fine we'll check it this thought you okay can you hear me now okay they untethered me so I'm really happy how is everybody this evening okay all right I'm sorry this is really going to be a tough act to follow I mean the kids were great so how do you follow something like that up with ethics I don't know but I'm sure going to try so as you know annually the board has to have a discussion about the code of ethics and that fulfills their qack requirements for the upcoming year so I handed out for you or thank you John Shaw John Shaw handed out for me a copy of the we're going to take look at on the back there's a couple of cases that we may just to just make that the same stat so the code of ethics is actually part of a larger ethic statute that enacted in 1992 code of ethics did not follow until 9 years later in 2001 and really when you look at it it really kind of guides the behavior of board members as board members it's up to you to withhold the trust and confidence of the people that you the people that are in your community um and by reviewing and adhering to the code of ethics you should be able to do that you know we we tell board members all the time if at any time you know you're doing something that makes a member of the public kind of like scratch their head and go hey wait a minute can they really do that that's what you really need to start thinking hey should we and let me go back and and review you know my behavior my attitudes what I said to make sure that I'm falling with these guidelines and I do call theode of Ethics really guidelines you know this is your lane and as long as you stay within that lane you'll be fine I'm not going to go through a and j I'm GNA pick out a couple um and then go from there so um my my all-time favorite is C because that really outlines what responsibilities are I will confin my board action to policy Mak planning and Appraisal so if you are not making policy if you are not making large free plans or you're not appraising how well those plans were carried out then you're not in your lead you're doing somebody else's job in the district so if you can keep those three words in mind you should be um you should be fine all the time I always like to point out the second piece of this that says I will help to frame policies and plans only after the board has consulted who will be affected by them that doesn't mean that as individual board members we go out and do that that means that we turn to the people in our Administration and say hey get us some information on this you know from all of our stakeholders whether it's our staff whether it's our community parents so that we can make sure that we're making a good decision so it's not up to us as individuals so C is always first and foremost um e is very important um and you're going to see why when we start reviewing a couple of the ethics cases and really what it says is I will recognize that Authority rests at the board of education and will make no per nor take any private action that may compromise the so you know my friend Jesse who actually retired in January uh Jesse was very fond of saying that being on the board is a team sport so you don't get to pick your team members you don't even have to like your team members but you do have to work within the team and that's what this really says any team member steps outside of that and start speaking or uh doing things that they shouldn't be doing that reflects on the board uh that's the problem so you're going to see why in a minute why we think this one is extremely important uh confidentiality is G I will hold confidential all matters pertaining to the schools which if disclos could injur uh needlessly injure people um right now we're in open session so everything that we talk about is great if somebody asks you a question by all means you can answer make sure you back information I support and protect scho performance of all of the people it's not up to us to evaluate that it's us to support them evate and that's respons and my last one is my fav of all this is one should never forget is will all administ officer act on complaints at public meetings only after failure solution you are not the problem solvers soone a issue get to refer it to Dr then the task and talk through and figure out how you want to proceed but as far as the individual constituents and people staff MERS [Music] District so that being said do any okay on the back I thought were kind of interesting these were not in 2023 so we put them on this list you probably hav't seen yet the first one on my list member copied and pasted and sometimes you do get emails you know from your Administration Friday emails updates and whatever so in this particular case this board member copied and pasted text from that he received from a board email and um the board has not yet voted not yet you can see where I what they let's take a look said I recogniz so that private action compromised the ru that one team member took action that they should not next one theard member they should not you don't take information the hased on yet so I'm going to skip two for a minute I'm going to go right to three because we get this a lot so in this particular forever we have have not problems with that so this one number took it upon themselves um to go conduct their own investigation to contact vendors get pricing us can anybody guess why that wasn't approprate so clearly see right iy they weren't framing those large plans and they weren't appraising Carri out they were clearly doing some else's job so that was number one the second thing was I recognized an authority rest of the Board of Education they took private action that has potential to compromise the board so you need to keep those all I guess you can kind of see a theme here why I kind of centered on E so let's just take a look at a couple more um okay so let's look at number five so the board member at the request of the Union president I'll say that again a board member at the request of the Union president notice I'm scratching my head here sent an email to the board and an administrative assistant but choosing superintendent of changing the graduation date due to a personal conflict okay um so you will see that they took private action right here we go with private action e again and the same member as the Secretary of a local organization was told by the principal that the chorus wouldn't be performing in an annual event that they held um so they texted the chorus teacher to ask why so uh again we are looking at a couple of you know issues here uh e being first and foremost that was Private action that could compromise the board in addition to that was I will carry out my responsibility not to administer the schools together with my fellow board members to see that they if you have any questions at all right you go superintendent that's your contact that is your contact if you want to know why the CHS didn't play wasn't going to play go to the superintend that's your contact they don't know they will find out um and I'm only going to do um one last one because I thought that this one was this one gave me a chuckle number seven the day after the board president lost an election they directed the board Council to conduct research on another board member who campaigned against him and again here comes that pesky e popping up again took private action um and used their position to secure unwarranted privileges for them themselves which is part of the actual ethics statute not the quote of Ethics so there were two violations in there um I did put a note at the bottom you know you can read the other cases that not every note that every case includes a violation of the E so the school ethics commission is taking a very hard look at people that aren't being team like questions Terry I that with regards to the um the repercussions for violating um code of ethic uh it appears that it comes two or three levels C re there's suspension and re um and there have been some suspensions in there there was one this is 2023 I think it was 2022 there was a board member in uh C County actually that was suspended for six months for some perceived threats that they made against the coach in a public meeting it wasn't a public meeting of the board I think it was like one of those Sports Association meetings they were there talking about things the board member attended um and said some things that led the coach to believe that they were losing their job so that case went before the scho ethics commission and they were suspended for six months we can be expended suspended or removed to removal um at this point I think is for very severe cases but I do know that if you do not fill out your annual disclosure statement that is one of the quickest ways to get removed from the board the other one is to not take your annual training if you don't do that that is the second questions I can stand here all night and talk about I can't you have any questions on ethics or anything else I can answer for you at this time sure have questions concerns else so what happens when you're directed to to is the yes absolutely and I will tell you if you have any questions at all about ethics or should I participate in this should I participate in that the best person to answer those questions is your board Attorney D can I just do safe aror for a second sure um and thanks a lot for coming in doing this ni seeing you again um I just want to remind all board members if you find yourself in a situation where you're concerned that you may be approaching a compromising position if you call Mrs you do not have to give her a reason um and ask for permission to speak to my office uh you can identify what the particular ethical concern is and if you provide me a series of facts which is accurate and I research the appropriate law and give you an opinion that the course of act action that you're about to take is appropriate in accordance with the school ethics laws um and you take that action and some third party files an Ethics complaint against you under that scenario this is all um that's called Harbor letter what that means is you have a right to reasonably rely you know against all in my opinion um and that you you rely upon opinion and the facts as relay set out in that opinion um are consistent with what transpired then you cannot be held liable there's even been cases where the attorney's been wrong in the advice and the board member has relied upon it and again Safe Harbor provision stands uh up against that as well so I would encourage any board member and and from time to time you've reached out with various legal issues or questions going through the the president as appropriate um but should you find yourself with an approaching ethical dma please call here for um and be out of a lot of trouble before we get very close to the line that we all know and the best thing I read and a lot of the literature that get put out on this type of stuff is it really this is great and you have all the rules you know they all are interpreted by the ethics commission all those things but it's what you feel in the gut if you know it's wrong you feel you know if it feels bad like you're not right the likelihood is stop so that's that's that's the trigger that makes you pick up the phone call Mr Fitz get get to my office prefer get Dan and Chris the right answer and instead of me and um you know proceed that way and what will happen is I'll give you that opinion and I will confidentially provide that opinion to Mrs Bo who will put that make sure that gets to your personal file so that that opinion is in the file and protects you froming future actions thank you Terry anything else Terry just did a great job and um again we thank you for coming and without a doubt going forward we're going to be seeing you in the several training sessions that's that are coming the that we will be ATT but again thank you so much you always come have a good evening thanks you too board members at this time are still on page two is there anyes thank you m moving along board members at this time I'm asking for a motion to approve the minutes from the meeting of the Board of it's a last before spring so the and I think iail to the MERS will hold next meeting on um April 11 4M vir we have poliy that will questions comments on the policy thank MERS this time moving I'm asking for motion to approve the superintend report at the beginning of Page Three and then continues through to the bottom of page eight is there motion m28 through eight second I have a question there yeah I like I like an explanation with number 23 and number 27 what page I'm on page six number 23 page six and Page seven number 27 page six number 23 and Page seven number 27 correct and what is your what is your question I just want an explanation of what that is I know 26 is approved request to accept the check in the amount of 2900 you know where is that coming from what is that money for and the same basic the same question on on page 727 M pa3 high school you know several District the njsia pay those workers out of the receipts for their service during that uh we are just receiving that check all those individuals provideed Service uh that check will depit for those workers because we get School District pay for it's pretty much re for those Serv is that CL on that yes um Dr very um number 24 27 27 Dr for those I know Title One recently the high school is identified as a school that needs Improvement so one the school is identified the state addition funding to help support their ini SCH we get title funding every year for all of our schools when we receive additional funding that money then has to be incorporated into the original bud so what's on the agenda here is the approve approval to do a grant Amendment so we are adding in the $125,000 that was received for the high school so this section shows the original money that high school is getting which is 27733 and that includes $125,000 that they just received so um just um to uh expound on that if you recall when I made that announ to the school district school board uh I also indicate that dist2 so we receive as a part of the grant funding there are three pretty much four grants that we receive funding for Title One title two uh Title One is primarily for servicing students title two is professional development your staff or dependent on the size of the class and en rment for second some place else is what you're seeing so you will see Aus 7,000 coming out of the 200 100 line and it's being transfer to 200 300 and we are allowed to do that within the grant so in order to make those changes we have to do an amendment yes that's professional development and carry money we have a large of money this is uh we're making a transfer most SS for Consultants or St uh development and we are M that line so so the additional money is that is that specific does that need to go specifically to a specific line item and do you have to report out on that above and beyond the rest of the because that's that's an additional fund additional so it does not go to a specific line so as a part of the identification process you have to develop the school by plan each school does that that plan is then submitted to the state and that plan is based upon your allocation of money from title one so each school has a different allocation amount for school number for the high school we're looking at about over the $277,000 so the lines that you see here on the side the 2235 100 100 those are the different ways that the money has been allocated to be spent it has to align with the plan that you submitted and that plan goes up to the state for approval saying that it's okay but you each individual School decides where they need and allocate some money to that line do it have to show Improvement to to the [Music] original it because classified every school that's been identified the state will have state representatives who will come down during the course of the time frame and will work with the school so there's regular monting and there is an assessment
