down in the well I'm sorry I thought I heard everybody say I yeah but you're supposed to say any opposed just keep him up you're welcome and then you say hearing n sorry what comination V uh at this point I'm going to ask um the mayor to make the presentation to The Honorable VI car uh they've known each other for a long time so I think that would be appropriate mayor we ask Mr Vic to come down here to Tom's over tonight because he's given a lifetime of service to our community he has started out as a teacher a principal a superintendent of schools ultimately was elected to the tombur township committee where he served I don't even know how many terms as both a committeeman and our mayor and ultimately as a Freeholder for Ocean County he spent his entire life uh dedicating service to our community and we just wanted to thank him for that and congratulate him for that and ask if he had anything he wanted to share good uh first of all I I just want to thank you for the great honor the mayor rodri and the council that that's over here today and a newly elected uh councilman elect uh Mr Burns uh for um being here but I'd like to do something else uh I started my political career right here in this room and I'll tell you where I came from a place called Jersey City up north Jersey okay and I'll tell you why we're everywhere as soon as I got out of college I taught one year in Jersey City I said to myself my wife and I said where is the best place to live to raise your family family and to retire and in the entire state of New Jersey I said it is Tom's River that's right and I taught my students one thing if you don't like something get involved and make a change when I was teaching in Brook Township they said to me Joe Mr fic why don't you get involved about a year later I said you know something I'm going to run for councel and unfortunately I don't know good or bad I won and I served you know five terms and um I had a little crazy I ran 38 elections and so far with the help of people in Tom's over I won each one but here's why I'm here today not only going to thank you for it it's a great place but I reminiscing I'm looking at my picture on the back there and I said do I look the same 45 years after I I survived so I think the proclamation is I survived with my wife Joyce 45 years when I first came in a little story my son Joey sat there 20 months old my daughter Dena sat over there four years old and my message is enjoy your family because they grow up so fast and I know what it is I know you're dedicated and there a lot of nights I came here to planing board meetings and different meetings and you take time from your families but I want to commend everyone that's elected official that's here today for what you do every single day because you take time for your family especially this time of the year is extremely important because Thanksgiving and Christmas and the holidays and everything else you can't relive that time so you know what we got involved it was when when everyone came up to me I was I felt really good we always listen as public officials but we try to make a difference and what I've learned when I first became a teacher uh the assistant superintendent was Warren Wolf he said Joe you know what you try to do try to make a difference every single day and you know Craig as a teacher in a vocational school and what we try to do is we try to make a difference and we help everybody no matter who you are we try to do our best we're not happy at all the time and you can't please everybody but the important thing is that Thomas river is the crown jewel of not only Ocean County it's the Crown Jewel of the state of New Jersey so I thank you for this great honor and this time again I think uh just be safe be happy be healthy and what we tell everyone the econom is very important we was I was talking to the mayor before and we started right there in this room to buy locally with the Chamber of Commerce that if you live in Tom's River spend your money in Tom's River go to restaurants in Tom's River help the local people and that's the strength of our community it's neighbor helping neighbor helping everybody helping together especially this time of year there's a lot of less fortunate but when you spend your money here I know it's easy I have Amazon come deliver to the door but remember the local businesses that are very very important so on behalf of my wife Joyce and my family and everyone else I would like to say thank you very much for this great honor it's something that's very important to me I've been honored by many of the 33 counties uh townships in Ocean County but this is the most important one thank you very much mayor thank you thank you so much and thank you for your service gentlemen this is going to go this is going to go with your 8,000 different proclamations Joe I'm not going to read it all you can uh you can go through it but uh congratulations Joe and thank you for coming and visiting with us today we're honored one two thank you very much my dad thank you council president I I believe I'd like an opportunity to speak on ordinance 7 and um ordinance 10 and I believe councilman lamb would like an opportunity to speak on ordinance 8 and and nine is that correct councilman I can hold my comments till the vote it's fine okay all right moving on ordinance number uh item number 7 is an ordinance of the township of Toms River Ocean County New Jersey amending and supplementing chapter 450 of the Township Code titled streets and sidewalks establishing a street excavation moratorium and curb to curb repaving requirement this is a first reading comments if you were to take a look at what the average tax bill Municipal tax bill is in Tom's rivver and you break it down by month it's about1 to $125 a month when you look at what you pay for your water bill it's $75 electric is twice that natural gas is 100 a qu on average these are averages they obviously fluctuate by months Cable phone all in these utility comp companies they're bringing in four to five times the amount of Revenue that times over Township brings in as a municipality in taxes and yet we go out and we pave a road like what we did in Gardens of Pleasant Plains and 6 months later a utility company comes along and puts holes throughout the entire Road uh because of poor planning or maybe because they just don't care um same thing goes with trenching roads they trench an entire Road and the trench just stays there what this ordinance does is as it requires if you cut open a road that is less than 5 years old the utility company has to pay to fix it and if you um patch a road you have to patch it by a certain distance curb to curb so it will result in getting an awful lot of our roads paved and the roads that we do pave they will want to know about our Paving plan in advance to plan for their infrastructure updates and I know one of the first things that someone might say is well what will that do to rates and the answer to that is absolutely nothing because rates are set regionally over many many towns and some towns towns that are Forward Thinking have ordinances like this and towns like ours take it on the chin and have our roads ripped up and poorly repaired so I asked for our Township engineer John mey to draft along with the legal team an ordinance that mimic certain other ordinances that will ensure from now on when our roads are ripped up they are repaired properly and and that when they tear up a road that is new that is totally and completely repaved thank you anyone else on ordinance 7 okay okay can we have a motion move seven motion was made by councilman lamb second in by councilman lman councilman lamb yes councilman lman yes councilman josi um this is a great idea thank you and I could give a perfect example what Mr rodri's talking about we waited so long to get Washington Street paid by the county and they did a beautiful job on that and then with in 3 to four months we have so many uh openings in the in that beautiful Street it it was um it was sad to see and it was actually one big one right down here uh by the traffic light downtown so uh it's a great idea and um I vote Yes councilman Iverson I vote Yes councilman quinis uh before I vote I just want to say that uh uh again today we suffer from lack of information in a timely manner we got our agendas today I believe it was 12:35 today uh and some of the couple couple of the items on there changed even after that um in regards to this particular ordinance um G of pleasant planes is there a unique situation I mean I'm glad you pointed it out but it's a unique situation covid is the one that messed up the paving schedule and the utility schedule in that particular Community one one company had to keep its own timeline and the other one had covid restrictions that uh uh that forced them to work after the paving was done but it is a good idea that we that we uh keep our roads in good shape it saves our vehicles wear and tear our personal vehicles it saves our fire equipment and police equipment uh lots of uh wear and tear it's the route N9 right now I know there're still working on it and I think they're supposed to be done sometime early 2025 is beating the hell out of just about everything so overall I think the ordinance is a great idea wish I had more time to learn about it and see how it may in fact impact us uh from our utility bills in the future cuz listen nothing's free but I'll vote Yes to this one Council vice president OU I'm going to vote Yes of course because we have a problem in Holiday City for a number of years on newly paved streets with Kylie who digs up the streets for the gas lines and puts them in and instead of waiting uh reasonable amount of time for the uh holes that they dig to sink down to what they're supposed to be and then they H Pay pave them they don't they hot pave them right away and they sink and we have poth holes you could bury the front end of your car in so I am definitely for this because it'll save a lot of angst and aggravation in our community and council president Coleman yes moving on to item number eight is an ordinance of the township Council of the township of Toms River Ocean County New Jersey amending and supplementing section 477 -79 section 21 speed limits of chapter 477 vehicles and traffic of the Township Code reducing speed limit on Bay Boulevard for the entire length from 35 mph to 30 mph to promote enhanced vehicular and pedestrian safety discussion I make who eight okay we have a motion by councilman Lan second motion was made by councilman lman second in by councilman lamb I believe councilman lman yes councilman lamb just want like to thank the legal department and the administration for getting us on the agenda tonight this goes back to almost two years the ortley beach F and taxpayers Association were looking to reduce speeds that's a County Road um the county did their study they um agreed to lower it the township agreed and and thankfully we got it on the agenda for tonight um so I vote Yes Council M Coy yes yes councilman ion yes councilman quinis again having just got the agenda this afternoon I haven't had time to talk to the police department to see if they did if Tom's River Police Department did their traffic study on this and they agree with the assessment or not uh thank you um but if if they did and then I have no problem uh voting yes for this one Council vice president OU yes council president Coleman yes item number nine is an ordinance of the township Council the township of Tom's River Ocean County New Jersey amending and supplementing section 477-6427 vehicles and traffic of the code of Township of Toms River Ocean County New Jersey like to move nine please second motion was made by councilman lamb second and by councilman quinis councilman lamb I'd like to thank councilman quinis um for seconding this motion this motion is important because again I spoke with the legal department I put my request in uh far beyond the rule is usually the Friday prior to the meeting at by 12:00 it's under rule 5'8 if you have any uh needs for your re Jim or David I spoke to David about two hours ago I explained that if you have any um ordinances or issues you want to bring up you know bring them up to the clerk prior to to the you know the Friday before 12:00 and we'll certainly get together and come up with resolution so I want to thank you councilman quinis for supporting it uh my vote Yes councilman quinis yes councilman Sosi yes councilman lman yes councilman Iverson yes Council vice president OU yes council president Coleman yes moving on to item number 10 it is a final reading ordinance of the township Council the township of Toms River Ocean County New Jersey amending and supplementing the township code to one established divisions of Community Development Health and Human Services Recreation and Parks buildings and grounds under chapter 40 of the Township Code Department of administration two repeal chapter 48 Department of Community Development in its entirety three repeal chapter 46 Department of Human Services is in its entirety for repeal chapter 56 Department of recreation in its entirety and repeal 23- 1 a 3 and 7 of the Township Code motion 10 please uh I was wondering before you vote if I can have a moment uh is that all right council president go ahead so there's been some discussion about this and I think there was um uh contined discussion during the meeting we talked about this ordinance um at our not this agenda meeting but the agenda meeting prior to that it was with uh councilman quinis was President I believe and so was councilman uh nerson we talked about this ordinance and Jim uh we also talked about the other two ordinances that you uh had said you weren't made aware of we've been talking about for a while I just want to clarify some things regarding ordinance 10 and why certain departments should be classified as divisions currently we have the division of roads with well over 50 employees and it's a division and it's headed by a division leader then we have like the department of senior services with four employees listed higher up than the division of Roads as a department it doesn't make sense to have one thing categorized as a department with four employees in it and something else categorizes lower than that as a division with 50 employees the same thing can be said about sanitation and the department of recreation sanitation has one of the largest workforces in the town it's listed as a division a division under Administration while the other department that we just mentioned um is a department and it has four employees at wreck I know it it swells in the summer with some part-time employees but it never gets anywhere near the size of the division of Sanitation so our nomenclature for these departments and divisions there's it's it's conflicting it doesn't make sense uh also everyone ultimately division heads department heads both automatically report to the ba via statute so this doesn't change who anyone reports to all it does is make everything consistent and it leaves behind as department heads the only people that are department heads by State Statute so there are department heads that are State Statute mandated by State Statute the clerk State Statute the ba the um tax assessor um the court administrator there are various department heads tax collector tax assessor uh the construction official they have terms the CFO they are statutory they're required by Statute and listed as department heads and they are what are supposed to be department heads but anybody that reports directly to the ba that can answer to the ba for us to call them a department head in some cases and in other cases where it's a larger group of employees to call them divisions and to list them lower than just doesn't make sense and we have to make sure this is all correct and there have been I'm here for seven years there have been a lot of changes along the way for reasons that are frankly unknown to me but this should all make sense and all uh you know support what what we see in State Statute with respect to department heads so that's what this ordinance does does uh as I said I know there was a lot of talk about this we discussed this at uh a prior uh meeting uh and also at a prior agenda meeting I just wanted to clarify it again for the folks on Council and for anybody who came in here today um to to uh to talk about that thank you okay at this point if there's anybody from the community would like to um speak to this ordinance please come forward and come to the microphone come up I'm going backwards my name is Linda and Miranda crunk I live at 126 oakill drive and I'm going to go backwards on you well this is only an opportunity to I know but it's about the the road about the speeding well there's going to be a will there be okay at the end because it's about the oakill dve yeah you have you have time to talk about that that's right the bumps we need there Halloween 50,000 kids almost got killed on my block right down yeah yeah we will you will have an opportunity anybody else would like to speak to this ordinance from the community okay hearing none then I'd like to turn it over to the council any other Council like to speak to this ordinance Jim sorry uh although I appreciate uh Mr rodri's comments tonight um all the learning I did on this without the advice of legal counsel of course um paints this in a different picture um I believe it's a consolidation of power under the control of the mayor and by extension to business agent or vice versa and and it has it uh the overtures to um sorry I can't read my own notes uh undermine the authority of this legislative Council it's taking away some of the power from this Council to to make decisions on different uh positions in town and it it makes this so that too much power is at the top and not enough control or span of control is available at the lower levels some of the changes sound like they'd be a great idea uh but overall I have to say no to this ordinance this is uh this is not uh not as simple as housekeeping it sounds more like something else to me I know we didn't anyone else okay then let's move ahead with the vote please and as when you're I'm sorry someone's got to make a motion motion right motion motion was made by this kind of uh government it's uh there's no oversight and it's a complete power grab so I vote no no councilman lman yes councilman Iverson no councilman quinlisk no council president Coleman yes council president could I just have one second to respond to the power grab comment just to be clar to clarify go ahead so in the fauler form of government the ba is always in charge we're not grabbing any power and the ba is in charge of all departments hiring firing the council for certain things gets to advise and consent on the hire but even if they advise no it's within the power of the administration to hire anyway but they'd have to like reappoint every 90 days so this is not a power GB the administrator in this form of government as you may know or may not know has those Powers anyway it was not about power it's all about making our table of organization make sense because there have been so many changes over the years by every new Administration that comes in and it just doesn't make sense for a department to have four employees and a lower level division not under that department to have 50 employees just doesn't make sense it looks silly and um it's a problem and that needed to be fixed thank you all right moving on to item number 11 is a separate resolution of the township Council the township of Toms River Ocean County New Jersey authorizing the governing body discussion of the 2024 best practices inventory any discussion okay um so Mr solanus the Department of Community Affairs puts out these best practices every year uh to each municipality and if you meet the necessary percentage of best practices then your state aid is not reduced we met the requisite number and have ensured that we meet the best practices set by the state of New Jersey just wanted to explain it real quick thank you anyone else okay vote motion motion was made by councilman lman second seconded by councilman lamb councilman lman yes councilman lamb yes councilman Sosi yes councilman Iverson yes councilman quinlisk uh unfortunately like I said earlier I got the agenda sometime after 12:30 this afternoon um I received uh something about this from our uh CFO uh another 24-page document I have haven't had a chance to review and understand it I reached out to her this afternoon and she said her you know she had a problem with her phone so she wasn't able to get back to me so I'd like an opportunity to review this and I think everybody should have an opportunity to review it before we make a decision on it so for that reason I'm going to have to say no at this time Council vice president yes council president colan yes doesn't matter I think you missed the councilman did we miss somebody or it's think yeah he voted okay okay moving on to the consent agenda all matters listed under the item consent agenda will be enacted by one Motion in the form listed below there will be no separate discussion of these items if discussion is desired on this is the um uh the repairs to the parking garage and after two or three revisions to the re uh to the bid specification that didn't actually change the bid specification we miraculously got a bid almost $200,000 less 300,000 I said 200 Less almost $200,000 less than the original bid and then if you do further review on it it's because we removed a lot of the line items so therefore it's not really following the bid SPC that and if I did my reading correctly that means that we're going to bid this out uh we're going to Ward this for $300,000 but by the time they head in back back in the line items it's going to cause delay and it's going to add expense to it and we'll probably wind up being over the initial bid nonsense you can call it nonsense but you had you bided out twice and you had competitive bids twice and then you changed something no we didn't have competitive bids the first time it was one person and you bid it for two weeks and one person came in at nearly 600,000 and then we bid it out again and we got much lower bids however the lower bids there was a I'm curious I'm curious how are you going to do a $500,000 job for 300,000 why you're saying it's a $500,000 job because you put it out for two weeks and only one person responded I said it wasn't a $500,000 job then it's come back lower and you're upset about it is it the same what line items did you remove and why the the engineer our engineer that you voted for went through it and looked at the unnecessary line items took care of those but even when we rebid it competitively for 45 days with those other line items it still came back $160 $175,000 less but I I forget exactly what the reason was that it had to be rebid again the third time but it was no fault of our own and it was rebid so now it was rebid again and lo and behold after we took a closer look at it and certain items as whether they were necessary or not an engineer did that they changed it and and we saved like another 100,000 so you're talking about $300,000 to do what you were oh my God going on news Channel 12 I think you guys were on news Channel 12 about how badly you wanted this done now we save 250 $260,000 and you're upset I'm so lost again again you pretend to be Republican but you're really a liberal far-left Democrat spend happppy far-left liberal Democrat who endorsed a Democrat at the last during the last election all right let's let's move on with the uh vote Jim your vote well I'm still not done with it because I was interrupted of course by I'm sorry go ahead Jim um there were things obviously that are not going to be taken care of by this $300,000 bid there is no doubt in my mind uh I still don't know who the original painting contractor that was awarded the original bid I'm always happy to save money but I'm not happy Happ to cut corners and lose something and then be build for it later on sure fooled me okay can are you finished you're just incredible Jim motion I please again so motion was made by counc then here's the other problem with this particular ordinance is I didn't have any time to do any homework to do an exact line item comparison to see what's going on because not only did I get the original agenda after 12 today this one showed up after 3:30 with this particular line item on it so it's impossible for me or any other member of this Council to do their homework on this thing so before you before uh Dan wants to continue to uh uh vilify me for not wanting to save money get the facts okay can we V please we you don't even have a motion yet pay ATT V one motion no second I think ation motion was made by councilman lamb second I'll second by councilman lman councilman lamb well I have the opportunity to speak to our Township engineer um to go over this um this was a complete Savings of nearly $300,000 um my vote Yes councilman lman um I was at the meeting with the engineer as well and we've had many discussions him and I about this contract and absolutely he's consent he's absolutely convinced that this is the good number and the only thing that would happen is if something grows in the contract and that would be something would be an extra but the items are all covered under a lumpsum contract so yes councilman Sosi it's always good to save money but um what did the councilman say we spoke extras we spoke no what did he just say extras if there's extras it's going to be extra money we about this remember Dave we spoke no no we did not we did we did not take a second to explain what I meant by extras okay extras all contracts have 20% this material is um pneumatically applied mortar on top of a a concrete base with rebar in it when you start to move that mortar to square it up so you can do a patch on it it's possible that more of that mortar will separate because it's been out long and other contract had the 20% potential for extras as well every contract you ever do correct Mr mcgucken there's a 20% built-in overage in every contract we won't even have to get into that if it doesn't go any higher than what it is right there right but the other one would have been 130,000 and over care of everything how do you guys wait wait excuse me council president I would really like a moment of the I'm just going to vote no so when it's over I would like a vote a moment on of the floor councilman Iverson if it'll make our garage safer for those who've seen it it really looks scary and dangerous I vote Yes get it done it's been too long councilman Quinn LK I'm not sure how I bid on something I don't know enough about I mean I'm sorry I'm not sure how I vote on something I don't know much about uh I'm I'm real happy that that uh Justin got a chance to review all this before before it got slammed on the agenda tonight or even today like this is ridiculous we've had meetings in the past a week in advance where agenda items would be discussed and we'd have chance to ask the professionals what's going on with these things so because I can't get my research and I can't even get the agenda in a timely fashion I have to vote no until I can do the research anybody in good conscious has to vote no council vice president OU yes council president Coleman yes council president may I have another minute of course go ahead mayor thank you so the first time this was bid as I said it was bid for a two- we period of time it was done in December before the administration when they were on the way out the door only one company responded then uh when it when it became known that I was uh skeptical about how expensive that was folks went on news Channel 12 and tried to pressure me into awarding it to this Soul bidder that was there for that when we bid it for two weeks we rebid the project for I believe the maximum amount of time allowable and we got back several bids and they all came back with much lower prices there was an issue with the specs and with something else I don't remember the specific I wanted to award we weren't allowed to award and we had to rebid it again and lo and behold it came back even lower Jim uh respectfully and I mean this with the utmost respect you and I are not engineers and you know whether you had extra time or not to review it you're not an engineer and you have no idea what you're looking at and this is and neither do I and that's why we pay these folks and are forced to pay these folks frankly a lot more money than any of us here make uh they are the experts when you wanted me to award to this other person we didn't have a full-time engineer on staff at the time you know so there's no reason and I I made this statement before to you I don't understand why you are so upset about this company not getting it do you have any relationship with the company that was originally awarded it can you please restate your accusation no it wasn't an accusation it was a question do you have a relationship your accusation it was a question do you have a relationship with that company do you have a relationship with the company that was awarded the contract initially that you wanted awarded a contract you're hesitating do you have a relationship have some reason to believe I do it's a question why are you answering with a question have a relationship with the current person winning winning this bid no very quick my response is very quick no do you have a relationship I'm trying to understand how you do you have a relig you won't answer the question you won't answer the question I have nothing for the council president thank you so much he won't answer the question because I'm not and you're making an ACC my person I want to move on with a vote sir please move on with a vote we moved we moved on we're now on resolution L okay thank you slanderous that's the word I was looking for thank you a question you won't answer time out you won't answer you are the one making an accus give me I'm going to listen I'm going to tell listen I'm going to tell you right now I'm not going back in the paper for being losing control of a meeting again this is nonsense all right that and folks if you open your mouth I have four patrolman here I've given them permission to immediately remove people that disrupt this meeting did everyone see that tonight four extra police officers yes did you notice and so if you're going to be out of line here where we bought up the abandoned Boat Works we haven't seen any uh follow-up documentation for the um environmental study uh I don't think the town should be purchasing this in any manner because this is a rable piece of property that we just took off the tax roll uh it's an environmental concern and uh we probably paid at least 6 or $ 700,000 more PS I do not know that guy either so I vote no we're not a minimum of $500,000 minimum the minimum we had an appraisal done okay and and we're buying a piece of property that we don't know which I don't know what we're doing with so I vote no council president before the next vote is cast can I just clarify before anyone else votes some inconsistencies and and and things that were said that were just completely incorrect first I'd like to say that the appraisal was not the appraisal just for the property it was the appraisal of the property and then what the property would be worth with the buildings down so the appraisal if you read it if you took the time had two two sets of appraised numbers they to save the town a tremendous amount of money are going to demolish it when we purchased the hotel downtown we purchased it and it wasn't demolished and the town then had to have it demolished and I believe it wound up costing us a million dollars because it cost the town so much more money to do work than it does for a private entity to do work so they're having it demoed and we're buying it for that value because if we bought it for the other value and demoed it ourself we'd get stuck with a massive massive Bel and as far as the uh contract it was just said that the property has been available for years that is completely incorrect the property was under contract by capid dagley the company that there was a Redevelopment agreement with to build 10 story two 10 story buildings and I know that it was scaled down to six however it was most certainly under contract by a developer and we had a great opportunity and I believe a good portion of the council supported it and I just asked that the council again support it it'll make a beautiful Pier it'll make a great extension to the park downtown and um that's all I have I believe you still have some votes out outstanding yes councilman lman yes abstain uh councilman Iverson I I abstain councilman quinis no and Council vice president OU yes the last one was S I believe resolution s discussion I brought that one up again uh it's another one that was not on the 12:30 agenda that I received uh it was on the 3:30 agenda that I found on the November certain line items wind up dwindling down certain line items have money left over in them a great example of that we just had a 1-hour meeting with the head of the ice rink where they ran out of money because their electric bill doubled to $40,000 a month as a result of these utility companies another perfect reason why we should be um having the utility companies cover the cost of our roads when they rip them up they bring in a tremendous amount of money and here our ice rinks went went up to $40,000 a month for electricity so these are the kind of things that occur which is why line items have to be moved around you budget for a certain amount of utility costs and if you exceed it you got to move money there if some other department runs out of money similarly there were robberies in Toms River this year so the for example the police department line item for overtime exceeded overtime I mean there were there are a number of different things that occur um and you always have the ability to reach out to the CFO in an email thank you very much council president um that's all I have thank you next moving on to the reports move the reports motion was made by it was ridiculous at least the young guy I don't agree with with uh his his party locally we do statewise and other but he has the courage to stick with his guns who he was but you and you'll never be a sellout because you put all your signs all over town everything you spent all your personal money your picture is going to go out on the hallway at the town's expense but the other people spend their money on their campaign and everything else so congratulations and you know who else is a lifelong Democrat and all the money is going to Democrats throughout New Jersey wake up people wake up of it don't know what you're getting out of it Craig that's an that's an anomaly right there but anyway on a brighter note this Saturday we're having a fundraiser for oceans of Love at Silverton Farms I guess maybe that's the special interest anyway all proceeds go to children with cancer food music name your price flea market all donations thank you council president I do have one more thing that I must finish so if everyone recalls back in January day one on the reorg I said the council and the mayor are getting a 50% raise by only having one meeting a night okay and Mr nerson he didn't even know that he was going to get a check so I have my bill here and I I net 228 um every two weeks I think all right so so before the uh in January I got 228 uh every two weeks then within one week of the new Administration my take-home pay went up to 247 so that's 1879 it went up I didn't notice it at first because it comes in uh email so I I never noticed that so that's $977 and7 uh8 to me extra a year so I'm trying to figure out for example so I do get medical insurance it's all deducted from here and I'm extremely grateful for it um so far I don't have to use it thank God but then but I'm only one person on this okay only one one person so follow me so I was thinking if somebody was making 75 or $80,000 a year how much would they get in deductions okay how much would they save $111,000 can we move on no no I can't move on so who impr approved this medical pay raise Council certainly didn't do it does it Tom's River help uh the employee e get it I don't think so I think it was only the mayor and Council that got this increase within one week the first week taken over so who approved it who authorized it where did it come from magic magic nobody knows and that's not the only thing that's going on in this town all right I'm going to cut you off Dave you've had plenty of time thank you all right thank you Pres uh councilman lman I'll say uh congratulations to Bill 8,000 votes versus two on the other side I would say that probably it's not going to be a sweet time sitting up here because if you vote your conscience you get beat up if you don't vote your conscience you become somebody else you have to scream and yell at everything I wish you a lot of luck I mean you're filling my seat so I kind of feel bad for you in a way but congratulations and I wish you the best of luck there is Council quinley uh Mr Burns I I repeat him I feel real bad for you you have no idea the the storm you're stepping into I hope you're prepared for it and strong enough to handle this because the amount of of chaos the amount of deception the amount of hidden agendas uh it's uh it's very hard to manage all this to and be honest and be a good person uh this is uh he this Administration has no interest in what you guys have to say they have no interest in giving you the information you need tonight is a prime example of that with everybody getting this agenda so late with the changes to the agenda with the meetings that go on that nobody knows about I would have loved to been part of the parking garage uh conversations that apparently happened over the last couple of months but uh there was never an invite and I didn't even well um so there's a lot of negative things going on here um since this Council took office the January 1st they said that they were going to go to one meeting a month and move it later and I've said this before so that more people can come to these meetings more people can get involved and more people can be heard ever since that meeting less people have been allowed to get involved and L and fewer people get fewer time to uh actually Express their opinion or bring up issues that uh that they have a problem with the town Mr Coleman your problem is not trying to keep these people in order your problem is you can't keep the mayor in order these people these people are the taxpaying residents of Toms River that put us in these seats and they have a right to be heard restricting the amount of time they have to take uh they have to to to voice their opinions or ask a question of this Administration and then constantly be erupted interrupted by Mr rodri it's going to wear on everybody it's going to make the tensions High and then this is leading to this Administration using our fine Police Department as your own personal brown shirts this is ridiculous four officers because your mayor is out of control because you can't y because you can't manage to keep him tame these people need to be heard they are trying to tell you something and no one wants to listen you call them well not you they've been called the peanut gallery and other things that that Dem mean what their their their Community activism here this is ridiculous this is not how a meeting is to be run this is not how government is to be run Mr Burns again congratulations please understand what it is I just said Thank You Happy Thanksgiving too by the way councilman lamb well first I want to thank uh councilman Sosi we spoke earlier and we had a good conversation on the phone and I um I really uh I found it I found interesting that we have a lot in common and um sometimes what separates us is not the um maybe not the exact wording of ordinances or exact wording of resolutions but maybe just maybe delivery and you know maybe that's again I I could do my part and call you ahead of time and we could talk it out and I'm going to do that from now on let me finish Dave I'm this is from the heart here to you I I think again you care about the town and I think you do too Jim I think you really do care about you know what you believe in even though I might not agree with it at times what I can say though David I was surprised I find it insulting to um to go on that diet tribe about U Mr burn I want to congratulate Mr burn for a hard fought election Mr dockerty I give him I want to also thank him for stepping out the spotlight it's certainly not easy putting yourself out there and running for public office whether you're Democrat Republican or independent it's certainly um you put all out there so I give Mr Dockery credit as well it's not easy to do um but you know when when there is when there is a winner David and we have a winner you give some respect and and you respect the man that won the voters felt that he was the best choice so I want to congratulate Mr burn on a successful um race and again your work up here is is your work and and no matter what is set up here you have to ultimately vote the way you feel that your voters want you and need you to be standing up for a community and that might not be popular at times and you have to live with that so David I I would just say in the future you know and and future races or future issues come up try to give some respect to those that you know that do win and you don't have to insult the man the man's here he wants to be here he's been here for months and I want to congratulate you again Mr burn for your hardfought win um otherwise I I really want to talk about what Jim said but I I don't know where to go with it it's always that it's all about Ralphie it's all about fighting for nothing we need to put that in the schoolyard I came down here after that in 1989 because this was Christmas land to me I called this the magical Toms River of my dreams I love this town I don't want this fighting in here I agree with all Mr chosi all of you you're all here to be our parents this is supposed to be where everybody wants to come when they're on the parkway driving down to Tom's River they think about what we do down here we want to come here we want to be in the place where we love where all the events happen where all the kids you can be kids here so what are we fighting about why can't we just get along my husband died and I died too I went three weeks ago I died went to heaven to visit him he sent me back here I did I died for 15 minutes and he said all the people that loved you want you back I want all of you to get along keep the schoolyard fight out there just can't we do that here why why can't we do it here I want to be here I know all of you personally we're not bullies this is not supposed to be bully land all these people behind me want to get their turn all I want it to be is the town that I love and I want to be in and I want to stay I don't want to leave and Mr rodri promised me seven years ago he was my neighbor around the corner that he would make me proud of him this is what I wanted to tell him tonight then make me proud I have ch sons that is an officer I mean I love myce police department and if it wasn't for them that night with the squad I would have been dead so my police are the loves of my life you all are so can we just get along that's all I want to know that's all I have to say you it's on your conscience tonight when you look in the mirror when you're built on Hooper Avenue near the intersection of Walnut Street I sent an email to to the mayor and the council and I'm not I sent this on November 1st I'm not sure if you all got it if it's permissible with the meeting I made photo copies of it and i' like to present it to all of these folks here that's fine sir you just hand it to the clerk he'll get distributed okay thanks thank you thank you in my remaining time I'd just like to read some excerpts of it basically we think that that process that that hotel got to today we think there was irregularities in the whole process this goes back to 2009 and from what we're able to find out it seems like in 2019 there was a planning board meeting and they approved that design now move move a little closer to the mic just a little bit thank you okay got to turn this up take the mic out PR yeah all right in in 2019 it was approved by the planning board there was that first design the larger design and then last month October 2024 the newer design was approved and we feel there should have been a public Hearing in between those two because the changes in the design were significant the building got bigger the amount of uh impervious Service uh surface increased the building design changed the most egregious thing that we the residents of vhall Road find offensive is the 2019 design had no windows on the west side of the building that's the side that faces the residents of oxol Road the 2024 design which was just approved has at least 26 windows on the west side of the building which look into our backyards and we think since those two design changes are significant we felt there should have been another public Hearing in there so in summary I'd like just like to say and I say it in this email I think the the whole process should be reviewed because we just feel that there was irregularities how this thing can carry on from 2009 to 2024 with all the approvals in place and the last thing I say about this and I said before and I think Mr mcgucken disagreed with me the um traffic and Environmental Studies are from 2009 15 years ago how could they still be good I think if this project is to proceed we should have another environmental and traffic study because conditions have changed quite a bit in Tom's River since then that's it thank you um Mr council president could I just respond to that go ahead um Mr glui um what I said said last week I agree that that's when the traffic studies were done um my understanding was that the last application last hearing before the board related to a sign variants and as a result the board would not be required nor could they be compel the developer to provide more testimony with respect to traffic as a result of the application that was before the board this year so I agree with you the the studies are old and if they had come in for a new application the board probably would have required that but all they were seeking was the sign variant and under the municipal Landes law they could not require a traffic study for a sign variant that that's what I meant to say if I wasn't clear that's what I said then all right and by the way we are still looking at it we haven't reached a final concl inclusion um but we are still looking at it yes ma'am good evening uh I'm Maria mcgallen 1015 Vox Hall Road uh I'm once again standing with Mr guchi to implore you to please help us um we can't believe that there is no expiration date on a variance um when I look at statutes I look at the ordinances it appears as though there is a 12month uh expiration date um you're shaking your head no um so New Jersey statutes appear to say there's a 12mon expiration date so we're questioning why this just goes on infinitum and there's nothing that can be done um legally to stop something that is now five and a half years old um Bob said from 2009 I'm saying from the 2019 last time that we got to actually Express anything with regard to this um this nightmare in our in our backyards um I this was also this was a site plan though in addition to a there this was a site plan where they approved several variances but but um there's no expiration on it though that's the that's the issue ma'am and what Mr McGuckin was just uh alluding to was it came before the planning board merely for a variance for a a sign height so I understand there's no Nexus between a variance for a uh sin height and a uh and a traffic study so that's the issue I understand all the different moving parts to this at least as you explaining them what I'm saying is that it's very disheartening to think that there's nothing that's protecting residents from something that some former Administration does five or six years ago that this man then just gets to do whenever the spirit moves him and the whims get to him and financially he's ready to put shovels in the ground again and ruin our lives so I'm imploring you and begging you from the bottom of my soul to please find a way you've managed to do something downtown there's got to be an angle there's got to be something I said the last time that I was here even talking to them about relocation I also have sent this around I gave this I gave uh all the copies to the planning board I spent $100 of our own money to make copies at Staples to do this I don't know if it was ever read but I brought the last copy this is the uh petition that 62 families in our neighborhood signed to let you all know that we are adamantly behem opposed to this and we are begging you to listen to us as residents of this town not some businessman man who has a wonderful deep pocketed attorney that can spend all the money and find all the angles we are just everyday folks and we're asking the administration is looking at it and if there's anything that could be done they'll they'll certainly try to assist you um but this was a a prior Administration and a prior planning board folks who might not even be in the town anymore that approved this many years ago we get so if there's anything that could be done they'll they'll assist you folks we get that I'm telling you that there are many people who stand in opposition to this we've also asked for the opportunity and I was invited by a councilman to come here tonight in the off chance that we got to speak with the mayor I'm still requesting that opportunity I'm requesting that opportunity to speak with you all about what else we can do if there's nothing that can be done with this thing going up then what else can we do to mitigate it we can look into having a meeting okay but so so I'm gonna give you your time your time sorry you can get you can get back in line for he talked over my time and so did Mr mcgucken please give me another 15 seconds Sir you know here's the problem I'll give you 15 seconds and the next person will say well you gave her 15 seconds but other people talk go ahead go you spoke to me I'll speak to you're saying we can look into please can look get into I'm asking you here tonight for some kind of a commitment that I will hear from from someone you have you spoke to me on the phone at length and you spoke to me last week I'll certainly the mayor wasn't had a a procedure couldn't stay but he'll certainly I'll I'll work at a meeting to meet with you guys okay no problem clear yes ma'am hi an doine 9 St Lawrence Avenue one of the most productive Council meetings we had to date was the one where the mayor left during public comment so this one might go that way too council president Coleman perhaps the mayor should leave during public comments so that the citizens can speak to you without constant interruptions and disrespectful comments that Force these meetings to become out of control I've been removed from two meetings simply for asking you why he is allowed to call out people's personal business and speak out of turn others have been removed for pointing out time limits on comments applying to everyone except the mayor you also have a record of picking and choosing which citizens are allowed more than 3 minutes I believe all of these actions are in violation of the open public meetings act let's pay attention and remove who really needs to be removed and I'd just like to add we will never ever get past the way you disregarded the homeless population in Tom's River closed down the Cod blue shelter in Riverwood Park and now would be forcing them out of the wood wooded areas a week before Thanksgiving and the animal shelter has been closed since June 6th there are absolutely no plans for a shared service agreement between Ocean County and Tom's River just one more lie at the expense of the animals the mayor has no heart and soul as I was being removed from the last meeting Mr Coleman said you're so pleasant to me well I must tell you I was always very pleasant and somehow I've allowed people like you up here to bring out a side of me that I didn't even know existed well that will not be happening anymore because none of you are worth it I hope you all have a wonderful Thanksgiving and while you count your blessings you are able to reflect on all the awful things you did to destroy this so many people this year yes ma'am hi uh my name is Virginia winck Ash Way and Tom's River um I just wrote what I had to say down it's so much easier um I would like to ask the council collectively to come together and take a hard look at how current rental seal policies are making it more enticing for investors to come into our local neighborhoods price out families to purchase a home to then turn around and have it become a glorified boarding house and how you can and how you can get ahead of it before it becomes more of a widespread issue you have repeatedly said you were against Lakewood style development I feel this issue falls under that as this is a widespread well-known own out of control problem in Lakewood don't you want to do your very best in making sure that doesn't happen here isn't that what you're elected for see if you can come together and figure out how to get ahead of the issue instead of waiting until it's too late right now the policies regarding rental cosos do not benefit homeowners in the neighborhoods and the quality of life there where these slum Lords invest in because they treat the homes like apartment buildings in the middle of a city you all including the mayor need to do better than what is in place now or else it just looks like the town is rolling out the welcome mat for these slim Lords instead of enticing more people to buy homes here to raise their families um I also remembered the earlier this year that you had spoken about that about maybe getting a commit I don't know how it works with you have a leaz on our committee to look into doing something about that or looking into the policies and seeing if there's anything that could be done to be tougher like make it hard for these people to to want to come in and do this council president I don't want to take time from from her but this is a huge problem in Tom's River now and I know personally I I live off Brookside up on Ocean View beautiful neighborhood original but it's rooming houses now we got eight nine dozen cars all single men living in600 700,000 homes there's more that problems like that in your neighborhood yes okay and when did that start may I ask it's been a couple of years and it's been rounds of getting people booted out and then the next round of people come in so they're kind of you know the code enforcement could come in they're limited on what they can do cfor used to do that there's more time than ever for code enforcement to respond to complaints we encourage residents to make compl every time hold on every time I've called they sound exasperated because they're short staffed and it takes a while so much they don't have the continued that's going on in Tom's River now they don't have the continued use and occupancy uh for resales anymore so they should have plenty of time to report to complaints well that has nothing to do with what I'm asking here I'm asking you guys to get together to address to see if there's something that you can do because the mayor isn't the end all to all this you guys can you guys can have a hand in helping this along making it tougher that you guys right now are making it more inviting by Lessing regulations and rules whatever the policies are for these rental cosos you're making it very easy the mayor's making it easy whatever the policies are make it tougher if you have a complaint and address why don't you come to the meeting and provide those addresses we'll certainly handle I can tell you that I spoke spoke to the prosecutor and and our calendars are full with I brought several properties to the code enforcement and they have complaints issued and they're at court so if you have those addresses provide them I'll stay after the meeting give me those addresses tonight David if you have an address if you see something say something give it to me and we'll certainly get to the code enforcement get well I'm kind ofing thank you every every house every house is inspected that requires a CO any rental is inspected thoroughly inspected but what it sounds like is that there's less for these home for these investors to do that there's no upkeep to the outside they they don't because what's happening is they're just getting their money they're filling these homes up with people that aren't even in this country legally so they don't speak English you can't communicate with them hopefully CH hopefully that's going to change Administration hopefully sounds like it is sounds like President TR I don't know how that is going to fly locally sounds enforcement they're doing whatever they can they're limited because there's people can say there's a family in the house but what constitutes a family we know that it's not a family we know that it's a bunch of people that have just been thrown in a house but there's very limit walks a line those occupancy walks in line with constitutional rights of people inside their homes but but we do I can tell you I can R yeah the the the folks from code enforcement are still doing inspections for anyone who needs a CO and as councilman lamb pointed out that's a very difficult thing to enforce but they're doing their best to enforce it and all all of the uh Provisions then make what rules you said more enforceable make more things that you can enforce we have well I said keep but you get to questions Dave has brought up uh Jim has brought up numerous times that he cannot vote on uh various items because he just got the agenda he just got the um the billing list half an hour before the meeting I would like to ask uh Mr Mr Coleman and Miss otou specifically how can you vote on items that you just got paperwork on how can you vote on a bill list when you got it 10 minutes before you sat down I tried to read through this and I missed the fast reading class I guess because I couldn't get through it I couldn't get through two pages of it while trying to listen to what's going on in the meeting and trying to read at the same time I'm not that talented but maybe you all are but how do you how do you vote on these things Mr Coleman when you just got the agenda and and you haven't had information on it I'm asking you specifically I'm not going to give you an answer right now okay Miss OU could you tell me how can you vote on items that you just find out about sitting at the meeting or vote on the bill list when you just sit down we can't hear you I'm sorry sorry it's okay there is an agenda meeting meeting and I was at that meeting I went over the billing I went over all of that with the people there at that meeting that's how the agenda was okay and also I had perview to that um the agenda was uh I guess it was out yesterday or this morning I think it came out at 1:30 this afternoon or 12:00 or something again Mr Coleman was also at the agenda meeting so he had privy to it um so you're saying that you all get a copy of the you get a copy of the today that's when I got on Council I was in the minority like Jim and David are right now seem to be on one side of the aisle when it comes to certain issues which is okay when I was in minority we would certainly walk into meetings myself and those in minority which was councilman Rodrick at the time and we would walk in and grab an agenda off the table and it was the first time I looked at it that was for the first two years of my Council no it's true David not yeah we spoke about D you don't have to yell you don't have to yell to make your point I'm speaking FR excuse me I'm speaking David let me ask you something let meish let me can but I wanted to ask you something what is there's got to be a law no there's not as to when this agenda no there's a there's a code that says if a counsel person would like something on the agenda he should get it to the clerk on Friday before noon before the next meeting I'll tell you why the clerk has a tough job he does a lot more than just putting together agendas he's dealing with the day-to-day business of the township Council and that's code and David should know better because that is in our code the clerk actually works for the council not the mayor so the clerk has a tough job not easy as far as the agenda a lot of these issues we know about weeks in advance because they're issues that are going to be coming up and you have time to contact the CFO if it's a money issue you have time to reach out to the engineer who's also here in the audience you can come down to town hall and see him personally you can call him email him you can reach out we're in that position where you have to come down to town hall I don't see either of these gentlemen here enough I'm here a lot because there's a lot that comes up and it comes up quick because a clerk he's doing a great job but it's a lot of work but as far as the agenda is concerned the first two years I'm un counil you get it the day of the meeting of sometimes and you know what it is what it is I would abstain a lot because I didn't have chance to read it I don't blame Jim for that a lot of these issues sometimes these guys in minority bring up are issues we deal with every year their accounting issues accounting principles engineer issues that they can see them and and get the answer quickly and whenever they want so that that's why and that's why we have I could add uh for meetings that are advertised at the beginning of the year There Is No Agenda required prior 48 hours to the meeting the reference that you hear is for special Council meetings that the agenda needs to be posted when known trust me the agenda is posted as soon as it's finalized it's posted it's just things are being shuffled around and it's not uh finalized until you had a question about the bill list the bill list comes about a week in advance and if you can't get through the bill list after being on counsel from multiple years and week in advance then you should really contact the CFO I do if I have a question or if I voted no to bills all the time I have a question I call the CFO what about as far as the public goes I mean don't you feel it would be beneficial to everyone here if we could get a look at this I have no problem with the bill list going out earlier than it does not even just the bill list the agenda and I understand the agenda changes however would it seems it would be in everyone's best interest in the township other than just for the council to make sure that this or or pass an ordinance we pass so many freaking ordinances pass an ordinance the agenda must be out 24 or 48 hours prior to the meeting wait a minute and I understand that things come up if something comes up and it's going to be discussed you may discuss it after the original whatever however it's not official it can't be official until it's at the next one and on the agenda at least 24 or 48 hours ahead I kind of feel like at the last minute neighbors are all making phone calls and scrambling saying hey did you see the agenda it just came out this is on there I didn't think this was going to be on there we need to get it it's it's always well well tonight and maybe I'm the plan for tonight but tonight was a speed reduction which I asked for about two years I only got it this year because again there was a change in administration I've been asking for it for two years I got that tonight so I'm sorry if I didn't have time to get out to the public I wish I did I can tell the ort Beach FES and taxpayers they knew about it well in advance because they've been asking for it um the other issue was a parking lot because we have some parking complaints and parking issues at the at the uh at our park at our boat ramp area um those issues again I I was happy the administration got it on again I asked for but there was other things that were brought up earlier I guess in the day throughout the township that are not on the agenda now they were supposed to be but now they were changed I I don't know that's and that's the point of not releasing it prematurely because that's what happens and then folks accuse the council the council president the mayor of being deceptive with it so that's the point of why it's being de it feels deceptive to us when the when it's not it's not it's a fluid process in your opinion sir and you know all due respect you may feel that way but I know a lot of people out here feel like we're we're showing an agenda so shortly before the meetings it makes things difficult and we feel like that too but I'll tell you why the administration is dayto day Town Hall they manage supervise all the employees and they have department heads chief of police engineer CFO they have to answer a lot of people and we're on Council and the clerk has to put all this together quickly and as quick as he can and that's the best you know again that Jim's been here a couple years he should know that we do the best we can but I can tell you that the first two years on Council I think Jim knows that the first two years on Council I'd walk in and pick it up just like everybody else and everybody said what's the problem we doing this for years like this not true it is true Mr pres think I think a lot of people out here would be in agreement that it would be very beneficial if you could get these out earlier and table whatever has to be you can't get in if you can't get it in a day or two ahead of time then table well I'm happy we didn't table the the speed limit reduction because that that's important for my residence there are things that were tabled till the next meeting I know but the point is but there's certain things that have to be considered when they do you get the agenda out earlier I we can all agree on it if I have may go ahead Jim if you keep if you keep repeating the same story that then eventually somebody's going to believe it but it's not me because the last Administration where he was part of Min minority give or take doesn't matter we had does matter all right it does matter because just remind council president the timer did go off a while ago so this after the meeting I'll meet with you and I'll I'll work with you cuz I think you got good ideas let me know when you're done you do all right so the prior Administration we had agenda meetings twice a month and still managed to get an agenda out uh to to two times a month two times a month and we still managed to get the agenda out at least a week ahead of time tell at least the council people and yes things Chang now please op request how many times Mr lamb has been invited to these council meeting or these agenda meetings so that when he that he only gets to see it here yes you can you feel you can rest assured that that's not the case would everybody it to the agenda meeting no because it would violate the sunshine you could only have three but we did it a week in advance we did it a week in advance stuff so we did it a week in advance and we did it twice a month these guys cannot manage to do it a day in advance once a month and yes things Chang and yes Steves is working his tail off but we did it before why the hell can't we do it now and goes back to what I said in my closing arguments before or closing speech there's something I me take our time there's something else going on so I appreciate you bringing it up you know this bid package and it was acknowledged on the record is the same as was awarded in December we got a cheaper bid this time okay so in December did we know a car was going to drive through the parking lot because we're really good this is not addressing what happened in the parking lot so I and there's hund and there's $140,000 in the bid of a addition requirements which were in the original bid which are now additions so my two-part question is one how are we addressing the problem because Mr lman said and very clearly that you uncover things you find things there's something we already know and the Timbers are added as an extra which is what that gentleman or whoever drove through so $144,000 when that gets triggered here do they have to stop the job and come back because you didn't approve that tonight that's my so my two-part question the uh accident that you're talking about is covered under its own change order to to repair that so that's not part of that but shouldn't it be under the scope for the the the contract covered under totally different contract totally different covered by Insurance that's why I understand that but I'm saying it's so it's a totally different contractor you have two contractors working what happens with the $144,000 of additions if they need to go into that part of this contract that hasn't been approved by the council so they would have to stop the job and come back here correct okay um the one thing that was not on the agenda tonight was the Redevelopment a lot of people were looking at that is there a reason why that was removed from the agenda what the Redevelopment the ordinance for the Redevelopment downtown Redevelopment is there a reason why that was removed we want to decide want we want to do more study period um you also uh you approved tonight the resolution for the closing documents on one Robins there was some question about expert reports and different things I just want to throw out there you know New Jersey is in the process right now of going through a change every one of us in this room every one of you if there is contamination if there's issues that have not been disclosed started my career in Toms River during Co in 2020 it was extremely difficult to watch many small businesses and restaurant owners facing severe financial hardship to the state's restrictions I personally met with many individuals to see how I could help them survive the pandemic I advocated for car's 3 funding to be cheap to can I get a second back that's I advocated for cares three funding to be accessible to the business all businesses in the state of New Jersey because Co did not discriminate it affected businesses all over the state not just in the urban areas I wrote and implemented the Toms River Main Street program so in the future if there is a need for state or federal funding tomser will qualify for the first round of Grants and will no longer be passed over and continue to be the whole in Swiss cheese I also assisted many businesses with their Grant application to secure Eda funding during this time is also when the bid started outdoor dining and created a nightlife down downtown most businesses and restaurants are now no longer closed after 4 30 the job as an executive director of the Toms River business improvement district has not been easy it has been very rewarding though Tom's River is a unique Jewel of the state and it is very different than many other communities there truly is Unity within the Toms River Community I am grateful for the opportunity to be part of this community and being able to help with the revitalization of the downtown unfortunately this will be my last council meeting and I will be transitioning to another position closer to my home at the end of the month I assure you as I move on I will not forget about the friends and relationships that I've made in the past four years and I will continue to assist these individuals and fight for the downtown Toms River I might be gone but I will never forget about the toms R Community thank you I I just want to say something to uh Marin God bless you you turned to downtown around it was dead and just because of you and your staff it was turned around businesses were just getting off their feet you were forced the hell out of here and I I'm resentful about that because ordinance of lowering the speed Li I think that's actually a good thing but let's be clear here you're not going to have the officers on the road to do this when they have to come to this meeting to you know we should respect people when they win an election I agree with that statement but when Mr Burns and Miss otoul who pretty much has now cost the township more money because she exposed in a letter that we all got about a lawsuit active against the township why would the council Mr Pascarella why you can shake your head why would the township allow a sitting council person to disclose anything about us a lawsuit I'm at a loss on that it's our first amendment right Mr I'm talking to Mr Coleman I'm the that was filed had nothing to do with the letter the lawsuit that was filed had nothing to do he just did ask me the lawsuit that was filed had nothing to do with the letter that Miss sool sent out well we're going to on that it actually had to do with things that occurred well before mayor rodri uh won uh the mayor's election well mayor mayor rodri was a sitting council person last year and I can assure you this was done intentionally to try to hurt people so if you think that Mr dockerty is is going to be harmed because Miss otou and Mr Burns in the back are going to use anything they can to discredit them by putting out letters which I'm telling you right now the township is going to pay dearly because she brought up a woman that filed a lawsuit and she is a council person fact she filed the law I think the lawsuit was filed after that letter went out it had in this town what he is doing and what you are allowing here to ruin our schools attacking school board members and the pretty much we're going the property values will go down so maybe some of you know what the what was said at today's Board of Health meeting uh that I attended uh there still is no signed agreement that's been sent over with two signatures uh from the township relating to the animal shelter uh and there is no certification of funds that was received over at the um uh County Board of Health um I want to talk about number two uh back at the um September meeting uh Mr Coleman you announced the rules at the onset of the meeting and you said that three minutes was going to apply to not only the residents but also everybody up here on the council including the mayor and to a large extent that was followed and the meeting was halfway decent last month was just absolutely atrocious um that was an embarrassment to the T uh you everybody it was like a kangaroo circus and you guys looked like buffoons um but now tonight I thought perhaps you would get your act together and you would go back to this three minute Rule and again you just let it go by the wayside and it's a freefor all and it's I do not understand why these per these meetings that in every other town every County uh every agency that has meetings are conducted in a professional manner and we come here and we watch this spectacle of Barbarians that just act up like they're monkeys and and I mean there's animals that are better control than humans here so I'm going to say to you get your act together Implement rules and express what they are are at the beginning of the meeting and they should be followed from one meeting to the next do not make them for September and then in October they go out the window and then we change the rules for November and then we change the rules again in December there should be consistent rules and everyone should comply and if it's 3 minutes make the mayor adhere to those rules and if he acts up he needs to be thrown out of the room just like the residents because what happened at the end of the last meeting when that woman uh that spoke and went over her time by a minute was thrown out of the meeting simply for that was absolutely ridiculous because we were subjected to long winded uh tie raides and rants from the mayor 10 minutes at a time thank of you I know you put a a lot of your personal time and energy into trying to do the right thing for our town um I grew up in Tom jiver and Tom jiver a town that I love and I love to teach and um one question I actually have is about the agenda and it having to be uh out 48 hours because I was looking something up and it says about the open public meetings Act and the you know statutes and all that stuff and then when I go to read it it does say how it has to be out 48 that issue has been before the New Jersey Supreme Court and they've clarified that that's only for special meetings meaning that meetings that are not uh planned at the beginning of the year that are not noticed uh in the uh General uh notice that the township puts out it says at the reorganization meeting okay I don't know it says adequate notice means written advance notice of at least 48 hours and this very issue has been argued by attorneys before our state's highest court Mr mcgucken he can also weigh in on that Mr Mr pasel is absolutely correct the township announces its meetings at the beginning of the year so it's impossible to know what's going to be on the agenda if we're going to have a special meeting we have to publish an agenda to the extent known um when the notice is sent out the 48 hour notice is for the paper also to publish uh to be advised of a special meeting and that notice has to be given to them so they can publish it at least 48 hours before a meeting so you're saying the agenda doesn't have to be posted online like our school board does that's correct doesn't Okay Okay um the other thing I want to say is yeah um I was here at the last meeting it was the first meeting I attended and there were lot of young people here and students and tonight too there's some people and I I I don't know the right way to say this but yeah I would definitely like to see the meetings conducted a little bit differently because you know you are all representing Tom's River and um you know we want to come across as professional as we can um I was upset to see some of the mailings that went out in Tom's River about board members like Kathy Egan and Jen how things that I know weren't true just like very upsetting things and it really does affect Tom's River the schools schools are big you know like uh Mr faki said before this is the town people you know came down here because they wanted to go of schools so it's just really important you know downtown falls apart next thing you know if our school falls apart Police Department this and that it's just not good for Tom's River so or six of the council members and it's very hard for us to understand how we've gotten to this point um we feel a lot of important issues come up and we all sit out here in the audience and say how can this be happening why don't we have a say why don't we have a say that's my question um there was talk that some of the ordinances from downtown Toms River are going to there's talk talk that they may be repealed I really didn't get much information about it I wasn't at the last meeting so I was you know hearing from this one and that one I I realized it wasn't brought up tonight it seems It's been tabled it has to go before the planning board but how is it that these are allowed to Simply Be repealed because somebody has an idea and says hey let's repeal these I don't understand how that can happen not to mention why I mean why do we want to repeal them and it seems that Miss Marin has done a lot of work in order to get Tom drier in in front of the the state on on a state level God forbid we have another problem I you were mentioning for funding I know she's still back there she was mentioning for different funding that may come down the pike if these ordinances are changed does that remove our position for this funding there's a lot to be looked at and and we don't understand any of it and the idea that five or six people can just say hey let's to repeal all this stuff that took years to put into place it scares people I mean I live right downtown four four people four people four people thank you it scares people I live downtown I've been here for 31 plus years between a code a resolution and an ordinance generally speaking our code is what what codifies ordinances that are passed okay a resolution is something that doesn't need to be it's like something legislative something that's a a one-time uh thing such as hiring somebody something that's not going to to permanently alter the code so like the the rule the law not law but like what a Township or municipality would have to follow is the code well two two things there's ordinances that are basically local laws okay there are also ordin es that address administration of the municipality there are there are ordinances that um provide separation of powers within the municipality um but the certain ordinances only apply for the council versus the mayor and the mayor versus the council um so they're separate types of ordinances it would take me you know about an hour to go through all I just meant just in general so so the township would be obligated to follow those that are on the book though right the C's obligated to follow state law and their own ordinances with the exception of ordinances that the council can enforce against Administration Council can if it chooses not to use mentioned the Flyers that had come out slanderous flyers about our Board of Ed members uh current Board of Ed members paid for by uh Township attorneys um it's quite disturbing um also the anti-semitic Flyers that keep coming from Mr rodri and why that is allowed to continue happening why are you villainizing and weaponizing a specific community of this town where we're all trying to get along at this point and we're all trying to work together to make Tom a better place but yet every mailing season every election season we get pictures of council members Board of Ed members Mayors and whatnot all with anti-semitic messages and photographs it's disgusting it's disgusting and the fact that this Township has not been sued for that yet is outrageous Mr Coleman as far as timing goes on your meetings I understand that it is your up to your discretion as far as how long people are allowed to speak as a zoning Board member we start our meeting at 6:30 if our meeting is technically done at 7 o' and there are people in line to talk about things that we have discussed we have to stay till 10 o'clock no questions asked that's our job that's why we're there um as far as code enforcement goes and the lack thereof regarding what um Mrs wenck said and yes her father-in-law was the mayor um there is no code enforcement officer in the right mind that would walk into any of these homes that are being spoken of and give a CO to anybody 10 12 19 people it's illegal five bedrooms you're not putting 19 people in there legally I don't care who your C enforcement officers are and what the jobs they're doing or not doing are it's illegal clean and simple all that being said I want to know why we can't ask the engineer about the bid um for the parking garage we always have been allowed to do that in the past and just because his name was brought up I feel as though that's an invitation for him to speak and he should be allowed to do so so we can hear it straight mention my disappointment with the decision of this Council uh on a second reading of the ordinance that essentially transferred all of these departments under the leadership of Mr solanis who to this day has never had the minimum qualifications that our Municipal Code required for the two positions that he has been appointed to and yet all of the responsibilities for these departments are now going to be under under his direct purview and without any of those now divisions the heads of those divisions now do not need to be uh confirmed and approved by this Council which otherwise had always had the authority and the ability to say no beginning all the way on January 1st and every council member up here save Mr lobman who was not yet appointed is responsible for not checking Mr solis's resume and comparing it to our municipal code for whether or not he had the minimum requirements for the B for the position of director of recreation he didn't but so be it jobs like that happen all the time that's government unfortunately that's what we're accustomed to but when it came to the ba position was very disturbing to me because I was aware of how much Authority the business administrator has over our Police Department it freaked me out knowing Mr solanis because I actually met Mr solanis and Mitch working on Dan rodri's original campaign it's kind of how I learned how to run campaigns I learned from him that's what he does he's a political consultant and now he's a business administrator that has all this authority over our police department and now as a result of tonight's action of this Council he has even more direct Authority and this Council now has no authority to confirm or deny hires of what should be department heads now with that being said that was just my disappointment another thing that was very disturbing for me and had this not happened I wouldn't have came up here and and spoke at all tonight but for the person and whatever that was about but Mr Coleman when a member of the public I don't care where they're from I don't care where they live for a member of the public to come here and stand at this mic at their time to speak and then
