Cummings Lane owns 200 ft of waterfront on the East Bank uh East Bank East Bank of the East Branch River gives 31 residences an opportunity to use the Waterfront in common access uh next to the Salt Mar over the last few years we've uh experienced significant erosion especially in the winter with some of the storms that we had and the Waterfront has starting to kind of wash into into the river we submitted a plan at your April 30th meeting and uh the commission had questions about how to prevent the plan impacting the title Zone and uh more wanted more detail to be provided so we we got avt Associates of Dart to come back and create a new plan which we're submitting today the plan is to build a new rock wall a minimum of 5 ft back east of the title Zone the wall will be 3 feet wide 4 feet high with a couple feet buried into the soil at our annual meeting excuse me on June 1st 2024 all 31 Cummings Lane residents approved submitting the plan to the conservation committee so that's why we're here now due to financial limitations c l corporations plans to construct the volum phases phase one which to protect the areas that have seen the most erosion are highlighted in red here so that's what we would do first and during construction we would use a straw area to Plate prevent straw or uh soil from washing to the river future phases would be constructed as funds become available this will this uh two-phase plan will also allow us the opportunity to observe how well this structure works before we do any more work further to it that's the South so we Cally request the Conservation Commission to approve this revised plan to eventually construct a wall across the entire prop okay I'm just going to put it over here so the camera can catch you okay sometimes gain this in for for others so can be seen on TV thank you uh Mr chairman correct this is a continuance of the Lanes Corporation Cummings Lane uh as Jack mentioned there's 31 residents within that area plans provided by avt Associates this is a notice intent with a file number given for SE 82727 the report date is July 2nd 2024 as well as a site visit on July 2nd 2024 I also met earlier with the the um land owners at the property to go over the Revis plan description of the work the Cummings Lane Corporation has revised the proposed plan for the rebuilding of an existing stone wall the new wall will be constructed further Inland of the existing to eliminate any salt marsh alteration the wall will be 3 ft wide and approximately 4 ft in height the corporation will not be financially able to build the wall all at once they propos to build in sections and progress with more as they acquire the needed funding the work is a preventative measure to protect the coastal property from title events uh flooding further Inland as a lot of properties have seen this winter resource areas impacted the flood zone Riverfront and buffer zone the reason for this continuance was the fact that the wall was trying to be rebuilt in the location of where it is and there is a marsh immediately in front of the wall this activity obviously would have been disruptive to the marsh so it it's recommended to leave that wall in place act as almost a barrier and build behind it so that is what this plan represents um that wall out in front towards the marsh and that fashion is not to be touched that again all that area was subject to 91 and is not proposed to rebuilding just DET terminous wall right along the edge of that Waterfront recommendations Westport conservation should open I should open and should approve the proposed stone wall reconstruction above mean high water and away from the marsh resource area with standard conditions for file number SE 82727 and I believe the date of the plan I don't know if I have the date of the plan Jack umed on May 10th 2024 thank you it's yeah it's it's on it's over I got it thank you if you leave a copy of the I have a small copy of the whole thing if is approximately 4 ft above high tide made High currently high tide current current mean high tide now as we all know it's has it has been going up a little bit over the that last few years right right so the top of the wall would be somewhere around 6 to 7 ft above high tide okay meain high tide okay I'll be the first one to admit that during some of the storms we had last winter and the year before the water has come up over across this road here and probably was maybe as high as 6 ft above yeah the norm the normal mean high side for for an hour right but but our our our of this wall is if you get a northwest wind or Southwest wind with a high tide it starts to really beat itself here and so I the barrier is designed by Carl we're we're hoping that will prevent the washing away the soil and into the marsh for that matter I the dirt is going into the marsh no no yeah I appreciate I don't know if that answers your question no it does it does I just you know just thinking about what would look like in 2030 or 2050 that's you know kind of it's hard to build I'm not about I mean because it just I'm sure it's not inexpensive to do this and so no it's not you know it's not the small amount of construction here is is about $6,000 to do the whole thing probably 20 to $30,000 right that's what I mean so you may think it's going to be worth a you know last a lifetime but it may be a decade you know that's what I'm just okay all right if I just may add Mr Jim through the chair it's they cannot build a barrier to prevent I know all storm action so of regulations do allow a minimist type event so we all I'm sure some people would like to see you know a concrete that was another 10t high wall and not have to worry about this for quite orever we would potentially say but the regulations do not cuz Again by doing this you exasperate potentially right increasing flooding to others so I think their approach is rebuilding something that's there but taking it Inland does I establish protocol on what we should do to maintain these areas or what we should not be doing uh in these areas so this is something to give the town some guidance which this Cobble policy Falls somewhat into play with that um but for this intense purposes there is a 10% match funds are required for this um I feel the wetlands fund has adequate funding obviously this community is a little strapped for cash and I think this would be a good time for us to utilize 10% match funds I'm thinking it's coming to about 10,000 $10,500 which would be our match funding so for the record Mr has been written by the administrator to try to adhere to some of their concerns um I I the only concern I have under what they're requesting is the fact that I think the materials should be divided between the southernly and Northerly sides of the road right down the middle of the roadway and not all southernly uh given to um discussing this with czm during our pre-conference for this Grant application she did not recommend it all going in One Direction um not to get into too much detail but the barrier is trying to adjust to climate change and it's doing so it's moving Inland which barriers do by us constantly pushing it the other direction in her opinion causes there to be more severe erosion uh than less so again this is a practice that's been going on for many years um but now since this past two events this winter it really got contentious um when the material wasn't cordially handed over um to these lot owners which again not getting into the legal part of anything the are proposing to put the material within the road layout and the owners of the properties would be responsible to move it to that point it's not to be spread by the town I have no problem with any of that again I only recommend that we make the minor adjustment that the materials be divided between the North side of the road and the south side of the road and not all materials go to the stly properties that is my recommendation and I would forward comments of that to the administrator for his in uh implementation in this final review of this policy scheduled for I believe their next meeting in July I just think this is going to turn into a nightmare for the town yeah you know someone's going to get more C the next person and the guy down the road is going to is washed more norly but it's going to get put a lot two lots down and I just don't know why the involved in it how I agree with it normally and subtly and what the chair is saying how do you what if a property owner decides they don't want or the the stuff on the South Side the South Lots owner doesn't want but the person on the North wants to Vice ver like what who's I mean how they are they going to fight over they think run a v plot on the Middle Road push to sides and whatever that's my recommendation fre Mr chairman it is becoming for a free-for-all they've they've chastised the town to the point where in my opinion for the record I don't think what they're making the town do is legal I think once that material washes it is owned by others and not them anymore and that's the regulation of um the action of accretion accretion is the accumulation of material in these type of storm barrier Beach areas so the law of accretion does not agree with what they are saying so but they've been very pressured by the these land owners and I just only wanted to try to make it fair that it was divided if the commission feels tonight that they think this is which again I don't find it to be very difficult to implement and not have contentious issues people were stealing the Cobble that the town spread they were going showing up on Saturdays with Bobcats and taking it and and it was just a free-for-all then they would the woman on the South Side North Side said you can have my stuff and they were scraping it off there to bring it to the South Side so the South lot owners think that this additional adding of material again I I think we all see why we're applying for this grant we're looking for guidance on a scientific point of view on how we can maintain this roadway or not maintain this roadway that's what we are you know discussing with this Grant application what is the town's steps in order to preserve or should we withdraw so all these things are going to be discussed so for the this sake of this Caro policy I thought it was just generally simple although we may not agree with it just to say we spread the material and divide it in half where we feel that some's going where the barrier wants it to go and some is going where the landowners want it to go and kind of makes it a medium so there's I mean on this on this point the thing that kind of jumped out at me as far as practicability of implementing it is that it requires the cleanup so to speak to um return the C to its point of origin that's the version that I written it doesn't refer to that and I'm trying to imagine how how is that possible to be done because it it's getting washed you know all over the place so which is different than the nor I mean I I do understand the what um they're saying about um you know that there's probably right more that is the volume of Cobble on the road is probably coming more from the south lot owners than the North lot owners so I'm not sure that even from a prac you know how dividing it evenly could happen I'm just worried from the town's point of view or giving lot owners to argue with the town about whether or not some particular bucket load of Cobble you know was delivered further than the point of origin and why the town would want to um agree to um you know trying to figure that out I just think you're I think it's too oh but I don't I also don't think I'm sorry I just I I don't know why they're asking the Conservation Commission to figure it out well I just think cut that thing down and you said well let me reiterate they are not asking this this was sent to me and I said oh my so if the commission chooses not to and feels that this is ludicrous in in nature and how is the origin this material they're not spray painted Phil is absolutely correct they round they roll so how are they to judge where it actually the physical origin could have been the Atlantic Ocean for all the intents and purposes so from the amount of explosiveness you really can't un again I was trying to be fair in respect to sentences to say you got to go down the middle of the road you got to push the stuff on the right side of the road to the right the left to the left and that's it you not and you're not you because if let's say you have more of these St from the the east side or gets pushed more westly you're not going to try to you know weigh it or how buckets on put in each lot you're just going to go with the plow you going to push it to the side of the road and let people deal with it yes well unless unless they don't want it and then in that case the to you just do what we last time put it on our lot which then created more problems yes so I say just split it down the middle the road like one or two sentences and you can't put it to the point ARS that's that's impossible because you don't know where it came from you just opening yourself up to a lawsuit by by agreeing to something like that and just say the right they're going to you know half the road goes to the right half goes to the left and we're done with it we washing our hands our job is to clear the road our job is on board about where the problem came from
