I'm gonna ask Vice Mayor Eisner to introduce our guest minister and then we can remain standing after the invocation and pledge allegiance to the flag. Yes, Thank you. I begin with of Hebrew of Yu Sha Sha maim, so the goal These Hebrew words mean, oh, heavenly, one protector and redeemer of Israel. Blessed to state of Israel, which marks the dawning of hope for all who seek peace. Shield up beneath the wings of your love, spread over at the canopy of your peas. Send your light and truth to all who lead and advise guiding them with your good counsel, establish peace in the land and fullness of joy for all who dwell there. May you bless the soldiers of the Israel Defense Forces and all who stand guard to protect the Jewish people. Help them secure freedom without loss of life for all those held captive by the enemy. Give strength to the Jewish community in our midst and beyond our shores to face the rising tide of anti Semitism. So if you're wondering what Ha happened to all the paper copies, we've, uh Um, moved into the 21st century. I guess so, Um, we've got 11 proclamations. All of them are extremely important. And we separated those, uh Proclamations up. In terms of responsibility amongst the commissioners. I'm going to give the first three the second. The next two are gonna be given by Vice Mayor Eisner, the next two by Commissioner Colas, the next two by Commissioner Kiano. And the last two by, uh, Commissioner did Donato. Major Mathis, are you here? Oh, there he is. Major math is more major terrine. Mathis uh, up until about two months ago, was known as Sergeant Mathis. He's from Tarpon Springs. He's a major now in our police department. We're very proud of him. He's sitting in for police Chief Young this evening. So OK. He also played football with my younger son in Tarpon Springs High school, so The proclamation is for peace Officer Memorial Day. Whereas police officers of the Tarpon Springs Police Department stand watch over our citizens selflessly risking their lives to protect individuals, families, neighborhoods and properties against crimes. And whereas May 15 2024 is observed nationally as police as peace officers Memorial Day in honor of those law enforcement officers who, through their courageous deeds have made the ultimate sacrifice and service to their community. Or have become disabled in the performance of duty. And whereas across the nation police week the calendar week in which may 15th falls is observed with ceremonies to honor law enforcement officers who sacrificed their lives. And well being in the line of duty. And whereas in is important that we acknowledge and honor the heroism of all of our law enforcement officers, and I encourage all citizens to express their deep appreciation to the men and women who risk their lives to guard and protect us and to remember those who are no longer with us now. Therefore I co vatic ks by virtue of the authority vested in me as mayor of the city of Tarpon Springs, Florida do hereby proclaim May 15th 24 as peace officers Memorial Day and may 12th through 18th 2024 as police week. Major. The When we're going to give the memorial Yes. May 15th is the ceremony for our memorial out at the police department. I believe that starts around 6 P.m. And then next week, I'll be traveling to DC, uh, to represent our city and our department at the National Law Enforcement Memorial Week. So on behalf of everybody at the department and my office standing in the back, I think you guys for all the support that the city gives us. Thank you. Thank you now. Ms Tucker if you could come forward. Um Ms Tucker is with the art club of Tarpon Springs. I'm gonna get into her formal title in the proclamation itself. And, um, we were doing, uh Basically provider appreciation Day. And, um You know, The interesting thing is that tarp and springs? Um we have many Children that are still here. If you look around, you may see older people, but we do have Children in town, too. And, um, the parents Unfortunately, both many have to work these days, then their situations with families and we really highly depend on service providers that I guess there's maybe about 10 that I name in here. Our club is very important in that regard, Ms Tucker is going to say a few words after the proclamation concerning that , but she is here representing our club and also all the service providers here in Tarpon Springs. So let me read this proclamation. Whereas the city of Tarpon Springs places the highest priority on the well being of and development of its Children and recognize that investing in them through resources for the quality childcare and early childhood education provides them with a strong foundation of years of learning as young students and for their growth into adulthood. And whereas child care providers often nurture offer nurturing environments that are fundamental to the healthy development in early learning of The youngest citizens, thereby laying the groundwork for future academic success and lifelong well being. And whereas the availability of quality child care is indispensable for enabling Tarpon Springs, parents and guardians to engage in the workforce with peace of mind, knowing that their Children are in safe and supportive care. And whereas the city of Tarpon Springs recognizes the work of child care providers in the vital role that they play for so many families in our community Our club child care, wheelchairs for kids, cops and kids, gospel trained Preschool Boys and Girls Club Union Academy Family Center , Head Start program, Lake Tarpon Learning Center, Christian Way Academy. The Y MC, A of the Sun coasts, Ignatius Childhood Center in Saint Nicholas preschool and more. Whereas the mayor and board of commissioners are honored to acknowledge the work of Lynn Tucker, strategic initiatives director of our club, child care centers and all service providers for their dedication, commitment and compassion in helping to raise our Children now, therefore, I Costas Vatic kots by virtue of the authority vested in me as mayor of the city of Tarpon Springs, Florida do hereby proclaim Friday May 10th 2024 as provider Appreciation day. Thank you, Mr T. Like to say a few words. Thank you, Mayor and Commission members. Um I just wanted to say that, um Childcare providers. Do a lot of hard work. They ready our kids for kindergarten. They make sure that our kids are getting youth development and character development. Our club has 48 licensed Um, programs across Pinellas County and we have a few here in tarpon and, um, look them up. Volunteer. Um And you know, uh, support those that you know who are child care workers? It's a hard job. Thank you. Mr Valero. George There is. The next proclamation is for National maritime Day. And, um Throughout the history of Tarpon Springs. Uh, actually, at one time was a lot more. Uh what would you call it Industrial working waterfront than it is today. When you go down the sponge docks. Obviously you see a lot of visitors. We call them tourists, but literally, they are visitors, and many of them are not even, um from out of state or out of the area. They're just local people that want to change and pace from where they live and wanna walk up and down the sponge docks. Um George Bare is the son of John Vale, and he's one of the bee. Whose father, um, started the, uh, one of the sponge diving and, uh, ex exhibitions in Tarpon Springs over 100 years ago, and we're going to be Commemorating that anniversary again on June 18th June, Uh, during founder's Day here at City Hall. Um I've known George since he was a little kid. His brother Michael, who's no longer with us is closer to my age. And he was a great football player, too. I remember that. And uh George operates, Uh, owns and operates Saint Nicholas. Uh, boat line today. So um, in honor of now, Georgia is here. But it's an honor of all of those that help create the Tarpon Springs working waterfront for what it was and what it is. Today. This proclamation is honoring that. And George Blair is standing next to me as a representative of that history, so Let me read that. Whereas on National Maritime Day, the city of Tarpon Springs honors the dedicated merchant Mariners. And whereas March 2nd is recognized annually as National Maritime Day for the Economic Service that merchant commercial Mariners in the longshoremen of their seaports, provide our state and nation along with security and marine transportation. And whereas the merchant Marines in our nation's commercial seaports play a vital role in moving goods that Produced around the United States and the world, providing jobs and economic benefits to our country and serve as the eyes and ears of America at sea, helping protect our homeland. And whereas maritime day in Florida is an opportunity to honor the men and women who serve the United States merchant Marines in our nation's seaports , as well as to remember the many Mariners who lost their lives serving our great nation. And whereas the city of Tarpon Springs acknowledges the benefits that the maritime industry provides, as well as the people who are part of that industry Now, therefore, I coses FiOS by virtue of the authority vested in me as mayor of the city of Tarpon Springs, do hereby proclaim May 22nd 2024 is National maritime Day. Congratulations, George. I Because you got on your agenda. I just like to thank everybody that's responsible for, uh Establishing this and honoring me to, uh, to receive this award. Um, on behalf of all my, uh Past family members who were captains and, uh People that go says, uh, had run this this sponge industry for a long time and worked a working docks for a long time. And she was killed at the is ACA. Ghetto. I don't wanna make it too. Morbid. My grandfather who I've been named after and all of the First born of the Eisner's all named after my grandfather. Who is more high, Eisner. And he was killed at Dutch Bau. So I did want to share that with you. So when you hear what goes on in this world of anti Semitism There's no place in this world. For anti Semitism or hatred. Free speech is free speech. Hate speech should never be tolerated in any which way shape and form. Thank you for listening to that. So Me lower this since I'm Challenged. Um Is proclamation, whereas Jewish Americans I immigrants to America ever since their first arrival to our shores in the 16th century, have played a central role in the creation. And I Presumptive. Yes, I. I know my friend would like to take a quick And then I'll. Say something. I know. I just just hold on for a sec. I bring it up a little bit. Um very honored to accept this proclamation and recognition of Jewish American heritage Month. Uh, many thanks to Mayor. That a kiss and the board of commissioners. I asked Mike about the pronunciation in particular Vice Mayor Mike Eisner, who stands by my side for your support of the Jewish community. This is a very important gesture of friendship and solidarity, especially as the ferocious surge of anti Semitism continues to threaten Jews in America. Know that your support will always be remembered fondly. I stand before you at a special time in the Jewish calendar year, just yesterday. Communities around the world mark the commemoration of Yom Hawa Vu ra, Holocaust and Heroism Remembrance Day by reading the names of thousands of individuals among the 6 million Jews killed by the who committed genocide against the Jews solely because of their religion. At the same time this day, recalls the righteous of the nations. Non Jews honored by Yad Vashem. Israel's Holocaust memorial for risking their lives to aid Jews. During those dark years when light seemed distant. Six days from now. Jews will celebrate Yoma, Zara, the day of national remembrance in Israel to honor the memory of soldiers and people who lost their lives during the struggle to defend the state of Israel from its pre state days to the modern day. It's then followed by a happy occasion. Yoha Ma, Israel Independence Day. As Israel celebrates its 76th birthday Since the October 7th massacre. Uh the Israelis at the hands of Hamas, the eyes of the world have been laser focused at Israel. I'm sure that all of us have followed Israel's military action in Gaza adjust response to a hostile enemy's incursion into Israel's sovereign land. In the past few weeks. Many of us have also seen the proliferation of pro Palestinian protests on college campuses, along with the efforts by universities and police to dismantle these disruptive encampments and maintain the rule of law. These protest groups claim to be only anti Israel. But in reality That is not the case. At its heart protesters who chant slogans like from the river to the Sea. Palestine will be free. Are engaged in a rallying cry for terrorist groups and their sympathizers. This includes Hamas, which is called for Israel's destruction since its inception in 1988. Furthermore, Protesters shouting globalize the intifada are calling for violence not only against Israelis but against Jews throughout the world. Simply put any suggestion that Jews do not have the right of self determination is by definition. Anti Semitic. Thankfully there are many ups standards in the world and to the ranks all add the leadership of the city of Tarpon Springs. An upstander is a person that takes a stand against explicit bias, hatred and anti-semitism. And for this, I'm truly grateful. As the psalmist has written. A Leo Anare tamo vom. May God give strength to God's people. And bless each and every one of us with Shalom. A measure of peace. Thank you. OK? We go back to the height challenge again. Um, I need the Coast guard. John Jennings. We have the flotilla Commander Ernest Kan Cannon, right? I have my neighbor. OK? OK? Somebody glued this where I'm can't pick it up yet, OK, this is a proclamation, whereas on average 650 people die each year in voting related accidents in the US 75% of these fatalities are from drowning. And whereas the vast majority of these accidents are reported to be caused by human error or poor judgment, and not by the boat equipment or environmental factors, and where a safe boating begins with preparation, the Coast Guard estimates that human error accounts for most voting accidents and that life jackets could prevent nearly 83% of the voting fatalities. Whereas through basic boating safety procedures carrying emergency dress, distress and communication equipment, attending safe boating courses and wearing life jackets could ensure boaters stay safe throughout the year, whereas national safe boating week is observed to bring attention to important life saving tips for recreational boaters, the city of Tarpon Springs recognized the support of the Tarpon Springs Flotilla, 11 9. Of the Coast Guard Auxiliary and our federal, state and local safe boating partners in their effort to educate the public and promote safe boating. Now. Therefore I Vice Mayor Mike Eisner by virtue of the authority vested in the mayor of the city of Tarpon Springs, Florida to hereby proclaim this week of May 18th to 24th. 2024 is national safe Boating week. And I wanted to add one thing. That is a pet peeve of mine. I own a boat. And I can't tell you how many times I see people. Having kids sitting on the front of the boat while they're underway. And it's all fun and games until God forbid something someone falls into the water. They have less than a second or two before. They hit the prom, and it's not a pretty sight. I've lost two people when I lived in New York, and my wife who's sitting right here will tell you it sets me off every single time. I see it. I usually make a comment to every person I see. I usually take back poor comments in return, and I'm OK with that. I will continue to fight for the fight of keeping kids alive and uninjured. So I. I did wanna say that. So I do wanna thank you and I am presenting this to my friend Joan Jennings. And two And if you if you'd like to say something, sure. Everyone I express express my deepest gratitude to the mayor and commissioners. Uh, Chief police Chief Young, uh, Fire chief Young Uh, for being supportive of our missions and helping keep the community safe, which we all care about. I'm encouraged to say that this year so far, our flotilla is inspected over 140 boats in the city and local area free of car charge to the local public. Uh, we also hold both America courses for new and seasoned voter to gain a better understanding of voting and voter safety from our knowledgeable instructors. That are out in the gulf without life jackets. Uh it's not a big investment and it's worth every penny. If your child or your pet falls overboard. Uh, Open and safe, and, um As they do as great a job as they can, and it's a hard job because it's a never ending job. Keeping our city clean and, uh, having it And I like to run If anybody that sees me out at the park, Johnny, um you know that I like to run, so I have run when you run in the streets. You really get to see potholes. And I've run the streets of New York City. I run the streets of Chicago and all over the, uh, the Tampa Bay area And you wanna see potholes. You go up to New York and Chicago. You'll see them here. Yeah. Here We got good streets. I know they could always be better, but they are good. And we wanna thank Tom for all that. Or integral part of our citizens everyday lives with our golf course. RO plant Recreation Cemetery. Sustainable. Sustainability and utilities maintenance. Whereas such facilities and services could not be provided without the dedicated efforts of the public Services Department who understand the importance of the work they perform. We're whereas the mayor and board of commissioners further commends the work done by Thomas Kiger. Public services director and staff for their hard work and dedication and improving the quality life of our residents. Commissioner Frank did Donato by virtue of the authority vested in the mayor of Tar Marines. Florida do you hear my proclaim May 5th through 11th 24 as public services week? Uh, here in public services. We have a really diverse group ranging from recreation to the city cemetery to the golf course, sustainability and utilities and they all work really hard every day to make tarp a special place to live. And I want to particularly recognize all of our staff who help out beyond the normal 9 to 5 covering weekends, holidays and late nights, our distribution staff, wastewater collections, workers, maintenance crews, environmental staff and water and wastewater. Plant operators work around the clock and every day of the year to provide essential water and sewer service to our citizens and small businesses. And with that in mind, we've invited some of our, um Operations staff here to accept this plaque on behalf of all of our dedicated employees. Lot of people. Compliance on any of the resolutions. And I want you to look at that in proportion to the rest of what you're paying, and you're gonna see. What a good bargain we have in tarpon. Through the administration of Mr Laos. Over the years. He's gotten the best staff for us. He's made efforts to keep the best staff here for us. We've had commissioners through the years. Look carefully at our budget to make sure they're spending it wisely. So I just wanted to say thank you to everybody here. But also to you for your patience and understanding and hopefully more support and involvement in our local government because they are doing a good job for us, Despite what we hear on the outside OK, thanks. So when I hear criticism, I tell people Go to work with them. Take some Gatorade some cold water, Go buy sandwiches and take them to them because I did that when I was mayor every time they were out all night long, my husband would make coffee and we'd go. They are dedicated to our city manager. They are heartbroken that he's gonna be leaving. And it's a bitter taste in a lot of them's mouth, but they can't come up here and say anything. So, mark, you've done a wonderful job. In the city with our departments. And the employees we have in this department and you are to be commended. For what you've done for us in Tarpon Springs. Yeah. Any public comments on anything that is not on the agenda. If you could state your name and your address, please. For the record. My name is Doctor Joshua Goldman . I live at 958 Bay Shore Drive. I've been a resident of the community and a practicing physician in the community for 20 years. I've lived here and I feel exactly the same way as everyone around here. We love this community. But I'm here to ask the commission, as are most of my neighbors to put a pause on the Bay Shore sewage. Um expansion project Partial, mostly because right now we have not had the time to get public. Meetings in in, uh In Line with your own ordinance in the city. Ordinance 2 15.03 says that we are supposed to be given a meeting within 15 days and time to Study the project that was gone. And then Norton, its 2-2 21 is supposed to allow us to protest or to evaluate the plan. And This plan is going to affect our street and our community in a negative way. Several ways I support sewer in our community. Most of us do. The problem is, is that the system that has been chosen for us unduly shifts a large portion of the cost to the families in our community up to $25,000? We've received bids. And It also doesn't address the issue of power outages. Bao Drive over the years has been subject to power outages with Irma. We were out of power for two weeks. The low pressure grinder system. Will only hold on average 100 gallons of water before electricity is required to move the sewage down the street. An average person uses 80 gallons a day. So when Irma came through, we were out of power at the end of Bay Shore for over two weeks. We actually in my own house, pump the sewage up to a lift station to pump it out to a field and have had to maintain generators. By doing this system, Everyone will have to maintain a generator if they wanna be able to live in their house in the event of a storm or a power outage. I understand the economic implications of doing a more expensive system, but this system is just shifting the burden to the homeowners and my neighbors around us. Again We support you guys. We support everything you do. We're we're We're all lovers of the community. We all feel comfortable here. I've been here longer than I've been anywhere else in my life. But please, you guys didn't notify us. You didn't give us time to talk to anyone. You didn't give us time to study anything. Your own city ordinance say that we were supposed to be given a meeting two weeks before the project started. The project started yesterday and our meeting was last night. That is not nearly Proper notification, and that doesn't leave us enough time to do anything to protest this to look at the system. Gravity systems may be difficult. Vacuum systems may shift the electricity to the city where you guys can manage the power a little bit easier than the above ground utilities at the end of Bay Shore. We're on above ground utilities. We lose our power whenever there's a storm, and we're bound to get more storms here. We've seen them. We've been lucky. But even with a glancing graze, we were out of power for two weeks. So we're here to All of our neighbors are here to ask you to pause this project and allow us time to find different proposals and different systems and to study this so that we can maintain our peaceful enjoyment of our homes if there's a storm. No. My name is Janet Adams. I'm at 962 Bay Shore Drive and II. I echo Joshua's sentiment. Um I've been on Bay Shore Street for, uh, 23 years. Most of us are on septic. Uh, we look forward to sewer just not in the just not what they have proposed. Uh, we found out just last minute that this was going on when we found that out by people showed up on our streets and they're marking, Uh, Marking the streets They're marking where we're septics are and we weren't given privy to any of this. Um I think that that, um we we're we're pro sewer, but we need to work together and find out. Um, find, um A system that is not the low pressure. That is the high pressure. Um, we've done some research in the very, very short time because we've just been made, uh, you know, aware of this, and as we speak for the past two days they've been They've been, um Putting lines in our streets without us even knowing really what's going on, and I just think that we should be able to. If we're all in this together. We should be able to sit down and talk about the different plans. Um The other thing I wanted to mention is when we went to the meeting the other day. Um They've given us very, very vague estimates on what the cost would be to the people. Uh, essentially, um, Essentially, they say that the city will pay over 1.2 million for the design and the construction of the pipe, But it's unbelievable. All the impacts that is going to be that the residents are gonna have. We are gonna have to pay impact fees to the to the city of Tarpon. Um sewer tap of 350 the impact fee of 1660 deposit. Just just the impact. Um that we're gonna have to pay is approximately $2006 per person times. This by the F. Uh essentially, um 100 and 15 houses that are there we're over . You know, we're over $231,000, and that's just the impact. The other thing that that with with this low system, um septic it, it's a grinder pump and I know way too much about this in the past two days on sadly, but the costs are, the residents are gonna have to pay for the grinder and prompt the residents are going to have to hook up to it. The residents are going to have to pay for any pump to get down there. The residents are going to have to pay to have their septic removed. Now we're talking something like 5 to $10,000 to have a company come and some of us have septics in the backs in the back of our homes close to structure, So those fees are between five and $10,000 to abandon. Um and take the septic away. It's unbelievable, but They're not giving us any guidance. We've had to scurry and try to figure out these numbers. And quite frankly, some of the numbers are between 15 and 20,000. That's that's a lot of money, and that's a lot of money when there are other alternatives, and I just feel that, um I just feel like they've raced through this. Um And I also think that there are, um there are grants. Specifically for waterfront and the EPA from either the state. Um you know, in grants, like, for example, Hillsborough. Is currently taking this load. Um this low grinder pump out. And they have they have found grants for their residents. The residents of Hillsborough in this particular community, and I have I have some, um, articles for this system and Places and, um, communities in Florida that have taken this out and the municipalities Hillsborough, being one of them has found grants so that this huge burden doesn't affect the, uh the residents. Um so in conclusion Ma'am, we give each resident four minutes and if you would take a few seconds and wrap up your thoughts that terrific Thank you. OK I just truly believe that the commu that the commissioners were not given the full scope of this project. Um and the details of the cost, So I request that that the commissioners vote to halt the sewer project right now, until further research can be done about installing the grinder versus a gravity system. Um And that'll give give, uh the city and the, um, time to take a look at the different options. Thank you very much for listening to us. Hello My name is Elaine de Lou. And I live on 944 Bays Shore Drive. I work for the Environmental Protection Commission of Hillsborough County. And I am not here on my professor professional capacity, but it's because of that that I first learned of the septic to sewer and the grinder pumps going on in Hillsboro County, so just to quote off their website Because Hillsborough County has put in these low pressure systems when they thought that this was the best alternative. It is a cheaper alternative to the gravity P systems. Low pressure sewer systems were initially constructed as an alternative collection system to septic tanks. At the time, the systems were considered the best option for central collection and transfer of waste water. But over time the systems have proven to be unreliable and inefficient to operate. Low pressure systems are susceptible to failures and overflows, potentially endangering public health and safety and low pressure systems that are near water or sensitive estuaries may pose an immediate threat to water quality and the environment. Conversion to a conventional collection system with modern technology will significantly improve the operation of these systems. Also Hillsborough County is doing these. They're replacing all of these low pressure systems because of the night there they have had and because of the nightmare to the residents, they are all have also maintained some of these grinder systems And in talking with the director , they said. It's been an absolute nightmare. They fail constantly, and they cause SS OS , which are the sanitary sewer overflows that need to Reported to DP. So that's how they know that it happens. Because if you put that on our street, you wouldn't know any of it because it doesn't get reported to the city. It's a bigger environmental impact than what you're trying to improve on, which is if we're moving the septic tanks. So the grinder systems you use a smaller pipe. It's a 2 to 4 inch pipe, and it require requires every resident to maintain a grinder pump on their property. With the gravity pull system. You wouldn't require anything further of the residence and I talked to the city of Tampa today. Also their director, I wanted to know what Harbor Island and Davis Island and other waterways, he said. They would never put one of these grinder systems in and burden the residents with that all of their systems. Harbor Island Davis Island, All other coastal ways are on gravity pull systems. So I'm asking you to do the same thing. That city of Tampa in Hillsboro is considering for their residence and take their residence. Account When you look at Toing a system this might have been feasible for the city because it was more economical, but the impact it has on the residents and the fact that they fail constantly. We heard last night from a resident I didn't know had already had it on their street three times he's had to replace that pump. You know, And he says good luck with the holiday. It feels every year less last Thanksgiving. You know it failed for him because they don't work and just go across to our neighbors all through key West and Lake Placid everywhere else. You can see where these have failed, but just go down and talk to the people in Hillsboro County, and they'll tell you why it's been such a disaster. And so they made the best options at the time, and they put in these systems But we know better and we know now what ? How they fail in the areas. We're asking you to do better for us. There was no notice on this. So I was shocked when this you know came to our door and the guy knocked on our door the same thing and we're asking for this to be halted. We're asking for the systems to be evaluated. Find out why they fail in other communities. And don't put these in When you can see just looking down the street why they failed in other areas. Thank you. Again, Anita Proto. I don't want to make sure drive. I'm not going to be connected to their system because it's already come on the old uh, pipeline. And But I wanna tell you, I made calls today. Venice. Uh, Sarasota. All the way down towards The beaches far down. None of them have the grinder. And those that had it have taken them out. But the shocking thing to me is when I was quoted I a plumber. What it would cost for me to get on. $20,000 I told him to leave my property That's crazy. And I'm not. I'm concerned about the ones that you're going to recommend that we use. It's all out there. Oh we're gonna make money We're gonna put in those lines. That's not right. You talk about transparency when we had other issues, and y'all gonna have transparency on all these things? Well, it's not on this one. A lot of us have live on pensions and fixed incomes. $20,000 and a lot of money to me and a lot of people on our street. And it's wrong. You need to go back to the drawing board. You need to do more a lot of more research on this and get the best for us. This is not gonna do for our community. It's shameful. It's shameful that we found out that they were gonna start working. And had a meeting last night. Uh at least, uh, Commissioner Eisner went to the meeting and he heard everything. You can ask your department. People were not happy and the numbers that come out. Astonishing. What are you doing to our citizens? That's crazy. If they don't have it in Clearwater, they don't have it in Saint Pete. They don't have it all the way down to, uh, Venice further down. You know that Something's wrong. Maybe we had the wrong company come to us , and maybe we need to go back out. Spend the money. You spend a lot of money on other things and get what's right for our community. Hi My name is Pamela Predmore. I live at 851 Bay Shore Drive. I'm here for Phyllis Atkinson, who lives at 840 Bay Shore Drive. She was one of the people that hooked on early early in the program, August 14th of 2020. She got a permit for the utilities to be hooked to the sewers. It cost her $1986. She had a company come out and connected her her. Her septic to the solar system on September 4th 2020 it cost her $4975 to do this. Since that date, she's had six emergency, clean out calls for insufficient lines and grinder pumps, failing over eyeglass wipes being put down a toilet. Um they've had to change the pipe twice. So since 20 September 4th of 2020 until August of 2023, they have spent $6038.94 just trying to maintain greater pumps that are insufficient into lines that are insufficient in our road. Thank you. There any other public comments on anything? That's Keep coming. They. Uh, Jim Warman. Uh, 754 Bayshore drive. Um I would like to start by saying we do support this community. I am a high school graduate at Turpin High School. My wife and I were married 33 years ago here in tarpon. We just bought our retirement home two years ago. We believe in this community, but I like the rest of my neighbors to understand that the burden that we were given late notice to Shifts a lot of cost to these residents for a system that, as people are pointing out, are not the best choice for the community. We understand that you got using ARP funds 1.2 million to put that infrastructure in. But I got a quote $18,000 to put in the system. And then I can count on failure after failure and year after year, spending more thousands of dollars to maintain a system that we really feel like Maybe this is rushed a little bit. Take a little more time to look at what the best solution is, especially when there's information out there that show this isn't the right system that We understand what you're trying to do to the environment, get rid of septics and things like that. But this does not seem like it's the best choice for the community. You see a lot of people here that are upset that it was short notice. Somebody shows up knocks on my door asking me to show him where I want the connection. And we just had a meeting last night . So two days before the meeting, somebody's knocking at my door. That's really not the way This is supposed to work when you're serving community. Thank you. Robinson nine for a bay or I want to reinforce what Josh and Janet and Elaine and others have said. We are in favor of moving off of septic onto sewer. But we want a sewer system that works. And that doesn't seem like a difficult uh, thing to ask. Our notification. Our official notification. Of course, it wasn't official was one of representative of the developer showed up at our door two weeks ago less than two weeks ago. With an electronic notepad and wanted me to sign off. And I'm gonna quote him on where our grinder pump was going to be placed. At the edge of our easement on our property. He didn't say we're the one way valve is gonna be placed, he said, where the grinder pump is going to be placed. So there's confusion even On the contractor side. We Nick Makris was kind enough to come the next day and start the official process of telling us What the city had. Plan for us, but that wasn't the first we heard of this, and I'm gonna quote from something in Florida statute 381. 0.00655. The publicly owned sewage system must notify the owner. Of the on site, sewage treatment and disposal system. That's the citizens. Of the availability of the central sewage system. No less than one year. Prior to the date, the sewage system will become available. The publicly owned or investor owned sewerage system shall notify the affected owner of the availability. Of the sewage system. So in other words, City Hall has missed your own deadline by six months. We're told. This system will be ready in November, and we have a year from that. No, we don't. To hook up. We've got two years from May. In other words, until May of 2026, according to Florida statute. Plenty of time. To Drop the stupid idea of a grinder system and put in a proper Gravity system. Thank you. Is there any other public comments? Um On on Let me just say the sewer system at Bay Shore. Ranch. Yes. Alright. Um You wanna say anything about that? The Bay Shore sewer system . I I'm I'm not gonna let you all leave without at least hearing something from us. So do you wanna say anything or Again and they were talking about grants for I mean, we can Look at those things. Um, we can look at all the things that were mentioned. Last night at the meeting. However, we did extensive study. When we did this and looking for the type, Um and I don't know. Uh, you know, we've been looking at the material that sent. We're working on getting our own material for the residents and stuff, you know, uh, just to verify You know what we did and what we examined and where we had our engineers look at, um This wasn't a system that we did on the cheap or or in anything else. This was anybody who knows and again. This has been talked about for 20 years. Um in our process. Um when we got to the analysis, um especially after we did the upgrade for Bay Shore Heights, we made the lift station and paid extra. Have it updated So this future Um the future ST could be done. We looked at the message with that land and the topography. Um I'm not so sure Anything's changed with the land and topography that's gonna change it from that being the system to go out there. Um but we have looked at everything that was submitted last night. We're looking at our own information to verify it. Um We will. Look I mean, we've got a great grants person that we have to see the availability of grants in the future for it, but we also got to recognize there's lots of Uh, resins on that street that are are waiting and been waiting and been calling us for years since the Bay Shore Heights. Um they was updated, um , to initiate their process. So again, we're analyzing on looking at everything you said, But we looked at it pretty thoroughly the examinations of what methods would work and be able to done there. And uh uh, you know, we're going back and verifying from the information, but we've already looked at some of the information and, uh, you know, we Those answers that we research it, OK? Um Let me let me just add a couple of things. Um You know, we this bay shore drive. Uh, sewer. Um Project, uh, sea Breeze drive. Uh, these things didn't just bring up overnight. Um, the space war drive. I remember before I was even the commission hearing complaints that the West Bay shore. Uh, development. The sewer that went in there that mirror, uh, former mayor pros was talking about, I think stopped around her house, and it didn't go all the way out to the end of Beore drive. And why didn't it and it was put on the shoulders of the, Um uh, on the city staff and commission to try and understand why that hasn't happened. Sea Breeze got approved and bay Shore drive, Um Bay Shore Drive got approved as well. Um but it it and you know, in Tarpon Springs, the squeaky wheel Uh, gets the oil And I can assure you people do weren't here. Uh, I don't wanna use the word politicking but lobbying. To get that sewer system in Um They wouldn't have gotten in There's other priorities as well in Tarpon Springs. Um As a former engineer, I can kind of suggest to you that, uh, gravity system is probably not, Um, um out of Out of the, um Out of the possibility. But you're gonna have live stage, not lift stations. You're gonna have, um, basically a manholes, um, were capturing the gravity feed? Probably not as many as you, uh, probably more than what you would like to see on your street. Um well, I'm just saying that if you wanna gravity feed, as the city manager was saying, you gotta work with the laws of gravity, the laws of physics, you can't violate physics. Water, among other things, runs downhill. They're going to have to run downhill. You can't run them. It's a quarter of an inch for every 10 ft, or whatever the rule is for sewer, which means that it's got to go from your house to wherever the, uh to Wherever the uh uh, manhole is it's gonna receive your product, And then there's gonna be a basically A, uh uh, a pump in that that pumps that to the next one down the street. It's a domino effect. And that's just the way it works. I'm not coming up with these designs. These are very traditional characteristic designs, And, um, on top of that , Um one or two of you mentioned your septic system being in the back of your house. I I can assure you if your septic system is in the back of your house and your sewer hookup is in the back of the house, it's gonna be an interesting thing to see how you're gonna get a gravity line to the front of the house to the street. And so I don't think that just because a gravity sign gravity line is the way to go. You're gonna get gravity. Not unless you wanna basically redesign your sewer system where it comes out of your house. And um, I know some of the houses out there. I've been in tarpon for all my life. A lot of them on slab on grade. You're just gonna have to deal with that. Which means that you're gonna wind up even with the gravity system. You're gonna have to have a grinder system anyway, to push the sewer coming out of the back of your house or some other part of your house that isn't conducive to a gravity line to where the gravity line is on the street. And then the other part of it is it doesn't matter whether you've got a gravity line or whether you've got a, uh a pressurized line. You're still gonna pay to demolish your septic system to crack it open, Fill it up and dispose of it. So the cost that you're talking about, Uh, hooking up to any kind of a sewer system is still gonna be incurred for demolishing the existing septic system that you've got. I. I know it's not a, um, uh probably , uh, I It's very, um, um, upsetting in that sense, and I'm not arguing with you on that. As a matter of fact, I don't even argue with you. I'm just stating you some of the things that I haven't heard tonight that are important to hear from somebody that's gone through this before this thing 25 years ago. Um we've got a contract that's out on. That's bin Laden. Um, is it 800,000 Is that what it was little more than that they're working. Um we could certainly, uh, you know, put a hold on it. Uh, to, you know, for a couple of days, just but the company that day look I'm just telling you something. There's a contract out there at $800,000 contract. If the city says we're gonna cancel the contract, that contractor is owed the profit on that contract. And then again as the city manager say this project. This area has been studied to death. If we come up with a sewer system, a gravity system the way I described it to you where you wind up with a half a dozen 8910. I have no idea, but certainly it's gonna be more than what you've got, and it comes out to a five or $6 million project. You're not gonna get sore. It's a fact of life. You wouldn't be getting sewer right now, unless a lot of your residents didn't come forward in stock talk to this man and his staff about the timing of putting sewer and then let me just say the other thing. Tarpon Springs and I heard a couple of y'all say this Tarpon Springs prides itself in being environmentally sensitive. And the two streets that have been the most sensitive in Tarpon Springs has been bay Shore Drive and sea breeze because they're both. They've got the golf on both sides on sea breeze. And you've got Kremer by you and the river on the other side, and so to say all of a sudden we're gonna just, you know, come up with a cost. That's $5 million, and we're not gonna do it and we have another cost that is a viable option to address the environmental issues. Then you know what? What do you do? II. I don't know. But here's Here's what I'm here's what I'd like to do. Um Technically, we can't have discussion items that are not on an agenda. So what I would like to do is have the, um , ask the commission to talk it over with the city manager. And see what they wanna do. They've heard every all of y'all tonight . I've shared some my thoughts to you tonight. I'm flexible. You know you're living there. I'm not. I'm not going to buy a house on a shore I. I live in 25 ft. Above City. Um my house is 100 years old. It's had gravity for I don't know how long so you need to be the ones that are happy. Y'all need to be happy. And all I'm saying is that that may not be, um that that man you know you're seeing it kind of through AAA kind of AAA lens in the way you wanna see it, but engineering just like the medical profession is a reality. Just because something is supposed to work doesn't sometimes it works out that way. And I would, uh, my name is Audrey Hinton. I live at 904 Bay Shore Drive, and I would encourage you to look back at your research and update your technology investigation because there has been innovations in medicine and in plumbing and in sewers. So what you have is a system that you looked at a few years ago. And you got this money. And you've allocated it to this project and you pulled it off the shelf and you're ready to go. But things have changed. We have learned that the systems don't work. We need to look at different technologies, and we need to find a Better way to deal with our sewage on tar on Bay Shore Drive. We all would love to be carefree of our sewage. You're not looking at people that don't want to accommodate environmental impacts. I mean the nitrogen waste that comes out of these systems impacts our waterways, but we need to have a system that is reliable and may have to be the latest technology instead of what was discovered years ago. And so I would encourage you to look back at that and reassess it as also looking back at grants that may be available to help offset the cost to the homeowners. I mean, there is a grant that was given to one of the, uh, not Bob Robertson last night, but to another fellow that is a current grant that is available for 2425. And so we need to look at ways to make this successful. In the years that come, we don't want to be spending $1000 a year or every six months for a new pump. We and we want our systems to work and we want to be environmentally friendly. So Please go back and look at the drawing board and make some changes at this. Thank you. What Um, a couple of a couple of commissioners of the light on to say anything, I. I really don't want to, um, kind of get into a AAA back and forth on this thing . Uh, we understand what you're saying. Do you have comments on Bao Drive? Go ahead. I do. Um, I live at 745 Bayshore Drive. I mean, we've heard from a lot of people here. I don't want to be redundant on this, but Any time you're talking about $20,000 in this kind of environment. I mean , the economy isn't actually you know, great for everybody right now. I'm sure some people are thriving, but not everybody. $20,000 There's a lot of money for other people to make decisions without any input from the homeowner. We feel like it's been jammed down our throats. You're making the decision for us spending $20,000 on a system. We never got a chance to talk about Vote on. And we never got a chance to You know, discuss options that somebody would listen to. So instead you get the grant Nothing out of your pocket. The 1.2 million, OK, that's being used on a system that nobody here based on the meeting last night is in favor of So I just don't see how it's benefiting Everybody here who's knocking on your door telling you that we need to change the system because I haven't heard it from anybody in the last night or today, So we're just Please, asking you very politely. Please look at other options before we move forward with a $20,000 investment that We have done research on it Looks like it's a failure. That's all. I got them. OK, um What? Um what? What I'm gonna do is, uh, as I said, ask the commissioners to talk to the city manager. Um he's gonna do his own homework. As far as this contract that we've got the contractor was, uh, that was so Is it kingo roofs? King of RV. Flamingo Yes. Yeah, They were, actually, um, We've had some, um , you know, we basically the contractor that, um got the bid is especially efficient of getting in and getting out. They do a good job. They did the intersection at Tarpon Avenue. Uh, which went almost painless, uh, to get that done, so we were very happy when that was done. Um The commission in in you, You know, you've had your say with me. I mean, not with me. But the commission this evening you have your say, I want you to provide some Come back, uh, to you, in a sense for something for you to think about, as well as far as the location of sewer in your home. It's still gonna cost you I don't know how much money to demolish the your your septic system, fill it and, uh, whatever else goes along with that, um and I'm gonna ask the commission to, um Talk to the city manager based on what they heard tonight and feel free to call them as well. Call me as well, if you like, um and see what if there may be another agenda item where we can discuss this in more more length in the future, that that's what I wanna leave with you tonight. No Hillsboro County residents are not paying a dime for the conversion because these systems do not work, so I wanna know is The city looked at any other grants for its residents in a project like this II. What you're saying is, uh is basically I understand what you said it consistent with what everybody else said, And there's a lot of variables here. Yesterday I was shocked to see orange trucks and heavy equipment on the street. Lawrence being painted. Today. There's a drill on there and a saw. The general consensus is that very little notice. If it all was given to residents. I'm one of them. Not everyone on the street wants a change. 15 years ago, my wife and I committed a good deal of money. To a high tech. Sewer system. It's complete on our property. We had to dome To accommodate A purple pipe brain system. The high tech system is as large as an SUV. I don't need The contact. To be connected to an existing to a new system. Where I have or what we have is a system in itself that was mandated. By by Ellis County Health Department. By the city of Tarpon Springs. And I am upset. That we have not had input into this decision. And, uh, I am one that, uh Questions the transfer of maintenance. And the financial responsibility from the city to the homeowner. I rest my case for that, but, uh There is something very, very wrong here as far as I'm concerned. And all of us last night felt as though it had been jammed down our throats, and that's not what we expect from the city of Tarpon Springs. We love the city. We want the best for it. And it's a major issue granted. But uh, the current status quo is not satisfactory as far as I'm concerned. I don't even feel as though I have to connect to this. I've got neighbors who Are impacted. I believe all of y'all on the board should have gotten a copy of it, indicating No extensions of their time frame for their development order, And if you read it It goes through and listing all these different executive orders that were issued for hurricane In But then they like to throw in Nicole, which was even two years before that, and they're now saying they've got four years 576 days that their development agreement orders are valid, which puts it to January. 30th of 2029. Hm? That's interesting. January of 2020 all these dates and if you actually look at the letter They try to claim both EN and Nicole two years and there's a whole bunch of leg rigor Moro in there. So we're trying to get an understanding because we requested this information. There's also a schedule of their plans as to when they want to, uh, do their things. There's a schedule of all the fees. For each of the permits. So we got all this through our records requests, and we now go to the city and say You got this April 18th. What is the city's response to this? Have you validated or verified those records? Are those dates actually correct. So we sent a very Nice letter. Official letter to the attorney, Mr Salzman and copied to city management course asking for what has the city responded to And, uh, I have to say I really kind of Thought you were kinda blowing us off and saying, Well, it's not a records request. You're asking a question and Mr Salzman will get to you when he's got some time basically, is what it said. Well. And I would have to if the people were still here when the general was asking how he knows you make a records request. Because that seems to be how it is. If you ask a question If it's not an actual records, they won't answer the question. But we now have resubmitted our request in a records request, and we hope to get some Validation as to what the city's response is to Morgan Group and Hill Ward Henderson's Statement of their dates. And from what I understand the city received a check for some funds for 81,000 Plus for permit 21 +3073. Which is for the groundwork, construction and clearing and infrastructure and such of that nature. Now, I would have to say maybe the city needs to go back and look See if they really have all their permits, and they say they have Cause I don't know if you've been looking at permits as much as we have. So I would ask the board of directors as the employer of the attorney. To ask your attorney To look at our request. And respond as expediently possible. Because that attorney is your litigation attorney and not your sitting attorney. So if you're not got a lot of litigation, maybe that he's working on Hopefully, then he should have the time and the ability to research it and respond within An adequate time period. Thank you. I'm here tonight to officially informally announce that I'm running for seat two. It did not arrive at this decision lightly. Had to Undertake a poll to see if that was the right thing to do because I had applied for the See you gave it to someone else. And I was under the impression That that person was not going to run for that seat, waited a long time. Ran that pole twice. 80% or so Said. They wanted me to run. So now I gotta run. No way to back out of it. Now I got people literally begging me by email to run. I would not have filed to run for the seat. If this gentleman would have Filed to run Before me. That would be ludicrous. There's another election. But it's too late now. The way this thing was communicated about that procedure. And the way you communicated about that procedure and how we came to this place. And people are afraid that we're going backwards. They cleaned house when they got most of these board members up here. They wanted a whole new fresh perspective, not this rampant development. They wanted to preserve. Their way of life in Tarpon Springs. So we got a whole new board And then what do you do? You go backwards. What's the first thing that happened when you appointed this gentleman? He appoints someone who is the biggest developer in Tarpon Springs. Of the Charter Review Committee. So Are we going back to that? Is that what you guys want? Because if it's not, you need to let the people know what you do want. We wanna preserve our community. We do not want rampant development. We want redevelopment. You want to redevelop dilapidated parts of this town? We do not want to tear up land. And oh, build. Skyscrapers. No. That's not what the people want. That's not what they're telling me. What are we doing? Going backwards or are we going forward? I'm running to go forward. To preserve our way of life. I just I just don't know what You were thinking, I just can't imagine. I mean, you didn't have to choose me. You could have chosen anybody else and I know you wanted experience. But you know who didn't have any experience? Craig one never served on a board. Did a great job. With zero experience. Did you ever consider that Phenomenal job as vice mayor. He didn't have any experience, but he was the right man at the right time for the job. But you want for experience. Well, there you go. You know what kind of experience you got? The kind that flipped the table on you. So you got what you got? Let's try to move forward now communicate more, please. City manager just reach out to people when you be It would be nice years before But at least you know, a month 90 days before you're gonna break ground on somebody's street. Why would you not do that? Why And I mean no disrespect to you, Frank. We just simply disagree. On government and on development. That's it. You don't have to be disagreeable about it. I have no harsh feelings for you. I what I said. I'm the only one that got up here and congratulated you. I hope you realize that Because I believe that they had a vision. Uh that because of that, and it doesn't matter whether it's a not anonymous or not, It's still a public record, but it could be a public. Uh, First Amendment issue. Would you like to explain that and I and I think I've asked each of the commissioners to read it, and then we've got to figure out what to do. As soon as we can go ahead, Mr Lewis. Yes, Mr Mayor. Yes, the question. Uh the online comments . Uh, that was the email that was provided to the board. Um obviously the, uh, rules of procedure allow for, uh, people to email in, uh, comments to the board and that they be read into the record. Uh but there are also decorum rules that is in those rules of procedure, namely , uh, making slanderous or, uh, impertinent comments or the impugn the personalities or motives of any members of the commission. It also I always like to bring up the fact that under the floor statutes the purpose of public comment is to provide the board. Information on how the board feels about what it's going to be before it votes on something, Um The email itself specifically says it's a general problem. It's a general comment and not directed towards any specific um, of the voting any anything that's on the agenda. Um So it well, obviously. It's uh, public Communist to be liberally construed to allow people to provide their opinions and have voice voice to their to their governing body. Um, it does not specifically That a category of anything that's on the board that is on the Um, agenda and again. It also doesn't also, I would say makes. Com uh, makes comments on commissioning, Uh commissioners, characters and motives that said it is also related to there's also comments about related to the elections and you don't want you don't want It's also you, You always want to tread lightly on issues of the First Amendment and having someone have their voices heard. Um, especially if it's involving. Um Of elections and people who are go and people who are Being who have put their names to be on the to be to be elected and the outcome as well. So With that said, Uh, I do think there was potentially some I there? I see there is a there is the argument that this would fall would this would have some public some First Amendment protections even though it's Not necessarily, uh, it should not be, um It can be. I think it does not fall under the rules of the rules procedure. So it it it . I mean not to put you on the spot because I ask the commission anyway, Um you're recommendation would be to read it. The safest I'll be honest with you the safest Safest for as the board's attorney, and to avoid litigation, the safest the safest asset. The safest way for the board is to Read into the record. Because then no one can claim that there's any. There's no public. There's no uh, First amendment violations, however, and anyone who anyone on the board who feels that they're, um beliefs that their personal record, their personal character is a bit impugned by these comments. Still still have any sort of arguments that they would make on a on a liability standpoint. Um they're not foregoing anything other than what's normally there for, uh, public public officials. But I, but again, I stand by my argument that it is not that is it would still be a Um It would still be a, uh it would it would still be not covered under the pub. The decorum standards in the rules procedure. OK Um rather than getting into a discussion, Let me just ask the commission. Uh, since we do things in the affirmative. Is there a motion to read the, uh, the letter or the email that received into the into the record? Is there a motion from anyone? I'll make a motion that the letter be read into the record. Is there a second by anyone? OK so the motion dies on I'd like to make some comments on it may pardon me. I'd like to make some comments on it. Well we don't. It's the same argument . We don't have a motion. We don't have anything on the table. This is public comments. This is an agenda item is for the purpose of clarifying so we don't We don't have a motion. Um and it's uh, we did have a motion and we didn't have a second, So it died for lack of second. And that's the end of the issue. The email is not being read, but married. The city attorney made some statements that he needs to be corrected on when General public comes up here for public comments. They're allowed to About any issue, they're actually stopped from refraining. And they're from speaking on any issue of which a voting item is supposed to come up. Because then they can speak during the public comments on that agenda item and we've also seen in the past. As commissioner Mike EER just stated half an hour ago. People have a right to free speech, but not hate speech. So as I read it There's nothing wrong with that. AOL. It's criticism, but yet you're stifling public comedy. It's not transparent for these. It is a public record. So anybody that's interested in getting a copy can certainly request it through the city Clerk's office. So do do you have anything else? Yeah, and also we talked about, you know, for years, Uh, commissioners were getting criticized. And now all of a sudden when this board You know, criticism. Face to face. They run away from it. But yet they're willing to come up here and say that free speech is free speech, so it's not transparent. It's obviously that you know, we can't handle criticism, and that's just not reflective of good government. So thank you. Well, let let's stop there and let's move on with Nothing has changed in terms of this commission with being a, uh uh, Open me open commissioner. It's just that there's a proper place and in a procedure and a process for everything to happen, So that's the end of our public comments. Um let's move on. It's after 730 . So let's go to the resolutions . We have one resolution, which is the, um resolution 2024 sister cities, uh, relationship with the island of Vegana. There's three parts to that. Resolution of the board of Commissioners of the city of Tarpon Springs, Florida, forming a sister city relationship with the island of Aegina, Greece and providing for an effective date Hereof. Uh, this resolution is basically, um Uh, following up with his sister city's organization and their recommendation that we should establish a sister city relationship with the island of Egana. Uh, to have a sister cities and I wanna talk to you when we get back at some point about, um Um there's a process that you can go through for, Um um Putting a making them dormant that relationship that sort of thing, And that's part of the trip to, uh, Hydra. The numbers that I gave you are are kind of, um, except for the airlines. That's pretty good. Um Dolly's, uh, we're paying for Dolly's way. Uh, the, uh, motels at Hydra are a little bit expensive. I think there's three or four days that are planned there. Uh and, uh, the mayor of Egana, and they're their government, I think is picking up the accommodations. Um, for Agen and They come over here, we'll We have to reciprocate that as well for them. So um, let me go to public comments on any of the expenses. I'd like to make sure you would like to make if there was a choice between if I had to make a choice. Whether I would go or Dolly would go, Dolly would go. So I'd like to make a motion, uh, to the effect of paying these expenses, but including Airline ticket. Very transfer. And meal fees. When they see that the city's paying for not only you but your your wife as well to do these trips, So I'm just telling you that you as the mayor, you're official. You represent us. It's another thing of what invoices I submit. And um you probably not gonna I appreciate the thought and the consideration, But you're probably not gonna get the invoices concerning Dolly on that, but, uh, the city attorney's got something to say about that, too. I would want to. I would just wanna confirm with, uh ethics and gift laws before that, just before, uh, that would be that would be done. Just because you don't want a good gesture to turn bad. But if I don't submit the voices for her that it's fine. I mean, nothing. Nothing was paid out. I understand, but I would before any sort of, I would SI would rec. I would caution against it. Uh, today we're recommending, authorizing, uh, the five year renewal for our utility rehab and construction services. We're awarding all four contractors that bid. Uh, this is an important procurement tool in our toolbox for emergency repairs for as needed repairs to water and sewer utilities. And uh, we usually also use this for, um as a procurement methodology for capital projects , and, uh, we've had good luck with this in the past and good success. Uh, getting projects done, uh, on time and on budget. And we would strongly recommend approval. Through any questions. Uh, let me is there any comments from the public concerning this item? Um, any commissioner CS Go ahead commissioner, Vice president I'm just curious because Things changed. Was this the, um agenda item that had the four different contractors on it? Uh yes. So my question then would be How do you How do you award four different contractors ? Um, projects They're all different prices. The This is not uncommon that we would have contractors. All the unit rates will be included based on the original bid items and, uh what you this is only an authorization to allow us to, Um, uh, a spending authorization. Over the course of this contract for five years. So uh, occasionally we have multiple, uh, contractors that can provide different services. Uh, We can award based on unit prices for any individual project, and, um We also have some areas where certain contractors might have, uh Areas that they're particularly, uh, qualified in and we can award on that basis, But we always keep an eye on, uh, keeping things. Uh, Affordable and doing good financial management for the utility. I still need to know how you award You know, because they're priced very differently. So do you go for the cheap one for or the inexpensive one first , And I mean, that's I. I just don't know how you award for four different contractors. That's my Real question. Uh, we would have a $1.6 million authorization to be awarded that could be divvied up in a variety of ways. Over the course of each of those five years, uh, based on performance of the various contractors as they work through various projects and repairs for the city, and we might also hold back some of that authorization in the event that we needed like to bid a particular capital project or for an emergency repair or something of that nature, So we probably won't be awarding the entire 1.6 million right away will be awarding it to our, uh, a smaller portion of our contractors. That's to be determined and then As we proceed through the project or through the over the course of the years, um, that might that might change. See, I'm not able to see, uh, find this. But I know that the four bids were very Large differences in between them. Correct. The total bid items were different, but those were based on stock quantities, so for any individual project or repair, the quantities might be different. And so the best value of the city might might be represented by one contractor. That might not necessarily be the low bid for the entire bundle of services. Well, that is like a very I. I just never seen a bid like that. Where you know you play in meeny, miny mo So, but OK, I, I mean, Listen, You're the one that has to handle it it it's just a little difficult, you know? Thank you. Direction on the 2040 comp Plan Update and adoption City manage course. Yes, Uh, Renee Benson. Good evening, Mayor or vice mayor and commissioners. Renee Vincent, planning a zoning director. Very happy to be before you to give you, uh, an update on the 2040 comprehensive plan. Um, update where we are in the process, and , uh, hopefully get your agreement to move forward with, um, some final engagement and, um, start a public hearing process. So um, just a little a little background. Um, for people that may not have been following us through the process, so we actually first started this in August of 2021. We had a consultant on board that helped us with some a lot of the technical analysis and the mapping and the community engagement early on, Um, we went set, then set forth to really doing the drafting the details, um, updating the goals, objectives and policies in the data and analysis. And then, um, I think this was a very fortunate, uh, thing that happened for us. The planning and zoning board. Um really stepped in at a point in time when we really needed some additional direction, and they they really guided us through the end of Process. So we conducted, um About 13 public workshops. Uh with or you know, workshops with the planning and zoning board going element by element through this update. So that preceded us, uh, to where we are now, And so I wanna go ahead and bring this forward to the board. I'm gonna give you a very high level overview again, um, hoping you don't have a million questions tonight on it. There's a lot of data here, but we'll be back in front of, um, everybody, uh, in multiple engagements, uh, to get additional input before we finalize and go to public hearing. So um, we're calling it tarpon tomorrow, planning for the future and preserving the past. So just a some major findings. Um Through the course of the 2040 projections. Uh, We're expected to have a population increase of really only about 2600 persons, and that's that's slow, incremental growth through 2040. The number of households is expected to increase by approximately 1300 the functional population, which includes our service area for utilities and seasonal population again, Um, you know, incremental increase up to almost 37,000 by the year 2040 total employment projections. Um, almost 3000 jobs, um, out to 2040. Most of this will come in the service sector, um, and commercial sectors. Um at the at just the very high level, the city has a sufficient available land to accommodate expected population growth, Um, with no increases to, uh to residential density. Um we have a very minor exception on the intensity. I'll talk about that a little bit later. Um we have sufficient water and sewer capacity to accommodate our expected population growth and economic expansion. Um And then there's a data point for those interested our population per square mile. Um, is around 27. 57 27 52 is what it would, uh today, um, in that, um, is not a not a big increase from 2010. But it's S quite a bit lower than our comparable cities around us. So we we're in a comfortable place, so to speak. Um major changes to the plan. Uh, obviously all the maps um and data have been updated, Um, the really big poor. Uh, New piece of this is the creation of a place based area map. I'll talk more about that in a moment. Uh, we've consolidated a lot of our future land use categories and rename them, uh, to align with the Countywide plan. Um obviously just removing outdated policies and completed actions. Removing repetitive policies. Uh, we do have it reorganized, Um, based on the strategic plan, focus areas, um and we've obviously included updates based on what we heard through our community engagement advisory board participation. So you had a lot of documents attached to the, uh to the agenda back up. Uh, you have the comprehensive plan itself, which is the introduction, the background findings and population projections and then the 13 elements themselves. Uh, you have a map series. You have the actual future land use categories and rules and all that's been consolidated into a nice table form. And then you have a definition section and then your supplemental data that's not intended to be adopted. That's the data and analysis. Um the actual work plan, which is our follow on things. To happen as a result of implementing the new plan. Um we have included sustainability crosswalk, uh, to show the integration. Uh, with that, uh, sustainability action plan, And then you have the community engagement summary to date. So as I said, they have 13 at comprehensive plan elements, and we'll read through all of these, um But, uh, that's makes makes up the bulk of the plan and one of our biggest challenges. If you recall when we started the comprehensive plan, we were also at the same time be embarking on drafting a strategic plan for the city. And so there was a lot of overlap between these between these efforts and we wanted to consciously align these two plans. And so the 13 elements of the comprehensive plan are now organized under the six focus areas of the strategic plan, with the exception of the sixth one being community engagement. That's in the center and that really kind of ties everything together, so that's how the plan is organized today. Um I won't go through the high level. These are just high level population employment projections. I already talked about them, Um, at the macro level. That's the detail. Uh regarding, uh, population accommodating population growth. So in order, um to accommodate Our population growth. Our data indicates that we need approximately 12,600 total housing units to accommodate existing and future, Uh, housing, future households. So interestingly we have over 13,000 housing units in the city today, so why do we need any more housing units? Well of those about 1700 are classified as vacant and that's a fairly consi. That vacancy rate is very consistent not only with Tarpon Springs Throughout Pinellas County. We have a very high vacancy rates and those are really because of seasonal short term rentals, Second homes, things like that They're not available to accommodate those households. And that growth um So while it looks like we have plenty, um we still need to be able to accommodate additional additional units throughout the planned period. We do have over 550 pipeline units. Um basically , those that are have been approved and or are under construction. Uh, that can accommodate that additional growth and we have additional vacant land that at current densities that can can accommodate, you know, over 3000 units. Um that's probably a little high when you start really narrowing down the valable. But that's just a you know, a high level number. Um, again. That's just the more detail on our vacant lands, Inventory and those those Those projects that are included in those that what we call the pipeline projects. It was previously approved. So the future land use element itself. Um We, uh we again we consolidated the future land use map categories to align with the Countywide plan. There are no increases to residential density or floor area ratio in any flu category. F category. I do have one minor exceptional talk about , uh, we did create this place based map to provide guidance, uh, on future land use and rezoning requests. Um and then we've included policies regarding heat severity and tree canopy. Preservation. Um So the this is just kind of a crosswalk of the current Future land use map categories to the proposed categories and the notes about changes. So as I stated at a high level, there are no increases in density anywhere in the plan. Um there have been some minor adjustments to lodging densities in a couple of categories. Um nothing over 40 hotel units per acre. Um and then the we have do have one category. It will be called Retail Services Limited. It was the old residential office retail category and, um That category today has two different floor area ratios. One is a 0.2 for retail and a 0.3 for office. The proposed category will have an overall 0.3 for all uses. So that is the one minor increase in floor area ratio that I just wanted to make Sure I was transparent about And then this is a continuation of that table. So the place based area map I think is, um To me is one of the more interesting things that that have come out come out of this planning process and the so the intent of this is and I'll just read the policy associated when, when making decisions to amend the future land use map or zoning Atlas, the place based area map and area description shall be considered. So there's I believe nine of these categories, So this is really a higher level map than the than the future land use map And so you have, you know, we have what we call a neighborhood suburban. That's kind of Tan color around here and these are, you know, established suburban neighborhoods. Um you have the special area Plan area that's established plan around it. We have what we call neighborhood traditional, and these are the areas that are adjacent to downtown. The docks. We've recognized the waterfront mixed area. We have the intensive working waterfront. Um we have an environmental reserve overlay , and it's as hard to see because it's a like a S a dot or stipple. And it actually overlays areas that, um And you have an opportunity should be either are already preserved or should be preserved with those opportunities become available, Uh, the agriculture we have an agricultural residential estate area, and that's this. You know this area up here in the dark green that really abuts up to you know the, uh, the Anglo River areas and then the Pinellas County unincorporated Pinellas County, which is extensively agricultural lands. So these are just a little more detail. I won't read through all these the descriptions of all of those, Um, there's very like, you know, place based areas And what what should you know? Be considered in those areas when you're evaluating a request for changes. The transportation element with establish a safety as our highest priority. Um Absolutely recognizes the need to minimize the potential for transportation related deaths and injuries. Um it also directs the update of the old 2007 multimodal Transportation district quality of services analysis. That's a mouthful, uh, to support a more comprehensive, citywide multimodal master plan. The coastal management element. Provides guidelines for determining the suitability of development and sets forth policies to reduce risk to life, property and infrastructure and increase with resilience to coastal flooding and sea level rise. Uh, previously, the coastal management and conservation element was one element. We split those in two because they kind of have different focus areas, so there are two different elements now. The conservation element is very closely aligned with our sustainability action plan. It establishes goals and objectives and policies to guide decision making to protect natural resources. Uh to, uh, policy changes that are recommended. Um in this element, Uh, what is an increase to our required wetland buffers, um, at least to match what is required by the Southwest Florida Water Management district and to decrease allowable impacts to wetlands. So right now, you have the ability to, uh to Pack wetlands and do mitigation and that is being recommended to be, um, to be able to Rein that in or reduce those allowable impacts. The recreation open space element. Uh, we maintained our previous level of service standards with regard to our facilities. You know our courts and ball fields and things of that nature. We do call for Parks and recreation Master plan , um, that will update those level of service standards in the future. And we also, uh, established this this map, which is really a tool for how we can prior where we should prioritize providing infill parks and things, uh, for areas of the city that do not have good accessibility, walkable access. Only to an existing park. Uh, the lifelong learning element was previously known as the public schools, facilities Element. Um And really the biggest change here is, um, a kind of broadening the scope of this to really address things like workforce development and equitable access to education. It's a little broader than just public schools. A historical and cultural resources element. Um Uh, Does. It was amended to include, uh cultural traditions and foster alter a artistic expression. Uh, we have new policies to encourage, um some additional preservation plans and tools. Um incentives for preservation. Um and a new policy to, uh implement adaptation and resilience and planning for the historic district Sponge docks in the hope Athens Greek community. Other utilities element addresses, water waste water, storm water, um, and disposable, solid waste and all these we are, really, um, meeting and exceeding our delivery needs both now and for our expected population growth. Really The focus here for utilities is going to be replacing, uh, be beyond replacing, um, aging infrastructure. The capital Improvements element. Um Is, uh, evaluates the need for public facilities and this really focuses on Across all the comprehensive plan. Uh, really is to ensure that Level of service standards that we do have are maintained. Um uh, in in that way are during the Capitol. Improvement Uh, budgeting process through the through the annual budget that those things are being addressed , so it does call for a review of the budget through the capital improvements element. Uh, the property rights element. There's no changes here from when this was originally adopted. This is mandated by the state. The planet Administration and work plan. Um, is just that the plan Administration element provides guidelines for how you use the comprehensive plan, and then we do have a work plan. Um That goes from zero out to I believe, uh, 10 years, uh to and we've identified, uh, actions that need to take place to fully implement the plan once it's um, once it's adopted. And our governmental Interagency co ordination just recognizes our need for continued coordinating with our, uh, adjacent local governments. Um School board, transit authorities, water management districts and then there in utility providers. So our our next steps. Um, if you give me authorization tonight we are 10. These are tentative schedules. Um, and dates. May 18th we would like to have, Um, uh, a community review as well as engage the steering committee again, Um, at the, uh, community Center on Walton Street, May 20th is our regular planning and zoning board meeting. We don't have any scheduled, uh, Applications. We wanna use that that time to have a planning and zoning board hosted workshop where we can invite the other appointed boards and the public to attend. Uh, June and then hopefully, June 17th. We would have our first public hearing with the planning and zoning board in July, 9th would be the first public hearing with the board of Commissioners, and that would be the transmittal hearing to for Pinellas and the Department of Economic Opportunity. So that all stop. That was a lot. I went through it as fast as I could. I know it's getting late. OK let me go to, uh uh, Public comments. Are there any public comments on this item? The planning and zoning board took. Um I am very grateful for their input because they really provided guidance when we really needed a direction so Thank you. Um glad to be here this evening with you , Uh, I'm here in capacity as chairman of the Planning and Zoning board and I realized tonight's not to approve the plan or anything, but I just just wanted to share. Uh the involvement of the PNZ board in in this process we had, like Renee said 13 different meetings that lasted 2 to 3 hours. Generally I think, and we went through the document. Page by page word by word. And we made a lot of changes. Significant, uh Things that we felt were improvements for the community. The staff has done a fabulous job. Of pulling this massive endeavor together, and, uh, and PNZ board was just a small participant. But uh, I think we were more involved. Probably then, uh, traditionally and probably more than staff was expecting, but but it turned out to be a good collaboration. I think we work together really well with them, and they were very patient with us when we sometimes Uh, didn't understand things as well. Uh so I'd I'd like to really commend staff for the effort that they've put into this as as well as, uh, my fellow board members on the PNZ board. I think everybody went above and beyond trying to bring a good product here, and I know you guys will continue in your review of it to just simply improve it even more and make it better for the people of Tarpon Springs. Uh I hope you'll be as impressed as I am with the product and pleased with what we've brought to you. Uh, if there's questions, I'd be glad to answer them. Ordinances for the adoption of the June 17th planning and zoning board that that will be the first ordinance to go to the board The June 17th . I was gonna ask. Is there any, uh, land use plan for the corner of Safford Avenue in Oakwood? I knew it wasn't, uh, reviewed in the last CR a program, So is anything gonna be done with that corner? Business wise, uh, housing or it's just sitting vacant for years. Is it city owned property as far as I think That's some of the city owned properties. Most of us that we deal with the county on that Pinellas housing. We've We've. Yes we've reached out to Pinellas County trying to trying to work with them on, you know, some sort of plan for those properties that you know the some of the some of the hits with those particularly nothing in this really affects that, um The challenges are what the monies that those properties were acquired with. Specify that they have to be used for certain things so That's part of our challenge. Yeah And believe me, all those vacant properties, oak, wood and even down and stuff where you know again, there was a plan that we had, and we were involved in back in 2007 2008 several different ideas Residential on top business on the bottom, a bunch of different things out there when the when the housing crash hit, Um it all went away. And then, of course, you know we're talking 2008 2009. It's 2024 that land since there most of us in control of the county. Whatever agency of housing in the county put into it. We've got some pieces in there. The best plan is to put them all together and to do something I know. Commissioner Cooley doesn't talk to me several people on this board and has talked about getting that plan going. And uh, one of our main projects in that area is to try to get everybody together. Um and try to have a plan. Uh for those areas and stuff that you're looking for, so it is top priority on our on our agenda for that. Yeah, we had and we've had conversations with the county. About how we can How we can work this, but it's you know, so we're it's in the works. OK because there were business people asking in the community about just what you were saying, Uh, business on the bottom and the Reds on top, So that's something that is in the in the plans to be looked at shocked to know how hard it is to find a developer that does that type of, you know of development for, you know, especially in the affordable housing realm. It's just it's a challenge. So what? We're working on it. OK, thank you. Are there any other public comments? In a book of All 115 Athens Street, and first of all, fantastic. This is finally coming to fruition. I just wanted a clarification. Uh, when you were talking about ordinances, I know there had been, um at the last PNC meeting . It was said that they were going to go over the, uh, proposed historic preservation ordinances on May 20th are those the ones you're no, that that's the that would be an ordinance to amend the Land Development code to establish that conserv. I mentioned this at the Charter Review Commission meeting yesterday, and I think it's important that we enshrine sustainability aspect. Um our vision into the charter Such that plan, just like the Comprehensive plan and the strategic plan, which is put into the charter is enshrined in the chart. So I would explore the board to look at that. But I'm thankful that at least some of the actions of Sustainability plan are being incorporated. And real quick. Glad to see that there was about land preserve and to look at those feasibility of acquiring those properties. Lastly I would just like to ask. I'm assuming that It regards the Properties or units or Coming into the city that Mentioned in the pipeline that including the For our For sure. Not going to happen. Thank you for your time. Um I did read through most of because I know we had a little bit of a data issue, And when it came, I tried to re read it again. Um so, I. I just wanted to touch base. It was excellent. I probably won't be here for the end of it when it finally gets put out, Um So I had a couple of questions, and this is not something that you have to answer right now. But it didn't really state. I know it. It had something to do with the Stouffer Pro Stoer area, and, uh, I wanted to know what is allowed on it. OK because there was specific comments made that it well, It wasn't specific to what we could put on it. OK, that was one thing. Um I do think also, there should be some stronger, um, consideration to having public transportation to the Anclote road, et cetera, et cetera. Over there since that is the new future Growth area. We should also be prepared to bring that information over to forward Pinellas, which I am happy to do. As I will be there tomorrow. Um There was a discussion and this goes back A while that, uh, we were looking to do, um Sidewalks for bikes and, um I. I will tell you this. I ride my bike around the city much. And we also have to consider having the overhead trees and other obstructions, um, taking care of, because what I mean by other obstructions. Duke Energy has these cables holding poles? Um and let me tell you something, There's a number of spots that you biker if they just blink can really hurt themselves. Um so that would be something that I'd like to see go into this. Um Then you had something on page 47. It was a It was your proposal that we had to go for, um, in front of forward Pinellas. And I just wanted you to know that was like number 145 on their list of 140. It is not even on their scale to do. There's no money for it. There's no um There is no nothing. So that has to do with. Um There were no funds. There was no time limit. Um it was I don't even know if it'll ever get on an agenda. You know, there was a discussion here about having that five years out when we were discussing that, uh, boat storage. I don't even see it being five years out. If we're talking about the Anclote road and the enlarging of it, it's just it's on there in notation, but there is no indication when that'll ever come down. Um I also do wanna have Um Like when you come off of Riverside Drive. There's a number of locations that have these Yellow or white stanchions to give you some sort of security and I think that those should be placed Um, on all the bike trails to give some sort of I. I know it's not gonna stop a cough from going off the road, but I think it would be something that we should have, you know, in our in our safety plan. Last but not least. Um when Vice Mayor Lunt and myself first became commissioners. We discussed that vision zero Um, plan that, uh, forward Pinellas put out and I've not seen anything pursue in that whatsoever in the two years that we're in office. So um, I, I do think they need to get a push. So whatever you can give me to push them. I am happy to take the ball and run with it. That But thank you, II. I loved what what it is. I've I've read through most of it and it it most of it is what we've agreed to and discussed in the past. Um through having staff and having all the input this This is It. It's not our charter, but it's our Bible to go forward. So I really like having some guidance for us and for the future. OK, um, any other Yes, ma'am. You had your light on first. Uh Mrs Vincent, I want I wanna thank you, Uh, for this comprehensive plan been a great job with staff putting together uh, one of the most important things I think in one of the major findings that you presented was, uh, the population growth and I you guys have a set up for a slow, steady growth over the next So many years. Um There was this thought that could possibly be up to 36,000. People from some other organizations in their Larger, uh, planning scheme and I'm happy that we were able to get that under control. As far as miss, Uh, Miss Taylor's comments were I I've been trying to work with staff that we try to get that area rezoned and there. I wanna try to encourage economic development because there's a lot of businesses popping up and , uh, we want some. At least I'd like to see it from some of the residents makes use buildings on the bottom businesses with some, uh, living up top, But the problem is some of those properties are affordable housing listed from the And so hoping there's a way we can. Uh, Get those changed or or come into our possession to really make that the walk ability and you know All inclusive walking area that the county initially wants the trail to be, so it's you know, it's a back and forth issue. So we're working on that. Um, as far as, um I. I know that We had an application come up for downtown buildings. There was, um, a about 2.0 for some of those buildings, ma'am. Oh, is it downtown? How does that relate? With what? We're looking at? Future liens categories. OK so the downtown area All of that is in the special area plan and the smart code, So it's like its own little mini comp plan, so nothing in here is changing anything That's in that, ma'am. Thank you. And, uh, this This future land use categories and rules and tables. Uh, it's very organized. It's very detailed when it comes to, uh, the different categories of land and permitted uses and density. Miss Vincent, Do you think we should be using this as we come forward ? We're making decisions with applications as this is gonna be adopted into the comp plan. Oh, that. Yeah that absolutely is. What What That document is the future land use categories and rules that is All that used to be buried in these in the elements and you had to dig it out. And thank goodness I have ally Ken on staffs because she took all of that and first brought it into a table of what is existing and then You know, converted everything into the new categories. So absolutely, that is, you know when, if we're rezoning property, or somebody wants to develop their property, they have two things They have to satisfy. One is whatever category they're in, and whatever their zoning is, And so , yes, that absolutely will be, Uh, you know, a daily part of what we do in the in the Planning department when someone calls and says, What can I do with this piece of property so and the intent is to help future boards with this guideline processing, too, for future applications. This is basically You know? Our Constitution or charter towards building applications in the future, So I just wanted to bring that up. Staff's gonna done a great job and the residents have really wanted this, Um To be updated, and so, uh, I'm happy to see the direction that's going and thank you all so much. OK? Can I take one moment to, uh I also just want to recognize my staff. Um, Ally, Ken. She, you know. She took something that's was illegible and turned it into a visual. Document that is functional. Open space, You know, it was very much Of them and massive collaborative effort, and I had the enjoyment of just kind of sitting back and evaluating and saying, Yeah, let's do this or let's not so it it was, you know, and with the planning and zoning board, you know, guiding us along the way. Um it turned into a really It was a great process, so I'm sorry. I didn't mean to interrupt your comment later. I just want to make sure that my staff got the recognition they deserve here. I know they've worked very hard as well. And uh, working with you on establishing this. Um, I do have a couple of comments. Um Sorry that on my phone To, um, in relation to this timeline here. Um Is so They Given the extensive nature and the importance of this of this Um Of this comprehensive plan. I. I think there needs. Uh I would like to see this broken into sections. And having these public having more public, um Participation in understanding this this plan and having more, uh The Because I'm only seeing the May 20th. So on May 18th Steering Committee Review Community Review is there is that a Is there? Public comment in that? We will. We will have those will be workshops so we will be able to take comment. Absolutely um, that that's the intent is to get feedback on the on the final draft of the plan. Um this is also up on connect tarpon, um in its entirety right now, And so we will also be pushing it out that way to get review comments. Concerns. Um I'm I'm I'm gonna be candid with you. I'm not looking to get you know. Like the same type of community engagement that took place at the beginning of this is That was good At the beginning. We needed all of that input to formulate this. And at this point, you know, so now it's about it's about community understanding of the plan. I Yeah, I would. I would suggest that we have at least one additional public. OK, but just that's just my we talked about putting some displays up in the library and some other options, so if we can we can get another community meeting scheduled in here. We we absolutely we can do that. I think it would be good and then I'm looking at, um And I know this is a tentative schedule. But July you have a July 9th. And I'm looking on our calendar and we have Uh, the board of Commissioners First Budget Workshop. On that date. So you may wanna Oops. Yeah Yeah , I know that will. We might wanna schedule a OK, I know this is I missed that completely in the city Manager's glaring at me right now, because that's a big mess. So in capital letters Tentative, So I, I take it It is tentative. Yes that That's really my comment. I'd like to see a little bit, uh, more opportunity for the public to understand the plan and, um and I thought it's so comprehensive and it's so expansive that if it was broken into sections, I think it'd be helpful. What? We don't Um And I'm very happy to see that the, um The economic development. We talked about that That's uh you didn't mention that, but that's uh, gonna be the 13th element. And um, and the thing that I didn't uh, miss I, I that I missed earlier. We're not gonna have it in time for the June, right? No, no, So that'll be an amendment to the complaint later date. Correct. Um On that. Um and I know that you mentioned that that was rolled into some, uh, consulting help that, um, was proposed to the commission and it was turned down. Um Is that something that you would like to have revisited for getting some help with that? Uh outside help, II. Um but, you know, once we've got this whole plan behind us, it kind of opens us up a little bit. We're asking the board to award a contract to Petrotech Southeast incorporated for the restoration of the Anglo Dredge spoil site in the amount of $452,758.20. Project consists of restoration of the project site that was leased from Enlo Properties LLC for dewatering and Storage of dredge materials from the recently completed dredging of the ankle River and the turning Basin. Um The bids came in under the $500,000 estimate and is funded in part from a grant from Pinellas County that was specifically intend intended to be used for site restoration purposes. And with that, that's my staff report. OK? Um Are there any public comments on this? This is for, um Restoring the site to the largely the way it was found. And that requirements rolled into the lease, and it's also rolled into the DP permit that was issued. I. I know that we talked that we're gonna be talking about the prospective purchase of the property, but, um, if the if it doesn't work out for whatever the commission doesn't want to move ahead with it if the residents don't, uh, approve it at the November election, which is what's proposed the um the owner of the stammers family would like to take possession of it as soon as they can, right after that day, which means that we can't wait till that day to decide whether we're going to restore it or not. It has to happen in ahead of time. So that that's the issue with the, uh with why are we talking about this right now? See manager, of course. Yes I'm bringing this to you tonight. As as said in the backup. Um we do have one last opportunity in talking with the ST family. Um, to purchase this property, Um Obviously, we just approved the item. We're gonna restore it by September, Close out the permits and do everything proper. Um with that, Um, the STA is family already begun. Plans um, to do something on that property, uh, for themselves in a project to use that property. Um they've agreed they've agreed to offer it to the city again. Um it will put them about a and one of the conditions is that we're able to get it on the November referendum. Way it would only cost them about six weeks of delay that if it wasn't approved that they could immediately begin with the project, um so it would cost them six weeks, but they've agreed to do that if the board goes forward. Um what I'm asking direction for tonight is what I would do First thing I need to ask you. Obviously, it's a major purchase. It's gotta go on referendum. A major amount of money. Um It's something I need to begin working on and spending some money for updates on appraisals. Um we need to negotiate the final sales contract and do all that and we have to do it within a time frame. Um to get to the when we have to submit it and the language, um for the referendum. Also I'd have to bring back to the finance, which obviously, the finance is gonna be some type of bank loan. Um, so we would have You got some kind of loan that Ronald Ronald be working on to put together, so it's a lot of work to put forward to bring to you a final approval of the sales contract going forward. Um but I don't wanna enter into that work and the expenses and stuff if this board is not willing with the price tag, or for whatever reason to go forward with this, um There is in preparation before we knew about that. I did get permission from another property owner to look at a piece of property. It's in the elementary stages. Um, as an alternative. It's I think, 9.7 it, it would. It would be something that would be only if we look at it and can fit. It would be only something to fit the spoil site. There'd be no room again. One of the things we have to look at with these pieces of property is that the spoil site, um, would fit in with the land and stuff. Um so that is out there, obviously smaller piece of land and stuff. Obviously it's a lesser price. But of course, the disadvantage. Um with the 5.5 million Appease the property. This boil site is now is that's like 17 acres, so there's extra acreage. I gave you some examples of in the future. One of the main things is they're gonna need to be a second storage tank of water, probably in the future. We're probably talking about the 15 or 20 year range. Um that we're talking about with the next dredge. But that is a future project where it would go right next door or it would go on the property and things Blazed. I gave you some other ideas. Maybe an additional Well, um, some different other we have no place to expand facilities. Public work. There's a lot of, but there's a lot of different uses that we could use that extra pieces of land for, um, but it belong in the future. But again, it's thinking in advance, almost like we did with the sponge docks property having that, because if you've been out there and look and you see what's around there and stuff, you know, five or 10 years there, there may not be an To have any property out that way. So he is thinking the fut future. But there is a lot of uses to have the extra land available for there. Um But it is it's just a question of direction. Do you want to move forward with that and go for the referendum where the people would decide? Do you wanna get any other information that I can? At the time of the other piece is I've kind of laid it out in the memo, and I'm ready to put all the forces together that needs to be working on these right away. Um depending on your input tonight and what direction you want me to go because again, we got the time frame that we have to deal with. Um First of all, I want to apologize that when I sat on this board, I did not push this matter as hard as I could have when it came up for discussion a couple of years ago. That was, uh, a fallacy on my part I should have. I was a little newer to the board. At that time . I should have actually pushed it harder. Um for the past, 25 or so years we've been leasing this property. It's been used for the same purpose for as a spoiled site. Um, is perfect. It's proven perfectly. Suitable for this. All the engineering has been done has got a perfect outflow. It actually is a great filter bed towards the river. It's been tested by the EPA and blessed off and stuff. It is just The optimal site. As as we've said, we everybody knows it's ideal. Um So it's already been engineered. Conditioned We're used to it. We know how it works, et cetera. Um, we're gonna lose this site. And we're gonna lose the site without any certainty that another preferable site is gonna become available and that is gonna put this City in the future. In a really hard place, It is just not going to be recoverable. Um it's something that should have been done much previous to this, but it hasn't been and I. I won't get into all the reasons there but Taking into consideration. I think we need to look at the value. Of this property to the city. Not just the cost. It's the value that it brings to the city. It's a known entity. It's ideal. Um you know the proximity, the elevation for dewatering, et cetera. Um the drainage base, Ralph. I've already mentioned that it's optimized for this particular operation and for the health of the river, which is one of our biggest concerns in Tarpon Springs. Um the additional benefits that mark brought up in his memo are there. Um, what he didn't mention was in the future. We're gonna want to expand. Solar farm. It's adjacent to it. It's right adjacent to the RO plant would make that process really easy as well as using it for other things, like, uh, possibly additional. C City works things there. Um The cost is there but also the site is there and it's gonna be a permanent addition to the city, so that's very, very good, long term. Um one of the other things we didn't mention is yes, we're gonna have to dredge the River Basin and the turning basin. Probably uh, in another 10 or 15 years. We also have to dredge the minor channels. It's in the charter of the city, and we have not been respecting that part of the charter. We need to do it now. We've sort of said Well, you can use a bucket and this and that to get rid of it. But if you have a spoil site that's a perfect place for it, and it's got to be done, And it has to be done at least as frequently, maybe even more frequently in the river because everything washes into those channels. Um So Acquisition of a new property. I know it's a big It's a big ask It's the biggest piece of property that I've seen come up in The city, uh, you know is being requested to purchase in a long time. Um Not gonna be able to find another one that fits these kind of ideal characteristics. We really are not. It's gonna be a loss to the city. If we don't act on this, I know the timelines there. I'm really upset about the fact that we have to put it back. Where it was only to tear it apart again. If we purchase it, etcetera and put it back to where it needs to be. But unfortunately that's just a matter of timing. Um so I'm gonna You know, if we buy another piece of property, we're still gonna have to take that piece of property and turn it into a proper spoil site have to reengineer and have to get all the permits and stuff like that. We're not gonna be familiar with. We'll have to work out how we're gonna get some stuff there and how we're gonna get it out. Um, thank you. Thank you. There any other public comments? Taylor 1991 Douglas Lane, Toppin Springs. I'm just curious how much Uh, Are they asking? And how much I know you don't know the value of it yet because you haven't had an appraisal. But if you've been renting it for leasing it for years and years. How much is that property worth today? Is it millions of thousands Just Is it millions of thousands? Praise value versus what they're asking for. Yeah, I mean, I mean, the last one we did was in the 3 Million little over three millionaire, but that's one of the things to do. I'd have to go find out what the I'd have to get an update in the praise on that. That's one of the things I'm mask of direction to look at it. We need to. We need to get that information for now what That is because they're they're possibly some changes. But from what former vice Mayor Lunt was saying you, you utilizing this property, So is it a catch? 22? You have to get to keep this property. In order to some to survive. You're gonna lose money, the city gonna lose money moving around, or is it Do we need to just buy this property? Is it? Is it a catch 22 here? I'm not sure about the C. I mean again. There's other options. It's just that And again in in the backup. I didn't mention but there's you know A There's information in there that Bob Robertson put together on us what it looked like to put another property together for it . If we went and leased another piece of property, and I think it was the era of $1.4 million is the estimate that if we lost it and had to go, and we if we if we could find the brand, that's the key of the thing if we could find the property and stuff, so you have to know whatever the value of the appraisal is where there's 3 million 3.5 are playing more. There's a $1.8 million figure in there. Um that's that could add to that appraisal and that if you add that up, then you're almost there to where where it is. And again. We'll see depending on the direction of the board. What these new appraisals say it is to compare that, but, um you also have to account for the cost and that that brings it closer. To what the price you're you're gonna pay for the property and that that doesn't include putting the property back to where it it has to be for this family. OK, thank you. I have to agree with former commissioner former Vice mayor Craig Lunt with regards to the importance and the value of this property. And I would like Point out that according to the assessed and the praise value, I don't have the records in front of me, but I think that Uh, appraise value is 1.3 million, and there at an almost four times that amount. Now I do think that negotiations should go forward, but I would like to put forth some other facts that have been forgotten about. OK? Pioneer development and thesis and families that have Pioneer development have gotten a lot of large jets from the city of springs over the last few years. But it's not forget that when they put in the project in Jasmine U vacated 2.5 blocks, which I at that time, equated to approximately $65,000 in value. Also don't forget the development out on a road where they came forward to have the impact fees reduced and impact for Brady Road and some of the other aspects And basically, you gave them a rebate back to I don't recall correctly about $50,000. And lastly, let me 0.1 other thing out when you prove the project for their project out on Keystone, you didn't require them to hook up the city water and sewer services because you said it would be too expensive for the developer. Yet in all of our ordinances when anybody wants to annex they have to annex and connect to the city services, so City Springs has given a lot of largesse to The pioneer development people, so I would suggest at this point you get some facts from your finance Department of the very largest that has been given and deduct that from the 5.5 million That might come up to more reasonable acceptable. For this particular property. 5.5 million. Four times the appraised and the value is That's just ridiculous. So I know you need to move forward on this, but you need to find a compromise somewhere between the 3.5 and the 5.5, which is to me sounds like 4.5. And salmon and families and pioneer development has saved plenty of money off the carbon. I don't think they're going to lose out. They've got $770,000 over the last seven years on black is your time is up. Your time is up, OK? Um anybody else, Mr Jump? And we do not have any other raised hands. OK? Is pro. Which then? Uh, gave me uh Uh, A reason to rethink this. You know, um Obviously it can be used, like the city manager said. For uh, An additional, uh, tank from the, uh Um The plant next door. Uh I didn't even think about the solar farm that could be made, uh, done on that property, So it gives us optional uses in current uses, rather than just trying to solve a problem that may show up 15 years from now and again, You know, we gotta be concerned about the budget. Um you know, we're not gonna have all the frills that we had. The last couple of years. One was the 11% increase in property values, and then also the, uh ARPA funds Now it's you know, we gotta pay as we go deal. Um The, uh again the Let me ask you I is. And The appraisal are are we bound to the 125% of appraise value? No, we're not. Why is that? Why? Why do We're not bound by the 125% of appraise value. I don't believe it's anybody. It it it. It's a standard we have used. But for instance, to get the Ross property, I believe it was 100 and 37% That's just, uh it's been a guideline of this. It's not, uh, a again In that case, extenuating service. D was the serious need for storm water out there in Florida Avenue for that property. Um so, um, and again went to the citizens for the vote. They voted for it. So um, what I'd like to II I would like to give the city manager uh the direction to go ahead, have the property. Reappraised because I think it would be important for the citizens to know exactly the value. Um now because when was that appraisal done? That you were talking about the 3 million You remember? Year or two, so it's pretty. It's pretty recent. De definitely has to be It has to be re apprentice. Yes OK, so I, I would want to give the city manager the, uh, the direction to be able to do that. I also wanna hear. Uh if we can bring this on the agenda at the next meeting, I'd also wanna hear, um The financing options have I'd like to hear from Mr Herring on Um The debt service. It's A timer. The uh I mean, uh, under, um, We don't have to go to referendum on the financing if it's 10 years or less correct. OK so if we have a 10 year note, I don't know what the interest is gonna be. But it's gonna be about, uh, 500,000 a year, plus interest. Um You know, I wanna hear from Mr Herring again how we're gonna pay for that. How that falls within. You know, Uh, obviously we're gonna pay for that. We're giving up something else Who's got you know, we have . We'd have finite amount of funds. So I would like to see that and because you know, for us to approve something. We don't even know how we're paying for it or how it fits into the budget that it wouldn't be, Uh, prudent. So um, but I would like , As I said, in my document, what? What I your next vote would be the entire process. The sales agreement, the appraisals, the financing it it and we're hoping again. It's going to depend on how fast we can get the appraisals. We've got the last two. We did pretty fast. I would like to bring it to that first meeting in June if I could if we can get those back and stuff, But we would bring all that back to you in one swoop. Um, for a final decision. Well, then, I. I think it falls into long range planning for the city. I mean, the See that city logo right there, and it's got the Enlo River with all the great things that you know, make up our city, and so Uh, I'm all for long range cleaning, but I do the, um I do want to address that there have been thoughts or discussions of potentially having a shepherd center building there, and I, you know, I'm not so much sure if I support that itself. But I know it's an additional area. I'm Unless the Shepherd center is interested in giving us that property over there, I. I don't even wanna have a consideration of what You know, making a spot for them and having Two spots to work out of. So uh, I do want that to be there for the residents to know about that, if that's either gonna happen, or it's just gonna be a spoil site, but definitely like to see it. Move forward. I don't know if you wanna get up to speak at this point, or if you wanted to speak in private, or, um, I, I would like to see some flexibility on uh, you know, we can have some flexibility, but I'd like to see some flexibility with you as well. From us, and I would wanna see the, uh this appraisals and so forth to be able to make any and talk to some advisors to see if that was , uh, something we would do or not, But I would make your decision based on the 5.5. Where the I mean, in a few. If I think that's a great site for the city, and it's one that probably they should own as an annex to your existing property out there . There is a lot of other uses that you could have for that. In addition to the spoil site for future city growth and projects But I did talk to my family about it, and that's kind of what we came up with. At this point. It's a it's a little too early to say. Um it's something we would consider. But I would want to have the same information the city wants to have, which is the appraisals and, uh, would have a chance to talk to some advisers on it as well. So part of what is being asked of us is to put that on hold while this city does their research, and it goes to a referendum. Um which delays us more than a few weeks, Probably four or five months. But, um I mean, we're willing to do that. I mean, I. I was approached by the city. Just so we're clear about this. I didn't have a, um You know, a $5.5 million number I came to you guys with that's what we've talked about in the past to others about the site that were interested in it. We decided we were going to develop it ourselves and the city reapproached me about purchasing it. So that's why we're here. So for sure. Is it like a residential development you're thinking about or warehouse or just not sure. Yet It's more of a, uh what we did across the street with the industrial little bit of both. OK, Thank you, sir. II I just feel that this we should have probably done this a long, long time ago. And I hope that with our recent communications with the Army Corps of Engineers that We can actually do this a little more often than than what we've been doing, and therefore it it. It just makes sense to me for us to consider purchasing. So I would authorize the city manager to Do what we need to do. OK? Um Just the, um The how we got here was, um, actually, we revisited, I guess, Uh, vice former Vice Mayor L got up and made a comment about. We should have done this and there seemed to be some interest on the commission. So we had a meeting with Mr Stamas. And the amount has I mean he went back and talked to the family. The amount came back , and he shared the revelation that he's got his project about half done, and the price was $5.5 million, which was the same as what it was before. And, um And, um, uh, So, uh, that that's what we came back here for you so as far as negotiation, it's not really unless see measure you know something more. It's not really negotiation on the price. It's $5.5 million is what the price is, and, um and the things that could be done, which is the value added from all these additional items because of its proximity to the, um to the oral plant. The Um of course that, uh, huge tank that we're talking about. It's a huge tank 5 million gallons or something? Yes yeah, and the importance of that tank. By the way, That's If , for whatever reason, the RO plant goes down. I know we've got a little bit of capacity. But if they are O plan goes down for whatever reason that $5 million gallons is about a 11 day or Two days' worth of I don't know how much water it it holds, but I mean as far as without conservation 5 million gallon tank will get you about a day and a half about a day. Yeah, with without any. Yeah without any. Uh uh, you know, conservation measures to go into that. So I mean reducing pressure. All that has a way of dealing with that, So it's kind of you know, for me. It's kind of an emergency. Sort of, Um, backup. Um also the Wells, we, You know, the cost of the water is directly tied to the salinity of the wells. And um, you know, there's some discussion Bill Pulos is looking at that. Internal auditor is looking at the, uh uh, water utilities, and you may have some to say about that, Of course, the solar expansion that we had talked about in the past. Maybe Maybe not. Um and also the dredging of the recreational channels, which really, from a standpoint of a scale that you don't need a, uh, disposal pond for that for that to dry out, you just plop the material down in the middle of the site, and, uh, by the time the, uh, water runs off that material drains out of its percolating in the Anyway And then of course, there were discussions. So there, um, haven't had any lately with the Shepherd Center for Project Refuge. Uh, we talked about them , and I think the value of this property to them at this point is it would give them some encouragement to start raising some funds for that. Project it again. Um it's not anything that's gonna happen overnight. And um, like everything else, it would have to be some kind of a completely separate deal that would be discussed with the commission from that rather than saying, Oh, sure, You can just have a couple of acres, but at least that's something that we had. About with them. So I, I don't wanna Necessarily take that off the table. But on the other hand, it's not part of the city's purchase right now. Critical needs that we have. And um, also, the, uh, city manager mentioned some other property. The one advantage this piece of property has and we used it 25 years ago, and we used it today. The path of that water from that particular Property back to the river is It's part of the trail. It's right away public right away. It's not going to go anywhere. Whereas this other piece of property we're looking at. We can't even tell you whether there's a path back to the river on it. So it's a roll of the dice. Yes, you could put a disposal pond on it. But that doesn't mean you can put the effluent in there for it to drain and then get the water back to the river. All that's gonna have to be done through DP. So it's kind of a roll of the dice of whether that piece of property other piece of property would would work. Um uh And I know where that other property is located. So, um But just for the purpose of, uh we all understand what it is that the city manager is gonna do. At the next commission meeting, which would be the first it'd be the last meeting in May. Right Is that what we're talking or did you have a different target? It depends on the appraise If I could make that I'm thinking more of the first meeting in June, which is only the next week. Remember we move so I was like I can get those appraisals. It's the end of it all we're gonna He's B will order the appraisals either, like tomorrow morning, it the whole thing of putting. We can negotiate the sales agreement. We can do the other things. Um we can do everything else. We just that final price of the appraisal is going to The meeting. And so I think we at least make the so that'll be D BT between one day or another, either the N MA or the first week in June, the settlement agreement that you're talking about the negotiating the terms that would be something that the Stamer family and the city would agree on, but not necessarily signed. Correct The authorization would be at this other meeting. If we go to that you you'd authorize the sales agreement. You'd authorize . Um you'd authorize it all at that meeting to understand. Authorize the financing. Everything We have the whole pack. We'd have that whole package for you to finalize. And then the next day is when we start working with the attorney and working on the referendum questions. Um and again we have we have time we got a little bit of cushion. We're not really pressed, but we don't have. We don't have a lot of time. But we have a cushion if we can get those, even if it goes to the second meeting of June for the APP, we still have time to then write the charter questions, Get them set and submit them so we can make the November election, OK? And uh, Mr Stas, I You don't have to get up. That's consistent with what your thoughts are. I know we talked about that at the at that meeting, OK to have the Make the referendum in November. Um item. 25 is the um, code enforcement settlement for 604 South Pinellas Avenue. Who do you want to handle this? Let me let me start because, you know We're in the process of evolving and how we do these code enforcement settlements, Um, with you. Obviously we have a setback because we're attorney Kardash is gonna work on it with us. These were immediate we have to deal with. So we dealt with these internally. Um they submitted the offer. Um, we I sent it to the code enforcement, um in the police department to look and see if they agreed with the offer. Obviously we don't wanna be negotiating, but, um, for this first one And I know he took it over last minute. He's kind of ready. Um, um Chief Young knew more about this thing from being here, but, um, in in this first case is a settlement for 604 South Pinellas Avenue. Um Again. The backup kind of they did a great backup at the police department going over the thing, um, realize that really what? They're being what they had no objection, um, to the highest limit of up to 20 of $20,000 to settle it. Um Major Mathis can go over some of the particulars of the case. It's pretty much as written there and stuff and what we were looking at in the, uh, we're we're watching and observing the commission's fields on these fines on on, you know the circumstances of the find what the commission thinks the percentage that we should get because we want to formulate something where we work on the next six months to have something where we got a good idea of where we wanna go with these things were to tell. You know the boards. Just not gonna Um, these sort of things so, so we're looking at this as a model for what we're going to put together in the next six months to revise and redo and put some criteria on these code enforcement settlements, which again will come back to you and do But we've got these two. We gotta deal with now. We can't wait on them. So if you have any questions of, uh, Major Mathis on the backup of the procedure I think you can have. I think he's studied up on it and can answer most of them. Yes with this. This is, uh from back in 2000 and, uh, four. This is when we were more of a proactive code enforcement. Not a, uh, reactive getting the complaints in. So this case goes back A long time ago, This property was a Uh, a waste management dumpster that did not have a fence enclosure around it. They came into compliance, and we had a bunch of hurricanes that year property only took the wood off and covered up his business. When that was done, they came back into compliance, and it's just been kind of sitting here. So that's kind of the gist of the, uh matter. Um the impact on the surrounding areas are minimal. The time that code enforce spent the amount of time that interested his crew has occurred on the fine of $47,039. We would suggest that the city commission Here. The settlement offer of $20,000 and accept the payment. Um, with interest. Uh that fine went from $47,039 to 100 and $34,462. No I mean it was only out of compliance for a period of, uh out of compliance with 471 days and the fine impose was $100 a day. So we gave you two options of what the, uh, with the interest 10 and 20% and what the, uh, cost would be without the interest? Uh, but the owner came up with the settlement of $20,000. Thank you. Is there anything else? I just reminded one thing that's not in there and I just remembered. I was looking on the back up. Whatever the settlement may be, um, we'd like to put a time at 60 Day, usually at 60 days to receive or it reverts back to the to normal . Fine so with whatever you consider a settlement and have the motion, um set a time frame for it to be either paid, or I don't think on this one. I think this one will be paid rather quick, but we need That time. My uncle. We had a problem with one that we didn't put a time limit on. We're kind of in limbo with that one. Now So, um, let's go to the public. Yes Uh, I was gonna ask Is the owner or the owners Representative? You are, Mr Patel. Uh it's 604 South Pen Last Avenue. My brother was generally taking care of this property and we've been here for 25. Plus years. Uh, We didn't know about any of this for the last 20 years. There was no communication from the city. There was every time we paid the property tax. There was no nothing. Nothing flagged. The only time that we found out about this one was when my brother has a cancer now, so we were trying. He's liquidating the property, and that's when we found out that there is a lien on the property. $437,000 And that's where we try to say, OK, What is it for? You know, maybe you guys send a notice, But my brother with his condition didn't look at it. It's not your fault, but it's our fault, But we are trying to see it's a minimal thing, and it's been in compliance for the last 20 years. And uh so we are just trying to see what mercy you guys can show. I threw the 20,000 just because He wants to liquidate. He needs to get this thing done, And that's why I even put me 20,000 is more But if that's what you guys want We a R ER ready and willing to take care of it. I'm mercy of you guys. Thank you. The next notice was in 23. Last year when my brother was diagnosed with the cancer, and that was the only notice that we got after a long time. So my question would be. Why have we not II? I know you may not know the answer. That's right. If I don't know it, I'll get back to you and get your answer, I. I could look away from the interest. It's hard for me to look away from the principal. But I could look away from the principle if We didn't do our job and give notifications which is what I'm hearing. Um believe me, I. I appreciate you coming before us and explaining that you know the situation with your brother and my you know, my sorrow with that , But you know what I What we have to also do is we can't allow people to ignore, um, liens or letters for the 20 years or 30 years or 40 years And then at the end, they decide well. You know now I want to sell. So now I'll negotiate for all those years. We didn't hear from anybody. So my main question to this. There was no notice for 20 years. That's what I'm asking. Major math is for because that is a really crucial things. If you didn't get them notification, I can't hold you liable for no for not knowing. But I don't know if there was something before that that would probably question for the city clerk run and go get the file clerk has asked to get three minutes to go run and get the file. And I'm not gonna ask the Why question because it's water under the bridge now, but, um, this wasn't dealt with in 2004. Now It's waited 20 years, so I'm not sure that I would I think I'm I'm gonna get right to the punch line. Um he was out of compliance for 471 days up to 2004. Forget the 20 years. Um I would settle at the 47,000. That would be the best deal I'd make. Um there's no point to going To Anything less than that, because he was out of compliance. 471 days up to 2004 the fact now we could we could punish him for not Are doing anything for about it for 20 years. But But we could be, uh, benevolent and, um We could, but I can't see any reason to go below the 47. That's what I said. Yeah I I'm in agreement with you. I can't see any reason to go below 47. We can have all kinds of arguments about. He didn't get a notice for 20 years, but he did get a notice back in 2004 when he was out of compliance. Correct. Uh, let me go back. Yes He was noticed when he was out of compliance, so he he was he was given notice. Uh, he he was out of compliance for 471 days. 2004 came It's irrelevant whether he got notices after that, Um And, uh, I think we would be benevolent in giving him a break on the interest, but I cannot see going anywhere and Beneath the, um The principle. Thanks. I just want to apologize to the applicant that you have to deal with this this type of situation, I. I mean, you know I It's what Habitat for humanity comes around. We give them 67 $70,000 breaks on homes that were owned by the minority neighborhood, and but we don't Blink an eye. You know, because it's affordable housing. We have a man who's you know? Got some health concerns. And we're talking about doors. On Trash can In an area in downtown that's frequently visited. And this guy, you know? The police department has recommended the $20,000 And we start nitpicking. But And consistent it. It's what we're we do favors for the nonprofits and then You know these individuals up here? They don't get a reasonable offer. Well there's a reason why we've as a code enforcement have changed to a policy driven to have people comply with policy as opposed to finding them, Uh Crazy amounts. Up until they comply, and we've got gray and co code enforcement officer Now does a great job, uh, helping people come in compliance ever. And I. I just think Anything above $20,000 is It's just wrong. You know, we talk about So we need to move forward. This guy is coming to us in in a need. Um It's serious. And $20,000 isn't a reasonable amount. And you guys start being inconsistent again on on this stuff, you pick and choose who you wanna give discounts to and not, And it's just not right. So I'm only gonna approve the $20,000, as recommended by the Police Department as recommended that this has been taken care of for 20 years now and as we have given discounts, or at least I have as much as we can on application. It's review the policies all he wants. But at the end of the day we make the decision on that settlement, and I'm hoping there's two other individuals up here. You're on notice that, uh, there's a lien out there, and it's called constructive notice, as opposed to actual notice as so as long as the actual case. The proper noses were were sent were mailed out which were beyond any sort of, uh, statute of limitations or appeals period for that, But as long as it's recorded, it was there was there was, uh, constructive notice of the lien being there and we and we do what we did have access to be able to talk on the break with the clerk on the records and at least once a year every year except for the covid year, 2020 that lien notice was was sent for every I think 2020 was the only year that was missed, and that that was the covid year where a lot of things got missed. But every year from 2004 5, the lien notice had been had been sent, and she had record there to show that all right, let's let's pick up with Vice Mayor. I want to finish up now. Yes I do. So here's where I'm I'm coming from, Um I. I don't wanna sit up here and have anybody have selective memory of the way they judge. Um Talking about Habitat for humanity. You're comparing a business a for profit business to a habitat for humanity. That was an embarrassing day that Habitat for humanity was asked to have an extra $10,000 per property. But if that's the way that commissioner wanted to do it, that's fine. This is a business and I believe me when I tell you, my condolences that your brother is ill, but I don't know for sure if your brother would have came to pay the bill if he was still in business, and you know, I. I could I could see moving away from the interest rate. Because You know that that we would be making a concession. But you kind of have to pay the principal. I mean, I. I appreciate that. They came up with this number of $20,000. But truthfully, the bottom line that's owed was $47,000. And that is the number that I would look for you to settle with, because the whole idea is you're trying to sell the business and I and I, and to me, it it gives me the image. That you, you know? Whatever you could get less than 47,000 is, is that much in your pocket pocket? And And I think that this thing could have been, you know, I feel bad that you're here, settling your brother's issue. So you know, but again, you know I. I could go to 47,000 like my fellow Uh, commissioner said I. I just can't see changing it to $20,000. You know, it's not up to the police chief to or the police. They just give a recommendation. Like an attorney . An attorney will give us many times a recommendation of a $10,000 on a $30,000. And it's up to us to decide whether it should be the 10 or the 30. I if it was something that was in a shorter period of time, I might have been able to look away from it. It feels to us, though, like it was just ignored. There was no communication back. I did look all the letters that we got . I did speak to the city clerk. Um and you know letters were going out. So I mean, I'd ask you what happened to the letters were they just I know with the letters just if the letters were just thrown out by your brother. What am I supposed to say to that? You know, we have. You know, when I look through this, there was each different permit department person. There was a, um you know, there were, um different code enforcement people that we've had over the years Each one has been involved . Uh, I know, uh, Ms Beis and, uh, you know, a city clerk has been the only person that signed off on these. But you know, we've had so many people that have had their hands on it. And we can't even begin to. You know if we had to do this to every person owes us money, we would have no incentive for the people to pay the, uh, pay their bill on time. So No, that's where I'm gonna be at OK, go ahead Commissioner. I. I see we was coming from I my understanding and the intent of code enforcement has always been at least in my definition to have the violation corrected. In a reasonable manner of time. Now when you're looking at 24 years, I think it is that for over 20 years It's So much happens. Yes he was notified. Somebody was notified every year from at least from us. The intent is to bring him into to You take care of the violation. And While he is Trying to sell the business. I don't think it's necessarily what That we should be. It makes us sound almost greedy to me to say. Well, I want as much as I can get. What I wanted was to see was him. Come into compliance, stay in compliance and pay a reasonable Fee for that delay and I. I agree that, uh, will you have the recommendation? I 20 is enough. I. I don't think that The purpose is not to beat people up with fines. The purpose is to improve our community. So That's my feelings. Okay? Um, Commissioner Julianna. She have more. You know the frustrating part here. Is and I saw the first letter That was in 2005, right? 2000. 2004 OK? So the 47,000 that was established as a fine That was that was Given in 2004. And subsequently 2005 6789 going forward. And I want to ask , Um, if your file shows any offer of settlement In the last 20 years. So, uh, And that's where I lack the sympathy here, I if, if you got $47,000 worth of fines, and then you came into compliance, and you, you, you, you approach the city. And you said OK, I'd like to pay, you know $10,000 or $5000 that I could understand is reasonable. But to let it go 20 years and then in this, uh, response here, it says, um, you know, hope the commissioners find reasonable amount of the total fine that we can pay to sell the property. So it seems like the only, uh Motivation to actually address this issue. Was a 20 years later because now they want to sell the property cancer. And that's where again, my, uh I would agree with The other commissioners on Um Reducing this fine. But I really believe it should have been done. Long before now. And now to say OK, Now, let's make a deal because we want to sell it when you ignored. 20 years of letters and our staff has to go through this whole thing of sending you sending you and we don't see again in the file any offer to settle this matter? Um Any time in this 20 years, and now we want to do it because we want to sell the property and, um So that's where I just lack. Uh, the, uh The empathy here on, uh On the reduction of this fine, So that's it. Thank you. Uh, he's uh, Commissioner Cu I had is light on first. I'm gonna I'm gonna make a comment or actually , I'm gonna ask the city attorney there was a statement made by the vice mayor that Um Yeah, but Code enforcement is basically treated different because it's a nonprofit as opposed to a business owner. OK this is the go to Commissioner Dido's comment, However, there's an outstanding fine in applicable Do now, and it's at $47,000 on June 2nd 2004. Not 2024 2004. That's 20 years from now. Was 20 years ago. So the fine was $47,000 at that point. Next It says interest was 35,000 at that time. And that could have been negotiated back in 2004. Could have been in 1005, 2006, et cetera, et cetera. The payoff at the time was 82,830. Now I'm gonna go to another. One that it has the same information that it was March 24,003 as of June 2004, and it went still fine amount, 47,000, But now the interest is $77,000. And the payoff amount is 100 and $25,039 . So it went up. 18 About $50,000. So it's not like we're punishing anybody or trying to hit them over the head. That's what was said the fines always been 47,000 from day one. So if you're saying you want to not have them come into compliance, um the or give them half their compliance than 20,000 is the right number. But 20,000 isn't the right number 47,000 is and that's why Commissioner Kiano and Are willing to go away from the interest but not the principle. The principle was on. Um 2004 June 2nd. So if anybody would like to contest what I'm saying, and there's been we've we've asked. There's been, um many letters stated, Um, I mean, are you if you're trying to just give gifts? That's a different story. But the penalty has to be what it was the first year that they came into compliance, and that was 47,000. Today It may have been 80,000 with what the code would do. Um I understand what the circumstances are, and they're There unfortunate, But from my perspective, there wasn't any request for reduction of fine back then. And it it by. I think that opportunity is gone. Uh, passed, uh, where we are right now, So that's how I feel about it. I'd like to make a motion to accept $47,000. I'll second with the, uh, contingent of 60 days. Is that what you said City manager? Of course. With 60 days that the offer's good for 60 days or revert to the original. It does so I watched code enforcement the other day, and, um, there was a gentleman who stood up a was his name. And he was the guy that did my papers back in the day when my house was built, and I had no idea why he was up there, But he decided to put some, um uh, skids on land that he owns on Lime Street. OK? And uh, he asked code enforcement at the time. If it was OK, But you know , the person said, Yeah, I don't see a real problem. But she, you know, he didn't really tell. He's he's from Brazil. And he didn't really tell them that he was going to Brazil for a year, So he takes off He goes to Brazil for a year. He gets hit with $8000 in fines. OK never responded to any of them because he's in Brazil. It wasn't getting to the location or when I saw him here up here, you know, he he gets up here and he he's never been before this board and this is the thing that we have to understand. We have to have some compassion for people that get up there and they have no idea. And he's just like, OK, you know, so he goes to contest the $8000 and Monk knows this whole story. He goes to Cates, the $8000. And they say, Well, the ruling is if you contest you gotta show your W-2 so he comes, he says. I can't bring my W-2. I make a lot of money, he says. I guess I just gotta pay it. I can't claim hardship, so he goes and comes back the next day and goes to the city clerk and hands them $9000, which is more penalties by the time I got a hold of mark and asked him, could we at least do something with this? The guy just doesn't have a clue. He's Clu. No it was paid $9000. And here we are. We're arguing over something that went on 20 something years. I mean, it's like this guy was one year and you know, sometimes things happen. But you know, he was he. As soon as he came home. He was proactive to try to see you know, he loves the town wants to be in the town, you know? I mean , bottom line this I don't think it's wrong to charge $47,000 for something that's been 20 something years. So that's my statement. So we have a sec. Um the next item is, um, the last one for this evening is, um Code enforcement settlement, 1606 Sea Breeze Drive. Um You know, I'll I'll Off because this is a little bit different scenario. Um, this is a case where Somebody brought bought a property and obviously they do did their due diligence. They knew there was a lien on it, but they bought the property and instead of us dealing with the owner who is trying to sell the property, um and get that off. This person bought the property and then, um, is asking for the request. Um So this has come up before and it's kind of a different situation. Um that we've dealt with. So we're looking and again what? I asked the co. The code enforcement the police department to do is really if there is any objection to the to the Fine. Presented for settling has no objection. Obviously we're trying to get a gear from the commission what they're looking for on each side of the thing. So they did say, um, this offer, I believe was in the 13,000 area, and, uh, and the settlement was 27 or 27 64 58. That's what the code enforcement had agreed to. That was there. His settlement request of the other fine was 13,000, and I can't make my screen bigger. So that's why That's why I haven't. Yeah The, uh, got it in a big, um, The payoff amount was $13,822.92. Why don't you go over and go over? Just go over the basics of this case, and, uh, this is, uh, the property located off the sea Breeze drive. Due to the impact of the surrounding area and at the time and the time could have fortunate spent on the case. We uh suggest that you consider this amount. The property was overgrown for 418 days. The property was issued a notice of Lien compliance of 12,000 to 100 and $92 on October 13th of 2023. The final imposed by Code enforcement board was $25 a day the property is vacant on a lot with no structure on it, located on a dead end street neighborhood impact was minimal on this property. The amount of funds without interest would be $11,711.50. Um the synopsis of the case is October, 20th code enforcement received a call from a neighbor about overgrowth grass on the right of way located at uh, the above mentioned address on October of 2020. A notice of violation was sent out to, uh, the owner out in California in November of 2020, A reinspection showed the property still overgrown in December of 2020 notice of hearing December 29th affidavit of posting was issued January 13th 2021 Reinspect re Bike. Uh, former code enforcement officer Hughes showed that it was still a, uh, overgrown In January of 2021. It went to a code board hearing. If not cut or trim by February, a fine of 25 Day was imposed. A reinspection by Beth Hughes in February was still not in compliance. And finally got in compliance in May of 2022 Um, in May of 2022 Code board issued an affidavit of compliance in June of 2022 Court board, accept the affidavit of compliance. Um, let's go to public comment first. In public comments. Are there any public comments on this item? Public Commons. Yeah, I GL 743 Chesapeake Drive. I have some comments in general on this kind of stuff. Um more specific to this. Uh, this property Whose owner was in California. This was a tax sale. So this fellow bought it by taxes. Um In California blew off any notice of maintaining the property at all. Just let it sit there. Um, he finally brought it into compliance. The only reason the fine amount is coming up right now is because somebody else bought it in another tax sale and what happens when he bought it was And I. I think I should really need to remind you of this. But when you purchase a property with a lien on it, the lien amount goes into escrow. So the person that bought it on the tax sale is really just trying to reduce his cost of purchasing the profit. Um It's my feeling that in cases like this, we should be leveraging the fine of the principal. Um and in this case, probably the entrance as well. Since the fellow who bought the property knew full well that this Lien was on the property when he purchased it. It was, if it's wasn't a consideration of his when he purchased it, then that's I. I fail to see how that's even possible because it was written on the actual tax sale. Notice that there was a lien there so It's all that happened. Um any other public comments? The pros. Nine and one base drive is really For the attorney. We need to do something. That we don't sit up here and bicker about Uh, these issues. If they owe it, they owe it. And we shouldn't be how many people in tarpon We've really lowered Assessments for them. Years, hundreds of thousands of dollars. We need to do something to get it straight and just stay with what we've decided to do. This is embarrassing for the community. It's embarrassing for the individuals and it's ridiculous. Yeah. I don't know if this means anything to everybody. But if you've driven down sea breeze when you just leave your place to look like who did it and ran. It is a great place for snakes, Coyotes and every other critter that roams Florida. So if you don't take care of your property You have to be fined and code enforcement did an unbelievable job. So the stoner did an unbelievable job. Everybody else did it unbelievable job except the person responsible unless somebody on the board wants to give them a gift. I don't I want full price. So I think it was part of, you know, I, I assume it was part of his thought process a worst case scenario. I get to buy it cheap. And then I have to pay a $13,000. Fine. And there you go, so Um, I'm gonna go along with, uh, the vice mayor. OK I got more to say if you don't mind, so here's The first gentleman came and he actually even gave us a reason why things are but this gentleman rides deer. I wanna settle this fine so I could obtain a clear title. This code enforcement fine was not my doing, which is true, and I have already paid $75,200 for the property and a lot. I want you to know the property that's across the street from my house on the water, which this is, is $700,000. So he got this for 75,000. And Um So it says the tax debt was 6000 some odd dollars, leaving a, uh, REM remnant of 69,000. I respectfully request that my offer of $2764.50, which is 20% of the fine can be accepted. I don't understand why You get a discount for buying a property that is in a lien the motion it was. I mean, is that a kind of rhetorical question? Because it was an auction. You just got the he won because he had the wire. Highest bid. Yeah, I'm aware of that. But I know how this works. So I can't answer if it's a retire. Who knows? It's a rhetorical question. Um particularly, I'm talking about the Pappas building. You know? Um So I just wanna throw that out there for a healthy discussion in the future. As far as, uh, I forgot to mention during the golf cart leasing the Little League, the football Little League and the soccer programs they been requesting, hopefully to have a golf cart. So uh uh around the facility, because I guess they currently don't have one on the complex. We can try to consider that have one for them. That would be great. Uh, The Bayshore Drive, Septic. Situation Uh, I mean, none of us were happy to see that amount of people here. You know, uh I think we Try to present everything is as it came to us with the ARPA with the way the bids came out now, uh We want those residents to come out of their pocket that much? No. So maybe, you know we can get some grant. Help with it. But, um I. I just It was tough to see that you know today and so we just try to do our best to help them as well. Um As far as the email earlier. You know, we had our city attorney, he Sat on the fence, but ultimately he said, that his, you know This could be in violation and mayor. You went out of your way to make a motion when we should have read into the record. You know, I don't understand what the violation was of the email because it criticized some of the Board commissioners, but You know, we're elected officials and we need to stop. This protection of free. And truthful speech. When And I'm looking at that direction. And so That's why they're looking away. And so when people are filing for office and withdrawing the public needs to know about this And when we hide this stuff, and that's what we did. We hit it and four of you went out of the way. It looks bad. It's not transparent. We're obligated to let these people know and we are obligated to let the public talk. With free speech. And we failed that tonight. And I don't think we got the best advice on that situation. So But The most important thing. Absolutely was Orthodox Easter. And I wish everyone a caua nasty. Which means Christ has risen. I'm proud to be of the or This community and I wanna thank the police department. Fire department. The liaison. The city manager. Uh, in the community to help make this happen, because it's part of our traditions as a community as a culture as a church. And uh, they're very thankful The community is the Orthodox community. And so, uh, to be able to make that happen was Extremely special and important to many of us, and so I can't think Mark. And all of the city staff enough who helped Come together to make it happen. Thank you. Yeah. Um, Commissioner, uh, Kas. Um. So in in regards to the Bay Shore. Um It's my understanding that There's a mandate to tap into the sewer. I'm I'm I'm gonna direct some of this to, um Attorney Lewis and not to Take your time and Digested and we can, and we can talk about it later. Um I assume there's a man that there's a mandate to tap into the sewer. Um But I understand it can be modified by ordinance. Um so I I'd like to look into that because what we could do is allow the line to be placed. I know that the work's been done and II. I appreciate what the, uh mayor said and given us, um The, uh Very clear rationale as to how Sewage goes Through pipes. And gravity. Oh, I is, uh is a, uh, a force that cannot be, uh Taken for granted. So, uh, with that? Uh, allow the line to be placed, so we go ahead and do what we need to do, But I'd like to find a way. That's why I was asking about a modification of ordinance. If it is then I. I could I would be able I would be more than happy to put A, uh, an agenda item on to modify It by ordinance. And allow those residents wishing to remain on septic to be allowed to stay on septic. Um And then they could retain the ability to tap in. To the system at a later date. Um if there's septics were to fail and they needed to tap in, they have they would have the option to be able to do that. I don't know the number. I mean, there was a number of people here. I have no idea how many homes are on bay Shore that are affected. As you said, Mayor , There may be a there was a clamoring to be on the septic. I mean, be on the sewer, so there may be enough people that wish to go ahead and tap in. We? We've, um Uh, We've already committed to the number we If we back out, we have, you know, stand the chance of litigation. There's no reason to do that. We might as well go ahead. Put the line through. It's on the right of way anyway, so it shouldn't impact people very much. And then at some point they can. If we can see if, uh, we can modify Beau ordinance, then allow Only those people wishing to tap in to tap in the people who wanna stay on septic and stay on septic. I think it might resolve some of the issues with the residents who have fear that the, uh That this grinder thing, uh, isn't uh, they they don't have confidence in that. Um So I think we can find a Happy solution. That allows us to do what we need to do and then allow these people to, uh, have the confidence in their facilities. I mean, just to let you know I'm on septic. I It's worked fine. I've had to, You know, uh Redo my leach field before and you know whatever that cost is, but Something that You know, every few years, I get it pumped and I'm good to go. So you know there are people that I'm sure who who are still happy staying on septic and be fine with that. So Let's see if we can find Uh, Attorney Lewis, if you don't mind. With The, uh Ryan Corba, who I challenged to come along with me, and, uh He's gonna get us some advent health shirts and so we're gonna be, uh, running for adventhealth up in Indianapolis in November. There's a situation everybody's got different personality. Some people stay very quiet. Some people have a gift of gab. I got the gift of gab. So you're always going to hear me speak much more than you. I remember working with you and rotary. I. I don't ever remember you open your mouth. So I, I take what I take What you say with a grain of salt? Um As far as this Sewer project. I was probably the only commissioner that was there last night. And believe me when I tell you and I'm sure Mayor Protus would admit today. It was a lot more civil than it was last night. Because last night, people just got the news. They were fuming mad. And so what You got to see here was a scratch of the surface. Um as far as what I wanted to interject before the mayor didn't let me speak. Um was I did some research between yesterday and today. And I went through some. They handed me a bunch of pamphlets and the pamphlets. Um One of the things that is in the pamphlet that you should know is that, um most new Locations that are built. Work with gravity systems. Most existing places, especially that have curves up and down work with low pressure. Pumps. I also did some research. There is a pump put out by pent there. That is a guarantee You can throw six diapers down the toilet went feminine. Everything you name it. It goes down Kids toys, It'll eat and chew up everything in its guaranteed not to break so all I wanted to do was give them that information. I don't know how much it costs. You may have to take out a second mortgage to buy the thing, but at least they should know that the, um grind the pump can you can buy a foolproof grinder pump . They make them and it is the next generation pump. Um I also wanted to share that I have a grind to pump in my house for 11 years. Um in the 1st 23 years. It failed for whatever reason, and I have had no problems with it for eight years, But I also don't have young girls in the house that throw everything in there. If you do have that It is an issue. There's no doubt about it. You just can't do that. Um so but otherwise I agree with the Commissioner Kanas is far as I would like to look into. And I'm pretty sure I know the answer to this. We can institute an ordinance to at least not have them. Install it yet. But the one thing we really should do is we should have somebody from the city going over to each and every house and letting them know which side they should decide to have their input into that, where that valve where they tie into the city's system. They somebody from the city should let them know where it is. Whether it's on the left side of the or the right side, because what what wound up happening is the contractors walked around because I heard it all last night, and they just said, point on a iPad and show us where and these people don't even know they flush the toilet, and that's the last They know where any of this goes, and so how are they supposed to know? But if you put that input on the wrong side, and now you wanna tie in, you may have to track so much more piping to get to that area, so we Be able to at least go to each person's house and let them know your lift station should be on the Left side or right side. Um so that's that end of it, I. I think we did drop the ball. Um, as far as communication That's what I heard, and, uh That's that's all I wanna say on that. Um I did wanna thank uh Jamie Taylor and Patricia Bishop for the, uh, save our seniors giving out it, it's really been a helpful thing , especially with the economy. They come and they give fresh fruit. And vegetables to people. Um at the, uh, you know, at at the rec center, and it's an amazing thing. Um I saw a couple of people I knew, um that that we're very thankful for it. So I did actually send a letter to, uh Jamie, thanking her for that. You know, involvement. Um And one last thing I wanted to thank the police of Tarpon Springs because we had the Pinellas Trail targeted Enforcement day. And um, between Bel Air Clearwater, Gulfport, Largo, Saint Pete Orpin Springs and We handled the most We did 17 traffic stops with three officers. We issued three citations. We gave 12 warnings. 60 trail user engagements. Police intern staff, the table and Tarpon Avenue with our safety, information, drinks and snacks available for trail users . We did the best job of all of these other police forces. So I wanna just thank you and, uh Um, that is pretty much a happy Greek Easter to my Greek friends or Greek Orthodox. There's a lot of ram, Uh, the reason why I didn't want to get in discussion tonight and any kind of thoughts of maybe there's a chance of this. There's a lot automations. If you're talking about grants, One of the questions are gonna be. Do you have an ordinance that requires people to hook up sewer? When you put sewer in? And then. The answer is either yes or no.
