The board’s deliberations on these cases included a motion to dismiss one infraction that failed, leading to the affirmation of the violation and the associated fine.
The meeting also addressed several requests for fine reductions related to other code violations. For one property with various infractions, the board compromised on a fine of $350 for both violations, considering the staff time involved in handling the case. Notably, a property owner on Northeast 111th Street, Brett Anthony Frey, was the focus of serious concern due to the property’s severe state of disrepair, including a caved-in roof, and a lack of response from the owner despite several communication attempts by the village. The board moved to issue an intent to lien for the three related cases.
The board granted extensions and continuances for several properties to come into compliance by pulling permits, with deadlines set and the possibility of fines for non-compliance. A property on Northeast 121st Street received a positive response from the board to the owner’s readiness to comply with permit requirements. The board also granted a 90-day extension for a property owner to remedy a non-compliance issue with the Village Park Association.
A property on Northeast 119th Street was granted a 90-day extension to go through planning and design review, emphasizing the need for a specific compliance deadline. For a driveway violation at 10921 Northeast 10th Avenue, the board noted the absence of permits and unsuccessful attempts to contact the property owners.
The board also dealt with a safety-related violation concerning a swimming pool fence that was below the required height, emphasizing the need for clear communication between the board and the property owner for timely compliance.
