Really down the person who handles all of these cases. And so I want to say thank you to you and also to share you for making sure that the attorneys document from last submitted I really appreciate tat. I do want to have this that I don't I you know, these are really, really complex cases that come before us anytime that there is consideration for license revocation. It isn't something that I take lightly at And it's really because there are so many different parties that are impacted. The business owner to the neighborhoods you know, and so it these are really tough decisions to me. And I want to let everybody know that the documents and really just the time and commitment needed to put into this. You know, I have and put in that time. Really appreciate my colleagues for him. Not only that time, Alina over, but for your willingness ask questions and look at the documents and other things that are before us. So today want to share that meant I believe that the recommendations of our Department of Safety inspections as outlined to the resolution before us supported by the evidence and the flex, the stance that we have taken in relation to keeping flavored tobacco out of the hands of children and minors under 21. They have said before that it is important for us to be think that we can to keep labor to back from those who are under. 21 because the tobacco companies use the flavors as a way entice them to try these like These addictive and harmful products. The testimony of licensing manager Hudak about their license history violations and current violation. Reports of inspected are compelling to me. I've been doing a lot of reflections on it. The the testimony that we heard from the attorney last week and there were there's just a few lines that really stuck with and say I wanted to play that back for everybody. The attorney said that they were referencing a license revocation that we did for a tobacco license holder and the midway area in a few years back. He said that in this case, the reason there was a revocation would be that somebody got killed. There were shootings. There were fights. There's drug dealing the store was selling truck hits. Those are all at great activating factors. That provide the basis to the court appeal that it was ok to double the penalty. You do not have that here. And what I really want to say is that I feel it's important that we don't wait for those things to happen in order to revoke a license. If that was the standard that we help ourselves to, then we have to. failed our community and there are so many ways that the have already been making so much progress in passing policies to that arbery preventative that stop us from getting to these tragedies that, you know, still happen to the state from lot of many different contributing factors. The recommendation of the Department of Safety and Inspection aligns with the decisions that we have made in the past when be regulated of flavored tobacco and our decisions and individual cases like Tom Angeles market where adopted the findings of fact conclusions of law and recommendations of the initiative law Judge. And revoke the license for a large amount of flavored tobacco products. When think about that just makes you how that actually have been leading in a way that is very aligned with what we have and wanted to do from the start in making these changes too. To district flavored tobacco products in our city. Here I see the same substantial and compelling reasons to support departure. In in this case and think the violations in this case are even more serious. The resolution proposed by our Department of Safety Inspection lays out many of the substantial ad compelling reasons for a quick picture to revocation. As we talked about during the hearing last week, licensee even applied for tobacco products, shop license and was turned down. So he knew he couldn't sell flavored tobacco products. He also got education and training yet they show up and hit the tobacco flavored tobacco products show up in his story again and again. I looked at the photos and read the report of inspect, the products that she had on his shelves are easily identifiable as player products by their names. This wasn't a mistake and it wasn't the first time that this has happened. It also, what's it like this? Wasn't like this was one or 2 products. The photos that our take, a city attorney, Theresa started showed that are in evidence and in report of a spark to vote unless over 15 different types of products with numerous individual products in each box. For all the reasons and the resolution. I think that this case is the typical. I also think that it is a typical because we have hundreds of tobacco shops licensees who can conduct business within the boundaries of the regulations. We have set up for flavored and unflavored tobacco products. Most most violations we see are the result of a small mistake. This type of violator is very different. And that is why I am recommending that we adopt the resolution of the Department of Safety inspections and the amended recommendations of the administrative law. Judge has our own findings of fact, conclusions of law and recommendations. So with that, move for approval of epic Haitian. Taxes feels out touch with the economic reality is many of us face as we struggle just to make ends meet. You have deferred payments which happened. It's just one of the word of same payment pay later and pay more taxes. He also stated nonpayment will result in 4.2 5% interest over 20 years of those 20 years. My parents will all even on their death beds. This poposal feels like a non for demand that places undue pressure on homeowners. I'd like my parents. My retired parents are on a fixed income. This would requirement parents to work each part time or full time at Walmart over 300 hours just to pay $5,181. We never received any notice about the construction being done on Annapolis Street. And there was no warning of communication about the disruption. It would cause. I came here a few months ago expressed how disappointed I was with the lack of communication from the city. Are there grants or other resources the local government can can find the funds for Minnesota had a tax surplus that why isn't that money being used for this? The Biden administration gave millions infrastructure bill for roads and bridges, although it MAY not be related to this project. I feel like there should have been money freed up from the state of Minnesota. Every $0.28 of every dollar of gas purchase is mandated for roads and bridges in the state of Minnesota warrant using these resources. Again, Iwill say the last time I was here, we were never notified. And I spoke to a lot of the community members and might on my street. We never received any notice. The roads are now it's an pave. After today, if you signed and I will follow up with you via e-mail and know that this isn't always the best setting to assess personal issues are are specific things to your property. I heard you say a couple of things. One of them is that construction is extremely disruptive. And I completely acknowledge that. I know we're doing a lot of work throughout the city right now. And sometimes it's difficult to find a way around just given how much is going on. The good news is that that means we're investing in our infrastructure. That's not had that investment in a long time. And at the end of the day, you should see improvement in front of your home. I also heard dissatisfaction with how tat construction is going and not feeling like the work is being done well, and that is something that I would follow up with you about because I'd like to hear more if this is not you're not seeing the improvements in front of your house, then w need talk about that and figure out what's going on with with that particular part of the work. I heard you say the communication about the bike lanes and the project in general was not forthcoming to you. Again, that is something that I would like to talk to about. We do try to get the word out to neighbors when projects like this are happening. But if you're not hearing about it, think clearly, we need to do better at that. So that's again, something that I can talk to about offline. I want to just say a word about the way that assess for street reconstruction projects like this one, because we actually have these coming in front of us almost every week and we regularly hear from folks who are dissatisfied with how this process works. The work that we did on Annapolis is done once every 20 years I think probably generous. It doesn't happen any other that often. It once and usually a lifetime of home ownership type of project. We you do use all the money that the state makes available to us. So we use all the grants all of the federal and state financing that we can. And we put that to use an roadwork when we have to come to property owners to ask for their tax dollars. That's because there's no other source that we can use. Pay for most of the road work out of the general fund, which is everybody's Texas. 75 1% of the work is done through the general fund. 25%. We ask the neighboring property owners to pay so everyone is paying in and the neighboring property owners. Hey, that 25%. And the reason we do that instead of just putting it on taxes is because we actually save ourselves money because we're able to assess tax exempt properties as well. So properties that otherwise wouldn't be paying in if we just raise taxes to cover this work all across the board every year pay. And when we do it this way. So it is I recognize a huge burden to have that bill suddenly come to you even though it can be paid over 20 years, even though we have deferrals, but ultimately rather than all of us paying more every single year, regardless of work happening on our streets, it actually saves all of us money in the long run. There are hardship deferrals available. And we have staff here who can speak to about that. If you're not able to pay and again, I will following up with people individually about specific issues that I heard here. But I am gonna move purple today. All right. Council PRESIDENT, thank you. Council members for the opportunity speak today. Clarify a few points on this application which was submitted by our project contract or Lynn, the construction. I'm Brent Christensen, civil engineer and public Works Bridge division and also the project manager for Khaled 3rd Street Bridge replacement, which got underway in JULY of this year. We've been under demolition of other portions of the bridge for the past month. I'd like to be upfront and honest about removal work. First it can be and is disruptive I I project contractors. We all acknowledge that we acknowledge the patient's empty, extensive ms or projects. It's especially disruptive. If we're looking at working over a weekend or overnight, this is not something that the contractors or the city team prefer. That's not something that we want to something that we plan for. Well, that we that we wish to perform yet. There are times such as this that sort of work is unavoidable in particular on the Kelly 3rd Street Bridge project, we have railroads and we have freeways and both external agencies place heavy restrictions on when and how bridge structures can be removed or their facilities. Since the perimeter of this on freeway closure. And in this case, you know, as as mentioned, lender, construction has applied for this somewhat variance base association with the removal work end at some of those parameters for clarification. In debt requires a detour of the interstate system following the interstate system. So this proposed freeway closure will detour traffic on 6.94 between the I-35 e e area downtown and the 6.94 for 94 interchange in Oakdale. Demolition work of the contractor includes protecting the freeway, hammering down the deck, the beams, the piers and hauling off all of that material to cleaning up the surface and reopening the roads. Dust is managed with water. There are ways that we can mitigate against that. However, noise and vibration is unavoidable. Public has already included these tentative closure dates along with information about today's public hearing I our website posts and also in the project email update reaches over 1000 subscribers. And if men that does not grant Linda permission to close the freeway on the weekend, starting OCTOBER, 25th, then demolition will plan to take place on the very next weekend. That is allowed. But in the end, it. So public works is respectfully aking that the council approved the sound of variance with the understanding that this work could move could shift to another weekend. This is a critical part of our PRESIDENT's schedule. Quite honestly, if we can proceed and that's direction, then this would cause delay to the three-year bridge project. Lastly, men that will only provide us with about around 10 days advance notice of this closure. And so as soon as men that approves the actual dates public works with updates through our channels. We would send mailings to nearby property owners and we would post to social media. And and that would have separate media coverage of the I-ninety foreclosure. We don't experience this very frequently, obviously in the city. But this is the weekend. Closure is kind of the means of bringing these structures down. Lastly, the 10 day notice that approximating. I would say that normally working partners, we would be able obtain more and better notice than that in this particular And that has an ongoing active project on I-94 at the 6.94 interchange, which is affecting freeway lane closures for their own project. And so our closure is unfortunately tied to that project. And that's why we have this reduced notice in this case. Just one quick follow-up. Council member chose so in the past month we've been working west of the freeway in the area ever spent a nature sanctuary and that demolition is occurring during the daytime. Closure that we're seeking through this noise variance as mentioned, tentatively for the 25th potentially a future weekend. That would involve removing the entire bridge structure over the freeway in a single weekend. And so it really hammer equipment, knocking the bridge down the span's go down to the freeway. The whole structure comes down between the, you know, freeway lanes out to the clearances onto the freeway. The only remaining structure at that point for the bridge would be the the abutment, the large support that's against 8 bluff. We indicate that and anytime you can have a contractor go through and develop beds in those bids can be amended to be consistent with the code compliance if that's necessary. We did not receive bids until the last week in SEPTEMBER for this. So we have bids. The kids are not signed and none of them indicated time frame in which to work would be conducted. Demolition is likely to be in the $30,000 Range. Will take about 45 days to get through all of the different environmental reviews and so on. At the end of that time. And can you show that you have a plan for getting to the other side with the work being done with respect to the financing on the project, we hve had 0 communication on money being available for the project in the letters that have gone down since the end of MARCH. It has been clearly stated that staff estimates the cost to exceed $75,000 if total for and more than 20% less. And staff estimates a high level of detail will be repaired. Financing could be visible business or personal accounts of But struck should know. So it makes available the situation that you could hve definitely lower beds. Show us the receipts and that's what we've gotten at the end of SEPTEMBER. We have I'm signed, are excepted. We have 2 electrical beds. So needs to be pulled together, sign and a schedule put into place. The last piece that was mentioned was affidavit and fine and sing. If you're showing a bank account. And saying this money is going to spend for this purpose. We'd like it is something that and say, yes, I have a bank account at a dc bank. I have $20,000 it. I dedicate these funds for this purpose until the project I That's gives a higher level of assurance to the city that money isn't going to be spent doing something else. Was discussed not just say that hearing. Then it was coordinated with the building inspector who runs these, that they would work with him in person to do. And and the inspection happened. And that report came at JULY. 29th. So there was and I didn't want to say there was a significant delay between application report the issue. But to my way o thinking the initial to way lies with the ownership and the sub second delay lies with the city. One streak. What way can get bids to do this kind of work in large companies like the ones with which he's interactive, have prepared. Dozens and dozens of bids for working on cat 2 buildings and would know what to identify MAY be missing. A couple of things. So do we see that every day? So there's a lot of options here that were in place. And can just one time and now that we have like the scope just all the things play with your recommendation of lane fir. What are things that he needs to provide? You know, for us t police? The in a coffin in place that he's able to actually get more time, particularly on the property. No later than open business on Monday morning. We should have a work plan. 3 sample work plans have been provided for his guidance several times over. We should have evidence of financing. These are things that should be pretty straightforward. He got the bids pretty quickly at the end of SEPTEMBER. Hopefully these companies are responsive to request for. You know, signing the bid.
