My name is Amy Rodriguez, director of the Saint Paul Parks, Recreation Department earlier this week on Indigenous People's Day, joined by community members, tribal leaders, students from American Indian and other partners. Mayor Carter announced a new call management agreement between the city of Saint Paul and our nonprofit partner walk-on Tpi. One got the to store the land at the park currently known as Prince Nature sanctuary through the agreement. Walk-on Tpi one copy will implement traditional idigenous land management methods to care for the 27 acre site. Known currently as priest that Bruce Vento Nature Sanctuary but also known as Walk on tv, which has long been a Dakota sacred site. This partnership reflects years of intentional learning alongside Dakota leaders by our staff within our design and construction division. Want to give a shout out to Alice Meserve, who's in the crowd today for her team in leading that work, the cultural landscape study at Mound Regional Park helped develop the concepts for the Walk on tv Center. A 7,500 square-foot cultural Environmental Interpretive Center scheduled to open in 2025. At its core. What this agreement means is that for the first time since Governor Ramsey declared in 18 62 that Indians and Minnesota must be exterminated or driven forever beyond the borders of Minnesota. We have worked together to restore access and authority to our Dakota Brothers and sisters as stewards of the sacred site. And while we acknowledge this important step in our collaborative effort on restoration stewardship and site management within the space, we also express our commitment to continued partnership with tribal nations and the Saint Paul American Indian community to further on our city's natural places. They're going to give us a staff report on Saint Paul's proposed wage theft Good afternoon Council. PRESIDENT Council members. It is truly an honor to be here again today. I am best Commerce, director and deputy director and human rights they shunned inside a hoin I'm joined today by to labor standards, investigators cement the inning and just flat. I'm not gonna make hear all these words promise. But just to let you know, heroes missions stand is on the screen for you. I just want to elevate that. Some of our main goals are to educate advocate and enforce in yellow. You see all the different areas that we work with that of a diverse department. The labor, why? How did we get to wage theft of the Labor Standards Advisory Committee or Lcec as we know it was created by you by the council and the mayor. And it is it's whole purpose is to guide hero and the city and our labor standards The first prioritize our alignment with the states are in sick and safe time. Law since they were passing on to catch up with Saint Paul Ed and the next priority they have for us I just want to level set right now. Our investigators currently in force sick and safe time and minimum wage. And now we're hoping that this process is just beginning, that we will soon be able to educate and enforce around a wage theft ordinance. I just want you to know that we've always fielded wage theft complaints the number has increased. I think I told each of you individually our numbers of inquiries have grown exponentially right now. All we can do is refer those community members to the Department Labor. There is a state law which you what you all know we've been discussing, but we can't investigate it and we can't investigate and tell you pass a ordinance and we're so grateful for your partnership. Just want you to know. We have 5 investigators and we are more than ready to do this work. And asked Josh to just tell you a few things. Thank you both. Appreciate it. Council PRESIDENT Council members now first off, I'd like to start off with. Talk a little bit about wage theft in general. So wage theft happens anytime employer does not pay wages to an to which they're legally entitled to. Coming back. What that said, Lcec brought to our attention and I didn't know this. That wage that is actually considered one of the number one wage when one of the number in America. And so workers are entitled or should be entitled to an honest day's wage. But in addition to that, unfortunately, also under cuts on us businesses that's what they can do and try to when they when they do comply with our laws. At end of the day. Now looking at what happens overall in the U.S.. So, for example, the Federal Department of Labor just in 2022. 2023 recovered over 172 million dollars back. Wages. And these are concentrated a few select area. So, for example, we're looking at things like construction looking at at Tip Industries and looking at health care's 3 of the top areas where wage theft occurs. And I also want emphasize that in particular, this happens among women bipoc undocumented workers and low-wage workers in particular. Turning to Minnesota. We've we've talked with our colleagues at the Minnesota Attorney general's office, also with the Minnesota Department Labor and Industry. And they've informed us that more than 39,000 workers in Minnesota experience wage theft per year, not over multiple years, but per year. And so that it more that are close to 12 million dollars in lost wages for workers and in particular, is concentrated and the late low-wage workers in Minnesota. So with that said, I want her nervous look all. Thank you. Council PRESIDENT Council members I'm here to talk about some recent increased as a labor center team has received, as you can see on the screen one of the most common type of way step that we see in that we received is that when an employee either get terminated, they quit voluntarily or get fired. They never received their lst paycheck and that paycheck can, you know, affect their livelihood? On this next screen, we have a little bit more example some other recent increase that the labor Senate he received. And I wanted to highlight in addition to those one of the case that I received as an investigator, this person was a single mom. She was working at a senior living cmpany for over a month and throughout employment, though she only received one paycheck from this employer and the employer counseling basically promised terror that she would get paid eventually and that the company is struggling financially. And so she was operating under the safe that she would get paid eventually. Under a month, it never got fulfilled for the Lakers in a team. When see that in Curry, we were unable to proceed due not having which ordinance. And so I had to refer the case to the eye, the department, labor of initiate from the state. So yeah, I will pass pecked to death for finishing of our presentation. Thank you. Thank you, Sam. Just are at that. Just to wrap up council, PRESIDENT Council members. We're not asking for any new obstacles for businesses and Saint Paul ae workers. Passing a state law that mayor passing a local ordinance there's a state will just give us the capacity to be a part of the solution. And we're really grateful for your support and your partnership. I'm going to take a positive approach and hope that it's passed by you, which would put us into the rulemaking period starting on NOVEMBER 7th, that rule making period as long we're thorough. We put those rules out for the public to give input and we always get some and we do better and the rules of the final and published on DECEMBER 30th and this ordinance would be set to take effect on JANUARY. And so it is important that we can move forward and enforce this and get the get the. The needs met for our citizens and Saint Paul. My name is Cara Peterson, PRESIDENT Of the Regional Labor Federation. And I serve on the labor Standards Advisory I will just say I will have more formal remarks next week. I wasn't anticipating being invited to come up and speak today, but certainly thank you for the opportunity labor unions in Saint Paul are really excited that the city is taking this up. We know that workers union and non-union experience wage theft in your work and we really feel like this is a way to level the playing field. Make sure that good employers it stuck and a disadvantage when they're trying to operate their businesses and and certainly want to make sure that city staff had the tools that they need to be able to help workers in the city find solutions when the experience which that so thank you for kindness. Thank you for your leadership is co chairs of the Labor Standards Advisory Committee has to come and for excuse you just got a promotion. That's actually you've been volatile. Karen but deeply appreciate your service, a city and your role in crafting this. I just wanted to take a minute to recognize that. So thank you. Thank you so much. I'm also really personal to like my parents are refugees and I have been low wage earners, their entire I can tell that the work that you do. It's it's yeah. Your input so empathetic towards the people that you talk to towards the people well be benefiting so positively as a result of the vote that the council here take since I want to see thank you to all of you for giving us even more put more tools to protect workers and our city. I just want you to know that I constantly get inquiries from people who are even outside of her city because they really like to see Paul as a place that has been that sanctuary for and been advancing workers rights and so much more. And so that's something really proud of that I want to share back to you because you also make that work possible in I just wanted to help with that. It such an honor to able to have chair. You be a part of this work in partnering with the city on this. I know probably are volunteering. MAY be on your time on the lcec down the side. By Monday morning as well as producing. The evidence that he had the financial capacity to execute that plan. An affidavit dedicating those funds. We received only an affidavit that okay, Ting funds. We did not receive anything related to specifics on account that was referenced and we have no updated work plan. In the normal course of events. At this juncture, I would recommend that the council ordered the building demolished with no opportunity for its rehabilitation. I tink that there is one other option that could be explored in this case. This is one that would allowed the owner to retain some equity. And I not. Lose the building and have an assessment on the parcel for the demolition. This would involve the owner of being responsible for coming into a development agreement with somebody who can produce that plan and produce that financing and show that they can do the work. And that normally is done by way of a purchase agreement. But others have done it by contract for deed or mortgage Lien. There's a lot of different. You know, there's different legal options and we certainly provide standard lnguage. But I the House would not be. Up for demolition. In that case, there would be somebody hopefully partnering there's I we've seen. And for the council, quite a few cases like this, So I'm hopeful that he can buckled down and find a development partner so he can salvage equity in the property asked that this be referred to legislative hearing on Tuesday, NOVEMBER 12 in order that he can produce that information. Hopefully have development partner accompanying him and we would be able to review those and send it back to council. That would be. So the last-ditch thing that we could give a tried to. But I this point do not have confidence that this honor can execute the rehabilitation of this property. Thank So are there any questions from his Mormon on the recommendation? Go ahead. Missing thanks. Council present. Just wanted to say that it is really disappointing to hear that their property owner hasn't followed through on their end of the deal at all. I feel that the last week very, very understanding. Also putting a lot of time effort really to get into the nitty gritty and figure out, ok, you know, what does success look like for you and what you need to? Basically get, you know, to your planning completed? And so i was reading it has have they need a new set of attempts to contact you at all since then? As usual with this particular case. Te legislative hearing office has reached out on several occasions. We've provided feedback that the financial. Docket, afidavit that the money would be made available was not sufficient. What was still needed. So there's been ongoing communication with our office throughout about what wasn't provided, what needs to be so. It's unfortunate. But it's clear that he doesn't have the capacity to do this work. As Johnson. And along those lines, Mormon was there and was there receptiveness to find a development partner. We recommend as the recommendation to allow that time to do so to allow for there to be communication. Like was there are ready like discussion around you need you would need to find a development partner in this case and there was interest and that I'm just kind of wondering if there was a receptiveness to the alternative solution. At this point, we have not had that conversation. I was able to talk with Councilmember Bowie about options yesterday and I wouldn't want to have brought forward a proposal at this juncture to the owner without your go ahead to have that conversation. And that would be. We sent him a ltter by email telling in here's what your options are scheduled. The hearing for things to be discussed and to be able to develop a recommendation after reviewing on, proposal and hopefully it development partner. Thank you for kind of like the same sentiments of just and just like the even with the communication and even with hearing and that it wasn't clear, instilled doesn't seem to be really clear to me. There's like a actual plan frward. But it sounds like we're trying to buy some time here. So. Well, a meaningful to that. I just kind of wonder like how much time are we allowing this instance that they wouldn't allow to others? So I'm a little concerned about can about allowing a full month to get that together. So I'm just kind of wondering if you guys could share a little bit more about like. It's OCTOBER 16. So that would be for NOVEMBER 12th. And just like we have other council meeting beforehand, we have other. What is the reason for the weeks later like multiple weekly over that's easily answered 2 things are happening. The next Tuesday that we would work on removing repairs. That would be the 4th Tuesday of the month next Tuesday. And I think tat reasonably this could not be accomplished within 5 business days. The other consideration is that Ike Tober has 5 Tuesday's and 5 Wednesday. So there are no meeting scheduled the last week of NOVEMBER. So the next available rpair date is November. 12th actually, to have this particular conversation, it does feel like a fair length of time to have him have a package fully put together. I am hopeful that not confident that he will do that. So. Goodness, Billy. Thank you, Marcia, much for that. And I appreciate everyone's questions. And I also share the same sentiments that is. You know, property owner has been given significant amount of time from the beginning of this year. So you know, this isn't a courtesy to the owner of this is more so a courtesy to the community to wear. I have already said that, you we we need to look at ways to hold him accountable. That does not reside and having a building bulldozed and my community. There's already sufficient amount of those cases. So what this type tentative that me went over. It's it's more. So giving him time to go into agreements with the partner who has the financing and has experience and has construction renovate the property and he can walk away with whatever you so he can just the city in can, you know, just be done with matter. Now, this is a isn't a new concept. This isn't something brand new for this city. We this before. Just and this type of way. It is giving him that time you know, not be under the ipression that he has to come up with those funds. But he finds someone is suitable for it. The last communication he's had. What the what the legislative hearing officer I'm sending his bank statements and, you know, the bank statements he did she year obviously show that he and not have And I think this is a situation of affordability. And if we can give him time to look to a partner to provide financing for this property, my values are more invested and ensuring that we have standard eyes properties and that, you know, this doesn't go into a situation where just eroding, but this is more providing him the supports what the city is not providing supports, providing and the time for him to get the support he needs for someone else to get the job done. So I'm recommending that we go with Marcia's recommendation. But I also open to more questions people have it. All right. Thank you for that. Ms Johnston, go Just a point of clarification. This Mormon, the finances that you received show he showed he did not have enough funding. He has not provided documentation that he has funding for this. We a bank statement in the month of JULY. The checking account had to recent large deposits in it. But we have no update that finances are available now at and OCTOBER. And we would definitely look for that. I think that's part of the responsibility I have on your behalf. Okay. So in this case, just when you're saying because my understanding of the affidavit was that it would need to be not just a source of funding, but a source that shows dedicated funding to be. That hearing that project had. But he will have to show that there is funding to finance that project. So not only in this case with new development partner, but you need to find its partners. Will. That? Evidence of being able to pay for the work and deciding the work to be done would completely be transferred to a new person and that. Would hopefully be a person. You know If you that proposal to make sure that they have those asset base before the council would grant time. This is taking it out of. And the owners hands in terms of abating, the nooses condition that exists there, it would be someone else doing it. Can add one more thing is sending it back to legislative hearing in this capacity. We have not done for. First visit one of these remover repair orders. We've done it for cases where someone has failed. And looking at it at a 6 month or 12 month point later. In this case, I would say there's a failure in the ability to pull it together and you if it's the council's will have this looked at more deeply, which I was hearing that the council is looking for last week. Then I think this is the best tool to do that with it's Haven't able to find somebody else who can do the job. go ahead. You think you got present all sides want add to that? When motion is my and i were talking part of the reason why we're going to this route is because since his property is in Category 3, it cannot be so like he is not like we, you know, sent a we sent a notice to his mortgage. We don't know how much she owes on his mortgage. So all of the different financing that he has not tied to the development, but in terms of his loan on tis property, we don't have any information to take into consideration of like what are the impacts. So since he is in Category 3, he cannot just sell his property, which he has to. His only option is to be in a purchase agreement with someone who can renovate his property. White is in compliance and he has to transfer it over. Is that and that? Is that correct? If they use a purchase agreement has the tools and absolutely that is correct. That heat the have or could also. Have a mortgage on the property and have that lien on the property. There's a couple different ways to do it. But the person partnering is going to want to be made whole. Plus some for the trouble. So And I so I just want to clarify safe. We not bring this motion for vote on this.
