e e e all right so uh for this the uh 17th day of April 2024 we'll have our roll call then we'll have well in fact roll call yes sir commissioner dollison commissioner Mercer here commissioner danler here mayor proes here and mayor Bon here all right then we will have our pred of Allegiance and then we have presentations so are all these going to be presented uh these will all be Monday even evening Mr Mayor and Commissioners um these are standard you know proclamations you've had presented to you in the years's past we'll point out item 5f okay will be the annual comprehensive financial report that will be presented by our Auditors which is Malden and Jenkins um and just for uh Clarity there is an item within the consent agenda I believe it is let me look here uh um yes 10A will be your acceptance of the annual comprehensive financial report so you'll actually get the report presented to you in in the first part of the of the meeting and then that will be an action item for you to officially accept it and it is a clean audit all right are there any questions about the uh voluntary annexation we reviewed that last time Commissioners any questions [Applause] all right so T has already told us about 10A uh the library board appointments have two members that are going to be reappointed Judy Joiner who has served on that committee for many many years Sarah Hanks who is a former city uh employee at the library who joined that board uh not too long ago okay and then the First Amendment to the uh Grant agreement uh I'm going to ask uh if if it's uh pleasurable to the to the commissioner to have Gary hubard Come forward and talk about 10c d and e they're a little okay little tricky good evening Miss bear Commissioners so the this um this is a grant that we we receive from Swift Mud to assist with developing a basically a surface and groundwater model for the onewater master plan plan so basically what it does is it ties our surface waters to our groundwaters and uh helps us understand how we're going to recharge the aquafer in the future and this grant basically is just a Time extension to wrap up the work uh late summer time so so G what what what is the um the signs of what you'll be doing so so basically the the only surface waters we really have are created by our rainfall MH so what we're doing is we're creating a water budget a water balance so we know roughly how much water we receive every year we can estimate how much flows through the ground surface uh based on areas uh that are not developed or are partially you know undeveloped and we can tie that or the the engineers and scientists have developed a way to tie that to the amount of recharge that occurs in our surficial and then our upper Florida and aquifer okay clear as mud no the only thing is I would you know um you know and I'm I'm thinking about the alternative water and what we are I'm just wondering how how does that affect what we are going to project it to need I mean how does that figure in it it figures into the amount how fast we can recharge the upper Florida and aquifer so the the plan was swiftmud is a partner in this uh uh exercise so they will um likely adopt it into their their policies as how much water you can plan on basically infiltrate infiltrating into the aquifer oh okay so in the long run it could have some special effects yes this is probably one of the key elements of the one waterer master plan okay all right continue uh the next item is the Cypresswood I think yes this is the Cypresswood so as you know we're we're planning on constructing two new water plants the Cypresswood water plant and po Road uh this is for the design and the construction documents CI services and this uh this work was done for all the wells that are proposed for Cypresswood and Pard Road the next item on the agenda is the Pard Road and that's basically CI Services only for the PO road work that will occur that's associated with the well drilling so mayor and Commissioners this is a kind of an intermediary step in the development of those water treatment fac Water Production plants dealing with the wells and then the CI is is part of the ongoing construction of that so uh this is a like I said an intermediary step in getting to the Full Construction and build out of those production so during this process we'll be looking at we'll be exploring the upper regions of the lower floran to see if if the water quality is sufficient there to uh provide um permitting for our water use if not then we'll we'll move towards the upper Florin but basically what this does is um it it provides the information that will be needed for the actual design of the treatment facilities so this is uh just one step along the path to get to new water treatment plants g g um with these two treatment plants and has the water been how much water we expect has that been injected so Cypresswood I believe the number is around 1.5 million gallons per day from Cypresswood and so that's all already uh factored into what I need that is correct it's going to be and poot Road as well is I think it's around 4 million gallons per day from po Road okay the Cypresswood replaces an existing site and Pard Road will take offline winter set Gardens that's correct okay okay so it's new wells just so just swapping water really right we're retiring some old assets and and constructing new but I'm just saying it's the same water yes sir yeah okay um is the Wells going to be on site at the Cypresswood or so we purchas we purchased property a couple of years ago where the old Wastewater Plant was located in Cypresswood and that's the new location for the new water plant okay there Groves there or what pardon there used to be Groves around the old Wastewater Plant I believe those Groves are dying out I'm not sure they're completely but um so we'll be located at that location Pard Road will be on the west side of the Wastewater Plant three okay any other questions any other questions comments thank you right thank you thank you Gary uh I think the next item uh police department roof replacement that's straightforward unless y'all have some questions well there's there is a bit of a uniqueness with it so this was something that we were looking to do potentially in fiscal year 25 and when we had the roof inspected the condition has deteriorated significantly and there's concerns about the Integrity of that roof going into hurricane season um so we are recommending that we go ahead and do the roof replacement in the current fiscal year it's not a budgeted item however we have within our ordinances for first reading the funding uh through a budget amendment that will utilize um uh I'll say enhanced interest earnings that we've realized over this first portion of the fiscal year that can be used to cover that expense remember we budget our interest earnings very conservatively because we don't know what the markets will do uh they have continued to produce higher than anticipated interest earnings so that will be the offset with it and it will allow us to get this roof done in advance of storm season and so do we have a I see you you projected it approximately 280,000 yeah $292,900 is the total estimated expense inclusive of the roof and if they have to do the but you don't have no bids to that effect right what's that you don't have no bids this would be done through um continuing contract that we have for roofing all right thank you Mr Mayor quick question um it's hard to believe that build is 21 years old cannot believe time goes so fast yes um did we look consider possibly a metal roof on that it's a membrane roof that's on yeah it's a membrane roof um you got can't can't you put one on top of that or we already done that we've I believe we've already done that so you got to take it up yeah I learned that from the rich that's in the Ritz in your building you're we're downtown yeah um it is uh it's hard to believe that building's 21 years old um uh commissioner dancer I I'll I hate to say I'm going to make you feel even older um this year marks 20 years ago that we opened the library ah wow God bless Kitty still one of my favorite people oh wow yeah so wow okay I'm good anyone else all right uh the next item is agreement to transfer of public roads Lake I'm going to ask Eric Labby to present this uh so he can clarify any questions that may be with it sure so we've been working with the county um Lake Road is an unimproved County right away uh that runs from Thompson Nursery Road on the North side to County Road 653 or Rattlesnake Road on the Southwest side um all the property around Lake Road um is within the city limits of Winter Haven with the exception of Heart Lake Hills subdivision and additionally the we have uh adopted a PUD ordinance ordinance 02339 which requires the developer of the multif family project um just south of Lake Road to construct that road from Thompson Nursery Road to his entrance um therefore given all those factors it's a approp for the city to take ownership of Lake Road uh we would be responsible for uh maintenance and operations after it's constructed by the developer it would be a city road um and staff does recommend approval of this uh transfer of Lake Road from po County to the City of Winter Haven um keep in mind uh I did want to point out that while the developer is required to construct uh Lake Road from Thompson Nursery Road intersection uh South to his entrance point to the subdivision um from the entrance point to the subdivision uh traveling west to um 653 will be a multi-purpose Trail and Landscaping also um constructed by the developer yes I had a quick question Eric um so about where is his interest going to be is it going where it turns where it turns and starts heading to the west or where's he going interest right about where the little dirt road that heads South right where the cursor is he's going to build it from Thompson Nursery Road down make that hard left to there and then it'll be like a then it'll be like a big incat like a it'll be a Boulevard entrance into his multif family development yep but there won't be a road going from there to 653 that'll that'll be just because I remember we approved that a while back and we had this discussion right it'll be a multi-purpose Trail but isn't that a retention is that a retention Swale in there cuz I walk back in there and jog all the time and it's just un improved right away um but I thought it was retention too but maybe not not existing retention there is some Wetland area in there to the um that would be the east side of the north south lake of Lake right in there yep I know I brought this up when we approved that that that but what what's the reason that we wouldn't goad and finish that road and release some of that pressure on that school so people can not have so much pressure on that light there yeah so it was twofold the discussion around that one was um there were some residents that had concerns about a road going behind their single family homes even though that is existing right away and two is keep in mind that that Lake Road um lines up directly across from the main entrance and exit for channel AES Elementary School uh and so while uh traffic traveling north on 653 and west on Thompson Nursery Road could potentially use Lake Road to avoid the light we might be creating an additional traffic um situation with the entrance to the elementary school by punching that through as well that those were the main conversation points around that I know it'd be expensive to finish that road but we ought to maybe noodle on that a little bit maybe if we could put a light there you could synchronize those two lights potentially yeah and because you have a light there at Thompson nursery and in beginning of Lake Road you have a light there already if you could synchronize those three lights you might be able to get some relief for those school yeah and that a bottleneck for about an hour yeah and I would say too that um once we own this RightWay um the developer is required to build his portion of the road and the multi-purpose Trail going west to the entrance um but at a future date at some point in the future if it did make sense to um change the multi-purpose Trail to a road and and punch that through we we now own that right away and we I'm just saying we might want to think about that for the future because that to me would help tremendously because there's going to be another school down there as you know commissioner dancer if I could add some uh just a couple points to for clarification there it does appear that on you mentioned retention in that Corridor does appear that there is retention in the form of a Swale on the backside of reck's corner which is the subdivision on the North there where you see puppy rush and well do what is that Cloverdale Road whatever there is some sailing behind there that that looks like it it is aligned with those single family uh that would be outside of the RightWay um so I did want to clarify on that that you are correct there is some some retention swells within there on the Chain Lakes Elementary one of the things that we had learned yesterday and uh Eric and and myself and some others participated in a panel discussion with superintendent Hyde the vacant land immediately south of chain Lakes Elementary School is slated to become a middle school and he had contemplated or they were contemplating from what he had shared with us the potential to develop some of the parking facilities associated with that school early on and thus allow queuing for the elementary school to be uh to utilize that is not just in the immediate but in the long term as well to relieve some of the pressure and congestion that we see on County Road 65 3 so that is something that they're exploring as well as how do you better contain that within the School site itself is that the property just south of those green roofs yeah right there y that's where they're talking about parking yeah the the middle school will go there and it goes almost all the way down to believe it's Cunningham Road there's a small swath in Cunningham Road that's still owned by the uh original developers of vamar but um the intent and certainly the way that school time starts are getting adjusted now that that would allow them to have some queuing flexibility within there but that is he is well aware of that I think that that chain leg Elementary um in the number of conversations I've had with him and public meetings over the past two or three months that comes up regularly so he is well aware of it and I got to think that that's probably one of the more challenging traffic mitigating right you know challenges they have so they're working what makes me think they're ultimately going to put a light right there at at elementary or maybe I don't know I'm just trying to figure out how they could do it but I bet they could synchronize those lights and move that traffic better maybe so that that road would become U City yeah correct the right away and the road itself from here to here and that becomes a rideway that we have right at the risk of maybe sounding a little sensitive uh a city uh Road that's called Lake uh creates a challenge for me uh in the city and uh I I don't if if we don't if we the road's turned over us whether or not we could change that name to a different name would be a I thank you there's no properties fronting it so there's no impact to to doing a a road yeah I don't change um particularly we could explore that when Traditions comes in to develop because I believe that would be the only property that would have an access point off of that roadway so and I I think with you know with the increase that that's going to be utilized more uh that name uh it's probably an old name going back I'm sure to a time but uh I I can promise you that that that is offensive to a lot of people uh so I I think that we can do better and uh so I think uh this is a great opportunity to take care that early as possible uh if that is uh acceptable and again I may a little sensitive to it but I I've lived the life that I've lived and I and I uh I know that that would be a challenge for some to hear it just listening to it I saw it kind of Drew my attention to it certainly makes uh perfect sense I'm in favor changing it too all I know is I went to a uh a ground breaking Friday out there I couldn't believe the track traffic at it was at uh the vamar yeah 12:15 to 12:45 it's like that constantly out there I'm saying I see I see why people are if you got kids in those schools put and what I what I found out is that uh the people that's doing that particular did that particular groundbreaking there that's like on only about 70 Lots the another whole section is being developed and they plan to get like 1502 200 lots I'm saying oh my goodness so the people are coming a big relief in that area ultimately will be the realignment of Thoms Nursery Road because dump into yeah yeah all right anybody else all right uh 10 H is um you may recall we had uh brought to the commission back in February a request from Bob Cameron to acquire two city-owned Parcels down there Office 17 well turned out that one of them the one that you see highlighted in red there is uh it's owned by the city but the that came to us when the the do realigned US Highway 17 and it has a reverter clause in it so that if there's any transaction involving that it goes back to do so this is a um recommendation of the commiss to the commission to authorize the execution of a quit claim deed that would put this property back in the hands of dot which in turn will negotiate with Mr Cameron for his acquisition thereof and we were quick question T are you sure you don't ever want to ever have a sign there or any kind of directional anything at all I mean I guess case you guys have looked at that cuz it's got Frontage on both roads I don't know cuz once we get rid of it it's gone I'm just sitting thinking I I I don't see I mean I think that if it can be um utilized for economic activity in the area um could you put a sign on there certainly you could but I don't know that you're going to get a whole lot of benefit of it uh other than for people that are headed southbound and I think that maybe if you wanted to do something in that regard probably look more so to the land that do don't dedicated to us in the area of um Third Street where it's splits right there at uh Andy ziggo you know you 17 kind of Curves off to the to the left and you can go straight up Third Street that parcel would probably be more appropriate of some type of iconic welcome to downtown or something um this area not so much I don't think we do either but I'm just I'm just trying to think it's gone it's gone but you know public art of signage or anything I don't know I'm just trying to think how we'd ever use that land it's not very big well and that that piece is coupled with another piece that we own that does not have any restrictions so there would be two pieces that would be ultimately conveyed to Mr Cameron if you may recall there was a I think it's just the piece just to the north yeah and yeah the police with the cursor on right now that that was conveyed to the city without any restrictions so that would be included in what and what is being sold to Mr Cameron we'll get money for that but we won't get money for the dot piece correct they might get some money they they'll get some money but we won't but we won't right um yeah and we've had communication with do and um I I have not heard back from their attorney yet but I've sent him the signature block for our quick claim deeds and he was going to furnish me with a quick claim deed I I asked do we need to have a resolution I've not had any specific response did you get a response from inquiry Eric no sir so it's conceivable the do may say oh we need a resolution from the city commission if they do we'll take care of that but in the meantime we want to get this before you so we're authorized for the mayor to sign a quick claim deed and get it back into Do's hands so the smaller piece I mean that's going to come because we we determined a price a sales price which included both partials so essentially that smaller piece still needs to come back before us to determine what that price is and I assume we'll we'll wait until we figure out what the do sales price is on the larger parel I would think ours would be more valuable because there's less of it supply and demand right sure absolutely I think twice as much yeah I I I think commission mayor foram Yates you're absolutely right I think we need to ascertain what the Dot's position is on that and then act accordingly so the other part that I was a little concerned about about was just the maintenance of that parcel so we've handled the maintenance of mowing the grass and trimming the trees and all that stuff on that parcel forever 23 years since it was created so if this goes back to do are we still responsible for maintaining it or not on that piece so but the do knows that they need to start mowing it now or I I had a I had a conversation with a representative from do and and and we talked through that and and specifically it was around conceptually if they couldn't come to terms with Mr Cameron what happens they probably convey it back to us and that was the answer was they would probably convey it back to us and we would continue to mow it and maintain it right that would be my guess yeah I guess my I'm just wondering like they want it in the interum so so then give it back to us if we take it back then we need to do whatever we we need to be allowed to do whatever we want to do with it without a revert I doubt well then they can M then they can pay to start maintaining it well I will observe that right that do did acquire this property via eminent domain prior to 2005 so the US Supreme Court kilo decision which puts some limitations on lands that would be for economic development and that that doesn't apply because this was pre25 emminent domain acquisition so there's a little bit more flexibility there for the dot to convey it to us without a wrer reverter but whether they will that's their call that's a political call kind of sort of on their part but certainly I agree with you 100% if they're going to be you know I grant it's it's not a big dollar amount I'm sure but it's you know it's um buy it for 500 bucks or something well yeah and you know it we we've paid to maintain it all along so now it's going back to the do I just I just didn't want the grass to become 10 feet and MJ just pointed out mayor prates that you know we have ongoing RightWay maintenance agreements with do all across the city um they would probably ask to place it within the jurisdictional boundary of one of those maintenance agreements and compensate some very small amount to mow it five or six times a year well it's going to be 500 a month yeah well we don't get to set that unfortunately and what pay us I will tell you they pay us I think uh 11 maintenance cycles per year on major roadways can you imagine if we only mowed Cypress Gardens Boulevard 11 times a year I think we hit it uh somewhere around 48 to 50 times a year that's routine I mean that that Dynamic is the dot only has a certain bare minimum level and then this local jurisdictions that they do more more bottom I guess it sounds like we're aware of of who's or what's going to happen maintenance wise so that that was just my concern as as we switch this thing back and forth and if they decide to move slowly it could draw out six 12 months and nobody's mowing the yard so all right anyone else becomes a code compliance can we put Code Compliance fines on the state we're moving on thank you mayor intergovernmental cooperation resolution R 2423 okay 2423 is um this is a just accepting Lenard's um two 22 I'm sorry 22 sorry 22 I jumped ahead well I did Skip 22 is lap agreement so Britney you want to tell them where this is yes um so in 2020 we applied for a grant with FD through the P County TPO um to do a complete Street project on Avenue C Southeast um from First Street back to 6th Street Southeast and so that is in the area of Grace Luther Von stadium and Brigham Academy um fdot agreed to fund the design of this project at $83,200 pedestrian infrastructure or pedestrian enhancements um so the the grant agreement basically says that we will have $83,200 another slide does it take that long to get a study done another slide for the design no it it doesn't typically take that long we just have until December 31st 2026 to actually do it in order to be reimbursed you expect to have it done sooner than that though yes we do anticipate going ahead and once we have the agreement um putting out a bid to to find a Armory a firm okay and Commissioners point out the significance of this project so you've got um realistically three schools along this Corridor between gra actually Four as it stands now Grace Luther and the language and literacy Academy for learning across the street which ultimately is going to move Dennis ele Dennison middle school and then at the very far end Brigham if you've had a chance to drive this Corridor certainly in the mornings or at the end of the school day there's a lot of of Youth uh traveling from that Winter Haven uh historic neighborhoods into those schools so enhancing the complete Street do design of that Corridor I think will have a significant Improvement on school age children's safety much needed any more questions what is the herbal Buddhist down there I gotta know who I got somebody's got to tell me enlighten me on what that is oh I see it herbal commissioner dancer I would you would be my go-to on something of that I don't know beauty supply store there is a new business that's opening right next to canes and I think we have a ribbon cutting for that coming up in the next week or so for Morenos which is a uh Latino food right there yeah they're open I've seen them open the hippie any more questions thank you all right now to r24 4 23 so this is uh just the um request to uh release the performance bond on the peace Creek preserve pre peace Creek Reserve uh subdivision in southeast Winter Haven 1907 plus or minus Acres 553 building Lots this is down across the street from South Point Elementary and you may recall that we had looked at this uh performance bond in the past in August of last year um we had uh kind of revised that in the sense we didn't reduce the amount um but what it was specific to based upon what improvements had been done um on March of this year the developer submitted the request to Rel fully release the remaining performance bond and our inspections have found that all has been completed as required within this uh subdivision so it's good to go all right any questions all right thank thank you um we'll move on to ordinance's uh first reading 0248 Eric would you uh present this this evening please sir so blue sky who got you all are familiar with um did the project up here at first in MLK they are the petitioner uh they're requesting the city to rezone a portion of a parcel from single family residential small lot R2 zoning to multif family residential uh low density r three uh zoning District it is the Western portion uh it is the Eastern portion of a parcel it's approximately 8.8 Acres the Western portion of the parcel is designated as commercial Highway C3 um they plan to develop a multifam residential product on the property based on the maximum permitted density of 15 units per acre uh for properties in R3 within the urban core uh a maximum of 132 units could potentially be developed on on the property this is an increase of 88 units over the existing R2 zoning surrounding uses include the Stonebridge Villas single family uh attached subdivision which is developed at 10.6 units per acre the Stonebridge single family detached subdivision to the South um CSX railroad tracks to the East and vacant property zoned R2 to the north um there is sufficient infrastructure within our um systems to handle this proposed change uh in your fact sheet is are two charts one showing the difference between R2 and R3 with respect to infrastructure and one showing the total uh impact there is adequate capacity at this time as with all developments final con concurrency uh will be determined at final U site development approval uh it is consistent with the comprehensive plan designation of traditional neighborhood area and um all notification requirements were met planning commission did meet on April 2nd and voted to recommend approval of this request there were three members of the public who spoke with concerns about Road access drainage issues and multif family development adjacent to single family residences um staff has concluded this is consistent um with the comp plan R3 will uh serve as a transition between the single family uses um to the South and higher uh intensity uses along Recker Highway uh it is consistent with the stone bridge Villas located to the South which are also zoned R3 uh and the request uh will uh increase public infrastructure demands however there is adequate capacity we do recommend approval of ordinance 0248 Commissioners I do believe um and Eric correct me from wrong that the developer um if should this go forward is is uh requested by them look to do this as an affordable house housing uh project and pursued tax credit financing similar to the Florence Place uh multif family that is slated to have a grand opening here any day now I believe um so I would expect that we would also at some point be asked to entertain a request for a local match towards that effort similar as we did with Florence Place so just kind of put that out there two questions um I assume I I hope that that's what we were going to hear about blue sky since it's the same developer but there's no way we can tie that to this approval that we're going to make that this actually is Workforce housing or affordable housing they they are separate requests the zoning request is you know not you can't tie it to a specific use whatever uses are allowable in that zoning District um multif family is an allowable use uh we establish the maximum densities um it is the zoning that they would need to pursue their project um and respond appropriately to the uh anticipated request for proposals from Florida housing for funding how are they going to get into this place where's their insance going to be likely it'll be off wrecker um they do have a small access area along 21st Street but I would Envision um subject to uh County permitting a right turn lane um on wrecker going into the into the property right in right out or the yet to be determined huh yet yet to be determined through County permitting okay anyone else 12 B Eric you want to go ahead and take 12 B2 since it deals with Planning and Development which one is this senary sewer Amendment to the conf plan yes sir um during the 23 legislator legislative session there was a house bill um House Bill 1379 um that required um local governments to adopt within their comprehensive plans um how they are addressing septic systems within their local municipalities um these items are required to be adopted by July 1st 2024 um in that bill we're required to do an analysis uh Winter Haven was a little bit ahead of the game we actually did our analysis in 2021 prior to adoption um of the bill so we were able to utilize our septic to Sewer Master Plan that was done by Wright Pierce um to satisfy that need within uh the legislative um documents and uh the city's um comprehensive plan uh will adopt a changes to their sanitary SE sewer sub element those changes are in a red line and strikeout version um in your fact sheet uh the major modifications include include adding a second goal uh addressing on-site septic systems specifically requiring any residential commercial industrial or institutional use located immediately adjacent or within 200 ft of a sanitary sewer pressure or vacuum line to connect to sewer um right now the the requirement is that um to connect they would require be required to connect to gravity line only uh within 200 fet of a property so this would include sewer pressure lines or vacuum lines um it would highly restrict the use of new and replacement septic systems it would require any new septic system uh when necessary to be set back a minimum of of 150 ft from any Lake high water Mark um and to be designed in a manner to facilitate connection to sanitary sewer upon availability uh adding appropriate maps and adding policies to support planning for capital projects um there's no direct Financial impact uh with this request the Planning Commission did hear this and recommend approval on April 2nd there were no public comments um I would add that planning staff did work with our utility staff to ensure um that what was going into the comprehensive plan would would meet not only meet legislative um requirements um but was in the direction that the our utility staff um envisioned within our Master planning efforts done by wri Pierce for septic systems within the city any questions I just uh we hit with with that right Pierce we had talked about some uh septic to se projects we did um bgy bottom and so then the next one was supposed to have been out by the airport or by Lake harridge if I'm not mistaken Gary is that correct I think like section 2A or something I forget with that 6A which is like um Due West of Home Depot kind of that area of of lake harridge and we're trying to pursue State Grant funds to help offset some of that as well yes we do have some Heartland money that's already dedicated to that project okay that's going to be a you know the the nice thing about bogy was that the um the majority of the infrastructure was there and it was just a matter of tying in in these other areas the infrastructure doesn't exist to that extent so the costs are significantly higher it's you know not just about tying in and uh decommissioning septic tanks but getting the actual gravity Mains and force Mains and whatnot into those systems so you can Envision you know gravity sewers are typically fairly deep so basically you go into install gravity sewer you're going to be tearing up the road if you have old water lines you may as well replace those so you're not coming back in at a later date so they they tend to be very expensive projects so are we pursuing it or yes we are we we are pursuing uh that area 6A we plan to build it in phases the initial phase would be the construction of the lift station that would serve that area so did we apply for any grants yes uh we apply uh through D and through Harland each year for septic to sewer money okay we didn't get it this time no we did not get it this time I have a question yes uh Gary um I know that with r Pearson and that you uh but what kind of criteria did you use to say which one's next I mean did you use environmental did you Ed because um it was um people requested it more want to hook up um what was your criteria for so there was a number of criteria to establish priorities um distance to a water body was one of the primary um factors that was considered um the distance to the closest sewer line was another factor that was considered um I don't recall all of the the priority factors but we can get that information for you I'm just curious so right anyone else thank you Gary thank you all right 0 2424 so mayor and Commissioners this is the item I mentioned that pertains back to the roof replacement being un budgeted item as we know the estimated cost of that replacement is $292,900 uh and is our CFO had noted within the fact sheet that we've had some rather robust earn interest earnings uh and so this is a budget amendment to recognize those additional Revenue earnings uh as projected to offset the cost of the roof replacement so this will go through uh two readings is a budget amendment okay all right then there's just second commission meeting in May what's that about so um you have a holiday in May that also coincides with a city commission meeting Memorial Day falls on May 27th which would be a normal City commission meeting and if I'm not mistaken City attorney can correct me per per our Charter when that happens the meeting just naturally falls to the following Tuesday so I just want to make an awareness of that I don't believe there's any action that's requ IR ired by the commission to make that change since it's already outlined but just we will make sure all of our first readings in in at the first meeting in May reflect the correct date for the second meeting in May which will be May 28th it'll be May 28th will be the actual date all right can I ask a question real quick I believe if I'm not mistaken May 22nd is the Winter Haven High School graduation I don't know what's that I I I don't know if that's pretty sure 99% so I wasn't sure if we wanted to continue with the agenda review on the 22nd if that is truly the case which I'm 99% sure it is while we're talking about the May 27th meeting it's hard to do both so that's why I mentioned it nor normally we we attend the Winter Haven High School graduation so what time is the graduation do you know 6 6:30 Lake there no way we can do both okay unless we have our general review like four or something gotcha gotcha okay have it earlier in the day graduation is 5 so if the commission you know by consensus is agreeable not to having a workshop that evening we just wouldn't have a workshop but I that's I'll leave that to the commission to give we have the workshop youall have to go to the graduation right is that like that road wow father has spoken going to be taking a rooll so what's the pleasure you can have an hour with me I will say you don't have to have a quorum for a workshop either so you're not taking any action at it but well see I'm supposed to give a take message so to the graduates I I think it's easiest just to forego the 22nd the agenda review meeting that night personally all right I I'll go along but like I said I'm taking a rooll you're looking at me just I'm looking both ways okay so is that consensus that we will foro the uh agenda review yeah that's fine all right okay this done okay last thing I have for you this evening just give you a quick update um Grant Nate applications have closed um Katrina they have copies of the spreadsheets Katrina's going to give you copies of the spreadsheets to let you know what we received this year this is still being audited so keep that in mind um this is just what was received it uh some of these may be weeded out if they didn't provide the detail or completeness as we require we have how to compare to last year well I'm I'm going to give you that so um we know it's more in terms of um app appliations received this year we had 51 applications received last year we had 53 so on par but but down to so that's that's uh uh not not too big of a drop there are 19 firsttime applications there are 24 uh returning two of those were not funded this current year and they they show up those are the ones you see in red in the green section those actually need to be moved down into the blue section because they weren't funded in the current year um as I said this list is UN audited applications as of today um we did receive five requests for single large scale initiatives which you see at the very top uh we have not been able to fund large scale applications because of the number of sheer applications we receive and um we will discuss that again with the grant Aid team this year with the this many applications it's going to be hard press to fund out large applications and still have a significant impact with all the other uh applicants that we received the um committee will meet the grant a committee's first meeting is on May 9th it begins at 9:00 a.m. here in this uh in this chamber members of that committee include Tina Summerland Alex Santiago Abdul Alti Steve Negley and Melinda caligus who replaced uh fill the seat that was vacated by Mr Alex cam you also have on that committee uh Alan weeks Christine Samuel and Bethany Owen is Staff ex officios representing U my office and finance so they will review all of these um and give you a recommendation that we will bring back in June they have a second meeting scheduled if needed but they've been typically able to get this done in one meeting and they are a pretty efficient group um I did want to point out that last year we used as a baseline kind of direction for that committee the P County um the portion of the uni of the United Way community needs assessment you may recall this document it was it was a study that was done by givewell foundation and United Way looked at Highlands Hardy and P counties and identified where areas of specific need were and so in the case of P County those tied to economic and employment opportunities housing education food security transportation and overall quality of life so our direction to the commit to the committee last year was to you know that's statistically valid information on where the greatest areas of need are within our community and recognizing where we do certain things from the city and our purview and certain things are not um that was a good Focus point for them on where to to invest their energies of you know where where can we deal with uh either housing support economic support Workforce skills those types of things uh education programs for both Youth and adults programs that enhance overhaul Quality of Life Food insecurity I think I mentioned um so that's uh that's kind of the the initial direction we give them I want to make sure the commission is still comfortable with us using this United Way kind of inventory um I think it is still very relevant still very accurate to what needs are within our community I'm good thanks great you said they're going to meet next month they meet uh the committee will meet May 9th oh May 9th okay yep and that is here in uh in this room well please express our gratitude to that committee for doing what they do they are they're good group that is I think um you know a group that meets really just twice a year I think we bring them in we'll we'll do it again uh to get some feedback from them and uh make any adjustments to the process and present that to the commission each fall but um Melinda caligus is the new one on that team Katrina Hill has done an orientation with Miss caligus and brought her up to speed so I think they're they're ready to get rolling they do an outstanding job for this commission you all chose extremely well in those uh those Representatives so I'm just looking real quick we had a lot of organizations that didn't reapply and am I reading this wrong it didn't reapply did not reapply Katrina can you speak to that I'm on you're not reading it wrong um down in the white for the bottom that's everybody that was funded in historic or in previous years going all the way back to 2020 2021 keep that there just for your reference and for the committee's reference but they were all notified multiple times and in multiple ways um there were 11 agencies that were funded in this past year that did not reapply correct those are the ones in the blue so if you look in the in the white column beginning with Abiding Savior Lutheran Church of Winter Haven okay um in the column listed 2023-24 yeah that shows what those entities were awarded this past year or this current year that we're in and they um so they actually got that money is a uh commitment and but did not reapply in the coming year so um kind of interesting it giv an example the GCT center Inc um that's an agency that has been funded you can see over the course of four years they did not reapply this year yeah I see heart for Winter Haven they're out because we moved them somewhere else heart for Winter Haven had um that's a a good uh point to make there Mr Mayor the um we fund them as a kind of a special initiative through the commission we plug that into our budget um we will get a presentation from Hart for Winter Haven typically in June uh is a continuation of their their efforts to address housing needs within our community we met with them I'm going to guess Eric what maybe a month ago to to look at their program how they're performing actually have recommended a pilot project for them that we're excited to be able to share with you when they come back to the table that specifically Targets in I think a unique way housing for families with school AED children which we've made a priority um and so that will come back but mayor they at one point had a um a completely separate program and I think at times it may have been their uh jobs for Life Training that was we'll do that then it was it was done through this effort at one point I think that's now more so folded into their overall financial literacy package that they do as well as some of the uh other Pro programmatic efforts they have that are not necessarily funded by the city I can speak to that a little bit if you'd like for me too that the $7,500 we used to give them was for jobs for life they use that for the that part and now they've kind of folded it all into to to everything they take but that's what that was four all right Mr may I got two questions real quick before we adjourn can we go back to 12a just real quick Eric this is the Blue Sky Community thing I'm I'm struggling with two things number one I know you say we have to approve this zoning before we can get a PUD but I thought we've done plenty of these things two things at one time zoning and a PUD that's not the way it works yeah sorry a PUD is a zoning District um we typically do future land use future land use and Zoning at the same time on an annexed parcel because it would not have such designated by the city so this is already has a future land use it already has existing zoning and they are requesting to change the zoning from one to another from single family to mul and would be we don't want any of the zoning categories you have we want some that is very separate and unique and specialized that's not what they're requesting but where I'm struggling is is I look at this and I look at all the properties around it it all looks like single family to me and I would be willing to go along with it if I knew it was going to be another blue sky Community for for affordable housing and Workforce but if this just going to be regular Apartments I'm I'm struggling with that because I still feel like theoretically as I look at the maps it should all be single family homes from the from from the planning perspective um number one the future land use is consistent and allows for R3 zoning um and so that's not an issue at all that's why we're not changing the future land use we've already through our comprehensive plan identified that this area is is likely appropriate for multif family keep in mind it does back up to um the railroad tracks um and the Nature park behind that and some of the single family what what looks like single family on the aerial are actually attached they're considered multif family um those ones uh right in there yep um and that whole Corridor is kind of a mixed use Corridor with uh you know non-residential and other apartments just less than a quarter mile or so south of there um as well so from a planning perspective we've analyzed that and we believe multif family is multif family whether it's affordable or not affordable and would be appropriate on this particular piece of property mayor ride out there and look at it again but commissioner dancer there is also a new and I'm trying to see exact it doesn't show up on this map but immediately south of the uh the Stonebridge uh subdivision there's a new multif family right at the corner of Avenue O and uh in Recker Highway as well that's nice look place I I'll ride out there and look at it again but I'm just if if I knew they were going to do what they did out here I'd be all over it I'd be willing to vote for that and I would also um point out as well that the the parcel it's all one parcel but the the area of this parcel that is immediately west of the red outline right there yeah that's designated commercial okay that's not designated um single family that's designated C3 commercial so at some point that will be a commercial development oh really okay well that's fronts on the highway really and commissioner Dan I know that you will consider all the facts and all the information of course before before you before you make any kind of decision anything else would be illegal John position get that yeah but I I'm glad you're going to go out and drive thank you see you I think those are what uh three story uh be three story yeah they T they typically do a mix of uh two and three story walk up the on an affordable prodject uh they generally don't go four story because that requires an elevator and just increase its cost think okay and my last thing uh T have you got any kind of update on for the Ritz on how negotiations been going can you update us on that or is this not not a good time or I certainly I can um in fact uh just happened to be at the Ritz Theater this morning doing a interview with Bay news9 um and Tom Westbury also participated in that uh I don't know that he knew that was going to be requested of him but he was kind enough to let us into the building and uh became a a cast member I'll say um things are going well they have officially reached out to us um on behalf of the board Tom Westbury did uh saying that that is their they you know the initial request was would the city be interested City said we would entertain um such a request that and so we met a week ago I'm going to say John Murphy representing the city myself Julie Adams from your parks recreation culture Department met with um uh Tom Westbury and Kim short of the board of directors to begin negotiating a purchase and sale agreement uh we will work directly through Mr Murphy's office along with Mark Turner who is uh I believe a board member and legal counsel to the Ritz and uh trying to get that all arranged for we have solicited a um boundary survey in a phase one environmental and asbest Survey of that building to be able to make sure that that things are what they need to be and uh we are progressing I would expect um given the magnitude of of work that we have dumped upon the City attorney with everything else we do we'll probably have a purchase and sale agreement um hashed out and ready for City commission approval at one of your two meetings in May I don't know did you guys discuss price at all or uh what we're looking at is is what's aligned with the mortgage and so um one of the things that we've requested from the the from Mr Turner's office is a copy of the mortgage um as well as the deed and everything else that would would be associated with that so we can do a a title search all all those things the wi Haven did they uh have they got back with you what their intentions are what they're willing to I've talked with Dan and he has been um you know he he reaches out to me regularly where are we where are we um and uh my understanding is that they are on board with that and that we um one of the things I need to do in that regard at the same time is craft a use agreement uh not only for the Ritz but really to revise and reinstitute a solid um use agreement for theater Winter Haven at chainel Lakes complex that's something that Mr isers and others have worked on for a while we still kind of going off of very old agreements um some written some you know oral agreements that we've had over the years from the time that Norm small First Step foot in that building in 1975 so trying to get a lot of that straightened out that will help them with some of their Grant efforts um not only at state level but here locally with TDC uh as well as some licensing that will allow them to do a little bit more in terms of concessions and some of those things so I expect to uh to bring that back forward to the commission here relatively quickly very good anything else that's all I had anyone else I me mayor protm Yates did I think there was a Ritz board meeting today so I don't know if they shared anything beyond what I've shared for the the commission this evening no I I passed on that same information to them and you know they that board is uh is committed to working through you know whatever the end date May effectively be so um they still have taxes to file and all that that stuff so that that board's committed you know obviously to to keep going if this deal were to not move forward then then that board you know is is you know ready to take the next steps necessary um whatever they may be all right all right
