Yarmouth Zoning Board Approves Special Permits and Variances

The project also involved variances related to driveway width, buffer requirements, and rear setback.
The Greenbird Landscaping Inc. proposal plans for a contractor’s yard, including a stormwater management system, on-site septic, and utilities. The company’s attorney provided an overview, emphasizing how the new site would support off-site services such as landscape maintenance and snow plowing. The plan included a 16-foot driveway flanked by 1-foot stone edging and 14 parking spaces, meeting zoning requirements. A landscaping plan promised low-growing plants to maintain the visual access to water, a condition specifically included in the approval to address community concerns about preserving the area’s aesthetic.
The proposed commercial building on Corporation Road for Greenbird Landscaping prompted discussions about the visual impact on neighboring properties and the preservation of views. The board, after deliberation, approved the special permit with the condition to maintain the open views, and the variance relief.
Another decision involved a petition from the town of Yarmouth seeking a special permit for municipal recreation use in a B2 zoning district. The redevelopment project aimed to transform the site into a park with improved access to the water, natural species plantings, and views along Route 28. The board discussed the concept of “undevelopment” and the need to maintain views post-development, with the violation notice for the property in effect and needing resolution with the building department.
The meeting also addressed a petition from Jamie and Neil Bolan regarding office space rental in a residential district. After discussions on space usage and parking availability, the board leaned towards granting a variance, recognizing the proposal’s merit and the public’s favorable view. The board approved the variance for office use, with emphasis on the less intensive use compared to the previous retail space.
Conversely, a petition for an accessory apartment met challenges due to insufficient square footage and parking, leading to the petitioner’s request to withdraw without prejudice, granted by the board. This allowed the petitioner to readdress the proposal’s deficiencies and resubmit at a later date.
The Cory Kitowskis’ request for a special permit to build a covered porch on a non-conforming dwelling was granted as well.
