A AAA with a negative outlook citing low operational risk as serious as a sewer system does not face regulatory mandate, capital projects and has a comprehensive man maintenance and upkeep of the system. Explainer that we're going to be hearing set for today on zoning amendments related to the future operation of cannabis facilities and retailers throughout the city. This staff report is going to entail a lot of important context for where the state is out in our city is that in terms of preparing for cannabis implementation under the new marijuana law, there will be a lot of information presented about just the different roles and responsibilities, licensing, etc. The item before us for the next week to specifically to zoning. So multiple staff are working on canvas implantation. The staff are here today will be able to beat his own. If you have a question outside of that, we're happy to get that to the right staff in May or may not be able to answer today. And this is the first time that we're doing this in the state. So everything is new and we look forward to working to that with that. I welcome you, Mr. Johnson for your staff report. Thank you for that. Made a good afternoon council. So this zoning study was initiated last year in response to what is now in Minnesota say Chad statue chapter 3.42, which legalized the possession. You spend you factor in the sale of certain cannabis products within the state. Under the new regulatory framework that this law creates the Office of Cannabis Management, which is a state office, is responsible for the licensing of cannabis businesses and then cities are responsible for regulating their locations through their zoning codes. We wanted to do this study in anticipation of licensing, which began in 2025. And the chart below on the slide shows generally kind of how the approval process of this work. So a business will apply for a license through ocm. They then have to get zoning approval for of Hamas will then issue a registration and then we're responsible for the compliance checks piece of this and then we can collect registration fees and will be given a portion of the sales tax revenue which proportional to the number of businesses that we have within our jurisdiction. So we're here today because we need to create a zoning regulations for this new industry in response to the state law. Zoning is really the thing that will set the stage for where all these businesses can locate. And by getting this done before 2025, will be able to provide businesses with certainty about locations that will work based off of the business operations that they want to do. So on the side were just breaking down a little bit of what the state responsibilities are versus the city of responsibilities. So again, the state is responsible for the licensing side of this. And as a part of that, they regulate business operations. So kind of say, well, each license I can do. They also have other requirements within that licensing code such as security plan with farm and the age requirement on advertising, polish and cetera. They're also the main enforcement agency for this new all state law. So they will enforce violations of state law, but we can root for violations of local ordinances to them to take action against cannabis businesses to 8. So in the city side were again, was possible for the zone. A, which is what we're doing here today will Sony. We do things like regulate the location of businesses. The state law allows us to do separation requirements so we can prohibit it. Business operations within certain distances up. You would be incompatible land uses such as schools. We can also do things like regulate the size of Texas. Another piece that we'll need to do which isn't covered by the study as well. That need to register businesses and through that process, we can collect registration fees. Will Cain will do the compliance checks and then again, we can get tax revenue based off of the number of businesses that we have in our city. So the main thing that we needed to do with this study is we needed to incorporate the 16 license I've shown on this chart into our zoning code. So on this chart, it's like a general kind of what they can do so. Make as businesses, for example, you could have a fully integrated vertically integrated cannabis businesses. Cannabis retailer can just do retail. Its editor and our approach to this generally was to amend existing land uses and the coal, whatever possible, rather than creating a new service. So, for example, we already have manufacturing and use. And so what we did was say that cannabis manufacturing over a certain size would hit within that existing. You scared. And Mr. Johnson, free move on. I did see question from his Billy. Go ahead. I think that the president have a quick question. Just a difference between a micro business in the metal business. So it's a micro business. They can do the onsite consumption piece of that. But the other difference is the amount of cannabis that they can cultivate and then also the amount of cannabis products they can manufacture. So cannabis micro businesses can cultivate up to 5,000 square feet of plants. Cannabis Mesa businesses can cultivate up to 15,000 square feet. So the license types like if they're in the same category, they'll just very about on the amount of stuff that they could do. And so there's to about Inc proposed to accommodate the retail side of all this ordinance. So the first is that we'll talk about as we got a lower potency hemp derived doubles. What you're under 0.3%, THC by volume. This is currently the product that you're seeing on market. So these were legalized earlier before all the rest of the cannabis industry. And a proposal these will be regulated as general retail. So that be allowed in mixed use areas, close quarters, neighborhood notes, but that only be permitted to so drive animal products. And and currently, we have 178 businesses in our market that are doing this. I should note that most of these are not. Quote, on, quote, dispensaries. For the most part, these are like bars, restaurants and things of that nature that are selling. These is kind of like a side business under a proposed amendments. Most of these businesses would be allowed to continue with a life and the 2025. The other all amendment that we made too cold to accommodate them. The full range of cannabis products was to create this new cannabis retail and use. And so these want to be able to sell about use cannabis, which is products that are over 0.3 tht and percent by volume. And these again will be allowed in mixed use areas, close quarters and the but notes, however, that be prohibited within 300 feet of schools and larger ones. Over 15,000 square feet would require special approval from the planning commission through the conditional use permit process. I have a question from Ms, Kim, go ahead and scan every very zoning, specific questions come out from my past. But it's not like as the crow flies because the tobacco like is when a person's life, a house, a 300 feet tournament. Sure. So it's measured from the property line of the school to the structure of the cannabis business. And it would be as the crow flies to you all. So in the cultivation and manufacturing side of this, there's 4 amendments proposed to accommodate those uses. All of the first want to talk about is this limited cultivation and manufacturing and what? And it's shown as light green on this map and in those areas we have a law. Limited cultivation manufacturing. If it's under 15,000 square feet and this would be allowed in closer corridors for the industrial-scale production over 15,000 square feet. Those will be allowed in the start treaty areas. And the framework that we're kind that we're proposing is similar to the way we regulate craft resources, microbreweries. So, for example, you can see you be able to see craft brewery is and the light green areas. But if you got to that national scale of Louis, you have to go into industrial districts and for that use. We're just on that for my own understanding. So in terms of just what we see on the map and the green, it appears to heavily essentially parallel where there's already a lot of industrial use or we just basically hewing to where there's already industrial use and saying these are the this type of process is essentially industrial use. This is where we can have these types of facilities. You have exactly so the larger scale facilities that won't do like direct retail to customers, those will have to go in the industrial districts and then those businesses will sell products, other businesses, the businesses that do you know, their own cultivation and manufacturing with like the micro as a license. Those are the ones that could potentially be and the light green areas. And so what you might see as a business that's kind of similar to a craft brewery in the sense where that you have like a storefront from and then you might have cultivation and production in the back of the House and then they could directly retail those products to customers. In areas of the city where Tardies zone for comparable used basically. Yeah, okay. That's exactly just trying to get to other uses that can do some other things where they live producing products and then selling them directly to customers. And so what we did again was look to existing land uses and the zoning code amended amendments to those uses that can do a comparable. Thanks. Great. Thanks for helping me confirm that. Understanding it. We also did an amendment to provide for outdoor cultivation. This is something that we don't think would be very likely an urban environment. But we wanted to create a pathway for businesses to do that if it makes sense. So, for example, an urban environment, it might make sense to cultivation on a rooftop for something like that. But with outdoor cultivation were requiring a conditional use permit regardless of the size. So any proposal that comes in for outdoor cultivation will have to be approved, reviewed and approved by the planning Commission before they could day. So the planning Commission has held a public hearing on the site in June 7 at that public hearing. We have 4 people speak against the amendments as drafted and to commenters were in favor of the amendment distracted and and having reviewed those those comments on August. 2nd, the Planning Fish Commission voted unanimously to recommend approval of the proposed amendments so that I'd be happy to all taking questions and also put some links to some additional resources in case you're interested. So the league of Minnesota Cities put together a great FAQ of things. It could be good to check out and get into the fence kind of outside of the rounds on like out taxes and things like that word. And then we also put a link to CNN's website. So if you're not already on it, you can get signed up for a list to get updates for most em and the kind of track what's going on at the state level. Thanks so much to you, Mr. Johnson, to your entire team from the work to towns like to the council president's point. We're really nearing where commerce, a retailer currently allowed where industrial production are currently allowed. The only exception is that the 300 feet of schools prohibition beyond just being in a retail zone. That right? Yeah, that's correct. And the 300 feet for a little bit of context of something that we applied a different liquor licenses. And so we took that kind of existing precedent and then moved it over for cannabis retail. And otherwise we have no cap on the number of licenses are cap on our distance requirement between retail locations or license. Yep. That's correct. Yeah. Caps. So we cap is something we could potentially do what I'm proposing it as part of the zoning ordinance and there. Yeah, we're not proposing any distances between businesses. And then one final question. So in addition, this is the zoning in terms of where business cannabis that's this can locate. There's also a licensing process after that can use to speak a little bit to kind of a lot of us have constituents are very interested in this. Jan, what what is the licensing process going to? Sure, yes, of the licensing process. Again, it's going to be done through the state. And so the way the work is a business owner will need to apply for a license kind of based off of what they want to do and once they have the license, another license that they want to apply for, they'll need to get zoning approval from. So the comments I have this license, I want to do it at this location. Does that work if it does, will sign off on the zoning and then will issue a registration after the license is granted by Cosio. And so the department safety inspections will have no role and in the licensing, it'll just be the state. And yep, yep. So the what a the role that the U.S. I will have is on the registration side. So after they get the license, we have to do the registration as part of that process. That's how we collect registration fees and then also know where we have to do the compliance checks on all the businesses after their operating. All very helpful to parse to. I just started to internalize that this week because it is confusing. So it's okay. This is new. We're doing good. Think one thing at a time. Any other questions from council members? Is there going to be a second? Like coming votes when it comes particularly around the collecting the compliance of, you know, whatever I can find standards are. And also, do you have a idea of what we are pro rating at for his particularly for permits for this conditional permit and also like what we're charging for fees for restoration? Yeah, so I don't have that information at this time. That will be done again with us. I'm the lead at a later time. One of the things I believe they were waiting for was for the rulemaking to be done what just literally hot off the press were looking at it today and they're they're finalizing. So now that the rule meant the rules are finalized, I think the s I could and, you know, go ahead and start working on like the registration piece of this. But as of now, I don't have information about the fees. There's a range that we can charge, but I don't know exactly what where thinking about setting them at and I'd be happy again to follow up. We can follow up. Yes, I am trying to get some more information to you. Yeah, it strikes me that we could gather some initial questions from this. More on the what's next round, right? Like first we do the zoning that allows businesses to establish where they want to, but a brick and mortar location and then they'll go through licensing. The rulemaking to the state is getting finalized. The cold peace is happening. So happy to figure out how to get that information back. Council president and council members, thank you for the FAA to consider the ordinance amendment before you as noted. The department safety inspections a month couple months ago was approach. I want to play by the Union people and the science because the Minnesota about the same time for offering vicar service in care events throughout the facility. And so I'm looking at state statute city Ordinace. It really doesn't fit what's currently out there as a city. We can issue liquor license to a restaurant, a hotel theater, auto racing facility, convention centers, sports facility, busy and transit centers not on there. So clearly it's one of those things that we are looking at. How do we support them in doing this? There's clear interest in the market to have a variety of catered events at these 2 facilities that are wonderful facilities. Unfortunate currently ordinance in statue don't reflect the multi function, nature of it. The ultimate solution is to work with them to go to the state legislature and get a special for the late provision which a lot of the similar facilities have the the museum, a Russian or American Swedish Institute. All those have special provisions within statute which allows them to serve as we're looking for in this particular situation. So unfortunately, we are not in session right now. So we will be working with them once we get there and looking at supporting them through that process. In the meantime, we want to support them between now and then. So this is sort of one of those efforts to really support he assets in our community and continue the vibrancy of our city. So we're looking for today is some small ordinance amendment, which allows these 2 facilities to have unlimited number of catering events with that. It's fully within the state statute language. There's extra hurdles they have to go to and that that they can do between now and when they would get a special provision. But it allows and the star doing like a catering events throughout their facilities without it with without a limited number. So it's a really nice sort of stopgap protesters say, OK, let's support them. In the meantime, as we move forward to get to the legislature, it allows them to be stronger, financially supports the vibrancy of our city as well as the meets a need in the community. So in terms of the issue at play here, it's that Union Depot is a transit Center. Science Museum is a science museum, but they also have convention like events because the event space, but that's not recognized by statute. So this basically allows them to it reflects how they currently operate better while we work on that. Is that. Roughly just cruelly summarizing hear from an understanding but council president. But that was more than cruelly. That was very well done. So thank you. That's exactly what is multi function. How do we reflect that in statute in ordinance? Amazing. I will take the validation. It's getting to be more and more people are looking for unique venues. And I think the science Museum, they're working with new vendors who are coming in to do the service. And I've been talking with them about some of the potential Union Depot is going to sort of a facelift idea of looking at that. So it's really look at how do we support that vibrancy? And I think they're looking at how do we create more vibrancy for these community asset as well as what the market demands are? So I think that really growing and they're definitely unique spaces that would fit that. It was President. I appreciate that extra context. I think that's a question that we might anticipate getting from folks knowing that those 2 institutions have been around for a long time. I'm sponsoring this and clearly in support and big supporter of both of those institutions and want to make sure that they are able to continue to bring vibrancy to their spaces. That said, I don't love public policies that call out specific institutions as a matter of practice. And I'm willing to do it in this case because as you pointed out, Legislature is not in session. We don't want to under these businesses in the meantime, but I would ask that you and the department and in partnership with these institutions and others make sure that it's part of our legislative agenda this year to get the legislature to make the fixes that are necessary, not just for these institutions but for food halls, markets bases, other places where in the past we've had problems with liquor licenses. I think this is a good opportunity to make this benefit apply more generously across the city. Council president council maker and that's exactly the message that we want to take the legislature like when we approach approach food halls for King case was interest at the time. We said it's not just going to be for this one institution. We're going to write it such that any and any organizations from throughout the city can do it. Before we go into the public hearing, the testimony is warm. And is there a staff report you'd like to provide for this? I have stepped up her. Yes, this but this is an appeal of a vacant building registration. Notice the vacant building registration was sent out following a condemnation of the property due to an electric shut off. And several days later, a vacant building fell is open. After that, it was confirmed the electricity was back on and one problem remained. And that is that the person occupying the property is not a tenant with a lease and is not an owner. And the owners first gravy scanning records here, Gray D Randall past and 2008 and Mary Randall, the other honor past and May of 2023. A son was living in the property. The appellant is the Suns, former girlfriend because she has no legal authority to be there. And this property has not been probated. It is not in foreclosure. There is no one with C legal right to represent that they can engage in a lease with her. You know, it's just simply legally kind of an abandoned property. So the question then becomes she has to leave because the city can't allow an ongoing occupation by somebody who can't legally be there. And there is no one to provide that authority to continue to live in that property. If the siblings who presumably would inherit the estate if they were to probate the property and seek to gain ownership. That would be one thing. They haven't done that so far and they haven't shown interest in taking any steps. So it remains to them that way. I was told in the hearing by the appellant that there is a reversed market in place on the property if the mortgage or were to foreclose upon that mortgage. It is actually in Ramsey County, one-year redemption, time period associated with that kind of foreclosure rather than 6 months, redemption, time, period. So there's an extended periods of time for there could be a rectification either through foreclosure and perhaps purchase or an arrangement with a bank legally or with the estate legally. So the council is in in in rather awkward position. And as I recommending that at the vacated by September 3rd, I made that recommendation following my hearing on July 12th. So that was 7 and a half weeks ago. This hearing was delayed. The owner had to act and had trouble getting signed up to testify. So we did a continuance. You may want to extend that a little bit further based on that. It's it's coming right up, September 3rd, but to the difficulties that she is experiencing remain. I don't have more of a staff report. So I understand the the I understand that there's no like legal owner of the property currently alive and that that is that the legal status is in limbo. The property has not been inspected and there's no one with the authority to apply for a certificate of code compliance or allow access to the property, unfortunately. But the bank could come in and ask who was living with the occupants in the home, you know, on the reverse mortgage. And I was also listed with that think so. And so is Craig. And we did kind of form and return that to them and resigned as well when she was still alive. And she's the mother, one of the owners of the home. So and I-10 years to come cheers. And the only reason I take very good care of this property and the house and I mean, I'm I'm okay with anybody coming in looking inside here. It is very clean is very I you know, it's I have not I take care of the lawn. I mean, all of those things. So as my to my surprise, when I came back after allowing him to, you know, move out and not have differences between the 2 of us and just do it smoothly. I had was gone for 5 days. I think 4 or 5 days that was it. And when it came back, there was a notice posted. And since then it's been a nightmare. I mean, I Craig it and I only separated and everything. I mean, she is is thing was on this. I he knows that. I need to, you know, I just I'm going back to work now. I have to get the funds. I also have had kids and people helping me find housing. It's a domestic abuse situation that took place and he's so important off of that. And so that's what happened. He was not forced to leave the home or anything you want. There's no restraining order that I put on him to make him believe that was just something that she did on his own. So and the other thing I want to bring up is that the notice was posted in that was told by by the new legislative process that they were informed about the electricity being off. This electricity was off for less, then a month. I mean, just say hypothetically the day. So the most it. Human spine. I just want to interrupt you briefly. So I want to make sure that we're sticking to just what you're asking is today. And I've let the people of my I've let it run a little long, but I I'm actually very times we're starting to go another heat shield and the how your mask and how would you ask ask you? I would like to stay in this house until I can get into my own house and that's what I'm going to working toward. But I mean, putting me out, I Q a homeless situation isn't even okay. I mean, there's nothing do much to ease back on it. Very good care of this column. So I don't know why the city has come in and done this to begin with, because according to Xcel, they'd never they told me that they have. And I think that the issue at play is the who is legally entitled to ownership of the home. And that is something that I think is we need to get clarified. And then the second isn't hearing you loud and clear that you at least one time too leave without having to rush and everything. And I find that reason alone. I certainly want to be able to show you that. So so there's a potential. I mean, it weakened as a council extending all the time. You have to, you know, as a starting point and minutes, October, 1st, like September 3rd isn't seem realistic anymore. But I mean, would I guess I'm I'm interested in whether October 1st is something that you feel is workable. After in November now. So that's the problem. You know, I don't know how long this is going to be. I mean, I'm trying to get help from the housing people. But there isn't any reason, even the shelter that they could go through right now. I've lived here for 6 years. You know, I mean, this is crazy. I take very good care of this home. I'm here by myself. And then they're posting things outside the door, get an invite for homeless people. You know that scared me. I don't know that we go to break a window and tried to get in here. And I live in an area where that very prevalent. As prime time hearing you, I'm hearing you say that you would prefer sometime into November and hearing it that you want to take time to understand that your rights are to the property and it's clear that are in distress or do they do that? So is there anything else you want to know today? Well, yeah, I mean, I wanted to also that debt. Like you said, it wasn't a leader. There isn't any kind of a rental agreement. I'm I'm listed as a person living here with the reverse mortgage Bank. So there are aware of that. So I mean, there may not be a lead that they asked for this letter to be sent to them who lived at the property. We all signed it together in 2019, me Mary and Craig. I think that I'm just trying to buy understand this plan. Understand. I think the thing I'm trying to ascertain from what you're sharing is the bank communicate with you isn't necessarily the same as having but like legal property ownership of the property that's been trying to parse what you're sharing in real time. But there that is something that I would want to understand. I fully here you that you have been communicated with by the bank of fully here that I understand that the least I don't think is really the the question or the issue necessarily. It's that's the question that the the the lens by which we have to look at this, in addition to your human experiences, what does the law say about the ownership of the property? That's the stuff I'm trying to hold the same time. So. Why are you guys still involved? I do. What can I mean? I don't understand. The electricity is not that houses not inhabitable. It's a nice. I mean, I don't understand why you're even involved in this bind. The reason. The reason is because the vacant building registration notice was appealed and then appeals of this type of come to the council. So that is how it comes to us. This was not something that I sought out. This is actually just a procedural future that is for all types of situations. So I don't know why this is. I know we get this reversed and and stop. Additional time is I don't really see a downside to additional time. And I think that could be useful. But can we try to ascertain what is going on with the property ownership in what we've heard today? That was my mind. One main question coming out of this. I heard testimony that in 2019, a document was signed by Mary. I'm sorry, I should have this right hand and I and this place that and get on that documented indicated who is living there, her son and this time we're also listed as occupants at that time. That is how I interpret what I'm saying. But I have not had a chance to review the documents. So it was basically a and accounting the occupants, not like what you would see on a rental lease where there is maybe less sea and they would list their children, you know, and children don't have authority in this case. You know, they're not signing the lease, you know, and so on. There is actually a landlord there. And there isn't here. We have the vacant building registration, certainly, but we have no road too. Get the property inspected and issue a certificate of occupancy which would be necessary for non owner occupant to live there. There is not a path for the city to take. No one can apply for that because there is no legal representative of the property. So while she could continue to live there, if there were such a person an agreement and that would be no problem whatsoever. Without that we would be allowing occupancy against the fire see of code in a way. Because there is there a way this is registe on understand the procedure and I and other members have questions. We can go to those 2. But just to finish off my main question here, if she has information that she can bring forward that further substantiate her connection to the property, that somehow has found its way into our records yet. Is there a way to take additional information at this time to allow the just a staff of review like if there actually is just not enough information about her right to the property and we can create time for that to happen. How would that get reviewed and how would she be able to bring that forward, that documentation she's talking about? What I would suggest is that the council the matter over for a week and ordered that those documents, that document can be provided for review. And you may get a report back. I would suggest that you go ahead and close. The public hearing today heard that testimony about the document. At that. So I'm hearing that I'm gonna miss Kim. I'm formulating recognition, but let's keep the question's going. Go ahead and get started. On that line, this question is to our show. How many times have you met with live on time? How much time from sort of notification to council has has has this time this time had the ability to submit? Some people or her appeal with Ben filed, I believe the end of June. I can check that date. Her alleged that hearing was July 12th and today, of course, is August 28th. Okay. So no one is further exacerbate the plane, but in sort of wondering if said documentation exist and why it hasn't already been submitted. And that's not to say you can't MS like this paperwork, but just sort of wonder the existence of that documentation given the amount of time that this person has had to submit proof of some sort of residency in a property. This isn't necessarily a fully formulated thought, but it strikes me that the the mechanism here of the vacant building registration notice seems ill-fitting. This is not a vacant building. This is a fully occupied building that it doesn't seem to have code compliance issues except for a temporary shut off electricity which has since been restored. I recognize the issues of ownership be unclear and not having a certificate of occupancy for someone who's not the title donor, but that seems like a different process and perhaps a less anxiety producing process than having the vacant building registration notice ordered to vacate hanging over its head. And so I'm not making recommendations here. But and I guess asking more about is this the right mechanism to get to what we're trying to get to, which is clear title. I guess you have insight on that this moment. I would say this is one of 2 pounds to get to that and point the other path would be that there would be orders written by fire certificate of occupancy staff that there's habitation without it fire certificate of pocket can see and that the vacated because you cannot have a non owner occupied property in the city of Saint Paul about a fire see about. And so both both come to the same place and that the referral to the vacant building program. But it would be this is the one tool it could be that other 2 on this that tool because it was formerly owner occupied yes to ace. Goodness, Bowie. And then I see Miss Kim. If you got to prevent, I think an core in terms of. I don't think this is the best mechanism. I do understand our tools that we have very limited tools of how we handle this issue. But Ms curious around it sounds like there's a a state issue of a state that there the lack of estate of Michael will lack of a pathway of where its ownership will be transferred to is their way. Do we have any information from the the child, particularly I would assume what, how you can hear it that is there any information, particularly around what the children's plans are particularly around handling this state at the ownership of this property? Given that it's done since last May believe that died, I would say that they are certainly going slow and going through a probate process, understand there's multiple siblings and that there would need to be an understanding among them because they would all reasonably be considered inheritors. And so they would need to bring that forward is a part of the proceeding. I think that may be of less interest to them because there is a reverse mortgage on the property and going through all of those legal machinations. Still the fund with a check at the end of the day that's worth very much. And so there's maybe it turned for them, take taking fathering, you know, with respect to relationships with the children and this pie. And I only know that she testified that her ex, who is the son of the deceased donors does say she could be there. She indicated that others so things did not want her to be there. So no, they didn't testify and I don't have information from them, but that that's a part of that as well. So it's it's tricky, obviously. When you follow up for that around the ownership, understand it's in limbo right now because of the passing of the owners say if none of the children take possession of the mortgage or the home and it's just now and the ownership of the bank. Wear with that. Get us in terms of its. Does that change anything with us in terms of if its, if this is now, what would that be a pro quo share? And clearly she still would have to vacate that. Just wondering if there was a transfer of ownership to the siblings and they were to go through the certificate of occupancy is at a pathway forward that would get us out of this vacancy, the process. You would have an actual owner that who could execute leases and do other things to do as an honor. If that were to happen, if probate it's not pursued and the bank continues to hold this reversed markets. I believe it's likely they would foreclose upon it if they haven't initiated those proceedings already. I don't know that that mail would be delivered to the site because the owners are deceased. Then they would have. Physician title to the property and their their choice do with it. What they will see, we did experience and it's a bit of attention in the foreclosure crisis that banks would walk on properties. And they were also doing that financial calculation. Is that worth nearly one to go through the foreclosure process? It is worth my while to go through probate. And a lot of them are saying, no, I think with the property values the way they are right now, we have been seeing that in the market and I would fully expect that they would 6 title. Any other questions? Otherwise, I would like to suggest a recommendation and just floated for ideas I think would be helpful is if we could, I would do it. I would appreciate it weekly over so that my office can try to hunt down some information related to title ownership. The family situation like a lot of things that have come out of this. If by the end of that time, we've not been able to get additional information to Mormon and staff work about resolving the question of the properties ownership. Then I think that the track we need to move forward on is to at least since its procedurally in the vacant building, that registration appeal process. I would probably be looking at a lake in November, move out date so that she has time still to final tentative housing. If she wants to pursue the property under her own means he's entitled to do that. But in the meantime, the the code is excuse me. The occupancy issue is it is fun, functionally illegal. And so I don't think we have other means. But I think the layover would give us time to figure out what we're dealing with. So I would welcome thoughts on this. I think this is a really we're done unique situation on like which I've I've actually never dealt with a situation like this. And I want to be I would like to be compassionate to the fact that this very much affect some buddies, a home and time that they have to make a to make decisions. Well, also that we have to I make this decision with illegal. And so I'm looking for thoughts here. But this is my idea is can. Yeah, in another all those have certified housing counselor and worked with a lot of families through foreclosures. I just want to emphasize, I think I would certainly entertain support Ali, over the thing that you're sort of cracked were grappling with is the unknowing intense of the it potential inheritors of the property. It doesn't like anyone is actually you have to file a petition for probate otherwise they may not want to have the property like we just don't know their intent. So I would be willing to entertain to weekly over if we can get some sort of indication and my preference would be in writing that they have or intend to file a petition to and here the property. And it also support for giving the live on additional time to find and secure additional housing. But the bottom line for me is that there is no alive honor to consent, to renting to leasing to having someone in their property and technically once the bank takes it over this person is, I think, legally squatting. And so we need to even potentially now it is what we're hearing. So I just want to hold space for all of it. But at the end of the day, there's no legal owner to consent to any decision that we could or solution we could even potentially offer. So I would entertain a layover. That is, again, gets written consent from the potential inheritor that they're going to petition for probate and their intent to take the House. And if not that, I would also when you're ready, support the motion to extend, I think a more generous and grateful timeline for a lot of on to find additional housing. I appreciate that. And I think the layovers is fully to get. It is time for staff to get that information and try to understand what's going on. And I think 2 weeks would be plenty of time to do that without going too far. And case there was a recheck on February 12th to see whether or not those orders have been addressed upon reinspection. You can see that it it's a little bit that are not completely better. And also there's some more material here on reinspection. So the on and Specter did some through a work order to do the clean up the cleanup photos here. You can see a little bit of that before you can see tires. You can see some bags over there and a big stir in the previous poses for black eggs. Only know what's a few black bags and wait aches. That's also not on my property. That is I've been in contact with Metro Transit's, a building and sites. They mourn all the all the moved all the brush from the from the university side and piled up the bags. And I was killed in December's tax assessment for at least $1100. Special assessment with the same pictures that you see here today. And I was being reassessed currently using the same pictures for $800 for the cleanup is since we've had the special hearing. I met with my neighbors. My tenants is a major problem in the neighborhood waiting cameras, security. There's a number of please support me chasing people out of their illegal dumping. Have one person follow my. This is partner son back to the House. The company truck and they stole the vehicle from this house was ended up being rolled over on. I-94 several weeks later. I'm doing everything I can. I'm asking for this is all I mean, the pollution porch chases out of there. I've been jumped once several entries. The neighbors are fed up with it. I need the city's help deal with this. The request for the recommendation I believe was to give what was it the recognition and extra month of time ideally to begin to work toward that? Is that what? And what it's like. I said the pictures here was metro changes. Garbage on Metro Transit property, not my property. I keep bill for it and I'm tired. I know of it for several cleanups and the city come and dump in my dumpster. Sites are removed by a 2 yard dumpster on safe because the sea was coming in dumping it when they did, they likely don't know is going their own Sullivan 100 all week overload charges on a 3 yard dumpster and I pulled the dumpster and went to all camps. I want a security fence up defining my property line. I've had several friends companies coming out there saying I need special assessments and that had not had a single one of them. Come back with that for a fence. I'm looking for help. The initial recommendation of just more time in order to work toward solutions. What would be your if you have request be on time right now? Like when used to help with its not my trash. I e. I have the text messages from a building management that president of light rail. I contacted 3 fence company is putting up the security fence to keep the problem from coming into my parking lot. I am on site every other week point rational there that's illegally dumped like Russian stuff. I have a dumpster. You can't go to a Ramsey County. Even a and these are private dumpsters, as you know, the private dumpster. And then my last question is around. You mentioned you have security cameras since you have put up. I haven't have security cameras on say they do have one covering the main entrance. But mice, my renters wonders a stream and this works and easy. Traitor have a camera set up in the lot. And since this incident, have you seen in the on your camera? I don't think I've actually physically followed vehicles. All called police officers was told to stop following that truck that was falling, ended up being stolen uhaul that they were just throwing stuff out the back by that wall. And they said stop only when we got on camera and I stopped all I've been jumped behind the building, a homemade business partner song which I hope for is head on footage. I'd say Paul police, there are people they're kidding themselves in the common area doorway and as saying as they walked away and came and the building, police said what we did see a minute property. So I would one thing I do suggest is is having a conversation with with the police department to see if they could even do some sort of it's not study, but we can report to see what can be done to mitigate the illegal dumping there and also to check in on what what property owners and tenants can do to deter that activity from happening to. And I have a question for Marcia, like the pen at the lengthy mention that that Metro Transit has been. Dumping trash onto their onto Metro transit property. But I'm just a bit confused because when I look at the map here, me, I see the property, which is to 98 University Avenue West. But is there a better chance of property that used to using us as well if they actually own an adjacent parcel? So it's not a transit associate with the green line about says its stand on the ship. The S and who who owns the adjacent property to transmit ran said, OK, and can you verify the lake has this resident or the property owner been getting billed for Metro Transit? And this did not come up in the hearing. So I don't have information except for the assessment that's in front of you today. And that assessment information did a line in my view.
