you very much good evening it's wonderful to see every body here tonight dear God master of the universe as the world we live in is changing rapidly We Stand humbled before you this evening and we recognize all of your blessings that you have bestowed upon us we are mindful of the fact you have blessed the city with wonderful leadership Direction dedication and a guiding Spirit which has resulted in many successful achievements over the last 20 six years we recognize that we are gathered before you this evening in pursuit of fulfilling your wishes as you dear God empowered Humanity with seven basic universal laws after the great flood of Noah these laws were once again reaffirmed by Moses at Mount Si to be taught to all of humanity universal laws that provide a framework of law order and Justice which will allow Humanity to settle the Earth in a civil ized manner we recognize that we have been entrusted by the citizens of Sunny is Beach to perform this sacred Duty as we stand today before the approaching holiday of porm which teaches us that we should never despair even by the most challenging circumstances we pledge to lead by spreading more goodness kindness and justice for the benefit of humanity almighty God please provide us with the Consciousness to constantly be aware of your presence so that we are consistent to our mandate please grant us the wisdom amen amen amen thank you where okay the first item uh do you want to play the opening statement please good evening ladies and gentlemen we appreciate your attendance and thank you for joining us tonight before we begin there are a few important reminders regarding conduct during our commission meetings please ensure all electronic devices are turned off or set to silent mode to maintain the Integrity of our proceedings mutual respect is a foundation of productive discussions we ask that everyone remains silent and attentive when someone is addressing the commission clapping applauding heckling or any verbal Outburst either in support or opposition of the speaker are strictly prohibited any individual wishing to address the commission must fill out a public speaker's card and submit it to the city clerk before the relevant item is announced each speaker is granted a maximum of 3 minutes should you exceed this time the chair will notify you to conclude your remarks speak directly to the agenda's points remain concise and avoid redundancy should an individual speak without the chair's permission or continue speaking after a warning they may be escorted out of the chambers it is act fund capital projects fund and stormw water Capital fund authorizing the city manager to do all things necessary to implement the terms and conditions of this this ordinance providing for an effective date and this is second and final reading Mr city manager mayor vice mayor members of the commission this is a second reading of our ordinance for standard uh approval for a budget amendment now into resolutions 10A is a resolution approving the combined voluntary cooperation and operational assistance Mutual Aid agreement between the city of s Al Beach and the town of medley mayor vice mayor members of the commission this is a mutual Aid agreement between our police department and the town of medley we have a number of these Mutual Aid agreements great thank you do we have any public speakers marce no ma'am we have any comments or questions from the commission no I'll take a motion please so mov great thank you all in favor next item please 10 C is a resolution ratifying an agreement with Southeastern surfaces and equipment to replace the hardwood floor in the Pelican Community Park gymnasium and authorizing the expenditure of budgeted funds for the purchase and installation of a new gym current divider and two electronic scoreboards great thank you Mr city manager mayor vice mayor members of the commission this is ratifying an agreement we're going to be replacing the floor and the PCP gym and we're going to do that over this summer and years's past we've just done maintenance but this is actually going to be a replacement of the floor we're also going to install a new gy curtain divider and two electronic scoreboards okay and do we have any public speakers comments or questions from the commission I'd just like to make it clear that um these uh this flooring goes through sanding operations each year or so and um this the life of this flooring is at its limit and it's uh thin as soon as much as it could be and it requires replacement Mr stavon you had something yeah um I want to clarify that it's going to take between six and eight weeks right s kind of yes ma'am okay and it's going to be during the summer so it's not going to be used for summer break and we are going to have the spot available for summer camp yes yes and also uh today we got the news that the H basketball and volleyball is going to start also you guys are going to find in finally build that facility outside the spot also for the teenagers right yes okay so I just want to put it out there for the people to know that we are not taking anything from resolution approving a Second Amendment to the project agreement with Keith and Associates for civil engineering and Landscaping architectural services for Bell Vista Park manager mayor vice mayor members of the commission this is a second amendment with Keith and Associates were required to do some additional civil engineering work for Bell Vista Park regarding a submerged land lease and some approving an agreement with Advanced Roofing to provide Citywide emergency roof inspection maintenance and repair services as needed mayor vice mayor members of the commission this is approval of an agreement with a roofing company for Citywide emergency roof inspection maintenance and repair it's part of our ongoing maintenance of our facilities just for clarification which which facilities does this include this includes Government Center Gateway pelican communic pelican community park right do we have any public speakers mauriceo no ma'am any questions from the commission and um no Mr city resolution approving a Fourth Amendment to the agreement with Craig a Smith and Associates for Civil Engineering Services for the central island area Pump Station and drain improvements project mayor vice mayor members of the commission we've put this project out to bid two different times now and the differences in the bids we've received are upwards of $10 million so what we're going to do is we're going to ask that we go back to our engineering consultant and we have a different way that we believe we can approach the drainage this is for central island drainage where it's possible that we can install a couple of mini lift stations versus two substantial lift stations so if we're able to do it from engineering it could save us a substantial amount of money but we need to have the engineering company review it it first and for clarification if you could just let everyone know where central island is central island is 174 to 183 great do we have any public speakers Mar no ma'am any questions or comments from the commission I'll take a motion any need a second second all in favor I okay thank you 10g is a resolution approving a First Amendment to the parking license agreement between the city of s's Beach and 18975 Collins Condominium Association mayor vice mayor members of the commission this is more commonly known as Armani the agreement we want to enter into is for them to park some additional cars at under the William Layman they had requested 50 additional spaces we were able to accommodate 10 and the price would be $257 per space per month we also built into the agreement that we could terminate with 30 days notice great any public speakers no ma'am any questions or comments from the commission no I'll take a motion so move I need a second second all in favor I I I okay next item 10 H is a resolution directing the city manager to create and maintain in the city's case program a Hebrew club for children age 6 through 11 years so This was um something that we discussed at our last Commission meeting um Toby Baron who's here had uh come to the city and to members of this commission requesting that we include uh Hebrew Club much like uh she already maintains with the public library and has been doing for quite a few years um and basically what we decided as a commission in this in the last meeting was that we were going to um direct staff to include that Hebrew Club in our aftercare or whatever what otherwise is known as the case program do we have any public speakers no public speakers okay do we have any questions or comments from the commission okay I do okay so at the last um last month's meeting uh we I raised concerns about the the legality of of having because here's there's the the legal concerns about having religious instruction through the city which is what I understand heu Club is and at the agenda meeting on Tuesday I asked to Define because if we're going to go with whatever is being done in the library I don't know what that is and I think it's better to Define what that is um rather than be referencing a program that really is not City run anyway and so if we're going to go with with including a a Hebrew uh program through uh Pelican then I would like us to Define what that is um specifically as I raced in my previous comments last month the absence of religious content but more Hebrew culturally uh history um but no use of um of religious texts or prayer uh the um City attorney gave us a a brief that I've read and you guys have had now more time to read it I've yet to hear any case law that negates any of that um and I don't think that we've properly addressed the presence of that religious component or the possibility of religious components within that Hebrew Club so that's still my primary concern the secondary concern is how this impacts the the weight list I didn't understand until very recently that while this uh conversation was going on like in the in the background trying to see how we could make this happen that the families that were on the wait list could have started after care in January and and instead we we kept investigating this issue so now we have families who were not being serviced and will not be serviced if we keep it in the in the manner that has been discussed because then this program that does not run until 6 o' and it does not run every day will will be taking up the one room that we have to service more families I I'm trying to be as clear as I can without rehashing everything but that's a piece that I did not understand until maybe last week how the weight list plays out with with this intersection and what um Gail presented at the workshop was a hybrid option of having a week-long program that's open up to the weight list so more families can come in but that includes the Hebrew component and I like that because we're servicing as many families as possible and we're able to also explore the Hebrew piece of it so I don't think this resolution addresses that and I'd like to discuss that or consider that before we pass a resolution I I want to respond um because this is my item so I want to make sure that I respond to to your concerns because I I I can appreciate that you have the concerns I think that the reason that the language of at like in the library was because it has been already a tried and true uh program that has been acceptable to the Miami day County Library um and many of our residents use it in fact uh yesterday they had an event I stopped by um Susan was there we had I they took up half of the library um and regarding the the the logistics of it the the details I hesitate to get to to that point as far as us as a commission having to worry about the details the staff is really tasked with that and for instance um again like you I didn't realize a lot of things but I almost feel like I don't need to know that level of detail for instance the K through one uh which would be on Mondays is not a problem because that room is available and those because those kids get out earlier so part of that problem is already solved uh and again it's more for us to pass the resolution and allow staff to figure out how to make it work and would this resolution allow for that hybrid option of of of being like what uh around the world or a do you understand what I'm saying no I I I do I I want to give others a chance to speak as well uh uh so we don't monopolize the entire conversation my issue is I don't understand in the manner as done in the library and I don't see why we have to adopt that as an explanation when we can Define it ourselves so if we're going to I'm not saying it's not tried and true I'm not saying that I'm just saying we should spell it out for ourselves I don't in the memo and in whatever else I don't see that so I'm not opposed to it I just think it could be better defined um and I'm not hearing I just don't want to leave out those other families and I want to make sure that there is no religious instruction I don't think those other families would be left out because it's up to the staff to be able to figure out programming for them uh I have not had anyone approach me with a request for cultural around the world kind of programming that's why this is agree me either I've had people approach me for after care right and this could still in in speaking with Susan this could still work if the staff was able to go back and figure it out especially since K through but but is the goal the I is I want to make sure that we understand what the goal is here is the goal to accommodate as many families as possible or is the goal to create the the opportunity for uh the the Hebrew component and everything else is secondary well I I'd like to hear from the rest of the commission because I think that it go it can be both does anyone have any questions I'll say that originally when this was brought up um it was uh um brought to us with the idea of trying to follow uh the a Aventura model and I still believe since the Aventura model does not have any um governmental opposition as far as um the Constitution I believe that we can follow that model and that our staff can arrange to follow that model and um have have what we're looking to accomplish okay commissioner sson I I don't understand the connection of the club with the waiting list that that I don't get it to be honest you know and the other thing is that we never been part of the details of the logistic about how much is any club how much um the time the schedule the people that going to be hiring if anything for example I have any conversation specifically about volleyball and and I have many residents asking me to make sure that our resident had the priority for volleyball and now people coming from everywhere you know and I know the the the excuses that they do the try outs and there is a competition team Etc but I actually believe that we should mandate to have an uh priority for the residents and that when until the last girl that wants to be part of the volleyball can be part of it then we can open for the press so and still we have never been part of that conversation so we never been part of that those details even though that we might have a strong opinions about it like volleyball specifically so I don't I really don't understand what why is this coming to us I am in favor of the Hebrew club I'm okay with that um and I don't know what they're bringing honestly the staff this to us when we never been part of this conversation and we do all receive like we all live here and we all receive like issues about Hebrew Club or volleyball like I said or anything else you know so my point is that um I don't get the connection I don't know how the Hebrew Club is affecting is affecting the the waiting list I don't get it at all um and we never been part of that conversation so I don't know what that what is this being being brought to us at this point yeah okay I just want yeah thank you so just a couple comments I think the uh religious component was addressed in the uh in the resolution um on on our Tuesday agenda review it you know um it was mentioned about the waiting list and the Tuesday um agenda review it was mentioned that if we pass this resolution that perhaps the kids are on the waiting list for the case right program could be left out with the way the Hebrew Club is is is structured or is thought of at the moment so I just want to have that clear in my mind and I think we this is something we need to discuss and make sure that right now as it stands if we pass this resolution I want a yes or no answer does that mean that we exclude other kids yes or no from the from the waiting list I think that the I mean I need to have this clear but here's the thing I I think that this is going to commissioner ston point we don't discuss any other programming to this level of details so I don't think it's incumbent on us or the City attorney to answer that question no I understand but it it it it was an issue it was a point that was brought up on our Tuesday agenda review that we could leave these kids out so I just want to make sure that it works for everybody you know I want the Hebrew Club but it needs to be structured in a way where it doesn't create another issue because this is coming to us because the way it was approved back in October or November uh without our knowledge uh created an issue so I don't want to kind of repeat history and for us to approve something and then be in a position 3 months later where we have another issue you know so I think we need to be clear and concise and make this work but you know what be be assertive and have a clear understanding on how this is going to be implemented I mean I want to make it work but I think that that answer I understand that staff needs to implement it and don't need to worry about that but in a way we do need to worry about that because um I want to understand what's going to happen with the these kids that are on the waiting list so um if if somebody could a address that point I let me try to explain wait hold hold on commissioner M I just want to give everyone a chance in order uh commissioner Joseph yes but but we have never been involved with um directing staff how to organize something we have not but now now this this has come to us because it was originally done the wrong way so I want to make sure that it's not it's done right this time that's my whole intent for it to to be done right and to work for the short and the long term and for many many years to come because I don't want this to come back to us again I don't think we could have guarantees of okay can I just address go ahead just address the one point with why this is before you so um you're right typically these items don't come before you uh however my understanding and the city manager can allude to it but there were various ways they tried to work it out on how to implement it and those were all rejected so it got to a point where City management was at a loss as to how to proceed forward logistically on how to do this and therefore it was brought to your attention and also because it was management choice not to do it and he needed to be the city manager needed to be directed to do that so that's why you have a resolution before you because staff and you can correct me if I'm wrong is still advocating not advocating but not wanting to proceed in the case program with the Hebrew club and therefore he's being directed to do that and that's why you have a resolution before you and I think they still need guidance as to how to implement it depending on what it's going to be the component of the Hebrew Club so so can we can we draft a resolution with some sort of amendment saying that we'll pass the Hebrew Club but we need to make sure that all case uh people that are signed up or on the waiting list for case are going to be um are going to be able to you know uh register for case that they're not going to be excluded can we do something like as amended vice mayor I want to give commissioner s a chance because she wanted to say something you are so I regarding this the amendment that I would then suggest and I can't make that motion is it doesn't need to be part of case it could be treated just like karate like for instance we have karate we can say how many kids are being excluded because that room is being used by karate again the going into this level of detail is assuming that it's not going to be popular and if it's not popular then it doesn't stay my understanding is that that was one of the suggestions to take it out of case but that was rejected but karate is already in the case program it's part of it no but it's but it's um first of all it's after hours anyway it's at it starts at at five or at six or whatever and the the issue here is you have one room left in which to add programming that's all we have during those school hours and so if we Implement a program let's say it's Mondays and Wednesdays because we're not talking about Hebrew Club being 2 to six Monday Friday this is not a Monday through Friday program so if you just implement it Mondays and Wednesdays okay but then you're not providing the five-day after CARE program that the people on the weight list need that's that's the conflict if we had multiple rooms this wouldn't be a conflict If This Were Hebrew Club at 6 o'cl or at 7 o'cl you know like karate then there's no conflict because there's room the problem is the the the intersection of the you know wanting to be in Pelican Park at those particular hours you're you're using up that room for those hours we'll call it Monday and Wednesday for now whatever it is but it's not for five days so by eliminating those time slots you're blocking out basically that block of programming for those 5 days because it's being requested in Pelican now if they wanted to do it you know in in a a different hour or here in the in the room in our meeting room where the bridge people are right now um then we wouldn't have that conflict but that was also rejected because that was offered in the previous conversations so the problem is having it that's why we're H we're having this conversation well we're having the conversation because it was brought to us right uh if it had been worked worked out without us we wouldn't be here but the things that were proposed were not acceptable so we bring it here and now we're hashing it out but that's the conflict that my make making sense yes you are and I think that rather than because I think we spent about an hour on this the last commission meeting so I just I I trust staff to be able to figure it out and if they come back to us and say this is you know you're going to have to spend $6 million on building a building just to make this work then we can talk about it at that time um but I I actually believe believe the same like um staff can figure it out I we never got to that level of detail of knowing how many rooms are left what is being available or what is not if they have enough staff for the children in the waiting list again we never been part of this conversation so I don't know also if what we are receiving right now um how accurate it is to to the reality so the point that we never been part of it and we are part of it right now is a l be uncomfortable for me uh because if we have a room left or available then I want to know since when it's available and if we have the staff in the room why we don't have the kids in in in after care that right now and then we figure this out or they can figure this out and add it as well so I I it feel like we are sequestering a room for this and I don't know if that is true I I I clearly don't believe it's like that I believe it the room is available the children are waiting for the for the service and we have the staff then shame on us on not having right now that program open so I don't want to shame anybody I'm not going to ask this is not a question so I am I want to trust that the staff is doing the best that they can with the resources that they have and I trust they're doing it and and and if the room is available perhaps is that we don't have enough staff or whatever so I don't want to go into the details of what's going on or what how they're doing things because we never been part of that conversation I fully trust the staff is doing the best that they can and I'm for the Club the same way that I'm okay with having a Russian theater or having many other programs I'm I'm I'm perfectly fine with it okay I I think that we've have enough debate and I'd like to take a motion unless you'd like to I'll make the motion okay I need a second okay all in favor I I'd like to defer I think we need more time to think about this and I think it needs to be done right so that we don't have this issue three months down the road we put put our heads together staff comes to us with a solution because we don't need to repeat this mistake again I I think this needs to be done the right way I understand vice mayor but we have a motion in a second right now and if I may just add so if you you're sending you trust staff to go forward with it the issue is if it's something that you don't AG it's going to have to come back to you because staff from what they're telling me and again the city manager can speak to it but they've said they've exhausted their options and none of them have worked um so to the extent that they put something forward are they going to need your approval to go forward or the manager has discretion at this point to move forward as he pleases because that would need to be included in the resolution because right now it doesn't say that I trust the staff can figure it out okay so then we'll we'll I'll need to amend the resolution to basically leave it to staff to created in the manner that they believe works and if that's a hybrid program like Gail presented at the agenda meeting on Tuesday that would that would be acceptable or are we goingon to have to come back here's here's why I I keep saying I I trust staff because I had a conversation with uh the deputy manager yesterday when I was at the program at the perm program she uh was gracious enough to go down and look at it so she had an idea of you know how many kids were there uh some of the parents are here in the audience and the she did start a conversation with with Mrs uh Baron and through that single conversation it was already determined that there was a partial solution uh that would work for both for both the city and for Mrs Baron and and that would be a benefit to the residents so that's why share can you share what that is the the K the K and uh one kids because they get out earlier that room is completely available it's not being used so those that choose to to sign up for that program can sign up for that program so the K1 from from two to three from two to three that room is completely empty okay so for those students and so the idea is the program opens and zero kids sign up okay well we don't do it or 30 kids sign up then we realize now we have to relook or not we staff needs to relook at you know how the programming is managed again it's the the this level of detail is to me somewhat alarming because I don't want to have to go through every single program that we have and we wouldn't have to this we're talking about this because I didn't put it on the agenda right that's how we're talking about it right one of us put it on the agenda I put it on the agenda for the purpose and that's why we're having this conversation because it could it didn't get because it didn't get worked out with staff prior all right so we uh Mr city manager we have a motion in a second based on the current uh based on the current uh resolution and then based on your conversation I would suggest the following language uh the city commission hereby directs the city manager to create and maintain a Hebrew C for inclusion in the city's case program for children age 6 through 11 years uh as generally described here in in the matter to be decided by the city manager or determined by the city manager if I can just because that says six kindergarten is fifth five years old so that needs to be the reason I took these ages is because those are the ages published by the library so that's why five it's kindergarten is five 5 to 11 and yes and to allow for me to for it to allow as much room as possible for the manager and the staff to do what they need to do it could be either case or a standalone uh program like karate or gymnastics or whatever so either stand alone or case so hybrid is out well case whatever it is that they decide okay so that would that would include hybrid case includes hybrid okay that's so we'll we'll make the changes to the language and the resolution so if you move forward and vote on it it's as amended so so that would I'm sorry that would resolve your concerns Alex wait let the vice mayor go ahead yeah I just wanted to make sure that that will resolve some of the concerns and will be inclusive of you know the other kids that are on on the waiting list well the changes to the resolution will allow the city greatest police department and that comes from the top as Madame mayor and uh Commissioners city manager chief of police you know you just watching the news last few days and got to me in the news this is the most one of the most professional police departments that I got to see in the news or outside the news witnesses myself as s police department and I'm very grateful for it and I'm looking baser I live at 18911 Collins Avenue uh at the last meeting the city council spent a great deal of time on an issue that was peculiar uh that issue of course being uh commissioner Jerry uh sir can just make sure no names you just address everything to me one of the Commissioners uh being denied a chance to take uh pictures of himself with a horse at Gulf Stream uh this was unexpected I'm sure the other members of the public were equally baffled by this uh about why the city council is wasting its time on this uh nonsense and uh why City Council meetings are turning into a clown show I would think that our commissioners are laser beam focused on issues that are of concern return to the residents of Sunny Isles uh for example we have had a Spate of car thefts in our buildings as I'm sure you have heard uh we've got traffic problems on Collins Avenue uh we expect our state and local property taxes to go up uh in the near future if they haven't already um the world is on fire our president's brain has gone aw well now I understand that some of these issues are not within the purview of the city council nonetheless uh the issue of a commissioner and a horse are probably not what animates most residents of sun is uh as a concerned Citizen and a member of the community uh I can say with certainty that nobody really gives a damn about the grave Injustice and the cosmic uh unfairness of uh uh being denied a picture of himself with a horse um with all due respect I mean the entire discussion last time that you all spent about 30 minutes on is infantile drible it is childish it is narcissistic and it is Unworthy of those who decided to go this route uh so to conclude uh perhaps some members of the commission uh need to re-evaluate uh why they're here why we need adults in the room perhaps why they're not the best adults for this role um and whether they really want to be here in the first place if their primary concern is how they look next to a horse on a in Sunny Al Beach and North Bay I'm here to um ask for help um we are having a big problems at our school and it looks like the the PTA is continuing to do this to us um I am just a regular parent I I'm I was new to the school I joined the PTSA in to um do things with my kids and with other kids and to help you know just create all these events and and do things that were good for the school and everybody else in it with the teachers as well and then um it looks like we're we're getting retaliated on we were placed on pause even before we started um we didn't even get to start in the beginning of the year and you know I looked at the budget and when I brought the budget up things started to um get a little bit difficult uh we were they were making accusations to um members in the board um that were in that in that um PTSA uh board from the year 2023 to 2024 now keep in mind we didn't even start yet um it was just the beginning of the year and um we were just new to this you know we had new parents in here and something went on uh last Wednesday and we have been sounding alarms to the principal we've been asking help mayor I'm sorry to interrupt just and I apologize uh just I I wanted to just caution you to the extent that it any comments are made towards the events of last week I just wanted to caution the commission uh because there was criminal process initiated at that event and there's other issues dealing with potentially the city that I don't want to get into on the day that I would just recommend to the commission not comment make any comments regarding that incident thank you my apologies you you still have the same amount of time go ahead okay yeah so I I just really want to ask for help I'm trying to understand why this PTA PTSA organization is allowed to harass um people that were on the board and to continue to spread U misinformation and although we asked for help we asked for help many times to show this investigation many many weeks ago and they seem to find it acceptable to do um newsletters to about a thousand people twice one accusing the previous Board of doing some improper activities and then another one today uh also again to th000 people and the board members are no longer part of this board we had quit and um it seems to continue to to go into that route we were speaking on Wednesday uh asking questions about the budget asking questions about how come the meeting wasn't conducted properly in the year of the 2023 2024 election um this was last year and and um we were getting um pulled out of the meeting by our own um our own president in our our own PTSA I'm wondering why why is this allowed to happen we're in a school with kids we're forced to pay this organization money why are we forced to pay this organization money we don't want this organization our school they're taking our money and what do I mean by that we're forced because when there are events in the schools like dress down oh sorry is is it a way that um if you can just finish up now okay yeah uh we're forced to pay the money because of dress Downs that are in our school cuz otherwise our kids cannot participate in that and that money is going around the world commissioner Member of Parliament they have already stood up against this atrocity and then for that reason many cities around the world they in order to make a point in this for this occasion they change the name of the U park or the change of the street including mayor of Frankfurt asked for changing the name of the street and it was approved by the commissioner and by the city in Vienna the same in Los Angeles the same OVA the same and uh in Toronto as well for that reason I thought since there is a Access Road in s since I'm living during the winter time I thought it would be a good idea for the city of Sunny Isle to participate in this Progressive approach to the life of humanity and women I think this is not just me for me I thought i' bring it to your attention is if if you if you want to do that do it if you don't want to do it it's up to you I think is the increase the level of the city to to the uh humanity and Progressive City that the or city Sun C concern about the uh freedom and life freedom and life for human the the women that's why the the uh the name they say uh women life freedom for that reason I brought this attention to all of your commissioner and of course uh the uh mayor uh and I started from last year I already sent a lot of information and I was was so happy that mayor of Sunny Isle actually informed he was informed everything and he she said no we know what's going on in this situation then I'm so appreciate if you donate access road from Collins wood to uh ocean to Atlantic Ocean which means that the spirit the spirit of M amini and the other 500 people died on this street in tan and other cities that spirit is going to be live and connected to the ocean that's it thank you very much thank you we're going to come down and present you within more and take a picture please thank you very much okay um commissioner s marce your next item please um next item will be mayor Cava is not yet here so we're going to keep going down to 2B which is the legislative update moving legislative update to B to B um Yes she'll be next we have so as a part part of the legislative advocacy efforts that we're making I thought that it would be appropriate to let everybody know where the the uh bills that we either supported or opposed as a commission how they did and where we are with them so I this will be brief um you the first one we did was the um alternative Mobility funding systems and impact fees we uh supported that and uh it when way it passed um the uh verification of eligibility for homestead exemption for certain um War veterans we supported that and it passed not all of these passed in their form some some of it was their companion uh um bills but it got done the car racing uh penalties also went our way uh Florida's women historical Market initiative uh did did not uh it died in um in the Appropriations Committee the residential building permits which we opposed uh unfortunately passed and um hopefully there's still some fight left in that the um Community associations uh was one that we supported heavily and that also passed and the um sovereign immunity suits against government we oppos that one and that one did not pass so for the most part we were on the winning side of things the way that we wanted them but the governor hasn't signed all of these are still pending but this is where we are in terms of uh the the legislative process in terms of the the house and the Senate so things either passed or failed and the things then they've been sent to the governor and we are um we are then awaiting that so we hopefully when our legislators come forward that you know it'll be U they'll have the the final chapter of the story uh and that's um that's my update thank you commissioner viscar and I understand you invited uh representative basabi who's going to be coming probably next month or so to to come yes he um he intended to come today but then because things are not completely where he didn't want to come in and not give a complete report yes so he'll come back when things are when the governor has signed or or vetoed all right you'll keep us posted thank you you very much for giving us the opportunity to present to you my name is Monica Diaz I'm the public involvement consultant representing the Florida Department of Transportation Commissioners and Madame mayor thank you again for allowing us to present to you this afternoon what we are going to present tonight at our hearing this hearing is going to be in the first floor meeting room starting at 6 pm and it Al it is also available online for the residents to come um we will share the website and we've been promoting this throughout your community for a few a month now so this project is for the Florida Department of Transportation Atlantic aisle at West of State Road A1A Bridge number 87421 18 this is a project development in environment PD study the public hearing is for financial management project number 43029 D2 d2202 and federal aid number d6210 B this environmental study has been conducted by fdot district 6 in compliance with all applicable federal environmental laws and pursuant to 23 us code section 327 and the implementing memorandum of understanding between fdot and the Federal Highway Administration signed on May 26 2022 the FD Office of Environmental Management in Tallahassee is the approving Authority we've gone through many public involvement for this and we're finally at the stage where we are at the hearing so it's an exciting moment for this project public participation for this project in hearing is solicited without regard to race color national origin age sex religion disability or family status persons wishing to express their concerns relative to fdot compliance with title 6 May do so by contacting the fdot title 6 Representatives they're shown here on this screen this public hearing is being conducted in accordance with the federal and state requirements shown on this slide on this next slide I'm going to go over for tonight's format of the hearing what's to be expected there are three primary components of the public hearing first is an open house which will occur prior to this presentation where members of the public are invited to view the project displays and to speak directly with the project team and provide comments in writing or to the court reporter that will be there this evening second this presentation which will explain the project purpose in need study Alternatives the preferred alternative and the potential benefits and or adverse social economic and environmental impacts and anticipated costs third the public hearing serves an official as an official forum for providing the opportunity for members of the public to express their opinions regarding the project a formal comment period will follow the presentation this evening after this presentation you do have the opportunity to provide comments and ask questions should you do so the team is here with me today and the public tonight will have the opportunity to provide statements at the microphone using the question or comment box and goto webinar that's the platform that we're hosting the meeting on virtually or provide comments directly to the court report and writing all comments and questions received during tonight's formal com comment period will be responded at a later date except for those questions regarding minor clarification it's a comment only section during the hearing all comments received tonight and today will be become part of the public record just a little bit of background information on public notice this hearing was advertised consistent with federal and state requirements public notice for this hearing including information on how to access this hearing was provided in letters to elected and appointed officials property owners and tenants in the project area the hearing was also posted on the Florida administrative register in the Miami heral and emails to persons on the project contact lists from previous meetings social media feeds and other notification methods through the department also we posted this project on the the information on the project website www southl roads.com Atlantic Albridge the purpose of the hearing is to share information to the general public about the proposed Improvement and its conceptual design all Alternatives that were under the study and the potential beneficial and adverse social economic and environmental impacts upon the community it also serves in an official forum for P for providing an opportunity for members of the public to express their opinions regarding the project members of the project team that are presenting today include Victoria vote the fdot project manager for this study Colleen Ross consultant project manager Joy Castro consultant for natural resources and contamination Max imman consultant for cultural resources I'll now turn this over to Victoria VA our project manager to continue thank you thank you Monica as previously mentioned my name is Victoria V and I am the fdot project manager for this project and um thank you again for the opportunity to present to you all today so the agenda for today's presentation is shown here on the slide and it will include a project introduction purpose and need for the project an overview of existing conditions the study process and public Outreach the Alternatives analysis the preferred alternative and the environmental documents the presentation will end with a review of the Project's contact information and after the presentation we will provide an opportunity for members of the public to provide comments or ask questions so the project is located on Atlantic island in the city of Sunny Isles Beach Atlantic island is home to a residential Community called Atlantic Isle and sits within the biscane bay the Atlantic Island Lagoon located on the island provides intra Coastal connectivity to biscane Bay the island is connected to the mainland by two small bridges that lead to Collins Avenue also known as State Road A1A so the study area includes Atlantic Avenue between the intersections of Atlantic aisles to the east and west as well as the Atlantic Island Bridge Park and Lagoon which are historical resources the Atlantic Isle Bridge Park and Lagoon were determined eligible for the national register of historic places or what we like to call nrhp the bridge was constructed in 1925 and is a low-level cast in place reinforced concrete Arch the facade of the arch is covered with uiic limestone in 1999 a load rating analysis was performed and concluded that the bridge structure has limited weight capacity the bridge is currently posted with a weight limit as shown here due to the stub sandard load rating the bridge is now inspected annually by fdot as opposed to the standard of inspections for every two years for non-weight restricted Bridges the bridge is owned and maintained by the city of Sunny Isles Beach and this PDN study is being conducted on behalf of the city and was initiated in the summer of 2020 a pdan study is an environmental and Engineering Process that ensures that Transportation projects are developed with consideration of current engineering standards project costs and minimization of Social and environmental impacts while also involving the public throughout the entire study process this project is eligible for federal funds therefore PD study phase is necessary before the Divi design phase can begin and the basic steps of a PDN study are shown here so the draft study documents were recently completed and are on display here tonight and on the project website we are currently at the public hearing stage of the study and following this hearing and after the comment period closes and all input has been considered a decision will be made and the final PD need documents will be approved the purpose of this project is to address the structural and functional deficiencies of the existing bridge in order to provide a safe and functional route for the surrounding community and the traveling public the project is needed to address the existing functional and structural deficiencies of the bridge the most recent Bridge inspection report was performed on September 29th of 2023 and the report noted that the bridge has a sufficiency rating of 40.9 and a health index of 6039 and is functionally obsolete further the report also noted issues such as crumbling uiic Limestone as well as exposed steel and corrosion on the underside of the arch in March of 2021 a geotechnical evaluation was performed to determine the size and type of the existing Bridge foundations however the investigation was inconclusive and the bridge has been classified as having unknown foundations the bridge Health index met measures the overall condition of a bridge with zero being the worst and 100 for the best overall health and a health index below 85 generally indicates that repairs are needed although it doesn't mean that the bridge is unsafe functionally obsolete only means that a bridge does not meet today's current road design standards so a sufficiency rating is a tool that is used to help determine whether a bridge with structural deficiencies should be repaired or just replaced Bridges with a sufficiency rating of less than 50 are eligible for federal funding for replacement and since this bridge has a sufficiency rating of 40.9 is therefore eligible for federal funding so fdot is conducting this project on behalf of the city of Sunny is Beach using federal funds to pay for 75% of the estimated project costs and Advance this project through the PDN design and construction phases the city is responsible for the remaining 25% of the project cost and future maintenance costs the project goals are shown here and they are in line with fdot's compass which centers on communities with five pillars surrounding them that include safety resilience supply chain technology and Workforce Development the compass establishes the Baseline for every project and specifically the goals of this project are to minimize environmental impacts minimize the effects of significant cultural resources and improve Mobility as well as enhancing safety the existing typical section of Atlantic Avenue is shown here and consists of a one-way roadway within approximately 60 ft of RightWay and the roadway width is 16 ft and has curb and gutter for drainage the existing Bridge typical section is shown here and is approximately 20 ft wide with a 10t wide one-way travel Lane and it spans approximately 43t over the Lagoon the AL Alternatives that were initially studied are listed here on the slide and the Alternatives analysis process included developing evaluating and screening potential Alternatives based on the Project's purpose and need and other evaluation criteria such as constructibility right of-way impacts impacts to environmental resources and costs Alternatives that did not meet the Project's purpose need were not considered viable and were thus eliminated from further consideration for the purposes of identifying potential of voidance Alternatives Alternatives were considered that avoid adverse effects to the nrhp eligible bridge and each build alternative was analyzed for improvements to both the Bridge and Atlantic Avenue so as shown here on the slide we do end up with two viable build Alternatives which include the bridge Rehabilitation and the bridge replacement the no action alternative did remain as an alternative throughout the PD study the no action alternative does not meet the Project's purpose and need however the PD process requires a no action alternative to be analyzed throughout the PD study to provide a baseline for comparison to the build Alternatives because the bridge is classified as having unknown foundations the remaining service life of the bridge is difficult to determine and the existing Bridge does not preserve the historical Integrity we going to pause our presentation so you thank you I I appreciate that I didn't want to stop you while mid sentence the the mayor of Miami day is here and I want to make sure that we just let her come and go because of uh uh her schedule all right I think Myra's letting her in she's coming okay she going through I don't think she's going through this okay so for those following along we're back to 2A on the agenda accommodating us in your schedule um as as I'm sure you're aware it's national uh women's history month and as a city we've been making more of an effort to acknowledge not only our our own history but our local history and uh um as the first woman mayor of Miami date County it is with great pleasure that on this women's History Month this majority woman commission presents Miami Dates County first woman mayor danela LaVine Cava with a proclamation honoring her service to our community and if I may read it it reads whereas women of every race class and ethnic background have made historic contributions to the growth and strength of our nation in countless recorded and unrecorded ways and whereas women have played and continued to play critical economic cultural social roles in every sphere of the life of the nation by constituting a significant portion of the labor force working inside and outside of the home whereas women have played a unique role throughout the history of the nation by providing the majority of the volunteer labor force of the nation whereas women were particularly important in the establishment of early charitable philanthropic and cultural institutions in our nation and whereas women of every race class and ethnic background served as early leaders in the Forefront of every major Progressive social change movement and whereas mayor Daniela LaVine Cava as Miami D County's first ever woman mayor elected November 2020 embodies the spirit of women's History Month by breaking barriers and demonstrating exceptional leadership in managing a metropolitan government that serves nearly three million residents thereby Paving the way for future generations of women leaders and whereas mayor LaVine kava's tenure is marked by her unwavering commitment to Public Health Economic Development environmental preservation and Community engagement exemplifying how women in leadership can effectuate significant positive changes in society and whereas in 2024 women's history theme women who advocate for Equity diversity and inclusion recognizes women throughout the country who understand that for a positive future we need to eliminate bias and discrimination entirely from our lives and institutions now therefore the city Commission of the city of s Beach hereby proclaims the month of March 2024 as women's History Month in the city of son speech and honor and recognize Miami date County mayor Daniela Lavin kov mayor if we can get a few words from you at the microphone so that anyone watching on TV can can hear you um I know you maybe more prepared to speak but we'd love to hear from you and then we'll come down and take a photograph with you please well I am really really tickled and honored to be here for this special recognition no other city has done anything of the sort so I just want to say thank you thank you for acknowledging and recognizing in women's History Month the achievements of women in elected office and of course you have your very own mayor who is a woman and majority and thank you so much to commissioner viscara for uh bringing this item and to all of you I um I I'd like to say because I heard it from a girl scout that it is great to be the first girl [Laughter] mayor very very special and I was in the time that I was sitting in traffic instead of being with you there were a couple of accidents on the highway and you know you all know what we're talking about so I do apologize for being late uh to our date here today but I had a chance to count up the number of senior staff on my team who are women so so of my directors and Chiefs that report directly to me I have 2/3 women how about that that very impressive I you know I didn't set about doing it intentionally these were the people that were best suited for the jobs but I have 21 female directors oh no 20 21 female directors and Chiefs who report directly to me out of uh 5 incredible it was very very exciting so um it is very important that we take time to recognize the history and the progress that has been made that women did not always even of course have equal rights and right to vote and even once having earned the right to vote still took so long to be at the table on in many important venues and uh we know that those of us who have achieved things know that we stand on the shoulders of of others who have worked so hard to open those doors for us and we are role models for others who look to us for examples and one day a girl I someone said oh you could be the next mayor this 12year old or so and she said no president so we know that women are young women are are taking this example seriously and dreaming dreaming big about the future so for taking the time as you have done to acknowledge all month long women who've achieved uh great things and worthy of recognition here is is really great we also know that there still are many barriers so while we celebrate it's also a time to renew our commitment to closing those gaps and pay Equity one among them we still have a very big pay Equity gap for the same jobs I think it's 82 cents on the dollar now our latest commission um report from our commission for women came out this week and uh you know very shocked really that we still lag behind and in fact the pandemic made it a little bit worse um also uh the gaps in leadership positions whether it's in the private sector or the public sector and that we still face discrimination and and violence at a greater level uh than men so we we all know this and our men who are supportive know this too and we salute our men not just our women uh for for caring so much about it uh I'm going to continue to work hard to close those gaps I know that you are as well so uh whether it's through our policies that you can make here in Sunny Isles Beach or whether it's through your own personal example in your Liv setting for example teaching young women that they can achieve and that they need to stand up for themselves and uh not be slow to take advantage of opportunities so thank you very much for honoring me and for honoring others really it's I said tickled I'm really delighted thank first please just let's get one for good luck two don't move so word [Music] thank you so much for uh being patient and we that was wonderful we're we're very privileged to have had the mayor and uh thank you commissioner vcar for sponsoring that okay it's uh no no problem thank you um well I'll will pick up where we left off um so the no action alternative does not meet the Project's purpose and need um however the PD process does require that a no action alternative um is analyzed throughout the entirety of the pan study to provide a baseline comparison to the build Al Alternatives so this slide presents a rendering of the typical section of the rehabilitation alternative and as part of this alternative a one-way traveling would remain as it is today and consists of a single 10ft wide traveling 1ot 10in wide barriers on each side of the bridge and a 3 foot 2in wide raised curb would be installed however the Planters would not remain as they do not meet current safety criteria so this is a rendering of the bridge Rehabilitation elevation view as you can see a new bridge deck would be placed over the existing bridge deck to preserve the existing concrete Arch and the Limestone facade as well as New Foundations being proposed this slide presents the plan view of the rehabilitation alternative and the existing Lime Rock base and roadway pavement would be removed and replaced with reinforced concrete provided by the new structural Arch approach slabs would also be installed at the bridge approaches so the rehabilitation alternative would consist of partially preserving the historic bridge by providing a new cast in place structural Arch on top of the existing Arch structure and within the existing barrier walls and the intent here is to preserve the existing Arch Bridge opening over the Lagoon and the architectural facade and this alternative does provide new bridge foundations an arch and a riding surface that would be designed to last 75 years and weight limit restrictions would be removed um so here on the slide we does show the typical section for the replacement alternative and to bring the bridge up to current design criteria the Bridge's new typical section would consist of a 10-ft wide one-way traveline with three foot wide shoulders and a barrier wall and as again the Planters would not remain due to current safety criteria here is a rendering of the bridge elevation View for the replacement alternative the new bridge structural Arch would be constructed of either cast in place or pre-cast concrete and it would be formed to mimic the aesthetic form of the existing Bridge multiple alignment options were considered for the bridge replacement alternative and as shown in blue Shifting the bridge to the south towards the Lagoon would result in significant impacts to the Atlantic ISO Lagoon and the resource Group and as shown in green Shifting the bridge to the north towards biscane Bay would result in significant impacts to the nearby Residential Properties as well as impacts to the existing natural resources between the Lagoon and the biscane bay this is a rendering of the plan View for the replacement alternative because Shifting the alignment either north or south of the existing Bridge results in significant impacts replacing the bridge on the existing alignment was Advanced build alternative to or the replacement alternative would consist of replacing the entire Bridge the existing Bridge would be demolished and the new bridge would be constructed at the same location to minimize overall environmental impacts and would be designed to last 75 years um the major disadvantage to this alternative is that the historical Bridge would be replaced some temporary traffic control is required for both build Alternatives during construction the bridge will be closed during construction therefore Atlantic Avenue is required to be a temporary two-way roadway for both Alternatives during construction and as shown in purple on the slide Atlantic Avenue would be temporarily widened and temporary turnaround area is required west of the bridge to accommodate large vehicle turning movements the pdan study began in the summer of 2020 and we are expected to be complete by the summer of 2024 and throughout the study there have been various opportunities for the public to provide input on this project several public meetings have been held dating from October 2020 until tonight's public hearing and you can see those dates of the meeting on the slide here agency coordination has also occurred and will continue to occur throughout the p and design phases of the project um we will continue this coordination with the pering agencies at the federal state and local level through inter agency meetings and eventually permit pre-application meetings during the design phase so here we show an evaluation Matrix that compares the characteristics of each alternative both build Alternatives would have a lifespan of 75 years and with the rehabilitation alternative the existing Limestone wall would be attached to the new structure and no longer be a structural element of the bridge um the lifespan of the Limestone facade would be based on the community's commitment to its maintenance both build Alternatives would result in similar impacts of sociocultural natural and physical resources how however build alternative to the replacement alternative does meet the Project's purpose and need by addressing both the structural and functional deficiencies of the existing Bridge while also providing a safe and functional route for the surrounding community and traveling public um this replacement alternative also has the lowest estimated cost to construct so the build Alternatives that were presented at our Alternatives public Workshop in June of 2022 um and based on input from the agencies and stakeholders and the results of this alternative analysis build alternative to the replacement alternative was selected as our preferred alternative and now I'll turn it over to Joy Castro to discuss the anticipated environmental impacts of the prefer alternative thank you very much thank you all for the opportunity um as mentioned my name is Joy Castro and I will now discuss the anticipated environmental impacts of the preferred alternative early in the study the study team identified the natural social physical and cultural resources within our study area the Atlantic Island Bridge is located within the biscan bay aquatic preserve which is designated as an outstanding Florida water also present within the project area is a tily influenced Lagoon and a small Canal that connects the Lagoon to biscane Bay no significant impacts to water quality are anticipated as a result of this project the natural resources evaluation completed for this study found that the preferred alternative is anticipated to result in 0.005 acres of unavoidable impacts to an existing seagrass Wetland habitat a conceptual mitigation plan to mitigate these impacts will be developed during the design and permitting phase of the project this project also lies within the Federal Emergency Management agency 100-year flood plane however no impacts to the 100-year flood plane are anticipated and the conceptual drainage report and location Hydraulics report are also on display and on the project website the natural resources evaluation also documents that the preferred alternative is anticipated to result in an effect determination of may effect not likely to adversely effect for the protected species that are shown on this slide effect determinations of no effect no effect anticipated or no adverse effect anticipated have been made for the remaining species with the potential to occur within the study area such as the wood stor and other protected waiting Birds no significant impacts are anticipated to protected species and habitat from this project informal consultation has been completed with the US fish and wildlife service and the Florida Fish and Wildlife Conservation Commission in accordance with Section s of The Endangered Species Act informal section 7 consultation is also being completed with the national marine fisheries service for protected species under that agency's jurisdiction including small tooth saw fish and swimming sea turtles seagrasses and oysters were identified within the Lagoon during the benic survey and mangroves are present along the western Shoreline of the Lagoon as well as along the western Bank of the small Canal adjacent to the Atlantic Island Bridge these resources are considered essential fish habitat an essential fish habitat analysis has been completed in accordance with the Magnuson Stevens fishery conservation and management act this analysis determine that impacts to essential fish habitat or habitat areas of particular concern are not anticipated to be significant coordination regarding potential impacts to essential fish habitat and habitat areas of of particular concern has been conducted with the national Marine fishery service throughout the study and will continue as needed throughout the rest of the PD phase and during the Project's Divine Design phase and the natural resources evaluation is also on display and available on the project website there are no known contaminated sites within the study area due to the age of the existing Bridge an inspection for asbestos containing materials and metal-based Coatings was completed no coating suspected of containing heavy metals were found and no asbestos was detected in any of the materials sampled therefore no contamination impacts are anticipated as a result of this project there are also no significant noise vibration or air quality impacts anticipated due to the scope and location of the project lastly no major utility impacts are anticipated as a result of the project and the contamination screening evaluation report and utility and assessment package are also on display and on the project website and now I'd like to turn it over to Max imman to discuss cultural resources thank you again uh good afternoon I'm Max Inman and I helped the department with cultural resources for this project so as part of this project an area of potential effect was established that's called an AP for what the Project's impacts could be on historic and archaological resources and this was presented to the state historic preservation officer or shipo through a through a report which received concurrence from the shipo in February 2022 you can see on the graphic we're displaying what the ap of the project is that's the orange shape and then the the main resources that were identified were what was called the Atlantic Island Resource Group which includes not only the bridge but also the Lagoon and the surrounding park each of these resources was determined as a group eligible for the national register of historic places and the bridge had previously been determined into individually eligible and the the green shape is the is the resource Group uh just a little background on the history of the island it was originally constructed during the Florida land boom in the 1920s and the original design of the island include the bridge the Lake of the aisle which is now called the Lagoon and the park surrounding Park and this is the the bridge is the only remaining historic Bridge of the three originally constructed on on and connecting to the island in the in 1925 and the bridge is significant for its design its engineering as well as its materials including the ultic Limestone material uh The Bridge originally had the four ulic Limestone Towers at its Corners which have been since removed but we can see those you know used commonly throughout the city as a design feature now because the study include area includes National register eligible historic properties and because of the federal funding associated with the project the section 106 process was followed under the National Historic preservation act this flowchart shows the steps that were followed along the way after the historic resources within the project AP were identified the next step was to evaluate the effects to the significant resources and our report was prepared addressing that the report found an adverse effect to the Atlantic Island Resource Group and as part of that consultation occurred with affected parties to resolve the effects which included the city of sun is Beach the state historic preservation officer and others two meetings were held with affected parties as well as two meetings with the city of Sunny Isles historic preserv Beach Sunny Isles Beach historic preservation board were held to discussed the project impacts to the historic resources and the last step of this process which we can see at the end there is the development of a memo random of agreement to outline the specific details of the and of the project and the legal obl ation of each agency or party during the affected parties consultation meetings conducted for this project potential measures to minimize and mitigate the adverse effects to Historic resources and to the bridge were coordinated the measures presented here are also documented in the draft Mo MOA between the fdot and the state historic preservation officer mitigation measures include continued coordination with the city of sun Al Beach and the shipo during the design phase as well as the consideration of the historic materials visual profile and Design Elements of the historic bridge when designing the replacement bridge and another mitigation measuring is the recording of the bridge and surrounding area under historic American engineering record and historic American landscape survey standards the mo MOA also includes the measure to erect a state historic marker similar to what is shown on this slide uh in close proximity to the new bridge and the marker would include text covering the history of the Atlant is's design and the development of the Lagoon Park and Bridge and now I'd like to turn it over to Colleen Ross just to discuss section 4f and social resources thank you hi thank you I'm Colleen Ross I'm the consultant project manager and I'm going to give you a brief presentation on the section 4f resources as well as the social environment resources because there is an adverse effect to the significant historic resources we had to do further documentation to comply with section 4f of the US Department of Transportation Act this is required when Federal funding is uh involved the section 4f resources um in the project area are the Lagoon the bridge and the park as well as the resource Group which also includes the Lagoon the bridge and the park um to satisfy the requirements of section 4f we had to evaluate all the Alternatives that either avoid the historic Resource Group or do the least harm to the group the individual section 4f evaluation which is on display um here in the in the The Sunny Isles Beach uh meeting room meeting room thank you and uh on the project website um it documents the evaluation of the proposed use of section 4f properties in the project area for all the Alternatives um this we are required to um satisfy two findings with the US do section 4f uh requirements the first is that there is no feasible uh and prudent alternative that completely avoids the use of the section 4f property the second finding is that the project include all possible planning to minimize harm to a section 4f property so our analysis has found that there was no feasible or prudent alternative that avoided uh that completely avoided the section 4f property however because we are replacing the bridge in PL in the same location the preferred alternative which is the replacement alternative requires minimal use of the Lagoon and park and was found to have the least overall harm so the study um also had to evaluate potential effect next to the social environment um this slide shows all the property um owners or Parcels in the study area it's an entirely residential area and there are no Community Service uh facilities located within the project area however the park is publicly owned by the city of Sunny Isles Beach and is used for recreation we anticipate there will be no effects to or impacts to Community Resources or features as a result of the project um we do expect some temporary impacts to the Atlantic Island Park because of the temporary construction needed uh shown earlier where we have to widen Atlantic Avenue or Atlantic yeah Atlantic Avenue to a two-way facility no relocations or impacts to Residential Properties are anticipated as a result of the project and I'll let Victoria finish this up thank you um so the evaluation and Analysis from the engineering and Environmental Studies conducted for this project were documented in a series of reports these pdan study documents have been available for public Review 21 days prior to this hearing and will be available for public review up until April 1st the PNE study documents are available for review here at the city s Al's Beach government center and also on our project website shown here is our overall schedule for the study and the next step is to incorporate input that we receive from this public hearing into our decision-making process and after the comment period closes and all input has been considered a decision will be made and the final PD need documents will be approved that approval is anticipated to occur in the summer of 2024 and I will pass it back over to Monica to wrap up our presentation um thank you that concludes our presentation and now we want to open it up to any questions or comments you have to make for our team okay thank you does anyone on the commission have questions vice mayor just great teamwork yeah ju just thank you I know that this has been long time in the making uh ju just one question because sometimes it's hard to see from from here when is the study going to conclude summer this summer this summer okay okay okay all right and when do you uh expect work to to start with the design the design and so um I'm I don't have it in front of me but I'm pretty sure construction is uh Pro is planned for 2027 they've already advertised the design um so that should begin in 2025 though they've advertised the design out to Consultants who want they they bid it out yes they bid it out okay yeah all right okay thank you okay okay any other any other questions and inflation has been taken into account we've had to uh adjust we've been dealing with this for three four years now and we've had to keep upping the cost to to deal with that yes okay thank you okay thank you thank you and as a reminder tonight we'll be here at 6 PM in the meeting room and I want to thank Modio for helping me throughout this entire study with all the coordination thank you thank you Mao okay next item thank you one second here next item is uh discussion 3A pending no excuse me that one was deferred the request of commissioner viscara so it's 3B uh discussion regarding the electric charging stations in Municipal parking garages and lots by commissioner serson she stepped out she needed to step out for a second okay can can we roll it because she's gonna give us some information she's here she's here okay can I have okay so I was approached by one of our residents Eric Luca about issues with the charging stations um we have a very few of them and apparently people is parking on them and not moving the car and also in the in the charging station that we have in Gateway when they are charging even though the the charge is free they have to pay for parking so one of his uh um his Solutions so actually his request was to see if we could get some kind of a sticker or decal the same registration that we are doing for the scooters to register the cars for the residents that want to use that service of the charging stations and that way when they're charging the parking will be free in Gateway that's the only place where we are charging so that that was the suggestion and uh another one will be to have more charging stations one of the places that uh having the conversation with him and then with other people they were saying that will be like good for it will be on the top of a Gateway Park in the parking area and having this discussion now with Susan Stan I find out a little bit more so you want to share a little bit what you share with me with the rest of the commission where we are about or you I'm so sorry you know whoever Susan yes okay thank you yeah okay um yes mayor vice mayor commission um we have been in contact with FPL regarding adding additional stations the last step was we sent them a map of all available locations um the reason we are trying to work with FPL is that with our last agreement with them they pay for the machine they pay for the install they do all the permitting um all of which could be very expensive if we were to take it on our own um so we're trying to work that angle first before we have to get to the point of of us having to purchase and install ourselves if we were to do that it would be a program mod in next year's budget as a request because it would be a significant amount of money right okay so the idea will be to give us like a um you know more information whenever the FPL comes back to you and tell you yes or not and and which location they approved Etc okay so it's just to keep us like inform of that our residents have this need and they be having this conversation uh I don't know if we could wave the uh the parking while they are charging what is the steps to do that uh if we can do it I don't know if if it's that decision that we have to make or you guys can do that internally but uh electrical vehicles are getting more popular or unpopular according to who you speak uh but if we could just make it easier for our uh residents to be able to charge and not to have another issue that was raised to me is the disputes when the people is charging the car but then they leave the car there for several hours then they are like not allowing other people to come and charge so if we can find some kind of a solution to that issue and that that is on on on our hands that is the conversation that I want to start having thank you so some other additional information that also speaking with commissioner she was not aware of so you may not be in we were going to put all this in a memo um currently we do not charge for charging so other places that you would typically go you enter your credit card and you pay to to charge the vehicle our vehicle charging is free and that's because of the agreement that we have with FPL the we do charge for parking in any lot that already charges for parking so that's Gateway the 175th Street lot and Heritage and then the fourth location is here and we don't charge for parking in our in our regular regular lot so there's no charge for parking or charging at this location only and then as far as the uh they call it idle time so in our conversation with FPL we also talked about um programming it so that if your car is finished charging which is free you would then start to get charged an idle fee if you don't remove your car to encourage people to once it's finished charging move out and they get notified through the app when their car is finished charging so they would know to go move it before they before they started to incur a fee okay does anyone have any go ahead so I don't have an electric vehicle but how long does it now are these quick Chargers or are these regular Chargers these are so in our conversations with FPL there's three types um one is the very long trickle charge which is typical for most homes um how long does that take that um 12 hours or so 10 12 hours then we have hours here right um which are typically a 4 to six but it all depends if your battery is completely low versus versus somebody who just needs a little charge right um so it it it varies so that gives you good beach time mhm now they have superchargers um that'll charge it within like 30 minutes to an hour and that is what they're looking at but those those Chargers are in the hundreds of thousands of dollars right right and another clarification that I didn't know as well is that um we are not charging they're not paying they they of the vehicles but we the city we are the one paying for in that bill so we are paying for the electricity uh for for the charge of these vehicles so they're not they're not pay nothing but somebody has to pay it's not FPL it's us the city yes so I don't have an electrical vehicle by the way full disclosure either yeah I I think that that's a conversation that we we definitely need to have because I agree with uh commissioner that perhaps if we are going to be doing this for more locations we need to consider charging it but I leave it all up to you all um and if possible remember we had discussed potentially Winston Towers had asked for it as well along that road right so in our conversation with FPL we had also inquired because they did have a program where they were encouraging people to put charging stations in their homes or businesses right um that program had ended but they said that they would let us know when a new program opened up so that would give the opportunity for the buildings to correct yes and they also when we sent them the map of potential locations they asked for not just city-owned properties but like Publix Walgreens places where people may go for a short period of time for those quick charges right but those would have to be per charge for pay correct I mean public was going to put in charging stations they wouldn't absorb the cost for the charge right yes do we know how much we're paying for these charges we don't we don't have a dedicated FPL meter but so it all comes out with our electric bill correct and we did not notice a spike in our electric bill once we inst we did not we did not notice okay okay no just wondering MH how long do you think it's going to take to sort of give us an entire update on this we will reach out to them again um I just had a meeting with them yesterday and this did not come up but I will follow up it it was a different group of people all right thank you commissioner Mard do you have any questions okay we're after four o'cl are we all in agreement that we keep going yes anyone oppose to it no okay Macio so the last item is 3C which is a discussion regarding the spot yes okay so this is my item and I know that we're now we've uh done roof repairs on the the spot the air conditioners are working better and we have afternoon and evening use for um after school students and in the evenings for uh adolescent meetings now it's still idle in the mornings and we have a great demand I know in Golden Shores and um northern uh end of City people that would Lov to have use of uh that that um spot for uh meetings for uh morning coffee for card games and I was hoping we could have a discussion and see if we could open up that space uh rather than having sit idle um okay if you can just clarify do you mean like uh a programming or just open space well um if we had uh tables set up for card for cards or uh whatever uh you know Canter and um Maan people so you wanted to be like a rec center for just like a little Rec Center a meeting Center meeting meeting place for residents a meeting place for residents thank you for uh morning hours um you know well PRI prior to when uh the adolescence would be out of school and we would be using it for other means I would just like to remind everyone that due to the work in Pelican Community Park we will be using it all day Monday through Friday in the summer so starting in June and we would need it in advance of that to get it ready for summer camp okay okay now also it was brought to my attention that uh you might be painting the walls there so um I was um thinking that we should not do the painting just to accommodate adolescence that it should be more favorable to a broader number of people how the walls are painted okay I believe just so you all know um commissioner is referring to a project that the team club had wanted to do which was the long wall that that takes you from the main room to the restroom is just a plain white wall they wanted to express some creativity and as a project um paint that wall I believe that's what you're referring to yes is that okay okay well um does anyone have any questions any comments I mean do you envision this yeah sorry I have a com a question do you envision this as just like a place where people could go in and out and hang out out in the mornings and play cards or dominoes or majan whatever it is yeah and have coffee and just and have coffee and but do you you don't want any uh scheduled activities there no I'm not uh right now you just want a Mee works out yes a meeting place and then uh depending upon uh the favorability and how many people we attract uh we could uh take input as to what else we might care to do okay I'm open to the idea but obviously we'll need to see what the logistics are correct I mean Susan just mentioned a couple of things yes I wasn't aware of that also that we'd be taking on uh the spot would be taking on those activities so it would be open to everyone then everyone yes so how would we prevent for instance um someone you know using it on a regular basis to hold meetings or oh you know without mon how would they we prevent it being monopolized by by groups that want to have meetings and so forth because a lot of the condos for instance have approached us to say well we need a space for for our Gatherings for theater group for this group no would we'd have to have uh you know a posting as to what the rules for we need to be staffed yes uh also um over a year ago I don't remember when it was that we designated that to be for the things and to be the spot but I know it was over a year ago my son was still in this school and now he's in high school and uh we promised the children back then the teenagers that we were going to have uh volleyball and basketball there for them uh now that is going to be used over the summer for summer camp I would like for you guys to consider giving the direction to once and for all finish the the conditioning of the outside area to be used for basketball and volleyball I believe you guys are already a few quotes ready for that that apparently they were not budgeted for uh but I know we do for example we have a few million dollars for parking Recreation so um if we can if you can share more about what is needed and what will be the impact and what what will be that will be given to them because again uh the children and and the teenagers and the people that participated into make making this spot uh that was like the biggest requirement that they had they wanted another place to play basketball to play volleyball Etc and one point about the painting um we give the space to them I I understand that we want it to be open for everybody and I'm okay with that actually okay but I don't like to come back to whatever we gave them the promises that we we made and we asked them to be creative and ask what's what they wanted and I'm pretty sure that can make an amazing job in that wall so if we tell told them and ask them what is it that you want to see there and they said the painting I don't want to disappoint them I will be in favor of them expressing in a respectful way their creativity and using that W in the intended purpose so if we can know a little bit more about what is needed for making H the volleyball and the basketball and anything outside please yes so um sorry I just wanted to hear from the city manager but if you want to defer this yeah we we discussed it and we have been checking prices and then I have given the direction to move forward with the volleyball and basketball okay all right so Susan did you have yeah I just like to add I mean we have a state-of-the-art senior center at Gateway um we are not not two miles long so Gateway is is close no matter where you are I understand it may not be right next door to you but you know if you're in Arland house or if you're in in you know uh Golden Shores it's not that far and it was it's been set aside before Gateway everybody was at Pelican and it's like you're saying the seniors would come in in the morning and they would have their programming and then the little ones would show up and kind of push them out and as senior programming grew uh whatever they had to get kicked out because we had to make room for the little ones and they they weren't happy the the seniors they they kind of like had to get jammed into this this situation so I feel like we would just be recreating a different version of that and we did like like um commission St and we we've been talking about a designated teen spot for a reason right that the teens are a a Fickle crowd and um they can be boisterous and they you know so and they have part particular tastes that are maybe not aligned with the the first grader the second grader those spaces are different so I and unless there's a reason that that uh Gateway is not meeting those needs and I I believe that it is I mean it's not like Gateway is always jam-packed with people all day long so there's tables there there's staff there there's uh parking there's you know I I think I I think it's it's better to leave it separate okay well let me just say um we have air conditioning running at the spot 247 correct it's on a schedule like you would your home so when it's when there's people in there it's higher but it never right but it's conditioned there yes and any event so we have this space uh we don't have a community center on the north side of the city and it just makes sense and we have the demand I mean I've been approached have you been approached May mayor regarding I've um I've only been approach about res wanting to use it for prayer no I know that but that um besides that no so no one has spoken to you that you can recall regarding um looking to have a a morning meeting spot for coffee and card playing and uh table games and things like that not a gathering Center I I don't disagree with you that it would be great great to have something for Golden Shores because obviously you and I live there so well it's not only Golden Shores but it's also the buildings on the east side I I agree with commissioner vascara that um that uh Gateway has become although we didn't really intended to become fully senior it has become fully senior and I think that staff has worked really hard to keep it a very adult Place despite many efforts including on my side to try to get more uh teens in there as well and so the fact that we did dedicate it as for teens you know if you're if you're are having the basketball and the volleyball and you're having the paint you know it becomes a teen space and I think it if if there is an opportunity perhaps to reserve it for something during the day I don't know I'm open to that like if you wanted to have a meeting space you wanted to meet with your you know whatever chess club or whatever your card playing C you can rent it out or not rent it out you know but so that it's not con constantly open and staffed and and you know open I also want to remind you that we only have a small portion of that space that we can use it's got the one restroom right two restrooms the restrooms and just the front space the entire back space is unusable right right exactly okay so we're not looking to ever expand the usage if we want to use the backspace we would have to fire sprinkle the entire building which from some preliminary conversations is very cost prohibitive MH as well as additional restrooms okay so that is what about 11,000 square feet that we have usable now no overall something I remember it was something like that I don't know that answer off the top of my head my apologies but I remember it was something like that so how much of that are we using now would you it's only that front bedroom that bedroom that front room that was like their Lobby right soes Square fet maybe yeah okay so and it does already have I don't know when you were in there last but it does already have some things for teens right taking up some space I've SE and decorated in a very because they had a party there and right MH okay so I'll let the residents
