uh good afternoon everyone welcome to the Westport Board of Health May 13 2024 meeting uh which I'm calling to order and reminding you on mass under Mass General Law chapter 30A section 20f this being this meeting is being recorded and please join me for the Pledge of Allegiance I pledge aliance to the flag of the United States of America and to the Republic for which it stand one God indivisible withy and justice for all thank you very much okay we'll get right down to business starting with the written report um any questions and otherwise I'll just let Matt go to his baral report I have I'm good proceed all right so the Red Cross will be holding blood drives at St John the Baptist Church 10:00 a.m. to 2:30 p.m. on May 16th and June 13th um I don't believe there's anything scheduled out beyond June 13th at this point uh when Linda comes back on Wednesday um and I were going to talk about that okay the rabus clinic was held on May 4th um at from 9 to 12 behind the Hicks bridge fire station there was a great turnout 47 total vaccinations were given which is quite a bit that's pretty much double what we usually get so that was a a really good clinic and I just want to say thanks to Chief Baldwin the vet and Dr Penny and uh Nick for making that clinic a success and we're going to try to make every effort to hold another clinic this year maybe uh in the fall but we'll have to check the budget and see you know if that's possible okay so mosquitoes the Massachusetts mosquito season typically begins in early spring and Peaks during the hot humid summer months you will usually start noticing increased mosquito activity around late April or early May the activity intensifies throughout the summer with mosquitoes becoming especially prevalent between June and August as temperatures start to cool around September and October mosquito populations usually decline there are simple steps you can take to protect yourself and your family from mosquito bites and the illnesses that they can cause protect yourself from illness by doing simple things like using insect repellants anytime you're Outdoors where long s clothing schedule outdoor activities to avoid the hours from Dust to Dawn during Peak mosquito season repair damage window and door screens and remove standing water from the areas around your home tick uh ticks and Massachusetts tick activity and tickborne illness can occur year round however most tickborne diseases tend to Peak during summer months of June July and August one of the most important things you can do do is check yourself with ticks once a day uh favorite places tick like to go on your body includ areas between the toes back of the knees groin armpits and neck along the hairline and behind the ears remember to check your children and pets too remove any attached ticks as soon as possible when going outside to an area likely to have ticks stick to the main Pathways into the center of the trails when hiking we light colored long sleeve shirt with long pain pants and tuck your pants into your socks this may be difficult to do when the weather is hot but it will help keep ticks away from your skin and make it easier to spot a TI on your clothing repellants that contain deep can be used on your Exposed Skin Perth rine is a product that can be used on your clothes always allow the product in uh I'm sorry always follow the product instructions and use repellant with no more than 30 to 35% de on adults and 10 to 15% de on children never use insect repellant on in [Music] infants okay great any that's it for updates that's it it's just um you know up on our sign out front we have um a web page you can go to if you have more questions about the mosquitoes and ticks I think it's going to be a particularly um active season because it's it's seems like it's going to be um hot humid type damp season so whatever you can do to minimize um U illness of you know for yourself um and others around your house it'll be helpful to follow you know these guidelines do we have um the tit cards do we have a bunch of those you do still have a bunch yes okay so we'll those are available at the board of health and uh they will be tomorrow they probably uh still tucked away oh there was some out on the table outside of the hallway I can replenish those okay yeah these are small like uh wallet size uh tick cards that show you the different um pictures of the different you know deer ticks dog ticks and so on so you to help identify at their various stages so um they're useful to have I have one on my refrigerator so great they have some new ones this year that it's the same card but it's also a removal tool it has a little uh tool built into it that you can remove the tiex with so be some of those I want one of those me too okay and dog owners need to check their dogs for ticks and get collars or uh medication um that can prevent the ticks from surviving when they get on the dog dogs get Lyme disease too yeah yeah okay great thank you um okay we'll move on to um minutes uh we have the April 1st 2024 minutes which I think uh we um were not able to to approv last time Phil you were absent and it was just you and I at those meeting that meeting so um we have to um review the minutes did you have any questions or no I didn't I was fine okay um can we just do one quick correction um on uh the uh page three the well variance hearing for Jill kremens it says Mr um leech noted the potential well sites were limited by the salt marsh on the property and the septic system was downgrade it should be downg gradient I don't don't want to be people to be confused about that um from the proposed Well site other than that um so I move to approve the minutes of April 1st 2024 I will second that and I abstain because I was absent y all in favor I so that's two uh to nothing with one abstention thank you um April 29th any uh questions or Corrections on that one um I just had one minor one um in the board member updates it said Miss Amal noted her attend attendance at the State Health Board Association program um it it says that focused on it addressed it wasn't focused on that that was part of um what was addressed at the meeting okay uh any and other than that um I move that we approve the minutes from April 29th 2024 okay motion is made and seconded all in favor I that's unanimous thank you okay um we now go on to some other business um first is the next regular meeting in two weeks would be on Memorial Day so we need to reschedule that um and we had a proposed date which um 30 the 30th um is that uh that works for me May 30th um I things have come up in the meantime oh no it doesn't May 30th does not work for me that's the past day why did I say I said i i d said the 30th um okay I don't know if that's the DAT you had um so on the 30th is I have signed did you sign up Phil I believe I did yeah okay we both have signed up for a past conference um at Boston College um you know that email um the 29th uh we have uh Mental Health First Aid training okay um for that whole day the 28th I thought we were thinking of the 28th the Tuesday um oh but you might have conom uming yeah I uh yeah so I think my the preference is not to in in the normal course have the our meeting at this same um week same week okay um so when your do you have um when is your concom meeting is it the June whatever June 1st um I should have come prepared with with you know with the with the calendar June 4th would be the I let's see so if I just look is the 31st available it's happening the 14th should normal of course it would happen the 14th and the 28th because it's happening tomorrow okay um Friday the 31st does that work no not for doesn't for me okay okay so um um and then the following week is is you have concom um can we we say the 28 well so the following oh so we could so it be the 11th would be the next concom meeting if it was on the 28th oh your concom is on the 28th yeah cuz it's it's tomorrow then two weeks would be the 28th and then the next two next okay so we're right now we are on the same week schedule that's what I'm saying oh okay yeah we are we talked about do you want to try you June 3rd works yeah but I June with me at 400 p.m. y okay so uh we'll move the um Memorial Day meeting to June 3rd 400 p.m. and we can see where we're at at that point whether we just slide everything else two weeks um hence or whether we um do another meeting in the following week do we need to get on the same week Asel board yeah right now you're Alterna we can't win can we well we're going to do we will do the next meeting June 3rd at 400m and then we'll assess the schedule after that do we need to do a official vote huh do we need to do official vote to make that okay okay so next meeting is June 3rd at 4 p.m. um uh we have um do we we could do can we do hearings early we don't have a Butters or do we want to do board member updates and let these gentlemen wait till 4:30 I do have a Butters online though ah okay I don't but I do have three green cards so okay um well let's go ahead and do Mr Nicholas so we can get him out of here um so I'm going to call the hearing for 180 tickle Road uh owned by Claire Messier as this is a three-bedroom repair with a Presby on a 22610 ft lot uh Greg necklace from South Coast engineering representing good afternoon Mr Nicholas good afternoon everybody thank you okay as stated existing three-bedroom house at 180 CLE Road has an existing system a pipe and stone system and it has an existing steel tank um which is the reason that this thing of flaged uh by the current owner the tank itself somewhere along the line somebody poured a concrete slab on top of it and that's downed the ball from the top so obviously the tank have to be replaced talking to the owner I suggest that said this system here is 40 years old I don't know what the um system itself looks like I didn't have the time to talk to us I replace the whole the whole thing at the time we did the per test we did un cover part of the system the system itself doesn't look bad but like I said it's 40 years old it's undersized it's built under uh probably the old uh whatever that was Article 7 even before Title 5 so it was s to replace it so what we have here is a PR system as you can see we have some stagged rules in order to meet the setback require requirements on the east side of the property and the one waiver we are requesting is to 3.7 ft away from the bond slab elevation that's a large uh shed small barn we're able to maintain 100 ft away from all the wells closest one being a locust well a 100.3 um this system will be staked out prior to having it installed because of that you know 3/10 of a foot doesn't really give us much wiggle room but we'll get it staked out and then we they will be sure that it goes in the right place so other than the um that one wave of request is pretty straightforward so I'll turn it back to the chair any questions uh let me turn first to Matt and then we'll open it up for board member questions no questions okay how are we with paperwork now are we getting the paperwork in that we need yeah we got so this is just a curiosity kind of question since there's um I don't know what kind of activi is uh at the barn and um you know I'm not I'm just curious um does it make sense to have H20 load instead of h10 because there might be heavy equipment coming in and out of that Barn that's a shed um after you ask me a question about or or thought you know that the last hearing do we really need that um I don't think we do but I mean I'm not opposed to it and it's not a big deal to change that just it was just more of a curiosity question because I didn't know how that um being used yeah this is was Warr mess's house so he had a tractor over here and um I don't think that tractor's moved in 40 years and uh his health is that that he's not going to be yeah but is it is this property going to be sold yeah I I would think so yeah yeah okay um I I leave that to your discretion I just yeah I don't think I don't think it warrants it turn uh anything else no okay it still needs yes deed restriction and whole harmless agreement y okay so I move that we approve the plans for 180 tickle Road one by CLA Messier um uh reversible trust revokable trust dated for 2024 for a three-bedroom repair um with a variance as um written in the plan distance from Edge of the system to the bar laab Foundation 3.7 ft um instead of 10 ft with the following conditions whole harmless agreement three-bedroom deed restriction and concom review second a motion made and seconded all in favor I that's thank you very much okay um I am going to wait till 4:40 um for the the next one um so we'll move to board member updates okay I have a couple sure um successfully um held the first mental health awareness event at the library on Saturday um regarding self-compassion um on Tuesday at the height Middle High School um we will have a presentation called increasing positive interactions and emotional well-being family communication um it will begin at 6: but doors will open at 5:30 um and then the following week and the speaker I have is a social worker who has um is part of the Westport practice here also is in private practice and does both um Adolescent and adult Psychotherapy and there'll be two um adjustment counselors Mary Joe madus and Johan Thomas um who will be there to answer questions for qu uh discussion and question and answer period after that um and we'll have a special guest which will be the therapy dog that is at the high school um which uh Sean Thomas owns and brings to school twice a week to show as a resource that's um available in the school so um I hope that um parents will come I hope teens will come because there will be addressing how to talk to your parents um and so I um um I think it benefits all families in the community um the following week on the 22nd we will have um our presentation of the impact of opioid Addiction on individuals families and communities there will be four speakers excuse me um uh Stephanie Perry from South Coast um Community Health where she's an expert in addictions our own Olive winki who is the um uh the coordinator of the collaborative um between us and other uh five other towns um and she will be presenting the community impact she has a masters in public health um uh Stephanie will talk about um individual impact um and impact in community as well and then we'll have two speakers we'll have a parent who lost from Westport who lost a child to opioid addiction and we will have somebody in long-term recovery um they will be an answer question and answer period of discussion afterwards as well so again that's at 6:00 um at the Middle High School on the 22nd of May doors will open at 5:30 great thank you um do you have those uh like on your I'm just thinking about ways to promote it more on Facebook well I'm promoting it on a couple of the Westport town uh Facebook pages okay um on my own um it's been um certainly has been I think I might contact UM the shorelines for next week to see if he can put in this is what's happening yeah a little blurb about that um I sent it to the school department to have them post it I don't know if it's gotten posted on the school website but I sent them um the two that are being held at the school okay so I'm not sure how else and and it's also oh and it's also been publicized in in the Fall River a United neighbors of fall River they have a massive email list and it's been sent to everybody on their email lists so they usually do this is what's happening this week and then they sent all the flyers from all the different organizations so ours have been in there as well okay great is there a Westport parent in Teachers Association yes yes I sent it to them okay good I was expecting it to get posted um I first sent it to the um and a um to the principal and then she directed me to someone else and I sent it to them okay but I don't I haven't seen anything posted and I get on Facebook pages for Westport schools and I haven't seen it posted okay all right well anything else we can you know each individually do to help promote it that would be help well spread the word yep there I mean especially I mean both of them are going to be good um the one next week I'm hoping that people in the community that have been impacted by opioid addiction will attend because there may be some discussion about um what would they like to see happen to the funds that are available for the opioid um the opiated settlement the opiated settlement funds which we now have a designated um account account for in town and I've also spoken um informally uh to sha Shelt about um you know Board of Health taking some leadership and I would be happy to and I'm sure Olive would be happy to um be participating in making some decisions or having a focus group where we ask people in town to come in what do you think we should do with this money to help people who've been impacted by opiod addiction the school the school department the Fire and Police Department should be involved um and people in the community uh Fall River is doing a has has had focus groups to talk about exactly how they like to see the money dispersed in the community to help best help so I'd like to see that happen here as well and the settlement funds that will be additional funds coming in from those various um pharmaceutical companies to each of the communities including Westport through 2038 so it's a long term so it's a very it's a long term but it is it the state is going to give guidance on specific use but it's for education and Outreach um it may be for some programming and pre uh prevention and also dealing with people who are struggling so that's something to keep in mind but um I'm expecting that there'll be some conversation about that on the May 22nd meeting yeah that would be helpful okay great thank you anything else nope okay Phil um no just that I you know started to move forward with some of the process thinking about the um private well regulations um and I'm going to check in with Matt and um you know as to what I'm thinking about and um you know how he would like to go about um about doing it um I had uh well this is part of the um sending you the data that uh that I had and and and are you doing this for just for that this most you know you said you were going to try to match it up are you going just do it for this most recent or you going to go back in time too oh I did it for this just because that's what you gave me I haven't looked at the older data okay and we can talk about the specifics of that but okay I would say half dozen unknowns them are um as a result of obviously an upgrade in the neighborhood you know with the because of distance well so most of the systems are newer yeah yeah that's yeah right exactly that's what yeah that you know that's what I would think okay I was just curious we can follow yeah yeah so we can follow up y okay okay all right um um I was out of town most of the last two weeks so except for I get back in time for town meeting as you everybody knows we did get um uh funding increased funding for animal control to try again to hire uh an animal control officer so um Matt will be working on that um we did get the funds for the um New dumpsters that we need at the transfer station so Matt will be working on that those are so he's on top of his game um and then the vaccine fund that was uh re revolving fund or whatever they call that that was passed so uh uneventful on our part from um town meeting um so I don't have any other updates and then it was also the um the change so that we could make funds available the loan the 1% loan programs thank you for reminding me um yes and I think um neia is working on that as well um we already had a number of folks who were interested in that program waiting for that change at town meeting which went through so that those loans can proceed um okay that's all I've got um anything else either unanticipated or topics for the next regular meeting that we should discuss otherwise we're going to um I I think that one of the things that we were talking about before was looking at what's going to happen on East Beach and looking at um you know evaluating how we can proceed um with things like tight tanks and systems down by the water I think that we need to kind of look at that obviously that is vulnerable territory and I was just reading about the uh switch from I forget elino to ELA is that right um and the they're anticipating a a very active hurricane season so that's going to be a challenge for East Beach um it is going to be um so that we should we should think about addressing that and we will have a opportunity to kind of job on a little bit about that at 450 yeah and I think that um you know just looking at the weather patterns recently too with all the tornadoes the some of the changes that are happening that's greatly impacting the flooding down in Brazil and there's just so much happening weatherwise that we really need to be um thinking about that planning for that um okay well I'll note that for a future meeting anything else not for me sorry okay what do we think can we just kind of uh sir are you here for a me for a hearing which one watch oh good oh do we have any other voters who might I I think if any I would have seen this dado the other one's in Arizona so he won't be coming I'm certain about made the trip to this the prim event okay and I don't know about the property line I can we take a chance and go early what do we think can but then if uh somebody shows up would have to restart it okay I'll sit for a minute so if I may to sit uh the route six sewer line waterline extension it looked like that did not pass through meeting so is there a a plan of action from here of what we're going to do uh in that area in general um the Board of Health has not been um in involved at all in uh the infrastructure planning or anything like that so we're not the most um we're not the best source of information I should say in terms of future planning um uh I think one thing we are doing from the Board of Health perspective is um we kind of held off uh you as you know we've extended the deadline for cess pools um we have a whole um cadr of somewhere around 800 properties where we have no plans in place on in our records um identified as properties where the house was built before 1970 so kind of of likely possible SS so we're trying to figure out how to prioritize um Outreach to those um properties um given that it appears that say um sewer is not imminent um and it it's never going to happen in many areas of town anyways um um so that's that's kind of what we're what we're thinking about but um that's kind of all I saw too so um um but uh the select board or the infrastructure committee would be the ones or the planning board perhaps would be the ones who would might have more idea about um the town regrouping and where it might go um there is still um the grant fund for the waterline extension to go down part of further down Route Six and around um the captures the macumber school because of it's a P Grant um because of contaminated Wells um so that is proceeding because that did not require any Town match or any borrowing or anything so that I know is proceeding um or I understand is proceeding but again um we are not U particularly privy to um the planning thank you can I ask is do you know if there's a voluntary tie into that my understanding it is um and that there is no um betterment fee it is um I don't know if they cover the cost of tie-in for those who have contaminated Wells um uh those voluntary tie-ins probably would have the connection cost and then obviously the cost of um the water bill in the future but I don't I don't know for sure I want to say that I listened to to me I mean not to the select some part of the select board meeting um where this was discussed and I believe there is just the connection C but um don't quote me on that again that was one of the sticky things too people talking about the betterment and how that was going to affect them taxwise for the sewer project yeah yeah and I know that there's some people in in town who are looking at um making recommendations about changing um some of the ways we tax in town so I don't know that will ever come to fruition but um certainly David Cole is is trying to present some information that might help with the next step but it's going to take some um convincing yeah the um I hope that in the future they do a really good education campaign yes I agree okay um anything else we want to discuss informally while we're waiting for Bo you can jump to topics the next regular meeting if you want for the next meeting uh we did we already covered that W pay atten probably probably looking at that plan yeah East Beach um sort of plan for anticipating whether extremes continuing to impact East Beach from a you know in terms of septic tight tank Etc um so that that's a future topic um think I don't have anything else I can think of Let's see we are um following up on um o just looked at my notes from our last working meeting that's something I forgot to follow up on um about the um mapping of the unknowns um so I I will do that make myself another note um yeah you're talking about mapping of the knowns where we don't know what kind of septic system somebody has right yeah um well that's where I was thinking going back with the longer list of where we identified um contaminated U you know stic C dmcl could kind of match those two yeah um well I know that there's data in the um integrated Water Management plan from um the clein filter gathered right you have access to that um what I would have access to is the list um well what we all have access to is you know because there's a single word perfect file that is has the list of all the letters right um that have been issued and that was the basis upon which kleinfelder developed the map okay but there able to do that because the software can um establish you know the laun to long that thing and put that information on on on the map okay they didn't convert to Excel or anything uh well I I I don't know cuz I I wasn't the part of it and I talked to my contact there Alex who was very involved in the sewer project so um and I think we could get them possibly to do it um but then also maybe as you would SE maybe there are other um other uh contacts and the gentleman's name I can't remember uh um who who might be able to do it either through Buzzard's Bay or some connection okay there um so but the list you gave me from uh was 2019 to 2023 yeah um is and there's if there's more earlier we can right right so I think there was about 80 well I think there was about 80 that they identified in the in the area of the in the buildout area of the sewer project okay and but they were more distributed throughout the throughout the town yeah say 200 or something and so um yeah so we you know so so we should work depends how complicate I mean so yeah so that piece of so that information we have and probably could be supplemented by this I think uh asking um you know the consultant to then integrate the 600 or whatever the 800 um unknowns into that to see where they match up um is you know a whole another ask well what what I did from the data you gave me today um was I just went into our septic database so I could look at um each address and see what kind of septic system is in place so I've highlighted the ones that are unknowns that we might want to prioritize that was maybe a half dozen right um right so as you were saying the further back in time we go so anyway yeah so it just requires somebody with more data savvy than I have to kind of you know kind of look at it but I think it was a general idea was wonder if we mapped all the unknowns and then were able to align it with the um contaminated well with the contaminated with the contaminated Wells um you know that that was that you know that that might be worthwhile it's certainly relevant if um you know I had another thought um the environmental Affairs uh data portal has um well data from Public Water Supplies um that you know p and so on right right um yeah and we can integrate that I don't know how easily that could be yeah I mean I just looked at it individually when we were sort of talking about p uh a while ago um can I just add one more thing maybe possibly to the next agenda which is the transfer station of Regulation with seeing about adding the age restriction okay yes at which restriction age oh most of the other transer stations across the state say something to the effect that if you know anybody between 12 and 16 have to remain in the vehicle oh I see oh supervised at all times or under 12 I thought it was under 12 uh they area across across the state so um see when we're having a particular issue that might be helpful all right um okay yep we'll put that in um so I'll I'll look into the that database and and see if there's a a useful way to yeah Co yeah okay cuz it's pretty it's sort of yeah random it's seems like um well I mean it's by by date but in terms of um easily accessible I'm I'm I'm not a data expert but um and I can talk to um Mike burough in the in planning because I think that they may have you know the software to be able to do it too you know so if it's you know I just don't know how automated it is how much there is a any the entry thing or if it was a situation where we have a spreadsheet and we can just give you the spreadsheet and then they you know the software could just read the spreadsheet and that would be good I don't know the okay well we have managed to um chew up the 10 minutes and it is 4:40 p.m. so I am going to call the uh um hearing for 2170 tickle Road owned by Jennifer Walsh this is a two-bedroom repair with a bottomless sand felter and advant T um on a 6,780 ft lot represented represented by Mark rodri so we'll have you start the presentation absolutely know we have at least one at butter here who is welcome to um ask questions uh once the presentation is stand by by uh good afternoon Mark Rodricks analysis and design engineering before us is a a repair plan for uh Jennifer Walsh 217 o tickle Road this is one of the small Pils of land that are bordering the South W Tupper Pond uh she currently has a Cess pool on the property perhaps a gray a graywater Cess pool as well we are proposing to replace that with a nitrogen reduction pre-treatment system consisting of a two compartment tank is required by the pre-treatment unit the advantex it's an ax20 RT system they're popular that you've seen from me before so that's the system that's often proposed uh and that's discharging to a bottomless sand filter the sand filter's been designed and is sized accordance to the guidelines uh RM guidelines uh the lot is only 6780 Square ft we've got uh P site and a buing Wells all around we've got the pond so my efforts were try to get something in here that's going to provide uh uh an environmentally compliant solution to this problem uh again it's the uh advant system with a bottomless sand filter there are several uh setback related waivers that I'm looking for they're listed in the letter and on the plan uh most importantly are the setbacks to Wells private water Supply Wells which are less than 100 ft that includes the site well uh which has an offset of approximately 82 fet uh William Walch III is at 217p to the north of the property shown on the plan that setback is 76 ft and the third of three well set backs less than 100 is Mr Brian NATO 217r tickle road with an approximate setback of 73 ft uh and that is Mr that's behind us here so if he has any questions or comments we welcome that uh the second uh setback distance is the tank and the advantic system which are on the west side of the two-bedroom uh dwelling are less than 10 ft that's 6 feet for the tank and 6.2 ft plus or minus uh for the uh property line setbacks uh that is one of the uh three butter notices that we've got a green card back on setback distance of the tank to the crawl space which is on the north side of this building that was evidently a converted Garage on slab that was now living space uh and that is also 6 ft versus 10 uh for the tank to the crawl space the advantech system to the slab is 6 ft versus 10 uh to the foundation uh cross space and the bottomless sand filter is 7 and change feet 7.7 ft versus 10 ft off the uh slab Foundation uh lastly I've included the fact that we did do a Civ analysis that was performed in L perk testing so not a lot of room and when we're space constrained uh generally the bsfs provide the most environmentally safe and compliant solution we can come up with the property that's all okay thank you Mr Rodricks um uh green cards you turned over great thank you right over here those are the three um and we turn to Matt's report uh I've been over this a couple times and there's been uh there's no issues ESP can do on this very small lot okay one questions no I'm just here is this near the tbos is this where the tbos are the I see the peninsula yeah yeah just know that when we had the all the flooding that whole Peninsula was flooded it's just something it's wet it was wet when I was working it when I met Mr NATO it was wet it went up to I think their second second floor almost to the second floor so I just think about that kind of thing too when we're looking at these down down close to the water it was actually quite obvious to me that there's there's some probability of the excessive rain we've got we've been having problems in many places that haven't seen water issues before this is going in front of I wanted to add if I may this is going front of conservation at tomorrow's hearing so an RDA has been filed with conservation and hearings tomorrow okay great um I have one niggling little cool request um the F uh first general note about uh compliance with Title 5 yes can you update the date because we now have updated title 5 regulations from 2023 they are and they just they're actually officially on the books today okay yeah so just um or or eliminate the date with current Title Five is fine okay that way you don't have to worry um but it just I know you're very conscientious so I wanted Y and and I actually I looked at those and the revisions for the new one really don't pertain to any of the matters that we're addressing here but but yes it's an official promulgated date of just now so oh I I thought it was August I mean July of 23 this year yep I think you might be right yes and I've been leaving that note pretty consistent but I can catch that July of last year July of 23 yeah okay that was just a for future you know it's I'm sure it's fine here but got it just to clean it up okay um so Mr Nat do you have any questions or concerns or you would want to look at the plan I don't need to look at the plan I'm just more concerned about my my drinking water and is there a possibility it could get contaminated and if so what are we what are your yeah I'm going to let um Mr Rodrick address that and and and I he had mentioned to me when we met that he would he questioned that which is a good question actually um right now his uh he's got a repair system uh rather old repair system on record uh I do not have an as built for that but that shows his uh conventional system is plus or minus 80 ft from his well um and we're calling for 73 ft per my measurement my field measurement of as well and then I also point to two other facts pertaining to that the current cess pool on this property which is not good not good period uh is approximately 7374 I did not excavate it and dig it up but there 's uh evidence of hydraulic failure in the area that I've shown on the plan and that too was approximately 80 ft uh so and then lastly that this provides such extensive pre-treatment that I think any uh residuals going into the ground from this type of system as compared to what is currently going into the ground with the sess pool are uh are more significant and severe to the uh uh to the situation of potential well contamination so this I believe clearly makes it better than what's there in terms of protection of Mr NATO's well do we have any preliminary water testing and you have not well we will require three years of water testing of your well and the all the affected Wells and there are two there site well and one and a third additional well who does the testing pardon who does the testing um it's a lab comes out and does the lab um and the testing is paid for by the applicant here so you don't have to pay for the testing they'll come out um the lab technician comes out to collect the water sample at all three locations for 3 years years now how how many times a year is it once a year once a year so what happens after 3 years um after that uh it would if you want to continue testing you could on your own on your own yes um uh so to Circle back to what Mr Rodricks was saying is based the his assessment is that this is an improvement to the current conditions because the there's a uh the existing septic system if you want uh which is assessible which is provides no treatment is about the same distance as what the new system will be and the new system is an advanced treatment system um it's sort of like a mini sewer plan on property if you will um that should be an improvement uh because it's providing Advanced treatment compared to the cess pool that's there now um the other uh thing that Mr Rodricks mentioned is that your own SE septic system is also less than 100 ft from your own well and was about 83 about I think it said plus or minus 80 on the plan that I found from the board Brian yeah it said plus or minus 80 but it was sort of a a hand sketch so it's a pretty old your system might be pretty old um it sounds like um if it's not new yeah so so that's another risk factor for your wealth from your own septic system um that he can't control with this plan so um the variable of what's happening on this your neighbor's property should be an improved situation it may not guarantee um uh well qual water quality um I don't know if you've had it tested on your own in the past because there's still a a um a a nonconforming what we call non-conforming meaning your existing system is less than 100 ft that title 5 would currently require if it was new construction you know the standards have um gotten more restrictive over time because we've seen that the older regulations didn't adequately protect so um So based so on the proposal that's happening now that should improve but there's still other sources of potential contamination to your well so even that you know the data won't won't say for sure if it's not great um that it's because of that this property owner it could be from your own so that it doesn't trace it like that um but will give us an idea um um do you do is there I forget like a baseline test yes yeah okay so we'll have a baseline test before the um the upgrade so that that can be a frame of reference um so you might want to think you know depending on what that shows and what shows after a year of um service of the new system um and there's if there's still if there is a a contamination levels that are higher than we'd like to see what happens um you might want to have your uh own septic system assessed for the risk it might be posing to your well because it's less than 100 ft and if you upgrade your own system then you're providing an additional protection to your so basically say 2 and 1/2 years from when it gets put in mhm they test comes back contaminated what happens that uh we if depend on the level of contamination Our advice to you is to um you know treat the well uh not necessar depending on the levels and what the contamination might be um you know you have to um think about how you want to use that water um whether you need bottled water whatever but so basically you're telling me comes back contaminated Mr NATO you going to drink bottle water for the rest of the time you live there no I'm I'm suggesting that you might consider looking at your own septic system as a source um um and if it's upgraded then then you're likely to have improveed further Improvement um but um you know we can't yeah we can't guarantee anything um in terms of water well water quality um if you have no data now if you haven't ever tested you well or recently tested you well um we have no no knowledge of what its condition is at this point so um at least we're going to get data points that you don't have right now um to assess um the water quality okay next question for Mark I've got it's an Arian well and I know it's 100t deep does that make a difference in like making it better to stay cleaner since the contamination got to filter through that much more me to respond yeah I I believe that a uh a drilled well uh 100 ft or 100 ft plus serves much better protection from contamination than a handd dug shallow well and and saying if I drill it deeper would it get better I don't think there's anything that says that would be a yes or a no the code says get it 100 ft away M and then that's the that's what they I'm not going to say arbitrarily but that's been the rule for a long long time yeah and I don't think you've got 100 ft separation to put another well so you you're pretty much as far away as you can get from this current system and also your own right I think the Baseline water test that uh Miss Walsh will be paying for is going to be very telling to you to kind of put you at ease or more or less at ease in terms of how's your well and do you drink the water now sometimes yeah okay but I think that Baseline which will be a part of this outcome today uh is that we will be getting a baseline sample done and I think that's good for you to have anyway especially given the proximity of your system to your Ro not 100 more like you now where is it was how many feet from I I've got it at 73 from the closest corner of the bottomless sand 73 and that's about the same distance as your well to her cess pool which is definitely not good for groundwater MH and your well is about 80 but this is a pre-treated system that they boast you know you almost drink what they discharge to that system which I wouldn't recommend that but you know they it is it is about as advanced the pre-treatment system as there is local that I am aware of okay that's the best we can do here not square peg in a wrong hole Mr Nicholas got 23,000 Square ft to work with I got 6,700 it's not me yeah that's we this is a challenge in all small Lots um that yeah um there's just not a whole lot of room to maneuver um did we answer all your questions yes okay um anything further from the board anything else from the audience s take a motion um it's going to be a long one I move that we approve the plan for 2170 tickle Road owned by Jennifer Walsh dated 42324 for a two bedroom um repair um with the variances as written in the plan there are numerous numerous talk about laundry list a for a tight tank replacement in different location uh representative represented by o engineering uh welcome pleas state your name and um you can begin your [Applause] presentation good evening Mark Marano with o engineering uh 75 o la secon Massachusetts then I'm representing Leslie French uh for a tight tank replacement at 190 East Beach Road um so as a result of the storm that occurred ex I'll wait excuse me can let's just [Music] wait 2 okay I think we can we can proceed now thank you um 190 East Beach Road it had a current it had a uh a tight tank found right here actually relatively closer to the beach which was exposed during the storm in December um and it's currently just exposed out of the ground and non-compliant at this point so we would like to remove that and relocate it further away uh to the north um towards East Beach Road and uh what we did here is we have I believe right so backing up a little bit the tank that was installed was around 1994 based upon your records for uh 220 gallons per day uh what we're proposing that was 1,000 gallon tank put in now we're proposing a 2,000 gon tank with with proper floats uh this will be hydraulically ballast as well in tightly sealed up uh Rises we're proposing the the Rises to be concrete Hy uh sealed to the tank in raised a minimum of a foot above grade with cast iron covers that lock can't get anything more to tighten more than that so um and uh we're also uh we we're showing right here on their connection Point um concrete to encase the concrete so that it doesn't break off uh if there was a storm uh due to Velocity or anything like that um other than that then we have uh the replication of this of the dun of the grass that's and brush that's over there okay uh thank you uh Mr Mariana let me turn to um Matt it's a pretty big lock down on East Beach I know it ,000 ft pretty big well most of it's in the ocean yes at this point it is um yeah I think relocating the T closer to the road is a good thing um and I know the onm is integrated on the plan up on the top so that's good um other thing I was wondering is you did a SI analysis we did not no cuz we we didn't have a field did I did you do I thought you did a s analysis no no no because this had a tight tank so um there wasn't uh we weren't we weren't putting a field in that that okay it just references one plan a little bit so oh well yeah those are our standard notes from from if they were using Title 5 sand for a standard system all right so um anyways other than that everything fine okay I'm I'm just curious whether or not there are tanks that are certified for lack of a better word for certain uh you know s like a hurricane proof one or that you know whether they are there's any kind of um quantitative analysis that's done as to the level of intensity of storm as you were saying they were locked down you know the covers are locked down and I just wonder um you know even from a sales perspective you know they're saying well you know these are you know X andx Pressure uh you know pressure resistant so I don't think they have pressure resistant tanks or anything like that because um you know the the the intent of a septic tank is shouldn't be under pressure so it's not something that right right but what what we do in this case is we look at the external forces that are going to be placed upon that tank number one all right the high frequency of storms are going to occur in the winter time this tank should be empty during the winter time and so then we have a high higher buoyancy on that and we have some CS kind of at the top over here that we used a an H20 tank so that's a heavy duty tank that's one that you can drive over you know M so it's that that allows 20,000 lb per axle but it also the reason we did that was for weight weight purposes right so the way we do our hydraulic head calculations is that we assume that water level is above the tank on an empty State and we have enough balance in the system to be able to with withhold and keep it in place um other than that you know some things that you typically wouldn't see on on normal like parking lot application or anything like that like I I put right here use stainless steel angles uh stainless steel angle and stainless steel wedge anchors to Anchor the concrete riser 18 in around the circumference of the of the Riser so not only are they setting that in a bed of hydraulic cement which seals the the interface between the two but um you're also mechanically anchoring that to the to the structure um and then when it comes because the the Rings themselves are about 4 in wide which provides a nice setting bed for the for the covers so then you would mud that in and that would kind of all get locked locked in okay I mean I don't know how like oh and then the cover itself is bolted down so that's threaded that that'd be really hard to pop that off I would say the PO the cover would likely release from share off the the face of the the Riser before the cover would ever come off there's going to be Pumpers that aren't going to be happy with me on the bolts but it's kind of necessary in this case okay yeah okay any other questions um so this leads into um we are um going to be exploring down the road you know how we feel about tight tanks on East Beach because obviously they keep on popping up out of the ground and um the conditions are not going to get any better no we presume at East Beach um so whether we say you know even though Title 5 allows them is there a point where we say this is just too vulnerable an area so we're not at that point yet so we don't have any what I can say is if this thing pops out of the ground or if it's getting exposed this person doesn't have any place to go to CU the their Beach is gone at that point but that that's part of the concern is that you know you describe the amount of erosion amount of erosion that has already occurred and we had do we have three big storms this year that caused we had two and we one minor one right yeah and so to you know to the fact that part of the road is um going to need to be repaired part of the road is gone and and those are the kinds of things that are concerning to me from an environmental standpoint is um continuing to allow tight tanks uh is not really an environmentally Sound Decision in my perspective um but again we don't have um uh any kind of um formal regulation in place to be able to say I guess what what I'm thinking is that um you've had one except you know allowance um to replace a tank tank but I would say that this would be the last one and if if if it needs to be replaced then it needs to go to self-containment or they're relocating elsewhere anyways um um I don't know if we can do that as a condition but that's and we maybe don't need to do it formally but I just sort of unnoticed that yeah what what do you define as um self-containment the trails have generally will have self-containment Trail so this small holding tanks okay see all right so if want out they would take it to the down the street to the camp no a lot of the no a lot of the The Travelers will just drop there they're not mobile so um Pumpers come to them and they hook up and the tank okay um almost like a out house type of thing but if there's a storm coming the trailers have to come off the beach so we don't have a the risk of environmental contamination yeah yeah obviously so um so that's just my informal piece of advice opinion it's not necessarily a formal condition that we could put on now and we haven't got a any um policy or R change um separately um on this at this point um but it's a that's a closing window of opportunity shall we say yes uh okay any other questions or comments no if not um i' take a motion Phil you want to do it oh okay I um so I move to uh approve the plan for the installation of a tight tank um at the property owned by Les French is that right yep at 190 East speed Road it's a two-bedroom repair on a plan dated 4 2624 um subject to concom review um and consistent with the uh local upgrade approval Provisions uh for uh tight tanks um including limiting to seasonal use and and uh and that's it an hold harmless oh no hold harmless agreement yeah the O I have it here I just didn't mention it yeah yeah om m is required as as part of title five and as is the um deed notice right okay yeah so that will be accompanying the the filings right and yeah uh and then we will need the the omm agreement a written agreement with whoever they're going to use used
