you tell the board where you received your education yeah sure um I received a Masters in City and Regional planning from Rutter University uh I'm a licensed professional planner uh in the state of New Jersey um I'm also a fellow of the American Institute of certified planners um I've been in uh in planning practice uh for about 40 years maybe a little bit more than 40 years um and I've served as a plan planning consultant to zoning boards and planning boards I've testified before planning and zoning boards throughout the state of New Jersey and in fact I've testified before uh the West Windsor planning board probably at least 10 years ago so it's been a little little bit of time since I've testify before this board but but I've been here before answer this evening all your licenses are still current uh yes they are absolutely okay accepted thank you Mr chairman just grabbing his Nemo sure so you've been out to the site and you've reviewed the application correct uh that is correct and can you just kind of go through what the conditional use standards are under the ordinance certainly uh and these are also referenced uh in your planning report by the bo planner um and I will be addressing can everybody hear me y uh I will be addressing the conditions some of the conditions in terms of the testimony that I'll be providing will be supported and and affirmed by the testimony from the from the tenant especially for the operations so there are two tiers of the conditional use requirements uh one is in section c section 200- 234 which uh has conditions for plan developments overall uh and this tency is within a plan development that's subject to those conditions so I'll just read through the conditions and then in response to each of those conditions um how the um applicant uh complies with those conditions uh the first which is the that the departures by the proposed development from zoning regulations otherwise applicable to the subject property conform to the zoning standards applicable to plan development and that in fact there are no departures uh from existing zoning regulations uh or the plan development approval so therefore that condition is met and again these are conditions associated with plan development as versus uh the uh conditions that are associated with the veterinary facility so the second one is that the proposals for maintenance and conservation of the common open space are reliable uh and the amount location and purpose of the common open space are adequate now there will be no change to the existing open space provided in the plan development uh in addition a dog waste Station will be installed in the front of the entrance and will be wellmaintained and emptied regularly by the tenant and again you will hear testimony from the tenant themselves affirming some of these statements and again that condition is me the third General condition applied to plan developments is that the provision uh through the physical design of the proposed development for public services control over vehicular and pedestrian traffic and the amenities of light air and Rec Recreation and visual enjoyment are adequate there's no changes that are being made to the public services or control over vehicular and pedestrian traffic um no no changes at all to the to the overall site plan uh all ventilation for the space would meet current and applicable local and state building codes and therefore the condition is met and again you will be hearing further testimony on the uh issue of ventilation in the space uh that the proposed plan development will not have an unreasonably adverse impact upon the area in which is proposed to be established there is going to be a 12T X 12T outdoor fenced area uh behind the proposed Pet Hospital uh which is which is proposed um and the area is going to be remained that fenced in area is going to be remain as as grass there are no other physical Chang is being made to the plan development and this condition is meant you'll also hear about some of the screening that is also being provided by an existing vinyl fence to that that fence facility and then the final General condition that's applied to plan development that's applicable to this application is in the case of a proposed development which contemplates construction over a period of years that the terms and conditions intended to protect the interests of the public and of residents occupants and owners of the proposed development in uh in the total completion of the development are adequate and this application doesn't involveed uh any construction over a period of years um there will be no impacts on the terms and conditions uh intended to protect the interest of the public residents occupants or owners of the proposed development uh and this condition is is met and you again you'll be hearing some testimony as to the floor plan and the internal operations of the veterinary facility when when the proposed tenant is uh is here so just in summary for the first PR we have an already existing shopping center where CH of the 12 by area that is correct otherwi all the original conditions have that is correct and there's no changes that affect any of those those original conditions okay so then we get into the conditions that are specifically uh applicable to the veterinary facility the the Animal Hospital uh and that is under Section D conditional use compliance and they're very specific conditions and again I'll emphasize that some of the uh my my responses are going to be based on testimony that you will be hearing uh in Greater detail from the from the tenant that is correct the there there is a all the information about the operation and about the U um the facility as proposed is in the application package and your again your planning report uh very clearly uh provides a I think a very good overview uh of the uh the proposed application uh so the first is the veterinary CL Clinic building shall be cited at least 150 feet from any residential use for zoning District uh in fact that the tenant space is located approximately 200 ft from the closest residential zone or use uh which is located ac across old Meadow Road to the east of the shopping center condition is met um and by the way I should point out in uh I think it's Pages four and five PL of your your planning report there is an itemized list of the conditions as well and affirmation by your board planner that each one of these conditions are are are being met um and I know that there was testimony and discussion U during the various technical review committee meetings as to the compliance of those conditions and board planner asked for certain information clarification which was was provided to that uh so the second condition appli applicable to Veterinary facilities is that building housing animals shall be sound proofed to a maximum transmission of 65 DB measured on the outside of the exterior wall other sound proofing requirements may be imposed by the board jur of jurisdiction such as but not limited to the f following the non-opening windows and forced air ventilation solid core doors and sound absorbent ceilings and you're going to hear a little bit more detailed information uh about this but uh for in summary uh the existing building walls are concrete block construction with 4in r113 insulated stud wall inside of that the existing demising walls are 6 in thick metal studs with 6 in r21 insulation in double layers of 5/8 in drywall on both sides additionally all interior walls within the tenant space would be filled with mineral fiber insulation uh for sound attenuation with a wall assembly STC rating of 47 minimum this will be in addition to the existing STC rating of the exterior walls and existing demising walls additionally all ceilings within the tenant space have a noise reduction coefficient of 7 meaning that they absorb 70% of the sound that hits them and they will have Loos laid bat insulation for sound attenuation provided above all ceilings as well don't ask me to go every single detail of that if there's any specific questions on the engineering and design perspective uh uh we can we can provide that as well so the bottom line is the condition has been met uh and I apologize for having to read all that into the we so number three uh proper and ample ventilation of all animal areas in the building shall be demonstrated to the satisfaction of the board of jurisdiction and shall meet all state licensing requirements again you'll hear testimony on this and all ventilation for this for the space will be met meeing current and applicable local and state building codes and the condition is meant number four animals may be kept overnight for only medical reasons animals will only be kept overnight for medical reasons if there is an animal on premise uh there always will be a veterinarian treat treating that emment pets are only kept on premises for inpatient Medical Care with direct supervision can you clarify the fencing around the 12 X1 12 area on your descriptive statement it said I don't know if it's for you or for the tenant can can you elaborate a little more on the pet waste Station how how and how it works and and why is it in the front of the building as opposed to you permitted in a zoning District provided to meet certain conditions right so if you have a use that's permitted that's conditionally permitted subject to five different conditions and an applicant is meeting all those it's considered permitted and they go in front of you uh if they are not meeting one of those conditions then they would require a conditional use variance and it'd be in front of Curtis and the zon board uh for a condition use VAR okay did review this application discuss it during the technical Review Committee and agree with all the planning testimony that they are meeting all the conditions and therefore are a permitted conditional use and are in front of the proper court and uh in my review I did not find any variances or waivers so uh that's essentially just that had a couple one or two questions regarding the operation that's it we have any idea what's happening I mean during the part trying to find trying to find big okay they are you know what what don't we put pets so if a West Wy resident has a pet chicken and it needs help could it come to V it could come to V so we see aiet so while they don't have instant knowledge in chickens if someone called us and said I have a pet chicken and see it yes you will see it but to be very clear we do not see far that it's not something we Market it's not something that we are putting out bring your someone itad of question is there a list of animals that you will see and animals that you won't see we don't necessarily have a list that weish out to the public or really publish to our internal employes I we don't see animals we don't see horses we don't see cows we don't see monkeys that is the are not allowed we you that is corre oper are in Monday Sy we have facility NE doties make experience no wants hospital um I have a quick question regarding you talked about truck unloading you know new PS FedEx is there a place in front for like animals to be dropped off notop off okay well carry it got it really appreciate the fact that this would be 24 hours and the staff would be 24 hours as well because one of my concerns when I was a pet owner was having a pet stay over and having nobody there that always kind of freaks me out so uh this is uh hitting all the nails in the head so I have no additional comments unless anybody has questions for me Starbucks closes at nine oh you it up thank you
