Mr. Feffer presented historical evidence, including a 1988 resolution, to establish the property’s longstanding non-conforming use. However, the focus shifted as residents like Schmu L. Xin voiced their grievances, with Xin providing photographic evidence of the containers and describing the disruption to his peaceful environment. Yok Herz also reported traffic challenges on White Road, offering to submit video proof.
Council members Jennifer Kuhn, Scott Sargent, Nino Borrelli, Mordechai Burnstein, and Stephen Chisholm Jr. engaged with the residents’ concerns, probing into the history of the property and recent operational changes. The council scheduled further testimonies for the April 17th meeting, emphasizing the need for a review with input from Mr. Rack and Chris Container, whose operations relate to the contentious property. Safety concerns were highlighted, particularly the stability of the containers and potential hazards to children in the absence of fencing.
In addition to the property use issue, the council deliberated SSP Enterprises’ variance request for LED fuel price signs, represented by attorney Michael Molinsky. Despite an initial hiccup with the zoning district notice, the council heard the application, which sought relief from sign area limitations. Kevin Dixon, a professional engineer and planner, testified on the necessity of the signage for motorist safety due to visibility obstructions from foliage and existing structures.
The debate on the LED signs centered on whether the benefits to public safety justified the variance, with concerns over visual clutter and precedence for future signage modifications. The council questioned the site’s uniqueness and the essential nature of the LED signs, given the presence of ground-level pricing. Ultimately, the council approved the application as a flexible C2 variance, acknowledging the site-specific challenges and the importance of motorist safety.
Other points from the meeting included the approval of resolutions for a new vice chair and board secretary, as well as a replacement recording secretary. The board also discussed implications of withdrawing site plans on previously granted variances and entered executive session to discuss attorney-client privileged matters concerning personnel.
