going to um go into resolution 22416 for the uh tropical storm which is now hurricane Milton okay and I will read the title and then I need a motion to adopt 20246 a resolution of the city Commission of the city of St Pete Beach Florida declaring a state of emergency in order to protect the health safety and Welfare of the community and property both public and private from the hazards of tropical storm Milton and providing for an effective date we have a motion to adopt the resolution motion to adopt the resolution Second City Clerk if you please do a roll call commissioner Riki yes vice mayor mahand yes commissioner Marriott yes commissioner Robinson yes mayor patrilla yes motion carries thank you which one's the next item please um this would be the PSTA amendment that attorney Dickman asked to add please okay Mr deckman yes thank thank you um after you all approved your the PSTA agreement we were contacted by PSTA um about a clause that they they believe is necessary have in their contracts just in general and I emailed it to you this morning I didn't know if you got it or not but it essentially reads um this is item six miscellaneous the parties agree that a certification under Section 90811 Florida statute is not required for this service as PSTA is not a common carrier as defined under the statute this statute has to do with um uh common carriers that would might or may transport uh undocumented aliens across state lines of course psca is a special district confined to pelis County so I doubt the trolley or anything related to what we're Contracting with them is going to be going across state lines um but I didn't want to just add this since it does reference a statute I thought in an abundance of caution we would go ahead and just ratify this amendment so I can get in and sign the agreement since I'm not sure if you're going to have a meeting tomorrow night or when the next time we're going to have a chance to meet okay thoughts comments discussion is there a motion I have motion to approve the change um on the agreement for PSTA second say clerk if you'll please through a roll call vice mayor mahand yes commissioner Marriott yes commissioner Robinson yes commissioner R niiki yes mayor patrilla yes motion carries thank you than you mayor the city manager and I are talking about cancelling tomorrow's meeting and we wanted to understand what your perspective was on that I think it'd be prudent for us to cancel that meeting um maybe we can set a new date for next Monday or Tuesday sure tent how about we tentatively put it on for seven days and then if we do seven days from today we'll continue to follow the statutory requirement for the 7-Day uh emergency renewal so I think that would be best because this Milton will be seven days on Mondays and helain is seven days on Tuesdays so if we do Monday we can get we can capture them both like we did today okay so I'll work on that later on this afternoon thank you thank you also related to that I wanted to let you know that we are working with um uh Mr degman to and his colleagues to basically modify this ordinance of emergency declarations to follow a pattern of the next regularly scheduled meeting so that we're not bound by this 7day um clock which is creating quite a bit of administrative backend and then also having to call you in for meetings based on the Cadence we're going to be in for a very long time in the foreseeable future if that's something you meable as well thank you okay okay anything else further for today no nothing else okay in that case we are adjourned thank you for
