- Meeting Overview:
The Fort Myers Beach Town Council held a meeting that encompassed a range of discussions, with a particular focus on state funding allocations, local infrastructure developments, and community event recognitions. The council approved financial appropriations that will impact the town’s recovery and development, including an $8 million grant for a new town hall through a replacement program. Additionally, discussions on local achievements, such as ShrimpFest and pre-St. Patrick’s Day celebrations, highlighted the community’s spirit and resilience.
A notable portion of the meeting was dedicated to the presentation by former interim Town Manager Chris Holly and Representative Adam Bana on legislative sessions. They brought attention to the accomplishment of securing over $50 million in funding over two legislative sessions. This funding will aid in the town’s improvements, notably for Bayside Park, and in revenue replacement due to a considerable loss in the tax base following a hurricane. The representatives discussed the governor’s potential veto options and the legislative process of obtaining these crucial funds.
The council also discussed upcoming community involvement events, including the Great American Cleanup and a local church group’s efforts to improve public facilities. Gratitude was expressed towards the Lee County Sheriff’s Office and staff members for their hard work during the Shrimp Fest. The Murf Committee recommended further education on sea turtle lighting compliance and the municipal lighting ordinance, alerting property owners to potential sewage leaks to prevent groundwater contamination.
The flood ordinance was a topic of importance, with the Town Flood Plain Manager Kristen Shumaker explaining the necessity for amendments to comply with new flood maps and changes to substantial improvement and damage determinations. The council expressed support for these changes, which aim to elevate manufactured homes in special flood hazard areas to the base flood elevation plus one foot.
The council addressed the non-exclusive natural gas franchise agreement with People’s Gas. The External Affairs Manager, Carlo Fy, thanked the town’s staff for their efforts in renegotiating the agreement. Although the renegotiation details were not discussed in this portion of the meeting, it was later revealed that the council suggested and the gas company agreed to double the aggregate cap on damages for negligent operation to $10 million.
Public hearings for various land use requests brought forward several development projects. These included a commercial plan development rezoning for a property on Estero Boulevard, which sought deviations from Land Development Code for site design to accommodate a convenience store with gas pumps. Another discussion revolved around refuse container screening enclosures’ height for a 7-Eleven on Polaro Circle, with the LPA recommending unanimous approval. The council also approved a special exception amendment for outdoor alcohol sales and live music at a local establishment, emphasizing the desire for the establishment to be under the same regulations as other businesses once construction is completed.
Parking issues near the Whale were addressed, considering the impact on fire district access and the potential for temporary signage to mitigate illegal parking. The council discussed resolution 24-42 for the reconstruction of structures at Pink Shell Vacation Villas, which were damaged during Hurricane Irma. The approved reconstruction aims to improve ADA compliance and drainage.
Lean reduction requests were a significant topic, with multiple property owners seeking relief from fines for various code violations. The council unanimously denied a 100% lean reduction for a property on Street and a 96% reduction in a $112,751 fine for short-term rental infractions. They also suggested that a property owner with a $365,575 fine for unpermitted work after a fire should come into compliance before applying for a reduction.
