is coordinating the parade and also helping us with the presentations Dave [Applause] okay first I'd like to thank the council the mayor for uh stepping up you know we didn't know how we were going to get this done if we were going to get it done but we went and sat with the mayor Mr Chabot and Mr sanis and uh all of our prayers were answered they hooked us up they took care of us so that we can do what we do in getting our kids for the um ESS contest and our grand Marshals for the parade so at this time I'd like to call up Mr Lou V and Mr Arie Bo [Applause] okay so on behalf of these two gentlemen they were chosen for their outstanding citizenship and and they're both veterans uh hopefully both of them are army [Laughter] guys so whereas Arnold e Bo and Lou B Mr B's an army guy and Arie is a merchant marinearmy SL whatever he's a nice guy I I I have to do this as far as he's concerned uh they both served in the Army uh both received milit multiple military awards uh Mr Bole is the commander of American Legion Post 129 and Mr B is just an allaround nice guy so so now therefore I Daniel t rodic on behalf of the mayor now he's the mayor of the township of Toms River with the full concurrence of the township Council wish to acknowledge Arie B and louel as this year's Ocean County veterans parade Grand Marshall and to thank them for all their selfless service to our country and our [Applause] town Dave don't go away sir don't go away we have a presentation for you for Veterans Day we' like to on behalf of the council and the mayor like this Proclamation presented to you um and we are looking forward to the parade onet Veterans Day and thank you for all of your work all right and as I said in one of my emails to Mr chavot or or Steve over here or even to Mr rodri this is going to be the best parade yet am all right yes sir okay there you go this is this is us all these guys and will you Gentle and the young lady please stand [Applause] up in the army that guy he was in the Army also and the young our goldar mother I have to assume there are other veterans in the crowd um would you ladies and Gentlemen please stand up and take a bow if there's other veterans here thank you thank you very much thank you Dave yes sir yes at this time I like to call up Teresa fretto who is a gold star mother and she has some wonderful presentations to make Teresa see if I can get this down for a little bit maybe not that's right I didn't take my weedies okay okay so I coordinate the Veterans Day essay contest every year in Toms River and it's for the Intermediate School levels as well as the high schools levels I contact the schools in early September we give them the topic this year the topic was why and how should we honor our military veterans there's different guidelines they have to pres the children have to present their original work 300 to 400 words three paragraphs at least must reflect proper grammar spelling and punctuation but we also ask for them to answer the question or to discuss the topic of what we've Chosen and we found that they were really really good and the schools have to pick their top three winners or their top three entries and they submit them to us and then from those three we scramble them all up I make a copy it's all on nobody knows who the children are when they read their essay and then we pick our first second and third Prize winners in the intermediate and the high school level so it's the same question same guidelin just two different age levels so our we're going to start with the intermediate our intermediate third place winner is Lauren Bush please come up Lauren is in grade seven she comes from Tom's River intermediate North and she's the third place winner our second place is Christian Leon Christian is in seventh grade and he goes to St Joseph grade school and the first place winner is Elena Schuler Elena is in sixth grade and she attends St Joseph grade school now this year our um winners we always used to give gift cards this year we're giving checks and they the checks are in the amount of 300 for the first place winner 200 for the second place winner and 100 for the third place winner so now we'd like to ask Elena to read her first place uh essay okay so come on in honoring veterans is really important because it shows how much we appreciate the people who have served in the military these brave men and women have made many sacrifices to protect our country and keep us safe by honoring them we say thank you for all they've done one reason we honor veterans is to show is to recognize their hard work and bravery many of them have faced dangerous situations at and have been away from their families for a large amount of time this can be very hard both both physically and emotionally by celebrating them we let them know that we see their sacrifices and that we care special days like Veterans Day Veterans Day are great opportunities to remember and honor their service with parades and ceremonies another reason we honor veterans is that it brings our communities together when we have events like parades and Memorial surf Services everyone can join in and show support it's a way for us to come together and say we appreciate you these events also give us a chance to learn more about what vener have experienced helping us understand their stories better honoring V honoring veterans also helps teach younger peoples about the import importance of service and sacrifice when veterans share their experiences in schools or Community programs they can Inspire kids to think about what it means to serve others finally honoring veterans is an is an essential for mental health many veterans deal with difficult feelings when they come back home and showing them that we care can make a difference when we honor them we we create a supportive en environment where they can talk about their experiences and seek help if they need it in conclusion honoring veterans is a way to show our gratitude bring communities together educate others and support those who have been who have served it reminds us that the freedom we enjoy the the freedoms we enjoy every day come from the sacrifices of these brave brave individuals and we should always remember to say thank you see why she won yes okay okay on the high school level in third place we have roen Miranda Walken is in grade 11 and attends High School South Second Place Jada Freestone up Jaden is in grade 10 and attends High School South first place Nicholas Miland grade 11 tomser High School East [Applause] [Applause] why and how should we support our military veterans veterans day is an important holiday that celebrates the heroics of those who have fought for our country courageously we honor our veterans on Monday November 11th and while many do understand and appreciate the courageous men and women who served for this country too many failed to recognize a significance and view it simply as another holiday but it is not just that it is a day where the heroes of this country that fought for our freedom should be honored and valued Beyond a single day on the calendar these veterans should be supported because of their sacrifice for our country their hardship and brutal way of life that they endure with while in battle and because without them we would not be free we should support them by recognizing each individual who has served for our country as without every single one of them our great Army would not be able to fight for freedom and equality first of all we need to recognize why veterans should be appreciated as a very important reason is the fact that they put their lives on the line in dangerous uncomfortable positions for the betterment of our country unsure if they will ever make a home but constantly selfless also they have to go through miserable conditions and attend training for a job where they are on the front lines doing what many people couldn't do many people leave families behind spouses children Etc and are unsure of when or if they will make it home but nonetheless they got on the battlefield with the goal of making the world a better safer place the trauma at PTSD leaves behind for many something that lasts very long after the days of war and has a permanent effect on their livelihood furthermore we need to support through our veterans through actions according to Mission call.org an average of 24 Veterans take their life each day not to mention the many homeless the men and women who put their lives on the line for the safety of others should not be forced into these situations there needs to be more places for former veterans to reach out regarding mental health and those homeless need to be individually accounted for and assisted by the government as they are the heartbeat of this country along with all veterans each veteran should have an opportunity for their name and their story to be viewed to everyone given an opportunity to show their sacrifice and their story so they don't feel alone charitable organizations to support veterans need to be more mainstream and we need to help our veterans as they put their lives on the line for the sake of the country ultimately Veterans Day is on Monday November 11th but let us support the courageous men and women who served our country it is important to recognize what they have done for our country and to understand the crucial role in in the freedom of America but also to help support our veterans as far too many are being neglected and forgotten we must not forget what they have done for our country and the importance of them we must stand with them as they've stood for us because in the end they are heroes okay I have to add something I forgot to tell you before um that sa contest winners their uh tribute is twofold one is coming here and receiving their award but also the second is they're invited to march in the uh Veterans Day Parade on Veterans Day um and at the parade They will receive their proclamations okay so if you can attend in any way make sure you're there and if not some of you gave me your address if I don't have your address I'll be reaching out if you're not there okay so thanks again thank [Applause] you great job this is this is an example of what your Tom over veterans commission is doing for the community and again I thank every one of you guys for allowing and assisting Us in getting it done at this time i' like to all come up and we're going to do a pass and review and end wow this is really something I mean we all follow Olympics Special Olympics and we have one of our own Tom's River people that did phenomenally well in the Special Olympics it's actually the Paralympics par okay I'm sorry sorry Special Olympics is for people with intellectual disabilities the par Olympics is uh equal to the Olympics it's for people who have physical disabilities uh physical visual impairments such like that but the Special Olympics is like a participation thing par Olympics we are actually Elite athletes so sorry sorry for the education on it but that's right I've been educated many times so one more time won't hurt um I'd like to announce the events that she competed in I hope this is right um the 50 freestyle 40 by 34 Point free relay 100 backstroke the 100 freestyle 100 butterfly and a 4X 134 Point medley relay amazing huh [Applause] and I didn't even tell you what she won yet that's very nice um join the Y there you go actually funny story we do have an active Beauty soldier who is par Olympic swimmer she also brought home five medals her name is Elizabeth Mar and she is the first Army soldier to ever never become fit for Duty after having an ucation she created the pathway for that and she does a lot so she's she's one of my [Applause] Heroes all right let me give you the good news Christy won Gold Medal and the 100 backstroke and the 100 butterfly I couldn't make one lap of the pool so I tell um she also won a silver medal in the 100 freestyle and 50 freestyle as well as a bronze medal in the 30 4.4x 100 freestyle relay uh she broke the par Olympic and American record in the 100 backstroke and broke the American record in the 100 freestyle and the world record in qualifying heat in the 50 freestyle she's something special Chris I'm not going to embar you embarrass you I'd like you to tell the people out here a little bit about your experience at the Olympics if you don't mind um yeah so uh I unfortunately um coming in as an elite level athlete prior to my injury um there was a lot of speculation on how disabled I actually am um I had a brain injury in 2018 where I had part of my brain removed um and so in the during the par Olympics I was actually faced with a lot of cyber bullying um right after I broke my world record people speculating that I was probably not as disabled as I present myself to be uh that's what happens a lot of times when you have an invisible disability so I was at rock bottom but thanks to two of my little ones that are here and my other daughter who's not um I was able to pick myself back up and get the job done put all of the bad stuff that was going on into a box and do what I was meant to do a lot of our service members will probably attest to that is you have to put aside what mental aspects might be going on and do the job so it was definitely a testament to my mental fortitude there and I'm just I'm very proud that we made it through the week and uh we were able to come home with some Hardware [Applause] Christie on behalf of the mayor and councel would like to present you with this Proclamation we hope that you'll display it in your home or wherever other people can see it because Tom is extremely proud of you and I mean that sincerely thank you so much for representing us can we get rest family come up for a picture [Music] I didn't see I'd like each of the council members to come by and Shake Christy's hands before you go back to the day please they're not Sol the ones are actually silver and then they're plated with gold but there are actually metcs that they need to follow for all as far as how much Medals of each and how much it weighs so fun thing about the this is actually the first um game where the emblem for the Olympics and the parps was the same so that was a step in for the gam the the fronts are the same this is actually a piece of the Eiffel Tower when they um did the Reconstruction of it they kept all the steel and so each of us has a piece of the Eiffel Tower brought home and then on the back of our medals um the Olympic medals always had the same goddess on the back every year but the paralympic medals get to have whatever they want this happens to be the underne belly of the Eiffel Tower and then you see there's rail uh bals from the Paralympics in the past sh them make different sounds of visually imped athletes this one hasil on it um as an homage to the creator of who is a little history [Applause] on okay Council we come on through and Shake Christy's hand I met thank you so much thank you for having thank you continue please okay all right item number seven on the agenda is an ordinance of the township Council the township of Toms River Ocean County New Jersey repealing all ordinances previously adopted by the township which had adopted and amended a downtown core Redevelopment plan a Robins Parkway development plan and a waterfront Redevelopment plan in accordance with the local Redevelopment Housing law NJ Essa 40a 12 A-1 I'd like to make a motion to table this because there's just so much in here that I don't know what I'm going to be voting on second that motion I need to flesh this thing out a lot motion to table was made by councilman n seconded by councilman Quinns list uh councilman nerson yes councilman quinlisk yes councilman Jai I'm going to vote Yes also to table it and I'll tell you my reasons why I just got the agenda at 10:35 this morning and and there's so much on this that there's no way I could vote either yes or no on the ordinance so I'm I'm going to table it and then the agenda was changed uh it was shuffled around a little bit at 1:00 this afternoon so it doesn't match up with mine but everything is on there but I'm not happy with it councilman lamb we had an agenda meeting last week I attended with councilman ion we spoke about this in full we spoke about the last couple election Cycles we spoke for about 2 minutes on it really no we spoke for about 15 minutes I was there okay 15 minutes to repeal all the ordinances in this thing this is the you think that's enough this is the downtown let me finish let me finish my comments and we'll let you uh if you want to rebut all we need is to vote well I like to explain why before I vote like to explain all right I'm going to call on two people I'm going to start with councilman lamb and then Tom Tom n you can have your go ahead councilman lamb just want to say that the last couple election Cycles the voters are clear crystal clear they don't want 50 foot buildings downtown they don't want affordable housing projects downtown they don't want a city within a city they don't want nor Jersey developers coming down here with payment L of taxes we don't get anything out of it and that's why we're talking about this time about repealing it so um I'm going to vote no to tbling it I I would like to counter just for a second there is a vote right I mean yeah I'm I already voted but I just he made a bunch of comments I'm making a bunch of comments then you can make a bunch of comments um this doesn't mean I'm for the building of a 15-story building could have fooled me could have fooled me too oh really yeah really just like you fooled everyone for the last year all of you I fooled everyone for the last year time okay you just opened up Pandora's Box stop Damon one person is going to talk tomet can I puppet Tom puppet can I finish look at the strings Tom don't give me a bunch of crap like this Dan and Justin seriously Tom enough wait if he's part let's we get back on a professional councilman Iverson no councilman quinas again there is no plan for a 15-story building downtown never has been never will be it's not going to be anything that does go down there it's not all going to be low income uh I think that uh somebody's banking on fear here and trying to intimidate people uh Downtown Development for Tom's River is a a plan that's been around for 30 years to improve Tom's River not to make it worse don't up uh not to make it worse uh by repealing these ordinances you're going to take us back 30 years in the progress of Tom D and by doing so I wish in that same 30-year step back that we can step back and make Dan rodri go back to Jersey City where he could be a Democrat where you stop pretending to be a republican where you from Tom my vote is no thank you next Council vice president OU yes Council president Coleman yes council president I would just like to thank all of the members of council that support it repealing the downtown Redevelopment plan uh the plan does call and we can bring up the township engineer if you like the plan does allow folks to go up to 150 ft uh in in height which is about 15 stories uh it does allow future governments or this government to negotiate payment in Le of tax programs as out as far out as 50 years um which would mean the schools get nothing we've all seen the impact of other Pilots that we've done or that the prior administration had done administrations had done the impact that it's had on schools and the school budget uh the schools are hemorrhaging funds as well so these Pilots are not good the tall buildings as far as uh its impact on traffic congestion quality of life people move to Tom's River like myself Jim you're right I grew up in Jersey City which is why I have a unique perspective on this people move to Tom's River to get away from cities to mess it up that's no no jimim you and your friends voted for this and we are repealing it and you're angry because you're in the pocket of developers and special interests that is why that is why you're angry you are out of your gour that is what you're angry no that is what you're angry out of your gourd and shame on you Mr ners because you said you every word out of your mouth is a lie support it repealing just keep lying every word out of your mouth is a lie it's all Bluster it's all fluff everything you do here is to make you look big every appointment is for you everything you pay for your benefit everything we did here tonight was for the taxpayers and the residents saving everybody money while you waste money Tom it's not Community Development Health and Human Services Recreation and Parks buildings and grounds under chapter 40 of the Township Code Department of administration two repeal chapter 48 Department of Community Development in its entirety three repeal chapter 46 department of human resources in its entirety four repeal chapter 56 Department of recreation in in its entirety and repeal 23-1 A3 and 7 of the Township Code this is a first reading the only thing I'll add is it wasn't Department of Human Resources Department in human services oh I apologize I make a motion to table this ordinance and and I'm sorry to bother you but did you guys did anybody read this full 20page ordinance in its entirety and can anybody besides Peter of course and whatever uh tell me what all this is and why are we finding out about such an important a second very important document uh 10:35 this morning we got this 10:35 and that one Nance alone is 20 pages co-mingling so many different departments and different job titles that it's impossible for anybody at this table with the exception of Peter and obviously this really smart guy here to make an educated decision on it and not only did we get it positions which are the positions that are required by law where folks receive tenure those positions will be as the statute States department heads now other heads of these divisions will be known as division leaders they report to Administration this codifies what's been going on forever and makes it consistent in all the Departments the language regarding the positions it's all it does doesn't change anything else doesn't cost the nickel all it does is make it consistent with the law Mr that's all we we're doing Mr Coleman go ahead jtim I have a I'm sure most people do have very difficult recall that you had uh made it a pretty strong point to hold agenda meetings which I did enforce and follow your direction and your suggestion also I did hold the agenda meeting this month uh in advance of this meeting I held it last Thursday uh Tom was there and the purpose of having three Council people there is to Comm communicate with the other Council people making them aware of what was discussed at the meeting um if the agenda meetings are not going to solve the problem of getting into these arguments then maybe we don't really need the agenda meetings we just go to the main meeting but I do believe that it also does solve some problems I mean I took your suggestion to heart it's not really suggested and um and put it in place we're not required to have an agenda meeting but I think in some cases it's a good idea okay so that's what I'm telling all right could I say something sure I know we went over these things at the agenda meeting but we probably didn't go over the real reason these things are on the agenda there's other reasons behind these that I wasn't made privileged to what are they okay I don't know what they are don't don't don't interrupt let Tom I'm sure you information I don't know what this plan entails I know there may be a redundancy in Services because the county provides uh some of the services that the homeless require and they have a better vision of how to handle these things and than I pretty certain our mayor does um and I think it's premature for us to to do this without a full consult with uh uh with the county and I'd also like uh you know in regards to mayor's comments last meeting uh that uh you know why should Tom rer pay for the services uh for residents that come from other towns well I think we should have some sort of shared service agreement with other towns uh and discuss the homeless and if the town if Tom R is in fact um uh footing an undue burden uh from Other M that that we should be sparing to other municipalities we should actually have some sort of useful service with these people um also um um the county offers services that that that Tom D is not going to I mean once we get people into temporary housing shelters what is Tom drier going to do for them where are these shelters and how are we funding this it's very premature to to vote on something like this without going uh The Next Step um and and I think uh I think we really need to step back on this one take a look at oh did you want to okay just if you're when you're done I'll speak but uh so without you have to be you have to be a good listener Jim you have to be a big boy and a good listener did you want an answer to your question I don't think I was finished oh so when you're listening you'd know I wasn't done all right you asked month ago I called you up to explain to you exactly what we're doing had you on the phone uh you sent an email acknowledging that I had you on the phone at 8:00 a.m. that we had this conversation at approximately 8:00 a.m. and you asked about a week ago for a list of all of our meetings that we had we sent you a list of about seven meetings and all the hang on all the people that attended uh and then invited you to come in when and I would explain again to you the plan for the second time and you didn't respond to that email you didn't respond to the clerk's email but all of that aside uh this is not for a shelter uh the toms Police Department Captain mayor and uh officer michelo and I spent about 4 hours in the camp about 2 or 3 weeks ago and um you could probably op request the video footage from the body cams if you like and we met dozens of people that were um you know in need of housing the DCA has I think it's about $4 million set aside to put these people into housing part of the problem is that um they don't have identification they don't have a birth certificate driver's license or credit card and it takes often times several months to get these people approved for housing so that they could sign a lease uh we're coming into winter there were several people in there that were rather old um on Social Security sadly they were only making some of them $800 $900 a month in Social Security uh we should definitely as a country be looking more closely at that I mean that's God awful um and they were living in tense and it's cold uh it's going to get colder so what this allows us to do is use some unutilized funds that we have we we we found about $2 million worth of arpa money uh that'll offset the Township in a lot of ways uh so this allows us to put these folks into hotels uh while the um while the DCA places them in permanent housing and it gives them the opportunity to work with the people so uh cuz a lot of these folks need other kinds of Services mental health addiction treatment and things of that nature um so this this basically puts them uh up for the winter and allows us to cover costs while the DCA places them uh the DCA thinks it'll take you know two two to three months to to get everybody placed but it'll be uh January and it's cold so we have extra money here because the council has been very diligent and worked uh with me uh in in reducing the size of government and we found this $2 million of arpa funding uh that that we didn't have before that we're going to be able to use for all sorts of things so uh we can consider it free money and we should do a good thing and get these people out of the woods and then once we do that they're going to sign off on an agreement uh the the person is running the camp and we're going to shut the camp down and tomser is no longer going to be a location where homeless people are camped out in our Woods that it's not only a danger for the people who are living in the woods in the winter it's a danger for for residents so uh we don't know who these folks are as I said they don't have identification in some cases they're addicted to substances uh in some cases they're mentally ill so uh this this will move them out of the woods and place them somewhere uh while the DCA Works to get them permanent housing and again Jim we we we did have that discussion I was willing to meet with you um I'm sure you'll vote against this but it's interesting because you support the idea of opening some shelter here in Tom's River where uh people would bring in homeless from all over the place and if you were to review the footage that the that are on the body cams from the two officers that were in the camp with me you would find out of the dozens and dozens and dozens of people we spoke to only four or five of them were from Tom's River they all said that they came here from somewhere else and they all came in uh within a very short period of time so um there are responsibility now because they're in our Woods we do have new tools legal tools after some Supreme Court decisions but simply throwing people out of town uh would would not uh be the right thing to do and could result in some sort of litigation a class action type litigation so this this solves the problem will allow us to close the camp and our new Chief has reassured me that going forward we will make sure we uh Patrol these areas and inforce our no camping ordinance which is already on the books for a very long time as well as our Laing lawyering ordinance so um I have nothing further but I hope that answers talk about first of all um you found $2 million in arpa money that's fantastic so that's more proof that we weren't $3.5 million uh uh suffering from a $3.5 million budget shortfall just so that's a miracle second of all I think you need approval to use arpa money for housing the homeless uh third of all if you were so concerned about the homeless why did you close the blue uh the the code blue shelter Co why' you close the code blue shelter when the state law requires that we have it is when you have 10 or more homeless people in our community homeless I'll I'll I thought it was I thought you asked a question so let me write these down real quick so you want to know why I close in that email that I sent you after our phone call yes I asked for supporting documents not an itinerary list you sent you read the email yeah the one that just gave me an itinerary I said that I got one that you just said that you didn't weary that's all it said there was no invitation to go into the woods there was no supporting document saying where you getting the money from there was nothing saying what the plan is there's nothing telling me what hotel you're going to okay so nothing so just real quick do you want me to answer why we convers no we no conversations between anybody at the state or the County Board of Health nothing you gave me an IT Steve rightfully gave me an itinerary so you you you asked about the code blue and why would I would oppose the county bringing in another code blue uh when when the folks came here uh they presented literature and spoke and they talked about how they brought in 288 people last year from all over ocean and Mammoth County uh then they disputed those numbers and showed us some literature that said they brought in 188 people here from all over Mammoth and Ocean County um you know and now we have people living in the woods so I don't think that Tom's River should be the Center of Ocean County's homeless problem we shouldn't be required to take those people in however we do have them now and and and they're all respons responsibility as well as the safety of all of our residents so we have to solve the current problem but what a code blue facility does is it brings in people especially when the provider is is is incentivized by doing so right if the provider makes money based on how many people they process then then then the incentive is to bring those people in and uh it creates a problem concentrates the entire County's problem here in Tom's River the police department they um they've been there 40 times in the last uh 24 months I think it was 27 this year alone so it's like every other week the trpd has to go in there and they're not going in there for small reasons they're going in there because people overdosed they're going in there for sexual assault complaints they're going in there for for regular assault complaints these are are not small things they're Nar canning people our EMTs have to get in there through the woods at night to to help save people's lives who have overdosed on drugs we don't want to be San Francisco Jim I know you may be comfortable with Tom's River being the next San Francisco but I'm not and that's why I'm doing this I tried to explain this to you again and um I explained it to Mr Nas in I explained it to everybody at the agenda meeting I've had several phone calls I called Mr seosi on the cell phone to talk to him about this I have it all here uh but anyway I have nothing further and frankly Jim I'm not answering any more of your questions about this you please Mr Mr doing a moot a motion on the floor I simply asked for the supporting documents and what the plan is I don't want any more homeless people I don't want people to be homeless but I also don't want that's good okay so I just want to make a a comparison what's going on here okay we have a president currently that doesn't have a clue what's going on in the country no cabinet meetings for almost a year he doesn't know who's behind him that he met 30 seconds before the uh heads of States behind him he doesn't even know that his defense secretary had a major operation and is incapacitated for like a week he doesn't know what's going on here we have the opposite we have one man maybe two guys in charge and we have a council up here the majority doesn't have a clue what's going on what's in the bill list what the ordinances are and the re repercussions of these votes they do not have a clue and when Jim or I or councilman nion asked a question where it attacked immediately ly for that and it's our fault because we don't know this or that or whatever but we just get the agenda the morning of and then the afternoon it's changed the bill list is changed I don't even know if all the bills are in this I have no idea where in the past I did so are our town is in trouble and And in regards to downtown Tom's River the building was only six stories and 20 to 30 years to get to this point we found one developer for $65 million to go down here to invest and we lost $5.6 million in a grant to improve the streets the storm drains the new entrance to the parkway all that money is gone and there's nobody going we're downtown is hanging on by a thread I have owned property down here since 1989 1990 so I I go way back to charies and everything and and and it's barely hanging on what we have left if we weren't the county seat we would have no downtown nobody's going to invest in Nickel in our town now during this current Administration and and and what's going on here behind closed door doors it's it it it it's completely ugly and everybody in here knows this so um I'm doing the best I can and um I'm sorry to uh W four that I can't do more but it was never like this before I was part of a team if I ever had a question if it was dumb or not or a serious question it was always answered and the previous Council presidents they always knew everything that was who what and where so I have a question that you know they were talking about uh number eight on there that uh giving people new titles and everything like that so who is this creat creative Management Inc another one out of per and boy so I need your help on this everybody grab a bill list and Google these names and who are getting these checks and from where Mal Holly per Amboy North Jersey all these Outsiders are getting this money and what does creative management do they give new names to department heads and team players or or whatever and I I don't know I'm rambling now and I apologize so good night and thank you for coming everyone thank you councilman [Applause] nerson I'd just like to say thank you to Dave for saying that so eloquently and and there's only one con man here the man who called me a con right here that's [Applause] all councilman quinley uh first um I want to say that the mayor LED on that the school is bleeding money and that's why they have to raise taxes and I'm going to assure you the school is not bleeding money for a guy who never mind uh the school's been horribly affected by the S2 cuts that our Democratic governor had put in place and that's why our school system's in trouble and that's why our school system is going to be forced to uh Implement another tax nobody wants it nobody wants at least of all the people in the school what we want is pressure on this on the state government to repeal the S2 or redo it so that it's fair and Equitable to everybody the school system our Tom D school systems have been among the best in the state for years they're doing the best they can with millions of dollars less than they normally have so it's not the fault of the school by any means uh secondly I have to Echo what Dave said like I sometimes feel like I'm dealing with something I can't describe because it's pretty it's pretty bad um the the I'm so vocal up here because I can be because you guys all can't be and I know more than what a lot of people are uh would would get to find out uh some of you are very good students and know more than me and I appreciate that um but the difference between this Administration and uh the mohill gang was that uh um we knew things we were informed of things I think when the uh their new CFO got up today that may have been the first professional that got up here in 10 months where the other meetings we would have professionals almost every meeting and we had two a month back then we didn't have to uh beg for for information or or be lied to about it or or have it just held from us until we're surprised at these meetings it was a whole different um way of doing business and and I think it was better well it's obviously was better uh the mayor is under under the belief that uh that uh that what we're doing is uh the negative and the the the bad thing that's happening in town and I want to assure you as most of you guys know because you come every week that uh I don't think we're the bad part of what's going on to this town all right we're trying to do the best thing we can we need information we need honesty and we need we need an Administration that's open instead of closed if you hide something even if it's um minute issue you're hiding why are you hiding there's no need to hide we're going to find out everything inevitably sadly some some of the bad some bad decisions will have negative repercussions that are going to cost us down the road and I'm sure we have plenty of lawsuits to support that statement but uh I just want to wish everybody a happy Halloween and have a good night thanks thank you thank you all for coming I appreciate [Applause] it councilman lamb just want to make a quick point that in referencing what councilman quinis was talking about over 10 months there's what's called transition period it was a major election and you have what's called transition it's pretty common in our in our uh Republic that you have a transition that's what we've been experiencing and um some sometimes you might not get information as fast as you want Jim and we're sorry about that um however when I was on Council for the first two years I was in minority with councilman Rodrick at the time and I could tell you that I was in the dark always there was no plan that was discussed with me there was no future uh discussions on what we're going to do and what we're going to do downtown and all of a sudden you just get thrown in your lap and you want you're told to vote on it and a lot of folks in the crowd that were against these skyscrapers and this Downtown Development are now flipping the tune and saying well no we should have that well that's unusual because you came to every meeting and you're railed against the development you're railed against putting up these again affordable housing projects these huge parking structures that serve no purpose for our schools and serve no purpose for the for all of us so what you're experiencing Jim and David I hate to tell you Dave I feel also bad for you Dave because you know you didn't tell the public you own a property downtown so I no you just said you own property and stay downtown and I think that think that I think that gives a little bit of conflict to the oh he didn't if you want to replay it he he said he owns property but all right well we'll have to replay it and listen to it but the point is David you're conflicted from talking about it sometimes because you know what at the end of the day the residents didn't want it we don't care what you want the residents voted no to it several times I can go back let me this is my this is my comment period I can tell you back in to 2017 they didn't want a large Firehouse down there that was three story stories and they certainly don't want a 15 story building or six-story David whatever you claim they just don't want it and every election we have we have residents that come out that live downtown saying they don't want it and that's what we're up here to do we're up here to answer a residents call and that's what we've been doing Jim I don't know if you see what's happening but we've been doing that um just want to just let the folks know that this past Saturday was at the ortley beach voters and taxpayers meeting was a very good meeting uh the police chief I know everybody wants to call him the acting police chief but in my world um when you're given any sort of uh promotion you out of respect you respect the the title so Chief sundack joined me at that meeting it was excellent and we discuss discussed a lot of issues but what we're really happy and looking forward to is we finally got our beach replenishment it's coming we have the Army Corp of Engineers that awarded $725 million to the Great Lakes dredge company ortley Beach will get 426,000 cubic yards of sand they're going to re-engineer that whole Sixth Avenue area which needs it it's been again it's been not our fault we've been just trying to throw as much sand as we can there every winner but now we need to re-engineer that and and do it right so after that replenishment comes hopefully in next you know few weeks we get some meetings going and get this thing going hopefully the boardwalk will come next and we'll get ortley Beach where it's where it's got to be at so um I look forward to more discussion and more debate with again those that are the majority with me but also with those in the minority if Jim you have a question call me I answer your calls David we talk frequently if you don't understand something or you want something broken down call me I'll certainly explain to you yeah but I'll I'll explain to you I'll show you I'll I'll I'll I'll break it down yeah but I'll I'll break it down sometimes a lot of times very strong feelings and you certainly have a right to express those but there's a appropriate way to do that too uh I've run a lot of meetings in my career and most of the time people had respect even know they disagreed with me or the other people that were involved in those meetings and U I'm just very disappointed I I look at Tom's over having some very intelligent people people that know what they want and we should be able to come together and then be like adults and express ourselves in a professional manner we've not done that and I hope that that changes in the future I really do I'm a very level-headed person I do look at all the issues I know you think that I'm in the mayor's back pocket but I have taken the time I visited the police station before we took that vote I visited the animal shelter before we took that vote I do my research and then I make up my mind based on what I've seen and what I find out and I'm sorry that Mr nion thinks I'm a puppet uh I've never been called that before because people know better than that but I'm just saying it's just it's just sad for somebody that's had 32 years of administrative experience to have have to experience this and I hope that in the future we can change and hopefully work together okay all right this time I'd like to oh I'm sorry sorry I always forget mayor I'm sorry I apologize go ahead mayor so um I just want to thank the members of council who supported repealing the downtown Redevelopment plan part of the problem with living in a EO chamber is you don't really get a chance to hear what other folks think and I know there are a lot of folks that are dedicated to coming out here and supporting Jim and and um and Dave you know it's about 25 or 30 they come out pretty regularly uh they they clap for them they boo when we do things that same crowd they've been coming for a long time I've been on this Council since 2017 and man I used to feel like man must I must really be in trouble here but I wound up winning the election with over 70% of the vote so I would just encourage the folks that are on Council uh to stay strong that the opinions that you hear when people are yelling at you and screaming at you they're not the opinions of the majority of folks at home the folks at home the people who vote the people who pay taxes they don't want 10-story buildings downtown they don't want a city of 20 buildings downtown they don't want to give tax abatement the big corporations uh that that we end up flipping the bill they're for smaller government lower taxes that's what they want and that's what they voted for that's what we're giving them so again I would just encourage those members of council who may be feeling like you know they're getting beaten up here to recognize that they were doing this during the primary as well and the folks that were with us Bill burn was with us in that primary he won by over 60% of the vote so uh again the People of Toms are were with you um and I want to thank you for supporting what they're asking for Which is less development reasonable development that's all I have thank you um it's um coming up towards 10 o' I'm going to limit public comments to 60 minutes we've been here a long time so in no not each total of 60 Minutes uh the clerk will keep track of that and again um when you come to the mic clearly state your name and address and you are not going to be interrupted during your 3 minutes okay all right come right up yes sir Joe Coco address please Joe I'm getting there oh sorry 161 w Creek Lane Tomas New Jersey I'm going to give you a little help with respect to divisions and excuse me departments this I don't know again how how much any of you are familiar with it or unfamiliar with it but I I I've been through some of this in the past the uh divisions are below the Departments so the department is the umbrella for the division and you had questions with regard to the engineer earlier and I can make my own work here so as an example in engineering it is the department of engineering I'm sorry it it's the dep Department of Community Development under that department is division of engineering division of construction services division of zoning and planning that's just one one particular Department you have the department of recreation they also have several divisions under them pretty much each of the Departments so now if you're going to make those a division you can't have divisions under divisions you know it's that that's not how how the the hierarchy works and at the same time what what are you shaking your head for we don't there there aren't going to be divisions under divisions not according no if you follow and do it this way you're still going to have those those divisions are going under the department of administration and under those divisions there's going to be bureaus going to be so this whole thing if you're going to do it should be done completely from one A B C D and F Etc is what I'm saying because if you just do this you're not going to have that you're still going to have these other ones there and what you're doing is you you're putting the entire Township directors or they won't be directors anymore okay but you're putting them under one one Department one person that's the things you got to look at it's not the entire Township no but I will tell you going back a few years and it was probably those were here even before that early on there were a handful of uh confidentials and those confidentials were moved around and some divisions were changed but what I'm saying and and you know mayor and business administrator you really need need to look and then just go through each of these but I think each one of you those that were here those that are here new really need to dig into looking at these departments you know and I I mentioned this before and remember I I don't come up here Shout Scream curse or anything else I'm just going on my experience there's my three minutes but what I'm telling you now is look at this stuff and we can do away with some of this argument all right thank you Joe I'll be up again council president um I just want to point out the ba is the the department head he is the head of the Department of administration so it is inappropriate to have other department heads comment go ahead mayor so you you you know having department heads report to a department head doesn't make sense you have division leaders appointing to the headed all right I think I think you made your point let's move on go ahead sir yeah Bob toolan messenger Street uh got a lot of things here so I'm going to talk quick first of all you say the public here you know the way we speak out because we're tired of lies and I'll start with Justin 15 stories 150 ft lies Justin but if you were here at more meetings you would know that I don't miss one uh the mayor the police never had a call at Riverwood for anything that you talked about never they were dropping people off there that they picked up off the streets here in Tom's River go ahead smile never okay the school board did not pass a 99.9% increase as you said in your letter they did strike three the consent agenda first of all we can't speak ask questions or anything but the word in in the uh phrasing no separate discussion of items if discussion is desired on any item that will be considered separately considered means contemplate study in way it doesn't mean vote on it separately uh as far as the EMTs goes I'm getting tired of this uh when I got thrown out last time uh I was listening at home and there was somebody complimenting the mayor on the number of EMTs on the road in one sentence one sentence you said yes I hired 8 18 No 19 no 23 no 28 new EMTs that was your line the board approved eight where' the other 20 come from and were they approved or is this just another one of your lies Miss UL if you can hear me at home there uh I don't know who received a letter for biso uh there's not more police boots on the ground there were 80 MTS not nine like she said in her letter but later on in her letter she says the mayor hired 28 new EMTs what's the truth here who knows uh as far as uh the mohill gang yeah we had our disputes with the former mayor and his people also but the difference was the public was treated with respect this mayor and Council have no respect for the people they're supposed to serve two petitions signed by appropriate number of Voters ignored and by constantly referring to the former mayor Hill and former Chief little you expose your jealousy of the respect these individuals have earned in the community your constant lies have not gone to notice by a large number of the population many of whom voted for you miss UL your letter if it was yours is not only filled with lies but probably opens you up for an Ethics violations uh when you talk about the police salaries and a money saved going to MTS once again I go back to a comment I made a long time ago we have a part-time mayor Pam half salary uh also if we didn't pay somebody $30 an hour to sell Beach badges maybe we'd have more for the police and EMTs as well the letters GOP government and the people not in Tom's River you're not allowed to say anything you can't ask questions we're useless here thanks for not serving us annland doine 9 St Lawrence Avenue it's now 10 months into this horrific Administration and not one thing was accomplished in fact we've gone backwards every homeowner is waiting to receive a letter redacting the lies that were sent out in previous mailings by the mayor tonight I was going to insist that a code blue building be made available since locking just believe out of Riverwood Park Building however I just read where Ocean County stepped up to the plate and will open a coat blue and Tom River thank you to those who worked so hard to get that done we also must insist that Silverton EMS be reopened there's a shortage of ambulances in service in that section of town and you know it there's no excuse to the cruelity that has been shown towards the animals the homeless population the former employees Silverton AMS the police department the Board of Education or disrespect towards fellow council members and concerned citizens I'm dis Ed with what I have witnessed and you're an embarrassment to this beautiful Township and then to add to the embarrassment insults our intelligence we receive a vile letter from lino tul endorsing burn and filled with lies about our former Chief of Police Lynn must have been involved in politics for at least what 70 or 80 years and just baffles me that she would choose to attack the most respected man in this town and just to clarify there are 155 police offic officers compared to 163 last year at this time this letter was counting class ones as full-time police officers how desperate are they to get burn on the council desperate enough for our Council vice president to risk her political career and what little Integrity she has left hey War Two if you're paying attention and realize this Council needs so much help running a decent council meeting and running this town to bring it back to the Tom's River we deserve then we also you also know we need a decent kind loyal candidate and we all know the best choice for Tom's River is not burn and that Lynn is how you get your message out to 50,000 residents watching you circus clowns every [Applause] month Dennis gante 1149 Cherokee Court Toms River New Jersey uh so name calling is okay right that's okay um I'm going to Echo about Leno Tool's letter the letter that she didn't write but she signed interesting she also says information that she cannot divulge of a lawsuit if even such a lawsuit is still in existence is if it's pending what are the the particulars in that lawsuit that does each and every other council member know what this is all about so I find a problem with that also um Mr Coleman your new policy that states that I can't ask questions well I can ask questions I believe it's on the tape I missed the last meeting and if I interpreted the tape you said that you cannot ask ask you can make comments you can't ask ask any questions well I'm going to beg your pardon if that's if not I'll stand corrected but the open public meetings act if that's what you said you are in violation of my rights under the open public meetings act which says that I can ask questions but you don't have to answer that okay and as far as your private meetings would you said to ask questions no I don't think so the public deserves to hear the answers to any so-called question okay um you want me to read you the open public meetings act or you'll look it up on your own so for the record any comment anything I ever say is a question because if you make it a comment and somebody says the wrong thing that could be defamation of character or that could be slander so anything is in form of a question Mr pastarella would you please stop pointing at people I find that very disrespectful to say the least okay you're also you're also you violated Mr Coleman's rule before when a public gets a a chance to speak that there will be no discussion or comment until after it's done but you interrupted and you answered a question so would you please stop that because I find that you're out of order quite a quite a bit and I'm sorry to see Mr lman and I'm going to finish up I'm not going to come back again that he left the meeting after the last meeting for all the 20 years I've been coming to meetings I've always try not to attack personally I've always come up I've always tried to talk to the individual if something went their way after the meeting okay Mr lman didn't like what I had to say at the last meeting that's okay he shook his self at me but the worst thing about it is and I'm sorry his daughter was standing right there told me to go myself and I'm intolerant of that thank you time is up Sir yeah thank you Robert guchi 1019 vhole Road my statement concerns the recent proposal of a resident in motel at the intersection of Hooper Avenue and Walnut Street which is in a lot of our near our backyards so I'd just like to read made a short statement at the 1624 planning board meeting all the board members approved the variances sought by the developer but did so rather reluctantly telling some of us during the break that since the plan had been previously approved in 2009 there there's little that they could do to deny the approval here is what I see lies the problem with this statement just to give you folks some background this hotel project was originally approved in 2009 some 15 years ago during the meeting presentations and questionings of the planning board meeting the statement came out during that meeting that the last time an environmental impact study and traffic study were performed for this application was in 2009 which I again say that's 15 years ago needless to say the development or as I would say the overdevelopment and the resulting increase in the traffic volume that has occurred in Tom's river in the past 15 years has dramatically and adversely changed the environmental and traffic conditions within this Township since so much time has pass from the original impact studies were conducted and the subsequent approval for this hotel excuse me was issued a prudent measure by the township officials should be this this is my recommendations because 15 years of gone by and we know traffic has increased overdevelopment has increased so how could they go forward with these old studies so here's my two recommendations the entire application should be reviewed by the appropriate Township offices to ensure its completeness accuracy and currency to make sure there was no inappropriateness with the process number two that the developer for this site Andor the township should initiate new environmental and traffic impact studies in order to currently assess the current scope of negative effects the construction this proposed Hotel would cause when these tasks are complete the township developer and the affected residents will have a current situational awareness of the negative effects that this proposed Hotel will have on the residence of Tom's River an issue that was raised during the meeting what what I see is an apparent hypocrisy by the township with regards to environmental issues I explain this to the board that every year when we receive our tax bills in the mail there was a flyer enclosed with the bill that urges the residents to take certain measur in their homes and businesses to minimize the effect of non-point source pollution I agree with what this flyer says and I do my best to ad here to its guidance and yet while this flyer is sent to the residents to do their part the township is allowing nearly unchecked development to happen in our Township all this sir you can come back again for actually Mr uh Coleman would you mind extending um Mr guchi was on the phone we were on the phone about 30 minutes and he's very passionate about this and I believe the folks that are all in line are very passionate about this the other thing I would ask if Mr guchi would mind waiting just a second as we we do have Mr mcgucken here who is uh a legal heavyweight uh when it comes to that that was not a pun that was not a pun um who may and I don't know if he got back to you yet but we were talking about whether or not we can I actually responded to him you did respond I it's an interesting argument the argument that the environmental study is old that the traffic study is old these are all excellent arguments um I certainly wouldn't want a a hotel built next to me as you noted it was built it was approved in 2009 maybe Mr McGuckin or uh could could give us some insight as to whether or not that's a viable option uh could the township uh require that they do another study um or or would we be um in trouble for that so did the board approve it yes well and Greg just by way of background it was only an a variance application for um the size of a sign that they were installing this was an application that had been granted a number of years ago this was an amended application and the only variance relief that they needed was for the size of the sign that the that the hotel was putting in in that case they would not be able to require them to update those reports because the application in front of the board was simply for the sign they already have an approval so they have vested rights as a result of that when you say vested rights what does that mean that means they have a right to build what was previously approved they wouldn't be able to do the sign if they denied the variance they'd have to go with the sign that was orally proposed but that's only thing that the board had control over at this juncture in 2024 okay everything else about the amended application was conforming to to our uh zoning Reg ulations I certainly would wouldn't want that by my house and uh as you see this is exactly why we just repealed the downtown Redevelopment plan these kind of structures are not commensurate with the Suburban feel of Toms River people move to Toms River to get away from uh big giant buildings and a lot of traffic um if there's anything we can do to help mitigate it and buffers anything we can do at all um I'm certainly open to that okay is my time over no you if you please finish can you have another three minutes Mr Coleman how about how about um how about a minute that' be great that'd be super thank you I'll read fast yes an issue that I raised during the meeting is is the apparent hypocrisy of the township with regards to environmental issues I I I explained about the flyer and Clos with our bill how we're told to be careful with our non-point source pollution and follow the guidance and like I say and while this fly us into the township would for the residents to do their part the township was allowing nearly uncheck development to happen in our Township which is degrading our Coastal waterways and diminishing the quality of life for its residents all this is happening despite the reports and the studies commissioned by either the township or performed by third-party organizations that clearly indicate that non-point source pollution caused by overdevelopment is literally destroying our Coastal waterways and killing the marine life in those waterways that's not an exaggeration the overdevelopment as Tom's River has to stop if we want to preserve what's left of our undeveloped lands and Coastal waterways and then I go on to say the township can start this process of overdevelopment cessation by preventing this hotel from being built all right thank [Applause] you Maria McOwen 1015 Hall Road I literally went door too into our neighborhood and spoke with over 60 homeowners about this proposed Hotel all of us share the same concerns concerns for safety concerns that placing this hotel in this location is detrimental to the public good and inevitably creates a serious nuisance that has negative and far-reaching consequences to illustrate my point did you know that in the past 22 months there's been 500 21 documented incidents involving the Toms River Police and the nearby Howard Johnson's hotel 283 or 54% of those calls were criminal and violent in nature including 108 disorderly persons offenses multiple weapons warrants and sex offenses 10 thefts and 57 nuisance related calls the 15 years that this developer has taken to pursue his building plans has been nothing nothing short of Agony for me and our neighbors we've attended all public hearings we've been notified of and begged previous administrations to address our concerns in the week following every time this developer signals he resuming his plans I've cried literally over the animals losing their Refuge the beautiful trees being torn down and all of us losing our privacy and our peace this developer has held our lives in limbo for 15 years so I come here this evening to respectfully ask that you collectively brainstorm what can be done to stop the building of this hotel in this location perhaps collectively together you can work together and have some ideas for some recourse perhaps not all timelines or deadlines were followed maybe there's an overriding ordinance or statute that can be used here's another idea given the magn magnitude of the fact that our Town's been so accommodating perhaps an amicable solution is a meeting between the town and the developer to discuss relocating this hotel if in fact Toms River wants the hotel but also wants to honor overdevelopment doesn't it make sense to at least have the discussion and do all you can to try to do what's and correct what's clearly a mistake so many of us said that this hotel relocating on on 37 may be in the vicinity of the old Food Town or any other the Myriad of existing places that makes more sense would benefit all there's many positives to this idea a hotel adjacent and walkable to shopping and restaurants helps all businesses to grow it's safer it minimizes imperious impervious land use is more easily accessible and is just plain smart good planning it's the right thing to do to try to mitigate what residents our planning board and other officials agree is building in the wrong a it's prudent I just have two three sentences and I'm finished it's prudent and in everyone's best interest to put in the effort now before this moves further along our Town's leaders have the responsibility to plan for today but there's also a responsibility to plan for the future please this is critically important ma'am I understand that but um you have a right to come back for another two minutes at the end okay excuse me all right I have to I have to cut off okay I'm sorry I'm sorry we will we will um Mr mcgucken can we um perhaps meet with Redevelopment Council to see what their thoughts are absolutely we'll take a look at the timeline of the approvals and extensions and so forth I assume the board did that but we will take a look at it okay thank you yes sir uh Dennis McGowan uh voxa Road same issue uh but I'm going to be a little bit shorter uh uh two ideas um that I they add well one request and one idea the first idea if something has to be built in that Woods what would benefit all tons Ser residents would be a better Jug Handle from Hooper Avenue South onto Walnut Street I worked at a Board of Social Services back in 1992 through 96 uh every rush hour that Jug Handle was backed up and it's still backed up from 92 to today uh you just built or the county just built a huge new Jug Handle around the vet clinic um and because you already had a bank there and you have that old sign building that's right on that corner of Walnut uh it might be better to do eminent domain and run your big new Jug Handle through this property I mean that would benefit residents more than residents in uh which is what this place is about to be um so that's one idea uh I have a whole bunch of examples of terrible traffic right there um just quick example from just Thursday night we were at the planning board on Wednesday and we were talking about the traffic and they said sorry we're only here for the one sign approval all done we wouldn't have approved this if this came to us today but because it's old it's approved um Thursday night we go out at 5:00 they're backed up from 37 all the way across Walnut Street so only two or three cars made it through the Green from Walnut over to edkin or vice versa everybody in The Jug Handle stayed at 6 o'cl we're on our way back from the edkin side edkin leads to Walnut uh same exact thing backed up I don't know if it's the same situation or just a new moment in time when the whole thing is backed up that time two cars made of that of The Jug Handle to do what they need to do as they were coming toward us so if we're building big beautiful jug handles uh we'd love to have one in our backyard um also this hotel is just um 160t from our building forget about property lines so if I tore down my neighbor's house the next house is where this hotel is going to be so that's not good uh so that was just sort of if it can be done first time my life I'm going to love the word eminent domain I'd ask you to check into that or talk to the county about it um the next thing if possible if this thing has to go up um we would ask if we could as some of the residents just meet with your town engineer and your Forester specifically to talk about what can be done to mitigate this issue uh we had a discussion with the Forester years ago uh this developer has been saying for years 75 ft they told the planning board 75 ft we're not going to take down a single tree about a month month after they left the planning board they drove a bulldozer right through the back of our yard 50 ft out so they could do uh soil testing uh the Forester was pissed uh he told them so he told us so he said we're going to have a reforestation plan to fill that whole Bear area plus all the other stuff they're supposed to do he's retired years have gone by we didn't know whether this thing is going to happen or not they came to the board evidently in 2002 I mean 2022 they were told they didn't have to tell us so this is the first time we're back knowing this thing's happening so if we can meet with the engineer at Forester we'd love to talk to him thank you thank you uh John Green 1011 vs Hall Road of course I Echo the sentiments of the individuals before me uh when this first was proposed years ago um there was a lady that stood up in front of the committee and and made reference to her concern about that hotel obtaining a liquor license because that's what they're seeking and she made reference to the concern that it was too close to a school by State Statute and everybody on the committee which was a different committee that that that she was speaking to kind of chuckled at her until and they said well Walnut Street Elementary is quite a distance down Walnut Street and she said no I'm referring to Westminster Nursery School which is approximately 200 feet or less from where they're going to be seeking um a license to serve alcohol not only with a restaurant there um but also uh a bar we requested information and some feedback on that all these years we've never got an answer is that in a Zone um where it violates State Statute I'm not asking you right now uh but I know it's within 200 feet and it's awfully close all right that was one concern and the second concern is the proximity of the hotel in regards to five schools westmin Nursery School Walnut Street Elementary thur intermediate North thomasb High School North and the Ocean County Vocational Center Westminster Nursery School we can measure in feet how close this hotel over 100 rooms will be next to a school where there's going to be 2 and A2 yearold children up to age four parents constantly bringing their their children back and forth not only during the school day 5 days a week but also at night uh for evening programs not to mention the Presbyterian Church which is right next door as well Walnut Street Elementary School it can be measured in yards from this hotel now the distance uh as I said measured in yards there's approximately 726 students ages 5 to 11 if you know that area and that hotel is going to be built between Chestnut and Walnut Street which is a a small pars of land if you know the area and you know the school district that area is zoned for all Walkers students in that area ages five up to um ages 11 will be walking on Walnut Street Elementary School Tom were immediate north um which has approximately 968 students although it's not in a walking area there are several bus routes and bus stops both on Chestnut and on Walnut Street in the adjacent developments there'll be constant travel with children on that road to a hotel where people will be coming and utilizing chestnut and walnut Street as a crossroad coming from the parkway or Route 9 or going to the parkway or route n th for High School North sir you can come back for a second shot I would like that I have a few more to share no problem yes sir how we doing Ronald Marino 2230 over MAV uh my concern is the speed on my street uh the development and and traffic is just horrendous uh I'm in between Hickory and North Maple there's passing lines in front of my house uh recently they opened up the Vermont Avenue going across 70 into the liquid section and the uh it's just they're not using New Hampshire Avenue and they're not using route n they're using our road we'll set up a uh we'll speak to the accidents on North Maple Hickory at least once a week pretty pretty serious accidents and uh the another concern is the parking on the corners on Hickory Street and Vermont you can't see the intersection to pull out to Cross Lanes or to turn left or right on on both Corners I've been on that inter on uh Vermont Avenue in Stark for 45 years and there was horses chicken farms at that time it was res rural res residential now like you said the development is just there's a house on every lot or something and uh you know if we could do something about the speed it's unsafe the speeding we'll talk to the Chief and he sets up um they set up the uh speed reader and they do a study and then they send some right because the fact that there's no passing on New Hampshire Avenue all the way through o Frey Hall Road up and down Route 9 there's no passing and I believe that's the third 35 in some sections and the other thing and they're staying 45 on my street and they're doing 70 the other thing would be having having somebody out there to yeah enforcement do some enforcement thank you thank you hello Irene Collins messenger Street Tom's River this is as an aside sitting in my road tonight there were high school students from I believe a government class they had uh picture of the US capital on the front of their folder they were here during the discussion of ordinance 7 it would be interesting to see how they write up their reports for tomorrow's class okay but besides that I started coming to the meetings when I saw on the front page of the reporter it was only two pages at the time coming with the shop right circular pictures of the towers I've come to almost every meeting since since that time I attended the special meeting regarding the towers uh that they had and the um Matt Lano um mayor Hill a few other people wanted range a meeting so the audience and there were it was almost filled would come up and talk to the engineer the Builder um the architect and whatever else they would come up and talk to them personally ask their questions hear the response the audience said no no no that's not going to happen we're going to have it in this format and that's what they did um there were a lot of people many people in this town who do not want a City development they want the village of Tom's River and I'm glad that you're leaning in that direction okay um the other thing that I just would like to ask what is the latest could you give an update on the animal shelter council president May so we had to send them sir I reached out to find out if they had um if they had put the plans out to bid or what have you and U Mr rump assemblyman rump is the Board of Health director had said they still hadn't received a certification of funds about what what's left in that uh trust uh which we believe we had sent them I guess at the end of September early October so there was some sort of Disconnect where they didn't receive it but now they have it and I guess they have to to to plan and bid to make those changes and you know construct I guess when we first started talking to them they were talking about you know 6 months but this has been pushed by so many different things all the way to the end of the year now we started this in February so my assumption is once they get rolling it's probably a 3 to six month process then who will be in charge of the Tomer animal shelter Ocean County Ocean County Ocean County will control it they'll have the money but we'll uh first of all assembly mcgucken uh inserted some rules that weren't originally attached to the money the money could have been used for anything now it can only be used uh for the animal shelter uh but uh we'll have to approve expenditures is that correct Mr mcgucken they have to report to us each year on what it's being spent for and it can only be used for those purposes if they didn't do that we would have the opportunity to stop any more additional funding or seek reimburse so and I think it was about 600 and some OD thousand in there it wasn't the the million that that folks were talking about and I guess it's because it's been spent down um on payroll it was used on payroll a lot of it okay thank you Clinton Bradley 133 Jeff Court Tom driven New Jersey I'd like to start off by thanking councilman Quin ion and Sosi for un laboring loyalty to the town and the citizens of Tom's River I've had the great pleasure of living in this town for 34 years and spending a good chunk of my time living off lean Street on erns road the neighborhood that I grew up in was a kid's dream you had a plenty of fellow kids to hang out with and could stay out late because someone's parents were always home watching over you also lived next door to a selfless man who is in the Toms River Hall of Fame his name was Bob Camp he was an AR and Patriot Korean War veteran storian and a school teacher gave me life lessons to standing up for what you believe in holding your head head high speaking up for those who had no voice and always doing the right thing there are times I wish he was still here because he would not have stood for what is currently occurring in this town Bob would also take me to Town Council meetings and never have I ever seen anything like this until this current Administration has taken over no one was ever asked to leave even if they disagree with what the Town Council decided to do no council members has ever looked down upon the citizens of Tom's River or anybody from a neighboring town as well everyone regardless of status was treated as equal they served selflessly and did not use their position for profit or gain I've been afforded the opportunity to serve this great state and Nation for the past 15 years as an army officer during that time I've learned many things of which a core one is the act of selfless surface which is described as the idea of putting others in their needs before oneself you really learn that when you're in command of an entire company siiz Element where you must be a mother and father to these soldiers and try and take care of your own needs as well when soldiers deploy we put our lives on hold to protect the ideals of this country and ensure that American citizens can continue to have the rights of which our forefathers fought to bring to fruition with the start of the Revolutionary War 249 years ago I've have deployed twice and I've seen how other count these other countries operate they do not treat their citizens right and their citizens live in fear of being killed either by their government for speaking out or a terrorist group that is present in their country when I came home from this current deployment I saw just how bad some of the Town Council treated its citizens and I felt betrayed because anytime a form of government wants to trample on the rights of the citizens you are lapping in the face of veterans like me who fought to preserve that right for good or bad I have sa sacrificed part of my physical mental and emotional health and service of this country and then we have people like some of you who just float the rules and Rule with an iron fist should want to be a citizen worth fighting for in closing I ask the select few who are not doing what is right for the town you change yourself as wage or if that is too hard for you then please resign and let someone who genuinely cares about this town take your position remember elected officials work for those elect who elected them not the other way [Applause] around it's a tough one to follow my name is Marin Bennett I'm the executive director of the Toms River business improvement district here in downtown I just wanted to say that we had a great event this past weekend we had over 5,000 people in attendance at our Harvest Arts Festival we had over 110 vendors which is the most vendors that we've ever had at a street festival uh thank you uh council president for joining us um I was disappointed that sensory trailer was not there uh hopefully we can have better communication and have the sensory trailer available because I would hate for one person to leave because we don't have that also we only spent $375 on pumpkins for 5,000 people but that's okay um I talk about resending the Redevelopment plan um you know it's very disheartening when I see the agenda this morning especially I try to work with this Administration very Hands-On hand to um not have a fluid conversation and to see it and see that it's on this tonight's agenda um I encourage everyone to read the Redevelopment plan if you have not read it um you really should because a appealing it is actually horrible idea and detrimental to the downtown amending it would be a smart Avenue there's things in the Redevelopment plan that restrict things from the downtown such as drive-throughs so you can't put a McDonald's on Main Street I mean obviously with traffic study and stuff but you don't want to have that you want to have a downtown feel you also have restrictions in the Redevelopment plan on what building materials use and what colors buildings can you also can't put storage units on Water Street you resend it you're taking away all the small business and the added retail businesses that would be built and desirable for a small community and an eat work live and you're replacing it with offices I had one gentleman that called me today he's probably putting about a million dollars into a facade and wanted to change his office buildings into retail unfort Ely resending the Redevelopment plan he has now said that it's easier for him to put an office we don't want offices downtown we want people to shop visit and come here as a destination so I encourage you once again please read the Redevelopment plan so at least you understand what you're appealing repealing thank [Applause] you um I'm Bernard Graham can can you repeat that sir I'm sorry oh Bernard Graham 107 Truman Drive Brick New Jersey um and as I've stated that I live in Brick and I'm currently attending OCC which as you all are well aware that that resides here in Tom's River um Mr rodri uh you've actually been a topic of conversation a great many times in my philosophy and government classes uh and the reason why that is is because you are truly an interesting figure and I can tell you concretely that our Town Council meetings over in Brick are not handled in such a manner with such a and lack of professionalism particularly on your behalf it's truly a shame that one of the most significant roles in our municipal government is currently occupied by somebody that has the emotional maturity of a rebellious 14-year-old going through an identity crisis I don't think it's inappropriate for me to say that you Mr rodri have proven time and time and again that you are unfit to be in such a powerful position your demeanor is that of a pouty child and you have been setting a dangerous precedent for future Generations about what it is or what it takes to be a high ranking government representative public affairs under your watch are not handled with the grace compassion and impartiality as they ought to be instead under your Reign the People of Toms River are subject to emotional instabilities and inability to manage your compulsions imitation ISM and political retribution the reason why I'm here tonight is because I find it shameful that a person such as yourself was able to achieve and maintain such an impactful role and as a citizen of one of your neighboring towns I'm here tonight to lend Brick Township support and sympathies to the people of Tom's River in dealing with these political grievances clearly Mr rodri you did not get to where you are now on any form of meritocratic calculus and have not what it takes to be the community figurehead that Tom's River Tom's River desperately needs you to be to be the face and pride of their municipal government I implore you to self-reflect on your decisions and actions as while I have staunch criticisms about your leadership and character I do also believe that it is not impossible for you you to eventually mend your ways but as it stands now you are not fit to lead this town and I would advise that you resign your position to avoid causing any more damage while you search for your lost soul I want to thank the council Mr rodri and the people of Tom for Lending me their time thank [Applause] you I'm gonna move that because I need the desk Brian B2 Consulting Group so I'm going to start with your Township has apparently a records attention issue because a open request for animal anal shelter inspection reports came back with a response of No Such record exists except that is a statutory requirement and if you want to know where that record is it should be hanging inside of your current animal shelter facility since it's still registered as a animal shelter number two all the request was all resolutions issued by the governing body authorizing and appointing an invidual to act as Animal control officer the response was no such records exist therefore the township doesn't actually have a authorized Animal control officer in any capacity third one all shelter pound animal reports filed by the shelter for the last 10 years and submitted to the state again the response no such record exists luckily for me those records exist they are received from other governmental entities through requests so either the town is falsely providing or falsely withholding information from the public or you just don't know where anything is next item is emails that were received through opra request from Mr solanis Mr rodri Mr Pascarella and a Academy after this body tabled inde definitely the the authorization to have a Academy they're all here the funny part is on an email dated June 19th from Mr Pascarella to a Academy Mr Matthews and at the and former Chief little it says please see the attached memo regarding animal control services said M said memo is then fully redacted with the note that contains legal advice protected under attorning client privilege here's the issue is a Academy your client you're not going to answer me that's fine they're not therefore attorney client privilege is waved from your own attorneys Mr Coleman you've said it in previous other meetings that questions cannot be asked it must be statements the issue is your own rules of this body says they can be and I'll be back up Wonder council president Coleman I would just like to address uh Contracting issues or we could have Mr MCU and do so but essentially when something is under $444,000 a year uh you do not need a a a vote of council or a bid you're allowed to contract with any entity you want up to 44 um and there are certain stipulations Mr mcgucken could probably elaborate if he' care to yeah under the local public contracts law contracts of that nature are issued by the U qualified purchasing agent um and executed by the mayor that's what the statute provides for thank you sir so so in other words they're not coming to get me for a Academy not for that one okay all right okay ma'am uh Julie Adamec 69 Cedar Grove Road in Toms River uh just to um correct something that one of the it was said earlier I was at that last Board of Health meeting for the county and the uh it was stated specifically that if the renovations were going to be done they would take a minimum of 9 months to over a year it was a year possibly a little less or a little over a year so it's not going to be any uh 1 to three months like we've heard 3 to six months uh that's all bogus it's nine months to more than a year uh the other thing just to follow up on what I talked about at the last meeting is the day after the council meeting I got a phone call from the president of one of the local an animal rescue groups and they said to me they watched the V the council meeting the night before and they said exactly what you said Julie just happened to us today they had a resident come in asking to borrow a cage a trap to try to trap an animal so the residents are being forced to try to trap animals themselves because we have inadequate animal control in this town um I'm going to move on to another topic though um Hooper Avenue and the number of accidents that are happening we've had five accidents that I'm aware of and I'm sure there's many many more uh but three of those accidents happened in a quarter of a mile in less than a month two of them happened in one day and the following day one was a pedestrian that was W uh Crossing at ter Terrace Avenue on Hooper in the crosswalk and had a significant head injury when she got hit by a a truck um the this uh Hooper Avenue there's seems to be very little police presence there it just seems to me that there would Common Sense would be that uh if you have an accident you should have a place presence in that area not let these accidents just keep happening and happening and there needs to be public education going on with the public pedestrians with uh what side of the street to walk on bicyclists scooters eikers there needs to be a public education campaign and if you can't do that because I know that would be too simple to implement in town and I know that the way our current Administration operates they do everything opposite of common sense then you need to give the residents bright yellow uh vest at the Township's expense take it get rid of a firework or uh $4,000 in pumpkins for a festival and buy everyone of vest so that they can wear that when they're out on the road um and that's all I have to [Applause] say good evening no my name is Su p g 1946 Mount Juliano Lane I've lived in Tom's River now almost 30 years and I feel it's my home and I love it here but this current Administration is upsetting me I used to know these folks but I don't know them anymore I don't know them anymore they're completely different than the people that I thought thought they were I am voting for Zach Dy and I want to ma'am ma'am please address me not the audience please address me why because that's the policy I'm asking you to please address me please okay thank you okay this is this is part of the silliness but anyway okay so Zach Dary I'll say it again Zach Dy is my overwhelming choice for Tom's River Council I did my mail in voting and I will be a pole worker again happy to be doing my civic duty for my own town these two that I used to know I once believed were friends of mine now I have come to know both of them could not have been what they preferred and professed to be honest caring helpful reasonable people it makes me wonder as a nurse assessing a mental patient did they sustain a brain injury might they have a disease are they fit to serve both of them are or were union leaders and members and now they are behaving like dictators like dictators as American people we strongly abhor dictators these folks are spreading false information and lies against an ideal highly motivated educated experienced Hometown boy Zach Dy the man is a gift to this town and we need to put him on the council November 5th [Applause] this election cycle the level of attacks by these people against Zach Dy has been an unamerican at best this is oldtime nasty politics I never thought I would see this mayor is not a leader and does not know enough about governing the people sorry your time is up ma'am his behavior me your is is too often apping let people your time is up please you can get back in line and do another two minutes please I'm asking you please did you give someone else another minute all right you got one minute go as a retired registered nurse my life is Guided by science and rationale a fundamental reasons serving to account for my behavior and decisions making in critical care situations I have to make critical care so do you here over the years I have observed that these two changing their behavior to such an extent that I now consider them desperate power seeking storytellers this is how politicians get a bad name public officials take an oath and swear to uphold the Constitution competent leaders are self-motivated to follow the law and continue educating themselves on the powers and duties of elected officials Zach Dy has returned from higher education and a demonstrated desire to serve his hometown of Tom's River he is a highly accomplished person at his young age with his sights set on running for office your time is now over I gave you an minut please andur ma' that's enough sir officer would you please remove her ma'am you are [Applause] excused to get my purse go yes I will get out now she's not that's not respectful get out or get arrest get out get out where's yes sir John Green again 1011 Vall Road thank you for giving me the opportunity to come back up I appreciate that sir you have two minutes two minutes correct uh I'll go quick I already made reference to the amount of uh the proximity of that hotel to Westminster nursery school I made reference to the approximately 200 students that'll be walking on Walnut Street and Chestnut to Walnut Street Elementary School Toms High School North is also zoned as a walking School in that zoned area so you'll have potentially another 100 kids or more walking to High School North where individuals will be using Chestnut as well as Walnut Street to cut across giv access to the parkway as well as Route 9 um there's also the vocational school which is nearby uh which brings traffic and buses from 13 schools in Ocean County and now we're adding a hotel within those two streets which will be heavily trafficked it's important to point that also that there are several students with special needs in that area where there are specific bus stops um where individuals will be traveling and now a new hotel is going to be placed I'm not saying don't build a hotel I'm saying don't build it there it's not safe and it's just a it's not if it's it's when all right a child will get hit and killed we've had three pedestrians killed on Walnut Street already within the last year now we're going to be bringing a hotel right next to that street with over 100 rooms people coming from all over and utilizing that road and if you know with daylight savings kind of coming to an end it's going to be dark in the winter time and we got Walkers going up and down and they're children going down with three adults were recently killed it's only a matter of time when this happens that a child will be killed I respectfully request that this site where they want to build a hotel um a restaurant and a bar to be reviewed the plans be reviewed we will do we will do whatever we can thank you very much to help you folks I I had said that to Mr guchi um if there's anything we can do we will do it you know it's my understanding again that it was a a sign right they came for a VAR variance about the sign uh if there's something we can do we will we will try uh the liquor license that's an important thing because I do believe that's in question because it was never considered nurse Westminster Nursery School respect I understand that okay thank about Behavior rules imagine that a 22-year-old talking about behavior and a whole bunch of people in position of power right what we witnessed today is really a disgrace of the position you guys hold in power the sly comments the name calling the arguing as you said arguing solves nothing arguing solves a lot of problems in the right discourse right the egos need to be checked the arrogance needs to be checked you guys are here to get stuff done how you guys going to get stuff done if you guys constantly won't understand what each other each others are saying right the old adage leave your do leave your dirty lawn laundry in the laundry room don't bring it in public have your issues solve them in private come out here and get the job done I should not be coming up here and lecturing you guys about behavior issues you know it's funny Dan I actually worked in your campaign 2017 and I actually really disgusted in your behavior that I'm seeing as a mayor right that's something you should guys all take that into account I was for I was for youth you worked on my campaign in 2017 yeah really in your first campaign would you I canvased you canvased knock door I was 16 no kidding I I don't recall that but okay yeah that's okay but but anyway going back I don't I don't remember having much help knocking on doors I think John and I knocked on about 7,000 doors that year but but but anyway as I nice to meet you nice to meet nice to meet you again anyway but as I was saying the same thing the behavior you guys present your body language shows is terrible it's terrible I work in finance in New York I close a lot of big deals I get the behavior I get you guys have to have good behavior you guys are not showing that especially people you guys are supposed to serve as somebody mentioned earlier we elect you to serve us not the other way around you guys should not take your power in your position to really take reverse the roles here that's not how public office works if you think that you guys should really consider about stepping down take a hard look in the mirror reflect in your behavior and talk to yourself like what is my behavior doing and has am I affecting the which can be accessed on the New Jersey ethics commission website public perception is the paragraph it's in the code of conduct for the mayor also addresses the importance of maintaining public trust roles but a lot of times department heads I'm assuming have to be appointed right well actually so if this changes does that change that well there's a lot of positions in administration again that the mayor can just do and again we we as a courtesy we just look at them and kind of Nod and say we kind of concur but a lot of positions can be filled by Administration I don't know what position change that no I don't know if you're referring to confidential employees or actually division heads I don't think so but again I probably more of a legal question then there's there's different departments and there's people that run those departments yeah without any type of specifics I'm going to say I don't think A Change Is that just again I was told that the agenda meeting and then tonight I think it's been said um again it's more of a tit in housekeeping issue again it's keeping everything within a certain tent and that's how it was explained to me and when I read it that's how available to the public and use them for personal use which is what this letter was it was a political campaign letter so there was no base on if anything in this letter is true or not and she's referencing Personnel information that I'm assuming wouldn't be available to the public so if she is using these this information for personal use I don't think it's inappropriate and it sounds your real objective is and be the last meeting you gave all these numbers about past cost for the animal shelter and I respect that I think the numbers were correct but what you didn't talk and you didn't project for the future you didn't talk about salary increases you didn't talk about the fact that this the uh dog shelter was underst staffed and we had to have it locked they wouldn't do evening hours if we had appropriate staff including a veterinarian it would cost more money including salary increase but you never mentioned the future you know I remember when I bought gas year five years ago it wasn't what it is today so things change sir so your numbers really don't matter much it's the projected cost and the mayor projected that it would probably be up to a million dollars to run the shelter as it should have been run that's the point and again I still am curious why you're so adamant here when you might be able to do more service to your community wherever that is cuz you
