- Meeting Overview:
In the recent Biscayne Park Code Compliance Board meeting, multiple property owners faced fines and deadlines for various code violations. The board discussed these cases with a focus on driveway and fence violations, extension requests, and the importance of timely permit acquisition.
One significant case involved a property owner who had been in violation of the driveway ordinance for two years. The owner, dealing with personal loss, was fined $250 and given until June 5th to comply or face a $50 daily fine. Meanwhile, another owner involved in a street parking violation for an unpermitted driveway was granted a 90-day extension to finalize their permit.
The case on Northeast 121st Street featured an unpermitted driveway used for street parking. Despite the owner’s permit application and request for a 60-day completion period, the board extended this to 90 days after discovering the permit had already been pulled, with further review set for the June 5th meeting.
At 12010 Northeast 11th Place, the new property owner’s plans to demolish and rebuild led to a continuance until July 17th to return with permits. Similarly, the property under contract at 10006 Northeast 118 Street received a 90-day continuance to facilitate its sale.
A non-compliant fence on Northeast 113th Street resulted in the board giving the owner until June 30th to comply. The property owner at 11460 Northeast 10th Avenue, deployed to Peru, provided documentation and was granted an extension for compliance upon their return.
Property owners articulated challenges such as finding contractors and navigating the permitting process. One expressed frustration after being directed to apply online despite completing all forms at the building department. The board agreed to halt daily fines once the permit process was finalized.
The board also dealt with short-term rental issues, discussing the need for clearer reporting procedures. A fact sheet on reporting short-term rental issues and clarification on noise violation reporting was requested.
A property owner seeking a driveway permit highlighted the lack of received notifications and questioned the fairness of fines, prompting the board to advise on updating addresses with the property appraiser’s office for future correspondence.
