- Meeting Overview:
The Yarmouth Conservation Commission has issued a new enforcement order to address unpermitted vegetation removal and the presence of unauthorized structures within a wetland buffer zone. At the gathering on May 16th, 2024, the Commission engaged in a multi-faceted debate over the ecological integrity of the wetlands and the adherence to local environmental regulations.
Central to the discussions was the case of a Dayton Road property where unpermitted alterations—including a gravel driveway, a chicken coop, and a patio—had been constructed within the buffer zone to a bordering wetland. The Commission deliberated on the appropriate course of action, given the disturbance to the area and the confusion over land ownership where the structures were erected. The resolution involved the removal of the patio and the submission of an after-the-fact request for determination of applicability for the driveway and chicken coop.
The Commission also examined the implications of a water resource recovery facility project, with comprehensive presentations on groundwater and surface water monitoring plans. The depth of the discussion extended to the technical aspects of effluent discharge, its travel time through the groundwater, and the potential impact on plant species. The identification of indicator species for monitoring, the establishment of monitoring plots, and the reporting and review processes underscored the Commission’s rigorous approach to environmental oversight.
Another enforcement matter involved a project for emergency sandbag reinforcement and sediment replenishment at Great Island Road, driven by the need to address erosion issues. The Commission considered the benefits of sediment addition and the dynamics of erosion in the area, including the role of groins and the frequency of sediment additions.
The Commission also revisited the Fiber Roll Project from 2008, focusing on the removal of remnants from the site and the source of sediment for beach nourishment. There was a discussion on the environmental considerations of beach nourishment and its impact on wildlife, particularly birds, with a note to incorporate feedback from relevant authorities into project plans.
In a different vein, the meeting addressed a project pending comment from the Natural Heritage & Endangered Species Program (NHSP). Due to the absence of this input, the Commission opted to continue the hearing until the next meeting on June 6th. The Commission also approved a notice of intent involving the replacement of a stairway, pier, and boat house piles at a property, including special conditions such as the seasonal removal of a float.
The discussions throughout the meeting emphasized the Commission’s role in ensuring compliance with regulations and the environmental integrity of the wetlands.
The Commission’s agenda also touched on financial matters, with a request for $25,000 from the conservation fund for the Chase Brook Park restoration and pedestrian bridge project, which is part of a larger budget of $1.2 million. This sparked a debate on the history and future funding of the conservation fund.
