where you got to make sure it's right well we were just trying to negotiate a higher input from come offered on I believe right okay so basically I'm saying that uh you know the the brine matches the LMC yeah uh so but but here here's the analysis that you didn't see the final number oh yeah okay there were 437 items that were supposed to be stickered on the Connecticut Shoreline only 189 were so that's 43% accuracy 43% compliance compliance compliance okay compliance oh okay okay then if you look at it from the home stand Homestead standpoint there were 124 homes that required at least one sticker I think you want to change that accuracy that compliance yeah okay y keep mind you're looking at something I'm not looking at it's on the board there if you want Oh ex me okay I turn to this one there but it's not focused on I left my driving glasses down in the truck so the number of Home required stickers was 12 24 number of homes that had at least one sticker was 63 half so half of the homes at least had one sticker so yeah basically says 49% of the homeowners ignored the program and changed the word they did have snub the program before that [Laughter] change or just say didn't comply yeah noncompliance that's Connecticut you're talking yes just any different percentages I will bring I will bring I didn't have that we have a whole new change in our accounting system here for POS and everything and I I've been buried all week dealing with that but I will update the to the numbers that you everybody supplied you know the corrections yeah and then we'll talk about that at the next meeting I don't want to get buried in that right now and if Suffield wants to go out and count go right always people count okay so what I'm saying is the photo shoot matches the LMC inventory yeah in Connecticut yeah in Connecticut yeah I'm GNA hand them the spreadsheet that shows every dot by household okay they're going to hand them a stick with 153 photos and saying you've got all the data I'm saying we've met the proofing right requirement if you want an independent you go do it y we're not going to lift another finger on this right no right nor do you have that that same thing with the with the southw side now the percentages no because he didn't take photos of everything I didn't I only took photos this year of Connecticut with Connecticut two years ago we did Massachusetts okay it was a lot higher than it's high obviously it's higher in the low the compliance yeah the compliance we know it's no question I see a lot of them that don't have them on and I know people some of the people I know they have them yeah in top dra they're on their table or something there so now we're going to here's a sample of one of the photos this happens to be the the jewelry property first property in in Connecticut and you can see down the bottom that's what the Excel spreadsheet looks like for that home I think that property is up for sale it was sold under agreement so ticked off the relationship with the neighbors yeah that she said she was going to sell did yeah she did so it's under agreement Lee corber told me that the other day yeah it hasn't cleared but it's under agreement all right so now we're gonna look at representation uh on for lpp and I'm going to say let's take a look at the lake management committee has a bunch of responsibilities but they are the eyes and the ears on the lake for lpp issues and wetlands violations okay and then take a look at the makeup of the LMC uh membership and you'll see that there are five members that live in Connecticut four of them live in Westfield and one of them is our vice chair so by default who lives in in who has Waterfront has water Mass also right all the Connecticut people have Waterfront po y right right right so by default because they are the number LMC is the eyes and ears for lpp they have representation yeah right okay absolutely right almost half of the committee yes that's yeah done by Design right you know legally I'm a Florida resident and then the next slide I just talk about U Jus as Suffield believes they they have not had LP representation for years so has southw Conservation Commission felt that enforcement of the 100 foot puffer zone is tougher in massachus Connecticut the Dual conservation Le leaon is a solution okay coule words of wisom okay and the last slide is what happens next if we do not come to an agreement and either we go to the chapter 91 process yeah or we reverse back to each Connecticut home own to paying their fair share and this would include fines for nonpayment and the southw select board will make that decision yeah okay now really is it really getting to this point that sounds very aggressive I believe there's a high probability we're not going to come to an agreement that you what we will not come to an agre you will not yeah why because there's some stubborn fool on their leftfield select board that is adding it about what in particular conservation voting member oh oh so in other words it's this or nothing right wow and we're gonna say Le aison or nothing basically and the answer is if if you don't want to have an agreement there the alternative is you V chapter 91 chter 91 or take it out or do the lp through us or get it out of the water nor can can we investigate and make sure that it's not legal to have one there that way we have no choice not legal to have a voting member on our yeah you can check you know what you can check with on that um is uh I either Jason Baron or Diane Gail I'm not sure who's I think Jason is our aison right now for uh LMC to the select board um and but Diane's been helping too so you could ask one or the other yeah to find out they can well they can go to our Our Town Council and have them come back and say no you can't do that you know you you it's it's a state formed uh commission mandated mandated not a the town doesn't go well you don't even play they can Define what the state rules are I don't know if they've made that connection or not I don't but I but Nicole can also take care of that she can make because it has to go through her anyway so what I would like to know from you tonight because this happens next week and it goes to the next select board meeting it'll happen before we get to meet again is of these two options which is our recommendation well those two options are the same option because lpp the second L the way it is the lpp with lpp you can still do chapter 91 if you want to well that's true so that so this is basically we're saying it's lpp difference is yeah of softare we'll say you're not in the lp program you go get all of you go get you have to do chapter 91 I see okay yeah that okay I think we want to continue the lppp route personally uh it's it's less painful for everybody it brings it generates the income all stays and used for the Lakes it's not used for like if if they go a chapter 91 license the town does not get a nickel we get zero one of the things and the state doesn't contribute anything anyway to the one of the things you know when you're talking to people I think I I could imagine that some folks in in subfield may be thinking well look the DP hasn't really enforce this stuff anyway so find threaten us with chapter 91 you don't kep the chapter 91 licenses and it matter but they may want to know that the environmental police have committed to starting to to patrol the Lakes we do have the and we see evidence the sheriff's boote has been around quite a bit this year on controls and and if if residents are required to do chapter 91 and they don't it's getting into it with the state of Massachusetts would get pretty ugly and I think in in in Otis I still I Think They confiscated dots I Otis they made up we we're actually the next in line in size because what they did is they went from the biggest working their way down in great ponds and we were next in line and that's why we really worked and worked and worked to get the local permitting as an option to chapter 91 license and it's easier for they don't D Mass D doesn't want to get swamped with chapter 91 licenses you know um so do you think it's still the belief then of some of the people on the seld side that basically poo poo you can't do anything to us anyways yeah that's yes yeah yeah fine us do whatever but we're not paying but once once the thing's in the water you know it's in Mass Water who's gonna take it out who's gonna come and take it out in front of somebody's property I doubt seriously that would happen no I mean but they threatens the state's done it the state the state's done it in Otis yeah that's Otis that's all in Mass you know now you're GNA have a feud with Connecticut but I I I think the best thing I agree with what Eric says the best thing is to keep it in the keep working on getting the ltp I think we have to understand what the restrictions are for conservation and that you can find out from like I say from Nicole or Dian Gale or or Jason are we under the understanding now that our Police Department here now is actually going to start enforcing that's the subject coming up okay hold your question that's hold your question yeah does anybody feel that the chapter 91 is the right solution so like no no no the lp all L is the right solution so that would be our recommendation to the select board say you want to vote on it you want to vote on it you want to V be in the minutes okay all right absolutely there's no question there best way to go it's it's better for everyone absolutely yeah chapter 91 is a horrible solution yeah okay the lpp contract with the state we haven't heard back yet on right I saw that saw that email oh oh the rental thing got submitted I thought that was about the um both got submitted oh they both got we haven't heard from either one right right they're still chewing on it got it they're legal they're it the last email so that they're their council is looking at it yeah yeah so that's the update from concom all right sorry took so long no it's good okay master plan any update there or yes there is a an update on master plan we now have a membership of a committee oh that was decided this past Monday night we have Jason Peron still to be announced a member from the from the planning board Jessica Taylor a Pam scan and Nan sheber are the members of the board okay and and you'll do like you usually do give us a a quick write up on what you want to all right okay all right next is CRC update um we had a good meeting the other night um and we had Lee Hamburg speaking on the canal the history of the canal and he had a big map of the original Canal it was very good people were very interested uh we've got golf this weekend which is a fundraiser for CRC and we have a lot of forom already it's GNA be very successful and there are a lot of prizes raffle PRS and then uh Michelle did bring up that we need people to help the beaver DS because some of our members are getting older but I don't know who nobody I know yeah so um not only are they gonna go back and look at people who are volunteered to help with CRC stuff on the membership form but also um asked folks to out broadc yeah yeah cool and should may put it on social media and then the boys um we still have our VP it's gonna get some guys together okay yeah because yeah uh Rick's not got the rate and Rick isn't gonna be able to do it right because right yeah that's good okay and then next meeting is the last meeting and I and I think the buoy that that we added um you know out of the into the new Marina do from what I've seen that's been pretty effective at getting people to move out yeah and I think again we can talk about that when we get down um enforcement is really the issue and and I have seen the the uh Sheriff's boat seen our boat out um I've not yet seen an environmental vot out yet but I know they are really really short on on officers they have so many to retire so what's with this getting old stuff yeah I mean you just can't do that okay yeah so I'm not having my I resemble that um okay so the next thing that's CRC then 129 North Lake a this this has been going on and on and on and on and while we were out um what it I I took a tour with Nicole Parker who's our new CEO and she wanted to see kont so we took a about hour and a half maybe more maybe it was two hours and went all three ponds the perimeter slowly and she asked a lot of questions and made a lot of observations and one of the obervation she made was about the lack of numbers because I described she asked what are the numbers for and the end of dogs I said well they're supposed to be on every dog and they're supposed to be I think they're four inches high minimum and I said you'll notice you know she said there a lot right there a lot of them don't have numbers on them and I said that's an address on the lake so if there's a an Emergency you know where you are because it's the it's Ma the digits that represent your house number and then three three letters represent the code of your uh Street and they're obvious they're not you know we didn't use Street x y and z um and so you know if something happens out there you can say you know I'm at whatever and the other thing is is it's required by the lpp and so that and along with the Miss stickers not on boats stickers not on on docks and she's pretty observant as to what were the differences that what am I looking at what are the differences and so we will talk uh because it came up at our last meeting and so I'll just defer that part of enforcement so we get to that item but that's she's a stickler she wants to see you know if we got a law then we should enforce it pleas you know dick one of the problems with these aluminum docks you only have that much yeah I put what I did on mine I put a I put a panel on that's what I did I put a panel on mine so what do I do with my my uh ladder that's right in the middle of that to get up onto the do on the one side yeah just a little tight a little tight you know I I had to attach a pel to mine that's what I did with mine that's what I did with mine I had to do the same thing because I have a wooden dock and if before the end of the year I end up replacing they they fall off oh yeah yeah they won't stick Top Channel very I spray painted yeah on a a piece of white plastic it's a pain but yep you're right so anyway um we couple things here before I forget we did not get the money uh from the state you know for our grant obviously they also tried to go a an ear Mark group did not get anything there Diane Gail said said there's a a grant she sent me the link to it that's uh Tractor Supply the only problem is is Tractor Supplies total pot is 300K all their grants and they're looking for you know 5K here 5K here 1K there you know not enough to do anything with so she agrees that it's not worth pursuing uh so then one of the other things that came up in in enforcement is on page 24 and 25 because this was subject of CRC um there were two pwc's in North Pond on uh Sunday August 11th at 2:59 p.m. and they were I guess from what it was described they were really acting crazy you know they were buzzing people and canoe people in canoes and kayaks and whatnot and so they got a verbal warning for reckless operation but says nothing about throwing them out of North Pond yeah I mean and that was the whole point you know they the ones that are there have got to understand what the laws are and enforce them what about our new sign I I'll get to that what I got I found I had to find something that would look like a PWC that's nice I actually found a sign that will we will clone half of the sign and then put the extra words the enforcement codes and whatnot on the bottom Circle in the slaps through yeah yeah and it's and it's no pwc's but it will say North Pond you know so we'll editorialize it's on Amazon I found it on Amazon and and it's got an image of it's got an image of a PWC and it's and you know so you know what it is and then you add the the words want to go with the yellow black white as we've done with several of the signs because it stands out better than and I would definitely suggest doing the circle with the slash through oh yeah oh yeah because otherwise be like that's what it is can go here it is that's what it is on the uh Amazon sign yeah so Amazon's good for a lot of stuff so yeah the verbs that are the verbage that's on here um we'd make that sign a little bigger and and it would have in the middle of it you know image yeah the image so we will do those we'll have them made uh over the winter and get them maybe it'll still get them in this fall possible because they're still out there oh yeah and they're still racing up and down the pond oh yeah so and and there's really no excuse for not understanding what a p SE is because that's what your license says when you get a not license but when you get a registration for it it's registered as a PWC it's not registered as a jet ski right but how many people how many kids look at their father's registration you know because I doubt if a kid stay in 30 grand yeah so anyway uh so back to 129 North North Lake AB so that was another one that was very obvious because that had three green stick three 2024 stickers on the three permanent docks and this has been an issue since you have all the data going back 10 years or better oh yeah yeah and they were put in illegally they never had a chapter 91 license to install them oh I know the ones yeah and and they are are not even and you can see them M if you look on your page uh yeah we we we've been talking about these dos literally for years so this is going to be part of this Enforcement issue but I want to go back to the question I was going to pose to you Norm was can you get a copy of what they the application for 129 and probably the other one is whatever the lower next lower number and I'm not sure how they registered them because there's three of them there and they all along to desart and they all have green stickers so I want to know how they got green stickers since what did they present since they're non-compliant docks right y I got a funky feeling that it's you're not going to find much so and that second one is f the north that's right well the the even the the main one that's mostly in front of their house is not totally in front of their house the biggest one yeah then the second one to the south of it is not at all in front of their house their property it's not on their property and and neither is the third one so two out of three and actually it's 2.2 out of three are not in front of their house wasn't there an email in the reading package though from who is it Jean is their secretary who does the who does the do Jean does the she say I I handed them out based on what they say but we got to find out what yeah read that because they have to sign they have to sign what they s and if they basically well obviously most of them wrong are inaccurate yeah that's why I'd like a copy of it I like to read that right or them there may be more than one because there's three docks so somehow they have to account for all three three stickers um so that takes us to 129 North Lake ABS is Page 41 then we start on uh again on the KGAN tour you know permanent docks and and uh and docks without stickers and so on so that just got us into how do we get to uh oh wait minute I just want to back up 129 North Lake a I don't think we need it because we've talked about it but can you bring that up to on U concom or do you want us to vote on it to have it brought up to conservation why are they getting stickers because they were denied actually the denial is in here is in the pages they were denied a chapter 91 license byp yeahp shows it as withdrawn right right but they they actually sent them a letter if you read the all the communications that went back and forth they would sent a letter that you know what they what they provided because you you you have to sign on the 91 that those are in front of your property and so that's that's not legal what they did you're signing something that's not true yeah I can bring it up but it won't be for the Monday's meeting okay yeah it's already already B yeah will bring that up at at the next we don't I don't think we have to vote on it the person you were giving a tour what is her position now she's the chief administrative officer she replaced Carl steinard oh okay okay she's from Hardwick uh she was ceao in Hardwick for I think three and a half years and prior to that she was assistant ceao for Palmer so she's got some Stripes it's also nice to see her interest in the link yeah yeah she was very like I said she's spent a lot of time you know touring and asking a lot of good questions yeah good so page 3 37 is the page where there's an email between Dennis Clark and and Gan responded saying she gave the stickes out this year based on the information she was providing yeah right right I read that yeah and that's what I that's why I want to read the information that they're providing because it may be not correct um so that kind of took care of all of that uh then we go [Music] to P page here 159 Berkshire real quickly uh I had a quick update on that from uh John Gard is the one on the planning board that's writing her on that he's also our storm orderer Guru and they have unfortunately until December of next year to implement what they signed up to do so what he's going to do he's sending an uh the engineer that designed it he's looking for a schedule as to when they are going to do the work because it's got to be done in the growing season and we don't want to wait till the snow's going to fly otherwise it'll be next year uh and so he's going to pin them down to a schedule so the next our next meeting I should have a schedule um bridging estimate covered that for you um line of sight at North Culver I want to put this let's see so open and get it into the open p yeah okay good all right I want to go to Pages where am I where am I looking you really think the do is move oh they have been absolutely have been in the second file they're in this they in the second file and it's Pages um 54 52 three and four that's why I want to put them up on the screen so you can see them it's really obvious because what I did utility poles don't move and I took measurements from across the street the only Mo moves when somebody hits them yeah sometimes they don't moveed so but must be anchored at the end of the thing yeah and the end has not moved the end has stayed I'll do it from here so I can explain uh when which one of you got want um the first one which is was page uh 52 52 yeah keep going right there okay so that's I labeled the year I don't know if you can rotate that or not that's 2023 that's current so what I did is I put pins on the map on the Google Earth map they don't move so this is where where the point of attachment that's what I said sh attachment is right there right in 2023 the angle is right there where that pin goes underneath that spot the outboard Eastern end is there the out outb end of the Eastern boats is right there that's the worst offender and the outboard end out there now what's interesting is the guy out here on the the far end that never moved mhm that distance is 300 ft to this utility pole see that pin way up in the quarter that's 300 feet it has changed but what changed was now you got 184t to the utility pole from the point of anchor 178 so now let's go to the next one so you got 192 and 184 so it shifted to the east the whole thing shifted to the east if you go one more we went back to I went back to 2015 shifted further away or closer closer to the opening of the Culver a lot and that's why you can't see going through I mean it's it was bad before it's terrible now it's actually worse than it's ever been so and then which is the opposite of our expectation because the beaver dam was removed allowing them to move the dot further away you're saying they move closer move he translated this end he moved this that way he moved this that way because look at the pins here I see it see where the the pins are that says where where it is today so the tip of each pin is where it is in anybody spoken to him is anybody spoken well we can't now we can we had to prove it and so now there'll be a 2024 Google Earth map shortly they usually are like September and they they get loaded uh towards the end of the year he should have no problem doing that well right he's gotta he's got to pull it back and and go yeah yeah and and you can say hey look you know we you know we we helped you so that you can get rid those the beaver the beaver huts and move it further away from that CT closer to the CT that was the original plan right that he said he would do right and and he can't even move it either direction without uh revising 91 yeah yeah yeah you see the dock is not straight it's like a bow right right right actually should be to our benefit If he if he one of the things I suggested yeah I'm glad you just talked about that one of the things that when we were talking was if he kept the same point of attachment which is uh where's that then anyway right there if he kept that same point of attachment where it was in 2015 right four to 192 192 yeah so if he kept the point of attachment here right there no and and he straightened this sucker out and went turn this turn that and make this a straight run he could keep the 300 feet out there keep it at keep the tip of it exactly where it is today but he wants to be able to get he wants to be able to get boats into that side right which he could do right well except for if he gets too far this way he won't be able to do that again right right no dra but there's room there there's room well what you said there's no draft there yeah when you keep moving it back right you eventually will run out of yeah and when he and what he was going to do was apply to get that to remove that go out because he was not allowed because he didn't you'd have to go through it's a long process it's a dredging process but you have to permit before you start removing materials so he was only allowed to take the the beaver a lodge and grab it like this pick it up and take it out he couldn't go down and and dig down and remove you know 20 years of of beaver droppings so if we if if we're going to go to D eventually on this yeah we also should go for his other violations which are he doesn't have his chapter 91 license number posted oh supposed to yeah and he's got membership only signs at the at the point Grove entry that's right because it's gated yeah and well the street he got one and then the gate that goes in it says members only oh yeah anybody can walk on that dock that's right anybody that's absolutely chapter 91 license it's in the license yes okay yeah yeah you can't restrict once you get chat that's another thing you could point out to seld by the way once you go chapter 91 license you know yeah they anywhere yeah but then if somebody from the public goes on there and gets hurt he's he's liable I NOA I don't know I don't know the answer to that we're not the judge and jury no I'm sure he's got signs up I would so now do we want do we have to do anything here with a vote about getting this fixed or do we are you going to bring it up to conservation conservation doesn't want to get involved with chapter 91 issues that have nothing to do with W so then I think we should vote we should V vot directly the D yeah um so what do we want a motion that we well I think what we have to do first is contact him find out he's either got to put it back to where it was next spring obviously it's too late to do anything now but he's going to take them out in another probably three weeks yeah when does he take them up we haven't gotten noticed yet I think I think you're gonna yeah right but they well in the past when it was tried peanut butter and jelly there it was they would take them out in like mid October yeah B basically you know usually around Columbus Day yeah I'd like to think there wouldn't be an issue for to do that right should not be so I think it should I think that should come from conservation because you can enforce um it's a violation of of the chapter 91 license in the water so you can send a letter from conservation that says you are in violation I think what Norm's saying is that conservation doesn't want to get involved in chap issues involves issues does it it's not a matter whether you can or not they don't want they don't want it I yeah all right so let's do a vote I would say let's talk about it but how about we have a vote that we send a letter to D well we send a letter to him yeah what yeah why don't we contact you know before we before we go to the state let's contact them say Hey you know this is what we noticed right mo one will be contact two if if no action then we follow by letter contact with Y no all right and I will contact him uh and and then if uh one doesn't work all right so let's have a motion to do that F I'll make that motion can you break into two parts because I'm gonna stay from the second what the letter to the Deb why because we have a Bo oh oh so it's conflict of interest oh I see I see all right so let's do it as two things all right so let's do it as two so one will be so this will be for one and I'll do for two all right so motion from Eric second I'll second Mike that's the first motion or the second motion first we're gonna talk to yeah yeah and then so first one is contact owner second it we'll talk about uh all in favor oppos abstain unanimous all right put my bingo chart Norm hi uh Mike de Bay hi Dick Gran's I Scotty hi Deb hi Eric hi unanimous affirmed all right so number two is is letter to De if one doesn't work if one not successful I'll put it that way okay and in that letter we're going to do all reissues yes we might as well yeah and when I talk to him I'll talk to him about um right the other two post license number member post license and he's got to take down the memb take down numbers only wait a little bit little more all right so for number two is a letter to D if we're not successful with number one and I need a motion from somebody no I'm G make that motion and a second I'll second Mike Mike D want to un and all in favor opposed abstain all right soain dead okay all right so now let's go Norm hi Mike debay hi Dick Ran's I Scotty hi uh Deb is obain you just have to say that uh Eric hi all right everything's affirmed that's a majority okay that takes care of that one um South Pond Turtle Cole that appears to be being fixed from what I kind of understand now yes that that problem went away it he has ceased from cutting any weeds he was manually cutting weeds I went over there and visited him the owner he's also the concrete guy that was put in the foundation of Ren new house okay his house okay and uh he thought he could cut weeds he may be able to cut weeds but he's going to he's going to do an RDA yeah yeah and that's in process he was sent an official deceased and desist until the RDA is approved okay all right so I got ceas not deas de yeah decease and toist um okay so I think that's I don't think there's any other action that we need on that sounds like it's moving along right yeah does anybody have anything else any other miscell yes okay um also at Monday select board meeting both the members for LMC and Canal committee will approved for uh extension on their next term okay okay and then at the last meeting I was selected to be the representative of LMC on the task force for North Pond oh so they decided to do that no they didn't oh select board decided not to go with LMC a representative from LMC or or other than Sabrina and to Compass so they did ask if Dian Gail asked if if I had anything for from LMC to submit to the task force let her know well what's funny is is I got a uh I wound up sub giving her information because she was it was in the newspaper I read it in the newspaper where they said they suggested that we up the Andy at the boat ramps so they could generate more money to put into the northpond conservation area so then I explained the whole thing to um that the state owns that property they control what can be charged every nickel that is charged there has to stay in those ramps it can't go outside the ramps at all zero and so and I said and getting it getting the amount raised took an act of Congress to go to eight and help to show all our records for the past years which good thing we you know we keep uh in addition to what a county has I have uh I have kept running tallies annual showing what we spended on every time we cut a purchase order you know it goes for PTI poodies it goes for power it goes for phones it goes for and everything is enumerated and we know exactly what we spend every year on everything and so I submitted all that that's how we got to go to and and what we SP for ramp attendants and and Mowing and like that so that justified going to eight so you can't just go well we want 12 we want 15 we want 20 you know uh and we are already up at the high end of what they charge in the Commonwealth now then Nicole says she says we keep they keep one up on the uh on the connected River I think at uh the marina there box Oxo yeah the Oxo Marina and she says oh and they and no or they they launch up there and the launch fee is 40 bucks a day to launch that right but that would be out of the that would be out of the commercial Oxo Marine great great right because they just just below the Oxo there is a public launch which doesn't charge anything right they don't Char anything no I've launched there before yeah so and that's if you can find a place to park yeah it's a very very limited par very small limited parking yeah but dumps you out in a very convenient spot where you can either go into the ox Boo or to the river and I and I would run out of fingers for the number of calls I get in a in a month from other municipalities in the Commonwealth about you know they've got a ramp uh because they've expanded the um off fishing boting access now has 300 something facilities in the Commonwealth and a lot of them are not managed uh they're just like ours used to be and the and the municipalities are going crazy because it's a it's a zoo so they want to know what do we do so I've been helping fig how to do that be done anything else anybody yeah oh yeah please so we had a with lee corber yeah who's in in charge now of the DPW for sville so um I meet him at the Phelps parking lot you know the bicycle parking lot there and when I first introduced my I'd met him once before so I introduce myself and he says yeah I asked everybody they said you're brand new on the committee I think what they were thinking was you is the liaison Guy new to subfield that's what I think was happening with with nor I said no I can assure you I've been around for a little while oh yeah anyway so originally when I so I so I he gets into my truck I drive around the corner I park you know off to the side there where you can get right at Mountain Brook bridge and he only wanted to go down to the Connecticut part I dragged him all the way down to we Gates I said no no no we're going for a walk go we're going for a what I says it's not that much further past that area so I get them all the way down to the wear gate so I could explore expl the whole system how it works and about two-third of the way back we meet up with Mike and Malcolm coming the other way so all three of us are on him his big question that he had initially though that he wanted me to ask deck and he wants me to get back to him about it tomorrow he says is there any reason why Southwick never came across into the Connecticut area to take out these beaver dams because they're in Connecticut is that is that pretty much so the way he asked he was asking that question he was perfectly fine with us doing it only way realize the reason you want to get rid of it for the same reason dick doesn't want to pick it up it's in Connecticut right our money now he would say you have our permission yeah from Connecticut more than welcome to let them come got the same equipment that we have well they have a brand new piece of equipment yeah new piece but it's on Wheels okay it's on Wheels this big new excavator they have that reaches out they need to try it out yeah learn how to use it in any event he sound reasonably receptive yeah he said he he got it on the list a list of work to do that he's overloaded like standard oh yeah and I've talked to him numerous times I I do you know uh niy with oh yeah nice guy and uh uh he said I'm down to what' he say seven or eight from 20 yeah two or 24 guys on his Department yeah because subel has cut the budgets time oh yeah that's for surex but and the one big thing that he's doing differently for what it's worth because his background was also in Paving and this and that he says I'll only take this job if we start Paving the roads in town instead of going out with the state and the feds and all this kind of stuff so he knows he can do it for a lot less money just like you'd mentioned right so that's of the things he is a plus I guess yeah he's training the people how to do this I guess so in any event but uh so so we gave him a good tour everything showed him the whole nine yards this and that and uh we told him the problem with the Rocks down at the Mountain Brook bridge and this and that and he could see where we had taken out two of them but not only do we still have two beaver dams to come out who now there's a big one two foot drop one further North one foot drop and now we have a new tree that not the Beavers just Mother Nature oh went over dropped across and that really it's a big tree that tree needs to somehow come out of there as well so and it's in Connecticut too yeah it's in Connecticut in yeah in Connecticut too so so well you know I'll get back to him and tell him that you know so uh I just want to mention one other thing you know we we've had a lot of issues it's been a tough year this year with the lake levels High lake levels low as we know we haven't had any rain this and that and by the way if Sunday morning Malcolm and I completely cleaned out all the beaver debris in front of the we Gates by Monday it was back oh yeah they built that's it's not crap floating downand new so it's like next to nothing but one of the things I wanted to just bring up a lot of concern about being able to put your boat lifts in the water and this and that because you know it is what it is my my point is this if a guy like me has lost no exaggeration four or five feet of this much of my Shoreline is now out in the lake yep that has raised up the bottom of the lake where my boat lift goes yep so therefore when I put my boat lift in in the water it's not going as deep in two two feet of water oret it's going in less water than it used to so yes it's hard for my boat to go on there just like everybody else actually it's not for me but for a lot of people it is yeah so all I've ever all I've ever said is you really don't need to go out there and brudge your thing you don't need to turn your boat around and turn the gas on and push it back on Shore you could just tie it to a tree but another thing is you go out there with these little PVC pipe you put your put your garden hose in the thing and you put it underneath all of the points that are hitting the bottom and it beaks the sand out from underneath a little bit and your lift then gets deeper in the water to begin with and makes it a little bit easier people do this with docks people do this with a dock poles my neighbors's been doing it that way for 20 years uh it's an easy way to do it and the other way to do it is just like Saunders has done it for many years where he turn a boat around one while because everybody's power Bing power you know getting out he digs a hole not sure you actually allowed to do that right stretching of that pushing the sand back in the holes what he's doing I think I think using your boat or PWC or what have you to drench I believe is not legal yeah in the state of Massachusetts so maybe the idea with a PVC pipe with a with a garden hose underneath the corners of the legs of these things to get them a little bit deeper in the water would help in some cases it might but but this is one of the reasons I believe why we have this problem because the erosion has pushed the dirt out into the lake so one thing to understand is some of the people the issue has nothing to do with the posts they lifts in other words the the the whole the whole bottom of the lift bottoms out it's it's putting their post down won't help them no because Carriage hits the bottom of the leg not the leg pip underneath underneath that no but it's not a spot it's the entire it's entire car you're not you're not but you can't blame everybody else because of the erosion that's caused the lake level still it's the like it or not it's still theep it is what it is yeah it is what it is y yeah all right I got a question and is really for Eric more than anybody else well last year way back a while back they brought up the issue of road salt and stuff and we were going to watch trabid would be the first indicor we been well not not uh conductivity contivity yeah and we really haven't been seeing changes but you have been Tes yeah yeah yeah conductivity is one of the things we're measuring and you know we're not seeing a progression okay good um probably that's a probably it's a testament to the separators yeah you know almost all the INF Falls have separators and you know and when I did the the storm water measurements I don't remember how many years ago that was we could see the effect of the separators they really work yeah because we tested Upstream of them and downstream of them yeah and it was like yeah those things really work um at some point in time some of those I think need to get scooped out they suck them up no they do suck them they by the way and I did take out two Bieber Dam so one underneath Mountain Brook and one further north of that anything else so we can wrap up we're good Mike thanks for asking yeah anything else watch have a motion to adjourn I make a motion to adjourn second Norm all in favor oppos stain unanimous and it is 809 Mr visitor thank
