good evening and welcome to this meeting of the Old Kings Highway Committee of the town of Yarmouth which is being held in accordance with chapter 470 of the acts of 1973 is amended at 7:15 p.m. on Monday March 3 March 25th 2024 at the Yarmouth Town Hall hearing room located at 1146 Route 28 South Yarmouth there was a typo there it said March 31st I thought wow that's an unusual month moreover pursuant to chapter 20 of the acts of 2021 considering certain covid-19 measures this meeting is being run in hybrid mode which is to say live participation Zoom participation there might be some telephone participation as well although I've yet to see that eight new applications for certificates of appropriateness and one table certificate of appropriateness will be heard this evening in the order listed on the agenda please be reminded that our committee's main purpose is to review items for appropriateness and setting and it is the responsibility the of responsibility of the applicant to comply with the regulations of other Town boards and departments including building conservation engineering Health zoning and the sign inspector you should know that there is a 10 calendar day appeal period starting once a decision is filed with the town clerk any person aggrieved by our decision tonight can appeal to the Regional Commission of the Old Kings Highway historic district our office administrator Lisa Sherman will be happy to answer any questions you may have regarding this process with regard to process as I call the application uh the applicant Andor the applicant's representative or Representatives if present will come to the table before us speak into the microphone identify who you are and present your application without interruption from members of this committee or those in attendance after which the committee will be free to make comments and ask questions and after that members of the public are free to ask comments and make questions and if you're present for that purpose you will step up to the podium to my front left and speak into the microphone identify who you are uh what your interest in the application is and make your comments and ask your questions so having said all of that the first application tonight is 24- a026 is to install 19 solar panels on the rear roof at 4 3 Arrowhead Drive Richard uh buckel or Buckle is the owner and freedom forever LLC is the agent and who do we have here tonight I think we have freedom for every it's like we have Kathy for Freedom 0 Kate Katie Katie Katie yes okay could you present the application to for us Katie yes so this um is actually we are revisiting this from January um originally they were for panels on the front of the roof for 43 Arrowhead Drive but we moved them to the back roof it's going to be 19 panels none are going to be facing the road um they are black on black um and the system size is 7315 and the total um array area is 390 Square ft and like I said nothing will be facing the road okay that is Katie yes all right so any questions or comments from the Committee hearing none are there any questions or comments from uh members of the public of Butters or anyone interested in this application I'm wondering why this didn't come before us as as an exemption an automatic exemption but nevertheless um it came as a you sure so Katie when you came in January what was the um system size uh back then um if you hold on one second I can look for you only it's it's not really pertinent so I'm just more Curious so yeah um it was the same system size so what we did was uh some tree trimming in the back and very that was answer my question okay yep thank you oh I see there's a there's a vent pipe in the back so yeah the vent pipe and then um there were actually a lot of uh the shading but uh the homeowner agreed to take care of some of the trees from the shading so that's why we're able to move it from the back to the front no my my question about the automatic exemption had to I discovered has a vent pipe which makes it U impossible to have a contiguous uh rectangular array um any other questions or comments do I hear a motion move to approve 24- a026 second all in favor of approving this application signify by saying I I I I I and I congratulations that coming back uhhuh down with Paul this you okay good there you go the next item on the agenda is 27- a027 is to install 12 solar panels on the front roof of 52 early Red Berry Lane har harison agular is the owner in Sunrun installations as the agent and I believe I recognize the representative from Sunrun here tonight good evening Steve Kelly from Sunrun this is a uh project that we brought back and we reduce the number of panels now we have a rectangular array of 12 panels on the front of the home we have an existing system on the rear so we weren't able to add any panels there is that it that's it okay questions or comments from the committee I think I would comment you did it well we did we moved the vent pipe yeah we have the fire setbacks that we need to adhere to now so it that also limits what we're able to do yeah but you managed it very good any other questions or comments from the committee so I did not see any other solar panels in the fronts of rofes in that neighborhood but this is not is this an exempt neighborhood I don't think it is is it no yeah well it's it's with the exception of the roof color it would be an exemptible application um and uh I too am um troubled by the fact that um that I've drove all around that area and the only uh solar panels that I saw were on Skipper Lane as you're approaching uh Union Street there's an array of solar panels on the back roof we we approved that application I remember it I think that's ours yeah that was yeah that's the back roof the back roof and the house is oriented in a way that um that they're not terribly evident they are um visible but they're not terribly evident um the problem I have with these is it's right on the front of a house that's close to the street and it would change in my view it would changed the character of that neighborhood um so yes go ahead excuse me what's funny is I was thinking that the house was kind of set back in comparison to some of the homes in that neighborhood I guess I wasn't seeing that um any other comments or questions from the committee well I just I would be disappointed if we we we basically told him to go back and move the vent pipe and he that's what he did and now he's here so it' be I would be disappointed to think that he's gone to that extreme and now we're not going to improve it was it an extreme that you went to it's never easy but yeah um you know the panels are the blackon black they've got the black skirt along the front so they blend in nicely to the roof you know the roof is not a black roof but light gray yeah I think the roof is light gray so they would definitely stand out in that roof um yeah I guess blending blending in is in the eyes of the beholder it's accurate so I'm I'm curious there's a lot of panels in the rear and the house seems relatively small why do they need additional panels it's all based on their usage you know the panels on the back of 360s the ones we're proposing are 405s so they're approximately 20% more efficient than the ones on the back but we're not going to just switch those out to gain that extra usage um so we're you know held to strict standards by the utilities for what we can put on there and so he's using enough to Warrant that additional usage I don't know if he put in a mini split if he you know more energy efficient Ching Tesla yeah there you know bounds of reasons can you weigh in on in the aggregate exactly how much incre ined Energy Efficiency we're talking about compared to the what you have already I can't I was asked that question at one of the last meetings and I asked if I had access to that information and it's all what they do in corporate it's all computer driven so it's really nothing that I can get a hold of is it is it answerable it's only answerable when you do you need to know the azimeth and the pitch in order to be accurate so when we do solar installation we have calculators that run the calculations for us because there's a lot that goes into it including inverter degradation there's an awful lot of aspects that are included it's not just if a panel is a 360 kilowatt panel times however or whatt times the number of panels that doesn't that gives you a a face value but it doesn't give you the the actual electric production because there's so many other considerations but it is it isn't answerable if you if one took the time to weigh in all the variables sure the designers have to answer that question I think it would be good to have the answer um it would help me formulate my opinion to know exactly how uh much need is there relative to what they already have okay well yeah again I'm not sure that is available uh I know we're basing it off of his utility bill it's not a number that they're just pulling out of the Hat yeah no um you know and again it's got to go through utility approval before essentially what the utilities don't want is they don't want you to become a power plant station and so it's limited to I want I think it's 110% of your use usage to what you can put on the roof and so he obviously uses more than what the system in the back produces now whether that's degradation due to tree growing or or something that might not be producing what they thought it was the pitch might be a little bit off I I don't have an answer any more questions or comments ments from the committee any questions or comments from the public or Butters I um I just have one more comment I don't know that the information that you're looking for is available to me well that's my question um I have not run into this before um here or you know anywhere on any of the projects I've been involved in so you know to give you that kind of an answer I I don't know if I can you have a thought on it well I don't I I'm struggling because I'm not sure how it's relevant to to um it appearance thinking of um does he need it yes that that it is needed that's what Steve is basically answering they wouldn't do this if we didn't need it yeah we wouldn't put it on and the utility wouldn't let us do you know what the um orientation of the front roof is well we can go on Google Earth it's uh 196 so it's just a little bit off true South good as of course we couldn't put it on the front previously so all the panels were put on the rear of the home well putting it on the front hasn't really changed previously however um this particular house and the houses that are bordering White Rock and south of that um to for me it borders on you know what's exempt and what isn't now this is on the front of the house in a neighborhood houses across the street but it's it's right at that point for me that I'm I'm kind of on the fence about it and since uh you did come here before and we told you exactly what you had to do in order for us to reconsider this and you went and did it um I don't know I think that uh you carried your your balance of what you had to do so I'm is it is it a sense of this committee that we made a promise to the applicant that if he uh worked around the vent pipe that we would approve this application that make any promises relative to that I just that's what I that's why I oppose the question make any promises none taken okay all right um I I don't think I was at that meaning and if this were located in an area that further north to Route 6A i' I'd probably say forget it but relevant too you're where you are so I'm with Paula on that aspect that it's not it's a I I'm in the fence too mostly because of the roof color yeah the roof color was a dark gray and it didn't wasn't so blatantly different I would feel better about it but just that's sort of in your face that's sort of I'm on the fence I'm not saying no but I just sort of on the fence yeah I can't change that not not at this stage anyway all right well here this one how long ago were the other ones put on 22 I could look it up exact but I looking at the plans it was and what did they just figure out that what they and that's a lot on the back um well it could also have been the uh I don't want to say lessening the the changing guidance regarding panels in the Old Kings Highway District the the regional guidance um a year ago we wouldn't even have thought about bringing panels on the front of a house yeah if it was down a dirt road we wouldn't have done it so it's it's um something that there's a need and if we can fill it we will fill it yeah you know it's it is you know it's a nice neighborhood It's relatively new and uh did they consult the neighbors across the street by any chance I didn't see anything relative to any letters or I have not been in contact with the neighbors but letters went out right Lisa letters were not t you about I'm assuming it went out twice all right well I shall I just make a motion and we'll see how it flows I think we should move it the middle of the house uh rather High and um the house is very nicely hidden with a bunch of greenery um difficult to see the array that you would see on cvy Drive um I don't think you're going to see much of that because it's only 11° so that would be the one that would be more evident but I think it's up high enough and I think it's with the 11 degrees it shouldn't be a problem okay is that it that's it all right we you have received a letter of support I am the owner occupier of 60 cvy drive and have no objection to the application of to install 10 solar panels on the rear roof at of 510 North Dennis Road mine is the only property immediately abing the rear of 510 North Dennis Road my view of the roof upon which the panels are to be installed according to the application has the view depicted from right to left on the overhead photograph appearing the upper leftand corner of page six of the application I'm out of States I'm out of state this month and I received the notice of public hearing and forwarded mail I received there's some typos here I Sor sorry about that forward forwarded mail I received over the weekend the applicant and her a agent are authorized to enter this email into the record s sincerely Regina M Mullen TR 60 Cy covet drive or I guess that's Cy Drive uh nominee trust so uh questions or comments from the committee I couldn't even find the house the fence on the side that's 5 feet with straight uh top Cedar board and then go along the back with six foot top you know same um Cedar board um and then have the two you know sides that go to the Street closed off with a gate and then we have some pictures that we sent along uh of the uh so we're extending our next door neighbors already have a cedar board fence or extending that to match and then continuing to fence in the whole backyard so you're joining up to their fence yes and their fence yes there there is a six foot there's this is five this is five this five and then on the other side it'll be six okay okay and then there'll be the six foot high shower on the back uh as well that's not really any so you have good relationships with your neighbor obviously yes so are these like forunate for you pictures of what you anticipate it looking like or another that's what the uh the fence looks like for the from the all fen's website oh so I see okay thank you going say why you want to add a patio uh behind the house adjacent to the kitchen and I think you have floor plans that detail all of this and then we'd like to add a stone wall uh in front of the house um not you know a foot to 18 in high and we've given you a picture of what we hope that will look like and um that's sort of completes the project MH dry Stone laid up dry yes absolutely yeah okay any questions or comments from the committee I didn't get any plans so I'm kind of oh yeah I didn't get any plans either behind it's kind of hard to visualize that sun room is just gorgeous oh wonderful we're excited what kind of stone are you planning on using I I most likely Granite something simple you have a good good Mason who's going to lay this up for you dry that's almost a lost art these days yes yes we actually haven't selected a a Mason yet but uh we hear what you're saying it's hard it's hard to find yeah okay um but if you have recommendations let us know I will think about that great thank you honestly I have uh I have sources of not for the Masons but for people who know the Masons Wonder thank you that would be great honestly if we couldn't Lay It Up dry we probably wouldn't be as interested in doing it we just no I think it's I think that's admirable yes um can you tell us a little bit about the um is a kitchen that the the the room that you're adding to the um no it's the West screen it's a it's a the screen porch is coming off of our what we call our dining room area not the kitchen so the panels are just screened in panels so they're stationary combination um doors so we will have the we can use screens in the summertime and then we can when it gets a little bit cooler we can change those out to to to glass with those grills not the grills the um what is it called when they're lights they're lights but they're embedded you know they're not they don't just detach if that makes in real I guess they call them real lights yeah so I noticed that there is looks like an addition of a new Koopa a Koopa on top of the screen PCH and a new KOA on top of the main house we have a very excited person who draws these things um we're okay to say goodbye to the KOA we're not happy to let those go he's um it's sort of his sign want to see Koopa added to Historic house it didn't have it before we're fine with that okay thank you yes it's it's um he did this when he redw the entire house after the fire everything seems to have a Koopa on it and we have not yet install you have to replace after the fire how much did you have to rebuild after the fire the complete insides the whole interior and uh and you know had to do did you own it or we did yes we did did yeah yeah we've been there for 15 years now there's a little Diamond feature on the West Side elevation what is that is that maybe that's just shingle work I I think what that designates is there's currently a fixture there a light fixture over the the deck that's falling down frankly um and so I think that's just what he's indicating there but Our intention would be to shingle it in such a way that it would essentially disappear so just trying to picture how this is going to I'm sorry you can't hear me just trying to kind of picture how this is going to where it's going to go in the existing house so I'm looking at the rear deck you have now so walking out of that large I can't tell if it's a slider or a French door walking out of the one on the right side that Parts converting to the screen and porch and then the left part of deck is remaining or is that changing that will uh the left part which left I'm looking at from the back so the from the west side so this is the addition is going there and then this porch will that change or is that remaining the same that that will change a bit too uh it all needs to come down something new has to be put there anyways it's old uh and it what what it will be is a much smaller deck space almost an L around the outline of the house off of the sun porch and then it will it will attach to the the um Pat the Terrace so we don't have that yet right that's right we don't have the Terrace no would have the Terrace I mean and and the wraparound deck you're talking about that that existing yeah it exists now and that goes away goes away so you're proposing a metal railing on that what's the railing on there now is it wood on there existing yeah those are wood what sort of metal railing are you envisioning uh something that is black that would not be particularly visible it would be um it's mostly a safety railing because of this the height of the of the patio and it looks like you're changing underneath the deck and sunp porch to put like a stone veneer instead of the lattice it's there now that would be an improvement yes yes for many reasons things like to run under there so you are or you are not going to have a koua on this not having a KOA unless you like us to then we would personally I like it but uh but my personal taste doesn't uh doesn't apply here it's your house and your design so oh thank you you can uh as far as I'm concerned you can have it or not okay so the the on the addition the you're going to do the the Fieldstone veneer MH okay that's on the back the dimensions may be on here somewhere but is what are going to be the dimensions in the center like 15 by 15 or a little 18 by 18 which is about a um it's frankly only uh I think it's six feet beyond what the current deck is and we're mindful of setbacks Etc and we're going to have to re survey the property anyway to move forward to make sure but it we're pretty sure it fits so the deck will come out to meet the front facade of the Sunport it will be recessed back a little recessed back where the current deck is so we're not bringing it any closer to the street in that regard okay thank you so the windows will be the same size as the windows on the house itself and um same Grill pattern um but they're not but they're um not double hung they're and they're bigger no they're not they're they're longer they're longer they're longer yes there's another set of not the intention is to mimic as much you know the outside of the house of the house yeah yeah no I think oh I see the drawing the the architect's drawing shows two over two but in actuality it's 6 over six you have there now right the grid pattern uh looks like it from the picture anyway uh on on our our existing windows on the front of the house on the rear on the rear 6 over six on the front it's 6 over six those are 6 over six these are all 6 over six even though he did four over four here I think that that's just I think that's the way the architect drew it but they're actually six over six so that actually they match better I think than if they were two over two okay so any other questions or comments from the committee no I think it looks very nice any questions or comments can you see that first first cupula uh looking at the house it seems to be way in the back we there are no existing at this a third of the house is that correct at this point we don't have we don't have any CPAs don't they didn't have any at all the architect shows it shows two did you decide to do that's a carryover from the drawings he did back when we did the fire redo and I think he just kept it in there didn't pull it out that's all yeah yeah yeah evening good hi my name is Mark Clancy I'll be the contractor should you approve okay tell us about this um application uh there's currently I think three or four different types of siding on the house now and they'd like to go with a a dip shingle everywhere um I don't know what else I can tell you about it okay so I saw shingle oh I'm sorry if you're are you done you're done I saw shingles on the front facade and clabber on the side and I didn't see the rear so you want they want to have it consistent all the way around shingles all the around right now there's stained shingles natural shingles and stained clapboard these the a graded mayic they are sell them any other questions comments from the committee so this is a very significant historic house in the town of yarmouthport um beautifully situated I looked at it with uh my then life partner in 1986 to buy actually wow it was a little over our budget um so it wasn't built in 1979 as it says in the application but um uh so what are what are the the front of the house the principal facade it's that's a shingled facade right currently yes yes it the what I think you'd call the front is natural shingles right now it faces natural shingles and on the side on the garage of the principal house not the additions in the back uh I guess it depends what you're calling the front well Turn Around the Corner side side it's it's clapboard MH and then on the other side it's stained shingles clapboard and natural shingles so just for uh to be sure what we're that we're on the same page so on the side of the front H the main house the original house as it faces M Lane yep the material is what cedar shingles cedar shingles natural okay okay uh any other questions or comments from the committee any questions or comments B BR okay so so um I'll try to keep it short and sweet I think we we talked a lot about some changes to make the last time that we were up here and we think we found like a really good middle ground try to address some of the concerns that were heard by the board at least with the grill patterns on the windows so what we selected to do obviously again you know replacing the full B Window was not really a Financial option for us so flattening out that bay window is something that we we absolutely still do want to do after discussing that the um only thing that we thought we could do to try to appease here because again we talked about doing grills on the top windows and not grills on the bottom windows or on the bottom sash of the window um it really was hard to follow that pattern of just having grills on the top portion of it without carrying it through where the bay window used to be and where the awning window that we suggested over the kitchen sink would be so what we suggested is to do two things number one is to set up meeting rails on the outer sashes of the casement the triple casement that we would want to put in at 102 so it appears like it's a double hung window even though it's still a casement you guys you guys are following that right you guys I know youall know what a mimic girl is is um and then across 101 to try to carry that same look over to that flat window that doesn't have any this would be the only window in the front of the house that we would try to extend the grills down into the bottom half of the sash that's the problem we ran into so this is kind of what we proposed was to do a a short fractional on the kitchen sink window short fractional in the center of the triple casement and then on the outer sashes to do mimic rails with Grill between glass and a 2 two pattern on the top part and we think we we really nailed it as close as we can get it to try to carry it across the whole house BL so I think I missed the meeting where this was tabled there was I think three members on the board maybe that day yeah um so can you let me know why it was tabled cuz what were you requesting before no grills so we requested no grills again we were trying to deal with the fixed income so we requested no girls new and we might not get away with it then we tried to you know basically backtrack from there and then this is the the drawing that we kind of landed on to present to you guys the last time and I think it's kind of appropo for the home and Miss BR you don't you didn't put down the age or the year the house was built do you know what year it was built 1970 thank you and then on the back one that was really the only one I had a question on because there was 109 on the back of the house it's set up as a situation where we can do one single window across it so we did a triple casement there but it's going to be next to a one 121 like physical full replacement um double Hong picture window double Hong and we were thinking maybe on that back window 109 if you guys would approve us just to leave the grills in the center window off is you see what I'm saying so it kind of matches I like that better you know it just kind of looks goofy throwing those grills across the top on that only that single window and I didn't submit it that way but just kind of so you would around we want to make that adjustment you're proposing that adjustment yeah that'd be the only adjustment I would propose on it and that's the window above the the um the garage I mean the um on the back of the house right the access to the basement and there's already been two newer windows that were installed or three newer windows that were installed at one point with the grill patterns on just the top stashes on the back of the of the any any other question any questions or comments from the committee uh my comment is that I wasn't here for that meeting but I drove around the neighborhood and there were several of the houses with no grids whatsoever even her next door neighbor so I was going to make the same observation in fact I made a list of ones that I saw yeah we have a little list too we came prepared with counter arguments 12 is a good median 12 Hill Crest 11 Embassy nine Brave Farm Road North and 32 Brave Farm Road North hey I thought I saw you I was legit I have a right to drive by your house okay and I was there was others in Hill too yeah especially with in the case of the 109 the center window without grills that that has you have company in the neighborhood in the rear is on the rear of the house planning boards uh list of um Scenic roads Scenic roads afford our our special attention um and um so I've drafted a letter and I'm prepared to hand it out to all of you for your review to see what you think of it uh provide your edits if you think it's an appropriate thing uh for me as chairman to send to Joanne Crowley who's the chair of the planning board and I'll read it into the record uh as stands now subject to your review Dear Miss Crowley we the members of yarm Old Kings Highway committee believe that the list of Scenic roads and the scenic road map on the town's website need to be updated specifically owing to their historic significance Scenic beauty or both we advocate for the addition of the following roads Thatcher Street Church Street Winter Street Center Street and Old Church Street street according the those roads Scenic Road status will enable us to give them our prioritized protection thereby aiding our committee to fulfill its mandate to preserve and protect the unique aesthetic and historic character of the historic district it is worth noting that with the exception of Route 6A all of the roads currently designated as Scenic were done so in 1973 and 1974 a half century ago Route 6A was so designated by Act of the Massachusetts General Court in 1992 updating the list and map is long overdue parenthetically we question the inclusion of Weir Road and Long's road which apparently no longer exists in the list and on the map to sum up we urge the planning board to initiate whatever action or actions it may deem necessary to realize the update as soon as as it is practicable to do so respectfully Robert Wilkins chairman of yarma L Kings Highway committee and um if you're all on board with this um I would uh advocate for us all signing it so how shocked that they weren't already on the scenic roads list those roads good job Bob it sounds great well good I'm glad you I'm glad you I may be one short take a look at the map to be honest to understand where church I know Center and I know they're all all the roads that I've um advocated are um between gingerbread and um well actually they're all they're all north of 6A Thatcher and Church of course are um church right defines the end of Thatcher Shore Road and Thatcher is uh between uh church and uh and gingerbread winter Center and old church are uh before you get to Union Street um on the west side of of Church Street and they're all north of 6A um and in my view you can all review them if you have other roads that you think deserve our uh prioritized protection that's why I'm giving this out now so that you can all evaluate to and uh and we can discuss at the next meeting or at uh whenever we feel com comfortable with the uh with the document I'd like to get it in the hands of the planning board um fairly soon um so that we can uh we can afford those those roads in particular are prioritized protection so are Mill and Warf currently listed as they are if you look on the town's website um on on the planning board page there's a link to the map and a list of uh there are I believe 11 Scenic roads that are that are designated by the planning board so you can find out what all of them are all all of them make sense with in my opinion the exception of Weir Road and this strange Longs road which I drove by it's right near where Richard lives and it's not there it does it literally does not exist Richard gorth or Richard Richard gorth yeah he dug it up when he moved in wouldn't put it FAS all right uh wouldn't put it faster would you so um there is one other item which I will um before you move off I just would say also that the letter is very good and I I commend the fact that you considered removing we Road I think that's important as well good all right um so I think I'll defer this until the next meeting is there are there any other um items to bring up under new business you said you had one more thing no I'm going to defer it till next time I changed my mind so all right um I'll understand a motion did I understand Mr chairman that you were asking this group to allow you to forward that letter as of now what I'm asking for now is for you to review it if you have any suggestions um and also there are members of the committee who are not here and uh so I will make sure that they see it as well and if there are any edit suggest I I I don't have pride of authorship um I worked on it for a couple of hours today and so and I've been thinking about it a lot prior to today but if um if you have thoughts on how to make it better or
