the United States of America and to the repic it stands one nation under God indivisible with liberty and justice for all all right um have Commissioners had a chance to review the previous minutes so we'll entertain a motion I would move that we accept the minutes of of the last meeting second all right we have a second all those in favor of approving the minutes say I I all oppos same sign all right minutes are approved I'll move into a brief explanation of how the hearing will go U cases will be read into the record and we will hear a presentation from staff Commissioners will have an opportunity to ask questions of Staff uh once Commissioners have had an opportunity to ask their questions we will close the planning portion of the hearing and open the public portion of the hearing anyone wishing to speak for or against a case starting with the applicant may do so and we ask that you limit your comments to five minutes um once everybody from the public has had an opportunity to speak we will close the public portion of the hearing and reopen the planning portion uh where Commissioners will be able to ask additional questions or we will entertain a motion and a vote um anybody in the public who thinks they may speak for or against a case if you would please stand and we'll have Jordan swear you in do you Solly swear or affirm that the testimony you're about to give in this case shall be the truth thank you Jordan all right we will move right into new business case number p- 24-22 request by Landmark Investments Inc to amend planned unit development ordinance -89 d04 General location 800 Havendale Boulevard the area covered by this request is is 13.58 plus or minus Acres um so on April 24th we received a request from Mark wilky who is an agent for the petitioner uh requesting this item to be continued so we are seeking a u motion to continue this to the June 4th Planning Commission meeting okay I will make a motion to continue this to the June 4th approval for a child care facility located in the mixed use MX zoning District General location 124 Avenue G Southeast the area covered by this request is 32 plus or minus Acres all right um before you is the zoning map as you can see the subject prop property is zoned MX as well as the properties to the north east and south and then the properties that front along First Street do have C3 uh commercial Highway zoning uh as you look at this aerial here you can see the location of the existing daycare facility um some other items in the area is to the east is a former church that is now a child care facility as well that receiv receives special use approval previously single family homes to the north um and Commercial entities to the um West and Northwest this is a view of the subject property standing on Avenue G Southeast as you look to the west to the north and to the east Menard childcare LLC is the petitioner and requests the Planning Commission Grant special approval for a child care facility in the mixed use zoning District the property subject to this request consists of 32 acres and contains a 2, 496 ft building with Associated parking which was constructed in 1981 the property has operated as a child care facility since 1994 the petitioner proposes to convert and expand the current covered outdoor space into 900 ft of additional classroom space the current Child Care Facility was established prior to the creation of the MX zoning district and the requirement for special use approval for a child care facility in the the zoning District parking is provided on site with access from Avenue G Southeast as this is considered an expansion a site plan review will be required to address code requirements this minor expansion of the facility is expected to have minimum impacts on public infrastructure based on the current operation of a child care facility on this property and the mixed use character of the surrounding area minimal impacts on the surrounding neighborhood are expected as a result of the expansion of the child care facility operation staff um recommends that the Planning Commission approve this request subject to the condition that is posted in the agenda pack and this is the um conceptual plan that was provided s for any questions you may have any questions no all right we will close the planning portion of the hearing and open the public portion of the hearing uh anybody from the public wishing to speak for or against no all right we will close the public portion and reopen the planning portion of the hearing any additional questions or I'll make a motion to approve case number P -4- 05-s request by Menard childcare LLC for special use approval for a child care facility located in the mixed use MX zoning District General location 124 Avenue G Southeast the area covered by this request is plus or minus 32 Acres as presented in the fact sheet second all right we have a second all those in favor say I I I all oppose same sign all right Cas is approved other business comments from staff okay just a couple items this evening um just an update on our April items the um Blue Sky request to the to do to make the resoning out there on recer Highway um that's moving forward the city commission this month for final action likewise the septic to sewer changes we propos to the comprehensive plan those have been sent up to the state and are currently under review by Florida Department of Commerce uh we expect those be back to the city commission probably in June so that's our past items from April that are still outstanding I do want to think ahead to our July 2nd meeting that is two days before Fourth of July holiday um if that's meeting date is going to be in issue we probably need to take action at our June meeting to uh move that date um typically what day of the week that is it's a Tuesday Tuesday I I'll be out of town that week I may be out of town as well I'll verify and let you know okay um typically we usually move to the Thursday if there's a conflict on the Tuesday but that's not necessarily an option this go around so the date would likely end up being uh July 9th going forward so just think about it and let us know and we'll need to take formal action if necessary at your next meeting okay also um just a reminder that uh Jennifer faskin did resign but is serving until replaced but we have advertised for the vacancy so if you know anyone that would qualify um lives in the city limits or owns property in the city limits that they can fill out a board and committee packet and also um those who are up for reappointment the city clerk will be sending out reappointment letters soon so once you receive this please return those we're going to take for the new appointment and any reappointments all together in on June to the city commission all right I have one thing to add there yeah um on case number p2422 uh that we are moving to the next meeting uh will we be notifying the people within 500 feet again that this action is being taken no it was notified that this for this meeting and at this meeting we took official action to continue it so we do not have to Ren notice it okay because there was um confusion about that and the letter that was sent had some information that was not correct and the people with who who are always on on the computer found what that error was and uh it really caused some confusion and uh I really think uh we need to send notification out to those people within 500 feet again so that uh we can eliminate the confusion not noted we'll we'll discuss with the with the appropriate um we'll discuss with the attorney and appropriate individuals and see if we should um notice that again I'm not aware of what the uh error in the advertisement was but we'll look at it right because uh we do not want to have confusion in and people getting angry over nothing agreed y we'll look at it any other comments from Commissioners any comments from the public no all right we're adjourned
