##VIDEO ID:U-WVFB8cb8g## all right we will open up the planning board meeting for Tuesday December 3rd 2024 this is being conducted in a hybrid manner pursuant to the general laws if anybody is recording that is fine you just need to let us know anyone okay um 7 o'clock Town planners report thank you very much Mr chair a couple of items to share with the planning board this evening uh the first is that I met with uh Greg Dy uh he's the chair of the economic development commission uh in recent weeks he's been so kind to share a uh a bit of an analysis that the he and other uh commission members have drafted when looking at new projects as they come into town uh under zoning planning board members uh take an impartial look at uh the use and the site and um other parameters related to those functions and the interrelationship between the two um from the economic development commission this uh document is more to be call it a value analysis um of uh project proponents in particular when we're talking about business um and the value that it could bring to the community I think we are likely to see if you will a draft of this uh coming forward he's asked to be uh on the distribution list essentially when a new project comes in uh you're familiar with the fact that I fired off to uh you know public safety building department Health Department conservation uh from time to time um for their review comments um and they're looking to get uh you know an early um look at a project as it might come in um the analysis are looking to produce will be um well I suppose the value of it will depend on the project and the content and really what's within the prview of the planning board to consider uh but I just want to let you know that I had the opportunity to speak with them and uh uh and discuss the gesture they're considering to extend here's the one thing that jumps to mind when you say that which is unless you can tell me where in the bylaws we can use that data it becomes completely useless to us right and and probably it's not appropriate in the course of a public year you know perhaps there's a another opportunity to underscore that aspect um I can't fathom what range of findings that you may be able to develop when looking at that analysis but if you the appropriateness uh was a factor that we discussed were I to have taken the time to go back in to my correspondents and pull out that Latin phrase that he used I might try to float that out there for board members right now essentially this being um again I'm gonna just fall back on the idea that is an advisory or even a a courtesy uh document but your words do not fall on ears um I mean I I'm not you know again it's this is not a criticism of it it is simply I'm not sure it's appropriate to have it be put into a public hearing if it can't in any way be utilized right it doesn't it doesn't add anything and and if someone relies on it then that's problematic potentially so that's the only issue to think about with it is um and I'm and I also the other part of it is I don't know if it could be part of the violence right I don't know if that is an appropriate criteria to use in evaluating these projects so to me it's a little bit of the carton for the horse I think finding that entry point potentially or making the entry point is probably step one versus this part fair enough and for sure for the time being uh anything that is incoming from them would be routed through the town planner's desk not that I want to make all judgment calls or filter everything but I we want to make sure that we had that opport I had that opportunity uh to look for those sensitive we're going to call Value judgments of a project that may not to be looking at call the benefit to the town as a whole or other very Project Specific items okay thank you uh thank you uh let's see I met with representatives from loar energy uh last week they operate the goosepond um solar project I think I brought this up because this is the second time I've had to the opportunity to speak with them uh and I'm deeply appreciative of their efforts to do some high level zoning review uh before they get deep into a project and uh waited to we'll get on to thin ice um there uh is land adjacent to town-owned land on the south side of town they're considering they're considering the Crepes tea house property off of Granville Road um for these Opera multiple Acres not giant tracks of land um and I think just about every site has at least some limitation with relation to adjacent residential uh use um but I want to share the fact that they they come in we generally look at GIS based mths I let them know these are my concerns about uh your access because it's only by in easement or how you might be coming to a property or in the case of the one by the state line so next to town property before you get to the transmission main the same one they connect to from goban uh you'd be looking at at a minimum a license uh type of issue um in order for them to uh Traverse the town property and get to that uh transmission line so uh just a high level review for this time after the last meeting uh Mr Thorton and I sat down with Jim Bole for 62a College Highway uh Mr Bole wanted to share uh some draft plan revisions without sticking words into anyone's mouth I like I say there are changes in a positive direction I know that uh bulk um safety traffic and parking management emergency access were strong issues that were uh heard by Mr Bole and his team uh it looks like he'll be preparing revised drawings for either later this month or early in the uh next year uh I think the last item I'll mention uh is that on November 20th the governor signed an economic uh development bill that has certain permit extension parameters written into it we haven't yet seen any guidance as to uh how that uh will play into um well site permitting uh my curs review tells me it has a provision looking back I think to January 1st 2023 um to January 1st 2025 I don't know to what degree of applicability within that period it has to be active um at the starting date like it did for people over Co permit extension what the the case may be but we'll look for more report back um just so we can keep an eye on what permits may be remaining alive given a certain extension of time I board members I have a continuance request from Mr Bole I'm looking to be continued to the next meeting we have some uh time available at the next meeting early on as the remand hearing for 771 discussions yeah um yeah since um Jesse since you're here why don't we we'll talk about Noble steeve you want to come on on how are you tonight good good uh just name for the record Jesse salt marsh Noble Steve all right um you know give us a update you want to start you want Jesse to start how do you want I suppose we'll do a little of both um Jesse had the opportunity to meet with uh Randy Brown last week uh because where we left off at the last meeting was that they're developing um if well their cost estimates in concert uh understanding that you know the town has its um position with a element of protection built into it and of course Jesse as an element of his business as his cost figures as well um justess if you want to pick it up from there R and I met and um we I made a pretty detailed schedule of value same with Randy and we went through it and the biggest part that we're kind of off on is the Culvert Crossing which is both and unknown to both of us so uh what I was asked uh John if if I could have a little bit more time to wait to get my plan from Terry Reynolds and I actually spoke with Terry today and he said I should have a a final plan within the next couple weeks and at that point I'll be able to have like a solid number that I can give to Randy but like all the other numbers we're really close on okay um so and that's also is going to be pending approval from um the state right to do that uh yeah but there like yeah it's a pending approval okay but I mean there're the idea is we're submitting a a plan and a drawing to the state that they're hopefully gonna improve like fair enough like you know what I mean I I can't say yeah they're going to approve it they might approve it with some Provisions but the the basic guideline is going to be that type of Culvert this amount of dirt on this drawing and that's that's what I'm what I'm trying to base my final pricing for that Culver Crossing area on that okay so get the drawing you can submit it to the state you can create your final numbers um but as far as work getting done it really just pushes well no there's no we're still continuing working okay we're not we're not stopping anything I'm just this is for the Bond money that's it understood um but I mean I guess there's two ways if you're looking to reduce the bond money I'm not looking to reduce it I'm not I'm looking to not increase it okay that's fair um I think it's at like 660 or something like that and I think Randy was right like around eight something and that's because of the Culver Crossing thing so that's where I'm trying but let's and and maybe maybe that plan causes him to come down from where he is down to where yeah it is but maybe it doesn't right so well that's why I'm looking for a you know if I can have that plan in a couple weeks you know I should have a number within a week after that to propose to him and have something into you guys but I'm not sure when the meetings are but but what's the plan for the work other than like the cover work can't get done until it gets State yeah the other work what is the is there a detailed schedule for that other work so we can have a sense of yeah we're we're continuing work and then that every two weeks I update them with the like we're pouring sidewalks tomorrow um and doing curving this week we're hopefully doing curving tomorrow it's obviously weather dependent but we're going to continue working through it we have uh you know heat protection Frost blankets down so we can continue doing work out there and the asphalt plants are still open till the last week in Christmas so is what's the sort of timeline to get the rest of that work obviously there's going to be punched the stuff and whatever else right but the bulk of that other work other than the proc oh U by by the the beginning of Spring do we have a a sort of schedule yeah I have I've shared a schedule with Randy I can I can email to John you want if it has the last one I have was from I think we sat down in May if we could update that yeah I've updated it as I've as I've went along I can share that with them at our next meeting next week yeah on Tuesday I mean because we meet bi-weekly so I'll bring that with them then okay you know and then I can come into the next meeting on the 17th and go over it with you guys as well yeah I I mean I think I just want to make sure putting even aside the bond issue right that's that's separate issue but I want to make sure work is moving forward right so the Culvert right I mean it seems like you're moving the the it into the state's hands you can't control the state obviously and you can't do work until you get the approval so that's a definition the other work I want to just we can move that along so that it's done by the spring and then you're sort of hopefully getting the approval and wrapping this thing up wrapping it up um so I don't have to come see guys I mean not that we don't like seeing you but enjoy company um yeah I mean if you want to do that if you want to plan on getting stuff to John and we'll put John for the next meeting and we can kind of get a better sense of St by step what needs to be done and the time frames yeah um you know which I you know we gota we got to just start holding it a little bit more to it right trying to get this really to the finish line by not the finish line but just before the finish line by this spring yep okay I agree all right that's fine Mr J I mean Jesse when we were talking on site and you kind of share uh the the sidewalk work you're doing right now the planned curbing work um and this is along if you will the back stretch of the development towards the high point of the site before you come back around to the Culvert uh will you be understand that work right there is intended not only to advance the project but also correct some of the drainage concerns yeah that uh people have had out there are you going to have opportunity to uh work and connect some of those drainage structures in the street this month yeah okay yeah because once we put the curb in it it needs to be connected okay just want to make sure if we talk about it here then yeah g ready respects the fact that while December is not a super risky month when it comes to weather there's some variability there if we uh yeah can see a push for that I think that's a that's a meaningful milestone um to achieve let's getting that section of drainage online yeah yeah yeah I mean I don't know I I don't know where that's going or what the drainage issues I don't remember what the drainage issues are but I mean that you know once that ground freezes potential for runoff um you know I mean that almost cause that cause some drainage issues of it's flowing down onto people prop well that's the whole idea with putting the curb in like wrapping that section up and back filling all the curves and everything okay El uh no that's it we uh just if you don't mind I'll take a look at that schedule for uh our DPW meeting next week yeah otherwise uh we'll look for an update um for the on the 1 okay all right thank you com tonight good night good night all right 7:15 any public hearing sixth streets before we get into that continu um that continuous request uh I had the chance to meet online with Rob LEC and some of his team members um and discuss the five lot threshold um for a fire Pond or fire sstem um out there I've received a draft uh plan showing an easement area for uh a proposed sister uh the fire chief and I will be sitting down to review that and uh go through some tangential concerns um or at least check those off those boxes as we move forward um so I expect uh at the next meeting we'll be we'll have an updated common driveway uh agreement contains an element um protecting durable access to the fire system because it would be located off of that common driveway uh so that's the sticky piece right there but I do expect the this we you'd legely can get to a point to post public hearing next meeting okay we have requests from the applicants to continue uh to the next available agenda uh uh so I would say why don't we just move may be aware that two weeks ago I think we got a decent amount of rain here in South was probably a little over an inch uh an inch to in and a half storm the Basin of concern number five over Depot Square drain within the resigned 72 hours uh the work which includes the Basin reconstruction and the resetting of a drain manhole um cover and and frame that was that all has been completed up there but the elements um looking to close out the fun held in escro and as remaining security for that project uh include a developers statement indicating that the stor Mark system is functioning properly we talked about that although that statement will be mitigated by the certain operations we do have a considerable duration that project has been active um that statement along with dpw's if you will review and comment on it uh there those both going to sit for just a little bit while um we have a few more precipitation events and we can see it can continue to perform and make sure that everything is at least appears adequate before releasing that secure so uh we'll expect to try to pick up the discussion in January we'll see all right sign permits for Roma restaurants there one second get things shared on screen okay work is proceeding at the ROM restaurant um Eagle Ed individuals may have seen that this sign has already been replaced uh these panels at least uh but it would these is replacement exist paneling 7 by 109 that comes out to 54 on the Square for left out to 50 square feet um so I think there's adequate uh space that the existing sign conformed uh given its rounded feature at the top okay so we'll be looking for a positive recommendation from the planning board on that close it up uh after the fact any comments or question questions from the board okay I hear a anything on stair Drive not for this meeting Mr chair any planning board member or staff comments um I have signed up uh to attend this coming Monday from 12 to 1:30 the metropolitan area planning council is going to have an informational meeting where they're going to be highlighting some examples of recently updated um bylaws in order to um account for the new Adu regulations supposed to be sharing some tips for implementing that and adapting oury law so hopefully that'll have some good information any other ping board member or staff comments just for everybody's information the first reading of the master plan implementation committee be December 11th okay thank you for sharing any other planning board member or staff comments no sir okay minutes minutes will be reviewed at the next meeting got it all right um what is the plan with um attorney O'Hara is just joined okay so we I will um make a motion to go into executive session with town Council pursuant to Mass General laws chapter 38 section 21 A3 regarding litigation and threat and litigation um discuss the strategy with respect to litigation and having this in an open meeting may have a detrimental effect on the
