President this is an ordinance of the city council of the city of Williston Florida resoning and amending the land use map of the city of Wilston comprehensive plan pursu to an application by turning point Fitness LLC under the amendment procedures established in chapter 163 Florida Statutes changing to changing the zoning and future land use classification on the following describ property from residential duplex R2 to commercial intensive C2 on certain lands within the corporate limits of the city of willon Florida providing severability providing for a corporation on city maps and providing an effective date this is a quasi judicial not my first um this is a quadside Judicial um public hearing uh so the first order of business is to determine um whether or not there have been any expart Communications among any of the uh council members anyone see shaking heads no no no okay all right the next order of business anyone who is going to present evidence the evidence is to be submitted to the clerk um to be included in the record does anyone have any documentary evidence other than what's included in the agenda packet that they intend to present today no okay the next you guys have seen this before we're talking about the property that is owned by turning point Fitness parcel 05076 20 Z they put an application to change it from residential duplex to commercial intensive um the property to the north is commercial intensive the property to the West is commercial intensive the property to the east is residential duplex that's being used as a doctor's office that which is commercial and the property to the South is residential duplex approval of the reone complies with the Land Development code therefore staff recommends approval the Planning and Zoning commission recommended approval on August 27th and city council approved on first reading on September 3rd all right you have any Witnesses no sir okay does the uh Council have any questions all right correct it's actually the second reading of this ordinance you guys have seen this one before as well Mr President this is a quasi judicial um hearing the first order of business is of course xart Communications if there have been any among any of the council members regarding this item um if there's any documentary evidence that anyone intends to present on this agenda item that is to be President I'll give you guys a refresher since this is the second reading but you haven't seen it for a few months uh the city of woodison city limit zoning and future map use um future land use maps had not been updated since 2012 so you guys employed JB Pro to conduct an update um the vote today will um that's not quite right the state has already looked at it so you guys saw it in May um May 7th in 20124 planning so in April and then we had to send it to the state and attached to the agenda item is the letter approving it from the state and so those this is the last one to um to update it and then of course this is a living document we've talked about that a couple times so the zone you guys did a minute ago we're going to go ahead and put that on here but we just wanted to get all the ordinances that had been done in the past 10 years onto the maps so that we could have a more accurate look at what we're doing here all right more witnesses so Council see question for Witnesses we have none um anyone in the would like to speak on the matter close the statement by the applicant if desired uh the city was the applicant so um we just hope that you guys can approve this so we can laminate it put it on our walls and start using it giving it to people good all right um at this time you may ask a question so I'm sorry so when it talks about a fiscal the fiscal impact that negative or positive for well you already paid that that was a contract that you guys already approved um this process took us gosh about six seven months so that's already been paid there's no more fiscal impacts um I had a meeting with um Kathy about some issues that I had um and where's the where the actual boundaries were for the city limits uh mostly down 7th Street and where they back up just St hedge farms and she took those um messages those notes that we talked about that day and I never heard back so I don't quite know whether they were resolved I know I never heard back from them it's kind of why I asked to see a map earlier well because I can't tell much from this map I can't even read The Legend So the Stone Hedge does stop right behind it doesn't go all the way over like they that our map usually previous had okay so the change is there yep yeah because the previous map showed it going all the way out yeah we we confirmed it with the with the um County and we confirmed it with the owners of ston HED that that was not correct it only goes to that um it's kind of weird I know because that's one parcel but some of that parcel um is in the county and some is in the I thought that was the case that's why I had a meeting with her yes so I'm glad to hear that you were able to figure that out we did and we also had a couple other on that same area we had some houses that on our map were in the city but they were not paying city taxes and they did not want to be in the city so they are also hatched I think 66 there so those were all moved out of our city limits so they were never INX just what you're saying okay um the other question I had if I can think of it again it just went out of my head go ahead I'll think of it again go ahead any other question now I'm sorry go ahead of course you guys have annexed since we sent this to the state you actually my question I'm sorry yeah you Annex um so again this is a living document but um ever our comp plan is up in about 18 months or so we'll be working on that and this will be part of it so we'll make the updates before we send it to the state again um so any annexations that we do hopefully between now and we have to send it to the state again we will we'll have this updated but you guys did Annex in the old middle school and that is not on this one that was while it was at the state and I did not want to upset them in any way have we notified this County that we annexed it so that it they now in the city yeah we notified the county but um not the state that's all right I think that's part of what happened before is that we had Annex the property in the county didn't get notified so quick question about annexation so if you Annex something it has to be touching a parcel that's already in yes you said and said got wheeli I'm just trying to orient myself on this map yeah it's hard so you won't see this map again the one that everybody's looking at right now all those hatch marks and numbers are going to go away once this is approved and we're going to have a clean version of the real City Limits and the real zoning and the only zoning Changers are ones that we actually reading of ordinance 202 24- 736 Mr President this is an ordinance the city of willon Florida amending the city of willon code of ordinances as amended providing for amending chapter 18 Article 2 Division 2 section 18- 51 and section 18-54 regarding powers and duties of the community redevelopment agency and powers and duties of the city council providing severability providing for incorporation in the city code of ordinances and providing an effective date this is not a quasi judicial um hearing this is the first reading of an ordinance obviously there will be a second reading of the ordinance if it is approved tonight on first reading Laura I know that your name is listed here but I I don't know if you want me take it [Music] away okay so I think that we over a year ago probably longer than that um first had our conversation about the fact that your ordinances so if you look at page um 96 of your packet essentially what you're looking at here is the provision of your code that talks about your CRA and what powers you all retain as a city council and what powers CRA has if you take a look at 18- 51 essentially what it says is that all of the powers duties and responsibilities in chapter 163 are given to the C that's pretty standard language when you develop a c not entirely uncommon if you then scroll down to page 97 you'll see that section 18-54 now don't look at the underlines the underlines are what I've added to sort of fix this problem um also says that all of the powers under chapter 163 are provided to you all um as a city council so it a direct conflict um that the really needed to be addressed your standard of practice is generally that there are certain Provisions under chapter 163 that are outlined there's about four of them and they're outlined in um 163 358 which a CRA cannot wield things like declaring an area to be slum or blighted um demolishing or acquiring property um and things of that nature those have to be reserved to you all as a city council under Florida statute your standard of practice in the past with your CRA is that they've held all the other powers that are not reserved to the city council on under Florida statute essentially what that means is your CRA has been operating in spending the money that's budgeted to them without coming to you all for approval on every single purchase that they make of determining which areas they're going to spend their money on and focus their efforts on on you know what programs they're going to implement what programs they're not going to implement those are all powers that are generally vested in cras um the f that we have here is basically to put your ordinances in keeping with how you all have been practicing between the city council and the CRA for a long time just so that your CRA feels that they have solid legal standing and that your Council feels like you have solid legal St standing for them to spend the monies that have been budgeted to them and continue to practice as they have been practicing so this is essentially giving you all the powers that are required to be reserved to you under the Florida statute and allowing your CRA to operate independently otherwise as they have I'm happy to answer any other questions if that hasn't completely turned everyone around and he used you well I got any questions all right so basically we're just going to approve it like normal and just a motion and a vote yep so I will entertain a motion for the first reading of ordinance 2024 736 I make a motion that first reading of ordinance 20243 all providing for the permanent closing of the unimproved road right away just west of Northwest Main Street in Williston Florida with a partial ID of 048 0000-00-00 and approximate area of 0.053 acres in a description as in exhibit a finding that the closing of the road right of way will not adversely affect the public health safety or welfare provid providing for the repeal of conflicting ordinances and providing an effective date this is a qu judicial um public hearing so the first matter of business will be um any expar Communications um by any of the council members regarding this item um second item is what if there are any documents that anyone intends to provide um in associated with this item if you will provide them to the C cler now other than what's already included in the President this applicant um filled out an excellent application I don't know how he knew what to do and how to I'm sorry are you coming up to S um so all the legal information is in there there's a lot of pictures there's some drawings but basically this is 053 Acres of our city lands that they're asking to vacate so I'm going to let Mr McMillan explain exactly why hello Steve McMillan surveyor Williston uh do everyone know my office up the street which used to be a new youth um it was built in 1940 something it was brought into town from somewhere near the airport well before me uh Dr sbert had bought it and remodeled it in the early 90s uh a new you bought it from Dr sweber I bought it from a new youu and this entire time the front kind of from my sidewalk to the railroad right away I'm sitting on your property is what I'm doing I can spin in my chair at my office I'm actually on your dirt um it's just a vacation of the front about 20t of my property which was the old railroad right away which is not Northwest Main Street just a little clean up I bought it four and a half years ago and I'm finally getting around to it but that's all it is I'm just going to own out to the sidewalk like it would you would look at my office and say oh you own to the sidewalk back of the sidewalk and then there was a little cutout for loming Sentry Link and put a little Vault they put a little Vault out front so I go around that you still own the Vault and you own the sidewalk and I I would own this back the sidewalk everything behind it that's it okay does the council have any questions so show us in the picture if you go to page um 113 there's the aerial that he may be able to point at and then page 116 is actual survey where I was can't tell a whole lot that let's do 160 yeah see I thought it was the driveway but it's not the driveway it's the front side yeah wow for are there any other houses along North West Main Street that have Sr issues you so they put the house down in the middle of the right okay close enough for and I think what she asked is are there other Parcels we need to be looking at too bought it from there was a railroad rway map done at that time when you guys purchased it but since then there's been pieces taken far we did a little piece so they could get that little driveway around um all the way we might look at those other two houses as wellous to so if if we move you out you're to come up next to I would own up to the back of the sidewalk right are there any legal issues or um utility issues that so the staff they did look at it and they they're okay there is as he said there's a a fiber box um there but staff looked at it and there weren't any utilities in there see that's why I raised my hand and got smart I knew you going to ask that question um we looked at everything and everything we're we're we're perfectly happy with everything that's on on the uh application thank and my office is also R this has no okay so what what is the actual problem with the way it's sitting now well I'd like to own my off here um I don't know I guess liability purposes I from a chain of title standpoint as the owner future banking would like to own what I'm occupying and obviously if someone gets hurt if I fall down in my office I guess I can come to the city right now I would it's I don't I'm just asking it just fixes it I don't know it cleans it up yeah I I just the legal benefit of this is that this is generally speaking what whenever this piece of property was no longer being used as a railroad we should have done at that time so this is really sort of we've been operating and it looks like most of the properties there have been operating as if this has already happened because it would have been standard procedure for us to do it back then when we realized that our sidewalk wasn't going to go on that piece of property as long as the city owns the piece of property does that mean we can go into his office anytime we want I would not recommend that not regarding Mr McMillan sorry but um if a one of the owners of the other pieces of property that currently have the same problem was to decline to accept the offer for the city to give them the property they pay the additional taxes what would happen that just be left the way that it is it would public right never do it unless they came an so this was an applicant by Mr McMillan application so he asked us if I would bring it to you when we go into our downtown master plan on our main street we have plans to survey that entire railroad because we know that it's not right and we'd like to know exactly where it is so at that time if there's any housekeeping um possibly we'll ask and maybe we could do it all at once doesn't cost anything extra if we put an ordinance together and advertise it all at once so we could maybe do it at a discount for everybody yep I was just thinking more along the lines tax increases for the owners of the property oh um yeah the city of Williston Florida amending the city of Williston Lane development regulations amending section 60- 295 special exceptions for the zoning category or the zoning category residential business to add retail providing severability and providing an effective date this is not a quasi judicial um but it is a public hearing um so this is the first reading of this ordinance essentially an amendment to your Land Development code okay M Jones oh sorry i' like to hear your opening presentation so this is the first time you've seeing this one this is an ordinance to update Our Land Development regulations specifically our zoning um chapter 60 we brought this over to um Planning and Zoning yesterday we had a meeting pushed up a little bit because we want to try and get this done well before the holidays if possible so we're talking a lot about our downtown and the things that we need and one of the things that we found was our residential business zoning which is not there's not many but it is this downtown which includes like Steve McMillan's office um it's residential business and it doesn't have many options for too many businesses so what we were asking for is to add as a special exception retail the reason we want to add it as as a special exception is so that planning and zoning and city council have some control over what goes in there if retail does want to move in into one of these buildings right here just North of city hall you would be able to make a decision on odor noise what it's going to sell if it's really what you want downtown that's the purpose really of a special exception is so that you can have a little bit of a part in that since um this is a retail that the the building that we're hoping can the business we're hoping can come in is retail it's just like a a cottage retail with little clothes and stuff um so we thought that this would be a perfect opportunity to bring retail downtown which I know that everybody's asking for and do it in a way that doesn't open up the property to commercial which could be a multitude of things um this kind of just pin holes in just a few different kind of businesses are you understanding me I'm tired yeah because it' be nice if it's done as a little cottage especially since I mean they're moving along pretty good on the ivy house so the Ivy House is actually commercial um but this property is just to the north of the Ivy House which is residential business so you know we really just wanted to open up our downtown to a little bit extra retail and of course we had an applicant and the applicant came to us with a purpose this is not something that we hadn't been thinking about doing anyway when we talked about downtown but this gave us an opportunity to bring that that before you a little bit quicker to try and get this business in okay we need to swear so this one isn't quasa judicial because it's just the change to your code it's not specific property H web and I own the house that's actually the a really I mean I think they should have probably named their restaurant restaurant next to the I house but uh We've owned that building my father has since 1947 Dr Willis first hospital and U and then I I lived in it from 78 to 88 my family and then after that I moved out R to some people it was always Z at one time back in the day residential commercial and I actually rented it to the I house to B re the 98 2002 and then I didn't renew their lease and then I moved my office in it in 2002 ran it up my convenience grocery stor so and I ran office I sold my business7 and I just had it whole time I'm thinking in my mind that it's still resal commercial I decided I was out and assuming and actually I kind of think I knew that it was residential bus but I thought business what I was leasing into was for a business but she was running she was had a boutique just women's clothing and so forth so little knickknacks and everything and of course found out really soon City that not Z for that so they sitting they got a lot of money invested you they got all their inventory in there they got a lot of inventory in there for the holidays and they aren't able to sell and so requesting that special exception that special exception would be just as long as I have a lease for that business such time that they don't renew the lease and move out go right back to Z is now and we ever to do back it's not an ask anything right so right now we're not asking for the special exception unfortunately the Flor man has to come back two more times but um or at least two more times but we're right now we're asking for the change in the Land Development code so that we're not pinpointing his business that he can do this and other people can't and so that we can bring retail downtowns these these cute homes this is one way that we're um hoping that the homes if they do do go change that they have more options to have businesses in them and they don't demolish them okay so just adding retail to special exception that's all we're so give me a definition of retail so the retail is just selling Goods right so it could be like tires but the good thing about you guys is it's a special exception so somebody comes in and tries to sell say tires downtown right here next to the Ivy House you guys can say no for what reason can we say no and what reason can we not say no so the special exceptions um just make me feel better about that yeah and that's why we wanted to do this we did not want to make this commercial property we could have easily just because Ivy House is commercial but we just wanted to keep with our downtown um so special exception kirston do you have that in front of you but there are there's a whole criteria it's traffic control traffic and yeah there's a whole criteria when you get a special exception application those are part of it um so the criteria for this one is the Conformity the existing land use pattern and all those things and then the special exceptions a little bit more in depth um can you say if he has a special exception for retail and it's for that Boutique when that Boutique out then it goes back to normal it goes back to residential business you don't have that exactly so if he bring so we're not not talking about his special exception but I but um yes so if he if if a business moves out of residential business and another retail wants to move in um I don't want to pinpoint any kind of business that's like that you guys wouldn't want because you may want them but if there's something that is unts for downtown or something you don't want say I don't a wine store I don't know P hul for example right well that's not retail so that's why we don't want it commercial that's why I want is there a definition of retail anywhere in there no but retail the commercial would allow a pool haul okay retail is literally defition of retail not in our Cod so if we're going to add retail should we not have a definition of retail we can do that it would make me feel better about it I can tell you um because I definitely want them to do what they want to do but it's a great place to do it yeah I mean we can do that before second reading but I when we're talking about every retail yes we're talking about every RB RB we're talking about the whole yes we're changing the land that's what we have to consider you know that we're talking about everybody at this moment right and every time a retail wants to come in they're going to have to come to you and ask permission for the special exception so they move out and somebody selling leather goods would have to go through the whole process again okay Mr Don I just want to mention this is very similar to a variance if you think about the board of adjustments right someone comes in and they go I'm I'm too close to the the setback and I want a variance for that that variant sunsets under special conditions okay and this is very similar to that so you know it could be because they destroy the shed so now because the shed's gone they can't they have to reapply or they have to go back to the previous setbacks that are in the code that's how this works so it's a case by case but it allows you to do it for anybody within the code who comes and applies for it so I know where there are some residential businesses can you kind of tell me where yeah if we go to the map we just have yeah I don't have a map that's my problem there's not one in in the packet we have the future land use and the zoning map I can't read it it's too little so almost all the residential businesses are right here downtown um pretty much from Steve's South to um their property and then there's a couple across the street they're the orange ones we'd really like to add that Z like expand that down that Corridor I mean I know there's a one over here too on yes first AB I know there where there's one there which I'm perfectly fine with it's in a great place for that kind of thing I just don't know if there's any others that I'm not aware of yeah so right on first where where you're thinking of that um it just goes down a couple blocks and I know whe there used to be someone who had a hair salon in their house I don't know I assume since they've moved out of that house that's no longer I don't so RB do you have to live there no okay it there was somebody who tossed that around um so right now in residential business can you rent to someone else or does it have to be the owner I've heard something about that too doesn't have to be the owner right the owner can rent it to someone else that a true statement yeah I'm not aware of any restrictions okay so the residential business district is intended to allow modest unobstructive selective infusion of service establishments in conjunction with continued residential uses such mix uses shall be low traffic generators and shall be the scale that will not conflict with the Tranquility of nearby res res es so you're just trying to blend some business in with a neighborhood and that's the reason for residential business versus commercial and I mean originally I thought that we did residential business you had to live there and you can have a business in your residence but that's not the case anymore is that what you're telling me I don't see that don't know that it's ever been that right okay no I mean the first ones that I know of that we did in city of Williston they were there were people that that lived in the house and they wanted to have a business in their house yes now keep in mind with on that particular topic yes ma'am there is and has been recently legislation about homebased businesses which is different from your residential business zoning category because a homebased business has to be primarily a home secondarily a business with a lot of other qualifications in order to qualify under that that statute but technically all of your residences could correct and you cannot stop that you are prohibited from doing that but technically all of your residential could have a homebased business that you could not stop but because residential business is sort of a different category okay thank you for that clarification you have anything else M Jones you have any questions any more questions all right between the first and the second reading I would like something that shows me all of the RB the map uhhuh you want a map or you want a list if I can read the map and it shows me where it is I'll be fine I just can't read The here at City Hall either by phone or email or in person a lot of people have simply expressed concern that they'd like to keep the naturistic um natural look of Peggy O'Neal and they thought that this type of activity would be better at John Henry so all I want to do is before it it it's almost here it's going to be in here probably the end of the month before we go ahead and do the work and set up the lights and put it out in the park I just wanted to make sure that uh Council didn't want to redirect us to take that equipment that's been purchased and put it in John Henry or you prefer us to put it uh and leave it at Peggy O'Neal um I just wanted to make sure we're clear because uh like I said we got a lot of comments on it so we're just trying to make sure we do what the community wants to have done so when did we purchase oh that would have been earlier probably uh late spring uh we brought up the it was the eight pieces of it doesn't require any electricity it's the like elliptical machine and the situp bench and it's the pull-up bars and it's it's all the free style exercise and it goes out kind of around the path with the design eight pieces throughout Peggy O'Neal so that as you're walking the path you can stop do sit-ups you can stop do elliptical you can stop do sit-ups you can and so that's that's what it is and as I said uh as we've been waiting for it to be ordered uh and shipped uh before it got here we just wanted to make sure that that's what the direction that you guys wanted before we do an install okay Mr Mayor thank you Mr President in my view and I use Peggy O'Neal a lot Peggy O'Neal is a natural park and these items that were purchased with good intent would be much better served for the community at a place like John Henry park that's my opinion and I just wanted to counsel the know I could just say that the comments I've had about people knowing that it was going to Peggy O'Neal especially the people that were in country laning states were really excited that it was going to be there and wanted to know when it was going to get there uh I do have concerns about the flooding there um and putting the machinery underwater um and being able to keep the water out so that is what I have to say but they were really excited um about it being there I also think of John Henry Celebration Park as being a children's park so I don't think and especially if you're going to put a spash pad I think we're getting really crowded in there um so I don't know where there's a good place for it I don't know what color it is what it bit into nature without being obtrusive yes we we did a a deep Brown and a green a hunter green oh cool that was chosen as the primary colors uh again see we Have No No Agenda here I just want to do what the community wants like I said we've gotten feedback from both sides and because it seemed to be controversial we just thought you know before we take the expense of putting down the concrete anchoring it we just wanted you guys' final input of what you'd like to see cuz uh that way when they blame me I can say it's y'all's fault well the Country Lane States people are excited about that and they're excited about this pickle ball tennis court that's not there yet but they keep asking when that's coming too those are the things I hear from my neighborhood do sorry can they put it in their location you mean in the same park with the with the tennis court and pickle ball is that what you're saying it probably would fit there but there's not really a good walking path there I mean that's not something that we consider but that's a really neat concept I mean you're doing tennis you're doing pickle ball you're exercising I mean it might not be a horrible place at walking distance there are lights there as well Mr Mr yes sir um so when I was um living in Savannah there was a park on the North End called Daffin Park and it was about the size of a park we have um that there was a perimeter run all the way around the park and like Donald is suggesting you would run about a quarter mile the whole Loop was about a mile and a half um and about every quarter mile you'd have a piece of equipment um and so I I mean Cornelius Williams would be a great place for that to be in my opinion not Peggy O'Neal I agree with him can William has a pretty big walking Track it does but I hate to say this out loud but we have so much vandalism out there I don't know if the machines would exist not I know that they're breaking sinks and they're breaking toilets I hate for them to break this equipment so are we going to disenfranchise the park because we're having issues correct I don't agree with I didn't say that say that at all do what so the being like I am not yes you are I said things get vandalized there I'm not sure the equipment would be better placed out there where we can't watch it didn't say anything about disenfranchising can't watch anything I haven't had any I haven't had any reports of any vand vandalism out there lately unless there's something Donald that you know haven't been told to me um Cornelius Williams is already designed it's a it's done we're not adding anything else it will not work so that project is moving ahead if you want to change the plans of Cornelius Williams you let me know and we'll do that but as of now it is not designed to have a running track around it or exercise equipment and this is why I don't want to make the decision well like you can't just throw a track around a design park it is walk not run P walk but like Mr Sting said but he was talking about a part where you know go every quarter mile and do that um if you go around Lake Alice University of Florida they have that um yeah where my wife grew up just what he mentioned it's very similar and that's where the concept came from outside of Houston a small Park in Meadows Place I mean he's right I mean you just you go so far and there's there's equipment like I said we don't have a problem putting Deo Neo we don't have a problem putting it anywhere that yall would like it's beautiful equipment it's going to be something that everybody's going to love to use um but we just need to before it gets here and before we put expense in we need to know where it's going and you know this is possible action so you guys can think about it come back and you know maybe have some more discussion or input um doesn't have to be necessarily decided tonight but I can give I can let you know that we're planning on getting it I believe uh very last couple days of September beginning of October oober there's concrete work that needs to be done for anchoring but I just need to know where to do that and so I mean you know we're more than happy to have any direction on that okay of course please state your name where you're from Sir still live in Willis I would like if if you all are not going to put it where you intended on putting it to still consider can Williams Park because there are people that jog and walk out there every day and it's large enough that it would fit and yet not be so close together all around that part and uh I don't know that I didn't realize that we're planning on cutting out the jogging and walking trail uh at canius Williams that was not part of my understanding I will get a quote to redesign Cornelius BLS Park and I'll bring it to your next meeting we leave it where it is so I I do want to say I No Agenda here if you want to do cornelus Williams just keep in mind that we can't install it until we get to the next phase so because I can't put up the equipment and anchor it and then have construction going around it storm water retention and changing the orientation of fields so if that's what if that's the direction the council wishes to do just keep in mind it's going to have to kind of stay in boxes and in storage until we get to that point of the development because you can't it's not something I can tear down and reset up tear down and reset up um my comment was related to the fact that if it's not going where it was originally intended right if it is if it is going where it was originally intended then I withdraw my comment but if it's not then I'd really like you to consider conelius Williams Park okay Mr Ste do you have a question U yes sir I was just going to ask Donald how many pieces are we talking about so it's eight pieces eight eight pieces so like you said it's it's uh meant to go every quarter mile on like a two mile track and that's basically how you set it up well and you know it doesn't have to be two miles but you know you loop at eight figure eights all that kind of stuff yeah what what did we pay for oh um give me a second here and I'll see the paper in my head um $ 13, like 900 I believe is what it was well you know don't ever quote me on this but that seems to be a reasonable amount of money we had to buy it again we could put it somewhere oh absolutely I mean this is something that you could put in another Park absolutely um matter of fact I think it'll be so popular that people will request it in some of the other Parks maybe on a smaller scale or even a larger so as I said the countryland states people are looking forward to it and I'll give you an update on the tennis courts not to sway your opinion any but um but that's what I'm saying look at mean it's only eight pieces is $133,000 you know yes ma'am and we'll we'll be afford 14,000 you know come October November December and I do think it's a great fit in a lot of parks I mean they have them all over in other places I've been um some are more popular some are less and um but uh if anybody wants to see a local example I believe the the Mary Sue Rich uh facility in Okala they have them out and about and jervy Gant has them as well like I said I mean they's someone always on a piece of equipment they're Hardy enough to where I mean even if kids fool around on them you're not going to get anything broken so maybe maybe Mary Mary L Rich they're they're in the Nature Park that's kind of connected to it there's the swamp walk and all that I think they're kind of spread out a few pieces there uh the new mayor had a large part in that Mr Mayor Marciano had a a large part getting that stuff out there he's big on exercise um he one sec you done Mr Barber okay please state your name where you from Sir name was Henderson I am from Florida I'm a city employee um the city of chap had the same tight deal just like that um at the CH high school for every quar mile they had a workout bench or a stepping ladder or they made it more like a nature workout type deal everybody utilized it back in the day until Che kind of closed it off to the public you had to go around parking lot P would be ideal for people are going out there to exercise anyway stretch walk if you place these equipment throughout P Meal instead of just one section so I have to walk over here to get to a do a workout after walk over here aach you know just do out just to change it up but make it was accessible to the public but yeah did everybody okay thank you could we let's say we started out at Peggy O'Neal and after a few months people aren't using it and then I'm not sure your time frame on how long for Cornelius Williams if they're not using at that part we can transfer the equipment all we're going to have is concrete pads to well there's lighting I mean because you need to light them um for security purposes I know we have dawn to dusk but if someone were to go into park they you know I think Chief would want to be able to identify that area where the person was or when they drive by see someone over there you know in the times that they're not supposed to be in the park so there's lighting involved there is a foundation of concrete so I mean the cost of that we had you know in the I told you the equipment's like 139 then there was not to exceed so that we could do some of the site work right um that was in there as well that you guys passed so it's kind of those two things combined I can get you a more specific number but they're not typically uh because they're outdoor and they're commercial and they're kind of an industrial piece of equipment they're they're not as easily easily movable as you would think um they're actually anchored so I don't know what kind of damage it would be getting the equipment out because it's not just about bolting there's parts of it that go you know get it encased okay um so I I don't know how easy that would be um I can ask the manufacturer again this might be something you guys want to table it maybe and when refresh my memory so when will we start onus Williams again it's with the county um we're waiting on the county and then the bid goes out takes about 25 days to advertise and put out the bid bids are 30 days then there's person that's awarded the bid that you guys choose the contract so and and by the way that's phase one so that's the grant that's the 486,000 even if she gets released the fur the Furs the community has really said they want that money kind of going toward a pavilion out there so that's you know that's already planned she's right there would have to be a redesign because you're talking about a Sports plex but you're talking about active uh organized sporting events and so it's very difficult we'd have to change the Museum location and the fountain location and some of the orientations of facilities near the parking to refit that in there that's what you guys want to do that's fine but just keep in mind we already paid right Pierce to give us a master plan on that Park I apologize I did not know that you would have to redesign the whole dog on Park to put that equipment there well I mean like I said it's we're trying to get master plans on all the parks that one was the first one we did and we paid for that Master Plan I withdraw my comments on it then because I don't want to see us drop back and start all over again at Cornelius Williams I mean I want to see us moving forward and I I'm not saying that it's not possible to have it out there I'm just saying that we would have to we'd have to look at the floor plans so to speak and see what we could do in regards to that um yeah I I mean now I will tell you there's places in corus Williams plan where we have little designated areas that are like uh spaces where we didn't designate specific to the activity like they didn't know if they wanted it as a dog park or they wanted it as a shuffle board court or they wanted as pickle ball there was a couple of small little sections but that kind of defeats the purpose of this or a splash park that was the other thing we reserved for there but that that kind of ruins the ability to to have it spread out which is kind of as Benton mentioned is kind of the uh uh purpose of this type of equipment so the path would have to be redesigned I I do agree with lur on that for sure um so again if you want us to have right Pierce give us a quote on that we can do that if you want us to put it in John Henry we can do that if you want us to put it Peg O'Neal we can do that you want erson we can do that you want it in uh the the tennis court area we can do that I mean it's that this is this is why I brought it because everyone has a different thought and we've gotten so much input once they found out we had it and obviously with the town everybody wants a piece of it unfortunately we only can do this in one spot at a time right so okay because once you guys build the park to the master plan that's going to be done up front you could come back and add that well again if you look at the master plan and we could have that at another meeting it's the path the path that people transverse around the different sports areas it's not really conducive in its current space with the museum and the fountain to spread out the equipment now that could be changed we can move around some stuff but that's what an engineer needs to do okay um and then also we need to obviously understand that all this was submitted to Swift Mud and the county so you also have regulatory agencies that say look we designed the storm water for what this plan is if you go and you change that plan you may have to start Dennis is not here but you may have to start part of that process over I don't exactly know what the stipulations on that are okay that's not city of Wilston by the way that's federal and state so call your legislature what we have right now and if we need to do it again atas Williams or anywhere else we can like that I think we can find the money if that time comes I'm pretty comfortable with saying that I could probably find the 13 or 14,000 to do it wherever it's beneficial throughout the city um you [Music] know when it's ready yeah when it's ready before you decide to move to the tennis pickle ball courts maybe um we he need to have that yeah all right now that's not an option so we want to we're going to move forward I will I will find you the Mone all right so just for the record we're moving forward with the plan as it was intended yall do me a favor put two L's on the end of O'Neal yes ma'am because it has two Ls yes ma'am my mistake Mr O'Neal what Happ that so we entertain motion technically you're not changing the plan so you really won't need a motion if the plan is to continue with the plan thank you all right the last one r r discussion with possible action discussion forming a charter Review Committee to review the charter and make changes to the city Charter that's mine um as I in the have gone to meetings as well as other Council um it's been interesting to listen what other municipalities how they have um terms for their Council people um their president how they do it they were say they were shocked that we only did twoyear terms because they said how do you how can you get anything accomplished in that amount of time you get somebody new who comes in their first year they're trying to figure it out well their second year they're getting more into it but then they're going to worry about well if I want to run again my intention is going to be on getting reelected so other places have done three and four year that's what they've done for their Council people um I think we need to kind of look at everything as far as with up here at the dis um the uh I've mentioned it before only to hear we don't need to change Charter um I wanted to get the date from Latricia when the last time this Charter was changed so I am um open to forming a committee rather it's all of us or with residents uh we've had that that's been brought up before um and I'm going to do that but I'm going to let Mr Bard say something so about it couple things that please don't don't be offended by this anybody but it's it's it's difficult to you know get a city council member up to speed get them where they feel comfortable have them understand the budget um only to lose them in the next p mon right so so it's difficult on staff you know and particularly the city manager's office you know always doing that always getting you this is what this means this is what that means y all feeling comfortable making decisions you know so obviously you know for us the longer term that that you can be the better for us um it just works out better for staff and for me and administration because you know we're here y'all get used to us you get used to what's going on you're more informed about the budget you understand the budget process I mean you you're facing the same battle I faced when I got here it took me a year to go around that curve and it was a long steep curve right even to have Stephen sit down and give me why are we recession first why do you keep saying we're recession Pro and have him sit down with the budget explain to me this is where you get this dollar this dollar this dollar this dollar and although we may be hurt here we will still be fine over here um and those are the things that y'all don't get the privilege of doing something that obviously I had to learn pretty quickly um you know the other thing is some of the training classes that you know I've gone to you know in Florida leag of cities that they they'll tell you you should review your Charter every couple years regardless of whether you're making changes or not um so I think there's some people that are in Conant uh told a story of one person that one city that just threw out their whole chter adopted anothers I thought was pretty radical but um that's what they did you know so you're looking at your processes and improving your processes and it's something Chief in our both very used to from from other places we've been doesn't hurt it really doesn't it doesn't mean you got to make any changes it does mean that look we've gone over it we've looked at it again it looks fine you know maybe we'll tweak this and do this and so that's kind of my little two bit little of information um I think it's counterproductive to have a twoe term I'm just say I don't know how else I can say that other than I wish it was so and I can say that the bo meetings that I attend for Florida Le of cities people are shocked that our mayor doesn't have a vote they they don't understand how we operate uh in in essentially a weak mayor form a government that the mayor doesn't have a vote because all of their cities do that they have a a mayor and a vice mayor instead of a president and a vice president so there are lots of things we could consider or our committee could consider uh from all the way from the beginning to the end as they've said we need to review it from top to bottom I agree you know I've been trying to get one going for years I fully agree that we do need Albert Fuller by the way and I'm still in Willis think you've been here too long Mr so funny I fully agree that there needs to be a charter review but let's not just let's not just focus on Counsel although there's some things in counsil that probably do that do need working on but there are the things that in the way the city operates that at least the citizen should have an opportunity citizens and Council should have an opportunity to review and potentially make changes and you know one thing one thing that always kind of baffled me is that you can you can run for an office if you don't win that office you just play musical chairs and go to the next uh go to the next office next time it comes up and available and so we don't know what you represent or you know it's like you basically are just moving from place to place and doing uh and doing business there and not actually having a place or place or portion of the C of the city that you actually represent bothers me that uh that we don't and that we don't run we don't run in that way uh in which most cities do not small ones small cities some small cities do most but just from Florida leag that I've been but the fact is that just because they don't doesn't mean it won't work better that way and that people won't get proper representation but it at least needs to be considered but then and that's not a point to be argued tonight but the fact is that there are other things that that are in this city that may need to be looked at not necessarily changed but may need to be looked at and so I think it's it's very important that we do review that Charter and see where we are and at least bring it up to bring it up to hey we reviewed it two years ago or we reviewed it a year ago or whatever such as things change and even as opinions change then we need to be in tune with those changes what's so crazy is it's only like 12 pages long and it runs our whole city that's what's so crazy Mr President if I may the process to start a charter review is very quick the process to go through a charter review is very slow so if this is something that the council is interested in my recommendation would be that you instruct me to come back with a resolution if you all want to what what I will need to know for that resolution is are you all going to operate as your Charter Review Committee or are you all going to appoint a charter Review Committee if you all operate who want to operate as the Review Committee I can draft a resolution to that effect if you all want to each appoint someone or appoint people in in some other kind of way then I can put that in the resolution as well now it does you don't have to make all of those decisions tonight before I bring you a resolution those are the decisions you'll need to make can it be let's say I would like to see Mr F can it be residents and part counsil it can be I I didn't understand so to form the committee can it be part Council and part residents I mean you can have a committee as as big as you want if you want to have the council and residents on the committee then then you're welcome to do that if that's right I wouldn't recommend just having one or two members of the Council on either the council and members of the public or just members of the public because essentially how it will work is just to give everyone sort of the 10,000 foot whoever is your Charter Review Committee will come up with their proposed changes to the Charter then those proposed changes will come before you all in the form of an ordinance which will then be read two times so you all as a councel outside of the charter Review Committee will see an ordinance which puts on a ballot referendum thank you yes on a ballot referendum right yes so you all will get the ordinance two times if that passes then those changes will go on a ballot referendum and each individually will be voted on by members of the public so you all are are involved in the decision making one way or the other um so I will just put that out there for you all I also know that we tried this process two years ago a year ago um and one of the problems that I think that we ran into was that scheduling was a nightmare and also we were trying to do it during budget season which was not um smartest idea we've ever had that's why I waited till we got out of budget I mean we only had one more hearing was to bring this up okay because we have until April when our next election is yeah that's so just let me know and again doesn't have to be tonight but those are the decisions you'll need to make do you want the council to be the Review Committee do you want Council and members of the public or want just members of the public appointed by you all and then how many and who's going to appoint okay just before I bring them a resolution again you don't have to make those decisions tonight but I can't bring you a resolution until I know what those decisions are okay so then at our next meeting guys got some homework figure out how we want to do it because if we sit there and we just come with different reasons well we can't do it because of this we'll never get it changed and I've been trying for years no so that's that's why I wanted to do it bring it up all right public weekend with Fiesta Fest so we will have a booth there with JB Pro so we need public participation and then we'll also have a booth there with our animal shelter I'll try to get some more doggies adopted Dar is is and the mayor they came out to our last one and they had a good time we actually have five dogs from that event that got that got reh homeed so that was great and one mayor that fell big part of that was when we had gone down south because our meetings would came back that one week was such a short week I get that I understand that that cannot be the excuse or the reason um we need to make sure that we do better on our agenda and not have us out three hours doing an AG I mean doing our duty to the city some um some places do consent agendas right where they a whole bunch of stuff together and you vote vote on it as a whole you get the opportunity at the beginning to pull something off the consent agenda put it on the regular agenda we could do it that way um the only way that's that I see that probably would work is that um and although I don't mind it's going to be um a little more oneon-one with me with these item so you understand this is going on the consent agenda are you okay with it do you understand it you know and talk to you about that and then you I can lck six or seven things on I don't there is I mean because think basically the whole half of could have been on a consent agenda if You' chosen right the whole first half of your meeting before open public hearing everything before then you could have had you chosen put on to a consent agenda voted on as one item items on open hearing Miss I'm saying I'm just saying because we typically I guess get our our stuff around Friday and only have three or four days and when it's a lot of information it's a lot of information that have to try to go through and then have to come sit here and go through that information I was just going to give you an example real quick uh last week Donald and myself uh and Jim Willis attended the Marian County Commission meeting they use the consent agenda format their agenda was three times as long as ours 17 pages and we were out of there in less than 45 minutes but but to add to add to what Chief said Maran County if you remember this uh last first meeting that we had we all had a meeting on Tuesday theirs was normally on Tuesday but they moved Theirs to Wednesday because what happens is the day before the meeting which they couldn't do on Monday because it was a holiday which is why the meeting was pushed uh not to violate Sunshine every single commissioner met with the senior staff and all of the questions that were asked tonight would have already been asked and that's why they're able to go into that meeting and have that consent agenda because all the questions all the ambiguity you know hey can I have this map can I get that answer all that was pre-done um and that's why they're able to move so quickly but we had 17 pages and they got through it in 45 minutes now all I can say from the staff end is we're really busy and we're doing a lot for the city so I understand what you're saying and I don't want to be here either I mean I'm sorry I don't get paid for all this so I agree with you but some of this stuff's time sensitive we've got contracts and things that have renewals and they have to get done it's like the disc muler we were going to lose it if we didn't get it on and as Terry mentioned he pulled six other items four of those were mine you know so I mean I understand what y'all are saying but at the same time we have deadlines to hit on these things and we only get these twice a month so so the only other thing is that for the planning department we try to push everybody who's mentioned they want something done before the holidays so that the holidays are light so the so from now on planning should be light because we don't want to push things through when people aren't around right so this is why mine was so heavy because I could have moved a couple back but then it's going towards the holidays and then I feel like people are worrying about me trying to get ordinances through when nobody's here I don't know it feels sketchy to me nobody as far as who the council the citizens yeah because they're not going to show up to a meeting a lot of yours are time a lot of yours are timely too well the gr you're trying to get stuff done for the businesses and for the property owners usually those go a little bit faster than today um because usually you guys just approve grants and then the um the zoning usually you know isn't too bad but that's one of the reasons it was a little heavy too because we couldn't wait any longer we already waited I mean if y'all want to try consent AG it we could do it the next time the chief's car could have been consent yeah the grants could have been consent because bur out yeah there's no cost I mean yeah if we talked to I made a brilliant speech you all corrected me you did make a brilliant speech but what I'd like to what I'd like to suggest is maybe that if there were a summary somewhere because yall were able to summarize very very quickly and easily what was on the budget separating out grants from the departmental budgets if there was like a oneliner across there're just doing that it would probably be easier for the citizens to make a to to make input because this is a public hearing and just that that would be a lot easier if citizens were able to look glance and maybe have input or not and in that case last week I probably would not have had input other than to say I really appreciate the fact that departmental budgets are really where they should be so thank you thank you m Fuller anybody top of the hill where are we with that and I I guess I'm don't know whether it has staff or attorney I function on addresses I'm so sorry I'm not which one is the top down um old pawn shop the one that we own okay so that's that's you guys then yeah I think that staff I just don't know where we are with that so the demon uh demolition is pretty much complete we have the two palm trees that we need to relocate um right now we've contacted uh Mr Hendry at the uh North Florida Economic Council we've sent him a bunch of information this week as a matter of fact to start building a proposal for Council to sell property but to sell it in a way that it's developed in in a way that everyone would like to see um he told us that the timeline on that was not extensive we're hoping that within 30 days we have an RFQ to present to see if you guys would like to go in that direction and we would present that um either lur or I would present that and bring it back to you all okay just want to make sure we're still mov it was assessed uh Latricia got all the assessments back so we have all the comps and everything for it terrific and we do have an appraisal for it right yes you remember what it was 120 so how about the one across the street that we were on the verge of following aeno so that one we do have a suit that's been filed we're effectuating service currently um family members have reached out I think that I gave you that update yeah um recently so we're working to see if there is potentially something that we could do to um get the property cleaned up get us reimbursed for our demolition costs and and see if we can keep Court intervention and a at a minimum so we're we're working toward that right now and obviously before we have any agreements or any settlements it'll come before you okay um Also regarding John Henry park that's not on the agenda um I'm still looking for a volleyball net not there I'll check one more time before I came tonight uh and I had a report that there was a bathroom door that got stuck and somebody actually got stuck in the bathroom I don't know if y'all know about that and if so anybody looked at it uh we'll look at the door situation the volleyball net has been ordered okay perfect that's all I have thank you right anybody else with all right Mr Mayor I just wanted to to be known that on the 25th I will be going to Le of Mayor meeting and I will not be available several days September 25th all right item five new business presentation lead service line inventory Mr Donald Barber president uh Public Works supervisor and Dennis David right Pierce just in time sir that's a good Tim in there isn't [Laughter] it am service so please state your name where you from all that good stuff all right Dennis Davis with right Pierce and I'm here to talk about the let service line inventory project so um yeah we could go I think we've got a presentation up there if we could get to that page 11 so I always like to do these we come and talk to you all about projects and things that need to happen here in the city and it's always nice I think to come back and revisit them and kind of let you know where things stand and and uh you know we on the Utility side of things the the guys are the guys and ladies in the utilities department are faced with a lot of mandates things that um the government is making us do and this was uh the case um if you remember uh EPA has um a policy for you know lead lead pipes and everything they outlaw lead within our drinking systems back in 1989 but um after Flint Michigan and what happened up there with lead being in people's uh portable water system they put a new emphasis on it and really identifying that lead in the system so if you go to the next next page please so as you see there there's a rule with fbe and from EPA it's called the lead and copper rule um and um you know it it identifies that you're not you're not supposed to have it in your system um you know it talks about lead service line cop pipes with lead solder are uh are a potential for getting lead into the system galvanized pipes a lot of times lead was used to pack or weld those lines and so those things have been identified as sources keep going down to it um next next slide so um the after Flint Michigan as a reminder we went through all of this part of it before but um after Flint Michigan um EPA came out with some new rules for the revised lead and copper Rule and uh became effective on December 21st or December of 2021 I should say and there were some specific requirements in there for every municipality and and not just municipalities but even anybody any private company that has a water system that provides Waters to people uh to to drink and so um as part of that rule um there was a requirement to identify LED within the in the water distribution system and um it's huge huge requirement and it's a you know unfunded mandate basically they the EPA through D said you have to do this and so um we worked with Donald and and the troops to come up with a plan to do that ultimately we have to provide a final report to D by um October 16th so just next month where we go out and and have a value valed all the all of the lead all excuse me all of the services within the city to identify lead so um we did a deskop analysis using GIS the property appraisers information to identify houses that were built after 1990 we could Clearly say that those were after the lead Serv the lead rule was passed so we took all of those off of the uh off of the inventory here's just a small uh example of of the information we got we there was over uh 2,000 records that we had to look at um to assess um again we used the the County property appraiser data to to as a first step on on that process um next slide after that we had to go out and uh actually look for those that were before 1989 or before 1990 we actually had to physically go out and look at the service lines where they come into the house we had to look on both sides of the meter the said you could look at it two sides look on at on the customer side of the meter and on the Utility side of the meter some of the houses we were able to get right into the meter box examine the pipe on both sides determine was it lead or was it not lead um sometimes we had to go outside of the box and dig holes outside and look at the pipe out there um so I think we ended up with almost 1,500 um spots no I it was more like 00 where we had to actually go in and dig these up so um R Pierce had a crew of two people up here for several weeks we were averaging about 50 units a day that we would be able to get through and examine um and we finished the work uh just a few weeks ago and uh the good thing is after all of the work that we did both through the desktop analysis and through the fieldwork we have not identified any lead service lines whatsoever yeah so there's no I didn't want to interrupt you you were giving us such good news uh I want to make sure that I understand because I was in this area During the period all of this was happening it's not the copper it's the lead solder there there's copper has nothing to do with it is the solder and they made us stop using lead solder for a period and go to Silver over solder only and that's when the new age kicked in and they said well that's not going to work we need to do something else so it is not the copper that's right well copper pipe is correct we're not worried about the copper pipe right but right if we are worried about you know is there lead solder out there and there is a lot of lead solder I just wanted to make sure I understood because this thing said copper and lead a number of times instead of saying lead in the C right okay yeah um right now there are still 14 addresses where we have to do a little bit more work um there were some of them that were just inaccessible it's done so what's that it's done okay so we're working with Donald to get those 14 taken care of and uh and ultimately submitted I'll be submitting a report to d uh and then ultimately EPA um within the next couple weeks we uh I was working with our GIS team to develop that report and get it submitted um tell you a funny story yeah I found two people digging up a line at the church and they were not in a normal spot where I knew that there was a m but they were close um and I said what are y'all doing and they they said they were working for the city and I saidwell you're not working for the city who are you working with they said right Pierce I said you said the right word and I wouldn't let them go about their business of course but it was really funny similar funny story my mother-in-law came home the other day and said I scared one of your guys she said I went to to uh uh ace and I saw the rap Pierce truck up there and I went and banged on the window and one of your guys was in there and I scared the heck out of so yeah I want to ask another question you know we had a lot of discussions about this and part of my concern and I voiced it at the time and I never really gotten clear on it we're just doing the service lines we're not talking about going into the house where all the lead solderers use throughout the house and making the homeowners repipe their house AR we are not no okay thank you I mean in the big picture you know this isn't a foolproof evaluation that that we're doing throughout the country I mean we can't dig up every foot of pipe we're not looking at connections I mean there's big concerns about the connections out in the street um you know we know there's some potential issues with that here in the city and and we have a plan to address those in the future but we we're meet we've met currently we're meeting the the requirements of D and the EPA we're going to have the documentation prove it um we're working with uh utilities you guys recently started using Diamond Maps the information is going to go up in Diamond Maps it's going to be provided to the and then of course one last piece of it was when we we gave you the proposal to do this work we had funding that was going to come from the city had to to provide some funding for this project but we also got funding from Florida Rural Water and so um so yeah just to finish on this slide we had 2,173 total service lines identified on our our um self spreadsheet through the property appraiser 740 of them were eliminated based on the date of construction so that was just simple look at it and it's done um 463 were eliminated because they were behind a Master Meter and all of the construction was done after 1990 this is of course Wilston Crossing and we our team investigated 970 out in the field zero lead service lines identified and the last point that I was getting to is initially Florida Rural Water had committed less right around $70,000 to the city as we got into the the submitting the documentation and everything they actually had some extra money so they've given you more money um I haven't I don't know what the final tally is yet I've got to work with them on one final invoice but you're going to get more than the money they had originally promised so that was a good another good uh outcome of the project and with that I think I'm finished if unless anybody has any questions any of council have any questions no sir thank you for the report it's good news we don't need to vote to accept it or anything you're just going to file it Item B resolution of the city council of the city of Willison Florida establishing authorization for the city of Willison to approve the contract for the wastewater treatment plant gate purchase and installation from Genco fabricating and not to exceed $25,000 and providing an effective date Mr Donald Barber Public Works director uh so due to the need for increased security uh Public Safety and inventory control the sewer plant and uh the utility Barn uh needs to have an improved entrance and exit gates to be installed uh now right now we're only actually requesting the sewer plant be done so let me make that very clear this isn't for both of them although both will eventually need to be done the urgency behind the sewer plant is that we now have folks living in homes uh families that are right there at the gate and the Country Lane Estates so what we're wanting to install would be u a gate an automatic gate um and then for security purposes it would require the same badge uh that an employee uses to get into this building for example in order to scan and have that gate open we'd be able to track who's going in who's going out um but primarily because the sewer plant has so many shall we say uh uh risky uh facilities I mean there's oxidation ditches there's digesters there's things that have zero buyant so if a child or someone were to crawl in there um it wouldn't be a question of can we save them it just be like when we recover the body because I mean nothing can float in some of those scenarios um so I just with the houses moving in and whatnot we went out we did our due diligence we got some quotes we did get a quote below the requirement for putting out an RFP and we would like to actually go with that company they're they're very reasonable actually um you'll notice the bid on the fence is lower than what we're asking we do need some money uh for it to go in and then actually install the badge recognizers you know the the actual uh components to the gate uh that open and close it but all the work here for the gate uh and the mechanisms to open it uh the chain and all that is included in the quotes so we're asking Council to allow us to move forward with that uh this would come out of uh some of the uh Capital that we could either use through capacity fees or uh I know Steven was spoken to with Terry and uh this could be funded out of regular Revenue so just depends on which direction youall want to go on that okay I've got a question jco when I look at their invoice it doesn't tell me much of what they're going to actually do I mean you got gate Canever sliding um chain link 2 but SL gate operating system um La were to install the gate and when you look over at the one that Billy Stanley did it's pretty in-depth detail of what they're going to do is there any way we can get that from Jenco so we took them out and we asked for all the same criteria they all put in a quote for the same things um the reason I mean I to be honest with you I mean we could ask but this is what they've submitted uh uh they they didn't break it down any further than that unfortunately um we can go back and we can ask for that but uh to answer your question okay yes Aon do you want to elaborate on that yeah I spoke with him about this all of them and got the quotes in a nutshell they're all bidding the same thing is to install the gate which is just a chain link gate bar wire on top 20 ft or whatever the distance is and and the appropriate conduits for the wiring for the controller that that's they're providing a controller to open the gate and installing the gate that's really all they're doing the pedestal is going to come up where the card readers are going to go and then the rest of it on us to do so no matter all three of the quotes were for the same thing a 20 foot gate installed with the pedestals and the opener and there was a considerable price difference between all of them except the Genco and that's why we wanted to go with them yes that's what I was looking at the difference they're at 148 14,800 where Billy Stanley was at 26,38 did we get a third one yeah we we submitted we contacted yeah like five five or six other companies and nobody would come out and bid on it so that's the only two we were able to even acquire okay but they were both for the same scope of work it's essentially like the airport gate except with a different opening mechanism well it'll probably be the same type of mechanism just they're going to use a card instead of they would use a card instead of punch number yeah but the reader would be different but the controller it may be a different brand from one to the other but it's still just a gate opener so they're installing basically the gate and the gate opener and the pedestals for the card readers the scope of the work was the same regardless of the company okay thank you sir so I I have a question um so we're talking about I know we're talking about doing both gates I know we talking about that but we're the 25,000 we have here is that there up there we're asking for to do both gate no sir so we wanted to make sure y'all knew that eventually we come back and asking for the other we're going to ask them to honor the same prices um but we're only asking for money to do the sewer plant because really that's all the money that's available right now so um and and the barn is a little bit more of a controlled environment you know we have Poli Department fire department next door we have more of City assets around it the sewer plant really is the higher priority with the neighborhood now right there by the entrance so do we know how much I can see the $14,000 bigger but how much more is adding the electronics going cost is that we talking $1,000 we talking $8,000 well that's why we put not to exceed the 25 because it could the card readers and all that could get expensive and we have to put in conduit and we have to do some electrical work to the gate which doesn't have any Electric to it right now so it was priced in to do the extra work on the city side that we would need to do as well ballpark anywhere from 3 to 5,000 probably okay I just wanted to and I like to do not exceed because sometimes we do exceed on things we have no control over them prices and bids we got from a year ago finally get around not getting around to doing it but having the opportuni for the price to do go up but yeah okay do I have any questions move approval of resolution 2024 d84 can still discuss that I move resolution 20248 can I get a second a second any other discussion yeah just a quick question um so you know everything that you're possibly going to need for that have you looked at any prices it's basically the same same equipment we already use at to open doors and stuff here all the control equipment is the same so we basically already know the rough pricing we're going to need the wiring May adjust depending on what distances we're running wiring but we have none of that on hand no and are we doing the labor yes they're going to install the gate with the opener concrete pads whatever it takes with the pedestals and put in the conduits we're going to wire the electric we're going to wire the control system up and bring the power to the gate okay I'll comment that I was all right that I was recently out there and was able to tour it and the gate that there is there a child could definitely get through and there was I think very recently a city employee that fell into the Maran County waste water and it wasn't mean made news so it's not a pretty thing yes he passed away I have a question yes sir what was the actual cost difference I can't remember I read it was it 26,000 when 14,000 so you're talking about almost double that didn't bring any red flags to anybody we uh didn't have any red flags because like I said we we tried to schedule with four or five other fence companies and none of them would come out um I guess it wasn't an attractive job for them or they didn't want want to give a quote so those are the only two quotes we could acquire I think if we' had gotten a third it would have been a good parameter of you know where why why they were so far apart I I don't know I think the red flag would be if we wanted to do the 26 yeah to me 148 is a lot of money if I can 148 is a lot of money but 26 the difference in one project that is so closely defined yeah causes me to wonder why there's that big a difference if it was 3 or 4,000 no problem unless he was biding both of them no that was just one and I I know both of these individuals and that just that's the price they gave us for the same job yeah it's a highly unusual difference in such a small project to have that larger difference I mean he broke it down very specifically the top half is 12561 and the bottom is 13,825 for a total of 26386 I mean he actually has the timers and the loop detectors and I don't know that all that was in the second bit it it's all included it's the same same scope of the project is the same well I think what's not included the jco bid is the 3 to 5,000 we discussed it's going to cost well that would the the other three to five would have been on top of the other bid as well yeah so there we're talking going from 14 you know 18,000 almost 19 so there your difference is about 6,000 7,000 where the other one correct me if I'm wrong is putting in all that stuff no sir no it was the same same scope of the project and scope of the bid was exactly the same and the photo eye all that's in the other one yes ma'am okay I thought I saw that is a big difference yeah the card reader is not here it's the it's just a pedestal for the C reader yeah ped anybody else got any questions all right we've got a motion we've got a second discussion all right I move to vote this is Stephen I'm here hey Hey Stephen Chief RS uh we're discussing the uh the purchase of the one uh law enforcement vehicle would you like to give them a breakdown on how we come up with the uh money for oh sure yeah it's on um uh 24 page 24 of the agenda uh so the the police department and that also includes uh the police dispatchers Department uh have some additional budget that that's available this year uh within their you know their original budget um and so what we're doing is we're reallocating those funds uh to be able to purchase um this vehicle you know using just what's in the budget uh no grants no you know nothing else um so it's 100% funded with the the current year this is a a one-time you know deal there's no no guarantee from year to year that there will be some available funds it just so happens um for 2024 that there is so that's kind of what we're presenting to is to to reallocate you know or amend to move that these items down to be able to purchase a vehicle he answered my one question was it this year's budget or next year's because I didn't want them to be short all that for next year so no but in fact we all recognize that because we're doing so well our grants are going to dry up in the police department you've seen it you've seen the change I expect in couple of years we're going to be like some of the other cities no nothing we we're already there um USDA is pretty much uh a done deal for us I mean we rode that gravy train for a long time and city manager can vouch for that and uh you seen how it went from 75% 25% 16% to we're just not getting it there so uh we did outo diligent this year and Tred to prepare for something like this so there's a lot of other things we could have done but uh we know that vehicles are important because we have to get the calls and officers have to be safe so uh we're just asking the counsel to allow us to purchase the vehicle I do have questions so and I know because bring us up because it's happening to us all over the place um the quote was back from I know the car is what it is but the quote for some the equipment and stuff is back from like February um I mean do you want to put add a little extra in there to make sure I know we have the resolution but are you firm on the numbers or yes uh the numbers you should have had an updated sheet did I okay are we are we good yeah we did an up she thank you for checking on that though that was the only yes thank you I commend you for saving all that money throughout the year so that you have it available to buy the e thank app our Florida Recreation development assistance program we try to go after Whenever there are funds um this is one of those we put it in we do a lot of work we have a lot of public meetings and then they either fund it or they don't don't fund anything or it's it's kind of a picky thing but we're going to try and get as many points as we can uh we're going to go after $200,000 for improvements at erson Park Mr Mayor please tell me that you didn't say we had to put $2,000 in and and hope we got a grant for it is that what you're saying we're going after a $200,000 Grant I understand that but you what were you talking about we're going to have to put certain things in to to improve our points just we go for it um we have a some Public Funding or some public meetings that we have for points um there's a couple different things you just want to try and get as many points as possible and we're going to go after it it's only a two week open Period so I just want to make sure that we weren't talking about spending $200,000 and hoping for a grant to get it back yeah so this is um one of those grants where you spend the money and then they give it back to you so and and we don't have um we have an agreement with Fred Fox and they take all of their funding out of the grants so we don't have to spend any money but we're just applying so we're we were still not even as B no we're just applying for it I'm just telling you guys we you know it's one of those things where we either everybody gets it that year or nobody gets that year so um going for it we would have to come back in front of you with the actual Grant the application the application the award what it looks like what it's going to cost the city out of our pocket and we could say no so so when you write this grant what's it going to say for erson Park uh we're going to do um Donald and I are going to get with Fred Box this week and we're going to do the final plans but he can tell you some of what he's talking about we want to do a major cleanup of the Pond out there clear out all that debris uh get the snakes out there possibly do a walking path around the pond uh Revitalize some of the monuments possibly look at a pavilion we we have to look and see what the design dollars will do for it um but we want to obviously take out what's left over of what was once the skate park reutilize that space get the bathrooms back up and running and make sure that they're functional put some work into the basketball courts so we just we want to revitalize and make it a space that's open that when you look at it from 27 we're not embarrassed from it and just make it a really usable space I talked to several homeowners in that area who tell me when they go in the park It's Not Unusual and I believe of our working people would say the same to find needles in the park uh that shows you the deterioration from not keeping the park up that's my point uh when when you don't keep your Parks up the wrong people start creting them so we do try and mow them and we do trim up but we're talking about basically removing all those trees and I think it's the kind of the Hidden nature of that area uh because it is a big storm water retention area that we're never going to change but what's unique about erson as opposed to some of the other dras is that it has a water uh basically water in it all the time so you know we we want to do some sort of device in the center that will make it spray and kind of do sort of our little version of Tusa uh Park in Okala something that has a water feature and that people can stick a cane pole in and you know it's a place to go each of the parks we're trying to develop a theme and erson would be something where we would look at um kind of having like a family reunion park The Picnic Park if we were to talk you know about a place that people would gather to visit with family or friends so that's kind of the theme of where we would like to go with with that I can't ever see anybody fishing in it well I'm not saying I said a cane pole yes you did and and you know the thing is is there's a lot of people who just want to stick a pole in water they don't care what comes out on the hook so I wouldn't recommend eating anything that comes very deep too I know how deep it is I used to I'm talking very deep Turtle alligator mosquito that's things can still come out of it are you planning on still leaving a fence around it yes ma'am we would just have the fence updated and more attractive and not look like it's surrounding a prison yard and I don't hear very much recreation in there other than the basketball court basketball picnic gazebos a dock that kind of goes out um walking paths things of that nature that's what we're looking at it's it's uh we've got a we've got a we've got a couple of weeks to get everything together together obviously you know whatever we were to submit we would obviously have to come back and and speak with you all about I just know that they dug it out with the drag line and it is extremely deep yes ma'am and I don't know that I'd put a dock or anything a fence is exactly what I would put I don't know that we need to be doing any recreating in the water please Chief RS I I have a question and it's totally off off the this park but I'm happy that we're doing these things for these Parks but I would like to know where we're at with Kus Williams so we have a fer app we have a $50,000 fer app out there for a uh picnic some updates to the water um fountains and some little things because 50 doesn't get me very far and then we have a half a million dollar Grant out there to update the soccer fields the in and the parking lots um it's a slow um process because Swift Mud got involved and they pretty much told us that we had to put almost the whole entire park turned into a retention fond and we were upset and it took a long time for them to come back with those those answers um luckily Walt and Dennis were out in events I think Dennis was there Walt and somebody was at an event and they heard another um resolution that another part came up with was Swift Mud that was approved so they went ahead and redesigned it a little bit saved us about 100 Grand and reduce some of the pond sizes so at this point Walt is getting ready to RFP the work um to move dirt to get those parking lots done and to um work on the the baseball fields and the soccer fields and then we'll go ahead and the the 50,000 f app I got that what two years ago and I still don't have the contract it's awarded they've told me it's it's a real thing but I still haven't gotten the contract for it so I can't spend that money yet until I get that contract I just wanted an update on it because I we've been talking about it for a while and uh you know there's been very little action so I was just wondering we're talking about doing all these other Parks I just wanted to get an update on that there there's been a lot of a lot of work on it a lot of work on it but it's all administrative and it's all regulatory after it went from Swift Mud and they approved it it then had to go to the county because that Park happens to be in the county so then the county has it and the county is actually the one that held us us held us up more than anybody else so that's one of the biggest problems with Cornus Williams it was just the bureaucracy that we had to work through um but again there's after this fur there's another one here on the agenda so we we're trying to address all the parks every single one we're trying to give them all kind of an equal share of our time and have some sort of real plan to go after for them so again what's the plan for Cores I mean youve said a lot of things cores Williams has a master plan that we've presented to council before and we can give you guys all copies of that and basically it's um it's the Sports plex that's what's in the comprehensive Plan and there's uh two baseball fields or softball fields there's uh a re uh redoing of the uh uh orientation of the football SL soccer Fields there is walk arounds there are um a whole recreational area that can be developed and there's a lot of ideas on what it can be but there's a whole recreational area for smaller activities um there is a a a museum that's proposed with a gazebo that museum uh a replica of the house that Mr Williams lived in uh we've got scans that have all been done of that house so it can be recreated and we've saved a lot of artifacts and uh personal items that his family's allowed us to hold so that when we get the museum built someday we can actually have some of his stuff in it we uh would be talking about a fountain on one spot um we talked about the main entrance becoming the entrance off of 318 that's in the master plan and then and then the memorial wall so there's there's a lot of stuff in that master plan we can get you guys copies of of any and all of that so the master plan changed I mean brand has been three years almost three years since I've seen the plan so it's changed a lot from the initial it hasn't changed at all it's always been a sports FX the only thing that's changed is you're going to see a lot more retention a lot less retention no you're going to see a lot more retention well from the initi when she saw it yeah I don't think we saw any before yeah I didn't so my question would be when we're doing the best we can okay okay thank you Mr Penny can't hear you can we find out about the tennis court some safety or a fence to put around the the big old sinkhole back there there's a 30 foot drop off and like I was riding around the other day on the golf cart and I think my three kids coming out to stop down by the tenant at erson which one are we talking about the tennis he's talking about the tennis court i f already can add I'm when when you saw those kids trespassing and C crawling out underne there did you call the police department they would already over they were already coming over I mean it' be nice to know if they were the same on no he did not no I but is there a way we could address that and try to get that it has a fence they must upgrades pardon I said that depends on who you ask keep going I was just GNA um I think we're going to do a splash park out there and whatever else Donald wants is still flood is the reason I made that comment I think we actually got something on theend we we do you know with uh we've seen a lot of rain in the last two weeks more so than what we're used to get and I think it's when we have heavy rains like that we're going to have flood no matter what we what we do we trying to prepare for I'm sure Mr PNY can attest the lack of water he's receiving now right all right could be no could be about it we have pictures and videos I can show you Miss Jones was that everything that you want to say related to that Don Henry is um we've had a we've promised the citizens of Splash Park for I don't know 10 years or so and we think it's like the perfect place there'll be some other improvements it's not going to cost $200,000 for a splash park it'll probably be fairly small we we we really would like to start thinking about replacing some of the playground equipment if you're at wondering what we'd like to do with the rest after a splash park uh the playground equipment's getting aged we had to remove uh two pieces just recently that were so broken and the cost of repairing them is almost as as expensive as replacing them so we removed two small little toddler items from John Henry we had to dispose of those so after doing the splash park we'd like to start thinking about replacing the main structures of the actual playground equipment have you already started looking at prices or do you wait to do that once no we' we've got all that research um we've got four different types of sets uh picked out and they range anywhere from 26,000 up to about uh 57,000 it just depends on what options they have how many slides how many swings what their footprint is so um we have a bunch of different sets that we have that we've been looking at pricing out getting quotes on you talk about the water I think she was talking about splash park yeah I'm talking about all of it yeah I I could tell you the splash park Latricia and I have uh on the same page in opinion that we want big one so and the mayor doesn't want one at all and you know I want one I've been talking about it for two years yeah but I don't know where we're going to put it are are we going to have to take something out to put it somewhere I don't think so no man we're looking at the plans and I mean there's there's a lot of different things that we could do we could rearrange playground equipment if we're getting new stuff um that playground equipment could go to the South uh West corner or we could put the splash park on the southwest corner and just shift the volleyball court slightly there's plenty of room for it there the big thing is we want to make sure when we put it in that we add a little bit of parking um that's one of the biggest issues so we're going to be looking at kind of adding some parking and then figuring out and and we would you know obviously have that engineered out in order to uh you know buy the materials and plan the job and all that kind of stuff so I don't know that anybody uses the handball court um I think it could probably go and that would be a great place to put it and that was kind of why I brought it up because I don't think there's any other place to put it but there yeah we're that we prefer the southwest corner if that were that is the southwest corner um and and I just like you have heard from Neighbors you know where are you going to put it what kind of traffic is it going to bring where are they going to park yeah we we know those concerns and we definitely want to make sure that we don't add something and then cause another Donald Barber public work supervisor a thank you Mr President so the city of Wilston streets and parks a big push this year is to really focus on our roads and our our easements um really improving uh as people transverse all parts of town uh what they drive on and what they drive next to so one of the tools that we would like to do um and this has multiple purposes but I'll start with the roads is an attachment to the skid steer that's a disc muler we've rented it before to do some clearing um the times that we've rented it it actually went out to do some work out at the airport um to clear a bunch of areas out there uh one of the main things that we've got in the budget this year and we've got a u a proposal uh going out and that is for the gas extension of the line for natural gas uh into the airport and um again we could either pay for land clearing we could either rent this or we could actually purchase one by the time we've rented it all the times we've had almost have paid for one uh right now Ring Power has one that's used um which is much cheaper than one brand new it's in great shape uh through Ring Power they warranty it and all that great stuff uh they came back and they wanted of course over 25,000 for it and I told the gentleman I said honestly if you do that we're going to be at an RF RFP so he went in talked to the superiors asked them to drop the price below it they've dropped the price below the $25,000 threshold and then of course we've given you competing prices if we were to go out and purchase a new one through another supplier including Ring Power if we were to buy a new one from them as far as um other types uh or other uh uh questions as to the financing um so I'm happy to report that uh the gas buyout from the town homes uh that that those funds have cleared uh they've come in and so now we're looking at how to use those for uh you know Capital toward gas and because we're going to be using primarily dis multure for that land clearing to come out and provide that line for the gas to be installed we'd like to purchase it out of some of that money that came in so I have that break down below uh funds to be used from the town homes gas bi was 179,00 we spent 880,000 of that uh this year on the northwest Gate station that was completely redone uh and then we are now asking for the 25,000 for the dis muler and that'll still leave 74,8 for Revenue that goes specifically into to gas infrastructure so um we're asking for this have a lot of uses roads the gas uh airport work anything in town that we need to do some land clearing and uh I think it would be a great opportunity and I think we have it at a really good price for R do like the idea about using it out at the airport for like the fence lines because I know there was a couple of them that I saw where trees and things were grow going into the fence um cost a lot of money to replace that fence so we can use it to keep the lines fence lines on inside and outside providing an effective date on Barber public director thank you Mr President so uh going back to the gas there were two issues in last year's audit that the uh Public Service commissioner um decided to kind of say hey these are improvements I don't want to ding you on them I don't want to write you up on them but one of them obviously was the very poor condition of the Northwest 7th uh Street Gate station that was the 880,000 that we've spent to redo that entire station it's completely brand new every bit of it it's online's working fantastic the other thing is is that every month uh at six points in town we have as just part of our compliance we go around and a special machine and it takes a read and tells us how quickly under a certain number it takes before the nose can detect uh the smell in the gas the mer captive and so um we're required to do that test we record those numbers we monitor that that machine is over 10 years old and one of the things that he asked because it can't really be calibrated as well as he'd like and they no longer make it was to get a new machine so went out talked to Florida gas utility and other gas uh Municipal providers said hey what machines do you guys use um we could only actually come up with a couple um a few and then the one that we actually had recommended to us was actually surprisingly one of the least expensive so that is the heath uh odorization to methane gas um Cal with calibration so um again in order to meet compliance here when the inspector shows up here in a couple weeks we'd like to say that we've moved forward with both those items okay Council have any questions all right I will entertain a motion for approval for resolution 2024-25 sir second second Mo any other discussion right we'll move to vote I'll do my best to explain this as quickly and easy as I can um this is to renew the contract that's expired for our current C Link internet provider that's the wholesale internet we purchase from to redistribute um we've negotiated it down to 700 a month less so it's an $8,400 a year savings and being this is working on being replaced our existing internet that we currently use for our services at the city is reaching end of life and going to expire their contract and they're not wishing to continue that service so we're going to need either a different service for that or we're going to use this in conjunction to have a secondary connection is the plan once we don't use it for C link anymore okay anybody have any questions no all right I will entertain a motion for resolution 202 24-11 not written properly there are three or four on here that are not that are written this way um that I read I didn't mark them all but there are it says that the president is going to approve it uh that is obviously the council has to approve it the president signs it U it's just a technicality but as long as the resolution itself and I I'd have to go to the resolution to look um it needs to be properly written before we sign it I would believe so the way that the resolutions are written and and I I don't necessarily disagree with the point the but if when you read the entire title it's the council provides authorization for the approval correct so it still vests the power in the council itself to provide the authorization we C whether you call it approval of the purchase whether you call it signing of the purchase execution of the purch purchase the the plain reading in my opinion is that the city council provides that authorization which is you all's power to do and that is exactly how it run the council the president cannot find something that the council does not approve that is that's my point exactly yeah and to me it doesn't read that way at all I know you're the attorney but when it says here that the Wilson city council president is to approve right establishing authorization by the city council for the president to approve we we can change the word approve to execute it they means in my opinion the same thing but if certainly no no legal difference to me if we if we leave it this way it it could very easily be changed later by one person whoever that president is would be and like I said there are three or four that are written in that manner um the rest of them are all written so that the city council get the president authorization to sign but that's what this says too it says we're authorizing the president it just say but we authorizing so how can another president later on come back they still can't change without us if the plan changes it says here the president can approve it in my opinion I agree but but it's never been written that way before it's suddenly changed I don't know why um maybe a mistake legally that's why I keep bringing it up okay way it's written I believe that legally my opinion is that the wording of this resolution is the city council providing authorization for the president to approve execute sign pick a name I'm happy to to change the wording I think that it's just my a different word than I typically do and my apologies for that for any confusion that that's caused and would the president not be a representative of the council yes but it do it by well I realize that correct the res this resolution would be the only thing that provides the president that power independent of the approval of this resolution there would be no power for the president to do that in the same way that we use the resolutions generally so I'm I'm happy to to make that change in the future yes that would there we can make sure that everybody's on the same same L thank you okay so Mr Barber yes Mr President so um we brought this up earlier tonight it's a recommendation of the staff to provide a small fence or barrier along the new drain uh retention area in John Henry Park um we would prefer not to go with chain link because of how it would look um any chain link fence like any other barrier you put up somebody could climb over dig under it's the point of liability of having the barrier and having appropriate signage so we would like to keep the very nice look of John Henry we'd like to have a nice Uh Wood picket fence that's you know 3 four feet tall that's painted uh that we can mow around we can manage um again uh it's also a lot less expensive to do the wood fence we can do a lot of Labor for ourselves um and uh so that's that's the recommendation we're making I have the price from lows typically with this price point we didn't have to come to council but we obviously with the controversy we wanted to make sure we had you guys' input and knew what direction you want to go if you want me to price out chain link we can go that direction but that's going to get a lot more expensive what would be the life of um the wooden Pence Asos to CH it's pressure treated it be on pressure treated 4x4 is anchored and as long as the paint maintained on it it would last for a long time so would the picket fence be would the uh boards be side by side or there's going to be little gaps everything would be completely a couple feet in from the sidewalk would be the fence the entire Ray around the pond with two gates that would be locked so that the mower could get in there and manage to mow and and obviously take care of it the other aspect of the uh f that we wanted to do is be a a couple inches gap between it and the and the ground and that's where we could you know obviously mitigate the weeds plant some seasonal flowers possibly put in some nice bushes and just make it look a little bit nicer than just having a chain link fence surrounding a ER Mr Barber if I'm correct and I'm pretty sure I am what the president is asking you is it going to be a shadow box or is it going to be side by side you would the 4x4s are going to be in the ins inside of them and two pan panels they come in panels they come in sections of panels they attach and they they share that 4x4 and so they're pickets they're they're pickets yes sir and they're they're panels and are they the thicker panels or the the thinner they're the commercial grade uh panels yes sir okay how tall of the is the fence going to be uh with the ground coverage and then the actual fence itself between three and a half and 4et which if you price out a chain link they're standard 5 foot uh again I mean nothing's going to keep anybody from necessarily climbing in but you put up a barrier you blocked it will put appropriate signage All Around the Pond mentioning that the the pond is not really the issue it's the inlet there's an inlet that's very large that leads to the the storm water chamber and that's really what we're trying to block off and we can do more than just put the fence up we can put if you know we consult with right Pierce we could put up some sort of grading or some other things to block that too but obviously we want to make sure we don't block the water so um that's something that we can work with them in the future but the inlet into that storm water system is the biggest concern so you'll be able to easily see over the fence absolutely okay we can concern would be if a child got in there if it's the way you're talking about setting it up you inv made to see through the fence oh no it's see on okay from a distance it would just look like there's a nice little Corral there and then when the water's dry it's just a little tiny dip of the field and then when there is water it's a pond that people can't go and mess around with and get dirty in and and the barrier would obviously keep small children completely out um it's the larger children that we can't stop and life expectancy on the so I mean I have a picket fence at my house it's over 15 years old and it looks great so I mean I I I think I think it has more to do with how you take care of it and with a staff you know obviously we'll manage the park and and keep care of it just curious did we have we you got a quote on for chain link we did not um I mean I I know from other things that we've done we we had to put up fencing at the well at airport we used field fence and 4x4s or posts excuse me we've had to put up fencing in quite a few places every time we've gone out for quotes on chain link for example cornelus Williams we've gotten quotes it's astronomical and and it's not really something that City staff can put up it's something that you actually want to have installed right so we were trying to keep the costs you know to what's reasonable with limit our liability so correct me if I'm wrong Miss I don't want to speak for you but I would say if I was standing here looking at Brook with the fence up and the Dr is down I'm not going to see a person in there with the fence with a pick oh yeah I mean you okay you'll be able to see so yeah I mean that how I'm just curious yeah how do I see through it I don't you talking there going to be spaces in between the fences yeah it's it's not a it's it's it's a picket fence so they're slats I mean it's not slats with enough gap for a child to get through but there are slats okay I was thinking so it's it's the kind of the perspective of motion so when you move across or you drive across you're going to see in the pond okay you said that so I was picturing that but okay that's two how do I see through that little space see through yeah if if someone were to look at the picket fence that's out here down from City Hall on North Main Miss Barker's house Miss Barker's house that's similar to what we're talking it's just going to be the green that matches the par so I mean when you drive by her house you can see all through her yard um we don't want to go with white because how dirty it gets so quickly but um but that you know that's that's that's what we're looking for but it if we put chain link up yes you're going to be able to see through it a little bit easier but it's just industrial looking it's not really the feel of of the park and again I think a CH personally I think the the picket fence with the spikes at the top and not spikes they're wood but they're angled is a whole lot harder to climb than a chain link fence I mean I'm fat and old and I can still hop over chain link F I want to watch you got it Chief you got it but you got to put money on that I come up with something too uh I just want to make sure it's it's tall enough that they can't climb over it yes you know that a eight 10-year-old getting clim over yes ma'am I think and the requirement around pool is and so maybe for liability purposes if we start there then we've done around the pool because I was by there this morning and noticed there was a basketball in the water you know just want to make sure that there's kids can't get into there whether it's chain link or um I'll also say this is the fastest way to get this T I can order this stuff get it in and get it built very very quickly but chain link it's going to be quotes it's going to be people coming out we're going to be a while from that Solution that's the other thing I want to point out and you're going to put it close enough to the sidewalk that is not going to be in the water we're going to have one mow path between the sidewalk and where the fence starts so the mower can go around one tie um I don't know about the green okay well I'm doing the color but um yeah like I said my my only concern I know the maror had ones last all time Donald said on last all time you know I get visions of looking at these wood fences out there that just you know R away to nothing and I get it it's all about care and maintenance and all that stuff and we do a great job of doing all that stuff um I wish I I wish we' actually priced out the vence because then we'd say okay to do that vence is $22,000 and then would be a no breaker um not the ones that e better the other just that we have to work our me I it isn't absolutely necessary to do this today and I know I'm I would highly recommend that you get a barrier up as quickly as possible yeah I wish you did it two weeks ago I wish we' done it before we open the park because they are kids everywhere but part of that falls back on the parents watching the kids I agree doesn't help problem they're grounded we need to put something around it and and I I'll be happy to hear what we say later about get to the next subse yeah I'm curious on to see what it would be for chain link I'm going through and we paid good money for our offence and going through 19 years three we're on our current third one with care of they're all about being sealed and covered and I mean I I'll tell you chain link has the same problem we've got places and lift stations and that and the in the Williston had a responsibility to have that place contained where their children could not accidentally die and we're going to lose that lawsuit I believe Mr President if I may yes ma'am you may for $3500 that's um if you approve it then I can ask Donald to put it as part part of the f app for the chain link for the future and this way we can save the children and then we could put the very expensive chain link up in a year too when we get that funding okay because that would be everybody would have what they want we could let the f app Grant pay for the defens okay whatever they want to do can I change mine on the conditions of what think we have to have another motion we need another motion okay well don't forget though I might not get the funding oh no because the state doesn't always fund it so sometimes the f app goes through a couple years where the state doesn't fund it at all so I'm not guarante seeing anything if not if if the fence does not last as the president is concerned about then we' just have to bite the bullet again and and I think if we bought the bullet again we could do it probably three or four times at the cost of a chain like this I don't know the answer to that from what I'm hearing for their estimates from from corus Williams what I do know that chain link sometimes is difficult to get when we were doing the animal shelter we were put on Hol several times and I also know that chain link is not all the same there's a cheaper grade chain link that deteriorates faster and the more expensive grade that we put at the animal shelter was much more expensive right there's a commercial grade yes and then there's a residential grade yes sir so all all of it just keep in mind though that if you're talking about getting three companies to come out place a bid and we find out how much it is obviously it's going to come before Council then once you guys approve that then we've got to actually get on their schedule so that IR regardless of price is not a fast option I promise you that you're looking at months so if they approve this tonight with another motion we talk about getting this fence I'm G put you on the hot seat when when am I getting this fence up when is it going to be made I'm usually on the hot seat so um those are common territory uh if you guys get me permission to do this I know Lowe's has the stuff in stock and I could say that probably by um within the next 30 days I have everything up painted and ready to go about two weeks I could possibly do two weeks but Miss Miss Jones you know I under promise an overd they're talking about is not they're talking about cor first it's there well it is but the price on that fence was like 200,000 so I mean per foot yeah it's totally different yeah we don't need eight president to approve additional funds payable to over construction for the John Henry celebration part drainage Improvement and providing an effective date Mr Barber Public Work Director and Mr okay so Dennis will be speaking for uh Walt but I'll I'll give you guys some introductory um there is obviously on Fifth Street some issues um and then along uh one of the inlets on the northeast uh or excuse me the southeast corner of the intersection of Northwest 2 a and Northwest Fifth Street so if you look at uh page 69 on your packet and you look at the map there that's provided and you take your Northern orientation um you'll see that second AB there so the inlet that we're speaking about initially uh that's having an issue is there on that top right hand side on that map uh with the orientation of the map actually I'm sorry it would be the way she has it down there and to the left side but the northern side of the intersection all right so if you were to go down this way on that map you'd be heading toward uh 7eventh Street Sixth Street 7eventh street so uh we're having a problem with the flow and uh if you look at page 70 a lot of this flow is having an issue there on the uh southwest corner of the Richardson property and then of course that buffer there that little line there that you see underneath that uh red L is the path that the storm water takes to get back to the uh the ER there in John Henry so this is where a lot of our problems are occurring so what happened was the engineers got together and said how do we fix this how do we mitigate this and this is the concept that they came up with uh ol Rich quickly got together a chain order uh basically it's like a commercial version of a French drain we're going to take a lot of the water and we're going to get it underneath and we're going to actually mitigate the flow that way and get it up toward that Inlet and then do some work on that Northern Inlet the inlet on Northwest Second on the west side of Fifth Street is working fantastic because it has a lot of extra concrete around it what we need to do is we need to add some concrete to the east north uh East Inlet on Northwest Second so um again I'll let Dennis speak more to this uh on what he wants to answer for you guys but this is what the engineers have come up with that we really need to do as far as some changes and addressing this and uh all the uh change orders are there for your viewing pleasure all right Mr Davis right um I had something thought got a yard thought got a yard stick what to from our understanding so the flow is coming from the West to to the east here across we're getting sheep flow yeah across across all of this property there's a couple new excuse me new houses in here and it's coming across the road and then we're getting flooding that's coming across here and then to this South uh southwest corner and then in that that person's yard right there right Miss Jones actually both sides of the are backing up right so what we're proposing to do here is um let me see if I can get out of okay so you'll see we're going to regrade this sale here um to provide some more positive drainage North and some more positive Advantage South towards this existing Inlet um the gentleman who own or the P people that own the house here they want to have access into their gate here um and they've kind of got a driveway it's not an official driveway but there is a drive there where they drive their boat right in the long run if we allow people to continue put drives in they're going to need to put coverts in so I think you know just from my understanding of this driveway right now is this is just going to be something where he's pulling off the road and going through the ditch but again I think long term if somebody wants to put a drive in a driveway in we really need to make make sure that they have a cover as the water's directed down here what we're going to do is put in um a small Basin it's um uh smaller than the type that we've put in in regards to it's not a big concrete structure it's a a uh a durable PVC structure with a metal grate it is traffic loading so when Donald crws are mowing out there we're not going to break anything it'll be able to be obtained purchased quicker than the big concrete structures um that water will drop down um into that structure and then into the existing pipe there so again we'll put in the the drainage here and then as Donald mentioned what we want to be able to do is also longterm um the pipe that you see here this red line is a a solid pipe that's going to be wrapped in a geotextile and gravel so that'll be under that'll help get the water out that's sitting there a long term the water that doesn't move quickly into the inlets it'll help allow that water to um drain down into what we call an under drain and get into that drainage system so you can you can hear it running I mean we were with an umbrella in the rain for now rain watching it um you can hear it running like crazy in the underground uh culs uh especially the one that goes toward the PIP across second from fifth across second the drain on the north side of fifth is actually higher than the road so there's no water going down it because it's way too high it's way above great that's itach go one the suppos to [Music] and then there's there once it press over there now the water be accepted under and not and as you said the the drain that is to the west of fifth that it's like a Whirlpool I mean it it's working really well but it's still backing up so bad is it because well what you're doing going to improve that so what it's going to do I'm it's backing up the entire length of the Block it's not going to have to go through that smaller area it's going to be able to soak in all the way through and then you adding an additional like you mentioned there before that and then you have you're still to have underground work going on there currently but you're going to also have the big concrete drain that was there before that's right at the base of that oak tree the water wasn't even reaching it right because it's getting like you said backed up somewhere else andwest second what we're having is events that we're getting and that afternoon while we were sitting here with meeting we got four and a half Ines within an hour and a half so it was credible so he went out one ofes constru took film video and this was the came up really you guys is there another issue on here that has to do with the filtration of the pond itself or it okay so why is the water not going down in the pond are you saying today it's not down it hasn't gone down in weeks it's it's because of how much rain we're getting so it wasn't designed for 255 Year events it was designed for daily and weekly and you know average rainfall it's going to go down and then as we get back we don't have these historic range you're going to see it actually saturate but I will say this when it has a few days to dry up it it actually is going down very very quickly um uh and again when it gets up to a certain level it can't surpass that level because of the inlets going down Fourth Street and where it connects into the system so even if it too right I know but even if it got too saturated it's like almost like a a relief valve in your sink that little hole there it's going to get to that point and then it's going to drain through the system so never you're never going to overflow it a few weeks ago when we had a lot of rain Pond got filled and it drained yes just like it was supposed to have done but we kept getting we gotten all this rain go talk to the people down in Bard County valua County all them they've had 16 17 days of rain they're flooded none of going nowhere right because they can't do it so Mr Jones I mean I we can look into the drainage design and and so that we I could better explain to you what's supposed to be happening and look at the rainfall totals that we had to understand how that's compared I mean I I think in terms of addressing that question that's how we would have to do it I think through through the the southwest flid of Water Management District we can get very specific rainfall amounts within tiny areas and so we can look at how the rainfall has affected or come down in within the Park area or the park strage Basin and try to answer that question I me it's kind of hard when you know I I do have a talk off of when I try to talk of what what other people have witnessed and whatnot and and try to give a good answer that makes everybody feel reassured but I I think from an engineering perspective we can look at real data and and try to give you an answer and the sand that's coming from the bill site the fact that it's coming down seventh going down second going into those inlets is it going to affect that pond that's what I'm worried about on this more than anything that it's yeah I mean any any water coming or excuse me any dirt coming from a construction site is not a good thing so yeah it's whether it's getting into the ditches upstream or into into the the concrete structures or into the the the RCP pipe structures that we've done that's a negative thing we don't want that to happen the contractors need to manage their water on site they can't be letting that um the dirt get out of there um the pond I would say has it would have less of an effect on the pond I would be more worried about the pipes that we can't see and how much dirt's getting in there that are transferring it to the farm I I did want to answer your question about percolation though or or the the saturation is one of the things I do want to mention and this was in the meetings and also in Walt's original presentation when he gave you guys if you recall when we talked about John Henry passing and and awarding them the contract there were a couple components of that contract that escalated and and went way above what the two grants provided for and one of those if you remember it was a funny turtle was called bam and when we initially designed the project there were extra things that were done above the standard that was required by Swift Mud and it was that special particulate I'm sure Dennis can answer more about that but we removed that bam because of the high expense in this project and that is part of the saturation and the speed of that saturation so and that was something that was brought before counsil and it was like well what's the price of that and the price was astronomical that was one of the things that we cut on it I remember to make it affordable so I don't know if Dennis if you want to address the BAM on that on that pond yeah it's it was an additive or material that we were going to put at the bottom of the pond it's a a very pervious material and then it also helps with water quality so um without that we rely at you know kind of the materials that are down there at the bottom of the pond to uh you know to provide that drainage and um in designing the pond we would have done some testing to see how much percolation we're going to get and so again M Jones that's where I get back to is that we would have to look at you know you we we designed for a certain percolation rate to the point that Donald was making how much inches of rain we're getting and make some comparison there as to what's happening so you look at the change order from ol Rich uh through their subcontractor um you're going to see uh the 2,326 and if you look at the resolution and what staff's asking for is the um not to exceed the 30,000 there will be a little bit extra for the residing of of that particular property and uh also any kind of incurred cost in um on Fifth Street on Fifth Street yes that's good he's W that right on Fifth Street it was dug up to put down the large Cs and it was never regassed or reeded so it's nothing but Lime Rock and big rocks um and mud with all this water that's r so yes he's very happy he was they were actually here at our last meeting that family that was here what that was them and we've been in very good communication with the folks directly affected I've been giving them weekly visits and updates I'm sure they're listening tonight on the link um because they they want to obviously see what's going to happen here one of the problems with the material going into the inlets was that because the the the grade wasn't proper and it didn't test out really well we weren't going to put sod down waste the money have it all ripped up only to have you know the sale redone so that's part of the problem so when we get this done the timing is critical because as soon as we get this work done we need to get the sod done and that's going to fix the problem have a question yes ma'am um other than the Wawa are there any Lots in that area that are un that where there is room to build that could affect the flow of the water going forward so that we don't have to revisit this again in the future so there's uh one lot across the street from it that has been purchased by a current home on Fifth Street I talked to them they have no intention of ever building on that lot as long as they own it they wanted the extra space on that corner but potentially someday they could sell and a house could go there um but that's right across the street uh we would have accounted for that there's a big lot on six there is a big lot uh where that could definitely be a possibility and then the only other one just finished building and that's one on Northwest first a and they actually still have kind of an active construction they haven't laid the sod down but as soon as that goes down really those other two are the only possibilities for further development North or excuse me south or uphill from this area thank you anybody else have any other questions or comments for Mr Don real quick um but if that were to happen you guys would have like guidelines so that it wouldn't cause the issue that you're having now all of them do and that's that's why we jumped on the construction project higher on the hill um I'm not going to name names but yall know who they are we immediately hopped on it they fixed the issue so we're as you know Terry's made sure that right Pierce ourselves staff we're not messing around with this stuff anymore if we see a violation we're reporting it we're stopping work they have to fix it um we're not going to have another situation like we had last year with some of the other stuff so um but yes we we we even we even miss Hines to your point we even report them even if they fix the issue we still document so that we kind of alleviate any kind of responsibility the city would have if they were to litigate and I watched what they did I did not know it was because of the city but I knew there was a serious problem and they did some serious work to control their water all to the point of even putting mats down so the trucks wouldn't bring the dirt out and the mud out uh so they have been trying I'm glad that you are on top of them well and I'll give credit to right Pierce there because Walt was here the day of events he didn't even have an appointment but he knew rain was coming and he was on site and he took video footage and he took uh information and he literally that day began to work on a solution in addressing the problem and so it was good to have good partners in that yeah much better now all right no other discussion questions all right I will entertain a motion for approval for I just wanted to add one to answer the question that was asked earlier about cornelus William Park um our design plans are done and are in with the county for approval um and we're just holding on them so as soon as we get approval from the county we can go to bid on the first phase of the improvements which is for the is it $400,000 worth of work out at the park is that the right number Laura yeah so would it be their planning department who we're waiting on yes so yeah as soon as we get that we can get out the bid they have hired a new planning director so maybe that'll speed things up a little bit so let me ask a question didn't have one at all when they you're talking about the fence is the fence only going around the actual soccer and is it soccer field so and softball field the fence is just for the entire 23 Acres it's a full perimeter it's just a perimeter fence just so that why are we putting a 10 foot fence around a perimeter that also is going to house a playground and other things for kids play well it's so thankfully it's 23 Acres so it's kind of like uh airport or Horseman's Park I mean it's not it's not a very small space so it doesn't look like a prison yard um secondly it's in the county exactly what I'm invis well I know but it's but the other thing it's in a county the other the other thing too is the part of the 10 foot is we priced out on the chain link on the bids uh when we initially priced it out to plan for the grant there's a junkyard there and there are Car Sales there and the reason why the height of it is because they put a special netting that's in woven into the chain link so that when you're in the nice park you're not looking at a used car lot you're not looking at a mechanic shop you're not looking at a junkyard and that's primarily the reason it was the Aesthetics of it the fence actually gave you better Aesthetics than just having a regular fence and you're looking out at all these commercial properties so the fence is going to be closer to the line of where the park starts and the property line the other property it's only the property line that's all it is and then Gates on the north entrance on 318 and on the west entrance on off of 27 that's that's all that we have on it no fencing internally in the other except you know like for your your backdrop of your baseball you know uh field or anything but other than that that's the only reason why we're having up it's for the Aesthetics then you have some property to the south of it we don't know someday if that'll get cleared so we didn't want to short fence there either because that's commercial property in the county so as this commercial properties developed you don't want to have a tiny fence because then you're looking into these I don't know if you've been out to the north side where the current football and soccer fields are I mean it's literally a junkyard it's it's horrendous let me add that I I've been out there twice to help clean it up when when the mayor did his cleanups and that was the area I was assigned around where the car sales are where the junkyard is down the other side we found where people had been living we found pop tops beer cans just all kinds of trash where they've been living in cars and we picked it all up and you put it in a bag but it's it's as much for the protection of the kids is it and and actually the I guess I'm not going to say Ingress to the to the park itself but for the protection of whoever might be living in there or in there when there are children on the property all right I may um when the friends of Cornelius Williams Park originally met with me to design this they' had major concerns even of the neighborhood um because people can come right through there is a small fence but they jump right over yeah but honestly um if city council so directs and they want to get rid of this fence I'll save almost $200,000 that I can put up for something else and this is not the first
