One notable topics was the substantial fine reductions approved by the council. In a notable case, the fines for Discovery Hope Sound investors LLC were reduced from $156,400 to just $156.40. Similarly, a property on Southeast Fairmont Street in Stuart, Florida, saw its outstanding fine of $421,000 plus costs, slashed to $2,500 following a change in ownership. The estate of Katherine Heasley also benefitted from a reduction, with one fine being cut from $71,400 plus costs to $227,200, which was 10% of the assessed property value, and another from $36,500 plus costs to $3,727. Additionally, a property on Southwest Bimini Terrace in Stuart had its fine of $586,500 plus costs reduced to $58,619.75, and another property on Southeast Paradise Place in Stuart saw a reduction from $14,400 to $1,440.
For instance, in a fine reduction case, the respondent had paid a portion of the outstanding fines and requested a reduction. The code enforcement coordinator testified about the details of the case and the proposed reduction, and the respondent was given the opportunity to speak. The council, after considering the evidence, decided to reduce the fines.
Beyond fine reductions, the meeting also tackled a series of property violations that brought to light various compliance issues within the community. In one case involving a property on Southwest Brier Brook Way Palm City, Florida, the property was cited for being overgrown and in violation of the county code. Despite the respondent’s absence and objections regarding evidence, the magistrate ruled in favor of the county, ordering compliance and outlining potential fines for continued violations.
Another case highlighted the installation of split AC units without a permit. The property owner had not corrected the violation despite being given the opportunity to do so, leading to an order of compliance by a specified date with potential fines. The council accepted all the County’s exhibits and found that a violation existed, imposing fines for non-compliance and reimbursement of investigation costs.
Noteworthy violations were cited on Southeast Miles Grant Terrace, where Allison M. Wiggley was ordered to rectify an expired AC permit, and at a property owned by Michael Richman, cited for trash nuisance, weeds, outdoor appliances, roofs, and drainage issues. Both respondents were ordered to comply by a specific date, with daily fines for non-compliance and costs of investigation to be reimbursed.
Further cases of non-compliance included Elizabeth Darbores and Diane Bores, who faced orders to correct violations related to trash, broken windows, and lack of power. William Pratt was found to have constructed a structure without a permit, and Matthew Higgins faced orders for an expired permit for a swimming pool; all were threatened with fines for non-compliance.
The meeting also dealt with cases of lean reductions, where property owners like Greg Lions and Groves 14 LLC offered to pay certain amounts to resolve outstanding fines.
In addition to these specific cases, the council approved the minutes for the March 20th hearing and set the date for the next hearing on June 19th, maintaining the regular schedule of governance and ensuring ongoing oversight of property-related concerns.
